CONSIDERING:
I.The Court adopts the statement of facts found to have been proven, as it is supported by the record. The following is also deemed established: 15.- According to the label, the product was to be applied at a rate of 0.5 K per 200 liters of water, whereas the handwritten technical instruction provided by Agro San Marcos personnel specified 1 K per 200 liters of water (see documents at folios 27 and 188, the testimony on examination of a party (declaración confesional) of [Nombre3] at folio 451, and the witness testimony (testimonial) of [Nombre5] at folio 462). The first finding of fact is corrected with respect to the number of the first property, the correct number being “one hundred thirty-nine thousand two hundred eight.”
III.Attorney Mario Gómez Pacheco, counsel for defendant Compañía Costarricense del Café S.A. (CAFESA), appealed the judgment on 23 de junio del 2009 and sets forth the following grounds of error (agravios): 1) He argues that the plaintiff did not prove the causal connection (nexo) between the causal event and the resulting damage. There is evidence showing that the plaintiff did not apply the alleged product distributed by his client in accordance with the original instructions appearing on the package; instead, on his own initiative and responsibility, he followed the advice of the product’s direct seller and relied on his own empirical knowledge, adding other products on his own initiative. He states that the importer or distributor of this type of product must indicate the dosage to be used and that any alteration made releases his client from all liability. He adds that the testimony of [Nombre5], at folios 456 and 457, establishes that the plaintiff was responsible for mixing the product, and that the admission of [Nombre3], representative of defendant Agro San Marcos de Tarrazú, at folio 451, states and acknowledges that he advised the plaintiff and that he authored the document at folio 188, consisting of the technical prescription for applying the zinc sulfate distributed by his client. 2) He argues that if an amount lower than that initially requested for direct damages is awarded using an objective and realistic benchmark, the same amount initially requested for non-pecuniary damage could not be awarded (folios 851 to 854).
In a filing dated 9 de julio del 2009, he submitted a “statement of grounds of error” (expresión de agravios) to this Court, which was filed out of time but essentially reiterates the grounds stated in the appeal.
IV.Attorney Marco Antonio Vargas Valverde, counsel for defendant Agro San Marcos Tarrazú, S.A., appeals the judgment on 23 de junio del 2009 on the following grounds:
V.On the legal institution of agrarian-environmental liability (responsabilidad agrario-ambiental) under special legislation. When our Constitución Política expressly enshrines every citizen’s fundamental right to a healthy and ecologically balanced environment—Article 50—and establishes consumers’ right to the protection of their health, environment, safety, and economic interests—Article 46—new constitutional principles and values arise that permeate special legislation. It is important, through constitutional interpretation (interpretación constitucional)—systematic, substantive, and evolutionary—to integrate all rules intended to govern economic relations with the principles and values of sustainable development (desarrollo sostenible). Freedom of private economic initiative entails, within the private initiative of an agricultural entrepreneur, the right to choose an agricultural activity (Article 56), the freedom to enter into contracts for the operation or establishment of an agricultural enterprise (Article 46), the freedom of territorial movement of plant or animal agricultural goods; the right to form agricultural associations (Article 25), the right to enjoy productive agricultural property in accordance with its economic, social, and environmental function (Article 45), freedom of competition, and the individual right to enter and remain in the market (Article 46).
However, all manifestations of freedom of economic initiative within agricultural activity and in the exercise of property rights must serve the constitutional principles enshrined in Articles 50 and 69 of the Constitución Política, namely, the promotion of sustainable development through productive activity, while ensuring the equitable distribution of production and the right to a healthy and ecologically balanced environment. Because these are constitutional provisions that do not establish distinct rules for agrarian matters, agricultural enterprises and real-property owners are understood to be subject to compliance with those obligations. Consumers’ demands within the agri-food market are aimed at consuming agricultural products (plant or animal) that have undergone production, agro-industrial, or agricultural marketing processes with the minimum amount of pollutants that could affect health.
Accordingly, appropriate hygienic and sanitary quality standards are required both in the production process and in subsequent processes involving the handling of agricultural products. Commercial agricultural activity must be based on techniques that are more natural and less artificial. Reducing the biological risk inherent in productive activity must not be detrimental to consumers’ health. Agrarian-environmental activity must be reconciled with nature in order to guarantee consumers a healthy environment. The technical dimension of agriculture plays a fundamental role in achieving this goal by seeking production and agro-industrial processes that are less harmful to health and the environment. Any agricultural activity based on artificial methods involving toxic chemicals harms health and the environment. Compliance with the constitutional principles protecting consumer rights and safeguarding human health and life is therefore mandatory.
Agrarian-environmental restrictions on property (limitaciones agroambientales de la propiedad) encompass numerous aspects of productive activities and the conservation of natural resources, Biodiversity, soil use and conservation, the protection of forests and ecosystems, the use and control of pesticides and chemically synthesized products, plant-health and animal- and plant-health controls, agricultural waste, water conservation, the use and management of wastewater in agriculture, and the restoration of soils and watersheds, among others.
VI.The agrarian liability of agricultural producers (responsabilidad agraria del productor agrario): It is evident that all agrarian-environmental restrictions on property are intended to preserve the environment through sustainable agricultural activities; accordingly, one common feature found throughout the legislation is strict liability for environmental damage (responsabilidad objetiva por daño ambiental). Constitutional and statutory rules have undergone remarkable development regarding liability for environmental damage: Constitución Política: “Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the damage caused... The law shall determine the corresponding liabilities and penalties” (Article 50). Ley Orgánica del Ambiente: “Whoever pollutes the environment or causes damage to it shall be liable...” (Article 2, subsection d).
“In any management and use of water capable of causing pollution, responsibility for treating discharges shall rest with the person who causes the pollution” (Article 66). “Damage to or pollution of the environment may result from acts or omissions and shall be attributable to all natural or legal persons who engage in such conduct” (Article 98). “The owners of the enterprises or activities where the damage is caused, whether by act or omission, shall also be jointly and severally liable (solidariamente).” The same liability shall apply to professionals and public officials who sign an environmental impact assessment (evaluación de impacto ambiental) that contravenes prevailing technical provisions or who fail to provide proper follow-up to proceedings arising from damage to the environment or biological diversity.” (Article 101). Ley Forestal: “...when legal persons are involved, civil liability (responsabilidad civil) shall extend to their legal representatives.
Furthermore, both natural and legal persons shall be civilly liable for the ecological damage caused, in accordance with Article 1045 of the Código Civil.” (Article 57). “The Procuraduría General de República is granted representative standing to bring a civil action for damages (acción civil resarcitoria) concerning ecological damage caused to the State’s natural heritage.” (Article 59, second paragraph). Ley de Protección Fitosanitaria: “Those who conduct research, experimentation, transport, environmental release, importation, exportation, propagation, or commercialization of plants or of the organisms or products referred to in Article 41 shall be liable for the losses and damages (daños y perjuicios) caused to agriculture, the environment, and human and animal health.” (Article 31). “Those who import, manufacture, formulate, repackage, repack, distribute, store, transport, sell, or apply chemical, biological, or related substances for agricultural use shall be required to compensate for the losses and damages that their acts or omissions cause to agriculture, livestock production, human health, and the environment” (Article 32).
Ley de Uso, Manejo y Conservación de Suelos: “Whoever pollutes or degrades soil resources, regardless of the existence of negligence or intent or the degree of participation, shall be liable, through the appropriate judicial proceedings, both to pay compensation and to repair the damage caused to the environment and affected third parties.” (Article 52).
VII.Criteria regarding strict agrarian liability (responsabilidad agraria objetiva) in agrarian case law (jurisprudencia agraria). Agrarian case law has been prolific in establishing strict liability (responsabilidad objetiva) for agro-environmental damage (daños agroambientales), particularly in cases involving burns (quemas); therefore, the Court will first analyze that issue: “IV.- Our legal system contains several provisions that expressly and directly address burns and forest fires (incendios forestales), as well as the liability arising from them. These include: a) Ley de Cercas Divisorias y Quemas, N°121 of 26 de octubre de 1909: Article 5 prohibits conducting burns in the countryside. It authorizes them only when land is being cleared to make it suitable for agricultural purposes. To do so, the following requirements must be met:
V.Modern legal scholarship, for its part, has supported making liability strict by including risk—alongside negligence and intent—among the factors for imputing and legally attributing damage. It has even been proposed that other objective factors be included: guarantee, equity, abuse of rights, and exceeding the limits of normal tolerance among neighbors. Damage is thus viewed not from the standpoint of the perpetrator’s act but from that of the injured party, to ensure that all unjustly caused damage is remedied. From another perspective, negligence has been separated from the unlawfulness of the act, giving the latter a more significant role. “Once the equivalence between the unlawfulness of the act and negligence was broken, the conduct acquired an autonomous character, detached from the subjective profile of the agent’s will, and became merely a means, cause, or criterion connecting a person deemed liable with a particular harmful event for which compensation must be provided.” (Franzoni (Massimo), La Actividad peligrosa, in Responsabilidad por daños en el tercer milenio, Abeledo Perrot, Buenos Aires,1997, p.120).
Thus, reference is made to the risk theory (Teoría del riesgo), which does not displace negligence but complements it and may be summarized as the duty of anyone who creates a risk to compensate a third party for the damage it causes. “Risk constitutes a ground for imputation when, owing to the occurrence of certain causes and the performance of particular activities classified as dangerous, damage occurs. Damage under these circumstances must be compensated, not because the agent acted intentionally or negligently, but because the legal system must protect the community from the conduct of dangerous activities, so that anyone who performs them incurs liability if damage is caused by doing so… Liability arising from risk does not depend on the agent’s intent or negligence but originates from the mere occurrence of damage resulting from the dangerous activity. This consideration entails a special evidentiary regime under which, solely because the unsafe activity was conducted, the agent’s negligence is presumed, relieving the victim of the burden of proving improper conduct.
The agent bears the burden of rebutting the presumption…” ([Nombre7], Hecho imputable dañoso in Del daño, Editora Jurídica, 1° Ed,Colombia,2001, p.260). According to other authors, “the causal relationship (relación causal) is an element of the unlawful act and contractual breach that links the damage directly to the unlawful act and indirectly to the element of subjective imputation or objective attribution. It is the unifying factor through which damage and negligence—or risk, as applicable—are integrated into the single act that gives rise to the obligation to compensate” (see [Nombre8] (), El perfil de la responsabilidad civil al finalizar el siglo XX in Responsabilidad por daños en el tercer milenio, Abeledo Perrot, Buenos Aires, 1997, p.24 to 26).
VI.The conduct of burns—regardless of their purpose—is unquestionably a hazardous activity. Accordingly, consistent with the cited scholarship, the Sala Primera de la Corte Suprema de Justicia has clearly stated: “VII.- Burns may give rise to civil and criminal liability for those who conduct them. Civil liability is governed by the Ley de quemas y Cercas divisorias, which establishes the obligation of anyone who conducts burns to pay the damages caused as a consequence of the fire (Article 5, paragraph 4). The owner, possessor, or lessee of the land that was prepared for that purpose at the time of the fire is presumed to be the person responsible for the burn… VIII.- The Sala Constitucional, through Voto N°3459 at 14 hours 42minutes on 20 de julio de 1993, established the repeal of Article 5°, fifth paragraph, of the Ley de Quemas y Cercas Divisorias with respect to criminal liability… The same Sala Constitucional (Voto N°439-I-95 at 14:36 hours on 22 de agosto de 1995) clarified the aforementioned judgment N°3459-93 to the effect that Article 5°, paragraphs 5° and 6, of the Ley de Cercas Divisorias y Quemas is repealed only as to the criminal matters it contains…
IX.- The rules governing burns and fires follow the strict-liability standard. Negligence is presumed on the part of anyone who created the conditions causing the damage by assuming the risk of harming third parties through a burn or fire. The resulting damages are borne by that person. The injured party is not required to prove negligence. The burden of proving the absence of negligence rests with the person who conducted the burn or caused the fire. This is a rebuttable presumption (presunción iuris tantum). Force majeure, fault of the victim, or the act of a third party would exempt that person from liability. [Nombre6]. A person assumes the risk when, having foreseen the eventuality or possibility of damage, that person accepts the consequences of the contingency. Liability is based on creating the risk of damage. By commencing the activity through the use of that person’s property, the person increases, intensifies, or multiplies the possibilities of danger. Even when the conduct may be lawful, the person who assumed the risk must always compensate for the damage.
There is even greater reason to attribute liability when the event arises from unlawful conduct. The injured party cannot be made to bear damage resulting from conduct that the injured party did not initiate, unless the injured party placed himself or herself in a position to suffer the damage. Anyone who burns or sets a fire, even with authorization from the corresponding authority, cannot be exempted from liability. This is so because, although the Ley de Quemas y Cercas Divisorias N° 121 del 26decotubre de 1909 establishes the guidelines for authorizing burns on agricultural holdings (fundos agrarios), and imposes a series of obligations on the person requesting authorization, this does not rebut the presumption of fault (presunción de culpabilidad). The requirements for authorizing burns are intended to ensure minimal risk. They constitute a precautionary measure (medida precautoria), but not a defense against liability (eximente de responsabilidad).
Therefore, compliance with the requirements essential for authorization cannot prejudice neighboring landowners if the incident occurs. Accordingly, damage to the property or crops of neighboring landowners, or to the landowners themselves, must be compensated by the person who created the conditions giving rise to the risk through the fire or burn. XI. The activity of setting fires or conducting burns is itself directed against Nature. It is a practice of primitive agriculture in which fire tends to replace human labor. Instead of using human or mechanical means to carry out agricultural activity, recourse is had to a destructive element so that, upon the ashes of what has been destroyed, the cultivation of plants or raising of animals may begin. Actions of this kind are incompatible with present-day values. They threaten safety by placing neighboring landowners’ property, possessions, and persons at risk.
They likewise undermine the values of environmental protection. The economic and social function of property also entails an ecological function: agriculture must be conducted in harmony, and not in conflict, with Nature. For the preservation of the environment, social solidarity requires the development of new mechanisms to prevent damage and threatening acts. This is the philosophy underlying the amendment to Article 50 of the Political Constitution (Constitución Política). The Ley de Quemas y Cercas Divisorias and the entire issue of liability arising from that activity must be analyzed in accordance with those principles” (see judgment N° 112 at 15horas 50 minutos on 11 de octubre de 1995.En igual sentido la N° 113 at 16 horas on 11deoctubre de 1995). VII. The Chamber likewise clarified in the cited judgments that the obligation to compensate for the losses and damages (daños y perjuicios) caused by burns, and the placement of the presumption of liability (presunción de responsabilidad) upon the person who prepared the land for that purpose, cannot be limited to cases of land clearing (desmontes).
“Although Article 5 of the Ley de Cercas y Quemas Divisorias establishes a general prohibition against conducting burns in fields, while authorizing them when they involve land clearing to prepare land for agricultural purposes (first paragraph), this does not preclude conducting that activity under other conditions and for other purposes, as current circumstances demonstrate. Accordingly, in the fourth paragraph of section 5°, the same Law establishes general liability when it states: “In every case, anyone who conducts burns must pay the losses and damages….” This falls squarely within the general principle of causing no harm to others. In this case, the losses and damages must be borne by the defendant because it assumed the risk of harming neighboring landowners through the burn. By commencing its activity and preparing the land to be burned, it increased the potential danger. This constituted unlawful conduct because it lacked authorization from the corresponding administrative authorities, as confirmed by the facts found proven (hechos probados).
It failed to take the minimum precautions required by law to prevent damage greater than that normally caused. Although it took certain precautionary measures—constructing firebreaks (hechura de rondas)—this is insufficient to exempt it from its liability to compensate the claimant for the losses and damages caused. The only way to be released from that liability was to prove contributory fault of the injured party (culpa de la víctima), a fortuitous event (caso fortuito), or the act of a third party (hecho de un tercero), which it did not do. Although the Ley de Quemas y Cercas Divisorias dates from 1909, it must be interpreted in accordance with Articles 10 of the Civil Code (Código Civil) and 5 of the Ley Orgánica del poder Judicial. Modern interpretation—systematic, substantive, and evolutionary—requires that the content of the provision be adapted to the historical circumstances and the social and economic reality in which it is to be applied.
To that end, the principles and values contained in the Constitution, as well as in special agricultural laws, must be taken into account.” (see cited judgment N° 112-95). VIII. As explained above, burns may be conducted on land suitable for agricultural and livestock use (terrenos de vocación agropecuaria), provided that the requirements established in our legal system are met, including taking sufficient precautions to control the fire, obtaining prior authorization from the respective public entities—particularly the appropriate office of the Ministerio de Agricultura y Ganadería—and notifying the owners or persons responsible for neighboring properties. This last requirement is of the utmost importance because, even if every possible measure is taken, natural phenomena such as wind, air currents, and others may cause the fire to spread to areas beyond those originally intended to be burned.
Notification of adjoining landowners (colindantes) is specifically intended to minimize or prevent the spread of the fire and the occurrence of greater damage, since it enables neighbors to exercise closer supervision over their own land and allows them to be prepared to fight the fire if necessary. Nevertheless, even where every possible precaution has been taken and authorization has been obtained, anyone who starts or causes a burn that damages third parties is liable for that damage. This is so because it is a hazardous activity (actividad riesgosa). Liability is strict (responsabilidad objetiva), as already explained." (Tribunal Agrario, No. 815-F-03 del 16 de diciembre del 2003). To the same effect, see the judgments of the Sala Primera de Casación numbers 1005-F-2006 116-F-2005 and 1071-F-2004
VIII.Objective noncontractual agrarian liability (responsabilidad agraria objetiva extracontractual). There is also case law (jurisprudencia) concerning objective noncontractual liability arising from aerial fumigation activities in agriculture: “VII. Liability arising from damage caused to nature, whether resulting from an agrarian activity or any other type of activity, has universally always been regarded as strict liability (responsabilidad objetiva). This general principle of law has been widely recognized in the most recent constitutional reforms, which introduced the right to a healthy and ecologically balanced environment, and the legislature adopted it even before those reforms and broadly reaffirmed it thereafter, such that it is present throughout the environmental sector of the legal system. This criterion has always prevailed since the earliest legal documents, because the victim cannot be required to prove the causal link (nexo de causalidad), as is required for fault-based liability (responsabilidad subjetiva), where the party causing the damage has assumed a risk, even in the course of a lawful activity, if its possible effects include causing harm to third parties.
The case law of this Chamber has ruled repeatedly on the subject of burns, whether agrarian or otherwise, that have harmful effects on adjoining or other agricultural holdings (fundos), and has established the liability of a person who, by burning his own waste or weeds on his own property, has caused harm to another, even if he took every appropriate precaution to prevent the fire from spreading (judgments N° 112 de las 15 horas 50 minutos y 113 de las 16 horas, ambas del 11 de octubre de 1995, y la N°26 de las 14 horas del 28 de febrero de 1996). Naturally, this doctrine is now invoked as a general principle of law for environmental protection, and it is correct to characterize it as such. It is enshrined in the Bible itself, from which it passed into legal texts of the most diverse kinds, as is the case with the entire Spanish tradition that has been so influential in our legal systems.
The basis of this doctrine is very simple. This is not the fault-based liability provided for in section 1045 of the Código Civil, because under that scenario the injured party must prove the causal link between the harmful party’s action and the losses sustained. Under strict liability, the mere existence of damage gives rise to the presumption that the party causing the damage is responsible for having caused it and must therefore compensate the damages and losses (daños y perjuicios) caused by that party’s conduct. This does not arise from an arbitrary act but from pure logic, because anyone who, even while engaging in lawful conduct, assumes a risk involving danger must be liable for all damage that such danger may cause. There are many examples in this regard. If a person handles gunpowder or any type of flammable material, whether in a factory, in a commercial activity, or for personal amusement, and an accident occurs that affects any neighbor, the injured party should not be required to prove the causal link between the conduct undertaken and the damage caused; rather, the legal system presumes the fault of the person who assumed the risk and danger, and that person may be exempted from liability only by proving that he was not directly responsible for the damage caused.
The burden of proof (carga de la prueba) is thus reversed, and the defenses from liability (eximentes), which could by analogy be applied in the environmental sphere, would be those set forth in the Ley General de la Administración Pública, which also provides for the State’s strict liability: ‘force majeure (fuerza mayor),’ ‘fault of the victim (culpa de la víctima),’ or ‘act of a third party (hecho de un tercero)’ (article 190). VIII. The record clearly established the damage sustained by the portion of the teak plantation adjacent to the agricultural holding planted with rice, with only a road separating the two holdings. The first element required for compensable damage (daño resarcible) is therefore established: namely, the existence of actual, certain, and effective damage. Likewise, injury to a legally relevant interest deserving of protection was deemed proven.” (First Chamber of Cassation (Sala Primera de Casación), No. 398 de las 16 hroas del 6 de junio del 2001).
IX.- “Extended” and “joint and several” agricultural liability (responsabilidad agraria) of distributors and merchants, for the benefit of agricultural producers. Regarding strict liability (responsabilidad objetiva) in favor of consumers and its scope, the Sala Primera has also stated the following: “V.- Strict liability arising from risk (responsabilidad objetiva por riesgo) in consumer matters. With regard to liability, two broad categories may be identified: a fault-based category (subjetiva), which requires the concurrence, and consequent proof, of intent or negligence on the part of the person responsible for the harmful act (e.g., Article 1045 of the Código Civil), and a strict-liability category, essentially characterized by dispensing with those elements, with the attribution of the damage serving as the central basis upon which the duty to provide compensation is founded. An example of the foregoing is Article 35 of the Ley de Defensa Efectiva del Consumidor, under which the merchant, producer, or supplier is liable for damages arising from goods traded and services rendered, even when no negligence, recklessness, lack of skill, or intent is found in its conduct.
It is also important to consider, because of its effect on evidentiary matters, that the elements determining the creation of civil liability (responsabilidad civil), whether fault-based or strict, are: harmful conduct, which may be active or passive, lawful or unlawful; the existence of damage, meaning injury to a legally protected interest; a causal link (nexo de causalidad) connecting the preceding two elements; and, in most cases, verification of a basis for attribution (criterio de atribución), which will depend on the specific legal regime. Regarding causation, it should be noted that it entails a case-by-case assessment by the adjudicator, who determines, based on the facts, whether a relationship exists between the damage claimed and the conduct of the economic actor. Although various theories exist on the subject, the one considered most consistent with the Costa Rican legal system is the theory of adequate causation (causalidad adecuada), under which damage and conduct are linked when the former originates from the latter, if not necessarily, then at least with a high degree of probability in light of the specific circumstances bearing on the matter (in this regard, see, among others, decisions 467-F-2008 of 14 hours 25 minutes on 4 de julio de 20085, and 1008-F-2006 of 9 hours 30 minutes on 21 de diciembre de 2006).
At this point, it is important to clarify that proof of defenses precluding liability (causas eximentes)—fault of the victim, an act of a third party, or force majeure—operates upon the causal link, ruling out the conduct attributed to the defendant as the cause of the injury sustained. Regarding the various bases for attribution, the theory of created risk (teoría del riesgo creado), which was expressly incorporated into the Ley de Defensa del Consumidor, is relevant for purposes of this case. The strict-liability framework adopted by the law, as well as the application of the aforementioned basis for attribution, follows from a straightforward reading of the provision at issue, which states: ‘the producer, supplier, and merchant shall be liable concurrently, and regardless of the existence of fault, if the consumer is harmed by reason of the good or service, inadequate or insufficient information concerning them, or their use and risks. / Only a person who proves that he or she had no involvement in the damage shall be released from liability. / The legal representatives of commercial establishments or, as applicable, the persons in charge of the business are liable for their own acts or conduct and for those of their employees or assistants.
Technicians and persons responsible for production and oversight shall be jointly and severally liable, where appropriate, for violations of this Law to the detriment of consumers.’ (emphasis added). A detailed analysis of the provision just transcribed reveals a series of elements conditioning its application. First, from the standpoint of the parties—namely, the person who causes the damage and the person who suffers it—the application of this liability regime depends upon their meeting certain qualifications. Thus, the former must be a producer, supplier, or merchant, whether a natural person or a legal entity. As to the latter, the injury must be inflicted upon someone participating in a legal relationship as a consumer, under the terms defined in the referenced statute and developed by this Sala. Both parties must therefore be part of a consumer relationship (relación de consumo), the object of which is the potential acquisition, enjoyment, or use of a good or service by the consumer.
The Bank acts in the exercise of its private-law capacity, as a genuine public enterprise, and in that capacity offers its customers a service; therefore, because a consumer relationship exists, the particular case must be analyzed within the scope of Article 35 under discussion. Second, the provision under review also shows that the legislature established a series of bases for attribution under which the strict liability governed by that article may be imposed, including the aforementioned theory of risk. Risk thus serves as a factor for assigning liability to the referenced parties. In essence, that theory holds that anyone who creates, conducts, or benefits from a lawful profit-making activity containing elements that are potentially dangerous to others must also bear its burdens (ubi emolumentum, ubi onus, which may be translated as where there is benefit, there is burden). Two characteristics may be inferred from the foregoing statement: on the one hand, the risk arises from a commercial activity; on the other, because the activity is carried out by human beings, so-called acts of nature are excluded.
At the same time, certain clarifications must be made regarding risks capable of giving rise to liability, since not every risk automatically results in liability. Today, life in society entails countless risks of differing degrees and scope, to the point that it may be said that no everyday activity is free from them. Accordingly, the interpretation of legal provisions cannot be based on an absolute and total aversion to risk, which, as noted, is an integral part of social coexistence and of the technological advances incorporated into it. The foregoing supports the conclusion that, for the duty to provide compensation to arise, the risk associated with the activity must be abnormal to some degree; that is, it must exceed the acceptable margin of tolerance under the rules of experience, which the judge must analyze on a case-by-case basis. The second point requiring comment concerns the party who becomes obligated by virtue of an activity deemed dangerous.
As already indicated, the basis for attribution is precisely the created risk, which presupposes that the person to whom the damage is attributed must be in a position of control over that risk; in other words, that person must conduct the activity or assume the potential negative consequences associated with it while receiving a benefit therefrom. That benefit may be direct, including, among other things, income or compensation received in exchange, or indirect, where the advantage arises reflexively, as occurs with alternative mechanisms intended to attract consumers and consequently yield an economic benefit to the party offering them. It is important to mention that different degrees of risk may exist within an activity and must be managed by the party benefiting from it, a circumstance that directly influences that party’s burden of proof because it is relevant to determining attribution in the case at bar (sub judice).
The foregoing, together with the existence of defenses precluding liability, demonstrates that the legislation under discussion does not establish an automatic transfer of assets. VI.- In this case, the Court, by majority vote, granted the claimant’s requested relief, finding that the operation of the electronic banking system presents such a degree of danger that the resulting damages may be attributed to the Bank. Experience confirms that transactions conducted over the Internet entail a certain level of risk; therefore, the general principles set out in the preceding recital (considerando) are applicable. Thus, the Bank’s liability arises not from the specific act of a third party taking the money, but as a consequence of the particular operation of the service offered to the public. The entity’s purpose is financial intermediation, a concept that includes receiving funds derived from the public’s savings and inherently entails safeguarding them, both physically and through the corresponding electronic records.
There can be no doubt that it is subject to an unavoidable obligation to ensure the security of transactions, whether conducted at a teller window or through any other means made available to customers. That obligation must necessarily encompass the use of all available mechanisms enabling it to attain a greater degree of certainty regarding the identification of persons authorized to conduct electronic transactions from the accounts. The liability attributed to the Bank is based not on a third party’s taking of the money, but on the existence of a risk, as explained in recital V, inherent in the operation of the service it offers, thereby allowing the origin of the damage to be attributed to the operation of that service. Financial activity, specifically banking, inherently generates a high level of risk, which is heightened in the service under discussion and requires the entity responsible for that activity to strengthen security thresholds and safeguards at the various levels, both with respect to its own activities directly performed by its employees or contractors and with respect to the means its customers must necessarily use to access and receive the service offered—which, moreover, is introduced, implemented, promoted, and deployed by the banking entity for its own benefit as well.
Accordingly, the argument that the Internet does not belong to the Bank is not admissible as a means of avoiding liability when the defendant is well aware that it offers a highly risky service. In any event, the relationship between the Bank and a third party for the provision of a service does not exclude the former’s liability toward its customers. The sensitive nature of the activity conducted is beyond dispute, and therefore the required standards of diligence, security, efficiency, care, and reasonableness in its management increase. After all, banks, including the defendant, safeguard and administer, among other things, property belonging to others—and not just any property, but public funds. Accordingly, the Bank is responsible not only for the robustness of its internal systems, but also for the security of those who, in order to reach those systems, use the only possible channels, which the Bank itself knows and acknowledges to be risky. And it is responsible for those channels not as matters external to it, but insofar as they constitute the means upon which it directly relies to provide the service.
As prescribed by section 35 of the Ley de Protección al Consumidor, a person has suffered harm as a result of the service, which, when used (and in view of its hazardous nature), caused significant injury to the person appearing as the plaintiff in the proceeding. Consequently, rather than an improper interpretation of the provision, the article has been given its proper and correct meaning. The means of accessing the Bank’s platform is therefore not an unrelated source of risk, but rather an instrument inherent to the service it provides; in other words, it is an intrinsic part of the activity which, although ancillary to that performed by the intermediary, is indispensable. Thus, mechanisms for protecting the customer-user must be provided not only within the Bank’s own digital walls, but also along the pathway used to access it as part of the service. It is not without reason that the Financial System has generally undertaken the implementation of two-factor authentication mechanisms, the improvement of passwords, and, in general, the use of newer systems such as tokens, rotating passwords, keys with special devices, among others.
In addition, it must not be overlooked that liability arises only where unlawfulness (antijuridicidad) exists, with strict liability (responsabilidad objetiva) being no exception; in this case, it must be determined whether the affected person was legally required to bear the harm, as follows from the principle of protection against economic loss (principio de indemnidad patrimonial). This underlying unlawfulness is identified here with the risk inherent in the operation of the service, as is apparent from the evidentiary record (acervo probatorio) itself, which is alleged to have been improperly assessed. For the reasons stated thus far, the appellant’s arguments that the duty of security is commercial rather than legal in nature cannot be accepted. As previously indicated, activities undertaken by a legal person that can foreseeably cause harm carry an implicit duty to ensure protection against such harm.
Accordingly, this is not a matter of the defendant demonstrating the diligence it exercised, since that is an aspect specific to a fault-based liability system (sistema subjetivo de responsabilidad). Finally, and from a general standpoint, it must be made clear to the appellant that the case under review is not comparable to a situation in which a customer is the victim of a street robbery while traveling to an ATM or bank branch. The situations presented are not comparable. First, it must be considered that the failure in the operation of the service offered by the financial intermediary lies in the lack of security of the customer-identification mechanisms used to access the internal platform. From this perspective, given the risks inherent in transmitting data over the Internet—of which the Bank is clearly fully aware, as demonstrated by its advertising campaigns—the process for verifying the identity of the person using the service must necessarily provide tools to reduce the possibility of identity theft (suplantación de identidad).
This is an intrinsic feature of the service offered by the Bank. In this regard, the example presented by the appellant is inapplicable because liability is not attributed on account of what occurred before access, but as a consequence of the risk created and the insecurity of the system when analyzed as a whole. The theft of money on the street is completed with the act itself, without any involvement whatsoever by the financial institution, whereas in the matter under review the harm results from the unmanaged risk of identity theft, an element over which the Bank holds a position of control (with respect to reducing that risk, of course). Second, there is another distinction that undermines the proposed analogy: the degree of self-determination available to the customer. Thus, in the example given, the means of getting there, the time, and even the choice of ATM or bank branch depend exclusively on the customer’s decision.
In this scenario, risk management depends predominantly—if not exclusively—on the customer, unlike electronic banking services, where the only means of accessing the service is through the Internet, with the risks already discussed. Although the user may choose to connect from a more or less secure location—a decision for which the user must bear a corresponding share of responsibility—the user is generally subject to the inherent risks of the Internet connection on which access depends. VII.- In addition to the foregoing, no exculpatory defense (eximente de responsabilidad), such as fault of the victim (culpa de la víctima), the act of a third party (hecho de un tercero), or force majeure (fuerza mayor), was established in this particular case. Although the first defense is invoked, the evidentiary record contains insufficient evidence to conclude that the victim participated in causing the harm.
Had any of these circumstances been proven, it would be impossible to establish a causal link (nexo de causalidad) between the Bank’s conduct and the injury, and therefore no duty to provide compensation could arise on the part of the entity. As already stated, the existence of an exculpatory defense means that the cause of the loss may be attributed to another person or, in other words, that the defendant is unconnected to the harm caused. In any event, it was not established here that an exculpatory cause existed or that the Ley de Protección al Consumidor was inapplicable; therefore, because harm occurred as a consequence of a hazardous service, within the meaning of section 35 of the aforementioned statute, there was no improper application of the legal framework by the lower courts. (Sala Primera de Casación, No. 1098-09, de las 14:45 del 22 de octubre del 2009).
X.Agricultural liability (responsabilidad agraria) for the use of agrochemicals (agroquímicos). Regarding this issue, the Agricultural Court (Tribunal Agrario) has also established its approach based on the principles of strict liability (responsabilidad objetiva). Thus, in judgment N° 0958-F-07 at 15:40 on 22 de noviembre del 2007, we stated: Strict liability arises both from considering the plaintiffs to be consumers protected under the Law for the Promotion of Competition and Effective Consumer Protection (Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor), N° 7472, and from the legislation governing agrochemicals itself. This Court has stated the following regarding the application of the strict-liability regime to damage caused by agrochemicals: “VII.- (...) However, given what occurred in this matter, the legal analysis of the grounds for appeal (agravios de la apelación) cannot be limited solely to matters related to the purchase and sale (compraventa) of a product, as the plaintiff seeks, because there is a subsequent stage: its aerial application.
Furthermore, where damage caused by products is concerned, modern consumer-law doctrine has developed novel criteria that are not confined to the contractual sphere, given the particular implications of their production, manufacture, marketing, and use. In this regard, Ley 7472 for the Promotion of Competition and Effective Consumer Protection, in Articles 32 and 34, regulates consumer rights and the obligations of merchants and manufacturers. One of the most important is precisely the right to information (derecho de información). Section 35 of that Law also establishes a strict-liability regime by imposing upon the producer, supplier, or merchant the duty to answer for harm, regardless of the existence of fault, if the consumer is harmed because of the good or service, inadequate or insufficient information concerning them, or their use and risks. Only a person who proves that they had no involvement in the damage is released from liability.
It further provides that legal representatives or persons in charge of businesses are liable for the acts or events attributable to employees or assistants. In this case, however, given the matters in dispute, there is no contention that the duty to provide information was breached, since the plaintiff alleges the erroneous delivery of a product; consequently, this cannot be deemed a case of liability for a defective product (responsabilidad por defecto del producto), nor would the allegation, even if the fact had been proven, provide grounds for applying the performance warranty (garantía de funcionamiento) regulated in section 43 of the cited Law and section 452 of the Commercial Code (Código de Comercio). VIII.-On the other hand, in matters of civil liability (responsabilidad civil), whether contractual or noncontractual, strict or fault-based, and regardless of whether the matter is agricultural, civil, or commercial, a claim may be allowed only if there is damage or loss attributable to or caused by the person sued.
Damage means ‘any impairment, loss, or detriment to the property or non-property legal sphere of the person harmed, resulting in the deprivation of a legally protected interest whose preservation could objectively have been expected had the harmful event not occurred. Under this approach, there is no civil liability in the absence of damage, just as there is no damage without an injured party. Moreover, only damage that is proven—its reality or existence—is compensable, this being a question of fact reserved to the sound discretion of the adjudicator…’ (First Chamber of the Supreme Court of Justice (Sala Primera de la Corte Suprema de Justicia), judgment Nº 114 at 16:00 on 2 de noviembre de 1979). In addition to being actual, certain, effective, and deserving of legal protection, the damage must have been caused by a third party and must continue to exist when the complaint is filed. There must also be a causal relationship (relación de causalidad) between the unlawful act and the damage sustained.” Tribunal Agrario, Voto N° 814-F-03 at 14:45 on 16 de diciembre del 2003.- Strict liability is not limited to the consumer perspective; it also derives from legislation governing agrochemicals.
The defendant is therefore incorrect in asserting that it does not apply to this matter, as the First Chamber has held: “V. (...) It is governed by Plant Health Protection Law (Ley de Protección Fitosanitaria) number 7664 and Civil Aviation Law (Ley de Aviación Civil) number 5050 of 11 de diciembre de 1972. The former provides: ‘Those who import, manufacture, formulate, refill, repackage, distribute, store, transport, sell, and apply chemical, biological, or related substances for agricultural use shall be required to compensate for the damage and losses that their acts or omissions cause to agriculture, livestock production, human health, and the environment’ (Article 32). The latter provides: ‘Any natural or legal person who uses aircraft intended for agricultural aviation shall be liable for damage caused to persons or third-party property on the surface’ (Article 107). Both clearly establish strict liability; neither requires the victim to prove any subjective element of attribution.
It is therefore sufficient to prove the damage and causal relationship in order to attribute civil liability to the persons who must objectively answer for it under the cited provisions. In a case similar to this one, the Chamber recognized strict liability, which is more imperative today than ever in the face of ecological problems (Sala Primera de la Corte Suprema de Justicia, Voto N° 607-F-02 at 16:15 on 7 de agosto del 2002.).-
The marketing and distribution of agrochemicals is an activity that entails risk to consumers, the environment, and agricultural producers, thereby giving rise to strict liability (responsabilidad de tipo objetivo) for anyone who assumes that risk by engaging in such activity. The aforementioned First Chamber has stated on another occasion: “VII. (...) The basis for this position is very simple. This is not the fault-based liability (responsabilidad subjetiva) provided for in section 1045 of the Civil Code, because under that hypothesis the injured party must prove the causal link (nexo causal) between the harmful agent’s action and the losses sustained. Under strict liability, the mere existence of harm gives rise to the presumption that the harmful agent is liable for having caused that harm and must therefore compensate for the damages and losses caused by its conduct. This does not arise from an arbitrary act but from pure logic, since anyone who, even while engaging in lawful conduct, assumes a risk involving danger must be liable for any harm that danger may cause.
There are many examples in this regard. The burden of proof (carga de la prueba) is thus reversed, and the defenses (eximentes), which by analogy could also apply in the environmental sphere, would be those provided for in the General Law of Public Administration, which also establishes the State’s strict liability: ‘force majeure’ (fuerza mayor), ‘fault of the victim’ (culpa de la víctima), or ‘act of a third party’ (hecho de un tercero) (artículo 190).- (Voto de la Sala Primera N° 398-F-01 de las 16:00 horas del 6 de junio del 2001).- The appellant’s argument that plant-health regulations (normativa fitosanitaria) are confined solely to the administrative sphere is inadmissible, because the legal system, by virtue of the principle of hermeneutic completeness (principio de plenitud hermenéutica), is a single whole.
Even in the absence of a written rule, the adjudicator must apply the substantive sources of law (fuentes materiales del derecho), such as case law and general principles of law, pursuant to the fifth article of the Organic Law of the Judiciary. Upholding the appellant’s argument would be equivalent to maintaining plant-health protection exclusively within administrative proceedings, which is untenable from any perspective, because those same regulations derive from Article 50 of the Political Constitution, which establishes the duty of the State—including the Judiciary—to safeguard the human right to a healthy and ecologically balanced environment by regulating hazardous activities, such as those involving agrochemicals. The first article of the Plant Health Protection Law establishes that the plant-health protection measures set forth in that law and its regulations are matters of public interest and mandatory application, without stating that they apply exclusively in administrative proceedings.
Consequently, the second and third grounds of appeal (agravios) are rejected.- VIII.-As its final ground of appeal, the defendant contends that the liability regime applicable to the case is fault-based contractual civil liability (responsabilidad civil contractual de carácter subjetivo)...The appellant is likewise incorrect. As explained at length, the applicable liability regime is one of strict liability. Nevertheless, the grounds asserted by the appellant also constitute defenses under this type of liability... Logic and experience tell us that, for example, when a person consults a physician, the patient must explain the ailment from which he or she suffers so that the professional can make a diagnosis and provide a ‘prescription.’ The same applies to agrochemicals: the farmer describes the problem, and the seller, who is presumed to have experience and full knowledge of the entire range of available products, advises the farmer to use a particular product.
This is precisely where the strict liability so strongly denied by the defendant lies: it incurred liability by allowing an employee such as the witness to sell highly hazardous products, such as pesticides, without exercising any judgment and without providing customers with proper advice and information. One must ask: what would happen if the product being sold were not pesticides but gunpowder?... Decreto 27034- MAG del 5 de enero de 1998 imposes obligations on companies such as the defendant to verify that sales personnel—such as the aforementioned witness—have received training for vendors and sales staff. This rule is entirely logical, given the delicate nature of handling and applying these products. Every company trains its personnel regarding the products it sells. ...From the standpoint of strict liability and even fault-based liability, the defendant company is liable for the sale and application of that product in disregard of the legislation governing this type of activity.
Accordingly, there was no fault of the victim, because the plaintiffs followed the defendant’s instructions and diagnosis. Since the event giving rise to the harm (hecho generador del daño) was the application of that product, which is not authorized for rice in our country, and since the agent that caused the harm was the defendant company acting through Mr. [Nombre9], it is established in this case, as the court below found, that the defendant is liable for the damages and losses caused to the plaintiffs’ rice crops. In view of the foregoing, it must therefore be accepted as established that the damage caused to the rice planting resulted from the application of Herness on the property (fundo), carried out by agreement between the plaintiff and AgroSuperior itself, under whose instructions the pesticide was applied. All of the foregoing leads to the conclusion that the cause constituting the event giving rise to the harm in these proceedings was the application of Herness to noventa hectáreas of rice, performed by the plaintiffs on their property under the defendants’ instructions, which caused damage to the co-plaintiffs’ rice planting.
It was not caused by force majeure or fault of the victim, neither of which was demonstrated in any way, but by the defendant’s conduct in causing the resulting harm. The causal link is established, and therefore fault attributable to the defendant exists, as has been proven. The defendant’s fourth and final ground of appeal is rejected.- ”.
XI.Claims of error by co-defendant Compañía Costarricense del Café S.A. and attribution of liability.- In its first claim of error, the appellant argues that the plaintiff failed to prove the causal link (nexo) between the triggering event and the damage caused. In its view, there is evidence showing that the plaintiff did not apply the alleged product distributed by the company it represents in accordance with the original instructions appearing on the package; instead, on his own initiative and under his own responsibility, he followed the advice of the product’s direct seller and relied on his own empirical knowledge, adding other products on his own initiative. It states that the importer or distributor of this type of product must indicate the dosage to be used and that any change made releases the company it represents from all liability. Certainly, upon analyzing the testimony of [Nombre5], he states that the plaintiff was responsible for mixing the product: “I know that in July 2001 the plaintiff purchased several products, such as zinc sulfate, Foliveex, polysaccharides, and Aptan, at the Agro San Marcos establishment...
The plaintiff was responsible for mixing the product, and we had to spray the product using motorized pumps...” (folio 460); it is also true that, in his confession, [Nombre3], representative of defendant Agro San Marcos de Tarrazú, states and acknowledges that he provided advice to the plaintiff and that he authored the document at folio 188 (see confession at folio 454), corresponding to the technical prescription for applying the zinc sulfate distributed by the company he represents, in which the dosage recommended on the product label is doubled (folio 27). However, insofar as co-defendant CAFESA thereby seeks exemption from liability by invoking “fault of the victim” (culpa de la víctima) or “contributory fault” (culpa concurrente) by the victim and the product distributor, that argument cannot be accepted for two sets of reasons: one legal and the other technical-scientific. The legal reason is directly related to the regulation of strict liability (responsabilidad objetiva) in this field because, as noted and as cited by the Trial Judge, there is an express provision—namely, Article 3 of the “Reglamento de Uso y Control de Plaguicidas Agrícolas y Coadyuvantes”—that establishes the strict and concurrent liability of both the distributor and the importer of agrochemicals, emphasizing liability for the risk created by the use of agrochemicals when proper agricultural practices are followed.
In this regard, the second paragraph provides: “When damage is caused to the environment, crops, or human health through the use of the product under proper agricultural practices, the manufacturer, registrant, and distributor shall be jointly and severally liable.” Likewise, the Ley de Protección Fitosanitaria establishes: “Those who import, manufacture, formulate, repackage, repack, distribute, store, transport, sell, and apply chemical, biological, or related substances for agricultural use shall be required to compensate for the losses and damages (daños y perjuicios) that their acts or omissions cause to agriculture, livestock, human health, and the environment” (Article 32). Hence, external and internal phytosanitary controls are multiplied to prevent damage to health, the environment, persons, plants, and animals. It is therefore important to indicate that, in the case of the agrochemical application, the agricultural practice was proper because it was performed by persons experienced in the use and handling of agrochemicals.
Thus, Don [Nombre5] clearly explained the following: “We followed the plaintiff’s instructions, although the product was applied in the customary manner, providing good coverage to the plant, using approximately one drum per manzana...” (folio 460). The technical-scientific reason: Notwithstanding the foregoing indication that the agricultural practice was proper and customary, the technical-scientific issue gives rise to joint and shared liability for two reasons: a) The distributing company CAFESA S.A. registered Zinc Sulfate under number CED6, batch 0018943, which ultimately, according to agrochemical monitoring, the analysis by the Quality Control Laboratory, and Decreto No. 27973-MAG-MEIC-S “Reglamento Técnico RTCR-318:1998. Laboratorio para el análisis de sustancias químicas y biológicas de uso en la Agricultura,” had a concentration of 0.122% (see documents at folios 14 and 16), thereby failing to comply with technical standard RTCR-228 “Fertilizantes/Tolerancias permitidas para la concentración de nutrientes,” in violation of Article 30 of the Ley de Protección Fitosanitaria 7764, Chapter IV, concerning controls, and Decreto 24337-MAG-S “Reglamento de Uso y Control de Plaguicidas Agrícolas y Coadyuvantes,” Articles 23-27.
This meant that the product had to be re-exported to the country of origin. Indeed, according to the chemical analysis, the upper limit for this type of product is 23,300; 22,500 was declared, and a concentration of 24.400 was found, with 0,122% Cadmium. b) Moreover, although the agricultural practice was proper, the technical specifications were not followed, since it has been established that, according to the label, the product was to be applied at a rate of 0.5 K per 200 liters of water, whereas the handwritten technical instruction provided by AgroSan Marcos personnel specified 1 K per 200 liters of water (see documents at folios 27 and 188, the confession of [Nombre3] at folio 451, and the testimony of [Nombre5] at folio 462). From all the foregoing, the conclusion regarding strict liability is evident, because both companies definitively contributed to the application of a product that, on the one hand, did not meet the technical chemical-analysis requirements and, on the other, should not have been applied at the percentage specified in the prescription.
Both circumstances undoubtedly contributed to causing the damage, since no defense to strict liability has been established—fault of the victim, fortuitous event (caso fortuito) or force majeure (fuerza mayor), or fault of a third party (culpa de un tercero). Regarding the second claim of error, it argues that if an amount lower than that initially requested for damages is awarded using an objective and realistic parameter, the same amount initially requested for non-pecuniary damage (daño moral) could not be awarded. However, the appellant is mistaken in this objection, because this case involves objectively established non-pecuniary damage (daño moral objetivado), which undoubtedly caused the plaintiff emotional distress upon seeing his agricultural coffee production frustrated and having to endure the entirety of these judicial proceedings in order to obtain full compensation (reparación integral) for the damage caused.
Indeed, from the outset, the defendant companies themselves acknowledged that damage in some manner when they offered Don [Nombre1] an alternative resolution in an attempt to avoid the lawsuit (see, in this regard, the proposed settlement in the document at folio 81), which the plaintiff refused to sign because he did not consider it equitable. The court below cited the testimony of [Nombre10] and [Nombre5] concerning the frustration and pain he experienced upon seeing the production from his coffee-growing activity cut short. Clearly, contrary to the appellant’s assertion, the amount awarded is low when the time that has elapsed for him to obtain at least some recognition of the harm he suffered is taken into account. Accordingly, the Court considers that this claim of error must be rejected. In a brief dated 9 de julio del 2009, it submitted a written “statement of claims of error” (expresión de agravios) to this Court, which was filed out of time but essentially reiterates the claims of error raised in the appeal.
[Nombre6] II.- Claims of error by co-defendant Agro San Marcos de Tarrazú and attribution of liability. With respect to the claims of error raised by this co-defendant, its arguments are likewise unfounded. First, regarding the burden of proof (carga de la prueba), it must be stated that the plaintiff proved that both companies created the risk, as indicated in the preceding recital (considerando). In the particular case of Agro San Marcos de Tarrazú, the technical specifications were not followed, since it has been established that, according to the label, the product was to be applied at a rate of 0.5 K per 200 liters of water, whereas the handwritten technical instruction provided by AgroSan Marcos personnel specified 1 K per 200 liters of water (see documents at folios 27 and 188, the confession of [Nombre3] at folio 451, and the testimony of [Nombre5] at folio 462). This last fact necessarily leads us to reject the remaining claims of error concerning the allegations of supposedly diligent conduct because, even if it delivered the packaged product exactly as supplied by the distributing company, Agro San Marcos de Tarrazú did have control over and knowledge of the relevant events, since it not only sold the product but also, as it itself acknowledges, provided a prescription different from that indicated on the packaging, doubling the product’s dosage.
Finally, it asserts that no assessment was made of the application of other products that were also contaminated and that the expert evidence indicating that very little cadmium was present in the plants and that it was not the cause of the plants’ condition was disregarded or ignored. It should be recalled that agricultural-law matters are governed by the principle of free evaluation of evidence (libre valoración probatoria), contained in Article 54 of the Ley de Jurisdicción Agraria, which permits greater weight to be given to some evidence than to other evidence. In this case, the court below clearly evaluated the evidence as a whole and concluded that strict liability existed. It has been technically established that Zinc Sulfate was a product that did not meet the conditions necessary for sale, yet it was nevertheless sold to [Nombre1], and the dosage was doubled, which logically caused the damage to his plantation; this was not rebutted.
On the contrary, the Court reaches the same conviction, based not only on the evidence concerning the product applications but also on the document dated 17 de agosto del 2001, in which they sought to bind [Nombre1] not to file lawsuits in exchange for 50 sacks of coffee fertilizer, alleging that there was no scientific certainty regarding the cause of the damage. This unquestionably demonstrates the appellants’ tacit acceptance of their strict and joint and several liability (responsabilidad solidaria), as provided both in agricultural legislation and in the technical regulations applicable to this specific case, cited in the preceding recital. In addition, there are the Laboratory analysis (folios 14 and 16) and the expert verification and conclusion of the Organismo de Investigación Judicial (folio 299) concerning the excess Cadmium in the product and the fact that it exceeded the maximum permitted tolerance.
POR TANTO:
The judgment under appeal is affirmed in all respects.

VOTO Nº 0541-F-11 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ Goicoechea, a las catorce horas treinta y cinco minutos del treinta y uno de mayo de dos mil once.- PROCESO ORDINARIO establecido por [Nombre1] , mayor de edad, casado una vez, caficultor, vecino de San Isidro de [Nombre2] , portador de la cédula de identidad número CED1 - - , en contra de AGRO SAN MARCOS DE TARRAZÚ SOCIEDAD ANÓNIMA, representada por el señor [Nombre3] , mayor de edad, casado una vez, Ingeniero Agrónomo, vecino de San Marcos de Tarrazú, portador de la cédula de identidad número CED2 - - , y COMPAÑÍA COSTARRICENSE DEL CAFÉ SOCIEDAD ANÓNIMA, representada por el señor [Nombre4] . , mayor de edad, empresario, vecino de San José, portador de la cédula de identidad número CED3 - - . Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de San José. Intervienen como apoderada especial judicial del actor la licenciada, Dinorah Mora Molina, abogada, cédula de identidad número CED4 - - ; como apoderados especiales judiciales de la demandada Compañía Costarricense del Café S.A. los licenciados Roy de Jesús Herrera Muñoz, Silvia Gómez Pacheco y Mario Gómez Pacheco, y de la sociedad Agro San Marcos Tarrazú S.A., el licenciado Marco Antonio Vargas Valverde, mayor, divorciado, abogado, vecino de San José, cédula de identidad número CED5 - - .- R E S U L T A N D O
Redacta el Juez Ulate Chacón, y,
CONSIDERANDO:
I.El Tribunal comparte la relación de hechos tenidos por probados, por tener respaldo en lo que informan los autos. Además, se tiene por acreditado lo siguiente: 15.- La aplicación del producto, según la etiqueta debía corresponder a 0.5 K por 200 litros de agua, siendo que en la indicación técnica manuscrita, por parte de personeros de Agro San Marcos fue de 1 K por 200 litros de agua (ver documentos de folios 27 y 188 y declaración confesional de [Nombre3] , a folio 451 y testimonial de [Nombre5] a folio 462 ). Se corrije el hecho primero en cuanto al número de la primera finca, siendo el correcto "ciento treinta y nueve mil doscientos ocho".
III.El apoderado de la demandada Compañía Costarricense del Café S.A. (CAFESA), Licenciado Mario Gómez Pacheco, apeló la sentencia el 23 de junio del 2009 y expone los siguientes agravios: 1) Alega no fue probado por la parte actora el nexo entre el hecho generador y el daño ocasionado. Existe prueba que demuestra que el actor no aplicó el supuesto producto distribuido por su representada conforme a las indicaciones originales que constan en el paquete, sino que por su cuenta y bajo su responsabilidad, siguió el consejo del vendedor directo del producto y los conocimientos empíricos del actor, agregando otros productos por su cuenta. Dice que el importador o distribuidor de este tipo de productos debe indicar la dosis a utilizar y cualquier cambio que se efectúe releva de toda responsabilidad a su representada. Agrega, consta la declaración de [Nombre5] , a folios 456 y 457, que indica el actor era el encargado de hacer la mezcla del producto, y a folio 451 la confesión de [Nombre3] , representante de la demandada Agro San Marcos de Tarrazú, que declara y reconoce haber brindado asesoramiento al actor, y que es de su autoría el documento de folio 188, correspondiente a la receta técnica para la aplicación del sulfato de zinc, distribuido por su representada. 2) Alega que si se concede un monto menor al inicialmente solicitado para los daños utilizando un parámetro objetivo y real, no podría otorgarse el mismo monto solicitado inicialmente para el daño moral (folios 851 al 854).
En memorial del 9 de julio del 2009, presenta escrito de "expresión de agravios" ante este Tribunal, el cual es presentado extemporáneamente, pero básicamente reitera los agravios del recurso de apelación.
IV.El apoderado de la demandada Agro San Marcos Tarrazú, S.A., Licenciado Marco Antonio Vargas Valverde, apela la sentencia el 23 de junio del 2009, con base en lo siguiente:
V.Sobre el instituto de la responsabilidad agrario-ambiental, en la legislación especial. Cuando se consagran expresamente en nuestra Constitución Política el derecho fundamental de todo ciudadano a un ambiente sano y ecológicamente equilibrado –Artículo 50- y se establece el derecho de los consumidores a la protección de la salud, ambiente, seguridad e intereses económicos –artículo 46-, surgen nuevos principios y valores constitucionales que impregnan la legislación especial. Es importante integrar, a través de la interpretación constitucional (sistemática, material y evolutiva), todas aquellas normas dedicadas a tutelar las relaciones económicas, con los principios y valores del desarrollo sostenible. La libertad de iniciativa económica privada supone, en el ámbito de la iniciativa privada del empresario agrario, el derecho de elegir la actividad agraria (artículo 56), la libertad de contratar libremente para el ejercicio o la constitución de la empresa agraria (artículo 46), la libertad de circulación territorial de los bienes agrarios vegetales o animales; el derecho de formar asociaciones agrarias (artículo 25), el derecho a gozar de la propiedad agraria productiva en función económica, social y ambiental (artículo 45), la libertad de competencia, el derecho subjetivo de acceder al mercado y permanecer en él (artículo 46).
Pero todas las manifestaciones de la libertad de iniciativa económica en el ámbito de la actividad agraria y en el ejercicio de la propiedad deben estar en función de los principios constitucionales consagrados en los artículos 50 y 69 de la Constitución Política, es decir el fomento del desarrollo sostenible a través de la actividad productiva, garantizando la distribución equitativa de la producción y el derecho a un ambiente sano y ecológicamente equilibrado. Como son disposiciones de orden constitucional, que no establecen una normativa distintiva para lo agrario, se entiende que las empresas agrarias y los propietarios de inmuebles quedan afectas al cumplimiento de dichas obligaciones. Las exigencias de los consumidores dentro mercado agroalimentario van dirigidos a consumir productos agrarios (vegetales o animales), sometidos a procesos de producción, agroindustria o agrocomercialización con el mínimo de sustancias contaminantes que puedan afectar la salud.
Por ello se exigen aspectos de calidad higiénico-sanitarias adecuadas tanto en el proceso productivo, como en los procesos sucesivos de manipulación de los productos agrarios. La actividad agraria empresarial debe basarse en técnicas más naturales y menos artificiales. La disminución del riesgo biológico, propio de la actividad productiva no debe ir en detrimento de la salud de los consumidores. La actividad agroambiental debe reconciliarse con la naturaleza en aras de garantizar un ambiente sano a los consumidores. En ello juega un rol fundamental el hecho técnico de la agricultura, para buscar procesos productivos y agroindustriales menos nocivos para la salud y el ambiente. Toda actividad agraria basada en métodos artificiales, con sustancias químicas tóxicas daña la salud y el medio ambiente. Por ello se impone el cumplimiento de los principios constitucionales, que protegen los derechos del consumidor, a favor de la salud y la vida humana.
Las limitaciones agroambientales de la propiedad, alcanzan gran cantidad de aspectos en el ejercicio de actividades productivas y en el ámbito de la conservación de los recursos naturales, la Biodiversidad, el uso y conservación de suelos, la protección del bosque y los ecosistemas, el uso y control de los plaguicidas y productos de síntesis química, el control fitosanitario y sanitario animal y vegetal, los desechos agrícolas, la conservación de las aguas, la utilización y manejo de aguas residuales en agricultura, la recuperación de suelos y cuencas hidrográficas, etcétera.
VI.La responsabilidad agraria del productor agrario: Es evidente que todos los límites agroambientales a la propiedad, tienen como finalidad preservar el ambiente con el ejercicio de actividades agrarias sostenibles y, por ello, una de las notas comunes que se observa en toda la legislación es la responsabilidad objetiva por daño ambiental. La normativa constitucional y legal, a tenido una evolución impresionante en materia de responsabilidad por daño ambiental: La Constitución Política: “Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado... La Ley determinará las responsabilidades y sanciones correspondientes” (Artículo 50). Ley Orgánica del Ambiente: “Quien contamine el ambiente o le ocasiones un daño será responsable...” (Artículo 2 inciso d).
“En cualquier manejo y aprovechamiento de agua susceptibles de producir contaminación, la responsabilidad del tratamiento de los vertidos corresponderá a quien produzca la contaminación”(artículo 66). “El daño o contaminación al ambiente puede producirse por conductas de acción u omisión y les son imputables a todas las personas físicas o jurídicas que la realicen” (artículo 98). “Solidariamente también responderán los titulares de las empresas o las actividades donde se causen los daños, ya sea por acción o por omisión”. Igual responsabilidad corresponderá a los profesionales y los funcionarios públicos que suscriban una evaluación de impacto ambiental contra las disposiciones técnicas imperantes o no den el seguimiento debido al proceso originado en un daño al ambiente o a la diversidad biológica.” (Artículo 101). Ley Forestal: “...cuanto se trate de personas jurídicas, la responsabilidad civil se extenderá a sus representantes legales.
Asimismo, tanto las personas físicas como jurídicas serán responsables, civilmente, por el daño ecológico causado, de acuerdo con lo que establece el artículo 1045 del Código Civil.” (Artículo 57). “Se le concede acción de representación a la Procuraduría General de República, para que establezca la acción civil resarcitoria sobre el daño ecológico ocasionado al patrimonio natural del Estado.” (Artículo 59, segundo párrafo). Ley de Protección Fitosanitaria: “Quienes realicen investigación, experimentación, movilización, liberación al ambiente, importación, exportación, multiplicación y comercialización de vegetales o de los organismos o productos referidos en el artículo 41, serán responsables de los daños y perjuicios que ocasionasen a la agricultura, el ambiente y la salud humana y animal.”(Artículo 31). “Quienes importan, fabriquen, formulen, reenvasen, reempaquen, distribuyan, almacenen, transporten, vendan y apliquen sustancias químicas, biológicas o afines para uso agrícola, estarán obligados a resarcir los daños y perjuicios que, con sus acciones u omisiones ocasionen a la agricultura, la ganadería, la salud humana y el ambiente” (artículo 32).
Ley de Uso, Manejo y Conservación de Suelos: “Quien contamine o deteriore el recurso suelo, independientemente de la existencia de culpa o dolo o del grado de participación, será responsable de indemnizar, en la vía judicial que corresponda, y de reparar los daños causados al ambiente y a terceros afectados.” (Artículo 52).
VII.Criterios en materia de responsabilidad agraria objetiva, de la jurisprudencia agraria. La Jurisprudencia Agraria ha sido prolífera en el establecimiento de la responsabilidad objetiva por daños agroambientales y en particular para el caso de las quemas, por lo que el Tribunal procederá, en primer lugar a analizar ese tema: " IV.- Nuestro ordenamiento jurídico contiene varias disposiciones que en forma expresa y directa se refieren a las quemas e incendios forestales y la responsabilidad que se origina por ellos. Tenemos así: a) Ley de Cercas Divisorias y Quemas,N°121 de 26 de octubre de 1909: Su artículo 5 prohibe hacer quemazones en los campos. Unicamente las autoriza cuando se trate de desmontes para habilitar terrenos con fines agrícolas: Para ello se debe: 1) Solicitar permiso a la autoridad política local, 2) Tener garantías y precauciones para evitar mayor destrucción ala que se pretende o perjuicio a terceros,3) Notificar personalmente o por cédula de la autoridad a todos los colindantes o interesados el día y hora de la quema, por lo menos con dos días de antelación, 4) Dejar una distancia mínima de 400 metros sobre los manantiales nacidos en los cerros, y de 200 metros sobre los manantiales en terrenos planos.
En materia de responsabilidad, expresamente indica que ,en todo caso ,el que hiciere quemazones debe pagar los daños y perjuicios que a causa del fuego se ocasionen. Se presume autor de la quemazón el propietario, poseedor o arrendatario que en la época del fuego estaba preparado para ese objeto. B) La Ley Forestal vigente, N°7575 de 13 de febrero de 1996, en su capítulo IV sobre “Protección Forestal” prohibe la realización de quemas en terrenos forestales y aledaños a ellos, sin haberse obtenido el permiso de la Administración Forestal del Estado. Remite al Código Penal para sancionar a quien realice una quema sin permiso (artículo 35). Asimismo, los numerales 59 y 60 respectivamente sancionan el causar dolosa o culposamente un incendio forestal, con penas de uno a tres años en el primer caso y de tres meses a dos años en el segundo. C) Reglamento a la Ley Forestal, Decreto N°25721-MINAE de 17 de octubre de 1996: Establece que el funcionario de la Administración Forestal debe visitar el lugar previo a otorgar un permiso de quema (artículo 34).
Indica incluso no opera el silencio positivo en cuanto al criterio del MINAE. En cuanto a los terrenos forestales, zonas protectoras, parques nacionales, refugios de vida silvestre, prohibe la realización de quemas (artículo 88). F) Decreto N°17015-MAG,del2 de mayo de 1986: Creó la comisión Nacional para los Incendios Forestales. Dicha Comisión, según el Decreto N° 19434-MIRENEM de 11 de diciembre de 1990, tiene como atribuciones recomendar las políticas nacionales y preparar los programas de prevención y combate de incendios forestales. G) Decreto N°21859-MIRENEN del 7 de diciembre de 1992: Estableció el Comité contra Incendios Guanacaste como una instancia de coordinación, apoyo y seguimiento del Programa de Incendios Forestales de la Región Huetar Norte. H) Decreto N°23850-MAG-SP del 4 de noviembre de 1994, Reglamento para quemas controladas con fines agrícolas y pecuarios: En él se establecen los requisitos mínimos para poder efectuar quemas e incendios, especialmente en terrenos de uso agrícola o pecuario.
Se define quema al fuego provocado intencionalmente, regulado por un plan preestablecido, en el cual se asumen todas las medidas preventivas para evitar daños a los recursos naturales y a las propiedades de los colindantes. Son incendios los que, natural o artificialmente, afecten bosques, terrenos forestales, terrenos agrícolas o de uso pecuario (artículo 1). Para efectuar quemas en terrenos agrícolas y pecuarios debe contarse con una autorización escrita del Ministerio de Agricultura y Ganadería. El funcionario además de las medidas ya tomadas aprobadas según visita que debe hacer previo al permiso, debe indicar si lo concede las adicionales que considere necesario (artículos 2 y 3). El numeral 6° establece como requisitos mínimos los siguientes:
VIII.Responsabilidad agraria objetiva extracontractual. También existe Jurisprudencia relacionada con la responsabilidad objetiva extractual, generadas del ejercicio de actividades de fumigación aérea en agricultura: "VII. La responsabilidad derivada de daños causados a la naturaleza, sea ésta proveniente de una actividad agraria o de cualquier otro tipo, universalmente siempre se ha considerado como una responsabilidad de carácter objetiva. Este principio general de derecho ha sido admitido ampliamente en las últimas reformas a la Constitución donde se introdujo el derecho a un ambiente sano y ecológico equilibrado, y el legislador lo ha asumido aún antes de esas reformas, reiterándolo ampliamente despues, para encontrarse en todo el sector ambiental del ordenamiento jurídico. Desde los más remotos documentos jurídicos este criterio siempre ha imperado porque no puede obligarse a la víctima a probar el nexo de causalidad, como sí acontece para la responsabilidad subjetiva, si el agente dañoso ha asumido un riesgo, aún cuando sea bajo una dimensión de una actividad lícita, si dentro de sus posibles efectos se pueden incluir el causarle un mal a terceros.
La jurisprudencia de esta Sala se ha pronunciado en repetidas ocasiones en el tema de quemas, agrarias o no, con efectos dañinos en fundos colindantes o ajenos, y ha establecido la responsabilidad de quien procediendo a quemar sus propios deshechos o malezas, en su misma finca, le ha causado un mal a otro, aún cuando hubiera tomado todas las previsiones del caso para evitar la propagación del fuego (sentencias N° 112 de las 15 horas 50 minutos y 113 de las 16 horas, ambas del 11 de octubre de 1995, y la N°26 de las 14 horas del 28 de febrero de 1996). Naturalmente esta tesis hoy se reclama como un principio general del derecho para la protección del medio ambiente, y resulta correcto afirmarlo así. En la misma Biblia se encuentra consagrado, de donde pasó a textos jurídicos de la más diversa índole como es el caso de toda la tradición española tan influyente en nuestros ordenamientos jurídicos.
El fundamento de esta tesis es muy simple. No se trata de la responsabilidad subjetiva prevista en el numeral 1045 del Código Civil, porque en tal hipótesis el damnificado debe probar el nexo causal entre la acción del agente dañino y los perjuicios sufridos. En la objetiva la simple existencia del daño reputa la responsabilidad en el agente dañino de haber sido el causante de ese daño, y por tal quien deberá indemnizar los daños y perjuicios causados con su conducta. Esto no deriva de un acto arbitrario sino de pura lógica, pues quien, incluso en una conducta lícita, asume un riesgo donde exista peligrosidad, debe responder por todo cuanto daño pueda causar esa peligrosidad. Existen muchos ejemplos al respecto. Si una persona manipula pólvora, o cualquier tipo de material inflamable, sea en una fábrica, en una actividad comercial, o por su propia diversión, en caso de ocurrir un siniestro con efectos en cualquier vecino, no ha de ser el damnificado el llamado a probar el nexo de causalidad entre la conducta ejercida y el daño causado, más bien el ordenamiento jurídico parte de la culpabilidad de quien asumió el riesgo y la peligrosidad, y solo para eximirlo de la responsabilidad podría probar no ser el responsable directo del daño causado, así la carga de la prueba se invierte, y los eximentes, como por analogía podría aplicarse para el ámbito ambiental, serían los previstos en la Ley General de la Administración Pública donde también se prevé la responsabilidad objetiva del Estado, siendo ellos “fuerza mayor”, “culpa de la víctima” o “hecho de un tercero” (artículo 190).
VIII. En autos quedó claramente demostrado el daño sufrido por el sector de la plantación de Teca adyacente al fundo sembrado de arroz, existiendo únicamente una calle entre ambos fundos. Se constata entonces el primer elemento para la configuración del daño resarcible, es decir la existencia del daño real, cierto y efectivo. Asimismo se tuvo por demostrada la lesión a un interés jurídicamente relevante, merecedor de amparo.." ( Sala Primera de Casación, No. 398 de las 16 hroas del 6 de junio del 2001).
IX.Responsabilidad agraria "extendida", y "solidaria" de los distribuidores y comerciantes, a favor del productor agrario. En relación con la responsabilidad objetiva a favor del consumidor y su extensión, la Sala Primera ha señalado también lo siguiente: "V.- Responsabilidad objetiva por riesgo en materia del consumidor. En lo que se refiere a la responsabilidad, se pueden ubicar dos grandes vertientes, una subjetiva, en la cual se requiere la concurrencia, y consecuente demostración, del dolo o culpa por parte del autor del hecho dañoso (v.gr. el cardinal 1045 del Código Civil), y otra objetiva, que se caracteriza, en lo esencial, por prescindir de dichos elementos, siendo la imputación del daño el eje central sobre el cual se erige el deber de reparar. Como ejemplo de lo anterior, se encuentra el numeral 35 de la Ley de Defensa Efectiva del Consumidor, en donde el comerciante, productor o proveedor, responderá por aquellos daños derivados de los bienes transados y los servicios prestados, aún y cuando en su actuar no se detecte negligencia, imprudencia, impericia o dolo.
Asimismo, es importante considerar, por su influencia en el tema probatorio, que los elementos determinantes para el surgimiento de la responsabilidad civil, sea esta subjetiva u objetiva, son: una conducta lesiva (la cual puede ser activa o pasiva, legítima o ilegítima), la existencia de un daño (es decir, una lesión a un bien jurídico tutelado), un nexo de causalidad que vincule los dos anteriores, y en la mayoría de los casos la verificación de un criterio de atribución, que dependerá del régimen legal específico. En cuanto a la causalidad, es menester indicar que se trata de una valoración casuística realizada por el juzgador en la cual, con base en los hechos, determina la existencia de relación entre el daño reclamado y la conducta desplegada por el agente económico. Si bien existen diversas teorías sobre la materia, la que se ha considerado más acorde con el régimen costarricense es la de causalidad adecuada, según la cual existe una vinculación entre daño y conducta cuando el primero se origine, si no necesariamente, al menos con una alta probabilidad según las circunstancias específicas que incidan en la materia, de la segunda (en este sentido, pueden verse, entre otras, las resoluciones 467-F-2008 de las 14 horas 25 minutos del 4 de julio de 20085, o la 1008-F-2006 de las 9 horas 30 minutos del 21 de diciembre de 2006).
En este punto, es importante aclarar que la comprobación de las causas eximentes (culpa de la víctima, de un hecho de tercero o la fuerza mayor), actúa sobre el nexo de causalidad, descartando que la conducta atribuida a la parte demandada fuera la productora de la lesión sufrida. En lo que se refiere a los distintos criterios de imputación, para los efectos del presente caso, interesa la teoría del riesgo creado, la cual fue incluida, en forma expresa, en la Ley de Defensa del Consumidor. El esquema objetivo por el que se decanta la ley, así como la aplicación del criterio de imputación citado, se desprenden de la simple lectura de la norma en cuestión, la cual estipula: “el productor, el proveedor y el comerciante deben responder, concurrentemente, e independientemente de la existencia de culpa, si el consumidor resulta perjudicado por razón del bien o el servicio, de informaciones inadecuadas o insuficientes sobre ellos o de su utilización y riesgos. / Sólo se libera quien demuestre que ha sido ajeno al daño. / Los representantes legales de los establecimientos mercantiles o, en su caso, los encargados del negocio son responsables por los actos o los hechos propios o por los de sus dependientes o auxiliares.
Los técnicos, los encargados de la elaboración y el control responden solidariamente, cuando así corresponda, por las violaciones a esta Ley en perjuicio del consumidor.” (la negrita es suplida). Realizando un análisis detallado de la norma recién trascrita, se desprenden una serie de elementos condicionantes de su aplicación. En primer lugar, y desde el plano de los sujetos, esto es, quien causa el daño y quien lo sufre, la aplicación de este régimen de responsabilidad se encuentra supeditada a que en ellos concurran determinadas calificaciones. Así, en cuanto al primero, se exige que sea un productor, proveedor o comerciante, sean estos personas físicas o jurídicas. Por su parte, en cuanto al segundo, la lesión debe ser irrogada a quien participe de una relación jurídica en donde se ubique como consumidor, en los términos definidos en el cuerpo legal de referencia y desarrollados por esta Sala.
Se requiere, entonces, que ambas partes integren una relación de consumo, cuyo objeto sea la potencial adquisición, disfrute o utilización de un bien o servicio por parte del consumidor. El Banco actúa en ejercicio de su capacidad de derecho privado, como una verdadera empresa pública, y en dicha condición, ofrece a sus clientes un servicio, por lo que, al existir una relación de consumo, el caso particular debe ser analizado bajo el ámbito de cobertura del numeral 35 en comentario. Asimismo, del precepto bajo estudio se desprende, en segundo lugar, que el legislador fijó una serie de criterios de atribución con base en los cuales se puede imputar la responsabilidad objetiva que regula este cardinal, dentro de los que se encuentra la ya citada teoría del riesgo. Así, este sirve como factor para endilgarle la responsabilidad a los sujetos a que se hace referencia. En esencia, dicha teoría postula que, quien crea, ejerza o se aprovecha de una actividad lucrativa lícita que presenta elementos potencialmente peligrosos para los demás, debe también soportar sus inconvenientes (ubi emolumentum, ubi onus, el cual puede ser traducido como donde está el emolumento, está la carga).
De la anterior afirmación se pueden colegir dos características: por un lado, que el riesgo proviene de una actividad de explotación; y por el otro, al ser realizada por el ser humano, se excluyen los denominados hechos de la naturaleza. Concomitantemente, importa realizar algunas precisiones en cuanto a los riesgos aptos para la generación de la responsabilidad, ya que no todo riesgo implica el surgimiento, en forma automática, de esta. En la actualidad, la vida en sociedad ofrece un sinnúmero de riesgos, de distintos grados y alcances, al punto que se puede afirmar que es imposible encontrar una actividad cotidiana que se encuentre exenta de ellos. En esta línea, la interpretación de las normas no puede partir de una aversión absoluta y total al riesgo, el cual, como se indicó, forma parte integral de la convivencia societaria y de los avances tecnológicos que se integran a esta. Lo anterior lleva a afirmar que, para el surgimiento del deber de reparación, el riesgo asociado con la actividad debe presentar un grado de anormalidad, esto es, que exceda el margen de tolerancia que resulta admisible de acuerdo a las reglas de la experiencia, lo cual debe ser analizado, de manera casuística, por el juez.
El segundo punto que requiere algún tipo de comentario es en cuanto al sujeto que deviene obligado en virtud de una actividad considerada como peligrosa. Como ya se indicó, el criterio de imputación es, precisamente, el riesgo creado, lo que hace suponer que la persona a quien se le imputa el daño debe estar en una posición de dominio respecto de aquel, es decir, debe ser quien desarrolla la actividad o asume las posibles consecuencias negativas asociadas, recibiendo un beneficio de ello. Este puede ser directo, el cual se puede identificar, entre otros, con los ingresos o emolumentos obtenidos a título de contraprestación, o bien indirectos, cuando la situación de ventaja se da en forma refleja, como sucede con los mecanismos alternos que tiendan a atraer a los consumidores, y en consecuencia, deriven en un provecho económico para su oferente. Es importante mencionar que en una actividad es dable encontrar distintos grados de riesgo, los cuales deben ser administrados por aquel sujeto que se beneficia de esta, circunstancia que ejerce una influencia directa en el deber probatorio que le compete, ya que resulta relevante para determinar la imputación en el sub judice.
Lo anterior, aunado a la existencia de causales eximentes demuestra que la legislación en comentario no constituye una transferencia patrimonial automática. VI.- En la especie, las pretensiones de la actora fueron acogidas por mayoría por el Tribunal, quién consideró que el funcionamiento del sistema de banca electrónica presenta una peligrosidad tal que permite imputar los daños irrogados al Banco. La experiencia confirma que las transacciones realizadas por Internet presentan cierto nivel de riesgo, por lo que las generalidades apuntadas en el considerando anterior resultan aplicables. Así, la responsabilidad del Banco surge, no por el acto específico de la sustracción del dinero por un tercero, sino como consecuencia del funcionamiento específico del servicio que se ofrece al público. La razón de ser de la entidad es la intermediación financiera, concepto que incluye la captación de fondos provenientes del ahorro del público, concepto que lleva implícita su custodia, tanto desde el punto de vista físico, como del registro electrónico correspondiente.
No cabe duda que se encuentra sometida a una ineludible obligación de garantizar la seguridad de las transacciones realizadas, ya sea en ventanilla o mediante cualquier otro medio puesto a disposición de los clientes, la cual debe abarcar, necesariamente, el uso de todos aquellos mecanismos disponibles que le permitan contar con un mayor grado de certeza en cuanto a la identificación de las personas que se encuentran facultadas para realizar transacciones electrónicas desde las cuentas. La responsabilidad que le fue imputada al Banco se fundamenta, no en la sustracción del dinero por un tercero, sino en la existencia de un riesgo, según lo expuesto en el considerando V, en el funcionamiento propio del servicio que ofrece, lo que permite imputar el origen del daño al funcionamiento del servicio. La actividad financiera, específicamente la bancaria, genera por sí misma, un elevado nivel de riesgo, el cual se ve acentuado en el servicio en comentario, que impone a la entidad encargada de aquella un redoblamiento de los márgenes y dispositivos de seguridad en los diferentes niveles, tanto en lo relacionado con sus actividades propias y directamente desplegadas por sus funcionarios o contratistas, como en lo relativo a los medios que sus clientes, necesariamente, deberán utilizar para acceder y recibir el servicio ofrecido, el cual, por demás, es implantado, implementado, promocionado y desplegado por la entidad bancaria, también para su beneficio.
Por lo anterior, no es admisible el argumento, para eximirse de responsabilidad, de que internet no es del Banco, cuando bien sabe el demandado que ofrece un servicio altamente riesgoso. En todo caso, la relación existente entre el Banco y un tercero para la prestación de un servicio no excluye la responsabilidad del primero frente a sus clientes. Lo delicado de la actividad ejercida queda fuera de toda duda, y por ende, los márgenes de exigibilidad en la diligencia, seguridad, eficiencia, cuidado y razonabilidad en el manejo aumentan. Al fin y al cabo, los Bancos, sin que el demandado sea la excepción, custodian y administran, entre otros, un bien ajeno; y no cualquier bien, sino fondos del público. Así las cosas, no solo responde por la fortaleza de sus sistemas internos, sino también por la seguridad de quien, para llegar allí, utiliza los únicos canales posibles que el propio Banco conoce y reconoce como riesgosos.
Y responde no en cuanto ajenos, sino en la medida en que constituye el medio del que se prevalece, directamente, para la prestación del servicio. Tal y como lo preceptúa el numeral 35 de la Ley de Protección al Consumidor, ha habido un perjudicado en razón del servicio, que al ser utilizado (y en vista de su carácter riesgoso) produjo una lesión importante a quien figura en el proceso como parte actora. En consecuencia, en vez de una indebida interpretación de la norma, se ha dado al artículo el recto y correcto sentido. El medio para acceder a la plataforma del Banco no se trata, por ende, de un foco ajeno de riesgo, sino de un instrumento consustancial al servicio que presta; si se quiere, forma parte intrínseca de la actividad, que si bien es accesoria a la que realiza el intermediario, resulta imprescindible. De allí que los mecanismos de garantía al cliente –usuario-, deben darse no solo dentro de los muros informáticos del propio Banco, sino también en el camino de acceso a él como parte del servicio.
No en vano, el Sistema Financiero se ha abocado, en general, a la implementación de mecanismos de doble identificación, al mejoramiento de las claves y, en general, el uso de sistemas recientes como la utilización de tockens, claves cambiantes, llaves con dispositivos especiales, entre otros. Aunado a lo anterior, no puede perderse de vista que el surgimiento de la responsabilidad depende de la existencia de antijuridicidad, sin que la objetiva sea la excepción, debiéndose determinar, en este caso, si el afectado se encontraba en la obligación legal de soportar el daño, tal y como se extrae del principio de indemnidad patrimonial. Esta antijuridicidad de base, se identifica, en la especie, con el riesgo existente en el funcionamiento del servicio, según se desprende del propio acervo probatorio cuya indebida valoración se reclama. Es por lo indicado hasta este punto, que no es de recibo los argumentos expuestos por el recurrente en el sentido de que la obligación de seguridad es de naturaleza comercial y no jurídica.
Como ya se adelantó, el desarrollo de actuaciones asumidas por un sujeto de derecho, y que previsiblemente tengan la potencialidad de causar daños, lleva implícito el deber de garantizar la seguridad de estos. En esta línea, no se trata de que el demandado demuestre la diligencia que ha asumido, ya que este es un aspecto propio de un sistema subjetivo de responsabilidad. Finalmente, y desde el punto de vista general, debe aclararse al recurrente, que el caso sub-examine no se asimila al supuesto en donde el cliente es víctima de un robo en la calle cuando se dirige a un cajero o una sucursal bancaria. Las situaciones planteadas no son comparables. En primer lugar, debe tomarse en cuenta que la falla en el funcionamiento del servicio que ofrece el intermediario financiero radica en la falta de seguridad en los mecanismos de identificación del cliente para acceder a la plataforma interna. Desde esta perspectiva, producto de los riesgos inherentes a la transmisión de datos mediante Internet, y de los cuales es claro que el Banco tiene pleno conocimiento, como lo demuestran las campañas publicitarias desplegadas, este proceso para acreditar la identidad de la persona que utiliza el servicio debe, necesariamente, brindar las herramientas para reducir la posibilidad de que ocurra una suplantación de identidad.
Se trata de una característica intrínseca del servicio que ofrece el Banco. En este sentido, se aprecia que el ejemplo planteado por el recurrente no resulta aplicable, toda vez que la responsabilidad no se imputa por lo ocurrido previo al acceso, sino como consecuencia del riesgo creado y la inseguridad que presenta el sistema, analizado en su conjunto. Una sustracción de dinero en la calle se agota en el acto, sin que exista ningún tipo de participación por parte de la entidad financiera, mientras que en el supuesto bajo estudio, el perjuicio se da producto del riesgo no administrado de una suplantación de identidad, elemento sobre el cual el Banco se erige en una posición de control (respecto de la reducción del riesgo, claro está). En segundo lugar, existe una segunda diferencia que desvirtúa el símil planteado, cual es el margen de autodeterminación que le asiste al cliente. Así, en el ejemplo planteado, el medio para llegar, la hora, así como la misma escogencia del cajero o de la sucursal bancaria depende, exclusivamente, de la decisión del cliente.
En este escenario, la administración del riesgo depende, en forma preponderante –por no decir exclusiva-, del cliente, a diferencia del servicio de banca electrónica, en donde la única forma de acceder al servicio es mediante Internet, con los riesgos ya comentados. Si bien es cierto el usuario puede elegir entre conectarse en un lugar más o menos seguro, decisión respecto de la cual debe asumir su cuota de responsabilidad, en términos generales se encuentra supeditado a los riesgos propios de la conexión de Internet, de la cual depende. VII.- En suma a lo expuesto, en el caso concreto no se demostró la concurrencia de una eximente de responsabilidad, como lo sería la culpa de la víctima, el hecho de un tercero o la fuerza mayor. Si bien se alude a la primera, no existen, dentro del acervo probatorio, elementos suficientes que permitan afirmar que la víctima tuvo participación en la producción del daño.
De haberse probado alguna de estas circunstancias, sería imposible establecer un nexo de causalidad entre la conducta del Banco y la lesión, por lo que no podría surgir un deber de reparar a cargo del ente. Tal y como ya se manifestó, la existencia de una eximente implica que la causa del menoscabo puede ser vinculada a otro sujeto, o lo que es lo mismo, que el demandado resulta ajeno al daño irrogado. En todo caso, en la especie no se logró demostrar la concurrencia de una causa eximente o bien, que la Ley de Protección al Consumidor no sea aplicable, por lo que, al existir un daño como consecuencia de un servicio riesgoso, en los términos del numeral 35 del cuerpo normativo citado, no se aprecia una indebida aplicación del régimen jurídico por parte de los juzgadores de instancia. (Sala Primera de Casación, No. 1098-09, de las 14:45 del 22 de octubre del 2009).
X.La responsabilidad agraria por la utilización de agroquímicos. Sobre este tema, el Tribunal agrario también ha establecido su solución bajo parámetros de reponsabilidad objetiva. Así en el voto N° 0958-F-07 de las 15:40 del 22 de noviembre del 2007 señalamos: La responsabilidad objetiva deviene tanto en considerar a los actores como consumidores al amparo de la Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, N° 7472, como de la misma legislación en materia de agroquímicos. Ha señalado este Tribunal sobre la aplicación del régimen de responsabilidad objetiva en materia de daños ocasionados por agroquímicos: "VII.- (...) Sin embargo, dado lo acontecido en este asunto, no puede limitarse el análisis jurídico de los agravios de la apelación únicamente a lo relacionado con la compraventa de un producto, como lo pretende la actora, por cuanto existe una fase posterior, la de su aplicación vía aérea.
Aún más, tratándose de daños producidos por productos, la doctrina moderna en materia de derecho del consumidor, ha desarrollado criterios novedosos, que no se limitan a la esfera contractual, por las implicaciones propias de la producción, elaboración, comercialización y uso de tales. En ese sentido, la Ley 7472 de Promoción de la Competencia y Defensa Efectiva del Consumidor, en sus artículos 32 y 34, regula los derechos de los consumidores y las obligaciones de comerciantes y fabricantes. Uno de los más importantes es precisamente el derecho de información. El numeral 35 de dicha Ley establece además un régimen de responsabilidad objetiva, al imponer al productor, proveedor o comerciante, el deber de responder independientemente de la existencia de culpa, si el consumidor resulta perjudicado por razón del bien o el servicio, de informaciones inadecuadas o insuficientes sobre ellos o de su utilización y riesgos.
Solo se libera quien demuestra ha sido ajeno al daño. Además, indica los representantes legales o encargados de los negocios son responsables por los actos o hechos producidos por los dependientes o auxiliares. En este caso, sin embargo, dado lo debatido, no se discute se haya faltado al deber de información, pues lo que se alega por el actor es una entrega errónea de un producto, ni puede considerarse por ello se esté en presencia de responsabilidad por defecto del producto, así como tampoco lo alegado da pie para aplicar, de haberse comprobado el hecho, la garantía de funcionamiento regulado en los numerales 43 de la Ley citada y 452 del Código de Comercio. VIII.-Por otro lado, en materia de responsabilidad civil, contractual o extracontractual, objetiva u subjetiva, independientemente de tratarse de materia agraria, civil o comercial, para ser admitido el reclamo debe existir un daño o perjuicio, el cual debe ser imputable u originado por quien se demanda.
Por daño se entiende “ todo menoscabo, pérdida o detrimento de la esfera jurídica patrimonial o extrapatrimonial de la persona (damnificado), el cual provoca la privación de un bien jurídico, respecto del cual era objetivamente esperable su conservación de no haber acaecido el hecho dañoso. Bajo esta tesitura, no hay responsabilidad civil si no media daño, así como no existe daño si no hay damnificado. Por otra parte, solo es daño indemnizable el que se llega a probar (realidad o existencia), siendo ello una cuestión de hecho reservada al prudente arbitrio del juzgador…”(Sala Primera de la Corte Suprema de Justicia, voto Nº 114 de las 16:00 horas del 2 de noviembre de 1979). Aparte de tener que ser real, cierto, efectivo y merecedor de amparo jurídico, se requiere el daño sea causado por un tercero y esté subsiste a la hora de plantearse la demanda. Debe mediar además una relación de causalidad entre el hecho ilícito y el daño acontecido." Tribunal Agrario, Voto N° 814-F-03 de las 14:45 horas del 16 de diciembre del 2003.- La responsabilidad objetiva no sólo se limita desde la óptica del consumidor, sino también se deriva de la legislación sobre agroquímicos, por lo que no lleva razón la demandada en estimar que no es aplicable la misma al presente asunto, tal y como lo ha estimado la Sala Primera: "V.
(...) Son las Leyes de Protección Fitosanitaria número 7664, y la de Aviación Civil número 5050 del 11 de diciembre de 1972, las que la regulan. La primera dispone: “Quienes importen, fabriquen, formulen, reenvasen, reempaquen, distribuyan, almacenen, transporten, vendan y apliquen sustancias químicas, biológicas o afines para uso agrícola, estarán obligados a resarcir los daños y perjuicios que, con sus acciones u omisiones, ocasionen a la agricultura, la ganadería, la salud humana y el ambiente” (artículo 32). La segunda establece: “Toda persona física o jurídica que utilice aeronaves destinadas a la aviación agrícola responderá por los daños que cause a las personas o bienes de terceros en la superficie” (artículo 107). Ambas determinan claramente una responsabilidad objetiva, ninguna obliga a la víctima a demostrar algún elemento subjetivo de imputación. Por ello basta con que se pruebe el daño y la relación de causalidad para imputar la responsabilidad civil a los sujetos que objetivamente deben responder, según las normas citadas.
La Sala en un caso similar al presente, admitió la responsabilidad objetiva, hoy más que nunca obligada frente a problemas de orden ecológico (Sala Primera de la Corte Suprema de Justicia, Voto N° 607-F-02 de las 16:15 horas del 7 de agosto del 2002.).-
El comercializar, distribuir agroquímicos es una actividad que implica un riesgo, tanto al consumidor como al medio ambiente, como al productor agrario, lo cual genera responsabilidad de tipo objetivo para quien asuma dicho riesgo al dedicarse a dicha actividad. Ha dicho la Sala Primera referida en otra oportunidad: "VII. (...) El fundamento de esta tesis es muy simple. No se trata de la responsabilidad subjetiva prevista en el numeral 1045 del Código Civil, porque en tal hipótesis el damnificado debe probar el nexo causal entre la acción del agente dañino y los perjuicios sufridos. En la objetiva la simple existencia del daño reputa la responsabilidad en el agente dañino de haber sido el causante de ese daño, y por tal quien deberá indemnizar los daños y perjuicios causados con su conducta. Esto no deriva de un acto arbitrario sino de pura lógica, pues quien, incluso en una conducta lícita, asume un riesgo donde exista peligrosidad, debe responder por todo cuanto daño pueda causar esa peligrosidad.
Existen muchos ejemplos al respecto. Si una persona manipula pólvora, o cualquier tipo de material inflamable, sea en una fábrica, en una actividad comercial, o por su propia diversión, en caso de ocurrir un siniestro con efectos en cualquier vecino, no ha de ser el damnificado el llamado a probar el nexo de causalidad entre la conducta ejercida y el daño causado, más bien el ordenamiento jurídico parte de la culpabilidad de quien asumió el riesgo y la peligrosidad, y solo para eximirlo de la responsabilidad podría probar no ser el responsable directo del daño causado, así la carga de la prueba se invierte, y los eximentes, como por analogía podría aplicarse para el ámbito ambiental, serían los previstos en la Ley General de la Administración Pública donde también se prevé la responsabilidad objetiva del Estado, siendo ellos “fuerza mayor”, “culpa de la víctima” o “hecho de un tercero” (artículo 190).- (Voto de la Sala Primera N° 398-F-01 de las 16:00 horas del 6 de junio del 2001).- La tesis del recurrente en cuanto a que la normativa fitosanitaria solo se circunscribe al ámbito administrativo es inadmisible, ya que el ordenamiento jurídico, en virtud del principio de plenitud hermenéutica, es uno solo.
Incluso a falta de norma escrita, el juzgador debe aplicar las fuentes materiales del derecho, como lo son la jurisprudencia y los principios generales del derecho, por disposición del artículo quinto de la Ley Orgánica del Poder Judicial. Sostener la tesis del recurrente equivaldría a mantener la protección fitosanitaria únicamente en sede administrativa en forma exclusiva, lo cual no es de recibo bajo ninguna óptica, ya que la misma normativa se deriva del artículo 50 de la Constitución Política que establece como un deber del Estado -Poder Judicial incluido- el garantizar la tutela del derecho humano al ambiente sano y ecológicamente equilibrado, regulando actividades riesgosas como lo es lo relativo a los agroquímicos. El artículo primero de la Ley de Protección Fitosanitaria establece que es de interés público y aplicación obligatoria las medidas de protección fitosanitaria establecida en esta ley y sus reglamentos, sin discriminar si lo es exclusivamente para sede administrativa.
En consecuencia, se rechazan el segundo y tercer agravios.- VIII.-Como último agravio, la demandada estima que el régimen de responsabilidad aplicable al caso lo es el de responsabilidad civil contractual de carácter subjetivo...Tampoco lleva razón la recurrente. Como se explicó ampliamente, el régimen de responsabilidad aplicable es el de tipo objetivo. Sin embargo, las causales expuestas por el apelante son eximentes también en este tipo de responsabilidad... La lógica y experiencia nos dice que, verbigracia, si uno acude a un médico, el paciente debe explicarle el mal que le aflige a fin de que el profesional le haga un diagnóstico y le brinde una “receta”. Igual sucede con los agroquímicos: el agricultor le expone el problema y el vendedor, que se supone tiene experiencia y conocimiento pleno de todo el “staff” de productos disponibles, le aconseja utilizar determinado producto. Aquí es donde radica la responsabilidad objetiva tan negada por la parte demandada, quien ha incurrido en responsabilidad por tener a un empleado como el testigo vendiendo sin ningún criterio y sin dar un adecuado asesoramiento e información a los clientes, productos altamente peligrosos como lo son plaguicidas.
Cabe preguntarse: ¿qué pasaría si lo que se vende no son pesticidas sino pólvora?... El decreto 27034- MAG del 5 de enero de 1998 impone obligaciones a empresas como la demandada de comprobar que el personal de ventas -como el mencionado testigo- haya recibido capacitación para expendedores y personal de ventas. Esta norma tiene toda lógica, por lo delicado que es el manejo y aplicación de estos productos. En toda empresa, se capacita el personal acerca de los productos que se venden. ...Desde el punto de vista de la responsabilidad objetiva e incluso la subjetiva la empresa demandada es responsable de la venta y aplicación de dicho producto sin observancia de la legislación que regula este tipo de actividad. Por ello, no ocurrió culpa de la víctima, ya que los actores se sometieron a las instrucciones y diagnóstico de la demandada, por lo que, siendo el hecho generador del daño la aplicación de dicho producto, no autorizado para arroz en nuestro país, y siendo el agente generador del daño la compañía demandada a través del señor [Nombre9], es que se configura en este caso, tal y como lo tuvo acreditado el ad quo, que la demandada es responsable de los daños y perjuicios ocasionados a los cultivos de arroz de los actores.
De acuerdo a lo anterior, debe tenerse entonces como cierto que los daños ocasionados a la siembra del arroz se debieron a la aplicación del producto Herness efectuada en el fundo por acuerdo de la parte actora con la misma compañía AgroSuperior, quien bajo sus instrucciones, fue que se aplicó el plaguicida. Todo lo anterior para concluir que la causa como hecho generador del daño en este proceso es la aplicación del Herness en noventa hectáreas de arroz realizada por los actores bajo instrucciones de los demandados en su fundo, la cual conllevó una daño en la siembra de arroz de los coactores. Y no por fuerza mayor o culpa de la víctima, lo cual de forma alguna se demostró, sino por la existencia del comportamiento de la demandada sobre la producción del daño causado. Se da el nexo causal por lo que existe culpabilidad imputable al demandado según se ha tenido por demostrado. Se rechaza el cuarto y último agravio de la demandada.- ".
XI.Agravios de la co-demandada Compañía Costarricense del Café S.A. e imputación de su responsabilidad.- En su primer agra v io, la recurrente aduce que no fue probado por la parte actora el nexo entre el hecho generador y el daño ocasionado. Existe prueba que demuestra, a su juicio, que el actor no aplicó el supuesto producto distribuido por su representada conforme a las indicaciones originales que constan en el paquete, sino que por su cuenta y bajo su responsabilidad, siguió el consejo del vendedor directo del producto y los conocimientos empíricos del actor, agregando otros productos por su cuenta. Dice que el importador o distribuidor de este tipo de productos debe indicar la dosis a utilizar y cualquier cambio que se efectúe releva de toda responsabilidad a su representada. Ciertamente, si se analiza la declaración de [Nombre5] , indica que el actor era el encargado de hacer la mezcla del producto: "Sé que el actor compró en julio del 2001 varios prodcutos como sulfato de zinc, foliveex, polisacáridos y aptan en el logal de Agro San Marcos...El actor era el encargado de hacer la mezcla del producto y nosotros nos tocaba rociar el producto con las bombas de motor..."(folio 460); también es cierto que en su confesión [Nombre3] , representante de la demadnada Agro San Marcos de Tarrazú, declara y reconoce haber brindado asesoramiento al actor, y que es de su autoría el documento de folio 188 (ver confesión a folio 454), correspondiente a la receta técnica para la aplicación del sulfato de zinc, distribuido por su representada, en la cual se duplica la dosis recomendada en la etiqueta del producto (folio 27).
Pero si con ello pretende la co-demandada CAFESA, eximirse de responsabilidad invocando que existe "culpa de la víctima" o "culpa concurrente", de la víctima y el agente distribuidor del producto, ello no es de recibo por dos órdenes de motivos, uno de orden legal, y otro de orden técnico-científico. El motivo de orden legal, está vinculado justamente a la regulación de la responsabilidad objetiva, en esta materia, porque, como se ha visto, y lo cita el Juez de primera instancia, existe una norma expresa, a saber el artículo 3 del "Reglamento de Uso y Control de Plaguicidas Agrícolas y Coadyuvantes”, que establece la responsabilidad objetiva y concurrente tanto del distribuidor, como del importador de agroquímicos, acentuando la responsabilidad por el riesgo creado por la utilización de agroquímicos, cuando se realiza una práctica agrícola correcta, al respecto, el párrafo segundo dispone: "Cuando se produzcan daños al ambiente, a los cultivos y a la salud de las personas, por la utilización del producto, en condiciones de práctica agrícola correcta, serán solidariamente responsables el fabricante, el registrante y el distribuidor" .
Asímismo la Ley de Protección Fitosanitaria establece: “Quienes importan, fabriquen, formulen, reenvasen, reempaquen, distribuyan, almacenen, transporten, vendan y apliquen sustancias químicas, biológicas o afines para uso agrícola, estarán obligados a resarcir los daños y perjuicios que, con sus acciones u omisiones ocasionen a la agricultura, la ganadería, la salud humana y el ambiente” (artículo 32) De ahí que se multipliquen los controles fitosanitarios, externos e internos, para evitar que provoquen daños a la salud, al medio ambiente, a las personas, las plantas y los animales. Por ello, es importante indicar, que en el caso de la aplicación del agroquímico, la práctica agrícola fue correcta, pues la realizaron personas con experienciaen la utilización y manejo de agroquímicos. Así Don [Nombre5] explicó claramente lo siguiente: "nosotros seguimos las instrucciones del actor aunque la forma de aplicar el producto es de la misma forma acostumbrada, dándole una buena cobertura a la planta, a más o menos un estañón por manzana..."(folio 460).
El motivo de orden técnico-científico : Pese a lo indicado anteriormente, en el sentido de que la práctica agrícola fue la correcta y la acostumbrada, el problema de orden técnico científico es lo que produce la responsabilidad solidaria y compartida por dos motivos a) La compañía distribuidora CAFESA S.A. registró Sulfato de Zinc bajo el número CED6, lote 0018943, que ha la postre, conforme al monitoreo de agroquímicos, y análisis de Laboratorio de Control de Calidad y el Decreto No. 27973-MAG-MEIC-S "Reglamento Técnico RTCR-318:1998. "Laboratorio para el análisis de sustancias químicas y biológicas de uso en la Agricultura" presenta una concentración de 0.122% (ver documentos de foliios 14 y 16), incumplimiento con la norma técnica RTCR-228 "Fertilizantes/Tolerancias permitidas para la concentración de nutrientes", en violación del artículo 30 de la Ley de Protección Fitosanitaria 7764, Capítulo IV referida a los controles, el Decreto 24337-MAG-S "Reglamento de Uso y Control de Plaguicidas Agrícolas y Coadyuvantes” , artículos 23-27.
Ello implicaba, que el producto debía ser reexportado al país de origen. En efecto, si se observa el análisis químico, el Límite superior para este tipo de producto es de 23,300, se declaró 22,500, y se encontró una concentración de 24.400, con un 0,122% de Cadmio. b) Por otra parte, pese a que la práctica agrícola fue correcta, no se siguieron las especificaciones técnicas tal y como se ha tenido por demostrado que l a aplicación del producto, según la etiqueta debía corresponder a 0.5 K por 200 litros de agua, siendo que en la indicación técnica manuscrita, por parte de personeros de AgroSan Marcos fue de 1 K por 200 litros de agua (ver documentos de folios 27 y 188 y declaración confesional de [Nombre3] , a folio 451 y testimonial de [Nombre5] a folio 462 ) . De todo lo anterior, resulta evidente la conclusión en cuanto al tema de la responsabilidad objetiva, pues ambas empresas, concurrieron definitivamente en que se aplicara un producto que, por un lado, no reunía las exigencias técnicas de análisis químico y, por otro, no debía aplicarse en el porcentaje indicado en la receta.
Ambas circunstancias, indudablemente, concurrieron a la producción del daño causado, pues no se ha demostrado algún eximente de responsabilidad objetiva (culpa de la víctima, caso fortuito o fuerza mayor, o culpa de un tercero). En cuanto al segundo agravio, a lega que si se concede un monto menor al inicialmente solicitado para los daños utilizando un parámetro objetivo y real, no podría otorgarse el mismo monto solicitado inicialmente para el daño moral. Sin embargo, no lleva razón el recurrente en este reparo, toda vez que estamos en presencia de un daño moral objetivado, y que ha producido indudablemente una afectación anímica al actor, al ver frustrada su producción agraria de café, y soportar el transcurso de todo este proceso judicial para poder obtener una reparación integral del daño causado, el cual, incluso, desde un inicio las mismas empresas demandadas reconocieron de alguna manera cuando le ofrecieron a Don [Nombre1] una salida alterna, pretendiendo evitar la demanda judicial (ver al respecto la propuesta de arreglo documento de folio 81), y que el actor no quizo firmar por no encontrarla equitativa.
El a quo citó la prueba testimonial de [Nombre10] y [Nombre5] , sobre la frustración y el dolor que tenía al ver truncada la producción de su actividad cafetalera. Evidentemente, la fijación del monto es, contrario a lo indicado al recurrente, una cifra baja, si se toma en consideración el tiempo que ha pasado para poder obtener, al menos, un reconocimiento de su afectación. De ahí que el Tribunal considera que debe rechazarse el referido agravio. En memorial del 9 de julio del 2009, presenta escrito de "expresión de agravios" ante este Tribunal, el cual es presentado extemporáneamente, pero básicamente reitera los agravios del recurso de apelación.
[Nombre6] II .- Agravios de la co-demandada Agro San Marcos de Tarrazú e imputación de responsabilidad. En relación a los agravios expresados por esta parte co-demandada, tampoco llevan razón en lo expuesto. En primer lugar, en cuanto al tema de la carga de la prueba, debe indicarse que la parte actora cumplió con demostrar la producción del riesgo por parte de ambas empresas, conforme se indicó en el considerando anterior, para el caso particular de Agro San Marcos de Tarrazú no se siguieron las especificaciones técnicas tal y como se ha tenido por demostrado que l a aplicación del producto, según la etiqueta debía corresponder a 0.5 K por 200 litros de agua, siendo que en la indicación técnica manuscrita, por parte de personeros de AgroSan Marcos fue de 1 K por 200 litros de agua (ver documentos de folios 27 y 188 y declaración confesional de [Nombre3] , a folio 451 y testimonial de [Nombre5] a folio 462 ) .
Esto último nos lleva a desestimar, irremediablemente, los restantes agravios, referidos a los alegatos en relación a la supuesta conducta diligente, pues aún cuando haya entregado el producto empacado, como lo hace llegar la empresa distribuidora, lo cierto es que Agro San Marcos de Tarrazú sí tenía conocimiento del dominio de los hechos, porque no solo vendió el producto, sino que además, como ellos mismos lo reconocen, entraron una receta diferente a la indicada en el empaque, duplicando la dosis del producto. Finalmente, m anifiesta que se omite valoración sobre la aplicación de otros productos también contaminados y se descalifica o ignora la prueba pericial que indica que la presencia de cadmio en las plantas era muy poca y que el mismo no era la razón del estado de las matas. Debe recordarse que en materia agraria, rige el principio de libre valoración probatoria, contenido en el artículo 54 de la Ley de Jurisdicción Agraria, que permite otorgar mayor valor a una pruebas que a otras.
En este caso, evidentemente, el a-quo valoró integralmente la prueba para concluir en la existencia de una responsabilidad objetiva. Técnicamente está demostrado que el Sulfato de Zinc era un producto que no reunía las condiciones necesarias para ser vendido, y aún así se le vendió al señor [Nombre1] , y se le duplicó la dosis, lo que lógicamente ocasionó el daño a su plantación, lo cual no fue desvirtuado. Por el contrario, el Tribunal también llega a esa convicción, basado no solo en la prueba de las aplicaciones del producto, sino también, en el documento de fecha 17 de agosto del 2001, en donde pretendían comprometer al señor [Nombre1] , a no interponer demandas judiciales, a cambio de 50 sacos de fertilizante de café, aduciendo que no existía certeza científica de la causa de los daños causados. Con ello se evidencia, sin duda alguna, una aceptación tácita, por parte de los recurrentes, en cuanto a su responsabilidad objetiva y solidaria, prevista tanto en la Legislación agraria, como en la reglamentación técnica aplicable al caso concreto, citada en el considerando anterior.
Pero a ello se suman el análisis de Laboratorio (folios 14 y 16), y la verificación y conclusión pericial del Organismo de Investigación Judicial (folio 299), sobre el excedente del Cadmio en el producto y la superación del máximo de tolerancia permitido.
POR TANTO:
Se confirma, en todos sus extremos, la sentencia recurrida.
