JUDGMENT NO. 0704-F-12 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at sixteen hours and twenty-five minutes on ocho de junio de dos mil doce.- ORDINARY PROCEEDING filed by [Nombre1], of legal age, married once, businessperson, identity card number […], resident of San José, acting personally and as executor of the ESTATE PROCEEDING (SUCESORIO) OF [Nombre2], identity card […], who was of legal age and resided in the same locality; against [Nombre3], of legal age, single, identity card number […], resident of Guácimo. CONSIDERING:
I.The statement of grievances appearing at folio 261 and signed by the plaintiff is rejected because it was filed out of time.
IV.At folio 249, the plaintiff appeals the judgment issued at ocho horas y once minutos del veintiséis de agosto de dos mil once. He alleges the following errors: PROCEDURAL ERRORS:
V.First, the procedural challenges raised by the appellant must be resolved. The argument that this matter should have been heard by the court handling the probate proceeding, which serves as the basis for seeking a declaration that the judgment is null and void, is without merit. The grievance implicitly challenges jurisdiction to hear this case, an issue that is already procedurally foreclosed (precluído), given that the plaintiff itself filed its action in the civil court, which declared that it lacked jurisdiction, whereupon the action was assigned to this agrarian court. In addition, it should be emphasized that, although Article 900 of the Código Procesal Civil establishes the estate proceeding’s ancillary jurisdiction (fuero de atracción) over other proceedings, that provision does not apply in this case because a more recent provision exists, namely Article 113 of the Ley Orgánica del Poder Judicial, which provides that the agrarian courts shall hear matters pertaining to agrarian law regardless of the amount in controversy, as well as because of the principle of non-extendable jurisdiction (improrrogabilidad) set forth in the cited Article 15 of the Ley de Jurisdicción Agraria.
This grievance is therefore rejected, as no violations of the right of defense or of procedural rules that would permit any declaration of nullity have been established. Likewise, the claim concerning the defect of ultra petita is without merit. This Court does not find that the appealed judgment ruled ultra and/or extra petita, because it did not grant more than was requested or address matters not disputed in the proceeding. Contrary to the appellant’s contention, when rendering judgment, the adjudicator has a duty to address the merits of the action brought, specifically standing, present interest, and entitlement to relief, matters that must be reviewed even if they were not invoked by a party. Consequently, this grievance must be rejected. The argument that the facts should have been deemed admitted and the complaint deemed answered in the affirmative because the defendant did not answer is likewise without merit.
The provision applicable to this situation is Article 40 of the Ley de Jurisdicción Agraria, which provides: “...Upon service of process, the judge shall instruct the defendant that he must respond to each fact individually, stating whether he acknowledges it as true, rejects it as inaccurate, or admits it subject to variations or corrections; with the warning that, if he fails to do so, those facts to which he has not duly responded may be deemed proven.” Likewise, Article 43 of that law provides that a declaration of default does not necessarily entail admission of the facts alleged in the complaint and instead establishes that: “When ruling on the merits of the matter, the court shall do so in consideration of the evidentiary record ultimately produced in the proceeding, including any evidence ordered sua sponte to facilitate adjudication (para mejor proveer).” It should be noted that the procedural consequence the appellant seeks to have applied in this case is impermissible, because the matter must be resolved through an analysis of the evidence, and the adjudicator must not rely solely on the failure to answer, since agrarian matters require determination of the substantive truth (verdad real) of what occurred with a view toward the correct application of the law. Consequently, this claim must be rejected.
VI.In addition, the appellant disagrees with the assessment of the evidence (probanzas) made by the court below. The appellant is not correct. The judge dismissed the complaint in all respects and found that neither standing to sue (legitimación activa) nor standing to be sued (legitimación pasiva) had been established and, furthermore, that the alleged damages and losses (daños y perjuicios) had not been proven. This Court finds that the analysis conducted by the judge is consistent with the merits of the record. It must be noted that: “Damage (daño), in the legal sense, constitutes any impairment, loss, or detriment to a person’s property or non-property legal sphere, suffered by the injured party (damnificado), which results in the deprivation of a legally protected interest whose preservation could objectively have been expected had the harmful event not occurred. Under that premise, there is no civil liability (responsabilidad civil) in the absence of damage, just as there is no damage without an injured party.
Moreover, only damage that is proven as real or existing is compensable damage (daño indemnizable), this being a question of fact reserved to the sound discretion of the judge. In short, damage constitutes the detrimental disparity suffered by the victim, resulting from comparing the situation before the unlawful act with the situation thereafter (Judgment No. 66 at 14 hours 15 minutes on February 12, one thousand nine hundred ninety-nine)…Damage constitutes the loss sustained by the injured party (damnum emergens [damnum emergente]), whereas loss of profit consists of the frustrated profit or benefit, or that which was not received (lost profits [lucro cesante]), which could reasonably and probably have been expected had the unlawful act not occurred. Not every instance of damage gives rise to an obligation to provide compensation. For that purpose, the following characteristics must essentially be present for it to constitute ‘compensable damage’ (daño resarcible).
Damage includes, first, property damage (daño material) and bodily injury (daño corporal), the former affecting the material things or property comprising the person’s estate, while the latter affects bodily and physical integrity…” (No. 398-F-01, First Chamber of the Supreme Court of Justice, at 16:00 hrs on June 6, 2001). In this case, no suitable evidence was presented to demonstrate that the plaintiff had suffered any specific and quantifiable loss subject to valuation, or that he had failed to receive any reasonable profit or benefit claimed in the complaint as lost profits; therefore, the judge ruled correctly, because standing to sue was indeed not established. Furthermore, standing to be sued was not conclusively established, because the evidence in the record is insufficient to attribute to the defendant the actions alleged in the complaint, specifically in the third factual allegation of the complaint.
With respect to the testimonial evidence (prueba testimonial), although the witness [Nombre4], at folio 149, refers to acts committed by the defendant, her testimony does not clearly establish matters relevant to the judgment sought in the complaint. The witness [Nombre4] stated that the defendant had cut down trees, cut and removed timber from this property, cleared vegetation along the riverbank at [Dirección1] since 2004, pulled out fences, cut the posts, and took the wire. This Court notes that the quantity and species of the trees cut and the timber removed, the area of land cleared, the length of fencing cut, the number of posts cut, and the amount of wire taken cannot be clearly determined. Likewise, witness G, at folio 150, states that the defendant [Nombre5] cut down some trees that were there, removed timber, burned the entire passage with herbicide, removed wire, and took it away.
Nevertheless, it is not possible to determine when those events occurred, the quantity and species of trees cut or the amount of timber removed, or the amount of wire that he states was taken. That information should have been clearly established, because it is not appropriate to defer those matters to the enforcement-of-judgment stage (ejecución de sentencia), as they are inherent to the claim adjudicated in these proceedings and should have been established during the merits stage (fase de conocimiento); pursuant to the burden-of-proof principle (principio de carga probatoria), they should have been proven by the plaintiff (through the supplementary application of Article 317, subsection 1), of the Code of Civil Procedure). Similarly, the documentary evidence (prueba documental) submitted in the record is not useful for proving the damages and losses claimed in the complaint. A copy of criminal case file EXPN1 against [Nombre3], in which [Nombre4] appears as the injured party, and of case file EXPN2 (folios 1-95) was submitted with the complaint; however, these documents contain no relevant evidence establishing the alleged damages and losses identified in the complaint or that they were caused by the defendant.
At folio 41, there is a report prepared by the Area de Conservación Tortuguero under official letter ACTo-OSRPG-CP-080-09 concerning a complaint filed by [Nombre1] regarding the cutting of trees in a riparian protection zone (zona de protección ribereña); however, there is no indication that the defendant was responsible for that act. This Court notes that those documents, as well as the official letter at folio 98 addressed by the plaintiff to the Tribunal Ambiental, concern complaints that were filed but, by themselves, provide no relevant evidence establishing the relief sought by [Nombre1], because they do not permit specific verification of the alleged damages and losses or of the defendant’s responsibility. The certifications at folios 99-102 establish only that the plaintiff is the registered owner of the property recorded in the Limón registry district under registration number […], but they are not useful for proving that the defendant caused the related damages and losses.
In addition to the foregoing, as stated in the judgment under appeal, the judicial inspection (reconocimiento judicial) conducted in connection with the trial, according to the record appearing at folio 147, revealed neither the alleged damage nor indications of its existence. The judge recorded that, at the time of the inspection, there was no indication that plantings had been destroyed or crops uprooted, or that any posts had fallen or fences had been destroyed. Regarding the challenge to the assessment of the evidence obtained through examination of a party (prueba confesional), this Court does not agree with the appellant’s arguments because, as the court below correctly stated, such evidence must be analyzed together with the entirety of the evidence; as explained above, the evidence presented is insufficient to grant the plaintiff’s claims. Therefore, under the principle of free assessment of evidence (principio de libre valoración probatoria) governing this subject matter and pursuant to Article 54 of the Law on Agrarian Jurisdiction (Ley de Jurisdicción Agraria), the decision of the court below is consistent with the events established in the record, and it is inappropriate to give the evidence obtained through examination of a party due to the defendant’s default (prueba confesional en rebeldía) the effect asserted by the appellant.
To the contrary, this Court finds that the judge’s assessment is consistent with the evidence produced in the proceedings, as the judge explained the reason for assigning less weight to that evidence. For the foregoing reasons, this ground for appeal must be rejected.
VII.Regarding the challenge alleging that the judgment is unclear as to who is ordered to pay the damages and losses arising from the prejudgment attachment (embargo preventivo)—whether [Nombre1] personally or the estate—the appellant is not correct. It should be noted that the appellant did not file a motion for clarification of the judgment (gestión de aclaración de la sentencia) on this issue. The judgment under appeal clearly provided in Considerando V, at the reverse of folio 245, that the order to pay the damages and losses related to the prejudgment attachment applies to both plaintiff [Nombre1] and the estate of [Nombre2], that is, to both plaintiffs; consequently, this ground for appeal cannot be sustained.-
VIII.Finally, the appellant requests reversal of the judgment insofar as it orders the appellant to pay costs, asserting that the appellant acted in good faith. Pursuant to section 55 of the Law on Agrarian Jurisdiction, this Court finds that the appellant is correct. It can be inferred from the record that the plaintiff litigated in good faith because, although the plaintiff did not prove the matters claimed, the record shows that there had been previous disputes between the parties, which supports the decision to submit this dispute for adjudication before this court. In view of the disposition of the matter, the judgment under appeal must be partially reversed solely insofar as it orders the plaintiffs to pay both categories of litigation costs (ambas costas del proceso), and this matter shall instead be resolved without a specific award of costs (sin especial condenatoria en costas). In all other respects, the judgment shall be affirmed.

VOTO N° 0704-F-12 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las dieciséis horas veinticinco minutos del ocho de junio de dos mil doce.- PROCESO ORDINARIO interpuesto por [Nombre1], mayor de edad, casado una vez, empresario, cédula de identidad número […], vecino de San José, en su condición personal y como albacea del SUCESORIO DE [Nombre2], cédula de identidad […], quien fue mayor de edad, mismo vecindario; contra [Nombre3], mayor de edad, soltero, cédula de identidad número […], vecino de Guácimo. Intervienen Lic. Mario A. Mesén Araya en calidad de abogado director de la parte actora y Lic. Esteban Cubero Toruño como abogado director del demandado. RESULTANDO:
Redacta la Jueza Hurtado García, y;
CONSIDERANDO:
I.Se rechaza la aplicación de agravio memorial visible a folio 261, suscrito por el actor, toda vez que el mismo fue presentado en forma extemporánea.
IV.A folio 249, el actor interpone recurso de apelación contra la sentencia dictada a las ocho horas y once minutos del veintiséis de agosto de dos mil once. Aduce los siguientes agravios: DE FORMA:
V.En primer término, procede resolver sobre los embates de forma planteados por el recurrente. Tocante al alegato que este asunto debió conocerlo el juzgado que tramitaba la mortual, que sirve de fundamento para apelar a la declaratoria de nulidad de la sentencia, no es de recibo. El agravio combate implícitamente la competencia para el conocimiento de esta causa, lo cual es un tema precluído, siendo que la misma parte actora planteó su acción en sede civil y ésta se declaró incompetente quedando radicada la misma en esta sede agraria. Aunado a ello es menester destacar que si bien el artículo 900 del Código Procesal Civil establece el fuero de atracción de la sucesión sobre otros procesos, esa norma no resulta aplicable en esta causa, al existir norma más reciente, que es el artículo 113 de la ley Orgánica del Poder Judicial que regula los juzgados agrarios conocerán de lo relativo a la materia agraria cualquiera sea la cuantía, y por el principio de improrrogabilidad contemplado en el citado artículo 15 de la Ley de Jurisdicción Agraria.
De tal manera se rechaza este agravio, no habiéndose constatado a su vez violaciones al derecho de defensa, ni a normas procesales que permitan declarar nulidad alguna. Igualmente, no es atendible el reclamo referido al vicio de ultrapetita. Este Tribunal no observa se hubiese incurrido en ultra y/o extra petita en el fallo apelado, toda vez no se ha resuelto más de lo pedido, ni se ha hecho referencia a aspectos no debatidos en el proceso. Al contrario a lo esbozado por el recurrente, en la labor de emisión de la sentencia a la persona juzgadora le asiste el deber de referirse a los aspectos de fondo de la acción planteada, propiamente a la legitimación, interés actual, y al derecho, extremos que deberán revisarse aunque no fuesen invocados por la parte. Consecuentemente, deberá rechazarse este agravio. Por otro lado, tampoco es de recibo el alegato referido a que debió tenerse por afirmativos los hechos y por contestada afirmativamente la demanda, ya que el demandado no contestó.
La normativa aplicable ante este supuesto es el numeral 40 de la Ley de Jurisdicción Agraria, el cual establece: "...En el acto de emplazamiento, el juez prevendrá al accionado que debe contestar, uno a uno, los hechos, manifestando si los reconoce como ciertos o si los rechaza por inexactos, o bien, si los admite con variantes o rectificaciones; bajo el apercibimiento de que, si así no lo hiciere, podrán tenerse por probados aquellos hechos sobre los cuales no haya dado contestación en forma debida". Asimismo, el artículo 43 de dicha ley regula que la declaratoria de rebeldía no implicará necesariamente la admisión de los hechos de la demanda, y más bien establece que "El tribunal, al pronunciarse sobre el fondo del negocio, deberá hacerlo tomando en consideración el resultado de la prueba que en definitiva arroje el proceso, inclusive la que se hubiera ordenado para mejor proveer". Nótese, no es dable la consecuencia procesal que el apelante pretende se aplique en este caso, puesto que es en el análisis de las probanzas que se permitirá dilucidar el asunto, y no debe la persona juzgadora atenerse únicamente a la falta de contestación, pues impera la necesidad en materia agraria de determinar la verdad real de lo acontecido en miras de la aplicación correcta del derecho. Consecuentemente, deberá rechazarse este reclamo.
VI.Además, el apelante se muestra inconforme respecto a la valoración de las probanzas realizada por el juez ad quo. No lleva razón el recurrente. El juzgador rechazó la demanda en todos sus extremos, y estimó no se acreditó la legitimación activa, ni la legitimación pasiva, además que no se demostró la comisión de daños y perjuicios reclamados. Este Tribunal estima el análisis llevado acabo por el juzgador lo es al mérito de los autos. Es menester señalar que “El daño en sentido jurídico, constituye todo menoscabo, pérdida o detrimento de la esfera jurídica patrimonial o extrapatrimonial de la persona (damnificado), el cual provoca la privación de un bien jurídico, respecto del cual era objetivamente esperable su conservación de no haber acaecido el hecho dañoso. Bajo esa tesitura, no hay responsabilidad civil si no media daño, así como no existe daño si no hay damnificado. Por otra parte, sólo es daño indemnizable el que se llega a probar (realidad o existencia), siendo ello una cuestión de hecho reservada al prudente arbitrio del juzgador.
En suma, el daño constituye la brecha perjudicial para la víctima, resultante de confrontar la situación anterior al hecho ilícito con la posterior al mismo (Sentencia No. 66 de las 14 horas 15 minutos del 12 de febrero de mil novecientos noventa y nueve)…El daño constituye la pérdida irrogada al damnificado (damnum emergente), en tanto el perjuicio está conformado por la ganancia o utilidad frustrada o dejada de percibir (lucro cesante), la cual era razonable y probablemente esperable si no se hubiese producido el hecho ilícito. No cualquier daño da pie a la obligación de resarcir. Para tal efecto han de confluir, básicamente las siguientes características para ser un “daño resarcible”. A) Debe ser cierto; real y efectivo, y no meramente eventual o hipotético, no puede estar fundado en realizaciones supuestas o conjeturas…En lo relativo a la magnitud o monto (seriedad) del daño, ello constituye un motivo de incumbencia subjetiva única del damnificado, empero el derecho no puede ocuparse de pretensiones fundadas en daños insignificantes, derivadas de una excesiva susceptibilidad.
Por otro lado, la legitimación pasiva no se demostró fehacientemente, pues la prueba que consta en autos es insuficiente para atribuir al accionado las acciones que se imputan en la demanda, propiamente en el hecho tercero del libelo de demanda. Respecto a la prueba testimonial, la deponente [Nombre4] a folio 149, si bien hace referencia a hechos cometidos por el demandado no se logra desprender con claridad de su testimonio aspectos relevantes para la condenatoria que se pretende en la demandada. La declarante [Nombre4] expuso que el demandado ha cortado árboles, ha cortado y sacado madera de esta propiedad, ha chapeado el costado del río en el [Dirección1] desde el año 2004, arrancó cercas, los postes los cortó, y se llevó el alambre. Nota este Tribunal que no se desprende en forma clara la cantidad y especie de árboles cortados y madera, cantidad chapeada de terreno, longitud de la cerca cortadas, cantidad de postes cortados y alambre sustraído.
Asimismo, el testigo G folio 150 relata que el demandado [Nombre5]. cortó unos árboles que había, sacó madera, quemó todo el paso con herbicida, quitó alambre y se lo llevó. Sin embargo, no se logra inferir cuándo ocurrieron esos hechos, qué cantidad y especies de árboles se cortaron, así como la madera, y tampoco la cantidad de alambre que indica fue sustraído. Tal información debió ser acreditada en forma diáfana, puesto que no es pertinente diferir para ejecución de sentencia esos extremos por ser propios de la pretensión ventilada en autos, que debió acreditarse en la fase de conocimiento y de conformidad con el principio de carga probatoria debió acreditarlos la parte actora (en aplicación supletoria del artículo 317 inciso 1) del Código Procesal Civil). De igual modo, la prueba documental aportada en autos no es útil para demostrar los daños y perjuicios que se reclaman en la demanda.
Con la demanda se aporta copia del expediente penal EXPN1 contra [Nombre3] en la cual figura como ofendida [Nombre4], y del expediente EXPN2 (folios 1-95), empero de esta documentación no se extraen elementos de interés para demostrar los argüidos daños y perjucios señalados en la demanda, ni que fueran cometidos por el demandado. A folio 41 consta informe elaborado por el Area de Conservación Tortuguero según oficio ACTo-OSRPG-CP-080-09, en el cual se informa sobre denuncia planteado por el señor [Nombre1] por corta de árboles en zona de protección ribereña, sin embargo no consta que el demandado sea el autor de este hecho. Nota este Tribunal que esa documentación, así como el oficio a folio 98 dirigido por el actor al Tribunal Ambiental, son denuncias planteadas pero por sí mismas no aportan elementos de interés para acreditar los extremos reclamados por el señor [Nombre1], toda vez no permiten verificar en forma concreta daños y perjuicios invocados, ni la autoría del demandado.
Las certificaciones a folios 99-102 solamente permiten derivar la titularidad registral de la parte actora con relación a la finca inscrita al partido de Limón matrícula […], mas no son útiles para demostrar la comisión de los daños y perjuicios relacionados, por parte del demandado. Aunado en lo expuesto, como se relaciona en la sentencia impugnada, en el reconocimiento judicial realizado en ocasión del juicio, según acta visible a folio 147, no se evidenciaron los daños reclamados o indicios de su existencia. El juzgador hizo constar que en el momento de la visita no se observó que se hubiesen destruido siembros o arrancado cultivos, ni postes caídos, ni cercas destruidas. En cuanto al embate referido a la valoración de la prueba confesional, no se comparte lo expuesto por el apelante, en virtud que efectivamente como lo señaló el juez ad quo, a prueba confesional debe analizarse con el conjunto de las probanzas; y conforme se expuso anteriormente, la prueba evacuada es insuficiente para conceder las pretensiones del demandante, de forma tal que al amparo del principio de libre valoración probatoria que impera en esta materia, al tenor del artículo 54 de la Ley de Jurisdicción Agraria, lo resuelto por el juez ad quo es conforme a lo acaecido en autos, y no es pertinente otorgar a la prueba confesional en rebeldía del demandado los efectos que señala el recurrente.
Por el contrario, este Tribunal estima que la valoración llevada a cabo por el juzgador es adecuada a lo que arroja el proceso, siendo que se fundamentó el motivo por el cual se le resta valor a la prueba confesional. Por las razones citadas, deberá rechazarse este agravio.
VII.Concerniente al embate referido a que la sentencia no es clara en cuanto a quién se le condena a pagar los daños y perjuicios del embargo preventivo, si es a [Nombre1] en lo personal o al sucesorio, no lleva razón el recurrente. Debe destacarse que el recurrente no hizo uso de la gestión de aclaración de la sentencia sobre este aspecto. En la sentencia recurrida se dispuso con claridad en el Considerando V, a folio 245 vuelto, que la condenatoria al pago de los daños y perjuicios relacionados con el embargo preventivo lo es respecto al actor [Nombre1] y a la sucesión de [Nombre2], a los dos actores; por consiguiente no es de recibo este motivo de apelación.-
VIII.Finalmente, la parte recurrente solicita se revoque la sentencia en cuanto se le condena a pagar costas, y aduce ha actuado de buena fe. De conformidad con el numeral 55 de la Ley de Jurisdicción Agraria, estima este Tribunal lleva razón. Se infiere de los autos que la parte actora litigó de buena fe, puesto que si bien no demostró los extremos reclamados, sí se infiere de los autos que ha habido conflictos anteriores entre las partes, lo cual sustenta, hubiera sometido su controversia a conocimiento de esta sede. Por la forma en que se resuelve deberá revocarse parcialmente la sentencia recurrida únicamente en cuanto condena a los actores al pago de ambas costas del proceso, para en su lugar resolver este asunto sin especial condenatoria en costas. En lo demás procede confirmar la sentencia.
POR TANTO:
Se revoca parcialmente la sentencia recurrida, únicamente en cuanto condena a los actores a pagar ambas costas del proceso. En su lugar, se resuelve este asunto sin especial condenatoria en costas. En lo demás, se confirma la sentencia impugnada, en lo que fue objeto de apelación.
