APPEAL (RECURSO DE APELACIÓN) filed in the present proceedings against [Nombre1], with CED1 CED2, for VIOLATION OF THE LEY DE PESCA, in the form of unlawful transportation, possession, and storage of Aquatic Flora and Fauna Products, TO THE DETRIMENT OF NATURAL RESOURCES. Judges [Nombre2], María Gabriela Rodríguez Morales, and Ligia Arias Alegría participated in deciding the appeal. Attorney [Nombre3], Deputy Attorney for the State (Procurador Adjunto), appeared in the appeal proceedings.

FINDINGS (RESULTANDO):

  1. 1By judgment number 31-F-12, issued at nineteen hours and fifty-six minutes on veintiuno de febrero de dos mil doce, the Tribunal de Flagrancia de Puntarenas ruled: “POR TANTO: Based on the foregoing and Articles 30 subsection k), 311 subsection d), and 312 of the Código Procesal Penal, a final dismissal (Sobreseimiento definitivo) is ordered in favor of [Nombre1] for the offense of VIOLATION OF THE LEY DE PESCA, in the form of unlawful transportation, possession, and storage of Aquatic Flora and Fauna Products, which was attributed to him to the detriment of NATURAL RESOURCES. The motor vehicle [Placa1] shall be permanently delivered to whoever demonstrates that they are its lawful owner once this decision becomes final; the case file shall be closed, and any restriction of liberty or precautionary measure (medida cautelar) ordered against the accused shall be lifted. This matter is decided without a special award of costs. Notice shall be given.
  2. 2Attorney [Nombre4], Deputy Attorney for the State, filed an appeal against the foregoing ruling.
  3. 3After conducting the corresponding deliberation in accordance with Article 465 of the Código Procesal Penal, the Court proceeded to consider the appeal.
  4. 4The relevant statutory requirements have been observed in the proceedings.

Appellate sentencing judge [Nombre5] drafts the opinion; and,

CONSIDERING:

I.By a written submission filed on 24 de abril de 2012, attorney [Nombre4], in his capacity as Deputy Attorney for the State, filed an Appeal from Judgment (Recurso de Apelación de Sentencia) against decision number 31-F-12, issued by the Tribunal Penal de Puntarenas, Sección Flagrancia, at 19:50 on 21 febrero del año 2012, whereby a final dismissal was ordered in favor of the accused [Nombre1] for the offense of violating the Ley de Pesca, to the detriment of natural resources.

II.As the first ground for his challenge, the appellant alleges a violation of Articles 1, 15, 16, 36, 38, and 428 of the Código Procesal Penal, and Article 3 subsection I) and Article 20 of the Ley Orgánica de la Procuraduría General de la República. According to the appellant, the final dismissal entered in favor of the defendant was improper because the conciliation agreement (conciliación) on which it was based was approved by the Tribunal de Flagrancia de Puntarenas without the consent of the Procuraduría General de la República (hereinafter referred to as the Procuraduría), as the State’s representative in its capacity as victim. Indeed, although the Procuraduría was notified of the record of the hearing at which the accused’s offer was presented, it stated—in a written submission appearing at folios 68 and 69—that it declined to address the offer because it lacked sufficient information to provide an adequate defense of the State.

Attorney [Nombre6] argues that the procedure established in Article 3 subsection I) of the Ley Orgánica de la Procuraduría General de al República was likewise not followed in this matter, because the proposed alternative measure (medida alterna) was approved without the Attorney for the State’s authorization. The appellant further considers that the victim suffered serious harm because the negotiations took into account the assessment of damages submitted by Incopesca, contained in a document that was not disclosed to the State, thereby preventing it from determining whether the agreement met its requirements as a victim. The State was also deprived of the opportunity to pursue other claims, such as forfeiture (comiso) of the truck used to commit the unlawful act, or requiring the defendant to perform community service to promote environmental conservation. In the appellant’s view, the decision of the lower court (Tribunal a quo) violated the State’s rights in its capacity as victim, as set forth in Article 71 subsection 3 of the Código Procesal Penal, which requires the adjudicating judge to consider the State’s position when reviewing the application of an alternative measure in lieu of trial.

In support of this argument, he cites voto 2012-00021 of the Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela. Finally, he notes that under Article 36 of the procedural code (Código de rito), the agreement must be reached between the victim—in this case, the State represented by the Procuraduría—and the accused. Consequently, because the former was not taken into account, that provision was violated. He requests that the appeal be granted and the challenged order (proveído impugnado) vacated.

III.As the second ground for his challenge, attorney [Nombre7] alleges a violation of Article 2 of the Ley de Notificaciones and Articles 367 and 489 of the Código Procesal Penal. He states that, by a written submission filed on 13 de abril del 2011, notice was requested to be served upon the legal representative of Mariscos Ticoporteño S.A.—the registered owner of the vehicle used in the events under investigation—because it is a third party with a civil interest (tercera civilmente interesada) in the proceedings; moreover, such notice is an indispensable requirement (sine qua non,) for obtaining forfeiture of the specified property. Furthermore, because that procedural step was incompatible with expedited flagrante delicto proceedings (proceso de flagrancia), the State requested, pursuant to Article 432 of the Código Procesal Penal, that the ordinary procedure (procedimiento ordinario) be applied in this case. However, that request was not addressed by the Tribunal de Flagrancia, which, despite the Procuraduría’s insistence, issued no ruling on the matter. This prevented consideration of the vehicle’s forfeiture and caused serious harm both to the State and to the Administration of Justice. He requests that the second ground of his appeal be granted and that the case be remanded (reenvío) for adjudication through the ordinary procedure.

III.The first ground of appeal is sustained. As an initial matter, the role performed by the Procuraduría General de la República in proceedings such as these must be clearly understood. Under Article 16 of the Criminal Code, the criminal action (acción penal) in environmental offenses may be brought by the Procuraduría General de la República jointly with or independently of the Ministerio Público. In addition, Article 38 establishes its authority to bring a civil action for damages (acción civil resarcitoria) for social harm (daño social) when criminal acts affect collective or diffuse interests (intereses colectivos o difusos). Likewise, Article 1 of its Organic Law establishes that this entity is responsible for representing the State in matters within its jurisdiction, with functional and decisional independence in the performance of its duties. Such powers are set forth in Article 3 of that same body of law, which states, among others: “...a) To represent the State in matters of any nature that are being or must be heard before the courts of justice. d) To participate in criminal cases, in accordance with the provisions of this law and the Code of Criminal Procedure. i) To act in defense of the national patrimony, the resources located in the maritime-terrestrial zone, the territorial sea, the exclusive economic zone, and the continental shelf.

To take the appropriate legal action to safeguard the environment, in order to guarantee every person’s constitutional right to a healthy and ecologically balanced environment. To ensure the proper application of conventions, international treaties, laws, regulations, and other provisions concerning these matters. To investigate, on its own initiative or at the request of a party, any action or omission that violates the aforementioned rules. To be recognized as a party, from the commencement of the proceedings, in criminal cases in which the commission of an offense or a violation of environmental legislation or the Law on the Maritime-Terrestrial Zone is alleged. For this purpose, it may bring the criminal action on its own initiative, without being subordinate to the actions and decisions of the Ministerio Público; file the same appeals that the Code of Criminal Procedure grants to the latter; and bring the civil action for damages...

  • I)To propose and enter into settlements or agreements during the processing of any proceeding when it deems them appropriate and timely. In such cases, written authorization shall be required from the Procurador General, the Deputy Procurador General, or the official to whom they delegate such authority.” The foregoing provisions make clear that the Procuraduría represents the interests of the State in matters involving environmental offenses, because the State is responsible for guaranteeing its inhabitants a healthy and ecologically balanced environment. Therefore, there can be no doubt that the State is a victim in this matter and that its legal representation falls to the Procuraduría General de la República. Turning to the specific case, this Sentence Appeals Chamber finds that the rights of the Procuraduría, as the victim’s representative, were disregarded. A review of the actions recorded in the investigation file (legajo de investigación) shows that, inconsistently, both the Ministerio Público and the Tribunal Penal de Flagrancia de Puntarenas went from recognizing the Procuraduría’s role in the proceedings to disregarding it entirely.

Thus, the document at folio 18 shows that the Ministerio Público notified that entity that the initial hearing had been scheduled for 17:15 hours on 12 de abril del 2011, but it was held at 20:20 hours on 15 de abril following (see minutes at folio 35), with no record in the main case file or in digital form of any notice to the Procuraduría concerning that change of date, much less any summons to the subsequent hearings. As a result, the Procuraduría was unable to participate in that procedural act, despite the appearance in the proceedings of Licenciado [Nombre4] as Deputy Procurador (folio 60), who stated in writing his interest in participating therein, in asserting civil claims, and even in expressing his position concerning the flagrante delicto procedure (procedimiento de flagrancia) (folios 22 and 23). At that hearing, the Criminal Court ordered that the case proceed under that special procedure without even considering the written motion—filed by Licenciado [Nombre7]—requesting that the ordinary procedure (procedimiento ordinario) be applied to the matter.

The defendant’s counsel subsequently proposed a settlement (conciliación), but because the Procurador was absent, the proceeding was adjourned at the request of the Ministerio Público in order to obtain the Procuraduría’s position. During that same proceeding, the prosecution submitted a document assessing the ecological damage, prepared by the Instituto Costarricense de Pesca y Acuicultura (Incopesca). By official letter dated 20 de abril del 2011, communicated to the Procuraduría on 26 de abril del 2011 at 15:15 hours (folios 65 and 64), the Tribunal Penal de Flagrancia informed it of the defendant’s settlement proposal and requested that it send its response to that offer by fax—that is, in writing. Although the letter stated that the hearing would resume on 27 de abril de 2011, the Procuraduría was not summoned to it, since it was not even informed of the time at which it would be held, nor was it advised of the existence of the environmental-damage assessment prepared by Incopesca.

As requested, in a written submission dated 27 de abril del 2011 (folios 61 and 62), Licenciado [Nombre8], substituting for the Procurador who had entered an appearance, stated that the submission dated 13 de abril was reaffirmed because the environmental-damage assessment was unavailable and the third-party owner of the property subject to forfeiture (comiso) had not been notified. He complained that he had not been duly notified of the date set for the initial hearing, thereby violating the right of the State’s legal representative to participate as a private prosecutor (querellante) and civil plaintiff (actor civil); finally, he stated that those irregularities prevented him from taking a position on the proposed reparation plan (plan reparador). On 27 de abril del 2011, the hearing resumed to consider the proposed alternative measure (medida alterna). No representative of the Procuraduría appeared; however, the Ministerio Público stated that on that same day “it contacted that representation by telephone, and they stated that they had no interest in reaching a settlement in this case” (sic, folio 66).

Notwithstanding the foregoing, at 18:07 hours the Trial Judge ruled that the case would continue under the flagrante delicto procedure and, despite the appearance in the proceedings of a Deputy Procurador of the Republic, determined that the Ministerio Público was the party legally authorized to state a position on the defendant’s settlement proposal. Thus, beginning at counter 18:10:10 of digital file c0000110427181012.vgz, the Court ruled: “Well then, after analyzing the arguments presented by the Procuraduría at folios 59 to 63, where where it essentially requests that the abbreviated procedure be applied—excuse me, the ordinary procedure—a position this Court does not share because, as the parties, both the defense and the Prosecutor, have correctly pointed out, folio 18 shows that on 08 de abril of the current year, notice was given by fax and the Procuraduría was granted a period of three hours to state whether it was interested in having this case processed under the expedited flagrante delicto procedure (procedimiento expedito de flagrancia); it was also informed that the initial hearing would be held at 17:15 hours on the 12th of that same month and that this was the procedurally appropriate time to file the private prosecution (querella) or civil action (acción civil).

However, at folios 22 to 23, on 13 de abril de 2011—that is, one day after the hearing that had been heard the previous day—the Procurador states that, because an environmental assessment must be performed and the company that is the registered owner of the vehicle must be notified, he requests that the ordinary procedure be applied in this case. The fact is that no injury and no right is being infringed with respect to the Procuraduría because, pursuant to Article 432, as the Prosecutor explained, it is during the first phase of the hearing that the civil plaintiff and the private prosecutor may constitute themselves as such. In the present case, however, it is apparent that proper notice had been given of this situation and that the hearing would be held. Excuse me, I neglected to state that I mistakenly said the initial hearing had been on the 12th; it was on the 15th. Nevertheless, this does not alter in any way what I am ruling.

Why? Because the expedited flagrante delicto procedure is a special procedure that is entirely oral, and once the Procuraduría’s representative has appeared, it is at that hearing that he must assert all such matters as he considers relevant to the defense of its interests. Certainly, filing a written submission and using it to request that these proceedings be transferred to the ordinary track is entirely improper because, as stated, it is at this hearing that the Procuraduría must assert its rights, in addition to the fact that, on the specified date, this judge had already ruled that the present case would be processed under the expedited flagrante delicto procedure. The Court considers that, even where there is opposition, it is for the Judge to assess it and decide whether or not the procedure applies in the present case. The Procuraduría has come to understand that this procedure is entirely different from the regular procedure.

And it is here, orally and in person, that the Procurador must come to assert his rights. Accordingly, despite the Procuraduría’s request that the ordinary procedure be applied, the judge decides to retain jurisdiction over the present case in this forum. Regarding the defense’s request that the settlement mechanism proceed as proposed, and given that, pursuant to the ruling I have just issued, the Procuraduría is no longer a party to these proceedings, but is merely a victim without a vote—that is, its statements are not binding—it falls to the Ministerio Público, as the State’s representative in the absence of the Procuraduría, to decide whether to accept the proposal that the defense reaffirms today and that had already been made. In this regard, because settlement is a matter for the parties, and because the Ministerio Público represents the interests of the State, it is the Ministerio Público and the defense that must, if they deem it appropriate, continue with the procedure.

I could not rule unilaterally without the consent of the Ministerio Público, and therefore I will give it the floor...” (18:18:20). This decision suffers from several defects. The first is the view that the Procuraduría may participate in the proceedings only if it appears as a private prosecutor and/or civil plaintiff, and that if it does not do so, its position cannot be considered, which openly contravenes Article 71(e) of the Code of Criminal Procedure. Second, it found that notice of the summons to the initial hearing had been properly given. Third, it found that the Ministerio Público could substitute for the Procuraduría General de la República as the State’s representative even though an official had duly entered an appearance in the proceedings. Even so, on that occasion the Ministerio Público did not agree to the settlement, and the proceeding was therefore adjourned once again.

However, on 29 de abril del 2011, with the consent of the Deputy Prosecutor of Puntarenas—as stated in the record at folios 70 and 71—the Public Prosecutor’s Office decided to settle with the accused and, with certain modifications to the original plan, agreed to enter into conciliation (conciliación) with him despite knowing that the victim, namely the State, represented by the Procuraduría, did not wish to use this mechanism. This agreement was approved by the Criminal Court and resulted in a final dismissal (sobreseimiento definitivo) in favor of the accused, which is now being appealed. The conciliation allowed under these terms violates Article 36 of the Code of Criminal Procedure (Código Procesal Penal), because, according to that provision, this alternative measure (medida alterna) is available “between the victim and the accused,” in this case between the State, represented by the Procuraduría, and the defendant [Nombre1].

That entity had already stated its objection to the proposed alternative measure, and therefore the Public Prosecutor’s Office could not assume the powers of the victim, which had duly entered an appearance in the proceedings (apersonada al proceso). Consequently, because the ruling is based on an action contrary to the provisions of law, the appeal is granted and judgment number 31-F-12, dismissing the case upon performance of the conciliation agreement, is vacated, together with all proceedings conducted since the initial hearing, because the Procuraduría General de la República was not duly summoned to that hearing. As unnecessary, no ruling is made on the second ground of appeal (motivo de recurso).

THEREFORE:

The dismissal judgment based on fulfillment of the conciliation agreement, number 31-F-12, is vacated, as are all proceedings conducted since the initial hearing, because the Office of the Attorney General of the Republic was not duly summoned to that hearing. As unnecessary, no ruling is made regarding the second ground of appeal. NOTICE SHALL BE GIVEN.

San Ramón, a las dieciséis horas veinticinco minutos del treinta de abril de dos mil trece.

RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre1], con CED1 CED2, por INFRACCIÓN A LA LEY DE PESCA, en su modalidad de transporte, posesión y almacenamiento ilegal de Productos de Flora y Fauna Acuáticos EN PERJUICIO DE LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, las juezas [Nombre2] , María Gabriela Rodríguez Morales y Ligia Arias Alegría. Se apersonan en apelación, el licenciado [Nombre3] , Procurador Adjunto.

RESULTANDO:

  1. 1Que mediante sentencia número 31-F-12 de las diecinueve horas cincuenta y seis minutos del veintiuno de febrero de dos mil doce, el Tribunal de Flagrancia de Puntarenas, resolvió: "POR TANTO: Con base en lo expuesto y los artículos 30 inciso k), 311 inciso d) y 312 del Código Procesal Penal se ordena el Sobreseimiento definitivo en favor de [Nombre1] por el delito de INFRACCIÓN A LA LEY DE PESCA , en su modalidad de transporte, posesión y almacenamiento ilegal de Productos de Flora y Fauna Acuáticos, que se les atribuyó en perjuicio de RECURSOS NATURALES. Se ordena la entrega definitiva del automotor [Placa1] a quien demuestre ser su legítimo propietario una vez firme la presente resolución, archívese el expediente, levántese cualquier restricción de libertad o medida cautelar que se haya ordenado contra el imputado. Se resuelve sin especial condenatoria en costas. Notifíquese.
  2. 2Que contra el anterior pronunciamiento, el licenciado [Nombre4] , Procurador Adjunto, interpuso recurso de apelación.
  3. 3Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal procedió a conocer del recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta la jueza de apelación de sentencia [Nombre5] ; y,

CONSIDERANDO:

I.Por escrito presentado el 24 de abril de 2012, el licenciado [Nombre4] , en su condición de Procurador Adjunto, interpuso Recurso de Apelación de Sentencia contra la resolución dictada por el Tribunal Penal de Puntarenas, Sección Flagrancia, número 31-F-12 de las 19:50 horas del 21 febrero del año 2012, mediante la cual se ordena el sobreseimiento definitivo en favor del imputado [Nombre1] por un delito de infracción a la ley de pesca, en perjuicio de los recursos naturales.

II.Como primer motivo de su impugnación, aduce el recurrente la infracción a los artículos 1, 15, 16, 36, 38 y 428 del Código Procesal Penal, artículo 3 inciso I) y 20 de la Ley Orgánica de la Procuraduría General de la República. Según el apelante, el sobreseimiento definitivo dictado a favor del encartado es incorrecto por cuanto la conciliación, que sustenta el mismo, fue homologada por el Tribunal de Flagrancia de Puntarenas sin contar con el consentimiento de la Procuraduría General de la República (en adelante llamada Procuraduría), como representante del Estado en condición de víctima. Incluso, aunque en el acta de la audiencia en la cual se expuso el ofrecimiento del imputado fue notificada a la Procuraduría, ésta -mediante escrito visible a folios 68 y 69- manifestó su negativa a pronunciarse sobre dicha oferta por no contar con elementos suficientes para la defensa adecuada del Estado.

Alega el licenciado [Nombre6], tampoco en este asunto se cumplió el procedimiento establecido en el artículo 3 inciso I) de la Ley Orgánica de la Procuraduría General de al República, dado que se aprobó la medida alterna propuesta, sin contar con la aprobación del Procurador. Por otro lado, considera el apelante, se causó un grave perjuicio a la víctima al realizarse la negociación tomando en cuenta la valoración de daños presentada por Incopesca, contenida en un documento que no fue puesto en conocimiento del Estado, impidiéndosele determinar si el acuerdo se ajustaba a sus exigencias como víctima. Asimismo, se le cercenó la posibilidad de plantear otras demandas, como el comiso del camión utilizado para la comisión del ilícito, o bien la realización por parte del encartado de trabajo social para promover la conservación del ambiente. Con la decisión tomada por el Tribunal a quo, en criterio del impugnante, se violentaron los derechos del Estado en su condición de víctima, contemplados en el artículo 71 inciso 3 del Código Procesal Penal, que impone la obligación del Juzgador del considerar su criterio cuando se conozca la aplicación de una medida alterna al juicio.

Para apoyar este argumento cita el voto 2012-00021 del Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela. Finalmente, señala, según el artículo 36 del Código de rito, el acuerdo se debe dar entre la víctima -en este caso el Estado representado por la Procuraduría- y el imputado. Entonces, al no haberse tomado en cuenta al primero, se produjo una violación a dicha norma. Solicita se declare con lugar el recurso de apelación planteado y se anule el proveído impugnado.

III.Como segundo motivo de impugnación, alega el licenciado [Nombre7] , violación del artículo 2 de la Ley de Notificaciones y los numerales 367 y 489 del Código Procesal Penal. Expone que mediante escrito presentado el 13 de abril del 2011, se solicitó la notificación al representante legal de la sociedad Mariscos Ticoporteño S.A. -propietaria registral del vehículo utilizado en los hechos investigados- pues es tercera civilmente interesada en el proceso; además, esta notificación es un requisito (sine qua non,) para lograr el comiso del bien indicado. Asimismo, por ser dicha diligencia incompatible con el proceso de flagrancia, de conformidad con el artículo 432 del Código Procesal Penal, el Estado requirió la aplicación del procedimiento ordinario en esta causa. Sin embargo, esa solicitud no fue atendida por el Tribunal de Flagrancia, el cual, pese a la insistencia de la Procuraduría, no resolvió al respecto. Así, se imposibilitó el análisis acerca del comiso del vehículo y se causó un grave perjuicio tanto al Estado como a la Administración de Justicia. Solicita, se declare con lugar el segundo motivo de su recurso y se ordene el reenvío de la causa, para ser conocida por la vía ordinaria.

III.Se declara con lugar el primer motivo del recurso. Como primer punto, debe tenerse clara la función que desempeña la Procuraduría General de la República, en un proceso como el presente. Según el artículo 16 del Código Penal, la acción penal en delitos contra el ambiente, puede ser ejercida por la Procuraduría General de la República en forma conjunta o independiente del Ministerio Público. Además el artículo 38 señala la facultad que tiene de ejercer la acción civil resarcitoria por daño social, cuando los hechos punibles afecten intereses colectivos o difusos. Asimismo, su ley orgánica en el artículo 1 establece que es a esta entidad a quien corresponde la representación del Estado en las materias propias de su competencia, con independencia funcional y de criterio en el desempeño de sus atribuciones. Tales facultades se contemplan en el artículo 3 del mismo cuerpo legal, señalando entre otras: "...a) Ejercer la representación del Estado en los negocios de cualquier naturaleza, que se tramiten o deban tramitarse en los tribunales de justicia. d) Intervenir en las causas penales, de acuerdo con lo que al efecto disponen esta ley y el Código de Procedimiento Penales. i) Actuar en defensa del patrimonio nacional, de los recursos existentes en la zona marítimo-terrestre, el mar territorial, la zona económica exclusiva y la plataforma continental .

Tomar las acciones legales procedentes en salvaguarda del medio, con el fin de garantizar el derecho constitucional de toda persona a un ambiente sano y ecológicamente equilibrado. Velar por la aplicación correcta de convenios, tratados internacionales, leyes, reglamentos y otras disposiciones sobre estas materias. Investigar, de oficio o a petición de parte, toda acción u omisión que infrinja la normativa indicada. Ser tenida como parte, desde el inicio del procedimiento, en los procesos penales en que se impute la comisión de una infracción o la violación de la legislación ambiental y de la Ley sobre la Zona Marítimo-Terrestre. Para ello, podrá ejercitar la acción penal, de oficio sin estar subordinada a las actuaciones y las decisiones del Ministerio Público; interponer los mismos recursos que el Código de Procedimientos Penales concede a aquel y ejercer la acción civil resarcitoria...

  • I)Proponer y acordar arreglos o convenios durante la tramitación de cualquier proceso, cuando valore su procedencia y oportunidad. En estos casos, se requerirá autorización escrita del procurador general, del procurador general adjunto o del funcionario en quien estos deleguen". Del anterior articulado, queda claro que la Procuraduría ejerce la representación de los intereses del Estado, cuando se trata de delitos relacionados con el ambiente, por cuanto es éste al que corresponde garantizar a sus habitantes un ambiente sano y ecológicamente equilibrado. Por lo tanto, no cabe duda de la condición de víctima que en este asunto ostenta el Estado, cuya representación legal corresponde a la Procuraduría General de la República. Ahora en cuanto al caso concreto, considera esta Cámara de Apelación de Sentencia, se han irrespetado los derechos de la Procuraduría como representante de la víctima.

Haciendo un recuento de las actuaciones que constan en el legajo de investigación, puede observarse cómo en forma contradictoria, tanto el Ministerio Público como el Tribunal Penal de Flagrancia de Puntarenas, han pasado de reconocer el papel de la Procuraduría dentro del proceso, al obviarlo por completo. Así, se desprende del documento de folio 18, que el Ministerio Público le comunicó a dicha entidad la programación de la audiencia inicial para las 17:15 horas del 12 de abril del 2011, pero fue llevada a cabo a las 20:20 horas del 15 de abril siguiente (ver acta de folio 35), sin que conste en el expediente principal o en forma digital, alguna comunicación a la Procuraduría de esa variación de fecha y mucho menos de la convocatoria a las subsiguientes audiencias. Lo anterior generó que la Procuraduría no pudiera participar en ese acto del procedimiento, a pesar de haberse apersonado al proceso el licenciado [Nombre4] en calidad de Procurador Adjunto (folio 60), quien manifestó por escrito su interés en participar del mismo, así como de realizar reclamos de índole civil y hasta haber externado su posición acerca del procedimiento de flagrancia (folios 22 y 23).

En la señalada audiencia, el Tribunal Penal dispuso la tramitación de la causa mediante ese procedimiento especial, sin valorar tan siquiera, la gestión escrita -planteada por el licenciado [Nombre7] - para que al asunto le fuera aplicado el procedimiento ordinario. Posteriormente, la defensa del encartado propuso una conciliación, pero ante la ausencia del Procurador, a solicitud del Ministerio Público, se suspendió la diligencia a fin de obtener el pronunciamiento de la Procuraduría. En ese mismo acto el ente fiscal aportó un documento con la valoración del daño ecológico, elaborado por el Instituto Costarricense de Pesca y Acuicultura (Incopesca). Mediante oficio de fecha 20 de abril del 2011, comunicado a la Procuraduría del 26 de abril del 2011 a las 15:15 horas (folios 65 y 64), el Tribunal Penal de Flagrancia le informó la propuesta de conciliación realizada por el imputado y le solicitó remitiera vía fax -es decir por escrito- su respuesta a dicho ofrecimiento.

Aunque se mencionaba en el oficio, que la continuación de la audiencia se realizaría el 27 de abril de 2011, no se convocó a la Procuraduría a la misma, pues ni siquiera se le indicó la hora de su realización, y tampoco se le puso en conocimiento la existencia de la valoración por daño ambiental realizada por Incopesca. Según lo solicitado, en escrito de fecha 27 de abril del 2011 (folios 61 y 62), el licenciado [Nombre8] , en sustitución del Procurador apersonado, expuso que se reiteraba el escrito de fecha 13 de abril, en virtud de no contar con la valoración de daños ambientales ni haberse realizado la notificación al tercero propietario del bien objeto de comiso. Reclamó no haber sido debidamente notificado de la fecha dispuesta para la audiencia inicial, violentándose así el derecho del representante legal del Estado de constituirse en querellante y actor civil, finalmente indicó que tales irregularidades le impedían pronunciarse acerca del plan reparador planteado.

El día 27 de abril del 2011 se continuó con la audiencia para conocer acerca de la medida alterna propuesta, a ella no se presentó algún representante de la Procuraduría, sin embargo, el Ministerio Público expuso que ese mismo día "se comunicó vía telefónica con dicha representación, quienes le manifestaron no tener interés en conciliar en esta causa" (sic, folio 66). A pesar de lo anterior, el Juez de Juicio, resolvió a las 18:07 horas continuar con la tramitación del procedimiento de flagrancia y, a pesar de haber un Procurador Adjunto de la República apersonado al proceso, determinó que era el Ministerio Público el legitimado para pronunciarse acerca de la propuesta de conciliación formulada por el imputado. Así a partir del contador 18:10:10 del archivo digital c0000110427181012.vgz, resolvió el Tribunal: "pues bien, este juzgador después haber analizado las argumentaciones que expone la Procuraduría en folios 59 a 63, donde donde básicamente lo que solicita es que se aplique el procedimiento abreviado, perdón procedimiento ordinario, tesis que no está compartiendo este Tribunal, por cuanto como efectivamente lo señalan las partes, tanto la defensa como la señora Fiscal, a folio 18 consta que el día 08 de abril del año en curso, vía fax se indicó y se le confirió a la Procuraduría un plazo de tres horas para que manifestara si tenía interés en que la presente causa se tramitara por el procedimiento expedito de flagrancia y además se le comunicaba que el 12 de este mismo mes, se iba a realizar a las 17:15 horas la audiencia inicial, y que este era el momento procesalmente oportuno para la interposición de la querella o la acción civil.

Sin embargo, a folios 22 a 23 al señor Procurador, el día 13 de abril de 2011, sea un día posterior a la audiencia, que se había conocido el día anterior, viene a hacer la manifestación de que dado que hay que hacer una valoración ambiental y que hay notificar a la sociedad propietaria registral del vehículo, entonces solicita la aplicación del procedimiento ordinario en este caso. Lo cierto es que, ninguna lesión, ningún derecho se le ésta quebrantando a la Procuraduría, porque con fundamento en el artículo 432, tal y como lo expuso la señora Fiscal, es en la primera fase de la audiencia donde el actor y el querellante, podrán constituirse como tales. Mientras que en el presente caso se nota que había sido debidamente comunicada esta situación y que se iba a hacer la audiencia. Perdón, omito manifestar que erróneamente dije que la audiencia inicial había sido el día 12, fue el 15, sin embargo, esto en nada viene a variar la situación de lo que estoy resolviendo.

¿Por qué? Porque el procedimiento expedito de flagrancia, es un procedimiento especial, el cual es completamente oral, y apersonada la representación de la Procuraduría, es en dicha audiencia donde debe hacer valer todas aquellas situaciones que considere vienen a corresponder en defensa de sus intereses. Ciertamente, el hecho de presentar un escrito y solicitar a través del mismo que el presente procedimiento se envíe a la vía ordinaria, pues viene a ser totalmente improcedente por cuanto es, como se dice en esta audiencia donde la Procuraduría debe hacer valer sus derechos, amén de que ya este juzgador en la fecha precisada, había resuelto acoger el trámite de la presente causa bajo el procedimiento expedito de flagrancia. Considera que, aún y cuando haya oposición, es criterio del Juez valorar la misma y resolver en cuanto a su aplicación o no en el presente caso. Y es que lo ha venido a entender la Procuraduría es que este procedimiento es totalmente distinto al procedimiento normal.

Y es aquí donde de forma oral y de forma personal, tiene que venir hacer valer sus derechos el señor Procurador. En este orden de ideas es que el juzgador, a pesar de que la Procuraduría solicita la aplicación de procedimiento ordinario, decide mantener el conocimiento de la presente causa en esta sede. Respecto a la solicitud de la defensa de que se continúe con el instituto de la conciliación, tal y como ella lo ha propuesto, y siendo que la Procuraduría dada la resolución que acabo de dar ya no forma parte de este proceso, solamente como víctima pero sin voto, sea sus manifestaciones no son vinculantes, le corresponde al Ministerio Público, como representante del Estado en ausencia de la Procuraduría, decidir si acepta o no la propuesta que hoy viene a reafirmar la defensa y que ya había sido hecha. En este sentido, y como la conciliación es de las partes, siendo el Ministerio Público el que representa los intereses del Estado, es el Ministerio Público y la defensa, las que deben, si así lo tienen a bien, pues continuar con el procedimiento.

Yo no podría pronunciarme unilateralmente sin un consentimiento del Ministerio Público, para lo cual le voy a dar la palabra..." (18:18:20). Esta decisión adolece de varios vicios, el primero de ellos, es considerar que la Procuraduría sólo tiene participación en el proceso si se apersona como querellante y/o actor civil, pues de no hacerlo, su opinión no podría tomarse en cuenta, lo cual contraviene abiertamente lo preceptuado en el artículo 71 inciso e del Código Procesal Penal. En segundo lugar, considerar que la comunicación de convocatoria a la audiencia inicial, fue bien realizada. Y tercero, que el Ministerio Público podía sustituir a la Procuraduría General de la República como representante del Estado, existiendo un funcionario debidamente apersonado al proceso. Aún así, en esa oportunidad el Ministerio Público no estuvo de acuerdo con la conciliación, por lo que nuevamente se suspendió la diligencia.

Sin embargo el 29 de abril del 2011, con la anuencia de la Fiscal Adjunta de Puntarenas- según se indica en el acta de folios 70 y 71- el Ministerio Público decide transar con el imputado y con algunas variaciones al plan original, acepta conciliar con éste a pesar de que conocía que la víctima, es decir el Estado, representado por la Procuraduría, no deseaba aplicar este instituto. Este acuerdo fue homologado por el Tribunal Penal y generó un sobreseimiento definitivo a favor del imputado, mismo que ahora se recurre. La conciliación admitida en estos términos, viola el artículo 36 del Código Procesal Penal, pues según dicha norma, esta medida alterna es procedente "entre al víctima y el imputado", en este caso entre el Estado representado por la Procuraduría y el encartado [Nombre1]. Dicho ente ya había señalado el rechazo a la medida alternativa propuesta, por lo que no era posible para el MInisterio Público arrogarse las facultades de la víctima debidamente apersonada al proceso.

En consecuencia, como el fallo se basa en una actuación contraria lo dispuesto por ley, se declara con lugar el recurso y se anula la sentencia de sobreseimiento por cumplimiento de la conciliación, número 31-F-12, así como todo lo actuado desde la audiencia inicial, ello en virtud de que a ésta no fue debidamente convocada la Procuraduría General de la República. Por innecesario se omite pronunciamiento acerca del segundo motivo de recurso.

POR TANTO:

Se anula la sentencia de sobreseimiento por cumplimiento de la conciliación, número 31-F-12, así como todo lo actuado desde la audiencia inicial, ello en virtud de que a ésta no fue debidamente convocada la Procuraduría General de la República. Por innecesario se omite pronunciamiento acerca del segundo motivo de recurso. NOTIFÍQUESE.
