Second Judicial Circuit of San José, Annex A.- At fifteen hours on February twenty-first, two thousand thirteen.- BACKGROUND

  1. 1Based on the facts stated and the legal authorities cited, this action seeks a judgment ordering the following: 1. A declaration that Articles 7 subsection e), 10, 10 Bis, 11, 17, 19, 20, 22, and 27 subsection p) of the “Regulations of the Municipalidad de Palmares for the Siting and Construction of Telecommunications Infrastructure,” issued by the Municipalidad de Palmares and published on February 14, 2012 in Official Gazette La Gaceta number 32, are inconsistent with the legal system, and their annulment with retroactive effect as of the time of their promulgation. The complaint was subsequently amended (folio 544) to request a declaration that Article 12 (formerly 11) of the aforementioned regulations, which was affected by the amendment published in Official Gazette La Gaceta number 159 dated August 20, 2012, is inconsistent with the legal system, and its annulment with retroactive effect as of the time of its promulgation. 2.- An order requiring the Administration to exercise the discretion inherent in its regulatory authority in accordance with the following limits and mandates imposed by the legal system, which the plaintiff requests be expressly declared, such that the regulations may not: expressly or implicitly exclude the possibility of constructing telecommunications towers; apply by analogy urban-planning rules intended to regulate the development of buildings, rather than mere service infrastructure; contain provisions contrary to the unambiguous rules of science and technology; or establish rules that do not comply with national legislation, which assigns SUTEL and the Ministry of Health jurisdiction to regulate access to scarce resources—namely, infrastructure—and health, respectively, as well as SETENA in environmental matters. 3.- A declaration that Municipalidad de Palmares has a duty to apply Article 11 of Decree No. 36195-MINAET-S-MEIC-MOPT: “Rules, Standards, and Powers of Public Entities for the Coordinated and Expeditious Approval Required for the Installation and Expansion of Telecommunications Networks,” published in La Gaceta No. 745 (sic), dated September 8, 2010, when granting the permits necessary to construct telecommunications towers to provide the municipality’s population with cellular telephone coverage, without needing to wait for the approval of new rules replacing those annulled. 4.- An order requiring payment of both categories of costs in favor of the plaintiff. 5.- An order requiring payment of damages and lost profits (daños y perjuicios), to be determined during enforcement of the judgment.In a filing submitted at fifteen hours forty-nine minutes on October 11, 2012 (folios 501-502), this last claim was clarified as follows: the damages consist of the sunk financing costs arising from payments for lease options to the owners of the land where the towers would be located, and costs incurred to obtain authorizations such as environmental feasibility (viabilidad ambiental), alignments (alineamientos), and land-use approvals (usos de suelo); the lost profits, in turn, consist of the income the plaintiff failed to receive because the contracts for leasing space on the towers that could not be built were frustrated, prudently estimated as of October 11, 2012 at US$723,568.-
  2. 2The legal representative of the defendant municipality answered, generally admitting the facts; nevertheless, he states that these decisions fall within the authority of the Municipal Council, which he cannot control in his capacity as Mayor, and requests that the Municipal Council be granted a reasonable period within which to amend the “Regulations of the Municipalidad de Palmares for the Siting and Construction of Telecommunications Infrastructure” with respect to the observations made by SUTEL in official letter CCI-20123-02, and to amend Chapter XIX4.3-bis, “Telecommunications Facilities,” of the Construction Regulations. He likewise stated that, if an award of damages and lost profits is entered, the Municipal Council should be held liable for them and he should be absolved from payment of costs. With respect to the amendment to the complaint, Municipalidad de Palmares entered a denial in accordance with the terms of its pleading appearing at folio 583.
  3. 3Following the filing of the motion for partial out-of-court satisfaction (satisfacción extraprocesal parcial), this Court granted that motion by decision number 06-2013 at fourteen hours on January 17, 2013, in the following terms: “Because it was acknowledged in the administrative proceedings, the following claim asserted by the plaintiff is declared satisfied out of court: ‘1. A declaration that Articles 7 subsection e), 10, 10 Bis, 11, 17, 19, 20, 22, and 27 subsection p), and all other related provisions, of the “Regulations of the Municipalidad de Palmares for the Siting and Construction of Telecommunications Infrastructure,” issued by the Municipalidad de Palmares and published on February 14, 2012 in Official Gazette La Gaceta No. 32, are inconsistent with the legal system, and their annulment with retroactive effect as of the time of their promulgation.’ The proceeding is terminated as to that claim.The case shall continue with respect to the remaining claims in the complaint that have not been satisfied” (folios 584-591). CONSIDERING

I.Proven Facts:

  • 1)Municipalidad de Palmares promulgated rules entitled “Regulations of the Municipalidad de Palmares for the Siting and Construction of Telecommunications Infrastructure,” published in Official Gazette La Gaceta No. 32, dated February 14, 2012 (folio 582).-
  • 2)The plaintiff company requested land-use authorization (autorización de uso de suelo) from the defendant municipality on three occasions for installation of the tower at issue, and the requests were denied: twice because no regulations existed, and the third time because the proposal contravened Article 11—now 12—of the aforementioned regulations, which requires a minimum distance of eight meters fifty centimeters from all property boundaries (fact 15 of the principal complaint, admitted by the defendant at folios 4 and 485).-
  • 3)Costa Pacífico Torres Limitada entered into a lease-option agreement dated August 12, 2010, for a term of eleven months, covering an area of three hundred thirty-five square meters within the property located in Provincia de Alajuela, Cantón Palmares, Distrito la Candelaria, registration number Placa27935, for the sum of one thousand five hundred dollars (folios 68-80).-
  • 4)This action was filed on March 30, 2012, challenging Articles 7 subsection e), 10, 10 Bis, 17, 19, 20, 22, and 27 subsection p), as well as Article 11 (initial filing at fs. 1 to 35).-
  • 5)On August 20, 2012, the Amendments to the “Regulations of the Municipalidad de Palmares for the Siting and Construction of Telecommunications Infrastructure,” approved through resolution CM-06-117-12 at Ordinary Session 117 of the Concejo Municipal de Palmares on July 24, 2012, were published in Supplement 115 to La Gaceta No. 159 (fs. 530 to 532 and 549 to 582).-

II.Unproven Facts. Sole Fact. That the plaintiff sustained damages and lost profits as a result of the administrative conduct challenged in this proceeding (the record).

III. PLAINTIFF’S ARGUMENTS

In summary, the plaintiff states that, following the opening of the telecommunications market through Law 8642, a paradigm shift has occurred through regulations ensuring the essential requirements for dismantling the monopoly model. Law 7593 declared the development of the infrastructure required for the deployment of telecommunications networks to be in the public interest, and the challenged Regulations intrude into an area over which municipalities have no jurisdiction because they regulate matters falling within the jurisdiction of the Executive Branch. The challenged provision is absolutely null and void because it regulates a matter within SUTEL’s jurisdiction; the Municipality lacks jurisdiction to impose restrictions because the location of towers depends on the network design and is determined by the operator. The plaintiff further states that the Municipality’s exercise of regulatory authority (potestad reglamentaria) is limited by the principle of statutory reservation (principio de reserva de ley), insofar as only legislation may regulate the legal framework governing constitutional rights; regulatory authority is subject to the rules inherent in the principle of legal regularity (principio de regularidad jurídica), such that regulations contrary to provisions of greater legal force and resilience are impermissible.

In this specific case, the Municipal Regulations departed from the provisions of Law 8642, making it impossible to install towers and commercially operate them; measures were adopted that obstruct or entirely prevent both the development of a high-quality cellular telephone network and the optimization of scarce resources. Accordingly, there is a defect of absolute nullity (nulidad absoluta) arising from the failure to apply the aforementioned statutory provisions, which are of superior rank and concern public policy (orden público). There is also a violation of reasonableness and proportionality; the challenged provision requires technical criteria justifying such regulation, provided that it does not hinder the development of more efficient networks. Moreover, the measures are unnecessary because the number of towers intended to be installed is not so large as to suggest that they would cause an excessively burdensome disruption to the appearance of the surrounding area.

Neither Executive Decree 36159 nor the FEMETRON model regulations contain analogous provisions, which demonstrates the measures’ clear inconsistency with the relevant technical criteria. The plaintiff alleges a lack of reasoning (falta de motivación) and states that a review of the administrative record (expediente administrativo) showed that no reasons whatsoever were provided for regulating the matter in the terms established by the provisions of the challenged Regulations. The damages consist of the sunk financing costs associated with payments for land-lease options, the costs of obtaining authorizations such as environmental feasibility (viabilidad ambiental), setback determinations (alineamientos), and land-use approvals (usos de suelo), and the losses arising from the income the plaintiff failed to receive because the lease agreements could not be completed.

IV. ARGUMENTS OF THE MUNICIPALITY

In summary, the Municipality states that these decisions fall to the Municipal Council and cannot be controlled by the Mayor in that capacity, and that, should an award of damages be ordered, the Municipal Council must be responsible for paying them. Following the amendments to the Regulations, the latter comply with the law and the Reglamento de Construcciones.

V. THE PUBLIC INTEREST IN TELECOMMUNICATIONS MATTERS

On this issue, it is important to cite Constitutional Chamber Judgment No. 015763-2011, issued at nine forty-six a.m. on the sixteenth of November of two thousand eleven, which stated as follows: “(...) V. IMPORTANCE, PUBLIC INTEREST, AND NATIONAL SCOPE OF TELECOMMUNICATIONS INFRASTRUCTURE UNDER THE CONSTITUTIONAL AND SUBCONSTITUTIONAL LEGAL SYSTEM. Based on a systematic analysis of the constitutional and subconstitutional legal system currently in force, it may be concluded that telecommunications infrastructure has significance extending beyond the local or cantonal sphere, is clearly a matter of public interest, and, naturally, constitutes an issue falling within the national sphere, even having implications in the field of Public International Law, because its development entails compliance with a series of international obligations previously assumed by the Costa Rican State. First, as this Constitutional Court has indicated, telecommunications are of great constitutional significance, to the extent that Article 121, paragraph 14), subparagraph c), of the Constitution provides that wireless services and the electromagnetic spectrum form part of the constitutional public domain (dominio público constitucional) and, specifically, constitute property of the Nation that cannot be withdrawn from public use (desafectado) or removed from State ownership.

The Ley General de Telecomunicaciones No. 8642 of 4 June 2008, hereinafter LGT, in setting forth the governing principles for this sector, provides in Article 3°, paragraph i), that scarce resources must be optimized, emphasizing that the use of telecommunications infrastructure must be ‘objective, timely, transparent, nondiscriminatory, and efficient, with the dual objective of ensuring effective competition and the expansion and improvement of networks and services.’ Specifically, the optimization, measured use, expansion, and improvement of telecommunications infrastructure and networks serve the express purposes of that body of law, including ensuring the application of the principles of universal access, efficiency, equality, continuity, quality, broader and improved coverage, and solidarity in telecommunications (Article 2° LGT). Furthermore, Article 32, paragraph d), LGT makes it perfectly clear that the objective of universal access and service, and of solidarity, is achieved, among other means, through infrastructure development, since only robust and fully developed infrastructure can reduce the digital divide and make it possible to enjoy the benefits of the Information and Knowledge Society, connectivity, and the availability of access devices and broadband services.

For its part, the Ley de la Autoridad Reguladora de los Servicios Públicos, No. 7593 of 9 August 1993, in Article 74, as amended by the Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones No. 8660 of 8 August 2008, declared telecommunications infrastructure and networks to be in the public interest by providing as follows: The establishment, installation, expansion, renewal, and operation of public telecommunications networks or any of their components shall be deemed an activity of public interest. That declaration has major implications because it constitutes statutory recognition that infrastructure in this field is clearly and unequivocally a matter of public or general interest that transcends the local or regional sphere within the country and extends into the national and international spheres, enabling the Costa Rican State to fulfill, in good faith, a series of obligations and commitments assumed in the context of Public International Law.

It should be noted that public interest is defined in Article 113, paragraph 1°, of the Ley General de la Administración Pública of 1978 as the expression of the coinciding individual interests of the governed (administrados). Paragraph 2 of the cited provision of the LGAP of 1978 clearly provides that the public interest shall prevail over the interest of the Public Administration when the two may conflict. One consequence of the foregoing is that the interests of any decentralized Costa Rican public entity, including municipalities, cannot take precedence over the clear public interest in telecommunications infrastructure thus expressly declared by the national legislature through a law expressing the general will (Articles 105 and 121, paragraph 1°, of the Constitution). That interest must prevail over local interests because municipal autonomy does not permit municipal governments to exempt themselves from matters declared to be of national interest; otherwise, territorial autonomy would be distorted by transforming municipalities into microstates removed from the intersubjective authority (dirección intersubjetiva) or oversight (tutela) that the State may exercise through constitutional bodies by enacting valid and effective laws and through the Executive Branch’s execution of international conventions and treaties approved by the Legislative Assembly (Articles 7°, 121, paragraph 4°, and 140, paragraph 10°, of the Political Constitution).

The declaration of public interest made in Article 74 of the Ley de la ARESEP also has sufficient and legitimate constitutional support in Article 45, paragraph 1°, of the Political Constitution, which establishes the principle of the relative inviolability of property (intangibilidad relativa del patrimonio) by recognizing expropriation on grounds of a legally established public interest. A second consequence arising from the declaration of public interest is that the construction, expansion, development, and improvement of telecommunications infrastructure are clearly and unequivocally national in scope. Thus, the State and its bodies assume governing and policymaking authority in this area, to which all subordinate public entities must submit in order to achieve objectives such as universal access and services, the reduction of the digital divide on grounds of solidarity, and the interconnection and connectivity necessary to enable all Costa Ricans, irrespective of the locality, district, canton, or region in which they live, to enjoy the benefits and advantages of the Information and Knowledge Society.

Far from treating telecommunications infrastructure as a local matter, the national legislature expressly and unequivocally made it a national matter. This is reflected in the creation of the Telecommunications Sector under Article 38 of the aforementioned Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector de Telecomunicaciones, which provides as follows: The Telecommunications Sector is hereby created within the framework of the State’s sectoral organization. It shall consist of the Public Administration, both centralized and decentralized, as well as public enterprises performing functions or activities related to telecommunications. Under this provision, the telecommunications sector is cross-cutting and therefore national in character because it encompasses the entire universe of public entities, including territorially decentralized entities such as municipalities.

Municipal governments therefore cannot exempt themselves from that sector. The national character of telecommunications generally, and particularly of telecommunications infrastructure, becomes even clearer upon consideration of Article 39 of the cited Law, insofar as it establishes that the sector shall be headed by the Minister of Environment, Energy and Telecommunications, who, in the exercise of a general function of intersubjective authority or administrative oversight (tutela administrativa), is responsible, among other matters, for the following:

  • a)Formulate policies for the use and development of telecommunications; b) Coordinate («) the preparation of the National Telecommunications Development Plan («); c) Ensure that Sector policies are implemented by the public and private entities participating in the telecommunications Sector; e) Issue the National Telecommunications Plan, as well as the corresponding implementing regulations; h) Coordinate telecommunications development policies with other public policies intended to promote the information society; i) Ensure compliance with applicable national environmental regulations and the sustainable development of telecommunications in harmony with nature. Lastly, the clearly national nature of telecommunications and their various components becomes apparent when Article 40 of the aforementioned Law regulates the National Telecommunications Development Plan, which is defined in paragraph 1 of that article as («) the instrument for the Sector’s general planning and guidance, which defines its goals, objectives, and priorities.

The legislature therefore chose to plan telecommunications at the national level, rather than merely at the local or regional level. Furthermore, the national nature of telecommunications is reinforced by the creation of the Superintendencia de Telecomunicaciones (SUTEL), which is vested with a series of powers that are unmistakably national in scope. Thus, pursuant to Articles 59 and 60 of the Ley de Creación de la ARESEP, it is responsible for regulating, applying, monitoring, and overseeing the telecommunications legal framework («), for all of which it shall act in accordance with Sector policies, the provisions of the National Telecommunications Development Plan, the Ley general de telecomunicaciones, the provisions established in this Law, and all other applicable statutory and regulatory provisions. The National Telecommunications Development Plan 2009-2014, in turn, establishes that, to make progress in harnessing the benefits of the Information and Knowledge Society, the country must undertake a significant investment effort in the development of telecommunications infrastructure so as to provide more and better telecommunications services to all sectors of the population.

In this regard, infrastructure development in that sector is a necessary and indispensable condition that must be accorded special priority in any national ICT project («), and it then specifies that the following guidelines must be followed to achieve the development of the national telecommunications infrastructure: a.1 Take the necessary measures to ensure that the country has modern telecommunications infrastructure while also ensuring the provision of high-quality services and the creation of value-added applications, enabling convergence, interoperability among systems, the incorporation of advanced technologies, and secure communications, and ensuring the development of infrastructure that makes it possible to deliver telecommunications services to all inhabitants of the country, in fulfillment of the objectives and targets for universal access, universal service, and solidarity («).

It is therefore a plan that, by express statutory provision, binds or obligates, among others, municipal entities and requires them to have robust, modern, optimal, suitable, and developed telecommunications infrastructure in order to enjoy the benefits of the Information and Knowledge Society. Achievement of this goal or objective will necessarily be thwarted if each territorial corporation, in a matter of clearly national scope, seeks to establish its own policies and requirements above national legislation and the instruments of Public International Law that bind all entities comprising the State in the broad sense (...)”. This Court considers the precedent cited above applicable to the case under review, since one of the matters at issue in these proceedings is telecommunications and its effects at the cantonal and national levels.

VI. TELECOMMUNICATIONS INFRASTRUCTURE, MUNICIPALITIES, REGULATORY PLANS, ZONING, LAND-USE CERTIFICATES, AND BUILDING PERMITS

In a clear attempt to provide consistency and standardization regarding telecommunications infrastructure, as this is a matter of clearly national scope, a significant number of generally applicable regulatory instruments have been issued at both the national and cantonal levels. Thus, the Poder Ejecutivo issued Decree No. 36159 of 10 May 2010, entitled Standards and Powers of Public Entities for the Coordinated and Expeditious Approval Required for the Installation and Expansion of Telecommunications Networks, the purpose of which was to standardize the procedures for obtaining authorizations to build and install telecommunications infrastructure in view of the prevailing regulatory fragmentation and to fill the existing gaps in this area. Article 10 of this Executive Decree provided that municipalities have the authority to issue land-use certificates (certificados de uso de suelo) and building permits (licencias constructivas), in accordance with the regulatory plan (Plan Regulador) or its regulations in force, provided that the installation of telecommunications infrastructure is contemplated in that plan or those regulations.

By reason of the provisions of subsections a) and h) of Article 3 of the Ley General de Telecomunicaciones, Law No. 8642, as well as the provisions of Article 74 of the Ley de la Autoridad Reguladora de Servicios Públicos, Law No. Placa3360, and in compliance with the principle of legality established in Article 11 of the Ley General de la Administración Pública and Article 11 of the Constitución Política, municipalities shall base their actions for issuing conforming land-use approvals (usos de suelo conforme) and building permits on the following principles:

  • a)Principle of universality, so as to facilitate the granting of the aforementioned authorizations to all parties interested in offering telecommunications services in the canton, without discrimination of any kind, with the aim of ensuring at least a minimum level of telecommunications services for the inhabitants of all areas and regions of the country under equal conditions.
  • b)Principle of technological neutrality, so that the granting of the aforementioned authorizations guarantees the right of network operators and telecommunications service providers to select the technologies they will use.
  • c)The declaration of public interest established in Article 74 of the Ley de la Autoridad Reguladora de los Servicios Públicos, so that the aforementioned authorizations are granted in consideration of the fact that the establishment, installation, expansion, renewal, and operation of public telecommunications networks or any of their components are matters of public interest.

The plaintiff states that the Municipal Regulations for telecommunications permits intrude into an area over which municipalities have no jurisdiction because local interests are subordinate to national interests. The plaintiff’s argument is without merit, since Article 10 of the aforementioned Decreto Ejecutivo 36159, which regulates the rules, standards, and powers of public entities for the coordinated and expeditious approval required for the installation or expansion of Telecommunications Networks, provides that municipalities shall have exclusive authority to issue land-use certificates (certificados de uso de suelo) and construction permits (licencias constructivas), in accordance with the Regulatory Plan (Plan Regulador) or its regulations currently in force, provided that such plan or regulations contemplate the installation of telecommunications infrastructure. Thus, it is evident that, although telecommunications are indeed a matter of national interest, municipalities are also called upon to participate in regulating the construction of telecommunications infrastructure and, for that purpose, may adopt such regulations as may be necessary, including the municipal regulations whose Article 12 is challenged herein.

Likewise, the challenged municipal regulations comply with Article 10 of Decreto Ejecutivo 36159 because they concern the installation of telecommunications infrastructure. It follows from the foregoing that the Executive Branch itself accepted that, regarding the construction of towers for mobile telephone services, although a national interest exists, there is also a local interest, which necessarily requires compliance with municipal urban-planning regulations, including the provisions of the Ley de Planificación Urbana and Ley de Construcciones, particularly because, by virtue of the principle of legality (principio de legalidad), the aforementioned decree must be applied consistently with those higher-ranking rules. Although telecommunications are a matter of national interest, this does not preclude their evident cantonal dimension, which also merits protection. Therefore, it is not true that the Reglamento de la Municipalidad de Palmares para la Ubicación y Construcción de Infraestructura de Telecomunicaciones intrudes into an area over which municipalities have no jurisdiction, and it is evident that the challenged Article 12 falls within the powers assigned to municipal entities and therefore remains within the limits of the regulatory authority (potestad reglamentaria) of the Municipalidad de Palmares.

The plaintiff requests a declaration that Article 12, formerly Article 11, of the Reglamento de la Municipalidad de Palmares para la Ubicación y Construcción de Infraestructura de Telecomunicaciones is inconsistent with the legal system and that it be annulled retroactively to the time of its promulgation. In support of this claim, the plaintiff has alleged that this regulatory provision contradicts the provisions of Laws 8642 and 7593; that it constitutes an urban-planning regulation lacking technical criteria to justify it; that it violates the principles of reasonableness and proportionality; and that the administrative act (acto administrativo) lacks a statement of reasons (motivación). First, this Court finds that the challenged article does not conflict with Laws 8642 and 7593. The plaintiff interprets the aforementioned Article 12 as seeking to prevent the operation, development, and installation of telecommunications towers.

However, this position is not shared. In the opinion of this Chamber, the challenged article regulates basic technical matters, such as the frontage and depth dimensions of the properties in relation to the height of the tower. This provision does not prevent the construction of a telecommunications tower whatsoever; it merely regulates a very basic technical requirement with which the tower must comply, so that if the structure complies with the regulatory provisions, there is no reason to prevent its construction. Similarly, the aforementioned Article 12 does not detract from the declaration that telecommunications activities are in the public interest (interés público); the fact that certain construction guidelines are imposed does not conflict with the public interest established for telecommunications activities in Law 7539. As to the assertions that this urban-planning regulation lacks a statement of reasons and technical criteria to justify it, and that it violates the principles of reasonableness and proportionality, these arguments are unfounded, since the current wording of Article 12 derives from the amendment made by the construction regulations in Chapter XIX Bis, “Telecommunications Installations,” Article XIX.4.3 Bis (folio 557).

The plaintiff should bear in mind that the Reglamento de Construcciones contains a special chapter devoted to the installation of telecommunications facilities, which sets forth technical requirements that are mandatory for the construction of Telecommunications Towers. These rules originate from the Executive Branch rather than the local government; thus, this is not a local provision, but one that literally applies what is already regulated by the Reglamento de Construcciones. It is also relevant that the amendment to the construction regulations is a rule currently in force and of mandatory application which, due to its general nature, amended Article 12 of the Reglamento de la Municipalidad de Palmares para la Ubicación y Construcción de Infraestructura de Telecomunicaciones. Therefore, it cannot be alleged that there is a lack of a statement of reasons or technical criteria to justify it, or that the principles of reasonableness and proportionality have been violated.

Since the plaintiff did not challenge the Reglamento de Construcciones from which the legal provision challenged herein originates, this claim must be declared unfounded, because Article 12 of the challenged municipal regulations has its legal basis in Chapter XIX Bis, “Telecommunications Installations,” Article XIX.4.3 Bis, of the Reglamento de Construcciones. The foregoing is consistent with Constitutional Chamber ruling number 15763-2011 and Laws 8642 and 7593, in the sense that local rules, such as the municipal regulations challenged herein, must be subject to and conform to national rules and regulations, such as the Reglamento de Construcciones in this case, because telecommunications are a matter of public interest, as established in Article 74 of the Ley de la Autoridad Reguladora de los Servicios Públicos, No. 7593 de 9 de agosto de 1993. Such a declaration has far-reaching consequences because it recognizes by law that telecommunications infrastructure is a matter of clear and unequivocal public or general interest that transcends the country’s local or regional sphere and extends into the national and international spheres, enabling the Costa Rican State to fulfill, in good faith, a series of obligations and commitments undertaken in the context of Public International Law.

It should be noted that public interest is defined by Article 113, paragraph 1°, of the Ley General de la Administración Pública de 1978 as the expression of the coinciding individual interests of governed persons (administrados). Paragraph 2 of that same provision of the LGAP de 1978 clearly provides that the public interest shall prevail over the interest of the Public Administration where the two may conflict. One consequence of the foregoing is that the interests of any Costa Rican decentralized public entity, such as municipalities, cannot take precedence over the clear public interest in telecommunications infrastructure expressly declared by the national legislature through a law expressing the general will (Articles 105 and 121, subsection 1°, of the Constitution). That public interest must prevail over local interests, since municipal autonomy does not permit municipal councils to exempt themselves from matters declared to be of national interest.

It is important to emphasize that Article 10 of Decreto Ejecutivo 36159, which the plaintiff has repeatedly cited and defended, states that municipalities must comply with the Ley de Construcciones and, consequently, its regulations. Therefore, the challenged Article 12 suffers from none of the grounds for nullity (nulidades) alleged by the plaintiff, since the municipal regulations were made subordinate to a national rule, namely the Reglamento de Construcciones, in order to respect the declaration made by Law 7593 that telecommunications activities are in the public interest and to comply with the aforementioned Decreto Ejecutivo 36159. Finally, because Article 12 of the Reglamento Municipal de Palmares is based on Article XIX.4.3 Bis of the Reglamento de Construcciones, and because those regulations contain a specialized chapter entitled “Telecommunications Installations,” the discussion as to whether towers are buildings or structures is irrelevant, since they are not being subjected to the general rules governing buildings, but rather to the specialized chapter governing Telecommunications Installations. Consequently, no deficiency warranting a declaration by this Court is apparent, and the claim for annulment (pretensión anulatoria) must therefore be dismissed.

VII.As to claims numbers 2 and 3, both must be dismissed because the proceedings revealed no deficiency or defect that could support a declaration of nullity, nor was any deficiency or improper application of discretionary elements (elementos discrecionales) found, since there was no improper exercise of such powers. Because the claim for annulment has been dismissed, the challenged Municipal Regulations remain intact, and the requested replacement of the challenged provision is therefore unfounded. Since the plaintiff initially requested the annulment of several articles—11, 17, 19, 20, 22, and 27 subsection p)—that are no longer part of the challenged Municipal Regulations, and that claim was resolved through satisfaction outside the proceedings (satisfacción extraprocesal), claim number 2 lost part of its basis because it was related to the request to annul those articles. The plaintiff sought to have the annulment of Articles 11, 17, 19, 20, 22, and 27 subsection p) of the challenged Regulations compel the Municipality to reformulate their text and, when doing so, apply the limits and directives proposed by the plaintiff in claim 2.

Nevertheless, as already stated, the aforementioned articles are no longer part of the challenged Regulations, and no grounds for nullity were found therein, specifically regarding Article 12; consequently, its wording remains unaltered. Because the challenged Regulations remain intact, it would make no sense to order the Administration, when drafting new articles as a result of a nullity that did not occur, to exercise its discretion subject to the requested limits. Likewise, claim number 3, which concerns Article 11 of Decreto 36159-MINAET, is without purpose because the Municipal Regulations remain intact and there are therefore no gaps to be filled through the aforementioned Article 11.

VIII. CLAIMS FOR COMPENSATION (PRETENSIONES INDEMNIZATORIAS)

In this specific case, the substantive claim in the complaint was rejected, which provides a sufficient basis for denying the monetary claim (reclamo pecuniario) asserted, insofar as it is ancillary thereto. Indeed, since no unlawful conduct by the Administration has been established, neither has there been an injury that the claimant is not legally required to bear. Administrative liability (responsabilidad administrativa), under the regime established by the General Law of Public Administration (Ley General de la Administración Pública, LGAP), requires establishing not only the existence of harmful conduct and pecuniary or non-pecuniary injury (lesión patrimonial o extrapatrimonial), but also a causal nexus (nexo causal) between them; that is, a direct cause-and-effect relationship between the alleged act and the resulting harm. Accordingly, this Court finds that the claim for damages (daños y perjuicios) asserted lacks legal merit and must therefore be dismissed.-

IX. SUBSTANTIVE REQUIREMENTS OF THE ACTION (PRESUPUESTOS DE FONDO DE LA ACCIÓN)

The respondent Municipality did not raise any defenses (excepciones). Notwithstanding the foregoing, both procedural doctrine and administrative litigation case law (jurisprudencia contenciosa) (in this regard, cassation judgment 34-1961, issued at diez horas veinte minutos del veintidós de marzo de mil novecientos sesenta y uno, may be consulted) recognize as substantive prerequisites for rendering any judgment those relating to the standing (legitimación) of the participating parties, their interest in the resolution of the dispute, and their legal right; all of which may be reviewed by any judge even on the court’s own motion (de oficio). In the case under consideration, both active and passive standing (legitimación activa y pasiva) have been duly established. In this regard, this Court finds that the claimant has sufficient active standing to participate in these proceedings pursuant to Article 10, subsection 2, of the CPCA, and that the respondent Municipality has passive standing because it is the entity that issued the challenged regulation.

It is likewise evident that the issue under discussion remains of current interest to the parties, precisely because the challenged Municipal Telecommunications Regulation remains in force and continues to produce effects. Finally, based on the considerations set forth in this decision, the complaint filed is determined to be without merit, demonstrating that the claimant lacks the legal right supporting its claim.

X. COSTS (COSTAS)

Article 193 of the CPCA provides that court costs (costas procesales) and attorney’s fees (costas personales) shall be imposed upon the unsuccessful party solely by virtue of its having lost, and that such a ruling must be made even on the court’s own motion, pursuant to that same provision, in conjunction with section 119.2 ibidem. Exemption from such an award is permissible only: a) when, in the Court’s judgment, there was sufficient cause to litigate; b) when the judgment is rendered on the basis of evidence of which the opposing party was unaware; or c) when plus petitio occurs, that is, when the difference between the relief claimed and that ultimately obtained is fifteen percent (15%) or more, unless the grounds of the complaint are expressly deemed provisional or their determination depends upon judicial discretion or an expert opinion (section 194 ibidem). In this case, this panel finds no grounds for applying the exceptions established by the applicable provisions and departing from the rule that costs are imposed upon the unsuccessful party. Accordingly, both categories of costs are imposed upon the claimant, Nombre103344.-

POR TANTO.

In accordance with the facts and judicial precedents cited in these proceedings, it is hereby ruled: on the Court’s own motion, a lack of legal right (falta de derecho) is declared. Consequently, the complaint filed by Nombre103344 against the Municipalidad de Palmares is declared WITHOUT MERIT. Both categories of costs shall be borne by the claimant. IIº Circuito Judicial de San José, Anexo A.- A las quince horas del veintiuno de febrero del dos mil trece.- Proceso de trámite preferente de COSTA PACÍFICO TORRES LIMITADA, representada por su apoderado general judicial Allan Hernández Vargas, casado, vecino de Santa Ana, abogado, con cédula de identidad CED110807; contra la MUNICIPALIDAD DE PALMARES, representada por su señor Alcalde Bernal Vargas Araya, casado por segunda vez, administrador, vecino de Palmares de Alajuela, con cédula CED27059. Participa como apoderado especial judicial de la parte demandante el doctor Nombre36865 , casado, abogado, vecino de Montes de Oca de San José, con cédula CED28443. Todos mayores.-

RESULTANDO

  1. 1Con fundamento en los hechos expuestos y citas legales invocadas, esta demanda tiene por objeto que en sentencia se disponga: 1. Declarar la disconformidad con el ordenamiento jurídico y se anulen con efecto retroactivo al momento de su promulgación, los artículos 7 inciso e), 10, 10 Bis, 11, 17, 19, 20, 22, 27 inciso p) del "Reglamento de la Municipalidad de Palmares para la ubicación y construcción de infraestructura de telecomunicaciones", publicado el 14 de febrero de 2012 en el Diario Oficial La Gaceta número 32, emitido por la Municipalidad de Palmares. Posteriormente se amplía la demanda (folio 544) y se solicita declarar la disconformidad con el ordenamiento jurídico y se anule con efecto retroactivo al momento de su promulgación el artículo 12 (antes 11) del reglamento supra citado que fue afectado por la reforma publicada en el Diario Oficial la Gaceta número 159 del 20 de agosto del 2012. 2.- Se condene a la Administración a ejercitar la discrecionalidad propia de la potestad reglamentaria, conforme a los siguientes límites y mandatos impuestos por el ordenamiento jurídico y que solicito declarar de modo expreso, de modo tal que el reglamento no podrá: excluir, expresa o implícitamente, la posibilidad de construir torres de telecomunicaciones; aplicar análogamente reglas urbanísticas dirigidas a regular el desarrollo de edificaciones, no así, meras infraestructuras para servicios; contener disposiciones contrarias a las reglas unívocas de la ciencia y la técnica; disponer reglas que no se sujeten a lo dispuesto por la legislación nacional, las cuales atribuyen a la SUTEL y al Ministerio de Salud la competencia de regular el acceso a los recursos escasos —infraestructura— y la salud respectivamente, así como a la SETENA en el ámbito ambiental. 3.- Declarar el deber de la Municipalidad de Palmares, de aplicar el artículo 11 del Decreto No. 36195-MINAET-S-MEIC-MOPT: "Normas, estándares y competencias de las entidades públicas para la aprobación coordinada y expedita requerida para la instalación y ampliación de redes de telecomunicaciones", publicado en la Gaceta No. 745 (sic), del 8 de setiembre de 2010, para el otorgamiento de los permisos necesarios para la construcción de las torres de telecomunicación para proveer a la población de la municipalidad con la cobertura de telefonía celular sin que sea necesario esperar a que se aprueben nuevas normas que sustituyan las anuladas. 4.- Se condene al pago de ambas costas a favor de la actora. 5.- Se condene al pago de los daños y perjuicios que se determinarán en ejecución de sentencia.En escrito presentado a las quince horas cuarenta y nueve minutos del 11 de octubre de 2012 (folios 501-502) se aclaró este último extremo así: los daños consisten en el costo financiero hundido por los pagos por opciones de arrendamiento a propietarios de los terrenos en que se ubicarían las torres, costos para obtener autorizaciones tales como viabilidad ambiental, alineamientos y usos de suelo; por su parte los perjuicios consisten en los ingresos dejados de percibir por la actora al verse frustrados los contratos de arrendamiento de espacio en las torres que no ha sido posible construir, los que estiman en forma prudencial al 11 de octubre de 2012 en la suma de US$723,568.-
  2. 2El representante legal del municipio demandado contestó admitiendo en general los hechos, no obstante, indica que se trata de decisiones que corresponden al Concejo Municipal, que no puede controlar en su carácter de Alcalde y solicita que se le dé un plazo prudencial al Concejo Municipal para que proceda con la modificación del "Reglamento de la Municipalidad de Palmares para la ubicación y construcción de infraestructura de telecomunicaciones", en lo referente a las observaciones hechas por la SUTEL en el oficio CCI-20123-02 y la modificación del Reglamento de Construcciones, Capítulo XIX4.3-bis, "Instalaciones de Telecomunicaciones". Así mismo señalo que de declararse la condena al pago de daños y perjuicios, el que debe responder por los mimos sea el Concejo Municipal y se absuelva en el pago de las costas. Con respecto de la ampliación en la demanda la Municipalidad de Palmares contesta en forma negativa, según los términos de su libelo visible a folio 583.
  3. 3Habiendo sido planteada la gestión de satisfacción extraprocesal parcial, este Tribunal resuelve declarar con lugar tal pedimento, mediante resolución número 06-2013 de las catorce horas del 17 de enero del 2013, en los siguientes términos: "Por haber sido reconocida en la vía administrativa, se declara la satisfacción extraprocesal de la siguiente pretensión formulada por el actor: "1. Declarar la disconformidad con el ordenamiento jurídico y se anulen con efecto retroactivo al momento de su promulgación, los artículos 7 inciso e), 10, 10 Bis, 11, 17, 19, 20, 22, 27 inciso p) y demás normas conexas del "Reglamento de la Municipalidad de Palmares para la ubicación y construcción de infraestructura de telecomunicaciones", publicado el 14 de febrero de 2012 en el Diario Oficial La gaceta No. 32, emitido por la Municipalidad de Palmares". Respecto de la cual se da por terminado el proceso. Continúese el juicio respecto de los restantes pedimentos de la demanda sobre los cuales no ha operado satisfacción alguna" (folios 584-591).En razón de lo anterior la pretensión anulatoria del actor se mantiene en definitiva de la siguiente forma: "se declare la disconformidad con el ordenamiento jurídico y se anule con efecto retroactivo al momento de su promulgación del artículo 12 -antes 11- del Reglamento de la Municipalidad de Palmares para la ubicación y construcción de infraestructura de telecomunicaciones publicado el 14 de febrero del 2012, en el Diario Oficial La Gaceta Nº32, emitido por la Municipalidad de Palmares y sus reformas publicadas en el Diario Oficial LA Gaceta Nº 159 del 20 de agosto del 2012".
  4. 4En los procedimientos ante este Tribunal no se han observado nulidades que deban ser subsanadas o que generen indefensión. Previa deliberación, se dicta esta resolución.-

Redacta el juez Zeledón Hernández y,

CONSIDERANDO

I.Hechos Probados:

  • 1)Que la Municipalidad de Palmares promulgó una normativa denominada: "Reglamento de la Municipalidad de Palmares para la Ubicación y Construcción de Infraestructura de Telecomunicaciones", publicado en el Diario Oficial la Gaceta No. 32, del 14 de febrero de 2012 (folio 582).-
  • 2)Que la empresa actora ha solicitado en tres ocasiones autorización de uso de suelo para la instalación de la torre en cuestión a la Municipalidad demandada y se le ha negado, en dos oportunidades por falta de reglamento y la tercera por oposición al artículo 11 -ahora 12- del reglamento referido supra, que requiere una distancia mínima de ocho metros cincuenta centímetros de todas las colindancias (hecho 15 de la demanda principal admitido por la accionada a folios 4 y 485).-
  • 3)Que la empresa Costa Pacífico Torres Limitada celebró un contrato de opción de arrendamiento en fecha 12 de agosto del 2010, por un plazo de once meses, para un área de trescientos treinta y cinco metros cuadrados, dentro del inmueble situado en la Provincia de Alajuela, Cantón Palmares, Distrito la Candelaria matrícula número Placa27935; en la suma de mil quinientos dólares (folios 68-80).-
  • 4)Que el 30 de marzo de 2012 se interpuso la presente demanda, en la que se impugnan los artículos 7 inciso e), 10, 10 Bis, 17, 19, 20, 22, 27 inciso p); además del 11 (escrito inicial a fs. 1 a 35).-
  • 5)Que el 20 de agosto de 2012, en el Alcance 115 a la Gaceta No. 159, se publicaron las Modificaciones al "Reglamento de la Municipalidad de Palmares para la ubicación y construcción de infraestructura de telecomunicaciones", aprobadas mediante acuerdo CM-06-117-12, de la Sesión Ordinaria 117 del 24 de julio de 2012, del Concejo Municipal de Palmares (fs. 530 a 532 y 549 a 582).-

II.Hechos no probados. Único. Que el actor haya experimentado daños y perjuicios como resultado de la conducta administrativa impugnada en este proceso (los autos).

III. ARGUMENTOS DEL ACTOR

En síntesis indica que a partir de la apertura del mercado de las telecomunicaciones mediante la ley 8642, se ha generado un cambio de paradigma, por medio de normativas que aseguran los requerimientos indispensables para la ruptura del modelo monopólico. Que la ley 7593 declaró de interés público el desarrollo de la infraestructura requerida para el despliegue de las redes de telecomunicaciones y que el Reglamento impugnado se introduce en un ámbito en el cual los municipios no tienen competencia, porque se regula materias propias de la competencia del Poder Ejecutivo. La norma impugnada es absolutamente nula porque regula materia propia de la competencia de la SUTEL, que la Municipalidad es incompetente para establecer limitaciones debido a que la ubicación de las torres depende del diseño de la red y es definida por el operador. Continúa manifestando que el ejercicio de la potestad reglamentaria por parte de la Municipalidad, está limitado por el principio de reserva de ley, en cuanto solo la ley podrá regular el régimen jurídico de los derechos constitucionales; la potestad reglamentaria está sujeta a las reglas propias del principio de regularidad jurídica, de modo que no es admisible que se regule en sentido contrario al dispuesto por las normas de mayor potencia y resistencia.

Que en el caso concreto el Reglamento Municipal se apartó de lo establecido en la ley 8642, imposibilitando la instalación de torres, junto con la explotación comercial de las mismas, se toman medidas que obstaculizan o impiden de modo absoluto, tanto el desarrollo de una red de telefonía celular de calidad, así como la optimización de los recursos escasos; por ello, existe un vicio de nulidad absoluta, por falta de aplicación, de las citadas disposiciones legales que poseen rango superior y son de orden público. Que existe un quebranto en cuanto a la razonabilidad y proporcionalidad, la disposición impugnada requiere de criterios técnicos que justifiquen esa regulación, siempre y cuando ello no obstaculice el desarrollo de redes más eficientes, además son innecesarias porque la cantidad de torres que se pretende instalar, no son tantas como para considerar que se causará un desajuste excesivamente gravoso para la estética del entorno.

Que en el Decreto Ejecutivo 36159, ni en el Reglamento modelo de la FEMETRON se encuentran normas análogas, lo cual evidencia la clara disconformidad con los criterios técnicos de las medidas antes relacionadas. Menciona una falta de motivación y que al revisar el expediente administrativo, se pudo concluir que no existe motivación alguna para regular en los términos en que lo hacen las normas del reglamento impugnado. Los daños consisten en el costo financiero hundido por los pagos por opciones de arriendo de terrenos, costos para obtener autorizaciones tales como viabilidad ambiental, alineamientos, usos de suelo y los perjuicios en los ingresos dejados de percibir por la actora al verse frustrados los contratos de arrendamiento.

IV. ARGUMENTOS DE LA MUNICIPALIDAD

En síntesis manifiesta que se trata de decisiones que corresponden al Concejo Municipal, que no puede controlar en su carácter de Alcalde, que de declararse la condena al pago de daños y perjuicios, el que debe responder por los mismos sea el Concejo Municipal. Que realizadas las modificaciones al Reglamento, este último se ajusta a derecho y al Reglamento de Construcciones.

V. SOBRE EL INTERÉS PÚBLICO EN MATERIA DE TELECOMUNICACIONES

Sobre este tema es importante traer a colación la sentencia de la Sala Constitucional número 015763-2011 de las nueve horas cuarenta y seis minutos del dieciséis de noviembre de dos mil once, indicó lo siguiente: "(...) V. IMPORTANCIA, INTERÉS PÚBLICO Y VOCACIÓN NACIONAL DE LA INFRAESTRUCTURA DE LAS TELECOMUNICACIONES EN EL ORDENAMIENTO CONSTITUCIONAL E INFRACONSTITUCIONAL. A partir de un análisis sistemático del ordenamiento jurídico constitucional e infraconstitucional vigente, es factible concluir que la infraestructura, en materia de telecomunicaciones, tiene una relevancia que excede la esfera de lo local o cantonal, asumiendo un claro interés público y, desde luego, erigiéndose como una cuestión que atañe a la órbita de lo nacional con, incluso, proyecciones en el terreno del Derecho Internacional Público al suponer su desarrollo el cumplimiento de una serie de obligaciones internacionales asumidas previamente por el Estado costarricense.

En primer término, como lo ha indicado este Tribunal Constitucional, el tema de las telecomunicaciones tiene gran relevancia constitucional, tanto que en el artículo 121, inciso 14), subinciso c), de la Constitución se indica que los servicios inalámbricos el espectro electromagnético forma parte del dominio público constitucional y concretamente es un bien propio de la Nación, siendo que no puede ser desafectado o salir del dominio del Estado. La Ley General de Telecomunicaciones No. 8642 de 4 de junio de 2008 en adelante LGT, al enunciar los principios rectores en este sector, indica en su artículo 3°, inciso i), que debe haber una optimización de los recursos escasos, destacando que la utilización de las infraestructuras de Telecomunicaciones debe ser («) objetiva, oportuna, transparente, no discriminatoria y eficiente, con el doble objetivo de asegurar una competencia efectiva, así como la expansión y mejora de las redes y servicios.

Precisamente, la optimización, utilización ponderada, expansión y mejora de la infraestructura y redes en materia de telecomunicaciones, obedece a los fines manifiestos de ese cuerpo normativo, tales como los de asegurar la aplicación de los principios de acceso universal, eficiencia, igualdad, continuidad, calidad, mayor y mejor cobertura y solidaridad en las telecomunicaciones (artículo 2° LGT). De otra parte, el artículo 32, inciso d), LGT establece con claridad meridiana que el objetivo del acceso y servicio universales y de la solidaridad, se logra, entre otros medios, a través del desarrollo de la infraestructura , dado que, sólo con una infraestructura robusta y plenamente desarrollada logra reducir la brecha digital, disfrutar de los beneficios de la Sociedad de la Información y del Conocimiento, la conectividad y la disponibilidad de dispositivos de acceso y servicios de banda ancha.

Por su parte la Ley de la Autoridad Reguladora de los Servicios Públicos, No. 7593 de 9 de agosto de 1993, en su artículo 74, modificado por la Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones No. 8660 de 8 de agosto de 2008, hizo una declaratoria de interés público de la infraestructura y las redes en telecomunicaciones al preceptuar lo siguiente: Considerase una actividad de interés público el establecimiento, la instalación, la ampliación, la renovación y la operación de las redes públicas de telecomunicaciones o de cualquiera de sus elementos. Tal declaratoria tiene grandes repercusiones, por cuanto, se reconoce, por ley, que el tema de la infraestructura en la materia reviste un claro e inequívoco interés público o general que trasciende la esfera de lo local o regional a lo interno del país, para proyectarse en el ámbito nacional e internacional, al permitirle al Estado costarricense cumplir, de buena fe, una serie de obligaciones y compromisos asumidos en el contexto del Derecho Internacional Público.

Cabe advertir que el interés público es definido por el artículo 113, párrafo 1°, de la Ley General de la Administración Pública de 1978, como la expresión de los intereses individuales coincidentes de los administrados, por su parte, el párrafo 2 del numeral citado de la LGAP de 1978 dispone, claramente, que el interés público prevalecerá sobre el interés de la Administración Pública cuando pueda estar en conflicto. Una consecuencia de lo anterior es que los intereses de cualquier ente público descentralizado costarricense, como podrían ser las municipalidades, no puede anteponerse al claro interés público de la infraestructura en telecomunicaciones así declarado, expresamente, por el legislador nacional a través de una ley que manifiesta la voluntad general (artículos 105 y 121, inciso 1°, de la Constitución), el que debe prevalecer sobre los intereses de carácter local, dado que, la autonomía municipal no le permite a los ayuntamientos sustraerse de lo que ha sido declarado como un interés de carácter nacional, de lo contrario se pervierte la autonomía territorial transformando a los municipios en micro estados, abstraídos de la dirección intersubjetiva o tutela que pueda ejercer el Estado, a través de los órganos constitucionales, mediante la emisión de leyes válidas y eficaces, la celebración de convenios y tratados internacionales por el Poder Ejecutivo y aprobados por la Asamblea Legislativa (artículos 7°, 121, inciso 4°, y 140, inciso 10°, de la Constitución Política).

La declaratoria de interés público efectuada por el artículo 74 de la Ley de la ARESEP, tiene, a su vez, asidero constitucional suficiente y legítimo en el numeral 45, párrafo 1°, de la Constitución Política, al establecer el principio de la intangibilidad relativa del patrimonio, al admitir la figura de la expropiación por interés público legalmente comprobado. Una segunda consecuencia que se extrae de la declaratoria de interés público, es que el tema de construcción, ampliación o desarrollo y mejora de la infraestructura en materia de telecomunicaciones tiene una clara e inequívoca vocación nacional. De modo que es el Estado y sus órganos los que asumen la rectoría y dirección en la materia a la que deben someterse todos los entes públicos menores para lograr objetivos como el acceso y servicios universales, la reducción de la brecha digital por razones de solidaridad, la interconexión y conectividad necesarias que le permitan a todos los costarricenses, independientemente de la localidad, distrito, cantón o región donde habiten, gozar de los beneficios y ventajas de la Sociedad de la Información y del Conocimiento.

El legislador nacional, lejos de localizar el tema de la infraestructura en telecomunicaciones lo nacionalizó expresa e inequívocamente. Reflejo de lo anterior, son la creación del Sector Telecomunicaciones previsto por el artículo 38 de la citada Ley de Fortalecimiento y Modernización de las Entidades Públicas del Sector de Telecomunicaciones, al disponer lo siguiente: Créase el Sector de Telecomunicaciones, dentro del marco de sectorización del Estado. Estará constituido por la Administración Pública, tanto la centralizada como la descentralizada, así como por las empresas públicas que desarrollen funciones o actividades relacionadas con las telecomunicaciones al tenor de esta norma el sector de las telecomunicaciones tiene un carácter transversal y, por ende, nacional, por cuanto, incluye a todo el universo de los entes públicos, incluidos, los descentralizados territorialmente como las municipalidades.

Es así, como los ayuntamientos no pueden sustraerse de tal sector. El carácter nacional de las telecomunicaciones, en general, y, particularmente, de su infraestructura queda más patente al considerar el artículo 39 de la Ley citada, en cuanto establece que el rector del sector lo será el Ministro de Ambiente, Energía y Telecomunicaciones, al que le corresponde, en ejercicio de una función general de dirección intersubjetiva o tutela administrativa, entre otras, las siguientes:

  • a)Formular las políticas para el uso y desarrollo de las telecomunicaciones; b) Coordinar («) la elaboración del Plan nacional de desarrollo de las telecomunicaciones («); c) Velar por que las políticas del Sector sean ejecutadas por las entidades públicas y privadas que participan en el Sector telecomunicaciones; e) Dictar el Plan nacional de telecomunicaciones, así como los reglamentos ejecutivos que correspondan; h) Coordinar las políticas de desarrollo de las telecomunicaciones con otras políticas públicas destinadas a promover la sociedad de la información; i) Velar por el cumplimiento de la normativa ambiental nacional aplicable y el desarrollo sostenible de las telecomunicaciones en armonía con la naturaleza. Por último, el carácter evidentemente nacional de las telecomunicaciones y sus diversos componentes, queda de manifiesto, cuando el artículo 40 de la Ley precitada regula el Plan Nacional de Desarrollo de las Telecomunicaciones, el cual es definido en el párrafo 1° de ese numeral como («) el instrumento de planificación y orientación general del Sector y define las metas, los objetivos y las prioridades de éste.

El legislador optó, entonces, por planificar a nivel nacional y no meramente local o regional el tema de las telecomunicaciones. De otra parte, la naturaleza nacional de las telecomunicaciones queda reforzada al crearse la Superintendencia de Telecomunicaciones (SUTEL), a la que le corresponde una serie de competencias de inequívoca índole nacional, así, conforme a los artículos 59 y 60 de la Ley de Creación de la ARESEP, le corresponde regular, aplicar, vigilar y controlar el ordenamiento jurídico de las telecomunicaciones («) para todo lo cual actuará en concordancia con las políticas del Sector, lo establecido en el Plan nacional de desarrollo de las telecomunicaciones, la Ley general de telecomunicaciones, las disposiciones establecidas en esta Ley y las demás disposiciones legales y reglamentarias que resulten aplicables. El Plan Nacional de Desarrollo de las Telecomunicaciones 2009-2014, por su parte, establece que Para avanzar en el aprovechamiento de los beneficios de la Sociedad de Información y Conocimiento, el país debe hacer un esfuerzo importante de inversión en el desarrollo de infraestructura de telecomunicaciones de manera que permita contar con más y mejores servicios de telecomunicaciones para todos los sectores de la población.

En este sentido, el desarrollo de la infraestructura en ese sector constituye una condición necesaria e indispensable a la que deberá brindarse una prioridad especial en cualquier proyecto país en materia de TIC («)y luego especifica que para lograr el desarrollo de la infraestructura nacional de telecomunicación deberá atender los siguientes lineamientos: a.1 Tomar las medidas necesarias para garantizar que el país cuente con una infraestructura moderna de telecomunicaciones, y al mismo tiempo asegurar la prestación de servicios de calidad y la generación de aplicaciones de valor agregado, permitiendo la convergencia, la interoperabilidad entre los sistemas, la incorporación de tecnologías de avanzada y la seguridad en las comunicaciones y garantizar el desarrollo de una infraestructura que permita llevar los servicios de telecomunicaciones a todos los habitantes del país, cumpliendo con los objetivos y metas de acceso universal, servicio universal y solidaridad («).

Se trata, entonces, de un plan que, por disposición expresa de ley, vincula u obliga, entre otros, a los entes municipales y que les conmina a contar con una infraestructura de telecomunicaciones, robusta, moderna, óptima, adecuada y desarrollada para disfrutar de los beneficios de la Sociedad de la Información y del Conocimiento. El logro de esta meta u objetivo, se verá, necesariamente, frustrado si cada corporación territorial, en un tema de clara vocación nacional, pretende establecer su propia orientación y requerimientos, por sobre la legislación nacional y los instrumentos del Derecho Internacional Público que obligan a todos los entes que conforman el Estado en sentido amplio (...)". Considera este Tribunal que el precedente supra citado es aplicable al caso en estudio, toda vez que uno de los aspectos que es objeto de análisis en la presente litis, es el tema de las telecomunicaciones y sus efectos en la esfera cantonal y nacional.

VI.INFRAESTRUCTURA DE TELECOMUNICACIONES, MUNICIPIOS, PLANES REGULADORES, ZONIFICACIÓN, CERTIFICADOS DE USO DE SUELO Y LICENCIAS DE CONSTRUCCIÓN. En un claro intento de brindar simetría y normalización en materia de infraestructura de telecomunicaciones por tratarse de un tema de clara vocación nacional, se han dictado una serie importante de instrumentos normativos de carácter general, tanto a nivel nacional como cantonal. Así, el Poder Ejecutivo dictó el Decreto No. 36159 de 10 de mayo de 2010, denominado Normas Estándares y Competencias de las Entidades Públicas para la aprobación coordinada y expedita requerida para la Instalación y Ampliación de Redes de Telecomunicaciones, cuyo fin fue uniformar los trámites para obtener autorizaciones para construir e instalar infraestructura de telecomunicaciones ante la dispersión normativa imperante y colmar las lagunas existentes en la materia. En el artículo 10, de este Decreto Ejecutivo se dispuso que es competencia municipal otorgar los certificados de uso de suelo y licencias constructivas, de conformidad con el Plan Regulador o sus reglamentos vigentes, siempre y cuando en dicho plan o reglamentos se contemple la instalación de infraestructura de telecomunicaciones.

En razón de lo dispuesto en los incisos a) y h) del artículo 3 de la Ley General de Telecomunicaciones, Ley No. 8642, así como lo dispuesto por el artículo 74 de la Ley de la Autoridad Reguladora de Servicios Públicos, Ley No. Placa3360, y en cumplimiento del principio de legalidad establecido en el artículo 11 de la Ley General de la Administración Pública, y en el artículo 11 de la Constitución Política, las municipalidades fundamentarán sus acciones para el otorgamiento de usos de suelo conforme y permisos de construcción en los siguientes principios:

  • a)Principio de universalidad, de manera que se propicie la concesión de las autorizaciones citadas a todos los interesados en ofrecer servicios de telecomunicaciones en el cantón sin discriminación alguna, con el objeto de que se garanticen, al menos, un mínimo de servicios de telecomunicaciones para los habitantes de todas las zonas y regiones del país en igualdad de condiciones.
  • b)Principio de neutralidad tecnológica, de manera que el otorgamiento de las autorizaciones citadas garanticen el derecho de los operadores de redes y proveedores de servicios de telecomunicaciones de escoger las tecnologías por utilizar.
  • c)La declaratoria de interés público que establece el artículo 74 de la Ley de la Autoridad Reguladora de los Servicios Públicos, de manera que se otorguen las autorizaciones citadas, considerando que resulta de interés público el establecimiento, la instalación, la ampliación, la renovación y la operación de las redes públicas de telecomunicaciones o de cualquiera de sus elementos.

La parte actora manifiesta que el Reglamento Municipal para licencias en telecomunicaciones, se introduce en un ámbito que las municipalidades no tienen competencia en razón de que el interés local queda subordinado a lo nacional. Esta argumentación de la parte actora carece de razón, toda vez que en el citado Decreto Ejecutivo número 36159, en donde se regula normas, estándares y competencias de las entidades públicas para la aprobación coordinada y expedita requerida para la instalación o ampliación de Redes de Telecomunicaciones, en su artículo 10, regula que será competencia exclusiva de las municipalidades el otorgamiento de los certificados de uso de suelo y licencias constructivas, de conformidad con el Plan Regulador o sus reglamentos vigentes, siempre y cuando en dicho plan o reglamentos se contemple la instalación de infraestructura de telecomunicaciones. De esta manera se logra evidenciar que si bien es cierto el tema de las telecomunicaciones reviste de un matiz de interés nacional, también es cierto que las Municipalidades están llamadas a participar en la regulación de la construcción de la infraestructura en telecomunicaciones y para ello pueden crear la reglamentación necesaria como es el reglamento municipal que es aquí impugnado en su artículo 12.

Asimismo, este reglamento municipal impugnado, cumple con lo establecido en el artículo 10 del Decreto Ejecutivo 36159, porque se refiere a la instalación de infraestructura en telecomunicaciones. De lo anterior se colige que el mismo Poder Ejecutivo aceptó que en materia de construcción de torres para operar la telefonía móvil, si bien existe un interés nacional, igualmente hay otro de carácter local, lo que lógicamente obliga al respeto a lo estatuido en la reglamentación urbanística municipal, incluyendo lo establecido en la Ley de Planificación Urbana y Ley de Construcciones, máxime que en virtud del principio de legalidad el citado decreto debe aplicarse de manera conforme con dicha normativa de rango superior. Si bien la temática de las telecomunicaciones revistan interés nacional, pero esto no excluye que también tengan una dimensión cantonal que es evidente y merece tutela, por lo tanto no es cierto que el Reglamento de la Municipalidad de Palmares para la Ubicación y Construcción de Infraestructura de Telecomunicaciones, se introduce en un ámbito en el cual los municipios no tienen competencia y resulta evidente que el artículo 12 impugnado, obedece a competencias asignadas a los entes municipales, y por lo tanto se encuentra dentro de lo límites de la potestad reglamentaria de la Municipalidad de Palmares.

La parte actora solicita se declare la disconformidad con el ordenamiento jurídico y se anule con efecto retroactivo al momento de su promulgación el artículo 12 antes el 11 del Reglamento de la Municipalidad de Palmares para la Ubicación y Construcción de Infraestructura de Telecomunicaciones. Para respaldar esta pretensión la parte actora ha alegado que dicha norma reglamentaria contradice las disposiciones de la ley 8642 y 7593, también que se trata de una regulación urbana que carece de criterios técnicos que la justifiquen, que existe quebranto a los principios de razonabilidad y proporcionalidad, junto con una falta de motivación del acto administrativo. En primer término este Tribunal considera que el artículo impugnado no se opone a lo dispuesto en las leyes 8642 y 7593. La parte actora interpreta que el supra citado artículo 12, pretende impedir la explotación, desarrollo e instalación de las torres de telecomunicación.

Sin embargo no se comparte tal postura, a juicio de esta cámara el artículo impugnado regula aspectos técnicos básicos como la dimensión de frente y fondo de los predios con relación a la altura de la torre. Esta disposición no impide en absoluto la construcción de una torre de telecomunicaciones, solamente se limita a regular un aspecto técnico y muy básico, que debe cumplir la torre, de modo que si estructura cumple con las disposiciones reglamentarias, no existe razón para impedir su construcción. De igual forma el artículo 12 supra citado no desmerita la declaración de interés público que reviste la actividad de telecomunicaciones, el hecho que se pongan algunas pautas constructivas, esto no se opone al interés público establecido para la actividad de telecomunicaciones en la ley 7539. Con respecto a que dicha regulación urbana carece de motivación, de criterios técnicos que la justifiquen, y que existe quebranto a los principios de razonabilidad y proporcionalidad, estos alegatos resultan improcedentes, toda vez que dicho artículo 12 debe su redacción actual a la modificación realizada por el reglamento de construcciones en su capítulo XIX Bis "Instalaciones de Telecomunicaciones", artículo XIX.4.3 Bis (folio 557).

Tome en cuenta la parte actora que el Reglamento de Construcciones tiene un capítulo especial dedicado a la instalación de telecomunicaciones, en donde indica presupuestos técnicos que son de acatamiento obligatorio para la construcción de Torres de Telecomunicaciones, esta normativa proviene del Poder Ejecutivo y no del gobierno local, por lo que no estamos ante una disposición de carácter local que aplica literalmente lo que de por sí, regula el Reglamento de Construcciones. También es relevante el hecho que la reforma al reglamento de construcciones es una norma vigente de acatamiento obligatorio que por su carácter general modificó el artículo 12 del Reglamento de la Municipalidad de Palmares para la Ubicación y Construcción de Infraestructura de Telecomunicaciones y por lo tanto no puede alegarse falta de motivación, falta de criterios técnicos que la justifiquen, y que existe quebranto a los principios de razonabilidad y proporcionalidad y siendo que el actor no impugnó el Reglamento de Construcciones que origina la disposición legal aquí impugnada debe declararse improcedente esta pretensión, al tener el artículo 12 del reglamento municipal impugnado su asidero jurídico en el Reglamento de Construcciones en su capítulo XIX Bis "Instalaciones de Telecomunicaciones", artículo XIX.4.3 Bis.

Lo anterior es conforme con el voto de la Sala Constitucional número 15763-2011, las leyes 8642 y 7593, en el sentido que las normas de carácter local como el reglamento municipal aquí impugnado debe someterse y ajustarse a normas y reglamentos de carácter nacional, como en este caso el Reglamento de Construcciones, por ser la materia de telecomunicaciones un tema de interés público así plasmado en la Ley de la Autoridad Reguladora de los Servicios Públicos, No. 7593 de 9 de agosto de 1993, en su artículo 74. Tal declaratoria tiene grandes repercusiones, por cuanto, se reconoce, por ley, que el tema de la infraestructura en la materia reviste un claro e inequívoco interés público o general que trasciende la esfera de lo local o regional a lo interno del país, para proyectarse en el ámbito nacional e internacional, al permitirle al Estado costarricense cumplir, de buena fe, una serie de obligaciones y compromisos asumidos en el contexto del Derecho Internacional Público.

Cabe advertir que el interés público es definido por el artículo 113, párrafo 1°, de la Ley General de la Administración Pública de 1978, como la expresión de los intereses individuales coincidentes de los administrados, por su parte, el párrafo 2 del numeral citado de la LGAP de 1978 dispone, claramente, que el interés público prevalecerá sobre el interés de la Administración Pública cuando pueda estar en conflicto. Una consecuencia de lo anterior es que los intereses de cualquier ente público descentralizado costarricense, como podrían ser las municipalidades, no puede anteponerse al claro interés público de la infraestructura en telecomunicaciones así declarado, expresamente, por el legislador nacional a través de una ley que manifiesta la voluntad general (artículos 105 y 121, inciso 1°, de la Constitución), el que debe prevalecer sobre los intereses de carácter local, dado que, la autonomía municipal no le permite a los ayuntamientos sustraerse de lo que ha sido declarado como un interés de carácter nacional.

Es importante resaltar que en el Decreto Ejecutivo 36159, que tantas veces ha sido citado y defendido por la parte actora, en su artículo 10 indica que las municipalidades deben sujetarse a lo fijado en la Ley de Construcciones y por ende su Reglamento, por lo tanto el artículo 12 impugnado no adolece de ninguna de las nulidades alegadas por el actor, siendo que se supeditó el Reglamento municipal a una norma de carácter nacional como el Reglamento de Construcciones, en aras de respetar la declaratoria de interés público en la actividad de telecomunicaciones que realiza la ley 7593 y respetar lo dispuesto en el supracitado Decreto Ejecutivo 36159. Por último al estar el artículo 12 del Reglamento Municipal de Palmares, basado en el artículo XIX.4.3 Bis del Reglamento de Construcciones, y dado que este reglamento tiene un capítulo especializado que indica "Instalaciones de Telecomunicaciones", carece de relevancia la discusión acerca de si las torres son edificaciones o estructuras, toda vez que no se les está aplicando la normativa general para edificaciones, sino más bien el capítulo especializado para Instalaciones de Telecomunicaciones. En consecuencia, no se observa deficiencia alguna que merezca ser declarada, lo que lleva al rechazo de la pretensión anulatoria formulada.

VII.Respecto de las pretensiones número 2 y 3, ambas deben ser rechazadas, por cuanto en el proceso no se observó deficiencia o vicio alguno que pudiera llevar a una declaratoria de nulidad, tampoco se encontró deficiencia o mala aplicación de los elementos discrecionales, toda vez que no hubo ejercicio indebido de tales potestades; al rechazarse la pretensión anulatoria el Reglamento Municipal impugnado se conserva intacto, y por lo tanto deviene en improcedente lo solicitado para la sustitución de la norma impugnada. Siendo que el actor en un primer momento solicitó la anulación de una serie de artículos (11, 17, 19, 20, 22 y 27 inciso p) que actualmente no son parte del Reglamento Municipal impugnado, y que esa pretensión fue resuelta mediante la satisfacción extraprocesal, su pretensión número 2, perdió parte de su fundamento, toda vez que se relacionaba con la pretensión de anulación de dichos artículos.

El actor pretendía que al anularse los artículos 11, 17, 19, 20, 22 y 27 inciso p) del Reglamento impugnado, la Municipalidad se viera obligada a replantear el texto de dichos artículos y en el momento de su formulación, se aplicara los límites y mandatos sugeridos por el actor en la pretensión 2; no obstante como ya se indicó, los artículos supra citados, ya no son parte del Reglamento impugnado y dentro del mismo no se encontró motivos de nulidad, específicamente en lo concerniente al artículo 12, por lo que su redacción se mantiene incólume. Al mantenerse el Reglamento impugnado con su redacción intacta, carece de sentido condenar a la administración para que cuando redacte nuevos artículos en razón de una nulidad que no se dio, se ejercite su discrecionalidad con los límites solicitados. En igual sentido la pretensión número 3 que se relaciona con el Decreto 36159-MINAET, artículo 11, carece de sentido toda vez que el Reglamento Municipal mantiene su normativa intacta y por lo tanto no existen vacíos que deban ser llenados por medio del supra citado artículo 11.

VIII. SOBRE LAS PRETENSIONES INDEMNIZATORIAS

En el caso concreto el planteamiento de fondo de la demanda fue rechazado y es base suficiente para denegar el reclamo pecuniario formulado, en tanto resulta accesorio de aquél. En efecto, en la medida en que no se ha constatado actuación ilegítima alguna de la Administración, no se ha configurado tampoco una lesión que el accionante no esté obligado a soportar. La responsabilidad administrativa, en el régimen de la Ley General de la Administración Pública (LGAP), exige que no solo se establezca la existencia de una conducta dañosa y una lesión patrimonial o extrapatrimonial, sino además, que entre ambas se dé un nexo causal, es decir, que exista relación directa de causa a efecto entre el hecho que se imputa y el daño producido. Así las cosas, opina este Tribunal que el reclamo de daños y perjuicios planteado carece de mérito jurídico y, en consecuencia, debe ser desestimado.-

IX. DE LOS PRESUPUESTOS DE FONDO DE LA ACCIÓN

La Municipalidad demandada, no formuló excepciones . No obstante de lo anterior, es lo cierto que tanto la doctrina procesal como la jurisprudencia contenciosa (en este sentido, puede consultarse la sentencia de casación 34-1961, de las diez horas veinte minutos del veintidós de marzo de mil novecientos sesenta y uno) reconocen como presupuestos sustanciales para el dictado de toda sentencia, los relativos a la legitimación de las partes intervinientes, el interés en la resolución del conflicto y el derecho; los cuales son revisables aún de oficio por todo juzgador. En el caso en estudio, es lo cierto que hay una debida legitimación, tanto activa como pasiva, en ese sentido, para este Tribunal el demandante cuenta con suficiente legitimación activa para participar en este proceso conforme al artículo 10 inciso 2 del CPCA; y la Municipalidad demandada por ser el ente que emitió el reglamento impugnado. Asimismo, también es evidente que el tema en discusión reviste interés actual para las partes, cabalmente en razón de que el Reglamento Municipal de Telecomunicaciones impugnado está vigente y surtiendo sus efectos. Y por último, es con fundamento en las consideraciones dadas en esta decisión, que se determina la improcedencia de la demanda interpuesta, lo que evidencia la falta de derecho que le asiste a la actora en su reclamo.

X. SOBRE LAS COSTAS

El artículo 193 del CPCA establece que las costas procesales y personales son impuestas al vencido por el solo hecho de serlo, pronunciamiento que debe hacerse incluso de oficio, al tenor de lo dispuesto en esa misma norma, en concordancia con el numeral 119.2 ibídem. La dispensa de esta condena solo es viable: a) cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar; b) cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria; o bien, c) cuando se incurra en plus petitio, esto es, cuando la diferencia entre lo reclamado y lo obtenido en definitiva sea de un quince por ciento (15%) o más, a no ser que las bases de la demanda sean expresamente consideradas provisionales o su determinación dependa del arbitrio judicial o dictamen de peritos (ordinal 194 ibídem). En la especie, no encuentra este órgano colegiado motivo para aplicar las excepciones que fija la normativa aplicable y quebrar el postulado de condena al vencido. Por ende, se impone el pago de ambas costas a la actora Nombre103344 .-

POR TANTO.

De conformidad con los hechos y citas jurisprudenciales que informan el presente proceso se resuelve: de oficio se declara falta de derecho. En consecuencia, se declara IMPROCEDENTE la demanda interpuesta por Nombre103344 contra la Municipalidad de Palmares. Son ambas costas a cargo de la actora.
