2 2 ORDINARY PROCEEDING (PROCESO ORDINARIO).
PLAINTIFF: Nombre39913 DEFENDANT: INSTITUTO COSTARRICENSE DE ELECTRICIDAD CASE FILE: 03-001262-0163-CA No.67-2013-I ADMINISTRATIVE LITIGATION COURT. FIRST SECTION. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. ANNEX A, GOICOECHEA. AT NINE THIRTY-FIVE IN THE MORNING ON VEINTIUNO DE JUNIO DEL DOS MIL TRECE.
The Court hears the appeal (recurso de apelación) filed by the plaintiff in the ordinary proceeding brought before the Administrative Litigation and Civil Treasury Court of the Second Judicial Circuit of San José by Nombre39913 against the INSTITUTO COSTARRICENSE DE ELECTRICIDAD. Nombre28493 appears as special judicial attorney-in-fact (apoderado especial judicial) for the plaintiffs, and Marcela Segura Salazar appears as special judicial attorney-in-fact for the defendant. The particulars of the parties and their representatives are stated in the trial court judgment appearing at folio 1356 of the principal case file and therefore are not repeated here.
RESULTS:
1. The amount in controversy in this matter having been definitively set at three million five hundred twenty-three thousand six hundred thirty dollars and fifty cents (folio 590 of the principal case file), the complaint seeks a judgment granting the following relief requested by the plaintiff: “1. That the Instituto Costarricense de Electricidad be held liable for the strict-liability damage (daño objetivo) caused to each of the plaintiffs, consisting of the loss in asset value of the properties at issue in this proceeding. / 2. That, by reason of the foregoing, the Instituto Costarricense de Electricidad is required to recognize and pay, individually to each owner of real property appearing as a plaintiff in this proceeding, compensation (indemnización) equal to at least fifty percent of the current market value of the respective affected properties, because they are located adjacent to high-voltage towers and cables used for the transmission of electrical energy.
The market value to which we refer would logically be the value that the properties, together with their buildings, would have were it not for the adverse effect caused by their proximity to the high-voltage cables./ 3. That the exact amount of compensation payable to each plaintiff be determined during enforcement of the judgment (ejecución de sentencia), unless that amount can be calculated beforehand in the principal judgment, in which latter event we hereby request that the exact amount of damages payable to each plaintiff be determined./ 4. That the defendant Institute be required to recognize interest at the statutory rate from the date on which the judgment becomes final. / 5. That the defendant Institute be required to pay both categories of costs (ambas costas) of the proceeding” (folio 126 of the judicial case file).- 2. The Instituto Costarricense de Electricidad denied the allegations and raised the defense of lack of legal entitlement (falta de derecho) and the expression “sine actione agit” (folios 509 to 541 of the record).
3. Attorney Greivin Steven Mora Alvarado, Judge of the Administrative Litigation and Civil Treasury Court of the Second Judicial Circuit of San José, ruled as follows in judgment No.1149-2012, issued at nueve horas cinco minutos del veintiocho de mayo del dos mil doce: “POR TANTO: By virtue of the proven facts, the cited legal authorities, and the arguments set forth in the reasoning portion of this decision, it is hereby determined: The defenses of lack of standing (falta de legitimación activa), as inapplicable, and sine actione agit, as nonexistent, all raised by the defendant, are denied. As to all other matters, although a present interest in the proceeding has been established, it is determined that the plaintiffs have no legal entitlement whatsoever to invoke and obtain satisfaction of their claims against or to the detriment of the defendant, because the alleged damage—specifically, the depreciation in the value of their real properties due to the project to expand the electrical-energy transmission lines constructed alongside their properties—was not proven.

4. Dissatisfied with the ruling, the plaintiff appealed. The appeal was admitted by an order issued by the Administrative Litigation and Civil Treasury Court at once horas y veintisiete minutos del trece de junio del dos mil doce, pursuant to which this appellate court hears the matter (folios 1375 and 1379 to 1410 of the appellate case file).
5. No defects or omissions that would render the proceedings null and void are apparent; accordingly, following the required deliberations, the Court unanimously proceeds to issue the appellate judgment within the time permitted by the Court’s workload.

CONSIDERING
I.Because it is consistent with the merits of the record and with the evidence cited in its support, the list of proven and unproven facts contained in the appealed judgment is approved.
II.In support of their appeal, the plaintiffs assert that the appealed decision is marred by a serious error of legal assessment. The judicial proceeding was brought as a consequence of the property damage (daño patrimonial) suffered by the claimants due to a set of factors affecting the depreciation of the properties located opposite high-voltage power lines installed by the defendant in the community known as Bosques de Doña Rosa. They state that the evidence the plaintiffs sought to introduce into the case record was intended to demonstrate the specific harm consisting of the loss of the properties’ asset value and its cause-and-effect relationship (relación de causa efecto) with the installation of the towers and cables by ICE. For this purpose, evidence was introduced from the Municipalidad de Belén, the Dirección de Tributación del Ministerio de Hacienda, and the court-appointed expert (perito judicial) designated by the courts themselves, together with the testimony of those whom they consider the persons best qualified in Costa Rica to conduct property appraisals, namely, the experts from the Ministerio de Hacienda.
In addition, the judicial record contains a judicial inspection (reconocimiento judicial) and abundant documentary evidence showing ICE’s acknowledgment of property damage in other communities in Costa Rica similar to that caused to the plaintiffs. The defendant, for its part, has presented no evidence to refute the property damage, limiting itself to alleging that, before the high-voltage cables and towers were installed, power lines already existed at the same location where the works were subsequently constructed, such that the residents could not later claim damage because a new structure had been built. That argument was disproved by the statement of an official from that same institution, who submitted to the record his responses to a questionnaire prepared by the plaintiffs, in which he acknowledged that the previous power line was merely a distribution line, very different in dimensions and electricity transmission capacity from the structure ultimately constructed (see examination of Ing. Edwin Bogantes Villegas), as well as by the statements of other witnesses.
The claimants also submitted a series of photographs to the record, likewise supported by testimony from persons familiar with the history of the power lines that had previously existed in the Urbanización, to demonstrate the enormous difference between the structure that had existed before and the one subsequently built. They argue that the court of first instance, by altering the subject matter of the dispute and falling into a kind of dialectical trap laid by the defendant itself when it answered the complaint, transformed the central issue in this proceeding, so that instead of determining whether property damage exists, it decided that the judicial dispute should revolve around whether the place where the claimants live is an area of electromagnetic pollution (contaminación electromagnética). When the respondent Institute answered the complaint, lacking arguments with which to rebut the market studies and appraisals performed by the technicians of the Ministerio de Hacienda, it chose to debate an entirely different issue: whether the high-voltage power lines and towers caused harm to health and whether, therefore, there was a possibility of physical harm to the owners of the land adjoining the newly constructed works.
In the appellant’s view, this issue had already been addressed before the Sala Constitucional in expediente No. 97-006785-007-CO, which gave rise to sentencia No. Placa7232, de de las 14:30 horas del 28 de abril de 1998. In this regard, during the proceedings, that representation had stated that the issue here was different, since what had to be demonstrated was whether, as a consequence of a structure having twelve-meter-high towers located between ten and twelve meters from the plaintiffs’ properties (see visual inspection (inspección ocular) at folio 712 of the judicial record), and the fear that this type of structure creates among the general public, together with other problems caused by the towers, such as the loss of scenic beauty and the noise generated by the flow of electrical current, there had been a loss in the asset value of the land and houses. They state that the challenged judgment chose to sift through the evidence gathered, both documentary and testimonial, to determine whether it showed the existence of an electromagnetic field (campo electromagnético) causing harm to the residents’ health, concluding that this had not been demonstrated and that the damage had therefore not been established either.
They note that, pursuant to artículo 190 de la Ley General de la Administración Pública, the judgment should have determined whether the plaintiffs’ assets had sustained exceptional harm and whether a legitimately protected interest (interés legítimamente protegido) was involved. In this respect, Costa Rican case law has emphatically held that the unlawfulness (antijuridicidad) of the Administration’s actions, when normal administrative activity (conducta normal de la Administración) is involved, arises from the existence of an exceptional burden (carga excepcional) on the plaintiffs’ assets that they must bear alone. In the claimants’ case, this situation arose from a project benefiting the entire country, and INTEL in particular, which uses virtually all the electricity transmitted through the high-voltage towers and cables crossing Bosques de Doña Rosa. They add that, as held in the case law of the Sala Primera de la Corte Suprema de Justicia, lawful conduct by the Administration that imposes a special sacrifice (sacrificio especial) upon a private party is considered unlawful, without any need to prove specific harm beyond that exceptional sacrifice, since the sacrifice itself constitutes the harm serving as the minor premise for constructing the legal synallagma (sinalagma jurídico) under artículo 190.
They then quote part of the ruling issued on this subject by the Sección Segunda del Tribunal Contencioso Administrativo, Voto N° 139 de las diez horas cincuenta minutos del veinte de julio del dos mil cinco, concerning strict administrative liability or liability for special sacrifice (responsabilidad administrativa sin falta o por sacrificio especial), in which the private party sustains special, abnormal harm that they are not required to bear, since doing so would violate the principle of equality in bearing public burdens (principio de igualdad ante las cargas públicas). The appellant states that, in the challenged judgment, the lower court (a quo) unsuccessfully searches for harm other than the sacrifice suffered by the plaintiffs and maintains that such harm—if it exists—would have to be electromagnetic pollution, which it even proceeds to define subjectively, while disregarding any other evidentiary consideration that might demonstrate the cause-and-effect relationship between the loss of asset value and the works constructed by ICE.
In the appellant’s view, the judgment commits a grave breach of procedural balance (equilibrio procesal) by relieving ICE of its obligation to demonstrate that the plaintiffs’ loss of asset value was attributable to reasons other than the project built by that institution, in violation of artículo 317 inciso dos del Código Procesal Civil. In the appellant’s view, the lower court makes ICE’s task far too easy, because on the one hand it exempts ICE from proving that the existing and established damage to the plaintiffs’ properties was attributable to the works it constructed in the area, and then determines that the plaintiffs failed to prove something they were not required to demonstrate, such as the existence of an electromagnetic field in the area. It would therefore appear that the court of first instance does not regard the exceptional burden suffered by the plaintiffs as sufficient and thus searches in vain for some other form of unlawfulness, as though seeking to identify subjective harm involving an agent who unlawfully causes the damage.
The appellant proceeds to cite sentencia No. 584 dictada por la Sala Primera de la Corte Suprema de Justicia a las diez horas cuarenta minutos del once de agosto del año dos mil cinco, which essentially holds that, for a right to compensation (derecho de reparación) to exist, there must be underlying antecedent unlawfulness, which in no way depends on the lawful or unlawful nature of the conduct of the party causing the harm or on the result produced by that action or omission. Even in cases of lawful and normal operation in which the conduct itself is not unlawful, a harmful consequence may arise that, because of certain characteristics—exceptional intensity or the small proportion of persons affected—is deemed subject to mandatory compensation, since the injury itself gives rise to the civil obligation and the corresponding right of action. They state that, after defining the harm to be identified as alleged electromagnetic pollution, the challenged judgment asserts that the Sala Constitucional’s ruling of 28 de abril de 1998 rejected the existence of electromagnetic pollution, making it very easy for the court to develop the remainder of its judgment, since it need only state that no harm has been proven and that the evidence gathered does not demonstrate it.
Moreover, the judgment in question ventures to make a truly reckless assertion, appearing on the reverse of folio 1362, Considerando VII, where it states: “…in view of the statements made by both parties to the effect that, as the plaintiffs indicate, harm to health is not at issue, one must proceed from the premise that no electromagnetic pollution has been proven.” The appellant considers it an unwarranted presumption for the judgment to infer that, because the plaintiffs repeatedly stated that this proceeding does not concern the existence of harm to people’s health but rather a loss of asset value, it must therefore be concluded that the plaintiffs agree that there is no electromagnetic pollution. This is an arbitrary inference because it misinterprets the position of one of the parties to the proceeding on the basis of purely subjective assessments. The appellant proceeds to make a series of observations concerning electromagnetic pollution, concluding that both the term pollution and the term electromagnetic pollution are extremely broad, to the point that the presence of any agent external to a natural environment could reasonably be described as a potential pollutant.
Second, for purposes of this proceeding, it is true that the Sala Constitucional, in the aforementioned ruling, did not define what an electromagnetic field was, nor did it determine whether the high-voltage power lines running through Dirección4859 created an electromagnetic field that polluted the surrounding area for nearby residents. The Sala Constitucional refrained from making these assessments, knowing that conflicting positions on the subject exist in the scientific literature. The appellant states that what the judgment issued in the writ of amparo proceeding (Recurso de Amparo) therefore establishes is that, based on the scientific research available to date, it has not yet been possible to prove an association between exposure to the energy produced by high-voltage cables and human health. Although the appellant disagrees with that conclusion, it cannot be inferred from it that, in Bosques de Doña Rosa or anywhere else in the world, it is impossible to delineate an area of electromagnetic impact, bearing in mind that any agent external to the environment, such as electricity transmitted in large quantities, may have a potentially harmful effect on human beings.
It states that what matters here is not whether the harmful effect has been proven, but whether it is possible to delineate an affected zone (zona de afectación) in which, because of the risk of contamination, it is prudent to establish a setback zone (zona de alejamiento). Regulation of the distance between residential homes and high-voltage lines is an important matter because all persons who live or may come to live near high-voltage lines know that they are not in the same situation as the rest of the country’s inhabitants, since there may potentially be a risk to their health; thus, even if such harm has not been proven, the mere fear of the risk of living there is sufficient to consider their subjective situation different from that of other persons. It adds that, in the case under examination, there are objective elements for defining what has been called an “affected zone” or potential-risk zone, which were established by the Sala Constitucional itself when, aware of the potential risk to the residents who had filed the constitutional protection proceeding (recurso de amparo), it prescribed a series of specific measures for their direct protection.
Thus, in the judgment issued at 14:30 hours on 28 de abril de 1998, it imposed a limitation on the amount of electricity that could be transmitted through the high-voltage lines, as well as permanent epidemiological surveillance in the geographical area where the high-voltage transmission line is located. Moreover, because the judgment was unclear as to the limits it imposed and the protected affected zone, in a subsequent ruling issued at 14:38 on 28 de octubre de 1998, in response to a motion for clarification and supplementation (recurso de aclaración y adición) filed by the interested parties, it stated that the intensity measurements must be taken outside the building line (línea de construcción) of the protected parties’ residential homes. This definitively located the affected zone, which it linked to “the area related to the proceeding” (an indeterminate legal concept (concepto indeterminado) used by the Sala Constitucional in the Por Tanto of the first judgment), referring to the properties of the protected parties, who are essentially the same persons who subsequently brought this judicial proceeding because they live directly across from the transmission line, a fact that was not disputed by the Instituto Costarricense de Electricidad during the proceeding and that is also apparent from the judicial site inspection (Inspección Ocular) conducted in this expediente.
Thus, in Fact 18 of the complaint, the claimants referred to their location across from the high-voltage lines, and ICE remained silent on that point. The expert report (informe pericial) of Nombre39923, obtained in this expediente, also makes it possible to establish that location. It states that it is even more significant that, in the operative portion of the April 1998 ruling, the Sala Constitucional recognizes the existence of a magnetic field at the location where the protected parties live, when it refers to ICE’s obligation to inform the Municipalidad and the residents of its measurements of the “magnetic field.” There is therefore a magnetic field producing an impact, which ICE must even monitor continuously, and an affected population upon which the Ministerio de Salud must conduct ongoing epidemiological studies. It reiterates that, for purposes of this proceeding, it is irrelevant whether it has been demonstrated that the magnetic field mentioned by the Sala Constitucional—which ultimately is a concept comparable to that of an electromagnetic field—does or does not affect health.
That is an issue that will continue to be debated for many years and has not yet been resolved in the scientific literature. What matters here is that there is a magnetic field producing an impact, which places the residents living near the project that generates that field in a different situation from that of other inhabitants of this country. To dispel any doubt about the different situation in which persons who currently live, or may come to live in the future, adjacent to the high-voltage lines built by ICE in Bosques de Doña Rosa must live, and about the fear with which they must live permanently, reference is made to the most recent studies by the Organización Mundial de la Salud concerning the potential effects of such infrastructure on health. This concern is directly related to property values, because who would want to purchase homes located ten or twelve meters from the electric transmission lines referred to in the cited scientific studies, except at reduced prices?
Apart from the issue of magnetic fields and their effect on the claimants, the judgment under appeal did not analyze other factors of great importance in determining the value of real property (bien inmueble), in Costa Rica or anywhere else in the world, such as the noise they produce, the loss of scenic beauty, the restrictions placed on children and even adults in using a park area that was formerly also a play area, and the fear caused not by possible electrical contamination, but by living across from structures of such great magnitude, anchored at the entrances to the homes. II. Analysis of the evidence received at trial. The appellant states that, in the ruling challenged here, the Trial Judge applied a free-conviction standard (sistema de libre convicción) in assessing the evidence, relying almost entirely on a merely subjective belief regarding it and, in some instances, ruling contrary to the evidence received.
In the appellant’s view, that method of assessing the evidence is also closely related to the prior determination by the a quo as to what harm he was required to seek in the expediente, which prevented him from analyzing the evidence received in terms of whether: a) it has or has not been demonstrated that the plaintiffs suffered a financial loss, and b) there is a causal relationship between that particular burden and the works constructed by ICE to which the trial relates. This was not what the adjudicator sought, so it is also logical that he could never find it. It states that it is important to emphasize that it might have been possible to submit evidence from real-estate brokers or other residents of the affected community concerning the financial harm suffered by the claimants. Testimony could also have been presented from prospective purchasers whose decisions would have been influenced by the proximity of the plaintiffs’ properties to the high-voltage towers.
That, however, would have introduced into the expediente an element of subjectivity that the judgment, curiously, finds lacking. The plaintiff chose to rely on much more objective and independent evidence, such as the study prepared by the Órgano de Normalización Técnica de la División de Tributación del Ministerio de Hacienda, entitled “Actualización de la Plataforma de Valores de Terrenos. Cantón de Belén,” dated junio de 2001, which appears at folios 239 to 343 of the expediente; the determinations made by the Municipalidad de Belén regarding the valuation of the plaintiffs’ properties, adopted at Sesión Ordinaria No.56-2002, dated 13 de agosto de 2002, at which it was specifically resolved to apply a 50% reduction in value to the land and buildings used for residential and commercial purposes located in the homogeneous zone affected by electromagnetic contamination in the Cantón de Belén (see the document by Ing. Hermis Murillo Zúñiga, Coordinador de Bienes Inmuebles de la Municipalidad de Belén, folios 503 to 505); and the expert study ordered by the judicial authorities themselves and conducted by Arquitecto Nombre39923 (folios 538 to 717), together with its supplement (folios 736 to 756).
In addition, two public officials whose specialty is precisely property valuation and the conduct of real-estate market studies were called to testify as witnesses, as was an Ingeniero Agrónomo who has the dual distinction of being an expert in property valuation and a long-time resident of the affected community. The foregoing evidence provides sufficient grounds for establishing the existence of the harm suffered by the plaintiffs, its individualized nature, its quantification, and its connection to the works carried out by ICE in Bosques de Doña Rosa beginning on 5 de enero del año 1998, as has been reiterated in the closing brief and in the appeals already filed with the Tribunal Superior on the occasions when the expediente has come before it on appeal because of defects in the trial-court judgments issued in this matter. In the appellant’s view, there is objective harm, and the evidence is entirely consistent on that point.
What is therefore surprising is the manner in which the trial-court judgment rejects each and every item of evidence converging on the same conclusion, introducing a series of subjective assessments more characteristic of litigants or persons outside the proceeding than of a judicial authority. It further states that it is striking that, at folio 1363 of the expediente, the Trial Judge quotes a judgment of the Sala Primera stating that harm does not lose that character merely because its quantification is uncertain, indeterminate, or difficult to assess or prove, yet immediately thereafter subjects the plaintiff’s evidence to a series of arbitrary criteria, without considering the evidentiary efforts made to place before the court evidence of the highest degree of objectivity and technical independence, in contrast to a defendant that had no interest whatsoever in submitting rebuttal evidence to the expediente.
With respect to the document issued by the Órgano de Normalización Técnica de la División de Tributación del Ministerio de Hacienda, entitled “Actualización de la Plataforma de Valores de Terrenos. Cantón de Belén,” the judgment begins by attacking that document because it defined an electrical-contamination zone “without explaining how that result was reached.” At the outset, that latter assertion must be refuted, because the authors of the study, engineers Nombre39925 and Nombre39927, did justify the use of that terminology when they prepared a document annexed to the valuation study for the entire cantón that specifically addresses the affected zone they classified as Z03-CE. The study, which the Trial Judge apparently did not read in full, appears as an Anexo 7 to the complete document and is entitled “Devaluación de Terrenos en el Cantón Belén por efecto del campo electromagnético.” That document was submitted to the expediente by the plaintiff together with the evidence attached to the initial complaint.
It is a very serious study containing extensive citations to bibliographic sources and statistical tables. The a quo may disagree with it, but it was prepared by experts in the field, and he had before him no expert study demonstrating the contrary. His sole basis for contradicting the studies in the aforementioned Anexo No.7 is the judgment of the Sala Constitucional, which would conflict with the assertions contained in that annex only as to its conclusions regarding health effects, but not as to other matters, such as the existence of an affected zone, which the Sala Constitucional itself identified as an area defined by the “magnetic field.” A more careful reading of that judgment would surely have enabled the Trial Judge to understand that an area of contamination does exist, understood as an area affected by the magnetic field generated by the high-voltage lines constructed by ICE, regardless of whether it is called an electrical-contamination zone or given some other name.
In any event, no one can deny that it fell within the authority of the Ministry of Finance’s expert witnesses to delimit that area, using the criteria established by science and technology, which they understand, given that the judgment of the Constitutional Chamber did not undertake—because it was not its role—to perform a mathematical measurement of that area. Furthermore, the appellant states that it is essential to note that the existence of a magnetic field generated by the high-voltage cables and its potential impact on health was not the only factor considered by the Ministry of Finance’s expert witnesses in the aforementioned document (appearing at folios 323 to 339 of the case file), as they subsequently confirmed in their testimony. Thus, under heading ...203 of the main document, which describes Zone Z03-CE, the following is stated: “According to the market research, due to the polluting effect of the power lines, the values must be reduced by 50% of the property’s value.” Subsequently, the document entitled “Depreciation of Land in the Canton of Belén due to the Electromagnetic Field,” namely Anexo 7 of the document referenced above, contains a paragraph that better explains the reasons for reaching the conclusion that made it possible to delimit the area or Zone Z03-CE.
In this regard, the Annex states as follows: “The reason why the land is depreciated in this situation is related partly to the potential effect of electromagnetic fields (EMFs) on human health and partly to fears arising from the risk of structural failure of the towers supporting the high-voltage lines (HVLs) due to some external factor, the loss of scenic beauty, and other related aspects.” In addition to the foregoing, in the portion of Anexo 7 subtitled “Depreciation of Land Values,” the authors mention a series of interviews with knowledgeable persons whom they questioned, which demonstrate the actual loss of the properties’ asset value along the boundary with the high-voltage power lines. Contrary to the isolation of a single analytical factor that concerned the judge in the challenged ruling, the Ministry of Finance’s expert witnesses who prepared the aforementioned document for the Municipalidad de Belén and testified as witnesses in the proceeding considered various factors in reaching their conclusions regarding the loss of asset value, since they conducted a market study in the area, a field in which they are experts and about which the judge of the court lacks expertise.
In this regard, the judgment’s analysis, which disparages the study conducted by the Ministry of Finance because it disagrees with the definition of an electrical pollution zone, is both excessively simplistic and unfair. The analyses conducted by specialists in the field and their market research cannot simply be dismissed, nor can it be overlooked that even the Constitutional Chamber, without defining an affected area because it was not its role to do so, effectively did so in practice, precisely to protect the residents of the area and their families. The lower court’s analysis of the document is so subjective that it even questions the instrument used by the Ministry of Finance’s specialists to measure the intensity of the electromagnetic field, or those specialists’ ability to perform the measurements, to the point of disregarding the fact that the professionals who authored the study are engineers and are qualified to provide a scientific opinion.
The judge is apparently unaware that the instrument used in such cases, known as a “gaussmeter,” is a simple device that the residents of Bosques de Doña Rosa themselves purchased through a public collection. It is not necessary to belong to the Ministry of Health to take those measurements. They may be taken by a professional with minimal scientific knowledge, and all the more so by a Ministry of Finance professional. The judge’s subjectivity and lack of knowledge on the subject reach an extreme when he criticizes the measurements taken by the authors of Anexo 7 as contradictory because there are two different readings at the building setback line (línea de construcción). What the trial judge fails to understand, because he plainly lacks knowledge of this subject, is that the magnetic-field intensity varies during the day according to the amount of energy being transmitted at that time.
In this regard, he adds, it must be recalled that what the Constitutional Chamber imposed on ICE was a maximum amount of energy that could be carried by the high-voltage cables, while ICE determines the amount transmitted based on the demand peaks occurring during the day. It should be noted that not even Instituto Costarricense de Electricidad, as the institution with technical expertise in the field, raised technical objections like those made by the judge in the judgment, who, venturing into a field in which he is not an expert and without expert evidence contradicting the specialists’ opinion, makes illogical and unscientific assessments. This is simply a violation of the rules of reasoned evaluation of evidence (sana crítica), and therefore of the provisions of Article 330 of the Code of Civil Procedure, Article 103 of the Law Governing Administrative Litigation Jurisdiction, and Article 220 of the Administrative Litigation Procedure Code.
According to the trial judgment, the entire market study is erroneous because it is supposedly based on an erroneous premise. However, aside from the fact that the premise is not erroneous, it is also improper to ignore that a market study considered factors such as the public’s fear of a project that, apart from its size and scale, could potentially harm health; the loss of scenic beauty, a factor always considered in any market study; and other concomitant factors. He states that even if harm to health is not a proven fact, the mere fear caused by conflicting information on the subject, as evidenced by the World Health Organization’s own website, creates a negative perception of properties bordering the transmission lines, which will necessarily affect their value. The trial judgment disregards all these additional factors because of the manner in which it reduces the discussion to a single issue, exaggerating and misinterpreting a single risk factor.
In its effort to weaken the evidence submitted by the plaintiffs, the court below (a quo) purports to lecture the Ministry of Finance’s specialists on how a market study should be conducted, stating that the interviews should have been documented, that a sampling study is lacking, and that no data exist regarding the value of the properties before or after the project in question. As a layperson on the subject and as the representative of persons who are likewise laypersons in the field, one must begin from the premise that the Ministry of Finance’s specialists know how to perform their work, as does the expert witness Nombre39923, appointed by the Judiciary to participate in this matter, who agrees in all material respects with the Ministry of Finance’s criteria. The appellant considers that the interviews do not require documentary support if they were in fact conducted by the persons assigned to that task, and that sampling is unnecessary because the entire affected area runs parallel to and faces the cable line.
The judge apparently also failed to read the judicial inspection report (Inspección Ocular) contained in the record or to study the maps included in the document prepared by the Órgano de Normalización Técnica del Ministerio de Hacienda, according to which the affected properties face a boulevard that is a park area and crosses Urbanización de Bosques de Doña Rosa from south to north. Moreover, the building setback line is the same for virtually all the houses except for a few, whose distance was determined by expert witness Nombre39923. Therefore, all the properties experience the same impact without any need for sampling. Furthermore, expert witness Nombre39923 did carry out an individualized assessment of damages, in which some variation can be seen between the impact on one property and another; thus, although the Ministry of Finance’s study did not go so far as to individualize damage that was practically the same for all the plaintiffs, the court-appointed expert did so.
The appellant considers that it was unnecessary to conduct a before-and-after value study because the Ministry of Finance conducted a value study for the entire canton, including Urbanización Bosques de Doña Rosa, thereby providing an objective basis for comparing prices—for example, by comparing the prices of real properties located in Bosques de Doña Rosa but not bordering the high-voltage cable line with those that do border it. Thus, knowing the value per square meter of land in the residential development, as well as the value per square meter of construction for each house (a calculation performed by expert witness Nombre39923), it is possible to compare it with the reduced price found by the Ministry of Finance’s specialists when conducting their market study. Moreover, two of the witnesses who testified in the case file, Nombre39928 and Nombre39927, were already familiar with the area, which enabled them to make historical comparisons that the judge failed to consider.
He concludes by stating that it is not the case that no real-property market study was conducted in the record to support the creation of Zone Z03-CE, which is the zone to which the plaintiffs belong. What happened is that the trial judge did not approve of that study and would have preferred it to have been conducted differently. At this point, it must be recognized that the experts in conducting market studies are the Ministry of Finance’s expert witnesses, and there is no expert report in the record contradicting the one they prepared. On the contrary, the expert report ordered by the Courts of Justice confirms and details the work conducted by the Ministry of Finance. For its part, the resolution of the Municipalidad de Belén reducing the property-tax assessment base for the plaintiffs’ properties by 50% likewise received no consideration as evidence of the damage caused to the plaintiffs.
In this regard, the judgment states the obvious point that this evidence is not binding on the defendant Institute. The judge, however, failed to grasp the purpose of this evidence, which was for the courts to take into account that a reputable public institution regarded the studies conducted by the Ministry of Finance as sufficiently persuasive and scientifically relevant to support a decision benefiting the taxpayers liable for real-property tax and affecting the municipal treasury to some extent. Moreover, it is evidence showing that, after conducting its own assessments through its specialists, the Municipality reached the same conclusion regarding the existence of an affected zone encompassing a specific group of residents of the Canton. Consistent with the one-sided approach characterizing the entire judgment, the resolution of the Municipalidad de Belén is completely discredited merely because it treated as an important factor in its decision the same electrical pollution zone identified in the Ministry of Finance’s study.
At this point in his ruling, the Judge introduces a definition of pollution (contaminación) that is not found in any legislation or scientific work upon which he might rely. To contradict the Municipality’s position, the Judge states that pollution entails biological harm to living structures and, in human beings, is caused by adverse effects on health, thereby confusing the subject matter of these proceedings and treating them as though they concerned an alleged claim regarding the plaintiffs’ health. Yet not even the Constitutional Chamber, despite all the evidence it received in the case file for the aforementioned amparo proceeding (Recurso de Amparo), including expert evidence from the Judicial Branch’s Department of Forensic Medicine that it disregarded, ventured to define pollution; the court below does so without any scientific support beyond its own freely formed conviction. Moreover, the Judge understands this plenary proceeding (juicio de conocimiento) as something akin to an extension of what had already been argued in the amparo proceeding, such that he adds and subtracts evidence to conclude that he finds no adverse effect on the plaintiffs’ health, thereby becoming confused in his treatment of the issue, since the definitions of “pollution” used worldwide, and even the term’s etymological meaning, are broader than those used by the Judge, as they regard as pollution any alteration of the environment that introduces harmful or potentially harmful elements into it.
With respect to the Expert Report submitted by Architect Nombre39923, who individually identified the adverse effects suffered by the plaintiffs, the appealed judgment accepts that it is a highly technical study recognizing three adverse-effect factors: distance, visual pollution (contaminación visual), and human health. Nevertheless, the Judge states that the expert appraisal assigns the same level of adverse effect to all the properties, an assertion that is untrue from the outset, since according to the table prepared by the expert, several properties have an adverse-effect value of less than 0.5%. The judgment then asks whether, in every case, the distance is twenty meters or more, or some other distance, which is in fact immaterial, given that the expert himself explains in his report that he would assign a different score according to the distance between each property and the high-voltage lines, thereby indicating that he conducted that examination individually in each case.
The judgment states that the report does not indicate how far away the properties are or how the valuation factors used affect each property. Although this is an observation ICE could have made regarding the expert report but did not, remaining silent on the matter, there are several reasons why such objections should not be considered decisive in nullifying and reducing the evidentiary value (valor probatorio) of the expert evidence (prueba pericial) to zero, as the appealed judgment did in a radical and reductionist manner, while also overlooking the cited case law of the First Chamber, according to which harm does not lose that character merely because its quantification is uncertain, indeterminate, or difficult to assess or prove (judgment No. 14 of 16:00 on March 2, 1993). In the appellant’s view, the objections noted above are immaterial in this matter because the proximity of the high-voltage cables, visual pollution, and electrical pollution (contaminación eléctrica), as facts determining the financial loss—understood as an unlawful sacrifice (sacrificio antijurídico) to the detriment of the plaintiffs—are common to all persons whose properties are situated parallel to the high-voltage lines.
This parallel location is shown on Map No. 3, entitled “Zonal Land Values by District,” accompanying the document “Update of the Land Values Platform” for Cantón de Belén, prepared by Ministerio de Hacienda. When expert Nombre39923 prepared his report, he referred solely to the properties along that parallel line, which he identified and which are also described in the judicial inspection (inspección judicial), constituting a source of information supplementary to the expert report and to the maps included in the Ministerio de Hacienda studies used to locate the plaintiffs’ properties. But if any doubts remained as to where the plaintiffs’ properties are located in relation to the boulevard, where the visual inspection (inspección ocular) indicates that the high-voltage cables are situated, it must be considered that ownership certificates for each and every plaintiff were entered into the record, showing the boundaries of each property, and that the cadastral plans (planos de catastro) for each property were attached to the expert evidence of Mr.
Nombre39923, showing the geographic location of the various properties. This information, which the expert had before him in determining both the distance from the building lines to the high-voltage wiring and the properties’ parallel location relative to the high-voltage lines, is what the Trial Judge failed to include in his assessment because, as he himself admits, he is not an expert on the subject. The Judge overlooked the fact that the ownership certificate and registered cadastral plan (plano catastrado) for each property cited in Mr. Nombre39923’s expert appraisal were entered into the record; thus, if anyone were to doubt the expert’s conclusions regarding the distance and location of each property relative to the high-voltage cables, the information necessary to challenge the expert appraisal was available there. Moreover, the judgment failed to consider that the expert had already conducted the analysis that the Judge found lacking; that is, having reviewed the registered cadastral plans and visited each affected property, Mr.
Nombre39923 knew perfectly well the distance from each such property to the high-voltage cables and its location on the area map. Furthermore, the record contains no expert or documentary evidence showing that the expert was mistaken in the locations he assigned to each property or in the values he determined. The appellant insists that it was unnecessary to specify how each individual property is affected by factors such as visual pollution, apprehension or fear, and electrical pollution because, since the properties are situated along a line parallel to the high-voltage cable network, these factors affect them all equally. Possibly, as expert Nombre39923 determined, some properties may suffer slightly greater harm because of their distance and others lesser harm, but that was precisely what his valuation addressed by incorporating the distance factor. Except for the distance factor, every other factor equally affects all properties aligned parallel to the high-voltage transmission lines constructed by ICE.
This makes it possible to understand, using the rules of logic and experience, why all the adverse effects are similar, while also bearing in mind, as stated in the Visual Inspection conducted by a Judge of the Judicial Office, that most of the homes are ten meters from the high-voltage lines, which is the same assertion we made in allegation number eighteen of the initial complaint and which ICE never denied. The appellant argues that the second source of criticism directed by the trial judgment at the expert appraisal is its assumption that there is an electromagnetic-pollution zone (franja de contaminación electromagnética), which was taken into account in establishing the values defined in that study. Once again, the Judge considered it important to determine whether there is a zone of exposure to harm to health, rather than whether there is a zone of electrical pollution, which could well have been called that or something else, but which, for purposes of these proceedings, describes an area adversely affected by its proximity to the high-voltage transmission cable network, which the Constitutional Chamber called a “magnetic field” (campo magnético) and to which the country’s authorities have afforded special protection since the judgment of April 28, 1998.
The issue here is not whether persons living within that affected area are certain to develop a health problem. That is not the issue in these proceedings; the question is whether the properties located in that affected area have suffered a diminution in value, causing a severe sacrifice to the owners of the respective properties. In short, it is immaterial here whether expert Nombre39923 called the area in question an “electromagnetic-pollution zone” or whether he could have given it another name. What matters is that he used that term to describe an area suffering economic harm. The appellant considers the Trial Judge’s complete rejection of the expert appraisal on the ground that it was methodologically inconsistent to be presumptuous. As he already noted when analyzing the Judge’s failure to consider the registered cadastral plans and land-registry certificates (certificaciones registrales) in determining the exact position of each property relative to the high-voltage lines, it is the court below that lacks knowledge of the methodology for conducting a study of this nature and that, strangely, decided to destroy all the evidence capable of establishing the harm caused to the plaintiffs, even if doing so required lapsing into logical inconsistencies and intellectual extravagances such as those cited here.
Regarding the record of judicial inspection (acta de reconocimiento judicial), the appellant states that it helps establish the location of the affected properties in relation to the works constructed by ICE, which also means that this evidence helps demonstrate the causal link (relación de causalidad) between the construction of the towers and the high-voltage cable network and the plaintiffs’ properties. The appellant states that the witness testimony (declaraciones testimoniales) of Nombre39928, Nombre39925, and Nombre39927 is highly important and that the only way to discredit or diminish the substance of those statements, particularly those of the experts from the Dirección de Tributación of Ministerio de Hacienda, was to challenge their superior expertise in conducting a market study by accusing them of not knowing how to conduct such real-estate market studies and asserting that the Judge was the one who knew how to do so.
That was the course chosen by the court below, which attempted to substitute its own interpretation of technical and scientific matters for the work of the Ministerio de Hacienda experts. In the case of Mr. Nombre39928, who is both an engineer specializing in property valuation and a resident of the Bosques de Doña Rosa community (not affected by the high-voltage cable network because his property does not adjoin the works), an attempt is made to disqualify him by stating that he was offered as a witness and not as an expert. This argument is untimely, since it should have been raised by the Judge who received the evidence. In any event, it is a form of party argument that is formalistic in nature and contrary to every judge’s obligation to seek the substantive truth of the facts before merely formal truth. As in the other cases, when analyzing the substance of this witness’s statement, it is almost troubling to see how the Trial Judge demands that he expressly identify his sources of information, finding the witness’s statement insufficient, as though every witness in turn required testimony or evidence from a second source, and that second source presumably required evidence from a third, and so on ad infinitum. That is not how the substance of a witness’s testimony is assessed.
If he is a reputable person, with a profession or knowledge relevant to the matters on which he is reporting, and if he testified under oath, there is no valid reason to question what he states merely because, for example, reference is made to information from bank appraisers or Tax Administration appraisers without mentioning the names of those appraisers, which the witness, the parties during the hearing, and the Judge who presided over it considered unnecessary to ask. This attempt to correct the formal requirements of evidence (prueba) after the fact, when not even the procedurally affected party has challenged the testimony, is contrary to the principle of procedural preclusion (preclusión procesal), and is also unfair because it does not allow the party that submitted the evidence to cure the defects later attributed to it as grounds for excluding its evidence. In this manner, the Judge seeks to require the witness, ex post facto, to provide information that he could surely have supplied had it been requested at the time of his testimony, but which he omitted during the deposition (deposición), not because he wished to generalize, but because he was testifying about the facts on the basis of which he could affirm that the claimants had suffered a financial loss.
This leads to the making of truly arbitrary accusations of a sort against the witness Nombre39928, such as, for example, that he did not refer to a specific place, so that it is supposedly impossible to know whether he was speaking about the Bosques de doña Rosa residential development or another one. That interpretation is arbitrary because the testimony as a whole shows that the witness was speaking about the residential development where the works constructed by ICE are located. In short, what is curious about the way in which the adjudicator interprets don Nombre39928’s testimony is that when he testifies as a knowledgeable expert witness (perito), he is disregarded, and when he testifies as a witness because he has personal knowledge of facts and circumstances that have affected the value of the properties belonging to residents adjoining the transmission line, he is likewise disregarded.
As an example of the foregoing, he notes that Mr. Nombre39928, testifying as a witness, stated with the utmost clarity: “Before the installation of the current lines, there was no other similar line at the site; there was one, but it was the traditional type that we can see along any public road in the country, consisting of what we might call ordinary-sized poles, rather than structures similar to the large towers and the current type of cable. I can also state that, with the previous lines, when it rained—generally in the afternoons or at night—no noise could be heard after the rain had passed; by contrast, at present, after an ordinary rainfall passes at night, the noise produced by the current power line is very loud and plainly audible to anyone, which did not occur with the previous line. I live approximately four hundred meters from the high-voltage towers.” The same witness then added at the end of his testimony: “…another factor that has an adverse effect is scenic beauty, since Bosques de Doña Rosa is characterized by its large green areas and (sic) boulevards, whose scenic beauty was entirely impaired, constituting another factor that depreciates the properties.” It may therefore be judged whether don Nombre39928 made important contributions regarding the harm suffered by the plaintiffs and whether or not he knew which residential development he was discussing.
It is obvious that, in making these statements, he testified as a witness, but they were nevertheless ignored by the adjudicator. As for the testimony of the witness Nombre39925, an appraiser from the Ministerio de Hacienda, the judgment dismisses his entire testimony out of hand, simply because the Judge considers it a repetition of the study he had already criticized elsewhere in the judgment and of which Mr. Nombre39925 is a co-author—a study that the Judge did not read in its entirety or did not understand. The adjudicator faults the witness and the study he co-authored with Eng. Nombre39927 for failing to make comparisons with the properties’ previous values, although, as already explained, this was unnecessary because the valuations were made against those of the other properties in the residential development. Contrary to the view of the Trial Judge, who also appears not to have read the witnesses’ testimony as a whole, the fact is that the witness Nombre39927 had previously conducted valuations in the same area when he first advised the Municipalidad de Belén on the preparation of a real-property value schedule.
Indeed, from the beginning of his testimony, the witness states that this was the second time he had advised the Municipalidad de Belén in the field of valuation. This witness therefore makes a historical comparison between the two occasions on which he valued the real property in Bosques de Doña Rosa, which the person who issued the trial judgment overlooked, like so many other matters that did not serve to support his own theories. In fact, the witness Nombre39927 introduces in this testimony a concept already mentioned by the deponent Nombre39928: the “desirability” of an asset, used as a valuation factor in this type of market study. This is a technical concept to which the trial judgment attached no importance whatsoever. With respect to this witness’s testimony, the court below (a-quo) faults him for not considering a series of variables that it deems necessary to substantiate his assertions, including comparisons among areas and between factors such as topography, services, appreciation, and others.
It would be pointless to reiterate here what the witness Nombre39925 said and the sources that he states were used in conducting his study. One may note, for example—to cite only one instance—his conversation with appraisers from the national banking system, his conversations with personnel from the Ministerio de Salud, and other considerations that he took into account when calculating the depreciation in the values of a group of real properties, all of which are tools typically used in studies of this nature. What is difficult to understand is that all this evidence should cease to have value for the adjudicator simply because the witness did not use the criteria that the adjudicator himself would have employed in conducting such a study, and that the adjudicator should even question the study’s reliability by alleging that the appraisers supposedly used their own subjective criteria—which is a genuine fallacy and an audacious claim by the adjudicator, as there is not a single piece of evidence supporting such an assertion—or by capriciously interpreting in his own way a fact supplied by the witness, namely, that housing listings were scarce, which attracts the Judge’s attention, while the other factors provided by the witness to explain the undervaluation of the properties do not.
The appellant states that the testimony of Mr. Nombre39927 is once again penalized because of the document of which he is a co-author, which is accused of lacking scientific rigor and of incorrectly interpreting the alleged electromagnetic pollution. In this way, the Trial Judge sets himself up as a kind of specialist not only in market studies but also in electromagnetic fields and electronic pollution, with deeper knowledge of all these subjects than the Ministerio de Salud, the appraisers of the Ministerio de Hacienda, and the Organización Mundial de la Salud. All of this is based on a partial reading of a ruling by the Sala Constitucional, which he did not fully understand. Thus, where the witness clearly compares values, the adjudicator claims not to understand, even though it is clear that the lower-value listings were located in the affected area, which the witness describes perfectly.
The judgment then attempts to identify a contradiction between the two appraiser witnesses concerning whether there were few or many listings, when in fact the witness Nombre39925 was referring to the difficulties that affected owners had in selling, whereas the witness Nombre39929 was referring to a set of samples that he had valued, agreeing with his colleague on the issue of listings. In any event, the witnesses were addressing different aspects of the same issue or different stages of the same phenomenon, and that detail is not truly essential to resolving the judicial proceeding. The adjudicator attributes to the witness Nombre39925 the assertion that the amount of depreciation was determined based on statements from residents or owners, which is absolutely incorrect; anyone reading the latter’s testimony without bias would find passages very different from what the judgment asserts.
Thus, he stated: “we consulted expert real-property appraisers and, applying our own criteria, reached the conclusions cited in the document.” In this way, the judgment under appeal seeks contradictions where none exist, and in this effort to discredit the evidence submitted by the plaintiff, it even refers to a witness named Loría who never testified in the matter, solely to discredit once again the testimony of Mr. Nombre39928—in fact, Eng. Roberto Loría is the Head of Appraisers at Banco de Costa Rica, with whom the witness Nombre39927 spoke, and whom the Trial Judge confuses with another witness. In short, the judgment finds a contradiction because the witness Nombre39925 speaks of having consulted expert appraisers, whereas Nombre39927 and Nombre39928 said that they had spoken with bank appraisers, thus engaging in a series of subjective assessments and making the error of failing to consider all the findings and objective observations of a witness as experienced and knowledgeable as Mr.
Nombre39927, which serve to establish a state of affairs—in this case, the situation concerning the value of a group of real properties. Thus, for example, compelling statements by that witness are overlooked, such as when he stated: “In this case, I considered that this area had been adversely affected and its value reduced due to the loss of scenic beauty, and because there is a fear that a cable could snap, someone could be electrocuted, an earthquake could occur, or the towers could fall; there are many listings and little demand. In the study I conducted, for which I visited about 40 times, I never saw people playing in that green area; they were presumably frightened by the problem posed by the towers, and I saw no birds in the trees… (…) after consulting appraisal experts such as engineer Roberto Loría, whom I believe is the head of appraisers in Costa Rica, he told me that he had appraised properties with electrical-wiring problems at reductions of up to 25% of their value, including the land and buildings, which I took into account after speaking with colleagues from places where I had worked, including Banco Nacional….” The appellant considers that the Trial Judge’s arbitrariness goes so far that he discredits the witness Nombre39927 for stating that people were afraid of the high-voltage cables, asserting that this is a technical opinion on a matter for which he was not offered as an expert witness, which means that, under the adjudicator’s reasoning, one must be an expert in a particular field to determine whether people are afraid of a public works project.
Moreover, it also follows that a valuation expert may not consider this factor because, in the court below’s view, that assessment must itself be validated by other experts, to some unknown number and generation. In law, this amounts to carrying an argument to the point of absurdity, and it must be stated as such here to demonstrate the disagreement with the highly subjective and unbalanced manner in which the evidence offered by the claimant has been assessed.
With respect to the remainder of the evidence submitted by the plaintiffs, the trial court judgment barely mentions it because, according to its particular view, it does not help establish the damage. Certainly, proof that ICE has deemed it necessary in other communities in the country to award compensation (indemnización) to owners of real property adjacent to high-voltage power lines does not constitute direct evidence of the damage suffered by those I represent. Nevertheless, this documentary evidence (prueba documental) (folios 295 and 455 to 479), together with the environmental impact study (estudio de impacto ambiental) for the Miravalles-Liberia electric transmission line (folio 479), constitutes clear evidence that, according to the defendant institute itself, there is a justification under public law (derecho público) for granting financial compensation to owners who bear a special sacrifice (sacrificio especial) as a result of works that benefit the remaining inhabitants of the national territory.
It is therefore unclear why, if the defendant has invested millions elsewhere in the country by awarding compensation to other inhabitants, an exception should be made for the affected residents of Bosques de Doña Rosa. The exceptional sacrifice and burden required by legal doctrine and legislation as a standard of unlawfulness (antijuridicidad) are present both in the case of San Carlos or Liberia and in the Cantón de Belén; it is therefore discriminatory for the plaintiffs to be placed in a different category when they have suffered damage of exactly the same legal nature. It must be considered that the evidence referred to here as indirect evidence supplements the direct evidence entered into the record, which establishes the existence of damage. Moreover, this evidence makes it possible to establish a cause-and-effect relationship between the construction of power lines and the installation of high-voltage cables and the financial loss that has led ICE, without violating the principles of legality and rational use of public funds, to pay compensation to owners affected by its works.
In conclusion, it may properly be stated that the record contains sufficient evidence to establish not only the financial damage caused to the claimants—which is not unilateral damage but multi-causal harm (daño plurilesivo), insofar as it results from various adverse factors—but also the relationship between that damage and the construction, beginning in 1998, of a high-voltage transmission line in the community where their properties are located. This is sufficient to warrant application of Articles 190 and 194 of the Ley General de la Administración Público and the granting of the complaint in all respects. The appellant requests that the decision appealed from be reversed and that the original complaint instead be granted in all respects. In the alternative, and in the hypothetical event that the trial court ruling is upheld, the appellant requests that it be reversed as to costs (costas).
For purposes of this latter request, the appellant asks that consideration be given not only to the fact that the plaintiffs have litigated from the outset in reliance on the protection afforded by Costa Rican law, but also to the procedural bad faith (mala fe procesal) displayed by the defendant Institute, which never had any interest in offering rebuttal evidence (prueba de descargo) that would have made it possible to determine the true origin of the damage caused to the claimants, as well as the existence of a causal relationship (relación causal) with the works it had constructed. It would seem unjust that, in addition to the sacrifice the claimants have already had to bear for a project that benefits so many Costa Ricans and foreign companies, they should also have to pay costs for defending their rights and those of their families.
As provided in Article 194 of the Ley General de la Administración Pública, the Public Administration shall be liable for its lawful acts and normal operation when they cause special harm to the rights of an administered party (administrado), due to the small proportion of persons affected or the exceptional severity of the injury; in such a case, compensation (indemnización) must cover the value of the damages at the time of payment, but not lost profits (lucro cesante). As established by legal scholarship, the system of liability without fault or for special sacrifice excludes any notion of abnormal operation of a public service, service-related fault, or personal fault, since the administered party suffers serious harm of particular severity arising from lawful acts, or acts substantially consistent with the legal system, or from the normal operation of public services, which far exceeds the ordinary or general sacrifices that administered parties must bear within a politically organized community.
The system of administrative liability without fault or for special sacrifice is exceptional in nature and arises from actions or omissions that exceed the bounds of tolerance with respect to the burdens imposed by public administrations, generate a particularly severe sacrifice for administered parties, and which they have no legal duty to bear. Harm resulting from lawful actions must be special and abnormal, as well as singular, serious, and severe, entailing a breach of the principles of equity, equality in bearing public burdens, and protection against impairment of property (indemnidad patrimonial). The exceptional, particular, and severe nature of the sacrifice gives rise to unlawful harm or injury (daño o lesión antijurídica) that must satisfy the requirements of specificity and abnormality. In any event, under the liability system established in our legislation, a finding of liability for lawful conduct also remains subject to proof that the administrative action or omission caused harm that is certain, actual, quantifiable, compensable, and not conjectural; the existence of that harm must be proven, as must the causal link (nexo de causalidad) between the exercise of the administrative function, whether by act or omission, and the unlawful injury caused to the administered party (see, in this regard, Jinesta Lobo Ernesto, “Tratado de Derecho Administrativo.” Volume II, Pages 155 et seq.).
In the case before the Court, the appellant argues that these judicial proceedings were brought as a consequence of the financial harm suffered by the plaintiffs, arising from a combination of variables affecting the depreciation of the properties and originating in the defendant’s installation of high-voltage cables in the community known as Bosques de Doña Rosa; in the appellant’s view, the evidence submitted to the case file proved the specific harm consisting of the loss in the financial value of their properties. The appellant contends that the evidence introduced by the plaintiffs into the judicial case file—the study by the Órgano de Normalización Técnica del Ministerio de Hacienda, the resolution of the Municipalidad de Belén, the court-ordered expert appraisal (peritaje judicial), testimony from persons qualified to appraise property, expert witnesses from the Ministerio de Hacienda, the judicial inspection (reconocimiento judicial), and the ICE’s acknowledgment of financial harm in other communities in the country similar to that caused to the plaintiffs—proved the specific harm consisting of the claimed loss in the financial value of the properties at issue in these proceedings, as well as its causal relationship with the ICE’s installation of the towers and cables.
Contrary to what has been argued, and as explained below, this Tribunal finds, based on a comprehensive analysis of the evidence in the record under the principles of sound rational judgment (sana crítica racional), that the plaintiffs have failed to establish, through useful and relevant evidence, the existence of the claimed special harm arising from liability without fault or special sacrifice; accordingly, the judgment issued must be affirmed insofar as it rejected the claim for compensation asserted in these proceedings.
IV.THE SUBJECT MATTER OF THE CLAIM AND ITS RELATIONSHIP TO THE EXISTENCE OF AN ELECTROMAGNETIC ZONE IN THE AREA WHERE THE PLAINTIFFS RESIDE. As the appellant notes, the issue of the existence of an electromagnetic field generated by the high-voltage cables in Residencia Bosques de Doña Rosa was examined by the Sala Constitucional in Judgment No. 2806-98, issued at 14:30 on April 28, 1998, in connection with the petition for constitutional relief (Recurso de Amparo) filed by residents of that residential development against the Instituto Costarricense de Electricidad because of the expansion of the high-voltage transmission line known as Línea de Transmisión Alajuela-La Caja, which in turn gave rise to these proceedings. That judgment examined the alleged violation or threat to the plaintiffs’ and their families’ constitutional rights to health and to a healthy environment arising from exposure to the electromagnetic fields generated by high-voltage transmission lines such as those installed in the community where the present plaintiffs reside; the Sala Constitucional clearly established that there is broad consensus within the scientific community that no association has been established between household exposure to power-frequency fields and possible risks to human health.
The judgment in question also acknowledged a consensus that exposure to these fields has not been, and cannot be, proven to be absolutely safe, a circumstance in which the general impossibility of conclusively proving a negative fact plays a fundamental role. The Sala Constitucional found that, for the case under review, it was sufficiently clear that the studies appearing to show risk were based on magnetic-field intensities far exceeding those expected to be found near the power lines at issue in the case considered by the High Court. The judgment concluded that, in the absence of criteria indicating even a genuine threat to the plaintiffs’ health or to the environment in which they live—indeed, the prevailing views indicate that no such threat exists—or to the other fundamental rights cited in the petition, the appropriate course was to deny the petition for constitutional relief by reiterating the precedents issued on the matter.
Nevertheless, in specifying the scope and effects of the judgment, the Sala Constitucional stated that the proper application of the prudent-avoidance principle (principio de evitación prudente) to the particular case made it necessary to order the ICE to adopt all measures required to ensure that the magnetic field generated by the works did not exceed, within the homes, the limits to which it had committed itself before the Sala and the community, namely, 0,1 to 0,3 micro T (8 MG) under normal conditions and a maximum of 0,8 micro T (8MG) under overload conditions for no more than two hours per year. The ICE was also required to designate and provide to the affected communities, necessarily through the Municipalidad de Belén, and additionally to any persons and community organizations requesting it, information concerning the regular measurements of magnetic-field intensity; the Ministerio de Salud was required to establish a permanent epidemiological-surveillance mechanism in the geographical area where the Project’s high-voltage transmission line is located.
By way of clarification, in voto 00664-I-98 of fourteen hours and thirty-eight minutes on the twenty-eighth of October, nineteen ninety-eight, the Sala Constitucional determined that electromagnetic-field intensity measurements must be taken outside the building line of the petitioners’ homes. In light of the foregoing, although the Sala Constitucional determined that an electromagnetic field existed within the Project, the fact remains that this issue is not the fundamental basis of the matter before the Court, because the plaintiffs’ claim for compensation is not based on the existence of health damage caused by the electromagnetic pollution (contaminación electromagnética) generated by the high-voltage cables passing through the Urbanización. The harm claimed in these proceedings is based on the effects that the installation of the high-voltage cables has had on the value of the plaintiffs’ properties—loss of scenic beauty, noise pollution (contaminación sónica) caused by sounds generated by the towers, and, principally, fear of the potential harm to health that might result from exposure to the electromagnetic fields generated by the high-voltage towers.
In the plaintiffs’ view, these factors constitute the causal event underlying the reduction in the financial value of their properties by at least 50%, as determined by the Órgano de Normalización Técnica and the Municipalidad de Belén; consequently, special harm has been caused that they have no duty to bear and that must be compensated because administrative liability without fault or for special sacrifice exists under Article 194 of the Ley General de la Administración Pública. In light of the foregoing, this Tribunal’s analysis of the appeal filed against the trial judgment will focus on these thematic areas.
Contrary to the appellant’s arguments, this Court finds no elements supporting the conclusion that the trial judge used a system of unfettered conviction (libre convicción) in assessing the evidence, made a subjective assessment, or ruled contrary to the evidence received. As will be explained based on the analysis of the evidence offered by the claimants, the damages claimed in this proceeding—corresponding to the financial loss represented by a decrease of at least 50% in the value of the claimants’ properties, allegedly caused by the installation of high-voltage towers by the respondent entity—have not been established by competent evidence (prueba idónea). 1. REGARDING THE STUDY PREPARED BY THE TECHNICAL STANDARDIZATION BODY. In June 2001, Engineers Nombre39927 and Nombre39925, officials of the Technical Standardization Body Division of the Ministerio de Hacienda, issued the document entitled “Update of the Land-Value Platform in the Cantón de Belén” (pages 239 to 343 of the principal case file), as it relates to Dirección4860 (Zone Z03-U23).
Anexo 7 of that document contains an assessment of the depreciation of land located on both sides of the transmission lines in the Cantón de Belén. The study indicates the existence of land depreciation associated partly with the potential effect of electromagnetic fields on human health and partly with fears arising from the risk of structural failure of the towers supporting the high-voltage lines due to some external factor, the loss of scenic beauty, and other related considerations. For these reasons, and based on the literature reviewed, the opinions of the residents consulted, the opinions of real-estate experts, and the value survey conducted, the study by the aforementioned body proposes that, for purposes of collecting real-property tax in the Municipalidad de Belén, depreciation of at least 50% be applied to the value of buildings and land for properties located within homogeneous zones affected by electromagnetic pollution.
This adjustment would apply only to residential and commercial properties located within the high-voltage lines’ area of influence. The study states that, to determine the effect of installing the transmission lines on land values within the area of influence in Belén, a study was conducted in the area and several residents were interviewed, including Luz María Campos, Lidia Duarte, and Pedro González, who described the problems they had encountered when attempting to sell properties in the presence of the towers. The Report also states that Nombre39930, a real-estate salesperson, said during an interview that it was very difficult to sell properties within the area of influence of the high-voltage towers and that the land value was at least 50% of the value of properties not subject to this effect. The Report adds that Engineer Roberto Loría (P&A Peritazgos y Avalúos) stated that he had appraised a property in Dirección4861 for a banking institution and had applied a 25% discount (personal communication).
Engineer Loría further indicated that land affected by high-voltage lines depreciates by between 50% and 75%, while buildings depreciate by 25%. The authors of the study also state that another basis for their recommendation was that one of the country’s most important banking institutions had informed them that it did not accept as collateral properties adjoining the edge of easements (servidumbres) established for high-voltage lines and that properties in these areas depreciated by 50% or more. Finally, the Report indicates that when people living under these circumstances become aware of this problem, they begin the process of disposing of the property or surrendering it to the Bank. In the opinion of this Court, and as the Trial Judge correctly held, the study conducted by the Technical Standardization Body of the Ministerio de Hacienda lacks technical rigor, because it is impossible to determine which sources were consulted or the technical bases supporting the claimed depreciation of between 50% and 75% for land affected by high-voltage lines.
Indeed, the study in question does not establish the circumstances of manner, time, and place surrounding the statements made by the residents interviewed, which would be necessary to determine whether the problems they claim to have encountered in selling properties were actually caused by the installation of the towers. It does not identify the properties concerned, when they were placed on the market, who made the offers, or any other circumstances that would make it possible to determine that causal relationship (relación de causalidad). Similarly, the study does not establish the technical grounds on which the real-estate expert Nombre39930—whose qualifications have not been established in the record—relied in asserting that land values had depreciated by at least 50%. Nor does it establish, apart from the statements of the study’s authors, the grounds on which the expert Roberto Loría—whose qualifications have not been established in the record—relied in asserting that he had appraised a property in Dirección4861 for a banking institution and had applied a 25% discount.
Likewise, the study does not establish the technical or scientific grounds on which Engineer Loría relied in determining that land affected by high-voltage lines depreciates by between 50% and 75%, and buildings by 25%. Thus, the study lacks the technical rigor required to determine that the claimants’ properties depreciated by at least 50%, given that its authors based their recommendation solely on mere references to sources that cannot be verified and whose reasoning and grounds are unknown (statements by residents and by purported real-estate experts whose qualifications were never established in the record). Likewise, apart from their own statements, the document’s authors do not establish the existence of an expert market study demonstrating the values of properties located in homogeneous zones affected by the installation of high-voltage towers, or of studies objectively and verifiably demonstrating the decrease in property values.
The evidence forming the basis of the study does not properly establish the sources used in formulating its recommendation or the criteria or technical reasons on which the purportedly consulted expert sources based their conclusion that the land had depreciated by between 50% and 75%. Likewise, there are no elements establishing the veracity of the source used to assert that one of the country’s most important banking institutions—without identifying which institution, when, in which cases, or under what circumstances—does not accept as collateral properties adjoining the edge of easements established for high-voltage lines, and that properties in those areas depreciate by 50% or more. Nor does the study establish the technical reasons on which, according to its sources, the difficulty of selling properties within the area of influence of the high-voltage towers and the conclusion that land there is worth at least 50% less than land not subject to this effect are based.
For these reasons, as the Trial Judge determined, the expert opinion (dictamen) of the Technical Standardization Body does not constitute useful evidence for establishing the damages claimed by the claimants in this proceeding, and the appellant’s grounds of appeal (agravios) are therefore unfounded. Indeed, the possibility that the claimant could have offered other types of evidence (testimony from real-estate brokers, other community residents, or prospective buyers whose decisions were influenced by the proximity of the properties to the high-voltage towers) is merely hypothetical, since it is for the parties, in accordance with their trial strategy, to determine which evidence they deem most appropriate to their interests in establishing the facts and relief sought in their complaint. Contrary to the appellant’s arguments, this Chamber finds the Trial Judge’s reasoning appropriate insofar as the study conducted by the Technical Standardization Body should have documented the interviews so that their sources and underlying grounds could be verified.
This Court considers that the mere fact that the study offered as evidence was conducted by officials of the Ministerio de Hacienda does not render it immune from judicial review. A judge may not begin the assessment of the evidence by assuming that the technicians of the Ministerio de Hacienda or the experts appointed during the proceeding know their work and that, consequently, the parameters used in their opinions cannot be questioned and must be accepted as presented, treating them as conclusive and irrefutable evidence. In this regard, the appellant overlooks the Judge’s role in resolving the dispute submitted to judicial adjudication and the duty to assess the evidence in accordance with the principles of reasoned sound judgment (sana crítica racional), as well as the authority to depart, on reasoned grounds, from the evidence submitted by the parties. As will be explained when analyzing the expert opinion submitted in the record by Nombre39923, although the expert performed an individualized assessment of damages showing some variation in the degree to which one property or another was affected, that opinion contains a series of methodological inconsistencies that prevent it from being considered useful evidence for establishing the damages claimed by the claimants in this proceeding.
The appellant’s arguments concerning the statements in the judgment questioning the device used by the technicians of the Ministerio de Hacienda to measure the intensity of the electromagnetic field are immaterial, because this complaint is not based on the existence of harm to the claimants’ health resulting from the effects generated by the electromagnetic field. In any event, as the Sala Constitucional determined, it is the responsibility of the Ministerio de Salud to ensure compliance with that Court’s order concerning the maximum amount of energy that may be transmitted through the high-voltage cables, making this issue irrelevant to the merits of the dispute in this proceeding. In any event, it is not true that the trial court’s judgment was based on the absence of only a single risk factor (harm to health from the effects generated by the high-voltage cables); rather, it was based on the absence of evidence establishing the damages, in light of the evidence submitted by the claimant.
Contrary to the appellant’s arguments, this Court finds that establishing the damages claimed by the claimants did require a study determining the values of the properties before and after the installation of the high-voltage towers, because this information is essential to establish both the claimed damages and the causal relationship between those damages and the administrative action.
The determination of the decrease in price must be made on the basis of the value of the real property before the adverse impact and after the event causing the damage, which cannot be accomplished by comparing the prices of properties belonging to the same Urbanización but not adjoining the high-voltage power lines with those that do adjoin them. In any event, there are no references that would make it possible to determine the actual existence and results of the market studies of homogeneous zones which, according to the authors of the Report, they conducted to support their recommendation of a 50% reduction in the value of the properties for purposes of paying real property taxes. Contrary to the appellant’s argument, there is no evidence of a study by the Ministry of Finance’s technical personnel demonstrating that properties located in the same Dirección4859 and not adjoining the high-voltage power lines did not decline in value relative to those that do adjoin them.
For purposes of proving the damage claimed by the plaintiffs, it is immaterial that the Ministry of Finance officials who conducted the study were experts in the field and were previously familiar with the area, which enabled them to make historical comparisons of property values. For the reasons stated, contrary to the appellant’s argument, this Chamber finds no technical basis supporting the Technical Standardization Body’s recommendation that the plaintiffs’ properties be depreciated by 50%; the grounds for appeal are therefore without merit and must be rejected. 2. AGREEMENT OF THE MUNICIPALITY OF BELÉN. By the agreement adopted at Session No.56-2002, article 19, held on 13 de agosto del 2002, the Municipality of Belén accepted the recommendation of the Public Works Commission and agreed to apply a 50% devaluation reduction to the taxable base (base imponible) of the Real Property Tax (Impuesto sobre Bienes Inmuebles) for the value of land and buildings used for residential and commercial purposes located in the Homogeneous Zone affected by electromagnetic pollution in the Cantón de Belén.
That agreement is based on Report DO231-2002 of 19 de julio del 2002, issued by the Directorate of Operations and Urban Development, which in turn is based on the study conducted by the Technical Standardization Body of the Ministry of Finance, whereby the land valuation platform for the Cantón de Belén was updated and which includes a study of land depreciation due to the electromagnetic field, conducted by Engineers Nombre39925 and Nombre39927. As recorded in the Municipal agreement, through official letter UBI-02-0037 the Real Property Unit reported that, accompanied by Engineer Nombre39927, it conducted a field inspection to determine the circumstances of the properties affected by the electromagnetic field, identifying, among others, the following relevant matters: a)- There are no leases or evictions involving the affected properties in the study area; b)- There is no evidence of activity in the purchase and sale of properties, since most of the parcels have continued to display for-sale signs indefinitely; c)- There is evidence of stagnation in new construction on the affected properties; and d)- The towers supporting the high-voltage lines cause permanent visual pollution.
In essence, the Municipal agreement states that the reason for the land’s depreciation is related partly to the potential effect of electromagnetic fields (EMF) on human health and partly to fears generated by the risk of a structural failure of the towers supporting the high-voltage lines (HVL) due to some external factor, the loss of scenic beauty, and other related matters. As is apparent from the foregoing transcription, although the agreement adopted by the Municipality of Belén indicates that the Real Property Unit conducted a field study whose results have not been substantiated, the fact remains that it is essentially based on the recommendation and findings of the Technical Standardization Body of the Ministry of Finance. As stated in the preceding Whereas clause (Considerando), that study lacks the technical rigor required to determine with certainty the depreciation of properties located within the high-voltage lines’ area of influence and therefore is not useful evidence for proving the damage claimed by the plaintiffs in the proceeding, since it contains a series of deficiencies that prevent proof that the installation of the high-voltage towers caused a 50% decrease in the value of the plaintiffs’ properties.
Contrary to the appellant’s argument, even though the Municipality considered the studies conducted by the Ministry of Finance to contain a scientific and technical basis for declaring a reduction in the taxable base of the real property tax, the Municipality’s assessments are based on the same premises and contain the same omissions and lack of supporting grounds as the study conducted by the Technical Standardization Body. Accordingly, for the same reasons, they do not constitute useful evidence for proving the existence of the pecuniary damage (daño patrimonial) claimed by the plaintiffs in this proceeding. The appellant’s arguments concerning the errors in the lower court judgment regarding the existence and definition of electrical pollution are immaterial to the issue under consideration in these proceedings, because the existence of a magnetic field generated by the high-voltage towers was already determined by the Constitutional Chamber and, in any event, the damage claimed by the plaintiffs in this proceeding is not based on the existence of harm to their health resulting from the installation of the high-voltage towers.
Accordingly, the discussion of this issue and of the possible inconsistencies that, according to the appellant, the lower court Judge committed in this regard is irrelevant to altering the ruling. For the reasons stated, the grounds for appeal asserted by the appellant regarding the rejection of this evidence as proof of the damage claimed in this proceeding are without merit and must be rejected. 3. REGARDING THE EXPERT REPORT. The court-appointed expert appraisal (peritaje judicial) prepared by Architect Nombre39923 (appearing at folios 838 a 1020), together with its supplemental report (folios 1038 a 1058), established as its general objective the determination of the degree to which properties adjoining the high-voltage lines in the la Caja-Belén project were affected and, as its specific objectives, the determination of the impact attributable to distance from the high-voltage power-line protection zone (direct or indirect impact); the impact on the real estate market (impact on the urban landscape and visual pollution); and the impact on health and the environment.
The expert proceeded to determine the unit value of the land and buildings of each claimant’s property, taking into account public utilities, urban infrastructure, the characteristics of the area, the property’s geographical location, its particular characteristics in terms of area, topography, use, degree of development, the supply and demand for identical parcels within the study area, and a detailed investigation of the current values of parcels having the same characteristics. He then prepared a summary of impacts, using as parameters the land value, net replacement value (valor neto de reposición), final value (land value + net replacement value), impact index, and affected final value. With regard to the properties’ impact index, the appraisal recognizes three factors: distance, visual pollution, and human health and healthy environment; the impact index is determined using the following formula: distance factor + visual pollution factor + health factor, with the result divided by three.
The impact index for each property is determined on the basis of the following variables, which apply to each impact factor as follows: an impact percentage of 1 to 0.50 if the property is located at a distance of 20 metros or less from the high-voltage lines; an impact percentage of 0.50 to 0.25 if the property is located at a distance of 20 a 30 metros from the high-voltage lines; and an impact percentage of 0.25 to 0 if the property is located at a distance of 30 metros or more from the transmission lines. As stated by the lower court Judge and endorsed by this Court, the appraisal submitted in these proceedings contains a series of methodological and substantiating inconsistencies that prevent it from being considered suitable and useful evidence for determining the damage alleged by the plaintiffs in this proceeding. Indeed, the appraisal does not reveal the technical or scientific basis supporting the selection of the factors and variables used to define the degree to which the properties’ value was affected.
The appraisal does not state why the properties’ impact index is defined on the basis of the factors of distance, visual pollution, and harm to health and a healthy environment. Moreover, the appraisal does not establish the technical criteria used to determine the variables defining the impact percentage for each factor (1 to 0.50 if the property is located at a distance of 20 metros or less from the high-voltage lines; 0.50 to 0.25 if the property is located at a distance of 20 a 30 metros from the high-voltage lines; and 0.25 to 0 if the property is located at a distance of 30 metros or more from the transmission lines). The foregoing methodological inconsistencies make it impossible to regard this evidence as useful and relevant for proving the existence and individual determination of the damage claimed by the plaintiffs in the proceeding, specifically the decrease in the value of their properties by a percentage of at least 50% of their value as a result of the installation of the high-voltage towers.
For the reasons stated, an analysis by this Court of the appellant’s arguments concerning the lower court judgment’s observations regarding the appraisal’s assignment of the same 50% level of impact to nearly all the properties, as well as regarding the distance and location of the properties in relation to the high-voltage lines and the manner in which each factor and variable used affects each property, would serve no purpose in altering the ruling. For the same reasons, an analysis of the appellant’s allegations concerning the judgment’s observations regarding the existence of the electromagnetic pollution strip and its effect on the assessment of the human-health and healthy-environment factor would be irrelevant to altering the ruling. This is because, although the perception of the potential harm that exposure to this type of pollution may cause to human health could affect the purchasing intentions of potential buyers of the properties, the methodological inconsistencies in the expert opinion (dictamen pericial) make it impossible to determine the effect that this factor might have on the value of the plaintiffs’ properties.
In view of the foregoing, the grievances raised by the appellant regarding the rejection of this evidence to prove the damage claimed in these proceedings are without merit and must be rejected. 4. REGARDING THE JUDICIAL INSPECTION (RECONOCIMIENTO JUDICIAL). As to the record of the judicial inspection, contrary to the appellant’s argument, this evidence is not useful for establishing the causal relationship between the challenged administrative action and the damage claimed by the plaintiffs in these proceedings. This is because, as the trial court correctly notes, such evidence is limited to establishing the state of affairs at the time of the Judge’s visit, but is not suitable for proving that the value of the properties was impaired to the percentage claimed in these proceedings. 5. REGARDING THE WITNESS TESTIMONY. It is the Judge’s duty to assess the various items of evidence presented by the parties in accordance with the principle of reasoned judgment (sana crítica racional), including the witness testimony admitted, and, contrary to the appellant’s argument, the witness testimony admitted into the record does not establish the existence of the damage claimed in these proceedings. a- In the case of the testimony given by Nombre39928 (folios 495 to 497), contrary to the appellant’s argument, the trial court did not disregard it solely because his statements were those of an expert witness (perito) rather than a fact witness, but because his testimony was not useful for establishing the damage claimed by the plaintiffs.
Indeed, the witness merely offers a series of observations, based on his experience as an expert appraiser (perito valuador) for several Institutions and his knowledge of the area, regarding the circumstances that, in his personal judgment, caused a decrease in the value of the plaintiffs’ properties as a result of the installation of the high-voltage towers. The witness states that he held a series of discussions with experts and officials from banks and the Municipalidad de Belén concerning the decrease in property values and the merits of the study conducted by the Ministerio de Hacienda for purposes of reducing the tax base (base imponible) by 50% for the Impuesto sobre Bienes Inmuebles, and that the Municipality took his opinion into account when preparing the value map (plano de valores). As stated by the trial court and endorsed by this Court, the testimony contains a series of deficiencies that prevent it from establishing the existence of the damage claimed in these proceedings.
Indeed, as the basis for his assertions regarding a decrease in the value of the plaintiffs’ properties, the witness merely states that he obtained information from bank appraisers, Tributación Directa appraisers, and banking institutions that purportedly did not accept as collateral properties located in areas with high-voltage lines; however, the witness does not specify his sources, the banking institutions to which he refers, the specific names of the officials and experts who served as his sources, or the technical grounds on which those sources based their assertions. Moreover, he merely states that he served as an Advisor to the Municipalidad de Belén and the Ministerio de Hacienda, but clearly and expressly states that he did not conduct any specific appraisal (avalúo), maintaining that he did so through discussions among experts rather than by conducting expert assessments (peritajes).
In essence, the witness merely offers a series of personal observations—which are therefore subjective because no evidence supports them—regarding the decrease that, in his view, the defendants’ properties suffered as a result of the defendant’s installation of the high-voltage towers. Contrary to the appellant’s argument, the witness’s statement alone is insufficient; there must be some means of verifying the circumstances of manner, time, and place in which he held the discussions with experts and bank officials, so as to determine the technical basis on which those other sources of information concluded that the plaintiffs’ properties had decreased in value and thereby subject those criteria to adversarial examination (contradictorio), allowing the opposing party to address those observations. The witness’s mere statement is therefore insufficient to deem his assertions true. Contrary to what was argued, irrespective of whether the defendant challenged that statement at the time the testimony was given, the Judge has a duty to assess that evidence in accordance with the principles of reasoned judgment, which in no way entails a violation of the principle of procedural preclusion (preclusión procesal).
The fact that the trial court disregarded the witness testimony does not imply any challenge to the witness’s personal or professional standing; in this Court’s judgment, the trial court properly assessed this testimony, which is insufficient to establish the existence of the damage claimed. The witness’s observations concerning the different characteristics of the high-voltage towers as compared with the preexisting power lines, the loud noise that the witness claims the high-voltage towers produce, and the impairment of scenic beauty as factors diminishing the property’s value are merely the witness’s personal opinions, which by themselves fail to establish the existence of the damage claimed by the plaintiffs in these proceedings. Likewise, the witness’s observations regarding the historical comparison between the occasions on which he appraised the properties in Bosques de Doña Rosa are unsupported by any evidence to that effect, because those historical studies were not introduced into the record as evidence. b- As to the statement of the witness Nombre39925 (folios 498 to 499), this Court endorses the trial court’s decision to find that this testimony lacked evidentiary value (valor probatorio), because the testimony is likewise not useful for the relief sought by the plaintiff in these proceedings.
Indeed, the witness merely describes his experience as an expert appraiser for the Ministerio de Hacienda and as an official of the Órgano de Normalización Técnica del Ministerio de Hacienda who, together with Nombre39927, conducted the study measuring the effects of high-voltage towers and lines in the Distrito de Belén, which served as the basis for the Municipality’s declaration of a 50% reduction in the tax base for the Impuesto sobre Bienes Inmuebles applicable to properties located within the high-voltage towers’ area of influence. The witness states that the findings and recommendations were based on an analysis of the Sala Constitucional case file, interviews with persons knowledgeable about the subject, and expert real estate appraisers concerning the impact of electromagnetic fields and their effect on the loss of property value. They concluded that values in the area were significantly lower than in the rest of the zone and that, according to some persons, the properties could be valued within a range of 50% to as little as 25% of their value; accordingly, they chose to recommend 50%, taking into account the loss of the area’s scenic beauty due to the continued presence of the towers, the noise they produced, and interference with radio and television signals.
The witness also states that, during the field study, they consulted experts from the national banking system, who said that they generally did not accept properties affected by high-voltage line fields or located near them because of the difficulty of selling such properties. Contrary to the appellant’s argument, the testimony described does not constitute objective evidence useful for establishing the damage claimed by the plaintiffs in these proceedings. This is because the witness merely confirms the observations contained in the value study that they conducted in their capacity as officials of the Órgano de Normalización Técnica and that served as the basis for the agreement of the Municipalidad de Belén. As stated in this Recital (Considerando), the study conducted by the Órgano de Normalización Técnica contains a series of methodological deficiencies that prevent it from serving as useful evidence of the damage claimed by the plaintiffs, and the testimony given confirms the deficiencies in that study, because neither evidentiary source establishes the technical or scientific basis for recommending a 50% reduction in the value of the plaintiffs’ properties or the reliability of the sources used to formulate that recommendation.
This is because the witness merely states that he held a series of discussions with experts and bank officials concerning the decrease in property values and the merits of the study conducted by the Ministerio de Hacienda for purposes of reducing the tax base for the Impuesto sobre Bienes Inmuebles, but does not describe the circumstances of manner, time, and place that would make it possible to confirm that those discussions occurred or the criteria used to determine the decrease in property values at the percentage stated by those sources. Contrary to the appellant’s argument, the rejection of the testimony is not based solely on the fact that it repeats the study conducted by the witness as an official of the Órgano de Normalización Técnica. The witness’s statement alone is insufficient, because he must properly establish the circumstances (who, where, how, when) in which he held the discussions with experts and bank officials, so that the technical basis on which those other sources of information concluded that the plaintiffs’ properties had decreased in value may be determined and those criteria may thereby be subjected to adversarial examination.
The witness’s observations concerning the different characteristics of the high-voltage towers as compared with the preexisting power lines, the loud noise that the witness claims the high-voltage towers produce, and the impairment of scenic beauty as factors diminishing the property’s value and their effect on the depreciation of the properties are merely the witness’s personal opinions, which by themselves fail to establish the existence of the damage claimed by the plaintiffs in these proceedings. Regarding the appellant’s reference to the content of the testimony of witness Nombre39925, appearing at folio 501, it must be noted that those statements correspond to witness Nombre39927. c- As to the statement of witness Nombre39927, his testimony is likewise not useful for establishing the damage claimed by the plaintiffs in these proceedings. Indeed, the witness merely describes his experience as an expert appraiser at the Ministerio de Hacienda and various Municipalidades throughout the country, including the Municipalidad de Belén, preparing value maps and the homogeneous-zone map (plano de zonas homogéneas), and updating values throughout the Cantón.
According to his testimony, this required him to conduct a field study involving approximately 40 visits. The witness states that, in this case, to determine the value schedule (plataforma de valores) for the area, he took samples of asking prices, completed sales, and consultations with experts—in this case Mr. Roberto Loría, whom he believes to be the Head of Appraisers at Banco de Costa Rica—appraisers from Banco Nacional, real estate agents, officials from the Ministerio de Hacienda, references from previous value schedules, studies in neighboring Cantones, and other references that could assist in determining the value.
He states that, in the specific case, he assessed the adverse effect as a 50% reduction in the value of the properties, considering that there was ample supply and little demand due to the presence of the wiring on the towers, which caused the value to decrease, and that, according to Mr. Roberto Loría, he had appraised properties with wiring problems at as little as 25% of their value. The witness adds that other colleagues at Banco Nacional had also suggested to him that rights-of-way easements (servidumbres de paso) through which electrical wiring ran were no longer accepted as collateral, among other reasons because of the difficulties involved in liquidating these properties when debtors defaulted on payment. He states that when he prepared the first property-value schedule (plataforma de valores), there was no differentiation in values, reduced marketability, offers, or decline in prices as there was on this occasion, because the situation was then that of an ordinary residential development; whereas there was now a difference that affected the value compared with the first study, stemming from the loss of scenic beauty and people’s fear of the electromagnetic field.
Contrary to the appellant’s argument, a detailed analysis of the testimony given does not establish the existence of the damage claimed by the plaintiffs in these proceedings. Although the expert states that he conducted a field study involving more than 40 visits and consultations with various experts from the Ministerio de Hacienda, Banco de Costa Rica, Banco Nacional, real estate agents, references from previous property-value schedules, studies in neighboring Cantones, and other references that could help determine the value, the fact remains that the circumstances of manner, time, and place—who, how, where, and when—under which those consultations were conducted have not been established, nor have the considerations relied upon by those sources in determining the existence of a depreciation in the properties on the terms recommended in the study conducted by the Órgano de Normalización Técnica del Ministerio de Hacienda, in which the witness participated.
As stated in this Considerando, that study suffers from a series of methodological deficiencies that prevent it from being treated as useful evidence to establish the damage claimed by the plaintiffs in these proceedings, and the testimony given confirms the deficiencies of that study because, as noted, neither of the two sources objectively establishes the technical or scientific basis relied upon to recommend a 50% reduction in the taxable base (base imponible) for the Impuesto sobre Bienes Inmuebles with respect to the value of the plaintiffs’ properties, or the reliability of the sources used in formulating that recommendation. It should be noted that, when explaining the reasons why he recommended a reduction in the value of the properties by the stated percentage, the witness merely indicates that he did so on the basis of statements made by Mr. Roberto Loría, who, according to the witness, is an expert appraiser for a state-owned bank, concerning appraisals of properties with electrical-wiring problems that were valued at 25% of their value; however, the expert did not establish which properties were involved, under what conditions, or which parameters were used to determine a reduction in value by that percentage.
He also states that the recommendation was formulated in light of suggestions made by Banco Nacional officials regarding a policy of not accepting as collateral rights-of-way easements through which electrical wiring passed, because of the difficulties in liquidating the properties in the event of default. The reasons provided by the witness lack technical rigor and, in this Court’s view, are insufficient to support a 50% reduction in the value of the properties, because neither the criteria and parameters are objective nor the sources verifiable. For these reasons, this Chamber endorses the trial judge’s reasoning in rejecting this testimony as useful evidence supporting the relief sought by the plaintiffs in the proceedings. The fact that, according to the witness, he had previously conducted appraisals in the same area when he first advised the Municipalidad de Belén in preparing a property-value schedule is of no utility in altering the decision, because the record contains no evidence—other than the witness’s statement—that such studies were conducted or of their results, so that they could be subjected to adversarial scrutiny.
In this Court’s view, the appellant’s arguments concerning the reasons given by the trial judge for discrediting the testimony cannot be accepted, because the judge correctly assessed the witness’s deposition. Likewise, the appellant’s argument that the trial judgment is inconsistent because the judge a quo stated that Mr. Roberto Loría had served as a witness in the proceedings, which is not borne out by the record, is irrelevant for purposes of these proceedings. Although that statement constitutes an error of assessment by the judge, since Mr. Loría was not called as a witness in the proceedings, that consideration has no bearing whatsoever on the ruling regarding the lack of probative fitness of the testimonial evidence offered by the plaintiffs. For these reasons, the witness’s observations concerning the differing conditions of the high-voltage towers in relation to the existing electrical transmission lines, the loud noise that the witness claims is generated by the high-voltage towers, and the adverse effect on scenic beauty as factors that diminish the property’s value are merely the witness’s personal opinions and, standing alone, do not establish the existence of the damage claimed by the plaintiffs in these proceedings. 6.
REGARDING COMPENSATION FOR OTHER PROPERTIES IN THE COUNTRY. The appellant’s arguments that the relief sought at trial should be granted in the judgment because the defendant Instituto has awarded compensation to owners of real property affected by similar projects in San Carlos and Liberia are unfounded, since even if the defendant had awarded this type of compensation, that circumstance does not constitute useful evidence establishing the damage claimed by the plaintiffs in these proceedings. In this regard, the documentary evidence offered (folios 295 and 455 a 479) and the environmental impact study (estudio de impacto ambiental) for the Miravalles-Liberia electrical transmission line (folio 479) do not constitute valid evidence for awarding compensation of the kind sought by the plaintiffs in these proceedings, because they are indirect evidence that is not suitable for establishing the existence of the alleged damage.
Contrary to the appellant’s argument, the evidence relating to compensation paid to owners of properties affected by other projects does not establish the requisite causal relationship (relación de causalidad adecuada) between the administrative action and the damage claimed in these proceedings. In the present case, the record contains no reliable evidence establishing the existence of the damage alleged by the plaintiffs and thus demonstrating the claimed pecuniary damage (daño patrimonial), consisting of compensation amounting to at least fifty percent of the current market value of the respective properties located along the route of high-voltage towers and cables used for the transmission of electrical energy.
Although, in this Court’s opinion, based on principles of experience and logic, it might be reasonable to consider that the installation of high-voltage towers could have a negative effect on the intention to purchase properties located within the project’s area of influence—“purchase desirability”—and therefore on supply and demand (given the existence of a negative visual impact, noise pollution, and buyers’ fear of the potential harm to human health that exposure to electromagnetic fields might cause), the fact remains that the evidence submitted into the record by the plaintiff is insufficient to duly establish the existence of the damages—at least in the form claimed in these proceedings—with respect to the impairment of the value of the properties by a percentage of no less than 50%, as claimed by the plaintiff at trial. Furthermore, it is impossible to defer the determination of the existence of the damage and its quantification to the judgment-enforcement stage (ejecución de sentencia), as the appellant seeks, because, given the nature of the civil claim at issue in these proceedings, even if the quantification of the damage is uncertain, the plaintiff bears the burden of proving the existence of the damage.
This is because, as expressly provided in Article 62(c) of the Law Regulating the Administrative Litigation Jurisdiction (Ley Reguladora de la Jurisdicción Contencioso Administrativa), when compensation for damages or indemnification for losses has been sought, the judgment may make a specific ruling regarding their existence and amount, provided they have been proven in the record; otherwise, it shall be limited to declaring the right, leaving the determination of the corresponding amount to the judgment-enforcement stage. Although the cited provision establishes the possibility of an unliquidated award of damages (condena en abstracto de daños y perjuicios), such an award remains subject to proof of their existence, which the plaintiff has failed to provide in these proceedings through evidence that this Court considers suitable. This prevents the Court from granting in its judgment the claim for compensation sought.
Contrary to the appellant’s argument, the burden of proof (carga de la prueba) regarding the reduction in the value of the properties as a result of the installation of the high-voltage towers does not fall upon the defendant but upon the plaintiffs (the principle set forth in Article 317 of the Code of Civil Procedure (Código Procesal Civil)), because the plaintiffs must establish, through suitable evidence, the existence of the alleged damage and the causal relationship (relación de causalidad) with the administrative action.
Pursuant to Article 98 of the Law Regulating the Administrative Litigation Jurisdiction and Article 221 of the Code of Civil Procedure, applicable to the proceeding at issue (sub-júdice) by virtue of Article 103 of the Law Regulating this subject matter, an award of costs (condenatoria en costas) is imposed upon the losing party by the mere fact of having lost, without such an award implying a finding of recklessness or bad faith. This rule arises from the need to reimburse the prevailing party for the costs incurred in defending a right or interest that the party was required to protect against interference by a third party, or in defending against claims brought against it—costs that the party would not have had to bear had the proceedings not been instituted. Conversely, when payment of those costs is waived, the adjudicator must justify that decision, because it constitutes an exception to the rule.
Exceptionally, the losing party may be exempted from paying either or both categories of costs when it has litigated in evident good faith, when the complaint or counterclaim contains excessive claims, when the ruling grants only some of the fundamental requests in the complaint or counterclaim, when the ruling accepts significant defenses raised by the losing party, or even when each party prevails in part. In the case at hand (sub-lite), this Court considers that, although the plaintiff’s complaint is without merit, there are factors supporting the valid conclusion that sufficient grounds existed to litigate and submit the matter for judicial determination. Indeed, the existence of the Report of the Technical Standardization Body of the Ministerio de Hacienda and the existence of the agreement of the Municipalidad de Belén, which accepted a 50% reduction in the value of the plaintiffs’ properties for purposes of the Real Property Tax (Impuesto sobre Bienes Inmuebles), could constitute factors that reasonably justified submitting to the Courts of Justice the claim for compensation to which the plaintiffs believed those documents entitled them.
Although the plaintiffs’ claims have not been upheld at trial for the reasons stated in the preceding recitals (Considerandos), this Chamber does consider that sufficient grounds existed to litigate and, therefore, to exempt the losing parties from paying costs. Accordingly, the appealed judgment must be reversed solely with respect to the award of costs against the defendants, and the matter must be decided without a specific award of costs.
For the foregoing grounds and reasons, insofar as the matter has been appealed, the appealed judgment must be partially reversed solely with respect to its order requiring the defendants to pay costs, and the matter must be decided without a specific award of costs. In all other respects, the judgment under appeal must be affirmed.

DE: Nombre39913 CONTRA: INSTITUTO COSTARRICENSE DE ELECTRICIDAD No.67-2013-I TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SECCIÓN PRIMERA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. ANEXO A, GOICOECHEA. A LAS NUEVE HORAS TREINTA Y CINCO MINUTOS DEL VEINTIUNO DE JUNIO DEL DOS MIL TRECE.
Se conoce recurso de apelación presentado por parte la actora dentro del proceso ordinario seguido ante el Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, interpuesto por Nombre39913 contra el INSTITUTO COSTARRICENSE DE ELECTRICIDAD. Figura como apoderado especial judicial de los actores Nombre28493 y como apoderada especial judicial de la parte demandada Marcela Segura Salazar. Las calidades de las partes y de sus representantes constan en la sentencia de primera instancia visible a folio 1356 del expediente principal por lo que se omite su reiteración.
RESULTANDO:
1. Que fijada en definitiva la cuantía del presente asunto en la suma de tres millones quinientos veintitrés mil seiscientos treinta dólares, cincuenta centavos (folio 590 del principal), la demanda es para que en sentencia se declaren las siguientes pretensiones de la parte actora: "1. Que el Instituto Costarricense de Electricidad es responsable del daño objetivo causado a cada uno de los actores, consistente en la merma patrimonial en el valor de las propiedades a que se refiere este juicio. / 2. Que en razón de lo anterior, el Instituto Costarricense de Electricidad se encuentra obligado a reconocer y pagar, de manera individual a cada uno de los propietarios de bienes inmuebles que figuran como accionantes en este juicio, una indemnización de al menos un cincuenta por ciento del valor actual de mercado de las respectivas propiedades afectadas, por encontrarse ubicadas frente al paso de torres y cables de alta tensión para el trasiego de energía eléctrica.
Este valor de mercado al que nos referimos sería lógicamente el que tendrían las propiedades junto con sus edificaciones, de no ser por la afectación que produce la vecindad con los cables de alta tensión./ 3. Que el monto exacto de la indemnización correspondiente a cada uno de los actores será determinada en ejecución de sentencia, salvo que se pueda calcular de antemano ese monto en la sentencia principal, caso este último en que dejamos solicitado desde ya la fijación exacta de la indemnización por daños correspondiente a cada actor./ 4. Que el Instituto demandado se encuentra obligado a reconocer intereses, al tipo de ley, a partir de la firmeza de la sentencia. / 5. Que el Instituto accionado deberá reconocer ambas costas del proceso” (folio 126 del expediente judicial).- 2. Que el Instituto Costarricense de Electricidad, contestó negativamente e invocó la defensa de falta de derecho y la expresión “sine actione agit” (folios 509 a 541 de los autos).
3. Que el Licenciado Greivin Steven Mora Alvarado, Juez del Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, en la sentencia No.1149-2012, dictada a las nueve horas cinco minutos del veintiocho de mayo del dos mil doce dispuso: " POR TANTO: En virtud a los hechos probados, citas de derecho invocadas y argumentos esgrimidos en la parte considerativa de esta resolución, se determina: Declarar sin lugar las defensas de falta de legitimación activa por improcedente, así como la de sine actione agit por inexistente, todas presentadas por el demandado. Entiéndase denegada cualquier acción no concedida de forma expresa.- Se condena a los vencidos al pago de las respectivas costas personales y procesales a favor del vencedor.-" (folios 1356 a 1373 del principal).
4. Que inconforme con lo resuelto, apeló la parte actora, recurso que fue admitido mediante resolución dictada por el Juzgado Contencioso Administrativo y Civil de Hacienda a las once horas y veintisiete minutos del trece de junio del dos mil doce, en virtud del cual conoce éste Tribunal de alzada (folios 1375 y 1379 a 1410 del legajo de segunda instancia).
5. Que en los procedimientos no se observan vicios y omisiones que generen la nulidad de lo actuado, por lo que por unanimidad, se procede a dictar el fallo de segundo grado dentro del plazo que permiten las labores del Despacho, previas las deliberaciones de rigor.
Redacta el Juez Jiménez Villegas; y
CONSIDERANDO
I.Por corresponder al mérito de los autos y ser conteste con los elementos de convicción que en su apoyo se citan, se aprueba el elenco de hechos probados y No Probados contenidos en la sentencia recurrida.
II.Señala la parte actora en sustento de su recurso de apelación que la resolución apelada adolece de un grave vicio de apreciación jurídica. El proceso judicial se formula a consecuencia del daño patrimonial sufrido por los accionantes, con ocasión de un conjunto de variables que influyen en la depreciación de las propiedades que se encuentran frente a un tendido de cables de alta tensión, instalado por la parte demandada en la comunidad conocida como Bosques de Doña Rosa. Indica que las pruebas que la parte actora procuró dentro del expediente tuvieron como fin demostrar el daño específico de la pérdida de valor patrimonial de las propiedades, y su relación de causa efecto con la instalación de las torres y los cables por parte del ICE. A este efecto se trajo prueba de la Municipalidad de Belén, de la Dirección de Tributación del Ministerio de Hacienda, del perito judicial nombrado por los mismos tribunales de justicia, junto con la declaración testimonial de las personas que en su criterio se encuentran mejor calificadas en Costa Rica para realizar valoraciones de bienes, como son los peritos del Ministerio de Hacienda.
Además, se cuenta dentro del expediente judicial con el reconocimiento judicial y con prueba documental abundante sobre el reconocimiento del daño patrimonial, por parte del ICE, en otras comunidades de Costa Rica, similar al ocasionado a los actores. Por su parte, el demandado no ha presentado ninguna prueba para descartar el daño patrimonial, limitándose a alegar que antes de que se instalaran los cables y torres de alta tensión ya existía un tendido eléctrico en el mismo sitio donde luego se construyeron las obras, de modo que los vecinos no podían alegar luego un daño por el hecho de que se construyera una nueva estructura, siendo que esta argumentación ha sido desvirtuada con la declaración de un funcionario de la misma institución, quien remitió a los autos la contestación de un cuestionario elaborado por la parte actora, donde reconoce que el tendido anterior era una simple línea de distribución, muy distinta en dimensiones y capacidad de transporte de energía eléctrica, a la obra que finalmente se construyó (ver interrogatorio de Ing. Edwin Bogantes Villegas) así como con las declaraciones de otros testigos.
Además, la parte accionante, aportó a los autos un conjunto de fotos, respaldadas también en testimonios de personas que conocen la historia del tendido anteriormente existente en la Urbanización, para demostrar la diferencia monumental entre la obra que había con anterioridad y la que se construyó luego. Argumenta que el Juez de primer instancia, modificando el objeto de la discusión, y cayendo en una especie de trampa dialéctica tendida por la propia accionada cuando respondió la demanda, transforma la discusión principal de este proceso, de modo que en lugar de determinar si existe un daño patrimonial, decide que la discusión judicial debe girar en torno a si en el sitio donde viven los accionantes se encuentra o no una zona de contaminación electromagnética. Cuando el Instituto accionado contestó la demanda, a falta de argumentos con los cuales rebatir los estudios de mercado y las valoraciones que habían realizado los técnicos del Ministerio de Hacienda, optó por entrar a discutir un tema totalmente diferente, como era si el tendido y torres de alta tensión producían un daño a la salud, y si por tanto existía una posibilidad de daño físico a los propietarios de los terrenos colindantes con la nueva obra construida.
En consideración del apelante, esta discusión ya se había dado ante la Sala Constitucional, dentro del expediente No. 97-006785-007-CO, que dio paso a la sentencia No. Placa7232, de de las 14:30 horas del 28 de abril de 1998. En este sentido, durante el proceso esa representación había señalado que la discusión aquí era otra, pues de lo que se trataba era de demostrar si como consecuencia de una obra que tiene torres de doce metros de altura, ubicadas a una distancia de entre diez a doce metros de las propiedades de los actores ( ver inspección ocular a folio 712 del expediente judicial), y del temor que este tipo de obras crea dentro del público en general, sumado a otros problemas que acarrean las torres, como es la pérdida de belleza escénica, el ruido que genera el paso de la corriente, ello había generado una pérdida en el valor patrimonial de los terrenos y de las casas. Indica que el fallo aquí impugnado decide espigar dentro de la prueba recabada, tanto documental como testimonial, si de la misma se desprende la existencia de un campo electromagnético que cause un daño a la salud de los pobladores, concluyendo que eso no se ha demostrado, por lo que el daño tampoco se ha acreditado.
Señala que de acuerdo con lo dispuesto en el artículo 190 de la Ley General de la Administración Pública, lo que la sentencia debía haber determinado era si había un daño excepcional en el patrimonio de los actores, y si estamos ante un interés legítimamente protegido. A este respecto, la jurisprudencia costarricense ha sido enfática en señalar que la antijuridicidad de la actuación de la Administración, cuando se trata de la conducta normal de la Administración, proviene de la existencia de una carga excepcional en el patrimonio de los actores, el cual éstos deben soportar en solitario. Se trata de una situación, en el caso de los accionantes definida a partir de una obra que beneficia a todo el país, y especialmente a la empresa INTEL, la cual utiliza prácticamente en su totalidad la energía que trasiega por las torres y cables de alta tensión que atraviesan Bosques de Doña Rosa. Añade que conforme lo ha considerado la Jurisprudencia de la Sala Primera de la Corte Suprema de Justicia, se considera como antijurídica, la conducta legítima de la Administración que produce un sacrificio especial en el administrado, sin que resulte necesario demostrar un daño específico más allá de ese sacrificio excepcional, desde el momento en que el sacrificio mismo constituye el daño que sirve como premisa menor para construir el sinalagma jurídico del artículo 190, procediendo a transcribir parte del voto que sobre el tema emitió la Sección Segunda del Tribunal Contencioso Administrativo, Voto N° 139 de las diez horas cincuenta minutos del veinte de julio del dos mil cinco, respecto del tema de la responsabilidad administrativa sin falta o por sacrificio especial en el que el administrado recibe un daño especial, anormal, que no está obligado a soportar, pues ello vulneraría el principio de igualdad ante las cargas públicas.
Indica el apelante que en el fallo cuestionado, el a quo, busca infructuosamente otro daño distinto del sacrificio sufrido por los actores, y pretende que ese daño -de existir- tendría que ser la contaminación electromagnética, la cual incluso entra a definir, de manera subjetiva, restándole toda importancia a cualquier otro elemento de juicio que pudiera demostrar la relación de causa efecto entre la pérdida patrimonial y las obras construidas por el ICE. En consideración del apelante el fallo incurre en una terrible falta desde el punto de vista del equilibrio procesal, de exonerar al ICE de su obligación de demostrar que la pérdida patrimonial de los actores se debe a otras razones distintas de la obra que fue construida por esa institución, violentando lo dispuesto en el artículo 317 inciso dos del Código Procesal Civil. En consideración del apelante, el a quo le facilita en demasía la labor al ICE, pues por un lado lo exime de probar que el daño existente y comprobado en las propiedades de los actores se debe a las obras que construyó en la zona, para luego determinar que los actores no probaron lo que no estaban obligados a demostrar, como podría ser, la existencia de un campo electromagnético en la zona.
Pareciera entonces que al Juez de Primera Instancia no le basta con la carga excepcional sufrida por los actores, de modo que busca en vano otra forma de antijuridicidad, tal como si se tratara de encontrar un año daño subjetivo en el que existe la participación de un agente que ilegítimamente causa el daño. Procede a citar la sentencia No. 584 dictada por la Sala Primera de la Corte Suprema de Justicia a las diez horas cuarenta minutos del once de agosto del año dos mil cinco, en la que en esencia se considera que para la existencia de un derecho de reparación ha de existir antijuricidad antecedente de base que en modo alguno apunta a la naturaleza (legítima o ilegítima) de la conducta desplegada por el agente productor del daño, ni por el resultado que produce dicha acción u omisión, pues aún en los supuestos de funcionamiento legítimo y normal, en los que no existe ilicitud en el comportamiento, se produce una consecuencia dañosa que con determinadas características (intensidad excepcional o pequeña proporción de afectados), se reputa como de obligada reparación, pues con la lesión misma surge la obligación civil y su consecuente derecho de accionar.
Indica que la sentencia impugnada, una vez definido que el daño a localizar consiste en una presunta contaminación electromagnética, afirma que en el voto de la Sala Constitucional de 28 de abril de 1998, se desestimó la existencia de contaminación electromagnética, de donde le resulta muy fácil desarrollar el resto del fallo, pues le basta señalar que no hay un daño probado y que la prueba recabada no lo demuestra. Pero además, se atreve el fallo en cuestión a realizar una afirmación realmente temeraria, visible al folio 1362 vuelto, Considerando VII, cuando señala que: “…vistas las manifestaciones de ambas partes en torno a que no se cuestiona como indican los actores la afectación de la salud, se debe partir de la premisa que no existe contaminación electromagnética comprobada”. Considera el apelante como un atrevimiento del fallo inferir que por el hecho de que la parte actora haya señalado reiteradamente que en este juicio no se discute la existencia de un daño en la salud de las personas, sino una pérdida patrimonial, de allí debamos concluir que entonces los actores están de acuerdo en que no hay contaminación electromagnética.
Se trata de una inferencia arbitraria, pues mal interpreta la posición de una de las partes del juicio, fundándose en aspectos de apreciación meramente subjetiva. Procede el apelante a realizar una serie de consideraciones con relación al tema de la contaminación electromagnética, concluyendo que tanto el término de contaminación, como el de contaminación electromagnética son muy amplios, al punto de que bien podría afirmarse que la presencia de cualquier agente externo a un medio natural es un potencial contaminante. En segundo término, y para los efectos del proceso, es lo cierto que la Sala Constitucional, en el voto antes referido, no entró a definir lo que era un campo electromagético ni entró a determinar si en el caso del tendido de cables de alta tensión que transitan por la Dirección4859 había o no un campo electromagnético contaminante para los vecinos. La Sala Constitucional se abstuvo de entrar a hacer estas valoraciones, sabiendo que existen en la literatura científica posiciones contrarias sobre el tema.
Indica el apelante que lo que la sentencia dictada en el Recurso de Amparo establece entonces es que con las investigaciones científicas existentes a la fecha, no se podido probar aún que exista una asociación entre la exposición a la energía producida por los cables de alta tensión y la salud humana. Aunque discrepa de esa conclusión, se puede decir que de la misma no se deriva que en Bosques de Doña Rosa y en cualquier otra parte del mundo no sea posible deslindar un campo de afectación electromagnética, entendiendo que cualquier agente externo al medio ambiente, como es la energía eléctrica trasegada en grandes cantidades, puede tener un efecto potencialmente dañino en el ser humano. Indica que aquí no interesa si el efecto dañino está probado o no, lo que interesa conocer es si resulta posible medir una zona de afectación, donde por el riesgo de contaminación resulta prudente contar con una zona de alejamiento.
La reglamentación del tema respecto de la distancia de las casas de habitación y los cable de alta tensión, es un tema importante, por el hecho de que todas las personas que viven o lleguen a vivir en la proximidad de los cables de alta tensión saben que no se encuentran en la misma condición del resto de habitantes del país, pues potencialmente puede existir un riesgo a su salud, de modo que aunque no esté probado ese daño, el solo temor al riesgo de vivir allí es suficiente para considerar su situación subjetiva, como diferente a la de otras personas. Añade que en el caso bajo examen, existen elementos objetivos para definir lo que se ha denominado "zona de afectación” o de riesgo potencial, que fueron definidos por la propia Sala Constitucional que conciente del riesgo potencial de los vecinos que habían interpuesto el recurso de amparo, definió una serie de medidas concretas en su directa protección.
Así, en el voto de las 14:30 horas del 28 de abril de 1998, estableció una limitación a la cantidad de energía que podía trasegarse por los cables de alta tensión, pero además una permanente vigilancia epidemiológica en el área geográfica donde se ubica la línea de trasmisión de alta voltaje. Más aún, en vista de que la sentencia no era clara en cuanto a los límites que imponía y la zona de afectación protegida, mediante una posterior resolución de las 14:38 de 28 de octubre de 1998, ante recurso de aclaración y adición presentada por los interesados, indicando que las mediciones de intensidad deben ser realizadas en el exterior de la línea de construcción de las casas de habitación de los amparados. Con ello se terminó de ubicar la zona de afectación, que vinculó con “el área relacionada con el recurso” (concepto indeterminado que usó la Sala Constitucional en el Por Tanto del primer voto), referido a las propiedades de los amparados, que son básicamente las mismas personas que luego han presentado este proceso judicial, por vivir directamente al frente a la línea de trasmisión, hecho que no fue rebatido por el Instituto Costarricense de Electricidad durante el proceso, y que además se desprende de la Inspección Ocular que se realizó en este expediente.
Así, en el Hecho 18 de la demanda, los accionantes se refirieron a su ubicación frente a los cables de alta tensión, guardando el ICE silencio al respecto. Por su parte el informe pericial de Nombre39923 , recabado en este expediente, permite realizar esa ubicación. Indica que resulta aún más importante que en el fallo de abril de 1998, en su parte dispositiva, la Sala Constitucional reconoce la existencia de un campo magnético en el lugar donde viven los amparados, cuando se refiere a la obligación del ICE de comunicar a la Municipalidad y a los vecinos, sobre las mediciones que haga del “campo magnético”, por lo que sí existe un campo magnético de afectación, que incluso debe estar constantemente monitoreado por el ICE, y donde hay una población afectada sobre la cual el Ministerio de Salud debe hacer permanentes estudios epidemiológicos. Reitera que para los efectos de este proceso, no interesa si está demostrado o no que ese campo magnético del que habla la Sala Constitucional, y que a la postre es un concepto asimilable al de campo electromagnético afecta o no la salud.
Ese es un tema que se seguirá discutiendo por muchos años, no definido aún en la literatura científica. Lo que interesa aquí es que hay un campo magnético de afectación, el cual coloca a los vecinos de la obra generadora de ese campo, en una situación diferente a la de otros habitantes de este país. A fin de que no quede duda de esa situación diferenciada con la que deben vivir las personas que actualmente habitan o puedan llegar a vivir en el futuro, en la colindancia de los cables de alta tensión que construyó el ICE en Bosques de Doña Rosa, y del temor con el que deben vivir permanentemente, haciendo mención a los estudios más recientes de la Organización Mundial de la Salud, sobre el tema de la potencial afectación a la salud de dichas obras de infraestructura, preocupación que tiene una relación directa con el valor de los inmuebles, pues quién va a querer comprar casas que se encuentran a diez o doce metros de las líneas de trasmisión eléctrica a los que hacen referencia los estudios científicos mencionados, si no es a precios reducidos.
La sentencia apelada, aparte del tema de los campos magnéticos y su afectación a los accionantes, no analizó otros factores de gran importancia para determinar el valor de un bien inmueble, en Costa Rica o en cualquier otra parte del mundo, como son: el ruido que producen, la pérdida de belleza escénica, las limitaciones para los niños e incluso adultos para utilizar una zona de parque, que antes era también zona de juego y el miedo que produce, ya no la contaminación eléctrica eventual, sino el vivir frente a estructuras de tan grande magnitud, ancladas en las puertas de salida de las casas. II. Análisis de la prueba recibida en el juicio. Señala el apelante que el fallo aquí cuestionado, el señor Juez de Primera Instancia ha utilizado un sistema de libre convicción en la apreciación de la prueba, guiándose prácticamente por un convencimiento meramente subjetivo de la misma, y en algunos casos fallando contra la prueba recibida.
En su consideración, esa forma de apreciar la prueba tiene también una íntima relación con la definición que previamente hizo el a-quo de cuál era el daño que debía buscar en el expediente, lo cual le impide analizar la prueba recibida en términos de si: a) está demostrado o no que los actores han sufrido una pérdida patrimonial y b) si existe relación de causa efecto entre ese sacrificio particular y las obras construidas por el ICE a que se refiere el juicio. Esto no fue lo que buscó el Juzgador, de modo que es lógico también que nunca lo pudiera encontrar. Indica que resulta importante recalcar que posiblemente hubiera sido factible traer a los autos prueba de corredores de bienes inmuebles o de otros vecinos de la comunidad afectada que se refirieran al daño patrimonial sufrido por los accionantes. También se pudo haber presentado la declaración de eventuales compradores, en cuyo ánimo hubiera pesado la cercanía de las propiedades de los actores con las torres de alta tensión.
Ello sin embargo hubiera introducido en el expediente un elemento de subjetividad que curiosamente extraña la sentencia. La parte actora prefirió recurrir a pruebas mucho más objetivas e independientes, como podía ser el estudio realizado por el Órgano de Normalización Técnica de la División de Tributación del Ministerio de Hacienda, denominado “Actualización de la Plataforma de Valores de Terrenos. Cantón de Belén”, de junio de 2001, el cual aparece visible a los folios 239 a 343 del expediente; las determinaciones tomadas por la Municipalidad de Belén en cuanto a la valoración de las propiedades de los actores, tomado en la Sesión Ordinaria No.56-2002, del 13 de agosto de 2002, en la cual precisamente se acordó aplicar un 50% de devaluación al valor de los terrenos y construcciones para vivienda y comercio ubicados en la zona homogénea afectada por la Contaminación electromagnética en el Cantón de Belén (ver documento del señor Ing. Hermis Murillo Zúñiga, Coordinador de Bienes Inmuebles de la Municipalidad de Belén, folios 503 a 505); y el estudio pericial ordenado por las mismas autoridades judicial, realizado por el Arquitecto Nombre39923 (folios 538 a 717), junto con su ampliación (folios 736 a 756).
Pero además, se llamó a declarar como testigos a dos personas que son funcionarios públicos, cuya especialidad es precisamente la valoración de bienes y la realización de estudios de mercados de bienes inmuebles, y a un Ingeniero Agrónomo que tiene la doble virtud de ser perito en materia de valoración de bienes inmuebles y de ser vecino desde hace muchos años de la comunidad afectada. Las probanzas anteriores aportan suficientes elementos de juicio para demostrar la existencia del daño sufrido por los actores, su individualización, su cuantificación y su relación con las obras realizadas por el ICE en Bosques de Doña Rosa a partir del 5 de enero del año 1998, lo que ha sido reiterado en el escrito de conclusiones y en los recursos que ya se han presentado ante el Tribunal Superior, las veces que el expediente ha venido en apelación, por defectos de las sentencias de primera instancia dictadas en el asunto.
En consideración del apelante, existe un daño objetivo y la prueba es absolutamente conteste al respecto. Lo que sorprende entonces es la forma en que la sentencia de primera instancia descarta todos y cada uno de los elementos probatorios que confluyen hacia una misma conclusión, introduciendo una serie de apreciaciones subjetivas, más propias de litigantes o de personas ajenas al proceso, que de una autoridad judicial. Señala que llama la atención también que a folio 1363 del expediente, el señor Juez de Primera Instancia realice una cita de la sentencia de la Sala Primera, donde se indica que el daño no pierde esta característica si su cuantificación resulta incierta, indeterminada o de difícil apreciación o prueba, cuando acto seguido somete la prueba de la parte actora a una serie de criterios arbitrarios, sin tomar en cuenta los esfuerzos probatorios que se han realizado para traer a los autos probanzas de la más alta objetividad e independencia técnica, de cara a una parte demandada que no tuvo el menor interés de traer contraprueba al expediente.
Respecto del documento emitido por el Órgano de Normalización Técnica de la División de Tributación del Ministerio de Hacienda, denominado “Actualización de la Plataforma de Valores de Terrenos. Cantón de Belén”, la sentencia comienza atacando dicho documento, por el hecho de haber definido una zona de contaminación eléctrica “sin exponer la forma en que se llega a tal resultado”. De entrada, habría que rebatir esta última aseveración, pues los autores del estudio, los ingenieros Nombre39925 . y Nombre39927 , sí justificaron el uso de esa terminología, cuando elaboraron un documento, anexo al Estudio de Valores todo el cantón, el cual resulta ser específico sobre la Zona de afectación que ellos clasificaron como Z03-CE. El estudio que aparentemente no leyó de manera completa el señor Juez de Primera Instancia, viene como un Anexo 7 del documento integral, y se titula “Devaluación de Terrenos en el Cantón Belén por efecto del campo electromagnético”, documento que fue aportado al expediente por la parte actora, junto con la prueba adjunta a la demanda inicial.
Se trata de un estudio muy serio, con cita abundante de fuentes bibliográficas, así como de cuadros estadísticos, que podrá no compartir el a-quo , pero que fue elaborado por técnicos en la materia, frente a cuya opinión él no tuvo a la vista ningún estudio pericial que demostrara lo contrario. Su único apoyo para contradecir los estudios del Anexo No.7 referido es la sentencia de la Sala Constitucional, la cual se opondría a las aseveraciones contenidas en el susodicho anexo solamente en cuanto a las conclusiones sobre los efectos en la salud, pero no en otros aspectos, como es la existencia de una zona de afectación, a la que la misma Sala Constitucional identificó como una zona determinada por el “campo magnético”. Una mejor lectura de esta última sentencia le hubiera permitido seguramente al Juez de Primera Instancia entender que sí existe un área de contaminación, entendida como área de afectación por el campo magnético generado por el tendido de cables de alta tensión construido por el ICE, independientemente de que se le denomine zona de contaminación eléctrica o se le quiera llamar de otra manera.
En cualquier caso, nadie puede negar que era competencia de los peritos del Ministerio de Hacienda entrar a delimitar esa área, con los criterios que ha determinado la ciencia y la técnica, que ellos dominan, si es que la sentencia de la Sala Constitucional no entró – porque no le correspondía- hacer una medición matemática de tal área. Además, señala el apelante que resulta fundamental señalar que la existencia de un campo magnético generado por los cables de alta tensión y su potencial afectación de la salud, no fue el único elemento de juicio que tomaron en cuenta los peritos del Ministerio de Hacienda en el documento reseñado ( visible a los folios 323 a 339 del expediente), lo cual luego confirmaron en sus declaraciones testimoniales. Así, en el epígrafe ...203 del documento principal, donde se describe la Zona Z03-CE, se señala lo siguiente: “De acuerdo con la investigación de mercado, el efecto contaminante de las líneas eléctricas, los valores deben ser devaluados en un 50% del valor del inmueble”.
Posteriormente en el documento titulado “Devaluación de Terrenos en el Cantón de Belén por efecto del Campo Electromagnético”, sea en el Anexo 7 del que se viene haciendo referencia, se encuentra un párrafo en el cual se explica mejor las razones por las cuales se llega a la conclusión que permitió deslindar el área o Zona Z03-CE. Al respecto señala el Anexo lo siguiente: “La razón por la que se devalúa el terreno en esta situación está relacionada en parte con el potencial efecto de los campos electro magnéticos (CEM) en la salud humana y en parte con los temores generados por el riesgo de una falla estructural de las torres que sostienen las líneas de alta tensión (LAT) debida a algún factor externo, por la pérdida de belleza escénica y por otros aspectos relacionados”. En complemento con lo anterior, en la aparte del Anexo 7 subtitulado “Devaluación del Valor de los Terrenos”, los autores mencionan una serie de entrevistas de personas conocedoras, interpeladas por ellos, las cuales demuestran la realidad de la pérdida de valor patrimonial de las propiedades en la línea de colindancia con el tendido de alta tensión.
A contrapelo de la unilateralización de un solo elemento de análisis que ha interesado al Juzgador en el fallo impugnado, los peritos del Ministerio de Hacienda que elaboraron el documento para la Municipalidad de Belén, antes referido, y que declararon como testigos en el proceso, tomaron en cuenta diversos factores para llegar a las conclusiones a que arribaron sobre la pérdida de valor patrimonial, pues realizaron un estudio de mercado en la zona, materia en la que son expertos y sobre la que el Juez del Despacho no es conocedor. En este sentido, el análisis que realiza la sentencia, según el cual se demerita el estudio realizado por el Ministerio de Hacienda, en razón de que no se está de acuerdo con la definición de una zona de contaminación eléctrica, resulta excesivamente simplista a la vez que injusto. No es posible desechar de golpe los análisis de técnicos en la materia, las investigaciones de mercado que realizaron, ni se puede perder de vista que aún la Sala Constitucional, sin entrar a definir un área de afectación, porque no le correspondía, en la práctica lo hizo, precisamente en protección de los vecinos de la zona y de sus familias.
Es tan subjetivo el análisis sobre el documento, realizado en primera instancia, que se llega a dudar del aparato empleado por los técnicos del Ministerio de Hacienda para medir la intensidad del campo electromagnético, o la capacidad de dichos técnicos para hacer las mediciones, al punto de ignorar que los profesionales autores del estudio son ingenieros y que están capacitados para dar un criterio científico. Seguramente el señor Juez no conoce que el instrumento usado en estos casos, denominado “gausímetro”, es un aparato sencillo que los mismos vecinos de Bosques de Doña Rosa han adquirido por colecta pública. No es necesario pertenecer al Ministerio de Salud para hacer esas mediciones. Las puede hacer un profesional con mínimos conocimientos científicos, y con mucha mayor razón un profesional del Ministerio de Hacienda. La subjetividad del Juez y su desconocimiento de la materia llega al extremo cuando critica que en las mediciones realizadas por los autores del Anexo 7 hay una contradicción porque existen dos lecturas distintas en la línea de construcción.
Lo que el Juez de Primera Instancia ignora, porque evidentemente él no conoce de esta materia, es que durante el día la intensidad del campo magnético varía, de acuerdo con la cantidad de energía que se esté trasegando en ese momento. En este sentido, añade, se debe recordar que la Sala Constitucional lo que le impuso al ICE fue un máximo de energía que podía ser transportada por los cables de alta tensión, siendo el ICE quien determina, de acuerdo con los picos de demanda que haya durante el día, la cantidad trasegada. Nótese que ni siquiera el Instituto Costarricense de Electricidad, como institución técnica en la materia hizo reparos de carácter técnico como los que realiza el Juez en la sentencia, quien atreviéndose a incursionar en un campo del que no es experto, y sin contar con pruebas periciales que se contrapongan al criterio de los técnicos, entra a valoraciones ilógicas y acientíficas.
Se trata sin más de una violación a las reglas de la sana crítica, y por tanto de lo dispuesto en el artículo 330 del Código Procesal Civil, 103 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa y 220 del Código Procesal Contencioso Administrativo. Para la sentencia de primera instancia, todo el estudio de mercado está errado, al partir – supuestamente- de una premisa errónea. Pues bien, aparte de que la premisa no es equivocada, tampoco es correcto ignorar que en un estudio de mercado se han tomado en cuenta factores tales como el temor en la población de una obra que aparte de su tamaño y de su magnitud podría potencialmente crear daños en la salud, la pérdida de belleza escénica, factor que siempre se toma en cuenta en cualquier estudio de mercado, y otros factores concomitantes. Señala que aún cuando el daño en la salud no sea un hecho comprobado, el solo temor por las informaciones contradictorias sobre el tema, según lo atestigua la página web de la propia Organización Mundial de la Salud, genera un ambiente negativo hacia las propiedades ubicadas en la colindancia de las líneas de trasmisión, que necesariamente va a influir en su valor.
La sentencia de primera instancia hace caso omiso de todos estos factores adicionales, debido a la forma en que unilateraliza la discusión, sobredimensionando y mal interpretando un solo factor de riesgo. En su afán por debilitar la prueba que presentaron la parte actora, el a quo pretende dar lecciones a los técnicos del Ministerio de Hacienda de cómo debe hacerse un estudio de mercado, indicando que las entrevistas debieron haberse consignado documentalmente, que falta un estudio de muestras y que no existen datos del valor de las propiedades antes ni después del proyecto en cuestión. Como lego en el tema, y como representante de personas que son igualmente legos en la materia, se debe partir de que los técnicos del Ministerio de Hacienda conocen su trabajo, igual que la conoce el perito Nombre39923 , nombrado por el Poder Judicial para intervenir en este asunto, y quien coincide en lo fundamental con los criterios del Ministerio de Hacienda.
Considera el apelante que las entrevistas no requieren de un apoyo documental si fueron efectivamente realizadas por las personas indicadas para esa labor, y que no es necesario hacer un muestreo, desde el momento en que toda la zona afectada corre paralelamente frente a la línea de cableado. Seguramente el señor Juez no leyó tampoco la Inspección Ocular que obra en autos ni estudió los mapas que contiene el documento elaborado por el Órgano de Normalización Técnica del Ministerio de Hacienda, según los cuales las propiedades afectadas se encuentran ubicadas frente a un boulevard, que es zona de parque y que atraviesa la Urbanización de Bosques de Doña Rosa de sur a norte. Además, la línea de construcción es la misma para prácticamente todas las cosas, excepto unas casas, cuya distancia determinó el perito Nombre39923. Por tanto, todas las propiedades, sin necesidad de muestreo, reciben el mismo impacto.
A mayor abundamiento, el perito Nombre39923 sí realizó un trabajo de individualización de daños, donde puede verse alguna variación entre la afectación de una propiedad u otra, de modo que si el estudio del Ministerio de Hacienda no llegó al detalle de individualizar un daño prácticamente igual para todos los actores, el perito nombrado en los autos sí lo hizo. Considera el apelante que no era necesario hacer un estudio de valores antes y después, porque el Ministerio de Hacienda realizó un estudio de valores de todo el cantón, incluida la Urbanización Bosques de Doña Rosa, de modo que existe un elemento objetivo de comparación entre precios, al poder confrontar por ejemplo los precios de los bienes inmuebles que pertenecen a Bosques de Doña Rosa, pero que no se encuentran en la colindancia del tendido de cables de alta tensión, con los que sí tienen esta última condición. Así, conociendo el valor del metro cuadrado de terreno en la Urbanización, así como del valor de metro de construcción de cada casa (cálculo que hizo el perito Nombre39923 ), es posible compararlo con el precio disminuido que encontraron los técnicos del Ministerio de Hacienda al realizar su estudio de mercado.
Por lo demás, dos de los testigos, quienes declararon dentro del expediente, los señores Nombre39928 y Nombre39927 , sí conocían la zona de previo, lo cual les permitió realizar comparaciones históricas que el Juzgador no tomó en cuenta. Concluye señalando que no es que en los autos no se hiciera un estudio de mercado de bienes inmuebles para sustentar la creación de la Zona Z03-CE, que es la zona a la que pertenecen los actores. Lo que sucedió es que ese estudio no gustó al Juzgador de Primera Instancia, quien hubiese preferido que el estudio se realizara de otra manera. Llegado este punto, habría que partir de que los expertos en la realización de estudios de mercado son los peritos del Ministerio de Hacienda, y en los autos no existe un peritazgo que contradiga el que ellos hicieron. Todo lo contrario, el peritazgo ordenado por los Tribunales de Justicia, confirma y detalla el trabajo realizado por el Ministerio de Hacienda.
Por su parte el acuerdo de la Municipalidad de Belén, mediante el cual se disminuyó la base imponible del impuesto sobre bienes inmuebles de la propiedad de los actores en un 50% tampoco mereció ninguna apreciación en el camino de demostrar el daño causado a los actores. Al respecto, la sentencia manifiesta un aspecto obvio, como es que esa prueba no resulta vinculante para el Instituto demandado. La idea de esta prueba sin embargo, no fue captada por el Juzgador, pues se trata de que los tribunales tengan en cuenta que una institución seria y de carácter público ha entendido que los estudios realizados por el Ministerio de Hacienda son lo suficientemente convincentes y científicamente relevantes, como para tomar una decisión que beneficia a los sujetos pasivos del impuesto de bienes inmuebles y que afecta, en alguna medida, las arcas municipales. Pero además, se trata de una prueba la cual revela que, hechas las propias valoraciones por la Municipalidad, y sus técnicos, ésta llega a la misma conclusión sobre la existencia de una zona de afectación a la cual pertenecen un grupo específico de vecinos del Cantón.
Fiel al unilateralismo que caracteriza toda la sentencia, se desacredita por completo el acuerdo de la Municipalidad de Belén, simplemente porque tomó en cuenta como factor importante para su decisión la misma zona de contaminación eléctrica que establece el estudio del Ministerio de Hacienda. Llega el Juez en esta parte de su fallo a introducir una definición de contaminación que no está en ninguna legislación ni en una obra científica a la que pueda echar mano. Para contradecir el criterio de la Municipalidad, señala el Juzgador que la contaminación implica un daño biológico a las estructuras vivientes, siendo en el ser humano provocado por afectaciones a la salud, confundiendo el objeto de este proceso, haciéndolo recaer en un supuesto reclamo sobre la salud de los actores, siendo que ni siquiera la Sala Constitucional, con todas las pruebas que recibió en el expediente del Recurso de Amparo referido, incluida prueba pericial que ignoró de la Medicatura Forense del Poder Judicial, se atrevió a definir lo que es contaminación, lo cual hace el Juez a-quo sin ningún respaldo científico más que en su libre convicción.
Pero además, entiende el Juez que este juicio de conocimiento es algo así como una extensión de lo ya discutido en el Recurso de Amparo, de modo que suma y resta pruebas para concluir que no encuentra afectación a la salud de los accionantes, incurriendo en una confusión en el manejo del tema, pues las definiciones de “contaminación” que se manejan a nivel mundial e incluso etimológicamente, son más amplias que las utilizadas por el Juzgador, pues contemplan como contaminación cualquier alteración del medio ambiente que introduzca elementos dañinos o potencialmente dañinos para ese medio. Con relación al Informe Pericial rendido por el Arquitecto Nombre39923 , quién realizó la individualización de las afectaciones recibidas por los accionantes, el fallo apelado acepta que se trata de un estudio muy técnico, donde se reconocen tres factores de afectación: factor distancia, contaminación visual y factor salud humana.
Sin embargo, el Juzgador señala que en el peritaje se asigna a todas las propiedades un mismo nivel de afectación, afirmación que de entrada no es cierta, pues según el cuadro realizado por el perito, hay varias propiedades con un valor de afectación inferior a 0.5%. Luego se pregunta el fallo si en todos los casos se está en la distancia de los veinte metros o más, o una distancia diferente, lo cual es en realidad un tema que no interesa, desde el momento en que el mismo perito explica en su informe que otorgará un distinto puntaje, según la distancia de cada propiedad de las líneas de alta tensión, con lo cual está indicando que ese examen lo ha realizado individualmente en cada situación. Señala la sentencia que en el informe no se indica a qué distancia están las propiedades, ni de qué forma afectan los factores de valoración utilizados a cada propiedad. Si bien es una observación que pudo hacer el ICE al Informe pericial y que no realizó, guardando silencio al respecto, existen varias razones por las cuáles se debe considerar que tales reparos no son determinantes para anular y llevar a cero el valor probatorio de la prueba pericial, como lo hizo de manera radical y reduccionista la sentencia apelada, olvidando de paso la jurisprudencia de la Sala Primera que fuera citado, según la cual, el daño no pierde esta característica si su cuantificación resulta incierta, indeterminada o de difícil apreciación o prueba (sentencia No. 14 de las 16 horas del 2 de marzo de 1993).
En consideración del apelante, los reparos antes señalados no son de importancia en este asunto, porque la proximidad de los cables de alta tensión, la contaminación visual y la contaminación eléctrica, como hechos que determinan la pérdida patrimonial, entendida como sacrificio antijurídico en perjuicio de los accionantes, son comunes a todas las personas que tienen sus propiedades ubicadas en paralelo a las líneas de alta tensión. Esta ubicación paralela se muestra en el mapa No. 3 titulado “Valores Zonales por Distrito para Terreno”, que acompaña el documento “Actualización de la Plataforma de Valores de Terrenos” del Cantón de Belén, realizado por el Ministerio de Hacienda. Cuando el perito Nombre39923 realiza su informe, se refiere únicamente a las propiedades que están en esa línea paralela, las cuales fueron identificadas por él, y que describe también la inspección judicial que constituye una fuente de información complementaria del informe pericial, y de los mapas que están incluidos en los estudios del Ministerio de Hacienda para ubicar las propiedades de los actores.
Pero si todavía quedaran dudas de dónde se encuentran ubicadas las propiedades de los accionantes, respecto de la línea del boulevard, que es donde según la inspección ocular se encuentran ubicados los cables de alta tensión, debe tomarse en cuenta que a los autos fueron aportados las certificaciones de propiedad de todos y cada uno de los actores, donde aparecen los linderos de cada inmueble, así como que con la prueba pericial del señor Nombre39923 se adjuntaron los planos de catastro de cada propiedad, donde se muestra la ubicación geográfica de las distintas propiedades. Esta información que tuvo a la vista el perito para determinar tanto la distancia de las líneas de construcción hasta el cableado de alta tensión, así como la ubicación paralela de las propiedades con las líneas de alta tensión, es la que el Juez de Primera Instancia no incluye en su valoración, pues como él mismo lo confiesa, no es un perito en el tema.
El Juzgador pasó por alto que en los autos se incorporó la certificación de propiedad y el plano catastrado de cada propiedad citada en el peritazgo del señor Nombre39923 , con lo cual si alguien pudiera dudar de las conclusiones del perito respecto a la distancia y ubicación de cada propiedad, respecto de los cables de alta tensión, allí tendría la información para cuestionar el peritaje. Pero además, dejó de considerar la sentencia que el perito ya había hecho el análisis que él extraña, es decir, que señor Nombre39923, con vista de los planos catastrados y de la visita que hizo a cada propiedad afectada, conocía perfectamente la distancia de cada una de dichas propiedades respecto de los cables de alta tensión y su ubicación en el mapa del lugar. No existe, por lo demás en los autos, ninguna demostración pericial, o documental que demuestre que el perito se haya equivocado en las ubicaciones que dio a cada propiedad y a los valores que determinó.
Insiste el apelante en señalar que no era preciso definir de qué forma cada propiedad en particular se ve afectada por factores como contaminación visual, temor o miedo y contaminación eléctrica, porque al estar ubicadas en línea paralela con el tendido de cables de alta tensión, estos factores los afectan a todos por igual. Posiblemente, como lo hizo el perito Nombre39923, habrá algunas propiedades, que por distancia sufran un perjuicio un poco mayor, u otras un perjuicio menor, pero precisamente en eso consistió su valoración, al introducir el elemento de la distancia. Salvo el factor distancia, cualquier otro factor afecta por igual a todas las propiedades alineadas paralelamente a las de trasmisión de alto voltaje construidas por el ICE. Esto es lo que permite entender, utilizando las reglas de la lógica y de la experiencia, por qué todas las afectaciones son parecidas, entendiendo además, como lo dice la Inspección Ocular que realizó un Juez del Despacho Judicial, que la mayoría de las viviendas están a diez metros de distancia de las líneas de alta tensión, que es lo mismo por nosotros afirmado en el hecho número dieciocho de la demanda inicial, y que el ICE nunca desmintió.
Argumenta el apelante que la segunda fuente de críticas del fallo de primera instancia hacia el peritazgo, es el presupuesto que éste asume de que existe una franja de contaminación electromagnética, que ha sido tomado en cuenta para los valores definidos en dicho estudio. Nuevamente para el Juzgador lo importante ha sido determinar si existe una zona de exposición a un daño a la salud, y no la existencia de una zona de contaminación eléctrica, que bien podría habérsele llamado de esa manera o de otra, pero que a los efectos de este juicio, lo que esa franja describe es una zona de afectación por la proximidad al tendido de cables de trasmisión de alto voltaje, que la Sala Constitucional denominó “campo magnético” y a la cual desde la sentencia de 28 de abril de 1998, se le brinda una protección especial de parte de las autoridades del país. No se discute aquí si al vivir dentro de esa zona de afectación las personas que allí residan tienen asegurado un problema de salud.
No es esa la discusión de este proceso, en el que lo que se discute es si las propiedades ubicadas en esa zona de afectación han sufrido un desmedro en su valor causando un sacrificio intenso a los propietarios de los inmuebles respectivos. En síntesis, no interesa aquí si el perito Nombre39923 denominó a la zona en cuestión como “franja de contaminación electromagnética”, o si le podría haber dado otro nombre. Lo que interesa es que describió con ese nombre una zona afectada con un perjuicio económico. Considera el apelante como un atrevimiento por parte del Juez de primera instancia el desestimar en su totalidad el peritaje por considerarlo metodológicamente inconsistente. Como ya lo señaló al analizar la omisión del Juzgador a la hora de tomar en cuenta los planos catastrados y las certificaciones registrales para ubicar la situación exacta de cada propiedad respecto de las líneas de alta tensión, quien desconoce la metodología para hacer un estudio de esta naturaleza es el a quo, quién de manera extraña decide destruir toda la prueba que le puede servir para acreditar el daño causado a los actores, aunque para eso tenga que caer en incoherencias lógicas y extravagancias intelectuales como las que aquí se han citado.
En cuanto al acta de reconocimiento judicial , señala el apelante que ayuda para ubicar las propiedades afectadas frente a la obra construida por el ICE, lo cual implica además que esta prueba coadyuva a demostrar la relación de causalidad entre la construcción de las torres y tendido de cables de alta tensión, respecto de las propiedades de los actores. Indica el apelante que las declaraciones testimoniales de Nombre39928 , Nombre39925 y Nombre39927 , resultan de gran importancia, siendo que la única forma de destruir u opacar el contenido de estas deposiciones, sobre todo las de los peritos de la Dirección de Tributación del Ministerio de Hacienda, era entrando a disputar con ellos el mejor conocimiento para realizar un estudio de mercado, imputándoles que no saben hacer esos estudios de mercado de bienes inmuebles y que quién sabe hacerlo es el Juez. Esta fue la decisión que tomó el a-quo, intentando sustituir con su propia interpretación de la técnica y de la ciencia, la labor de los peritos del Ministerio de Hacienda.
En el caso del señor Nombre39928 , quien reúne la doble condición de ingeniero especialista en valoración de bienes y también de vecino de la comunidad de Bosques de Doña Rosa (no afectado con el tendido de cables de alta tensión, pues no es colindante de la obra), se pretende descalificarlo señalando que fue ofrecido como testigo y no como perito. Este argumento resultan extemporáneos, pues debió hacerlo el Juez que recibió la prueba. En todo caso, se trata de una especie de alegato de parte, de carácter más bien formalista, contrario a la obligación de todo juzgador de buscar la verdad real de los hechos, antes de la verdad meramente formal. A igual que en los demás casos, en el análisis del contenido de la deposición de este testigo, resulta casi molesto ver la forma en que el Juez de Primera Instancia exige que explicite sus fuentes de información, no bastándole el dicho del testigo, tal como si cada testigo requiriera a su vez el testimonio o la prueba de una segunda fuente, y seguramente esa segunda fuente requiriera la prueba de una tercera y así hacia el infinito.
Esa no es la forma en que se valora el contenido de la declaración de un testigo. Si éste es una persona seria, con una profesión o conocimiento atinente a lo que está refiriendo, y si declaró bajo la fe del juramento, no hay razón válida para entrar a dudar de lo que expone, simplemente porque por ejemplo se hace referencia a información de peritos bancarios o de peritos de Tributación y no se menciona el nombre de esos peritos, lo cual el testigo, las partes durante la audiencia y el propio Juez que la dirigió, consideraron innecesario preguntar. Esta forma de pretender corregir a posteriori la formalidad de una prueba, cuando ni siquiera la parte procesalmente afectada ha impugnado la declaración, resulta contraria al principio de preclusión procesal, y además injusta, porque no permite a la parte que aportó la prueba subsanar los defectos que luego se le imputan para desechar sus probanzas.
De esta manera, el Juez pretende exigirle al testigo, ex post facto, una información que de habérsele requerido en el momento de su declaración seguramente pudo haberla consignado, pero que en el momento de la deposición omite, no porque desea generalizar, sino porque está declarando sobre los hechos con fundamento en los cuales puede afirmar que ha existido una pérdida patrimonial para los accionantes. De esa manera se llega a hacerle al testigo Nombre39928 una especie de imputaciones realmente arbitrarias, como por ejemplo que no se refiriera a un lugar concreto, de modo que no se sabe si está hablando de la urbanización Bosques de doña Rosa o de otra. Dicha interpretación resulta arbitraria, porque del conjunto de la declaración dimana que el testigo está hablando de la Urbanización donde están las obras construidas por el ICE. En fin, lo curioso de la forma en que el Juzgador interpreta la declaración de don Nombre39928 , es que cuando declara como perito conocedor, no se le hace caso, y cuando lo hace como testigo, porque conoce personalmente de hechos y circunstancias que han influido en el valor de las propiedades de los vecinos de la colindancia de la línea de trasmisión, tampoco se le hace caso.
Como ejemplo de lo indicado señal que el señor Nombre39928, declarando como testigo señaló con la mayor claridad: “Antes de la instalación de las actuales líneas , no existía en el lugar otra similar, sí existía una pero la misma era del tipo tradicional que podemos observar en cualquier vía pública del país, eran lo que llamamos digamos postes del tamaño normal, pero no similares a las grandes torres y al tipo de cable actual. Incluso puedo indicar que las líneas anteriores que habían cuando llovía por lo general en las tardes, en la noche, no se escuchaba ningún ruido luego de pasaba la lluvia, en cambio en la actualidad después de que pasa la lluvia normal, en la noche, el ruido que provoca el tendido actual es muy fuerte, totalmente sonoro para cualquier persona, cosa que no sucedía con la línea anterior. Yo vivo a aproximadamente cuatrocientos metros de las torres de alta tensión”. Luego agregó el mismo testigo en la parte final de su declaración: “…otro factor que afecta es el de la belleza escénica ya que Bosques de Doña Rosa se caracteriza por sus grandes zonas verdes y (sic) boulevares, lo que afectó totalmente la belleza escénica del mismo, siendo otro factor desvalorizante de las propiedades”.
Júzguese entonces si don Nombre39928 no hizo importantes contribuciones sobre los perjuicios que sufren los actores y si conocía o no de qué Urbanización estaba hablando. Es obvio que la hacer estas manifestaciones declaró como testigo, pero igual fueron ignoradas por el Juzgador. En cuanto a la declaración del testigo Nombre39925 , perito del Ministerio de Hacienda, la sentencia le resta credibilidad de un plumazo a toda su declaración, por el simple hecho de que al Juez le parece que es repetición del estudio que ya criticó en otras partes de la sentencia, del cual el señor Nombre39925 es coautor; estudio que el señor Juez no leyó de manera completa o no comprendió. El Juzgador le achaca al testigo y al estudio por él realizado en coautoría con el Ing. Nombre39927 no haber hecho comparaciones con valores anteriores de las propiedades, lo cual, según ya se comentó no es necesario, porque las valoraciones se hacen versus las del resto de propiedades de la urbanización.
Para contrariedad del señor Juez de Primera Instancia, que parece tampoco se leyó las declaraciones de los testigos de manera integral, resulta ser que el testigo Nombre39927 sí había realizado valoraciones previas en la misma zona, con ocasión de la primera vez que asesoró a la Municipalidad de Belén en la elaboración de una plataforma de valores de bienes inmuebles. En efecto, el testigo refiere desde el inicio de su declaración que era la segunda vez que brindaba asesoría a la Municipalidad de Belén en el campo de la valoración. Pues bien, este testigo hace una comparación histórica entre las dos ocasiones en que valoró los bienes inmuebles de Bosques de Doña Rosa, que quien ha dictado la sentencia de primera instancia pasó por alto, como tantas otras cosas que no le interesaron para afirmar sus propias tesis. El Testigo Nombre39927 Introduce de hecho en esta declaración un concepto al que ya se había referido el deponente Nombre39928 , que es la “deseabilidad” de un bien, utilizado como factor de valoración en este tipo de estudios de mercado.
Se trata de un concepto técnico al que la sentencia de primera instancia no le dio la menor importancia. Con respecto a la declaración de este testigo, el a-quo le imputa no haber tomado en cuenta una serie de variables que estima necesarias para comprobar su dicho, integrando comparaciones entre zonas, comparando elementos como topografía, servicios, plusvalía y otros. Resulta ocioso volver a insistir aquí en lo que dijo el testigo Nombre39925 y en las fuentes que él señala se utilizaron para hacer su estudio. Puede verse por ejemplo- solo cito uno- su conversación con peritos del sistema bancario nacional, sus conversaciones con personal del Ministerio de Salud, así como otros elementos de juicio que tomó en cuenta para calcular una depreciación en los valores de un conjunto de bienes inmuebles, herramientas que son típicas en estudios de esta naturaleza. Lo que resulta difícil de entender es que toda esa prueba deje de tener valor para el Juzgador, simplemente porque no utilizó los criterios que él hubiera empleado para hacer un estudio de ese tipo, y que llegue incluso a dudar de la seriedad del estudio, imputando un supuesto uso de criterios subjetivos de los propios peritos (lo cual es una verdadera falacia y atrevimiento de quien juzga, porque no hay un solo elemento de juicio para afirmar una cosa así), o interpretando caprichosamente a su manera un dato ofrecido por el testigo, en este caso que habían escasez de ofertas de vivienda, que llama la atención del Juez (sin que le llame la atención el resto de elementos aportados por el testigo para afirmar el por qué de la infravaloración de los bienes.
Señala el apelante que al testimonio del señor Nombre39927 , se le vuelve a castigar de nuevo, por el documento del que es coautor, al cual se le acusa de falta de rigurosidad científica e interpretación equivocada de la presunta contaminación electromagnética. De este modo, el Juez de Primera Instancia se erige en una especie de especialista ya no solo en estudios de mercado sino también en campos electromagnéticos, contaminación electrónica, con conocimientos más profundos en todas estas materias que el Ministerio de Salud, que los peritos del Ministerio de Hacienda y que la Organización Mundial de la Salud. Todo por medio de una lectura a medias de un fallo de la Sala Constitucional, el cual no llegó a entender a cabalidad. De este modo, donde el testigo es claro al comparar valores, el Juzgador afirma que no entiende, cuando es claro que las ofertas de menor valor estaban en el área afectada que el testigo describe perfectamente.
Luego ensaya la sentencia una especie de contradicción entre los dos testigos peritos, en materia de poca o mucha oferta, cuando lo cierto es que el testigo Nombre39925 a lo que hizo referencia fue a los problemas que tenían los afectados para vender, mientras que el testigo Nombre39929 se refería a un conjunto de muestras por él valoradas, coincidiendo con su compañero en tema de oferta. En todo caso, los testigos se referían a enfoques distintos del mismo tema o a momentos diferentes de un mismo fenómeno, sin que realmente ese sea un detalle fundamental para resolver el proceso judicial. El Juzgador le atribuye al testigo Nombre39925 haber afirmado que el valor de devaluación se otorgó por indicaciones de vecinos o propietarios, lo cual es absolutamente incorrecto, pudiendo quién sin malicia proceda a leer la declaración de este último, encontrar párrafos muy diferentes a lo afirmado en la sentencia.
Así cuando se indica que “acudimos a la consulta de valuadores expertos en materia de valoración de inmuebles y aplicando nuestros criterios llegamos a las conclusiones que se citan en el documento”. De esta forma, el fallo apelado busca contradicciones donde no las hay y en esta labor destructiva de la prueba aportada por la parte actora se llega a hablar de un testigo Loría que nunca declaró en el asunto, solamente para desacreditar nuevamente el testimonio del señor Nombre39928 (de hecho el señor Ing. Roberto Loría es el Jefe de Peritos del Banco de Costa Rica, con quien conversó el testigo Nombre39927 , y quien el Juez de Instancia confunde con otro testigo). En fin, el fallo encuentra contradicción porque el testigo Nombre39925 habla de haber conversado con valuadores expertos, mientras que Nombre39927 y Nombre39928 hablaron de que habían conversado con peritos bancarios, entrando pues en una serie de valoraciones subjetivas incurriendo en el error de no tomar en cuenta las declaraciones de un testigo tan experimentado y conocedor como el señor Nombre39927 , todas sus constataciones y observaciones objetivas que sirven para construir un estado de cosas, en este caso, un estado de situación sobre el valor de un conjunto de bienes inmuebles.
Así, se pierde por ejemplo de vista declaraciones tan contundentes del testigo indicado, como cuando por ejemplo señaló:“En este caso consideré que esta zona estaba afectada disminuyendo su valor por pérdida de belleza escénica, pérdida porque hay un temor de que se reviente un cable, se electrice alguien, un temblor o caigan las torres; hay muchas ofertas y poca demanda. En el estudio que hice, que fui unas 40 veces, nunca vi gente en esa zona verde jugando, seguro que estaba atemorizada por el problema de las torres, no vi pájaros en los árboles… (…) consultando a peritos tasadores como el ingeniero Roberto Loría que creo que es el jefe de peritos en Costa Rica, me decía que él había tasado propiedades con problemas de cableado eléctrico, hasta en un 25% del valor, incluyendo terreno y construcciones, lo que yo consideré, hablando con colegas de donde había trabajado, del Banco Nacional…”.
Considera el apelante que la arbitrariedad de Juzgador de primera instancia llega a tal extremo, que descalifica al testigo Nombre39927 por haber manifestado que la gente sentía temor por los cables de alta tensión, indicando que ese es un criterio técnico para el que no fue ofrecido como perito, resultando que según el criterio del Juzgador para determinar si las personas tienen temor de una obra pública, hay que ser perito en una determinada materia. Pero además, resulta también que un perito valorador no puede tomar en cuenta este factor, pues en criterio del A-quo, el criterio debe ser a su vez validado por otros peritos, quien sabe hasta qué número y generación. Esto en derecho equivale a llevar un argumento al límite del ridículo, y así debe ser manifestado aquí, para que se vea la inconformidad con la forma tan subjetiva y desequilibrada en que ha sido valorada la prueba ofrecida por la parte accionante.
Con relación al resto de la prueba aportada por la parte actora, la sentencia de primera instancia apenas hace mención a la misma, pues de acuerdo con su especial punto de vista, la misma no ayuda a acreditar el daño. Ciertamente la demostración de que el ICE ha considerado en otras comunidades del país necesario reconocer una indemnización a las propietarios de bienes inmuebles en la colindancia de cables de alta tensión, no constituye una prueba directa de la existencia del daño de mis representados. No obstante, esta documental (folios 295 y 455 a 479), junto con el estudio de impacto ambiental de la línea de trasmisión eléctrica Miravalles-Liberia (folio 479), constituyen una prueba clara de que según el propio instituto demandado, existe una justificación desde el punto de vista del derecho público para hacer un reconocimiento económico a las propietarios que sufren un sacrificio especial con las obras que benefician al resto de habitantes del territorio nacional.
No se entiende entonces por qué si en otras partes del país, el demandado ha invertido sumas millonarias, reconociendo indemnizaciones a otros habitantes del país, se deba hacer una excepción con los vecinos afectados de Bosques de Doña Rosa. El sacrificio y la carga excepcional que exige la doctrina y la legislación como parámetro de antijuridicidad se presenta tanto en el caso de San Carlos o Liberia, lo mismo que en el Cantón de Belén, resultando discriminatorio para los actores que a ellos se les ubique en una categoría distinta, si han sufrido exactamente un daño de la misma naturaleza jurídica. Se debe considerar que la prueba aquí referida como una prueba indirecta, viene a complementar la prueba directa que se recibió en el expediente, y que acredita la existencia de un daño. Pero además, esta prueba permite vincular, en relación causa efecto, la construcción de líneas y posteado de cables de alta tensión, con la pérdida patrimonial que ha permitido al ICE, sin incumplir con el principio de legalidad y racionalidad del uso de fondos de la hacienda pública, pagar indemnizaciones a los propietarios afectados con sus obras.
En conclusión, bien puede afirmarse que de los autos se desprende la existencia de prueba suficiente para tener por demostrado no solo el daño patrimonial causado a los accionantes, que no es un daño unilateral sino plurilesivo, en cuanto depende de distintos factores de afectación, lo mismo que la relación entre dicho daño y la construcción de una línea de trasmisión de alta tensión a partir del año 1998 en la comunidad donde tienen sus propiedades. Esto es suficiente para que se aplique lo dispuesto en los artículos 190 y 194 de la Ley General de la Administración Público, acogiendo la demanda en todos sus extremos. Solicita, se revoque la resolución aquí apelada y en su lugar se acoja la demanda inicial en todos sus extremos. De manera subsidiaria, y para el caso hipotético de que se resolviera mantener el fallo de primera instancia, solicita se revoque el mismo en cuanto a costas. Para efectos de esta última solicitud pide el apelante tomar en cuenta no solo el hecho de que los actores han litigado desde el principio confiados en el amparo de la legislación costarricense, sino también la mala fe procesal exhibida por el Instituto demandado, quien nunca tuvo interés por ofrecer prueba de descargo que permitiera determinar el origen cierto de los daños ocasionados a los accionantes, así como la existencia de una relación causal con las obras que había construido.
Parecería injusto que además del sacrificio que ya han tenido que pagar los accionantes, por una obra que beneficia a tantos costarricenses y compañías extranjeras, todavía tengan que pagar costas por defender sus derechos y el de sus familias.
Conforme se dispone en el artículo 194 de la Ley General de la Administración Pública, la Administración será responsable por sus actos lícitos y por su funcionamiento normal, cuando los mismos causen un daño a los derechos del administrado en forma especial, por la pequeña proporción de afectados o por la intensidad excepcional de la lesión, siendo que en este caso la indemnización deberá cubrir el valor de los daños al momento de su pago, pero no el lucro cesante. Según se ha determinado en doctrina, en el sistema de responsabilidad sin falta o por sacrificio especial está excluida toda idea de funcionamiento anormal del servicio público, falta de servicio o de falta personal, puesto que, el administrado sufre un daño grave, de especial intensidad originado en actos lícitos o sustancialmente conformes con el ordenamiento jurídico o por un funcionamiento normal de los servicios públicos, el cual excede, con creces, los sacrificios comunes o generales que deben soportar los administrados en el marco de una comunidad políticamente organizada.
El régimen de responsabilidad administrativa sin falta o por sacrificio especial, tiene un carácter excepcional y se origina en actuaciones u omisiones que sobrepasen el margen de la tolerancia respecto de las cargas impuestas por las administraciones públicas, que generan un sacrificio de especial intensidad a los administrados y que no tienen el deber jurídico de soportar. El daño generado en actuaciones lícitas debe ser especial y anormal, de carácter singular, grave e intenso que implica un quebranto de los principios de equidad, igualdad ante las cargas públicas y la indemnidad patrimonial. El carácter excepcional, particular e intenso del sacrificio genera un daño o lesión antijurídica que debe cumplir los requisitos de especialidad y anormalidad. En todo caso, conforme al régimen de responsabilidad contenido en nuestra legislación, la determinación de responsabilidad por conducta lícita queda sujeta también a la demostración de que la actuación u omisión administrativa genera un daño (cierto, efectivo, evaluable, indemnizable y no conjeturable), cuya existencia debe ser demostrada, así como el nexo de causalidad entre la manifestación de la función administrativa, sea por acción u omisión y la lesión antijurídica provocada al administrado (ver en este sentido Jinesta Lobo Ernesto "Tratado de Derecho Administrativo." Tomo II, Páginas 155 y siguientes).
En el caso tratado en autos, argumenta el apelante que el proceso judicial se formula a consecuencia del daño patrimonial sufrido por los accionantes, con ocasión de un conjunto de variables que influyen en la depreciación de las propiedades originados en la instalación que hizo la demandada de un tendido de cables de alta tensión en la comunidad conocida como Bosques de Doña Rosa, siendo que en su consideración las pruebas allegadas al expediente demostraron el daño específico de la pérdida de valor patrimonial de sus propiedades. Considera el apelante que las pruebas que la parte actora procuró dentro del expediente judicial (estudio del Órgano de Normalización Técnica del Ministerio de Hacienda, acuerdo de la Municipalidad de Belén, peritaje judicial, declaraciones testimoniales de personas calificadas para realizar valoraciones de bienes, peritos del Ministerio de Hacienda, reconocimiento judicial y reconocimiento del daño patrimonial realizado por el ICE en otras comunidades del país, similar al ocasionado a los actores), demostraron el daño específico de la pérdida de valor patrimonial de las propiedades reclamado en este proceso, y su relación de causa efecto con la instalación de las torres y los cables por parte del ICE.
Contrario a lo argumentado y conforme se dirá, en criterio de éste Tribunal de un análisis integral de las pruebas que constan en autos conforme a los principios de sana crítica racional, la parte actora no ha logrado acreditar por pruebas que resulten útiles y pertinentes, la existencia del daño especial por responsabilidad sin falta o sacrificio especial reclamado, por lo que la sentencia dictada debe ser confirmada en cuanto rechazó la pretensión indemnizatoria pretendida en el proceso.
IV.SOBRE EL OBJETO DE LA DEMANDA Y SU RELACIÓN CON LA EXISTENCIA DE UNA ZONA ELETROMAGNÉTICA EN LA ZONA DONDE HABITAN LOS ACCIONANTES. Conforme lo señala el apelante, el tema de la existencia de un campo electromagnético generado por los cables de alta tensión en el Residencia Bosques de Doña Rosa, fue analizado por la Sala Constitucional en el voto No. 2806-98, de de las 14:30 horas del 28 de abril de 1998, dictado con ocasión del Recurso de Amparo interpuesto por los vecinos del citado Residencial contra el Instituto Costarricense de Electricidad con motivo de la ampliación de la línea de transmisión de alto voltaje denominada Línea de Transmisión Alajuela-La Caja, que a su vez origina el presente proceso. En dicho voto se analizó lo relativo a la lesión o amenaza de los derechos constitucionales a la salud y a un ambiente sano de los actores y sus familias con ocasión de la exposición a los campos electromagnéticos generados por la líneas de transmisión de alto voltaje como las instaladas en la Comunidad donde habitan los hoy actores de éste proceso, siendo que la Sala Constitucional fue clara al establecer que existe un amplio consenso en la comunidad científica en el sentido de que no se ha establecido una asociación entre la exposición doméstica a campos de frecuencia industrial y los posibles riesgos a la salud humana.
Asimismo, la sentencia en cuestión reconoció que también hay consenso respecto de que no ha sido y no puede ser probado que la exposición a estos campos sea absolutamente segura, circunstancia en la que juega un papel fundamental el hecho de que en general no se puede demostrar fehacientemente un hecho negativo. Consideró la Sala Constitucional que para el caso analizado, está suficientemente claro que los estudios que parecen evidenciar riesgo, parten de intensidades en los campos magnéticos que superan, con mucho, a aquellos que se espera encontrar en la vecindad de las líneas eléctricas de interés en el caso analizado por el alto Tribunal. Concluyó el fallo señalando que ante la ausencia de criterios que indiquen que existe siquiera una verdadera amenaza a la salud de los accionantes o al ambiente en el que viven (por el contrario los criterios mayoritarios apuntan hacia que no la hay), así como a los demás derechos fundamentales que se citan en el recurso, lo que procede es desestimar el amparo por la vía de reiteración de los antecedentes dictados en la materia.
No obstante, al dimensionar el fallo, la Sala Constitucional, señaló que una correcta aplicación del principio de evitación prudente al caso concreto, determina como necesario ordenar al ICE que adopte todas las medidas que sean requeridas para asegurar que el campo magnético generado por las obras no exceda, en las viviendas, los márgenes a que se ha comprometido con la Sala y con la comunidad, a saber, de 0,1 a 0,3 micro T (8 MG) en condiciones normales y un máximo de 0,8 micro T (8MG), en condiciones de sobrecarga y por no más de dos horas al año, debiendo el ICE designar y comunicar a las comunidades interesadas, necesariamente y por medio de la Municipalidad de Belén, y además a las personas y organizaciones comunitarias que lo requieran, la información relativa a las mediciones que se practicará regularmente de la intensidad del campo magnético, debiendo el Ministerio de Salud establecer un mecanismo permanente de vigilancia epidemiológica en el área geográfica donde está ubicada la línea de transmisión de alto voltaje en el Proyecto.
Por la vía de aclaración, la Sala Constitucional en el voto 00664-I-98 de las catorce horas con treinta y ocho minutos del veintiocho de octubre de mil novecientos noventa y ocho, determinó que las mediciones de intensidad del campo electromagnético deben ser realizadas en el exterior de la línea de construcción de las casas de habitación de los amparados. En razón de lo dicho, y si bien la Sala Constitucional determinó la existencia del campo electromagnético en el Proyecto, es lo cierto que este aspecto no constituye la base fundamental del tratado en autos, pues el objeto de la pretensión indemnizatoria por parte de los actores no se fundamenta en la existencia de daños a la salud causados con ocasión de la contaminación electromagnética generada por los cables de alta tensión que transitan por la Urbanización. El daño reclamado en el este proceso se fundamenta en los efectos que la instalación de los cables de alta tensión han generado sobre el valor de los inmuebles de los actores (pérdida de belleza escénica, contaminación sónica por los ruidos que generan las torres y principalmente por el temor que sobre el eventual daño a la salud que pueda generar la exposición a los campos electromagnéticos que generan las torres de alta tensión), factores que constituyen en criterio de los actores el hecho generador de la disminución del valor patrimonial de sus propiedades en un porcentaje de al menos un 50%, según lo determinara el Órgano de Normalización Técnica y la Municipalidad de Belén, por lo que se ha generado un daño especial que no tienen el deber de soportar y debe ser resarcido al existir una responsabilidad administrativa sin falta o por sacrificio especial en los términos del artículo 194 de la Ley General de la Administración Pública. En razón de lo dicho, sobre estos ejes temáticos se centrará el análisis de éste Tribunal respecto del recurso de apelación formulado contra la sentencia de instancia.
Contrario a lo argumentado por el apelante, éste Tribunal no evidencia la existencia de elementos que permitan concluir que el Juzgador de instancia ha utilizado un sistema de libre convicción en la apreciación de la prueba, ni una apreciación subjetiva ni fallando contra la prueba recibida, pues conforme se dirá del análisis de la prueba ofrecida por los accionantes, en la especie no se ha probado por prueba idónea el daño reclamado en este proceso, correspondiente a la disminución patrimonial representada por la disminución del valor de los inmuebles de los actores en un porcentaje de al menos del 50%, generada por la instalación de torres de alta tensión por parte del ente demandado. 1. SOBRE LA PRUEBA DEL ESTUDIO DEL ÓRGANO DE NORMALIZACIÓN TÉCNICA. En el mes de junio del 2001, los Ingenieros Nombre39927 y Nombre39925 , funcionarios de la División Órgano de Normalización Técnica del Ministerio de Hacienda, emitieron el denominado "Actualización de la Plataforma de Valores de Terrenos en el Cantón de Belén" (folios 239 a 343 del principal), en lo relativo a la Dirección4860 (Zona Z03-U23).
En el Anexo 7 de dicho documento, se realiza una valoración de la devaluación de los terrenos situados en ambos lados de las líneas de transmisión en el Cantón de Belén, señalando dicho estudio la existencia de una devaluación del terreno relacionada en parte con el potencial efecto de los campos electromagnéticos en la salud humana y en parte con los temores generados por el riesgo de una falla estructural de las torres que sostienen las líneas de alta tensión debido a algún factor externo, por la pérdida de belleza escénica y por otros aspectos relacionados. En razón de lo señalado, y con base en la literatura revisada, la opinión de los vecinos que fueron consultados, de expertos en bienes raíces y la investigación de valores realizada, el estudio del citado órgano propone que para efectos del cobro del impuesto sobre bienes inmuebles en la Municipalidad de Belén, se considere una devaluación de por lo menos 50% en el valor de la construcción y del terreno de los inmuebles ubicados en las zonas homogéneas afectadas por la contaminación electromagnética, afectación que aplica únicamente para los inmuebles de uso residencial y comercial ubicados en la zona de influencia de las líneas de alta tensión.
Señala el estudio que para determinar el efecto de la instalación de las líneas de transmisión en el valor de los terrenos de la zona de influencia en Belén, se realizó un estudio en la zona y se entrevistó a varios habitantes entre ellos a los señores Luz María Campos, Lidia Duarte, Pedro González, quiénes señalaron los problemas que han afrontado para la venta de los inmuebles con la presencia de las torres. Asimismo, señala el Informe que el señor Nombre39930 , vendedor de bienes raíces, manifestó en entrevista que resulta muy difícil vender inmuebles en la zona de influencia de las torres de alta tensión y que el valor del terreno es por lo menos del 50% con respecto de inmuebles donde no existe este efecto. Añade el Informe que además el Ingeniero Roberto Loría (P&A Peritazgos y Avalúos), manifestó que realizó, a una Institución bancaria, el avalúo de un inmueble en el Dirección4861 y consideró un castigo de un 25% (comunicación personal).
Además, el Ingeniero Loría indicó que los terrenos afectados por las líneas de alta tensión se devalúan de un 50% a un 75% y las construcciones en un 25%. Asimismo, señalan los suscriptores del estudio que otro de los fundamentos de la recomendación formulada lo constituye el hecho de que una de las instituciones bancarias más importantes del país les informó que no aceptan como garantía inmuebles contiguos al borde de servidumbres establecidas para las líneas de alta tensión y que la devaluación de los inmuebles en estas zonas es de un 50% o más. Finalmente se indica en el Informe que cuando la gente que vive en estas circunstancias se entera de este problema, inicia los trámites para deshacerse del inmueble o dejárselo al Banco. En criterio de éste Tribunal y como bien lo sostiene el Juzgador de Primera instancia, el estudio realizado por el Órgano de Normalización Técnica del Ministerio de Hacienda carece de rigurosidad técnica, toda vez que no se logra determinar cuáles fueron las fuentes consultadas, ni las bases técnicas que fundamentan la existencia de una desvalorización de los terrenos afectados por las líneas de alta tensión entre un 50% y 75%.
En efecto, el estudio en cuestión no acredita las condiciones de modo, tiempo y lugar que amparan las manifestaciones de los vecinos que fueron entrevistados, para acreditar si efectivamente los problemas que aducen han tenido con la venta de inmuebles se origina en la instalación de las torres, pues no se acredita cuáles fueron esos inmuebles, cuándo se pusieron en venta, quiénes formularon las ofertas y demás condiciones que permitan determinar esa relación de causalidad. De igual manera, no se acredita en el estudio las razones técnicas en que se fundamenta el experto en bienes raíces Nombre39930 -cuya condición no ha sido acreditada en autos-, para sostener que el valor de los terrenos se había desvalorado en por lo menos un 50%. Asimismo, no se acredita, salvo el dicho de los autores del estudio, las razones en que se fundamenta el perito Roberto Loría -cuya condición no ha sido acreditada en autos-, para sostener que le realizó a una Institución bancaria el avalúo de un inmueble en el Dirección4861 y consideró un castigo de un 25%.
De igual forma, no acredita el estudio los fundamentos técnicos o científicos en que se fundamenta el Ingeniero Loría para considerar que los terrenos afectados por las líneas de alta tensión se devalúan de un 50% a un 75% y las construcciones en un 25%. Así, el estudio carece de rigurosidad técnica, para definir que los inmuebles de los accionantes se desvalorizaron en un porcentaje de al menos un 50%, siendo que los autores del estudio se basan para formular la recomendación únicamente en meras referencias de fuentes que no son constatables y cuyas razones y fundamentos son desconocidos (manifestaciones de los vecinos, de expertos en bienes raíces cuya condición nunca se acreditó en autos). Asimismo, no acreditan los autores del documento -salvo su dicho-, la existencia de un estudio de mercado de expertos que acredite los valores de las propiedades ubicadas en zonas homogéneas afectadas por la instalación de las torres de alta tensión, ni estudios que acrediten de manera objetiva y constatable la disminución del valor de los inmuebles.
La prueba que constituye la base del estudio, no permite acreditar de manera debida las fuentes utilizadas para formular su recomendación, ni cuales fueron los criterios o las razones técnicas en las que las fuentes periciales supuestamente consultadas fundamentan la existencia de una desvalorización de los terrenos entre un 50% y un 75%. De igual forma, no existen elementos para acreditar la veracidad de la fuente utilizada para afirmar que una de las instituciones bancarias más importantes del país (sin señalar cuál, cuándo, en que casos y bajo cuáles circunstancias), no aceptan como garantía inmuebles contiguos al borde de servidumbres establecidas para las líneas de alta tensión y que la devaluación de los inmuebles en estas zonas es de un 50% o más. Asimismo, no se acredita en el estudio cuales son las razones técnicas por las que según las fuentes fundamentan la dificultad de vender inmuebles en la zona de influencia de las torres de alta tensión y que el valor del terreno es al menos de un 50% menor respecto de inmuebles donde no existe este efecto.
En razón de lo dicho, conforme lo determinó el Juzgador de instancia, el dictámen del Órgano de Normalización Técnica no constituye prueba útil a efecto de acreditar el daño reclamado por los actores en este proceso, siendo que los agravios formulados por el apelante carecen de fundamento. En efecto, el hecho de que la parte actora hubiera podido ofrecer otro tipo de pruebas (prueba de corredores de bienes inmuebles, otros vecinos de la comunidad, declaraciones de eventuales compradores en cuyo ánimo pesaba la cercanía de las propiedades con las torres de alta tensión), constituye una mera hipótesis, pues corresponde a las partes según su estrategia en juicio determinar la prueba que estime más conveniente a sus intereses para acreditar los hechos y pretensiones de su demanda. Contrario a lo argumentado por el apelante ésta Cámara considera procedentes las consideraciones del Juzgador de instancia en punto a considerar la necesidad de que el estudio realizado por el Órgano de Normalización Técnica, debió haber acreditado documentalmente las entrevistas con el fin de constatar la fuente y sus fundamentos.
Considera éste Tribunal que no por el hecho de que el estudio ofrecido como prueba, fuera realizado por funcionarios del Ministerio de Hacienda, resultan inmunes al análisis judicial, siendo que el Juez no puede partir en su análisis de la prueba en el hecho de que los técnicos del Ministerio de Hacienda o los peritos designados durante el proceso conocen su trabajo, por lo que los parámetros tomados en sus dictámenes no pueden ser objeto de cuestionamiento y deben ser adoptados de la forma en que son rendidos, teniéndose como plena prueba de carácter irrefutable. En este sentido, olvida el apelante la función del Juez de dirimir el conflicto sometido a sede jurisdiccional y de su deber de valorar la prueba conforme a principios de la sana crítica racional y la posibilidad de apartarse de manera razonada de las pruebas propuestas por las partes. Conforme se dirá al analizar el dictamen pericial rendido en autos por Nombre39923 , aún cuando el perito realizó un trabajo de individualización de daños, donde puede verse alguna variación entre la afectación de una propiedad u otra, dicho dictamen contiene una serie de inconsistencias metodológicas que impide considerarla como prueba útil para acreditar el daño reclamado por los actores en el presente proceso.
Las argumentaciones del apelante respecto de las consideraciones contenidas en la sentencia con relación al cuestionamiento del aparato utilizado por los técnicos del Ministerio de Hacienda para medir la intensidad del campo electromagnético, carece de interés en tanto el fundamento de ésta demanda no lo constituye la existencia de un daño a la salud de los accionantes con ocasión de los efectos generados por el campo electromagnético, siendo que en todo caso, conforme lo determinó la Sala Constitucional le corresponde al Ministerio de Salud, velar por el cumplimiento de lo ordenado por ese Tribunal en cuanto al máximo de energía que podría ser transportada por los cables de alta tensión, lo que convierte a éste tema en una discusión estéril para efectos del fondo debatido en el presente proceso. En todo caso, no es cierto que la sentencia de primera instancia se hubiera fundamentado en la inexistencia de un solo factor de riesgo (daño a la salud por los efectos generados por los cables de alta tensión), sino en la ausencia de prueba para acreditar el daño, según las pruebas propuestas por la parte actora.
Contrario a lo argumentado por el apelante, en criterio de éste Tribunal, si resultaba necesario para acreditar el daño reclamado por los accionantes la existencia de un estudio que determinara los valores de los inmuebles antes y después de la instalación de las torres de alta tensión, toda vez que ésta información resulta imprescindible a los efectos de acreditar el daño reclamado y la relación de causalidad entre este y la actuación administrativa. La determinación de la disminución del precio debe realizarse a partir del valor del inmueble antes de la afectación y después del hecho que genera el daño, lo cual no se puede lograr a partir de la confrontación de precios con inmuebles que pertenecen a la misma Urbanización pero que no se encuentran en la colindancia del tendido de cables de alta tensión, con los que sí tienen esta última condición. En todo caso, no constan referencias que permitan determinar la existencia real y resultados de los estudios de mercado de zonas homogéneas que según el dicho de los redactores del Informe, realizaron para fundamentar su recomendación de la disminución de un 50% del valor de los inmuebles para efectos del pago de impuestos sobre bienes inmuebles.
Contrario a lo argumentado por el apelante, no se evidencia la existencia de un estudio por parte de los técnicos del Ministerio de Hacienda por medio del cual se acredite que inmuebles que se ubican en la misma Dirección4859 y que no se encuentran en la colindancia del tendido de cables de alta tensión, no hayan desmejorado su valor respecto de los que si tienen ésta última condición, resultando intrascendente para efectos de acreditación del daño reclamado por los actores, el hecho de que los funcionarios del Ministerio de Hacienda que realizaron el estudio, sean peritos en la materia y que conocían la zona de previo, lo que les permitía contar con elementos para realizar comparaciones históricas del valor de los inmuebles. Por las razones dichas, contrario a lo argumentado por el apelante, no evidencia ésta Cámara la existencia de fundamentos técnicos que amparen la recomendación por parte del Órgano de Normalización Técnica de una desvalorización en un porcentaje de un 50% del valor de los inmuebles de los actores, por lo que los agravios no son de recibo y deben ser rechazados. 2.
ACUERDO DE LA MUNICIPALIDAD DE BELÉN. La Municipalidad de Belén, mediante el acuerdo adoptado en la Sesión No.56-2002, artículo 19, celebrada el 13 de agosto del 2002, acogió la recomendación de la Comisión de Obras y acordó aplicar una disminución de la base imponible del Impuesto sobre Bienes Inmuebles en un porcentaje del 50% de devaluación al valor de los terrenos y construcciones para vivienda y comercio ubicados en la Zona Homogénea afectada por la contaminación electromagnética en el Cantón de Belén. El citado acuerdo se fundamenta en el Informe DO231-2002 del 19 de julio del 2002, de la Dirección de Operaciones y Desarrollo Urbano, mismo que a su vez se fundamenta en el estudio realizado por el Órgano de Normalización Técnica del Ministerio de Hacienda, mediante el cual se actualiza la plataforma de terrenos para el Cantón de Belén, y que incluye un estudio sobre devaluación de terrenos por efecto del campo electromagnético, realizado por los Ingenieros Nombre39925 y Nombre39927 .
Según se consigna en el acuerdo Municipal, la Unidad de Bienes Inmuebles mediante el oficio UBI-02-0037, informó que en compañía del Ingeniero Nombre39927 , se realizó una inspección de campo para determinar el comportamiento de los inmuebles afectados por el campo electromagnético, determinando entre otros los siguientes aspectos de interés: a)- En la zona de estudio no existen alquileres ni desalojos de las propiedades afectadas; b)- No existe evidencia de movimientos en cuanto a compra y venta de propiedades, ya que la mayoría de los terrenos mantienen los rótulos de propuesta de venta por tiempo indefinido; c)- Se evidencia estancamiento en cuanto a nuevas construcciones de los precios afectados y d)- Las torres que soportan las líneas de alta tensión generan contaminación visual permanente. En lo fundamental el acuerdo del Municipio señala que la razón por la que se devalúa el terreno está relacionada en parte con el potencial efecto de los campos electromagnéticos (CEM) en la salud humana y en parte con los temores generados por el riesgo de una falla estructural de las torres que sostienen las líneas de alta tensión (LAT) debida a algún factor externo, por la pérdida de belleza escénica y por otros aspectos relacionados.
Según se evidencia de lo transcrito, resulta evidente que el Acuerdo adoptado por el Municipio de Belén, a pesar de que indica de la existencia de un estudio de campo por parte de la Unidad de Bienes Inmuebles, cuyos resultados no se acreditan, es lo cierto que en lo esencial se fundamenta en la recomendación y elementos que fueron determinados por el Órgano de Normalización Técnica del Ministerio de Hacienda. Conforme lo señalado en el Considerando anterior, dicho estudio carece de rigurosidad técnica para determinar con certeza la desvalorización de los inmuebles ubicados dentro del área de influencia de la líneas de alta tensión y por ende no resulta ser una prueba útil a los efectos de acreditar el daño reclamado por los actores en el proceso, toda vez que contiene una serie deficiencias que impiden acreditar que como consecuencia de la instalación de las torres de alta tensión se ha generado una disminución del valor de los inmuebles de los actores en un porcentaje del 50%.
Contrario a lo argumentado por el apelante, aún cuando el Municipio consideró que los estudios realizados por el Ministerio de Hacienda contenían una base científica y técnica para declarar una reducción de la base imponible del impuesto sobre bienes inmuebles, es lo cierto que las valoraciones de la Municipalidad parten de las mismas premisas y contienen las mismas omisiones y falta de fundamentación que el estudio realizado por el Órgano de Normalización Técnica, por lo que por paridad de razones no constituye prueba útil para acreditar la existencia del daño patrimonial reclamado por los actores en este proceso. Las argumentaciones del apelante en cuanto a los yerros de la sentencia de instancia respecto de la existencia y definición de la contaminación eléctrica, carecen de utilidad para efectos de la discusión del asunto tratado en autos, ya que que la existencia de un campo magnético generado por las torres de alta tensión ya fue determinado por la Sala Constitucional y en todo caso, el daño reclamado por los actores en el presente proceso no se fundamenta en la existencia de un daño a la salud de los actores con ocasión de la instalación de las torres de alta tensión, por lo que la discusión respecto de este tema y las posibles inconsistencias en que según el apelante incurrió el Juez de instancia sobre el particular, resulta inconducente a efecto de variar lo fallado.
En razón de lo dicho los agravios formulados por el apelante respecto del rechazo de ésta prueba para acreditar el daño reclamados en este proceso, no son de recibo y deben ser rechazados. 3. RESPECTO DEL INFORME PERICIAL. El peritaje judicial rendido por el Arquitecto Nombre39923 (visible a folios 838 a 1020) y su ampliación (folios 1038 a 1058), estableció como objetivo general determinar el grado de afectación de las propiedades conlindantes a las líneas de alta tensión en el proyecto la Caja-Belén y como objetivos específicos determinar la afectación por distancia a la zona de protección del tendido de alta tensión (afectación directa o indirecta); determinar la afectación en el mercado inmobiliario (afectación al paisaje urbano y contaminación visual) y; la determinación de la afectación a la salud y al medio ambiente. El perito procedió a determinar el valor unitario del terreno y de la construcción de las propiedades de cada uno de los accionantes, considerando los servicios públicos, equipamiento urbano, características de la zona, ubicación geográfica del inmueble, características propias referidas a área, topografía, uso, grado de explotación, oferta y demanda de terrenos idénticos y dentro de la zona en estudio, investigación minuciosa sobre valores actuales de terrenos con iguales características.
Luego procede a realizar un resúmen de afectación, tomando como parámetros el valor del terreno, el valor neto de reposición, el valor final (valor de terreno+valor neto de reposición), índice de afectación y valor final afectado. En lo que respecta al índice de afectación de los inmuebles, el peritaje reconoce tres factores: factor distancia, contaminación visual y factor salud humana y ambiente sano, siendo que el índice de afectación se determina utilizando la siguiente fórmula: factor distancia + factor de contaminación visual + factor salud y el resultado lo divide entre tres. La determinación del índice de afectación de cada uno de los inmuebles, es definido a partir de las siguientes variables, mismas que son de aplicación a cada uno de los factores de afectación, de la siguiente forma: Un porcentaje de afectación de un 1 a 0.50 si el inmueble se encuentra a una distancia 20 metros o menos de las líneas de alta tensión; un porcentaje de afectación de 0.50 a 0.25 si el inmueble se encuentra a una distancia de 20 a 30 metros de las líneas de alta tensión y un porcentaje de afectación de 0.25 a 0 si el inmueble se encuentra a una distancia de 30 metros o más de las líneas de transmisión.
Conforme lo señala el Juzgador de instancia y que avala éste Tribunal, el peritaje rendido en autos contiene una serie de inconsistencias metodológicas y de fundamentación que impide su consideración como prueba idónea y útil que permita determinar el daño pretendido por los actores en este proceso. En efecto, no se aprecia en la pericia la base técnica o científica que fundamenta la determinación de los factores y variables que utilizó para definir el grado de afectación del valor de los inmuebles. El peritaje no establece las razones por las cuáles el índice de afectación de los inmuebles se define a partir de los factores distancia, contaminación visual y daño a la salud y ambiente sano. Además, la pericia no establece con base en qué criterios técnicos se determinan las variables que definen el porcentaje de afectación de cada uno de los factores (de un 1 a 0.50 si el inmueble se encuentra a una distancia 20 metros o menos de las líneas de alta tensión; de un 0.50 a 0.25 si el inmueble se encuentra a una distancia de 20 a 30 metros de las líneas de alta tensión y de un 0.25 a 0 si el inmueble se encuentra a una distancia de 30 metros o más de las líneas de transmisión).
Las anteriores inconsistencias de metodología generan la imposibilidad de considerar la utilidad y pertinencia de dicha prueba para acreditar la existencia e individualización del daño reclamado en el proceso por los actores respecto de la disminución del valor de los inmuebles de su propiedad en un porcentaje de al menor un 50% de su valor con ocasión de la instalación de las torres de alta tensión. En razón de lo dicho, resulta inútil para variar lo fallado el análisis por parte de éste Tribunal de las argumentaciones del apelante en cuanto a las consideraciones del sentencia de instancia respecto de la asignación que hace el peritaje de un mismo nivel de afectación en casi todos los inmuebles de un 50%, así como respecto de la distancia y ubicación de las propiedades respecto de las líneas de alta tensión y la forma en que cada uno de los factores y variables utilizados afectan cada propiedad.
Por paridad de razones, resulta inconducente para variar lo fallado el análisis de los alegatos del apelante respecto de las consideraciones contenidas en la sentencia respecto de la existencia de la franja de contaminación electromagnética y su efecto para la valoración del factor salud humana y ambiente sano. Lo anterior toda vez que si bien la percepción respecto del potencial daño que puede causar a la salud humana la exposición a este tipo de contaminación, pudiera generar un efecto en la intencionalidad de compra de eventuales interesados en los inmuebles, las inconsistencias metodológicas del dictamen pericial, impiden determinar el efecto que sobre el valor de las propiedades de los actores pudiera generar este factor. En razón de lo dicho los agravios formulados por el apelante respecto del rechazo de ésta prueba para acreditar el daño reclamados en este proceso, no son de recibo y deben ser rechazados. 4.
RESPECTO DEL RECONOCIMIENTO JUDICIAL. En cuanto al acta de reconocimiento judicial, contrario a lo argumentado por el apelante, ésta prueba no resulta útil para acreditar la relación de causalidad entre la actuación administrativa acusada y el daño reclamado por los accionantes en este proceso. Lo anterior toda vez que conforme bien lo señala el Juzgador de instancia, dicha prueba se limita a acreditar el estado de las cosas al momento de la visita del Juez, pero no resulta idónea para acreditar el grado de afectación del valor de los inmuebles en el porcentaje reclamado en este proceso 5. RESPECTO DE LAS DECLARACIONES TESTIMONIALES. Constituye un deber del Juez realizar una valoración de las distintas pruebas alegadas por las partes conforme al principio de sana crítica racional entre ellas la prueba testimonial evacuada, siendo que contrario a lo argumentado por el apelante, de la prueba testimonial evacuada en autos, no se acredita la existencia del daño reclamado en este proceso. a- En el caso del testimonio rendido por Nombre39928 (folios 495 a 497), contrario a lo argumentado por el apelante, este no es desechado por el Juzgador de instancia de manera exclusiva en razón de que sus deposiciones son propias de un perito y no de un testigo, sino en razón de que su testimonio no resulta útil a efecto de acreditar el daño reclamado por los actores.
En efecto, el testigo se limita a formular una serie de consideraciones con base en su experiencia como perito valuador de varias Instituciones y de su conocimiento de la zona, sobre las circunstancias que en su criterio personal han generado una disminución en el valor de los inmuebles propiedad de los accionantes con ocasión a la instalación de las torres de alta tensión. El testigo señala que realizó una serie de conversaciones con peritos y funcionarios bancarios y de la Municipalidad de Belén, respecto de la disminución en el valor de los inmuebles y de las virtudes del estudio realizado por el Ministerio de Hacienda a los efectos de rebajar en un 50% de la base imponible para efectos del Impuesto sobre Bienes Inmuebles, siendo que para realizar el plano de valores el Municipio le tomó su parecer. Conforme lo señala el Juzgador de instancia y que es avalado por éste Tribunal, el testimonio contiene una serie de deficiencias que impiden acreditar la existencia del daño reclamado en este proceso.
En efecto, el testigo se limita a señalar como fundamento de sus consideraciones respecto de la existencia de una disminución del valor de los inmuebles de los actores que obtuvo información de peritos bancarios, peritos de Tributación Directa y de informaciones de entidades bancarias según las cuáles no admitían garantías de inmuebles ubicados en zonas donde hubieran cables de alta tensión, siendo que el testigo no especifica cual es la fuente, de que entidades bancarias se refiere, el nombre concreto de los funcionarios y peritos que le sirvieron como fuente y los fundamentos técnicos en que dichas fuentes fundamentan sus argumentos. Además se limita a señalar que fungió como Asesor de la Municipalidad de Belén y del Ministerio de Hacienda, pero de manera clara y expresa señala que no realizó ningún avalúo específico, lo que sostiene lo ha hecho a nivel de conversación de peritos, más no así realizando peritajes.
En esencia el testigo se limita a señalar una serie de consideraciones personales y que por ende resultan subjetivas por ausencia de prueba que la ampare, respecto de la disminución que en su consideración sufrieron los inmuebles propiedad de los demandados con ocasión de la instalación por parte del demandado de las torres de alta tensión. Contrario a lo argumentado por el apelante, no basta con el sólo dicho del testigo, debe existir algún medio de comprobar las condiciones de modo, tiempo y lugar en que sostuvo las conversaciones con peritos y funcionarios bancarios a efecto de determinar cual fue el fundamento técnico que tuvieron esas otras fuentes de información para considerar la existencia de una disminución del valor de los inmuebles de los actores y de esa forma someter dichos criterios al contradictorio para permitir a la parte contraria a referirse sobre dichas consideraciones, por lo que no basta el simple dicho del testigo para tener por ciertas sus manifestaciones.
Contrario a o aducido, de manera independiente a que la parte demandada no hubiera impugnado dicha declaración en el momento de la deposición, el Juez tiene el deber de realizar una valoración de dicha prueba conforme a los principios de la sana crítica, lo cual no implica de ninguna manera el quebranto del principio de preclusión procesal. El hecho de que la prueba testimonial fuera desechada por el Juez de instancia, no implica cuestionamiento respecto de la condición personal o profesional del testigo, siendo que en criterio de éste Tribunal el Juzgador ha procedido de manera adecuada a valorar éste testimonio, el cual no resulta suficiente para acreditar la existencia del daño reclamado. Las consideraciones del testigo respecto de las distintas condiciones de las torres de alta tensión con relación al tendido eléctrico que existía, el fuerte ruido que según el testigo generan las torres de alta tensión y la afectación a la belleza escénica, como factores desvalorizantes de la propiedad, constituyen simples opiniones personales del testigo, que por sí solos no logran demostrar la existencia del daño reclamado por los actores en este proceso.
Asimismo, las consideraciones del testigo respecto de la comparación histórica entre las ocasiones en que valoró los inmuebles de Bosques de Doña Rosa, no se encuentra amparada a la existencia de prueba alguna en ese sentido, pues dichos estudios históricos no han sido aportados a los autos como prueba. b- En cuanto a la declaración del testigo Nombre39925 (folios 498 a 499) , éste Tribunal avala la consideración del Juzgador de instancia al desacreditar el valor probatorio de éste testimonio toda vez que la deposición tampoco resulta útil para los efectos de los pretendido por la parte actora en el proceso. En efecto, el testigo se limita a señalar su experiencia como perito valuador del Ministerio de Hacienda y funcionario del Órgano de Normalización Técnica del Ministerio de Hacienda que realizó conjuntamente con Nombre39927 , el estudio para medir el efecto de las torres y líneas de alta tensión en el Distrito de Belén y que sirvió da base al Municipio a declarar una disminución de un 50% de la base imponible del Impuesto sobre Bienes Inmuebles de las propiedades ubicadas en el área de influencia de las torres de alta tensión.
Señala el testigo que las conclusiones y recomendaciones formuladas fueron determinadas con base al análisis del expediente de la Sala Constitucional, entrevistas a personas conocedoras de la materia, valuadores expertos en materia de valoración de inmuebles , con relación a la afectación de los campos electromagnéticos y su efecto en la pérdida de valor de los inmuebles, llegando a concluir que los valores en la zona eran significativamente menores al resto de la zona, y que según algunas personas podían ubicarse en un rango del 50% y hasta un 75% de su valor, por lo que escogieron recomendar un 50%, considerando la pérdida de belleza escénica del lugar por la permanencia de las torres, los ruidos que generaban, la interferencia en las señales de radio y televisión. Asimismo, señala el testigo que en el estudio de campo consultaron a peritos del sistema bancario nacional quiénes dijeron que normalmente no aceptan propiedades afectadas por campos de líneas de alta tensión o en las cercanías de éstas, dada la dificultad de vender dichas propiedades.
Contrario a lo argumentado por el apelante, el testimonio descrito no constituye una prueba objetiva que resulte útil para acreditar el daño que reclaman los actores en este proceso. Lo anterior, toda vez que el testigo se limita a confirmar las consideraciones del estudio de valores realizado por ellos en su condición de funcionario del Órgano de Normalización Técnica y que fundamentó el acuerdo de la Municipalidad de Belén. Conforme se señaló en el presente Considerando, el estudio realizado por el Órgano de Normalización Técnica contiene una serie de deficiencias metodológicas que impiden tenerlo como prueba útil para acreditar el daño reclamado por los actores, siendo que el testimonio rendido viene a confirmar las deficiencias de dicho estudio, pues de ninguna de las dos fuentes probatorias se logra comprobar el fundamento técnico o científico que se tuvo para recomendar una disminución de un 50% del valor de los inmuebles de los actores, ni la certeza de la fuentes empleadas para llegar a la formular dicha recomendación.
Lo anterior toda vez que el testigo se limita a señalar que realizó una serie de conversaciones con peritos y funcionarios bancarios respecto de la disminución en el valor de los inmuebles y de las virtudes del estudio realizado por el Ministerio de Hacienda a los efectos de rebajar la base imponible para efectos del Impuesto sobre Bienes Inmuebles, pero no señala las condiciones de modo, tiempo y lugar que permitan confirmar la existencia de dichas conversaciones y cuales fueron los criterios empleados para determinar la disminución del valor de los inmuebles en el porcentaje señalado por dichas fuentes, siendo que contrario a lo argumentado por el apelante, el rechazo del testimonio no se fundamenta únicamente en el hecho de que éste constituye una repetición del estudio efectuado por el testigo como funcionario del Órgano de Normalización Técnica. No basta con el sólo dicho del testigo, pues debe acreditar de manera debida las condiciones (quién, donde, como, cuando), en que sostuvo las conversaciones con peritos y funcionarios bancarios a efecto de poder determinar cual fue el fundamento técnico que tuvieron esas otras fuentes de información para considerar la existencia de una disminución del valor de los inmuebles de los actores y de esa forma someter dichos criterios al contradictorio.
Las consideraciones del testigo respecto de las distintas condiciones de las torres de alta tensión respecto al tendido eléctrico que existía, el fuerte ruido que según el testigo generan las torres de alta tensión y la afectación a la belleza escénica, como factores desvalorizantes de la propiedad y su efecto en la desvalorización de los inmuebles, constituyen simples opiniones personales del testigo, que por sí solos no logran demostrar la existencia del daño reclamado por los actores en este proceso. En punto a la cita que realiza el apelante respecto del contenido de la deposición del testigo Nombre39925 , visible a folio 501 debe señalarse que esas manifestaciones corresponden al testigo Nombre39927 . c- En cuanto a la declaración del testigo Nombre39927 , su testimonio tampoco resulta útil para acreditar el daño reclamado por los accionantes en este proceso. En efecto el testigo se limita a señalar su experiencia como perito valuador en el Ministerio de Hacienda y diversas Municipalidades del país, entre ellas la Municipalidad de Belén, haciendo planos valores y el plano de zonas homogéneas y actualización de valores en todo el Cantón, para lo cual según indica en su deposición, debió realizar un estudio de campo que involucró unas 40 veces de visita.
Señala el testigo que en este caso para determinar la plataforma de valores en la zona tomó muestras de oferta de valor, ventas realizadas, consultas a peritos en este caso al señor Roberto Loría que cree es el Jefe de peritos del Banco de Costa Rica, peritos del Banco Nacional, vendedores de bienes raíces, funcionarios del Ministerio de Hacienda, referencias de plataformas anteriores, estudios en Cantones aledaños y otras referencias que pudieran ayudar a determinar el valor. Indica que en el caso concreto, consideró la afectación en la disminución del valor de los inmuebles en un 50%, considerando que hubo mucha oferta y poca demanda debido a la existencia del cableado de las torres que hace que el valor disminuya, siendo que según le manifestó el señor Roberto Loría, el había tasado propiedades con problemas de cableado hasta en un 25% del valor. Añade el testigo que además otros colegas del Banco Nacional, le insinuaron que ya no se tomaba en garantía servidumbres de paso donde pasaba el cableado eléctrico, entre otras razones por los problemas de liquidación de estos inmuebles ante el incumplimiento de pago por parte de los deudores.
Indica que cuando hizo la primera plataforma de valores, no había diferenciación de valores, no había la poca deseabilidad de venta, no habían las ofertas, no bajaron los precios como se hizo ahora, porque el panorama era el corriente de una urbanización, siendo que ahora si hubo diferencia que afectó el valor respecto del primer estudio, originado en la pérdida de belleza escénica y el temor de la gente por la existencia de el campo electromagnético. Contrario a lo argumentado por el apelante de un análisis detallado del testimonio brindado, no se puede considerar la acreditación de la existencia del daño reclamado por los actores en este proceso. Si bien el perito señala que realizó un estudio de campo que involucró más de 40 visitas y consultas a diversos peritos del Ministerio de Hacienda, Banco de Costa Rica, Banco Nacional, vendedores de bienes raíces, referencias de plataformas anteriores, estudios en Cantones aledaños y otras referencias que pudieran ayudar a determinar el valor, es lo cierto que no se ha acreditado las condiciones de modo, tiempo y lugar (quién, como, donde, cuando) en que se hicieron tales consultas y cuales fueron las consideraciones de dichas fuentes para determinar la existencia de una desvalorización de los inmuebles en los términos en que fueron recomendados en el estudio realizado por el Órgano de Normalización Técnica del Ministerio de Hacienda, en el cual participó el testigo.
Conforme se señaló en el presente Considerando, dicho estudio adolece de una serie de deficiencias metodológicas que impiden tenerlo como prueba útil para acreditar el daño reclamado por los actores en este proceso, siendo que el testimonio rendido viene a confirmar las deficiencias de dicho estudio, ya que conforme se ha dicho, ninguna de las dos fuentes logra acreditar de manera objetiva el fundamento técnico o científico que se tuvo para recomendar una disminución en la base imponible del Impuesto sobre Bienes Inmuebles en un porcentaje del 50% del valor de los inmuebles de los actores, ni la certeza de las fuentes empleadas para llegar a formular dicha recomendación. Nótese que el testigo al momento de fundamentar las razones por las que recomendó una disminución del valor de los inmuebles en el porcentaje dicho, se limita a señalar que lo hizo con base a consideraciones del señor Roberto Loría, quién según su dicho es un perito de un Banco estatal respecto de tasaciones de propiedades con problemas de cableado eléctrico que fueron tasadas en un 25% de su valor, pero sin que el perito acredite cuales propiedades, en que condiciones y cuales fueron los parámetros para determinar una disminución del valor en ese porcentaje.
Asimismo señala que la recomendación se formuló considerando insinuaciones de funcionarios del Banco Nacional respecto de la política de no tomar como garantía servidumbres de aso donde pasara cableado eléctrico, por los problemas de liquidar los inmuebles ante un eventual incumplimiento. Las razones brindadas por el testigo carecen de rigor técnico y no son suficientes en criterio de éste Tribunal para fundamentar el porcentaje de disminución del valor de los inmuebles en un porcentaje del 50%, pues los criterios y parámetros no son objetivos, ni las fuentes constatables. En razón de lo dicho, ésta Cámara avala las consideraciones del Juzgador de instancia para desechar éste testimonio como prueba útil para acoger las pretensiones de la parte actora en el proceso. El hecho de que según manifiesta el testigo, sí había realizado valoraciones previas en la misma zona, con ocasión de la primera vez que asesoró a la Municipalidad de Belén en la elaboración de una plataforma de valores de bienes inmuebles, resulta un hecho que carece de utilidad para variar lo fallado, toda vez que no se ha acreditado en autos -salvo el dicho del testigo- que tales estudios hubieran sido realizados, ni sus resultados a efecto de someterlos al contradictorio.
En criterio de éste Tribunal, las argumentaciones del apelante respecto de las consideraciones esgrimidas por el Juzgador de instancia para desacreditar el testimonio no son de recibo, toda vez que obedece a una valoración acertada de la deposición del testigo. En este mismo sentido carece de relevancia para efectos del proceso el argumento del apelante en cuanto a la existencia de una incongruencia de la sentencia de instancia, al señalar el Juzgador A-quo que el señor Roberto Loría fungió como testigo en el proceso, lo cual no es conforme a los autos. Si bien lo consignado en este sentido constituye un error de apreciación por parte del Juzgador, pues el señor Loría no fue llamado como testigo en el proceso, es lo cierto que dicha consideración en nada incide en lo fallado respecto de la falta de idoneidad de la prueba testimonial ofrecida por la parte actora. En razón de lo dicho, las consideraciones del testigo respecto de las distintas condiciones de las torres de alta tensión con relación al tendido eléctrico que existía, el fuerte ruido que según el testigo generan las torres de alta tensión y la afectación a la belleza escénica, como factores desvalorizantes de la propiedad, constituyen simples opiniones personales del testigo, que por sí solas no logran demostrar la existencia del daño reclamado por los actores en este proceso. 6.
RESPECTO DE INDEMNIZACIÓN DE OTRAS PROPIEDADES EN EL PAIS. Los argumentos del apelante en cuanto al deber de reconocer en sentencia las pretensiones formuladas en juicio tomando en consideración que el Instituto demandado ha reconocido indemnizaciones a propietarios de bienes inmuebles afectados por proyectos similares en San Carlos y Liberia, carece de fundamento, toda vez que aún cuando el demandado hubiera reconocido este tipo de indemnizaciones, ésta circunstancia no constituye prueba útil para acreditar el daño reclamado en este proceso por los actores. En este sentido la prueba documental ofrecida (folios 295 y 455 a 479) y el estudio de impacto ambiental de la línea de trasmisión eléctrica Miravalles-Liberia (folio 479), no vienen a constituir una prueba válida para para hacer un reconocimiento económico como el pretendido por los actores en este proceso, pues constituye una prueba indirecta que no resulta idónea para demostrar la existencia del daño reclamado, ya que contrario a lo argumentado, las pruebas correspondientes a la indemnización a propietarios de inmuebles de otros proyectos, no permite vincular la relación de causalidad adecuada, entre la actuación administrativa y los daños reclamados en este proceso.
En el presente caso no existe prueba en autos que acredite de manera fehaciente la existencia del daño alegado por los actores para tener por demostrado el daño patrimonial reclamado, correspondiente a una indemnización de al menos un cincuenta por ciento del valor actual de mercado de las respectivas propiedades ubicadas frente al paso de torres y cables de alta tensión para el trasiego de energía eléctrica.
Aún cuando en criterio de éste Tribunal, atendiendo a principios de experiencia y lógica, pudiera resultar razonable considerar que la instalación de las torres de alta tensión pueden generar un efecto negativo en la intención de compra de los inmuebles ubicados en el área de influencia del proyecto "deseabilidad de compra" y por ende de la oferta y la demanda (ante la existencia de un impacto visual negativo, contaminación sónica y el temor de los compradores por los eventuales daños que pudieran generar a la salud humana la exposición a campos electromagnéticos), es lo cierto que la prueba allegada a los autos por la parte actora resulta insuficiente para acreditar de manera debida la existencia de los daños -al menos en la forma reclamada en este proceso- respecto de la afectación en el valor de la propiedades en un porcentaje no menor a un 50%, conforme lo reclama la parte actora en juicio.
Además, existe una imposibilidad de diferir la determinación de la existencia del daño y su cuantificación a la vía de ejecución de sentencia, conforme lo pretende el apelante, toda vez que conforme a la naturaleza del reclamo civil objeto del presente proceso, aún cuando la cuantificación del daño resulte incierta, corresponde a la parte actora demostrar la existencia del daño. Lo anterior ya que conforme lo señala expresamente el artículo 62, inciso c) de la Ley Reguladora de la Jurisdicción Contencioso Administrativa, cuando se hubiere pretendido el resarcimiento de daños o la indemnización de perjuicios, la sentencia podrá formular pronunciamiento concreto sobre la existencia y cuantía de los mismos, siempre que constaren probados en autos y en otro caso, se limitará a declarar el derecho quedando al período de ejecución de sentencia la determinación de la correspondiente cuantía. Si bien el numeral citado, establece la posibilidad de condena en abstracto de daños y perjuicios, la misma queda sujeta a la demostración de su existencia, lo cual no ha hecho la parte actora en este proceso por prueba que en criterio de éste Tribunal resulte idónea, lo que impide reconocer en sentencia la pretensión indemnizatoria reclamada, siendo que contrario a lo argumentado por el apelante, la carga de la prueba respecto de la disminución patrimonial de los inmuebles con ocasión de la instalación de las torres de alta tensión no le corresponde al demandado, sino a los actores (doctrina del artículo 317 del Código Procesal Civil), pues corresponde a los demandantes demostrar con prueba idónea la existencia del daño reclamado y la relación de causalidad con la actuación administrativa.
De conformidad con lo establecido por el artículo 98 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa y el artículo 221 del Código Procesal Civil aplicable al sub-júdice por dispensa del artículo 103 de la Ley Reguladora de la materia, la condenatoria en costas se impone al vencido por el sólo hecho de serlo, sin que dicha condenatoria implique una calificación de temeridad o mala fe. Dicha regla deriva de la necesidad de que se reconozcan a la parte gananciosa los costos en que incurrió para ejercer la defensa de un derecho o interés que debió tutelar ante la perturbación que de ellos hizo un tercero, o bien, de la defensa de pretensiones ejercidas en su contra; costos que, de no haberse planteado el proceso, no hubiese tenido que afrontar. Contrariamente cuando se exonera de ese pago, el Juzgador debe justificar su proceder, por ser ésta la excepción a la regla. Excepcionalmente puede eximirse al vencido al pago de una o ambas costas, cuando ha litigado con evidente buena fe, o cuando la demanda o contrademanda comprendan pretensiones exageradas, o bien cuando el fallo acoja solamente parte de las peticiones fundamentales de la demanda o reconvención, así como si el fallo admite defensas importantes invocadas por el vencido, e incluso si hay vencimiento recíproco.
En el sub-lite, considera éste Tribunal que a pesar de que no lleva razón la parte actora en su demanda, existen elementos que permiten considerar válidamente la existencia de motivo suficiente para litigar y someter el asunto a la vía judicial. En efecto la existencia del Informe del Organismo de Normalización Técnica, del Ministerio de Hacienda y la existencia del acuerdo de la Municipalidad de Belén que acogieron una reducción de un porcentaje de un 50% del valor de los inmuebles de los actores para efectos del Impuesto sobre Bienes Inmuebles, podría constituir elementos que permitan razonablemente someter a conocimiento de los Tribunales de Justicia la indemnización que con ocasión de dichos documentos consideraban los actores que lea asistía. Si bien las pretensiones de los actores no han sido reconocidos en juicio por las razones enunciadas en los Considerando precedentes, si considera ésta Cámara que existe motivo suficiente para litigar y por ende para eximir a los vencidos al pago de las costas. En tal sentido, se deberá revocar la sentencia apelada, únicamente en lo relativo a la condena en costas a los demandados, debiendo fallarse el asunto sin especial condenatoria.
Por lo expuesto, motivos y razones dadas, en lo que ha sido objeto de recurso, se deberá revocar parcialmente la sentencia apelada únicamente en cuanto condenó a los demandados al pago de las costas, debiendo fallarse el asunto sin especial condenatoria. En lo demás se deberá confirmar la sentencia venida en apelación.
POR TANTO
En lo que ha sido objeto de apelación, se revoca parcialmente la sentencia apelada, únicamente en cuanto condenó a la parte actora al pago de ambas costas, debiendo fallarse el asunto sin especial condenatoria. En lo demás de confirma el fallo apelado. NOTIFÍQUESE.
