DECISION NO. 1244-F-11 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, Goicoechea, at fourteen hours and twenty minutes on November 11, 2011.- ORDINARY PROCEEDING (PROCESO ORDINARIO), brought by AGROINDUSTRIAL EL MANANTIAL SOCIEDAD ANÓNIMA, corporate identification number CED1 - - , represented by [Nombre1], of legal age, agricultural entrepreneur, resident of Puriscal, identity card number CED2 - - , in his capacity as general attorney-in-fact without limitation as to amount (apoderado generalísimo sin límite de suma); against [Nombre2], also known as [Nombre2], agricultural entrepreneur, resident of Alajuela, identity card number CED3 - - ; and [Nombre3], agricultural entrepreneur, resident of Alajuela, identity card number CED4 - - . WHEREAS:
II.Counsel for the defendants, attorney Francisco Morera Alfaro and attorney María del Carmen Calvo Money, appeal the ruling. They contend that the interim relief (medida cautelar) granted does not satisfy the necessary requirements. They state that, by closing the channel, Mrs. [Nombre2] is merely exercising self-help (autotutela) to protect her rights as owner. They indicate that, although they were at one time compelled to open the channel by court order, that occurred previously, under different circumstances, and the order therefore ceased to have effect. What is occurring now is a return to the prior factual situation, which had been altered by the order to open the channel. They note that the lower court (a quo) states that the flow of water through the channel was what kept the water from flooding the adjoining property. This contention, they say, is unacceptable because the flooding problem is not caused by the channel but by the low infiltration capacity of the soils on both the applicant’s property and Mrs. [Nombre2]’s land.
The existing channel causes the neighbors’ water to flow through the defendants’ property. It was constructed artificially with a dredger rather than occurring naturally on the property of [Nombre4], who had applied for interim relief addressed in case file EXPN1, and it has a sufficient slope to cause the water to flow toward the co-defendants’ property. They state that the testimony of [Nombre5] clearly indicates that he knew the property in 1993 and 1998, when it belonged to [Nombre4], who sold it to Mr. [Nombre1], and that he stated that, when he worked for Don [Nombre4] during that period, the area where the channel is located was a “sheet of water,” where the water stood at ground level, and that it was only later that the channel was constructed with a dredger and the water from the property now owned by Agroindustrial El Manantial was channeled. They add that this channeling toward [Nombre4]’s property, which was later sold to Agroindustrial El Manantial, was directed toward Doña [Nombre6]’s property in approximately 2007, reaching that property and giving rise to the present dispute.
This rebuts the likelihood of success on the merits (apariencia de buen derecho) that the lower court deemed established. They indicate that it is untrue that Mrs. [Nombre2] Calvo’s closing of the channel after the effects of the court order had lapsed altered the factual situation regarding the flow of the water, since she acted strictly in the exercise of her rights as owner. That factual situation, altered when the channel carrying the water was artificially constructed, is entirely the responsibility of the owner of the property on which that channel is located, including whether any portions of that property flood, depending on the condition of the channel or the soil’s infiltration capacity. Instead, the lower court erroneously interpreted this argument as grounds for granting the relief. The judge goes even further by describing the soil’s infiltration capacity as “nil,” a fact of which he has no personal knowledge and which has not been established in the record; moreover, this is contrary to logic, because no matter how heavy the soil may be, it must have some infiltration capacity. [Nombre7], their clients are under no obligation to receive water artificially channeled through the use of a dredger to construct a channel.
They state that it is likewise unclear whether this is a public-domain watercourse (cauce de dominio público) originating from a spring (naciente). They argue that Mr. [Nombre1] knows he can construct drainage within his own property to channel his water toward [Dirección1], which adjoins his property, without improperly and abusively taking advantage of the defendants’ internal channels, which the defendants constructed at their own expense. As to the lower court’s statement that the water flowed over the top and fell into the parallel channel constructed by the parties against whom relief was sought, its assessment is incorrect and inconsistent with what was observed during the judicial inspection (reconocimiento judicial). The water does not pass over the top; rather, it seeps through the walls of the constructed channel, which is logical because the water exerts pressure from top to bottom.
They state that no damage to pasture was observed either; instead, pasture of a good height was observed, and no livestock operation was seen to be taking place on Agroindustrial El Manantial S.A.’s property. The arguments given by the lower court to support the requirements are wholly irrelevant; the ruling therefore lacks the required reasoning and must be declared null and void. They indicate that there is also no danger in delay (peligro en la demora), because the applicant failed to establish the alleged impact on production, demonstrating that neither the purported urgency nor the alleged irreparability of the harm exists. The applicant has shown no consistency in pursuing, processing, or arguing the various interim proceedings filed; indeed, this appears more like an act of harassment against the co-defendants and the judicial system than a situation warranting interim protection.
They state that it must be borne in mind that four long years have passed and that Agroindustrial El Manantial’s property remains in the same condition regardless of whether the channel is open or closed; they therefore ask, where is the danger in delay? They request that, if the decision granting interim relief is affirmed, the plaintiff be ordered to keep the channel free of all weeds, pasture, and fallen tree trunks. They further request that the applicant for interim relief be ordered to refrain from channeling any additional water and/or any water other than that already directed into the channel at issue, to prevent the volume from exceeding the channel’s current water-receiving capacity, all so as not to make the situation of the co-defendants’ property more burdensome. Finally, they request that a counter-security (contracautela) be ordered, requiring the plaintiff to provide a reasonable financial guarantee of approximately three million colones for any damages sustained by the co-defendants’ property as a result of receiving the channeled water originating from Agroindustrial El Manantial’s property, particularly if such damages result from the overflow of the channel at issue (see submission at folios 145 to 154).
III.The Tribunal Agrario has developed important case-law criteria identifying the requirements that must be met before interim relief may be granted: “II. Atypical interim relief (medida cautelar atípica) is based on three fundamental requirements: 1.- Residuality (residualidad): it must be established that the right for which judicial protection is sought is seriously threatened and cannot be protected through typical interim relief, thereby creating the urgency for the measure. For this purpose, it is essential to conduct a judicial inspection or to be accompanied by an expert in order to assess the actual imminent danger or risk. This is essential because the party requesting the measure could use the proceeding to delay the case or for no practical purpose. Logically, because such interim measures are not specifically provided for by law, they must be adopted on the basis of definite evaluative criteria that can be verified by the court; the mere assertion of one of the parties is insufficient to order the measure. 2.- Likelihood of success on the merits, meaning that the claim asserted in the principal action, or the right or public asset sought to be secured, is likely to be protectable under the legal system, that is, in the judgment on the merits.
This does not mean delving into the merits of the case; on the contrary, procedural simplicity must be maintained, since otherwise, if hearings are held or excessive evidence is taken, the purpose for which such measures were conceived would be distorted. 3.- Danger in delay, arising from the urgency of adopting the measure and preventing irreparable harm to any party, or to the collective interest, before the matter is decided. Article 242 of the Código Procesal Civil so provides by stating that interim relief must be adopted to prevent serious harm from occurring before judgment is rendered.- (T.S.A., decision No. 193 at 14:40 hours on April 23, 1997.)
IV.Interim measures (medidas cautelares) have been established to guarantee a party, generally the claimant (actora), effective judicial protection (tutela judicial efectiva), and are granted when the essential prerequisites for obtaining such protection under the legal system are met; they have also been granted for the protection of the environment. For purposes of ruling at this stage on the appellant’s grounds for appeal, it is necessary to provide a historical account of what has occurred in this case and in others that have led to the adoption of a series of measures in different proceedings, regarding which there is abundant documentary evidence in this case file. A series of interim measures have been ordered in different proceedings, both with the participation of the parties involved here and of others, as a result of the closure of the channel through which water from neighboring properties has been flowing and which continues through the channel closed by the defendant herein.
In prior proceedings involving the defendants herein and Mr. [Nombre4], this Court granted the interim measure requested by the latter, based on a series of documents and reports that have also been added to these proceedings as documentary evidence. At that time, when judgment Nº 532-F-09 of 8:19 hours on 30 de julio de 2009 was issued, the following was stated insofar as relevant: “... we find the following to have been established: 1.-) In marzo del 2008, defendants [Nombre3] and [Nombre6] carried out earthworks (movimientos de tierra) and removed materials from the watercourse (cauce) of a tributary of a stream whose spring (naciente) originates on the claimant’s property, flows through another neighboring property, and naturally crosses the defendants’ property. The principal purpose of this work was to obstruct the natural flow of the water, for which purpose fill was deposited using a Daewoo dredger (See photographs at folios 3 to 7 and record of the judicial inspection (acta de reconocimiento judicial) at folios 27 and 28). 2.-) The claimant’s property is entirely planted with hearts of palm, and it contains several channels for draining the water; it also contains a spring that flows downstream across the property of Agroindustrial el Manantial and enters the defendants’ property.
However, because of the obstruction, the water pools and in some places reaches a depth of more than a meter and a half; the aforementioned watercourse runs along the edge of the claimant’s heart-of-palm crops (see photographs at folios 31 to 46). 3.-) According to the assessment report of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, prepared in mayo del 2008, the obstruction created on the defendants’ property causes water to back up upstream; this is the only watercourse whose topographic conditions facilitate drainage and allow the water originating on the claimant’s parcel to be discharged. It also causes a reduction in water downstream, with the effects extending to the pasture areas on Mr. [Nombre1]’s property and to the heart-of-palm cultivation areas, which may be at risk because of high water tables. The obstruction was caused by the accumulation of soil and logs at coordinate point [Dirección2] (see report at folios 51 to 61). 4.-) According to studies by the Instituto Nacional de Transferencia y Tecnología Agropecuaria, a water table almost at surface level may cause diseases in heart-of-palm plantations (folios 108 to 117). 5.-) The technical report prepared on 5 de diciembre del 2008 by the Departamento de Aguas of MINAET determined that the drainage channel from the spring originating on the claimant’s property is a publicly owned watercourse (cauce de dominio público) and that the vehicle crossings must therefore be removed to allow the normal flow of the water resource (...) (report at folios 393 to 400).
V.- Based on the foregoing facts found to have been established, in the present case the Court reaches a conclusion different from that reached by the lower court (a-quo). As stated, the purpose of atypical interim measures (medidas cautelares atípicas) in agricultural and agro-environmental matters is to protect agricultural production and safeguard the environment and the natural resources underlying productive activities. Accordingly, there is not merely a purely individual interest in carrying on an economic agricultural activity or agricultural enterprise, but also a collective interest in ensuring that products, harvests, and therefore plantations, as well as natural resources, remain in good condition. Interim measures are essentially preventive: they seek to prevent irreparable harm or harm that would be difficult to remedy and therefore fall within the constitutional principle of ‘effective judicial protection,’ particularly where production is involved—as in this case, a heart-of-palm plantation—whose development requires certain groundwater conditions, since excessive moisture may cause plant stress and phytosanitary diseases.
Moreover, when a tributary naturally flows across neighboring properties until it empties into a stream, obstructing that tributary may have adverse effects not only on the normal use of the resource but also on productive activities upstream, because water pools, and downstream, because the water flow is reduced and is probably used for other productive activities. A biological risk consequently arises from human intervention, which could be avoided under the preventive principle (principio preventivo), now firmly established in environmental matters and extended to agri-food and agro-environmental matters. For these reasons, this Court considers wholly inexplicable the manner in which the ruling on this interim measure was delayed at first instance, as though it were effectively a full adjudicatory proceeding, when the proper course in interim proceedings is to make, as promptly as possible, a prima facie assessment (juicio de verosimilitud) to determine whether the prerequisites for granting the measure have been met; if granted, the measure constitutes a provisional solution to the underlying issue.
The court of first instance could have ruled on the interim measure based on the earliest evidence before it, because the established facts make it evident that the necessary prerequisites for granting it are present. The likelihood of success on the merits (apariencia de buen derecho) arises precisely from the existence of a heart-of-palm plantation and a channel through which the water from the spring originating on the claimant’s property flows. The danger in delay (peligro en la demora) is justified by the fact that the longer the proceedings continue, the greater the risk that harm may occur. And residual necessity (residualidad) undoubtedly lies in the fact that the interim measure is necessary because there is no other means of protecting against the factual risk sought to be avoided during the pendency of the proceedings. The evidence entered in the record shows that in marzo del 2008, defendants [Nombre3] and [Nombre6] carried out earthworks and removed materials from the watercourse of a tributary of a stream whose spring originates on the claimant’s property, flows through another neighboring property, and naturally crosses the defendants’ property.
The principal purpose of this work was to obstruct the natural flow of the water, for which purpose fill was deposited using a Daewoo dredger (See photographs at folios 3 to 7 and record of the judicial inspection at folios 27 and 28). In the months following those events, technical reports were prepared showing the impact of the obstruction. These included the assessment report of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, prepared in mayo del 2008, according to which the obstruction created on the defendants’ property causes water to back up upstream; this is the only watercourse whose topographic conditions facilitate drainage and allow the water originating on the claimant’s parcel to be discharged.
It also causes a reduction in water downstream, with the effects extending to the pasture areas on Mr. [Nombre1]’s property and to the heart-of-palm cultivation areas, which may be at risk because of high water tables. This final report logically confirms the need to apply not only the principles governing interim protection (tutela cautelar), but also preventive principles for environmental protection and, in this case, the principle that doubt must be resolved in favor of protecting natural resources, in accordance with Article 45 of the Ley Orgánica del Ambiente. It follows from all the foregoing that the measure must be granted in the manner stated below, but not without first noting that, although the defendant has submitted additional evidence, particularly photographs depicting the various drainage works carried out within the properties in dispute, that evidence cannot in any way rebut the prima facie assessment made by this Court in granting the measure, which, in any event, as stated, is provisional in nature (...) The appealed decision is reversed insofar as it denied the interim measure. Instead, the defendants are ordered, at their own expense, to reopen the closed channel until the matter is finally resolved, so that the water originating on the claimant’s property may flow normally ...” (see folio 1 of this interim-measure file).
It is clear from the foregoing that, although the reopening of the channel was ordered on that occasion, it was subsequently obstructed and filled again by the co-defendants herein, on the pretext that the interim measures previously ordered had ceased to be effective. Notwithstanding the foregoing, this Court considers the conduct of the co-defendants herein to be entirely in bad faith, because, despite knowing the effects caused by obstructing and filling the channel, particularly the flooding of neighboring properties, they did so again. It must be borne in mind that, although the aforementioned measure was granted with respect to Mr. [Nombre4], in this case the property of the claimant, Agroindustrial El Manantial S.A., is located between the two properties, that is, between the land of [Nombre6] and that of [Nombre4].
Furthermore, as stated in the above-cited judgment, the blocked channel also serves to drain several springs (nacientes) located on [Nombre4]’s land, thereby also affecting the flow of their waters. The purpose of the measure thus also extends to protecting that water resource, making the measure protective of the environment and not merely of the parties’ interests. It must not be overlooked that, as the appellant itself acknowledges, it is not yet clear whether this is a public-domain watercourse (cauce de dominio público); therefore, protection must be granted regardless of the parties’ interests in these proceedings. In this regard, it is important to highlight the technical report submitted by [Nombre8] and [Nombre9], engineers from the Water Department, appearing at folio 1271 of the principal case file, which states in point 2: “Due to the work already carried out on the main drainage channel crossing the properties, it cannot be determined with certainty whether it is natural or artificial because there has been human intervention; however, it serves to drain the spring located on the property of Mr. [Nombre4], and therefore that drainage channel is a public-domain watercourse.
(...) Recommendations: 1- Since the natural drainage channel of the spring was altered, it is recommended that the current watercourse be maintained as the principal drainage channel for that spring; it is therefore a public-domain watercourse, because the waters of the spring located on the property of Mr. [Nombre4] flow through it. Accordingly, the spring protection area, consisting of a radius of 100 mts around it, must be observed; furthermore, the watercourse shall have a protection area of 15 mts on each bank throughout its entire course, passing through the properties of [Nombre4], [Nombre1], and [Nombre2], until reaching its outlet at [Dirección1], pursuant to Article 33 of Ley Forestal 7575, all of the foregoing for the benefit of protecting the water resource and in accordance with the principle of In dubio Pro Natura....” This Court has no doubt whatsoever that the dispute concerns the same channel on which this Court ruled in the judgment cited above, except that the plaintiff on this occasion is Agroindustrial El Manantial S.A., represented by [Nombre1], who is even identified as the owner of the property in the reports cited above.
Contrary to the finding of the a quo that the co-defendants did not act in bad faith, this Court reaches a different conclusion, as it considers the co-defendants’ conduct to have been entirely malicious toward their neighbors and the environment, because they blocked the spring’s drainage outlet despite the warnings issued to them on previous occasions by the appropriate administrative authorities. The appellants’ arguments in their grounds for appeal are without merit because, regardless of whether it is a natural watercourse, the channel at issue serves to drain the neighboring properties, runoff water (aguas de escorrentía), and the waters of the spring located on the property lying between theirs, as explained above. Although the co-defendants have now closed the main channel, and although there is an administrative decision issued by the Water Directorate of the Ministry of Environment, Energy and Telecommunications at thirteen hours and thirty-seven minutes on the twentieth of September of two thousand eleven, appearing at folio 178 of this precautionary-measure record (legajo de medida cautelar), ordering both parties to close the drainage channels they opened without the corresponding permits, that decision refers to the other drainage channels that were opened, not to the main channel, which is deemed a public-domain watercourse because it drains the spring following the alteration of that channel.
In submitting the cited decision of the Water Directorate as evidence to assist the Court in reaching a decision (prueba para mejor resolver), the appellant makes a subjective and erroneous interpretation of its contents in an attempt to suggest that they were ordered to close the channels they had constructed. In this case, however, it is instead the main channel—which serves as the spring’s watercourse—that was closed; it must therefore be reopened as ordered in the decision under appeal. The court of first instance shall personally serve this decision on the co-defendants for purposes of the criminal offense of disobedience of authority should they fail to comply with what is ordered herein. For the foregoing reasons, the decision issued is affirmed, and the appellant’s grounds for appeal are rejected.
V.As to the requirement of countersecurity (contracautela), it is denied because the channel serves as drainage (desagüe) for the spring (naciente) located on [Nombre4]’s property and also crosses the properties of the parties participating in these proceedings.
POR TANTO
The ruling issued is affirmed.

VOTO Nº 1244-F-11 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ Goicoechea, a las catorce horas veinte minutos del once de noviembre de dos mil once.- PROCESO ORDINARIO, planteado por AGROINDUSTRIAL EL MANANTIAL SOCIEDAD ANÓNIMA, cédula jurídica número CED1 - - , representada por [Nombre1] , mayor, empresario agrario, vecino de Puriscal, cédula de identidad número CED2 - - , en su condición de apoderado generalísimo sin limite de suma; contra [Nombre2] , conocida como [Nombre2] , empresaria agraria, vecina de Alajuela, cédula de identidad número CED3 - - ; y [Nombre3] , empresario agrario, vecino de Alajuela, cédula de identidad número CED4 - - . Asimismo los últimos plantean reconvención contra AGROINDUSTRIAL EL MANANTIAL SOCIEDAD ANÓNIMA, de calidades antes mencionadas.Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica. Actúan como apoderados especiales judiciales: de la parte actora, los licenciados Álvaro Meza Lazarus, mayor, casado, abogado, vecino de Curridabat, cédula de identidad número CED5 - - ; Roldan Morales Novoa, mayor, casado, vecino de Heredia, cédula de identidad número CED6 - - ; y de la parte demandada los licenciados: Francisco Morera Alfaro, mayor, casado, abogado, cédula de identidad número CED7 - - ; María del Carmen Calvo Monney, mayor, soltera, abogada, cédula de identidad número CED8 - - .- Redacta el juez Darcia Carranza; y,
CONSIDERANDO:
II.Los apoderado s de l a parte demandada licenciado Francisco Morera Alfaro y licenciada María del Carmen Calvo Money apelan el fallo dictado. Considera n que la medida cautelar acogida no cumple con los presupuestos necesarios para ello. Dice que la señora [Nombre2] al cerrar el canal lo que está haciendo es autotutelando sus derechos como propietaria. Indican que si bien en algún momento se vieron en la obligación de abrir el canal por orden judicial, ello fue antes en otro momento por lo que perdió sus efectos. Lo que ahora ocurre, es que se vuelve a la situación de hecho anterior que había sido alterada con la orden de apertura del canal. Señal que el a quo indica que el discurrir de las aguas por el canal era lo que producía las aguas no se anegaran en la finca colindante. Ello, dicen, no es de recibo debido a que el problema de anegamiento, no se debe al canal, sino a la poca capacidad de filtración de los suelos de la finca de la promovente y también del terreno de la señora [Nombre2] .
El canal existente es el que hace que discurran las aguas de los vecinos por la propiedad de los demandados, canal que fue hecho artificialmente con una draga, no de forma natural en la propiedad de [Nombre4] quien fuera promovente de una medida cautelar que se conoció en el expediente EXPN1, con un grado de inclinación suficiente que hace que las aguas discurran hacia la propiedad de los codemandados. Dice, el testimonio de [Nombre5] es claro en indicar que conoció la propiedad en los años 1993 y 1998, la cual pertenecía a [Nombre4] , quien le vendió al señor [Nombre1] y manifestó que desde esa época en que trabajaba para don [Nombre4] , la zona donde esta el canal era un "paño de agua", en donde el agua estaba a nivel del suelo y que fue con posterioridad que se hizo ese canal con una draga y se encausaron las aguas de la propiedad hoy de Agroindustrial El Manantial. Agrega que ese encausamiento hacia la propiedad de [Nombre4] , que luego fe vendida a Agroindustrial El Manantial y aproximadamente en el 2007, fueron dirigidas hacia la finca de doña [Nombre6] haciéndose llegar hasta la misma y es lo que ha ocasionado hoy el presente conflicto.
Ello permite rebatir la apariencia de buen derecho que el a quo tuvo por demostrada. Indican, no es cierto que el hecho de que la señora [Nombre2] Calvo cerrara el canal por orden judicial haya alterado la situación de hecho del discurrir de las aguas por haber decaido los efectos de tal orden, en ejercicio estricto de sus derechos como propietaria. Esa situación de hecho alterada desde que se construyó artificialmente el canal que encausa las aguas es enteramente responsabilidad del propietario de la finca que tiene ese canal, si algunos de los sectores de su propiedad se anegan o no, dependiendo del estado del canal o de la capacidad de filtración del suelo. Argumento este que más bien se interpretó erróneamente por parte del a quo para acoger la medida. El juez incluso va más allá al señalar como de "nula" la capacidad de filtración del suelo, lo cual no solo no le consta y no está demostrado en autos, sino que es todo lo contrario a la lógica, pues por más pesado que sea el suelo, alguna capacidad de filtración debe tener. [Nombre7], sus representados no están en la obligación de recibir aguas encausadas artificialmente a través de la utilización de una draga para hacer un canal.
Dicen, tampoco está claro se trate de un cauce de dominio público de una naciente. Aduce, el señor [Nombre1] sabe que puede hacer una canalización dentro de su propiedad para encausar sus aguas hacia el [Dirección1] , que colinda con su propiedad, sin tener que aprovecharse en forma indebida y abusiva de los canales internos de los demandados, quienes han canalizado asumiendo todos los costos. En cuanto a lo dicho por el a quo de que las aguas discurrían por encima, cayendo al canal paralelo que realizaron los coaccionados, su apreciación es incorrecta y no concordante con lo visto en el reconocimiento judicial y no es que las aguas pasen por encima sino que se filtran a través de las paredes del canal hecho, lo cual es lógico porque las aguas presionan de arriba hacia abajo. Dice, tampoco se vio afectación de pastos, más bien se observó un pasto de buena altura y no se vio existiera una explotación ganadera alguna realizándose en el fundo de Agroindustrial El Manantial S.A., los argumentos expresados por el a quo para fundamentar los presupuestos carecen de toda relevancia por lo que adolece de la fundamentación debida y debe declararse la nulidad.
Indica, tampoco se da el peligro en la demora, por cuanto no logró demostrar la afectación productiva que dice tendría, lo que evidencia que la urgencia y presunta irreparabilidad del daño no es tal, pues no ha existido de parte de la promovente consistencia en la gestión, tramitación y argumentación de esos diversos procesos cautelares presentados, más bien pareciera una acción de hostigamiento a los codemandados y al sistema judicial que una situación que amerite tutela cautelar. Dice debe tenerse en cuenta son cuatro largos años, y la propiedad de Agroindustrial El Manantial, independientemente de si el canal está abierto o cerrado sigue en las mismas condiciones, por lo cual señala ¿dónde está el peligro en la demora?. Solicita en caso de que se confirme la resolución que acoge la medida cautelar, se ordene a la actora que deberá mantener libre de toda maleza, pastos y troncos de árboles caídos al canal.
Se ordene también a la promovente de la medida cautelar abstenerse de encausar más aguas y /o aguas diferentes a las ya inducidas, en el canal de marras, para evitar que sobrepase la capacidad de recepción de aguas que actualmente tiene, todo ello con el fin de no hacer más gravosa la situación de la finca de los codemandados y por último solicita se ordene una contracautela consistente en que la actora rinda una garantía económica prudencial de unos tres millones de colones, por los eventuales daños y perjuicios que sufra la propiedad de los codemandados por el motivo de estar recibiendo las aguas inducidas provenientes de la finca de Agroindustrial El Manantial y máxime si estos se producen por un rebalse del canal de marras (ver memorial a folios 145 a 154).
III.El Tribunal Agrario ha desarrollado importantes criterios jurisprudenciales, al reconocer los presupuestos necesarios para que pueda acogerse una medida cautelar: "II. La medida cautelar atípica se basa en tres presupuestos básicos: 1.- La residualidad, es necesario constatar que el derecho que se busca tutelar judicialmente está seriamente amenazado, sin posibilidad de protegerse mediante una medida cautelar típica, y de ahí la urgencia de tomar la medida. Es fundamental para ello practicar un reconocimiento judicial, o bien hacerse acompañar de un perito con el fin de valorar el verdadero peligro o riesgo inminente. Esto es fundamental por cuanto quien solicita la medida podría utilizar el trámite para atrasar el procedimiento o sin ningún sentido práctico. Lógicamente, tales medidas cautelares, por no tener una tipicidad en la ley, deben tomarse con parámetros valorativos ciertos y verificables por el Juzgador, no siendo suficiente la simple manifestación de una de las partes para ordenar la medida. 2.- La apariencia de buen derecho, en el sentido de que la pretensión de la demanda principal, o del derecho o bien público que se quiera asegurar, tenga probabilidad de ser tutelable en el ordenamiento jurídico, sea, en la sentencia de fondo.
Ello no significa entrar a descubrir el fondo del asunto, sino, por el contrario, lograr la sencillez procesal, pues de lo contrario, si se incurre en audiencias, o en pruebas desmedidas, se estaría desnaturalizando el fin para el cual fueron concebidas. 3.- El peligro de demora, por la urgencia de tomar la medida y evitar daños irreparables a alguna de las partes, o al interés de la colectividad, antes de que se falle el asunto. Así lo establece el artículo 242 del Código Procesal Civil al indicar que la medida cautelar debe tomarse para evitar que se cause una lesión grave, previo al dictado de la sentencia.- (T.S.A., voto Nº 193 de las 14:40 horas del 23 de abril de 1997.)
IV.Las medidas cautelares han sido previstas para garantizar a la parte, generalmente la actora, una tutela judicial efectiva, y se otorgan cuando se reúnen los presupuestos indispensables para obtener dicha protección por parte del ordenamiento jurídico , también se han dado para la tutela del ambiente . Para efectos de resolver en esta instancia los agravios del recurrente, se hace necesario hacer un recuento histórico de lo que ha venido sucediendo en este caso y otros que han dado pie a la toma de una serie de medidas en diferentes procesos y de lo cual existe abundante prueba documental en este expediente. Se han dictado una serie de medidas cautelares en diferentes procesos tanto con la participación de las partes aquí involucradas, como de otras por el cierre del canal por donde han venido discurriendo aguas de las fincas vecinas y que continúan por el canal que cerrara la parte aquí demandada.
Este tribunal en un proceso anterior en el que participaron los aquí demandados y el señor [Nombre4] había acogido la medida cautelar solicitada por éste último tomando como base una serie de documentos e informes que se encuentran también agregados como prueba documental a este proceso. En dicho momento al dictarse el voto Nº 532-F-09 de las 8:19 horas del 30 de julio de 2009 se había indicado en lo que interesa lo siguiente: "... tenemos por acreditado lo siguiente: 1.-) En marzo del 2008, los demandados [Nombre3] y [Nombre6] , procedieron a realizar movimientos de tierra y remoción de materiales, sobre el cau c e del afluente de una quebrada, cuya naciente se origina en la finca del actor, discurre por otra finca aledaña, y pasa naturalmente por el inmueble de los demandados. El objeto principal de dichos trabajos fue taponear el paso natural del agua, para lo cual se procedió a realizar un relleno con una draga marca Daewoo (Ver fotografías de folios 3 a 7 y acta de reconocimiento judicial de folios 27 y 28). 2.-) El inmueble del actor está totalmente cultivado de palmito, y en él existen varios canales para evacuación de las aguas, en él existe una naciente, que discurre aguas abajo sobre el inmueble de Agroindustrial el Manantial y se interna en la finca de los demandados, sin embargo, al producirse el taponamiento, el agua se estanca, siendo que en algunas partes alcanza una profundidad de más de metro y medio, el referido cau c e pasa a la orilla de los cultivos de palmito del actor (ver fotografías de folios 31 a 46). 3.-) Que según el informe de evaluación del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, realizado en mayo del 2008, el taponamiento realizado en la finca de los demandados, provoca un remanso de aguas arriba, siendo el único cau c e que por su condición topográfica facilita el drenaje y permite evacuar las aguas que se originan en la parcela del actor, además de que causa una disminución de aguas abajo, alcanzando dicha afectación las áreas de pasto de la finca del señor [Nombre1] y las áreas de cultivo de palmito, las cuales pueden estar en riesgo al mantener niveles freáticos altos.
El taponamiento fue generado por la acumulación de suelo y troncos, en el punto de coordenadas [Dirección2] (ver informe de folios 51 a 61). 4.-) Según estudios del Instituto Nacional de Transferencia y Tecnología Agropecuaria, el nivel friático del agua, casi a nivel de superficie, puede provocar enfermedades a las plantaciones de palmito (folios 108 a 117). 5.-) El informe técnico realizado el 5 de diciembre del 2008 por el Departamento de Aguas del MINAET, determinó que el drenaje de la naciente que se origina en la finca del actor es un cauce de dominio público y por lo tanto los pasos vehiculares, deben eliminarse para permitir el flujo normal del recurso hídrico (...) (informe de folios 393 a 400). V.- Con fundamento en los anteriores hechos tenidos por acreditados, en el presente caso el Tribunal llega a una conclusión distinta de la sostenida por el a-quo. Como se ha indicado, el fin de las medidas cautelares atípicas, en materia agraria y agroambiental, es la protección de la producción agraria y la tutela del medio ambiente y los recursos naturales que sirven de base a las actividades productivas, con lo cual no solamente existe un interés puramente individual, para el ejercicio de una actividad agraria económica o una empresa agraria, sino también colectivo, para que los productos, las cosechas y por ende las plantaciones se conserven en buen estado, lo mismo que los recursos naturales.
Las medidas cautelares son esencialmente preventivas, buscan evitar que se produzca un daño irreparable o de difícil reparación, y por eso se enmarcan dentro del principio constitucional de "tutela judicial efectiva", máxime cuando exista una producción, como en este caso una plantación de palmito, para cuyo desarrollo requiere de ciertas condiciones friáticas, siendo que la excesiva humedad le puede provocar estrés a las plantas y enfermedades fitosanitarias. Pero por otra parte, cuando existe un afluente de agua que discurre naturalmente, sobre propiedades vecinas, hasta desembocar a una quebrada, la obstrucción de ese afluente puede provocar efectos adversos, no solo al uso normal del recurso, sino a las activides productivas, aguas arriba, porque se producen estancamientos, y aguas abajo, porque se produce una disminución del caudal del agua, probablemente utilizado en otras actividades productivas.
Se genera en consecuencia un riesgo biológico, como producto de la intervención humana, que podría evitarse bajo el principio preventivo, consolidado en materia ambiental y ahora ampliado a temas agroalimentarios y agroambientales. Por esos motivos, este Tribunal considera totalmente inexplicable, la forma en la cual se ha prolongado la resolución de esta medida cautelar en primera instancia, como si se tratase prácticamente de un proceso de conocimiento, cuando en la medida cautelar lo correcto es realizar, a la brevedad posible, un juicio de verosimilitud para determinar si se dan o no los presupuestos necesario para acoger la medida, la cual en caso de proceder, es una solución provisional a un problema de fondo. Desde los primeros elementos de juicio que tuvo en poder el juzgado de primera instancia, pudo haber resuelto la medida cautelar, pues resulta evidente, conforme a los hechos probados, que existen los presupuestos necesarios para acogerla.
La apariencia de buen derecho, se deriva justamente de la existencia de una plantación de palmito, y de un canal por donde discurre el agua de la naciente que se origina en la finca del actor. El peligro en la demora, se justifica por el hecho de que entre más se prolongue la duración del proceso, más riesgo existe de que se pueda provocar un daño. Y la residualidad, sin duda alguna radica en que la medida cautelar resulta necesaria, al no existir otro medio para tutelar la situación fáctica del riesgo que se pretende evitar con la duración del proceso. De los elementos traídos a los autos resulta que en marzo del 2008, los demandados [Nombre3] y [Nombre6] , procedieron a realizar movimientos de tierra y remoción de materiales, sobre el cau c e del afluente de una quebrada, cuya naciente se origina en la finca del actor, discurre por otra finca aledaña, y pasa naturalmente por el inmueble de los demandados.
El objeto principal de dichos trabajos fue taponear el paso natural del agua, para lo cual se procedió a realizar un relleno con una draga marca Daewoo (Ver fotografías de folios 3 a 7 y acta de reconocimiento judicial de folios 27 y 28). El inmueble del actor está totalmente cultivado de palmito, y en él existen varios canales para evacuación de las aguas, en él existe una naciente, que discurre aguas abajo sobre el inmueble de Agroindustrial el Manantial y se interna en la finca de los demandados, sin embargo, al producirse el taponamiento, el agua se estanca, siendo que en algunas partes alcanza una profundidad de más de metro y medio, el referido cau c e pasa a la orilla de los cultivos de palmito del actor (ver fotografías de folios 31 a 46). En los meses posteriores a tales hechos ellos, se levantaron informes técnicos, en los cuales se evidencia el impacto de dicho taponamiento, tales como el informe de evaluación del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, realizado en mayo del 2008, el taponamiento realizado en la finca de los demandados, provoca un remanso de aguas arriba, siendo el único cau c e que por su condición topográfica facilita el drenaje y permite evacuar las aguas que se originan en la parcela del actor, además de que causa una disminución de aguas abajo, alcanzando dicha afectación las áreas de pasto de la finca del señor [Nombre1] y las áreas de cultivo de palmito, las cuales pueden estar en riesgo al mantener niveles freáticos altos.
El taponamiento fue generado por la acumulación de suelo y troncos, en el punto de coordinadas [Dirección3] y [Dirección4] (ver informe de folios 51 a 61). Por otra parte, también se constató según estudios del Instituto Nacional de Transferencia y Tecnología Agropecuaria, el nivel friático del agua, casi a nivel de superficie, puede provocar enfermedades a las plantaciones de palmito (folios 108 a 117). Finalmente, el informe técnico realizado el 5 de diciembre del 2008 por el Departamento de Aguas del MINAET, determinó que el drenaje de la naciente que se origina en la finca del actor es un cauce de dominio público y por lo tanto los pasos vehiculares, deben eliminarse para permitir el flujo normal del recurso hídrico (informe de folios 393 a 400). Con este último informe, se constata lógicamente la necesidad de aplicar no solo principios de tutela cautelar, sino también principios preventivos de protección al medio ambiente, y en este caso de duda en favor de la protección de los recursos naturales, lo cual está conforme con lo dispuesto en el artículo 45 de la Ley Orgánica del Ambiente.
De todo lo anterior se concluye que debe acogerse la medida en la forma que se dirá, no sin antes hacer ver que si bien la parte demandada ha aportado otras pruebas adicionales, especialmente fotograrías en las cuales se representan los diversos drenajes realizados dentro de los fundos en conflicto, dicha prueba no puede de manera alguna desvirtuar el juicio de verosimilitud que este Tribunal hace para acoger la medida, que en todo caso, como se indicó, es de carácter provisional (...) Se revoca la resolución recurrida en cuanto rechazó la medida cautelar. En su lugar, se le ordena a los demandados, la reapertura del caño cerrado, a su costa, hasta que sea resuelto el asunto en forma definitiva, a fin de que el agua proveniente de la finca del actor discurra normalmente ..." (ver folio 1 de este legajo de medida cautelar) . De lo expuesto resulta claro que independientemente a que en dicha oportunidad se ordenó la reapertura del canal, posteriromente fue vuelto a taponear y rellenar por parte de los aquí codemandados bajo la excusa de que las anteriores medidas cautelares dictada perdieron su efectividad.
No obstante lo anterior considera es Tribunal el actuar de los aquí codemandados es totalmente de mala fe, pues a sabiendas de los efectos que causa el taponamiento del canal y su relleno, en cuanto a la anegación de los terrenos de los vecinos lo vuelve a hacer. Debe tenerse en cuenta que si bien es cierto la medida citada se dio respecto del señor [Nombre4] , en este caso el fundo de la parte actora Agroindustrial El Manantial S.A., se encuentra localizado entre ambos fundos, es decir entre el terreno de [Nombre6] y el de [Nombre4] . Por otra parte tal y como se indicó en el voto supracitado, el canal taponeado, sirve de desague también de unas nacientes existentes en los terrenos de [Nombre4] , por lo que también se afecta el discurrir de las aguas de las mismas, por lo que el objeto de la medida también tiende a la protección de dicho recurso hídrico, convirtiéndose la medida también en tutelar del ambiente y no solo del interés de las partes.
No debe dejarse de lado que tal y como lo reconoce la misma parte apelante, no esta claro todavía, si se trata de un cauce de dominio público o no, por lo que la tutela debe prosperar, independientemente al interés de las partes en este proceso. Resulta importante sobre este aspecto resaltar el informe técnico rendido por los ingenieros del departamento de Aguas [Nombre8] . y [Nombre9] . visible a folio 1271 del principal el cual en el punto 2- indica "Debido a los trabajos ya realizados en el drenaje principal que atraviesan las fincas no se pude determinar con exactitud que el mismo sea natural o artificial debido a que hubo intervención humana, pero el mismo sirve de drenaje de la naciente ubicada en la propiedad del señor [Nombre4], por lo que dicho drenaje es un cauce de dominio público. (...) Recomendaciones: 1- En razón que el drenaje natural de la naciente fue intervenida, se recomienda que se mantenga como drenaje principal de dicha naciente el cause actual, por lo tanto es un cause de dominio público, ya que por el transita las aguas de la naciente ubicada en la propiedad del señor [Nombre4] , por lo que debe guardar el área de protección de la naciente que equivale a un radio de 100 mts, a su alrededor, además el cause tendrá un área de protección de 15 mts., en cada margen del mismo, en todo su trayecto pasando por las fincas de los señores [Nombre4], [Nombre1], [Nombre2], hasta llegar a desemobocadura del [Dirección1] , esto según lo establecido en el artículo 33 de la Ley Forestal 7575, todo lo anterior en beneficio de la protección del recurso hídrico y apego al principio de In dubio Pro Natura...".
No le cabe la menor duda a este Tribunal se está discutiendo sobre el mismo canal sobre el cual este Tribunal resolvió en el voto citado supra, solamente que quien demanda en esta ocasión lo es la empresa Agroindustrial El Manantial S.A., representada por el señor [Nombre1] de quien incluso se habla como el propietario del fundo en los informes anteriormente citados. Contrario a lo indicado por el a quo, en cuanto a que no hay mala fe de parte de los codemandados, este Tribunal llega a una conclusión diferente, pues considera que el actuar de los codemandados es totalmente mal intencionado para con sus vecinos y para con el ambiente, al taponer el lugar de desague de la naciente a pesar de las advertencias que se le ha hecho en otras oportunidades por parte de las autoridades administrativas correspondientes. No llevan razón los apelantes en lo expuesto en sus agravios por cuanto a pesar de que se trate de un cause natural o no, el canal objeto de litigio sirve para desaguar los terrenos de los vecinos, las aguas de escorrentía y las aguas de la naciente ubicada fundo de por medio del suyo conforme lo expuesto.
Si bien es cierto en este momento se cerró el canal principal por parte de los codemandados y existe una resolución administrativa de parte de la Dirección de Agua del Ministerio de Ambiente, Energía y Telecomunicaciones, dictada en fecha de las trece horas treinta y siete minutos del veinte de setiembre de dos mil once visible a folio 178, de este legajo de medida cautelar, en donde se ordenó tanto a las partes cerrar los drenajes que han abierto por no tener los permisos correspondientes se refiere a los otros drenajes que se han abierto pero no al principal, el cual está considerado cauce de dominio público al desaguar la naciente por el mismo, al haberse intervenido dicho canal. La apelante al presentar como prueba para mejor resolver la resolución de la Dirección de Agua citada hace una interpretación subjetiva y errónea en cuanto a lo que la misma dice, para tratar de hacer ver se les ordena cerrar los canales que han hecho, pero dado en este caso, más bien se trata del canal principal que sirve como cause de la naciente el cerrado, deberá proceder a abrirlo conforme se le ordena en la resolución venida en alzada.
Notifíquese por parte del Juzgado de Instancia en forma personal a los codemandados la presente resolución para efectos del tipo penal de desobediencia a la autoridad en caso de no acatar lo aquí dispuesto. Por lo anteriormente expuesto se confirma la resolución dictada y se rechazan los agravios de la parte apelante.
V.En cuanto a exigir una contracautela la misma se rechaza pues el canal sirve de desague para la naciente ubicada en la propiedad de [Nombre4] y atraviesa las propiedades también de las partes intervinientes en este proceso.
POR TANTO
Se confirma la resolución dictada.
