JUDGMENT NO. 0 020-F-12 AGRARIAN COURT OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at ten hours five minutes on diecisiete de enero del dos mil doce.- ORDINARY PROCEEDING (PROCESO ORDINARIO), brought by [Nombre1], of legal age, widowed, merchant, resident of Grecia de Alajuela, identity card number CED1- -; against [Nombre2], of legal age, married once, farmer, resident of Limón, identity card number CED2 - -; [Nombre3], of legal age, married once, resident of imón, identity card number CED3 - -; [Nombre4], of legal age, single, precision mechanic, resident of Bananito Sur, identity card number CED4 - -. WHEREAS:

  1. 1The plaintiff instituted an ordinary proceeding, requesting that the judgment declare the following: “1- That this complaint be admitted and allowed to proceed. 2. That the defendants herein, [Nombre2], 2nd [Nombre5], and 3rd [Nombre4], be ordered to pay one hundred eighty thousand colones corresponding to 50% of the cost of the forest inventory (inventario forestal) paid by the plaintiff herein. 3rd. That [Nombre2], 2nd [Nombre6], and 3rd [Nombre4], be ordered to pay the sum of one million two hundred thousand colones for the work of felling, skidding, and decking thirty thousand inches of timber located in the yard on property belonging to the defendants herein. 4. That the defendants herein, [Nombre2], 2nd [Nombre6], and 3rd [Nombre4], be ordered to pay damages (daños y perjuicios) caused by the unilateral termination of this contract, and the damages caused by the nonpayment for work performed after we incurred expenses for fuel, tractor hours, wages, and food for the tractor operator and assistant laborers. 5. That the defendants herein, [Nombre2], 2nd [Nombre6], and 3rd [Nombre4], be ordered to pay all legal costs (ambas costas)” (folios 130 to 134)

2- The defendants answered the complaint filed against them in the terms appearing at folios 152 to 160 and raised the defenses (excepciones) of nonperformance of contract and lack of legal right.

3- Attorney Wilbert Alvarez Li, judge of the Agrarian Court of Limón, by a ruling issued at eleven hours on treinta de enero del dos mil nueve, decided: “THEREFORE: Based on all the foregoing, A) this Ordinary complaint brought by [Nombre1] against [Nombre2], [Nombre7], and [Nombre4] is hereby dismissed. The unsuccessful party is ordered to pay the costs of the proceeding. The defense of lack of legal right is likewise sustained, and no ruling is made on the other defense because it is unnecessary. B) With respect to the counterclaim (contrademanda) brought by [Nombre2], [Nombre7], and [Nombre4] against [Nombre1], it is hereby sustained, and the unsuccessful party is ordered to pay damages in the amount limited in the counterclaim pleading to five million colones, as well as interest at the statutory rate accrued from the date on which each item of damage was caused until that sum is fully paid, which shall be addressed during the corresponding judgment-enforcement stage (ejecución de sentencia). The unsuccessful party is ordered to pay the costs of the proceeding.” (folio 467)

  1. 4The plaintiff filed an appeal (recurso de apelación), expressly stating the reasons for challenging the trial court’s position (folios 471 to 478).-

5. The statutory requirements were not observed in the conduct of the proceeding, and the judgment contains errors or omissions capable of rendering it null and void.

CONSIDERING:

I.The Agrarian Court of the First Judicial Circuit of the Atlantic Zone, by a ruling issued at ten hours on veintinueve de setiembre del dos mil once, declared the counterclaim inadmissible because the State had not been joined as a party (integrado la litis). (See ruling at folio 546).

II.The counterclaiming defendants appeal the aforementioned ruling on the following grounds: 1) They state that, by a ruling issued at 8:45 hours on 6 de julio de 2011, they were ordered to effect joinder (integrar litisconsorcio) against the State, through MINAET, because they had alleged the existence of environmental damage (daño ambiental). They filed a motion for reconsideration (recurso de revocatoria) against that ruling. They assert that they cannot be compelled to sue the State when they have no adverse interest against it. They state that it is the counterclaiming defendant who is reporting the environmental damage caused and therefore has no interest adverse to the State, for which reason there is no basis for suing it; instead, the State should enter the proceeding as an intervening party (coadyuvante), since they are defending natural resources. The State may be served as an interested third party (tercero interesado) so that it may appear and defend the collective rights that they are also defending.

The court below (a quo) makes an erroneous interpretation that results in the denial of their rights under the counterclaim, because it imposed procedural burdens upon them (suing the State) that are inapplicable given that they share the same interests (protection of natural resources). The proper course is to notify the State so that it may join as an intervening party and not as a defendant of the parties they represent, because no claim or relief is sought against the State. The applicable procedural mechanism is a different one, not compulsory joinder of defendants (litis consorcio pasivo necesario). 2) They state that, even while objecting, they proceeded to join the parties on 26 de agosto de 2011, and that the eight days granted to do so had not elapsed between the date on which the ruling was served upon them and the filing date; it was therefore filed on time. What may have confused the court below concerns the parties to be sued, since the pleading does not clearly identify them, but it is evident that the complaint is against both, namely the State and MINAET; and if the court did not consider this clear, it should have ordered correction of the complaint rather than rejecting the joinder.

III.In this particular case, by a ruling issued at 8:45 hours on 6 de julio del 2011, the court below ordered the State and the Sistema Nacional de Areas de Conservación to be joined as parties, granting the counterclaiming defendants a period of 8 days to do so (see ruling at folio 523). By a pleading filed with the court on 26 de agosto de 2011, the counterclaiming defendants joined MINAET as a defendant (see folios 533 to 545). By a ruling issued at 10 hours on 29 de setiembre de 2011, the court below deemed the joinder of the State unfulfilled, declared the counterclaim inadmissible, and granted the final six-day period for closing arguments (alegato de conclusiones) (see folio 546).

IV.In this case, this Tribunal considers that the appellant is correct, because the court below has committed a series of inconsistencies in the manner in which it has handled this matter. It should be noted that it ordered the necessary parties to be joined (integrar la litis), including the State and the Sistema Nacional de Areas de Coservación, an entity attached to the Ministerio de Ambiente, Energía y Telecomunicaciones, based on possible negligence in supervising the extraction of timber from the property that is the subject of the contract, as well as possible joint and several liability (responsabilidad solidaria) for any environmental damage that may have been caused (see folio 523). In this case, a reading of the allegations in the counterclaim (contrademanda) shows that the defendants seek damages caused to their property by the plaintiffs when implementing a forest management plan (plan de manejo forestal), while the plaintiffs seek recovery of the cost of preparing the management plan and other amounts arising from the performance of a timber sale and purchase agreement (see the complaint and counterclaim at folios 130 and 160).

An analysis of the facts reveals no claim involving either the State or the Sistema Nacional de Areas de Conservación that would make it necessary for them to be direct parties to this proceeding; therefore, this panel does not understand how a party can be compelled to sue the State and the Sistema Nacional de Areas de Conservación. Moreover, the court below is effectively modifying the parties’ claims and thereby violating the principle of party disposition (principio dispositivo) to which they are entitled, because, in issuing the ruling ordering the joinder of the necessary parties, the court below states: “... The co-defendants [Nombre2], [Nombre8], and [Nombre9] having alleged at folio 160 possible damage to the stream in the area that was the subject of the contract, as well as an apparent violation of the Ley Forestal and the Ley de Aguas, and environmental damage having been alleged, the undersigned judge considers that the State, represented by the Procuraduría General de la República, must be brought into the proceeding because, according to legal doctrine, all environmental damage entails a social cost that must be claimed by the State.

It is likewise considered appropriate to extend the litigation to the Sistema Nacional de Areas de Conservación, an entity attached to the Ministerio de Ambiente, Energía y Telecomunicaciones, based on possible negligence in supervising the extraction of timber from the property that is the subject of the contract, as well as possible joint and several liability for any environmental damage that may have been caused. Based on the foregoing, the counterclaimant is hereby ordered to extend this counterclaim (reconvención) to the State, represented by the Procuraduría general de la República, and the Sistema Nacional de Areas de Conservación, an entity attached to the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), for which purpose it is granted a non-extendable period of EIGHT DAYS, ...” The foregoing ruling is entirely without basis. In seeking compensation from the plaintiffs for the damage caused to their property during the performance of the contract entered into by the parties, the counterclaimants seek nothing other than recovery for the damage caused to their land.

They assert no claims against anyone other than the plaintiffs in this proceeding, and the court below is effectively suggesting claims that were not pleaded. The appellant is correct in stating that the State could be notified as an interested third party (Tercero interesado), given the possible environmental damage at issue. It appears that the trial judge does not clearly understand the concept of necessary passive joinder (litis consorcio pasivo necesario). In this regard, this Tribunal considers it necessary to discuss that concept for the guidance of the court below. With respect to joinder of parties (litis consorcio), it is important to examine what this Tribunal has previously held: “... The legal scholarship concerning joinder of parties has stated that: ... it is one of the forms a proceeding may take and consists of a plurality of plaintiffs or defendants. Accordingly, joinder exists when several persons bring an action against a single defendant, when one person sues several persons, and when two or more persons sue two or more persons.

Joinder also occurs in cases of accession and intervention. Joinder may be voluntary or necessary. It is voluntary when undertaken pursuant to a statutory right to establish it; it is necessary or mandatory when the proceeding cannot validly be commenced except through joinder because the legal issues adjudicated therein affect more than two persons, such that no valid and effective judgment may be rendered without hearing all of them ...” (See PALLARES Eduardo. Diccionario de Derecho Procesal Civil. Editorial PORRUA S. A 5TA edición 1966. Pag. 512). Legal scholarship has also stated regarding this subject: “A plurality of parties may initially arise through joinder (when several persons sue or several persons are sued), or may arise subsequently (when principal third parties intervene with claims shared by some of the parties and with a legal interest in the outcome of the judgment, which may legally benefit or prejudice them—that is, as regards the existence or terms of the right or relationship they claim—and therefore the intervenor brings its own dispute into the proceeding so that it may also be adjudicated there), or when proceedings are consolidated and some of their parties share the same community of interests ...

It is therefore essential to take care not to confuse joinder with a plurality of parties in a proceeding, because the former is the species and the latter is the genus; that is, there may be a plurality of parties without joinder, for example, when there is a plaintiff or defendant and a supporting intervenor (coadyuvante) assisting one or the other. Consequently, joinder will exist in three cases: a) When several persons appear in a proceeding as plaintiffs or defendants. b) When third parties satisfying the stated requirements enter the proceeding. c) When proceedings involving different parties are consolidated and some of those parties share common claims ... The first situation may occur in the initial complaint or through its timely amendment. That is, there will always be joinder among multiple plaintiffs or defendants, but not always among intervenors or between them and the plaintiff or defendant ...

Joinder may be necessary or mandatory, voluntary or permissive or useful, original or successive, active or passive, mixed, simple, or reciprocal. It may also combine several of the foregoing characteristics, such as initial or original and necessary, or initial and voluntary; it may be proper or improper, depending on whether the co-parties’ claims or defenses are connected by a legal relationship or merely by legal affinity ... There are legal or substantive relationships concerning which it is not possible to rule in part, by dividing them or determining them only with respect to some of their subjects, because the decision necessarily encompasses and binds them all. In such cases, the presence in the proceeding of all persons connected to that relationship is indispensable so that the procedural legal relationship may be complete and its merits may be adjudicated in the judgment. If there are more than two such persons in the legal rather than physical sense (for example, a representative or attorney-in-fact and the represented party constitute a single subject), there will be necessary joinder (litis consorcio necesario) ...

A necessary opposing party (contradictor necesario) will be absent in two situations: when those appearing are not the persons entitled in that case to assert or contest the claims set forth in the complaint; and when those appearing were required to be parties as plaintiffs or defendants, but only in conjunction with other persons who have not appeared in the proceeding—that is, when the plaintiff side, the defendant side, or both must be composed of several persons, but not all of them are present in the proceeding ... In our view, the proper formation of the necessary opposing side is a matter of incomplete standing to sue or be sued (legitimación de causa incompleta), which precludes a judgment on the merits. To avoid this offense against procedural economy—that is, the waste of time, money, and effort involved in conducting a futile proceeding—the judge must, on the court’s own initiative, summon the absent persons during the first instance so that the necessary opposing side may be completed.

This means that failure to properly establish necessary joinder is never grounds for nullifying the proceeding, but rather grounds for a judgment declining to rule on the merits (sentencia inhibitoria). However, the voluntary appearance of necessary co-parties who were neither sued nor initially summoned, when it occurs before the judgment at the appellate or sole-instance level, cures the irregularity, and the judgment must therefore address the merits; the proceeding is never returned to an earlier stage, and the intervenor accepts it in its current state, which is why intervenors are required to set forth in their intervention filing the facts and reasons on which they rely and to submit the relevant evidence ... If the judgment on the merits is not rendered against and in the presence of all persons in the substantive legal relationship, it will have no effect, because it cannot bind one but not the others; therefore, if any person is absent, the judgment must decline to rule on the merits ...

For the same reason, such a judgment cannot in practice be enforced, because otherwise a person who was not a party to the proceeding would be prejudiced, given the indivisible nature of the substantive legal relationship, and that person’s right of defense would be violated ... Necessary joinder may be initial or successive. The former ordinarily occurs (among plaintiffs or defendants), but the law may require, as a condition for the valid conduct of the proceeding, that another person sharing interests with one of the parties, whether plaintiff or defendant, be summoned, thereby establishing joinder between them ... Care must be taken not to confuse compulsory intervention (intervención forzosa) with necessary joinder. Compulsory intervention, in turn, differs from compulsory summons (citación forzosa); the latter is the genus and the former the species. Whenever intervention is compulsory, the summons will be mandatory; however, there are many cases in which the law requires a summons but the person receiving it remains free to enter the proceeding or not, and in such cases that person’s intervention will not be compulsory.

This occurs with creditors in bankruptcy and insolvency proceedings. In such cases, the summons alone does not make the person summoned a party. In compulsory intervention, by contrast, the person summoned becomes a party upon receipt of the summons, even if that person does not appear to assert procedural rights. Yet even in the latter cases, the necessary intervention of those persons does not mean that joinder exists between them and one of the parties; on the contrary, they often occupy an independent position as autonomous third parties, third-party claimants, or intervenors ad excludendum ... for example, mortgage creditors holding an interest in attached real property who are summoned to the enforcement proceeding in which the attachment was ordered. From the foregoing examination of necessary joinder, the precise meaning of voluntary or permissive joinder, also known as useful joinder, may be deduced.

Joinder is permissive or voluntary when it depends on the parties’ choice to commence separate proceedings as plaintiffs for their respective claims or against each defendant, or when it depends on the third parties’ choice whether to intervene in a proceeding initiated by other persons, without either the unity of res judicata (cosa juzgada) or the law requiring one course or the other, so that if not all co-parties appear, a judgment on the merits may nevertheless be rendered with respect to those who did appear, or, likewise, if separate proceedings are chosen, the respective judgments may be enforced independently of the others.

But it is always essential that the co-litigant (litis consorte) submit for the Judge’s determination, in that proceeding, a dispute of its own concerning a right or substantive legal relationship of which it is the holder. As we explained in the preceding point, when such intervention occurs, the third party may be summoned pursuant to a statutory mandate or at the request of one of the parties, or the third party may appear voluntarily. This permissive joinder (litis consorcio facultativo) may be initial, when it occurs in the complaint or its amendment, or subsequent, when it occurs thereafter. Initial joinder may be classified as proper or improper; the former requires an element of legal connection, while in the latter mere affinity or homogeneity among the claims of each plaintiff is sufficient; both, of course, require partial subjective identity, or identity of the parties—that is, that one of the parties be the same party, whether plaintiff or defendant and whether composed of one or several persons.

Subsequent joinder always requires a connection and therefore must be proper. A legal connection between two or more claims or disputes means one resulting from the existence of at least two identical common elements—not merely analogous or similar—among the several elements constituting every procedural legal relationship, namely: the parties, the cause of action (causa petendi), the relief sought or the content of the claims, and what [Nombre10] calls the instrumental element, which arises when two or more disputes are such that the same instruments serve to resolve them. Identity of cause of action exists in those adjudicatory proceedings (procesos de conocimiento) in which the same reasons or grounds exist ... One instance of identity of subject matter occurs in enforcement proceedings (procesos ejecutivos) in which the same assets, in whole or in part, are pursued to satisfy different claims of the enforcing parties, or when the judgment debtor, in different proceedings, asserts the same facts and legal grounds as defenses.

An example of instrumental identity occurs when the same evidence—not merely similar evidence—must be used in several proceedings or for several claims, such as the same witnesses, the same expert opinion, the same judicial inspection, or the same document. Initial joinder (voluntary or initial) may occur on the plaintiff’s side or also on the defendant’s side—several against one or one against several—but it may also occur on both sides—several against several; the first is active, the second passive, and the last mixed ... Finally, voluntary joinder (litis consorcio voluntario) may be simple or reciprocal. The former is common and occurs when there is a dispute between one or more persons forming one party and the others forming the opposing party, but no dispute among the persons on the same side; for example, several debtors under an obligation are sued and are therefore in litigation with the plaintiff, but not with one another.

The latter occurs when there are as many disputes as there are pairs of parties—that is, when all persons in a proceeding are in litigation with one another; for example, the creditor sues the guarantor, who in turn impleads the debtor under the benefit of excussion (beneficio de excusión); or title to a property is claimed and the defendant gives its seller notice of the action. In these cases, the interests of all the persons are distinct and adverse, and reciprocal disputes therefore exist among them. Nevertheless, there is joinder between this multiple-party side and the opposing party. Our procedural system accepts both proper and improper permissive joinder, provided that there is similarity in the issues of fact and law—not merely in the latter—even when the former are separate or independent ... We also accept consolidation based on identity of the relief sought, but we believe that this constitutes proper joinder by reason of an instrumental connection—the Court has also accepted it.

Necessary joinder (litis consorcio necesario) is always proper ... it must be admitted whenever there is a connection among several claims, whether causal, purposive, or instrumental, and one of the parties is the same—that is, when proper joinder exists—as well as in the cases of improper joinder that we have just explained, because in all of them the same considerations of procedural economy and the unity and consistency of judicial decisions apply, which legal doctrine regards as the grounds for this institution ...” (See DEVIS ECHANDIA, Hernando. Compendio de Derecho Procesal. 10.edición Editorial BOGOTA. 1985 pags. 331 a 338) ...” (See judgment of this Court Nº 839 de las catorce horas del treinta de noviembre de mil novecientos noventa y ocho, N° 167 de las quince horas del treinta y uno de marzo del dos mil and judgment 654 de las 08:20 horas del 7 de setiembre del 2001). In the present case, this Court considers that necessary passive joinder (litis consorcio pasivo necesario) is not present, because the decision rendered here could not affect other persons or parties not sued in this proceeding.

The plaintiff seeks payment of certain amounts arising from the performance of a forestry contract for the sale of timber, and the defendants likewise seek payment of certain amounts arising from the performance of the contract and compensation for the damages caused to their property. With respect to environmental damage (daño ambiental), pursuant to Article 50 of the Constitución Política, any person could seek compensation for it; therefore, necessary passive joinder does not exist in this case as interpreted by the court below (a quo). By declaring the counterclaim inadmissible because a nonexistent necessary passive joinder had not been established, the court leaves the defendants without an adequate defense and violates due process (debido proceso). Accordingly, this Court considers that the ruling ordering the establishment of necessary passive joinder against the Estado and the Sistema Nacional de Areas de Conservación is manifestly improper.

Moreover, the trial court fails to recognize that the Sistema Nacional de Areas de Conservación is an entity lacking its own legal personality because it is a state body belonging to a Ministry and is therefore represented by the Procuraduría general de la República, as representative of the Estado. Consequently, the order issued at las ocho horas cuarenta y cinco minutos del seis de julio del dos mil once must be vacated. Likewise, the decision under appeal, issued at las diez horas del veintinueve de septiembre del dos mil once, declaring the counterclaim inadmissible, is reversed. Instead, the proceedings shall continue.

THEREFORE:

The order issued at eight forty-five on July 6, 2011, directing that the scope of the litigation be expanded to include the State and the Sistema Nacional de Areas de Conservación, is annulled. As to the matter appealed, the order is reversed, and the proceedings are ordered to continue. The court below shall take note of the errors committed and shall correct the proceedings.

VOTO Nº 0 020-F-12 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las diez horas cinco minutos del diecisiete de enero del dos mil doce .- PROCESO ORDINARIO, promovido por [Nombre1] , mayor, viudo, comerciante, vecino de Grecia de Alajuela, cédula de identidad número CED1- - ; contra [Nombre2] , mayor, casado una vez, agricultor, vecino de Limón, cédula de identidad número CED2 - - ; [Nombre3] , mayor,casado una vez, vecino de imón,cédula de identidad número CED3 - - ; [Nombre4] , mayor, soletro, mécanico de precisión, vecino de Bananito Sur,con cédula de identidad número CED4 - - . Actúa como a poderado especial judicial de la parte actora el licenciado Frank MC Kenzie Peterkin, mayor, casado una vez, abogado, vecino de [Dirección1] cédula de identidad número CED5 - - ; y como a poderado especial judicial de la parte demandada, el licenciado Jorge Cerdas Pérez, mayor, casado una vez, abogado, vecino de Moravia, cédula de identidad número CED6 - - . Tramitado ante el Juzgado Agrario de Limón . -

RESULTANDO:

  1. 1El actor interpone proceso ordinario , solicitando que en sentencia se declare lo siguiente: “1- Que se admite y de curso a la presente demanda. 2. Que se le condene a los aquí demandados, [Nombre2] , 2º [Nombre5] , y 3º [Nombre4] . , al pago de ciento ochenta mil colones correspondientes al 50% del costo del inventario forestal cancelado por el aquí demandante. 3º. Que se le condene [Nombre2] . 2º [Nombre6] , y 3º. [Nombre4] . , al pago de la suma de un millón doscientos mil colones, porlas labores de corta, arrastre y empatiado de treinta mil pulgadas de madera que se encuentran en el patio en propiedad de los aquí demandados. 4. Que se condene a los aquí demandados [Nombre2] . 2º [Nombre6] , y 3º. [Nombre4] . , al pago de daños y perjuicios causados por el rompimiento unilateral de este contrato, y por los daños y perjuicioscausados por el no pago de labores realizadas después de que incurrimos en gastos de pago de combustible, horas tractor, salarios y gastos de alimentación del tractorista y peones ayudantes. 5. Que se conedne a los aquí demandados [Nombre2] . 2º [Nombre6] , y 3º. [Nombre4] . , al pago de ambas costas" (folio 130 a 134)

2- La parte demandada contesto la demanda incoada en su contra en los términos que corren a folios 152 a 160, e interpuso las excepciones de excepción de contrato no cumplido y falta de derecho.

3- El licenciado Wilbert Alvarez Li , juez del juzgado Agrario de Limón, mediante resolución de las once horas del treinta de enero del dos mil nueve , resolvió: "POR TANTO: Por todo lo anteriormente expuesto A) que procede declarar sin lugar la presente demanda Ordinaria de [Nombre1] contra [Nombre2] , [Nombre7] y [Nombre4] . Se condena a la parte perdidosa al pago de las costas del proceso. Asimismo se declara con lugar la excepción de falta de derecho y en cuanto a la otra se omite pronunciamiento por innecesario. B) En relación con la contrademanda establecida por [Nombre2] , [Nombre7] y [Nombre4] contra [Nombre1] , Sedeclara con lugar la misma, condenándose a la parte vencida a pagar por concepto de daños y perjuicios la suma limitada en el escrito de contrademanda en la suma de cinco millones de colones, así como los intreses al tipo legal que se hubieren generado desde la fecha en que se causó cada uno de los daños, hasta la efectiva cancelación de dicha suma, lo cual deberá ventilarse en la etapa de ejecución de sentencia correspondiente. Se condena a la parte vencida al pago de las costas del proceso." (folio 467)

  1. 4La parte actora formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, ( folios 471 a 478 ).-

5. En la substanciación del proceso no se han observado las prescripciones legales, y se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta el Juez Darcia Carranza; y,

CONSIDERANDO:

I.El Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, mediante resolución de las diez horas del veintinueve de setiembre del dos mil once declara inadmisible la contrademanda al no haberse integrado la litis contra el Estado . (ver resolución a folio 546).

II.La parte demandada reconventora apela la resolución anteriormente citada con fundamento en lo siguiente: 1) Dice, mediante resolución de las 8:45 horas del 6 de julio de 2011, se le previno integrar litisconsorcio en contra del Estado, por medio del MINAET, dado ellos plantearon la existencia de un daño ambiental. Contra dicha resolución planteó recurso de revocatoria. Indica no es posible se le obligue a demandar al Estado, cunado no tiene ningún interés contrapuesto contra éste. Dice, es el demandado reconventor quien está denunciando el daño ambiental causado por lo que no tiene intereses contrapuestos con el Estado por lo que no tiene porque demandarlo, más bien el Estado debe entrar al proceso como su coadyuvante, pues están defendiendo los recursos naturales. El Estado puede ser notifiacdo como tercero interesado para que se apersone a a defender los derchos colectivos que también ellos están defendiendo.

El a quo hace una interpretación errónea que hace se vean negados los derechos a la contrademanda, pues les estableció cargas procesales (demandar al Estado) que no corresponden al compartir los mismos intereses (cuido de los recursos naturales), siendo lo procedente notificar al Estado para que este se constituya como parte coadyuvante y no como demandado de sus representados, pues no hay reclamo ni pretensión alguna que hacerle al Estado. La figura procesal es otra y no un litis consorcio pasivo necesario. 2) Dice aún bajo protesta procedió a integrar la litis en fecha 26 de agosto de 2011, y de la fecha en la que les notificaron la resolución y la presentación no transcurrieron los ocho días que se les había condedio para hacerlo, por lo que fue presentado a tiempo. Lo que pudo haber confundido al a quo es en cuanto a los sujetos a demandar, pues en el escrito no se indica en forma clara, pero es evidente que se trata de demanda contra los dos, sea el Estado y a el MINAET, y si el juzgado no lo tuvo claro debía prevenir la correccción de la demanda y no rechazar la integración de la litis.

III.En este caso particular el a quo mediante resolución de las 8:45 horas del 6 de julio del 2011, ordenó integrar la litis contra El Estado y contra el Sistema Nacional de Areas de Conservación, otorgándole a la parte demandada reconventora un plazo de 8 días para ello (ver resolución a folio 523). La parte demandada reconventora mediante memorial presentado a estrados en fecha 26 de agosto de 2011, integró la demanda contra el MINAET (ver folio 533 a 545). El a quo mediante resolución de las 10 horas del 29 de setiembre de 2011, tuvo por no cumplida la integración de litis contra el Estado, declaró inadmisible la contrademanda y otorga audiencia final de los seis días para alegato de conclusiones (ver folio 546).

IV.En este caso, considera este Tribunal lleva razón la parte recurrente, pues se han dado una serie de inconsistencias por parte del a quo en la forma que ha tramitado este asunto, nótese ordena integrar la litis contra el Estado y contra el Sistema Nacional de Areas de Coservación entidad adscrita al Ministerio de Ambiente, Energía y Telecomunicaciones ante una eventual negligencia en la supervisión de la extracción de madera de la finca objeto de contrato, así como una eventual responsabilidad solidaria por el daño ambiental que se pueda haber causado (ver folio 523). En este caso de la lectura de los hechos de la contrademanda los demandados reclaman daños realizados en su propiedad por parte de los actores al ejecutar un plan de maejo forestal, mientras que los actores reclaman el costo por la elaboración del plan de manejo y otros rubros en la ejecución de un contrato de venta y compra de madera (ver demanda y contrademanda a folios 130 y 160).

Del análisi de los hechos no existe ninguna pretensión que tenga alguna relación con el Estado o el Sistema Nacional de Areas de Conservación, que haga necesario tener a éstos como partes directas en este proceso, por lo que no entiende esta cámara como se trata de obligar a una parte a demandar al Estado y al Sistema Nacional de Areas de Conservación. Por otra parte el a quo realmente está modificando las pretensiones de las partes y violentando con ello el principio dispositivo a que estas tienen derecho, pues al dictar lña resolución que ordena integrar la litis el a quo señala¨: "... Alegándose por parte de los codemandados [Nombre2] , [Nombre8] y [Nombre9] al folio 160, un eventual daño a la quebrada en el área que fuera objeto de contratación así como una aparente tragesiva a la Ley Forestal, Ley de Aguas; alegándose un daño de caracter ambiental, considera el suscrito juez que debe traerse al proceso al Estado representado por la Procuraduría General de la República, pues conforme a la doctrina, todo daño ambiental tiene un costo social que debe ser reclamado por el Estado.

Igualmente se considera pertinente, ampliar la litis respecto del Sistema Nacional de Areas de Conservación entidad adscrita al Ministerio de Ambiente, Energía y Telecomunicaciones ante una eventual negligencia en la supervisión de la extracción de madera de la finca objeto de contrato, así como una eventual responsabilidad solidaria por el daño ambiental que se puede haber causado. Por lo anteriomente expuesto, se le previene a la parte contrademandante ampliar la presente reconvención respecto del Estado representado por la Procuraduría general de la República y el Sistema Nacional de Areas de Conservación entidad adscrita al Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), para ello se le concede un plazo improrrogable de OCHO DÍAS, ..." . La anterior resolución carece de todo sentido, y al demandar los reconventores los daños causados en su inmueble por parte de los actores en la ejecución del contrato suscrito entre las partes, no está pretendiendo otra cosa que cobrar los daños realizados a su fundo.

No tiene pretensiones contra otras personas que no sean los aquí accionantes, y lo que hace el a quo es sugerir pretensiones que no han sido objeto de demanda. Tiene razón el apelante al indicar el Estado podría ser notificado como un Tercero interesado al estar de por medio un posible una daño al ambiente. Parece ser que el juzgador de instancia no tiene clara la figura del litis consorcio pasivo necesario. En dicho sentido considera necesario este Tribunal hacer referencia a dicha figura con fines ilustrativos para el a quo. En cuanto a este punto sobre la litis consorcio, es importante analizar lo que ha venido estimando este Tribunal respecto a esto: "...La doctrina referente a litis consorcio ha señalado que: ...es una de las modalidades del proceso que consiste en la pluralidad de actores o demandados. Por tanto, hay litis consorcio cuando varias personas ejercitan una acción contra un solo demandado, cuando una persona demanda a varias, y cuando dos o más demandan a dos o más personas.

También se produce el litisconsorcio en los casos de adhesión y de intervención. El litisconsorcio puede ser voluntario o necesario. Es voluntario si lleva a cabo en uso de una facultad que otorgue la ley para promoverlo; es necesario u obligatorio, cuando el proceso no puede iniciarse validamente, sino en la forma de litisconsorcio porque las cuestiones jurídicas que en él se ventilan afectan a más de dos personas, de tal manera que no sea posible pronunciar sentencia válida y eficaz sin oírlas a todas ellas ... “. (Consúltese PALLARES Eduardo. Diccionario de Derecho Procesal Civil. Editorial PORRUA S. A 5TA edición 1966. Pag. 512 ). También respecto a este tema la doctrina señala que: ”La pluralidad de partes puede originarse en un Litis consorcio de manera inicial (cuando demandan varias o se demandan varias personas), o posteriormente (cuando intervienen terceros principales, pero con pretensiones comunes a algunas de las partes y con un interés jurídico en los resultados de la sentencia, que podrá beneficiarlos o perjudicarlos jurídicamente, es decir en cuanto a la existencia o modalidades del derecho a la relación que reclaman, por lo cual el interviniente aporta al proceso su propio litigio para que allí sea también resuelto) y cuando se produce una acumulación de procesos y entre algunas de las partes de ellos existe esa misma comunidad de intereses ...

Es pues, indispensable tener buen cuidado de no confundir el litis consorcio con la pluralidad de partes en el proceso, pues aquél es la especie y esta el género, es decir, puede existir pluralidad de partes y no haber litis consorcio, por ejemplo, porque se trate de un demandante o demandado y un coadyuvante de aquel o de éste. Por consiguiente, existirá litisconsorcio en tres casos: a) Cuando en un proceso hay varias personas como demandantes o demandadas. b) Cuando concurren al proceso terceros que reúnen los requisitos indicados. c) Cuando existe acumulación de procesos con partes distintas y exista comunidad de pretensiones entre algunas de ellas ... El primer caso puede ocurrir en la demanda inicial o por corrección de esta hecha en oportunidad. Es decir siempre habrá litis consorcio entre varios demandantes o demandados; pero no siempre entre los intervinientes o entre estos y el demandante o demandado ...

El litis consorcio puede ser necesario u obligatorio y voluntario o facultativo o útil u originario y sucesivo; activo o pasivo y mixto; simple recíproco. Puede también reunir varias de las anteriores cualidades, como inicial u originario y necesario; inicial y voluntario, puede ser propio o impropio, según exista conexión jurídica o simple afinidad jurídica entre las pretensiones o excepciones de los consortes ... Hay relaciones jurídicas o sustanciales sobre las cuales no es posible pronunciarse por partes, fraccionándolas o calificándolas sólo respecto de algunos de sus sujetos, porque indispensablemente la decisión comprende y obliga a todos. En esos casos la presencia en el proceso de todos los sujetos vinculados a esa relación se hace indispensable a fin de que la relación jurídica procesal quede completa y sea posible decidir en la sentencia sobre el fondo de ella: si los sujetos son más de dos, en sentido jurídico y no físico (por ejemplo, el representante o apoderado y el representante, forman un solo sujeto), estaremos en presencia de un litis consorcio necesario...

Faltará el contradictor necesario en dos hipótesis: cuando quienes concurren no son los sujetos a quienes corresponda en este caso formular o contradecir las pretensiones que aparecen en la demanda; y cuando aquellos debían ser partes, en la posición de demandante o demandado, pero en concurrencia con otras personas que no han comparecido al proceso, es decir cuando la parte demandante o la demanda o ambas deben estar formadas por varias personas, y en el proceso no están presentes todas ellas ... Para nosotros, la debida formación del necesario contradictorio es un problema de legitimación de causa incompleta que impedirá sentencia de fondo, para evitar ese pecado contra la economía procesal, es decir la perdida de tiempo, dinero y trabajo de tramitar un proceso inútil, el Juez debe citar oficiosamente a las personas que faltan para integrarlo,durante la primera instancia. Lo anterior significa que la falta de integración adecuada del litis consorcio necesario, nunca es casual de nulidad del proceso, sino motivo de sentencia, inhibitoria.

Pero la comparecencia espontánea de los litis consortes necesarios no demandados, ni citados inicialmente, cuando aquella ocurra antes de la sentencia de segunda o única instancia, sanea la irregularidad y por tanto la sentencia debe ser un mérito o de fondo; el proceso nunca se retrotrae, se toma por el interviniente en el estado en que se encuentre, y por ello se les exige exponer en el escrito de intervención los hechos y las razones que invoquen y acompañar las pruebas pertinentes ... Si la sentencia de fondo no es pronunciada frente a todos y con la presencia de todos los sujetos de la relación jurídica sustancial, carecerá de efectos, porque no puede obligar a uno y no a los demás por esto, si alguno falta, debe de ser inhibitoria ... Por la misma razón, en la práctica esta sentencia no puede tener ejecución, pues de lo contrario resultaría perjudicado quien no fue parte en el proceso, dada la naturaleza indivisible de la relación jurídica sustancial y se violaría su derecho de defensa ...

El litis consorcio necesario puede ser inicial o sucesivo. Ordinariamente ocurre el primero (como demandantes o demandados ) pero puede suceder de que la ley exija, como requisito para la válida tramitación del proceso, la citación de otra persona que tenga intereses en común con una de las partes, demandante o demandada, con lo cual se establece un litis consorcio entre ellas... Debemos cuidarnos de no confundir la intervención forzosa con el litis consorcio necesario. La primera se diferencia a su vez de la citación forzosa; esta es el género y aquella es la especie; siempre que la ejecución sea forzada, será obligatoria la citación; pero son muchos los casos en que la ley exige la citación y sin embargo la persona que la recibe queda en la libertad para concurrir o no al proceso, y entonces será forzada su intervención. Así ocurre los acreedores en los procesos en quiebra y concurso. En estos casos la simple citación no convierte en parte al citado.

En la intervención forzosa en cambio; el citado es parte desde cuando recibe la citación, aunque no comparezca a hacer valer sus derechos procesales. Pero aún en los últimos casos la intervención necesaria de esas personas no significa que exista litis consorcio entre ellas y una de las partes; por el contrario, muchas veces tienen una situación independiente, como terceros autónomos o terceristas o intervinientes ad excludendun... : por ejemplo los acreedores en la hipoteca sobre el inmueble embargado que son citados al proceso ejecutivo donde se decretó embargo. Del examen hecho acerca de la litis consorcio necesario se deduce la exacta noción del voluntario o facultativo, también denominado útil. El litis consorcio es facultativo o voluntario cuando depende de la voluntad de las partes iniciar por separado como demandantes varios procesos para sus respectivas pretensiones o contra cada uno de los demandados o cuando depende de la voluntad de los terceros intervenir o no en el proceso iniciado por otros sujetos, sin que la unidad de la cosa juzgada ni la ley exijan lo uno o lo otro, de manera que si no concurren todos los litis consortes la sentencia podrá ser mérito respecto de quienes si no lo hicieron o igualmente la ejecución de las respectivas sentencias en el supuesto de optarse por procesos distintos – podrá lograrse con independencia de las otras.

Pero siempre es indispensable que el litis consorte someta a la decisión del Juez, en ese proceso, un litigio propio sobre algún derecho o una relación jurídica sustancial de que sea titular. Como en el punto anterior, lo expusimos, cuando esa intervención puede ocurrir que la citación al tercero provenga de mandato legal o por solicitud de una de las partes, o porque el tercero concurra espontáneamente. Este litis consorcio facultativo puede ser inicial, cuando es en la demanda o en su corrección, o sucesivo cuando ocurre con posterioridad. El inicial puede distinguirse en propio o impropio; el primero exige un elemento de conexión jurídica en el segundo basta la simple afinidad u homogeneidad entre las pretensiones de cada demandante; ambos desde luego, exigen la identidad parcial subjetiva o de las partes, es decir, que una de las partes sea la misma (demandante o demandada), sea que se halle formada de uno o varios sujetos.

En el sucesivo se exige siempre la conexión y por lo tanto debe ser propio. Se entiende por conexión jurídica entre dos o más pretensiones o litigios, la que resulta de la existencia por lo menos de dos de los elementos comunes idénticos (no sólo son análogos o similares) de los varios que constituyen toda relación jurídica procesal que son: los sujetos la causa pretendi, el objeto perseguido o el contenido de las pretensiones, y el llamado por [Nombre10], instrumental, que nace cuando dos o más litigios son de tal índole que para su composición sirve los mismos instrumentos. Identidad de causa petendi, en aquellos procesos de conocimiento en que existan unas mismas razones o unos mismos fundamentos ... Un caso de identidad de objeto existe en los procesos ejecutivos en que para satisfacer distintas pretensiones de los ejecutantes, se persiguen unos mismos bienes en su totalidad o parcialmente, o cuando el ejecutado en distintos procesos alega los mismos hechos y razones jurídicas como excepciones.

Un ejemplo de identidad instrumental es cuando varios procesos o para varias demandas se deben utilizar las mismas pruebas (no solamente otras similares), como los mismos testigos, el mismo dictamen de perito, la misma inspección judicial, el mismo documento. El consorcio inicial (voluntario o inicial) puede presentarse en la parte demandante o también en la demandada - varios contra uno o uno contra varios - ;pero puede ocurrir también en ambas partes - varios contra varios -, el primero será activo, el segundo pasivo y el último mixto ... Por último, el litis consorcio voluntario puede ser simple o recíproco. El primero es frecuente y ocurre cuando existe litigio entre una o varias personas que forman una parte y las demás son la parte contraria, pero no litigio de aquellas entre sí; por ejemplo: se demanda a varios deudores de una obligación, quienes por lo tanto, están en litigio con el demandante, pero no entre sí.

El segundo se presenta cuando existen tantos litigios como parejas de partes, es decir cuando todos los sujetos de un proceso se encuentran en un litigio entre sí; por ejemplo: el acreedor de demanda al fiador y este por su parte llama en garantía al deudor en uso de beneficio de excusión; o se reivindica una finca y el demandado denuncia el pleito a su vendedor; en estos casos los intereses de todos los sujetos son distintos y opuestos y por ende, existen litigios recíprocos entre ellos. Pero existen litis consorcio en esta parte plural frente a la contraria. En nuestro sistema procesal se acepta el litis consorcio facultativo propio como el impropio, siempre que exista analogía en las cuestiones de hecho y de derecho (no éstas solamente),aún cuando las primeras sean separadas o independientes ... Aceptamos también la acumulación por identidad de fin perseguido, pero creemos que se trata de un litis consorcio propio, por conexión instrumental (la Corte también lo ha admitido).

El litis consorcio necesario es siempre propio ... se debe admitir siempre que exista una conexión entre varias pretensiones, bien sea causal o final o instrumental y que una de las partes sea la misma, es decir, cuando hay un litis consorcio propio, y en los casos de litis consorcio impropio que acabamos de explicar, porque en todos ellos operan las mismas razones de economía procesal, de unidad y armonía de las decisiones judiciales que la doctrina considera como determinantes de esta institución ... " (Véase DEVIS ECHANDIA, Hernando. Compendio de Derecho Procesal. 10.edición Editorial BOGOTA. 1985 pags. 331 a 338 ) ..." ( Ver voto de este Tribunal Nº 839 de las catorce horas del treinta de noviembre de mil novecientos noventa y ocho, N° 167 de las quince horas del treinta y uno de marzo del dos mil y voto 654 de las 08:20 horas del 7 de setiembre del 2001). En el presente caso, considera este Tribunal no estarse ante un litis consorcio pasivo necesario, ya que lo que aquí se resuelva no podría afectar a otras personas o partes no demandadas en este proceso.

El actor, conforme a lo pretendido es cobrar cierto rubros propios de la ejecución de un contrato forestal de venta de madera y los demandados pretenden de igual manera cobrar ciertos rubros propios de la ejecución del contrato y los daños y perjuicios causados a su propiedad. En cuanto al daño ambiental conforme a lo dispuesto por el artículo 50 de la Constitución Política, cualquier persona podría cobrarlo, por lo que no existe un litis consorcio pasivo necesario en este caso tal y como lo interpreta el a quo. Al declarar inadmisible la contrademanda por no haber integardo un litis consorcio pasivo necesario inexistente deja en estado de indefensión y se violenta el debido proceso. En razón de lo anterior considera este tribunal lo resuelto en cuanto a ordenar integrar un litis consorcio pasivo necesario contra el Estado y contra el Sistema Nacional de Areas de Conservación resulta evidentemente improcedente, aparte de que desconoce el juzgado que el Sistema Nacional de Areas de Conservación es una entidad que carece de personería jurídica propia al ser un ente estatal perteneciente a un Ministerio por lo que quien lo representa es la Procuraduría general de la República como representante del Estado, por ende debe anularse la resolución dictada a las ocho horas cuarenta y cinco minutos del seis de julio del dos mil once.

Asímismo, se revoca la resolución venida en alzada, dictada a las diez horas del veintinueve de septiembre del dos mil once que declara inadmisible la contrademanda. En su lugar continúese con los procedimientos.

POR TANTO:

Se anula la resolución de las ocho horas cuarenta y cinco minutos del seis de julio del dos mil once que ordenó ampliar la litis contra el Estado y contra el Sistema Nacional de Areas de Conservación.En lo apelado, se revoca la resolución dictada y en su lugar se ordena continuar con los procedimientos. Tome nota el a quo de los errores cometidos y proceda a enderezar los procedimientos.
