JUDGMENT 37-2013 ADMINISTRATIVE AND CIVIL TAX COURT, SECOND JUDICIAL CIRCUIT OF SAN JOSÉ, ANNEX A, FOURTH SECTION, at fourteen hundred hours on April twenty-ninth, two thousand thirteen.
Ordinary proceedings (proceso de conocimiento) conducted under expediente 12-1453-1027-CA, brought by Mr. Nombre90837, of legal age, married, tourism entrepreneur, resident of Santa Elena de Monteverde, Dirección13397, identity card CED88448, against the CONSEJO DISTRITAL DE MONTEVERDE, represented by the Mayor of its Municipal Council, Mr. José Francisco Vargas Leitón, of legal age, married, public official, resident of San Luis de Monteverde, identity card CED88449, and the MUNICIPALIDAD DE PUNTARENAS, represented by Mr. Nombre3986, of legal age, married, identity card CED4044, resident of Puntarenas, Dirección13398 300 meters west, 200 south and 100 west, in his capacity as Mayor; represented in the proceedings, the first by his special judicial attorney (apoderado especial judicial), Lic. José Alberto Brenes León, resident of Puntarenas, identity card CED32597; the second by his special judicial attorney, Lic. Randall Marín Orozco, identity card CED53799, divorced, resident of Dirección13399; and the third by her special judicial attorney, Lic. Evelyn Alvarado Corrales, married, identity card CED88450, resident of Dirección13400; the latter three being of legal age and attorneys.
BACKGROUND 1- Based on the complaint filed (folios 1 to 9), as amended at the Preliminary Hearing (folios 114 and 115) and at the commencement of the oral and public trial, the following relief is sought in the judgment: “That the originally intended use of the building adjacent to my property, namely as a recycling center for the district of Monteverde or for any other similar purpose involving waste management, be set aside. That the defendant Institution be ordered to pay damages (daños y perjuicios), to be quantified in the judgment and indexed to present value. That it be ordered to pay interest on the amounts awarded, calculated from the filing of this complaint. That it be ordered to pay interest on the amounts awarded, calculated from the filing of this complaint.” At the commencement of the oral and public trial, he stated that he estimated the non-pecuniary damage (daño moral) at nineteen million colones.
2- The representative of the Municipalidad de Puntarenas denied the complaint and raised the defenses of Lack of Standing to Sue (Falta de Legitimación activa) and Lack of Standing to Be Sued (Falta de Legitimación ad causam pasiva) (see folios 89 to 98).
3- The Consejo Municipal de Distrito de Monteverde denied the complaint and raised the defense of Lack of Legal Right (Falta de Derecho).
4- The oral and public trial was held at hearings on March 13 and April 5 and 12, all in 2013, attended by all parties.
5- The statutory requirements have been observed throughout the proceedings, there are no defects capable of rendering them null and void, and this decision is issued within the time limit established in section 111 of the Código Procesal Contencioso Administrativo for complex proceedings, following deliberation and by unanimous decision:
CONSIDERING:
I- PROVEN FACTS. THE FOLLOWING ARE DEEMED PROVEN:
1- On July 11, 2008, Mr. Nombre90837 acquired from Mr. Nombre111877 a 625-meter parcel of land for construction purposes, under cadastral plan P-1277300-08 (see deed at folio 11 of the main case file); 2- On November 6, 2008, Mr. Nombre111877 donated to the Consejo Municipal Distrital de Monteverde an unregistered property measuring 368.09 square meters, under cadastral plan P- 1276123-2008, bordered to the north by the property of Nombre90837 (see folio 1 of the administrative case file and Nombre111877’s trial testimony); 3- The land acquired by the plaintiff is located at Dirección13401 (see folio 14 of the business-license administrative case file); 4- On that land, Mr. Nombre90837 built several cabins to accommodate guests because of the tourism activity prevalent in the area (see folio 14 of the administrative case file and the testimony of Carlos Alberto Miranda Villalobos at the oral and public trial); 5- The claimant, Nombre90837, applied to the Consejo Municipal del Distrito de Monteverde for a business license (patente) for lodging activities, which was approved in April 2011 (see folios 14 and 15 of the business-license administrative case file); 6- In January 2012, the claimant, Nombre90837, reported to the Consejo Municipal de Distrito de Monteverde a profit of two million five hundred eighty-eight thousand two hundred twenty-five colones from his commercial activity (see folio 20 of the business-license administrative case file); 7- The property donated by Mr.
Nombre111877 to the Consejo Municipal de Distrito de Monteverde was registered under cadastral plan P 1372747-2009 (see folios 3 and 4 of the administrative case file); 8- By Municipal decision of June 27, 2012, land-use authorization (uso de suelo) was granted to the Mayor of the Consejo Municipal de Distrito de Monteverde for the construction of a shed to house the Solid-Waste Collection Center (Centro de Acopio de desechos sólidos) (see folio 5 of the administrative case file); 9- The Consejo Municipal de Distrito de Monteverde de Puntarenas has neither a Zoning Plan (Plan Regulador) nor Zoning Regulations (Reglamento de Zonificación) (see folio 5 of the administrative case file); 10- During the final months of 2011, construction began on a shed on property belonging to the Consejo Municipal de Distrito de Monteverde, cadastral plan P- 1372747-2009, for use as a Collection Center (Centro de Acopio) (fact not disputed by the parties; trial testimony of Engineer Olman Quesada Ugalde); 11- The foregoing structure measures 190 m2 (testimony given at the oral trial by Municipal Engineer Olman Quesada Ugalde, construction plans for the project included in the administrative case file, and land-use authorization at folio 5); 12- The plaintiff’s cabins and the Collection Center do not share an entrance, even though they are adjacent, and the latter has now been completed (folios 100 to 102 of the judicial case file, testimony of Adriana Flores Calvo, and photographs submitted as evidence); 13- On March 20, 2013, the Ministerio de Salud issued the Consejo Municipal de Distrito de Monteverde a sanitary operating permit (permiso sanitario de funcionamiento) for the Collection Center activity (see folio 148 of the judicial case file).
II- UNPROVEN FACTS. IT WAS NOT PROVEN THAT:
1- The land donated by Mr. Nombre111877 to the Consejo Municipal Distrital de Monteverde was subject to a condition that it be used for the construction of green areas and a children’s playground; 2- Mr. Nombre111877 carried out a subdivision development (proyecto de lotificación) in the area where he sold the land to the plaintiff; 3- Mr. Nombre90837 earned income from the lodging activity conducted on his property exceeding the amount he reported to the Consejo Municipal de Distrito de Monteverde; 4- Mr. Nombre90837 suffered damages as a result of the structure built adjacent to his property by the Consejo Municipal Distrital de Monteverde for use as the Collection Center; 5- Construction of the structure intended for the Collection Center adversely affected the plaintiff’s activity; 6- The Consejo Municipal de Distrito de Monteverde commenced recycling operations; 7- The Consejo Municipal de Distrito de Monteverde prepared the municipal comprehensive waste-management plan (plan municipal de gestión integral de residuos) for approval and implementation (the record).
III- THE PARTIES’ ARGUMENTS The claimant (accionante), Nombre90837, files suit alleging unlawful conduct by the Consejo Municipal de Distrito de Monteverde. He alleges that in 2008 he acquired a property from Mr. Nombre111877 in order to develop a tourism project consisting of 8 cabins with restaurant service, taking advantage of the area’s natural landscape. The project was completed in 2009, for which he had to obtain loans totaling approximately one hundred thirteen thousand dollars. However, in September 2011, the respondent Consejo Distrital de Monteverde began construction on land adjacent to his business to establish a waste collection or recycling center (centro de acopio o reciclaje de basura), an activity that he claims threatens the future of his establishment. He argues that Monteverde is a tourist area and that the mere announcement that a garbage dump would be installed next to his cabins has made some guests reluctant to continue staying at his establishment, resulting in reduced income.
As a second argument, he states that the land on which the collection or recycling center was being built had been donated by Mr. Nombre111877 to the Consejo de Distrito de Monteverde for use as a children’s park and green areas. Contrary to that purpose, the municipal body decided, in contravention of the natural environment, to construct the aforementioned facility, causing noise pollution (contaminación sónica) from early in the morning when construction work began. He further alleges that construction regulations were violated because there were no construction permits for the “garbage dump,” nor any health or environmental authorizations to establish the collection center, thereby creating a danger to public health. Although he has attempted to obtain the environmental impact study (estudio de impacto ambiental) that should exist for the implementation of such a project, he has been unable to do so, and when he requested information in that regard, the Municipality acknowledged that not all procedures required for the project had been completed.
He states that such conduct and the violation of due process (debido proceso), through the District Council’s installation of the “garbage dump” facility, cause him damages (daños y perjuicios) that are impossible or difficult to remedy. The representative of the Consejo Municipal de Distrito de Monteverde acknowledges that the claimant operates a business, while clarifying that the project consists only of four cabins and a small eatery (soda) serving basic food, not a restaurant, activities for which a municipal license was issued effective 15 de abril de 2010. The representative states that the claimant’s alleged financial prosperity from his lodging facilities is not known to it, since the income reported to the Municipality does not reflect what Mr. Nombre90837 claims. It acknowledges that, at the end of 2011, construction began on a shed for a collection center after the construction plans had been approved, as shown by municipal document RMU-412 del 27 de junio de 2012.
It further states that there is no restriction on the location or land use (uso de suelo) for that construction and that, because the project serves the public interest, originates with the District Council, and is being built on its own land, it does not require a construction permit. Likewise, it does not require environmental feasibility approval (viabilidad ambiental), because the construction does not exceed 300 square meters. It asserts that the project involves the establishment of a collection center, not a waste-recycling facility, and that it does not in any way interfere with the claimant’s activities. It denies that the construction of a garbage dump was announced and that it has been established that construction of the collection center reduced the claimant’s income or business activity. Regarding the land, it acknowledges that Mr. Nombre111877 donated it without conditions.
It further states that neither the land on which the collection center is located nor the claimant’s facilities form part of a subdivision development (proyecto de lotificación); to the contrary, if that were the case, the developer would have been required to process the matter and comply with the regulations established for that purpose under the Ley de Planificación urbana. Consequently, contrary to the claimant’s assertion, installation of the collection center on that land does not violate the law, because the donation was not subject to any designated use. It denies that the construction caused the adverse effects alleged by the claimant, acknowledging only that it caused the normal effects of any construction project; on the contrary, conditions of health, cleanliness, and harmony with nature are maintained at the site. Regarding the aforementioned collection center, it states that the permits required for its operation will be processed as appropriate once construction is completed and reports that Monteverde has no regulatory plan (plan regulador).
During the oral and public trial, it stated that construction had been completed and that a health operating permit (permiso sanitario de funcionamiento) had already been granted, although matters relating to its administration had not yet been determined. It opposes the claim, reiterating that the project is a collection center, not a garbage dump as the claimant calls it. The Municipalidad de Puntarenas acknowledges that the Consejo Distrital de Monteverde planned the construction of a collection center to address a community need and that it was constructed on the lot adjacent to that of the claimant, Nombre90837. It denies the claimant’s assertions regarding the establishment of a garbage dump and the consequences of such a facility, which concern future circumstances, without taking into account that the activity is regulated and will be supervised by the Ministerio de Salud, and therefore will not cause pollution affecting the environment, neighbors, or workers.
Regarding the donation of the land, it admits that Mr. Nombre111877 made the donation, but that the act was not subject to any designated use, contrary to the claimant’s assertion. It emphasizes that the property on which the collection center is intended to operate does not share an entrance with the claimant’s cabins and that what occurs at the collection center cannot even be seen from the claimant’s property, because the properties are separated by a living fence. It further states that, on the recommendation of the municipal environmental manager, the noise is intended to be contained away from the claimant’s property. It contends that Monteverde has neither a regulatory plan nor a Reglamento de Zonificación and that land may therefore be used by its owners provided that they comply with the legislation in force. It rejects the damages sought and the due-process violation alleged by Mr. Nombre90837 and states that all activities conducted at the collection center will comply with the provisions of the 8839 Ley para la Gestión integral de Residuos.
IV—REGARDING COLLECTION CENTERS Ley para la Gestión Integral de Residuos number 8839 of June 24, 2010, establishes that the municipalities shall be responsible for the integrated waste management (gestión integral de residuos) of waste generated in their canton; to that end, they must establish and implement the municipal integrated waste management plan in accordance with the national policy and National Plan; issue regulations within the canton governing the classification, selective collection, and final disposal of waste, which must further the objectives of this Law and its Regulations; promote the creation of an environmental management unit responsible for the integrated waste management process, with its corresponding budget and personnel; ensure that selective, accessible, periodic, and efficient waste collection services are provided throughout their territory to all inhabitants, as well as material recovery centers, with special emphasis on small- and medium-scale centers for subsequent recovery of value; provide cleaning services for gutters, drainage ditches, culverts, roads, public spaces, rivers, and beaches, where applicable, as well as the sanitary handling of dead animals on public roads; prevent and eliminate dumps within the canton and the unauthorized stockpiling of waste; promote alternative systems for the selective collection of recoverable waste, such as containers or receptacles, among others; and set fees for waste-management services that include the costs of carrying out integrated waste management, in accordance with the municipal integrated waste management plan.
That Law and its Regulations, and in proportion to the quantity and quality of the waste generated, ensuring the strengthening of the infrastructure necessary to provide those services and guaranteeing their self-financing; coordinate compliance within the municipality with this Law and its Regulations, the national policy and National Plan, and any other technical regulation on integrated waste management; promote training and conduct educational campaigns to raise awareness among the inhabitants of the respective canton in order to foster a culture of separate collection, the cleaning of public spaces, and integrated waste management; and enter into agreements with microenterprises, cooperatives, women’s organizations, and other local organizations and/or businesses so that they may participate in the waste-management process, particularly in communities located far from the cantonal seat.
Municipalities are also authorized to develop alternative technologies for waste treatment, provided that they are less polluting, and to use the planning and management instruments provided for in the Código Municipal, including associative and business-integration mechanisms. They are further authorized to establish differentiated fees based on the type and quantity of waste for those who separate waste at its source, or another form of tax incentive for the generator or manager that contributes to integrated waste management within the canton. These provisions also state that the municipal integrated waste management plan is the instrument that shall guide municipal actions for integrated waste management within the canton. It shall be prepared on the basis of the guidelines established in the National Plan and the Regulations to that Law. This plan may be jointly prepared with other municipalities.
For its preparation, the municipality shall convene a public hearing in accordance with the provisions to be established in the Regulations to the Law, in coordination with the Ministerio de Salud, for the purpose of formally presenting the scope of the municipal integrated waste management plan to the community and interested parties. Municipal plans shall be submitted to the Ministerio de Salud for registration, follow-up, and monitoring (Article 8). Likewise, in section 6, the Law defines integrated waste management as the coordinated and interrelated set of regulatory, operational, financial, administrative, educational, planning, monitoring, and evaluation actions for the handling of waste, from its generation through final disposal. For its part, the Reglamento General a la Ley para la Gestión Integral de Residuos, executive decree N° 37567-S-MINAET-H, establishes that, as indicated by the law it regulates, the municipalities are responsible for the integrated management of waste generated within their canton and therefore have the authority to issue regulations and implement the measures necessary to achieve such management throughout their cantonal territory.
Likewise, to safeguard municipal autonomy, this law authorizes municipal corporations to use and develop alternative technologies that are less polluting to the environment (Article 3). Said regulatory instrument further requires municipalities, as the entities responsible for the integrated management of waste generated within their canton, to prepare and implement, through a participatory process, a Municipal Integrated Waste Management Plan, in accordance with related national policies and the National Integrated Waste Management Plan. To achieve this objective, the Manual para la Elaboración de Planes Municipales de Gestión Integral de Residuos Sólidos is available, providing step-by-step guidance for preparing that planning instrument, which municipalities may use at their discretion. The municipality may make any adjustments necessary to meet the canton’s needs (Article 20). In accordance with the foregoing, municipalities are required to provide a solution within their territory for the waste generated there.
To that end, they possess broad powers, including the authority to regulate the activity and determine, in accordance with their needs, population size, area, and the factors to be considered in implementing the legal and technical mechanisms provided by law for carrying out that function.
V—ON THE MERITS The plaintiff first requests in his complaint that construction of a large shed intended for the installation of a Collection Center be suspended and that the structure be demolished; at the preliminary hearing, he modified that claim by requesting that the intended use of the structure be changed, that the Center not be installed at that location, and that he also be compensated for the damages caused to him by such municipal activity. Based on an analysis of the plaintiff’s assertions in his complaint and at the oral and public trial, he alleges a violation of the construction regulations concerning what he calls a “garbage dump,” because it lacks the corresponding permits, such that the installation and commencement of operations of the Collection Center pose a danger to public health. From the established factual record, this Chamber finds that the property owned by the respondent, Consejo Municipal Distrital del Monteverde, was in fact donated by Mr.
Nombre111877, who appeared at the oral and public trial and expressly acknowledged that he had always intended for the land he donated to the Consejo Municipal to be used to create green areas and a children’s park. He conveyed that intention to his attorney at the time, who was responsible for contacting municipal officials of the Consejo Distrital de Monteverde and coordinating matters related to the donation. However, he states that, before signing the deed of transfer, he never communicated with representatives of the Consejo Municipal de Monteverde; rather, everything was handled through his attorney, and he merely appeared to sign the deed. In this regard, it is essential to note that, although Mr. Nombre111877 stated at trial that his intention was to donate the land to the Consejo Municipal for the creation of green areas and a children’s park, he never spoke with officials of the Consejo Distrital and trusted that his attorney had made the corresponding arrangements, after which he appeared to sign the deed.
Although, in the view of this Chamber, his testimony was sincere and his account of his intent in donating the land is credible, that intent was not conveyed to the Consejo Distrital so that the donation would be made for a specific purpose and that purpose recorded in the public instrument documenting the donation. There is no evidence in the record establishing that the Consejo Distrital knew of Mr. Nombre111877’s intention regarding the transfer of the property. It therefore cannot be deemed established that the donation was formally made for that purpose, and the plaintiff’s allegation concerning the change in the intended use of the land donated by Mr. Nombre111877 is accordingly without merit. Consequently, its owner, Consejo Municipal Distrital de Monteverde, was entitled, as it did, to exercise unrestricted control over its property in accordance with its interests. It must be noted that Monteverde de Puntarenas does not have a Regulatory or Zoning Plan establishing land-use planning and the use of properties in the area.
Consequently, there was no provision limiting the owner’s use of the property, nor was there any limitation or reservation imposed by other laws regarding the disposition of the property and the use assigned to it. It should also be added that, if this were a conditional donation, the donor—not the plaintiff—would have standing (legitimación) to bring the claim. That structural requirement is therefore not satisfied.
VI—ON THE CONSTRUCTION OF THE COLLECTION CENTER It is alleged that construction standards were violated in the warehouse intended to serve as a recycling center (Centro de Reciclaje); however, the plaintiff does not support his claim with any technical findings in this regard, nor does he identify any regulations that he believes the defendant Municipal Council violated. On this matter, testimony was received at the oral and public trial from Mr. Olman Alvarado Ugalde, the Municipal Architect who was responsible for the construction work. He stated that there is no Regulatory Plan (Plan Regulador), and therefore there is no technical obstacle to undertaking the project on that lot or to its intended use. In addition, the project is located on a road outside the city center, where there are few residences, and even the road providing access to the collection center (Centro de Acopio) is not ordinarily used to access the plaintiff’s cabins.
He stated that he understands that a recycling center will be installed there, which may be used for plastic, cardboard, glass, aluminum, and other materials; that the selected land is suitable for construction of the project as such, which is the matter within his area of expertise; and that the constructed building is environmentally compatible. For her part, Ms. Adriana Flores Calvo, environmental manager (gestora ambiental) for the Municipalidad de Puntarenas, stated that she visited the project at a time when there was no waste there and that access to it is not shared with the plaintiff’s cabin project. She indicated that, before the collection center begins operating, the District Municipal Council must prepare an environmental management plan (plan de gestión ambiental) to determine the types of waste to be received, and that organic waste must not be handled at that center; the waste must be received inside the premises.
She further stated that the project has an appearance similar to that of other centers she has visited, that it is roofed, and she made recommendations concerning its operation, including keeping the waste dry during temporary storage and carrying out unloading indoors. Before activities begin, there must be a waste management plan (Plan de manejo de desechos), which must be approved by the District Municipal Council. To prevent noise pollution (contaminación sónica), she recommended constructing an insulating wall along the boundary adjoining the plaintiff’s property, and operation requires a sanitary operating permit (Permiso Sanitario) from the Ministerio de Salud. This testimony reveals important matters, including that the professional in the field visited the site and determined that it was not yet operating as a collection center and that its activities had not begun; and that, with respect to its construction characteristics, there is no technical impediment restricting its construction, apart from the Regulatory Plan, which does not exist in that area.
This is consistent with the defendants’ assertions and is further supported by the evidence submitted at the oral hearing by the representative of the District Municipal Council, establishing that the sanitary operating permit from the Ministerio de Salud was not granted until 20 de marzo de 2013. This evidence therefore defeats the plaintiff’s arguments and assertions, since it is not possible to find the damages he alleges from an activity that has not begun. Only the structure has been built, and its operation requires not only a sanitary permit but also the preparation of a waste management plan to be approved by the Municipal Council and the establishment of the organization necessary for its operation. Matters such as its administration, the number of workers, the types of waste to be received, and many other aspects must be resolved before it can operate. The plaintiff states that the project lacks an environmental impact study (estudio de impacto ambiental) supporting its operation and regulating its impact on nature, as well as its effects on health.
On this matter, the General Regulations on Environmental Impact Assessment Procedures (Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental, EIA) Nº 31849-MINAE-S-MOPT-MAG-MEIC establish in Article 3 what is understood by an environmental impact study: “34. bis Environmental Impact Study (Estudio de Impacto Ambiental, EsIA) for activities, works, or projects with low or moderately low potential environmental impact: In cases where the activity, work, or project, because of its attributes (size, duration, location, materials and equipment used, and production), is classified as having a low or moderately low potential environmental impact, it shall comply, whenever the regulations in force expressly require the submission of an EsIA, with the procedure established by SETENA, in accordance with the principles of proportionality and reasonableness, provided that all elements encompassed by the definition of EsIA included in these Regulations are fully satisfied.
(The preceding subsection was added by Article 1 of Decreto Ejecutivo N° 32734 of 09 de agosto de 2005).” It likewise defines what an assessment consists of: “35. Initial Environmental Assessment (Evaluación Ambiental Inicial, EAI): A procedure for analyzing the environmental characteristics of an activity, work, or project in relation to its location in order to determine the significance of its environmental impact. It involves submitting an environmental document signed by the developer, having the nature and scope of a sworn declaration (declaración jurada). Its analysis may result in the granting of environmental viability (license) (viabilidad [licencia] ambiental), or in making such viability conditional upon the submission of other EIA instruments.” The provisions transcribed above show that there is an essential distinction between an environmental impact study and an environmental impact assessment: they have a genus-to-species relationship.
The assessment encompasses the possibility of evaluation in all its forms, as necessary to determine, according to the works or activities to be undertaken, the relevance, appropriateness, and necessity of an environmental impact study. In this specific case, the Comprehensive Waste Management Law (Ley para la Gestión integral de residuos) does require an environmental assessment before the activity begins. Depending on the type of waste to be recycled, whether ordinary or special, its purpose would require the corresponding environmental impact study in order to determine, prevent, and properly implement measures against pollution. At this time, however, the plaintiff’s arguments are, in this Chamber’s view, premature, because the recycling activity has not begun, nor has the Comprehensive Waste Management Plan (Plan Integral de Gestión de los residuos) determining the types of waste to be recycled been prepared.
Only at that time must the Consejo Municipal de Distrito de Monteverde undergo the corresponding initial environmental assessment to determine whether an environmental impact study is necessary. In addition, Anexo n°2 establishes the List of activities, works, or projects subject to the EIA process for which no specific laws require it. In compliance with Article 17 of the Organic Environmental Law (Ley Orgánica del Ambiente), for human activities for which no specific law orders an EIA, or which may alter or destroy elements of the environment or generate waste or toxic or hazardous materials, SETENA, together with a Joint Technical Support Commission (Comisión Mixta de apoyo técnico), has prepared a list of activities, works, or projects that would be subject to the EIA process before their activities begin. In abbreviated form, this list is designated the EIA List (Lista de EIA), and it specifically requires such approval for the construction and operation of buildings in urban areas, except for single-family residences and buildings comprising up to 300 square meters of construction on two floors or fewer.
(As amended by Article 13 of Decreto Ejecutivo N° 32734 of 09 de agosto de 2005). Accordingly, the plaintiff’s claim is likewise unsupported, since it was established that the completed construction measures 190 square meters. The evidence in the record does not show that the center is operating, and it is therefore impossible to accept the plaintiff’s claim concerning damages caused by construction of the collection center, because only a warehouse in which it will be installed has been built. It will not be possible to determine whether it complies with the technical standards and recommendations necessary for its activity until operations begin. Accordingly, in the opinion of this collegiate body (órgano Colegiado), Mr. Nombre90837’s claim is premature. There are no grounds for presuming the serious harm described by the plaintiff in support of the damages he claims; and although some witnesses stated that some waste was received at one point, everything indicates that this was a symbolic act associated with the inauguration of the warehouse.
He also claims damages because the mere announcement that the center would be installed has caused him harm. For that purpose, he called Mr. Carlos Alberto Miranda Villalobos, who stated that he was the contractor who built the cabins on the plaintiff’s property and testified at trial that Nombre90837 had told him that the cabin business was being harmed by the “dump” that was to be installed. An observation is important here: the plaintiff has consistently maintained that what is actually intended to be installed is a dump, which would harm his commercial activity. That characterization, however, is made by Mr. Nombre90837 and is not accurate, because in his view a collection or recycling center is comparable to a dump. This is incorrect, since it is clear that such centers do not handle organic waste, as the municipal environmental manager emphasized. As stated above, a properly managed recycling center should not cause pollution of any kind.
It is currently premature for this Chamber to assess that matter because the center has not begun operating. Instead, this reflects the public’s fear arising from how this problem was handled many years ago, rather than the contemporary framework currently governing it. Regarding the harm allegedly caused to the plaintiff by the center’s location next to his property and to the surrounding environment, which, according to the plaintiff, creates an imbalance with the nature prevailing in the area, it must be clearly understood that, because no Regulatory Plan exists in the area, property owners are free to determine the activities they conduct or the structures they build on their properties, provided that they do not violate other laws, given the nature of their properties and the activities they intend to undertake. In the judgment of this Panel of Judges (Colegio de Jueces), therefore, installation of a recycling center at that location, next to the plaintiff’s property, does not violate any technical regulation.
The activity is viable and lawful, provided that the corresponding operating permits (sanitary permit) are obtained beforehand, a waste management plan is in place, and the activity is properly administered in accordance with applicable laws. There is no basis whatsoever to support the plaintiff’s claim for compensation, because the challenged activity is lawful and he failed to demonstrate that it has caused or will cause him any harm. Accordingly, this Court finds that neither the arguments nor the claims of the plaintiff, Nombre90837, are admissible. It must be stated to the Consejo Municipal de Distrito de Monteverde that the foregoing does not exempt it from the responsibility entailed in conducting activities at the collection center, including compliance with the technical recommendations made by the environmental manager, construction of a wall to contain noise along the boundary adjoining the plaintiff’s property, preparation of the Waste Management Plan (Plan de Manejo de desechos), and performance of recycling activities in accordance with the laws and regulations governing them.
It bears noting that any technical recommendation that may be issued in the future to prevent harm to the plaintiff or third parties must be considered with the seriousness it deserves; this does not exclude the possibility of adopting decorative measures compatible with the surroundings.
VI—REGARDING THE DEFENSES:
The defendants raise the defenses of lack of standing (falta de legitimación activa) and failure to state a valid legal claim (Falta de Derecho). These defenses must be rejected. The plaintiff demonstrated in the proceedings that the structure was built adjacent to his property and that he felt adversely affected by such conduct of the Municipal Council, which did in fact give him standing to bring his legal action. With regard to failure to state a valid legal claim, the plaintiff’s claim cannot prevail because, in the opinion of this Chamber, the complaint concerning the future operation of the collection center is premature, and it was not demonstrated that the actions of the Municipal District Council violated the legal order (ordenamiento jurídico).
VII—REGARDING COSTS.
Pursuant to Articles 119, 193, and 194 of the Administrative Litigation Procedural Code (Código Procesal Contencioso Administrativo), this proceeding shall be resolved without a specific award of costs (especial condenatoria en costas), because, although the action was dismissed, the nature of the issues in dispute provided sufficient grounds for litigation. The plaintiff felt adversely affected in his commercial activity and believed that he was entitled to bring his claim.
THEREFORE:
The defenses of lack of active standing and lack of passive standing ad causam (Falta de Legitimación activa y ad causam pasiva) are rejected, and the defense of failure to state a valid legal claim is sustained. This ordinary action (demanda ordinaria) is dismissed in its entirety. The defendants shall take note of the provisions set forth in the reasoning portion of this judgment. This matter is resolved without a specific award of costs. Let notice be given.

SENTENCIA 37-2013 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, ANEXO A, SECCIÓN CUARTA, a las catorce horas del veintinueve de abril de dos mil trece.
Proceso de conocimiento tramitado bajo el número de expediente 12-1453-1027-CA, incoado por el señor Nombre90837 , mayor, casado, empresario Turístico, vecino de Santa Elena de Monteverde, Dirección13397 , cédula de identidad CED88448, contra el CONSEJO DISTRITAL DE MONTEVERDE, representada por su Intendente del Consejo Municipal, señor José Francisco Vargas Leitón, mayor, casado, funcionario público, vecino de San Luis de Monteverde, con cédula de identidad CED88449 y la MUNICIPALIDAD DE PUNTARENAS representada por el señor Nombre3986 , mayor, casado, cédula de identidad CED4044 vecino de Puntarenas, Dirección13398 300 metros al oeste, 200 sur y 100 oeste, en su condición de Alcalde, representados en el proceso, el primero por su apoderado especial Judicial Licenciado José Alberto Brenes León, vecino de Puntarenas, cédula de identidad CED32597, el segundo por su apoderado especial judicial licenciado Randall Marín Orozco cédula de identidad CED53799, divorciado, vecino de Dirección13399 , y la tercera por su apoderada Especial judicial licenciada Evelyn Alvarado Corrales casada, cédula de identidad CED88450, vecina de Dirección13400 , los tres últimos, mayores y abogados.
RESULTANDO
1- Con base en la demanda interpuesta (folios 1 a 9), lo ajustado en la Audiencia Preliminar (folios 114 y 115) y al inicio del juicio oral y público, se ordene en sentencia: " Que se deje sin efecto el uso original que se le pretendía dar a la edificación contiguo a mi propiedad, en cuanto a destinarlo como centro de reciclaje del distrito de Monteverde o cualquier otro fin similar para el manejo de basura. Que se condene a la Institución demanda al pago de los daños y perjuicios los cuales se liquidarán en sentencia, indexados a valor presente. Que se condene al pago de intereses, sobre los rubros de la condenatoria, a partir de la interposición de esta demanda. Que se condene al pago de intereses, sobre los rubros de la condenatoria, a partir de la interposición de esta demanda." Al inicio del juicio oral y público, indico que estima el daño moral por la suma de diecinueve millones de colones.
2- La representación de la Municipalidad de Puntarenas contestó negativamente la demanda y opuso las defensas de Falta de Legitimación activa y Falta de Legitimación ad causam pasiva (ver folios 89 a 98) 3- El Consejo Municipal de Distrito de Monteverde contestó la demanda de forma negativa y opuso de la defensa de Falta de Derecho.
4- El juicio oral y público se celebró en las audiencias de los días 13 de marzo, 5 y 12 de abril, todas del 2013, a las cuales asistieron todas las partes.
5- En los procedimientos se han seguido las prescripciones legales, no existen defectos capaces de producir nulidad y se dicta esta resolución dentro del término establecido en el numeral 111 del Código Procesal Contencioso Administrativo, para los procesos de trámite complejo, previa deliberación y por unanimidad:
CONSIDERANDO:
I- HECHOS PROBADOS. SE TIENEN POR DEMOSTRADOS LOS SIGUIENTES:
1- El señor Nombre90837 , adquirió el 11 de julio de 2008 del señor Nombre111877 , terreno para construir con una medida de 625 metros, bajo el plano catastrado P-1277300-08 (ver escritura de folio 11 del expediente principal); 2- En fecha 6 de noviembre de 2008 el señor Nombre111877 donó al Consejo Municipal Distrital de Monteverde una finca sin inscribir, con una medida de 368,09 metros cuadrados con plano catastrado P- 1276123-2008, la cual linda al norte con la propiedad de Nombre90837 (ver folio 1 del expediente administrativo, declaración en juicio de Nombre111877 ); 3- El terreno adquirido por el actor se encuentra ubicado en el Dirección13401 (ver folio 14 del expediente administrativo de patentes); 4- Que en el citado terreno el señor Nombre90837 construyó varias cabinas para el alojamiento de personas, en razón de la actividad turística que impera en la zona (ver folios 14 del expediente administrativo y declaración testimonial en el juicio oral y público de Carlos Alberto Miranda Villalobos); 5- El accionante Nombre90837 solicitó ante el Consejo Municipal del Distrito de Monteverde patente para la actividad de hospedaje la cual le fue aprobada en el mes de abril de 2011(ver folios 14 y 15 del expediente administrativo de patentes); 6- En el mes de enero de 2012, el accionante Nombre90837 reportó ante el Consejo Municipal de Distrito de Monteverde como utilidad obtenida por la actividad comercial realizada de dos millones quinientos ochenta y ocho mil doscientos veinticinco colones (ver folio 20 del expediente administrativo de patentes); 7- La finca donada al Consejo Municipal de Distrito de Monteverde por el señor Nombre111877 , fue inscrita bajo el plano catastrado P 1372747-2009 (ver folios 3 y 4 del expediente administrativo); 8- Mediante resolución Municipal del 27 de junio de 2012 se otorgó uso de suelo al Intendente del Consejo Municipal de Distrito de Monteverde, para la construcción de un galerón para la instalación del Centro de Acopio de desechos sólidos (ver folio 5 del expediente administrativo); 9- El Consejo Municipal de Distrito de Monteverde de Puntarenas no cuenta con Plan Regulador ni con Reglamento de Zonificación (ver folio 5 del exp. Admvo); 10- Que en los meses finales del año 2011 se inició la construcción de un galerón en propiedad del Consejo Municipal de Distrito de Monteverde plano catastrado P- 1372747-2009, a fin utilizarlo como Centro de Acopio ( hecho no controvertido por las partes, declaración del Ingeniero Olman Quesada Ugalde en juicio); 11- Que la anterior construcción mide 190 m2 (declaración del Ingeniero Municipal Olman Quesada Ugalde rendida en juicio oral y planos constructivo de la obra visible en el expediente administrativo y a folio 5, uso de suelo); 12- Las cabañas propiedad del actor y el Centro de Acopio no tienen una entrada común, aún cuando son colidantes, mismo que a la fecha se encuentra finalizado (folios 100 a 102 del expediente judicial, declaración de Adriana Flores Calvo, fotografías aportadas como prueba); 13- En fecha 20 de marzo de 2013, se otorgó permiso sanitario de funcionamiento por parte del Ministerio de Salud para la actividad de Centro de Acopio al Consejo Municipal de Distrito de Monteverde (ver folio 148 del expediente judicial) II- HECHOS NO PROBADOS, NO SE PROBÓ QUE:
1- El terreno donado por el señor Nombre111877 al Consejo Municipal Distrital de Monteverde, tuviera supeditaba para la construcción de áreas verdes y un parque infantil; 2- El señor Nombre111877 , haya realizado en la zona donde vendió el terreno al actor un proyecto de lotificación; 3- El señor Nombre90837 tuviera ingresos mayores a los reportados por él ante el Consejo Municipal de Distrito de Monteverde en relación con la actividad de hospedaje que realiza en su propiedad; 4- Con ocasión de la construcción realizada contiguo a su propiedad por el Consejo Municipal Distrital de Monteverde, para destinarla al Centro de Acopio el señor Nombre90837 haya sufrido daños y perjuicios; 5- La construcción de la obra destinada para Centro de Acopio haya impactado negativamente la actividad que desarrolla el actor; 6- El Consejo Municipal de Distrito de Monteverde haya iniciado labores de reciclaje; 7- Se haya elaborado por parte del Consejo Municipal de Distrito de Monteverde el plan municipal de gestión integral de residuos para su aprobación y puesta en marcha (los autos) III- SOBRE LOS ARGUMENTOS DE LAS PARTES El accionante Nombre90837 formula demanda acusando conductas antijurídicas del Consejo Municipal de Distrito de Monteverde.
Alega que en el año 2008, adquirió una propiedad del señor Nombre111877 , a fin de desarrollar un proyecto turístico, compuesto de 8 cabañas, con servicio de restaurante, en aprovechamiento del paisaje natural del lugar, proyecto que finalizó en el año 2009, para lo cual debió adquirir créditos de alrededor de ciento trece mil dólares. Sin embargo para el mes de setiembre de 2011, el demandado Consejo Distrital de Monteverde inició construcción en el terreno colindante a su negocio a fin de instalar un centro de acopio o reciclaje de basura, actividad que denuncia amenaza el futuro de su establecimiento. Argumenta que Monteverde es una zona turística, y que el solo anuncio de la instalación del basurero a la par de sus cabañas, existe renuencia de algunos huéspedes para continuar en su establecimiento lo que ha tenido como consecuencia la reducción de sus ingresos. Como segundo argumento señala que el terreno donde se construye el Centro de Acopio o reciclaje, fue donado por el señor Nombre111877 al Consejo de Distrito de Monteverde con la finalidad de que el mismo se destinara a un parque infantil y áreas verdes, contrario a tal destino, el órgano Municipal decidió contraviniendo el entorno natural, la construcción de la obra indicada generando una contaminación sónica desde temprano al inicias las obras constructivos, acusa además que se han violentado las normas de construcción porque no se cuentan con los permisos de construcción del " basurero", ni tampoco las autorizaciones sanitarias ni ambientales para establecer el centro de acopio, lo que genera un peligro para la Salud Pública.
Aún cuando ha intentado obtener el estudio de impacto ambiental que debe existir para la realización de tal proyecto no le ha sido posible, y que cuando solicito información al respecto la Municipal acepta que no se han realizado todos los trámites necesarios para la obra. Informa que tal conducta y la violación del debido proceso, el Consejo de Distrito con la instalación de las obra " basurero" le acarrea daños y perjuicios de imposible y difícil reparación. La representación del Consejo Municipal de Distrito de Monteverde, acepta que el actor cuenta con un negocio, aclarando que el proyecto tal solo consta de cuatro cabañas y una soda para alimentación básica no un restaurante, actividades para las cuales de expidió la licencia Municipal, lo anterior a partir del 15 de abril de 2010, indica que no le consta la prosperidad económica del actor proveniente de sus instalaciones de hospedaje, pues los ingresos reportados ante el Municipio no reflejan lo afirmado por el señor Nombre90837 .
Acepta que a finales del año 2011 se inició la construcción de un galerón para un centro de acopio, previo aprobación de los planos constructivos, según demuestra con el documento municipal RMU-412 del 27 de junio de 2012, además que no existe impedimento para la ubicación o uso de suelo de dicha construcción, y que por el interés público que reviste el proyecto y provenir del Consejo Distrital y construirse en sus propio terreno no requiere de licencia de construcción, de igual forma tampoco requiere viabilidad ambiental al no exceder de 300 metros cuadrados de construcción. Afirma que el proyecto constituye la instalación de un Centro de Acopio no reciclaje de basura, que no atenta de forma alguna contra la actividad que desarrolla el actor, rechaza que se haya anunciado la construcción de un basurero y que no acreditado que la construcción del Centro de acopio le haya reducido sus ingresos o actividad.
Respecto al terreno acepta que el mismo le fue donado por el señor Nombre111877 sin condicionamiento, además que el lugar donde se encuentra tanto el terreno donde se ubica el centro de Acopio como las instalaciones del actor no constituye un proyecto de lotificación, por el contrario si fuere de esa forma el desarrollador debió haber tramitado y cumplido con la normativa establecida al efecto Ley de Planificación urbana, porque lo que no atenta como lo indica el actor contra la legalidad la instalación del centro de acopio en ese terreno, por que su donación no estuvo afecta a ningún destino. Rechaza que la construcción haya provocado las afectaciones que señalar el actor, sino acepta que son las normales de cualquier obra constructiva, por el contrario en el sitio se mantiene condiciones de salud, limpieza y armonía con la naturaleza. Respecto al citado Centro de Acopio menciona que los permisos para su funcionamiento una vez terminada su construcción se gestionarán conforme correspondan, informa que en Monteverde no hay plan regulador.
Durante el Juicio oral y público hizo ver que la construcción fue terminaba y ya se les otorgó el permiso sanitario de funcionamiento, aún cuando no se ha determinado lo relativo a su administración. Rechaza la demanda reafirmando que el proyecto constituye un centro de Acopio no un basurero como lo denomina el actor. La Municipalidad de Puntarenas acepta que el Consejo Distrital de Monteverde proyectó la construcción de un Centro de Acopio a fin de dar solución a una necesidad de la comunidad, construcción que se instaló en el lote colindante con el del actor Nombre90837 , rechaza las manifestaciones del actor sobre la instalación de un basurero y de las consecuencias de dicho establecimiento, refiriéndose a situaciones futuras, sin observar que dicha actividad se encuentra regulada y será fiscalizada por el Ministerio de Salud por lo que no habrá contaminaciones al ambiente, vecinos o trabajadores, rechazándola.
Respecto a la donación del terreno, admite que la realizó el señor Nombre111877 pero dicho acto no estuvo sujeto a destino alguno como lo afirma el actor. Resalta que la la propiedad donde se pretende instalar el centro de acopio no comparte entrada común con las cabinas del actor, ni siquiera se puede observar desde la propiedad del actor lo que sucede en el Centro de Acopio, ya que las propiedades se delimitan por una cerca viva, y que por recomendación de la gestora ambiental municipal se pretende confinar el ruido hacia la propiedad del actor. Aduce que en Monteverde no existe plan regulador ni Reglamento de Zonificación, por lo que los terrenos puedes ser utilizados por sus dueños siempre y cuando respeten la legislación vigente. Rechaza los daños y perjuicios pretendidos y la violación al debido proceso acusa por el señor Nombre90837 , y que la actividad que se realice en el Centro Acopio se hará en cumplimiento a las disposiciones de la 8839 Ley para la Gestión integral de Residuos.
IV- SOBRE LOS CENTROS DE ACOPIO Ley para la Gestión Integral de Residuos número 8839 del 24 de junio de 2010, establece que las Municipalidades serán responsables de la gestión integral de los residuos generados en su cantón; para ello deberán establecer y aplicar el plan municipal para la gestión integral de residuos en concordancia con la política y el Plan Nacional, dictar los reglamentos en el cantón para la clasificación, recolección selectiva y disposición final de residuos, los cuales deberán responder a los objetivos de esta Ley y su Reglamento, promover la creación de una unidad de gestión ambiental, bajo cuya responsabilidad se encuentre el proceso de la gestión integral de residuos, con su respectivo presupuesto y personal, garantizar que en su territorio se provea del servicio de recolección de residuos en forma selectiva, accesible, periódica y eficiente para todos los habitantes, así como de centros de recuperación de materiales, con especial énfasis en los de pequeña y mediana escala para la posterior valorización, proveer de los servicios de limpieza de caños, acequias, alcantarillas, vías, espacios públicos, ríos y playas cuando corresponda, así como del manejo sanitario de animales muertos en la vía pública, prevenir y eliminar los vertederos en el cantón y el acopio no autorizado de residuos, impulsar sistemas alternativos para la recolección selectiva de residuos valorizables como contenedores o receptores, entre otros, fijar las tasas para los servicios de manejo de residuos que incluyan los costos para realizar una gestión integral de estos, de conformidad con el plan municipal para la gestión integral de residuos.
Esa Ley y su Reglamento, y en proporción con la cantidad y la calidad de los residuos generados, asegurando el fortalecimiento de la infraestructura necesaria para brindar dichos servicios y garantizando su autofinanciamiento, coordinar el cumplimiento de esta Ley y su Reglamento, la política y el Plan Nacional y cualquier otro reglamento técnico sobre gestión integral de residuos dentro del municipio, promover la capacitación y realizar campañas educativas de sensibilización de los habitantes del cantón respectivo para fomentar la cultura de recolección separada, de limpieza de los espacios públicos y de gestión integral de residuos, establecer convenios con microempresas, cooperativas, organizaciones de mujeres y otras organizaciones y/o empresas locales, para que participen en el proceso de gestión de los residuos, especialmente en las comunidades que se ubican lejos de la cabecera del cantón.
Además se autoriza a las Municipalidades para que desarrollen tecnologías alternativas para el tratamiento de residuos, siempre y cuando sean menos contaminantes y la utilización de instrumentos de planificación y gestión previstos en el Código Municipal, entre ellos los mecanismos de integración asociativa y empresarial. Se le autoriza, además, a establecer tasas diferenciadas, según el tipo y la cantidad de residuos a aquellos que separen en la fuente, u otra forma de incentivo fiscal para el generador o el gestor, que contribuya en el cantón a la gestión integral de residuos. Señala además dicha normativa que el plan municipal de gestión integral de residuos es el instrumento que orientará las acciones de las municipalidades para la gestión integral de residuos en el cantón. Se elaborará a partir de los lineamientos dictados en el Plan Nacional y el Reglamento de esa Ley. Este plan podrá ser formulado en forma mancomunada con otras municipalidades, para su confección la municipalidad convocará a una audiencia pública conforme lo establecerá el Reglamento de la Ley, en coordinación con el Ministerio de Salud, a fin de presentar formalmente a la comunidad y a los interesados los alcances del plan municipal de gestión integral de residuos, planes municipales serán presentados ante el Ministerio de Salud para su registro, seguimiento y monitoreo (artículo 8 ).
Asismimo define la Ley en su numeral 6 a la Gestión integral de residuos como conjunto articulado e interrelacionado de acciones regulatorias, operativas, financieras, administrativas, educativas, de planificación, monitoreo y evaluación para el manejo de los residuos, desde su generación hasta la disposición final. Por su parte el Reglamento General a la Ley para la Gestión Integral de Residuos, decreto ejecutivo N° 37567-S-MINAET-H, establece que conforme lo indica la ley que reglamento las municipalidades son las responsables de la gestión integral de los residuos generados en su cantón, por lo que es potestad de éstas dictar los reglamentos y aplicar las medidas que sean necesarias para alcanzar dicha gestión en su territorio cantonal: Asimismo, en resguardo de la autonomía municipal, esta ley deja autorizada a las corporaciones para emplear y desarrollar tecnologías alternativas que resulten menos contaminantes para el ambiente (artículo 3), impone además dicho cuerpo reglamentario que los Planes municipales para la gestión integral de residuos, como responsables de la gestión integral de residuos generados en su cantón, deben elaborar e implementar en forma participativa un Plan Municipal de Gestión Integral de Residuos, en concordancia con las políticas nacionales afines y el Plan Nacional para la Gestión Integral de Residuos.
Para lograr lo anterior, está disponible el Manual para la Elaboración de Planes Municipales de Gestión Integral de Residuos Sólidos, que orienta paso a paso en la elaboración de dicho instrumento de planificación, el cual será utilizado a conveniencia de las municipalidades. La municipalidad podrá realizar los ajustes necesarios según las necesidades del cantón (artículo 20). Conforme lo anterior, los Municipios se encuentran obligadas a dar solución en su territorio a los residuos generados, para ello cuentan con amplias potestades, inclusive reglamentar la actividad, la determinar conforme a sus necesidades cantidad de pobladores, zona y los factores que debe considerar para poner en marcha los mecanismo legales y técnicos que la ley de provee para la ejecución de dicha labor.
V- SOBRE EL FONDO La parte actora solicita primeramente en su demanda que se suspenda y demuela la construcción de un galerón para la instalación de un Centro de Acopio, pretensión que en la audiencia preliminar, solicitando se cambien el destino de esa construcción, que no se instale en ese lugar el Centro y además se le cancelen los daños y perjuicios que tal actividad municipal le ha causado. En análisis por lo afirmado por el actor en su demanda y en el juicio oral y público, tenemos que se alega violación a las normas de construcción de lo que llama “basurero”, al no contar con los permisos correspondientes, por lo que la instalación puesta en marcha del Centro de Acopio genera un peligro para la Salud Pública. Esta Cámara del cuadro fáctico acreditado extrae que efectivamente la finca propiedad del accionado Consejo Municipal Distrital del Monteverde fue donada por el señor Nombre111877 , quien se hizo presente en el juicio oral y público y reconoce a viva voz que el citado terreno que le donó al Consejo Municipal, siempre fue su intención que el mismo se destinara a crear áreas verdes y un parque infantil.
Voluntad que le expresó a su abogado en aquel momento, profesional que se encargó de contactar a funcionarios Municipales del Consejo Distrital de Monteverde y coordinar lo relativo a dicha donación, sin embargo nos dice que nunca se comunicó antes de la firma de escritura de traspaso con personeros del Consejo Municipal de Monteverde, sino que todo se dio por medio de su abogado, que él solo se presentó a firmar la escritura. A respecto es esencial mencionar que si bien el señor Nombre111877 manifiesta en juicio que su intención fue donar el terreno al Consejo Municipal para la creación de áreas verdes y parque infantil, nunca conversó con funcionarios del Consejo Distrital y confió en que su abogado coordinó lo correspondiente y luego se presentó a firmar la escritura, si bien su declaración en criterio de ésta Cámara fue sincera y le merece credibilidad sobre su voluntad al donar el terreno no fue trasmitida al Consejo Distrital, a fin de que la donación se realizara con un fin específico, mismo que se consignara en el documento público el que se plasmo la donación.
No existe probanza en autos, que logré acreditar que el Consejo Distrital tuviera conocimiento de la intención de don Nombre111877 , respecto al traspaso de la propiedad por lo que no es posible tener por cierto que la donación se hizo formalmente con ese fin, no siendo de recibo de esta forma lo denunciado por el actor, sobre el cambio de destino del terreno donado por don Nombre111877 . Lo que arroja como consecuencia que su propietario el Consejo Municipal Distrital de Monteverde podía, como lo hizo, ejercer libre disposición de su bien conforme a sus intereses. Resulta necesario mencionar que Monteverde de Puntarenas no cuenta con un Plan Regulador o de Zonificación, que establezca el ordenamiento y uso de las propiedades en la zona, no existiendo en consecuencia ninguna disposición que limitará la utilización del bien de parte de su propietario, o bien que existiera alguna limitación o reserva dispuesta por otras leyes respecto a la disposición del bien y el uso que se le asignó.
No esta demás agregar que si estuvieramos frente a una donación condicionada, sería el donante el legitimado para reclamarlo, persona que no es el actor. De suerte que se incumple ese requisito estructural.
VI- SOBRE LA CONSTRUCCIÓN DEL CENTRO DE ACOPIO Se alega que se violentan normas de construcción en el Galerón destinado a Centro de Reciclaje, sin embargo no sustenta el accionante su demanda con señalamientos técnicos al respecto, ni tampoco normativa que considera violentó el demandado Consejo Municipal. Sobre el tema se recibió en el juicio oral y público al señor Olman Alvarado Ugalde, arquitecto Municipal quien estuvo a cargo de la construcción de la obra, narra que no existe Plan Regulador, por lo que no hay obstáculo técnico para la realización de la obra en ese lote, y el destino que se le pretende dar. Aunado a que el proyecto se encuentra ubicado en una calle fuera del centro de la ciudad, donde existen pocas viviendas, y que inclusive la calle que da acceso al Centro de Acopio no es común en el ingreso a las cabinas del actor. Nos relata que sabe se instalará un Centro de Reciclaje, el cual puede destinarse para el plástico, cartón vidrio, aluminio y otros, que el terreno escogido es apto para la construcción de la obra como tal, que es la materia de su competencia, y que el edificio construido es amigable con el entorno.
Por su parte la señorita Adriana Flores Calvo, gestora ambiental de la Municipalidad de Puntarenas, nos habla que visitó la obra momento para el cual no habían residuos y que el acceso al mismo no es compartido por el actor para su proyecto de cabinas. Señala que para inicie su funcionamiento el Centro de Acopio debe realizarse un plan de gestión ambiental por parte del Consejo Municipal distrital a fin de determinar la clase de residuos que se han de recibir, y que en dicho centro no deben manejarse desechos orgánicos, que los residuos deben ser recibidos dentro del local, nos informa además que la obra tiene un aspecto similar a otros centros que ha visitado, que está techado y emite recomendaciones sobre su funcionamiento de mantener secos los residuos, mientras se da su almacenaje temporal, que la descarga debe ser interna, que previo a iniciar actividades debe contarse con un Plan de manejo de desechos que debe aprobarse por parte del Consejo Municipal Distrital, y que para evitar la contaminación sónica recomendó que se construyera una pared aislante en la parte colindante a la finca del actor, y para el funcionamiento debe contarse por el Permiso Sanitario del Ministerio de Salud.
Tal declaración nos refleja aspectos de importancia, tales como que la profesional en el campo visitó el lugar determinándose que todavía no está funcionamiento como Centro de Acopio, no se han dado inicio sus actividades, que respecto a sus características constructivas no hay ningún impedimento técnico que limite su construcción, a excepción del plan Regulador que no existe en esa zona, lo cual coincide con lo afirmado por los demandados y encuentra mayor respaldo en la prueba aportada en la audiencia oral por el representante del Consejo Municipal de Distrito, donde se acredita que el permiso sanitario de funcionamiento del Ministerio de Salud fue otorgado hasta el 20 de marzo de 2013. Por lo que tales probanzas hacer caer los argumentos y afirmaciones del actor, pues no es posible considerar los daños que pretende por un actividad que no se ha iniciado, tan solo se construyó la obra, que para su funcionamiento requiere más que un permiso sanitario sino la elaboración de un plan de manejo de desechos que debe ser aprobado por parte del Consejo Municipal, y generarse la organización necesaria para su funcionamiento.
Aspectos tales como su administración, el número de trabajadores, que tipo de residuos se van a recibir y otros tantos aspectos que deben completarse para su funcionamiento. El actor menciona que el proyecto no cuenta con un estudio de impacto ambiental que respalde su funcionamiento y regule el impacto con la naturaleza, así como la afectación a las Salud. Sobre el tema el Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA) Nº 31849-MINAE-S-MOPT-MAG-MEIC, establece que en su artículo 3, lo que se entiende por Estudio de impacto ambiental " 34. bis Estudio de Impacto Ambiental (EsIA) para actividades, obras o proyectos de bajo y moderado bajo impacto ambiental potencial: Para aquellos casos en que la actividad, obra o proyecto, por sus atributos (dimensión, duración en el tiempo, localización, materiales y equipos que utiliza, y producción), se defina como de bajo o moderado bajo impacto ambiental potencial, deberá cumplir, cuando la normativa vigente le solicita de forma expresa, la presentación de un EsIA, y siguiendo el principio de proporcionalidad y razonabilidad, con el trámite que la SETENA defina, siempre y cuando se cumplan de forma cabal los elementos que abarca la definición de EsIA que se incluyen en el presente Reglamento.
(Así adicionado el inciso anterior por el artículo 1° del decreto ejecutivo N° 32734 del 09 de agosto de 2005). Así como en que consiste una Evaluación: "35. Evaluación Ambiental Inicial (EAI): Procedimiento de análisis de las características ambientales de la actividad, obra o proyecto, con respecto a su localización para determinar la significancia del impacto ambiental. Involucra la presentación de un documento ambiental firmado por el desarrollador, con el carácter y los alcances de una declaración jurada. De su análisis, puede derivarse el otorgamiento de la viabilidad (licencia) ambiental o en el condicionamiento de la misma a la presentación de otros instrumentos de la EIA. " De las normas transcrita se desprende que existen una diferencia esencial entre un estudio y una evaluación de Impacto ambiental, una relación de género y especie, la evaluación incluye la posibilidad de evaluación en todas sus modalidades, necesario para determinar la pertinencia, procedencia y necesidad conforme a las obras o actividades a desarrollar de un Estudio Impacto ambiental, en el caso concreto si de determina en la Ley para la Gestión integral de residuos la evaluación ambiental previo al inicio del actividad.
Está tiene como finalidad considerando el tipo de residuos a reciclar, bien sea ordinarios o especiales, requeriría del correspondiente estudio de impacto ambiental, esto a fin de determinar, prevenir y ejecutar adecuadamente medidas para la no contaminación, sin embargo a este momento, los argumentos del actor resultan en criterio de ésta Cámara prematuros, en razón de que no se ha iniciado la actividad de reciclaje ni tampoco se ha realizado el Plan Integral de Gestión de los residuos que determine el tipo de residuos a reciclar, por solo para ese momento es que el Consejo Municipal de Distrito de Monteverde, debe someterse a la correspondiente evaluación ambiental inicial, para determinarse si resulta necesario el Estudio de impacto Ambiental. Aunado a lo anterior, el anexo n°2 establece la Lista de actividades, obras o proyectos sujetos al proceso de EIA y para los cuales no existen leyes específicas que así lo soliciten, que en cumplimiento de lo establecido por el artículo 17 de la Ley Orgánica del Ambiente, aquellas actividades humanas para las cuales no existe una ley específica que ordene la realización de una EIA, o que, sean susceptibles de alterar o destruir elementos del ambiente, o generar residuos, materiales tóxicos o peligrosos, la SETENA, en conjunto con una Comisión Mixta de apoyo técnico, ha elaborado una lista de actividades, obras o proyectos que estarían sujetas al proceso de EIA de previo al inicio de sus actividades.
De forma corta, dicha lista, se asigna como la Lista de EIA, y concretamente impone que se requiere tal aprobación en la construcción y operación de edificaciones en la zona urbana, excepto las viviendas uni-Familiares y edificaciones de hasta 300 metros cuadrados de construcción en dos pisos o menos. (Así reformado por el artículo 13 del Decreto Ejecutivo N° 32734 del 09 de agosto de 2005). Conforme lo anterior, de igual forma el reclamo del actor, pierde sustento, al quedar acreditado que la construcción realizada tiene una medida de 190 metros cuadrados. De la prueba aportada en autos no se evidencia que el Centro se encuentre en funcionamiento, por lo que no es posible aceptar la pretensión del actor sobre daños que le ha provocado la construcción del Centro de Acopio, pues tan solo se construyó un galerón donde estará instalado, y no es hasta que se inicien labores en el mismo que podrá determinarse, si cumple con las normas y recomendaciones técnicas necesarias en su actividad por lo que resulta en tal sentido en criterio de éste órgano Colegiado prematura la demanda del señor Nombre90837 .
No existen bases para presumir las graves afectaciones que narra el actor a los daños que reclama; y si bien algunos testimonios narran que en algún momento se recibió algún desecho, todo indica que fue un acto simbólico, a partir de la inaguración del Galerón. Reclama también daños porque el solo anuncio de la instalación de dicho centro le causado daños, para ales efectos trae al proceso al señor Carlos Alberto Miranda Villalobos quien dice fue el constructor que realizó las cabañas en propiedad del actor, quien nos narra en juicio que Nombre90837 le comentó que se estaba viendo afectado en el negocio de las cabañas por “basurero” que se pretende instalar. Resulta de importancia realizar una observación, el actor ha venido sosteniendo que se pretende instalar en realidad es un basurero lo que perjudica su actividad comercial, empero tal calificación la realiza el señor Nombre90837 , sin que resulte cierta, pues conforme su criterio asemeja un Centro de Acopio o reciclaje con un basurero, lo cual resulta equivocado, pues es claro que en dichos centros no se manejan desechos orgánicos como lo recalcó la gestora ambiental municipal.
Tal y como se indicó supra un Centro de Reciclaje adecuadamente manejado no debe llamar a la contaminación desde ningún ámbito, lo cual en este momento resulta prematuro para esta Cámara calificar pues no ha entrado en funcionamiento. Se trata más bien de un temor de la población hacia como se ha manejado esa problemática hace muchos años y no el entorno contemporáneo que rige actualmente. Sobre los daños que le provocan al actor por la ubicación junto a su propiedad, y al entorno, provocando según criterio del actor un desequilibrio con la naturaleza que impera en la zona. Al respecto debe tenerse claro que ante la inexistencia de un Plan Regulador en la zona, los propietarios tienes una libre disposición sobre la actividad que realicen o construyan en sus propiedad, siempre y cuando no contravengan otras leyes, en razón de las naturaleza de sus fundos y la actividad que pretendan realizar.
Por lo a juicio de este Colegio de Jueces, la instalación de un Centro de Reciclaje en el lugar, junto a la propiedad del actor, no contraviene ninguna normativa técnica siendo viable y legal dicha actividad siempre y cuando se obtengan previamente los permisos de funcionamiento correspondiente (permiso sanitario), se cumpla con la existencia de un plan de manejos de residuos, así como una sana administración de la actividad conforme a la leyes vigentes. No se encuentra sustento alguno en que pueda descansar la pretensión indemnizatoria del actor, pues la actividad acusada es lícita y que no demostró que la misma haya causado o provoque daño alguno al actor. Así las cosas considera este Tribunal que no resultan de recibos ni los argumentos ni pretensiones del actor Nombre90837 . Es menester indicar al Consejo Municipal de Distrito de Monteverde, que lo expuesto no lo exenta de la responsabilidad que conlleva realizar la actividad en el Centro de Acopio, respecto a las recomendaciones técnicas realizadas por la Gestora ambiental, pared para el confinamiento del ruido en la colindancia con el actor, la elaboración del Plan de Manejo de desechos así como la actividad de reciclaje apegada las leyes y reglamentos que la ordenan.
No está demás señalar que toda recomendación técnica que el futuro se llegué a generar para evitar la afectación al actor, o a terceras personas debe ser valorada con la seriedad que merece; lo que no excluye la posibilidad de adoptar medidas decorativas afines con el entorno.
VI- SOBRE LAS EXCEPCIONES:
Interponen los demandados las excepciones de falta de legitimación activa y Falta de Derecho. Tales defensas deben ser rechazadas, el actor demostró en el proceso que la obra se construyó en su colindancia sientiéndose afectado por tal conducta del Consejo Municipal, lo que efectivamente lo legitimaba para su acción judicial. Respecto a la Falta de Derecho, no le asiste al accionante, pues en criterio de esta Cámara el reclamo sobre a futura actividad del centro de acopio, resulta prematura, y tampoco se demostró que las actuaciones del Consejo Municipal de Distrito violentarán el ordenamiento jurídico.
VII- SOBRE LAS COSTAS.
De conformidad con los ordinales 119, 193 y 194 del Código Procesal Contencioso Administrativo, se impone resolver este proceso sin especial condenatoria en costas, toda vez que aunque se declaró sin lugar la acción, por la naturaleza de las cuestiones debatidas hubo suficiente motivo para litigar. El actor se sintió afectado en su actividad comercial y consideró tener derecho en su reclamo.
POR TANTO:
Se rechazan las defensa de Falta de Legitimación activa y ad causam pasiva, y se acoge la de Falta de Derecho. Se declara sin lugar en todos sus extremos la presente demanda ordinaria. Tomen nota los demandados de lo dispuesto en la parte considerativa de este fallo. Se resuelve este asunto sin especial condenatoria en costas. Notífiquese.
