Judge Picado Vargas drafts the opinion; and, CONSIDERING (CONSIDERANDO)
I.The request for additional evidence to aid the court’s determination (prueba para mejor resolver) is denied as unnecessary because the record contains sufficient evidence.-
II.The list of facts deemed proven is adopted, except for the second, which is a conclusion rather than a fact. It is amended as follows: 2.- On diez de noviembre del dos mil siete, defendant [Nombre2] appeared at the properties in dispute accompanied by four persons and prevented the plaintiff’s employees from continuing their work; from that time onward, he has prevented the plaintiff from accessing the property (Cf. Uncontested fact in facts 4 and 6 of the complaint at folios 41 to 42 and answer to the complaint at folios 90 to 91). The following is added: 3.- This complaint was filed on 29 de noviembre del año dos mil siete (Cf. Filing-receipt notation on the complaint at folio 47).-
III.Co-defendant [Nombre2] appeals the decision issued by the Juzgado Agrario de la Zona Sur at thirteen hours on treinta de junio del dos mil diez (folios 312 to 326), stating as follows: He challenges the finding that the plaintiff had current and immediate possession of the leased properties because the witnesses it presented are entirely biased, as their testimony benefits their employer, as in the case of witness [Nombre6] . He adds that the property has an area far larger than the location where the oral hearing (juicio verbal) was held, and therefore many of the defense witnesses had little knowledge of what was occurring in that specific sector, but attested that they had never observed the plaintiff performing monitoring duties, only employees of the defendant company. By way of example, he cites the testimony of witnesses [Nombre7] , [Nombre8] , and [Nombre9] . He concludes that the plaintiff’s possession must extend over all the leased land, not merely one sector of it, and therefore the plaintiff lacks standing to sue (folios 346 to 355).-
IV.Co-defendant [Nombre3] also appeals the cited decision, stating as follows: 1.- He challenges the finding that the plaintiff exercised current and immediate agricultural possession (posesión agraria), because the only fact it was able to prove was that it sent a young man on a motorcycle to perform monitoring duties, as reflected in the testimony of [Nombre7] , which does not qualify as agricultural possession. 2.- He states that costs should not have been awarded because, as indicated in the answer to the complaint, the defendant entered the land pursuant to a lawful right (amparado en derecho) (folios 356 to 357).-
V.Both appellants allege, as a ground of appeal, that it was not shown that the plaintiff exercised possession (posesión) over the land. They invoke witnesses offered by the defendant and consider the testimony of the other deponents unsuitable. Their ground of appeal is without merit. Agrarian case law has repeatedly held that, in the case of very extensive tracts of land, agricultural possession (posesión agraria) need not be exercised over every square centimeter of the land, since the entire tract is itself a single productive unit: “On any farm, and particularly on large ones, there are areas of land suitable for agricultural activity, others that are not, others designated as reserves, and lastly those designated for the infrastructure needed to carry out that activity. In this case, the disputed area was designated as a reserve and for infrastructure because, on the one hand, it was where the drainage channels essential for devoting the remainder of the farm to rice cultivation were located and, on the other, it is where the forested portion of the farm is situated.
If the channels and a road alongside them were maintained, it was because the plaintiff exercised possession over that area of land. It has already been stated that an entire farm need not be devoted wholly to production activity in order for possession of the whole to be deemed established, even less so now, when production policies must be consistent with sustainable development, which seeks a balance between nature and humankind so as not to destroy the habitat of living beings, including, of course, humankind. ...” TRIBUNAL AGRARIO, Voto No. 243 de las 14:15 horas del 28 de marzo de 1995. However, in the case before us, although ten farms were leased to the plaintiff (an uncontested fact according to the first factual allegation in the complaint and the answer), the trial court (a quo) acted properly in conducting the judicial inspection (reconocimiento judicial) and oral hearing (juicio verbal), as well as in defining the subject matter of the witness testimony, in the disputed area.
This Court agrees with the a quo that the plaintiff did prove its current and immediate exercise of agroforestry possession (posesión agroforestal) over the land. This special type of possession, specific to Agrarian Law (Derecho Agrario), constitutes “a de facto power exercised by a person—the agroforestry possessor or silviculturist—over a specific object: property of a forestry nature. This power is manifested through stable and effective possessory acts aimed at developing a plant biological cycle that results in forest species for commercialization. It is silvicultural activity and entails a series of effective acts by the silvicultural possessor directly intended to manage the biological cycle of the forest species the possessor seeks to produce, thereby ensuring continuity in the forestry activity—forest cultivation—subject to environmental-interest limitations; that activity must be performed while conserving the existing or intended tree vegetation and, with it, the ecosystems established on the property.
Agroforestry possession has been defined as an activity specific to a silvicultural enterprise, consisting of the timber exploitation of a forest through the extraction of timber trees and their subsequent and immediate reforestation, so that the productive biological cycle continues and the continuous use of that natural resource remains possible. Accordingly, the combination of these possessory acts constitutes the threefold function of agroforestry possession, which is enshrined in the first article of Ley Forestal No. 7575, establishing it not only as environmental but also as economic and social, since it creates employment through the agroforestry or silvicultural enterprise, which conducts its activity and exercises its possession through an agricultural contract for a forest management plan (plan de manejo forestal). The agroforestry enterprise is thus established not only as a producer of goods but also of environmental services, in accordance with the third article of that legislation, which is additionally grounded in a series of international treaties and conventions concerning agriculture and forestry that form part of our positive agrarian legal system, such as the 1972 Stockholm Declaration of the United Nations Conference on the Human Environment, the 1982 World Charter for Nature, the 1992 United Nations Conference on Environment and Development in Río de Janeiro, the 1994 United Nations Framework Convention on Climate Change, the 1997 Kyoto Protocol, the 1992 Convention on Biological Diversity, and the Regional Convention for the Management and Conservation of Natural Forest Ecosystems and the Development of Forest Plantations, among others.
To assert that this type of agricultural possession does not exist because it is not regulated in our Código Civil reflects a very limited view of the Costa Rican system of positive-law sources.” [Nombre10] () and another. Los interdictos en materia civil, agraria y ambiental, San José, Dupas, 2008, p.p.142-143. Agrarian case law has defined it in the same terms: “It would constitute commercial forest property if the entrepreneur’s activity entails participation in the biological cycle, from planting and cultivating trees to replacing one species with another and, in general, caring for the forest for silvicultural production, or at least the intention to submit to a legal regime whose obligation consists of promoting a business activity aimed at maintaining real property characterized by the production of timber trees to be placed on the market...” Sala Primera de la Corte Suprema de Justicia, Voto No. 92 de las 10:00 horas del 20 de junio de 1991.
In the case before us, the plaintiff company claims to have this type of current and immediate possession in its capacity as lessee of the defendants, which the latter accepted in their answer to the first and second factual allegations at folio 88. The defendants contend that the lease agreement has expired; however, that fact cannot be adjudicated through summary possessory proceedings (vía interdictal), pursuant to article 457 of the Código Procesal Civil, because such proceedings are not the proper avenue for resolving lease-related matters. The exercise of that possession was proven by the testimony of [Nombre7], who stated at folios 261 to 262: “I am aware of the dispute concerning this farm (...) I entered this property to harvest by order of Mr. [Nombre1]; I do not remember the exact date, but that was more than six years ago. The land was prepared and replanted, and the second time we entered to harvest was on November ten two years ago, in two thousand seven (...) Ston Forestal was responsible for planting that timber, and Ston maintains that plantation for four years, after which only monitoring is performed.” It should be noted that the witness states that he is specifically familiar with the sector of the farm where the dispute arose, at the front of folio 262.
For his part, witness [Nombre8] stated on the reverse of folio 263: “This farm had already been planted and harvested by Ston Forestal; it was replanted by Ston, and that is when I was assigned supervisory duties, which consist of monitoring the farm, preventing the timber from being stolen, and clearing brush, until two years have passed; after that, only monitoring is performed. That monitoring has continued to the present; in this specific case, a person comes every fifteen days (...) Ston maintains the property’s fences, including the firebreak. I have not seen anyone unaffiliated with Ston maintaining the fences and firebreaks.” Appellant Valenciano’s ground of appeal—that monitoring work does not constitute agroforestry possession—is incorrect because, once the harvest has taken place, that work forms part of the biological cycle of silviculture. Witness [Nombre6] testified in the same terms, attesting that the plaintiff company performed the harvesting, maintenance, and monitoring of the forest plantation (folio 265).
In contrast, the witnesses invoked in his favor by defendant [Nombre2] are unsuitable. On the one hand, witness [Nombre11], on the reverse of folio 261, refers to an area containing mamón trees but gives no indication of its location in relation to the disputed site and no dates or references to periods that would situate her testimony in time and place. Her testimony is therefore unsuitable because it provides no relevant evidence. Witness [Nombre9] is unsuitable because, at folios 262 and 263, he stated: “I was unfamiliar with this sector where we are (...) I have entered this sector where we are only once, three years ago.” Witness [Nombre12], at folio 264, refers, as did the preceding witnesses, to land containing mamón trees and states that he does not know who planted the gmelina trees. Accordingly, the plaintiff’s exercise of agroforestry possession is deemed proven, and the first ground of appeal in both appeals is denied.-
VI.As to the second ground of appeal, concerning the award of costs (condenatoria en costas), the appellant’s argument is without merit. The argument advanced cannot be entertained in summary possessory proceedings, in which the examination of matters relating to ownership rights is barred under article 457 of the Código Procesal Civil. To resolve this ground of appeal, it is necessary to examine the rules governing awards of costs under Costa Rican procedural law. In its broadest sense, an order to pay procedural and professional costs (costas procesales y personales) arises when a judicial decision requires a particular person to pay litigation expenses that, absent such an order, that person would not be obligated to pay. Therefore, the substance of an award of costs almost always concerns the expenses of the opposing party or parties. Under the principle of objective defeat (principio del vencimiento objetivo), the rule is that costs are awarded against the litigant who has lost the proceedings.
In accordance with the foregoing, in light of section 56 of the Ley de Jurisdicción Agraria and sections 221 and 222 of the Código Procesal Civil, this Court finds that the ground of appeal cannot be entertained because there are no elements establishing with certainty that the plaintiff litigated in good faith. Section 56 of the Ley de Jurisdicción Agraria establishes the principle of objective defeat, meaning that the losing party must bear the costs of the proceedings; because there is no evident good faith as required by article 222 of the Código Procesal Civil, applied supplementarily, the ground of appeal is denied and, as to the matters appealed, the decision under review is affirmed.
THEREFORE
As to the matters under appeal, the challenged decision is affirmed.

RESULTANDO:
Redacta el juez Picado Vargas, y;
CONSIDERANDO
I.Se rechaza la solicitud de prueba para mejor resolver por innecesaria al existir suficientes elementos de prueba en los autos.-
II.Se prohíja el elenco de hechos tenidos por demostrados, excepto el segundo que más que un hecho es una conclusión. Se modifica el mismo en el siguiente sentido: 2.- El día diez de noviembre del dos mil siete, el demandado [Nombre2] se apersonó a las fincas en conflicto en compañía de cuatro personas e impidió que los empleados de la actora continuaran con sus labores, y a partir de ese momento ha impedido a la actora el acceso a la finca (Cfr. Hecho no controvertido en los hechos 4 y 6 de la demanda a folios 41 a 42 y contestación de demanda a folios 90 a 91). Se añade el siguiente: 3.- La presente demanda se interpuso el día 29 de noviembre del año dos mil siete (Cfr. Razón de recibo en libelo de demanda a folio 47).-
III.El codemandado [Nombre2] presenta recurso de apelación contra la resolución dictada por el Juzgado Agrario de la Zona Sur a las trece horas del treinta de junio del dos mil diez (folios 312 a 326), manifestando lo siguiente: Refuta que se diera por demostrado que la actora estaba en posesión actual y momentánea en las fincas dadas en arriendo por cuanto los testigos ofrecidos por ésta son totalmente parciales pues benefician a su patrono, como es el caso del testigo [Nombre6] . Agrega que la finca tiene un área mucho mayor a la del lugar donde se realizó el juicio verbal, por lo que muchos de los testigos de descargo no tenían mucho conocimiento de lo que pasaba en ese sector en específico, pero dieron fe de que nunca han observado a la actora realizando labores de vigilancia, sino a empleados de la sociedad demandada. Cita de ejemplo al testimonio de los deponentes [Nombre7] , [Nombre8] y [Nombre9] . Concluye que la posesión del actor debe ser en todo el terreno arrendado, no solo en un sector de él, por lo que no existe legitimación activa (folios 346 a 355).-
IV.El codemandado [Nombre3] también interpone recurso de apelación contra la citada resolución, manifestando lo siguiente: 1.- Refuta que se tenga por demostrado que la actora ejercía posesión agraria actual y momentánea, ya que lo único que ésta pudo demostrar es que enviaba un muchacho en moto para realizar vigilancia, según consta en el testimonio de [Nombre7] , lo cual no califica como posesión agraria. 2.- Señala que no debió condenarse al pago de costas ya que como lo indicó en la contestación de la demanda, el demandado ingresó al terreno amparado en derecho (folios 356 a 357).-
V.Ambos recurrentes alegan como agravio que no se demostró que la actora ejerciera posesion sobre el terreno. Invocan testigos ofrecidos por la demandada y consideran inidóneos los testimonios de los otros deponentes. No llevan razón en su agravio. La jurisprudencia agraria ha sostenido, en forma reiterada, que tratándose de terrenos muy extensos, no se requiere que la posesión agraria se realice en cada centímetro cuadrado del terreno, pues en sí todo el terreno es una sola unidad productiva: “En cualquier finca y en especial las de gran extensión, existen áreas de terreno aptas para el ejercicio de la actividad agraria, otras que no lo son, otras destinados a reserva y por último las destinadas a infraestructura necesaria para el desarrollo de esa actividad. En este caso, el área en conflicto estaba destinada a reserva e infraestructura, ya que por una parte era en donde se encontraban ubicados los canales de desagüe indispensables para poder dedicar el resto de la finca al cultivo del arroz y porque en ella es donde se encuentra la parte boscosa de la finca.
Si a los canales y un camino a la orilla de éstos, se les daba mantenimiento era porque la actora ejercía posesión sobre esa área de terreno. Ya se ha dicho que no es necesario que toda una finca esté dedicada en su totalidad a la actividad de producción, para considerar que se está en posesión del todo, menos ahora, que las políticas de producción deben de estar acordes con el desarrollo sostenible, que pretende un equilibrio entre la naturaleza y el hombre, con el objeto de no destruir el hábitat de los seres vivos, incluyendo desde luego a aquél. ..." TRIBUNAL AGRARIO, Voto No. 243 de las 14:15 horas del 28 de marzo de 1995. Sin embargo, en el caso que nos ocupa, si bien fueron diez las fincas dadas a la actora en arrendamiento (hecho no controvertido de acuerdo con el hecho primero de la demanda y contestación); bien hizo el a quo en realizar el reconocimiento judicial y el juicio verbal, así como la determianción del objeto de la testimonial, en el área en conflicto.
Este Tribunal concuerda con el a quo que la actora sí demostró el ejercicio de una posesión agroforestal en el terreno actual y momentánea. Este tipo especial de posesión, propio del Derecho Agrario, constituye "un poder de hecho ejercido por un sujeto -poseedor agroforestal o silvicultor- sobre un objeto determinado: bien de naturaleza forestal. Este poder se manifiesta a través de actos posesorios estables y efectivos tendientes al desarrollo de un ciclo biológico vegetal que se traduce en especies forestales con el fin de su comercialización. Es la actividad silvícola, implica una serie de actos efectivos de parte del poseedor silvícola directamente encaminados a dirigir el ciclo biológico de las especies forestales que quiere producir, dándole continuidad a su actividad de silvicultura -cultivo del bosque-, con limitaciones de interés ambiental, debiendo realizar dicha actividad conservando la vegetación arbórea que exista o se pretende establecer y con ellos, los ecosistemas que en el fundo se hayan establecidos.
Se ha definido a la posesión agroforestal como aquella actividad propia de la empresa silvícola consistente en la explotación maderera de un bosque mediante la extracción de los árboles maderables y la posterior e inmediata reforestación con el objeto de que continúe el ciclo biológico productivo haciendo posible el aprovechamiento continuo de ese recurso natural. Es por ello, que la comunión de estos actos posesorios configuran la triple función de la posesión agroforestal, la cual se encuentra consagrada en el artículo primero de la Ley Forestal No. 7575, estipulándola no solamente como ambiental, sino también como económica y social, pues genera empleo a través de la empresa agroforestal o silvícola, la cual desarrolla su actividad y su posesión por medio de un contrato agrario de plan de manejo forestal, conformándose, la empresa agroforestal, no sólo como productora de bienes, sino también de servicios ambientales, de conformidad con el artículo tercero de dicha normativa, la cual tiene fundamento además en toda una serie de tratados y convenios internacionales en materia agraria forestal, que son parte de nuestro ordenamiento jurídico agrario positivo, tales como la Declaración de la Conferencia de las Naciones Unidas sobre el Medio Humano de Estocolmo en 1972, La Carta Mundial de la Naturaleza de 1982, la Conferencia de las Naciones Unidas sobre el Medio Ambiente y Desarrollo de Río de Janeiro de 1992, la Convención Marco de Cambio Climático de 1994, el Protocolo de Kyoto de 1997, el Convenio sobre Diversidad Biológica de 1992, el Convenio Regional para el Manejo y Conservación de la Biodiversidad y Protección de Áreas Silvestres Prioritarias de América Central, entre otros.
Afirmar que este tipo de posesión agraria no existe por no encontrarse regulada en nuestro Código Civil representa tener una visión muy limitada de lo que es el sistema de fuentes positivas costarricense." [Nombre10] () y otro. Los interdictos en materia civil, agraria y ambiental, San José, Dupas, 2008, p.p.142-143. La jurisprudencia agraria la ha definido en iguales términos: "Sería una propiedad forestal empresarial si la actividad del empresario implica la participación suya en el ciclo biológico, desde la siembra, cultivo de árboles, sustitución de unas especies por otras, y en general cuido del bosque con el fin de producción silvícola, o cuando menos la voluntad de someterse a un régimen jurídico cuya obligación consiste en impulsar una labor empresarial orientada a tener un inmueble caracterizado por producir árboles maderables para ser colocados en el mercado..." Sala Primera de la Corte Suprema de Justicia, Voto No. 92 de las 10:00 horas del 20 de junio de 1991.
En el caso que nos ocupa, la empresa actora aduce tener este tipo de posesión actual y momentánea, en carácter de arrendataria de la demandada, lo cual es aceptado por éstas en su contestación del hecho primero y segundo a folio 88. Se aduce por parte de las accionadas que el contrato de arrendamiento se encuentra vencido, sin embargo, dicho hecho no es susceptible de ser discutido en la vía interdictal, por disposición del artículo 457 del Código Procesal Civil, pues no es la vía para dilucidar aspectos arrendaticios. El ejercicio de dicha posesión se ha demostrado con el testimonio de [Nombre7] , quien a folio 261 a 262 afirmó: "Yo tengo conocimiento sobre el litigio que se da en esta finca (...) Yo entré en esta propiedad a cosechar por orden del señor [Nombre1] exactamente no recuerdo la fecha pero eso due hace más de seis años, se preparó el terreno y se volvió a plantar, y en una segunda vez que entramos a cosechar esa vez el diez de noviembre de hace dos años, el dos mil siete (...) La Ston Forestal se encargó de sembrar esa madera y el mantenimiento de esa plantación se la da la Ston, durante cuatro años y después lo que se da es vigilancia".
Nótese que el testigo afirma conocer en forma concreta el sector de la finca en que se da el conflicto a folio 262 frente. Por su parte, el testigo [Nombre8] a folio 263 vuelto manifestó: "Ya esta finca había sido sembrada y cosechada por la Ston Forestal, se volvió a sembrar por la Ston y es cuando se me da las labores de supervisión las cuales consisten en la vigilancia de la finca, que no se roben la madera, las chapias, hasta los dos años después de ahí solo se da vigilancia. Hasta la actualidad se ha dado esa vigilancia, en este caso concreto una persona viene cada quince días (...) Las cercas de la propiedad de la Ston le da mantenimiento inclusive la ronda. No he visto personas fuera de la Ston dándole mantenimiento a las cercas y las rondas." El agravio del recurrente Valenciano de que las labores de vigilancia no constituyen posesión agroforestal es incorrecto, pues estas labores, una vez hecha la cosecha, son parte del ciclo biológico de la silvicultura.
En iguales términos declara el testigo [Nombre6] , dando fe de que la cosecha, mantenimiento y vigilancia de la plantación forestal se la ha dado la empresa actora (folio 265). En cambio, los testigos invocados a su favor por parte del demandado [Nombre2] no son los idóneos, pues, por una parte, la testiga [Nombre11] a folio 261 vto, se refiere a un sector de árboles de mamones pero no da señales de ubicación con el lugar en conflicto y fechas o referencia a épocas para poder situar en tiempo y lugar su testimonio, por lo cual no es idóneo ya que no aporta elementos de prueba relevantes. El testigo [Nombre9] no es idóneo pues a folio 262 y 263 indicó que "Por este sector en donde estamos no lo conocía (...) Por este sector donde estamos solo he ingresado una vez hace tres años". El testigo [Nombre12] a folio 264, se refiere igual que los anteriores testigos, a un terreno de mamones, y sobre la gemelina indica no saber quién los sembró. Por ende, se tiene por demostrado el ejercicio de la posesión agroforestal de parte de la actora y se rechaza el primer agravio de ambos recursos.-
VI.En cuanto al segundo agravio, relativo a la condenatoria en costas, no lleva razón el recurrente. El argumento esgrimido no es de recibo en el proceso interdictal, en el cual está vedado analizar aspectos relativos al derecho de propiedad conforme al artículo 457 del Código Procesal Civil. Para dilucidar este agravio, resulta menester analizar lo concerniente al régimen de condenatoria en costas que sigue el ordenamiento procesal costarricense. En su sentido más genérico, la condenatoria a pagar las costas procesales y personales se produce cuando hay una resolución judicial que impone a determinada persona el pago de estos gastos procesales que, sin dicha imposición, no estaría obligada a pagar. Por tanto, el contenido de la condena en costas se refiere casi siempre a los gastos de la parte o partes contrarias. La regla es, en virtud del principio del vencimiento objetivo, que la condena en costas está prevista para la parte litigante que ha sido vencida en el proceso.
De conformidad con lo expuesto a la luz del numeral 56 de la Ley de Jurisdicción Agraria y los numerales 221 y 222 del Código Procesal Civil, considera este Tribunal que el agravio no es de recibo pues no existen elementos que den certeza de que la actora litigó de buena fe, ya que el numeral 56 de la Ley de Jurisdicción Agraria establece el principio de vencimiento objetivo, en el sentido de que la parte perdidosa es quien debe correr con las costas del proceso y no existiendo evidente buena fe como lo exige el artículo 222 del Código Procesal Civil, aplicado supletoriamente, se rechaza el agravio y en lo apelado, se confirma la resolución venida en alzada.
POR TANTO
En lo objeto de apelación, se confirma la resolución impugnada.
