Judgment No. 65-2011-SII TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SECOND SECTION. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- Goicoechea, at sixteen hours and ten minutes on treinta de junio del dos mil once.
Ordinary proceeding (proceso ordinario) conducted before the Juzgado Contencioso Administrativo y Civil de Hacienda under case file 06-00452-0163-CA, brought by Nombre72674 , of legal age, married, identification card CED53843, resident of Escazú, against MUNICIPALIDAD DE ESCAZÚ, represented by Nombre38617 , of legal age, married, holder of a degree in Economics, identification card CED29802, resident of Escazú, in his capacity as Mayor, with authority to act as the Municipality’s legal representative.
BACKGROUND

CONSIDERING
Because it is consistent with the record, the list of proven facts in the appealed judgment is approved. II.- GROUNDS OF APPEAL: The appellant asserts that the proven facts merely state the page numbers on which the findings are based, without identifying the evidence establishing them, thereby creating legal uncertainty because it is impossible to know the judge’s reasoning. The appellant also challenges the following proven facts: number 1, because it says nothing and merely lists public institutions without making clear what is deemed established; number 6, because although the Municipality accepted the works as satisfactory, a notation was made regarding the treatment plant stating that this did not constitute acceptance of that work because the matter fell within the jurisdiction of the Ministerio de Salud; number 10, because the appellant considers it contradictory to deem it established that a sanitary order (orden sanitaria) issued by the Ministerio de Salud existed and was not complied with—which establishes the jurisdiction of the Ministerio de Salud, which issued an administrative act (acto administrativo) but did not enforce it—while at the same time holding the Municipality liable for failing to inspect the work and exercise the necessary controls in that regard; facts numbers 12 and 13, because the appellant considers them inconsistent, since it is deemed established that acceptance of the treatment-plant works is the Municipality’s responsibility and, immediately afterward, that the head of the Departamento de Desarrollo Urbano informed the Mayor by official letter that the treatment plant falls within the jurisdiction of the Ministerio de Salud, such that the process of accepting the works does not include the treatment plant; and because the reasoning contradicts the proven facts by stating that the Municipality alleges that complaints regarding the pollution do not fall within its jurisdiction but within that of the Ministerio de Salud or the Instituto de Acueductos y Alcantarillados, and that because the condominiums were nearing completion, the matter was no longer within the Municipality’s purview.
Fact number 15 is challenged because the judge deemed it established that the Instituto de Acueductos y Alcantarillados informed the plaintiff that it had not accepted the Condominios El Cortijo project as satisfactory, which means that she tacitly acknowledges that AyA approval was required and that AyA therefore bears responsibility. Fact number 18 is challenged because, once again, the judge deemed it established that the treatment plant did not fall within municipal jurisdiction. Fact number 21 is challenged because the Judge does not identify the source official letter and deems it proven that the Municipality breached its inspection duty by failing to bring the treatment plant into compliance with the law; moreover, the appellant considers that the lower-court judge (a quo) prejudged the matter and held the Municipality liable without evidence beyond the statements made by the Procuraduría General de la República.
Fact number 24 is challenged because the Judge deemed the causal link (nexo causal) between the conduct and the non-pecuniary damages established without identifying any supporting evidence. Citing Articles 1, 7, 10 and 43 of Decreto Ejecutivo 26042-S MINAET, Article 132 of the Ley de Conservación de la Vida Silvestre, and Article 43 of the Regulations (which establishes that the Ministerio de Salud is responsible for monitoring water quality in accordance with operational reports), the ground of appeal states that the Judge was incorrect in finding that the pollution originated from the Municipality’s failure to conduct inspections, because the División de Saneamiento Ambiental del Ministerio de Salud and the Ministerio del Ambiente y Energía exist for that purpose. It further states that, in this particular case, the judge also failed to consider all the actions taken by the Municipality in response to the complaint filed by the plaintiff: the Municipal Corporation sampled the water and, upon receiving the result showing fecal matter in the water, notified the condominium administration to correct the problem; it coordinated inspections of the treatment plant; and it pursued other actions to resolve the matter, such as analyzing the possibility of installing pipes, which was ruled out because it was determined that this would instead complicate the matter by making it impossible to see what was occurring with the naked eye and would merely move the sewage discharge farther away rather than correct the problem.
The appellant therefore argues that there was no omission (conducta omisiva), but rather that the matter falls within the jurisdiction of other institutions, such as the Ministerio de Salud. Furthermore, the Municipality notified the Condominium Administration on several occasions to correct both the discharge point and the operation of the treatment plant, but the necessary corrective measures have not yet been taken. The Condominium Administration was also asked to provide monthly operational reports and to coordinate with the central level of the Ministerio de Salud so that random samples could be taken from the influent for more continuous cross-monitoring, which would help ensure that the condominium administration responsibly undertook the treatment of the sewage it generates. The Municipal Administration also asked the Área Rectora de Salud to issue the corresponding sanitary orders declaring the building uninhabitable.
A criminal complaint (denuncia penal) was also filed with the Fiscalía de Pavas against Guimonsa S.A., the current administrator of Condominio El Cortijo. The appellant adds that, regarding the apparent health problems affecting Mr. Nombre72674’s family, it should be clarified that the foul odors from the wastewater discharged by the condominium’s sewage-treatment plant are perceived more intensely at Mr. Nombre72674’s residence because it was built within a protected area (zona de protección) along the stream, making it more susceptible to those odors. With regard to non-pecuniary damages, the appellant argues that the judge did not identify the documentary and testimonial evidence on which she relied to assess subjective non-pecuniary damages (daño moral subjetivo), instead basing her decision on an assumption. The appellant also considers the amount of eight million colones disproportionate for a period of 4 years, which amounts to two million colones per year and, in the appellant’s view, is neither reasonable nor proportionate; moreover, the plaintiff’s calculation is based on an incorrect period.
It is further asserted that the alleged omission did not occur, and a copy of sanitary order no. 100-E-(R)-2010 is submitted as evidence thereof. Regarding costs, the appellant requests that the award be reversed and that the matter be decided without a specific award of costs. Regarding the plaintiff’s pleading dated 28 de setiembre, the appellant argues that the criminal complaint was not filed until the year 2009 because certainty regarding the irregularities was not obtained until then and that, in any event, steps were also taken for the Ministerio de Salud to declare the condominium uninhabitable and order its evacuation. The evacuation orders remain stayed because the condominium owners filed a pre-suit interim measure (medida cautelar ante causam) before the Tribunal Contencioso. The problem first became known in the year 2003. Finally, the appellant offers, as additional evidence for adjudication (prueba para mejor resolver), the appeal filed against the judgment of the lower-court judge.-
As additional evidence for adjudication at this second instance, the appellant submits the written appeal at issue, received on 8 de setiembre del 2010 and appearing at page 541. That additional evidence is rejected because it does not satisfy the requirements of Article 575 of the Código Procesal Civil and because, moreover, it does not technically constitute evidence, its nature instead being that of an appeal.
Section 574 of the Código Procesal Civil provides that, upon appearing before the higher court, the appellant must state the grounds for appeal against the challenged decision. “Stating the grounds for appeal” means identifying the aspects of the appealed judgment that the appellant considers adverse to the appellant’s interests, contrary to law, or contrary to the merits of the record. Strictly speaking, the purpose of such a pleading is not to challenge the opposing party’s arguments (since that was already done before the lower court), nor to reiterate the arguments supporting the complaint, but rather to challenge the reasoning of the judgment—that is, the reasoning of the court a quo. As the Sala Primera de la Corte Suprema de Justicia has held (see judgments Nº 195-2002 at 16:15 hours on 20 de febrero del 2002 and Nº 00255 at 10:45 hours on 4 de abril del 2008), the appeal defines the jurisdiction of the appellate court (tribunal de alzada), because challenges to judicial decisions are governed by the party-presentation principle (principio dispositivo).
An appeal in this area is not a proceeding conducted upon mere request, but rather a formal and technical remedy. It is at the initiative of the interested party and through that party’s specific application that the judge who issued the decision, or the judge’s superior, depending on the type of remedy involved, must analyze the decision to determine whether it complies with the law. To perform this review function, specific grounds showing prejudice must be presented; those grounds delimit the review of the decision, and the adjudicator may not address matters other than those challenged. The appellate court is limited to examining the claims submitted and may consider only the issues that are the subject of the appeal; it may not conduct an ex officio review (examen oficioso) of the lower-court judge’s decision. The appellant must therefore clearly and expressly state the objections to the challenged decision and must explain clearly and precisely the nature of the errors committed by the court a quo; in light of these requirements, the appeal must be self-contained and fully comprehensible.
As previously noted, under the party-presentation principle, the judgment is reviewed based on the arguments submitted by the parties when stating their opposition; accordingly, it is on the basis of the grounds for appeal that the appellate court proceeds to assess the specific case.
In this case, the dissatisfied party presents a series of arguments that will now be analyzed one by one, both those constituting grounds for appeal (agravios) and those that technically do not constitute grounds for appeal. The appellant challenges established facts (hechos probados) numbers 1, 6, 10, 12, 13, 15, 18, 21, and 24, as well as the following arguments: With respect to the first fact, the appellant states that the sewage treatment plant at Condominio El Cortijo in Escazú had pollution problems, followed by a list of the authorities involved. Although that fact cites several pages of the record without specifically stating their content, it can readily be inferred from reading them that it has indeed been established that the treatment plant had pollution problems. While it does not state that those authorities were involved in investigating that situation, it is clear that complaints were filed with them, as clarified in the second fact.
Regarding the appellant’s claim that the established facts merely indicate the page numbers on which the findings are based, without identifying the evidence supporting them, thereby creating legal uncertainty (inseguridad jurídica) because it is impossible to know the judge’s reasoning, that argument is rejected. A simple reading of the pages of the case file cited in parentheses shows that they contain the basis on which the a quo found a fact to have been established. Accordingly, there was no denial of the opportunity to defend (indefensión), since the interested party could readily consult those pages and determine for itself whether they reasonably supported the conclusion reached by the lower court, offering, as appropriate, arguments and evidence to prove that conclusion or a different one, as it deemed fit. Therefore, neither its right of defense (derecho de defensa) nor due process (debido proceso) was per se violated, and there are no grounds for nullity (nulidad).
It should be recalled that nullity applies solely and exclusively when a denial of the opportunity to defend occurs, where the grounds and evidence are entirely concealed. That did not occur in this case, since the page numbers where the evidence supporting the judgment is located were expressly identified. With respect to the sixth fact, the a quo found it established that the Municipality granted a construction permit (permiso de construcción) to Condominio El Cortijo and accepted the works as satisfactory (recibió las obras a satisfacción) on 13 de enero del 2006, and that the reported pollution problem persisted on that date. The appellant objects that, although this is true, official letter DU-1431-2005-EXTERNO includes the following reservation: “... Regarding the treatment plant, this department determines that it is a matter within the jurisdiction of the Ministry of Public Health; therefore, acceptance of this work is not considered and is consequently omitted.” This Court approves the fact as determined by the a quo because page 253 of the administrative record (expediente administrativo) states verbatim: “... it is the determination of this Department to grant final approval for the acceptance of the works for that project pursuant to municipal permit Nº 185-2002 del 7 de junio del 2002.” Thus, there is an express act by the Urban Development Department of the Municipalidad de Escazú recording final approval of the acceptance of the project’s works pursuant to the municipal permit.
Moreover, the statement cited by the appellant appears in a notice to comply (prevención) in which the Municipality informs Constructora Kirebe S.A. that the cyclone fence encroaching upon an adjoining watercourse is authorized to remain because the watercourse is not in the public domain; imposes a fine because the swimming pool and recreational pavilion were not included in the construction plans; and further states that it declines to rule on the treatment plant because it considers the matter to fall within the jurisdiction of the Ministry of Health. However, that statement was made in a notice to comply during the process for acceptance of the works as satisfactory, and that assessment is not reflected in the approval ultimately granted and recorded on page 253, where the works were accepted as satisfactory without any reservation. With respect to fact 10, the appellant argues that it is contradictory to find that a health order (orden sanitaria) issued by the Ministry of Health existed and was not complied with, while nevertheless holding the Municipality liable for failing to inspect the project and to exercise the necessary oversight in that regard.
As to this argument concerning an apparent contradiction, this Authority considers that no such contradiction exists because, in this case, several institutions charged with safeguarding the environment and ensuring compliance with urban-planning and health legislation are involved, including the Ministry of Health, the Ministry of the Environment, and the Municipality of the locality. This entails shared responsibility (corresponsabilidad) among various institutions; the plaintiff could have sued one or all of them. Because, in this particular case, the plaintiff sued the Municipalidad de Escazú, the a quo could validly rule only with respect to that institution, recognizing that it was indeed obligated to safeguard the environment and enforce urban-planning regulations, which it clearly failed to do because, had it done so (hypothetical elimination), the pollution that harmed the plaintiff herein would not have occurred.
The fact that other institutions may also be liable does not in any way eliminate the Municipality’s share of joint responsibility (co-responsabilidad), and this ground for appeal is therefore without merit. Regarding facts 12 and 13, the appellant contends that there is an inconsistency because it was found that acceptance of the treatment plant works was the Municipality’s responsibility and, immediately thereafter, that the Municipality stated in an official letter that the process for accepting the works did not include the treatment plant, which was not within the Municipality’s jurisdiction. Regarding this ground for appeal, the Court reiterates what was stated concerning fact 6: this argument is without merit because an act exists accepting the works as satisfactory without any reservation. It is in another act—one imposing a fine because the swimming pool and recreational pavilion were not included in the construction plans—that the reservation is also made; however, the acceptance of the works says nothing in that regard.
With respect to fact 15, the ground for appeal is also rejected because, as stated supra, the concurrent responsibility of other institutions does not relieve the Municipality of liability. The Municipality was also obligated to ensure that all authorizations from the other institutions having jurisdiction over the matter were in order, and it should have denied the permits and acceptance of the works if any of those institutions had not approved the project at issue. Regarding fact 18, the ground for appeal asserting that the treatment plant does not fall within municipal jurisdiction is also rejected, because that is not what fact number 18 states. Rather, it states that the Municipality said that the company was required to satisfy the requirements applicable to the treatment plant, including approval from the Ministry of Health. This does not mean that the Municipality was not required to verify that the approvals issued by those other competent institutions were in order before granting the construction permit and accepting the works as compliant (recibo conforme de las obras).
The specific issue is that the Municipality has exclusive jurisdiction to grant or deny construction permits and to accept works as compliant; for such a permit and acceptance to be granted, the interested party must have all approvals from the Ministry of Health and the Ministry of the Environment. The Municipality must therefore verify compliance with those requirements and deny the permit if they have not been met. If any institution denied its approval or acceptance of the works and the Municipality failed to verify that those requirements were lacking, the Municipality breached its duties and consequently incurred liability. The General Regulations on Environmental Impact Assessment Procedures (Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental) clearly establish, among the requirements for processing construction and renovation permits, that in the case of sewage treatment plants, the construction plans approved by the Human Environment Protection Directorate of the Ministry of Health must first be submitted, and that those approvals must then be presented to the Municipal Corporation for purposes of processing the construction permit.
It is precisely the Urban Development Department that must, first and foremost, verify compliance with all these requirements when processing applications for municipal construction permits, as well as supervise their effective and efficient implementation upon acceptance of the works. It is therefore inadmissible for the Municipality to defend itself by asserting that matters relating to the sewage treatment plant fall within the exclusive jurisdiction of the Ministry of Health, when it is precisely the Municipality’s responsibility to ensure, before issuing the permit and before accepting the works, that the interested party has obtained the Ministry of Health’s approval of the treatment plant and that the plant is operating optimally at the time the works are accepted. Regarding fact number 21, although the a quo does not state the opinion number, she does identify the page number in the court record (expediente judicial) where that opinion appears.
A review of page 362 shows that the opinion number is AEP-298-2008 del 5 de junio del 2008. Accordingly, that omission does not warrant setting aside the judgment, and this Court concurs with the conclusions of that opinion based on the applicable provisions of the Municipal Code. Regarding fact 24, the ground for appeal asserting that the causal link (nexo causal) between the conduct and the non-pecuniary harm (daño moral) was found to have been established without reference to any evidence is also rejected. The a quo identifies in parentheses the page of the court record documenting the failures concerning the treatment plant, and facts 22 and 23 also set forth all the suffering that the plaintiff has had to endure, which constitutes evidence of the causal link. These same reasons require rejection of the ground for appeal concerning non-pecuniary harm because the Municipality’s breach and the suffering endured by the plaintiff have been established.
For all these reasons, this Authority affirms the judgment on appeal insofar as it held the Municipalidad de Escazú liable for the non-pecuniary harm suffered by the plaintiff due to the municipal corporation’s failure to act (inactividad). The Municipality’s failure to act consisted, on the one hand, of failing to verify that, before the permit was granted for the Condominio El Cortijo project, the project had obtained all endorsements and approvals from the various institutions sharing responsibility in this area, since those authorizations are prerequisites for granting the municipal permit. On the other hand, the local government body also failed to act when it neglected to supervise whether the works were performed in accordance with the parameters of the plans and endorsements obtained. The urban-planning legislation system is designed to require every human undertaking to include planning and provision for the services and consequences arising from the use made of the land and the buildings erected upon it, and to require the Municipality to preventively address the problems that human coexistence may produce.
It is only when the Municipality has failed to fulfill its obligations that the General Health Law (Ley General de Salud) provides that a complaint may be filed with the Ministry of Health (Ministerio de Salud) for environmental pollution (contaminación ambiental), so that it may conduct the necessary studies and issue the necessary health orders (órdenes sanitarias) and eviction orders (desalojos). However, the purpose of the entire legal framework is to avoid having to resort to such measures through proper municipal management and oversight, by means of its police powers (poderes de policía) in urban matters, the process for granting construction permits and licenses, and the acceptance of works (recepción de obras). In this specific case, because the Municipalidad de Escazú failed to properly inspect the project known as Condominio El Cortijo, environmental pollution occurred, and it became necessary to resort to the applicable regulations in order to restore order in the community.
For all the reasons outlined above, the Municipalidad de Escazú is liable for the pollution that occurred, even though it subsequently took all appropriate action in response to the complaint filed by the plaintiff and other residents. The fact remains, however, that had it diligently fulfilled its duties during the initial stages of construction of the aforementioned project, the pollution would not have occurred, nor would it have been necessary to undertake all the proceedings before the various authorities that subsequently became necessary. As to the appellant’s grievance that the house belonging to Nombre72674 is allegedly built within the protected area (zona de protección) of the watercourse and that, because it was purportedly constructed unlawfully, Nombre72674 therefore has no right to seek to hold the Municipality liable in these proceedings, it has not been established that the house belonging to Nombre72674 was in fact built within a protected area or whether it has the required permits.
In any event, that issue is not under consideration in these proceedings, and the interested party must resort to the appropriate forum if it wishes to bring an action in that regard. It must also be understood that, even if that fact were ultimately established, it would not release the Municipality from joint liability (co-responsabilidad) for what occurred in connection with the condominium in question, as has been consistently stated. Finally, regarding the assessment of non-pecuniary damages (daño moral) at Eight million colones, given that this amount covers approximately 4 years, it represents compensation of Five thousand five hundred fifty-five colones per day for subjective non-pecuniary harm (daño moral subjetivo) caused by having to endure nauseating odors in the home and having to eat, sleep, and remain under such unhealthy and unpleasant conditions. This amount is neither irrational nor disproportionate in view of the severity of the harm suffered as a result of the Municipality’s inaction, despite its responsibility to safeguard human coexistence within the canton in a planned, organized, and rational manner.
As to the grievance that the a quo did not state the evidence on which she based her conclusion and assessment of non-pecuniary damages, that grievance is rejected because our domestic case law has repeatedly held that non-pecuniary harm may properly be assessed in re ipsa, and therefore “…on some occasions, the commission of the negligent act is sufficient for the damage to arise from it, in accordance with the sound assessment of the trial judges, when they may infer the damage on the basis of circumstantial evidence (Sentencia N° 114 de las 16:00 hrs del 2 de noviembre de 1979).” Therefore, harm to non-pecuniary interests (lesión moral) may be established through human presumptions inferred from circumstantial evidence, and thus proof thereof is “in re ipsa,” since it primarily affects honor, health, privacy, and integrity, among other interests. In this connection, the award of costs is likewise neither incorrect, disproportionate, nor unreasonable.
Finally, the appellant asserts that the lower court (a quo) committed the defects of inconsistency (incongruencia) and failure to state reasons (falta de fundamentación) in its ruling; however, the nature and location of those defects are not specified, and the assertion is therefore rejected. Accordingly, the present appeal must necessarily be denied and the ruling under review affirmed, as is hereby done.-
THEREFORE
As to the matters challenged on appeal, the appealed judgment is affirmed. LET NOTICE BE SERVED.

Voto Nº 65-2011-SII TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SECCIÓN SEGUNDA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- Goicoechea, a las dieciséis horas diez minutos del treinta de junio del dos mil once.
Proceso Ordinario tramitado ante el Juzgado Contencioso Administrativo y Civil de Hacienda bajo el expediente 06-00452-0163-CA, promovido por Nombre72674 , mayor, casado, cédula CED53843, vecino de Escazú, contra la MUNICIPALIDAD DE ESCAZÚ representada por Nombre38617 , mayor, casado, Licenciado en Ciencias Económicas, cédula CED29802, vecino de Escazú, en su calidad de Alcalde con facultades de representante legal de la Municipalidad.
RESULTANDO
Redacta la Jueza Jara Velásquez; y
CONSIDERANDO
Por ser acorde con el mérito de los autos, se aprueba el elenco de hechos probados de la sentencia apelada. II.- AGRAVIOS DE LA APELACIÓN: La recurrente acusa que los hechos probados únicamente indican los números de los folios con base en los cuales se tiene por probados los hechos pero que no se indica los elementos de prueba que los demuestran, creando inseguridad jurídica por cuanto no es posible inmiscuirse en los pensamientos de la juzgadora. Además se objeta los siguientes hechos probados: el número 1 por cuanto no se dice nada y se hace un listado de instituciones públicas sin que quede claro qué se tiene por acreditado, el número 6 por cuanto si bien la Municipalidad recibió las obras a satisfacción en cuanto a la planta de tratamiento se dejó razón de que no se considera recepción de dicha obra por ser un asunto competencia del Ministerio de Salud, el número 10 por cuanto considera el recurrente que es un contrasentido que se tenga por acreditado que existió una orden sanitaria del Ministerio de Salud que no se cumplió, lo que acredita la competencia del Ministerio de Salud que emite un acto administrativo y no lo ejecuta pero a la vez se condene a la Municipalidad por falta de fiscalización de la obra y no ejercer los controles necesarios al respecto, hechos número 12 y 13 por cuanto considera existe incongruencia por cuanto se tiene por acreditado que la recepción de las obras de la planta de tratamiento es responsabilidad de la Municipalidad y seguidamente que mediante oficio el jefe del Departamento de Desarrollo Urbano le indicó al Alcalde que la planta de tratamiento es competencia del Ministerio de Salud, por lo que el proceso de recepción de obra no incluye la planta de tratamiento, y en el considerando se contradice los hechos probados con el texto que indica que la Municipalidad alega que lo de las denuncias por la contaminación no es competencia suya sino del Ministerio de Salud o el Instituto de Acueductos y Alcantarillados y que por estar finalizando los condominios ya no era de resorte de la Municipalidad.
Hecho número 15 por cuanto la juzgadora tiene por acreditado que el Instituto de Acueductos y Alcantarillados le informó al actor que el proyecto de Condominios El Cortijo no fue recibido a satisfacción por ellos, eso quiere decir que reconoce tácitamente que debe haber aprobación por parte del AyA y que por ende existe responsabilidad del mismo. Hecho número 18 por cuanto se reitera que la juzgadora tiene por acreditado que la planta de tratamiento no es del resorte municipal. Hecho número 21 por cuanto la Jueza no indica el oficio fuente y tiene por probado que la Municipalidad incumplió con su deber de fiscalización no ajustando la planta de tratamiento a derecho, aparte de que considera el recurrente que la a quo adelanta criterio y condena a la Municipalidad sin mayor prueba que lo manifestado por la Procuraduría General de la República. Hecho número 24 por considerar que la Jueza tiene por acreditado el nexo causal entre la conducta y el daño moral sin indicación de elemento probatorio alguno.
Indica el agravio, citando los artículos 1, 7, 10 y 43 del Decreto Ejecutivo 26042-S MINAET, 132 de la Ley de Conservación de la Vida Silvestre y 43 del Reglamento (donde se establece que es competencia del Ministerio de Salud fiscalizar la calidad del agua de acuerdo a los reportes operacionales), que no lleva razón la Juzgadora al indicar que el origen de la contaminación se tuvo en la falta de fiscalización de la Municipalidad por cuanto para eso existe la División de Saneamiento Ambiental del Ministerio de Salud y el Ministerio del Ambiente y Energía, y que en el caso en concreto además la juzgadora no tomó en consideración toda la labor desplegada por la Municipalidad en cuanto a la denuncia presentada por el actor en el sentido de que la citada Corporación Municipal realizó muestreo de aguas y cuando tuvo el resultado de la materia fecal en el agua se notificó a la administración del condominio que corrigiera el error así como en el sentido de que se coordinó la realización de inspecciones en la planta de tratamiento y en cuanto a que se ha buscado otras acciones para solucionar el asunto como el análisis del entubado, descartándose el mismo por cuanto se determinó que más bien se complicaba el asunto porque no se podía ver lo que ocurría a simple vista y lo que fomenta es simplemente el alejamiento del vertido de aguas negras y no la corrección del problema, por lo que argumenta que no ha habido conducta omisiva sino que el asunto es competencia de otras instituciones como el Ministerio de Salud.
Además, el Municipio notificó en varias ocasiones a la Administración del Condominio para que corrigiera tanto el punto de desfogue como el funcionamiento de la planta de tratamiento, sin que a la fecha se hayan dado las medidas correctivas necesarias. Además se le pidió a la citada Administración del Condominio que aportara informes de operaciones mensuales y que se coordinara con el nivel central del Ministerio de Salud para realizar muestreos aleatorios al afluente para un control cruzado más continuo lo que vendría a garantizar que la administración del condominio asumiera responsablemente el tratamiento de las aguas negras que genera. También la Administración Municipal ha solicitado al Área Rectora de Salud que gire las órdenes sanitarias correspondientes declarando inhabitable dicha edificación. Y también se presentó una denuncia penal ante la Fiscalía de Pavas contra la sociedad Guimonsa S.A. que es la actual administradora del condominio El Cortijo.
Agrega que en cuanto a los aparentes problemas de salud que aquejan a la familia el señor Nombre72674 se debe aclarar que los malos olores de las aguas de vertido que salen de la planta de tratamiento de aguas negras del condominio de cita se perciben de una forma más intensa en la vivienda del señor Nombre72674 toda vez que ésta se edificó en una zona de protección de la quebrada, lo que la hace más vulnerable a que se perciban dichos olores. En cuanto al daño moral alega el recurrente que no indica la jueza en cuál prueba documental y testimonial se fundamentó para fijar el daño moral subjetivo sustentandose en una suposición; además estima desproporcionado el monto de Ocho millones de colones para cubrir el período de 4 años, lo que redunda en Dos millones de colones por año lo que estima que no es razonable ni proporcionado, y que el cálculo que hace la parte es sobre un lapso incorrecto.
Además se indica que la conducta omisiva imputada no es tal y para constancia aporta copia de la orden sanitaria nº 100-E-(R)-2010. En cuanto a las costas solicita se revoque la condena y se resuelva sin especial condenatoria en cuanto a las costas. En torno al escrito de fecha 28 de setiembre del actor, argumenta el recurrente que se interpuso la denuncia penal hasta el año 2009 porque hasta ese momento se tuvo certeza de las irregularidades y que en todo caso se gestionó también para que se declarara inhabitable el condominio por parte del Ministerio de Salud así como el desalojo. Las órdenes de desalojo se mantienen en suspenso porque los condóminos presentaron medida cautelar ante causam ante el Tribunal Contencioso. La problemática se empezó a conocer desde el año 2003. Finalmente se ofrece como prueba para mejor resolver el recurso de apelación interpuesto contra la sentencia del a quo.-
El recurrente aporta como prueba para mejor proveer en esta segunda instancia el escrito del recurso que nos ocupa recibido en fecha 8 de setiembre del 2010 y que rola a folio 541. Dicha prueba para mejor proveer se rechaza por no cumplir con los supuestos del artículo 575 del Código Procesal Civil y por cuanto además no constituye técnicamente una prueba, siendo que su naturaleza es más bien la de un recurso de apelación.
El numeral 574 del Código Procesal Civil dispone que en el acto de comparecer ante el superior, el apelante debe expresar agravios contra la resolución cuestionada. "Expresar agravios" significa poner de manifiesto los aspectos de la sentencia recurrida que aquél considera adversos a sus intereses, contrarios a derecho o al mérito de los autos. El sentido de dicho alegato no es, en rigor, combatir los argumentos de la contraparte (pues eso ya se hizo en instancia), ni una reiteración de las argumentaciones que fundamentaron la demanda, sino combatir los argumentos de la sentencia; es decir, los del aquo. Conforme lo ha señalado la Sala Primera de la Corte Suprema de Justicia (véase las sentencias Nº 195-2002 de las 16:15 horas del 20 de febrero del 2002 y Nº 00255 de las 10:45 horas del 4 de abril del 2008), el recurso delimita la competencia del tribunal de alzada, toda vez que en materia de impugnaciones rige el principio dispositivo.
La apelación en ésta materia, no es rogatoria, sino por demás un recurso formal y técnico. Es por iniciativa del interesado y a través de su gestión específico, que el Juez que dictó la resolución o su superior, según sea el tipo de recurso de que se trate, debe analizarla, para determinar si se encuentra o no ajustada a derecho. Para llevar a cabo esa función contralora, es menéster la exposición de motivos concretos de agravio, los cuales delimitarán el examen de lo resuelto, no pudiendo el juzgador abarcar aspectos diversos a los reclamados. El Tribunal de alzada se restringe al estudio de los cargos sometidos y sólo podrá conocer de los puntos objeto del recurso, no pudiendo verificar un examen oficioso de lo decidido por el Juez de instancia. Se requiere entonces que el apelante formule de manera diáfana y manifiesta las objeciones que tiene contra la resolución impugnada, estando obligado a explicar, clara y precisamente, en qué radican los yerros cometidos por el a-quo debiendo el recurso, en orden a esas exigencias, bastarse a sí mismo, en cuanto a su cabal entendimiento.
Conforme se ha venido señalando, a partir del principio dispositivo, la sentencia se revisa a partir de los argumentos que brindan las partes al expresar su oposición, motivo por el cual es a partir de los agravios, que el Tribunal de alzada entra a valorar el caso concreto.
En la especie, la parte disconforme expone una serie de alegatos que se procede a analizar a continuación uno por uno, tanto los agravios como los que técnicamente no constituyen agravios. El apelante objeta los hechos probados número 1, 6, 10, 12, 13, 15, 18, 21, 24 así como los argumentos siguientes: En cuanto al hecho primero indica que la planta de tratamiento de aguas negras del Condominio El Cortijo en Escazú presentaba problemas de contaminación y luego se hace un listado de autoridades involucradas, si bien en dicho hecho se indica varios folios sin expresarse concretamente el contenido de dichos folios de la lectura de los mismos es fácil desprender que efectivamente está demostrado que la planta de tratamiento presentaba problemas de contaminación, y si bien no se dice que esas autoridades fueron las que estuvieron involucradas en el estudio de dicha situación es claro que ante dichas autoridades se presentó quejas tal y como se aclara en el hecho segundo.
En cuanto a que la recurrente acusa que los hechos probados únicamente indican los números de los folios con base en los cuales se tiene por probados los hechos pero que no se indica los elementos de prueba que los demuestran, creando inseguridad jurídica por cuanto no es posible inmiscuirse en los pensamientos de la juzgadora, dicho alegato se rechaza por cuanto de la simple lectura de los folios del expediente consignados entre paréntesis se desprende que allí se encuentra el fundamento con base en el cual el a quo tuvo por demostrado un hecho, de manera que no hay tal indefensión por cuanto el interesado bien podía dirigirse hacia esas páginas y constatar por sí mismo si de allí se desprendía razonablemente la conclusión a la que arribó el inferior o no, ofreciendo en su caso los argumentos y evidencias para demostrar esa conclusión u otra distinta, según considerara, de manera que per se no se ha violentado su derecho de defensa ni el debido proceso, por lo que no hay nulidad alguna.
Recordemos que la nulidad procede única y exclusivamente cuando se genera indefensión, cuando hay ocultamiento total de los fundamentos y evidencias, cosa que no ha ocurrido en la especie toda vez que se hizo explícita el número de página en donde se encuentra los elementos de convicción que apoyan el fallo. En cuanto al hecho sexto la a quo tuvo por demostrado que la Municipalidad otorgó permiso de construcción al Condominio El Cortijo y recibió las obras a satisfacción en fecha 13 de enero del 2006 y que para esa fecha persistía el problema de contaminación denunciado. El apelante objeta que si bien eso es cierto, en el oficio DU-1431-2005-EXTERNO se hace la salvedad de que: "... En cuanto a la planta de tratamiento este departamento dispone que es un asunto de competencia del Ministerio de Salud Pública, por lo que no se considera recepción de esta obra y por consiguiente se omite" Esta cámara aprueba el hecho tal y como está considerado por parte del a quo por cuanto a folio 253 del expediente administrativo textualmente se lee: "... es disposición de este Departamento dar el visto bueno definitivo del recibimiento de obras de dicho proyecto conforme el permiso municipal Nº 185-2002 del 7 de junio del 2002." de manera tal que hay un acto expreso del Departamento de Desarrollo Urbano de la Municipalidad de Escazú donde consta el visto bueno definitivo del recibimiento de obras del proyecto conforme con el permiso municipal y por cuanto la manifestación a la que hace alusión el apelante se encuentra en una prevención donde la Municipalidad comunica a Constructora Kirebe S.A. que se autoriza la permanencia de la malla ciclón que invade un curso de agua colindante por cuanto no es un cauce de dominio público, se impone una multa por no estar contemplados en los planos constructivos la piscina y el rancho recreativo y además se indica que se omite pronunciarse respecto de la planta de tratamiento por considerar que se trata de un asunto competencia del Ministerio de Salud, pero esa manifestación se hizo en una prevención durante el trámite de recepción de las obras a satisfacción y esa apreciación no se ve reflejada en el visto bueno que al final se da y que consta a folio 253, en donde se tiene por recibidas las obras a satisfacción sin hacer ninguna salvedad.
En cuanto al hecho 10 alega el recurrente que es un contrasentido que se tenga por acreditado que existió una orden sanitaria del Ministerio de Salud que no se cumplió y que sin embargo se condene a la Municipalidad por falta de fiscalización de la obra y no ejercer los controles necesarios al respecto. En lo relativo a este argumento de aparente contradicción, en realidad estima esta Autoridad que no existe tal contradicción, porque en la especie confluye una serie de instituciones obligadas a velar por el medio ambiente y por el cumplimiento de la legislación urbanística y sanitaria, tales como el Ministerio de Salud, el Ministerio del Ambiente y la Municipalidad de la localidad. Ello implica una corresponsabilidad de diversas instituciones; y el actor bien pudo demandar a una o a todas ellas; y como en el caso concreto a quien demandó fue a la Municipalidad de Escazú, es únicamente respecto de ésta institución que el a quo podía válidamente resolver, reconociendo que dicha institución sí se encontraba obligada a velar por el ambiente y las normas urbanísticas, lo que evidentemente no hizo, porque de haberlo hecho (supresión hipotética) no se hubiera dado el resultado de la contaminación que perjudicó al aquí actor.
El hecho de que haya otras instituciones que también sean responsables no elimina para nada la cuota de co-responsabilidad que le cabe a la Municipalidad, y por ello este agravio no resulta de recibo. En cuanto a los hechos 12 y 13 expone el agraviante que considera que existe una incongruencia por cuanto se tiene por acreditado que la recepción de las obras de la planta de tratamiento es responsabilidad de la Municipalidad y seguidamente que mediante oficio la Municipalidad indica que el proceso de recepción de la obra no incluye la planta de tratamiento, lo que no era competencia de la Municipalidad. En cuanto a este agravio se reitera lo dicho respecto del hecho 6, en el sentido de que dicho alegato no es de recibo por cuanto existe un acto que recibe las obras a satisfacción sin ninguna reserva, y es en otro acto, que constituye una imposición de una multa por no estar contemplados en los planos constructivos la piscina y el rancho recreativo, en donde además se hace dicha salvedad; pero en la recepción de obras no se dice nada al respecto.
En cuanto al hecho 15 se rechaza también el agravio por cuanto, tal y como se dijo supra, el hecho de que también confluya la responsabilidad de otras instituciones no exime de responsabilidad a la Municipalidad, la que también tenía la obligación de velar por que todas las autorizaciones de las otras instituciones también competentes en la materia, estuvieran en regla, y debió haber denegado los permisos y recibo de obras en el caso de que alguna de ellas no diera su visto bueno en cuanto al proyecto de marras. En cuanto al hecho 18 se rechaza también el agravio en el sentido de que la planta de tratamiento no es competencia municipal, por cuanto eso no es lo que dice el hecho número 18, sino que la Municipalidad dijo que la empresa requería los requisitos propios de la planta de tratamiento, entre los cuales está el visto bueno del Ministerio de Salud, pero ello no quiere decir que la Municipalidad no debiera fiscalizar que dichos vistos buenos de esas otras instituciones competentes estuvieran en regla antes de otorgar el permiso de construcción y el recibo conforme de las obras.
El asunto concreto es que a la Municipalidad le compete con exclusividad el tema de conceder o denegar los permisos de construcción y el recibo conforme de obras, y para otorgar dichos permisos y recibo conforme es requisito que el interesado cuente con todos los vistos buenos del Ministerio de Salud y Ministerio del Ambiente; debiendo por ende la Municipalidad fiscalizar esos cumplimientos, y denegar el permiso si ello no es así. Si alguna institución denegó el visto bueno o el recibo de las obras, y la Municipalidad no fiscalizó la falta de esos requisitos, incurrió la Municipalidad en un incumplimiento de sus deberes y por ende en responsabilidad. El Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental establece claramente dentro de los requisitos para tramitar permisos de construcción y remodelación que en caso de plantas de tratamiento de aguas negras de previo debe presentarse los planos constructivos aprobados por la Dirección de Protección al Ambiente Humano del Ministerio de Salud y que luego esas aprobaciones se deben presentar ante la Corporación Municipal para efectos de tramitar el permiso de construcción.
Es justamente el Departamento de Desarrollo Urbano el que debe en primerísimo lugar fiscalizar el cumplimiento de todos estos requisitos a la hora de tramitar las solicitudes de permiso municipal de construcción, así como fiscalizar su implementación eficaz y eficiente a la hora de la recepción de las obras, de manera que no resulta admisible que se excepcione la Municipalidad diciendo que lo relativo a la planta de tratamiento de aguas negras es competencia exclusiva del Ministerio de Salud cuando justamente corresponde a la Municipalidad asegurarse de que de previo al permiso y de previo a la recepción de las obras el interesado haya cumplido con el visto bueno del Ministerio de Salud en cuanto a la planta de tratamiento así como de que su funcionamiento sea el óptimo para el momento de la recepción de las obras. En cuanto al hecho número 21 si bien la a quo no indica el número de dictamen, sí indica el número de folio del expediente judicial en el que se encuentra dicho dictamen, y revisado dicho folio 362 allí consta que el número de dictamen es AEP-298-2008 del 5 de junio del 2008, por lo que dicha omisión no tiene mérito para anular la sentencia, y en cuanto a las conclusiones de dicho dictamen, las mismas las comparte este Tribunal, con fundamento en la normativa del Código Municipal aplicable.
En cuanto al hecho 24 se rechaza también el agravio en el sentido de que se tiene por acreditado el nexo causal entre la conducta y el daño moral sin indicación de elemento probatorio alguno, por cuanto la a quo indica entre paréntesis el folio del expediente judicial en donde consta los incumplimientos en cuanto a la planta de tratamiento y por cuanto además consta en los hechos 22 y 23 todos los sufrimientos que ha tenido que soportar el actor, lo cual constituye evidencia del nexo causal. Estas mismas razones obligan a rechazar el agravio en cuanto al daño moral por cuanto está demostrado el incumplimiento de la Municipalidad y los sufrimientos que han aquejado al actor. Por todas estas razones esta Autoridad confirma la sentencia apelada en cuanto declaró responsable a la Municipalidad de Escazú por el daño moral sufrido por el actor por la inactividad de la corporación municipal. Dicha inactividad de la Municipalidad consistió por un lado en no verificar que efectivamente antes de otorgarse el permiso al proyecto de Condominio El Cortijo éste hubiera cumplido con todos los visados y vistos buenos de las diferentes instituciones corresponsables en la materia, ya que dichos avales son pre-requisitos para el otorgamiento del permiso municipal; por otro lado también incurrió el ente local en inactividad cuando omitió supervisar que las obras se hicieran acorde con los parámetros de los planos y visados obtenidos.
Y es que el sistema de legislación urbanística está hecho para que toda obra humana requiera planificación y previsión de los servicios y consecuencias del uso que se le dé al suelo y a las edificaciones que se levanten y para que la Municipalidad combata preventivamente los problemas que la convivencia humana pueda llegar a producir. Es sólo cuando la Municipalidad ha incurrido en no cumplimiento de sus obligaciones que, la Ley General de Salud prevé que se puede plantear una denuncia ante el Ministerio de Salud por contaminación ambiental para efectos de que el mismo haga los estudios necesarios y gire las órdenes sanitarias y desalojos necesarios. Pero la idea de todo el ordenamiento es que no se tenga que llegar a ello por medio de la adecuada gestión y fiscalización municipal, a través de sus poderes de policía en materia urbana, y del proceso de otorgamiento de permisos y licencias de construcción así como de la recepción de obras.
En el caso concreto, como la Municipalidad de Escazú no fiscalizó adecuadamente la obra denominada Condominio El Cortijo se produjo la contaminación ambiental y se tuvo que acudir a la normativa prevista para restablecer el orden en la comunidad. Por todo lo esbozado es responsable la Municipalidad de Escazú por la contaminación ocurrida, a pesar de que luego haya desplegado toda la actividad debida en atención a la denuncia del actor y de otros vecinos, pero lo cierto es que si hubiera cumplido con diligencia sus deberes en momentos iniciales de la construcción del proyecto citado no se hubiera producido la contaminación ni se hubiera tenido que desplegar toda la actividad ante las distintas instancias como se tuvo que hacer luego. En cuanto al agravio del recurrente en el sentido de que supuestamente la casa de Nombre72674 se encuentra edificada en zona de protección del cauce y que por ello no le asiste derecho a reclamar en esta sede responsabilidad alguna a la Municipalidad, dada su situación de haber construido en contra de la legalidad; no está demostrado que efectivamente la casa de Nombre72674 esté construida en zona protegida, ni si tiene o no permisos, y en todo caso ello no es objeto de discusión en este proceso debiendo el interesado acudir a la vía correspondiente si desea accionar al respecto y entendiendo que aún en caso de llegarse a demostrar dicho hecho ello no exonera de co-responsabilidad a la Municipalidad por lo sucedido con el Condominio de marras, según se ha venido sosteniendo.
Finalmente en cuanto a la fijación del daño moral en Ocho millones de colones, se estima que dado que cubren aproximadamente 4 años, resulta una fijación de Cinco mil quinientos cincuenta y cinco colones diarios por concepto de indemnización de daño moral subjetivo por soportar olores nauseabundos en su vivienda y tener que comer, dormir y permanecer en esas condiciones insalubres y desagradables, lo que no resulta ni irracional ni desproporcionado, dada la intensidad del daño sufrido por inercia de la Municipalidad, llamada a tutelar planificada, organizada y racionalmente la convivencia humana del cantón. Respecto del agravio en el sentido de que la a quo no indica con base en qué elementos de prueba llega a la conclusión y la fijación del daño moral se rechaza dicho agravio por cuanto nuestra jurisprudencia patria ha sido reiterada en el sentido de que la valoración del daño moral es procedente apreciarla in re ipsa, por lo que “…basta, en algunas ocasiones, con la realización del hecho culposo para que del mismo surja el daño, conforme a la prudente apreciación de los Jueces de mérito, cuando le es dable inferir el daño con fundamento en la prueba de indicios (Sentencia N° 114 de las 16:00 hrs del 2 de noviembre de 1979).” por lo que se permite la comprobación de la lesión moral a través de presunciones humanas inferidas de indicios y por ello su prueba, es “in re ipsa”, al afectar éste principalmente el honor, la salud, la intimidad y la integridad entre otros.
En este orden de ideas tampoco resulta incorrecta, desproporcionada ni irracional la condena en costas. Finalmente indica la apelante que la a quo incurre en su resolución en los vicios de incongruencia y falta de fundamentación, sin embargo no se indica en qué consisten ni dónde se encuentran dichos vicios por lo que se rechaza lo indicado. Así las cosas, necesariamente debe rechazarse la presente apelación intentada y en su lugar confirmar la resolución venida en alzada, como en efecto se hace.-
POR TANTO
En lo que es objeto de recurso se confirma la sentencia apelada. NOTIFÍQUESE.
