Ordinary proceeding (proceso ordinario) brought by Nombre80088 against the State Nº 11-2012-II Second Section of the Administrative and Civil Tax Court (Tribunal Contencioso Administrativo y Civil de Hacienda). Second Judicial Circuit of San José. Goicoechea, at fifteen hours and forty-five minutes on treinta y uno de enero del dos mil doce.- The appeals (recursos de apelación) filed by both parties against Judgment Nº 1075-2011 of the Administrative Litigation Court (Juzgado Contencioso Administrativo), issued at catorce horas diez minutos del treinta y uno de mayo del dos mil once, are hereby heard in the ordinary proceeding brought by Nombre80088, who is married, a forestry engineer, a resident of San Pedro de Montes de Oca, identity card Nº CED59645, against the State, most recently represented by Deputy State Attorney Clara Villegas Ramírez, identity card Nº CED613, whose other particulars were not provided.-
Findings:
The amount in controversy (cuantía) in this matter was set at one hundred fifty million colones (see the decision at folio 245).- II) The State’s representative denied the claim and raised the defenses (excepciones) of lack of a legal right, lack of passive and active standing to sue (legitimación ad causam pasiva y activa), as well as the plea sine actione agit (see the filings at folios 179-195 and 237-244).- III) The Judge of the Administrative Litigation Court, Ana Lía Umaña Salazar, in Judgment Nº 1075-2011 issued at catorce horas diez minutos del treinta y uno de mayo del dos mil once, ruled: "The present ordinary claim filed by Nombre80088 against the State is partially granted. The defense of lack of a legal right is partially sustained. Consequently, decisions 796-01-TAA of dos de noviembre de dos mil uno and 199-02-TAA of diecinueve de marzo de dos mil dos, issued by the Administrative Environmental Court (Tribunal Ambiental Administrativo), are declared null and void; accordingly, the sanctions imposed upon the plaintiff are vacated, namely, the order to pay the sum of ONE MILLION ONE HUNDRED TWENTY-NINE THOUSAND ONE HUNDRED THIRTY-TWO COLONES AND THIRTY CÉNTIMOS (¢ 1.129.132,30) as compensation, as well as the remedial sanction (sanción reparadora) consisting of the order ‘to reforest with twice the number of trees felled without authorization within three months of service of this decision.’ The claim for material or economic damages sought by the plaintiff, which he quantified at ONE HUNDRED NINETEEN MILLION NINE HUNDRED SEVENTY THOUSAND SIX HUNDRED SIXTY-SEVEN COLONES for the period from 1999 to junio de 2003, is denied, as is the claim that such final amount be adjusted as of the date of the actual damage.
The claim for compensation for non-pecuniary damages is partially granted and set at the sum of FIVE MILLION COLONES; finally, the State is ordered to pay both categories of costs in this proceeding (...)" (folios 724-753; it should be noted that the underlining appears in the original).- IV) The plaintiff filed an appeal (folios 755-765), as did the State’s representative (folios 766-778). Both challenges were admitted by a decision of the court below (Juzgado a quo) issued at nueve horas y treinta y nueve minutos del veintiuno de junio del dos mil once (folio 779).- V) The statutory requirements have been observed throughout the proceedings, and no grounds have been found that would render the proceedings null and void or deprive the parties of their right of defense (indefensión). This judgment is issued within the time permitted by the Court’s workload; Judge Canales Hernández authors this judgment; and,
Considering:
“Article 152.- 1. An administrative act may be revoked for reasons of expediency, appropriateness, or merit, subject to the exceptions set forth in this law.
2. Revocation shall take place only when there is a serious divergence between the effects of the act and the public interest, notwithstanding the time elapsed, the rights created, or the nature and other circumstances of the legal relationship sought to be terminated.
Article 158.- 1. The absence or defect of any requirement of an administrative act, expressly or implicitly required by the legal system, shall constitute a defect therein.
2. An act that substantially conflicts with the legal system shall be invalid.
3. The grounds for invalidity may consist of any substantial violations of the legal system, including violations of unwritten rules.
4. For these purposes, technical and scientific rules having an unambiguous meaning and exact application under the circumstances of the case shall be deemed incorporated into the legal system.
5. Non-substantial violations shall not invalidate the act, but may give rise to disciplinary liability on the part of the public servant responsible.” Having stated the foregoing, a review of the complaint as a whole shows that the plaintiff consistently challenges the administrative acts applied to him as contrary to the legal system, alleging multiple grounds for contesting them, without ever claiming that those acts were inexpedient or inappropriate. Accordingly, the trial court judgment at issue correctly ruled on the claim for annulment (pretensión anulatoria) brought by the plaintiff, and the alleged violation of the principle of congruence (principio de congruencia) does not exist. Finally, it should be noted that taking into account the clarification of the relief sought that the plaintiff provided in his closing submissions (folio 694) does not constitute grounds for altering the subject matter of the proceedings when that possibility was already barred under procedural law (mutatio libeli), as the defendant contends; instead, it was a means of reasonably interpreting the scope of the action brought so as to avoid a denial of justice.- VI) Regarding the second ground of appeal raised by the State’s representative: In this Court’s view, this other argument likewise does not warrant reversing the trial court judgment.
This conclusion is based on the following reasons: a) A review of the principal grounds for annulling the challenged acts and ordering the State to pay compensation for the non-pecuniary harm (daño moral) caused shows that they were as follows: 1º: The challenged acts lack clear and individualized grounds (motivo), as they are based on nonexistent and inaccurate facts, in disregard of Articles 128, 133, 158, 166, and 169 of the Ley General de la Administración Pública (see folios 741 verso-743 recto); 2º: Submission of an environmental impact study (estudio de impacto ambiental) is not a requirement that the Forest Regent (Regente Forestal) must satisfy, because that study is incorporated into the Management Plan (Plan de Manejo) and was not required by the Administración Forestal del Estado (folio 743 recto and verso); 3º: The act is supported by inadequate reasoning (motivación), because the report of the Comisión de Evaluación de Planes de Manejo del Área de Conservación de Osa is based on a visual inspection (inspección ocular) that is internally contradictory: on the one hand, the plaintiff herein was charged with cutting 22 trees without authorization from the Administración Forestal del Estado, while, on the other hand, it was established that there were 15 uprooted and fallen trees; moreover, that report is unsigned by the person responsible and bears only the initials of witnesses (see folios 743 verso-744 verso); 4º: The act lacks the formal element of a statement of reasons or legal grounds (motivación o fundamentación), in violation of Article 136 of the Ley General de la Administración Pública.
It is alleged that the reasons considered by the administrative authority in reaching its decision were not stated in connection with the financial penalty imposed on the claimant. It is also stated that relevant evidence was not analyzed, such as the fact that “(...) before the Commission evaluated the Management Plan for the property of Mr. Nombre80089, the plaintiff, in the second site-visit record, had issued an order suspending the cutting of trees; it likewise fails to consider that the Commission acknowledges that authorization for harvesting (aprovechamiento) was granted after that date and that this is supported not only by the Commission’s own site-visit record, but also by the authorizations requested by Mr. Nombre80089 to initiate the procedure for obtaining a harvesting permit and by the authorization he issued for portable sawmills to enter his property in August 2000”; the assertion that trees of the María and Nombre80091 species were cut during the harvesting authorized by Forest Regent Nombre80088 also lacks any supporting reasoning (folios 744 verso-746 recto); b) A review of the evidentiary findings in the challenged judgment (proven fact 15) shows that one of the circumstances mentioned in this ground of appeal—namely, the existence of a resolution of the Administración Forestal del Estado authorizing Nombre80089 to exploit the trees in any manner, issued after approval of the Management Plan—served as a basis for annulling the challenged administrative acts issued by the Tribunal Ambiental Administrativo.
This Chamber adopts that proven fact and agrees with the conclusion of the court below (Juzgado a quo) that, if the Administración Forestal del Estado issued valid permits for timber exploitation after the suspension order given by the Forest Regent, full responsibility for the unlawful exploitation carried out cannot be attributed to the latter; c) Nor is the State’s representative correct regarding the other circumstance mentioned in this ground of appeal—namely, that it is false that the plaintiff issued an order suspending the exploitation, because what he actually issued was merely a recommendation, and that it is therefore improper to exempt him from liability as Forest Regent, since such liability remained in effect throughout the period authorized for harvesting. The foregoing is stated because, pursuant to Article 19 of the Reglamento de Regencias Forestales (Decreto Ejecutivo Nº 26870 of 04 March 1998), “(...) The technical instructions issued by the regent during each visit to the property are mandatory for the party under the regency (...)”; the position advanced is therefore unsupported.
In any event, it must be noted that whether the Forest Regent failed to timely report the violation of the provisions of the Management Plan and the order suspending operations that he had issued to the appropriate authorities—namely, the Colegio de Ingenieros Agrónomos and the Administración Forestal del Estado—was not a matter addressed or sanctioned in the challenged resolutions, and this Court therefore cannot issue a ruling in that regard. It must be borne in mind that our appellate jurisdiction (competencia funcional) in this matter is limited to reviewing the proceedings in relation to the grounds of appeal raised by the interested parties against the trial court judgment, and we may not extend our review to matters not timely raised by the parties.- VII) Regarding the State’s third ground of appeal: Having analyzed this argument, the Court finds that, although the State is partially correct in its challenge, that circumstance is not sufficient to reverse the judgment under appeal.
The foregoing is stated based on the following considerations: a) Although it was previously stated that the technical instruction suspending implementation of the Management Plan (Plan de Manejo) was mandatory and, as such, the regulated party Nombre80089 could not disregard it, it is also true that the responsibility of the Forestry Regent (Regente Forestal) does not cease until the preparation and submission of the final report closing the activities, as provided in Article 18 of the Reglamento de Regentes Forestales: “The regent must submit a final report closing his activities for each management plan under his responsibility.” Thus, the position expressed in the trial court judgment—that responsibility is limited merely to conducting visits and ends upon issuance of the technical suspension instruction—cannot be accepted without qualification. Notwithstanding that this is the prevailing legal framework, the fact remains that, in this particular case, the responsibility of the Forestry Regent, who is also the plaintiff herein, cannot continue beyond those acts, because it was the State Forestry Administration itself that, despite the existence of that suspension order, which was also binding upon it, issued permits that allowed timber harvesting to continue, thereby facilitating the occurrence of environmental damage and, as a result, preventing the cited provision from being applied to its full extent; b) In any event, it is not true that the trial court judgment failed to address the State’s arguments in support of the Forestry Regent’s liability, as established in the challenged decisions of the Administrative Environmental Tribunal (Tribunal Ambiental Administrativo).
On the contrary, the judgment under appeal extensively analyzed the legal framework governing the administrative liability of Forestry Regents, examining, in recitals (considerandos) VI through IX, the provisions of the Ley Orgánica del Ambiente in relation to the Ley Forestal and related legislation such as the Ley de Biodiversidad. The scope of the Reglamento de Regentes Forestales, the Reglamento a la Ley Forestal, and the Ley del Colegio de Ingenieros Agrónomos itself was also explained. Accordingly, the alleged omissions challenging the legality of the trial court judgment do not exist.- VIII) Regarding the State’s fourth ground of appeal: The Court finds that the State is likewise incorrect in its arguments. First, the appellant does not specify what evidence for the Court’s own consideration (prueba para mejor proveer) it offered or at what procedural stage it did so, rendering the challenge imprecise.
Nor does it even explain the importance of the evidence on which a ruling was allegedly omitted, how it might affect the proper resolution of the case, or how that evidence could change the decision. Second, it is also untrue that the award of five million colones as compensation for non-pecuniary damage (daño moral) lacks substantive grounds; rather, the matter is extensively analyzed and explained at the end of recital X of the challenged judgment (folios 749-751). This challenge is therefore also unsupported. Finally, the State is likewise incorrect in asserting that the trial court judgment is contradictory because it partially upholds the defense of lack of legal right (excepción de falta de derecho). The decision was correct because the action was partially upheld with respect to the claims seeking annulment of the administrative acts and compensation for non-pecuniary damage, while the claim for compensation for pecuniary damage (daño material) was denied.
It was therefore appropriate to uphold the defense of lack of legal right with respect to the denied claims and reject it with respect to the claims that were granted.- IX) Plaintiff’s appeal: The challenge was presented at two procedural stages: first, through the filing of the appeal (folios 755-765), and second, through the brief stating the grounds of appeal (folios 784-795). In both pleadings, the challenge essentially disputes the denial of the claim for pecuniary damage in the trial court judgment. He contends that the evidence was erroneously assessed because he submitted to the record certifications from the Colegio de Ingenieros Agrónonos proving the volume of his work, consisting of 152 Forestry Regent contracts or forms during the period 1993-2000. He asserts that this volume of work was adversely affected by decisions 796-01-TAA and 199-02-TAA of the Tribunal Ambiental Administrativo, cutting short a thriving professional career as an Engineer and Forestry Regent.
He was never hired again because of the professional disrepute he suffered and had to subsist on assistance from family members. He alleges that this erroneous assessment of the evidence left him without a proper defense and unable to obtain compensation for the damage suffered, and that the pecuniary damage, consisting of lost profits (lucro cesante) caused by his professional inactivity, was calculated by an actuarial mathematician acting as an expert witness. He insists that the expert report is properly and conclusively documented, scientifically rigorous, and based on the regency contracts registered with the aforementioned professional association. He further contends that the certification issued by the Certified Public Accountant, which determined the income received between 1993 and 1998, was also disregarded. He asserts that the testimony of Nombre80092, Juvenal Valerio Garita, and Nombre80093 was not assessed, even though they agreed regarding the “negative atmosphere” resulting from the sanction imposed on him, thereby establishing the causal relationship between the administrative action and the loss of income, and requiring application of the principle of adequate causation (principio de causalidad adecuada).
He emphasizes that it is false that he resigned from or endorsed seven cases to Engineer Nombre80092 because of the persecution directed against that individual, as the lower-court judge (Juez a quo) stated, since the only entity authorized to disqualify an Engineer or Forestry Regent is the aforementioned professional association. He requests that the appeal be granted with respect to the challenged portion, awarding him the sum of one hundred nineteen million nine hundred seventy thousand six hundred sixty-seven colones (¢119.970.667,00), while leaving the remainder of the appealed decision undisturbed.
In the brief appearing at folios 810-813, the State opposes the appeal filed by the plaintiff, stating that the certification issued by the Public Accountant is based on unsupported assumptions and projections. It argues that the testimony received, particularly that of Nombre80092, indicates that the plaintiff agreed to transfer his clients to other Forestry Regents, and that he failed to establish that the alleged pecuniary damage he suffered had a causal nexus (nexo causal) with the State’s conduct. Accordingly, it maintains that the reasoning on this point in the recitals of the referenced judgment was correct (and provides the corresponding citations). It emphasizes that, for a claim seeking compensation for damage to succeed under the doctrine of Article 196 of the Ley General de la Administración Pública, the damage must be “actual, quantifiable, and attributable to an individual person or group,” and that granting compensation under these circumstances would be improper. It therefore requests that the challenged judgment be affirmed in that respect.- Having analyzed the ground of appeal submitted by the plaintiff, the Court finds that his argument is without merit. The Court reaches this conclusion for the following reasons:

Proceso ordinario de Nombre80088 contra el Estado Nº 11-2012-II Sección Segunda del Tribunal Contencioso Administrativo y Civil de Hacienda. Segundo Circuito Judicial de San José. Goicoechea, a las quince horas y cuarenta y cinco minutos del treinta y uno de enero del dos mil doce.- Se conocen los recursos de apelación interpuestos por ambas partes contra la sentencia del Juzgado Contencioso Administrativo, Nº 1075-2011 de las catorce horas diez minutos del treinta y uno de mayo del dos mil once, en el proceso ordinario interpuesto por Nombre80088 , quien es casado, ingeniero forestal, vecino de San Pedro de Montes de Oca, cédula de identidad Nº CED59645 contra el Estado, representado últimamente por la Procuradora Adjunta, Clara Villegas Ramírez, cédula de identidad Nº CED613, de otras calidades no indicadas.-
Resultando:
A este asunto se le fijó una cuantía de ciento cincuenta millones de colones (véase resolución de folio 245).- II) La representación estatal contestó negativamente la demanda y opuso las excepciones de falta de derecho, falta de legitimación ad causam pasiva y activa, así como la expresión sine actione agit (obsérvense los escritos de folios 179-195 y 237-244).- III) Que la Jueza del Juzgado Contencioso Administrativo, Ana Lía Umaña Salazar, en su sentencia Nº 1075-2011 de las catorce horas diez minutos del treinta y uno de mayo del dos mil once, dispuso: "Se declara parcialmente con lugar la presente demanda ordinaria presentada por Nombre80088 contra el Estado. Se acoge parcialmente la excepción de falta de derecho. Consecuentemente se declaran nulas las resoluciones 796-01-TAA del dos de noviembre de dos mil uno y 199-02-TAA del diecinueve de marzo de dos mil dos dictadas por el Tribunal Ambiental Administrativo, por lo que se dejan sin efecto las sanciones impuestas al actor que son la condenatoria al pago de la suma de UN MILLÓN CIENTO VEINTINUEVE MIL CIENTO TREINTA Y DOS COLONES CON TREINTA CÉNTIMOS (¢ 1.129.132,30) por concepto de indemnización y además la sanción reparadora impuesta consistente en la orden "de reforestar el doble de los árboles talados sin autorización en el plazo de tres meses contados a partir de la notificación de esta resolución." Se rechaza el extremo de daño material o económico solicitado por el actor que liquidó en la suma de CIENTO DIECINUEVE MILLONES NOVECIENTOS SETENTA MIL SEISCIENTOS SESENTA Y SIETE COLONES que va del año 1999 a junio de 2003, así como la pretensión consistente en que ese monto final esté sujeto a la fecha del daño efectivo.
Se acoge parcialmente la pretensión indemnizatoria por daño moral la cual se fija en la suma de CINCO MILLONES DE COLONES y finalmente se condena al Estado al pago de ambas costas de este proceso (...)" (folios 724-753; cabe indicar que los subrayados corresponden al original).- IV) La parte actora interpuso recurso de apelación (folios 755-765), lo mismo que hizo la representación estatal (folios 766-778). Ambas impugnaciones fueron admitidas por resolución del Juzgado a quo de las nueve horas y treinta y nueve minutos del veintiuno de junio del dos mil once (folio 779).- V) En los procedimientos se han seguido las prescripciones legales, no encontrándose motivos que determinen nulidad de lo actuado ni indefensión para las partes. Se emite la presente sentencia dentro del plazo que lo permiten las labores encomendadas al Tribunal; Redacta el Juez Canales Hernández; y,
Considerando:
"Artículo 152.- 1. El acto administrativo podrá revocarse por razones de oportunidad, conveniencia o mérito, con las excepciones que contempla esta ley.
2. La revocación deberá tener lugar únicamente cuando haya divergencia grave entre los efectos del acto y el interés público, pese al tiempo transcurrido, a los derechos creados o a la naturaleza y demás circunstancias de la relación jurídica a que se intenta poner fin.
Artículo 158.- 1. La falta o defecto de algún requisito del acto administrativo, expresa o implícitamente exigido por el ordenamiento jurídico constituirá un vicio de éste.
2. Será inválido el acto sustancialmente disconforme con el ordenamiento jurídico.
3. Las causas de invalidez podrán ser cualesquiera infracciones sustanciales del ordenamiento, incluso las de normas no escritas.
4. Se entenderán incorporadas al ordenamiento, para este efecto, las reglas técnicas y científicas de sentido unívoco y aplicación exacta, en las circunstancias del caso.
5. Las infracciones insustanciales no invalidarán el acto pero podrán dar lugar a responsabilidad disciplinaria del servidor agente." Dicho lo anterior, si se observa la totalidad de la demanda, se encuentra que la parte actora en todo momento cuestiona que los actos administrativos que se le aplicaron, son contrarios al ordenamiento, aduciendo múltiples razones para impugnarlos, sin que en algún momento plantee que dichos actos son inoportunos o inconvenientes. De esa manera, la sentencia de primera instancia que se comenta, resolvió correctamente sobre la pretensión anulatoria planteada por la parte actora, no existiendo la violación al principio de congruencia que se acusa. Finalmente, cabe acotar que el hecho de haber tomado nota de la aclaración de la pretensión que hizo la parte actora, en su escrito de conclusiones (folio 694), no constituye causal de cambio del objeto del proceso, cuando ya esa posibilidad estaba vedada por el ordenamiento procesal (mutatio libeli), como lo reclama la parte demandada, sino más bien constituyó una forma de interpretar razonablemente los alcances de la acción planteada, para no incurrir en denegación de justicia.- VI) Sobre el segundo agravio de la representación estatal: Según considera este Tribunal, este otro argumento tampoco sirve para revocar lo dispuesto en la sentencia de primera instancia.
Se considera lo anterior, con base en las siguientes razones: a) Si se revisan los fundamentos principales para anular los actos cuestionados y condenar al Estado a indemnizar por el daño moral irrogado, se tiene que estos fueron los siguientes: 1º: Los actos cuestionados carecen de un motivo claro e individualizado, fundándose en hechos inexistentes e inexactos, inobservando los artículos 128, 133, 158, 166 y 169 de la Ley General de la Administración Pública (véanse folios 741 vuelto-743 frente); 2º: La falta de presentación de un estudio de impacto ambiental, no es requisito que deba cumplir el Regente Forestal, por estar ese estudio incorporado en el Plan de Manejo y no haber sido exigido por la Administración Forestal del Estado (folio 743 frente y vuelto); 3º: El acto está incorrectamente motivado, por cuanto el informe de la Comisión de Evaluación de Planes de Manejo del Área de Conservación de Osa, está fundamentado en una inspección ocular contradictoria en sí misma, siendo que por un lado se le imputó al aquí actor la corta de 22 árboles sin la autorización de la Administración Forestal y por otro lado, se comprobó que habían 15 árboles desraizados y caídos, además que dicho informe aparece sin firmar por el responsable y sólo aparece rubricado por testigos (obsérvense folios 743 vuelto-744 vuelto); 4º: El acto carece del elemento formal de motivación o fundamentación, quebrantando el artículo 136 de la Ley General de la Administración Pública.
Se aduce que la sanción económica impuesta contra el accionante no se expresaron las razones valoradas por la autoridad administrativa para tomar esa decisión. Se dice también que no se analizaron elementos probatorios relevantes como que "(...) antes de que la Comisión evaluara el Plan de manejo de la finca del señor Nombre80089 el actor, en la segunda acta de visita había emitido la orden de paralización de la corta de árboles, de igual forma omite considerar que la Comisión acepta que hubo una autorización para el aprovechamiento posterior a esa fecha y que se sustenta no solo en la misma acta de visita de la Comisión sino también las autorizaciones solicitadas por el señor Nombre80089 para iniciar el trámite para el permiso de aprovechamiento y la autorización que da este para que ingresen aserraderos portátiles a su propiedad en agosto del año 2000", quedando también sin sustento argumentativo que la corta de árboles de las especies María y Nombre80091 se hayan cortado durante el aprovechamiento autorizado por el Regente Forestal Nombre80088 (folios 744 vuelto-746 frente); b) Si se observa en el elenco probatorio de la sentencia impugnada (hecho probado 15), se evidencia que una situación mencionada en este agravio (que exista una resolución de la Administración Forestal del Estado que autorice a Nombre80089 a explotar de cualquier forma los árboles, emitida con posteridad a la aprobación del Plan de Manejo), sirvió como fundamento para anular los actos administrativos cuestionados, emitidos por el Tribunal Ambiental Administrativo, siendo ese hecho probado prohijado por esta Cámara, compartiéndose el criterio del Juzgado a quo, en el sentido de que si la Administración Forestal del Estado concedió guías útiles para explotar madera, con posterioridad a la orden de paralización dada por el Regente Forestal, no es posible atribuirle toda la responsabilidad a este último sujeto por la explotación ilegal que se practicó; c) Tampoco lleva razón la representación estatal, con la otra situación mencionada en este agravio (que es falso que el actor haya emitido orden de paralización de la explotación, siendo que lo que había emitido en realidad era una mera recomendación, siendo improcedente que se le exima de responsabilidad como Regente Forestal, por mantenerse ésta durante todo el período autorizado para el aprovechamiento).
Se afirma lo anterior, por cuanto de conformidad con el artículo 19 del Reglamento de Regencias Forestales (Decreto Ejecutivo Nº 26870 del 04 de marzo de 1998), "(...) Las instrucciones técnicas dadas por el regente, en cada visita que realice al predio, son de acatamiento obligatorio para el regentado (...)", quedando de esa forma sin sustento la posición esgrimida. En todo caso, debe anotarse que si el Regente Forestal no denunció oportunamente la violación de las estipulaciones del Plan de Manejo y la orden de paralización de operaciones que realizó, ante las instancias correspondientes, sea, el Colegio de Ingenieros Agrónomos y la Administración Forestal del Estado, no fue objeto de discusión y sanción en las resoluciones impugnadas, no pudiéndose emitir criterio a ese respecto por parte de este Tribunal, debiéndose tener presente que nuestra competencia funcional en este asunto está reducida a conocer lo actuado en el proceso, en relación con los agravios que planteen las partes interesadas, contra la sentencia de primera instancia, no pudiéndonos extender a asuntos no planteados oportunamente por las partes.- VII) Sobre el tercer agravio de la representación estatal: Analizado este argumento por parte del Tribunal, se encuentra que si bien lleva razón parcialmente con lo cuestionado, esa situación no tiene el mérito suficiente para revocar la sentencia venida en alzada.
Se afirma lo anterior con base en las siguientes consideraciones: a) Si bien es cierto antes se dijo que la instrucción técnica de paralización de la ejecución del Plan de Manejo, tenía carácter obligatorio y como tal el regentado Nombre80089 , no podía incumplirla, también es cierto que la responsabilidad del Regente Forestal, no cesa sino hasta la confección y presentación del informe final de cierre de actividades, según lo dispone el artículo 18 del Reglamento de Regentes Forestales: "El regente deberá presentar un informe final de cierre de sus actividades por cada plan de manejo que esté a su cargo", no siendo aceptable sin más el criterio expresado en la sentencia de primera instancia, que entiende que la responsabilidad se reduce a la mera realización de las visitas y termina con la instrucción técnica de paralización. No obstante ser éste el régimen jurídico imperante, lo cierto es que este caso en particular la responsabilidad del Regente Forestal y aquí actor, no puede continuar después de esos actos, por cuanto fue la propia Administración Forestal del Estado, la que a pesar de la existencia de esa orden de paralización que también la vinculaba, emitió guías que permitieron que la explotación maderera continuara, facilitando de esa manera que se produjera el daño ambiental, impidiéndose por esa circunstancia que se pueda aplicar la norma citada, en todos sus alcances; b) En todo caso, no es cierto que en la sentencia de primera instancia no se haya hecho referencia a los argumentos del Estado para sostener la responsabilidad del Regente Forestal, establecida en las resoluciones cuestionadas del Tribunal Ambiental Administrativo, siendo que por el contrario en la resolución venida en alzada, se hizo una amplio análisis del régimen jurídico de responsabilidad administrativa de los regentes forestales, analizándose entre los considerandos VI y IX, las disposiciones de la Ley Orgánica del Ambiente, con relación a la Ley Forestal y disposiciones conexas como la Ley de Biodiversidad.
También se explicaron los alcances del Reglamento de Regentes Forestales, el Reglamento a la Ley Forestal y la propia Ley del Colegio de Ingenieros Agrónomos, no existiendo de esa forma, las omisiones acusadas tendientes a cuestionar la legalidad de la sentencia de primera instancia.- VIII) Sobre el cuarto agravio de la representación estatal: Es criterio del Tribunal que tampoco con los argumentos mencionados, la representación estatal lleva razón. En primer lugar, la parte recurrente no precisa cuál fue la prueba para mejor proveer que ofreció, ni en qué oportunidad procesal lo hizo, convirtiéndose el cuestionamiento realizado en impreciso, además que ni siquiera se menciona la importancia que la prueba sobre la cual supuestamente se omitió pronunciamiento, como puede incidir en la adecuada resolución de la causa, ni la manera en que dicha prueba puede cambiar lo resuelto. En segundo término, tampoco es cierto que la condenatoria a indemnizar cinco millones de colones por concepto de daño moral, esté desprovista de consideraciones de fondo, siendo que más bien se hace un amplio análisis y explicación al respecto, al final del considerando X de la sentencia impugnada (folios 749-751), quedando sin sustento también este cuestionamiento.
Finalmente, tampoco acierta la representación estatal cuando afirma que en la sentencia de primera instancia, haya contradicción cuando acoge parcialmente la excepción de falta de derecho, habida cuenta que lo así resuelto es correcto, en el tanto se acogió parcialmente la acción en cuanto a las pretensiones de anulación de los actos administrativos y de indemnización por concepto de daño moral, rechazándose en lo concerniente a la reparación del daño material, correspondiendo entonces acoger la excepción de falta de derecho, en cuanto a las pretensiones rechazadas y rechazarla en cuanto a las pretensiones que fueron declaradas con lugar.- IX) Recurso de apelación del actor: La impugnación fue expuesta en dos oportunidades procesales: la primera, la interposición del recurso de apelación (folios 755-765) y la segunda, el escrito de expresión de agravios (folios 784-795): En ambos libelos, la impugnación se contrae en esencia a cuestionar el rechazo del daño material, que fue rechazado en la sentencia de primera instancia.
Aduce que existió una errónea apreciación de la prueba, habida cuenta que en los autos aportó certificaciones del Colegio de Ingenieros Agrónonos, en el que se prueba la cantidad de trabajo, consistente en 152 contratos o formularios de Regencia Forestal en el períodos 1993-2000, afectándose ese nivel de trabajo con las resoluciones 796-01-TAA y 199-02-TAA del Tribunal Ambiental Administrativo, viéndose truncada una boyante carrera profesional como Ingeniero y Regente Forestal, no volviéndosele nunca más a contratar por el desprestigio profesional sufrido, teniendo que subsistir por ayudas familiares. Alega que esa errónea apreciación de la prueba lo dejó en estado de indefensión e imposibilidad de resarcir el daño sufrido, siendo que el daño material consistente en el lucro cesante a causa de la inactividad profesional, fue estimado por perito actuario matemático. Insiste que dicha pericia está debidamente documentada y en forma contundente y con rigor científico y con base en los contratos de regencias inscritos en el Colegio antes mencionado, no tomándose tampoco en cuenta la certificación del Contador Público Autorizado donde se determinó los ingresos percibidos entre 1993 y 1998.
Afirma que no se valoró los testimonios de Nombre80092 , Juvenal Valerio Garita y Nombre80093 , que fueron contestes en la "negativa atmósfera" sufrida por la sanción que se le impuso, acreditándose la relación de causalidad existente entre la actuación administrativa y la pérdida de ingresos, debiéndose aplicar el principo de causalidad adecuada. Recalca que es falso que haya renunciado o endosado al Ingeniero Nombre80092 , siete casos por la situación persecutoria que se dio en contra de dicha persona, con lo afirmó la Juez a quo, siendo que el único ente que puede inhabilitar un Ingeniero o Regente Forestal, lo es el Colegio antes citado. Pide que se declare con lugar el recurso de apelación en lo que fue objeto de impugnación, aprobándolo en la suma de ciento diecinueve millones novecientos setenta mil seiscientos sesenta y siete colones (¢119.970.667,00), manteniéndose incólume la resolución recurrida.
En el escrito que se aprecia a folios 810-813, la representación estatal se opone a la apelación presentada por la parte accionante indicando que la certificación del Contador Público se basa en suposiciones y proyecciones, sin sustento, siendo que incluso, según los testimonios evacuados y especialmente el del declarante Nombre80092 , se puede entender que el actor accedió a trasladar sus clientes a otros Regentes Forestales, no lográndose demostrar que los supuestos daños materiales sufridos por él, tengan nexo causal con la conducta del Estado, estando acertado lo dicho a ese respecto en la sentencia indicada, en su parte considerativa (realiza las citas correspondientes). Recalca que para que prospere una pretensión de indemnización de daño, de acuerdo con la doctrina del artículo 196 de la Ley General de la Administración Pública, éste debe ser "efectivo, evaluable e individualizable en relación con una persona o grupo", siendo improcedente que se conceda en esas condiciones, debiéndose confirmar la sentencia impugnada en cuanto a ese extremo.- Analizado el agravio presentado por la parte actora, se encuentra que no lleva razón con lo planteado. El Tribunal llega a la anterior conclusión, por las razones que se apuntan a continuación:
Por tanto:
