Possessory information proceeding (Información posesoria) Nº08-0028-163-CA // APP. 188-TA-13 Petitioner: Junta de Educación Escuela Líder de Paso Tempisque Nº206-2013 ADMINISTRATIVE AND CIVIL TAX APPEALS COURT. II JUDICIAL CIRCUIT OF SAN JOSÉ. ANNEX A. Goicoechea, at sixteen hours thirty minutes on April eighth, two thousand thirteen.- Possessory information proceedings, filed before the Administrative and Civil Tax Court by the Junta de Educación Escuela Líder de Paso Tempisque, Carrillo, Guanacaste, represented by its President, vested with powers of an unlimited general attorney-in-fact, Nombre161096, of legal age, single, homemaker, resident of Dirección19438, holder of identity card CED126610.- Appearing as interested parties are the State, represented by Deputy Attorney General Lydiana Rodríguez Paniagua, whose personal particulars are not indicated, and the Instituto de Desarrollo Agrario, represented by its general judicial attorney-in-fact Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Guachipelín de Guanacaste, holder of identity card CED28225.- RESULTS:
Judge Fernández Argüello writes the opinion, and
CONSIDERING:
I).- Given the manner in which this matter is resolved, no ruling is made concerning the proven facts enumerated by the first-instance Judge.- II).- The Attorney General’s representative states that the survey plan on which these proceedings are based shows that the property for which title is sought is bounded on the South by the Acueducto Rural de Paso Tempisque, a circumstance also established by the testimonial evidence received in the record.- She indicates that the Instituto Costarricense de Acueductos y Alcantarillados, in official letter SUB-G-AID-UEN-AMB-2011-1736 of September twenty-second, two thousand eleven, stated that because the property adjoins the ASADA well, the construction of septic tanks on the property must be avoided in order to prevent potential contamination of the aquifer supplying the well. For that reason, she repeatedly requested that the Judge furnish the State with the statements made in that regard by the representative of that Asociación, but received no favorable response, thereby depriving the State of its right to present a defense.- She alleges that the only document sent to them was a certificate stating that “drinking water for human consumption supplied by this Asociación is available,” but not the statement of Nombre161100 on which the Judge based her ruling.- She asserts that the land to be registered encompasses part of the protection area (área de protección) adjoining the well, which is in the public domain (dominio público), pursuant to Article 31(a) of the Ley de Aguas, which provides that lands surrounding collection sites or drinking-water intake points, within a perimeter having a radius of no less than two hundred meters, are public-domain property (bienes demaniales).
The matter is regulated in similar terms by Article 7(c) of the Ley de Tierras y Colonización and Article 2 of the Ley General de Agua Potable. For those reasons, because there is no certainty that the ASADA issued a report regarding the area surrounding the well that is encompassed by the land to be registered and the percentage of the property affected, these proceedings must not permit the petitioner to register the property described in plan G-937584-90 with a perimeter having a radius of less than 200 meters from the well, because that would be equivalent to allowing it to incorporate the remaining strip, which is in the public domain. She requests that the appealed judgment be vacated and that the proceedings instead be ordered corrected in the terms indicated.- III).- It is an undisputed fact, as acknowledged by the petitioner and as shown on the very survey plan forming the basis of the possessory information proceeding, that the property for which title is sought is bounded on its southern boundary by the Acueducto Rural de Paso Tempisque, administered by the Asociación Administradora del Acueducto Rural of that locality (see plan at folio 7 and the first fact stated in the initial filing in these proceedings, at folio 18).- Because of this circumstance, from the moment she entered an appearance, the State’s representative requested that a report be obtained from the Instituto Costarricense de Acueductos y Alcantarillados to determine whether that well supplies water to the population or should be reserved for that purpose, because, if so, as she stated, “a new plan must be submitted excluding the spring (manantial) and the two hundred or three hundred meters adjoining it, depending on the configuration of the land” (folio 128).- In response to that request, the first-instance Judge sent an official letter to the aforementioned Instituto (folios 130 and 131).
The ASADA stated that water for human consumption is available on the land for which title is sought (folio 135), and Engineer Moisés Bermúdez García, Head of the Instituto’s Departamento de Cuencas Hidrográficas, stated the following in official letter NºSUB-G-AID-UEN-AMB-2011-1736 of September 22, 2011: “The Dirección de Acueductos Rurales del A y A was consulted, and note SUB-G-GSD-UEN-AP-EBD-2011-2228, dated 13/07/2011, indicates that the Paso Tempisque water-supply well is located near the property. Field verification is suggested. In that same regard, we inform you that the Departamento de Aguas del MINAET was consulted on our own initiative, and note DA-2036-2011, dated 26/05/2011, indicates that no concessions for the use of water to supply the population are registered for that property. Attached. According to the analysis conducted using our information system concerning water use for supplying populations, the property identified in expediente Nº08-0028-0163-CA is not currently subject to any such use and does not form part of future plans for that purpose.
The property adjoins the well of the ASADA de Paso Tempisque. In our judgment, this property has low water-resource vulnerability (fragilidad hídrica). Notwithstanding the foregoing, the construction of septic tanks on the property must be avoided to prevent potential contamination of the aquifer supplying the well. Therefore, pursuant to the environmental legislation in force, we recommend strict observance and protection of the waters and their recharge and protection zones (Art. 33 Ley Forestal and Arts. 31 and 32 Ley de Aguas). Should it be considered necessary to examine in greater depth any technical aspect related to the protection of these important areas and appropriate to inspect the sites under study, we remain fully available to assist” (folios 168 and 169, 180 and 181). By order issued at eleven hours and four minutes on June sixth, two thousand twelve, the first-instance Judge deemed that documentation submitted and continued processing the matter without making any observation in that regard (folio 183).
Accordingly, in a filing of October twelfth of that same year, the Attorney General’s representative requested that the Asociación administering the water-supply system be notified of the proceedings conducted, in order to determine whether the plans overlapped, given that public-domain waters were involved (folios 205 and 206). Subsequently, in a pleading of January seventeenth, two thousand thirteen, she stated that it was necessary to verify the condition of the lot in order to determine the land’s protection area pursuant to Article 31 of the Ley de Aguas and exclude it from the registrable area because it was in the public domain (folios 214 to 216). Nevertheless, neither of those two requests was addressed at first instance.- III).- Following the foregoing review, the Court notes that, as alleged, the judgment under appeal was issued prematurely, since essential procedural steps remain pending, without the completion of which it is impossible to issue a valid ruling in this matter.
The lot sought to be registered borders, along its southern boundary, the well of the Paso Tempisque rural aqueduct (acueducto rural), and it has not yet been determined in these proceedings whether that circumstance requires the establishment of a well protection area (área de protección) and, consequently, the possible exclusion of any portion of the land claimed by the applicant Board.- The State representative has vehemently and repeatedly insisted on the need to verify this matter in order to protect the water resource (recurso hídrico), and the Instituto Costarricense de Acueductos y Alcantarillados, through the Departamento de Cuencas Hidrográficas, established the need to conduct a field inspection (inspección de campo), even placing its technical resources and personnel at the Court’s disposal so as not to adversely affect the public interests involved.- The a quo Court (Despacho a quo), however, disregarded those requests and referred the matter to the deciding Judge, who issued the judgment without making any reference to this specific issue.- In doing so, it failed to comply with Article 31 of the Ley de Aguas, which establishes, in such cases, the judge’s obligation to take the necessary precautions to protect the water resource, none of which occurred in this case.- That omission unquestionably affects the validity of the judgment, which must be vacated so that the proceedings may be brought into conformity and it may be determined whether there is a protection area surrounding the intake site (sitio de captación) or well of the Paso Tempisque rural aqueduct; if so, the appropriate measures must be taken before a final decision is rendered in these proceedings.- This case file shall be remanded to the Court of First Instance so that it may proceed without delay with the required formalities.-
POR TANTO:

II CIRCUITO JUDICIAL DE SAN JOSÉ. ANEXO A. Goicoechea, a las dieciséis horas treinta minutos del ocho de abril del dos mil trece.- Diligencias de información posesoria, formuladas ante el Juzgado de lo Contencioso Administrativo y Civil de Hacienda, de la Junta de Educación Escuela Líder de Paso Tempisque, Carrillo Guanacaste, representada por su Presidenta con facultades de apoderada generalísima sin límite de suma, Nombre161096 , mayor, soltera, ama de casa, vecina de Dirección19438 , , cédula CED126610.- Intervienen como interesados, el Estado, en la persona de la Procuradora Adjunta Lydiana Rodríguez Paniagua, de calidades no indicadas y el Instituto de Desarrollo Agrario, en la persona de su apoderada general judicial Carmelina Vargas Hidalgo, quien es mayor, divorciada, abogada, vecina de Guachipelín de Guanacaste , cédula CED28225.-
RESULTANDO:
Redacta el Juez Fernández Argüello, y
CONSIDERANDO:
I).- Por la forma en que se resuelve este asunto, se omite pronunciamiento sobre los hechos probados que enumeró la señora Jueza de primera instancia.- II).- Manifiesta la señora Procuradora, que en el plano base de estas diligencias consta que el inmueble a titular colinda por el rumbo Sur con el acueducto rural de Paso Tempisque, circunstancia que también quedó de manifiesto de la prueba testimonial recibida en autos.- Indica, que el Instituto Costarricense de Acueductos y Alcantarillados, en oficio SUB-G-AID-UEN-AMB-2011-1736 del veintidós de setiembre del dos mil once, indicó que por colindar con el pozo de la ASADA, se debe evitar la construcción de tanques sépticos en dicha finca, a fin de evitar la contaminación potencial del acuífero que abastece al pozo; razón por la cual, solicitó en múltiples ocasiones a la señora Jueza, adjuntarle al Estado las manifestaciones que al respecto vertió el representante de esa Asociación, sin resultados positivos, lo que le causó indefensión.- Aduce, que lo único que se les remitió, fue una constancia que indica que "existe disponibilidad de agua potable para consumo humano que esta Asociación suministra", no así la del señor Nombre161100 , en que se fundó la juzgadora en su fallo.- Que el terreno a inscribir, abarca parte del área de protección contigua al pozo, que es de dominio público, conforme al artículo 31, inciso a), de la Ley de Aguas, que dispone que son demaniales las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio, situación que se regula en similares términos en la Ley de Tierras y Colonización -artículo 7 inciso c)- y la Ley General de Agua Potable -artículo 2-.
Por esas razones, al no haber certeza de que la ASADA rindiera un informe, respecto del área circundante del pozo que abarca el terreno a inscribir y en qué porcentaje la afecta, a través de estas diligencias no debe permitirse a la promovente inscribir el inmueble descrito en el plano G-937584-90 con un perímetro menor a los 200 metros de radio del pozo, por cuanto equivale a permitirle incorporar al mismo la franja faltante, que es de dominio público. Solicita que se anule la sentencia apelada y que en su lugar, se ordene la readecuación de los procedimientos, en los términos indicados.- III).- Es un hecho incontrovertido, pues así lo acepta la parte actora y consta en el mismo plano que sirve de base a la información posesoria, que el inmueble que se pretende titular colinda, en el lindero Sur, con el acueducto rural de Paso Tempisque, administrado por la Asociación Administradora del Acueducto Rural de esa localidad (ver plano de folio 7 y hecho primero del escrito inicial de estas diligencias, a folio 18).- En virtud de esa circunstancia, desde el momento mismo de su apersonamiento, la representante estatal solicitó que se pidiera informe al Instituto Costarricense de Acueductos y Alcantarillados, a fin de determinar si ese pozo surte de agua a la población o conviene reservarla para tal fin, pues de ser así -se indicó-, "deberá presentarse un nuevo plano excluyendo el manantial y los doscientos o trescientos metros contiguos a la misma, según la configuración del terreno" (folio 128).- La juzgadora de instancia, en atención a ese requerimiento, remitió oficio al referido Instituto (folios 130 y 131).
La ASADA, indicó que en el terreno a titular existe disponibilidad de agua para consumo humano (folio 135) y el Ing. Moisés Bermúdez García, Jefe del Departamento de Cuencas Hidrográficas del Instituto, en oficio NºSUB-G-AID-UEN-AMB-2011-1736, de 22 de setiembre de 2011, manifestó lo siguiente: "Se realizó consulta a la Dirección de Acueductos Rurales del A y A, y en nota SUB-G-GSD-UEN-AP-EBD-2011-2228, con fecha 13/07/2011, se indica que cerca de la propiedad está el pozo del acueducto de Paso Tempisque. Se sugiere comprobación de campo. En ese mismo sentido, le indicamos que, de forma oficiosa, se consultó al Departamento de Aguas del MINAET, y en nota DA-2036-2011,con fecha 26/05/2011, se indica que no existen concesiones registradas de aprovechamiento de aguas para uso poblacional en dicha propiedad. Adjunto. De acuerdo al análisis que hemos realizado en nuestro sistema de información, sobre los aprovechamientos de agua para abastecimiento a poblaciones, en la propiedad que se señala en el expediente Nº08-0028-0163-CA no existe ningún aprovechamiento en la actualidad, ni forma parte de futuros planes para tal fin.
La propiedad colinda con el pozo de la ASADA de Paso Tempisque. De acuerdo con nuestro criterio, esta propiedad presenta una baja fragilidad hídrica. No obstante lo anterior, deberá evitarse la construcción de tanques sépticos en la propiedad a fin de evitar la contaminación potencial del acuífero que abastece el pozo. Por lo tanto, recomendamos, al amparo de la legislación ambiental vigente, se hagan respetar y proteger rigurosamente las aguas y sus zonas de recarga y protección (Art. 33 Ley Forestal y Arts. 31 y 32 Ley de Aguas). En el caso de que se considere necesario profundizar en algún aspecto técnico relacionado con la protección de estos importantes territorios, y oportuno realizar una inspección a los lugares en estudio, estamos en la mayor disposición de colaborar" (folios 168 y 169, 180 y 181). La juzgadora de instancia, en auto de las once horas y cuatro minutos del seis de junio del dos mil doce, tuvo por aportada esa documentación y continuó el trámite del asunto, sin ninguna observación al respecto (folio 183); por lo que, en escrito del doce de octubre de ese mismo año, la señora Procuradora solicitó comunicar a la Asociación administradora del acueducto lo actuado, para determinar si existía algún traslape de planos, dado que se estaba ante aguas del dominio público (folios 205 y 206), posteriormente, en memorial del diecisiete de enero del dos mil trece, indicó que era necesario verificar la situación del lote, a fin de determinar el área de protección del terreno, conforme al artículo 31 de la Ley de Aguas y excluirla del área inscribible, por tratarse de dominio público (folios 214 a 216), no obstante, ninguna de esas dos peticiones fue atendida en primera instancia.- III).- El Tribunal advierte, luego del anterior recuento, que tal y como se alega, la sentencia apelada se dictó en forma prematura, pues aún se encuentran sin diligenciar trámites esenciales, sin cuya sustanciación no es posible emitir un pronunciamiento válido en este asunto.
El lote que se pretende inscribir, colinda por el lindero Sur con el pozo del acueducto rural de Paso Tempisque y a la fecha no se ha determinado, en esta sede, si esa circunstancia da o no lugar al establecimiento de un área de protección del pozo y, por ende, a la eventual exclusión de alguna parte de los terrenos que interesan a la Junta accionante.- La representante estatal, ha insistido en forma vehemente y reiterada, en la necesidad de hacer esa comprobación, en defensa del recurso hídrico y el Instituto Costarricense de Acueductos y Alcantarillados, a través del Departamento de Cuencas Hidrográficas, estableció la necesidad de realizar una inspección de campo, poniendo incluso a disposición del Despacho, sus recursos técnicos y personales en aras de no afectar los intereses públicos involucrados.- El Despacho a quo, empero, hizo caso omiso de esas peticiones y trasladó el asunto al Juez decisor, que dictó la sentencia, sin hacer ninguna referencia a este tema concreto.- Con ello, se desconoció lo dispuesto en el artículo 31 de la Ley de Aguas, que establece para estos casos la obligación del juzgador, de tomar las previsiones necesarias para proteger el recurso hídrico, nada de lo cual ocurrió en este caso.- Esa omisión afecta, a no dudarlo, la validez del fallo, el que debe anularse, con la finalidad de que se readecuen los procedimientos y se determine si existe un área de protección del sitio de captación o pozo del acueducto rural de Paso Tempisque, en cuyo caso, habrán de tomarse las medidas que correspondan, como paso previo a la decisión final de estas diligencias.- Remítase este expediente al Juzgado de primera instancia, para que sin dilación, continúe con el trámite de rigor.-
POR TANTO:
