JUDGMENT N° 0076-F-12 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at fifteen hours and twelve minutes on treinta de enero de dos mil doce.- POSSESSORY TITLE PROCEEDINGS (DILIGENCIAS DE INFORMACIÓN POSESORIA), brought by [Nombre1], of legal age, married, farmer, resident of Osa, identity card CED1 - - . Participating in the proceedings are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose personal particulars are not stated in the record, in her capacity as Deputy Attorney General; and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - - , represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Escazú, legal entity identification number CED3 - - , in her capacity as general judicial attorney-in-fact. FINDINGS:
5. The statutory requirements have been observed in the conduct of the proceedings, and the judgment contains no apparent errors or omissions capable of rendering it null and void.

CONSIDERING:
II.The appeal was filed by attorney Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General. She disagrees with the judgment rendered at 16 hours on 26 de octubre de 2011, which approved the possessory title proceedings. She asserts the following ground of appeal: According to the testimonial evidence, the judicial inspection (reconocimiento judicial), and the judgment itself, the property is forest in nature. Although forestry legislation permits the titling of properties outside protected wilderness areas (áreas silvestres protegidas), provided that the petitioner proves that he holds the legal rights arising from ten years of possession, satisfies the other applicable requirements, has protected the resource, and has duly demarcated the property, it must be borne in mind that the same legislation assigns forests located in national reserves to the State’s natural heritage (patrimonio natural del Estado), a forest-based public domain.
She cites judgment Nº4587-97 of the Sala Constitucional de la Corte Suprema de Justicia without providing further details regarding that decision and states that forest lands may be titled only if adverse possession (usucapión) had been completed before they became part of said heritage by operation of law. She also cites decisions numbers 15753-2005; [Telf1]; 738-2003 of the same Constitutional Chamber, as well as opinions C-321-2003 and C-146-2008 issued by that State representative. Based on the criteria stated therein, she analyzes the legal impossibility of obtaining title to public-domain property; the inadmissibility of adverse possession and titling against the public domain; and the impossibility of acquiring possession, emphasizing that lands with forest cover (cobertura boscosa) cannot be titled in favor of private parties. She considers that the witnesses’ statements fail to establish that the petitioner held the ten years of possession necessary for adverse possession at least 10 years before properties of a forest nature were assigned to the State’s Forest or Natural Heritage. She provides a review of the matter (folios 173 to 182).
III.The State representative’s grievance lies in the contention that, because this is an area with forest cover (cobertura boscosa), it is not eligible for acquisition by adverse possession (usucapión), as it forms part of the State forest estate (patrimonio forestal del Estado). These proceedings are brought for the purpose of recording in the Registro Público de la Propiedad the property located in Punta Mala, [Dirección5], Osa canton, Puntarenas province, measuring 35 hectares 2507 square meters, according to registered cadastral plan P-1463927-2010 (folio 117). Said property is located outside any protected wild area (área silvestre protegida), as indicated in the certification issued by Sistema Nacional de Áreas de Conservación and submitted as evidence (folio 76). The soil study in the record indicates that the resource has been used in accordance with its designated use and consists of secondary scrubland (tacotal) with steep slopes (folios 118).
The Court conducted a judicial inspection (reconocimiento judicial) of the site and drew up a record stating: “... The land consists mostly of secondary scrubland, approximately twenty to twenty-two hectares, and the remainder is mountainous land with secondary forest. There is a well-protected spring (naciente) with a regular flow, abundant vegetation, and no structures. There are small areas planted with plantains, bananas, cacao, and Gallinazo trees (sic) ...” (folio 80). Testimony was also received from the witnesses [Nombre4], [Nombre5], and [Nombre6] (folios 77, 77 verso, and 78, respectively). Their testimony shows that most of the property is devoted to conservation and that the petitioner, when her possession is added to that of her transferor, had possessed the property for more than ten years before the initial filing. The foregoing demonstrates the petitioner’s conservation-oriented approach, as she has preserved most of the property as secondary scrubland.
In view of the foregoing, the Court does not agree with the State representative’s assertion that, because the land is devoted to forest, it forms part of the State’s natural heritage, since, pursuant to article 856 of the Código Civil, the property is eligible for acquisition by adverse possession. Therefore, pursuant to the cited article 7, the Court finds that the evidence submitted did establish the exercise of the required legal possession (posesión legal) over the property for ten years before the date on which these proceedings were instituted, and that the land at issue in these proceedings is eligible for acquisition by adverse possession because it is located outside any protected wild area, regardless of its management category. IV. In connection with the arguments made by the State representative concerning the State forest estate, it is appropriate to refer briefly to the subject.
For this purpose, it is appropriate to cite judgment Nº51 issued at 15 hours 15 minutes on 26 de mayo de 1995 by the Sala Primera de la Corte Suprema de Justicia, which states, insofar as relevant: “IX.- The State forest estate encompasses the entire national territory (articles 4, 32 through 42), which may in turn be subdivided into three areas: A) The area covered by the forestry regime (régimen forestal) (articles l, 2, 7, 47 through 54, 66 through 81); B) forest harvesting (aprovechamientos forestales) on privately owned land (articles 43 through 46, 60 through 65, 82 through 91); and C) national reserves (reservas nacionales) (articles 32 et seq.). The forestry regime—for its part, consisting of the body of legal, economic, and technical provisions intended to give substantive effect to the conservation, protection, and rational use of forests and forest land (terrenos forestales) (article 7)—also has three subareas: A) protective zones (zonas protectoras), B) national parks, forest and biological reserves, and C) forests and forest land.
X.- Beginning with Ley de Tierras y Colonización Nº 2825 of 14 de octubre de l961, the term national reserves identifies all lands referred to by the Código Fiscal de l865, and subsequently by Ley Nº l3 of 19 de enero de l939 itself (Colección de Leyes y Decretos, l939, I semester, p. l0), as national public-domain lands (baldíos nacionales). These are properties that are not privately owned and are not recorded in the Registro Público de la Propiedad, within the meaning of articles 267 and 486 of the Código Civil (see the decision of the Corte Plena in the constitutional challenge filed by [Nombre7] against the Ley de Tierras y Colonización concerning the provisions on excess land (demasías), adopted at the extraordinary session of 25 de noviembre de l971). These lands differ from privately held lands recorded in the name of the State or its Institutions and consist of the remainder left after the preceding two categories.
Originally, during the Colonial period, they were not designated for public service or use. Following the guidelines of the Código Civil, Ley General de Baldíos Nacionales Nº l3 of l0 de enero de l939 declared that lands within the borders of the Republic belonged to the State when they had not been privately acquired through lawful title (e.g., by adverse possession), were not recorded in the Registro Público under the name of any private or public person, and had not been designated for public service. Ley de Tierras y Colonización Nº 2825 of l4 de octubre de l961 maintained the same approach, except that it expanded the lands declared inalienable under the former law (Article 7). In general, those reserves have been subject to limitations on possession, as well as surface-area limitations on registration through possessory information proceedings (informaciones posesorias). Initially, their administration was entrusted to the Sección de Tierras y Colonias of the Departamento de Crédito Rural, Tierras y Colonias del Banco de Costa Rica; it later passed to the Instituto de Tierras y Colonización; and when Ley Forestal Nº 4465 entered into force, administration of the State forest estate was granted to the Dirección General Forestal, created within the Ministerio de Agricultura y Ganadería.
Today, the Dirección General Forestal forms part of the Ministerio de Recursos Naturales, Energía y Minas (articles 9 through 16). All lands considered national reserves immediately become subject to the purposes of forestry regulations (article 32). On those lands, the State may create—by law or executive decree—forest reserves, protective zones, national parks, wildlife refuges, and biological reserves, thereby constituting the forest estate (article 35). Legislative authorization is required for them to be colonized or transferred (article 40), and even when they are possessed by third parties, such parties acquire no rights; the State’s right to recover them is not subject to prescription (article 33). National reserves are regulated in detail in the Chapter entitled ‘Use of Forest Resources on Lands Belonging to the State and Other Public Administrative Bodies.’ Harvesting in national reserves may be carried out only under concessions granted by the Dirección General Forestal (articles 55 and 56).
Tender procedures shall be conducted in accordance with technical forest-management plans (planes técnicos de manejo forestal), subject to the tender specifications prepared by the Dirección (article 55 subsection a), with concessionaires providing sufficient security (article 56). No person may obtain concessions over the forest estate in quantities exceeding their demonstrated raw-material needs. Authorizations obtained directly or through intermediaries in contravention of the foregoing are null and void (article 59). XI.- At the opposite end of the spectrum from national reserves is private property, addressed in the law under the heading ‘Use of Forest Resources on Privately Owned Land.’ For reasons of social interest, these lands form part of the State forest estate. This is because private parties—operating under any system, whether an agricultural or livestock enterprise, for land subdivision (parcelación) or colonization, and whether they are nationals or foreigners—whose work plans include forest exploitation or forest removal in any form must obtain the express approval of the Dirección General Forestal, in accordance with the Ley Forestal and its regulations (article 60).
Accordingly, the State forest estate regime applies to all lands within the nation where natural forest resources exist. To exploit their own timber resources, private parties must prepare technical forestry plans, and the Dirección shall grant them long-term concessions (article 6l). The foregoing entails voluntary submission to the forestry regime. This is a legal presumption because it is the private party’s only option, as the party is prohibited from cutting trees or using or exploiting forest products on their own property without prior authorization from the Dirección General Forestal (articles 63 and 65). For these purposes, the State grants a series of incentives for the management and regulation of privately owned forests and forest land, particularly through Certificados de Abono Forestal (articles 82 through 86) and other tax incentives (article 87). Because the Dirección General Forestal must have trained personnel and forest rangers and maintains relations with the authorities, it shall provide owners with all necessary assistance to keep their lands free from intrusions and occupants (article 67)....” It follows from the foregoing that the State forest estate consists of properties that are not privately owned and are not recorded in the Registro Público de la Propiedad, within the meaning of articles 267 and 486 of the Código Civil, according to the reference made to the ruling of the Sala Constitucional de la Corte Suprema de Justicia.
Alongside this estate, there is also private property. Throughout the evolution of forestry legislation, possessors of properties who had already perfected their ownership rights through adverse possession were afforded the opportunity to obtain title to them. That opportunity is available through compliance with the requirements of the Ley de Informaciones Posesorias; accordingly, express authorization is granted to obtain title registrable in the Registro Público for lands located in protected wild areas, regardless of their management category, where the applicant for title proves possession for more than 10 years before the effective date of the law or decree creating the protected wild area (articles 1 and 7 of the Ley de Informaciones Posesorias). For the foregoing reasons, the decision under appeal must be affirmed as to the matters appealed.
POR TANTO:
The judgment is affirmed as to the matters appealed.

Goicoechea, a las quince horas doce minutos del treinta de enero de dos mil doce.- DILIGENCIAS DE INFORMACIÓN POSESORIA, promovida por [Nombre1] , mayor, casado, agricultor, vecino de Osa, cédula de identidad CED1 - - . Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos, en su condición de procuradora adjunta ; y e l INSTITUTO DE DESARROLLO AGRARIO, cédula jurídica CED2 - - - , representado por Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecina de Escazú, cédula jurídica número CED3 - - , en calidad de apoderada general judicial. RESULTANDO:
5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.
Redacta la jueza Díaz Bolaños; y,
CONSIDERANDO:
II.La apelación es interpuesta por la licenciada Lydiana Rodríguez Paniagua en su carácter de Procuradora Adjunta. Se muestra disconforme con la sentencia de las 16 horas del 26 de octubre de 2011 donde se aprobaron las diligencias de información posesoria. Expone como agravio el siguiente: Según la prueba testimonial, el reconocimiento judicial y el autosentencia se tiene que la naturaleza del inmueble es un bosque. Aun cuando la legislación forestal permite la titulación inmuebles fuera de áreas silvestres protegidas, si el promovente demuestra ser el titular de los derechos legales de posesión decenal, con las demás condiciones exigidas al efecto, haber protegido el recurso y tener el inmueble debidamente deslindado, ha de tenerse en cuenta que la misma normativa afecta al patrimonio natural del Estado, dominio público forestal, los bosques de las reservas nacionales. Cita el voto de la Sala Constitucional de la Corte Suprema de Justicia Nº4587-97 sin precisar mayores datos sobre esa decisión, e indica que los terrenos de bosque solo podrán titularse si la usucapión se había consolidado antes de ingresar por ley al citado patrimonio.
También de la misma Cámara Constitucional sentencias números 15753-2005; [Telf1]; 738-2003; así como los dictámenes de tal Representación Estatal C-321-2003; C-146-2008. A partir de los criterios vertidos analiza la imposibilidad jurídica de titular bienes de dominio público; la improcedencia de la usucapión y titulación contra el dominio público; la insusceptible de adquirir la posesión, para enfatizar que los terrenos con cobertura boscosa no se pueden titular a favor de particulares. Estima las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir en cabeza del promovente con 10 años de antelación de la afectación de los inmuebles de naturaleza forestal al Patrimonio Forestal o Natural del Estado. Realiza un recuento (folios 173 a 182).
III.El agravio de la representación estatal radica en estimar, al tratarse de una zona con cobertura boscosa no es apta para usucapir por ser parte del patrimonio forestal del Estado. Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad el inmueble ubicado en Punta Mala, [Dirección5] , cantón Osa, provincia de Puntarenas, el cual tiene una medida de 35 hectáreas 2507metros cuadrados, según el plano catastrado P-1463927-2010 (folio 117). Dicho bien se ubica fuera de cualquier área silvestre protegida, conforme se indica en la certificación emitida por Sistema Nacional de Áreas de Conservación aportada como prueba (folio 76). En el estudio de suelos que consta en autos se indica, se ha ejercido el uso conforme de dicho recurso que es un tacotal con fuertes pendientes (folios 118). El Juzgado practicó un reconocimiento judicial del lugar, procediendo al levantamiento de un acta en la que consignó: "...
El terreno esta compuesto por tacotales en su mayoría aproximadamente unas veinte a veintidós hectáreas y el resto es terreno de montaña con bosque secundario. Existe una naciente de agua de un caudal regular bien protegida con abundante vegetación sin construcciones. Existen unas pequeñas áreas de siembre de plátanos, banano, cacao y árboles de Gallinazo (sic) ..." (folio 80). También se recibió la declaración de los testigos [Nombre4] , [Nombre5] y [Nombre6] (folios 77, 77 vuelto y 78 respectivamente). De sus declaraciones se desprende que el inmueble está dedicado a la conservación en su mayor parte y que el promovente, sumada la posesión de su transmitente, ha estado en posesión del fundo por más de diez años antes de la presentación del escrito inicial. De lo anterior se denota que existe una actitud conservacionista por la promovente al conservar en en la mayor parte del fundo en tacotales.
De acuerdo a lo anterior, no se comparte lo señalado por la representante estatal, que el terreno al estar destinado a bosque forma parte del patrimonio natural del Estado, porque la promovente de conformidad con el artículo 856 del Código Civil el fundo es apto para adquirir por usucapión. Por ende, conforme al artículo 7 citado, estima el Tribunal que si fue acreditado con la prueba aportada, el ejercicio de la posesión legal exigida sobre el fundo, con diez años de antelación a la fecha en la que se promovieron estas diligencias, y el terreno objeto de las presentes diligencias es apto para usucapir al encontrarse fuera de cualquier área silvestre protegida sea cual fuere su categoría de manejo. IV. Relacionado con lo expuesto por la representación estatal, vinculada con el patrimonial forestal del estado, resulta oportuno hacer una breve referencia sobre el tema. Para ello, es oportuno citar el voto Nº51 de las 15 horas 15 minutos del 26 de mayo de 1995 de la Sala Primera de la Corte Suprema de Justicia, el cual en lo que interesa indica: " IX.- El patrimonio forestal del Estado incluye a todo el territorio nacional (artículos 4, 32 al 42), el cual a su vez se puede subdividir en tres áreas: A) La comprendida por el régimen forestal (artículos l, 2, 7, 47 a 54, 66 al 81) B) Los aprovechamientos forestales en terrenos de propiedad privada (artículos 43 al 46, 60 al 65, 82 al 91); y C) las reservas nacionales (artículos 32 y siguientes).
Por su parte el régimen forestal -constituido por el conjunto de disposiciones de carácter jurídico, económico y técnico, encargado de darle un contenido a la conservación, protección y racional aprovechamiento de los bosques y terrenos forestales (artículo 7)- tiene también tres subáreas: A) zonas protectoras, B) parques nacionales, reservas forestales y biológicas y C) bosques y terrenos forestales. X.- Con el nombre de reservas nacionales se identifica, a partir de la Ley de Tierras y Colonización Nº 2825 del 14 de octubre de l961, todas aquellas tierras denominadas por el Código Fiscal de l865, y luego por la misma Ley Nº l3 del 19 de enero de l939 (Colección de Leyes y Decretos, l939, I semestre, p. l0), como baldíos nacionales. Se trata de los inmuebles no sometidos a propiedad privada, no inscritos en el Registro Público de la Propiedad, en los términos de los artículos 267 y 486 del Código Civil (ver lo resuelto por la Corte Plena, en recurso de inconstitucionalidad de [Nombre7] contra la Ley de Tierras y Colonización, respecto de las normas de demasías, acordado en sesión extraordinaria del 25 de noviembre de l971).
Estas tierras difieren de las tierras de dominio privado inscritas a nombre del Estado o de sus Instituciones, y se encuentran constituidas como remanente de las dos anteriores. Originalmente, en la época de la Colonia, no fueron destinadas al servicio o uso público. Siguiendo los lineamientos del Código Civil la Ley General de Baldíos Nacionales Nº l3 del l0 de enero de l939 las declaró pertenecientes al Estado, dentro de los límites de la República, y que no hubieren sido adquiridos en propiedad mediante título legítimo por particulares (vgr. por usucapión), ni estuvieran inscritas en el Registro Público a nombre de ninguna persona -privada o pública-, ni destinadas al servicio público. La Ley de Tierras y Colonización Nº 2825 del l4 de octubre de l961 mantuvo la misma orientación, solo que amplió las declaradas, por la anterior ley, como inalienables (Artículo 7). En general esas reservas han tenido límites para poseerlas, así como límites -en cuanto a la superficie- para ser inscritas por medio de informaciones posesorias.
En un principio su administración fue confiada a la Sección de Tierras y Colonias, del Departamento de Crédito Rural, Tierras y Colonias del Banco de Costa Rica, luego pasó al Instituto de Tierras y Colonización, y al entrar en vigencia la Ley Forestal Nº 4465 se concedió la administración del patrimonio forestal del Estado a la Dirección General Forestal creada en el Ministerio de Agricultura y Ganadería. Hoy la Dirección General Forestal forma parte del Ministerio de Recursos Naturales, Energía y Minas (artículos 9 al 16). Todas las tierras consideradas como reservas nacionales quedan afectas en forma inmediata a los fines de la normativa forestal (artículos 32). Sobre ellas puede el Estado crear -por Ley o por Decreto Ejecutivo- reservas forestales, zonas protectoras, parques nacionales, refugios de vida silvestre y reservas biológicas, conformando así el patrimonio forestal (artículo 35).
Para poder ser colonizadas o enajenadas se requiere autorización legislativa (artículo 40), y aún cuando fueren poseídas por terceros éstos no adquieren ningún derecho, siendo imprescriptible el derecho del Estado para reivindicar (artículo 33). Tienen las reservas nacionales una detallada regulación dentro del Capítulo "Del aprovechamiento del recurso forestal en terrenos del Estado y demás organismos de la administración pública". Estos aprovechamientos en las reservas nacionales solo podrán practicarse por concesión otorgadas por la Dirección General Forestal (artículo 55 y 56). Las licitaciones se tramitarán de acuerdo a planes técnicos de manejo forestal, sujetos al cartel confeccionado por la Dirección (artículo 55 inciso a), otorgando garantía suficiente los concesionarios (artículo 56). Ninguna persona puede obtener concesiones del patrimonio forestal en cantidades superiores a las necesidades de materia prima que demuestre requerir.
Son nulas las autorizaciones que se obtengan directamente o por medio de personas interpuestas, en contra de lo indicado (artículo 59). XI.- En una posición diametralmente opuesta a la de las reservas nacionales se encuentra la de la propiedad privada, denominada en la ley como "Del aprovechamiento del recurso forestal en terrenos de propiedad privada". Estas tierras, por intereses de orden social, forman parte del patrimonio forestal del Estado. Esto es así porque los privados -funcionando bajo cualquier sistema (empresa agrícola o ganadera, para parcelación o colonización, tratándose de nacionales o extranjeros)- si dentro de sus planes de trabajo está la explotación forestal o la eliminación del bosque, en cualquier forma, deberán necesariamente obtener aprobación expresa de la Dirección General Forestal, en los términos de la Ley Forestal y del reglamento a la misma (artículo 60). Por ello el patrimonio forestal del Estado es aplicable a todos los bienes nacionales donde existan recursos naturales forestales.
Para poder explotar sus propios recursos maderables los privados deben elaborar planes técnicos forestales, y la dirección les otorgará concesiones a largo plazo (artículo 6l). Lo anterior implica un sometimiento voluntario al régimen forestal. Esta es una presunción legal pues resulta ser la única alternativa del privado quien se encuentra impedido para talar árboles, aprovechar o explotar los productos forestales, dentro de su mismo bien, si previamente no hay autorización de la Dirección General Forestal (artículo 63 y 65). Para estos efectos el Estado otorga una serie de incentivos para el manejo y reglamentación de los bosques y terrenos forestales de dominio particular, especialmente a través de los Certificados de Abono Forestal (artículos 82 al 86) y otros incentivos fiscales (artículo 87). Como la Dirección General Forestal debe contar con personal capacitado, guardabosques, y mantiene relaciones con las autoridades, ésta le brindará a los propietarios toda la colaboración necesaria para mantenerlos libres de invasiones y ocupantes (artículo 67)..." De lo anterior se desprende, el patrimonio forestal del Estado, se trata de los inmuebles no sometidos a propiedad privada, no inscritos en el Registro Público de la Propiedad, en los términos de los artículos 267 y 486 del Código Civil, según la referencia que se hace sobre lo indicado por la Sala Constitucional de la Corte Suprema de Justicia.
Frente a este patrimonio, se encuentra también la propiedad privada. La cual a lo largo de la evolución de la legislación forestal se concedió la oportunidad a poseedores de fundos, que ya habían consolidado su derecho de propiedad por usucapión a titularlos. Esa posibilidad se da a través del cumplimiento de los requisitos de la Ley de Informaciones Posesorias, y por ello se autoriza de manera expresa a titular terrenos ubicados en áreas silvestres protegidas cualquiera que sea su categoría de manejo a obtener título inscribible en el Registro Público, al comprobar el titulante de una posesión de más de 10 años antes de la fecha de vigencia de la ley o decreto en que se cree tal área silvestre (artículo 1 y 7 de la Ley de Informaciones Posesorias). En razón de lo anterior, en lo apelado, deberá confirmarse lo resuelto.
POR TANTO:
Se confirma la sentencia en lo que ha sido objeto de apelación.
