It was initially also brought against INSTITUTO COSTARRICENSE DE TURISMO and MUNICIPALIDAD DE NICOYA.

BACKGROUND (RESULTANDO)

  1. 1The plaintiff brings this proceeding, stating that his ultimate claim is solely against the State and the Sistema Nacional de Áreas de Conservación Tempisque—hereinafter SINAC—setting forth his claims in the initial complaint and modifying them at the oral and public trial, such that they were established as follows: 1- That it be declared that, in Dirección17264 between meridians 367.5 and 368 and between parallels 206.5 and 207, the land located at Dirección17265, which forms part of the maritime-terrestrial zone (zona marítimo terrestre), belongs to the State’s natural heritage (Patrimonio natural del Estado) and must therefore be administered by MINAET through SINAC. For this purpose, that the Procuraduría General de la República, through the Notaria del Estado, be ordered to prepare a deed so that the land at issue in this proceeding may be registered in the Real Property Registry in favor of the State, all in accordance with Article 13 of the Ley Forestal. 2- That the failure by the Área de Conservación Tempisque of MINAET to exercise its supervisory and administrative-protection powers (potestades de fiscalización y tutela administrativa) be declared contrary to the legal system; 3- That the Área de Conservación Tempisque of MINAET be ordered to exercise its supervisory and protective powers efficiently and effectively in the area belonging to the State’s natural heritage in the Nombre41685 area, Cangrejal Buena Vista sector of the Province of Guanacaste, particularly in the area lying between meridians 367.5 and 368 and parallels 206.5 and 207, opposite boundary markers five through nineteen of the public zone (zona pública); all for the purpose of preventing the continued, repeated encroachments constituting the irrational, illegal, and unsustainable exploitation of the primary forest (bosque primario) that forms part of the State’s natural heritage.Accordingly, SINAC is to be ordered to demarcate the property at issue in this proceeding and post signs identifying it as State property; likewise, should trespassers be found in the public-domain area (zona demanial), the administrative or judicial proceedings aimed at evicting them from the State’s natural heritage are to be initiated within a maximum period of eight business days after the judgment in this proceeding becomes final and has the force of res judicata (cosa juzgada material); 4- That the Área de Conservación Tempisque of MINAET be ordered to fulfill an affirmative obligation (obligación de hacer) consisting of the adoption of uniform public policies aimed at planning, directing, unifying, and overseeing processes intended to achieve sustainability through the restoration, recovery, and rehabilitation of the ecosystems, species, and environmental services (servicios ambientales) harmed by the reckless conduct of private parties, facilitated by the failure of the Área de Conservación Tempisque to act in the area at issue in this proceeding, which forms part of the State’s national heritage; for this purpose, that the creation of the Consejo Regional Ambiental be ordered for the analysis, discussion, reporting, and oversight of environmental activities, programs, and projects, all in accordance with Article six of the Ley Orgánica del Ambiente. 5- That the defendants be ordered, with the amount to be determined subsequently (en abstracto), to pay damages and losses (daños y perjuicios) pursuant to Article 122.m.ii of the CPCA, and, in view of the Administration’s manifest material inability to take appropriate action to protect the environment of the environmentally fragile area declared to be part of the State’s natural heritage located in Cangrejal de Playa Nombre41685, that the Administration be ordered to enter into an agreement or contract with a public or private higher-education institution, company, or national or international scientific institution, to which the compensation amounts are to be transferred so that actions aimed at restoring, recovering, and rehabilitating the damaged elements of biodiversity may be carried out efficiently, pursuant to Article 54 of the Ley de Biodiversidad. 6- In the event that the co-defendants oppose the claims, that they be ordered to pay both categories of litigation costs (ambas costas) in this proceeding and the corresponding interest.
  2. 2In response to the initial claims, the State’s representative raised the defense of lack of legal entitlement (falta de derecho), and, with respect to the modified claims, added the defenses of lack of standing (falta de legitimación activa), lack of legal entitlement, and lack of a present interest (falta de interés actual) in relation to the modifications made by the plaintiff at the oral and public hearing.
  3. 3In response to the complaint and the modified claims, SINAC’s representative raised the defenses of failure to join all necessary defendants (litis consorcio pasiva necesaria incompleta), which was resolved by interlocutory ruling, lack of interest (Falta de Interés), and lack of legal entitlement (Falta de derecho).
  4. 4By a ruling issued at fourteen hours thirty-seven minutes on seventeen May two thousand ten, it was proposed that this matter be declared subject to expedited or urgent processing (see folio 88).
  5. 5The corresponding case file was referred to the Sixth Section, which, by a ruling issued at ten hours on twenty-five May two thousand ten, accepted that form of processing and began the procedural examination of the matter as an “expedited proceeding.” (folio 89)
  6. 6During the processing of this proceeding, by a ruling issued at fifteen hours ten minutes on eight July two thousand ten, the following interim measures (medidas cautelares) were ordered: 1) SINAC-ACT is ordered to adopt the appropriate and necessary measures to ensure the protection of biodiversity in the area at issue in this proceeding, including overseeing compliance so that any person present on the property refrains from cutting trees, roots, branches, or low vegetation; burning the understory (sotobosque); opening trails or roads; clearing vegetation; polluting; removing or disturbing forested areas; introducing animals into that area; planting non-native species or species foreign to the area’s native flora; or carrying out any type of construction. 2) SINAC-ACT (SINAC) is ordered to report every two weeks, beginning upon service of this ruling, to both the enforcement judge of the Court and this Section regarding compliance with the interim protection ordered, and to submit a biweekly report to the Court. That ruling was not challenged by the parties. (Folio 198 and the record).
  7. 7The oral and public trial in this proceeding commenced on fourteen January two thousand thirteen and was adjourned for continuation on twenty-nine January two thousand thirteen; that hearing was held on the land for which protection is sought, where the Court conducted a site inspection and the presentation of the expert report ordered in the record began. After that hearing was adjourned, the oral and public trial continued on fourteen February of the current year, and, upon its conclusion, this matter was declared a complex proceeding (trámite complejo) pursuant to Article 111 of the Código Procesal Contencioso Administrativo.
  8. 8During the oral and public trial, INSTITUTO COSTARRICENSE DE TURISMO and MUNICIPALIDAD DE NICOYA, which had been defendants until then, were deemed no longer parties to the proceeding because the modified claims did not affect them, and their participation in the proceeding was terminated at that time.
  9. 9No preliminary defenses (defensas previas) remained pending resolution.
  10. 10No errors or procedural omissions giving rise to nullity are identified in this matter, and this judgment is issued within the statutory period.

Judge Solano Ramírez authors the judgment, with the unanimous vote of Judges Garita Navarro and Hess Araya.

CONSIDERING (CONSIDERANDO):

I. REGARDING THE EVIDENCE OFFERED TO ASSIST THE COURT IN REACHING ITS DECISION (PRUEBA PARA MEJOR RESOLVER)

At the hearing, the plaintiff submitted as evidence to assist the Court in reaching its decision certain photographs and documentary evidence consisting of report DFOE-SAF-IF-01-2013 dated 28 January 2013, offering them as evidence of the current conditions on the property. This evidence must be rejected. On the one hand, with respect to the offer of the photographs, the Court notes that the proponent provided no justification regarding their relevance and usefulness to the substantive analysis required in this judicial proceeding. Those images depict areas adjacent to the area for which protection is sought, as may be inferred from an analysis of the expert evidence submitted to the record, which will be discussed below. An understanding of that technical evidence establishes that the photographs submitted do not depict current conditions in the area lying between meridians 367.5 and 368 and parallels 206.5 and 207.

This is because the expert report states that the container discovered during the corresponding visit is located in an area different from the property itself. Although it is an area adjacent to that sector, it ultimately does not show conditions occurring within the property at issue, and the photographs are therefore immaterial to the examination of the various claims and issues raised in this dispute. As to the report of the Contraloría General de la República that was submitted, that document generally describes the nationwide financial circumstances of the conservation areas, without any particular emphasis or focus that could establish a direct bearing of the circumstances described therein on the implications of the matter under dispute. Strictly speaking, the content of that document neither establishes nor proves the existence of the alleged failures to act, nor the existence of the asserted harm to the strip of land for which protection is sought.

It is therefore immaterial, and its admission is deemed improper. From that perspective, in light of the provisions of Article 110 of the CPCA, in relation to Article 331 of the Código Procesal Civil (applicable by virtue of the general reference in Article 220 of the CPCA), the evidence offered to assist the Court in reaching its decision is rejected.

II. PROVEN FACTS (HECHOS PROBADOS)

The following facts are deemed proven and relevant to the resolution of this proceeding: a- In playa Nombre41685, Cangrejal sector, between meridians 367.5 and 368 and parallels 206.5 and 207, there is land designated as a State natural reserve (reserva natural del Estado) (see expert report (peritaje) at pages 894 to 930 and 1045 et seq.); b- The land located between meridians 367.5 and 368 and parallels 206.5 and 207 in Playa Nombre41685 adjoins properties 5-50113, survey plan (plano) G498365-83, 69902-000, survey plan G433081-81, and property 36219-000, survey plan G-41510-92 (see expert report at page 897); c- This land constitutes an environmentally fragile area (zona ambientalmente frágil) because it is within the Maritime-Terrestrial Zone (Zona Marítimo terrestre) and contains primary forest (bosque primario) (clarification of the expert opinion during the oral and public trial at ten hours twenty-eight minutes, pages 238 to 240 of the case file); d- Because this area is part of the State Natural Heritage (patrimonio natural del Estado), its conservation and administration were entrusted to the Ministry of Environment (hereinafter MINAET) through SINAC (see page 126); e- Área de Conservación Tempisque is responsible for the verification, oversight, and boundary demarcation (deslinde) of the area at issue (same citation); f- In the area between meridians 367.5 and 368 and parallels 206.5 and 207, clear-cutting (tala rasa) of the forest, exploitation of flora and fauna, and extraction of products have occurred without legal authorization (see judicial inspection (reconocimiento) and addendum to the expert report at page 1044); g- SINAC was notified of the acts of illegal logging and exploitation of flora and fauna in the area at issue (see pages 138, 144, 154, 277 of the principal case file); h- In March and April of 2010, third parties made incursions into the area between meridians 367.5 and 368 and parallels 206.5 and 207, involving the entry of heavy machinery (see judicial inspection conducted in May of 2010 and the judicial inspection conducted for that purpose during the current year); i- Work was performed in the area between meridians 367.5 and 368 and parallels 206.5 and 207 that delineated an access track (trocha de acceso) and several terraces, where areas were burned and forest areas were destroyed (see the cited expert report and the oral expert testimony at ten hours twenty-eight minutes); j- During the term of the precautionary measures (medidas cautelares) granted in these proceedings, it was discovered that the aforementioned area had been subjected to brush clearing (chapia), tree cutting, and vegetation burning (pages 453, 517, 669, 675, 693, 732, 843, 847, and judicial inspection conducted during the current year); k- The area between meridians 367.5 and 368 and parallels 206.5 and 207 has lost its status as forest and has been transformed into an area of forest cover (cobertura boscosa) (see expert report at page 913 and hearing recording at ten hours thirty-eight minutes); l- The track area identified as the starting point in the judicial inspection is not located within the area between meridians 367.5 and 368 and parallels 206.5 and 207 (see expert addendum regarding point 793); m- The expert evidence states that “the area located between meridians 367.5 and 368 and parallels 206.5 and 207 has been subject to anthropogenic (human) intervention (intervención antropogénica (humana)) that has remained constant over time, due to the presence of species such as pipa (...), banano cuadrado (...), marañón (...), and Teca (...), of different ages; likewise, the presence of creeping plants (vines), as well as grasses and shrubs ecologically classified as total heliophytic species (especies heliófitas totales)—species with a very high demand for light, highly aggressive growth, and highly opportunistic behavior in invading clearings (openings in the forest)—is considered an indicator that the site has undergone alterations” (page 908 of the expert report and recording containing the supplemental testimony given during the oral and public trial); n- The cadastral survey (levantamiento catastral) of the entire canton of Nicoya, including Nombre41685, has been completed (page 1000 of the court case file); o- SINAC officials have filed complaints concerning the incursions into the area located between meridians 367.5 and 368 and parallels 206.5 and 207 (see pages 750, 769, 816, 818 of the principal case file); p- In the area located between meridians 367.5 and 368 and parallels 206.5 and 207, the clear-cutting of the forest, exploitation of flora and fauna, and extraction of products are carried out for the purpose of effecting a land-use change (cambio de uso del suelo) (listen to the recording of the judicial inspection during the oral and public trial); q- The Plan Nacional de Desarrollo Forestal de Costa Rica 2011-2020 was issued by MINAET in August of the year Placa7398 (see documentary evidence in electronic format submitted by the State); r- SINAC issued and publicized the Políticas para las Áreas Silvestres Protegidas (see same citation).

III- UNPROVEN FACTS (HECHOS NO PROBADOS). The following facts are deemed unproven and relevant: a- That no enabling concession or use permit (concesión o permiso de uso habilitante) granted by any entity exists that allows the use, enjoyment, and occupancy of the area located between meridians 367.5 and 368 and parallels 206.5 and 207 (no evidence clearly establishing this matter was submitted); b- That the clear-cutting of the forest, exploitation of flora and fauna, and extraction of products in the area located between meridians 367.5 and 368 and parallels 206.5 and 207 are carried out with legal authorization (there is no evidence thereof); c- That the Consejo Regional del Área de Conservación Tempisque has been established and is operating (no documentary evidence whatsoever was submitted in this regard).

IV. CLAIMANT’S ARGUMENTS (ALEGATOS DE LA ACCIONANTE)

The claimant states her claims for relief (pretensiones), relying on the circumstances that she describes as justification for her action. She alleges that in the Sámara area, specifically within the strip located between meridians 367.5 and 368 and parallels 206.5 and 207, a series of actions have been undertaken by third parties seeking to alter and destroy an area that, in her view, constitutes the State Natural Heritage because it contains forest; she states that the responsible entities have allowed the illegal exploitation of the natural resources in that geographical area, resulting in changes to its flora and fauna, the extraction of products, and a change in land use; although those incursions were reported to the administrative authorities—as she indicates—institutional activity has been “entirely fruitless”; she states that the failure to exercise the oversight powers (potestades de fiscalización) granted by law to SINAC constitutes a manifest illegality and that this inaction is an omission contrary to the legal system (ordenamiento jurídico), which must be remedied through an order requiring performance of the conduct mandated by the legal system.

V. THE STATE’S ARGUMENTS (ALEGATOS DEL ESTADO)

With respect to the initial claims, counsel for the State opposes the action and asserts failure to state a legal right (falta de derecho). With respect to the specification and amendment of the claims during the oral and public hearing, counsel also raises the defenses of lack of standing (falta de legitimación activa), failure to state a legal right as to the amended claims, and lack of a current legal interest (falta de interés actual), stating that there was no expansion of the factual allegations that would justify the amendment in the manner undertaken by the claimant. Counsel states that a specific procedure has been established for registering land such as that at issue and that work is underway on that process, as shown by the cadastral survey of the canton of Nicoya submitted as evidence for that purpose by the señora Procuradora when responding to the aforementioned amendment; counsel considers that there is no need to prepare any deed, that boundary markers (mojones) 5 through 19, included as reference points in the disputed sector, are unrelated to the area owned by the State, and that there is no need to demarcate the property cadastrally because, under the cartographic demarcation used pursuant to Article Ii) of the Manual de Clasificación de Tierras dedicadas a la Conservación de Recursos Naturales en zona marítimo terrestre, such action is improper.

Counsel states that, in matters concerning the State Natural Heritage, Article 1 of the Ley Forestal prevails over the Ley Orgánica del Ambiente, and therefore the request relating to the application of the Ley General del Ambiente should not be granted; furthermore, other instruments are already in place, such as the Plan Nacional de Desarrollo Forestal 2011-2020, which includes the interinstitutional strategic plan for the protection, management, and governance of forests and forestlands within the State Natural Heritage, and a Consejo Regional de Área exists in Área de Conservación Tempisque pursuant to Article 30 of the Ley de Biodiversidad. Regarding the payment to entities not party to the proceeding of compensation for damages (indemnización de daños y perjuicios), counsel argues that the request is improper, stating that case law (Jurisprudencia) has repeatedly held that any amount awarded under that heading must be paid to the State; therefore, because SINAC is legally responsible for implementing the policies relating to those areas, an amount payable would be awarded in its favor, which counsel does not consider legally permissible.

VI. SINAC’S ARGUMENTS (ALEGATOS DEL SINAC)

In response to the complaint and the amendment of the claims, counsel for SINAC raised the defenses of failure to join all necessary defendants (litis consorcio pasiva necesaria incompleta), which was resolved by interlocutory ruling, lack of legal interest (Falta de Interés), and failure to state a legal right (Falta de derecho). In support thereof, counsel states that the duty of oversight and protection has been fulfilled in a timely, responsible, and serious manner; that the area delineated between boundary markers five through nineteen is located in an area different from the one identified by the claimant as the disputed area, as shown by the plans submitted and contained in the record; and that the area that does in fact belong to the State Natural Heritage is being continuously monitored and inspected by personnel from SINAC, with that work resulting in the corresponding criminal authorities being notified of the unlawful removal of natural resources. Counsel states that the reports generated pursuant to the precautionary measure have disclosed what was discovered during each follow-up inspection conducted in the area as a result of that precautionary measure.

VII- MERITS AND DEFENSES The plaintiff seeks a declaration in his favor of a series of claims related to the exercise by the defendants of protection over a sector of Nombre41685 beach where the strip of land, identified as being located between meridians 367.5 and 368 and between parallels 206.5 and 207, is part of the maritime-terrestrial zone and corresponds to the Natural Heritage of the State. Under the plaintiff’s view, in order to assess the claims, it must first be clearly defined, in accordance with the legal system, what constitutes the Natural Heritage of the State and the Maritime-Terrestrial Zone; for such determination, this Chamber adopts the criteria issued in repeated case law on the matter: It is therefore stated that “(…) Pursuant to section 13 of the Ley Forestal, ‘The natural heritage of the State shall consist of the forests and forestlands of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other bodies of the Public Administration, except for real property securing credit transactions with the National Banking System that becomes part of their assets…’ Thus, the provision offers three possibilities regarding the property comprising such heritage: a) forests and forestlands of national reserves; b) forests and forestlands of areas declared inalienable; and c) forests and forestlands of properties registered in its name and those belonging to municipalities, autonomous institutions, and other bodies of the Public Administration.” (See RES: 000853-F-S1-2011 of the FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE, issued at ten fifteen on veintiuno de julio de dos mil once.).

Regarding the Maritime-Terrestrial Zone, it must be noted: “(...) that strip of land is governed by Ley No. 6043 of 2 de marzo de 1977, published in Supplement No. 36 to La Gaceta No. 52 of 16 de marzo de 1977, entitled ‘Ley sobre la Zona Marítimo Terrestre.’ That body of law establishes a series of powers for various administrative units in order to set guidelines for the effective administration, control, inspection, and oversight of that public-domain zone. In this regard, section one of the cited legislation clearly establishes the public-domain status of such lands by providing: ‘The maritime-terrestrial zone forms part of the national heritage, belongs to the State, and is inalienable and not subject to acquisitive prescription. Its protection, as well as that of its natural resources, is an obligation of the State, its institutions, and all inhabitants of the country. Its use and exploitation are subject to the provisions of this law.’” (See ruling 24-2013-VI of the ADMINISTRATIVE LITIGATION COURT, SIXTH SECTION, at 16 hours 15 minutes on 07 de febrero del 2013.) “The maritime-terrestrial zone is divided into two zones: the public zone, which comprises the strip fifty meters wide, measured from the ordinary high-tide line, consisting of the shoreline, seashore, or coast extending through permanent tidal inlets and estuaries to the point where they are appreciably affected by the tides and display defined marine characteristics (section 2(h) of the Reglamento a la Ley de la Zona Marítimo Terrestre, Decreto Ejecutivo number 7841-P); and the restricted zone, consisting of the remaining one hundred fifty meters.

By virtue of the foregoing, the following form part of the public portion of the maritime-terrestrial zone: a tidal inlet, defined as the portion of a river near its entry into the sea and extending as far as the tides reach (subsection f) of section 2 of the cited Decreto Ejecutivo number 7841-P); therefore, in relation to the provisions of section 9 of the Law governing this matter, the two-hundred-meter strip adjoining tidal inlets is also part of the maritime-terrestrial zone; ‘islets, rocks, and other small areas and natural formations protruding from the sea’ (final paragraph of section 10 of the Ley de la Zona Marítimo Terrestre); (...) with respect to the natural resources contained in the public zone, it is further noted that flora and fauna may not be exploited, trees cut, or products extracted from the coast without proper authorization—a permit or concession—in this case from the Wildlife Directorate of the Ministry of Environment and Energy, following an environmental impact study, pursuant to section 17 of the Ley Orgánica del Ambiente.

(...) This oversight function also encompasses the eviction of trespassers and even the destruction or demolition of structures, facilities, or works constructed, whether merely fences, shacks, sales stands, or dwellings, without any liability whatsoever (as held by the Administrative Litigation Court, Third Section, in resolution number 7900-98). Pursuant to section 39 of the Ley de la Zona Marítimo Terrestre, concessions may be granted only within the restricted portion of the maritime-terrestrial zone, under the authority of the municipalities (section 40 of the cited Law); except where a protected wilderness area exists—forest reserves, protective zones, national parks, biological reserves, national wildlife refuges, wetlands, or natural monuments—which, pursuant to sections 32 of the Ley Orgánica del Ambiente and 73 of the Ley de la Zona Marítimo Terrestre, are under the administration of the Ministry” (ruling 54-2012 issued on 17 de febrero del 2012 by the Third Section of the Administrative Litigation Court).

In light of these judicial assessments of the legislation in force, the plaintiff’s position must be analyzed. Mr. Nombre142575 states that within the maritime-terrestrial zone of the Sámara sector there is a strip of land located precisely between meridians 367.5 and 368 and between parallels 206.5 and 207, designated as Natural Heritage of the State. In accordance with the foregoing, following expert assessment of the information provided by the plaintiff in his complaint and by the defendants in their answers, the existence of such a strip of land must be deemed established. The evidence submitted and the inspections conducted establish with certainty that, geographically, this strip of land does belong to the maritime-terrestrial zone. The plaintiff now seeks recognition in these proceedings that this strip of land, allegedly comprising a forested area, has been affected by incursions by third parties for the purpose of removing elements of the area’s biodiversity, thereby causing a harmful alteration of the area.

He seeks a series of protective remedies for that zone, expressly defining his request so that the protection sought may be applied to that protected area and the total loss of that ecosystem avoided. In response to such requests, it is appropriate to analyze each of them in light of the legal system, which has enacted express provisions concerning the environment, forest protection, and biodiversity, and which provide legal protection or coverage for State property located within the maritime-terrestrial zone that forms part of a forested area and the Natural Heritage of the State. The analysis will therefore proceed as set forth in the following sections.

VIII.Regarding the request for a declaration that, at Dirección17264 between meridians 367.5 and 368 and between parallels 206.5 and 207, the land located at Dirección17265 forms part of the maritime-terrestrial zone and corresponds to the Natural Heritage of the State. The maritime-terrestrial zone and the lands classified as Natural Heritage of the State having been defined by law, the area described by the plaintiff in his complaint as the physical area to be protected through this action does, according to the evidence gathered, meet the requirements for both legal classifications. Indeed, this fact has been acknowledged by the defendants through the documentary evidence submitted in response to the plaintiff’s amendment of his claims. The expert evidence and the inspections conducted by this Court itself clearly establish that the strip of land at issue belongs to the maritime-terrestrial zone.

It is equally clear to this Chamber that this land is an area qualifying as Natural Heritage of the State. This is because, following a substantive review of the record, it has been established that the land possesses two particular attributes that determine that status. First, its stated status has been administratively declared (see the State’s response to the amendment of claims); second, the site has forest cover, an attribute supporting its classification as natural heritage. Because this land possesses both attributes, it enjoys the special State protection granted by section 4 of Decreto 36786-MINAET of 12/08/2011, entitled Manual para la Clasificación de Tierras Dedicadas a la Conservación de los Recursos Naturales dentro de la Zona Marítimo Terrestre en Costa Rica, which provides: “(...) the Natural Heritage of the State is in the public domain; its conservation and administration are entrusted by law to the Ministry of Environment, Energy and Telecommunications through the National System of Conservation Areas.

The Heritage consists of two major components: a) Protected Wilderness Areas, regardless of their management category, declared by Law or Executive Decree: forest reserves, protective zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments. b) Other State and public-institution forests, forestlands, or lands suitable for forestry (section 13 of the Ley Forestal), which are subject to an immediate statutory designation. With respect to the Maritime-Terrestrial Zone, the Ley de Zona Marítimo Terrestre, Ley Nº 6043, in its section 73 excludes Protected Wilderness Areas from its scope and subjects them to their own legislation. The remaining coastal forested areas and lands suitable for forestry are also under the administration of the Ministry of Environment, Energy and Telecommunications and are governed by their specific regulations, section 13 of Ley Forestal Nº 7575 and related provisions, and Constitutional Chamber Ruling 4587-97.” (See cited legislation.) Given this legal status of the Natural Heritage of the State, both MINAET and SINAC are consequently responsible for overseeing and protecting the activities carried out on the land whose protection is sought in these judicial proceedings.

Throughout these proceedings, the statements made by SINAC officials, both in the answer to the complaint and in the reports submitted while the interim relief granted in the record remained in effect, support the conclusion that the agency was uncertain as to whether this strip of land belonged to the Natural Heritage of the State zone. However, through the documentary evidence submitted by the State itself and the assessments made in the expert report filed in the record, the true status of the property in question can be clarified. The territorial area located in Sámara, between meridians 367.5 and 368 and parallels 206.5 and 207, does belong to the area constituting the Natural Heritage of the State, and it is appropriate to declare it as such in these proceedings, as requested.

IX.Regarding the request for a determination that the tract of land located between meridians 367.5 and 368 and between parallels 206.5 and 207 must be administered by MINAET through SINAC. The legal system establishes the allocation of powers among State bodies, granting specific powers to MINAET and SINAC. Regarding powers related to assets comprising the State Natural Heritage (Patrimonio Natural del Estado) and the Maritime-Terrestrial Zone (Zona marítimo terrestre), the provisions set forth in the Manual for the Registration of this type of property have already been transcribed; this allocation of powers is further supplemented by Article 8 of the Ley Orgánica del Ambiente and Article 9 of the Ley de Biodiversidad, pursuant to which the Sistema Nacional de Áreas de Conservación, as a separate legal entity, is responsible for implementing processes aimed at achieving sustainability in the management of Costa Rica’s natural resources and for exercising such administration.

(See Article 22 of the cited law.) In light of those mandates, SINAC has a legal obligation to carry out the activities for which that body was created whenever such activities arise from or affect conditions on the land located in Sámara, between meridians 367.5 and 368 and between parallels 206.5 and 207. Notwithstanding that mandate, the record has shown that there is no institutional clarity regarding its authority over that tract of land, as officials of both defendants stated. Given the defendants’ uncertainty to date as to whether or not the tract of land falls within the area subject to their powers, the requested declaration may be granted so as to ensure effective fulfillment of the protective purposes served by the designation of the property described by the plaintiff as State Natural Heritage. From that perspective, it is therefore appropriate to establish that, pursuant to the powers granted by the Ley de Biodiversidad, SINAC is the competent administrative authority to administer that tract of land, this being a power-duty (poder-deber) that must be undertaken and exercised by that public entity in order to satisfy the public interests inherent and essential to the framework of powers conferred upon it; it being clear that such powers may not be postponed, declined, extinguished by prescription, or transferred (doctrine of Sections 4, 11, 12, 59 and 66, all of the Ley General de la Administración Pública.)

X.Regarding the request that the Procuraduría General de la República, through the Notaria del Estado, be ordered to prepare a deed so that the land at issue in these proceedings may be registered with the Registro de Bienes Inmuebles in favor of the State, all in accordance with Article 13 of the Ley Forestal”: The requested declaration, in the form sought, is improper. Under the Manual para la Clasificación de Tierras Dedicadas a la Conservación de los Recursos Naturales dentro de la Zona Marítimo Terrestre en Costa Rica (Decreto 36786-MINAET of 12/08/2011, hereinafter the Manual), there is a general procedure that must be followed for lands protected under this classification. For the classification of units—tracts of land—and the granting of protected status (categoría protegida), the Manual states, insofar as relevant, that both a geographic information survey (levantamiento de información geográfica) and the “placement of boundary monuments (monumentación de mojones)” are required before the properties may be recorded in the registry.

Upon submission of a certification of the status of the property concerned, the property will be entered in the property register (matriculación); this follows from the evidence in the record and the particular characteristics of the tract of land at issue here. It is not appropriate to convey these tracts of land by deed because, once the prescribed procedure has been completed and the requirements set forth in its numbered provisions have been satisfied, the Manual provides for the registry registration (inscripción registral) of the lands as a direct consequence. This is because, under the specific terms of this special procedure, the property is recorded or registered in favor of the State after the aforementioned stages have been completed, without any need to execute a public deed (escritura pública). Accordingly, the required entry in the property register, which is the ultimate result sought by the moving party, is accomplished by completing the prescribed procedure, which, as explained, is currently underway; what is therefore required is to order its completion as soon as possible, given this Court’s determination that the land in question belongs to the State Natural Heritage.

In this regard, the response to the amended claims establishes as true that the information survey and placement of boundary monuments have already been completed, and it may therefore be stated that only the issuance of the certification remains pending; once issued, that certification must be submitted to the Registry—the Registro Nacional de Bienes Inmuebles—for the purpose of completing the registration described in the aforementioned Manual. Ergo, it is not necessary to formalize the matter through a State notary, as the plaintiff requests. Nevertheless, this Chamber considers it important to order completion of the procedure, which throughout these proceedings has repeatedly been stated to have already been completed, although no registration thereof is recorded to date. The expert evidence establishes that the Maritime-Terrestrial Zone in which the tract of land protected by this judicial claim is located has no registered survey plans (planos inscritos) that would make it possible to determine whether it has been definitively structured, even though the parties have agreed in the record that it does constitute State Natural Heritage.

Therefore, although the plaintiff requests notarization, the appropriate course is deemed to be, pursuant to the aforementioned Manual, to complete the procedure already commenced and issue the certification needed to establish certainty regarding the status of the property. Accordingly, given that the plaintiff requests the preparation of a deed for the purpose of registering the land at issue in these proceedings with the Registro de Bienes Inmuebles in favor of the State pursuant to Article 13 of the Ley Forestal, it is appropriate to order the Director de Área de Conservación to submit, within seven days, the certification required by the Manual de Clasificación de Tierras Dedicadas a la Conservación de Recursos Naturales en Zona Marítimo Terrestre for registration with the Registro Nacional of the existence and boundaries of the tract of land situated in the area of Nombre41685 between meridians 367.5 and 368 and between parallels 206.5 and 207, so that it may be duly registered, afforded the protection of the legislation in force through public notice in the registry (publicidad registral), and the area sought to be geographically located or defined as protected by this judicial action may be safeguarded. The corresponding official communications are hereby ordered to be transmitted for due compliance.

XI.- “That the failure by the Tempisque Conservation Area of MINAET to exercise its unexercised administrative oversight and protective powers be declared inconsistent with the legal system.” In ruling on this claim, it must be borne in mind that the legislation in force establishes that MINAET AND SINAC are responsible for carrying out actions for the protection, delimitation, and development of areas designated as forest, nature reserve, and other ecosystems; however, the legal texts do not specify how such actions are to be exercised, leaving their implementation to the general rules. To determine how the Administration must proceed in exercising these powers, it must be taken into account that, pursuant to the law, the Public Administration shall act subject to the legal system and may perform only those acts or provide only those public services authorized thereby, and that in so acting, the Administration shall be liable for all damage caused by its lawful or unlawful, normal or abnormal operation, except in cases of force majeure, fault of the victim, or the act of a third party.

(See Articles 11 and 196 of the General Law of Public Administration). In this particular case, it is alleged that SINAC officials, as has been established in the record, conducted inspections at the site to protect the area, but that despite those actions, natural resources have been extracted and destroyed. In view of these facts, which have been deemed established, this Chamber considers it prudent to find that the officials’ conduct was omissive, because their actions must be carried out in a manner that achieves the purpose sought by the Administration—namely, in this case, the protection of the area constituting State Natural Heritage. Such activity performed by the Administration must fulfill the purposes established by law, and consequently the relevant measures must be taken to attain those purposes. In this regard, the First Chamber has clearly stated: “It is now generally accepted that administrative conduct encompasses not only active conduct by the Administration (and, within it, administrative acts), but also omissive conduct—that ‘failure to act’ which has come to be known as administrative inactivity—in both its formal aspect (insofar as it results in a presumed act through administrative silence) and its material aspect (referring essentially to the service-provision sphere of the administrative organization).

Thus, material administrative inactivity must be understood as that arising from the failure to fulfill a pre-established legal obligation, which occurs when, outside an administrative proceeding, the Administration fails, through omission, to fulfill an obligation imposed by the Legal System or by any other self-binding mechanism, such as its own prior act or consensual instruments, directly harming a legitimate interest or a subjective right, whether or not it alters a pre-existing legal-administrative relationship. Put more simply, inactivity of this kind exists when, although a public entity or body is under an obligation to give or to act imposed by the legal system or by one of its prior decisions, outside or within an administrative proceeding, it fails to undertake the factual or legal activity required to bring the assigned function to a successful conclusion, to the detriment of the rights or interests of one or more affected parties, whether private or public, individual or collective.

This is the ‘culpa in ommittendo’ whereby the functional duty to act is breached through inaction. It goes without saying that administrative indolence may cause (and in fact does cause) more serious harm than the restrictive action of the public body or entity itself. It must therefore be stated unequivocally (on the basis of and in accordance with the foregoing recitals) that the Public Administration is also liable for the loss and damage caused by its administrative inactivity. For purposes of non-contractual civil liability, such passivity in fulfilling pre-existing obligations constitutes abnormal operation by the Administration (insofar as it relates to required material activity) and unlawful conduct, which in this case may coexist, to the extent that failure to perform what is required not only violates the rules of sound administration, but also infringes legality, inasmuch as it fails to exercise the functional administrative powers arising from the Legal System itself.” (Voto 584-F-2005 of the FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE, issued at ten forty a.m. on the eleventh day of August of the year two thousand five.) In the case at hand, monitoring activity was undertaken; however, the expert report, the judicial inspection, and SINAC’s own reports clearly show that the actions taken were insufficient to provide the required protection of the aforementioned heritage, given the evidence of intrusive activities on the land at issue.

The Administration’s operations in addressing the particular needs of the area have not eliminated the problem, and the record contains no evidence that any steps were taken to seek other forms of protection or other measures that would prevent access by third parties making improper use of the area. The reports submitted in the record show that the officials of the Tempisque Area, assigned by the Executive Director of SINAC (see Article 26 of the Biodiversity Law, No. 7788, hereinafter Ley 7788), in exercising their duties, limited themselves to monitoring, which was occasional rather than permanent. Far from preventing the destruction and deterioration of the area, this, in the opinion of this adjudicative body, enabled the conduct of third parties in the area, in breach of the duty of protection that the law assigns to the defendant institution—SINAC. Some of the reports even state that the third parties offered explanations concerning the verified facts and asserted that they were outside the area covered by the precautionary measure.

This adjudicative body finds it incomprehensible that, if the report was prepared in order to comply with the judicial protection order and the inspection was conducted within the area geographically defined by that judicial order, no immediate action was taken with respect to those third parties. On account of those actions, the plaintiff seeks a declaration that the conduct of the Tempisque Conservation Area of MINAET is inconsistent with the legal system. Given that the body known as the “Conservation Area” is responsible for applying the legislation in force, and that its Director, pursuant to Article 31 of Ley 7788, is responsible for applying it, implementing national policies, and carrying out the directives of the Regional Council of its Conservation Area or those of the Minister of Environment and Energy, it follows that the conduct of the Administration challenged as inconsistent with the legal system—which, pursuant to the Law, is attributable to SINAC as the competent body—must be declared inconsistent with the legal system, with such declaration applying by operation of law to SINAC and not specifically to MINAET, given the characteristics of the body that performs the oversight activity.

XII.That the Tempisque Conservation Area of MINAET Tempisque Conservation Area of SINAC [sic] be ordered to exercise its oversight and protective powers efficiently and effectively in the area constituting State Natural Heritage in the Nombre41685 area, Cangrejal Buena Vista sector of the province of Guanacaste, particularly the area located between meridians 367.5 and 368 and parallels 206.5 and 207, opposite boundary markers five through nineteen of the public zone, all for the purpose of preventing the continued, repeated incursions constituting irrational, illegal, and unsustainable exploitation of the primary forest that forms part of the State Natural Heritage. This judgment has explained that the Administration is required to remedy the adverse effects of its actions or omissions arising from normal and abnormal operation. In the case before us, this Chamber has found SINAC’s activity to have been abnormal because it was not carried out through the proper performance of its duties conferred by Law.

Although SINAC is the body required to establish policies and to plan and implement processes aimed at achieving sustainability in the management of Costa Rica’s natural resources, as mandated by Article 22 of the Biodiversity Law, it has confined itself to occasional monitoring activities in the area, without implementing at the site in question any acts or processes aimed at ensuring the sustainability of that area’s natural resources. Accordingly, in light of the evidence in the record—which clearly establishes that the area has been subject to constant anthropogenic (human) intervention over time—and in addition to the reports in the record documenting incursions, that circumstance is established by expert evidence through the presence of species such as coconut palm (...), square banana (...), cashew (...) and teak (...), of different ages, creeping plants (vines), as well as grasses and shrubs ecologically classified as full-light heliophytic species, which have a high demand for light, are highly aggressive in their growth, and are highly opportunistic in invading clearings or areas where the forest has been removed, the requested relief may be granted.

The Executive Directorate of SINAC is therefore ordered to fulfill its duty to ensure that said body conducts proper oversight and takes appropriate action to prevent further incursions into the area concerned in this action and to rehabilitate it until its natural condition is restored. It is therefore appropriate to order the Executive Director of SINAC to effectively perform his or her duties pursuant to sections 4, 11, 12, 59, and 66 of the General Law of Public Administration and section 122(f) and (g) of the Contentious-Administrative Procedure Code.

XIII.That SINAC be ordered to demarcate the property at issue in this proceeding and post signs identifying it as State property. In view of the declaration that SINAC’s actions were inconsistent with the legal system, this Chamber considers the direct posting of signs in the requested area prudent and appropriate in order to protect the right to a healthy environment (as State Natural Heritage is involved); this is warranted as a means of fulfilling the defendant’s existing duties. Such signs must be posted around the perimeter of the State Natural Heritage area. Before this can be done, however, the previously ordered certification of State Natural Heritage status must be completed so that, based on the property’s cadastral description, signs may be posted around the perimeter of the area. To ensure that action is taken immediately, SINAC is granted a period of fifteen days from the date this judgment becomes final to post such signs.

XIV.That, if trespassers (invasores) are found in the public-domain zone (zona demanial), administrative or judicial proceedings aimed at evicting the trespassers from the Natural Heritage of the State (patrimonio natural del Estado) shall be initiated within no more than eight business days after the judgment in these proceedings becomes final with the effect of substantive res judicata (cosa juzgada material). With regard to the responsibilities of the officials charged with exercising administrative authority, the regulations in force have not specified the activities that the Administration must undertake in order to effectively exercise the protective authority granted to SINAC. The record shows that the officials designated by SINAC have filed complaints against persons who entered the strip of land at issue in these proceedings without authorization and damaged the property by extracting elements native to the area, in accordance with the ordinary procedure.

The persons in possession of objects removed from the area shall consequently be liable for the reported acts, and the duty to report such acts that has existed since the creation of SINAC remains in effect; this Court therefore considers that establishing a time limit for filing complaints is inconsistent with the inherent duties of the institution responsible for ensuring the immediate protection of the area, a duty that cannot be subject to time limits because its exercise must be “immediate” and urgent. The defendant Public Administrations should, however, be reminded of their duty to ensure that such complaints are actually filed and, for that purpose, that all information in the institution’s possession be provided so that immediate judicial action may be pursued against the third parties who, to date, have attacked the natural resources of this area.

XV.That the Tempisque Conservation Area of MINAET be ordered to fulfill an affirmative obligation (obligación de hacer) consisting of adopting uniform public policies aimed at planning, directing, unifying, and overseeing processes intended to achieve sustainability through the restoration, recovery, and rehabilitation of the ecosystems, species, and environmental services (servicios ambientales) that have been damaged by the reckless conduct of private parties, enabled by the omission of the Tempisque Conservation Area in the area at issue in these proceedings, which forms part of the Natural Heritage of the State. As explained above, compliance with national policies for the protection of the Maritime-Terrestrial Zone (zona Marítimo terrestre) and the Natural Heritage of the State is an institutional duty; accordingly, the officials of the Tempisque Conservation Area of MINAET have a duty to comply, and specifically ordering what is requested here would merely reiterate a duty already declared.

It is nevertheless important and necessary to emphasize that the existence of policies intended to enable the State to exercise its protective powers over the natural resources in the area affected by the facts under consideration has been clearly established by the corresponding documentary evidence. However, the implementation of those policies and of the protective law itself has not been demonstrated in the record, and the implementation described throughout these proceedings does not meet the needs of the area. Therefore, pursuant to Articles 131 of the General Law of Public Administration and 50 of the Political Constitution, and under the powers granted by Article 122(c) and (f) of the Contentious-Administrative Procedure Code, it is essential that, in view of this situation, the defendants proceed as ordered to activate procedures so that the implementation of those public policies is properly monitored.

Accordingly, the Executive Director of SINAC must be personally served so that, in the exercise of that office, the Director shall submit, under oath, the compliance reports concerning both the interim measures (medidas cautelares) and the enforcement of the orders contained in this judgment, for the purpose of determining the Director’s personal responsibility as a public official and institutional head for the omissions of the agency under the Director’s authority; the Director shall further be ordered to proceed in accordance with the regulations in force to ensure effective protection and restoration of the Natural Heritage of the State area that has been the subject of this dispute. Those reports shall be submitted to the enforcement division of this Court until compliance with the orders contained in this judgment regarding the effective restoration and rehabilitation of the area constituting the Natural Heritage of the State at issue in this case has been established by expert evidence.

XVI.That the Regional Environmental Council be created for the analysis, discussion, reporting, and oversight of environmental activities, programs, and projects, all in accordance with Article six of the Organic Law of the Environment.” With regard to the creation of the Regional Environmental Council, it must be borne in mind that the Regional Council of the Conservation Area already exists by operation of law (it was created by Article 29 of Ley 7788); likewise, a National Commission for Environmental Management legally exists, and the powers of both bodies encompass the activities that the plaintiff seeks to assign to the Regional Council whose creation is requested through this judgment. The claim in this respect must be dismissed because, pursuant to art 14 of Ley 7788, a body responsible for carrying out those actions already exists. This Chamber does, however, consider it necessary, in order to ensure proper compliance by the entities sued herein and in view of the absence of evidence concerning the composition of both aforementioned bodies, to order that, within FIFTEEN DAYS, documentation be submitted stating the names and terms of appointment of the members of both bodies, so that, if those bodies have been constituted (which has not been established in these proceedings), the identities of their members will be made available to the community; otherwise, representatives of the corresponding sectors comprising them shall be appointed within that period.

Likewise, to ensure the proper rehabilitation and recovery of the area protected through these proceedings, an official shall be assigned to conduct the relevant studies for its proper rehabilitation and recovery and shall not be assigned any other duties until that official submits the report, subject to appropriate follow-up by the institutional authorities. To that end, a copy of this judgment shall be sent to the oversight bodies responsible for ensuring compliance concerning the protection of State property—the Office of the Comptroller General of the Republic, the Ombudsman’s Office, and the other entities involved in environmental protection—so that they may provide the corresponding legally required follow-up regarding compliance with the duties established by law.

XVII.That the defendants be ordered to pay damages in an amount to be determined (condena en abstracto), pursuant to Article 122.m.ii of the CPCA. In view of the declaration that the Administration’s actions in this case were unlawful (disconformidad), and because the existence of practices and actions harmful to the environment in the sector at issue—such as tree felling, burning, and the introduction of non-native species—has been established, this Court finds that the public authorities operated abnormally, thereby constituting the legally adequate cause (causa adecuada) of those environmental harms, which, in this case, arose from the governmental inertia and indifference that allowed such damage to occur. Indeed, because inadequate oversight and protection by the Administration of the Natural Heritage of the State in the area at issue, as well as damage to the ecosystem located there, have been established, that inertia constitutes a causal link to the harmful conduct, thereby giving rise to causation (nexo causal) which, in accordance with the provisions of ordinal 190 of the General Law of Public Administration, entails the liability of the Public Administration, whose inactivity exacerbated the unlawful injury.

This Court considers that the duty to safeguard public-domain property (bienes demaniales) implicitly entails public liability for failure to discharge those duties, insofar as such failure constitutes a legally relevant cause of the damage. For the purpose of restoring the natural condition of State property, damages must be applied under special conditions; the case law has repeatedly so stated when ruling on this issue: “due to the specialized nature of the subject matter and the technical and professional resources available to the Ministry of Environment and Energy, that Ministry is, in the particular case and according to its specific features and characteristics, the appropriate entity to carry out that task. Likewise, based on the premise of effective enforcement of the constitutional judgment, a budgetary mechanism must be created that benefits and maximizes the principles of efficiency, effectiveness, promptness, and economy.

Accordingly, the amount ordered by the Contentious-Administrative Court, which held the Cooperative and the State jointly and severally liable, must be deposited in the State’s Single Treasury Account (numerals 66 of the Financial Administration of the Republic and Public Budgets Law and 83 and 84 of its Regulations), in a client account created specifically for that purpose, the account holder being the Ministry of Environment and Energy, which must allocate those funds exclusively to repair and restoration works for projects concerning the Siquiares River.(sic) Because it has been concluded that this payment constitutes public funds, the use of this financial instrument is appropriate in order to ensure responsible management of public finances; it will assist in effectively achieving environmental objectives and goals, for which the support of the governing body of the Financial Administration System is required.

Thus, it is reiterated that, to expedite receipt and administration of the award, it must be deposited in that separate account, identifying its source and the purpose to which it is allocated. For that reason, insofar as the State is concerned, the Ministry of Finance, to which this decision shall be communicated, must make the financial provisions under the corresponding budget heading. XVI.- (see Judgment of the First Chamber 675 at 10 hours on 21-9-2007) It is therefore established that the State has a duty to compensate for damage caused by the normal or abnormal acts of its officials; and because, in this case, the failure to properly exercise administrative functions for the protection of the area has been proven, as has the alteration of the natural condition of the property at issue, this claim shall be granted so that, during enforcement of the judgment, the damage caused may be assessed and the financial amount necessary for the restoration, recovery, and rehabilitation of the elements of biodiversity damaged within the tract of land located in Nombre41685, which has been the subject of this litigation, may be determined.

XVIII.In view of the Administration’s manifest material inability to take appropriate action to protect the environmentally fragile area declared to be part of the State’s natural heritage (patrimonio natural del Estado), located in Cangrejal de Playa Nombre41685, the Administration is requested to be ordered to enter into an agreement or contract with a public or private higher education institution, company, or national or international scientific institution, to which the amounts awarded as compensation (indemnización) would be transferred so that actions aimed at the restoration, recovery, and rehabilitation of the damaged elements of biodiversity may be carried out efficiently, pursuant to Article 54 of the Biodiversity Law. This claim must be denied. Awards imposed for environmental damage (daños al ambiente) constitute public funds, given that the sums awarded must necessarily be allocated to the regeneration of the damaged environment or, if regeneration is impossible, to financing environmental-protection measures.

From this perspective, to ensure that such sums are properly allocated to the stated purpose, they may be administered by various actors, among which the participation of local entities, nongovernmental organizations, and others could be considered. However, this Chamber agrees with the position established by the First Chamber of the Supreme Court of Justice in the aforementioned Judgment No. 675-2007, which provides that those funds must be administered by MINAET through their incorporation into the national budget under a specific budget line allocated to the environmental regeneration of the affected sector (Cangrejal de Sámara, within the physical area already identified), subject to appropriate oversight of budget execution by the Office of the Comptroller General of the Republic, the Office of the Attorney General of the Republic, and MINAET itself. Accordingly, this Chamber finds that, pursuant to the duty to protect public assets and to properly oversee the Administration’s activities, the Administration itself must carry out the resulting remedial measures.

This determination must, of course, prevent the possibility of another institutional failure to perform its duties. It is therefore deemed prudent to provide that the amounts awarded as damages (daños y perjuicios) in this judgment must be deposited into a budget line within MINAET devoted exclusively to the restoration, recovery, and rehabilitation of the damaged elements of biodiversity within the area of land located in Nombre41685 between meridians 367.5 and 368 and parallels 206.5 and 207, because this is the area falling within the range sought to be protected in these judicial proceedings. Those funds must also be used to repair the environment, in accordance with the parameters established by expert evidence during the judgment-enforcement stage (etapa de ejecución de sentencia) as necessary to restore the area’s original natural conditions.

XIX. COROLLARY

ANALYSIS OF THE DEFENSES RAISED. Regarding any possible dispute concerning the claimant’s standing (legitimación activa) to seek remediation of the environmental damage (daño ambiental), the following must be stated. It is clear that the claimant does not seek compensation in his own name or for his own individual benefit. What is sought is a declaration of the State’s duty to provide compensation and thereby remedy, through monetary compensation, the environmental damage caused by its neglect in the sector at issue. From this perspective, the claim does not seek redress for direct harm caused to the claimant through the environment, but rather general remediation in favor of the environment for that injury, as a consequence of the protection required by Article 50 of the Constitution. The action brought by the claimant therefore falls within the standing requirement for a citizen suit (acción popular) under Article 10, subsection one, paragraph d), of the CPCA, as authorized by environmental law, specifically Article 106 of the Biodiversity Law.

Accordingly, in light of the analysis set forth herein, this Chamber finds that the claimant, as a citizen in the full exercise of his rights and in furtherance of the rights granted by Article 50 of the Political Constitution, has properly exercised the right to defend the environment against the entities that, by operation of law, were responsible for protecting and safeguarding the geographical area alleged to have been affected in this action. Consequently, this Court finds that he has a legitimate interest and standing against the defendants herein. Because the latter—the State and SINAC—are legally the parties directly obligated to protect such rights, as required by Articles 13 of the Ley Forestal and 131 and 59 of the General Public Administration Law, it is also determined that the defendants have proper standing as defendants (legitimación pasiva) in these proceedings; therefore, both defenses must be denied.

As to the defense of lack of a legal right (Falta de Derecho) asserted by the defendants, it must be granted in part because, as already explained, this Court does not find it appropriate for the award of damages against the defendants to permit the amounts assessed on that basis to be administered by any entity or body other than MINAET, nor is it appropriate to create any body through these judicial proceedings. As to the remaining claims, that defense must be denied.

XX. CONTINUED EFFECT OF THE PRECAUTIONARY MEASURES GRANTED

As stated in finding number 6 of this judgment, the record contains a precautionary measure (medida cautelar) under which SINAC was ordered, by a ruling issued at fifteen hours and ten minutes on July eighth, two thousand ten, to submit reports. Given that the claims concerning the unlawfulness of the activities carried out by that defendant have been granted, this Chamber finds it prudent to maintain the measures granted and to expand them so that detailed reports are submitted as ordered in the aforementioned ruling. From the date this judgment becomes final until compliance with the orders herein concerning the effective rehabilitation and restoration of the State Natural Heritage area is established through expert evidence, those reports must state, under oath by the Director of SINAC, the actions taken to comply with this judgment and thereby provide proper protection to the affected area, this legal obligation ensuring that protective measures are carried out under the supervision and review of the head of the institution.

XXI. COSTS

Regarding the award of both categories of costs (ambas costas) in these proceedings and the corresponding interest, because this action has been granted in part and most of the claims have been upheld, and because the defendants’ conduct has been found inconsistent with the legal system, under the applicable law both defendants must be ordered to pay both categories of costs in these proceedings, consistent with Article 191 of the Contentious-Administrative Procedure Code. This Court finds no ground that would permit application of any exception to the prevailing-party rule governing costs in this matter. As to interest on those amounts, because the moving party expressly requested it, interest must be awarded from the determination of the amount during the judgment-enforcement stage until payment in full.

POR TANTO:

The objections of lack of standing to sue and to be sued, as well as the defense of lack of current interest, raised by the defendants are dismissed. The objection of lack of a legal right raised by the defendants is partially upheld, solely with respect to the Creation of the Regional Environmental Council for the analysis, discussion, reporting, and oversight of environmental activities, programs, and projects, and with respect to ordering the Administration to enter into an agreement or contract with a Public or Private Higher Education institution, Companies, or national or international scientific institutions for the transfer to it of the amounts relating to the compensation awarded herein. Consequently, the present action brought by Nombre142575 against the State and the National System of Conservation Areas is partially upheld on the following terms, and is deemed dismissed insofar as relief is not expressly granted:

  • 1)It is declared that the land located in the Sámara beach sector, Cangrejal, between meridians 367.5 and 368 and parallels 206.5 and 207, forms part of the maritime-terrestrial zone and constitutes State Property.
  • 2)The failure by the Tempisque Conservation Area of MINAET to exercise its administrative oversight and protective powers over that strip of land is declared contrary to the legal system, and SINAC is ordered to pay for the damages and losses caused thereon.
  • 3)SINAC is ordered, within FIFTEEN DAYS, to issue the certification for the area between meridians 367.5 and 368 and parallels 206.5 and 207, and to forward that certification to the National Real Property Registry for the proper registration of this property as Natural Heritage of the State;
  • 4)SINAC is ordered to demarcate the property at issue in these proceedings and post signage identifying it as State property within FIFTEEN CALENDAR DAYS after this judgment becomes final. Likewise, within FIFTEEN DAYS, the defendants shall submit documentation stating the names and terms of appointment of the members of the Regional Council of the Conservation Area and the National Commission for Environmental Management; and if these bodies have not been constituted, the representatives of the respective sectors comprising them shall be appointed within said period.
  • 5)The State and the National System of Conservation Areas are held jointly and severally liable for payment of the environmental damage caused in the Cangrejal sector, Nombre41685, Guanacaste, within the land located at the coordinates of meridians 367.5 and 368 and parallels 206.5 and 207. The assessment and determination of such damage shall be made during the judgment-enforcement phase, for which purpose an expert opinion must be ordered to establish the specific damage and its amount. Once that sum has been determined, the award established during the enforcement phase shall be included in the budget of the Ministry of Environment and Energy under a budget line specifically allocated to carrying out measures to repair and rehabilitate the aforementioned area, which budget line shall be administered by said Ministry or by the respective Conservation Area. This judgment shall be communicated to the Office of the Comptroller General of the Republic so that, in accordance with Law No. 8131, it may order such budget-execution measures as may be appropriate with respect to those budget lines. The judgment shall likewise be communicated to the Office of the Attorney General of the Republic so that the Ministry of Finance may make the necessary financial provisions under the corresponding budget title.
  • 6)Both categories of litigation costs shall be borne jointly and severally by the defendants, together with the corresponding interest, with the amount to be established during the enforcement phase of this judgment.
  • 7)The measure ordered by this Court in its ruling of las quince horas diez minutos del ocho de julio del año dos mil diez is expanded, and the Executive Director of SINAC is ordered, from the date this judgment becomes final and until compliance with what is ordered herein concerning the effective rehabilitation and restoration of the Natural Heritage of the State area has been established by expert evidence, to state in the reports submitted the actions taken to ensure effective compliance with this judgment regarding the rehabilitation and restoration of the Natural Heritage of the State area; such reports shall be submitted under oath.
  • 8)This judgment shall be personally served on the Executive Director of SINAC for purposes of administrative compliance with the orders herein.

Inicialmente dirigido además contra INSTITUTO COSTARRICENSE DE TURISMO y MUNICIPALIDAD DE NICOYA.

RESULTANDO

  1. 1La parte actora interpone el presente proceso indicando que su pretensión final es solamente contra el Estado y el Sistema Nacional de Áreas de Conservación Tempisque, - a partir de ahora SINAC-, formulando sus pretensiones en demanda inicial y ajustando las mismas en juicio oral y público de manera que han quedado ajustadas en la siguiente forma: 1- Que se declare que en Dirección17264 entre meridianos 367.5 y 368 entre paralelos 206.5 y 207 , el terreno ubicado Dirección17265 que es integrante de la zona marítimo terrestre y corresponde a Patrimonio del Estado y por lo tanto debe ser administrado por MINAET a través de SINAC. Para lo anterior que se ordene a la Procuraduría General de la República por medio de la Notaria del Estado que confeccione una escritura con el objetivo que el terreno objeto de este proceso se inscriba en el Registro de Bienes Inmuebles a favor del Estado todo de acuerdo con el artículo 13 de la Ley Forestal. 2- Que se declare disconforme con el ordenamiento jurídico la omisión de ejercicio de potestades de fiscalización y tutela administrativa no actuadas por el Área de Conservación Tempisque del MINAET; 3- Que se ordene al Área de Conservación Tempisque del MINAET el ejercicio eficiente y efectivo de sus potestades de fiscalización y tutela en la zona que corresponde a Patrimonio natural del Estado en zona Nombre41685 sector Cangrejal Buena Vista de la provincia de Guanacaste particularmente en la zona comprendida entre los meridianos 367.5 y 368 entre paralelos 206.5 y 207 frente a los mojones cinco a diecinueve de la zona pública; todo con el fin de evitar que se sigan dando las arremetidas constantes configuradoras de explotación irracional, ilegal e insostenible del bosque primario que constituye patrimonio natural del Estado.Con motivo de lo anterior se ordene al SINAC demarcar y rotular el inmueble objeto de este proceso como propiedad del Estado, asimismo en caso de encontrar invasores, en la zona demanial se inicien los procedimientos administrativos o jurisdiccionales tendentes al desalojo de los invasores del patrimonio natural del Estado en un plazo máximo de ocho días hábiles luego de quedar firme con carácter de cosa juzgada material la sentencia del presente proceso; 4- Que se ordene al Área de Conservación Tempisque del MINAET cumplir con una obligación de hacer consistente en el dictado de políticas públicas uniformes tendientes a planificar, dirigir y unificar y fiscalizar procesos dirigidos a lograr sostenibilidad mediante la restauración recuperación y rehabilitación de los ecosistemas, las especies y servicios ambientales que han sido dañados por el proceder irreflexivo de los sujetos privados ante la complicidad omisiva del Área de Conservación Tempisque en la zona objeto del proceso constitutiva de patrimonio nacional del Estado, con ese fin se ordene la Creación del Consejo Regional Ambiental para el análisis discusión , denuncia y control de las actividades, programas y proyectos en materia ambiental todo de conformidad con el artículo seis de la Ley Orgánica del Ambiente. 5- Se condene en abstracto a los demandados al pago de daños y perjuicios de conformidad con el artículo 122.m.ii del CPCA y en virtud de la incapacidad material manifiesta de la Administración para la toma de acciones adecuadas con motivo de la protección del medio ambiente de la zona ambientalmente frágil declarada como patrimonio natural del Estado ubicada en Cangrejal de Playa Nombre41685 se ordene a la Administración la suscripción de un convenio o contrato con alguna institución de Educación Superior Pública o Privada, Empresas o instituciones científicas nacionales o internacionales para que le sean girados los montos relativos a la indemnización con motivo que se realicen de forma eficiente las acciones tendentes a la restauración, recuperación y rehabilitación de los elementos de la biodiversidad dañados de conformidad con el artículo 54 de la Ley de Biodiversidad. 6- En caso de oposición de los codemandados se condene a los mismos al pago de ambas costas de este proceso y los intereses correspondientes.
  2. 2La representación del Estado sobre las pretensiones iniciales interpuso excepción de falta de derecho, y en cuanto al ajuste de pretensiones adiciona las excepciones de falta de legitimación activa, falta de derecho y falta de interés actual en relación a los ajustes aplicados por el actor en audiencia oral y pública.
  3. 3La representación del SINAC sobre la demanda y ajuste de pretensiones interpuso excepciones de litis consorcio pasiva necesaria incompleta resuelta interlocutoriamente, Falta de Interés y Falta de derecho.
  4. 4Mediante resolución de catorce horas treinta y siete minutos del diecisiete de mayo del año dos mil diez se propone que el presente asunto se declare como de trámite preferente o urgente (ver folio 88).
  5. 5El expediente respectivo fue remitido a la Sección Sexta siendo que por resolución de diez horas del veinticinco de mayo del año dos mil diez acepta la forma de tramitación e inicia la instrucción procesal como de "trámite preferente" .(folio 89)
  6. 6Que durante la tramitación de este proceso por resolución de las quince horas diez minutos del ocho de julio del año dos mil diez se dictaron las siguientes medidas cautelares: 1) Se ordene al SINAC-ACT, que adopte las medidas adecuadas y necesarias que garanticen la protección de la biodiversidad de la zona objeto de este proceso, lo que incluye fiscalizar que cualquier persona que se encuentre en la propiedad, se abstenga de cortar árboles, raíces, ramas o vegetación menor, quemar el sotobosque, abrir trochas o caminos, chapear, contaminar, eliminar o intervenir las zonas boscosas introducir animales a dicha zona, sembrar especies exógenas o ajenas a la flora propia de la zona, realizar cualquier tipo de edificación. 2) Se ordena al SINAC-ACT (SINAC), informar en períodos quincenales a partir de la notificación de la presente resolución, tanto a la jueza ejecutora del Tribunal como a esta Sección acerca del cumplimiento de la tutela cautelar impuesta y rendir un informe quincenal ante su autoridad. Dicha resolución no fue impugnada por las partes. (Folio 198 y los autos).
  7. 7El juicio oral y público dentro del presente proceso fue llevado a cabo a partir del catorce de enero del año dos mil trece, fue suspendido para continuación en fecha veintinueve de enero del año dos mil trece, señalamiento realizado en el terreno cuya protección se reclama lugar donde se efectuó reconocimiento por parte del Tribunal y se inició la exposición del peritaje ordenado en autos; suspendida dicha audiencia, el juicio oral y público continuó en fecha catorce de febrero del año en curso, siendo que al finalizar el mismo, de conformidad con el artículo 111 del Código Procesal Contencioso Administrativo fue declarado el presente asunto de trámite complejo.
  8. 8Dentro del juicio oral y público celebrado se tuvo como ajenos al proceso a los hasta entonces demandados INSTITUTO COSTARRICENSE DE TURISMO y MUNICIPALIDAD DE NICOYA ante el ajuste de pretensiones sin afectación en su contra, y se tuvo por terminada su participación procesal en el acto.
  9. 9No se determinó existencia de defensas previas pendientes de solución.
  10. 10Dentro del presente asunto no se aprecian errores, ni omisiones procesales que generen nulidades y la presente sentencia se dicta dentro del plazo legal.

CONSIDERANDO:

I. SOBRE LA PRUEBA OFRECIDA PARA MEJOR RESOLVER

Aporta la parte actora en audiencia como prueba para mejor resolver unas fotografías y una documental consistente en el informe DFOE-SAF-IF-01-2013 de fecha 28 de enero del año 2013, ofreciéndolas como elemento para demostrar las condiciones actuales en el inmueble. Esta prueba debe ser rechazada. Por un lado, en cuanto al ofrecimiento de fotografías, cabe señalar, no observa este Tribunal justificación de parte del proponente en cuanto a su relevancia y utilidad para el análisis de fondo que se formula en esta causa judicial. Esas imágenes corresponden a áreas aledañas a la zona cuya protección se reclama; lo que se puede colegir del análisis de la prueba pericial aportada a los autos y que se será referida infra. La compresión de ese elemento técnico permite establecer que las fotografías aportadas no describen condiciones actuales de la zona comprendida entre los meridianos 367.5 y 368 y paralelos 206.5 y 207.

Lo anterior dado que la pericial describe que el contenedor que se descubrió en la respectiva visita, se ubica en una zona distinta a la que propiamente corresponde a la propiedad. Si bien se trata de una zona aledaña a ese sector, en definitiva no evidencia condiciones que se produzcan dentro del inmueble objeto de controversia, por lo que resultan inconducentes para el abordaje de las diversas pretensiones y objetos que han sido planteados en esta contienda. En cuanto al Informe de la Contraloría General de la República aportado, ese documento se direcciona a describir las situaciones financieras nacionales de la áreas de conservación de manera genérica, sin hacer un énfasis o enfoque especial que pueda llevar a establecer una incidencia directa de lo allí descrito en las implicaciones del objeto debatido. En rigor, el contenido de ese documento no acredita ni demuestra la existencia de los hechos omisivos que se pretenden tener por demostrados, ni la existencia de la afectación argumentada sobre la franja de terreno que pretende ser protegida, resultando por ello inconducente por lo que se estima improcedente su recibo.

Desde esa arista de examen, a la luz de lo establecido en el ordinal 110 del CPCA, en relación al 331 del Código Procesal Civil (aplicable por la remisión genérica del canon 220 CPCA), se rechaza la prueba ofrecida para mejor resolver.

II. HECHOS PROBADOS

Se tienen de importancia para la solución de este proceso como probados los siguientes hechos: a- Que en playa Nombre41685 sector Cangrejal entre meridianos 367.5 y 368 entre paralelos 206.5 y 207 existe un terreno destinado a reserva natural del Estado (ver peritaje a folios 894 a 930 y 1045 y siguientes, ); b- Que el terreno ubicado entre meridianos 367.5 y 368 entre paralelos 206.5 y 207 en Playa Nombre41685 es colindante con las fincas 5-50113, de plano G498365-83, 69902-000 de plano G433081-81 y finca 36219-000 de plano G-41510-92 (véase peritaje a folio 897); c- Que ese terreno se constituye en una zona ambientalmente frágil por ser Zona Marítimo terrestre y contener bosque primario (aclaración pericial juicio oral y público diez horas veintiocho minutos, folios 238 a 240 expediente); d- Que al ser esa zona parte del patrimonio natural del Estado, su conservación y administración fue confiada al Ministerio de Ambiente (desde ahora MINAET) por medio del SINAC (ver folio 126); e- Que el Área de Conservación Tempisque está a cargo de la verificación, fiscalización y deslinde de la zona de interés (misma cita); f- Que se ha dado en la zona entre meridianos 367.5 y 368 entre paralelos 206.5 y 207, sin autorización legal, tala rasa del bosque, explotación de flora y fauna y extracción de productos (ver reconocimiento y adendum de peritaje a folio 1044); g- Que se pusieron en conocimiento del SINAC los actos de tala ilegal y explotación de flora y fauna en la zona de interés (ver folios 138, 144, 154, 277 del expediente principal); h- Que en marzo y abril del 2010 se hicieron incursiones por terceros, en la zona entre meridianos 367.5 y 368 entre paralelos 206.5 y 207, consistentes en ingreso de maquinaria pesada (ver reconocimiento efectuado en mayo del 2010 y reconocimiento efectuado al efecto en el presente año); i- Que en la zona entre meridianos 367.5 y 368 entre paralelos 206.5 y 207, se efectuaron trabajos que delimitaron una trocha de acceso y varias terrazas, en las cuales hubo quema de áreas y destrucción de zona de bosque (ver peritaje de cita y escucha de peritaje oral a diez horas veintiocho minutos); j- Que durante la vigencia de las medidas cautelares otorgadas en autos se descubrió que esa zona antes citada, fue objeto de chapia, tala de árboles, quema de vegetación ( folios 453, 517, 669, 675, 693, 732, 843, 847, reconocimiento efectuado en el presente año); k- Que la zona comprendida entre meridianos 367.5 y 368 entre paralelos 206.5 y 207, ha perdido su condición de bosque y se ha transformado en zona de cobertura boscosa (ver peritaje a folio 913 y escucha de audiencia a diez horas treinta y ocho minutos); l- Que dentro de la zona ubicada entre meridianos 367.5 y 368 entre paralelos 206.5 y 207 no se encuentra la zona de trocha identificada como punto de inicio en el reconocimiento (ver adendum pericial sobre punto 793); m- Que pericialmente se indica que " la zona ubicada entre meridianos 367.5 y 368 entre paralelos 206.5 y 207 ha sido objeto de intervención antropogénica (humana) que ha sido constante en el tiempo, debido a la presencia de especies tales como: pipa (...), banano cuadrado (...), marañón (...) y Teca (...), de diferentes edades, así mismo la presencia de plantas rastreras (enredaderas) así como de gramíneas y arbustos calificados de ecológicamente como especies heliófitas totales, especies altamente demandantes de luz, muy agresivas en su crecimiento y muy oportunistas para invadir claros (aperturas en el bosque) es considerado un indicador de que el sitio ha recibido alteraciones" (folio 908 informe pericial y grabación donde consta la ampliación rendida en juicio oral y público); n- Que se encuentra efectuado el levantamiento catastral de todo el cantón de Nicoya incluyendo Nombre41685.

(folio 1000 del expediente judicial); o- Que los funcionarios del SINAC han interpuesto denuncias por las incursiones en la zona ubicada entre meridianos 367.5 y 368 entre paralelos 206.5 y 207 (ver folio 750, 769, 816, 818 del expediente principal); p- Que en la zona ubicada entre meridianos 367.5 y 368 entre paralelos 206.5 y 207, la tala rasa del bosque, explotación de flora y fauna y extracción de productos se produce con el objeto de cambiar el uso de suelo (escuchar grabación de reconocimiento en juicio oral y público); q- Que fue emitido el Plan Nacional de Desarrollo Forestal de Costa Rica 2011-2020 por el MINAET en el mes de agosto del año Placa7398 (ver documental en soporte electrónico aportada por el Estado); r- Que el SINAC emitió y publicitó las Políticas para las Áreas Silvestres Protegidas (ver misma cita) III- HECHOS NO PROBADOS. De importancia se tienen como no probados los siguientes hechos: a- Que no existe concesión o permiso de uso habilitante que permita el uso disfrute y ocupación otorgados por ente alguno sobre la zona ubicada entre meridianos 367.5 y 368 entre paralelos 206.5 y 207 (no se aporta prueba que determine con claridad ese aspecto); b-Que en la zona ubicada entre meridianos 367.5 y 368 entre paralelos 206.5 y 207 la tala rasa del bosque, explotación de flora y fauna y extracción de productos se produzcan con autorización legal ( no hay prueba de ello); c- Que se encuentre conformado y funcionando el Consejo Regional del Área de Conservación Tempisque (no se aporta documental alguna en ese aspecto)

IV. ALEGATOS DE LA ACCIONANTE

Expone la parte actora sus pretensiones al amparo de los elementos que narra como justificantes de su actuar. Reclama que en la zona de Sámara, exactamente en la franja ubicada comprendida entre los meridianos 367.5 y 368 entre paralelos 206.5 y 207, se han presentado una serie de actuaciones de terceros tendentes a la modificación y destrucción de la zona que en su criterio constituye Patrimonio Natural del Estado, por constar en ella bosque; narra que las entidades encargadas, han permitido la explotación ilegal de los recursos naturales de esa área geográfica siendo que se está dando una variación de la flora la fauna y dada la extracción de productos, y variación del uso de suelo; siendo denunciadas esas incursiones ante las autoridades administrativas -según indica- la actividad institucional ha sido "absolutamente infructuosa"; expresa que la omisión en el ejercicio de las potestades de fiscalización dadas por ley al SINAC constituyen una ilegalidad manifiesta y esa inactividad es una omisión disconforme con el ordenamiento jurídico que debe ser enmendada mediante la condena a realizar la conducta mandada por el ordenamiento jurídico.

V. ALEGATOS DEL ESTADO

La representación del Estado sobre las pretensiones iniciales se opone al proceso, aduce falta de derecho, asimismo sobre la deducción y ajuste de pretensiones en audiencia oral y pública, adiciona las excepciones de falta de legitimación activa, falta de derecho sobre lo ajustado y falta de interés actual, indicando que no existió ampliación alguna de hechos que justifique el ajuste en la forma efectuada por el actor. Indica que existe un procedimiento específico creado para fines de inscripción de terrenos como el que nos ocupa, y que se encuentran trabajando en ese proceso como consta en el levantamiento catastral del cantón de Nicoya aportado al efecto como prueba por la señora Procuradora al contestar sobre el ajuste antedicho; considera esa representación que no es necesario confeccionar escritura alguna, que los mojones 5 al 19 que se incluyen como referencia en el sector en discusión, son ajenos a la zona propiedad del Estado, y que no es necesario demarcar catastralmente el inmueble pues de conformidad con la demarcación cartográfica utilizada conforme el artículo Ii) del Manual de Clasificación de Tierras dedicadas a la Conservación de Recursos Naturales en zona marítimo terrestre, no es procedente esa actuación.

Indica que en materia de Patrimonio Natural del Estado prevalece la Ley forestal en su artículo 1 sobre la Ley Orgánica del Ambiente por lo que no procede acoger la petición relacionada con la aplicación de la Ley General del Ambiente, además se cuenta ya con otros instrumentos como el Plan Nacional de Desarrollo Forestal 2011-2020, donde se contempla el plan estratégico interinstitucional de protección, Manejo y Gestión de los Bosques y terrenos forestales en patrimonio natural, y existe el Consejo Regional de Área en el Área de Conservación Tempisque conforme el artículo 30 de la Ley de Biodiversidad. En cuanto al giro a entidades ajenas al proceso de la indemnización de daños y perjuicios, expone la improcedencia de lo pedido indicando que ha sido reiterada la Jurisprudencia en que debe ser girado a favor del Estado lo concedido en cuanto a ese rubro por lo que siendo el SINAC el encargado por ley del cumplimiento de las políticas relacionadas con esas áreas, se le impondría a su favor un rubro a pagar lo que no considera esa representación legalmente posible.

VI. ALEGATOS DEL SINAC

La representación del SINAC sobre la demanda y ajuste de pretensiones, interpuso excepciones de litis consorcio pasiva necesaria incompleta resuelta interlocutoriamente, Falta de Interés y Falta de derecho, para ello indica esa representación que se ha cumplido con el deber de fiscalización y tutela en forma oportuna, responsable y seria; que la zona delimitada entre los mojones cinco a diecinueve se encuentra en otra área distinta a la establecida por el actor como área de discusión, según se desprende de los planos aportados y constantes en autos y que el área que efectivamente pertenece a patrimonio natural del Estado está siendo supervisada e inspeccionada en forma constante por personeros de su entidad, dándose como resultado de tal labor, la puesta en conocimiento de las autoridades penales correspondientes de las acciones de sustracción ilegítimas de recursos naturales. Indica que en los informes o reportes generados por la medida cautelar se ha puesto en conocimiento lo descubierto en cada seguimiento efectuado en la zona a raíz de esa medida cautelar.

VII- SOBRE EL FONDO Y EXCEPCIONES Pretende la parte actora que se declare a su favor una serie de pretensiones relacionadas con el ejercicio de la protección por parte de las demandadas sobre un sector de playa Nombre41685 donde la franja de terreno, que se identifica como la situada entre meridianos 367.5 y 368 y entre paralelos 206.5 y 207, es parte de la zona marítimo terrestre y corresponde al Patrimonio Natural del Estado. Bajo esa apreciación de la parte actora, para valorar las pretensiones, debe en primer término definirse con claridad según el ordenamiento que son Patrimonio Natural del Estado y Zona Marítimo terrestre, `para tal determinación esta Cámara hace suyos los criterios emitidos por reiteradas jurisprudencias al respecto: Se expone entonces " (…) Conforme al numeral 13 de la Ley Forestal “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio...” De esta forma, son tres posibilidades las que brinda la norma, respecto a los bienes que integran dicho patrimonio: a) bosques y terrenos forestales de las reservas nacionales; b) bosques y terrenos forestales de las áreas declaradas inalienables, y c) bosques y terrenos forestales de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública." (ver RES: 000853-F-S1-2011 de la SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA, dictada a las diez horas quince minutos del veintiuno de julio de dos mil once.).

En cuanto a la Zona Marítimo Terrestre debe indicarse: " (...) esa franja de terreno se encuentra regulada por la Ley No. 6043 de 2 de marzo de 1977, publicada en Alcance No. 36 a La Gaceta No. 52 de 16 de marzo de 1977, titulada "Ley sobre la Zona Marítimo Terrestre". Dicho conjunto legal establece una serie de competencias para diversas unidades administrativas, con el objeto de fijar las pautas para el despliegue de una efectiva administración, control, fiscalización y vigilancia de esa zona demanial. En ese sentido, el numeral primero de la citada legislación establece con claridad la demanialidad de esos terrenos en cuanto indica: "La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país.

Su uso y aprovechamiento están sujetos a las disposiciones de esta ley." (ver voto 24-2013-VI del TRIBUNAL CONTENCIOSO ADMINISTRATIVO, SECCIÓN SEXTA, de 16 horas 15 minutos del 07 de febrero del 2013. ) "La zona marítimo terrestre está dividida en dos zonas: la pública, que comprende la faja de cincuenta metros de ancho, contados de la pleamar ordinaria, compuesta por la litoral, orilla o costa del mar que se extiende por las rías y esteros permanentes , hasta donde éstas sean sensiblemente afectadas por las mareas, y presenten características marinas definidas (artículo 2 inciso h) del Reglamento a la Ley de la Zona Marítimo Terrestre, Decreto Ejecutivo número 7841-P); y la restringida, constituida por los restantes ciento cincuenta metros. En virtud de lo anterior, son parte de la zona pública de la zona marítimo-terrestre: la ría, definida como la parte del río próxima a su entrada en el mar, y hasta donde llegan las mareas (inciso f) del artículo 2 del citado Decreto Ejecutivo número 7841-P); de manera que en relación con lo dispuesto en el artículo 9 de la Ley que rige esta materia, también es zona marítimo terrestre, la franja de los doscientos metros contigua a las rías; "los islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar" (párrafo final del artículo 10 de la Ley de la Zona Marítimo Terrestre); (...) tratándose del recurso natural contenido en la zona pública, se advierte que tampoco se puede explotar la flora y la fauna, cortar árboles o extraer productos de la costa, si no es con la debida autorización -permiso o concesión-, en este caso, de la Dirección de Vida Silvestre, del Ministerio de Ambiente y Energía, previo estudio de impacto ambiental, al tenor de lo dispuesto en el artículo 17 de la Ley Orgánica del Ambiente.

(...) Esta labor de fiscalización también concierne al desalojo de los invasores, e incluso, de destruir o demoler las construcciones, instalaciones u obras realizadas, ya sea que se trate de simples cercas, tugurios, puestos de venta, o casas de habitación, sin responsabilidad alguna (como lo consideró el Tribunal Contencioso Administrativo, Sección Tercera en resolución número 7900-98). Conforme al artículo 39 de la Ley de la Zona Marítimo Terrestre, sólo es posible otorgarse concesiones en la zona restringida de la zona marítimo terrestre, a cargo de las municipalidades (artículo 40 de la citada Ley); salvo en los supuestos en que exista un área silvestre protegida -reservas forestales, zonas protectoras, parques nacionales reservas biológicas, refugios nacionales de vida silvestre, humedales, monumentos naturales- que conforme a los artículo 32 de la Ley Orgánica del Ambiente y 73 de la Ley de la Zona Marítimo Terrestre, están bajo la administración del Ministerio " (voto 54-2012 dictada el 17 de febrero del 2012 por la Sección Tercera Tribunal Contencioso Administrativo).

A la luz de estas valoraciones jurisprudenciales sobre la normativa vigente, debe analizarse el planteamiento de la parte actora. Expone el señor Nombre142575 que en la zona marítimo terrestre del sector de Sámara, se encuentra una franja de terreno ubicada exactamente entre meridianos 367.5 y 368 entre paralelos 206.5 y 207, determinada como Patrimonio Natural del Estado. De acuerdo con lo expuesto líneas atrás, valorados pericialmente los datos otorgados por la parte actora en su demanda y por los demandados en su contestación, se debe tener como cierta la existencia de tal franja de terreno. De la prueba aportada y reconocimientos efectuados se descubre con certeza que geográficamente esa franja de tierra sí pertenece a la zona marítimo terrestre. Ahora bien, pretende la parte actora que se reconozca en este proceso que tal franja de terreno constitutiva de zona boscosa -según su dicho-, ha sido afectada por la incursión de terceros, con el fin de sustraer elementos propios de la biodiversidad del lugar, generadores de una modificación perjudicial en el área.

Reclama una serie de pretensiones protectoras para dicha zona, determinando en forma expresa su pedido a fin de que se aplique la protección pretendida a esa zona protegida y evitar la pérdida total de ese ecosistema. Es procedente ante tales pedimentos establecer el análisis de cada uno de ellos a la luz del ordenamiento jurídico que ha emitido normas expresas en materia de Medio Ambiente, protección Forestal, y Biodiversidad, y que permiten una protección o cobertura jurídica de los bienes del Estado ubicados sobre la zona marítimo terrestre que pertenecen a zona boscosa y Patrimonio Natural del Estado, de forma tal se procede de la forma que en los apartes venideros se realiza.

VIII.En cuanto a que se declare que en Dirección17264 entre meridianos 367.5 y 368 entre paralelos 206.5 y 207, el terreno ubicado Dirección17265 es integrante de la zona marítimo terrestre y corresponde a Patrimonio Natural del Estado. Determinada por ley la zona marítimo terrestre y los terrenos calificados como Patrimonio Natural del Estado, la zona descrita por la parte actora en su demanda, como área física a proteger mediante esta acción, de acuerdo a la prueba recabada, efectivamente, cumple los requerimientos para pertenecer a ambas condiciones legales e incluso, este hecho, ha sido reconocido por parte de los demandados, a través de las documentales aportadas al efecto de responder al ajuste de pretensiones del actor. A través de la pericial rendida y de los propios reconocimientos efectuados por este Tribunal, queda clara la pertenencia de la franja de terreno de interés, a la zona marítimo terrestre.

Resulta igualmente claro para esta Cámara, el hecho de que ese terreno es zona que califica como Patrimonio Natural del Estado. Lo anterior ya que se ha determinado, luego del análisis de fondo de los autos, sobre la misma se dan dos condiciones particulares que determinan tal condición. Por un lado, existe declaración administrativamente de la condición dicha (véase respuesta del Estado al ajuste de pretensiones) y la segunda, que el sitio presenta condición de cobertura boscosa, elemento validable para constituirse en patrimonio natural. Ese terreno al contener ambas condiciones, disfruta de la protección especial del Estado otorgada por el artículo 4 del Decreto 36786-MINAET de 12/08/2011 denominado Manual para la Clasificación de Tierras Dedicadas a la Conservación de los Recursos Naturales dentro de la Zona Marítimo Terrestre en Costa Rica que enuncia: "(...) el Patrimonio Natural del Estado es de dominio público; su conservación y administración están confiadas por ley al Ministerio de Ambiente, Energía y Telecomunicaciones, a través del Sistema Nacional de Áreas de Conservación.

El Patrimonio lo integran dos importantes componentes:a) Las Áreas Silvestres Protegidas, cualquiera que sea su categoría de manejo, declaradas por Ley o Decreto Ejecutivo: reservas forestales, zonas protectoras, parques nacionales, reservas biológicas, refugios nacionales de vida silvestre, humedales y monumentos naturales. b) Los demás bosques y terrenos forestales o de aptitud forestal del Estado e instituciones públicas (artículo 13 de la Ley Forestal), que tienen una afectación legal inmediata. Para la Zona Marítimo Terrestre, la Ley de Zona Marítimo Terrestre, Ley Nº 6043 en su artículo 73 excluye de su ámbito las Áreas Silvestres Protegidas y las sujetas a su propia legislación. El resto de áreas boscosas y terrenos de aptitud forestal de los litorales están también bajo la administración del Ministerio de Ambiente, Energía y Telecomunicaciones y se rigen por su normativa específica, artículo 13 de la Ley Forestal Nº 7575 y concordantes, y el Voto de la Sala Constitucional 4587-97."(ver normativa expuesta) Dada esta condición jurídica del Patrimonio natural del Estado, tanto el MINAET como el SINAC en consecuencia, son los encargados de la labor de fiscalización y protección de las actividades que se desarrollen sobre el terreno cuya protección se pretende en este proceso judicial.

A lo largo de este proceso las manifestaciones expuestas por los personeros del SINAC, tanto en la contestación de la demanda como en los informes rendidos durante la vigencia de la medida cautelar otorgada en autos, permiten concluir la existencia por parte de esa entidad, de una duda o inseguridad en cuanto a la pertenencia de esa franja de terreno a la Zona Patrimonio Natural del Estado, sin embargo a través de la documental aportada por el mismo Estado y gracias a las valoraciones realizadas en el peritaje rendido en autos, es posible esclarecer la condición real del bien citado. La zona territorial existente en Sámara, entre meridianos 367.5 y 368 y paralelos 206.5 y 207, sí pertenece a la zona constitutiva de Patrimonio Natural del Estado, y procede declararla en esa condición en autos tal y como se pretende.

IX.En cuanto a que se determine que la zona de terreno comprendida entre meridianos 367.5 y 368 entre paralelos 206.5 y 207, debe ser administrado por MINAET a través de SINAC. Establece el ordenamiento jurídico, la distribución de competencias de los órganos estatales, otorgando al MINAET y al SINAC competencias específicas. En cuanto a las competencias relacionadas con los bienes constitutivos de Patrimonio Natural del Estado y Zona marítimo terrestre ya se ha transcrito lo expuesto por el Manual para la Inscripción de este tipo de bienes, adicionada tal distribución de competencias por la Ley Orgánica del Ambiente en su artículo 8 y 9 de la Ley de Biodiversidad, donde corresponde al Sistema Nacional de Áreas de Conservación, como persona jurídica propia, ser la encargada de ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica y ejercer esa Administración.

(véase su artículo 22 de la ley citada). A la luz de esos imperativos, el SINAC tiene la obligación legal de realizar las actividades para las que fue creado ese órgano que surjan o afecten las condiciones sobre el terreno existente en Sámara, entre meridianos 367.5 y 368 entre paralelos 206.5 y 207. Pese a tal imperativo, ha quedado demostrado en autos que no existe claridad institucional sobre su competencia en esa franja de terreno, así lo manifestaron personeros de ambos demandados. Dada la duda hasta ahora existente por parte de los demandados en cuanto a la pertenencia o no de la franja de terreno a la zona de interés de sus potestades, es posible acceder a la declaratoria pedida, en aras de que se dé un efectivo cumplimiento a los fines proteccionistas que tiene esa declaratoria de Patrimonio Natural del Estado sobre el bien descrito por el actor. Desde ese plano, procede entonces establecer que de conformidad con las atribuciones dadas por la Ley de Biodiversidad, el SINAC es la instancia administrativa competente para administrar esa franja de terreno, siendo una potestad que se constituye en un poder-deber, que ha de ser emprendida y ejecutada por dicha instancia pública para lograr la satisfacción de los intereses públicos que son inherentes y consustanciales al marco de competencias que le han sido conferidas, siendo claro que son atribuciones impostergables, indeclinables, imprescriptibles e intransferibles (doctrina de los ordinales 4, 11, 12, 59 y 66, todos de la Ley General de la Administración Pública.)

X.En cuanto a que se ordene a la Procuraduría General de la República por medio de la Notaria del Estado que confeccione una escritura con el objetivo que el terreno objeto de este proceso se inscriba en el Registro de Bienes Inmuebles a favor del Estado todo de acuerdo con el artículo 13 de la Ley Forestal": Conforme se pretende resulta improcedente una declaratoria en la forma pedida. A la vista del Manual para la Clasificación de Tierras Dedicadas a la Conservación de los Recursos Naturales dentro de la Zona Marítimo Terrestre en Costa Rica, (Decreto 36786-MINAET de 12/08/2011, desde ahora Manual) existe para las tierras protegidas por esta clasificación, un procedimiento general que debe seguirse. Para la clasificación de unidades -terrenos-; y otorgamiento de la categoría protegida, en el Manual se expresa en lo conducente la necesidad tanto del levantamiento de información geográfica, como "monumentación de mojones", ello de previo a la inscripción registral de los inmuebles.

A través de la remisión de una certificación de condición del inmueble de interés se procederá a la matriculación del inmueble; según se describe de la prueba existente en autos, y condiciones propias de la franja de terreno que nos ocupa. No es procedente escriturar estas franjas de terreno, por cuanto terminado el procedimiento establecido, cumplidos los requerimientos descritos en sus numerales, el Manual expone la inscripción registral de los terrenos como un efecto directo. Lo anterior ya que en el contexto del detalle de este procedimiento especial, el registro o inscripción del bien a favor del Estado se realiza luego de satisfacer las etapas aludidas, sin necesidad de suscribir escritura pública alguna. De ahí que la necesaria matriculación que como efecto último pretende la parte promovente, se ve satisfecha mediante el cumplimiento del procedimiento señalado, mismo que según se ha explicitado, se encuentra en curso, siendo lo debido disponer su culminación al menor plazo posible, dada la determinación de este Tribunal en el sentido de la pertenencia del citado terreno al patrimonio natural del Estado.

En ese sentido, a través de la contestación dada al ajuste de pretensiones, se tiene como cierto que ya existe el levantamiento de información y la monumentación de mojones, por lo que puede afirmarse que solo falta la emisión de la certificación, misma que una vez emitida, debe remitirse para ante el Registro -Registro Nacional de Bienes Inmuebles-, con el fin de efectuar la Inscripción descrita por el Manual antedicho. Ergo, o es necesario formalizar a través de notario del Estado como lo pretende el actor. Sin embargo, sí estima esta Cámara que resulta importante ordenar la culminación del procedimiento, mismo que a lo largo de este proceso se ha indicado en reiteradas ocasiones que ya se efectuó, pero del cual no consta a la fecha, inscripción alguna. De la pericia rendida se conoce que la zona marítimo terrestre en la cual se encuentra la franja de terreno que está siendo amparada por este reclamo judicial, no cuenta con planos inscritos que permitan determinar la existencia de una estructuración definitiva de la misma, ello pese a que las partes han sido acordes en autos en que sí constituye Patrimonio Natural del Estado.

Por ello, pese a que el actor solicita una notarización, se estima que lo procedente es, conforme al referido Manual, se concluya el procedimiento iniciado y se expida la certificación que permita establecer certeza en cuanto a la condición del inmueble; por ello ante el hecho de que solicita el actor se confeccione una escritura con el objetivo que el terreno objeto de este proceso se inscriba en el Registro de Bienes Inmuebles a favor del Estado de acuerdo con el artículo 13 de la Ley Forestal, procede ordenar que el Director de Área de Conservación, remita en el plazo de siete días la certificación requerida por el Manual de Clasificación de Tierras Dedicadas a la Conservación de Recursos Naturales en Zona Marítimo Terrestre para la inscripción ante el Registro Nacional de la existencia y determinación de la franja de terreno contemplada en la zona de Nombre41685 entre los meridianos 367.5 y 368 y entre paralelos 206.5 y 207, quedando debidamente inscrita y protegida por la Legislación vigente ante la publicidad registral y proteger la zona que se ha pretendido localizar o determinar geográficamente como la protegida por esta acción judicial. Así se ordena remitir los oficios correspondientes para el cumplimiento debido.

XI.- "Que se declare disconforme con el ordenamiento jurídico la omisión de ejercicio de potestades de fiscalización y tutela administrativa no actuadas por el Área de Conservación Tempisque del MINAET". Para resolver tal pretensión debe tenerse presente, que la normativa vigente establece que el MINAET Y EL SINAC, son los encargados de realizar las acciones de protección, delimitación y desarrollo de las áreas destinadas a bosque, reserva natural y demás ecosistemas, sin embargo, los textos legales no indican las formas de ejercicio de tales acciones, dejando esta aplicación a la normativa general. Para determinar cómo debe proceder la Administración en el ejercicio de estas potestades debe tenerse en cuenta que conforme a la ley, la Administración Pública actuará sometida al ordenamiento jurídico y sólo podrá realizar aquellos actos o prestar aquellos servicios públicos que éste autorice, siendo que en ese actuar, la Administración responderá por todos los daños que cause su funcionamiento legítimo o ilegítimo, normal o anormal, salvo fuerza mayor, culpa de la víctima o hecho de un tercero.

(Véase artículos 11 y 196 de la Ley General de la Administración Pública). En este caso particular se reclama que los personeros del SINAC, como se ha tenido por probado en autos, han realizado inspecciones al lugar, para proteger la zona pero que pese a esas acciones, se ha presentado extracción y destrucción de los recursos naturales, ante tales hechos tenidos por ciertos, es prudente según esta Cámara, estimar que la conducta de los funcionarios ha resultado omisiva, porque su actuación debe realizarse de forma que se produzca el fin pretendido por la Administración, a saber en este caso, la protección de la zona Patrimonio Natural del Estado. Dicha actividad que realiza la Administración debe cumplir los fines trazados por la ley, y consecuentemente deben tomarse las medidas pertinentes para esa obtención de fines; en ese sentido ha sido clara la Sala Primera que indica:" En la actualidad es pacíficamente aceptado que la conducta administrativa abarca no solo el comportamiento activo de la Administración (y dentro de él, el acto administrativo) sino además, la conducta omisiva, ese “ no hacer ” que se ha dado en llamar inactividad de la Administración, tanto en su vertiente formal (en la medida en que se revierte en un acto presunto por silencio administrativo) como material (referida básicamente al ámbito prestacional de la organización administrativa).

De esta manera, ha de entenderse la inactividad material administrativa como aquella derivada de la omisión en el cumplimiento de una obligación jurídica preestablecida, que se produce cuando, fuera de un procedimiento administrativo, la Administración incumple, por omisión, una obligación impuesta por el Ordenamiento Jurídico o por cualquier otro mecanismo de autovinculación, como es el caso de un acto propio o de los instrumentos consensuales, con lesión directa de un interés legítimo o de un derecho subjetivo, ya sea que altere o no una relación jurídico-administrativa preexistente. Más simple, hay inactividad de este tipo cuando existiendo para el ente u órgano público una obligación de dar o hacer impuesta por el ordenamiento jurídico o por una previa decisión suya, fuera o dentro de un procedimiento administrativo, no se despliega la debida actividad fáctica o jurídica que lleve a buen término la función otorgada, con detrimento de los derechos o intereses de uno o varios sujetos pasivos, ya sean privados o públicos, individuales o colectivos.

Se trata de esa “ culpa in ommittendo ” en la que se incumple por inacción el deber funcional de actuar. De más está decir, que la indolencia administrativa puede producir (y de hecho produce) más graves lesiones que la propia actuación limitativa del órgano o ente público. De ahí que, ha de afirmarse de manera contundente (con fundamento y de acuerdo con lo dicho en considerandos anteriores) que la Administración Pública también es responsable por los daños y perjuicios ocasionados con su inactividad administrativa. Esa pasividad frente al cumplimiento de obligaciones preexistentes se enmarca, para efectos de la responsabilidad civil extracontractual, como funcionamiento anormal de la Administración (en tanto se corresponda con una actividad material debida) y con una conducta ilegítima , que para este caso puede ser concurrente, en la medida en que el incumplimiento de lo debido no sólo atenta contra las reglas de buena administración, sino que infringe la juricidad (sic) en tanto incumple las potestades administrativas funcionales que dimanan del propio Ordenamiento Jurídico." (Voto 584-F-2005 de SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA de diez horas cuarenta minutos del once de agosto del año dos mil cinco.) En el caso de marras la conducta de vigilancia fue generada, sin embargo, claramente del peritaje, del reconocimiento y de los mismos informes del SINAC se evidencia, ese ejercicio de acciones no fue suficiente para la tutela debida del patrimonio aludido, dadas las acreditaciones de prácticas intrusivas en el terreno objeto de controversia.

La operatividad de la Administración para las necesidades propias de la zona no ha permitido una eliminación de la problemática y en autos, no consta, que se realizara alguna gestión para la búsqueda de otras formas de protección o de otras acciones que impidieran el acceso de terceros que hicieran uso indebido de la misma. Los informes que se han rendido en autos muestran que los personeros del Área Tempisque, asignados por el Director Ejecutivo del SINAC (ver artículo 26 de la Ley de Biodiversidad, No. 7788, desde ahora Ley 7788) en el ejercicio de sus funciones, se han limitado a la labor de vigilancia, misma que fue ocasional, no permanente. Ello, lejos de impedir la destrucción y deterioro de la zona, a criterio de quienes resuelven, hizo permisivo el comportamiento de terceros en el área, contraviniendo el deber de protección que la ley atribuye a la institución demandada -SINAC-. Incluso en algunos de los informes se indica que los terceros exponen posiciones sobre los hechos verificados y que se indica que se encuentran fuera del área de la medida cautelar, siendo incomprensible para quienes resuelven que si el informe se hace a efecto de cumplir la orden judicial de protección, y se realice en el área geográficamente determinada por la orden judicial esa inspección, no se tomen acciones inmediatas sobre esos terceros.

Por esas acciones, reclama la parte actora una disconformidad con el ordenamiento de la conducta del Área de Conservación Tempisque MINAET, y siendo que el órgano denominado "Área de Conservación" es el que se encarga de aplicar la legislación vigente y que su Director, según el artículo 31 de la Ley 7788 será el encargado de aplicarla, e implementar las políticas nacionales y ejecutar las directrices del Consejo Regional de su Área de Conservación o las del Ministro del Ambiente y Energía, resulta en consecuencia, que el comportamiento de la Administración que es tachado como disconforme y que corresponde al SINAC como órgano propio de acuerdo con la Ley, debe ser declarado disconforme con el ordenamiento correspondiendo por imperio legal tal disconformidad contra el SINAC y no propiamente contra el MINAET por las características del órgano que desarrolla la actividad de fiscalización.

XII.Que se ordene al Área de Conservación Tempisque del MINAET Área de Conservación Tempisque del SINAC [sic] el ejercicio eficiente y efectivo de sus potestades de fiscalización y tutela en la zona que corresponde a Patrimonio natural del Estado en zona Nombre41685 sector Cangrejal Buena Vista de la provincia de Guanacaste particularmente en la zona comprendida entre los meridianos 367.5 y 368 entre paralelos 206.5 y 207 frente a los mojones cinco a diecinueve de la zona pública; todo con el fin de evitar que se sigan dando las arremetidas constantes configuradoras de explotación irracional, ilegal e insostenible del bosque primario que constituye patrimonio natural del Estado. Se ha expuesto en esta sentencia que la Administración se encuentra obligada a la reparación de los efectos negativos de sus acciones u omisiones, generadas por funcionamiento normal y anormal. En el caso que nos ocupa, se ha estimado por esta Cámara que la actividad del SINAC ha sido anormal por cuanto no se ha realizado en el ejercicio adecuado de sus deberes, otorgados por Ley.

El SINAC, siendo el órgano obligado a dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica conforme lo ordena la Ley de Biodiversidad en su artículo 22, se ha limitado a ejercer en la zona una labor ocasional de vigilancia, sin aplicación en el sitio de interés de actos o procesos dirigidos a la sostenibilidad de los recursos naturales de esa zona, motivo por el cual, a la luz de la prueba existente en autos, en la cual se ha determinado claramente que ha sido objeto de intervención antropogénica (humana) constante en el tiempo, y que adicional a los informes de existencia de incursiones que corren en autos, tal circunstancia se deduce pericialmente por la presencia de especies tales como: pipa (...), banano cuadrado (...), marañón (...) y Teca (...), de diferentes edades, plantas rastreras (enredaderas) así como de gramíneas y arbustos calificados de ecológicamente como especies heliófitas totales, altamente demandantes de luz, muy agresivas en su crecimiento y muy oportunistas para invadir claros o zonas donde fue eliminado el bosque permiten acoger lo peticionado, ordenar a la Dirección ejecutiva del SINAC el cumplimiento de su deber de efectuar una fiscalización y acción adecuada por parte de dicho órgano con el fin de que se eviten nuevas incursiones en la zona de interés de esta demanda y se proceda a la rehabilitación de la misma hasta reestablecer su condición natural.

Es procedente entonces ordenar al Director Ejecutivo del SINAC, que proceda al efectivo cumplimiento de sus funciones, conforme a los ordinales 4, 11, 12, 59, 66 de la Ley General de la Administración Pública y numerales 122 incisos f y g del Código Procesal Contencioso Administrativo.

XIII.Que se ordene al SINAC demarcar y rotular el inmueble objeto de este proceso como propiedad del Estado. Esta Cámara ante la declaratoria de disconformidad de las acciones del SINAC estima prudente y adecuado, en aras de proteger el derecho a un ambiente sano (estando involucrado patrimonio natural del Estado), la acción directa de rotulación en la zona solicitada, ello procede como medio de cumplimiento de los deberes existentes a cargo de esa demandada. Tal rotulación deberá hacerse en el perímetro de la zona patrimonio natural del Estado, y se requiere entonces, previo a la misma el cumplimiento de la certificación de Patrimonio natural del Estado ya ordenada a fin de que con vista en la descripción catastral del bien se proceda a la rotulación en el perímetro de la zona. En aras de que las acciones se tomen en forma inmediata se otorga al SINAC el plazo de quince días para que proceda a tal rotulación a partir de la firmeza de esta sentencia

XIV.Que en caso de encontrar invasores, en la zona demanial se inicien los procedimientos administrativos o jurisdiccionales tendentes al desalojo de los invasores del patrimonio natural del Estado en un plazo máximo de ocho días hábiles luego de quedar firme con carácter de cosa juzgada material la sentencia del presente proceso. Acorde con las responsabilidades de los funcionarios a cargo del ejercicio de la potestad administrativa la normativa vigente no ha especificado las actividades a realizar la administración a fin de dar efectivo cumplimiento a la potestad protectora otorgada al SINAC. Consta en autos que los funcionarios encargados por el SINAC han iniciado denuncias contra personas que han ingresado sin autorización a la franja de terreno objeto de discusión en este proceso y afectado, a través de extracción de elementos propios de la zona el inmueble, ello conforme al procedimiento normal.

Los poseedores de los objetos sustraídos de la zona, responderán en consecuencia por los actos denunciados y el deber de denuncia existente desde la creación del SINAC permanece, por ello estima este Tribunal, que establecer un margen temporal para denunciar, resulta ajeno a los deberes propios de la institución que debe velar por la atención inmediata de la protección a la zona, deber que no puede contar con plazos para ese ejercicio debido por ser "inmediato" y urgente. Sí se considera oportuno recordar a las Administraciones Públicas accionadas el deber de que tales denuncias sean efectivamente realizadas y que en atención a ello se brinde la totalidad de la información que la institución posea para que se dé el seguimiento judicial inmediato contra los terceros que hasta la fecha han arremetido contra los recursos naturales de esta zona.

XV.Que se ordene al Área de Conservación Tempisque del MINAET cumplir con una obligación de hacer consistente en el dictado de políticas públicas uniformes tendientes a planificar, dirigir y unificar y fiscalizar procesos dirigidos a lograr sostenibilidad mediante la restauración recuperación y rehabilitación de los ecosistemas, las especies y servicios ambientales que han sido dañados por el proceder irreflexivo de los sujetos privados ante la complicidad omisiva del Área de Conservación Tempisque en la zona objeto del proceso constitutiva de patrimonio nacional del Estado. Se expuso líneas atrás, que es deber institucional el cumplimiento de las políticas nacionales de protección a la zona Marítimo terrestre y patrimonio natural del Estado, por ende, los funcionarios del Área de Conservación Tempisque del MINAET tienen un deber de cumplimiento, ordenar específicamente lo aquí peticionado es redundar en un deber ya declarado, sin embargo es importante y resulta necesario destacar, que la existencia de las políticas que tienen como propósito el ejercicio de las potestades proteccionistas del Estado sobre los recursos naturales en el área afectada por los hechos que aquí se conocen, ha quedado clara, por el aporte de la documental correspondiente que permite estimarlo así.

Sin embargo, la puesta en práctica de esas políticas y de la propia ley protectora, no ha sido demostrada en autos, y la descrita durante todo este proceso no responde a las necesidades de la zona, por lo que en atención de los artículos 131 de la Ley General de Administración Pública y 50 de la Constitución Política, bajo las potestades otorgadas por el Código Procesal Contencioso administrativo en su artículo 122 incisos c) y f) resulta indispensable que los demandados ante tal situación procedan como se ha ordenado a efectuar la activación de procedimientos a fin de que la fiscalización se dé en forma adecuada sobre el ejercicio de tales políticas públicas. Por ende es necesario notificar personalmente al Director Ejecutivo del SINAC para que en ejercicio de su cargo sea quien rinda los informes de cumplimiento tanto de las medidas cautelares como de la ejecución de lo ordenado en esta sentencia, bajo fe de juramento, en afán de determinar su responsabilidad personal como funcionario público, jerarca institucional de las actuaciones omisivas del órgano que dirige, y ordenarle que deberá proceder de conformidad con la normativa vigente en la búsqueda del efectivo cumplimiento de la protección y restauración de la zona Patrimonio Natural del Estado, que ha sido objeto de esta discusión.

Dichos informes deberán ser remitidos a la instancia de ejecución de este Tribunal, hasta que sea determinado pericialmente el cumplimiento de lo ordenado por el presente fallo en cuanto a la restauración y rehabilitación efectiva de la zona que constituye el Patrimonio Natural del Estado objeto de interés en esta causa.

XVI.Que se ordene la Creación del Consejo Regional Ambiental para el análisis discusión , denuncia y control de las actividades, programas y proyectos en materia ambiental todo de conformidad con el artículo seis de la Ley Orgánica del Ambiente." En cuanto a la Creación del Consejo Regional Ambiental, debe tenerse presente que por Ley, existe el Consejo Regional del Área de Conservación (lo crea el artículo 29 de la Ley 7788); asimismo, existe legalmente una Comisión Nacional para la Gestión Ambiental, ambos órganos, contemplan en sus atribuciones las actividades que se pretenden asignar al Consejo Regional que el actor pretende sea creado mediante esta sentencia; la demanda en ese aspecto debe rechazarse por existir de acuerdo con el art 14 de la ley 7788 un órgano encargado de cumplir esas acciones. Sí estima esta Cámara necesario que en un afán de dar adecuado cumplimiento por parte de los entes aquí demandados, ante la ausencia de pruebas de la conformación de ambos órganos precitados, ordenar que en el plazo de QUINCE DIAS se aporte documental en la cual se indiquen los nombres y plazo de nombramiento de los miembros de ambos órganos, con el fin de que si están conformados esos órganos (lo que se ha logrado acreditar en este proceso), quede a disposición de la comunidad la identidad de los miembros, y en caso contrario que dentro del plazo dicho se proceda a la asignación de los representantes de los correspondientes sectores que los conforman.

Asimismo con el fin de que la zona objeto de protección a través de este proceso encuentre una rehabilitación y recuperación adecuadas, se ordena destinar un funcionario a efecto de que proceda a efectuar los estudios pertinentes para la adecuada rehabilitación y recuperación de la zona de marras, y hasta tanto no rinda tal informe no se le destinen otras funciones con el debido seguimiento de las autoridades institucionales siendo que para ello se ordena remitir copia de la presente sentencia a los órganos contralores del cumplimiento en cuanto a protección de bienes del Estado, Contraloría General de la República, Defensoría de los Habitantes, y demás entidades relacionadas con la protección ambiental a fin de que brinden el seguimiento de ley correspondiente al cumplimiento de deberes instituido por ley.

XVII.Que se condene en abstracto a los demandados al pago de daños y perjuicios de conformidad con el artículo 122.m.ii del CPCA . En atención a la declaratoria de disconformidad de las actuaciones de la Administración en este caso, y al haberse determinado la existencia de prácticas y acciones intrusivas del ambiente en el sector cuestionado, tales como tala de árboles, quemas, introducción de especies no autóctonas, este Tribunal ha tenido por establecido la existencia de un funcionamiento anormal de parte de las autoridades públicas, que se han constituido como causa adecuada de la generación de esas lesiones ambientales, derivadas, en este caso, por la inercia e indolencia pública que llevaron a propiciar esos daños. En efecto, al haberse establecido la indebida fiscalización y tutela de la administración del Patrimonio Natural del estado en la zona objeto de conflicto y la ocurrencia de daños en el ecosistema allí presente, esa inercia se constituye en puente causal de las conductas lesivas, surgiendo de ese modo un nexo causal que implica, a tono con lo estatuido con el ordinal 190 de la Ley General de la Administración Pública, la responsabilidad de la Administración Pública que con su inactividad, ha potenciado la lesión antijurídica.

Estima este Tribunal, el deber de tutela de los bienes demaniales lleva implícita la responsabilidad pública por la desatención de esos deberes, en la medida en que se haya constituido en causa jurídicamente relevante para ocasionar el daño. Con el fin de restituir las condiciones naturales de los bienes del Estado, la figura de los daños y perjuicios debe aplicarse en condiciones especiales; así ha expuesto la jurisprudencia en forma reiterada cuando sobre este extremo ha resuelto: " por la especialidad de la materia, los recursos técnicos y profesionales con que cuenta el Ministerio de Ambiente y Energía, para el caso en concreto, según sus particularidades y características propias, resulta el idóneo para llevar a cabo esa tarea. Del mismo modo, manteniendo como premisa la ejecución efectiva del fallo constitucional, es de rigor crear un mecanismo de naturaleza presupuestario que beneficie y potencie al máximo los principios de eficiencia, eficacia, celeridad y economía, por lo que, la suma dispuesta por el Tribunal Contencioso Administrativo que condenó solidariamente a la Cooperativa y al Estado, se deberá depositar en la Caja Única de este último (numerales 66 de la Ley de Administración Financiera de la República y Presupuestos Públicos, 83 y 84 de su Reglamento), en una cuenta cliente creada específicamente para tal fin, cuyo titular será el Ministerio de Ambiente y Energía, quien deberá destinarlo para ejecutar obras de reparación y restauración, en forma exclusiva, a proyectos sobre el río Siquiares.(sic) Al haberse concluido que ese pago es fondo público, en aras de garantizar un manejo responsable de las finanzas públicas, es pertinente la utilización de esta herramienta financiera, la que ayudará a alcanzar los objetivos y metas ambientales en una forma efectiva, y para esto se requiere el apoyo del órgano rector del Sistema de Administración Financiera.

De este modo, se insiste, para agilizar el recibo y administración de la condena, deberá depositarse en esa cuenta separada, con la identificación del origen y del destino al cual esta afecto. Por tal razón, en lo concerniente al Estado, deberá el Ministerio de Hacienda, a quien se comunicará esta resolución, tomar las previsiones financieras en el título presupuestario correspondiente. XVI.- (ver Sentencia de Sala Primera 675 de 10 horas del 21-9-2007) Queda así establecido, que es deber del Estado, satisfacer aquel daño producido por la acción normal o anormal de sus funcionarios y dado que en el presente caso, la omisión de un ejercicio adecuado de la actividad administrativa para la protección de la zona ha sido probada, y demostrada también en autos, la modificación de las condiciones naturales del inmueble que nos interesa, procede conceder este extremo, para que en ejecución de sentencia sea estimado el daño producido y valorado el contenido económico necesario para la restauración, recuperación y rehabilitación de los elementos de la biodiversidad dañados dentro de la zona de terreno ubicada en Nombre41685 que ha sido objeto de la presente litis.

XVIII.Que en virtud de la incapacidad material manifiesta de la Administración para la toma de acciones adecuadas con motivo de la protección del medio ambiente de la zona ambientalmente frágil declarada como patrimonio natural del Estado ubicada en Cangrejal de Playa Nombre41685 se ordene a la Administración la suscripción de un convenio o contrato con alguna institución de Educación Superior Pública o Privada, Empresas o instituciones científicas nacionales o internacionales para que le sean girados los montos relativos a la indemnización con motivo que se realicen de forma eficiente las acciones tendentes a la restauración, recuperación y rehabilitación de los elementos de la biodiversidad dañados de conformidad con el artículo 54 de la Ley de Biodiversidad. La presente pretensión debe rechazarse. Las condenas que se impongan por daños al ambiente, son constitutivas de fondos públicos, dado que esas sumas condenadas, han de direccionarse indefectiblemente a la regeneración del ambiente lesionado, o en su defecto, caso de la imposibilidad de regeneración, a financiar acciones de tutela ambiental.

Desde esta óptica, esas sumas condenadas, a efectos de que se direccionen de manera debida para el fin señalado, puede ser administrado por varios actores, dentro de los cuales podría ponderarse la participación de entes locales, organizaciones no gubernamentales, entre otros. Sin embargo, esta Cámara participa del criterio forjado por la Sala Primera de la Corte Suprema de Justicia en el precitado fallo No. 675-2007, que establece, esos fondos han de ser administrados por el MINAET, mediante su incorporación dentro del presupuesto nacional, dentro de una partida presupuestaria específica, direccionada a la regeneración ambiental del sector afectado (Cangrejal de Sámara, en el espacio físico ya identificado), con la debida orden de control en cuanto a la ejecución presupuestaria de parte de la Contraloría General de la República, la Procuraduría General de la República y el mismo MINAET.

De ese modo, estima esta Cámara que al amparo del deber de protección de los bienes, y fiscalización adecuada de las actividades de la Administración, debe ser la misma Administración la que ejecute los actos de reparación que se generen; en tal apreciación debe evitarse por supuesto, la posibilidad de una nueva omisión institucional de cumplimiento de deberes, por lo que con esa claridad se estima prudente, establecer que los montos fijados por concepto de daños y perjuicios otorgados en esta sentencia, deben ingresar a una partida presupuestaria dentro del MINAET, destinada en forma exclusiva a la restauración, recuperación y rehabilitación de los elementos de la biodiversidad dañados dentro de la zona de terreno ubicada en Nombre41685 entre los meridianos 367.5 y 368 entre paralelos 206.5 y 207 por ser la zona contenida en el rango que se pretende proteger en este proceso judicial. Asimismo ejecutarse con esos fondos la reparación al Medio Ambiente, de conformidad con los parámetros que pericialmente se establezcan en etapa de ejecución de sentencia como los necesarios para el restablecimiento de las condiciones naturales originarias de la zona.

XIX. COROLARIO

ANÁLISIS DE DEFENSAS OPUESTAS. En cuanto al eventual debate sobre la legitimación activa del accionante para reclamar la reparación del daño ambiental, ha de indicarse lo que de seguido se expone. Es claro que el actor no pretende una indemnización en cabeza propia, en su propio beneficio individual. Lo peticionado es la declaratoria del deber indemnizatorio del Estado de restituir mediante compensación económica, el daño ambiental producido por su indolencia en el sector objeto de conflicto. Desde este plano, no se peticiona la reparación por una daño directo al accionante producido a través del ambiente, sino una reparación genérica, a favor del ambiente, por esa lesión, como derivación de la tutela que impone el ordinal 50 de la Carta Magna. Lo ejercido por el accionante entonces encaja dentro del presupuesto legitimante de acción popular (artículo 10 inciso primero, numeral d) del CPCA), así habilitado por la normativa ambiental, en concreto, canon 106 de la Ley de Biodiversidad.

De ese modo, a la luz de los análisis elaborados en este acto, esta Cámara estima que la parte actora, como ciudadano en ejercicio pleno de sus derechos, y en aseguramiento del ejercicio de los derechos otorgados por la Constitución Política en el artículo 50 de la misma, ejerce en forma adecuada el derecho de defensa del medio ambiente contra las entidades que por decreto legal, eran las encargadas de proteger y asegurar la zona geográfica que se estima afectada en esta demanda; en consecuencia este Colegio, lo encuentra asistido por el interés legítimo y legitimación activa contra los aquí demandados, y al ser legalmente, estos últimos -Estado y SINAC-, los obligados directos para ejercer la protección de tales derechos, conforme lo ordenan los artículos 13 de la Ley Forestal y 131 y 59 de la Ley General de Administración Pública, se determina también, que los demandados se encuentran legitimados pasivamente en este proceso y por ende ambas excepciones deben rechazarse.

En cuanto a la excepción de Falta de Derecho que invocan los demandados, procede declarar la misma parcialmente con lugar, pues como ya se expuso no se estima procedente por quienes resuelven, que la declaratoria de daños y perjuicios contra los demandados permita la asignación de los montos estimados por ese concepto para ser administrados por ente u órgano distinto del MINAET, ni es procedente la creación de órgano alguno a través de este proceso judicial. En cuanto a las restantes pretensiones debe rechazarse tal excepción.

XX. SOBRE LA PERVIVENCIA DE LAS MEDIDAS CAUTELARES OTORGADAS

De conformidad con lo expuesto en el resultando número 6 de esta sentencia, existe en autos una medida cautelar en la cual se ordena al SINAC por resolución de las quince horas diez minutos del ocho de julio del año dos mil diez, se le obliga a la presentación de informes. Esta Cámara estima que ante el acogimiento de las pretensiones relacionadas con la disconformidad de las actividades desarrolladas por tal demandada, es prudente mantener las medidas otorgadas, y ampliarlas a fin de que se rindan conforme se ordenó en la resolución antedicha, informes detallados, en los mismos a partir de la firmeza de esta sentencia y hasta que conste pericialmente el cumplimiento de lo aquí ordenado en cuanto a la efectiva rehabilitación y restauración de la zona Patrimonio Natural del Estado, deberán indicarse por parte del Director del SINAC, bajo fe de juramento, las acciones realizadas para cumplir lo ordenado en esta sentencia y con ello, dar una debida protección a la zona afectada, garantizando con esta obligación legal, el ejercicio de las acciones de protección, bajo la vigilancia y estudio del propio jerarca institucional.

XXI. SOBRE COSTAS

En cuanto a la condena al pago de ambas costas de este proceso y los intereses correspondientes, siendo que se ha declarado parcialmente con lugar este asunto, y se han acogido la mayoría de pretensiones, de conformidad con la normativa vigente, al estimarse la actividad de los demandados disconforme con el ordenamiento, procede imponer a cargo de ambos demandados el pago de ambas costas de este proceso, a tono con lo estatuido con el numeral 191 del Código Procesal Contencioso Administrativo, sin que considere este colegio la concurrencia de causal alguna que permita aplicar los supuestos de excepción de la máxima de condena al vencido que se impone en esta temática. En cuanto a los intereses sobre las mismas, por haberlos peticionado expresamente la parte promovente, han de ser concedidos a partir de la determinación de su cuantía en la etapa de ejecución de sentencia y hasta su efectivo pago.

POR TANTO:

Se declaran sin lugar las excepciones de Falta de legitimación activa y pasiva, así como la defensa de falta de interés actual, interpuestas por los demandados. Se declara parcialmente con lugar la falta de derecho interpuesta por los demandados, únicamente en cuanto a la Creación del Consejo Regional Ambiental para el análisis discusión , denuncia y control de las actividades, programas y proyectos en materia ambiental y en cuanto a que se ordene a la Administración la suscripción de un convenio o contrato con alguna institución de Educación Superior Pública o Privada, Empresas o instituciones científicas nacionales o internacionales para que le sean girados los montos relativos a la indemnización que aquí se conceda. En consecuencia, se declara parcialmente con lugar la presente demanda incoada por Nombre142575 contra el Estado y el Sistema Nacional de Áreas de Conservación, en los siguientes términos, entendiéndose rechazada en lo no expresamente concedido:

  • 1)Se declara que el terreno ubicado en el sector de playa Sámara, Cangrejal ubicado entre meridianos 367.5 y 368 y entre paralelos 206.5 y 207, es integrante de la zona marítimo terrestre y corresponde a Patrimonio del Estado.
  • 2)Se declara disconforme con el ordenamiento jurídico la omisión de ejercicio de potestades de fiscalización y tutela administrativa no actuadas por el Área de Conservación Tempisque del MINAET sobre esa franja de terreno y se obliga al SINAC al pago de los daños y perjuicios ocasionados sobre la misma.
  • 3)Se ordena al SINAC, proceder dentro del plazo de QUINCE DIAS, a emitir la certificación de la zona comprendida entre los meridianos 367.5 y 368 entre paralelos 206.5 y 207, y remitir dicha certificación al Registro Nacional de Bienes Inmuebles para la debida inscripción de este inmueble como Patrimonio Natural del Estado;
  • 4)Se ordena al SINAC demarcar y rotular el inmueble objeto de este proceso como propiedad del Estado dentro del plazo de QUINCE DIAS NATURALES a partir de la firmeza de esta sentencia. Asimismo en el plazo de QUINCE DIAS aporten los demandados documental en la cual se indiquen los nombres y plazo de nombramiento de los miembros de Consejo Regional del Área de Conservación y la Comisión Nacional para la Gestión Ambiental, y en caso de no estar conformados estos órganos, dentro del plazo dicho proceda a la asignación de los representantes de los correspondientes sectores que le conforman.
  • 5)Se condena al Estado y al Sistema Nacional de Áreas de Conservación, de manera solidaria, al pago de los daños ambientales que se han producido en el sector de Cangrejal, Nombre41685 de Guanacaste, dentro del terreno ubicado dentro de las coordenadas meridianos 367.5 y 368, paralelos 206.5 y 207. La estimación y concreción de tales daños han de ser determinado en fase de ejecución de sentencia, a efectos de lo cual, debe ordenarse la realización de un dictamen pericial que posibilite establecer los daños concretos y la cuantía de los mismos. Fijada esa suma, la condena que sea establecida en fase de ejecución deberá ser incluida dentro del presupuesto del Ministerio de Ambiente y Energía, en una partida presupuestaria específicamente direccionada a la ejecución de acciones de reparación y rehabilitación de la zona aludida, partida que deberá ser administrada por el citado Ministerio o bien por la respectiva Área de Conservación. Se ordena comunicar el presente fallo a la Contraloría General de la República, a efectos que, de conformidad con la Ley No. 8131, disponga las acciones de ejecución presupuestaria que sea de mérito, respecto de esas partidas. Igual comunicación se dispone en cuanto a la Procuraduría General de la República, a efecto de que el Ministerio de Hacienda tome las previsiones financieras en el título presupuestario correspondiente.
  • 6)Son ambas costas del proceso a cargo de los demandados, más sus respectivos intereses, de manera solidaria, aspecto a establecer en fase de ejecución del presente fallo.
  • 7)Se amplía la medida ordenada por este Tribunal en resolución de las quince horas diez minutos del ocho de julio del año dos mil diez ordenándose al Director Ejecutivo del SINAC, que a partir de la firmeza de esta sentencia y hasta que conste pericialmente el cumplimiento de lo aquí ordenado en cuanto a la efectiva rehabilitación y restauración de la zona Patrimonio Natural del Estado; en los informes rendidos, deberán indicarse las actuaciones efectuadas a fin de dar efectivo cumplimiento a lo ordenado en esta sentencia en cuanto a la rehabilitación y restauración de la zona Patrimonio Natural del Estado y bajo fe de juramento deberán rendirse dichos informes.
  • 8)Notifíquese personalmente esta sentencia al Director Ejecutivo del SINAC para los fines del cumplimiento administrativo de lo aquí ordenado.
