N º 426 -2011-I N º 426 -2011-I TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. FIRST SECTION. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. GOICOECHEA, ANNEX A. At fifteen hours and five minutes on treinta de setiembre de dos mil once.

Appeal in appraisal proceedings (diligencias de avalúo) for expropriation instituted by the INSTITUTO COSTARRICENSE DE ELECTRICIDAD -ICE-, represented in these proceedings by its General Judicial Attorney-in-Fact (Apoderada General Judicial), attorney Andrea Campos Villalobos, of legal age, single, an attorney, resident of Heredia, holder of identity card number CED26664, against Nombre39163, of legal age, married, an airline pilot, resident of Goicoechea, holder of identity card number CED29906. Acting as General Attorney-in-Fact without Limitation as to Amount (Apoderada Generalísima sin Límite de Suma) for the expropriated party is Victoria Diez Menk, of legal age, married, a homemaker, holder of identity card CED31265.

BACKGROUND

I.The Instituto Costarricense de Electricidad - Nombre9574 - instituted these proceedings so that the judgment may establish the compensation payable to Nombre39163 for the establishment of four tower sites and an easement right (derecho de servidumbre) over a strip of land measuring 36.771,20 square meters within a property owned by the latter, located in Naranjito de Aguirre and recorded in the Registro Público under Real Property Folio N°042940-000 of the Puntarenas Registry District. This property has a total area of 113 hectares and 1.414,13 square meters. On this land, Nombre9574 needs to establish an easement required for the passage of the transmission line known as SIEPAC, along its Dirección3800 - section.

II.The expropriated party did not accept the amount established in administrative appraisal (avalúo administrativo) N° 318-2006.

III.Attorney José Andrés Cruz Tenorio, Judge of the Contencioso Administrativo y Civil de Hacienda, by ruling number 1430-2010 issued at catorce horas cuarenta y ocho minutos del catorce de mayo del dos mil diez, ordered: “THEREFORE, the total compensation that the Instituto Costarricense de Electricidad must pay to Nombre39163 for the establishment of an easement and four tower sites on a property owned by the latter is set at TWENTY-TWO MILLION FOUR HUNDRED SEVENTY-SEVEN THOUSAND NINE HUNDRED TWENTY-FOUR COLONES AND SIX CÉNTIMOS (¢22.477.924,06). The property is located in Dirección4726, Province of Puntarenas, and, according to Registro Público Real Property Folio N°042940-000 of the Puntarenas Registry District, has a total area of 113 hectares and 1.414,13 square meters; its boundaries, according to the Registro Nacional certification, are as follows: North: Road with 834 linear meters and 85 centimeters; South: Ananias Cordero and Laura Mora; East: Road with 934 linear meters and P7 centimeters; West: El Manu de las Colinas S.A. Said amount is itemized as follows: ¢19.304.880,00 for the easement, ¢2.453.044,06 for damage to the remainder (daño al remanente), and ¢720.000,00 for the four tower sites.

The easement to be established has a centerline length of 1.226,50 meters, a width of 30,00 meters (15 meters on either side of the centerline), and a total area of 36.771,20 square meters; it runs northwest-southeast at an azimuth of 131º02'46'' degrees in its first section, beginning at the northern boundary with Nombre39164 and crossing the Río Naranjito; in its second section there is a change point, at which the azimuth changes to 146º52'46'' degrees, until it reaches the southern boundary with Ofelia Carpio Alfaro. Its boundaries are as follows: North: Dirección336; South: Ofelia Carpio Alfaro; East: Remainder of the property; and West: Remainder of the property. The tower sites to be established are described as follows: Z-57 is an angle tower located approximately 43 meters from the northern boundary; Z-58 is located 412 meters from the first tower; Z-59 is located 298 meters from the second; and Z-60 is located 445 meters from the third.

The Instituto Costarricense de Electricidad is ordered to pay legal interest on the difference between the amount established in the administrative appraisal and the compensation set in this judgment, from the date possession was taken, namely veintidós de abril del dos mil nueve, until the amount owed is paid in full. The Instituto Costarricense de Electricidad is ordered to pay all costs of this action. The expropriated property shall be devoted to the stated public purpose. The establishment of said easement over the cited land (N°042940-000 of the Puntarenas Registry District) in favor of the Instituto Costarricense de Electricidad shall be recorded in the Registro Público, expressly stating that the remainder, or servient estate (fundo sirviente), is encumbered by the transmission-line easement hereby established. The registration of said easement shall be exempt from the payment of fees, taxes, stamps, registration charges, and all other fiscal charges.

The following activities are prohibited within the easement strip: construction of residences, offices, commercial establishments, educational or sports facilities, and agricultural or livestock facilities; planting crops that are periodically burned (for example, sugarcane); planting flooded crops (for example, rice); maintaining vegetation (trees or crops) whose mature growth comes within five meters of the lowest conductor cables when those cables are under maximum-load or contingency conditions; earthworks (movimientos de tierra) that, through accumulation, raise or alter the natural ground level; storage of flammable or explosive materials; and accumulation of materials or other objects that come within five meters of the lowest conductor cables when those cables are under maximum-load or contingency conditions. If an excavation is planned near the support structures of the transmission lines, the Instituto Costarricense de Electricidad must be consulted beforehand. Access must be permitted to personnel responsible for the construction and maintenance of the works. Notice shall be given.”

IV.Disagreeing with that judgment, the respondent filed an appeal and a motion to nullify the judgment (recurso de apelación y nulidad de la sentencia); the appeal was admitted, and the appellate court therefore hears the matter.

V. The appeal has been processed as required, and this ruling is issued following the requisite deliberation

CONSIDERING

I.Regarding the evidence for better adjudication (prueba para mejor resolver) offered by the expropriated party: The appellant offers, as evidence for better adjudication, a copy of public deed Nº 120 executed before Notary Public Jacqueline Hidalgo Rojas on 9 de octubre del 2009, whereby a right-of-way easement (servidumbre de paso) was created over a property owned by the appellant, consisting of pastureland located in the same area and place as the present expropriation, for which Nombre9574 paid him the sum of Siete millones doscientos diecisiete mil setecientos cincuenta colones con cincuenta céntimos for an affected area of cuatrocientos noventa y seis punto cinco metros cuadrados. In this regard, pursuant to provisions 331 and 575 of the Código Procesal Civil, its admission is denied because, since it was not offered by the party at first instance and was obviously not assessed by the judge at that time when rendering judgment, it would implicitly entail reopening the original general dispute concerning fair compensation (justiprecio) on the basis of that newly submitted documentary information; the issue of fair compensation would then be decided at a single level of jurisdiction due to the necessary review, assessment, analysis, and ruling on that evidence, which would distort the concept of the technical two-tier review (doble instancia técnica) guaranteed in this area.

Such review must concern specific grounds of grievance arising from the judgment under review, since an appeal (alzada) is not procedurally structured as a party-initiated review of the matters litigated. A comparison with the case law reveals that: “Numerous precedents of this Chamber, referring to evidence for better adjudication, have stated that such evidence belongs to the judge, not to the parties. Consequently, the decision to obtain it is discretionary for the court, and it may dispense with it without issuing any ruling whatsoever. Therefore, the failure to rule thereon—precisely because the evidentiary stage, during which the parties must prove the facts giving rise to their rights as required by the rules governing the burden of proof, has already passed and that stage is closed—means that it shall be the exclusive prerogative of the adjudicator to determine whether new evidence necessary for the proper resolution of the dispute should be added to the record.

Among many others, the following decisions may be consulted: 59 de las 15:20 horas del 31 de mayo de 1996, 23 de las 14:20 horas del 4 de marzo de 1992, 34 de las 10:45 horas del 28 de mayo de 1993 y 83 de las 14:40 horas del 22 de diciembre de 1993. (…)”. In support of the foregoing, judgment N ° 29 de las quince horas treinta minutos del veintidós de febrero de mil novecientos noventa y cinco, issued by the Sala Primera, clarifies the following: “(…) The central feature of evidence for better adjudication is its optional or discretionary nature; it cannot be demanded by the parties. Its ordering depends entirely on the initiative, prudence, and judgment of the court, and consequently, its denial does not cause any lack of opportunity to present a defense.” Due regard must likewise be given to the consistent judicial course (iter jurisdiccional), which establishes that “after the filing of the complaint and the answer thereto, only those documents contemplated in article 293 of the same Code are admissible, namely: documents bearing a later date; documents previously unknown to the party submitting them; documents that could not previously have been obtained for reasons not attributable to the interested party; or documents that, without constituting the basis of the complaint, serve to rebut the defendant’s defenses or constitute supplementary evidence.

Accordingly, to be admissible under canon 575, first paragraph, of that Code, documentary evidence on appeal must fall within one of the circumstances contemplated in article 293 thereof. The legislature’s intent is not to make it possible to offer any document whatsoever at that stage; on the contrary, it seeks ‘...to impress upon litigants that all evidence must be offered at first instance and that the taking of evidence at second instance is exceptional, without prejudice, of course, to the authority to order evidence for better adjudication.’ In exceptional cases, other types of evidence besides confessional or documentary evidence are also admissible at second instance. In this regard, the first paragraph of article 575 of the aforementioned Code establishes five exhaustive circumstances in which such evidence would be admissible, namely: ‘1) When, for reasons not attributable to the appellant, all or part of the evidence proposed at first instance could not have been taken.

  • 2)When an event has occurred that gives rise to a supervening defense.
  • 3)When an absent defendant for whom a guardian ad litem (curador) has been appointed enters an appearance in the proceedings after the opportunity to offer evidence at first instance.
  • 4)When a new event having an actual bearing on the decision has occurred and could not have been alleged at first instance, or when the interested party has learned of an earlier event of equal importance and affirms that it had no prior knowledge thereof.
  • 5)If the parties agree as to its necessity and propriety.’ Nevertheless, the court retains the authority to order only such evidence as it considers indispensable, logically taking into account the relevance of the evidence and the probative elements already incorporated into the proceedings, as expressly provided in the second paragraph of the aforementioned provision” (Sentencia N° 000235-A- S1-2008 de las nueve horas cinco minutos del cuatro de abril del dos mil ocho; to the same effect, see Sentencia N° 794-F-2006, 9 horas 31 minutos del 9 de octubre de 2006 and Sentencia N° 790 de las 11 horas del 10 de septiembre del 2004). It follows from the foregoing that the documentary evidence offered by the appellant before the Court does not correspond to any of the circumstances stipulated in provisions 293 and 575 thereof, since there is no indication or reference whatsoever intended to justify its admissibility on that basis.

I I.- The list of proven and unproven facts is approved because it is supported by the elements contained in the record.

III.Grounds for appeal: Appeal by the expropriated party (apelación del expropiado). The appellant bases his disagreement essentially on seven grounds, as follows:

  • 1)The lower court (a quo) used as the principal basis for its decision the administrative appraisal (avalúo administrativo) submitted into the record, even though it had been rejected by the expropriating Administration when it accepted the expert report (dictamen) prepared by Engineer Muñoz; therefore, Engineer Muñoz’s report could not be ignored and rejected by the judge as it was in the judgment, which renders the judgment absolutely null and void because, in his view, the Administration, having issued the administrative act, is the only entity legally empowered to annul its own acts through the procedures established by the General Law of Public Administration. He contends that the lower court lacks legal authority to depart from the will of the Administration and, by doing so, violates Article 11 of the Political Constitution by arrogating powers that do not belong to it. He notes that the reasoning advanced by the judge to uphold the administrative appraisal and refuse to abide by the will of the Administration rests on a situation that is unusual and entirely unrelated to the parameters for determining fair compensation (justo precio), namely the protection of public resources. In his opinion, if the lower court believes that public funds have been misused or that ICE officials have committed irregularities in their use, that issue must be heard by the competent authorities, such as the Office of the Comptroller General of the Republic and the criminal courts, but not in these proceedings, whose purpose is to determine fair compensation and not injury to the Public Treasury.
  • 2)In the challenged judgment, the lower court retracts and disregards its prior agreement to grant his request to supplement the report so that it would address the environmental and tourism-related impact and the damages caused. The court had even considered that expert work in support of the adjustment of the expert fees approved in the record, yet, without any technical explanation or appraisal evidence—which, in his opinion, warrants disqualification—the court rejects it, stating that determining the value of environmental damage (daño ambiental) requires the existence of a business or a project for the development of commercial and tourism activities. He notes that the reports submitted demonstrate that the portion of the property to be expropriated is tourism-oriented in nature and that tourism is the only activity that could be developed there; therefore, he has been deprived of that tourism right because the easement (servidumbre), measuring 3 hectares and 6.771,20 square meters, divides the property and encroaches upon its best portion.
  • 3)He contends that the scope of the legal institution of expropriation (instituto de la expropiación) outlined by the lower court cannot in any way affect the fair compensation sought in these proceedings, and that the imposition of an easement on real property, whether or not towers have been installed, always deprives the expropriated party of the right to exercise the incidents of ownership, since the restriction is lifelong and permanent and causes the property to lose its identity. He further contends that the importance of electricity service has nothing to do with the assessment of just compensation (justiprecio), because its cost is borne by the customers.
  • 4)The lower court makes assessments concerning differences between the administrative appraisal and the judicial appraisal (avalúo judicial) that are improper, unlawful, and null and void as a matter of law because the administrative appraisal was revoked and rejected by the Administration. He notes that Nombre9574 did not object to the amount or raise technical or substantive arguments against the supplemental report submitted by the court-appointed expert when he addressed the environmental damage resulting from the harm caused by ICE. He states that the judge rejects Engineer Muñoz’s determination and assessment of the environmental impact without any technical assistance and fails to justify his assertions, since there is no evidence that the amount stated in the report is excessive, profit-making, or productive of disproportionate wealth to the detriment of the environment.
  • 5)He contends that the judgment violates Article 45 of the Political Constitution, as well as the provisions of 6313 de 1979 and 7495 de 1995 governing expropriations, by referring the expropriated party to another avenue in pursuit of compensation (indemnización). He states that at no time is compensation being sought for harm to a diffuse interest (interés difuso), but rather for environmental damage affecting him as the owner.
  • 6)The lower court rejects recognition of the item relating to tourism activity because it is contingent and future and therefore not compensable under Article 3 of the Expropriations Law. He contends that, because this damage was determined by the court-appointed expert and Nombre9574 raised no objection in that regard, the lower court could not depart from expert Muñoz’s report, disregard that evidence, and rely on mere legal speculation, such as Articles 194 and 196 of the General Law of Public Administration. He notes that ecotourism is provided by nature and does not require a Canopy, and that the court-appointed expert warns that the imposition of the easement will cause visual pollution, resulting in the loss of the property’s comparative advantage as an exclusive natural-forest property because of both the physical and visual discontinuity. He notes that the judge has no technical evidence of any kind supporting his position regarding Engineer Muñoz’s supplemental expert report, and that his reasons for rejecting it are based on his own statements, personal and subjective assessments, and provisions bearing no relationship whatsoever to the expropriation proceedings.
  • 7)The trial judge insists on considering the administrative appraisal in determining just compensation and addressing its updating. The appellant reiterates that the judge could not assess the administrative appraisal because Nombre9574 had discarded it and it had been replaced by the court-appointed expert’s report, which must be followed because it reflects the will of the Administration. In his view, the amounts established in the judicial appraisal are those that must be approved by the judge, and the compensation ordered in the appealed judgment is contrary to the principles of legality, legal certainty, and due process, because the judge assumes powers that do not belong to him and overturns the will of the Administration by claiming powers reserved exclusively to ICE’s senior authorities. He requests that the appealed judgment be annulled and the claim be dismissed, or alternatively that the amount of compensation set by the judge be set aside and replaced with the compensation amount established by expert Nombre39165 and accepted by ICE.

IV. FAIR COMPENSATION

To satisfy the guarantee of full restitution (restitución integral) inherent in the power of expropriation (potestad expropiatoria), the expropriated property must be valued in such a manner as to provide fair compensation rather than an extraordinary gain. Legal scholarship has sought to establish the parameters to be followed in determining fair compensation, which, according to García de Enterría, can be achieved only through judicial proceedings, the sole forum in which such “fairness” can be determined in each case. He understands it as the replacement value (valor de sustitución) of the property expropriated or otherwise affected, sufficient to acquire comparable property in place of that taken through expropriation or impairment. Others refer to just compensation as an element that serves as the determining factor of the objective value of the property expropriated or affected, namely its prevailing market price; that is, just compensation must correspond to the true economic value of the expropriated or affected property so as to provide sufficient money to obtain an adequate replacement for that property.

Nombre32650, an Argentine legal scholar, contends that fair value (justo valor) means that the expropriated party must receive a present and complete equivalent of the value of which he is deprived. That value must represent a cash amount, or its reasonable equivalent, for which an owner willing but not compelled to sell would have sold the property to a buyer willing but not compelled to purchase it, excluding speculation as a variable. As can be seen, the concept of just compensation seeks to achieve a balance whereby the expropriated party is not harmed through a reduction in the value of his real-property holdings, while also preventing it from becoming a source of profit to his benefit and to the corresponding detriment of the expropriating entity. This can be achieved only through a wise and prudent combination of the principles of equity and justice, such that just compensation, which is always discretionary in conception and determination, must refer in expropriation proceedings to the value of the real property in the condition and form of use in which it is taken by the expropriating entity, according to the values and other evidentiary elements contained in the record.

The compensation to be awarded in expropriation proceedings must be comprehensive and must cover the “market” value (valor venal) of the property in question. For that purpose, this concept is supplemented by the principles of “replacement value” (valor de reposición), “area values” (valores de zona), and “depreciation” (depreciación); on the basis of those principles and the positive and negative factors affecting the expropriated property, applied through technical instruments, the fair unit price is determined.

V. DETERMINATION OF FAIR VALUE (JUSTIPRECIO)

Expropriation or encumbrance through the creation of an easement (servidumbre) cannot generate an undue benefit either for the State that expropriates or imposes the encumbrance or for the party that is expropriated; there must be a balance between the two. Nor may it be overlooked that expropriation constitutes an individual and specific sacrifice and is, as such, discriminatory. Therefore, application of the principle of equality in bearing public burdens (Artículos 18 y 33 de la Constitución Política) requires fair restoration or compensation, which, this court notes, is that established by the trial judge. It could not be otherwise, since otherwise there would be no justification whatsoever for appointing expert witnesses in judicial proceedings (sede jurisdiccional), as none could disagree with the administrative appraisal (avalúo administrativo), because if it were corrected or modified, it would be argued that it had unlawfully been disregarded.

Section 36 of the Ley de Expropiaciones provides that: “The expert opinion must comply with the provisions of Article 22 of this law, and its purpose shall be to review the administrative appraisal so that it reflects the value of the property at the time it was appraised.” Nowhere does it state that the appraisal may not be modified, that matters not introduced during the administrative proceedings may not be included, or that the findings of the State’s expert witnesses may not be contradicted; it states only that the appraisal must reflect the price of the property when the administrative appraisal was performed, which, it bears repeating, does not mean that an opinion differing from that issued by the Administration may not be rendered. Accordingly, nothing in the Ley de Expropiaciones prevents the judge from departing from the opinions of the various expert witnesses contained in the record; rather, section 40 of the aforementioned Law expressly authorizes the judge to do so, subject only to the limitation that the judge may not exceed the highest amount estimated in the appraisals.

Otherwise, if the judge, with the assistance of the appointed expert witnesses, could review the matter only by checking whether the Administration’s expert’s description is correct, that would constitute a manifest mockery of the constitutional principle of effective judicial protection (tutela judicial efectiva). Although special expropriation proceedings have a limited purpose, that does not alter their judicial nature or the fact that their purpose is to determine fair value; accordingly, each party is entitled to fair, broad, and necessary judicial protection in determining the market value (valor venal) of the real property, as already stated. This is nothing other than judicial discretion, since the judge is the expert of experts. Furthermore, it should be noted that when an expert conducts an entirely new expert appraisal, thereby creating a new framework for analyzing the case, the judge is provided with additional grounds for reaching a decision.

Naturally, when the two opinions are compared, each point of disagreement identifies a deficiency that, in the judicial expert’s view, is present in the administrative opinion; such deficiencies need not in any sense be expressly stated, much less binding upon the judge. Of course, every expert appraisal is a recommendation to the judge, who ultimately is the expert of experts, such that the final determination always forms part of the judicial function, provided it is duly reasoned. It must also be recalled that determining fair value is, above all, a complex undertaking in which a considerable number of variables interact; therefore, the more factors that are considered, the lower the likelihood of judicial error and consequent harm to either party, without prejudice to the fact that, as a human endeavor, it will always be capable of improvement. Ultimately, the judge’s prudence, based on the rules of sound judgment (sana crítica), is the decisive element in determining fair value, insofar as this is not an undertaking governed by a single unequivocal criterion capable of establishing the specific amount of compensation payable in each particular case.

VI.The appellant’s objection concerns the judge’s determination of fair value, which the appellant believes fails to respect the amount set forth in the judicial appraisal (avalúo judicial), even though the expropriating entity raised no objection to that appraisal. In this regard, it should be noted that the compensation (indemnización) provided to redress the loss sustained within the expropriated party’s property interests is borne by all taxpayers through the tax system, since it is paid from public funds. Thus, expropriation arises from a legally established public interest and, as such, must be compensated subject to the limitations of the public interest on grounds of public necessity. Expropriation compensation constitutes the economic equivalent of the sacrifice imposed upon the expropriated party’s property interests and, consequently, must be aimed at fully restoring that party’s assets.

When the concept of “Fair Value” is used as a synonym for expropriation compensation, it refers to the idea of economic equilibrium and a commutative relationship, in which the word “fair” entails a duty to assess objectively and externally the value of what was taken and the damage caused by the expropriation. It must also be comprehensive and complete, so that the assets of the party subject to the expropriation relationship remain intact. Moreover, expropriation compensation must be free from any subjective assessment and must be determined in accordance with the law in order to be considered fair. Hence, determining the amount of fair value is fundamental. It may not in any way benefit only the expropriating authority; therefore, the economic value established as compensation must preserve the expropriated party’s assets intact by recognizing the property’s objective, current, or market value.

Otherwise, that is, if the compensation were derisory or merely symbolic, it would be unjust. Furthermore, compensation likewise cannot become a source of profit or wealth. Compensation can only mean reparation—comprehensive, fair, and full reparation for what has been expropriated—so as to eliminate any possibility of profit at the expense of public funds, since what the expropriated party obtains through compensation is an equalization or balancing of values, never profit, income, or capital gain.

VII.It should be noted that the legislature conceived expropriation as consisting of two phases: 1) The administrative phase, in which the individual subject to the Administration (administrado) is expected to agree to the value proposed by the expropriating authority, so that the matter results in an amicable, extrajudicial reconciliation of interests—that is, mutual agreement regarding the price of the property. 2) The judicial phase, in which, in addition to the State’s expropriation authority being exercised against the interests of the private party whose property is expropriated, the judge, as guarantor of judicial protection, directs the proceedings to carry out the expropriation in strict accordance with the law. Central to this phase is the judicial determination of the amount of compensation, since it is precisely on this issue that no reconciliation was reached during the administrative phase between the private party’s interests and those of the State.

There are, of course, other reasons why the judicial phase becomes necessary in an expropriation; nevertheless, for the particular case at hand, it is precisely the determination of the amount of compensation that is relevant. Accordingly, the failure to agree on the quantification of the compensation resulting from the deprivation of the property gives rise to a dispute over fair value that must be resolved at this stage—that is, during the judicial phase—and the resulting judgment will establish the corresponding amount of compensation, determine fair value, and order the deprivation of the expropriated property. In this context, the judge, as the expert of experts, shall determine the amount of compensation by establishing the claimed monetary value according to standards of prudence and reasonableness. There is no doubt that when the expropriated party refuses to accept the amount of the administrative appraisal and compels the expropriating authority to resort to judicial proceedings to obtain a determination of fair value, that party submits to the judge’s decision, which, it bears repeating, is neither arbitrary nor capricious, but rather the product of an analysis of the evidence in the record, the rules of sound judgment, and the application of the constitutional principles of prudence and reasonableness.

Such submission to the court cannot be precluded or displaced except by a formal out-of-court settlement in which both parties freely agree to set an amount and withdraw from the judicial proceedings. Because public funds are involved, determining the amount of compensation entails responsibility for their allocation and management; consequently, so long as that determination remains subject to the aforementioned proceedings, responsibility for determining fair value rests with the court. Even where the Administration has stated that the judicial appraisal may be accepted, it must be remembered that the judge serves as a guardian of legality (contralor de legalidad), which requires the judge to assess the reasonableness of the price, as well as all other circumstances relevant to establishing the suitability of the study conducted to determine fair value. In other words, the expropriating party’s acceptance of the judicial appraisal neither requires the judge to deem it valid nor makes it binding upon the judge, because the judge is required to scrutinize the scope and implications of that evidence.

The judge bears the responsibility and duty to verify the price, particularly when it will be paid with funds from the public treasury. The public interest inherent in expropriation proceedings requires the judge to go beyond the mere acceptance expressed by the state official, who may have been constrained by time considerations and a lack of knowledge regarding the conditions that must be considered when determining the amount of compensation. None of those reasons prevents the judge, in the exercise of sound discretion, from assessing, in accordance with the rules of sound judgment and for the purpose of determining the substantive truth (verdad real), the entire body of evidence that, in conformity with the legal system, makes it possible to determine the fair price. The judge is not a mere observer but a central participant in the proceedings, and responsibility for the decision rests with the judge. In this regard, the Sala Primera de la Corte Suprema de Justicia, in judgment Nº166-92 issued at 16:20 hrs on 18/12/1992, stated:

“The determination of fair value or compensation is legal in nature and not merely economic, since it involves an indeterminate concept; its magnitude and determination must be reviewed by the court.” In the same vein, it should be noted that the appellant’s disagreement with the decision of the court below to depart from the judicial appraisal (avalúo judicial) has no legal basis because, in addition to what has been stated thus far, Article 40 of the Expropriations Law (Ley de Expropiaciones) provides that expert appraisals (peritajes) constitute parameters for determining the final price to be awarded and, as such, are not binding on the judge, since the very purpose of this type of proceeding is to determine just compensation (justiprecio). To that end, assistance is sought from experts whose work establishes a price or financial compensation for the loss or impairment of property. It bears emphasizing, however, that the law itself allows judges to depart from expert reports and the evidence submitted in order to review the administrative appraisal.

Thus, the appellant’s arguments concerning this ground of appeal have no legal support, since the law itself authorizes the judge or the Court, as the ultimate arbiter of expert opinions (perito de peritos), to depart from the opinion expressed by the assisting experts, because the expert appraisal provides guidelines and criteria, but it is the judge or Court that ultimately establishes the amount of compensation (quantum indemnizatorio). Accordingly, the price ultimately determined is not the amount awarded by the expert or experts appointed in the record; rather, its determination is an exclusive function of the adjudicator because it constitutes a legal decision.

VIII. REGARDING THE AWARD OF COMPENSATION FOR ENVIRONMENTAL DAMAGE

Although it has been claimed as part of the just compensation sought by the expropriated party, the disputed issue concerning environmental damage (daño ambiental) and the failure to recognize the alleged tacit acceptance by the expropriating entity—based on its purported failure, according to the appellant, to oppose the supplemental judicial expert appraisal establishing environmental damage on the property upon which the easement (servidumbre) is imposed—warrants separate analysis. The judicial expert valued that damage at the exact sum of Thirty-five million four hundred thirty thousand colones. First, it should be noted that the judicial expert supplemented his opinion on 27 de setiembre del dos mil nueve and filed it with the court on 20 de octubre de ese mismo año (folio 112 a 149). By order issued at diez horas treinta minutos del diez de noviembre del dos mil nueve, the parties were granted a hearing regarding that supplement on veintitrés de noviembre de mismo año (folio 150), and the expropriating entity, through its representative, expressly opposed it (folio 151).

This refutes the appellant’s allegation that the expropriating entity did not oppose this supplement to the judicial expert appraisal, since the record demonstrates otherwise. Nevertheless, it must be noted that, even if the expropriating Institute had not responded to the supplement to the judicial opinion, this would not signify and could not be construed as tacit acceptance thereof, since a party’s silence cannot in any way be understood as acceptance to the detriment of its rights and duties. The same applies to the court below’s admission of that evidence when it was offered by the expropriated party and the requested supplement was authorized, since it must be remembered that a judge’s approval of the taking of evidence does not signify and cannot be construed as an advance favorable assessment of that evidence for purposes of granting the relief sought. The judge evaluates the evidence as a whole under the rules of sound rational judgment (sana crítica racional) and uses it as an instrument in accordance with the judge’s own judgment, analyzing it in light of the rules and principles governing the subject matter of the proceeding.

In the same vein, it must be remembered that the judge is not bound by the experts’ findings; rather, those findings serve as parameters for the judge’s final decision as the ultimate arbiter of expert opinions. Regarding Environmental Damage, it should be noted that, pursuant to subsection 1° of Article 11 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales): “everyone has the right to live in a healthy environment and to have access to basic public services.” This guarantee is expressly regulated in paragraph 2° of Article 50 of our Political Constitution (Constitución Política). This right entails the corresponding duty of States to promote the effective, expeditious, and diligent protection, preservation, and improvement of the environment, which in turn implies the need to establish a series of regulations—both national and international—aimed at preventing pollution and the irrational exploitation of natural resources.

In our legislation, environmental damage has no specific definition because the subject has not been addressed specifically as such. Nevertheless, an imprecise definition appears in the Organic Law of the Environment (Ley Orgánica del Ambiente), which establishes, as one of the principles underlying that Law, that damage to the environment constitutes an offense of a social, economic, cultural, and ethical nature. It is an offense of a social nature because it affects the foundations of society’s existence. It is economic because it harms productive resources. It is cultural insofar as it endangers the way of life of communities, and ethical because it threatens the very existence of present and future generations. It has been understood as damage affecting the human right to enjoy a healthy environment. Our Constitutional Court (Tribunal Constitucional) has defined the environment as follows: “All human life necessarily takes place in relation to the environment, particularly with respect to improving quality of life, which is the central objective required by development; however, development must relate to the environment in a manner that is harmonious and sustainable.” (Voto 3705-93 de las 15 hrs del 30 de julio de 1993).

Accordingly, it is maintained that the environment must be understood as a potential resource for development to be used appropriately, requiring integrated action with respect to its natural, sociocultural, technological, and political relationships; otherwise, its productivity is degraded for both the present and the future, and the heritage of future generations could be placed at risk. In the case before us, the supplement to the judicial expert appraisal does not refer to environmental harm caused by the imposition of the easement, such as the loss of flora and fauna, the loss of a healthy environment, pollution or the irrational exploitation of resources, threats to the way of life of communities, or other activities, all of which are necessary elements for determining environmental damage. Nor does the supplemental expert appraisal state that the alleged harm additionally threatens the very existence of present and future generations, or that the work performed by the Instituto Costarricense de Electricidad in imposing the easement is not related to the environment in such a way as to be harmonious and, still less, sustainable for development.

As the court below indicates, the expert appraisal at issue does not provide the technical elements necessary to establish a direct adverse impact resulting from the imposition of the easement that must be compensated personally, bearing in mind that this type of compensation is intended by law not to increase private wealth, but to mitigate the harm and restore the affected natural environment. Therefore, because the alleged damage was not established, this ground of appeal must be rejected, and the ruling of the court below is affirmed for the reasons set forth herein.

IX. REGARDING THE CONCOMITANT NULLITY

The appellant seeks the concomitant nullification (nulidad concomitante) of the judgment under appeal. In fact, nullification constitutes an extraordinary procedural remedy and, as such, is appropriate in cases involving procedural defects that disrupt the balance that must always exist between the litigating parties, leaving one party without a defense, or where the normal course of the proceeding has been violated. Outside those two circumstances, nullification must be assessed subject to the Principle of Preservation of Procedural Acts and Procedural Economy (principio de Conservación de los Actos Procesales y Economía Procesal). Furthermore, nullification is not warranted if the procedural step can be repeated or the action corrected, thereby avoiding unnecessary delays in the processing of the case. Having assessed the principles governing nullification, this Chamber finds no procedural defects or omissions in the present matter that would constitute grounds for nullification and consequently require the judgment to be declared null as alleged.

X.CONCLUSION.- For the reasons stated, with respect to the matters expressly identified by the appellant, the appeal and the request for nullification are denied, and the challenged judgment is affirmed in all respects.

THEREFORE

The evidence offered by the appellant for purposes of further adjudication is rejected. The requested nullification is denied. As to the matters under appeal, the judgment appealed from is AFFIRMED.

N º 426 -2011-I N º 426 -2011-I TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. SECCIÓN PRIMERA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. GOICOECHEA, ANEXO A. A las quince horas cinco minutos del treinta de setiembre de dos mil once.

Apelación en diligencias de avalúo por expropiación establecidas por el INSTITUTO COSTARRICENSE DE ELECTRICIDAD -ICE-, representado en este proceso por su Apoderada General Judicial, l a licenciada Andrea Campos Villalobos, mayor, soltera, abogada, vecina de Heredia, con cédula de identidad número CED26664 , contra Nombre39163 , mayor, casado, piloto aviador, vecino de Goicoechea, con cédula de identidad número CED29906. Actúa en condición de Apoderada Generalísima sin Límite de Suma del expropiado, la señora Victoria Diez Menk, mayor, casada, ama de casa, con cédula de identidad CED31265.

RESULTANDO

I.El Instituto Costarricense de Electricidad - Nombre9574 - , estableció estas diligencias para que en sentencia se fije la indemnización que le corresponde a Nombre39163 por la constitución de cuatro sitios de torre así como un derecho de servidumbre sobre una franja de terreno de 36.771,20 metros cuadrados en un inmueble propiedad de este último, que se ubica en Naranjito de Aguirre y el mismo está inscrito en el Registro Público en el folio Real N°042940-000 del Partido de Puntarenas. Este inmueble presenta un área total de 113 hectáreas 1.414,13 metros cuadrados. En este terreno, el Nombre9574 necesita constituir un derecho de servidumbre necesaria para el paso de la línea de transmisión denominada SIEPAC, en su tramo Dirección3800 - .

II. La parte expropiada no aceptó el monto establecido en el avalúo administrativo N° 318-2006

III.El licenciado José Andrés Cruz Tenorio , juez Contencioso Administrativo y Civil de Hacienda , mediante resolución número 1430-2010 de las catorce horas cuarenta y ocho minutos del catorce de mayo del dos mil diez , dispuso: “POR TANTO Se fija en VEINTIDÓS MILLONES CUATROCIENTOS SETENTA Y SIETE MIL NOVECIENTOS VEINTICUATRO COLONES CON SEIS CÉNTIMOS (¢22.477.924,06) la indemnización total que debe pagar el Instituto Costarricense de Electricidad a Nombre39163 por la constitución de una servidumbre y cuatro sitios de torre en un inmueble propiedad de este último, el cual se ubica en el Dirección4726 , de la Provincia de Puntarenas, que según Registro Público folio Real N°042940-000 del Partido de Puntarenas presenta un área total de 113 hectáreas 1.414,13 metros cuadrados y sus linderos según certificación del Registro Nacional son los siguientes: Norte: Camino con 834 metros 85 centímetros lineales; Sur: Ananias Cordero y Laura Mora; Este: Camino con 934 metros P7 centímetros lineales; Oeste: El Manu de las Colinas S.A. Dicho monto se desglosa de la siguiente manera: ¢19.304.880,00 por la servidumbre, ¢2.453.044,06 por el daño al remanente y ¢720.000,00 por los cuatro sitios de torre.

La servidumbre a constituir posee una longitud sobre línea de centro de 1.226,50 metros, un ancho de 30,00 metros (15 metros a ambos lados de la línea de centro) y un área total de 36.771,20 metros cuadrados; posee una orientación noroeste - sureste con un azimut de 131º02'46'' grados en su primer tramo, iniciando en la colindancia norte con Nombre39164 , pasando por el Río Naranjito; en su segundo tramo existe un punto de cambio, por lo que el azimut cambia a 146º52'46'' grados, hasta salir al lindero sur con Ofelia Carpio Alfaro. Sus linderos son los siguientes: Norte: Dirección336 ; Sur: Ofelia Carpio Alfaro; Este: Resto de finca y; Oeste: Resto de finca. Los sitios de torre a constituir se describen de la siguiente manera: la Z-57 es una torre de ángulo y se ubica aproximadamente a 43 metros del lindero norte, la Z-58 se ubica a 412 metros de la primera torre, la Z-59 se ubica a 298 metros de la segunda y la Z-60 se ubica a una distancia de 445 metros de la tercera.

Se condena al Instituto Costarricense de Electricidad al pago de los intereses legales sobre la diferencia entre el monto establecido en el avalúo administrativo y la indemnización fijada en la presente sentencia, a partir de la entrada en posesión, sea el veintidós de abril del dos mil nueve, hasta el efectivo pago de lo debido. Se condena al Instituto Costarricense de Electricidad al pago de ambas costas de esta acción. Destínese el inmueble expropiado al fin público indicado. Inscríbase en el Registro Público la constitución de dicha servidumbre sobre el terreno citado (N°042940-000 del Partido de Puntarenas) a favor del Instituto Costarricense de Electricidad, indicándose expresamente que sobre el remanente o fundo sirviente pesa la servidumbre de líneas de transmisión que en este acto se constituye. La inscripción de dicha servidumbre estará exenta del pago de derechos, impuestos, timbres, derechos de registro y demás cargas fiscales.

Dentro de la franja de servidumbre se prohíben las siguientes actividades: Construcción de casas de habitación, oficinas, comercios, instalaciones educativas, deportivas y agropecuarias, siembra de cultivos que se quemen periódicamente (por ejemplo caña de azúcar), siembra de cultivos anegados (por ejemplo arroz), permanencia de vegetación (árboles o cultivos) que en su desarrollo final se aproxime a cinco metros de los cables conductores más bajos, cuando éstos se encuentren en condiciones de carga máxima o de contingencia, movimientos de tierra que por acumulación eleven o alteren el nivel natural del suelo, almacenamiento de materiales inflamables o explosivos y acumulación de materiales u otros objetos que se aproximen a cinco metros de los cables conductores más bajos, cuando éstos se encuentren en condiciones de carga máxima o de contingencia. En caso de planear una excavación en las cercanías de las estructuras de soporte de las líneas de transmisión, deberán antes consultar al Instituto Costarricense de Electricidad. Se debe permitir el acceso a funcionarios encargados de la construcción y mantenimiento de la obra. Notifíquese. ”.

IV.Inconforme con dicho fallo, el accionado interpuso recurso de apelación y nulidad de la sentencia , recurso que le fue admitido y en virtud de lo cual conoce el tribunal en alzada.

V. Al recurso se le ha dado el trámite que corresponde y se dicta esta resolución, previa la deliberación de rigor

Redacta la Jueza Carmona Castro, y,

CONSIDERANDO

I.Sobre la prueba para mejor resolver ofrecida por la parte expropiada: El recurrente ofrece como prueba para mejor resolver, copia de la escritura pública Nº 120 otorgada ante la notaria Jacqueline Hidalgo Rojas el día 9 de octubre del 2009, mediante la que se constituye servidumbre de paso sobre una finca propiedad del recurrente, que es terreno de pastos ubicada en la misma zona y lugar de la presente expropiación, en la que el Nombre9574 le pagó la suma de Siete millones doscientos diecisiete mil setecientos cincuenta colones con cincuenta céntimos por una afectación de un área de cuatrocientos noventa y seis punto cinco metros cuadrados. Al respecto, de conformidad con los numerales 331 y 575 del Código Procesal Civil, se deniega su admisión, por estimarse que al no haber sido ofrecida por la parte en la instancia inicial y obviamente no valorada por el juez en esa oportunidad para el dictado de su sentencia, implícitamente traería la reapertura del debate primigenio general sobre el justiprecio con base a esa nueva información documental aportada, resolviéndose entonces en un único grado la cuestión del justiprecio por la necesaria revisión, valoración, análisis y pronunciamiento de esa prueba, lo que desnaturalizaría el concepto de la doble instancia técnica garantizada en esta materia, misma que debe recaer sobre aspectos puntuales de agravio ocurridos en la sentencia en revisión, esto, por no instrumentalizarse adjetivamente la alzada en una revisión rogada de lo discutido.

Parangón jurisprudencial revela que en: "Múltiples precedentes de esta Sala, refiriéndose a la prueba para mejor resolver, han señalado que esta es prueba del juez, y no de las partes. En consecuencia, la decisión de recabarla es facultativa del órgano jurisdiccional, y puede prescindirse de ella sin necesidad de resolución alguna. Ergo, la omisión de pronunciamiento a su respecto, precisamente porque ha sido rebasada la etapa probatoria, en la cual deben las partes demostrar los hechos constitutivos de su derecho, según lo imponen las normas sobre la carga de la prueba y precluida aquella etapa, será facultad exclusiva del juzgador, determinar si deben allegarse a los autos nuevas probanzas necesarias para la correcta decisión del litigio. Pueden consultarse, entre muchas otras las siguientes resoluciones; 59 de las 15:20 horas del 31 de mayo de 1996, 23 de las 14:20 horas del 4 de marzo de 1992, 34 de las 10:45 horas del 28 de mayo de 1993 y 83 de las 14:40 horas del 22 de diciembre de 1993.

(…)”. En abono a lo anterior, la sentencia N ° 29 de las quince horas treinta minutos del veintidós de febrero de mil novecientos noventa y cinco dictada por la Sala Primera, aclara lo siguiente: “(…) El aspecto medular de la prueba para mejor proveer es su carácter facultativo o discrecional, no pudiendo ser exigida por las partes; su ordenación depende, enteramente, de la iniciativa, prudente y criterio del órgano jurisdiccional, consecuentemente su denegatoria no causa indefensión alguna”. Debe atenderse de igual manera al iter jurisdiccional reiterado que informa que "con posterioridad a la presentación de la demanda y su contestación, únicamente son admisibles aquellos documentos previstos por el artículo 293 del mismo Código, a saber: los de fecha posterior, los no conocidos antes por la parte que los presenta, los que no haya sido posible adquirir con anterioridad por causas no imputables al interesado o los que sin ser fundamento de la demanda, sirvan para combatir excepciones del demandado o constituyan prueba complementaria.

Por ende, la prueba documental en segunda instancia, para ser admisible según el canon 575, párrafo primero, de ese Código, debe encontrarse en alguno de los supuestos previstos por el 293 ibídem. La intención del legislador no es abrir la posibilidad de ofrecer cualquier documento en esa oportunidad, sino, al contrario, persigue "...hacer conciencia en los litigantes de que la prueba debe ser ofrecida en la primera instancia en su totalidad, y que es excepcional la recepción de prueba en segunda instancia, sin menoscabo, desde luego, de la facultad de ordenar prueba para mejor proveer." . También, en casos excepcionales, resulta admisible en segunda instancia otro tipo de prueba que no sea confesional o documental. Al respeto, el párrafo primero del artículo 575 del citado Código, establece cinco supuestos taxativos en los cuales esas pruebas serían admisibles a saber: "1) Cuando por causas no imputables al apelante no hubiere podido practicarse toda o parte de la prueba propuesta en primera instancia.

  • 2)Cuando hubiere ocurrido algún hecho que importe excepción superviniente.
  • 3)Cuando el demandado ausente a quien se le hubiere nombrado curador, se apersone en el proceso después de la oportunidad de ofrecer prueba en primera instancia.
  • 4)Cuando hubiere ocurrido algún hecho nuevo de influencia efectiva en la decisión, que no hubiere podido alegarse en primera instancia, o que hubiere llegado a conocimiento de la parte interesada alguno anterior, de la misma importancia y del cual asegure no haber tenido antes noticia.
  • 5)Si las partes estuvieran conformes con su necesidad y procedencia.". No obstante, el tribunal conserva la facultad de ordenar solo aquella que considere indispensable, tomando lógicamente en cuenta la pertinencia de la prueba y los elementos de convicción que ya hubieran sido incorporados al proceso, según lo dispone expresamente el párrafo segundo de la citada norma” (Sentencia N° 000235-A- S1-2008 de las nueve horas cinco minutos del cuatro de abril del dos mil ocho, en igual sentido ver Sentencia N° 794-F-2006, 9 horas 31 minutos del 9 de octubre de 2006 y Sentencia N° 790 de las 11 horas del 10 de septiembre del 2004). De lo expuesto se desprende, que la documental ofrecida por el apelante ante el Tribunal, no corresponde a ninguno de los supuestos estipulados en los preceptos 293 y 575 ibídem, pues no hay indicación o referencia alguna tendiente a justificar su admisibilidad en tal sentido.

I I.- Se aprueba el elenco de hechos probados y no probados, por tener fundamento en los elementos contenidos en autos.

II I .- De los agravios: Apelación del expropiado . El recurrente fundamenta su inconformidad básicamente en siete motivos básicos a saber:

  • 1)Que el a quo utiliza como referencia esencial de su resolución, el avalúo administrativo aportado a los autos, pero desestimado por la Administración expropiante al aceptar el dictamen elaborado por el Ingeniero Muñoz, por lo que el dictamen del Ingeniero Muñoz no podía ser ignorado y desestimado por el juzgador como lo hizo en sentencia, lo cual, lo hace absolutamente nulo ya que a su criterio, es la Administración, la que al haber dictado el acto, la única que tiene las atribuciones legales para anular sus actos propios mediante los procedimientos señalados por la Ley General de la Administración Pública. Considera que el a quo carece de las atribuciones legales para apartarse de la voluntad de la Administración, y al hacerlo, lesiona el artículo 11 de la Constitución Política al arrogarse funciones que no le corresponden. Advierte que la fundamentación que esboza el juzgador para mantener el avalúo administrativo y negarse a acatar la voluntad de la Administración, encuentra apoyo en una situación insólita y extraña totalmente a los parámetros de valoración de un justo precio, como lo es, la protección de los recursos públicos, pues según opina, si el a quo considera que existe un mal uso de las finanzas públicas, o que se incurre en irregularidades en su empleo, por parte de los funcionarios del ICE, ello constituye una situación que debe ventilarse ante las autoridades competentes como la Contraloría General de la República y los Tribunales represivos, pero no en estrados, cuyo fin es determinar un justo precio y no una lesión a la Hacienda Pública.
  • 2)Que en la sentencia impugnada, el a quo se retracta e ignora, la anuencia que hubo de su parte para acceder a la solicitud de ampliación del dictamen solicitado por él, a fin de que se refiriera al impacto al medio ambiental y turístico y, los daños y perjuicios ocasionados, labor pericial que incluso valoró para justificar la readecuación de honorarios de perito aprobada en autos pero que, sin ninguna explicación técnica y sin prueba valorativa -lo cual a su parecer amerita su descalificación-, rechaza indicando que para fijar el valor del daño ambiental se requiere de la existencia de un negocio o que exista un proyecto para desarrollar la actividad comercial y turística. Advierte que, mediante los dictámenes rendidos se demuestra que la parte a expropiar de la finca es de naturaleza turística, y que la única actividad que en ella podría desarrollarse es esa, por lo que se le ha despojado de ese derecho turístico en virtud de que la servidumbre de 3 hectáreas 6.771,20 metros cuadrados, divide la finca y la invade en la mejor parte.
  • 3)Considera que los alcances del instituto de la expropiación que esboza el a quo, en nada puede afectar el justo precio perseguido en estas diligencias y, que la afectación de una servidumbre sobre un inmueble, tenga o no instalada torres, priva siempre al expropiado de ejercer su derecho a los atributos de la propiedad, pues su limitación es vitalicia, permanente al perder la identidad de la finca. Considera además, que la importancia del servicio de electricidad, no tiene nada que ver con la estimación del justiprecio, pues son los abonados quienes sufragan su costo.
  • 4)Que el a quo realiza valoraciones en cuanto a diferencias entre el avalúo administrativo y el judicial, que resultan improcedentes, ilegales y nulos de pleno derecho pues el avalúo administrativo fue derogado y desestimado por la Administración. Advierte que el Nombre9574 no objetó el monto ni adujo razones técnicas o de fondo en contra de la ampliación del dictamen rendida por el perito judicial, cuando se refirió al daño ambiental generado por los daños ocasionados por el ICE. Indica que el juzgador rechaza la determinación y valoración que hiciera el Ingeniero Muñoz sobre el impacto ambiental sin ningún auxilio técnico y, no justifica sus afirmaciones, pues no existe prueba de que el monto del dictamen sea excesivo, lucrativo, generador de riqueza en forma desmedida y en detrimento del medio ambiente.
  • 5)Considera que la sentencia violenta la norma del artículo 45 de la Constitución Política, así como las normas de los artículos 6313 de 1979 y 7495 de 1995 que rigen las expropiaciones al remitir al expropiado a otra vía, en busca de la indemnización. Señala que en ningún momento se están reclamando daños por un interés difuso sino, el daño al medio ambiente que le está afectando como propietario.
  • 6)Que el a quo rechaza el reconocimiento del extremo relacionado con la actividad turística, por ser eventual y futuro y no ser indemnizables de conformidad con la norma del artículo 3 de la ley de expropiaciones. Considera que al haberse determinado ese daño por parte del perito judicial y al no mediar oposición del Nombre9574 al respecto, el a quo no podía apartarse del dictamen del perito Muñoz desconociendo esa prueba y apoyándose en meras especulaciones legales como las del artículo 194 y 196 de la Ley General de la Administración Pública. Advierte que el turismo ecológico lo da la naturaleza, sin que se requiera de un Canopy, y que el perito judicial advierte que la imposición de la servidumbre afectará con contaminación visual, que hace perder la ventaja comparativa de la finca como finca de exclusividad de bosque natural por la discontinuidad física además de la visual. Advierte, que al juzgador no le asiste prueba técnica de ninguna índole, que respalde su posición al peritaje del ampliación del Ingeniero Muñoz, y que sus argumentos de rechazo se basan en su dicho, e apreciaciones personales y subjetivas y en normas que no guardan relación alguna con las diligencias de expropiación.
  • 7)El juzgador de instancia insiste en considerar el avalúo administrativo para determinar el justiprecio y referirse a la actualización del mismo. Insiste el recurrente, que el juzgador no podía entrar a valorar el avalúo administrativo en la medida en que éste fue desechado por el Nombre9574 y fue sustituido por el dictamen del perito judicial, que es el que debe ser acatado al ser la voluntad de la Administración. Es su criterio, que son los montos establecidos en el avalúo judicial, los que deben ser aprobados por el juzgador y que la indemnización que éste dispone en la sentencia recurrida, resulta contraria el principio de legalidad, seguridad y debido proceso, pues se atribuye funciones que no le corresponden y revoca la voluntad de la Administración atribuyéndose competencias exclusivas de los jerarcas del ICE. Solicita que se anule la sentencia recurrida, declarándose sin lugar, o bien el monto de la indemnización fijada por el juez y en su lugar, se fije la indemnización en el monto establecido por el perito señor Nombre39165 y aceptado por el ICE.

I V .- DEL PRECIO JUSTO. Para satisfacer la garantía inherente en la potestad expropiatoria de la restitución integral, se hace necesario, valorar el objeto expropiado de tal manera que resulte una justa compensación y no un ingreso extraordinario. La doctrina ha intentado establecer los parámetros a seguir para determinar un justo precio, que según García de Enterría, se alcanza solamente a través de la vía judicial, única donde se verificaría esa "justicia" en cada caso, y la entiende como el valor de sustitución de la cosa expropiada o afectada , suficiente para adquirir otro bien análogo, al que por expropiación o afectación se priva. Otros se refieren al justiprecio como un elemento que actúa como factor determinante del valor objetivo del bien expropiado o afectado , sea el precio corriente en el comercio, esto es, el justiprecio ha de coincidir con el verdadero valor económico de los bienes expropiados o afectados , con objeto de proveer de dinero suficiente para obtener la adecuada sustitución de tales bienes.

Nombre32650, tratadista argentino, considera que el justo valor supone que el expropiado debe recibir un valor equivalente a aquél del cual se lo priva, de modo actual e integral.- Dicho valor debe representar una suma al contado o en términos razonablemente equivalentes, por la cual el dueño del bien, deseoso de vender pero no obligado a hacerlo, hubiera vendido su propiedad a un comprador deseoso de ello, pero no obligado a hacerlo, excluyendo la variable de la especulación. Como se observa, el concepto de justiprecio, lo que pretende es buscar el equilibrio donde no vaya a resultar perjudicado el expropiado al desmejorar su patrimonio inmobiliario ni tampoco, constituirse en una fuente de ganancias a su favor, con el consecuente perjuicio al ente expropiante, lo que sólo se alcanza con la sabia y prudente combinación de los principios de equidad y justicia, de tal manera que el justiprecio, siempre de concepción y estamento discrecional, debe referirse en el juicio de expropiación a lo que el inmueble vale en el estado y forma de explotación en que es tomado por el expropiador, según los valores y otros elementos de convicción concentrados en los autos.

La indemnización que ha de reconocerse en el trámite de expropiación ha de ser plenaria, debe cubrir el valor "venal" del bien de que se trate; para tal efecto complementan este concepto los principios del "valor de reposición", los "valores de zona", la "depreciación", y es con base en esos principios y a los factores positivos y negativos que afectan al inmueble expropiado, a través de instrumentos técnicos, que se llega a la determinación del justo precio unitario.

V. FIJACIÓN DEL JUSTIPRECIO

La expropiación o afectación por constitución de servidumbre, no puede generar un beneficio indebido ni para el Estado que expropia o afecta ni para la parte que es expropiada; debe darse un equilibrio entre ambos. No es posible dejar de lado tampoco, que la expropiación constituye un sacrificio singular y concreto, y como tal discriminatorio. Por ende, en aplicación del principio de la igualdad ante las cargas públicas (Artículos 18 y 33 de la Constitución Política) exige una restauración o compensación indemnizatoria justa, y como tal, reseña esta instancia, la establecida por el juez de instancia. Y no podría ser de otra manera, pues de lo contrario no tendría justificación alguna el nombramiento de peritos en sede jurisdiccional, ya que no podría ninguno estar en desacuerdo con el avalúo administrativo, pues si se corrige o se modifica, se alegaría no tomarlo en cuenta por ilegal. El numeral 36 de la Ley de Expropiaciones establece que: "El dictamen deberá sujetarse a lo dispuesto en el artículo 22 de esta ley y su objetivo será revisar el avalúo administrativo para que se ajuste al valor del bien en el momento que fue valuado".

En ningún momento se indica que no se puede modificar, que no se pueden incluir aspectos que no fueron introducidos en sede administrativa, ni que se puede ir en contra de lo dispuesto por los peritos del Estado, únicamente que debe ajustarse al precio del bien cuando se efectuó el avalúo administrativo, lo cual no indica, se reitera, que no pueda dictaminarse un criterio diverso al emitido por la Administración. De esa forma, no existe en la Ley de Expropiaciones impedimento alguno para que el juzgador se aparte de los criterios dados por los diversos peritos que constan en autos, sino más bien existe una autorización expresa para ello, en el numeral 40 de la Ley de repetida cita, con la única limitación de no poder exceder el juez la suma mayor estimada en los avalúos. Ello, en el supuesto de que si el juez (con el auxilio de los peritos nombrados) sólo puede revisar en cuanto cotejar si lo descrito por el experto de la Administración está o no correcto, se estaría generando una burla manifiesta el principio constitucional de tutela judicial efectiva, pues si bien el proceso especial expropiatorio tiene un objeto limitado, eso no es óbice para indicar que es jurisdiccional y su fin es la determinación del justiprecio, por lo que dentro de esa orientación la parte tiene el derecho a una garantía jurisdiccional justa, amplia y necesaria, para definir el valor venal del inmueble como ya se indicó.

Lo anterior, no es otra cosa que la discrecionalidad judicial, por ser el juez, el perito de peritos. A mayor abundamiento, es de señalar que cuando un experto realiza un peritaje totalmente nuevo, al generar un nuevo parámetro de análisis del caso, permite al juez tener mayores elementos de convicción; naturalmente, del contraste entre ambos criterios, cada elemento discordante es una exposición de falencias que a juicio del perito judicial presenta el criterio administrativo y bajo ningún sentido, tiene que ser necesariamente explícita, mucho menos, vinculante para el juez. Claro esta, todo peritaje es una recomendación hacia el juzgador quien a final de cuentas es el perito de peritos, de tal suerte que la determinación final es siempre parte de la actividad jurisdiccional, en tanto tenga una debida fundamentación. Debe recordarse asimismo, que la definición de un justiprecio es ante todo un fenómeno complejo, donde interactúan una considerable cantidad de variables; por lo que entre mayor cantidad de elementos estén presentes, se genera una disminución de que exista un error judicial y con esto se llegue a perjudicar a alguna parte, todo sin perjuicio de que como obra humana, siempre será perfectible.

Al final de cuentas es la prudencia del juzgador, sobre la base de la sana crítica, el elemento definitorio del justiprecio, en la medida de que no se trata de una actividad donde exista un criterio unívoco que permita definir el monto en concreto a indemnizar en cada caso concreto.

VI.La inconformidad del recurrente, estriba en la determinación del justiprecio por parte del juzgador, por considerar, no respeta el monto que dispone el avalúo judicial aún y cuando el instituto expropiante, no formuló objeción en cuanto a este último. Al respecto, debe advertirse que la indemnización que como forma de compensación se genera ante el menoscabo sufrido en la esfera patrimonial del expropiado, corre a cargo de todos los administrados, a través del sistema tributario pues es tomada de los fondos públicos. De manera que la expropiación surge ante un interés público legalmente comprobado, y como tal, debe ser indemnizado con las limitaciones de interés social por motivos de necesidad pública. La indemnización expropiatoria, se traduce en el equivalente económico del sacrificio impuesto a la esfera patrimonial del expropiado y por consiguiente como tal, se exige que se oriente al pleno reintegro de su patrimonio.

Cuando se recurre al concepto de "Justiprecio" como sinónimo de indemnización por expropiación, se hace referencia a la idea de equilibrio económico y relación conmutativa, donde el vocablo "justo" implica la obligación de objetividad, de la apreciación externa del valor de lo sacrificado y los daños generados con la expropiación. Debe además, ser integral y plena, de forma que el patrimonio del sujeto pasivo de la relación expropiatoria quede incólume. Pero además, la indemnización expropiatoria debe estar exenta de cualquier apreciación subjetiva y realizarse en apego a la norma jurídica, para que se considere justa. De allí que la fijación del monto del justiprecio resulte fundamental. No puede en modo alguno generar beneficio únicamente al expropiador, por ello, el valor económico que se fije con la indemnización debe mantener intacto e incólume el patrimonio del expropiado, reconociendo el valor objetivo, actual o venal, pues lo contrario, esto es, una indemnización irrisoria o simbólica, la tornaría en injusta.

Más aún, tampoco puede la indemnización convertirse en una fuente de ganancia o riqueza. La indemnización sólo puede ser sinónimo de reparación, y de una reparación integral, justo y pleno de lo expropiado, de modo tal, que se elimine cualquier posibilidad de lucro a expensas de los fondos públicos, ya que el expropiado lo que obtiene mediante la indemnización, es un equilibrio o compensación de valores, nunca una ganancia o renta o de capital.

VII.Es conveniente señalar, que la expropiación ha sido concebida por el legislador, en dos fases: 1) La administrativa, aquella en que se prevé un avenimiento del administrado al valor propuesto por el expropiante, de modo que todo resulte en una conciliación de intereses amistosa y extrajudicial, esto es, un acuerdo de voluntades sobre el precio del bien. 2) La Judicial, en donde además de estar presente la potestad expropiatoria del Estado frente a los intereses del particular expropiado, el juzgador como garante judicial, dirigirá el proceso en aras de ejecutar la expropiación en estricto apego a la norma jurídica, y se hace medular, la cuestión relativa a la imposición por decisión judicial, del valor de la indemnización pues es precisamente en este aspecto, donde no medió conciliación entre los intereses del particular respecto de los del Estado en la fase administrativa del procedimiento.

Claro está, que existen otros motivos por los cuales la fase judicial se hace necesaria en la expropiación, no obstante, para el caso en particular, es precisamente la fijación del valor de la indemnización la que interesa a los efectos. De modo tal, que la falta de acuerdo en la cuantificación de la indemnización que produce la privación del bien, genera una discrepancia sobre el justiprecio que debe ser dirimida en esta fase, esto es, la fase judicial y, mediante la sentencia que se dicte, se fijará el monto correspondiente a la indemnización, el justiprecio y dispondrá la privación patrimonial del bien expropiado. En este orden, el juez, como perito de peritos, dispondrá el valor de la indemnización fijando bajo criterios de prudencia y razonabilidad el precio monetario reclamado. No hay duda en cuanto a que al momento en que el expropiado rehusa aceptar el monto del avalúo administrativo y obliga al expropiante a acudir a la vía judicial en busca de la fijación del justiprecio, se somete a la voluntad del juzgador, la cual, se reitera, no es arbitraria ni antojadiza, sino producto del análisis de la prueba constante en autos, la sana crítica, y la aplicación de los principios constitucionales de prudencia y razonabilidad.

Ese sometimiento al órgano jurisdiccional, no puede ser vedado ni sustituido más que por un arreglo extrajudicial formal, en que ambas partes manifiestan su libre voluntad de fijar un cuantum y apartarse del proceso judicial, pues en tratándose de fondos públicos, la fijación del monto de la indemnización lleva inserta la responsabilidad en cuanto al destino y manejo de los mismos, consecuentemente, mientras esa definición esté sometida al mencionado proceso, la responsabilidad en la fijación del justiprecio, recae en el órgano jurisdiccional. Aún y cuando la Administración haya manifestado que es posible aceptar el avalúo judicial, debe recordarse que el juez tiene un rol como contralor de legalidad, que lo obliga a valorar la razonabilidad del precio así como las demás circunstancias que permitan establecer la idoneidad del estudio realizado a fin de determinar el justiprecio. Es decir, el hecho de que la parte expropiante acepte el avalúo judicial, no obliga al juez a tenerlo por válido, ni le es vinculante, en el tanto está obligado a escudriñar los alcances de esa prueba.

Al juez le alcanza la responsabilidad y la obligación de verificar el precio sobre todo, cuando aquel será saldado con fondos provenientes del erario público. El interés público inherente al proceso de expropiación, impone al juzgador ir más allá de la mera aceptación del funcionario estatal, que pudiera haberse visto constreñido por razones de tiempo y falta de conocimiento en cuanto a las condiciones que deben considerarse para determinar el valor de la suma a indemnizar. Ninguna de esas razones, es óbice para que el juez a su mejor arbitrio valore conforme a las reglas de la sana crítica y a fin de determinar la verdad real, todo aquel conglomerado probatorio que con ajuste al ordenamiento jurídico, permita determinar el precio justo. El juez no es un mero observador, es un protagonista del proceso y en él recae la decisión del fallo. Al respecto la Sala Primera de la Corte Suprema de Justicia, al dictar la sentencia Nº166-92 de las 16:20 hrs del 18/12/1992, ha indicado:

"La determinación del justiprecio o indemnización, es de carácter jurídico y no sólo económico, pues se juega con un concepto indeterminado, su magnitud y fijación debe ser controlada por el órgano jurisdiccional”.

En este mismo orden de ideas, es preciso señalar que la inconformidad del recurrente en cuanto a la decisión del A quo de apartarse del avalúo judicial, no encuentra asidero jurídico, pues además de lo hasta aquí indicado, el artículo 40 de la Ley de Expropiaciones, dispone que los peritajes constituyen parámetros para la determinación del precio final a conceder y como tales, no son de obligado acatamiento para el juzgador, pues la razón de ser de este tipo de procesos es precisamente la determinación del justiprecio, y para lograrlo se busca del auxilio de expertos, que vengan a determinar con su labor, un precio o compensación económica, ante la pérdida o afectación de una propiedad. Pero se insiste, la misma ley le concede la posibilidad a los juzgadores de apartarse de los informes periciales y de la prueba aportada, con el fin de revisar el avalúo administrativo. De modo, que la fundamentación del recurrente en cuanto a este agravio, no encuentra apoyo jurídico, pues la propia ley autoriza al juzgador o al Tribunal, como perito de peritos, a apartarse del criterio vertido por los expertos auxiliares, ya que el peritaje concede lineamientos y criterios, pero es éste, quien en definitiva, establece el quantum indemnizatorio.

De allí que la fijación del precio que en definitiva se determine, no es la concedida por el o los peritos nombrados en autos, sino que la misma constituye una función exclusiva de quien juzga al corresponder a una decisión jurídica.

VIII. SOBRE EL RECONOCIMIENTO DE LA INDEMNIZACIÓN POR DAÑO AMBIENTAL

Aún y cuando, ha sido pretendido como parte del justiprecio reclamado por el expropiado, análisis aparte merece la cuestión debatida respecto del daño ambiental y la falta de reconocimiento de la supuesta aceptación tácita por parte del ente expropiante, por no haberse opuesto -según asegura el recurrente- a la ampliación del peritaje judicial que establece el daño ambiental en la finca en que se impone la servidumbre, y el cual fue valorado por el perito judicial, en la suma de Treinta y cinco millones cuatrocientos treinta mil colones exactos. En primer orden, es preciso señalar que el perito judicial realiza la ampliación a su dictamen en fecha 27 de setiembre del dos mil nueve y lo presenta a estrados judiciales el día 20 de octubre de ese mismo año (folio 112 a 149). Mediante resolución de las diez horas treinta minutos del diez de noviembre del dos mil nueve, se confiere audiencia a las partes respecto de la misma el día veintitrés de noviembre de mismo año (folio 150), y el ente expropiante, por medio de su representante se opone en forma expresa al mismo (folio 151).

Lo anterior, desvirtúa el alegato del recurrente en cuanto a que no medió oposición del ente expropiante a esta ampliación del peritaje judicial, pues los autos se evidencia lo contrario. Sin embargo, es de rigor advertir, que aún y cuando el Instituto expropiante no se hubiere pronunciado respecto de la ampliación del dictamen judicial, no significa ni puede entenderse como una aceptación tácita del mismo, pues el silencio de la parte no puede de ninguna forma, entenderse como una aceptación en perjuicio de sus derechos y deberes. Igual situación ocurre con la admisión que al momento de proponerse dicha prueba por parte del expropiado, hace el A quo admitiendo la ampliación solicitada, pues debe recordarse, que el hecho de que el juzgador avale la realización de una prueba, no significa ni puede entenderse, como la valoración positiva anticipada de la misma a los efectos de conceder la pretensión que se persigue.

El juzgador valora la prueba en conjunto, bajo las reglas de la sana crítica racional y, como instrumento, él la utiliza de acuerdo a su criterio analizándola a la luz de la normativa y principios que informan la materia objeto del proceso. En ese mismo orden de ideas, debe recordarse, que el juez no está obligado a sujetarse a lo que informan los peritos, sino que los mismos sirven de parámetro para su decisión final como perito de peritos. En cuanto al Daño Ambiental, es preciso señalar que de conformidad con lo dispuesto en el inciso 1° del artículo 11 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales: “toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos”. Garantía que se encuentra expresamente regulada en el párrafo 2° del artículo 50 de nuestra Constitución Política.

Este derecho tiene como corolario el deber de los Estados de promover de manera efectiva, expedita y diligente la protección, preservación y mejoramiento del ambiente, circunstancia que a la vez implica la necesidad de establecer una serie de regulaciones -tanto de carácter nacional como internacional- que tiendan a impedir la contaminación y el aprovechamiento irracional de los recursos naturales. En nuestra legislación, el daño ambiental no encuentra una definición concreta, en virtud de que el tema no ha sido considerado en forma específica como tal. A pesar de esto, existe una definición imprecisa dentro de la Ley Orgánica del Ambiente, al establecer como uno de los principios que inspiran esa Ley, el daño al ambiente, el cual constituye un delito de carácter social, económico, cultural y ético. Un delito de carácter social, pues afecta las bases de su existencia. De carácter económico, en virtud de que atenta contra las materias productivas.

De tipo cultural, en tanto pone en peligro la forma de vida de las comunidades; y ético, porque atenta contra la existencia misma de las generaciones presentes y futuras. Se ha entendido como aquel que afecta el derecho humano de disfrutar de un ambiente sano. Nuestro Tribunal Constitucional ha definido al medio ambiente, así: “Toda la vida del hombre ocurre en relación inevitable con su ambiente, en especial con el mejoramiento de la calidad de vida que es el objeto central que el desarrollo necesita, pero éste debe estar en relación con el ambiente de modo tal que sea armónico y sustentable." (Voto 3705-93 de las 15 hrs del 30 de julio de 1993). De allí que se sostenga, que el ambiente, por lo tanto, debe ser entendido como un potencial de desarrollo para utilizarlo adecuadamente, debiendo actuarse de modo integrado en sus relaciones naturales, socioculturales, tecnológicas y de orden político, ya que, en caso contrario, se degrada su productividad para el presente y para el futuro y podría ponerse en riesgo el patrimonio de las generaciones venideras.

En el caso que nos ocupa, la ampliación del peritaje judicial no hace referencia a los daños ambientales que ocasiona la imposición de la servidumbre, daños ambientales tales como la pérdida de la flora y la fauna, o la pérdida de un medio ambiente sano, la contaminación o el aprovechamiento irracional de los recursos, el peligro en la forma de vida de las comunidades y otras actividades, elementos éstos necesarios para determinar el daño ambiental. Tampoco refiere la ampliación pericial, que estos daños alegados, adicionalmente, atenten contra la existencia propia de las generaciones presentes y futuras, ni que la labor realizada por el Instituto Costarricense de Electricidad al imponer la servidumbre, no esté relacionado con el ambiente de modo tal, que no resulte armónico y menos aún, sostenible para el desarrollo. El peritaje en cuestión, tal y como lo indica el a quo, no brinda los elementos técnicos necesarios, que acrediten una afectación directa con ocasión de la imposición de la servidumbre, y que deba ser indemnizada en forma personal, recordando que este tipo de indemnizaciones están destinadas por ley, no al acrecentamiento patrimonial particular, sino, a mitigar y restablecer la naturaleza afectada. De forma que, al no haberse acreditado el daño alegado, procede el rechazo del agravio confirmándose lo dispuesto por el a quo por las consideraciones que aquí se esbozan.

IX. SOBRE LA NULIDAD CONCOMITANTE

El recurrente formula nulidad concomitante respecto de la sentencia recurrida. En realidad, la nulidad constituye un remedio procesal de carácter extraordinario y como tal, resulta procedente en aquellos casos en que se presenten defectos procesales que irrumpan el equilibrio que siempre debe existir entre las partes litigantes, provocando indefensión a una, o cuando se ha violado el curso normal del procedimiento y fuera de esos dos supuestos, la nulidad debe ser valorada y subordinarse al principio de Conservación de los Actos Procesales y Economía Procesal. La nulidad además, no prospera si resulta posible reponer el trámite o corregir la actuación evitándose con ello atrasos innecesarios en la tramitación del proceso. Esta Cámara, una vez valorados los principios que rigen la figura de la nulidad, estima que en el presente asunto, no se encuentran defectos u omisiones procesales que resulten motivo de nulidad y que como tales, obliguen consecuentemente a declarar la que de la sentencia se acusa.

X.CONCLUSIÓN.- Por las razones expuestas, en cuanto a los aspectos expresamente determinados por e l recurrente, se rechaza el recurso formulado así como la nulidad intentada y, se dispone confirmar en todos sus extremos la sentencia impugnada.

POR TANTO

Se rechaza la prueba para mejor resolver ofrecida por el recurrente. Se rechaza la nulidad pretendida. En lo que es objeto de recurso, se CONFIRMA la sentencia apelada .
