Judge Díaz Bolaños writes the decision; and,
WHEREAS:
I.Deputy Attorney José Joaquín Barahona Vargas makes the request set forth in the brief on page 44, which was filed in a timely manner (see the certificate of service on pages 37 and the reverse of 26, the ruling at folio 25, and the filing stamp on the brief at folio 44). He states that the matter must be referred to the administrative litigation jurisdiction (vía contenciosa administrativa) for processing because the relief sought is the lifting of a statutory prohibition, contained in rules of Public Law, against cutting trees located in a protected area (área de protección), the harvesting (aprovechamiento) of which constitutes, in principle, a forestry offense (delito forestal). He argues that jurisdiction is a procedural prerequisite for the validity of the proceedings and cannot be extended in administrative litigation and public-finance civil matters. He believes that the requested cutting of 32 trees, an “environmental asset,” is excessive and distorts the nature of this type of proceeding, and that protection of this asset is the State’s duty under the Constitution.
He also criticizes procedural matters relating to the appointment of a private forestry manager (regente forestal), as well as decisions made by the Court in another matter. He adds that, according to the complaint—specifically, the first allegation—and the registry certification submitted, the nature of the property is not agricultural, the claim is not related to the pursuit of an agricultural activity, and the claimant is not an agricultural entrepreneur (folios 44 to 46).
II.Subject-matter jurisdiction (competencia por razón de la materia) in agricultural matters is defined generally by Articles 1 and 2 of the Ley de Jurisdicción Agraria. Likewise, section 113 of the Ley Orgánica del Poder Judicial provides that the agricultural courts shall hear matters pertaining to agriculture, regardless of the amount in controversy, as well as any other matters entrusted to them by law. Furthermore, trees, as natural resources, are governed, among other provisions, by the Ley de Biodiversidad, section 11(3) of which provides that the environmental public interest is one of the criteria for the
application of that legislation. Specifically, the provision states: “The use of the components of biodiversity must safeguard the development options of future generations, food security, ecosystem conservation, the protection of human health, and improvements in citizens’ quality of life.” These matters must be considered in deciding this proceeding because a natural resource is at issue, and subject-matter jurisdiction to make that determination is reserved by law to this Jurisdiction. In essence, section 108 of the Ley de Biodiversidad provides: “In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative litigation courts. As exceptions to the foregoing rule, offenses against biodiversity shall be tried by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act or public-domain property shall fall within the jurisdiction of the agricultural courts.” It follows from the foregoing that, because this is a proceeding in which a private person asserts a claim relating to a natural resource, it falls within the subject-matter jurisdiction of the agricultural courts under the cited legislation; the objection must therefore be denied. This position was maintained by this panel of the Tribunal Agrario in decision 1577-C-12, issued at twelve fifteen p.m. on December twentieth, two thousand twelve.
THEREFORE:
The objection based on lack of subject-matter jurisdiction (incompetencia en razón de materia) filed by the Procuraduría General de la República is denied.

CONSIDERANDO:
I.Pide el procurador adjunto José Joaquín Barahona Vargas según memorial de página 44, presentado en tiempo (ver acta de notificación de página 37 y 26 vuelto, resolución de folio 25, y sello de memorial en foja 44). Indica el asunto debe remitirse a la vía contenciosa administrativa para que lo tramite porque se pretende levantar una prohibición legal contenida en las normas de Derecho Público de corta de árboles ubicados en un área de protección, cuyo aprovechamiento es, en principio un delito forestal. Aduce, la competencia es un presupuesto procesal de validez de los trámites e improrrogable en materia contencioso administrativo y civil de hacienda. Estima se pretende la corta de 32 árboles, "bien medioambiental ", cuya tutela es deber del Estado por mandato constitucional, afirma el número es excesivo y desnaturaliza este tipo de proceso. Por otra parte critica aspectos de procedimiento relacionados con el nombramiento de un regente forestal, privado; así como las decisiones asumidas por el Despacho en otro asunto. Agrega, según el escrito de la demanda, en el hecho primero y la certificación registral aportada, la naturaleza del inmueble no es agraria, tampoco la pretensión se relaciona con el ejercicio de una actividad de tal naturaleza, ni la actora es empresaria agrícola (folios 44 a 46).
