VOTE No. 0655-F-09 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at eight forty-eight on dieciocho de setiembre de dos mil nueve.- POSSESSORY TITLE PROCEEDING (INFORMACIÓN POSESORIA), brought by [Nombre1], of legal age, married, merchant, resident of Florencia de San Carlos, identity card number CED1- - . The PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose particulars are not stated in the record, in her capacity as Deputy State Attorney, and the INSTITUTO DE DESARROLLO AGRARIO, represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Guachipelín de Escazú, identity card number CED2- - , in her capacity as general attorney-in-fact for judicial proceedings, are participating in the proceeding. The matter was heard by the Juzgado Agrario del Segundo Circuito Judicial de Alajuela. 1. The petitioner instituted these possessory title proceedings, valued at two million colones, seeking an order directing that the following-described property be registered in the Public Property Registry: “Pastureland and forestland, located at [Dirección1], in the Province of Alajuela. [Nombre2] to the NORTH, adjoining [Nombre3], [Nombre4], [Nombre5], [Nombre6], and a right-of-way easement (servidumbre de paso) with a frontage of six linear meters; to the SOUTH, adjoining [Nombre7], [Nombre8], and a right-of-way easement with a frontage of six linear meters; to the EAST, adjoining a public road with a frontage of 538.59 linear meters; and to the WEST, adjoining [Nombre7]. It measures TWENTY-ONE HECTARES EIGHT THOUSAND ONE HUNDRED FIFTEEN SQUARE METERS and corresponds to cadastral plan number A-1164082-2007.” (folios 15 to 16 and 34 to 35).- 2. The Procuraduría General de la República and the Instituto de Desarrollo Agrario were deemed to have entered appearances in the proceeding under the terms set forth at folios 53 to 56 and 76, respectively.- 3.

Attorney Zoila Flor Ramírez Arce, the trial judge, ruled at seven eight on veintiuno de julio de dos mil nueve: “POR TANTO: In accordance with the Ley de Informaciones Posesorias n° 139 del 14 de julio de 1941, as amended, and Article 58 of the Reglamento a la Ley Sobre Uso, Manejo y Conservación de Suelos, this POSSESSORY TITLE PROCEEDING brought by [Nombre1] IS APPROVED. The PUBLIC PROPERTY REGISTRY shall register, free of encumbrances and subject to the real-property restriction stated below, without prejudice to third parties having superior rights, in the name of [Nombre1], identity card number CED4- - -, of legal age, married once, merchant, resident of Santa Rita Florencia, San Carlos, one [Dirección2] from the local school, the land described as follows: pastureland and forestland, with a corral, located in Santa Rita de Florencia, [Dirección3], in the tenth canton of San Carlos, Province of Alajuela.

Boundaries: NORTH: [Nombre4], [Nombre4], [Nombre5], [Nombre3], [Nombre9], and a stream; SOUTH: [Nombre7] and [Nombre8], and a stream; EAST: [Dirección4], with a frontage of [Dirección5] meters and [Dirección6] centimeters, [Dirección7], and [Nombre8]; WEST: [Nombre7]. According to cadastral plan number A-1164082-07, dated veinte de noviembre del dos mil siete, its area is [Dirección8], EIGHT THOUSAND [Dirección9] FIFTEEN METERS. The land is crossed from south to north by a stream, which is duly protected, as are those along the southern and northern boundaries. The property was valued at TWO MILLION COLONES. LEGAL RESTRICTIONS: 1-) The area adjoining the streams along the northern and southern boundaries and the stream crossing the land to be registered from south to north, as well as the small watercourse (yurro) and spring (naciente), constitutes a protected area (área de protección) pursuant to Article 33(a) of Ley Forestal Número 7575, and the cutting or removal of trees is prohibited; furthermore, the channel and waters of that watercourse are in the public domain (Ley de Aguas, Article 1, subsection IV, and Article 3, subsection III).- 2-) In view of the condition of the road located to the east of the property registered through this proceeding, the property shall be subject to the reservations established in the Ley General de Caminos Públicos, under which the minimum width of highways is twenty meters and that of local roads is fourteen meters (Article 19 of the Ley de Informaciones Posesorias and Article 4 of the Ley General de Caminos Públicos).-” (folios 136 to 141).- 4.

The Procuraduría General de la República filed an appeal (recurso de apelación), expressly stating the reasons for challenging the trial court’s position, under the terms set forth at folios 145 to 159.- 5. The statutory requirements were observed in the conduct of the proceeding, and there are no errors or omissions capable of rendering the judgment null and void.

Judge Vargas Vásquez drafts the opinion; and,

CONSIDERING:

I.The facts deemed proven in the appealed judgment are adopted because they are consistent with the evidence in the record. The following facts of that nature are added on appeal: 12. The property to be titled is duly demarcated along its boundaries by fences that are in good condition and are maintained by the petitioner (see the witness testimony of [Nombre10], [Nombre11], and [Nombre12] at folios 63 to 65, as well as the record of judicial inspection (reconocimiento judicial) at folio 103). 13. The forested sector, the protected area surrounding the streams crossing the property, and a spring located on the landholding (fundo) have been protected by the petitioner, who, together with his transferor, has possessed the landholding openly, peacefully, continuously, and as owner for more than ten years before the possessory title proceeding was filed. (See the transfer document at folio 13, the witness testimony of [Nombre10], [Nombre11], and [Nombre12] at folios 63 to 65, the record of judicial inspection at folio 103, the report of the Departamento de Cuencas Hidrográficas del Instituto Costarricense de Acueductos y Alcantarillados at folio 112, and the soil report issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria at folios 30 and 31).­

II.Attorney Lydiana Rodríguez Paniagua, Deputy State Attorney of the Procuraduría General de la República, filed an appeal against the judgment issued at 7 hours 8 minutes on 21 de julio de 2009, in a pleading sent by fax on day 30, the original of which was filed with the court on day 31 of that month and year (folios 145 and 160). In essence, she objected to the titling of the property, maintaining that the judicial inspection, witness testimony, and petitioner’s statements show that part of the property is devoted to forest; forestland and forests within national reserves are subject to the public domain and form part of the State Natural Heritage (Patrimonio Natural del Estado), at least since Ley Forestal 4465 de 1969, Article 33, as amended by Ley Forestal 7174 de 1990, Articles 32 and 33, a public-domain status (carácter demanial) maintained by Ley Forestal 7575, Articles 13 and 14. In support of the foregoing, she cites several excerpts from decisions referring to the characteristics of public-domain property and its inalienability and immunity from acquisition by prescription (imprescriptibilidad), as well as what the appellant describes as the continued application of repealed law to govern legal situations arising while it was in force; these include decisions of the Sala Constitucional in votes [Telf1], 15753-2005, [Telf2], [Telf3], 336-1998, 738-2003, 12239-2006, 12240-2006, 12241-2006; the judgment of the Tribunal de Corte Plena at 10 hours on 18 de marzo de 1992, 1119-90; decisions of the Sala Primera de la Corte in votes 79-1989, 104-1989, and 105-1989; and opinions of the Procuraduría General de la República C-321-2003, C-146-2008, among others.­

III.In this proceeding, the petitioner (promovente) seeks an order registering in his name in the Public Registry the property located in Santa Rita de Florencia de San Carlos, [Dirección10], in the province of Alajuela, measuring 23 hectares 7091,97 square meters, as depicted on cadastral plan A-348899-79 (folios 2 and 20). According to a certification issued by the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente, Energía y Telecomunicaciones (folio 3), the property lies outside any protected wildlife area (área silvestre protegida). From the remaining evidence in the record, the Court concludes that the appellant is correct in asserting that part of the property consists of forest (bosque), as indicated in the aforementioned plan, in the appellant’s statements made under oath, in the judicial inspection report, and in the testimonial evidence. Once the existence of forest on the property has been verified, Article 7 of the Ley de Informaciones Posesorias applies.

That provision states: “When the property to which the possessory title proceeding (información posesoria) relates is located within a protected wildlife area ... Properties located outside those areas that contain forests may be titled only if the petitioner proves that he is the holder of the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years, and that he has protected that natural resource, it being understood that the property must be duly demarcated and enclosed by fences or cleared boundary lines ...” A constitutional challenge (Acción de Inconstitucionalidad) was brought before the Sala Constitucional against the interpretation that the Tribunal Agrario had given that provision, under which possession had to be exercised personally; it was also alleged that the provision was impermissibly retroactive. In that regard, the Chamber issued vote 4587-97 at 15 hours 45 minutes on 5 August 1997, partially cited by the appellant, which held: “The action is partially granted and, consequently, the judicial interpretation of Article 7 of Ley de Informaciones Posesorias No 139 of 14 July 1941, the text of which corresponds to the amendment enacted by Ley Forestal No. 7174 of 28 June 1990, is declared unconstitutional insofar as that interpretation requires, in order to obtain title to land located within national parks, biological reserves, forest reserves, or protective zones, personal possession commencing ten years before the effective date of the law or decree creating the protected wildlife area and does not, in such cases, recognize possession transferred by prior possessors.

This judgment is declaratory and has retroactive effect, without prejudice to rights acquired in good faith. In all other respects, the action is denied. A summary of this judgment shall be published in the Diario Oficial La Gaceta; it shall be published in full in the Boletín Judicial; it shall be communicated to the Secretaría General de la Corte Suprema de Justicia and notice thereof shall be given. In all other respects, the action is denied.” Accordingly, the Chamber struck down as unconstitutional this Court’s interpretation requiring personal possession because it found that transferred rights may be relied upon to establish the ten-year possession required by the provision. Likewise, in the reasoning portion of its decision, the Chamber stated the following concerning the claim that the provision was unconstitutional because of its retroactive effect: “The claimant states that the text of the challenged provision infringes the right to property and the principle prohibiting the retroactive application of the law to the detriment of vested property rights or settled legal situations because it extends the ten-year period of possession required to acquire ownership by acquisitive prescription (prescripción positiva) and because it applies retroactively, affecting vested property rights, particularly those relating to the exercise of possession.

The first paragraph of Article 7 of the challenged Ley de Informaciones Posesorias, the text of which predates the latest amendment by Ley Forestal No.7575 of 13 February 1996, governs the titling of real property located within an area declared to be a national park, biological reserve, forest reserve, or protective zone. That article states that the person seeking title must prove that the ten-year possession was exercised beginning at least ten years before the effective date of the law or decree that created the wildlife area. The challenged provision governs the titling of real property that has been incorporated into the public domain (dominio público) through its designation as a protected wildlife area, regardless of its specific classification. It must now be determined whether, under the circumstances contemplated by the challenged provision and in light of the doctrinal and jurisprudential criteria governing the doctrines of acquisitive prescription (usucapión) and the possession required for such prescription, discussed above, the challenged provision regulates a special type of possession required to acquire ownership of real property and imposes specific requirements that may infringe the right to property or the constitutional principle prohibiting the retroactive application of the law to the detriment of vested rights or settled legal situations.

First, it should be noted that the challenged article does not modify—by increasing or decreasing—the ten-year period of possession required for acquisitive prescription, established in Article 860 of the Civil Code for the generality of cases in which ownership of real property is sought through acquisitive prescription. The extension of the period alleged by the claimant to infringe the right to property does not occur because, given the nature of the property for which title is sought (public property), the period of possession capable of supporting acquisitive prescription must run before the property is incorporated into the public domain. In other words, designation as a protected wildlife area prevents possession subsequent to such incorporation from being counted and precludes satisfaction of the requirements for acquisitive prescription if the right had not been acquired by that time—that is, if the ten years of possession capable of supporting acquisitive prescription had not elapsed under the conditions established by law.

This is merely the natural result of applying the concepts governing the object of possession and the requirement that possession be exercised as a titleholder, which are necessary for possession ad usucapionem. It should be recalled that property incorporated into the public domain, regardless of its specific classification, cannot be acquired through acquisitive prescription if the conditions necessary to acquire the right were not satisfied before such incorporation occurred. In that respect, although the challenged provision appears to govern a specific case of acquisitive prescription, it does not create a regime with requirements different from those established in the Civil Code for cases generally. Likewise, the alleged retroactive effect of the provision does not arise because the ten-year period of possession required for acquisitive prescription is established in the Civil Code, and the challenged provision merely highlights certain elements inherent in acquisitive prescription that are also defined in the general legislation, such as the object of possession and the conditions under which possession must be exercised for it to support acquisitive prescription.

In other words, the provision establishes no different principle—or more stringent requirement—concerning the application of the general rules of acquisitive prescription. It merely specifies how those rules must be applied, which is consistent with the logical result dictated by the public-domain status of the property for which title is sought. Accordingly, the amendment to Article 7 of Ley de Informaciones Posesorias, whose text is challenged, is not deemed to have introduced a different regime concerning the requirements for acquisitive prescription that could have worsened the situation of persons exercising possession ad usucapionem over land that was declared to be in the public interest.” According to the Chamber’s reasoning, designation as a protected wildlife area prevents possession subsequent to incorporation into the public domain from being counted and precludes satisfaction of the requirements for acquisitive prescription if the right had not been acquired by that time.

In this case, the property for which title is sought has not even been incorporated into the public domain by a law or decree including the area sought to be titled within a protected wildlife area; rather, it is unregistered real property partially devoted to forest. According to the Chamber, Article 7 is the natural result of applying the concepts governing the object of possession and the requirement that possession be exercised as a titleholder, which are necessary for possession ad usucapionem, because property incorporated into the public domain, regardless of its specific classification, cannot be acquired through acquisitive prescription if the conditions necessary to acquire the right were not satisfied before such incorporation occurred. On that point, the Chamber added that although the challenged provision appears to govern a specific case of acquisitive prescription, it does not create a regime with requirements different from those established in the Civil Code for cases generally, and therefore the alleged retroactive effect of the provision does not arise either.

Thus, if the Chamber held constitutional a provision permitting the titling of real property located within protected wildlife areas, provided that ten-year possession is proven for the ten years preceding its incorporation into the public domain, then there is even greater reason to consider properties located outside such areas eligible for titling when personal or transferred possession is established for the ten years preceding the filing of the titling application.

IV.In light of the foregoing, in order to obtain title to the property sought to be registered through these proceedings, it is necessary to verify whether the petitioner exercised ten years’ possession (posesión decenal) before filing his application, whether he protected the forest resource (recurso forestal), and whether the property is duly demarcated by fences or cleared boundary paths (carriles limpios). To establish possession, the petitioner offered the testimony of three witnesses, as required by Article 6 of the Ley de Informaciones Posesorias. As evidence of possession, the applicant for title (titulante) submitted a deed establishing that, on May 7, 1982, [Nombre12] sold him the possessory rights (derechos posesorios) exercised over the property publicly, peacefully, continuously, and as owner for more than ten years (folio 13). To establish that transfer of possessory rights, as well as the possession exercised by the petitioner, he offered the testimony of three witnesses, whose statements were taken on July 26, 2008.

The witness [Nombre10] stated: “The petitioner has held and possessed the land for more than twenty-five years. It first belonged to his father, [Nombre12], who possessed it for many years and then transferred it to his son, who continues performing acts of possession (actos posesorios) to this day. ... A stream runs through the property (sic), and its protected area (área protectora) is well protected and has always remained so. The petitioner uses the land for pasture, while another portion consists of forest ...” (folio 63). Likewise, the witness [Nombre11] stated: “I have known the property sought to be titled for approximately twenty-five years, and from the time I first knew it, it belonged to the petitioner’s father, Mr. [Nombre12] ... A stream runs through much of the property, and I have observed that its protective margin (margen protectora) is well protected. The property is duly fenced along its boundaries with the neighboring properties and the public road. ... since his father transferred the land to him, he has possessed it publicly and peacefully ...

The land has always been used for (sic) pasture and contains a forested area that the petitioner preserves. ... The boundary fences are in good condition, as the petitioner provides the necessary maintenance ...” (folio 64). Finally, [Nombre13] testified: “... The property first belonged to the petitioner’s father, Mr. [Nombre12] ... The land is used for pasture, scrubland, and forest, which he protects, specifically where the stream crosses the farm; its banks are well protected (sic) along its course through the farm sought to be titled... The boundary fences are in good condition; the petitioner is the person who keeps them in good condition and provides the required maintenance to the land. A stream flows through the property, and I have seen a small spring (nacientillo), whose spring margin is also protected...” (Folio 65). For its part, the record of the judicial inspection (acta de reconocimiento judicial) stated: “...

The farm is demarcated by two strands of wire in good condition... The inspection continues to vertex nine, where it can be observed that the wooded area is demarcated by two strands of wire in good condition. ... During the inspection, no tree felling or springs were observed.” (Folio 103). It follows from the foregoing that the property sought to be titled is demarcated by fences, which are maintained in good condition. It is likewise concluded that part of the property is in fact wooded land, which is protected, as is the protective zone (zona protectora) of the streams crossing the property and that of what the witness [Nombre12] described as a “small spring,” whose waters need not be protected for the purpose of supplying nearby communities, according to a report from the Watershed Department (Departamento de Cuencas Hidrográficas) of the Instituto Costarricense de Acueductos y Alcantarillados (folio 112).

Protection of the forest resource is established by the evidence cited and also by the soil report issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (folios 30 and 31). Accordingly, the Court finds that, because the applicant for title demonstrated compliance with the requirements referred to in Article 7 of the Ley de Informaciones Posesorias, whose conformity with constitutional law was declared by the Sala Constitucional, registration of the property in his name must be authorized, and repealed provisions may not be applied in this case to deny registration.

V. For the foregoing reasons, the appealed ruling must be affirmed as to the matters challenged on appeal

POR TANTO:

As to the matters appealed, the judgment is affirmed.

[Nombre14] [Nombre15] [Nombre16] NOTE BY JUDGE [Nombre15] This note is submitted to indicate that the case under review does not concern public-domain property (bien demanial), as the appellant asserts. It should be noted that the property measures twenty-three hectares, seven thousand ninety-one square meters and ninety-seven square decimeters; it is pastureland and contains no wooded land (see the cadastral survey plan (plano catastrado) at folio 2), and according to the soil study appearing at folio 31, most of it consists of natural pasture. This means that it is not a primary forest important for aquifer recharge (recarga acuífera) to supply any community and therefore does not possess that significant characteristic necessary to be considered public-domain property. Rather, it is a property with respect to which the applicant for title has demonstrated the exercise of acts of possession.

The property is pastureland, as shown by the witness testimony at folio 64; consequently, it is not considered public-domain property. I therefore do not agree with the appellant’s arguments or with those set forth in the majority opinion regarding this issue, because the property is agricultural in nature. VOTO N° 0655-F-09 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las ocho horas cuarenta y ocho minutos del dieciocho de setiembre de dos mil nueve.- INFORMACIÓN POSESORIA, promovida por [Nombre1] , mayor, casado, comerciante, vecino de Florencia de San Carlos, cédula de identidad número CED1- - . Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos, en su condición de procuradora adjunta, y el INSTITUTO DE DESARROLLO AGRARIO, representado por Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecina de Guachipelín de Escazú, cédula de identidad número CED2- - , en su condición de apoderada general judicial. Tramitado en el Juzgado Agrario del Segundo Circuito Judicial de Alajuela. Actúan como apoderado especial judicial del promovente el licenciado Manuel Jones Chacón, mayor, casado, abogado, vecino de San Carlos, cédula de identidad número CED3- - .-

RESULTANDO:

1. La parte promovente planteó las presentes diligencias de información posesoria, estimadas en la suma de dos millones de colones, a fin de que se ordene inscribir en el Registro Público de la Propiedad, el inmueble que se describe así: "Terreno de repasto y montaña, situada en el [Dirección1] , de la Provincia de Alajuela. [Nombre2] al NORTE con [Nombre3] , [Nombre4] , [Nombre5] , [Nombre6] , y servidumbre de paso con un frente de seis metros lineales; al SUR con [Nombre7] , [Nombre8] y servidumbre de paso con un frente de seis metros lineales; al ESTE con calle pública con un frente de 538.59 metros lineales; y al OESTE con [Nombre7] . Mide VEINTIUNA HECTAREA OCHO MIL CIENTO QUINCE METROS CUADRADOS, y corresponde al plano catastrado bajo el número A-1164082-2007.", (folios 15 a 16 y 34 a 35).- 2. Se tuvieron como apersonados al proceso a la Procuraduría General de la República y el Instituto de Desarrollo Agrario , a los términos que corren a folios 53 a 56 y 76, respectivamente.- 3.

La licenciada Zoila Flor Ramírez Arce, jueza de primera instancia, en resolución de las siete horas ocho minutos del veintiuno de julio de dos mil nueve, resolvió: "POR TANTO: De conformidad con la Ley de Informaciones Posesorias n° 139 del 14 de julio de 1941 y sus reformas, Artículo 58 del Reglamento a la Ley Sobre Uso, Manejo y Conservación de Suelos, SE APRUEBA esta INFORMACIÓN POSESORIA promovida por [Nombre1] . Proceda el REGISTRO PÚBLICO DE LA PROPIEDAD a inscribir, libre de gravámenes y con la carga real que se dirá, sin perjuicio de terceros de mejor derecho, a nombre de [Nombre1] , cédula de identidad número CED4- - -, mayor, casado una vez, comerciante, vecino de Santa Rita Florencia, San Carlos, un [Dirección2] de la Escuela local; el terreno que se describe así:terreno de repasto y montaña, con un corral, situado en Santa Rita de Florencia, [Dirección3] , del cantón décimo San Carlos, de la provincia de Alajuela.

Linderos: NORTE [Nombre4] , [Nombre4] , [Nombre5] , [Nombre3] , [Nombre9] y Quebrada, SUR [Nombre7] y [Nombre8] y quebrada, ESTE: [Dirección4] con un frente de [Dirección5] metros con [Dirección6] centímetros [Dirección7] y [Nombre8] ; OESTE: [Nombre7] . Según plano catastrado número A-1164082-07, fechado veinte de noviembre del dos mil siete, mide de extensión [Dirección8] , OCHO MIL [Dirección9] QUINCE METROS. El terreno es atravesado por una quebrada en sentido sur a norte, la cual se mantiene debidamente protegida al igual que la existente por la colindancia sur y norte. El inmueble se estimó en DOS MILLONES DE COLONES. LIMITACIONES LEGALES: 1-) El área contigua a las quebradas existentes por la colindancia norte, sur y la que atraviesa el terreno a inscribir en sentido sur a norte, así como el yurro y naciente, según señala el artículo 33, incisos a), de la Ley Forestal Número 7575, constituye área de protección y queda prohibida la corta o eliminación de árboles, así como que el cauce y las aguas de esa corriente son de dominio público (Ley de Aguas, artículos 1, inciso IV, y 3, inciso III).- 2-) En vista de la situación del camino que existe al este de la finca inscrita mediante esta información, ésta quedará afectada por las reservas que indica la Ley General de Caminos Públicos, en cuanto a que el ancho mínimo de las carreteras es de veinte metros y de los caminos vecinales de catorce metros (artículos 19 de la Ley de Informaciones Posesorias y 4 de la Ley General de Caminos Públicos).-”, (folios 136 a 141).- 4.

La Procuraduría General de la República interpuso recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del juzgado de instancia, a los términos que corren a folios 145 a 159.- 5. En la substantación del proceso se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.

Redacta la jueza Vargas Vásquez; y,

CONSIDERANDO:

I.Se comparten los hechos tenidos por probados en la sentencia recurrida al ser acordes con las probanzas constantes en autos. De tal naturaleza en esta instancia se adiciona: 12. El inmueble a titular se encuentra debidamente delimitado mediante cercas en sus colindancias, las cuales se encuentran en buenas condiciones de mantenimiento, ocupándose el promovente de cuidarlas (Ver declaraciones testimoniales de [Nombre10] , [Nombre11] y [Nombre12] de folios 63 a 65, así como acta de reconocimiento judicial de folio 103). 13. El sector de bosque, la zona protectora de las quebradas que atraviesan el inmueble y una naciente existente en el fundo, han sido protegidas por el promovente, quien junto con su transmitente, ha estado en posesión del fundo en forma pública, pacífica, ininterrumpida y con el carácter de dueños desde más de diez años antes de que se presentaran las diligencias de Información Posesoria. (Ver documento de traspaso de folio 13, declaraciones testimoniales de [Nombre10] , [Nombre11] y [Nombre12] de folios 63 a 65, acta de reconocimiento judicial de folio 103, informe del Departamento de Cuencas Hidrográficas del Instituto Costarricense de Acueductos y Alcantarillados de folio 112 e informe de suelos emitido por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria de folios 30 y 31).­

II.La licenciada Lydiana Rodríguez Paniagua, Procuradora Adjunta de la Procuraduría General de la República, interpuso recurso de apelación contra la sentencia emitida a las 7 horas 8 minutos del 21 de julio de 2009, en memorial remitido por fax el día 30, cuyo original fue presentado a estrados el 31 del citado mes y año (folios 145 y 160). En lo medular se mostró inconforme con la titulación del inmueble al estimar que del reconocimiento judicial, prueba testimonial y las manifestaciones del promovente se evidencia que parte del inmueble esta destinado a bosque, siendo que los terrenos forestales y los bosques de las reservas nacionales están afectos al dominio público, Patrimonio Natural del Estado, al menos desde la Ley Forestal 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990, artículos 32 y 33, carácter demanial que mantuvo la Ley Forestal 7575, artículos 13 y 14.

Cita como fundamento de lo anterior varios extractos de resoluciones en las que se hace referencia a las características de los bienes de dominio público y su condición de inalienabilidad e imprescriptibilidad, así como lo que califica la recurrente como la supervivencia del derecho derogado para regular las situaciones jurídicas que nacieron en su época de vigencia; entre ellos, de la Sala Constitucional los votos [Telf1], 15753-2005, [Telf2], [Telf3], 336-1998, 738-2003, 12239-2006, 12240-2006, 12241-2006, del Tribunal de Corte Plena la sentencia de las 10 horas del 18 de marzo de 1992, 1119-90, de la Sala Primera de la Corte los votos 79-1989, 104-1989 y 105-1989, y de la Procuraduría General de la República los dictámenes C-321-2003, C-146-2008, entre otros.­

III.El promovente pretende con este proceso que se ordene inscribir a su nombre en el Registro Público la finca ubicada en Santa Rita de Florencia de San Carlos, [Dirección10] de la provincia de Alajuela, con una medida de 23 hectáreas 7091,97 metros cuadrados, graficada en el plano catastrado A-348899-79 (folios 2 y 20). Dicho bien se ubica fuera de cualquier área silvestre protegida, según certificación emitida por el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente, Energía y Telecomunicaciones (folio 3). De las demás probanzas constantes en autos, concluye el Tribunal que lleva razón la recurrente al afirmar que parte del inmueble está formado por bosque, pues así se indica en el plano citado, en las manifestaciones del recurrente con carácter de declaración jurada, del acta de reconocimiento judicial y de la prueba testimonial. Al verificarse la existencia de bosque en el fundo, resulta aplicable lo dispuesto en el artículo 7 de la Ley de Informaciones Posesorias.

Dicha norma dispone: "Cuando el inmueble al que se refiera la información posesoria esté comprendido dentro de un área silvestre protegida ... Las fincas ubicadas fuera de esas áreas y que tengan bosques, sólo podrán ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios ...". Contra la interpretación que de dicha norma hacía el Tribunal Agrario, exigiendo que la posesión fuera ejercida en forma personal, se planteó una Acción de Inconstitucionalidad ante la Sala Constitucional, alegándose además, que la norma tenía vicios de retroactividad. Al respecto, la Sala emitió el voto 4587-97 de las 15 horas 45 minutos del 5 de agosto de 1997, parcialmente citado por la recurrente, en la que se dispuso: "Se declara parcialmente con lugar la acción y, en consecuencia, que es inconstitucional la interpretación judicial del artículo 7 de la Ley de Informaciones Posesorias No 139 de 14 de julio de 1941, cuyo texto corresponde a la reforma producida por la Ley Forestal No. 7174 del 28 de junio de 1990, de acuerdo con la cual para titular terrenos comprendidos en parques nacionales, reservas biológicas, reservas forestales o zonas protectoras, se requiere posesión personal con diez años de antelación a la fecha de vigencia de la ley o el decreto que crea el área silvestre protegida, y que no favorece en estos casos la posesión transmitida por anteríores poseedores.

Esta sentencia es declarativa y sus efectos retroactivos, sin perjuicio de derechos adquiridos de buena fe. En lo demás se declara sin lugar la acción. Reséñese esta sentencia en el Diario Oficial La Gaceta; publíquese íntegramente en el Boletín Judicial; comuníquese a la Secretaría General de la Corte Suprema de Justicia y notiriquese. En lo demás se declara sin lugar la acción. " De acuerdo a lo anterior, la Sala anuló por inconstitucional la interpretación dada por este Tribunal de exigir posesión personal, pues estimó, es posible aprovechar la transmisión de derechos para poder acreditar fa posesión decenal exigida par la norma. Así mismo, la Sala en la parte considerativa, en relación con el alegato de inconstitucionalidad por irretroactividad de ésta, señaló: "Señala el accionante que el texto de la norma cuestionada infringe el derecho de propiedad y el principio de no aplicación retroactiva de la ley en perjuicio de derechos patrimoniales adquiridos o situaciones jurídicas consolidadas, porque amplía el plazo de diez años de la posesión necesario para adquirir la propiedad por prescripción positiva, y porque se aplica retroactivamente afectando derechos patrimoniales adquiridos especialmente referidos al ejercicio de la posesión.

El artículo 7 párrafo primero de la Ley de Informaciones Posesorias impugnado, cuyo texto es anterior a la última reforma por Ley Forestal No.7575 de 13 de febrero de 1996, regula el caso de la titulación de bienes inmuebles comprendidos dentro de un área declarada parque nacional, reserva biológica, reserva forestal o zona protectora. Señala ese artículo que e! titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la ley o el decreto que creó el área silvestre. La disposición cuestionada regula el caso de titulación de un bien inmueble que ha sido afectado al dominio público con la declaratoria de área silvestre protegida, cualquiera que sea su especificidad. Corresponde ahora determinar si de acuerdo con la hipótesis que contempla la norma impugnada, a la luz de los criterios doctrinarios y jurisprudenciales que informan los institutos de la usucapión y de la posesión necesaria para usucapir, expuestos anteriormente, la norma cuestionada regula un tipo especial de posesión necesaria para adquirir la propiedad sobre los bienes inmuebles, que impone requisitos específicos que pueden infringir el derecho de propiedad o el principio de irretroactívidad de la ley en perjuicio de derechos adquiridos o situaciones jurídicas consolidadas, regulados en la Constitución.

En primer termino, debe señalarse que el artículo cuestionado no modifica -aumenta o disminuye- el plazo de diez años de posesión necesario para usucapir, fijado en el artículo 860 del Código Civil para la generalidad de los casos en que se pretende adquirir la propiedad de los bienes inmuebles por prescripción positiva. La ampliación del plazo que alega el accionante como infractor del derecho a la propiedad no se produce, porque dada la naturaleza del bien que se pretende titular (cosa pública), el plazo de posesión apta para la usucapión debe transcurrir antes de que se produzca la afectación del bien al dominio público. Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley.

Lo anterior es únicamente el resultado natural de aplicar los conceptos sobre el objeto de la posesión y su condíción de ejercicio en calidad de titular, necesarios para la posesión ad usucapionem. Recuérdese que los bienes afectados al dominio público, tengan las especificaciones que tengan, no son susceptibles de adquisición por usucapión, si antes de producirse la afectación no se dieron las condiciones necesarias para la adquisición del derecho. En ese sentido, la disposición cuestionada, a pesar de que en apariencia regula un caso específico de usucapión, no crea un régimen con requisitos diferentes a los establecidos en el Código Civil para la generalidad de los casos. En ese sentido, tampoco se produce el alegado efecto retroactivo de la norma, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son. el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión.

Es decir, la norma no viene a establecer ningún principio diferente -o requisito más riguroso- en relación con la aplicación de las reglas generales de la usucapión. Simplemente especifica la forma en que deben aplicarse esas reglas, lo que coincide con un resultado lógico dada la condición de bien demanial del objeto a titular. De ahí que no se considere que la reforma al artículo 7 de la Ley de Informaciones Posesorias, cuyo texto se impugna, haya introducido un régimen diferente en relación con los requisitos de la usucapión, que haya podido agravar la situación de personas que se encontraban ejerciendo posesión ad usucapíonem en terrenos que fueron declarados de interés público." De acuerdo a lo expuesto por la Sala, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho.

En este caso, lo pretendido titular ni siquiera ha resultado afecto al dominio público mediante una ley o decreto que haya incluido el área pretendida titular dentro de una área silvestre protegida, se trata de un inmueble sin inscribir destinado parcialmente a bosque. Según la Sala, lo dispuesto en el artículo 7 es el resultado natural de aplicar los conceptos sobre el objeto de la posesión y su condición de ejercicio en calidad de titular, necesarios para la posesión ad usucapionen, pues los bienes afectados al dominio público, tengan las especificaciones que tengan, no son susceptibles de adquisición por usucapión, si antes de producirse la afectación no se dieron las condiciones necesarias para la adquisición del derecho. Sobre ese extremo, la Sala agregó que la disposición cuestionada, a pesar de que en apariencia regula un caso específico de usucapión, no crea un régimen con requisitos diferentes a los establecidos en el Código Civil para la generalidad de los casos, por lo que tampoco se produce el alegado efecto retroactivo de la norma.

De ahí que, si la Sala declaró constitucional una norma que permite la titulación de inmuebles ubicados dentro de áreas silvestres protegidas, siempre que se demuestre la posesión decenal, diez años antes de la afectación a dominio público, con mayor razón podría considerarse susceptibles de titulación las fincas ubicadas fuera de dichas áreas, cuya posesión personal o transmitida se acredite diez años antes de la gestión de titulación.­

IV.De acuerdo a lo expuesto, para poder titular el inmueble pretendido inscribir mediante este proceso, es preciso verificar si el promovente ha ejercido posesión decenal antes del planteamiento de su gestión, si ha protegido el recurso forestal y si el fundo está debidamente delimitado por cercas o carriles limpios. Para acreditar la posesión, el promovente ofreció la declaración de tres testigos, conforme lo exige el artículo 6 de la Ley de Informaciones Posesorias. Como prueba de la posesión, el titulante aportó escritura mediante la cual acredita que [Nombre12] le vendió el 7 de mayo de 1982 los derechos posesorios ejercidos sobre el inmueble en forma pública, pacífica, continua y con el carácter de dueño por más de diez años (folio 13). Para acreditar dicha transmisión de derechos posesorios, así como la posesión ejercida por el promovente, éste ofreció la declaración de tres testigos, cuyas declaraciones fueron recibidas el 26 de julio de 2008.

El testigo [Nombre10] , manifestó: "El promovente tiene más de veinticinco años de tener el terreno y de poseerlo, primeramente le perteneció a su padre [Nombre12] , quien lo poseyó por muchos años y luego se lo cedió a su hijo, quien continúa con los actos posesorios al día de hoy. ... Por la (sic) inmueble pasa una quebrada que lo atraviesa, la cual está bien protegida en su área protectora y siempre ha permanecido así. El promovente tiene el terreno dedicado a repastos y otro sector esta comprendido por bosque ..." (folio 63). De la misma forma, el testigo [Nombre11] , señaló: "Tengo como veinticinco años de conocer el fundo que se pretende titular y desde que lo conozco, pertenecía al padre del promovente señor [Nombre12] ... Por el fundo pasa una quebrada que lo atraviesa en gran parte, misma que he observado bien protegida en su margen protectora. El fundo se encuentra debidamente cercado por sus colindancias con los vecinos y la calle pública. ... desde que su padre le cedió el terreno lo ha poseído en forma pública y pacífica ...

El terreno siempre se ha dedicado a la (sic) repastos y tiene un área de bosque que el promovente conserva. ... Las cercas de colindancia están en buen estado, siendo que el promovente les da el mantenimiento necesario ..." (folio 64). Finalmente, [Nombre13] declaró: "... El inmueble primeramente perteneció al padre del promovente señor [Nombre12] ... El terreno esta dedicado repasto charrales y bosque que lo protege, precisamente por donde pasa la quebrada que atraviesa la finca, misma que esta bien protegida en sús margines (sic), por el paso sobre la finca a titular... Las cercas de colindancia están en buen estado, el promovente es quien las mantiene en buen estado y le da el mantenimiento requerido al terreno. Por el fundo discurre una quebrada y he visto un nacientillo de agua, que también está protegida en la margen de esa naciente..." (Folio 65). Por su parte, en el acta de reconocimiento judicial, se hizo constar: "...

El área de la finca se encuentra delimitada con dos hilos de alambre en buen estado... Se llega hasta el vértice nueve en donde se observa que el área de montaña se encuentra delimitada con dos hilos de alambre en buen estado. ... Durante el recorrido no se observa tala de árboles ni nacientes." (Folio 103). De lo expuesto se desprende que el inmueble pretendido titular se encuentra delimitado mediante cercas, las cuales se mantienen en buen estado de conservación. Así mismo, se concluye que efectivamente, parte del bien está destinado a montaña, la cual se encuentra protegida, al igual que la zona protectora de las quebradas que atraviesan el inmueble y la que el testigo [Nombre12] calificó de "nacientillo", cuyas aguas no es necesario sean protegidas para el abastecimiento de las poblaciones cercanas, según informe del Departamento de Cuencas Hidrográficas del Instituto Costarricense de Acueductos y Alcantarillados (folio 112).

La protección del recurso forestal se acredita con la prueba citada y además, con el informe de suelos emitido por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (folios 30 y 31). Por ende, estima el Tribunal que si el titulante logró demostrar el cumplimiento de los requisitos a los que hace referencia el artículo 7 de la Ley de Informaciones Posesorias, cuyo apego a la normativa constitucional declaró la Sala Constitucional, debe autorizarse la inscripción del fundo a su nombre, sin que pueda pretenderse la aplicación en este caso de normas derogadas para denegar la inscripción.­

V. Por lo expuesto, deberá confirmarse la resolución recurrida en lo que ha sido objeto de apelación.­

POR TANTO:

En lo apelado, se confirma la sentencía.

[Nombre14] [Nombre15] [Nombre16] NOTA EXPUESTA POR LA JUEZA [Nombre15] Esta nota se expone en en el sentido de indicar el caso bajo examen no es de naturaleza demanial como lo afirma la apelante. Nótese, el imueble tiene una medida de veintitrés hectáreas siete mil noventa y un metros con noventa y siete decímetros cuadrados, es terreno de potrero no contiene montaña (ver plano catastrado a folio 2, y según estudio de suelos visible a folio 31 la mayor parte del mismo es de pastura natural, de allí implica no es se trata de un bosque primario de importancia de recarga acuífera para abastecer a alguna población de allí no tenga esa relevante característica para que sea considerado un bien demanial. Si no que se trata de un inmueble del cual se ha demostrado el ejercicio de actos posesorios por parte del titulante. La naturaleza del inmueble es de repastos según se observa en la declaración testimonial de folio 64, de allí no se considere sea un bien demanial, por lo que no se comparte los argumentos de la apelante, y tampoco los expuestos en el voto de mayoría con relación a este tema, pues la naturaleza del inmueble es agrícola, por lo que el conteo de la posesión decenal lo es bajo la tesitura de la posesión agraria simple, sin ser necesario entrar a valorar normativa que regula terrenos boscosos, cuya posesión y conteo decenal sería diferente al aplicar al caso bajo examen.- [Nombre15] PROCESO: INFORMACIÓN POSESORIA PROMUEVE: [Nombre1] C+P+N
