FINDINGS OF PROCEDURAL HISTORY
I.This full-cognizance proceeding seeks a declaration that the Municipalidad de Pérez Zeledón caused him economic damages (daños económicos), which he estimates at cuarenta y dos millones quinientos setenta mil colones, losses (perjuicios) of diez millones de colones, and quince millones de colones in non-pecuniary damages (daño moral). He also seeks compound interest on those amounts, as well as payment of all legal costs (costas) of the proceeding (folios 1 al 4 of the matter sub judice).
II.Upon service of process, the defendant opposed the action and raised the defenses (excepciones) of lack of legal entitlement, lack of active and passive standing, and lack of a current interest; it further alleges that any right arising more than cuatro años before the filing of the complaint is time-barred. It also raised the preliminary defense of failure to exhaust administrative remedies (falta de agotamiento de la vía administrativa), which was denied by interlocutory ruling número 946-2011 (folios 52 al 101 of the record).
III.This proceeding was declared complex, pursuant to artículo 111 of the Código Procesal Contencioso Administrativo, and judgment has been issued in accordance with ordinal 47 of its regulations.
IV.The mandatory legal requirements have been observed in the proceedings, and no defects or omissions capable of rendering the proceedings void or denying the parties an opportunity to defend themselves are apparent. This decision is issued following deliberation, within the statutory period, and by majority vote.
Drafted by Judge Espinoza Salas, except with respect to the date from which indexation applies, and Nombre147 C O N S I D E Nombre5836 R I N G I)- FACTS: I.1)- PROVEN FACTS: The following facts relevant to the resolution of this matter are deemed proven because they are consistent with the evidentiary elements cited in support thereof:
I.2)- UNPROVEN FACTS: The plaintiff failed to prove: The specific extent of the damages suffered by the plaintiff company (the record).
The Municipalidad de Pérez Zeledón failed to prove: 1) That there was fault on the part of the victim (culpa de la víctima) or force majeure (fuerza mayor) in connection with the adverse effects caused by the Municipalidad de Pérez Zeledón garbage dump to the sugarcane crops cultivated by the plaintiff on the property in the Partido de San José, registration […] (the record). 2) That the garbage dump bordering the property leased by the plaintiff received technical, specialized, and adequate waste treatment that prevented the spread of scavengers, feral dogs, and vultures (the record).
I.3)- EVIDENCE ORDERED FOR FURTHER CONSIDERATION: At the oral trial, the documentation appearing at folios 238 a 355 of the record was admitted as evidence ordered for further consideration (prueba para mejor resolver), pursuant to ordinal 50.2 of the Código Procesal Contencioso Administrativo. Likewise, the testimony of Nombre33221 Mr. Nombre5307. was deemed withdrawn.
II.2) SPECIFIC CASE: Applying the foregoing to the resolution of this matter, we find that the claimant is partially correct in seeking a declaration that the Municipalidad de Pérez Zeledón is liable for the payment of damages for the harm caused to her sugarcane crops by the land on which that entity deposits garbage. As established by the proven facts, the witness testimony obtained, and the legal grounds set forth in substantive Considerando II.1, it is clear that the essential elements for determining the liability of the Municipalidad de Pérez Zeledón are present in this matter. As can be seen, there was an abnormal material administrative act (actuación administrativa material) by that territorial entity, consisting of the fact that the municipal garbage disposal site adjoining the property leased by the plaintiff for growing sugarcane is exposed to the elements and open to the sky.
In this regard, as determined in the second and third proven facts, the Municipalidad de Pérez Zeledón leased the properties registered in the Partido de San José, […], for the purpose of using them as a sanitary landfill (relleno sanitario). However, on the land leased for that purpose by the municipal entity, which adjoins the plaintiff’s crops on the property registered in the Partido de San José under folio […] (fourth and fourteenth proven facts), garbage is deposited in the open air (twentieth proven fact). Because the waste is permanently exposed to the environment, this situation results in the proliferation of vultures, scavengers, and feral dogs (twentieth proven fact). As the witness Nombre111924 stated: “The dogs lie in the sun in the furrows, there are flies, garbage is strewn about, vultures move around in large flocks, and burning takes place.” Similarly, the expert witness Don Nombre5836. was unequivocal in his expert opinion and in his statements at trial that, because of the operation of the garbage dump, there are problems caused by the incursion of scavengers, approximately two hundred feral dogs have proliferated, as have large numbers of vultures, such that there is no sanitary landfill, but rather an open garbage dump (botadero de basura).
Furthermore, as stated in the nineteenth proven fact, the situation is aggravated because the boundary between the garbage disposal site and the property leased by the plaintiff for growing sugarcane consists of shrubs, allowing the garbage to pass through them. As stated by Mr. Nombre111925 in his testimony and by Engineer Nombre5836. in his expert report, garbage was found along the boundary between the property and the municipal garbage dump, while flocks of vultures and packs of feral dogs were observed within the dump itself and in the sugarcane crops. They further stated that, on the land leased by the municipality, garbage could be seen in the open air together with vultures, as well as a depression in the terrain resembling a large pit that was covered with voluminous quantities of garbage and waste. The abnormality of this conduct stems from the fact that, for the proper provision of a public garbage-collection service, it is not sufficient for a municipal entity merely to collect garbage and deposit it, without any treatment, on land leased for that purpose.
The respondent entity did not establish in the proceedings that the garbage was being properly disposed of through technical management and special monitoring, in accordance with the provisions governing sanitary landfills, so as to prevent pollution, harm to neighboring properties, and environmental damage. Accordingly, it constitutes anomalous, abnormal, and improper conduct for the Municipality merely to establish a waste dump without prior preparation and without adequate oversight, thereby failing to comply with the Reglamento sobre Rellenos Sanitarios, number 27378 of nueve de octubre de 1998, as well as Sections 278 through 284 of the Ley General de Salud, which were in force at the time of the events and expressly require the use of suitable means for the collection, transportation, accumulation, utilization, treatment, and final disposal of garbage. It is clear to the Court that collecting and accumulating a canton’s garbage is a lawful activity, but it must be performed in compliance with a series of technical requirements intended to reduce not only health risks but also harm to third parties, requirements that clearly were not met in this case.
With respect to the requirement of injury, or the existence of unlawful harm (daño antijurídico), this administrative conduct did in fact adversely affect Mr. Nombre147.’s assets, causing him an unlawful and compensable injury that he has no duty to bear—objective unlawfulness (antijuridicidad objetiva)—within the meaning of Section 196 of the Ley General de la Administración Pública. It cannot be justifiably argued that, because the plaintiff is not the owner of the property, she could simply have moved to another property, an inherently burdensome and unfeasible course of action given the intrinsic difficulty of finding available land suitable for growing sugarcane and the considerable number of years during which she has carried out that agricultural activity on the property. It is therefore possible to identify a serious and particular burden that the plaintiff company is not obligated to bear, which forms the basis of the liability declared in this case under the standards of strict liability (responsabilidad objetiva) applicable to the Administration.
Thus, the public entity was authorized to carry out its public activity, but it was required to assume liability for any harm it might cause. Accordingly, in further support of the foregoing, there is an evident causal nexus (nexo causal), that is, a cause-and-effect relationship between the alleged act and the resulting harm, which gives the claimant standing to bring the damages action; nor did any grounds for breaking the causal nexus arise, such as force majeure (fuerza mayor) or contributory fault of the victim (culpa de la víctima), as alleged by the respondent. Moreover, a review of the record does not reveal any unforeseeable and unavoidable natural events that would exempt the Municipalidad de Pérez Zeledón from liability. Rather, as stated above, the packs of dogs, flocks of vultures, and flies arose and proliferated because of the manner and condition in which the garbage was kept, which plainly attracted those harmful conditions.
As the expert witness determined, all these events harmful to Nombre111923.’s sugarcane crops occurred because the Municipalidad de Pérez Zeledón did not maintain on that land a proper sanitary landfill complying with the above-cited rules governing the subject, where the waste would be treated, but instead maintained only a garbage dump and disposal site. Nor did the respondent benefit from the defense of a third party’s act (hecho de un tercero), because the plaintiff did not engage in any conduct that, through carelessness, negligence, or inexcusable recklessness, caused the injury. Rather, the harm to her crops was caused by the deposit of garbage on the land leased for that purpose by the Municipalidad de Pérez Zeledón, which adjoined the land on which the plaintiff cultivated her crops. As to the injury caused to the plaintiff, as stated in the twenty-first and twenty-second proven facts, it consists of the damage caused to the six hectares of the claimant’s crops adjoining the garbage disposal site, resulting in reduced income from the sale of the product and increased production costs, as shown by the statements of Mr.
Nombre3640. and the expert report of Engineer Nombre5836. The economic harm therefore caused the aforementioned injury to the plaintiff. Furthermore, the proliferation of vultures and feral dogs adversely affected soil compaction and resulted in the creation of trails, dens, and excavations by those animals on the land. Although the land leased by the claimant for growing sugarcane covers more than eighteen hectares, only the six hectares adjoining the garbage disposal site were affected; the compensation awarded is therefore limited exclusively to that area and portion of cultivated land. In this regard, the expert opinion, which the Court endorses, is clear that the injury occurred solely on the six hectares adjoining the garbage disposal site, where damage resulted from reduced harvest income and increased planting and maintenance costs. The compensable period will be specified when ruling on the statute-of-limitations defense (excepción de prescripción) raised by the respondent.
However, the alleged damage corresponding to reduced harvest income and increased planting and maintenance costs for the years following the filing of the complaint must be denied because it concerns hypothetical, future, contingent, and uncertain events that are not compensable, as they do not satisfy the statutory requirements of being certain, actual, real, assessable, and individually ascertainable under the cited Section 196. As to the amount to be used as the basis for determining the compensable years, because the items to be awarded for each year—both for reduced income and for increased planting costs relating to the six hectares—were not established with sufficient clarity, their determination shall be deferred to the judgment-enforcement stage (ejecución de sentencia). In this case, no specific amount of damages in favor of the plaintiff can be established because of insufficient evidence; nevertheless, the existence of the harm is evident to the Court.
All of this permits the claim to be recognized in the abstract so that it may be calculated and its quantum determined during enforcement of the judgment, thereby ensuring effective judicial protection (tutela judicial efectiva) under Article 41 of the Constitution and Article 122 of the Código Procesal Contencioso Administrativo. Furthermore, the amounts established must be indexed (indexadas) in accordance with Section 123 of the Código Procesal Contencioso Administrativo from the date the judgment specifically establishing them becomes final until they are actually paid. Likewise, statutory civil interest (intereses legales civiles) must be awarded pursuant to Section 1163 of the Código Civil on those amounts from the date the judgment becomes final until they are actually paid.
II.3) REGARDING THE CLAIMED SUBJECTIVE NON-PECUNIARY DAMAGE (DAÑO MORAL SUBJETIVO): The plaintiff assesses the subjective non-pecuniary damage caused by the municipal authorities’ actions at fifteen million colones. In this regard, it should be noted that a simple presumption of fact (presunción de hombre) is sufficient to prove such damage and that the judge, as an expert among experts, is qualified to determine its quantum, because it entails an unjust disturbance of the person’s emotional state and does not require direct evidence, being left to the judge’s equitable assessment (Judgment of the Sala Primera de la Corte Suprema de Justicia number 555-F-99, issued at 15:15 hours on 16 de setiembre de 1999). Accordingly, its determination is subject to the nature of the events, the type of harm, and the principles of reasonableness, proportionality, sound judicial assessment (sana crítica), logic, justice, and prudence, which limit the judge’s discretion.
In view of the foregoing, and taking into consideration that the damage suffered by her crops for several years as a direct consequence of the dumping of garbage clearly caused emotional harm, and that she was forced to endure the distress caused by the invasion of feral dogs, damage caused by scavengers, vultures, and the surrounding garbage, it is appropriate and reasonable to award the claimant five hundred thousand colones for subjective non-pecuniary damage. That amount must be adjusted for inflation (indexada) under section 123 of the Código Procesal Contencioso Administrativo from the date the judgment specifically establishing it becomes final until actual payment, together with statutory civil interest, pursuant to section 1163 of the Código Civil, on that amount from the date the judgment becomes final until actual payment. The in re ipsa determination of that prudentially fixed amount is justified because it is appropriate, proportionate, and reasonable in light of the emotional distress, worry, sadness, and anxiety that an event of this nature causes a farmer, who constantly strives to ensure that the fruits of her labor are rewarded with adequate production, such that abnormal circumstances like the described invasion of pests resulting from the garbage dump frustrate her legitimate aspirations.
The amount is appropriate because the harm to her crops was partial rather than total, since only six hectares of the entire cultivated property were damaged; therefore, the compensation awarded fairly remedies the psychological harm caused by that partial injury.
II.4) REGARDING THE STATUTE-OF-LIMITATIONS DEFENSE (EXCEPCIÓN DE PRESCRIPCIÓN) RAISED BY THE DEFENDANT: Extinctive prescription (prescripción extintiva), negative prescription (prescripción negativa), or liberative prescription (prescripción liberatoria) is intended to protect social order and legal certainty in legal relationships. It is defined as a period established by the legal system for asserting a right, and its existence is grounded in considerations of legal certainty. Its essential elements are the passage of time, inaction by the right-holder, and the beneficiary’s intent to invoke it, whether by means of a claim or a defense. It is characterized by eliminating an objective state of uncertainty; it is a means of extinguishing obligations; it may not be declared sua sponte, but only at the request of an interested party; it may be waived tacitly or expressly, provided the waiver is not made in advance; and it may be interrupted or suspended (see, to that effect, the judgment of the Sala Primera de la Corte Suprema de Justicia Nº 120, issued at 15:00 hours on 20 de julio de 1992.).
“In general terms, the limitation period runs from the day on which the right could have been asserted or, in other words, from the time the claim or right arose.” (Pérez Vargas Víctor. Derecho Privado. Litografía e imprenta Lil. 1994. Tercera edición. San José, Costa Rica, página 199.). Nevertheless, it may be interrupted or suspended, which prevents it from running and precludes the enforceable situation from arising, such that when interruption of the limitation period occurs, “the period begins to run anew, and the time elapsed before the interruption may not be added.” (Pérez Vargas Víctor, Op. Cit. página 203). The grounds for interruption are expressly established in sections 875, 876 Y 879 of the governing Code, which provide: ARTICLE 875.- “Acquisitive prescription (prescripción positiva) is interrupted when the possessor is deprived of possession of the property or enjoyment of the right for one year, unless either is recovered through judicial proceedings.
ARTICLE 876.- All prescription is civilly interrupted: 1º.- By the possessor’s or debtor’s tacit or express acknowledgment in favor of the owner or creditor of the property or right sought to be acquired by prescription; and 2º.- By service of judicial process, attachment, or sequestration notified to the possessor or debtor. ARTICLE 879.- Negative prescription is also interrupted by any judicial or extrajudicial action undertaken to collect the debt and secure performance of the obligation.” As to suspension of the limitation period (suspensión de la prescripción), “the right is already enforceable and has already come into legal existence; nevertheless, its exercise is hindered by the special circumstances of the person or persons in the relationship (...) these are cases in which the limitation period does not run (...) giving rise to two possibilities: a) if the ground for suspension predates the enforceability of the legal situation, it operates analogously to what is known as an impediment: the limitation period begins to run when the ground ceases to exist; b) when the ground for suspension arises subsequently, the period during which that ground remains in existence is not counted and is added to the subsequent period.” (Pérez Vargas Víctor, Op. Cit. página 201 y 202).
This occurs because exercise of the right is impossible, in the circumstances identified by section 880 of the governing Code, which provides: “The limitation period shall not run: 1º.- Against minors and persons lacking legal capacity while they have no guardian or curator representing them in accordance with the law. 2º.- Between parents and children while parental authority continues. 3º.- Between minors or persons lacking legal capacity and their guardians or curators, for the duration of the guardianship or curatorship. 4º.- Against military personnel on active duty during wartime, whether within or outside the Republic. 5º.- Against an unadministered estate, while there is no executor who has accepted the appointment. 6º.- Against day laborers and domestic servants with respect to their wages or salaries, while they continue working for or serving the person who owes them. 7º.- In favor of a debtor who, through unlawful acts, has prevented a creditor from exercising the claim.” The statutory basis governing prescription in matters involving the liability of the Public Administration is set forth in sections 190 to 213 of the Ley General de la Administración Pública, which provide that the right to claim compensation from the Administration shall prescribe four years after the event giving rise to liability.
Nevertheless, as held by the Sala Primera de la Corte Suprema de Justicia in judgment number 606-F-2002, issued at 16:10 hours on siete de agosto del 2002, in civil proceedings involving the Treasury (procesos civiles de hacienda), consideration must be given to the fact that the damage may occur or become apparent some time after the conduct in question; consequently, that limitation period begins to run when the damaging events become certain or known. Applying the foregoing to this case, the defendant entity raises the statute-of-limitations defense, arguing under section 198 of the Ley General de la Administración Pública that claims arising more than four years before the filing of the complaint must be declared time-barred. In this regard, the statute-of-limitations defense must be partially sustained, but not as of the date asserted by the defendant; rather, it applies from four years before the administrative claim (reclamo administrativo) was filed with the Municipalidad de Pérez Zeledón.
As stated in proven fact eleven, through a written submission filed with the Municipalidad de Pérez Zeledón on 30 de julio del 2009, the claimant submitted an administrative claim for damages in which she stated that her crops had been damaged on the property located in Pérez Zeledón under registration number […], adjacent to the garbage dump. That legal act was sufficient to interrupt the limitation period, as provided in section 879 of the Código Civil. Accordingly, all damages claimed by the plaintiff that arose before 30 de julio del 2005 must be declared time-barred. Thus, the damage caused by the fire that the plaintiff states occurred at the garbage dump, as established in proven facts five through twelve, as well as the damage to the boundary fence that she states burned in the fire of 1999, is time-barred.
II.5)- DEFENSES: The respondent raises the defenses of lack of legal entitlement (falta de derecho), lack of standing to sue and be sued (falta de legitimación activa y pasiva), and lack of a current interest (falta de interés actual). It also asserts the statute of limitations (prescripción) with respect to all rights arising more than four years prior to the filing of the complaint and requests at the trial hearing that the defense of failure to exhaust administrative remedies (agotamiento de la vía administrativa), which had been denied in an interlocutory ruling, be granted. In this regard, it must be stated that the preliminary defense of failure to exhaust administrative remedies must indeed be rejected. In ordinary civil proceedings involving the Public Treasury (procesos ordinarios civiles de hacienda), such as this one, in which no challenge to municipal resolutions is involved, mandatory exhaustion of administrative remedies does not apply.
As the Constitutional Chamber of the Supreme Court of Justice correctly stated in ruling 3669-2006 at 15:00 hours on 15 de marzo del 2006, exhaustion of administrative remedies is optional rather than mandatory and is required only when municipal resolutions are challenged under constitutional Article 173, or pursuant to constitutional Article 184 in matters of government contracting (contratación administrativa); in all other cases, it ceases to be a mandatory prerequisite for the admissibility of an administrative-law proceeding (proceso contencioso administrativo). Accordingly, in claims for damages (reclamos indemnizatorios) such as this one, in which the strict liability (responsabilidad objetiva) of the municipal entity is at issue and no challenge to municipal resolutions is involved, exhaustion of administrative remedies should not be required, because the matter at issue is not the legality of the administrative act issued, but rather the civil liability of the municipal entity.
The defense of lack of standing to sue and be sued is rejected, because the damages claimed by the plaintiff, arising from the harm caused to his sugarcane crops by the municipal entity’s dumping of garbage, establish both the plaintiff’s standing to sue and the cited Municipality’s standing as respondent. Although the claimant is not the owner of the affected property, he does hold a lease (contrato de arrendamiento), which confers upon him an individual right (derecho subjetivo) to bring this action. The defense of lack of a current interest is rejected; there undoubtedly existed, when the complaint was filed, a genuine need, utility, and legitimate benefit to the plaintiff in seeking the relief claimed in these proceedings, and that interest remains at the time judgment is rendered. Finally, for the foregoing reasons, the defense of lack of legal entitlement raised by the respondent is partially rejected and must be deemed granted as to any relief not expressly awarded, because, pursuant to the cited provisions, the evidence submitted, and the factual grounds set forth, the plaintiff is partially entitled to the right invoked in support of his claims, which, as stated, arise under Articles 190 et seq. of the Ley General de la Administración Pública, because he suffered damages as a result of the challenged administrative conduct.
THEREFORE:
By majority decision, the defenses of lack of standing to sue, lack of standing to be sued, and lack of a current interest are rejected. The action brought by Mr. Nombre147. against Nombre33221 a Municipalidad de Pérez Zeledón is declared partially meritorious; the defense of lack of legal entitlement is partially granted as to any relief not expressly awarded and denied as to the relief granted. Consequently, Nombre33221 a Municipalidad de Pérez Zeledón is ordered to pay Mr. Nombre147. the damages caused to his sugarcane crops from 30 de julio del 2005 through 05 de agosto del 2010, consisting of the reduction in his income from the sale of the product and the increase in the production costs for six hectares. That amount shall be determined during the judgment-enforcement stage (ejecución de sentencia) and shall be indexed from the date on which the judgment specifically establishing it becomes final until actual payment, together with civil legal interest pursuant to Article 1163 of the Código Civil, from the date the judgment becomes final until actual payment.
Nombre33221 a Municipalidad de Pérez Zeledón is further ordered to pay Mr. Nombre147. the sum of five hundred thousand colones as compensation for subjective emotional distress (daño moral subjetivo). That amount shall be indexed from the date on which the judgment specifically establishing it becomes final until actual payment, together with civil legal interest pursuant to Article 1163 of the Código Civil, from the date the judgment becomes final until actual payment. The statute-of-limitations defense is partially granted, and the damages claimed for dates prior to 30 de julio del 2005 are declared time-barred. DISSENTING OPINION I concur with my colleagues in the decision; however, I depart from their interpretation regarding the date from which indexation of the amounts awarded in the judgment begins to run, which, according to the respected majority’s position, is the date on which the judgment specifically establishing those amounts becomes final. In the undersigned judge’s view, however, indexation in the case of value-based obligations (obligaciones de valor) must run from the date on which the judgment awarding them becomes final, without postponing that date until a specific amount has been determined; in the case of monetary obligations (obligaciones dinerarias), it must run from the date the expenditure was incurred. Accordingly, to establish full and complete compensation (indemnización integral y plena) and avoid harming the litigant, indexation must begin when the obligation is established, adjudged, and recognized.
Given the nature of this legal mechanism (instituto), which seeks to bring preexisting monetary obligations to their present value or to update, as of the date of judgment, value-based obligations recognized therein, its application must not, in the case of obligations declared in the abstract, be deferred until the judgment entered in the enforcement proceedings that determines their amount becomes final, because the right has already been declared and established. Likewise, if the amount of compensation has already been determined in the judgment, as in the present case, in which five hundred thousand colones was awarded for emotional distress (daño moral), there is even less reason to postpone until later stages, to the detriment of the prevailing party, the court’s duty on its own motion to index those amounts. Although Article 123 of the Código Procesal Contencioso Administrativo clearly provides that a monetary obligation recognized in a judgment shall be updated from the date it becomes due and payable, Article 124, subsections one and two, states with respect to value-based obligations that, once converted into money, the enforcement judge (juez ejecutor) shall update them, but does not indicate the date from which such updating must begin.
Therefore, the logical interpretation, based on the principle of full and complete reparation (reparación integral y plena), is that when determination of the amount during enforcement and its subsequent payment are deferred, it is reasonable for the updating to run from the date the obligation was declared in the judgment until actual payment. Hence, in the case of value-based obligations whose amounts are fixed in the judgment awarding them, there is even less reason to defer indexation until later stages. Although the statutory provision states that a value-based obligation shall be updated once converted into a monetary obligation, this is because, logically, indexation cannot be applied to an unquantified amount; it does not, however, mean that such updating should begin only when the enforcement judge determines the amount.

San José, a las quince horas del quince de marzo del año dos mil doce.- Proceso de conocimiento, interpuesto por el señor Nombre147., […], representado por su apoderado especial judicial el Licenciado Felipe Barbas Jiménez, […], en contra de la Municipalidad de Pérez Zeledón, representada por la señora Nombre5836., […], y por sus apoderados especiales judiciales los licenciados Greivin Vindas Mejías, […] y Jimy Arias Dávila, […] abogados. Tramitado bajo el expediente número 10-002478-1027-LA.
RESULTANDO
I.Con el presente proceso de conocimiento se acciona con el objeto de declarar que la Municipalidad de Pérez Zeledón le produjo daños económicos los cuales estima en la suma de cuarenta y dos millones quinientos setenta mil colones, perjuicios por diez millones de colones y quince millones de colones de daño moral. Requiere además el interes de intereses sobre dichas sumas, así como el pago de ambas costas del proceso (folios 1 al 4 del subjudice).
II.Conferido el traslado de rigor, la accionada se opuso a la acción e interpuso las excepciones de falta de derecho, falta de legitimación activa y pasiva y la falta de interés actual, alega además la prescripción de todo derecho anterior a los cuatro años previos a la interposición de la demanda . Formula también la defensa previa de falta de agotamiento de la vía administrativa la cual se rechazó interlocutoriamente mediante resolución número 946-2011 (folios 52 al 101 de los autos).
III.Que el presente proceso se declaró de trámite complejo, conforme con el artículo 111 del Código Procesal Contencioso Administrativo y la sentencia se ha dictado de acuerdo con el ordinal 47 de su reglamento.
IV.En los procedimientos se han observado las prescripciones legales de rigor, y no se observan vicios u omisiones susceptibles de producir nulidad de lo actuado o indefensión a las partes. Se dicta esta resolución previa deliberación, dentro del término de ley y por mayoría.
Redacta el juez Espinoza Salas , salvo en lo referente al plazo a partir del cual rige la indexación y , Nombre147 O N S I D E Nombre5836 A N D O I)- SOBRE LOS HECHOS: I.1)- HECHOS PROBADOS: Se tienen por demostrados los siguientes hechos de interés para la resolución de este asunto, por ser contestes con los elementos de convicción que en su apoyo se citan: 1) Que mediante contrato de arrendamiento de inmueble celebrado en el año de 1991, entre la M.S.A. y el señor Nombre147., la primera en su condición de propietaria del fundo del Partido de San José, […], le arrenda cuatro hectáreas de este inmueble al señor Nombre147. con el objeto de destinarlo al cultivo de azúcar, las cuales se extenderán en 1992 a ocho hectáreas (folio 6 del expediente administrativo de reclamo por daños y perjuicios). 2 ) Que por contrato de arrendamiento número AJ-3262 efectuado el 23 de ju n io de 199 7 , la Municipalidad del Pérez Zeledón alquiló el inmueble matrícula de folio real […], propiedad de la señora Nombre317., […], para destinarl a a relleno sanitario (folios 135 al 148 de los autos). 3 ) Que mediante contrato de arrendamiento número AJ-3901 celebrado el 31 de julio de 1998, la Municipalidad del Pérez Zeledón alquiló el inmueble matrícula […], propiedad del señor Nombre33221., para destinarlo a relleno sanitario (folios 118 al 119, 131 a 134 de los autos , así como ).
I.2)- HECHOS NO PROBADOS: No demostró la actora : El alcance concreto de los daños y perjuicios sufridos para la sociedad actora (los autos).
No demostró la Municipalidad de Pérez Zeledón : 1) Que haya habido culpa de la víctima o situaciones de fuerza mayor en las afectaciones causadas por el depósito de basura de la Municipalidad de Pérez Zeledón a las siembras de caña de azúcar que el actor desarrolla en la propiedad del partido de San José matrícula […] (los autos). 2) Que al depósito de basura que colinda con la propiedad que arrenda la actora le haya dado un tratamiento técnico, especial y adecuado de los desechos que impidiera la propagación de buzos, perros salvajes y zopilotes (los autos).
I.3)- PRUEBA PARA MEJOR RESOLVER: En el juicio oral se admitió como prueba para mejor resolver de conformidad con el ordinal 50.2 del Código Procesal Contencioso Administrativo, la documentación que rola a folios 238 a 355 de los autos. Asimismo, se tuvo por desistido el testimonio de Nombre33221 señor Nombre5307.
II.2) CASO CONCRETO: Aplicado, lo anteriormente expuesto a la resolución del presente asunto, tenemos que lleva razón parcialmente la gestionante en sus pretensiones al accionar con el objeto de que se declare la responsabilidad a cargo de la Municipalidad de Pérez Zeledón del pago de daños y perjuicios por los daños causados en sus cultivos de caña de azúcar a causa del terreno en el cual tal entidad deposita la basura. Tal y como se acreditara en los hechos probados, las declaraciones testimoniales recabadas y del fundamento jurídico expresado en el considerando de fondo II.1, es claro que acaecen en el presente asunto los elementos esenciales para determinar la responsabilidad de la Municipalidad de Pérez Zeledón. Como se observa, hay una actuación administrativa material anormal de tal ente territorial consistente en que el depósito de basura municipal que colinda con la propiedad que arrenda la actora para el cultivo de caña de azúcar se encuentra a la interperie y a cielo abierto.
Al respecto, como se determinara en los hechos probados segundo y tercero, la Municipalidad de Pérez Zeledón arrendó los inmuebles del Partido de San José, […], con el objeto de destinarlos para relleno sanitario . Sin embargo, en el terreno arrendado al efecto por el ente Municipal y que colinda con los cultivos del actor en el inmueble del Partido de San José matrícula […] (hecho probado cuarto y catorce), la basura es depositada al aire libre (hecho probado veinte). Tal situación produce, que ante la exposición permanente al medio ambiente de los desechos, que proliferen zopilotes, buzos y perros salvajes (hecho probado veinte). Como lo expresara el testigo Nombre111924 . "los perros se asolean en los surcos, hay moscas, la basura está tirada, los zopilotes andan en grandes bandadas y se hacen quemas". En igual sentido, el perito Don Nombre5836., es contundente en su experticia y en las manifestaciones que expresara en juicio, que debido al funcionamiento del basurero hay problemas por la invasión de buzos, han proliferado alrededor de doscientos perros salvajes y gran cantidad de zopilotes, de modo que no existe un relleno sanitario, sino un botadero de basura.
Además, como se expusiera en el hecho probado diecinueve, la situación se agrava porque entre el depósito de basura y el inmueble alquilado por la actora para el cultivo de caña de azúcar los linderos se encuentran compuestos por arbustos, produciendo que la basura los traspase, como lo expresara en su declaración el señor Nombre111925 en su informe pericial el Ingeniero Nombre5836., se constata la existencia de basura en la colindancia de su propiedad con el botadero de basura municipal y dentro del botadero y en los propios cultivos de caña de azúcar manadas de zopilotes y de perros salvajes. Además, expresan que en el terreno que arrenda la municipalidad se observa la basura a cielo abierto con zopilotes, y un desnivel de terreno como especie de gran orificio que se encuentra cubierto con cantidades voluminosas de basura y desperdicios. La anormalidad de tal conducta, se deriva del hecho de que no es suficiente para la adecuada prestación de un servicio público de recolección de basura, que un ente municipal simplemente haga acopio de ella y la deposite sin tratamiento alguno en un terreno alquilado al efecto.
No acreditó en el proceso la entidad accionada que a la basura se le estuviera dando la adecuada disposición, dándole un manejo técnico y vigilancia especial, conforme a las disposiciones que rigen los rellenos sanitarios, para evitar la contaminación, la afectación de los fundos vecinos y los daños al medio ambiente. En mérito de ello, constituye una conducta anómala, anormal e indebida el que simplemente se limite la Municipalidad a constituir un vertedero de desechos sin preparación previa y sin un control adecuado, incumpliéndose así el Reglamento sobre Rellenos Sanitarios, número 27378 del nueve de octubre de 1998, así como los ordinales 278 al 284 de la Ley General de Salud, vigentes al momento de los hechos, que expresamente obligan a utilizar los medios idóneos para la recolección, el transporte, acumulación, utilización, tratamiento y disposición final de la basura. es claro para el Tribunal que al recolección y acopio de la basura de un cantón es una actividad lícita, pero debe realizarse en cumplimiento de una serie de requerimientos técnicos para disminuir no solo los riesgos en salud, sino también las afectaciones a terceros, que en este caso es evidente que no se cumplieron.
Respecto al presupuesto de la Lesión o existencia de un daño antijurídico, efectivamente, de tal conducta administrativa se observa una afectación al señor Nombre147. en su esfera patrimonial, produciéndole una lesión antijurídica y resarcible que no tiene el deber de soportar (antijuridicidad objetiva), en los términos del ordinal 196 de la Ley General de la Administración Pública. Sin que sea justificable alegar que al no ser el propietario del fundo la actora, bien pudo haber cambiado de propiedad, circunstancia de por si sumamente gravosa no viable, debido a la dificultad intrínseca de encontrar terrenos disponibles y aptos para el cultivo de caña y debido a la considerable cantidad de años que lleva desarrollando tal actividad agrícola en dicho fundo. De manera que es posible ubicar un sacrificio intenso y singular que la sociedad actora no se encuentra en la obligación de soportar, siendo esta la base de la responsabilidad declarada en este caso, bajo los parámetros de la responsabilidad objetiva que cubre a la Administración.
De manera que el ente público estaba facultado para desplegar su actividad pública, pero asumiendo la responsabilidad de las afectaciones que pudiera haber producido. Así las cosas, en abono a lo expuesto, se aprecia un evidente nexo causal, una relación de causa a efecto entre el hecho que se imputa y el daño producido que legitiman al promovente para incoar la acción indemnizatoria, y sin que hayan acontecido causales de exclusión del nexo de causalidad como la fuerza mayor y la culpa de la víctima que alegara la accionada. Ahora bien, del estudio de los autos, no se observa que acontecieran hechos de la naturaleza imprevisibles e inevitables que eximan de responsabilidad a la Municipalidad de Pérez Zeledón, sino que las manadas de perros, de zopilotes y las moscas, se han generado y proliferado, como se expresó, por la forma y condición en que se encuentra la basura, siendo un foco de atracción evidente de tales situaciones perjudiciales.
Como lo estableciera el señor perito, al no tener en tales terrenos la Municipalidad de Pérez Zeledón un adecuado relleno sanitario que fuera conforme con la normativa supracitada que rige la materia, en el cual se le diera tratamiento a los desechos, sino que había un mero botadero y depósito de basura, es que se generaron todos estos hechos perjudiciales para las cosechas de caña de azúcar de Nombre111923 . Tampoco acaeció en beneficio de la accionada la eximente de responsabilidad del hecho de un tercero, porque la actora no ha generado conducta alguna que por su descuido, negligencia e imprudencia inexcusable, haya producido la lesión, sino que más bien las afectaciones a sus cosechas se produjeron por el depósito de basura en los terrenos que arrendara al efecto la Municipalidad de Pérez Zeledón, que colindaban con los terrenos donde el actor ejerce sus cultivos. Respecto a la lesión generada al actor, ésta estriba, como se expresara en los hechos probados veintiuno y veintidós, en los daños ocasionados en las seis hectáreas de los cultivos de la gestionante, que colindan con el depósito de basura, implicando una disminución en sus ingresos por la venta del producto y un aumento en los costos de producción, tal y como se desprende de las declaraciones del señor Nombre3640. e informe pericial del Ingeniero Nombre5836.
De manera que la afectación económica genera la lesión antes señalada para la actora. Además, la proliferación de zopilotes y perros salvajes le han causado afectación en la compactación del suelo, así como por la realización de realización de trillos, madrigueras y excavaciones que estos animales realizan en tales terrenos. Si bien los terrenos arrendados por la promovente para el cultivo de la caña de azúcar, se trata de más de dieciocho hectáreas, se causa afectación únicamente en las seis hectáreas que colindan con el depósito de basura, limitándose la indemnización otorgada únicamente a tal magnitud y porción de terreno sembrado. Al respecto, es clara la experticia, la cual avala el Tribunal, en torno a que la lesión es la producida únicamente en seis hectáreas que colindan con el depósito de basura, en las cuales se ha generado daños por disminución de ingresos de las zafras, elevación de costos de siembra y mantenimiento, cuyo período de indemnización se expresará al resolver la excepción de prescripción incoada por la accionada.
Sin embargo, debe rechazarse como daño lo correspondiente a la disminución de ingresos de zafras y elevación de costos de siembra y mantenimiento de los años posteriores a su demanda, por tratarse de hechos hipotéticos, futuros, eventuales e inciertos, no indemnizables al no cumplir con los presupuestos normativos de ser ciertos, efectivos, reales, evaluables, individualizables, al tenor del ordinal 196 citado. En torno al monto que se tomará como base para la fijación de los años indemnizables, al no haber quedado suficientemente claro los rubros que deberán otorgarse por cada año tanto por disminución de ingresos como por elevación de costos de siembra por las seis hectáreas, quedará para etapa de ejecución de sentencia su determinación. En este caso no se llega a establecer en concreto un monto específico de daños y perjuicios a favor de la actora, ante la insuficiencia probatoria; pese a esto la existencia del daño resulta evidente para la cámara.
Todo lo cual permite su reconocimiento en abstracto, para que sea liquidado, y determinado su quántum en ejecución de sentencia, permitiendo el cumplimiento de la tutela judicial efectiva al amparo del artículo 41 constitucional y el artículo 122 del Código Procesal Contencioso Administrativo. Además, las sumas que se establezcan deberán ser indexadas en los términos del ordinal 123 del Código Procesal Contencioso Administrativo a partir de la firmeza de la sentencia que las establezca en concreto y hasta su efectivo pago. De igual forma, se deberán reconocer intereses legales civiles, acorde al ordinal 1163 del Código Civil, sobre dicho montos a partir de la firmeza de la sentencia y hasta su efectivo pago.
II .3 ) RESPECTO AL DAÑO MORAL SUBJETIVO RECLAMADO : Liquida la actora por concepto de daño moral subjetivo por las actuaciones municipales, la suma de quince millones de colones. Al respecto debe indicarse que basta para demostrar el mismo una simple presunción de hombre y que el juez como perito de peritos está en capacidad de establecer su quántum, debido a que supone una perturbación injusta de las condiciones anímicas y no requiere de prueba directa, quedando a la equitativa valoración del juez (Voto de la Sala Primera de la Corte Suprema de Justicia número 555-F-99 de las 15:15 horas del 16 de setiembre de 1999). Así las cosas, su fijación está sujeta a la naturaleza de los hechos, tipo de afectación y a los principios de razonabilidad, proporcionalidad, sana crítica, lógica, justicia y la prudencia, que limitan la discrecionalidad del juzgador. En mérito de ello, tomando en consideración que efectivamente implica un afectación anímica evidente el hecho de que sus cultivos se hayan visto dañados por varios años como consecuencia directa del depósito de basura y que haya tenido que padecer moralmente la invasión de los perros salvajes, daños de los buzos, zopilotes y de la basura aledaña, es que resulta adecuado y razonable otorgarle a la gestionante la cantidad de quinientos mil colones por concepto de daño moral subjetivo, suma que deberá ser indexada en los términos del ordinal 123 del Código Procesal Contencioso Administrativo a partir de la firmeza de la sentencia que las establezca en concreto y hasta su efectivo pago, con el reconocimiento de los intereses legales civiles, acorde al ordinal 1163 del Código Civil, sobre dicho monto a partir de la firmeza de la sentencia y hasta su efectivo pago.
La determinación in re ipsa de tal monto fijado en forma prudencial se justifica en el hecho de que se trata de una suma adecuada, proporcional y razonable en razón de la afectación anímica, preocupación, tristeza y ansiedad que un hecho de esta naturaleza le causa al agricultor que vela constantemente por el hecho de que el fruto de su trabajo se vea recompensado con una producción adecuada, de modo tal que situaciones anómalas como las expresadas de invasión de plagas producto del depósito de basura, truncan sus legítimas aspiraciones. El monto es adecuado en razón de que la afectación sufrida en sus cultivos es parcial y no total, al haberse dañado únicamente seis hectáreas de la totalidad del fundo sembrado, por lo que la indemnización otorgada solventa en su justa medida el perjuicio psicológico que se le hubiere causado por tal lesión parcial.
II .4 ) RESPECTO A LA EXCEPCION DE PRESCRIPCION FORMULADA POR LA ACCIONADA : La prescripción extintiva (extinctive), negativa o liberatoria (ou libératoire) tiene por objeto tutelar el orden social y la seguridad en las relaciones jurídicas, se define como un lapso de tiempo establecido por el ordenamiento jurídico a efecto de reclamar un derecho y se fundamenta su existencia por motivos de seguridad jurídica, sus presupuestos esenciales son el transcurso del tiempo, la inercia del titular, y la voluntad del favorecido de hacerla valer bien sea por medio de una acción o de una excepción. Se caracteriza por eliminar una situación objetiva de incerteza, es un medio extintivo de las obligaciones, no es declarable de oficio sólo a petición de parte interesada, se puede renunciar tácita o expresamente siempre que no sea en forma anticipada, y se puede interrumpir y suspender ( Ver en ese sentido la sentencia de la Sala Primera de la Corte Suprema de Justicia Nº 120 de las 15:00 horas del 20 de julio de 1992. ).
"En términos generales, la prescripción corre desde el día en que pudo haberse hecho valer el derecho o bien, lo que es lo mismo, desde que la acción o derecho haya nacido.". (Pérez Vargas Víctor. Derecho Privado. Litografía e imprenta Lil. 1994. Tercera edición. San José, Costa Rica, página 199.), no obstante la misma puede interrumpirse o suspenderse, lo cual constituye un impedimento de su curso que obsta el surgimiento de la situación exigible, de modo que cuando acaece la interrupción de la prescripción "el plazo comienza a contarse de nuevo sin que pueda sumarse el tiempo anterior a la interrupción.". (Pérez Vargas Víctor, Op. Cit. página 203). Las causales de interrupción las establece expresamente los ordinales 875, 876 Y 879 del Código de rito, al indicar: ARTICULO 875.- "Se interrumpe la prescripción positiva, cuando el poseedor es privado de la posesión de la cosa o del goce del derecho durante un año, a menos que recobre uno ú otro judicialmente.
ARTÍCULO 876.- Toda prescripción se interrumpe civilmente: 1º.- Por el reconocimiento tácito o expreso que el poseedor o deudor haga a favor del dueño o acreedor de la propiedad o derecho que trata de prescribirse; y 2º.- Por el emplazamiento judicial, embargo o secuestro notificado al poseedor o deudor. ARTÍCULO 879.- La prescripción negativa se interrumpe también por cualquier gestión judicial o extrajudicial, para el cobro de la deuda y cumplimiento de la obligación. Por su parte, en cuanto a la suspensión de la prescripción, "el derecho es ya exigible, ya ha nacido a la vida jurídica; sin embargo, el ejercicio de éste se llega a ver obstaculizado por la especial situación del sujeto o sujetos de la relación (...) se trata de casos en que la prescripción no corre (...) lo que da lugar a dos posibilidades: a) si la causa de suspensión es preexistente a la exigibilidad de la situación jurídica opera en forma análoga al llamado impedimento: el tiempo de la prescripción comienza a contarse desde el momento en que desaparezca la causa; b) cuando la causa de suspensión sobreviene, el período durante el cual subsiste la causa no se cuenta y se suma al tiempo sucesivo.".
(Pérez Vargas Víctor, Op. Cit. página 201 y 202), por existir una imposibilidad para el ejercicio del derecho, las cuales son indicadas por el ordinal 880 del Código de rito, al disponer: "No corre la prescripción: 1º.- Contra los menores y los incapacitados durante el tiempo que estén sin tutor o curador que los represente conforme a la ley. 2º.- Entre padres é hijos durante la patria protestad. 3º.- Entre los menores é incapacitados y sus tutores o curadores, mientras dure tutela o curatela. 4º.- Contra los militares en servicio activo en tiempo de guerra, tanto dentro como fuera de la República. 5º.- Contra la herencia yacente, mientras no haya albacea que hubiere aceptado. 6º.- Contra los jornaleros y sirvientes domésticos, respecto a sus jornales o salarios, mientras continúen trabajando o sirviendo al que se los debe. 7º.- A favor del deudor que con hechos ilícitos ha impedido el ejercicio de la acción de un acreedor.".
El sustento normativo de la prescripción en materia de responsabilidad de la Administración Pública se regula en los ordinales 190 a 213 de la Ley General de la Administración Pública, disponiéndose que el derecho de reclamar la indemnización a la Administración prescribirá en cuatro años contados a partir del hecho que motiva la responsabilidad. No obstante, como lo dispusiera la Sala Primera de la Corte Suprema de Justicia en el voto número 606-F-2002 de las 16:10 horas del siete de agosto del 2002, tratándose de procesos civiles de hacienda, debe tomarse en consideración que el daño se produce o se evidencia tiempo después de acaecida la conducta, en razón de lo cual tal término extintivo contará desde que se tiene certeza o conocimiento de los hechos dañosos. Aplicado lo indicado al presente asunto, tenemos que la entidad accionada incoa la excepción de prescripción, manifestando en los términos del ordinal 198 de la Ley General de la Administración Pública, que se debe declarar prescritos los reclamos que superen los cuatro años desde que se incoa la demanda.
Al respecto debe acogerse parcialmente la excepción de prescripción, pero no en la fecha que expresa la demandada, sino desde cuatro años antes desde que se formuló el reclamo administrativo ante la Municipalidad de Pérez Zeledón. Como se aprecia en el hecho probado once, la promovente mediante libelo presentado ante la Municipalidad de Pérez Zeledón el 30 de julio del 2009, formula reclamo administrativo por daños y perjuicios en los que manifiesta haber recibido daños en sus cultivos en la finca situada en Pérez Zeledón bajo la matrícula […], contiguo al botadero de basura, siendo dicho acto jurídico causa eficiente para interrumpir la prescripción, como lo expresa el ordinal 879 del Código Civil. En mérito de ello, se debe declarar prescrito todo daño y perjuicio reclamado por la actora anterior al 30 de julio del 2005. Así las cosas, los daños generados por el incendio que expresa la actora se produjeron en el depósito de basura, como se determinan en los hechos probados cinco al doce, así como los daños a la cerca divisoria que expresa se quemó con el incendio del año de 1999, se encuentran prescritos.
II.5)- EXCEPCIONES: Interpone la accionada las excepciones de falta de derecho, falta de legitimación activa y pasiva y la falta de interés actual, alega además la prescripción de todo derecho anterior a los cuatro años previos a la interposición de la demanda y solicita en la audiencia de juicio que se acoja el agotamiento de la vía administrativa que fuere denegado interlocutoriamente. Al respecto debe indicarse, que efectivamente procede el rechazo de la defensa previa de falta de agotamiento de la vía administrativa. Tratándose de procesos ordinarios civiles de hacienda como el presente, en el cual no hay de por medio la impugnación de acuerdos municipales, no aplica el agotamiento preceptivo de la vía administrativa. Como bien expusiera la Sala Constitucional de la Corte Suprema de Justicia en el voto 3669-2006 de las 15:00 horas del 15 de marzo del 2006, es facultativo y no preceptivo el agotamiento de la vía administrativa, y que únicamente se requerirá cuando se impugnen acuerdos municipales en los términos del ordinal 173 constitucional o acorde al 184 constitucional en materia de contratación administrativa, desapareciendo en los demás casos como presupuesto obligatorio de admisibilidad de un proceso contencioso administrativo.
Así las cosas, en reclamos indemnizatorios como el presente en el cual se discute la responsabilidad objetiva de la entidad municipal, y no hay de por medio la impugnación de acuerdos municipales, lo procedente es que no se requiera el deber de agotar la vía administrativa, debido a que no se discute la legalidad del acto administrativo dictado, sino la responsabilidad civil del ente municipal. Respecto a la excepción de falta de legitimación activa y pasiva, se rechaza, toda vez que con ocasión de los daños y perjuicios reclamados por la actora, producto de la afectación que recibiera en sus cultivos de caña de azúcar por el depósito de basura de dicha entidad municipal, es que se acredita la condición de legitimado activo del actor y de la Municipalidad citada como accionada. Si bien la promovente no es la propietaria del fundo afectado, si ostenta un contrato de arrendamiento el cual le confiere un derecho subjetivo para incoar la presente acción.
En torno a la falta de interés actual se rechaza, sin duda existe una necesidad real, una utilidad, un provecho legítimo del actor al momento de la interposición de la demanda, de solicitar la pretensión ejercida en autos, la cual se mantiene al momento del dictado de la sentencia. Finalmente, en razón de lo expuesto se rechaza parcialmente la excepción de falta de derecho, formulada por la accionada, debiendo entenderse acogida en lo no expresamente concedido, porque de conformidad con la normativa citada, prueba aportada y los fundamentos de hecho expuestos, le asiste parcialmente el derecho invocado a la actora en sustento de sus pretensiones, que como se expresó emanan de los ordinales 190 y siguientes de la Ley General de la Administración Pública, al habérsele causado daños y perjuicios producto de la conducta administrativa reprochada.
POR TANTO :
Por mayoría, se rechazan las excepciones de falta de legitimación activa y falta de legitimación pasiva, así como la falta de interés actual. Se declara parcialmente con lugar la acción formulada por el señor Nombre147. en contra de Nombre33221 a Municipalidad de Pérez Zeledón , acogiéndose parcialmente la excepción de falta de derecho en lo no expresamente otorgado y denegándose en lo concedido. E n consecuencia se condena a Nombre33221 a Municipalidad de Pérez Zeledón a pagarle al señor Nombre147. los daños y perjuicios causados en sus cosechas de azúcar desde el 30 de julio del 2005 y hasta el 05 de agosto del 2010 y consistentes en la disminución de sus ingresos por la venta del producto y el aumento en los costos de producción de seis hectáreas, suma que se determinará en etapa de ejecución de sentencia y que deberá ser indexada desde la firmeza de la sentencia que las establezca en concreto y hasta su efectivo pago, así como el reconocimiento de intereses legales civiles, acorde al ordinal 1163 del Código Civil, a partir de la firmeza de la sentencia y hasta su efectivo pago.
Se condena además a Nombre33221 a Municipalidad de Pérez Zeledón a pagarle al señor Nombre147. por concepto de daño moral subjetivo la suma de quinientos mil colones, monto que deberá ser indexado desde la firmeza de la sentencia que las establezca en concreto y hasta su efectivo pago, así como el reconocimiento de intereses legales civiles, acorde al ordinal 1163 del Código Civil, a partir de la firmeza de la sentencia y hasta su efectivo pago. Se acoge parcialmente la excepción de prescripción y se declaran prescritos los daños y perjuicios reclamados con fecha anterior al 30 de julio del 2005. Son ambas costas a cargo de la Municipalidad de Pérez Zeledón. NOTIFIQUESE.- Carlos Espinoza Salas Ricardo A. Madrigal Jiménez Francisco Javier Muñoz Chacón Proceso de conocimiento.

VOTO SALVADO Concurro con mis compañeros en el voto, no obstante me separo en cuanto a la interpretación realizada respecto al momento a partir del cual corre la indexación de las sumas otorgadas en sentencia, que acorde a la respetable posición de mayoría lo es desde la firmeza de la sentencia que las establezca en concreto. Sin embargo, para el suscrito, la indexación tratándose de obligaciones de valor, debe correr a partir de la firmeza de la sentencia que las otorgue, sin que sea necesario trasladar tal data hasta que exista un monto concreto y en caso de obligaciones dinerarias desde que se incurrió en la erogación. De este modo, lo correcto para establecer una indemnización integral y plena, y para no causarle perjuicio al justiciable, es que se deba indexar desde que se establece, dicta y reconoce la obligación. Por la naturaleza de este instituto, el cual pretende actualizar al valor presente las obligaciones dinerarias preexistentes o actualizar al momento del dictado las obligaciones de valor reconocidas en sentencia, no debe quedar sujeta su aplicación, tratándose de obligaciones declaradas en abstracto, hasta el momento de la firmeza de la sentencia de ejecución que defina su monto, por cuanto el derecho ya se declaró y estableció.
De igual modo, si el monto indemnizatorio ya se definió en sentencia, como en el presente caso que se otorgó por daño moral la cantidad de quinientos mil colones, con muchas menos razón debe postergarse a etapas posteriores en perjuicio de la victoriosa el deber oficioso de indexar tales rubros. Si bien, el ordinal 123 del Código Procesal Contencioso Administrativo es claro en que la obligación dineraria reconocida en sentencia se actualizará desde la fecha de su exigibilidad, el numeral 124 inciso primero y segundo, en cuanto a las obligaciones de valor, expresa que una vez convertida en dinero efectivo el juez ejecutor la actualizará, pero no indica a partir de cuando. En razón de ello, la interpretación lógica, con base en el principio de reparación integral y plena, es la de que al diferirse en el tiempo la fecha de su fijación en ejecución y posterior pago, es lo razonable que la actualización se produzca desde que se declaró en sentencia y hasta su efectivo pago.
Ergo, en el caso de obligaciones de valor en las cuales se fija su monto en la sentencia que las otorga, con mucha menos razón debe diferirse su indexación a etapas posteriores. Si bien el precepto legal dispone que una vez convertida en dineraria la obligación de valor se actualizará, ello obedece a que por razón lógica no puede aplicarse la operación de indexación a un rubro no cuantificado, pero ello no implica que tal actualización deba correr hasta que el juez de ejecución establezca su monto.
