Heard before the Agrarian Court of the First Judicial Circuit of the Atlantic Zone. * Judge González Mora drafts the decision, and * WHEREAS: * * * * * * * * * * I.- The Special Judicial Attorney-in-Fact for codefendant Banco Popular y de Desarrollo Comunal timely raises the objection of lack of subject-matter jurisdiction (excepción de incompetencia en razón de la materia). He argues, in summary, that the Bank is a non-state public institution governed by the rules of public law, and that the Contentious-Administrative Court therefore has jurisdiction to hear this proceeding, given the special ancillary jurisdiction (fuero de atracción especial) established in Article 2, subsections E and F, of the Contentious-Administrative Procedural Code, which provides that said jurisdiction hears: E) conduct or relationships governed by public law, even when arising from private persons or when such persons are parties thereto.

  • F)Any other matters expressly assigned to it by law. He adds that, given the claim seeking annulment of the registry entry (inscripción registral)* for the property owned by the Bank, that claim must be heard by the Contentious-Administrative Court (filing at folios 58 to 61). * * * * * * * * * * II.- Regarding the jurisdiction of the agrarian courts (jurisdicción agraria) in proceedings involving claims that are specifically agrarian in nature, * in which state entities participate, this Court has favored keeping such proceedings within the Agrarian Jurisdiction, because they fall within its specialized jurisdiction. “II. Before ruling on jurisdiction in this specific case, it is important to mention the judicial precedents that have existed concerning the conflict between agrarian and contentious-administrative matters. The Court, in Voto N° 91 de las 10 horas del 15 de febrero de 1994, reiterated in N° 102 de las 9:50 horas del 10 de marzo de 1999, stated as follows: “VI.- For some time, our case law has been defining the contours of agrarian matters.

The fundamental consideration that has prevailed for this purpose is the criterion of agricultural activity (actividad agraria), which is the lowest common denominator of the institutions of Agrarian Law (Derecho Agrario). Nevertheless, certain aspects have yet to be clearly defined, one of which concerns precisely those cases or proceedings in which a public entity of the State is a party (such as the Instituto de Desarrollo Agrario) and matters related to agrarian legislation, or to one of the institutions of our discipline, are in dispute; the problem arises not so much when the State’s property regime is at issue (through civil proceedings involving the public treasury (vía civil de hacienda)), but primarily * * when the annulment of acts or provisions of the Public Administration is sought. Initially, the First Chamber of the Supreme Court of Justice held, in judgments N° 117 de las quince horas del seis de setiembre de mil novecientos ochenta y cinco and N° 175 de las dieciséis horas cuarenta y cinco minutos del tres de diciembre de mil novecientos ochenta y seis, that the Contentious-Administrative Jurisdiction had jurisdiction to hear and decide matters brought against the Instituto de Desarrollo Agrario.

Subsequently, in decisions N° 114 de las quince horas treinta minutos del diez de junio de mil novecientos ochenta y ocho and N° 149 de las quince horas cincuenta y cinco minutos del trece de julio de mil novecientos ochenta y ocho, it was held that such matters had to be heard within the Agrarian Jurisdiction, stating as follows: “Indeed, the jurisdiction of the Agrarian Jurisdiction may not be extended or waived and must be exercised by courts specializing in the subject matter, irrespective of the parties appearing in the proceedings, pursuant to Articles 5 and 15 of the Law under discussion. Consequently, in determining which court has jurisdiction to hear a matter, whether the Administration is the plaintiff or defendant is of secondary importance, because the proceedings must always be governed by the principles applicable to agrarian proceedings (proceso agrario), such as orality, directness, or direct examination of evidence, which provide the basis for Article 48 thereof.

Thus, the mere fact that an administrative act is challenged or its annulment is sought does not mean that the matter must be brought before the Contentious-Administrative Jurisdiction, because the agrarian subject matter, rather than the public status of the entity, is predominant. Accordingly, if the case is among those contemplated in Articles 1 and 2 of the Jurisdictional Law and the doctrine underlying it, jurisdiction to hear it lies with the Agrarian Courts.” (emphasis* not in the original). However, none of the foregoing decisions made a clear distinction between contentious proceedings properly belonging to civil proceedings involving the public treasury and full-jurisdiction contentious proceedings (procesos Contenciosos de Plena Jurisdicción), or proceedings for the annulment of acts issued by the Public Administration. In judgment N° 183 de las quince horas cinco minutos del treinta y uno de octubre de mil novecientos noventa, the First Chamber established, for the first time, a distinction between those types of proceedings.

Regarding full-jurisdiction “AGRARIAN” contentious proceedings (proceso Contencioso “AGRARIO” de Plena Jurisdicción), it stated as follows: “I.- Agrarian contentious proceedings (contencioso agrario) are proceedings established by the Ley Reguladora de la Jurisdicción Contencioso Administrativa, N° 3667 del 6 de setiembre de 1968, jurisdiction over which lies with the Agrarian Jurisdiction when the disputed subject matter falls within Agrarian Law. Specifically, this applies when the matter concerns the application of agrarian legislation currently in force, arises from the various activities carried out by an agricultural enterprise (empresa agraria) (the primary activity of production and the related activities of processing, industrialization, or marketing of agricultural products), or involves disputes concerning agrarian contracts, ownership, possession, or any of the legal institutions of the discipline.

These are proceedings that do not lose the nature originally assigned to them, but whose adjudication was entrusted by the legislature to the Agrarian Judge because of the specialized nature of the rules to be applied and interpreted. This is provided for in Article 79 of the Ley de Jurisdicción Agraria. Logically, because it dates from mil novecientos ochenta y dos, this Law postdates the Contentious-Administrative Law. In this regard, irrespective of the participation of a public entity in the proceedings, the specialized nature of agrarian matters draws contentious-administrative matters into its jurisdiction—as has also occurred with matters previously heard as civil, commercial, criminal, and other matters, with the sole exception provided for by law, namely labor matters—because the fact that an entity is administrative in nature * does not mean that it is solely and exclusively subject to that jurisdiction, just as occurs in areas where the State is a party before other specialized jurisdictions, such as labor or traffic matters.

Agrarian contentious proceedings have solid legal roots in both laws, with the established procedure being applicable but necessarily adapted to the principles specific to Agrarian Procedural Law (Derecho Procesal Agrario), such as oral proceedings, which allow evidentiary proceedings to be conducted promptly and swiftly and enable the inherent principles of directness and concentration to operate more efficiently. In these proceedings, moreover, the Judge must assume a more active role by advancing the case without having to await a party’s application; the Judge may order the production of evidence deemed important to bringing the proceedings closer to the actual, rather than merely formal, truth; the rules are interpreted broadly, without strict adherence to the rules of ordinary law; and it is also important that agrarian contentious proceedings incorporate the principle of free access to justice, in the dual sense that no payment is required for any judicial act and no security for costs is required.

That criterion was reiterated in judgments N° 81 de las trece horas del treinta y uno de mayo de mil novecientos noventa y uno and N° 82 de las trece horas cincuenta y cinco minutos del treinta y uno de mayo de mil novecientos noventa y uno. Those decisions clarify that when the legality of acts and provisions of the Public Administration subject to Administrative Law is disputed, the procedure established by the Ley Reguladora de lo Contencioso Administrativo must be applied, together with the principles specific to agrarian procedural law. They likewise establish that: “With respect to cases heard in the Contentious-Administrative Jurisdiction that are classified as civil proceedings involving the public treasury, because they are, in substance, ordinary proceedings, and given that the Ley de Jurisdicción Agraria has provided a specific procedure for such cases, the appropriate course is to pursue ordinary agrarian proceedings (ordinario agrario) within this jurisdiction, rather than the proceedings prescribed by the Ley Reguladora de la Jurisdicción Contencioso Administrativa.” “In addition to the foregoing, agrarian contentious proceedings shall address only matters arising from acts of the Public Administration to which Administrative Law applies, unlike civil proceedings involving the public treasury, whose subject matter concerns the property regime or liability of the State and public institutions, or their Private Law aspects, even though rules of Public Law are, logically, involved.” VII.- In decision N° 148 de las quince horas del once de setiembre de mil novecientos noventa y uno, the First Chamber of the Supreme Court of Justice changed its position regarding contentious-administrative annulment proceedings (Proceso Contencioso-Administrativo de anulación), assigning jurisdiction over them to the Contentious-Administrative Jurisdiction.

In that decision, the majority held as follows: “The majority of the Chamber considers that jurisdiction to hear these ordinary contentious-administrative proceedings lies with the Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda, where they were filed and have remained pending, because they constitute full-jurisdiction contentious-administrative proceedings, in which a declaration is sought: ‘on the basis of the Ley Reguladora de la Jurisdicción Contenciosa Administrativa...,’ among other things, that: decrees numbers 16306-G and 16307-G del dieciséis de mayo de mil novecientos ochenta y cinco are null and void because they incorporated into the Reserva Indígena de Talamanca* new areas of privately owned land without establishing the corresponding compensation; and that, because the aforementioned Decrees are null and void, Decreto N° 16323-G del veinte de diciembre de mil novecientos ochenta y cinco, which ordered the repeal of Decreto N°* 16410-G del seis de junio de mil novecientos ochenta y cinco (which had ordered the expropriation of certain lands for the Reserva Indígena), lacks a legal basis and must also be annulled.

In addition to the aforementioned annulments, a declaration is also sought that the State and the Comisión Nacional de Asuntos Indígenas compensate the plaintiff for the value of the land and timber, interest, and damages; it is later stated: ‘V.- If we analyze the response to the complaint, we will also note that the arguments advanced in opposition to the claim fall within the field of Administrative Law. Certainly, matters concerning the invalidity of the challenged decrees or their lawfulness, as well as the public interest manifested through the State’s actions in establishing the Reservas Indígenas and embodied in administrative laws and administrative decrees, and matters concerning potential expropriations, are matters of concern to Public Law and, specifically, Administrative Law. There is only an indirect relationship with Agrarian Law insofar as the plaintiff corporation is an allegedly agroforestry enterprise, but that does not prevent its interests concerning the invalidity of the challenged Executive Decrees and * the alleged liability of the defendant public entities from having to be resolved in the appropriate forum, namely contentious-administrative proceedings.’” On this occasion, the minority dissenting opinion of the President of the Chamber, Lic. Edgar Cervantes, maintained the criterion or guidelines of the case law identified in the preceding whereas clause (considerando).

Other subsequent decisions have sought to maintain this new criterion. Thus, judgment No. 202 de las catorce horas quince minutos del once de diciembre de mil novecientos noventa y uno stated as follows: “In the case at bar, the claims of the Instituto (IDA) do not seek the annulment of any administrative act, but rather the annulment of the transfers made between the defendants after the expropriation and cancellation of several properties. In cases such as this one, this Chamber has repeatedly ruled that agrarian jurisdiction and competence may not be extended or waived, that they must be exercised by courts specializing in the subject matter, and that the participation of the State or a public institution as a party does not preclude this. And in decision No.

87 at thirteen hours twenty minutes on treinta de junio de mil novecientos noventa y dos, the following was stated: “Through these proceedings, among other things, the plaintiff seeks a declaration that an administrative act issued by the Instituto de Desarrollo Agrario is null and void; that act ordered him to vacate a strip of land [Dirección1] hundredths (sic) wide by [Dirección2] forty meters long, located along one of the boundaries of a lot that he possesses in Cariari de Guápiles, Limón, on which there is a dwelling and a commercial building. The dispute concerns a small strip of land on which, moreover, no agricultural activity is conducted; consequently, this is not an agricultural matter, but rather an administrative-litigation matter, since it involves a challenge to an administrative act. Accordingly, it is appropriate to declare that jurisdiction over this matter lies with the Juzgado Cuarto de lo Contencioso Administrativo y Civil de Hacienda.” VIII.—As we can see, conflicting theories have arisen within the Sala Primera de la Corte itself, which is ultimately responsible for resolving these jurisdictional disputes (conflictos de competencia).

This has prompted a nationwide debate (See the Case Comments by Cesar Hines C. in Revista Ivstitia* N° 64, page 12, and by Álvaro Meza Lázarus in Revista Ivstitia* N° 68, page 18). Dr Rafael González Ballar, commenting on the judgment concerning agricultural administrative litigation (contencioso agrario), states as follows: “Several important observations may be drawn from the foregoing: a-) first, a hybrid subtype of proceeding known as ‘agricultural administrative litigation’ is clearly defined; b-) it is derived from the Ley Reguladora de la Jurisdicción Contencioso Administrativa (which is number 3667 of 12 de marzo de 1966, and not as erroneously indicated); c-) it then takes on the nature inherent in the law from which it ostensibly originated (‘it is a proceeding established in the Ley Reguladora de la Jurisdicción Contencioso Administrativa... which does not lose the nature in which it was conceived...,’ the judgment states); ch) it must be governed by the principles and rules of agricultural procedural law (derecho procesal Agrario).

It is therefore d) within the jurisdiction of the agricultural courts (jurisdicción agraria), fundamentally because of e-) the specialized nature of the rules applied and interpreted therein. This applies, of course, f-) when the subject matter in dispute falls within Agricultural Law. Thus, g-) it is irrelevant whether a public entity participates in the ‘case’ as a party to the proceedings... From the foregoing enumeration, it must be made clear that our Ley Reguladora de la Jurisdicción Contencioso Administrativa neither expressly nor implicitly establishes a special procedure such as the one described. With the exception of the special judicial procedures established for tax matters, the removal of directors, and preparatory and final acts in administrative contracting (art. 82, 87 and 89), the procedure set forth therein is single, unequivocal, and unalloyed. Accordingly, it cannot be asserted, as the judgment does, that the aforementioned ‘agricultural administrative-litigation’ proceeding derives from our Ley Reguladora.

That proceeding is plainly the product of the judgment itself and, in that sense, has a purely jurisprudential origin” (See GONZÁLEZ BALLAR* RAFAEL). “La integración para un proceso Contencioso administrativo Agrario.” In Derecho Agrario Costarricense, edited by [Nombre13], 1992, pp. 346-347. In our country, unlike the Venezuelan Agricultural Jurisdiction, annulment proceedings in administrative litigation (proceso Contencioso de anulación) are not expressly contemplated as part of the Agricultural Cooperative. Indeed, in Venezuela, the Organic Law on Agricultural Courts and Procedures (Ley Orgánica de Tribunales y Procedimientos Agrarios) makes a clear distinction between Agricultural Administrative Litigation under full jurisdiction (Proceso Contencioso-Agrario en plena jurisdicción) and Agricultural Annulment Litigation (Contencioso Agrario de Anulación). Regarding the former, legal scholarship states as follows: “If disputes between agricultural producers and agricultural administrative bodies constitute autonomous actions distinct from other agricultural actions, thereby justifying reference to the category of agricultural administrative litigation under full jurisdiction, the fact that special rules constituting privileges for such bodies apply in the procedure through which those claims are pursued also supports the proposition that this category exists within agricultural matters.

Indeed, given their nature as genuine claims or forms of relief sought, the applicable procedure is the ordinary agricultural procedure, which is the labor procedure, unless the Ley Orgánica de Tribunales y Procedimientos Agrarios or other special laws establish special procedures for adjudicating the action....” Regarding the latter, legal scholarship states: “...pursuant to article 2 of the Ley Orgánica de Tribunales y Procedimientos Agrarios, agricultural matters also encompass actions for annulment of administrative acts issued by agricultural administrative bodies....” The Juzgado Superior Agrario de Caracas thus acquires the status of a Special Administrative Litigation Court.... Jurisdiction over this special administrative litigation is assigned at first instance to the Juzgado Superior Agrario headquartered in Caracas and, at second instance, to the Corte Primera de lo Contencioso Administrativo, pursuant to article 28 of the Ley Orgánica de Tribunales y Procedimientos Agrarios.

In the processing and adjudication of such cases, the aforementioned Court must apply, depending on whether the actions seek annulment of acts having general or individual effects, the procedure prescribed for such actions in Sections Two, Three, and Four of Chapter II, Title V of the Organic Law of the Supreme Court of Justice (Ley Orgánica de la Corte Suprema de Justicia). In such cases, the Juzgado Superior Agrario may also exercise the authority and powers conferred upon it by the Ley Orgánica de Tribunales y Procedimientos Agrarios in all agricultural proceedings, namely those provided for in the articles...” (See DUQUE CORREDOR ROMAN) Derecho Procesal Agrario. Ed. Jurídica Venezolana, Caracas 1986, pp. 304, 309 and 311). (The underlining does not appear in the original.) Thus, in the Venezuelan Agricultural Jurisdiction as well, this takes the form of a hybrid proceeding in which the already prescribed procedure must be followed, while the principles specific to agricultural proceedings may also be applied.— IX.—As stated in the first recital (considerando primero), the ordinary action seeks the recovery of damages arising from investments in cacao cultivation that failed because the seed was not of good quality; the banking entities sued herein, which form part of the Sistema Bancario Nacional, and other State institutions participated as creditors in financing those activities.

This is unquestionably * a civil proceeding involving the Public Treasury (proceso civil de hacienda), which must be conducted pursuant to articles 38 et seq. of the Ley de Jurisdicción Agraria. The situation would be different if the nullity of administrative acts issued by the defendant public entities were in dispute, in which case the matter would indeed have to be heard by the administrative-litigation courts (jurisdicción contencioso-administrativa)..´ * * * * * * * * * * III.- In other matters, the Tribunal has invoked as a jurisprudential framework the principles stated by the Sala Constitucional so that other jurisdictions may hear claims against the State: “III.- Clearly, the issue lies in whether other ‘jurisdictions,’ apart from the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), would be empowered to adjudicate the nullity of acts and contracts issued by the Public Administration.

In a recent decision, the Sala Constitucional resolved that issue by stating the following: ‘VII.- If the provision granted the status of a subjective right (derecho subjetivo) to the possibility of challenging unlawful acts “of the administrative function of the State, its institutions, and any other public-law entity” (art. 49 prf.1), the second characteristic of this right follows, namely, that it may be exercised before any court of the Republic to which the law has delegated those powers. Therefore, this Sala considers that the legislature’s decision to create specialized jurisdictions in which the legality of acts of the Public Administration may be adjudicated, such as the agrarian jurisdiction (jurisdicción agraria), does not violate the constitutional order.’” (Emphasis not in the original). Sala Constitucional, N° 2023 at 15 hours 57 minutes on 3 de agosto de 1993. IV.- In more recent decisions, the Tribunal Agrario has maintained the position that, even when a State entity is sued, if agrarian matters are involved, the case must remain within the Jurisdicción Agraria: “In this case, the dispute concerning the conflict of jurisdiction (conflicto de competencia) between the agrarian and contentious-administrative jurisdictions arises again.

Certainly, the position of the Sala Primera de la Corte Suprema de Justicia has been reiterated in its most recent decisions, to the effect that, if an administrative act (acto administrativo) is challenged on grounds of nullity, jurisdiction lies with the Jurisdicción Contencioso Administrativa (among others, Voto N° 758-C-2002 at 9:30 hours on 4 de octubre del 2002). * * However, this case must be analyzed very carefully because of the consequences that would arise if the matter were referred to the Jurisdicción Contencioso Administrativa, since the purpose pursued by special agrarian legislation would be defeated. Indeed, this ordinary agrarian proceeding (ordinario agrario) was brought by [Nombre14] , who alleges matters of substance that are eminently agrarian. As may be seen, the fundamental issue in the ordinary proceeding is not only the nullity of an agrarian administrative act (acto administrativo agrario); the plaintiff also requests that she be retained as the owner of an agrarian property (fundo agrario) and, in the alternative, that she be compensated for the value of the property, the interest, and the improvements she has made since 1991—claims involving agrarian rights in rem (derechos reales agrarios).

Moreover, it must be considered that the Land Allocation Agreement (contrato de Asignación de Tierras) is an agreement establishing an agrarian enterprise (empresa agraria), through which the Agrarian Entity (Instituto de Desarrollo Agrario) awards an agrarian property to a producer or farmer who lacks land, subject to the conditions, restrictions, and limitations established by the Law itself. The purpose of the agrarian agreement (contrato agrario) is to fulfill the social function of property (función social de la propiedad), and it seeks to achieve an equitable distribution of land so that persons of limited economic means may gain access to it. Logically, the resolution issued by the Instituto’s Junta Directiva gives rise to an administrative act whose purpose, grounds, and content are substantially linked to the specific objectives of the Ley de Tierras y Colonización; therefore, the review, revocation, or nullity of the administrative act cannot be considered from a purely administrative perspective.

In this case, it would be necessary to analyze not only the procedure itself used by the Instituto to make the award, but, fundamentally, whether the substantive grounds may affect the plaintiff’s rights in rem. Because this is an agrarian administrative act (acto agrario administrativo) with property-related consequences, since it gives rise to highly important institutions of Costa Rican Agrarian Law, such as the agrarian enterprise, agrarian possession (posesión agraria), the social function of property, and special agrarian succession (Sucesión especial agraria), it is clear that the matter must be decided by a judge specializing in agrarian matters rather than by a contentious-administrative judge. V. The agrarian administrative act comprises legally relevant interests arising from the exercise of the administrative function and the regulation of agriculture by a public agrarian entity.

If a distinction is drawn among the rules governing agrarian administrative acts, some will be specifically agrarian and others will be general administrative rules. The specifically agrarian rules are those containing regulations concerning the grounds, content, cause, and purpose of the agrarian administrative act. Their core revolves around the concept of agrarian character (agrariedad), since they are characterized by the development of a biological cycle in agrarian activity for the fulfillment * of the economic, social, and environmental function of the institutions of Agrarian Law. Accordingly, it has been stated that ‘The agrarian administrative act differs from other administrative acts because of its specific purpose, which is the fulfillment of the social function of the agrarian enterprise. Analysis of the purpose of the agrarian administrative act is one of the stages richest in possibilities:* * the act will be defective if its purpose does not conform to the purposes of agrarian law, including, among others, the well-being of the farming family, the country’s food security, and the full realization of justice in relationships immediately connected with agriculture.’ ([Nombre15] , Héctor et al. El proceso agrario-administrativo.

Análisis del Conflicto de Competencia entre las Jurisdicciones Agraria y Administrativa. Tesis de Grado. Licenciatura en Derecho, Universidad de Costa Rica, 1993, pág. 64). VI. But there is another, more compelling reason for holding that this matter must be heard in the Jurisdicción Agraria. On the one hand, the general jurisdiction provided for in artículo 2 inciso h) establishes that all disputes arising from acts and contracts to which an agrarian entrepreneur (empresario agrario) is a party must be heard in the Jurisdicción Agraria. In this case, the dispute concerns an agrarian administrative act that resulted in the revocation of a parcel (revocatoria de parcela). VII. Finally, it should be noted that the Ley General de Administración Pública itself excludes the Ley de Tierras y Colonización from its scope of application with respect to administrative procedure (procedimiento administrativo) (See Voto del Tribunal Superior Agrario N° 561 at 15:00 hours on 28 de julio de 1993.).

Consequently, the analysis of this matter must fall to the Tribunales Agrarios and not to the contentious-administrative jurisdiction, because, pursuant to artículo 22 of the Ley de Jurisdicción Agraria, the Instituto de Desarrollo Agrario is a party to all agrarian proceedings in which its interests may be affected. (See the decisions of this Tribunal, N° 801-C-05 at 11:14 hours on 7 de octubre del 2005 and N° 379-C-07 at 11:05 hours on 10 de mayo del 2007). III.- The new Código Procesal Contencioso Administrativo regulates the jurisdiction of that branch as follows:* “ARTICLE 1.-

  • 1)The Jurisdicción Contencioso-Administrativa, established in artículo 49 of the Constitución Política, has the purpose of protecting every person’s legal positions (situaciones jurídicas), guaranteeing or restoring the legality of any conduct of the Public Administration subject to Administrative Law, and hearing and deciding the various aspects of the legal-administrative relationship (relación jurídico-administrativa).
  • 2)The grounds of illegality (motivos de ilegalidad) encompass any breach of the legal system, whether by act or omission, including misuse of power (desviación de poder).
  • 3)For the purposes of this Law, Public Administration shall mean: a) The Central Administration. b) The Poderes Legislativo, Judicial and the Tribunal Supremo de Elecciones, when they perform administrative functions. c) The decentralized, institutional, and territorial Administration and all other public-law entities. ARTICLE 2.-The Jurisdicción Contencioso-Administrativa y Civil de Hacienda shall also hear the following:...c) Ordinary proceedings that the Ley orgánica del Poder Judicial and other laws assign exclusively to the civil treasury courts (vía civil de Hacienda), which shall be conducted in accordance with this Law,...f) Ordinary proceedings in which a public enterprise participates.” The jurisdiction of the Jurisdicción Contencioso-Administrativa y Civil de Hacienda shall extend to the hearing and determination of preliminary questions (cuestiones prejudiciales) (artículo 4), and its jurisdiction cannot be extended by agreement (improrrogable) (artículo 5). Nevertheless, such jurisdiction is not exclusive to the contentious-administrative courts because, according to the cited Constitutional jurisprudence, those provisions could not be regarded as preventing the legality of the administrative function from being guaranteed by other jurisdictions, such as the agrarian and labor jurisdictions. In this regard, in a binding ruling issued specifically when analyzing artículo 49 of the Constitución Política, the Sala Constitucional de la Corte Suprema de Justicia stated the following in voto 3905 at 15 hours 7 minutes on 3 de agosto de 2004: “First, the nature of artículo 49 of the Constitución Política should be defined. This provision forms part of a concept—in its modern sense—introduced into Costa Rican political law by the Constitución de 1949, namely, judicial review of public acts (fiscalización judicial de los actos públicos). The concept was strengthened by the amendment introduced through ley #3124 of 25 de junio de 1963, which also permitted challenges to discretionary acts (actos discrecionales) of the Administration, which were not contemplated in the original wording of artículo 49, under which the contentious-administrative jurisdiction was limited to reviewing the ‘exercise of regulated powers’ (uso de facultades regladas). The purpose of the constituent legislature was to establish within Costa Rican constitutional law a new and genuine subjective right in favor of citizens, guaranteeing their defense against overreach by government officials. III.- Indeed, the provision at issue must be interpreted in harmony with the rules of artículos 11 and 129, which embody the principle of legality (principio de legalidad). These provisions, on the one hand, far from establishing jurisdiction in its forensic sense, define the limits on the actions of public authorities; they embody the principle of government officials’ liability for their acts, which arose from the liberation movements of the siglo 18, as well as the principle of the universal applicability of laws. On the other hand, they establish the need to create, by legislative act, a jurisdiction—at least one—in which disputes arising from State activity may be adjudicated. It is within this aspect that the consultation before us falls. IV.- If, as explained, the ratio legis of the constituent assembly was to provide individuals, in their disputes with the Public Administration, with a specialized means of defense, the organizational structure developed by the ordinary legislature for that purpose is constitutionally irrelevant. It is sufficient to emphasize the placement of the provision at issue within the dogmatic section of the Constitution and, in particular, as part of the catalogue of individual rights set forth in Título V, Capítulo Único. The number of courts, their composition, and their territorial or subject-matter jurisdiction, for example, are matters of secondary importance that are clearly expressly delegated to the legislature under the terms of artículo 152 of the Constitution, which states: ‘Article 152: The Poder Judicial shall be exercised by the Corte Suprema de Justicia and by the other courts established by law.’ It is therefore clear that the function of artículo 49 responds to the need to provide individuals with an effective remedy against unlawful administrative acts.

And the unlawful nature of the acts is emphasized, since, in contrast to the ordinary jurisdiction (jurisdicción común), of which the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa) forms part, the constituent assembly also provided for constitutional jurisdiction (jurisdicción constitucional), which was exercised by the full Supreme Court (Corte Plena) until 1989, when it was assigned to this specialized Chamber of the Supreme Court of Justice. The hierarchy of normative sources (fuentes normativas) also determines the jurisdiction of constitutional or ordinary courts. V.- The statements made in the preceding sections are corroborated by the provisions of Article 153, which forms part of Title XI, Sole Chapter, located in the organic section of the Constitution dealing with the Judicial Branch. This clause grants the legislature full discretion to organize the courts through which the Judiciary performs its function.

The text reads: “Article 153: In addition to the functions assigned to it by this Constitution, the Judicial Branch shall hear civil, criminal, commercial, labor, and contentious-administrative cases, as well as such other cases as may be established by law, regardless of their nature and the status of the persons involved; shall issue final decisions thereon; and shall enforce the judgments it renders, with the assistance of law enforcement if necessary.” This provision resolves the issue raised by the Office of the Attorney General (Procuraduría) regarding the constitutional status of contentious-administrative jurisdiction, insofar as the Constitution did not intend to confer upon a special category of courts—the contentious-administrative courts—special protection above that afforded to the others. Rather, as stated above, it created a constitutional right (derecho constitucional) that may be exercised before various courts of the Republic.

VI.- Nevertheless, it follows from the foregoing that there is a constitutional prohibition against eliminating that jurisdiction altogether or reducing its subject-matter jurisdiction (competencia) to such an extent as to render the right it protects ineffective. In this regard, it is indeed necessary and mandatory for the legislature to provide the country with that judicial mechanism. But it could by no means be maintained that, for the ultimate purpose of creating a constitutional right, the Constitution granted superior status to this type of court and thereby vested exclusive authority in those courts to hear this specific subject matter. VII.- If the provision conferred the status of a subjective right (derecho subjetivo) upon the ability to challenge unlawful acts “arising from the administrative function of the State, its institutions, and any other public-law entity” (art. 49 para. 1), the second characteristic of this right follows: it may be exercised before any court of the Republic to which the law has delegated such powers.

Accordingly, this Chamber considers that the legislature’s decision to create specialized jurisdictions in which the legality of acts of the Public Administration may be adjudicated, such as the agrarian jurisdiction (jurisdicción agraria), does not violate the constitutional order. THEREFORE:* The* Optional Constitutional Consultation (Consulta Facultativa de Constitucionalidad) is* answered to the effect that the legislative creation of an agrarian jurisdiction vested with subject-matter jurisdiction to review the legality of certain acts of the Public Administration does not violate Article 49 of the Constitution.” That decision is binding pursuant to Article 13 of the Law on Constitutional Jurisdiction (Ley de Jurisdicción Constitucional), both as to its recitals (considerandos) and its operative part (parte dispositiva). It provides the basis for resolving any doubt concerning the subject-matter jurisdiction of the Agrarian Jurisdiction (Jurisdicción Agraria) to hear and decide proceedings in which the legality of administrative acts (actos administrativos) must be ensured.

The specialized nature of the subject matter lies precisely in the fact that the instrument underlying the proceeding consists of a loan secured by a mortgage (hipoteca), in which the investment plan relates to agrarian productive activity, pursuant to Article 1º of the Law on Agrarian Jurisdiction (Ley de la Jurisdicción Agraria). * * * * * * * * * * IV.- In this particular case, as stated in the initial pleading, appearing at folios 1 to 10, the plaintiffs are farmers and claim to be “possessors without title (poseedores en precario) of agricultural properties for more than seven years. Special agrarian possession (posesión agraria especial) as established by section 92 of the Ley de Tierras y Colonización” (folio 2). They request recognition of their right of possession and, ultimately, payment for all improvements (mejoras). They also request that the registry entry (asiento registral)* for the property owned by the defendant entity be declared null and void (folios 1 to 9).

Accordingly, this Court considers that this claim must be heard by the specialized agrarian jurisdiction (jurisdicción especializada agraria), pursuant to Article 2(a) of the Ley de la Jurisdicción Agraria: “Article 2. The agrarian courts shall have jurisdiction over: a) actions for recovery of property or possession (juicios reivindicatorios o posesorios) in which one or more agricultural workers, or groups thereof organized by the corresponding Institute, are parties.” Furthermore, the Instituto de Desarrollo Agrario (currently INDER, Instituto de Desarrollo Rural) is named as a defendant; it is the state institution primarily responsible for ensuring compliance with the Ley de Tierras y Colonización and for the country’s sustainable agrarian and rural development. For that reason, the Ley Orgánica del Poder Judicial vested jurisdiction over all agrarian matters in the agrarian jurisdiction, including those in which the Instituto de Desarrollo Agrario or the Procuraduría General de la República participates in defense of its interests, as expressly provided in Article 22 of the Ley de Jurisdicción Agraria, which, as a special law governing the subject matter, must prevail over any other general law.

Several provisions of the Ley de Jurisdicción Agraria refer to the Instituto de Desarrollo Agrario (currently INDER), not only Article 22, but also Article 2(c), the third paragraph of Article 32, Articles 78, 82, and 83, and Transitory Provision II thereof; the legislature’s intent to submit these disputes to the specialized judge is therefore evident. Moreover, it should be recalled that the Sala Primera de Casación has already heard disputes between private parties and the Instituto de Desarrollo Agrario (currently INDER) concerning payment for improvements, because they constitute proceedings typically involving agrarian real-property rights (derechos reales agrarios). Finally, Ley Nº 9036, which transforms the IDA into INDER, provides: “Disputes. Agrega que, dada la pretensión de solicitar la nulidad de la inscripción registral* del inmueble propiedad del Banco, la misma debe ser conocida por el Tribunal Contencioso Administrativo (escrito a folios 58 a 61). * * * * * * * * * * II.- Sobre la competencia de la jurisdicción agraria en caso de procesos con pretensiones propiamente agrarias, * en los cuales intervienen entidades estatales, este Tribunal se ha inclinado por mantener este tipo de procesos en la Jurisdicción agraria, por ser parte de la competencia especializada. "II. Previo a pronunciarse sobre la competencia en este caso concreto, es importante mencionar los criterios jurisprudenciales que han existido en torno al conflicto entre lo agrario y lo contencioso-administrativo. El Tribunal, en Voto N° 91 de las 10 horas del 15 de febrero de 1994, reiterado en el N° 102 de las 9:50 horas del 10 de marzo de 1999, señaló lo siguiente: “VI.- Desde hace algún tiempo, nuestra jurisprudencia, ha venido delimitando los contornos de la materia agraria.

El aspecto fundamental que ha privado para ello, es el criterio de la actividad agraria que es el mínimo común denominador de los Institutos del Derecho Agrario. A pesar de ello, todavía quedan aspectos que no han sido definidos claramente, y uno de ellos se refiere precisamente a los casos o juicios en donde es parte un ente público del Estado (como podría ser el Instituto de Desarrollo Agrario) y se discute sobre aspectos relacionados con la legislación agraria, o con alguno de los Institutos de nuestra disciplina; el problema se plantea, no tanto cuando se discute sobre el régimen patrimonial del Estado (vía civil de hacienda), sino fundamentalmente * * cuando se busca la nulidad de actos o disposiciones de la Administración Pública. En un principio, la Sala Primera de la Corte Suprema de Justicia, estableció en sentencias N° 117 de las quince horas del seis de setiembre de mil novecientos ochenta y cinco, y N° 175 de las dieciséis horas cuarenta y cinco minutos del tres de diciembre de mil novecientos ochenta y seis, que la competente para conocer y resolver asuntos tramitados contra el Instituto de Desarrollo Agrario, lo era la Jurisdicción Contencioso-Administrativa.

Posteriormente en resoluciones N° 114 de las quince horas treinta minutos del diez de junio de mil novecientos ochenta y ocho y N° 149 de las quince horas cincuenta y cinco minutos del trece de julio de mil novecientos ochenta y ocho, se sostuvo de dichos asuntos, debían ser tramitados dentro de la Jurisdicción Agraria, indicándose lo siguiente: "En efecto, la Jurisdicción Agraria es improrrogable y debe ser ejercida por Tribunales especializados en la materia, con independencia de los sujetos que figuren como parte en los procesos, según los artículos 5 y 15 de la Ley de comentario. Ello hace que para determinar quién tiene la competencia para conocer de un asunto, resulte de segundo orden si la administración es actora o demandada, pues siempre habrá de sujetarse a los principios que gobiernan el proceso agrario, caso los de oralidad, inmediatez o inmediación de la prueba, que sirven de fundamento al artículo 48 ibídem.

De modo que, no por el hecho de que se impugne o pide la nulidad del acto administrativo el asunto deba radicarse en la jurisdicción contencioso administrativa, pues lo predominante es la materia agraria y no el carácter de ente público. De ahí que si el caso se encuentra previsto entre los que indica los artículos 1 y 2 de la Ley de Jurisdicción y la doctrina que la informa su conocimiento corresponde a los Tribunales Agrarios." (lo* subrayado no es del original). Sin embargo en ninguna de las resoluciones anteriormente citadas, se hizo una clara distinción entre aquellos procesos Contenciosos propios de la vía civil de hacienda, y los procesos Contenciosos de Plena Jurisdicción o de anulación de actos emanados de la Administración Pública. En la sentencia N° 183 de las quince horas cinco minutos del treinta y uno de octubre de mil novecientos noventa, la Sala Primera, establece por primera vez, una distinción entre ese tipo de procesos.

En cuanto al proceso Contencioso "AGRARIO" de Plena Jurisdicción, dice lo siguiente: "I.- El contencioso agrario es un proceso establecido en la Ley Reguladora de la Jurisdicción Contencioso Administrativa, N° 3667 del 6 de setiembre de 1968, cuyo conocimiento compete a la jurisdicción agraria cuando el objeto en discusión es propio del Derecho Agrario. Concretamente cuando se trate de la aplicación de la legislación agraria vigente, o el asunto provenga de las diversas actividades ejercidas por la empresa agraria (la primaria de producción, y las conexas de transformación, industrialización o comercialización de productos agrícolas), o se están en discusión contratos agrarios, propiedad, posesión, o cualquiera de los institutos jurídicos de la disciplina. En un proceso que no pierda su naturaleza conforme fue concebido, pero por la especialidad de las normas a aplicar e interpretar su conocimiento le fue confiado por el legislador al Juez Agrario.

Ello se encuentra previsto en el artículo 79 de la Ley de Jurisdicción Agraria. Esta Ley, como es lógico por ser de mil novecientos ochenta y dos, es posterior a la de lo contencioso administrativo. En este sentido, independientemente de participar en el proceso un ente público, la especialidad de la materia agraria atrae a la contencioso administrativa -como también ha sucedido con asuntos conocidos otra como civiles, comerciales, penales y otros, con la única salvedad prevista en la Ley que es la materia laboral- pues por el hecho de tratarse de un ente de naturaleza administrativa * ello no implica estar sujeto única y exclusivamente a esa jurisdicción, como efecto sucede en materia donde el Estado es parte en otras jurisdicciones especializadas, tal es el caso de la laboral o de tránsito. El contencioso agrario tiene una sólida raigambre jurídica en ambas leyes, entendiéndose aplicable el proceso ya pautado, pero necesariamente siendo adecuado a los principios propios del Derecho Procesal Agrario, tal es el caso de la verbalidad con lo cual las diligencias de pruebas podrán ser expeditas y rápidas, además de que operarán en forma más eficiente los principios consustanciales a éste de la inmediatez y concentración, pero también en este proceso el Juez deberá asumir una actividad más dinámica impulsando el proceso sin necesidad de esperar la gestión de parte, podrá ordenar prueba cuya presencia en el juicio juzque importante por acercarse a encontrar la verdad real y no solo formal, las normas se interpretan en una forma muy amplia, sin sujeción estricta a las normas del derecho común, y siendo también importante la incorporación para el contencioso agrario del principio de gratuidad de la justicia, en su doble aspecto de no ser necesario pagar por ningún acto judicial, y tampoco será necesario el afianzamiento de costas.

Ese criterio, es reiterado en las Sentencias N° 81 de las trece horas del treinta y uno de mayo de mil novecientos noventa y uno, y N° 82 de las trece horas cincuenta y cinco minutos del treinta y uno de mayo de mil novecientos noventa y uno. Se aclara en dichas resoluciones, que cuando se discuta la legalidad de los actos y disposiciones de la Administración Pública sujeta al Derecho Administrativo, se debe aplicar el proceso pautado por la Ley Reguladora de lo Contencioso Administrativo, con los principios propios del derecho procesal agrario. Igualmente establece que "Respecto de los juicios tramitados en la jurisdicción contencioso administrativa cuya denominación los inscribe dentro de la vía civil de hacienda, por tratarse en el fondo de juicios ordinarios, y dada la circunstancia de que la Ley de Jurisdicción Agraria ha previsto una tramitación específica para estos casos, lo procedente es seguir dentro de esta jurisdicción el ordinario agrario y no el de la Ley Reguladora de la Jurisdicción Contencioso Administrativa.".

"Además de lo dicho, en el contencioso agrario, sólo se discutirá de asuntos derivados de los actos de la Administración Pública donde se aplique el Derecho Administrativo, lo cual no sucede en lo civil de hacienda donde el objeto de ellos se refiere al régimen patrimonial, o a la responsabilidad del Estado y las instituciones públicas, o en su aspecto de Derecho Privado, aún cuando, lógicamente, estén de por medio normas de Derecho Público." VII.-En resolución N° 148 de las quince horas del once de setiembre de mil novecientos noventa y uno, la Sala Primera de la Corte Suprema de Justicia cambia de criterio en cuanto se refiere al Proceso Contencioso- Administrativo de anulación, para otorgarle competencia a la Jurisdicción Contencioso Administrativa. En dicha resolución en voto de mayoría sostuvo lo siguiente: "La mayoría de la Sala considera que el conocimiento del presente proceso ordinario de carácter contencioso administrativo corresponde al Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda, donde fue presentado y ha radicado, ya que se trata de un juicio contencioso administrativo de plena jurisdicción, pues en él se pretende se declare: "con fundamento en la Ley Reguladora de la Jurisdicción Contenciosa Administrativa...", entre otras cosas que: los decretos números 16306-G y 16307-G del dieciséis de mayo de mil novecientos ochenta y cinco son nulos, porque por su medio se procedió a incorporar a la Reserva Indígena de Talamanca* nuevas áreas de propiedad privada, sin establecer la indemnización correspondiente, que siendo nulos los Decretos antes dichos, carece de fundamento legal y también debe anularse el Decreto N° 16323-G del veinte de diciembre de mil novecientos ochenta y cinco, que ordenó la derogatoria del Decreto N°* 16410-G del seis de junio de mil novecientos ochenta y cinco (que había ordenado la expropiación de ciertas tierras para la Reserva Indígena).

A parte de las nulidades mencionadas, también se pretende se declare que el Estado y la Comisión Nacional de Asuntos Indígenas le indemnicen a la actora el valor de las tierras, la madera, los intereses y los daños y perjuicios, más adelante se expresa: "V.- Si analizamos la contestación a la demanda, también notaremos que los argumentos que se dan para oponerse a la pretensión de la acción se enmarcan dentro del campo del Derecho Administrativo. Ciertamente, lo relacionado a la nulidad de los decretos impugnados o su localidad, así como el interés público manifestado por las acción del Estado en la constitución de las Reservas Indígenas y plasmado en leyes administrativas y decretos administrativos,y lo relacionado con eventuales expropiaciones es materia que interesa al Derecho Público y concretamente al Derecho Administrativo. Solo de manera indirecta existe una relación con el Derecho Agrario en cuanto a la sociedad actora es una empresa que se dice agro-forestal, pero eso no obsta para que sus intereses en punto a la nulidad de los Decretos Ejecutivos impugnados y * a la presunta responsabilidad de los entes públicos demandados tenga que ser dilucidada en la vía contencioso administrativa, donde corresponde.

"En esta oportunidad el Voto salvado de minoría, del Presidente de la Sala Lic. Edgar Cervantes, mantuvo el criterio o lineamientos de la jurisprudencia que se señaló en el considerando anterior. Se han dado otras resoluciones posteriores, en donde se ha tratado de mantener este nuevo criterio. Así en la Sentencia No. 202 de las catorce horas quince minutos del once de diciembre de mil novecientos noventa y uno, se expresó lo siguiente: "En el subjúdice, las pretensiones del Instituto (IDA) no son para que se anule ningún acto administrativo, sino los traspasos efectuados entre los demandados con posterioridad a la expropiación y cancelación de varias fincas. En casos como el presente, esta Sala ha resuelto reiteradamente que la jurisdicción y competencia agraria son improrrogables, que deben ser ejercidas por Tribunales Especializados en la materia y que a ello no se opone el hecho de que figuran como parte el Estado o una institución pública.

Y en la resolución No. 87 de las trece horas veinte minutos del treinta de junio de mil novecientos noventa y dos, se expuso lo siguiente: "Mediante este proceso, entre otras cosas, el actor pretende que se declare la nulidad de un acto administrativo dictado por el Instituto de Desarrollo Agrario, mediante el cual se le ordenó desalojar una franja de terreno de [Dirección1] céntimos (sic) de ancho, por [Dirección2] cuarenta metros de longitud, situada en una de las colindancias de un lote que él posee en Cariari de Guápiles, Limón, en el que existe una casa de habitación y un edificio dedicado al comercio. Lo que está en discusión es una reducida franja de terreno, donde además no se desarrolla ninguna actividad agraria, de ahí que no se está ante un asunto de naturaleza agraria, sino más bien de índole contencioso administrativo, pues se trata de la impugnación de un acto administrativo.

En consecuencia procede declarar que el conocimiento de este asunto corresponde al Juzgado Cuarto de lo Contencioso Administrativo y Civil de Hacienda." VIII.-Como vemos, han surgido tesis contrapuestas en la misma Sala Primera de la Corte, quien es a la que, en última instancia corresponde definir estos conflictos de competencia. Lo anterior, ha provocado un debate a nivel nacional (Ver los Comentarios de Sentencia de Cesar Hines C. en Revista Ivstitia* N° 64, página 12, y de Álvaro Meza Lázarus en Revista Ivstitia* N° 68 página 18). El Dr Rafael González Ballar, comentando la sentencia referida al contencioso agrario dice lo siguiente: "De lo transcrito podemos extraer varias observaciones importantes: a-) en primer término se define con claridad una híbrida subespecie de proceso denominado contencioso agrario", b-) derivado en la propia Ley Reguladora de la Jurisdicción Contencioso Administrativa ( corresponde a la número 3667 de 12 de marzo de 1966 y no como por error se indica), c-) que pasa a seguir la naturaleza propia de la ley en su aparente origen ("es un proceso establecidoen la Ley Reguladora de la Jurisdicción Contencioso Administrativa... que no pierde su naturaleza conforme fue concebido..." señala la sentencia) ch) debe sujetarse a principios y normas del derecho procesal Agrario.

Es por ello, d) que su conocimiento compete a la jurisdicción agraria, fundamentalmente en razón de e-) la especialidad de las normas que allí se aplican e interpretan. Esto claro está f-) cuando el objeto en discusión es propio del Derecho Agrario. De manera que, g-) resulta irrelevante si en el "juicio" participa como sujeto procesal un ente público... De la anterior enumeración, es preciso dejar claro,que nuestra Ley Reguladora de la Jurisdicción Contencioso Administrativa no establece expresa ni implícitamente un procedimiento especial como el señalado. Con la salvedad de los procedimientos jurisdiccionales especiales establecidos para asuntos tributarios, separación de directores y actos preparatorios y finales de la contratación administrativa (art. 82, 87 y 89), el procedimiento que allí se señala es uno sólo, unívoco y puro. De modo tal, que no puede afirmarse como se hace en la sentencia, que de nuestra Ley Reguladora se deriva el indicado proceso "contencioso agrario".

Este, como es obvio, es el resultado de la propia sentencia, y en ese sentido, tiene un origen netamente jurisprudencial" (Ver GONZÁLEZ BALLAR* RAFAEL). "La integración para un proceso Contencioso administrativo Agrario". En Derecho Agrario Costarricense, Editado por [Nombre13], 1992, p. 346-347. En nuestro país, a diferencia de la Jurisdicción Agraria Venezolana, no está contemplado expresamente el proceso Contencioso de anulación como parte de la Cooperativa Agraria. En efecto, en Venezuela, la Ley Orgánica de Tribunales y Procedimientos Agrarios, hace una clara distinción entre el Proceso Contencioso- Agrario en plena jurisdicción, y el Contencioso Agrario de Anulación. En cuanto al primero la doctrina dice lo siguiente: "Si las controversias entre los productores agropecuarios y los órganos administrativos agrarios, constituyen acciones autónomas diferentes al resto de las acciones agrarias, lo cual justifica que se habla del género contencioso administrativo agrario de plena jurisdicción, la circunstancia de que en el procedimientos por el cual se sigan tales demandas se apliquen normas especiales que constituyen privilegios para tales órganos, también contribuye a que se pueda sostener que tal género existe dentro de la materia agraria.

En efecto, dada su naturaleza de verdaderas demandas o pretensiones, el procedimiento que se aplica es el mismo procedimiento agrario, que es el procedimiento laboral a menos que la Ley Orgánica de Tribunales y Procedimientos Agrarios y en otras leyes especiales, se establezcan procedimientos especiales para ventilar la acción...". En cuanto al segundo, dice la doctrina: "... en virtud de los dispuesto en el artículo 2 de la Ley Orgánica de Tribunales y Procedimientos Agrarios, la materia agraria comprende también las acciones de nulidad contra los actos administrativos dictados por los órganos administrativos agrarios..." De esta forma, el Juzgado Superior Agrario de Caracas, adquiere el carácter de Tribunal Especial de lo Contencioso Administrativo... La competencia en este contencioso administrativo especial está atribuída, en primera instancia, al Juzgado Superior Agrario con sede en Caracas, y en segunda instancia, a la Corte Primera de lo Contencioso Administrativo, de conformidad con lo que dispone el artículo 28 de la Ley Orgánica de Tribunales y Procedimientos Agrarios.

Ahora bien, en la sustanciación y decisión de dichos juicios en el referido Juzgado deberá aplicar según se trate de acciones de nulidad de actos de efectos generales o particulares, el procedimiento que para tales acciones se pautan en la Secciones Segunda, Tercera y Cuarta del Capítulo II, Título V de la Ley Orgánica de la Corte Suprema de Justicia. También podrá aplicar en dichos juicios el indicado Juzgado Superior Agrario las facultades y poderes que la Ley Orgánica de Tribunales y Procedimientos Agrarios le atribuye en todo proceso agrario, cuales son las previstas en los artículos..." (Ver DUQUE CORREDOR ROMAN) Derecho Procesal Agrario. Ed, Jurídica Venezolana, Caracas 1986, p. 304, 309 y 311). ( lo subrayado no es del original). De modo que también en la Jurisdicción Agraria Venezolana se configura como un proceso híbrido en el cual se tiene que seguir el procedimiento ya pautado, pero pudiéndose aplicar los principios propios del proceso agrario.- IX.- Como quedó expuesto en el considerando primero, la demanda ordinaria pretende el cobro de daños y perjuicios originados como producto de las inversiones en la siembra de cacao, las cuales fracasaron por cuanto la semilla no era de buena calidad; en el financiamiento de dichas actividades, participaron como acreedores los entes bancarios aquí demandados, que forman parte del Sistema Bancario Nacional, y otras instituciones del Estado.

Se trata sin duda de * un proceso civil de hacienda, cuya tramitación debe seguirse conforme a lo dispuesto en los artículos 38 y siguientes de la Ley de Jurisdicción Agraria. Diferente sería, si se estuviera discutiendo la nulidad de actos administrativos emanados de los entes públicos demandados, caso en el cual sí debe ventilarse en la jurisdicción contencioso-administrativa..´ * * * * * * * * * * III.- En otros asuntos, el Tribunal ha invocado como marco jurisprudencial,lo indicando por la Sala Constitucional, para que otras jurisdicciones puedan conocer demandas contra el Estado: "III.- Evidentemente, el problema radica en si otras "Jurisdicciones," distintas de la contencioso-administrativa, estarían facultadas para conocer de la nulidad de actos y contratos emanados de la Administración Pública. En un fallo reciente, la Sala Constitucional resolvió dicho problema, al indicar lo siguiente: "VII.- Si la norma otorgó el carácter de derecho subjetivo a la posibilidad de impugnar los actos ilegales "de la función administrativa del Estado, de sus instituciones y de toda otra entidad de derecho público" (art. 49 prf.1), surge la segunda característica de este derecho, cual es que puede ser ejercido ante cualquier tribunal de la República al que la ley le haya delegado esas atribuciones.

Por ello, estima esta Sala que no quebranta el orden constitucional, la decisión del legislador de crear jurisdicciones especializadas en las que pueda ventilarse la legalidad de los actos de la Administración Pública, como lo es la jurisdicción agraria."(Lo subrayado no es del original). Sala Constitucional, N° 2023 de las 15 horas 57 minutos del 3 de agosto de 1993. IV.- El Tribunal Agrario, en fallos más recientes, ha mantenido el criterio de que, aún cuando se demanda un Ente estatal, si hay aspectos agrarios de por medio, debe mantenerse en la Jurisdicción Agraria: "En este caso, regresa la discusión en torno al conflicto de competencia entre lo agrario y lo contencioso-administrativo. Ciertamente, la posición de la Sala Primera de la Corte Suprema de Justicia, ha sido reiterada en los últimos fallos, en el sentido de que si se ataca un acto administrativo alegando su nulidad, compete a la Jurisdicción Contencioso Administrativa (entre otros, Voto N° 758-C-2002 de las 9:30 horas del 4 de octubre del 2002). * * Sin embargo, este caso debe analizarse muy cuidadosamente, por las implicaciones que traería si se enviara el asunto al conocimiento de la Jurisdicción Contencioso Administrativa, pues se perdería el fin que persigue la legislación especial agraria.

En efecto, este ordinario agrario lo plantea [Nombre14] , argumentando aspectos de fondo eminentemente agrarios. Como se observa, el proceso ordinario tiene como punto fundamental de discusión no sólo la nulidad de un acto administrativo agrario, sino también solicita la actora se le mantenga como propietaria de un fundo agrario, y supletoriamente que se le indemnice el valor de la finca, los intereses y las mejoras que ha introducido desde 1991, pretensiones que son de naturaleza real-agraria. Por otra parte, debe considerarse, el contrato de Asignación de Tierras es un contrato constitutivo de empresa agraria, mediante el cual el Ente Agrario (Instituto de Desarrollo Agrario) le adjudica a un productor o campesino que carece de ellas, un fundo agrario, con las condiciones, restricciones y limitaciones que establece la misma Ley. El propósito del contrato agrario es el cumplimiento de la función social de la propiedad, y busca lograr una distribución equitativa de la tierra, para que las personas de escazos recursos económicos tengan acceso a ella.

Lógicamente el acuerdo emanado de la Junta Directiva del Instituto, genera un acto administrativo, cuyo fin, motivo y contenido están sustancialmente ligados a los fines propios de la Ley de Tierras y Colonización, y por tanto, la revisión del acto administrativo, su revocatoria o nulidad, no pueden verse desde una órbita puramente administrativa. En este caso, se tendría que analizar no solo el procedimiento en sí mismo, utilizado por el Instituto, para otorgar la adjudicación, sino fundamentalmente, si las causas de fondo, pueden afectar derechos reales de la actora. Por tratarse de un acto agrario administrativo, con consecuencias patrimoniales, pues de él se generan institutos importantísimos del Derecho Agrario Costarricense, tales como la empresa agraria, la posesión agraria, la función social de la propiedad, la Sucesión especial agraria, es claro que el asunto debe ser dilucidado por un Juez especializado en materia agraria, y no por uno contencioso-administrativo.

V. El acto agrario administrativo se integra de intereses jurídicamente relevantes nacidos del ejercicio de la función administrativa y la regulación de la agricultura por un ente público agrario. Si se distingue a las normas reguladoras de los actos agrario administrativos, habrá unas específicamente agrarias y otras administrativas de carácter general. Las específicamente agrarias son aquellas que contienen regulaciones en torno al motivo, contenido, causa y fin del acto agrario administrativo. Su núcleo gira en torno al concepto de agrariedad, pues presentan como rasgo el desarrollo de un ciclo biológico en la actividad agraria para el cumplimiento * de la función económica, social y ambiental de los institutos del Derecho Agrario. Por ello se ha afirmado que “El acto agrario administrativo se diferencia del resto de los actos administrativos por su fin específico, el cual es el cumplimiento de la función social de la empresa agraria.

El análisis del fin del acto agrario administrativo es una de las etapas m{as ricas en posibilidades:* * el acto estará viciado si su fin no se adecua a los fines del derecho agrario, entre otros el bienestar de la familia campesina, la subsistencia alimentaria del país y la plena realización de la justicia de las relaciones inmediatamente conexas a la agricultura.´([Nombre15] , Héctor y otra. El proceso agrario-administrativo. Análisis del Conflicto de Competencia entre las Jurisdicciones Agraria y Administrativa. Tesis de Grado. Licenciatura en Derecho, Universidad de Costa Rica, 1993, pág. 64). VI. Pero hay otro aspecto de más peso para afirmar que este asunto debe ser tramitado en la Jurisdicción Agraria. Por un lado, la competencia genérica del artículo 2 inciso h), establece que todos los conflictos derivados de los actos y contratos en que sea parte un empresario agrario, deben ser tramitados en la Jurisdicción Agraria.

En este caso, se discute sobre un acto agrario administrativo que originó una revocatoria de parcela. VII. Finalmente, debe indicarse que la propia Ley General de Administración Pública, excluye de su ámbito de aplicación la Ley de Tierras y Colonización, en lo relativo al procedimiento administrativo (Ver Voto del Tribunal Superior Agrario N° 561 de las 15:00 horas del 28 de julio de 1993.). Por ende, el análisis de este asunto deberá corresponder a los Tribunales Agrarios y no a la Jurisdicción contencioso-administrativa, pues de conformidad con lo dispuesto en el artículo 22 de la Ley de Jurisdicción Agraria, el Instituto de Desarrollo Agrario es parte en todos los procesos agrarios en los cuales puedan verse afectados sus intereses. (Véanse los votos de este Tribunal, N° 801-C-05 de las 11:14 horas del 7 de octubre del 2005 y N° 379-C-07 de las 11:05 horas del 10 de mayo del 2007). III.- Según el nuevo Código Procesal Contencioso Administrativo, regula dentro de la competencia de esa jurisdicción lo siguiente:* "ARTÍCULO 1.-

  • 1)La Jurisdicción Contencioso-Administrativa, establecida en el artículo 49 de la Constitución Política, tiene por objeto tutelar las situaciones jurídicas de toda persona, garantizar o restablecer la legalidad de cualquier conducta de la Administración Pública sujeta al Derecho administrativo, así como conocer y resolver los diversos aspectos de la relación jurídico-administrativa.
  • 2)Los motivos de ilegalidad comprenden cualquier infracción, por acción u omisión, al ordenamiento jurídico, incluso la desviación de poder.
  • 3)Para los fines de la presente Ley, se entenderá por Administración Pública: a) La Administración central. b) Los Poderes Legislativo, Judicial y el Tribunal Supremo de Elecciones, cuando realicen funciones administrativas. c) La Administración descentralizada, institucional y territorial, y las demás entidades de Derecho público. ARTÍCULO 2.-La Jurisdicción Contencioso-Administrativa y Civil de Hacienda también conocerá lo siguiente:...c) Los procesos ordinarios que la Ley orgánica del Poder Judicial y las demás leyes atribuyan, exclusivamente, a la vía civil de Hacienda, los cuales se tramitarán de conformidad con la presente Ley,...f) Los procesos ordinarios en los que intervenga una empresa pública."La competencia de la Jurisdicción Contencioso-Administrativa y Civil de Hacienda se extenderá al conocimiento y la decisión de las cuestiones prejudiciales (artículo 4), y su jurisdicción es improrrogable (artículo 5). Sin embargo, dicha competencia no es exclusiva de la jurisdicción contencioso administrativa, pues de acuerdo a la Jurisprudencia Constitucional citada, dichas normas no podrían considerarse como limitantes para que la legalidad de la función administrativa sea garantizada por otras jurisdicciones como podrían ser la agraria y la laboral. Al respecto, en forma vinculante, la Sala Constitucional de la Corte Suprema de Justicia, con ocasión del análisis precisamente del artículo 49 de la Constitución Política señaló en el voto 3905 de las 15 horas 7 minutos del 3 de agosto de 2004, lo siguiente: "En primer término, cabe definir la naturaleza del artículo 49 de la Constitución Política. Esta norma, forma parte de un concepto -en su acepción moderna- introducido al derecho político costarricense por la Constitución de 1949, cual es el de la fiscalización judicial de los actos públicos. El concepto fue reforzado por la reforma introducida mediante ley #3124 de 25 de junio de 1963 que permitió impugnar también los actos discrecionales de la administración, no contemplados dentro de la redacción original del artículo 49 que limitó la jurisdicción contencioso-administrativa a fiscalizar el "uso de facultades regladas". El propósito del legislador constituyente fue situar en el derecho constitucional costarricense, un nuevo y verdadero derecho subjetivo en favor de los ciudadanos, que garantizara su defensa en caso de extralimitaciones de los gobernantes. III.- En efecto, la norma en cuestión debe interpretarse en armonía con las reglas de los artículos 11 y 129, que recogen el principio de legalidad. Estas normas, por una parte, lejos de establecer una jurisdicción en su sentido forense, definen los límites de acción de los poderes públicos; recogen el principio de la responsabilidad de los gobernantes por sus actos surgido de los movimientos libertarios del siglo 18, así como el de la vigencia universal de las leyes. Por otra, estatuyen la necesidad de constituir, por acto legislativo, una jurisdicción -al menos una- en la que se pudiesen ventilar los litigios surgidos de la actividad del Estado. Es en esta vertiente que se sitúa la consulta que nos ocupa. IV.- Si, como se ha expuesto, la ratio legis del constituyente fue procurar al individuo en sus conflictos con la Administración Pública, un medio de defensa especializado, carece de relevancia constitucional la organización que el legislador común desarrolle para ese propósito. Basta con resaltar la ubicación de la norma en cuestión dentro de la sección dogmática de la Constitución y en especial como parte del elenco de derechos individuales desarrollados por el Título V, Capítulo Único. El número de tribunales, su integración, la jurisdicción territorial o material, por ejemplo, son aspectos de secundaria relevancia que obviamente son materia delegada expresamente al legislador en los términos del artículo 152 de la Constitución que dice: "Artículo 152: El Poder Judicial se ejerce por la Corte Suprema de Justicia y por los demás tribunales que establezca la ley." Es claro, entonces, que la función del artículo 49 obedece a la necesidad de brindar al individuo una herramienta efectiva contra los actos administrativos ilegales. Y se resalta la naturaleza de ilegalidad de los actos, puesto que en contraste con la jurisdicción común de la que forma parte la contencioso- administrativa, el constituyente también contempló la jurisdicción constitucional que fue ejercida por la Corte Plena hasta 1989, año en que fue asignada a esta Sala especializada de la Corte Suprema de Justicia. La jerarquía de las fuentes normativas determina también la competencia de los tribunales constitucionales o los comunes. V.- Lo expresado en las secciones anteriores, es corroborado por lo dispuesto en el artículo 153, que es parte del Título XI, Capítulo Único, ubicado en la sección orgánica de la Constitución, que se ocupa del Poder Judicial. Esta cláusula otorga al legislador plena discrecionalidad para organizar los tribunales por los que la Judicatura ejerce su función. Veamos el texto: "Artículo 153: Corresponde al Poder Judicial, además de las funciones que esta constitución le señala, conocer de las causas civiles, penales, comerciales, de trabajo y contencioso-administrativo así como de las otras que establezca la ley, cualquiera que sea su naturaleza y la calidad de las personas que intervengan; resolver definitivamente sobre ellas y ejecutar las resoluciones que pronuncie, con la ayuda de la fuerza pública si fuere necesario." Con esta norma, se resuelve el punto levantado por la Procuraduría en cuanto al rango constitucional de la jurisdicción contencioso-administrativa, en tanto la Constitución no pretendió revestir a una categoría especial de tribunales -los contencioso-administrativos- de una protección singular por sobre los demás. Más bien, como se ha expresado, creó un derecho constitucional que puede ser ejercido ante diversos tribunales de la República. VI.- Eso sí, resulta de lo expuesto, el impedimento constitucional de eliminar esa jurisdicción del todo, o de reducir su competencia al punto de hacer nugatorio el derecho que protege. En este sentido, sí resuelta necesario y obligatorio para el legislador el proveer al país de ese instrumento judicial. Pero de ninguna manera podría sostenerse que, con el fin último de crear un derecho constitucional, la Constitución otorgó rango superior a este tipo de tribunales y por ello concentró en ellos el conocimiento de esta materia específica. VII.- Si la norma otorgó el carácter de derecho subjetivo a la posibilidad de impugnar los actos ilegales "de la función administrativa del Estado, de sus instituciones y de toda otra entidad de derecho público" (art. 49 prf.1°), surge la segunda característica de este derecho, cual es el que puede ser ejercido ante cualquier tribunal de la República al que la ley le haya delegado esas atribuciones. Por ello, estima esta Sala que no quebranta el orden constitucional, la decisión del legislador de crear jurisdicciones especializadas en las que pueda ventilarse la legalidad de los actos de la Administración Pública, como lo es la jurisdicción agraria. POR TANTO:* Se* evacúa* la Consulta Facultativa de Constitucionalidad en el sentido de que la creación legislativa una jurisdicción agraria a la que se le atribuye la competencia material de revisar la legalidad de algunos actos de la Administración Pública, no quebranta la Constitución en su artículo 49." Esa resolución es de acatamiento obligatorio de conformidad con lo dispuesto en el artículo 13 de la Ley de Jurisdicción Constitucional, tanto en sus considerandos como en la parte dispositiva. La misma sirve de fundamento para aclarar cualquier duda acerca de la competencia material de la Jurisdicción Agraria para tramitar y resolver procesos en los que deba garantizarse la legalidad de actos administrativos. La especialidad de la materia radica precisamente en que el documento base del proceso esta constituido por un crédito garantizado con hipoteca en el que el plan de inversión está relacionado con la actividad productiva agraria, de conformidad con lo dispuesto por el artículo 1º de la Ley de la Jurisdicción Agraria. * * * * * * * * * * IV.- En este caso en particular, según se indica en el escrito inicial, visible a folios 1 a 10, los actores son agricultores y manifiestan ser "poseedores en precario de fincas agrícolas desde hace más de siete años. Posesión agraria especial según lo determina el numeral 92 de la Ley de Tierras y Colonización" (folio 2). Piden se les reconozca su derecho de posesión, y eventualmente,se les paguen todas las mejoras. Asimismo, se declare la nulidad del asiento registral* del inmueble propiedad de la entidad demandada (folios 1 a 9). De allí considera este Tribunal este reclamo debe ventilarse en la jurisdicción especializada agraria, de conformidad con lo dispuesto en el artículo 2 inciso a) de la Ley de la Jurisdicción Agraria: "Artículo 2. Corresponde a los tribunales agrario conocer: a) de los juicios reivindicatorios o posesorios, en que sean parte uno o varios trabajadores de la tierra, o grupos de éstos organizados por el Instituto correspondiente". Además, está como demandado el Instituto de Desarrollo Agrario (actual INDER, Instituto de Desarrollo Rural), que es la institución estatal que por excelencia debe cumplir con el cumplimiento de la Ley de Tierras y Colonización, y el desarrollo agrario y rural sostenible del país. Por esa razón, la Ley Orgánica del Poder Judicial reservó la competencia de todos los asuntos agrarios en la jurisdicción agraria, incluso aquellos en donde participa el Instituto de Desarrollo Agrario o la Procuraduría General de la República, en defensa de sus intereses, lo cual esta previsto expresamente en el artículo 22 de la Ley de Jurisdicción Agraria, la cual, al ser una Ley especial de la materia debe prevalecer sobre cualquier otra Ley general. La Ley de Jurisdicción Agraria, hace referencia en varias normas al Instituto de Desarrollo Agrario (actual INDER), no solo en el artículo 22, sino también en el 2 inciso c), en el 32 párrafo tercero, 78, 82, 83 y el transitorio II de la misma, por lo que es evidente la voluntad del legislador de someter a conocimiento del juez especializado estos conflictos. Por otra parte, debe recordarse que la Sala Primera de Casación, ya ha conocido de conflictos entre particulares y el Instituto de Desarrollo Agrario (actual INDER), donde se discute el pago de mejoras, por tratarse de un proceso típico de derechos reales agrario. Finalmente, la Ley Nº 9036 que transforma el IDA en INDER, establece: "Controversias. El conocimiento de las situaciones y relaciones jurídicas originadas en la presente ley corresponderá a la jurisdicción agraria, cuando por su contenido material o sustancial esté relacionada con una conducta administrativa en que esté de por medio la actividad agraria, agroambiental o de desarrollo rural, y de conocimiento de la jurisdicción contencioso-administrativa, cuando la pretensión sea para cuestionar la invalidez o disconformidad sustancial con el ordenamiento jurídico administrativo de una conducta administrativa o de cualquier manifestación singular de la función administrativa."
