JUDGMENT Nº 0 438 - F -1 1 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at eight hours and three minutes on nueve de mayo de l dos mil once.- POSSESSORY TITLE PROCEEDING (INFORMACIÓN POSESORIA) brought by [Nombre1] , of legal age, single and in a domestic partnership, resident of Guayabo de Bagaces, Guanacaste, identity card CED1 – –. The PROCURADURÍA GENERAL DE LA REPÚBLICA appeared, represented by attorney Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General, whose other particulars are unknown in the record; as did the INSTITUTO DE DESARROLLO AGRARIO, represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Escazú, identity card number CED2 - -. Attorney Melvin Lobo Palacios, of legal age, single, attorney, resident of Aguas Claras de Upala, identity card CED3 - -, acted as special judicial representative (apoderado especial judicial).- RESULTS:
Judge Castro García drafts the opinion; and,
CONSIDERING:
I.The list of proven facts 1, 3, 4, and 5 is affirmed because it is well supported by the record. No ruling is made on the remaining facts because they are unrelated to the subject matter of this appeal. The following fact of the same nature is added at this stage: 11) The title claimant has exercised possession by protecting the forest resource and has devoted the property to forest and scrubland (land-use certificate (certificado de uso de suelos) at folios 6 and 7, witness testimony at folios 60 to 61, and judicial inspection record (acta de reconocimiento judicial) at folio 66).
II.The appeal was filed by attorney Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General (folio 86). She asserts the following grounds of error against the first-instance decision: 1) The judgment deems it established that the property for which title is sought is bounded to the north by an easement, with [Nombre2], [Nombre3], and [Nombre4] on the other side. She argues that the Ley de Informaciones posesorias is not an appropriate mechanism for establishing a right-of-way easement (servidumbre de paso) and that no document was submitted proving that the encumbrance had been duly established. She states that property is presumed to be free of encumbrances and that this easement may be created only by agreement of the parties or by will, and that even immemorial possession is insufficient to establish it, pursuant to sections 376 and 379 of the Código Civil. She requests that the eastern boundary be corrected to state that it adjoins only [Nombre2], [Nombre3], and [Nombre4], without an intervening easement. 2) The petitioner’s statements, the certified copy of the deed of conveyance, the judicial inspection conducted, the land-use certificate, the witness testimony, the survey plan submitted, and the challenged judgment itself establish that the land is forested in nature (mountain land); because such lands are located within national reserves, they have been subject to the public-domain regime (régimen de dominio público) as State Natural Heritage (Patrimonio Natural del Estado) since Ley Forestal 4465 de 1969, artículo 33, as amended by Ley Forestal 7174 de 1990 (artículos 32 y 33), and retain their status as public-domain property (carácter demanial) under Ley 7575, (artículos 13 y 14).
She states that the witnesses’ testimony does not establish the ten-year possession required for the petitioner to acquire the property by acquisitive prescription (usucapir). She argues that the law permits title to property outside protected wilderness areas (áreas silvestres protegidas) if the petitioner proves legitimate rights arising from ten-year possession, together with the other conditions required for that purpose, including having protected the resource and having the property duly demarcated. This leads her to conclude that title may be granted if acquisitive prescription (usucapión) was completed before the property became part of the Patrimonio Natural del Estado by operation of law. She cites judgment 4587-97 of the Sala Constitucional and further contends that forest lands are immediately dedicated by law to the public domain. She alleges as error that the witnesses’ testimony does not establish ten-year possession sufficient for the petitioner to acquire the property by acquisitive prescription. She then cites judicial precedents and opinions issued by the Procuraduría General de la República, specifying the following:
III- Regarding the claim of error concerning the perpetual designation of forests as public-domain property. With respect to the possibility of private parties registering forest-covered property located on untitled land, this Tribunal has ruled that unregistered land with forest cover (cobertura forestal), whether inside or outside protected wilderness areas (áreas silvestres protegidas), may indeed be titled, provided that the legal requirements established in the various applicable bodies of law have been met. By way of illustration, one of the relevant decisions of this Court states: “In connection with the arguments submitted by the State’s representative concerning the State Forest Estate (patrimonio forestal del Estado), a brief discussion of the matter is appropriate. To that end, it is useful to cite Decision No. 51, issued at 15 hours 15 minutes on May 26, 1995, by the Sala Primera de la Corte Suprema de Justicia, which states, insofar as relevant: ‘IX.- The State Forest Estate encompasses the entire national territory (Articles 4 and 32 through 42), which may in turn be divided into three areas: A) The area covered by the forestry regime (régimen forestal) (Articles 1, 2, 7, 47 through 54, and 66 through 81); B) forestry operations (aprovechamientos forestales) on privately owned land (Articles 43 through 46, 60 through 65, and 82 through 91); and C) national reserves (reservas nacionales) (Articles 32 et seq.)......
In general, limits have applied to the possession of those reserves, as well as limits—in terms of surface area—on their registration through possessory-information proceedings (informaciones posesorias). .... XI.- In a position diametrically opposed to that of national reserves is private property, referred to in the law as “On the Use of Forest Resources on Privately Owned Land.” For reasons of social interest, these lands form part of the State Forest Estate. This is so because private parties—operating under any system (whether as an agricultural or livestock enterprise, for subdivision or colonization, and whether they are nationals or foreigners)—whose work plans include forestry exploitation or the removal of forest in any form must necessarily obtain the express approval of the Dirección General Forestal, under the terms of the Ley Forestal and its regulations (Article 60). The State Forest Estate therefore applies to all property in the nation where natural forest resources exist.
To exploit their own timber resources, private parties must prepare technical forestry plans, and the Dirección will grant them long-term concessions (Article 61). The foregoing entails voluntary submission to the forestry regime. This is a legal presumption (presunción legal), since it is the only alternative available to a private party, who is prohibited from felling trees or using or exploiting forest products on that party’s own property without prior authorization from the Dirección General Forestal (Articles 63 and 65)..... It follows from the foregoing that the State Forest Estate consists of real property not subject to private ownership and not registered in the Registro Público de la Propiedad, under Articles 267 and 486 of the Código Civil, as referenced in the ruling of the Sala Constitucional de la Corte Suprema de Justicia. Alongside this estate there is also private property.
Throughout the evolution of forestry legislation, possessors of tracts who had already perfected their ownership rights through acquisitive prescription (usucapión) were afforded the opportunity to obtain title to them. That opportunity is available through compliance with the requirements of the Ley de Informaciones Posesorias, which therefore expressly authorizes the titling of land located in protected wilderness areas, regardless of their management category, and the obtaining of title eligible for registration in the Registro Público, provided that the applicant for title (titulante) proves possession dating back more than 10 years before the effective date of the law or decree creating the protected wilderness area (Articles 1 and 7 of the Ley de Informaciones Posesorias).’ (Decision 100-F-09 of the Tribunal Agrario). Regarding the public-domain status (carácter demanial) of forests and the impossibility of obtaining title to them through the Ley de Informaciones Posesorias, this Court has held: ‘The Tribunal does not share that view, finding that those properties were removed from the public domain (desafectación) upon the entry into force of the current Ley Forestal, which amended Article 7 of the Ley de Informaciones Posesorias.
With respect to forested properties located outside protected wilderness areas, that provision states: “... Properties located outside those areas and containing forests may be titled only if the petitioner (promovente) proves that he or she holds the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years, and has protected that natural resource, it being understood that the property must be duly demarcated and enclosed by fences or cleared boundary paths.” The constitutionality of that provision and of the interpretation once adopted by this Tribunal was challenged, resulting in the issuance of Decision 4587-97 of the Sala Constitucional, specifically cited by the appellant. In that decision, the Sala upheld the constitutionality of the provision, leaving it in force. Under those circumstances, the proper course in this case is to affirm the trial judge’s ruling, because the petitioner proved compliance with the requirements established in that Article, namely: ten-year possession, protection of the natural resource, and demarcation of the property by fences or cleared boundary paths.’ (Voto 573-F-09).
Likewise, the Sala Constitucional rejected the constitutional inquiry submitted by this Tribunal against Article seven of the Ley de Informaciones Posesorias, which permits the titling of tracts with forest cover (cobertura boscosa) located inside or outside protected wilderness areas, under expediente EXPN1, leaving that provision and its effects in force.
IV- Regarding the claim of error concerning the inalienability of the forest and the witnesses’ testimony. These proceedings were instituted for the purpose of registering in the Registro Público de la Propiedad a parcel of land located at [Dirección6], in the thirteenth canton, Upala, in the province of Alajuela, according to registered cadastral plan (plano catastrado) A- 1072503-2006 (folio 9), with an area of 10 hectares 1104 square meters and 24 square decimeters, consisting of mountain land and scrubland (charral) (registered cadastral plan at folio 9, soil study at folio 25, and judicial inspection (reconocimiento judicial) at folio 66). According to the submitted certification issued by the Sistema Nacional de Áreas de Conservación (folio 26), this property does not form part of a protected wilderness area. The soil study in the record (folios 6 and 7) states that possession has been exercised in accordance with land-use capability (capacidad del uso del suelo), that the land is devoted to scrubland and mountain land, and, in its observations, that the property has been devoted to conservation and contains old, regenerating scrubland.
Its recommendations state that the land should continue to be used for conservation purposes because of the nature of the soil resource and should not be used for livestock farming, noting that no evidence of such activity was found on the property. A judicial inspection of the property was conducted (folio 66), and a record was prepared stating that land with extensive forest cover and native forest species from the area, such as laurel and cedar, among others, was observed. The trial judge observed no evidence of tree-felling in that forest. The property was found to be fully demarcated, with rice crops in the central sector. During the proceedings, testimony was received from [Nombre6] (folio 60), [Nombre7] (reverse of folio 60), and [Nombre8] (reverse of folio 61 and folio 62), all of whom consistently stated that they had known the tract for longer than the ten-year period required by law: they had known it for 40 years, 30 years, and 27 years, respectively.
They stated that the applicant for title acquired the property from his father, [Nombre9], and that the petitioner’s possessory acts (actos posesorios) consisted of growing beans and maintaining secondary growth (tacotal) and mountain land, according to the first witness cited, and maintaining secondary growth and mountain land, according to the other witnesses. Having found that the ten-year possession required to obtain title through these proceedings has been proven, this Court rejects the claim that the witnesses failed to establish ten-year possession sufficient for the petitioner to acquire ownership by acquisitive prescription, particularly because the appellant does not specifically state the grounds for that claim. The appellant expresses her disagreement on the ground that the property contains forest. The cited evidence establishes that the land is covered by scrubland and forests, as shown by the plan and the judicial inspection.
The appellant is incorrect in claiming that land with forest cover cannot be titled because it forms part of the Patrimonio Natural del Estado. This is because the soil study shows that scrubland also covers fifty percent of the land’s area, and because the titling of such forested tracts is legally permissible, provided that the legal requirements of the various legal provisions are satisfied. The testimony, judicial inspection, and soil certification establish that the property contains scrubland and forests and that the applicant for title has adopted a conservation-oriented approach in exercising possession, since the property has been devoted to conservation purposes and the soil resource has been protected. Accordingly, this Court does not agree with the State’s representative that the land forms part of the Patrimonio Natural del Estado because it contains forests. That objection, based on Article 856 of the Código Civil, is unfounded because this is a tract capable of being acquired by acquisitive prescription, pursuant also to Article 7 of the Ley de Informaciones Posesorias, as already explained in this decision.
The Tribunal finds that the evidence submitted did indeed establish the exercise of lawful and legally sufficient possession (posesión legítima y apta) over the tract for more than ten years before these proceedings were instituted, which is the applicable period because the tract lies outside every protected wilderness area. Likewise, the exercise of possessory acts aimed at conserving natural resources was established, since the land has been used in accordance with the capability of that resource; those arguments are therefore rejected.
V- The appellant is incorrect in claiming that repealed law continues to govern legal situations arising under it and in invoking the protection of public ownership rights over forests established by prior legislation against retroactive applications detrimental to those rights. As explained in the third recital (considerando) of this decision, this Tribunal finds that Article seven of the Ley de Informaciones Posesorias removed such property from the public domain and expressly authorized private parties to obtain title to land with forest cover, provided that all legal requirements are met; that provision remains fully in force.
VI—Regarding the establishment of an easement (servidumbre). Article 379 of the Civil Code provides that discontinuous easements of every kind and continuous non-apparent easements may be established only by agreement or by last will, and possession, even from time immemorial, is insufficient to establish them. The conditions governing easements are determined by the instrument that created them, and real properties are presumed to be free of encumbrances unless the existence of an easement is proven otherwise (Articles 375 and 376 of the Civil Code). In these possessory title proceedings (diligencias de información posesoria), the submitted survey plan (plano) number A- 10772503 (folio 9) shows, along the western boundary of the land, a right-of-way easement (servidumbre de paso) running from bearing point 12 to 17 and from 18 to 36, which provides other properties, distinct from the one sought to be titled, with access to the public road.
In this regard, the adjoining landowners were notified and raised no objection to these proceedings; therefore, there is no objection concerning the easement depicted on the survey plan forming the basis of these proceedings. The appealed decision states that the appellant’s objection concerning the establishment of the easement was resolved by the ruling issued at 14:04 hours on 7 de octubre del 2009, which rejected that argument because this easement did not affect the property to be titled, but rather another property belonging to a third party, and because the registered survey plan (plano catastrado) reflects that circumstance. With respect to this issue, the court below ruled in the appealed judgment that the northern boundary adjoins [Nombre10] and others, with an easement between them, without stating that such an encumbrance was being established in favor of a dominant estate (fundo dominante) and against a servient estate (fundo sirviente); accordingly, these proceedings should not be understood as establishing an easement.
It was also stated that the property is free of encumbrances. This Court finds that the appellant’s claim of error cannot be accepted because it is unfounded: the trial judge did not establish the easement through these proceedings, but merely acknowledged its existence as shown on the registered survey plan, which depicts a road described in that document as an agricultural easement (servidumbre agrícola). Indeed, it physically exists on the property, as indicated by the witnesses in the testimony of [Nombre7] and by the judicial inspection (reconocimiento judicial). Mentioning that easement in the survey plan and the appealed judgment does not establish it, because neither a registered survey plan nor proceedings of this nature constitute legally adequate grounds for bringing it into legal existence and deeming it established. For the reasons explained, the Public Registry must register the property as free of real-property encumbrances (cargas reales) with respect to third parties, while recording the cadastral information therein.
In relation to this issue, this Court ruled as follows in decision number 752, issued at 9 hours 3 minutes on 12 de agosto de 2010: “Article 379 of the Civil Code provides that discontinuous easements of every kind and continuous non-apparent easements may be established only by agreement or by last will, and possession, even from time immemorial, is insufficient to establish them. The conditions governing easements are determined by the instrument that created them, and real properties are presumed to be free of encumbrances unless the existence of an easement is proven otherwise (Articles 375 and 376 of the Civil Code). IV. In these possessory title proceedings, it can be seen that the submitted survey plan number ... indicates that, along the southern boundary of the land, a right-of-way easement is depicted that provides access to the public road; all adjoining landowners were notified and raised no objection to these proceedings.
The appealed decision states that the southern boundary adjoins ..., ..., with a right-of-way easement between them, and that the easement is not being established (see proven fact No. 1 and the operative portion). For the reasons explained, the appellant’s position is unfounded, because the trial judge did not establish the easement but merely acknowledged the existence of access to the public road and clarified that it was not being established. Such access physically exists on the property but has not been established as an easement through an appropriate legal instrument; therefore, the Public Registry must register the property as free of real-property encumbrances with respect to third parties, while recording the cadastral information therein. With respect to the modification of the southern boundary requested by the appellant, she is correct; therefore, the decision must be reversed solely in that respect, and the boundary must be stated as follows: South: [Nombre11] , [Nombre12] and [Nombre13] , with an access road to the public road between them .
This latter wording is required because the legal nature of such access is unknown.” (In this regard, decision 443-F-10 of this Court may be consulted.) The position expressed in the cited decision has been reiterated by this Court. With respect to the modification of the northern boundary requested by the appellant, the appellant is correct, and such modification is deemed appropriate because the referenced easement has not been established. Accordingly, the decision must be reversed solely with respect to that boundary, which must be stated as follows: North: [Nombre2] , [Nombre3] and [Nombre4] and not an agricultural easement. In all other respects challenged on appeal, the appealed decision is affirmed.
VII—For the reasons stated and pursuant to Articles 7 and 11, among others, of the Ley de Informaciones Posesorias and Articles 6, 26, 54 and 79 of the Ley de Jurisdicción Agraria, the decision must be partially reversed with respect to the northern boundary, so that it instead states that the property adjoins [Nombre2] , [Nombre3] and [Nombre4] , and the decision must be affirmed in all other respects challenged on appeal.
POR TANTO:
The decision is partially reversed solely with respect to the property’s northern boundary. Instead, it is stated that the northern boundary is [Nombre2] , [Nombre3] and [Nombre4] . In all other respects challenged on appeal, the appealed decision is affirmed.
[Nombre14] [Nombre15] [Nombre16] NOTE BY JUDGE [Nombre16] This note is submitted to indicate that the case under review does not concern public-domain property (bien demanial), as the appellant asserts solely because part of the property consists of woodland (montaña). It should be noted that the property measures diez hectáreas mil ciento cuatro metros con veinticuatro decímetros cuadrados; more than cincuenta por ciento of its area consists of brushland (charrales), and it also contains agricultural crops, such as corn on approximately una hectárea, according to the judicial inspection at folio 66. Moreover, the woodland said to exist there is neither primary forest nor located within any protected area. Most of the property is agricultural land and pastureland (repastos), and only a smaller percentage is forested area (área boscosa); consequently, it is not a primary forest of importance for aquifer recharge (recarga acuífera) supplying any population and therefore lacks the significant characteristic required for it to be deemed public-domain property.
Rather, it is a property with respect to which the title applicant (titulante) has been shown to have exercised acts of possession (actos posesorios). The property is predominantly agricultural in nature and is therefore not deemed public-domain property. Accordingly, I do not share the appellant’s arguments or the arguments set forth in the majority decision concerning reliance on Article 7 of the Ley de Información Posesoria to calculate the ten-year period in this matter. Because the property is predominantly agricultural in nature and contains secondary forest (bosque secundario), the ten-year possession period must be calculated under the principle of ordinary agrarian possession (posesión agraria simple), without any need to assess the rules governing forested land, for which possession and calculation of the ten-year period would differ if applied to the case under review.— [Nombre16] POSSESSORY TITLE PROCEEDINGS PETITIONER: [Nombre5] [Nombre17] /
VOTO Nº 0 438 - F -1 1 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las ocho horas tres minutos del nueve de mayo de l dos mil once .- INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor de edad, soltero en unión libre, vecino de Guayabo de Bagaces, Guanacaste, cédula CED1 – – . Intervienen la PROCURADURÍA GENERAL DE LA REPÚBLICA representado por licenciada Lydiana Rodríguez Paniagua en su condición de procuradora adjunta , y demás calidades desconocidas en autos ; así como el INSTITUTO DE DESARROLLO AGRARIO representada por Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecino de Escazú, cédula de identidad número CED2 - - . Actuó como apoderado especial judicial el Licenciado Melvin Lobo Palacios , mayor, soltero, abogado, vecino de Aguas Claras de Upala, cédula de identidad CED3 - - .-
RESULTANDO:
Redacta la Jueza Castro García; y,
CONSIDERANDO:
I.Se comparte el elenco de hechos probados 1, 3, 4 y 5 por tener buen sustento en los autos. Se omite pronunciamiento sobre los demás por no estar vinculados al objeto de esta apelación. De tal naturaleza se agrega en este sede: 11) El titulante ha ejercido la posesión mediante la protección del recurso forestal y lo ha dedicado a bosque y charral (certificado de uso de suelos a folio 6 y 7, declaraciones testimoniales folios 60 a 61, acta de reconocimiento judicial a folio 66).
II.La apelación es interpuesta por la licenciada Lydiana Rodríguez Paniagua en la condición de Procuradora Adjunta (folio 86). Como agravios contra la resolución de primera instancia expone: 1) que la sentencia tiene por acreditado que la finca a titular colinda por el rumbo norte con Servidumbre en medio de [Nombre2] , [Nombre3] y [Nombre4] . Argumenta, la Ley de Informaciones posesorias no es un mecanismo adecuado para constituir una servidumbre de paso y no se aportó ningún documento que comprobara la debida constitución del gravamen. Indicando que los bienes se presumen libres y que esta servidumbre solo puede ser creada por convenio de parte o testamento y que aún la posesión inmemorial no basta para establecerla, acorde con el ordinal 376 y 379 del Código Civil. P ide que sea rectificado el lindero este para que se indique que colinda únicamente con [Nombre2] , [Nombre3] y [Nombre4] y no con servidumbre en medio. 2) Consta en las manifestaciones del promovente, testimonio de escritura de traspaso, reconocimiento judicial practicado, certificado de uso de suelos, prueba testimonial, plano aportado y la misma sentencia impugnada, que la naturaleza del terreno es boscosa (montaña), los mismos por ubicarse en reservas nacionales están afectados a régimen de dominio público, Patrimonio Natural del Estado, desde la Ley Forestal 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y de carácter demanial que mantiene la Ley 7575, (artículos 13 y 14).
Indica que las declaraciones de los testigos no demuestran la posesión decenal necesaria para usucapir en cabeza del promovente. Argumenta, la Ley permite titular inmuebles fuera de las áreas silvestres protegidas si la promovente demuestra sus legítimos derechos de posesión decenal, con las demás condiciones exigidas al efecto, haber protegido el recurso y tener el inmueble debidamente deslindado. Lo anterior la lleva a concluir, que es posible titular si la usucapión se ha consolidado antes de ingresar por ley a Patrimonio Natural del Estado. Cita voto de la Sala Constitucional voto 4587-97, además esgrime los terrenos de bosques tienen una afectación inmediata por Ley a dominio público. Agravia, la declaración de los testigos no demuestran la posesión decenal apta para usucapir en cabeza de la promovente. Procede a citar precedentes jurisprudenciales y pronunciamientos emitidos por la Procuraduría General de la República, especificando los siguientes:
III- Sobre el agravio de la afectación al dominio público de bosques a perpetuidad. Respecto al tema de la posibilidad de los particulares de inscribir bienes cubiertos por bosques ubicados en terrenos no titulados, este Tribunal ha resuelto que si es posible titular terrenos no inscritos con cobertura forestal dentro o fuera de áreas silvestres protegidas, siempre y cuando se hubieran cumplido los requisitos legales exigidos en los diversos cuerpos normativos aplicables. A manera de ilustración se expone uno de los votos relevantes de esta Sede: " Relacionado con lo expuesto por la representación estatal, vinculada con el patrimonial forestal del estado, resulta oportuno hacer una breve referencia sobre el tema. Para ello, es oportuno citar el voto Nº51 de las 15 horas 15 minutos del 26 de mayo de 1995 de la Sala Primera de la Corte Suprema de Justicia, el cual en lo que interesa indica: " IX.- El patrimonio forestal del Estado incluye a todo el territorio nacional (artículos 4, 32 al 42), el cual a su vez se puede subdividir en tres áreas: A) La comprendida por el régimen forestal (artículos l, 2, 7, 47 a 54, 66 al 81) B) Los aprovechamientos forestales en terrenos de propiedad privada (artículos 43 al 46, 60 al 65, 82 al 91); y C) las reservas nacionales (artículos 32 y siguientes)......
En general esas reservas han tenido límites para poseerlas, así como límites -en cuanto a la superficie- para ser inscritas por medio de informaciones posesorias. .... XI.- En una posición diametralmente opuesta a la de las reservas nacionales se encuentra la de la propiedad privada, denominada en la ley como "Del aprovechamiento del recurso forestal en terrenos de propiedad privada". Estas tierras, por intereses de orden social, forman parte del patrimonio forestal del Estado. Esto es así porque los privados -funcionando bajo cualquier sistema (empresa agrícola o ganadera, para parcelación o colonización, tratándose de nacionales o extranjeros)- si dentro de sus planes de trabajo está la explotación forestal o la eliminación del bosque, en cualquier forma, deberán necesariamente obtener aprobación expresa de la Dirección General Forestal, en los términos de la Ley Forestal y del reglamento a la misma (artículo 60).
Por ello el patrimonio forestal del Estado es aplicable a todos los bienes nacionales donde existan recursos naturales forestales. Para poder explotar sus propios recursos maderables los privados deben elaborar planes técnicos forestales, y la dirección les otorgará concesiones a largo plazo (artículo 6l). Lo anterior implica un sometimiento voluntario al régimen forestal. Esta es una presunción legal pues resulta ser la única alternativa del privado quien se encuentra impedido para talar árboles, aprovechar o explotar los productos forestales, dentro de su mismo bien, si previamente no hay autorización de la Dirección General Forestal (artículo 63 y 65)..... De lo anterior se desprende, el patrimonio forestal del Estado, se trata de los inmuebles no sometidos a propiedad privada, no inscritos en el Registro Público de la Propiedad, en los términos de los artículos 267 y 486 del Código Civil, según la referencia que se hace sobre lo indicado por la Sala Constitucional de la Corte Suprema de Justicia.
Frente a este patrimonio, se encuentra también la propiedad privada. La cual a lo largo de la evolución de la legislación forestal se concedió la oportunidad a poseedores de fundos, que ya habían consolidado su derecho de propiedad por usucapión a titularlos. Esa posibilidad se da a través del cumplimiento de los requisitos de la Ley de Informaciones Posesorias, y por ello se autoriza de manera expresa a titular terrenos ubicados en áreas silvestres protegidas cualquiera que sea su categoría de manejo a obtener título inscribible en el Registro Público, al comprobar el titulante de una posesión de más de 10 años antes de la fecha de vigencia de la ley o decreto en que se cree tal área silvestre (artículo 1 y 7 de la Ley de Informaciones Posesorias). ( voto 100-F-09 del Tribunal Agrario). Y con respecto al carácter demanial de los bosques y la imposibilidad de titularlos mediante la Ley de Informaciones Posesorias, esta instancia ha declarado: “El Tribunal no comparte ese criterio, al estimar se dio una desafectación de dichos bienes con la entrada en vigencia de la Ley Forestal vigente, la cual reformó el artículo 7 de la Ley de Informaciones Posesorias.
Dicha norma, en lo referente a las propiedades con bosque, ubicadas fuera de las áreas silvestres protegidas, señala: "... Las fincas ubicadas fuera de esas áreas y que tengan bosques, sólo podrán ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios." La constitucionalidad de dicha norma y de la interpretación dada en algún momento por este Tribunal fue cuestionada de constitucionalidad, gestión que generó la emisión del voto de la Sala Constitucional 4587-97, precisamente citado por la recurrente. En dicho voto la Sala declaró la constitucionalidad de la norma, manteniendo su vigencia. Ante tal situación, lo procedente en este caso es confirmar lo resuelto por el Juzgador, al haber acreditado el promovente el cumplimiento de los requisitos que dispone ese artículo, a saber: la posesión decenal, protección del recurso natural y la delimitación del inmueble mediante cercas o carriles limpios”.
(Voto 573-F-09). De igual forma, la Sala Constitucional rechazó la consulta de constitucionalidad contra el artículo sétimo de la Ley de Informaciones Posesorias realizada por este Tribunal, que permite la titulación de fundos con cobertura boscosa ubicados dentro o fuera de áreas silvestres protegidas, bajo expediente EXPN1, quedando vigente tal norma y sus efectos.
IV- Sobre agravio de inalienabilidad del bosque y declaración de los testigos. Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad un terreno, sito en [Dirección6] , , del cantón treceavo Upala, de la provincia de Alajuela, según plano catastrado A- 1072503-2006 (folio 9), con un área de 10 hectáreas 1104 metros cuadrados con 24 decímetros cuadrados y con una naturaleza de montaña y charral ( plano catastrado a folio 9, estudio de suelos a folio 25 y reconocimiento judicial a folio 66). Tal inmueble no es parte de área silvestre protegida, conforme se indica en la certificación emitida por el Sistema Nacional de Áreas de Conservación aportada (folio 26). El estudio de suelos constante en autos (folio 6 y 7), menciona que se ha ejercido la posesión conforme a la capacidad del uso del suelo, estar dedicada a charrales y montaña y en las observaciones se indica que la finca se ha dedicado a la conservación, presencia de charrales viejoes en regeneración y en la recomendaciones se señaló que el terreno debía seguir siendo dedicado a fines de conservación debido a la naturaleza del recurso suelo y no utilizarla para explotación ganadera, mencionando que no se encontraron vestigios de dicha actividad en el inmueble.
Se practicó un reconocimiento judicial (folio 66) del inmueble, del que se levantó un acta en la que se anotó fue observado un terreno con amplia cobertura boscosa con especies forestales autóctonos de la zona, tales como l aurel, c edro, entre otros. En dicho bosque no se observó por el juzgador de instancia vestigios de tala de árboles. Se encontró la finca totalmente deslindada y cultivos de arroz en el sector central. Dentro del proceso, se recibieron declaraciones de [Nombre6] (folio 60) [Nombre7] (folio 60 vuelto) y [Nombre8] ( folio 61 vuelto y 62), quienes fueron contestes en afirmar conocer el fundo por un periodo mayor al plazo decenal exigido por ley: pues todos lo conocían desde hacía 40 años, 30 años y 27 años respectivamente. Manifestaron que la finca fue adquirida por el titulante de su padre [Nombre9] , los actos posesorios del promovente han consistido en el desarrollo de cultivo de frijol, tacotal y montaña, según señala el primer testigo citado, y tacotal y montaña según los otros deponentes.
Constatando esta instancia, que se ha probado la acreditación de la posesión decenal requerido para titular mediante estas diligencias, se rechaza el agravio referido a que los testigos no logran acreditar la posesión decenal apta para usucapir en cabeza del promovente, aunado a que la apelante no menciona los motivos de tal agravio en forma concreta. La apelante expresa su disconformidad, indicando que hay bosque en el inmueble. De los elementos citados se concluye que el terreno se encuentra cubierto por charrales y bosques, según se desprende del plano y reconocimiento judicial. No lleva razón la apelante cuando agravia de la imposibilidad de titular terrenos con cobertura forestal por formar parte del Patrimonio Natural del Estado. Lo afirmado, por cuanto el terreno se encuentra cubierto también de charrales también en un cincuenta por ciento de su área, según se desprende del estudio de suelos, y ser legalmente viable la titulación en dichos fundos boscosos, siempre y cuando se cumpla con los requisitos legales de las diversas normas jurídicas.
De lo arrojado por las declaraciones, el reconocimiento judicial y la certificación de suelos, se comprueba que en la finca existen charrales y bosques y se observa una actitud conservacionista por parte de la persona titulante en el ejercicio de la posesión, pues se ha dedicado la finca a fines de conservación y se ha protegido el recurso suelo. De acuerdo a lo anterior, esta instancia, no comparte lo señalado por la representante estatal, que el terreno al estar conteniendo bosques, forma parte del Patrimonio Natural del Estado. Disconformidad fundada en el artículo 856 del Código Civil, siendo un fundo apto para adquirir por usucapión, y el artículo 7 de la Ley de Informaciones Posesorias, según ya se razonó en esta resolución. Estima el Tribunal que efectivamente fue acreditado con la prueba aportada, el ejercicio de la posesión legítima y apta sobre el fundo, con más de diez años de antelación a la fecha en la que se promovieron estas diligencias, plazo que opera por encontrarse el fundo fuera de cualquier área silvestre protegida.
De igual forma, se acreditó el ejercicio de actos posesorios de conservación de los recursos naturales, pues se ha ejercido el uso de suelo acorde con la capacidad de tal recurso, por lo que se rechazan tales alegatos.
V- No lleva razón la apelante en sus agravios de la supervivencia del derecho derogado para regular las situaciones jurídicas que nacieron al amparo, indicando de la protección del derecho de dominio público forestal establecido por la legislación anterior contra aplicaciones retroactivas en su perjuicio, tal y como se motivó en el considerando tercero de esta resolución, este Tribunal estima que el artículo sétimo de la Ley de Informaciones Posesorias desafectó tal demanialidad y autorizó en forma expresa a particulares la posibilidad de titular terrenos con cobertura boscosa, siempre que sean cumplidos todos los requisitos legales y tal norma se encuentra en plena vigencia.
VI-Sobre la constitución de servidumbre. Establece el artículo 379 del Código Civil, las servidumbres discontinuas de toda clase y las continuas no aparentes, solo podrán ser constituidas por convenio o por última voluntad y la posesión, aún la inmemorial, no es suficiente para establecerlas. Las condiciones de las servidumbres son determinadas por el título que las creó y existe la presunción de que los inmuebles son libres salvo prueba en contrario sobre la existencia de la servidumbre (artículos 375 y 376 Código Civil). En estas diligencias de información posesoria, se observa que el plano aportado número A- 10772503 (folio 9), se observa en el lindero oeste del terreno, una servidumbre de paso que di s curre del derrotero 12 a 17 y del 18 al 36, que sirve de salida a la calle pública de otros fundos diversos al que se pretende titular. Al respecto los colindantes fueron notificados y no manifestaron ninguna oposición con respecto a estas diligencias, por lo que no existe objeción en cuanto a la servidumbre graficada en el plano base de estas diligencias.
La resolución apelada resuelve que la objeción de la apelante con respecto a la constitución de la servidumbre fue resuelto mediante resolución de las 14:04 horas del 7 de octubre del 2009, en donde se rechazó tal alegato al no afectar esta servidumbre al fundo a titular, sino a otro terreno de un tercero y consignarse lo que indica el plano catastrado. El aquo resuelve sobre este aspecto en la sentencia apelada, que el lindero norte es con servidumbre en medio de [Nombre10] y otros, sin que se mencione que se constituye tal gravamen a favor de un fundo dominante y en contra de uno sirviente, por lo que no debe entenderse que mediante este trámite se este constituyendo servidumbre. Además se ha señalado, que la finca se encuentra libre de gravámenes. Estima esta Sede, no es de recibo el agravio de la recurrente al no asistirle razón, pues el juez de primera instancia no constituyó la servidumbre mediante este proceso, sino que se limitó a acreditar la existencia de la misma según consta en el plano catastrado donde se grafica un camino descrito en dicho documento como servidumbre agrícola.
Pues tal, existe en la materialidad del fundo, tal como lo han señalado los testigos en sus deposiciones de [Nombre7] y el reconocimiento judicial. Con la mención de dicha servidumbre en el plano y la sentencia recurrida, no se constituye, pues un plano catastrado o unas diligencias de esta naturaleza, no son causas jurídicas idóneas para hacerla nacer a la vida jurídica y considerar se encuentre constituida. Por lo explicado, el Registro Público deberá inscribir el inmueble libre de cargas reales, para efectos de terceros, pero consignando la información catastral en el mismo. En relación a este tema este Tribunal resolvió por voto número 752 de las 9 horas 3 minutos del 12 de agosto de 2010 lo siguiente: "Establece el artículo 379 del Código Civil, las servidumbres discontinuas de toda clase y las continuas no aparentes, solo podrán ser constituidas por convenio o por última voluntad y la posesión, aún la inmemorial, no es suficiente para establecerlas.
Las condiciones de las servidumbres son determinadas por el título que las creó y existe la presunción de que los inmuebles son libres salvo prueba en contrario sobre la existencia de la servidumbre, (artículos 375 y 376 Código Civil). IV. En estas diligencias de información posesoria, se observa que el plano aportado número ..., se indica que el lindero sur del terreno, se observa graficado una servidumbre de paso que sirve de salida a la calle pública, todos los colindantes fueron notificados y no manifestaron ninguna oposición con respecto a estas diligencias. La resolución apelada resuelve que el lindero sur es con ..., ..., servidumbre de paso en medio, y que la misma no se esta constituyendo (véase hecho probado Nº1 y parte dispositiva). Por lo explicado, a la recurrente no le asiste razón, pues el juez de primera instancia no constituyó la servidumbre, sino que se limitó a acreditar la existencia de un acceso a la calle pública y aclaró que no se estaba constituyendo tal, mismo que existe en la materialidad del fundo, pero que no constituye como servidumbre en documento idóneo, por lo cual el Registro Público deberá inscribir el inmueble libre de cargas reales, para efectos de terceros, pero consignando la información catastral en el mismo.
Con respecto a la modificación del lindero sur solicitado por la apelante, lleva razón, por lo que deberá revocarse la resolución únicamente con respecto a éste, que debe indicarse de la siguiente manera: Sur: [Nombre11] , [Nombre12] y [Nombre13] , camino de acceso a calle pública en medio . Esto último al desconocerse la naturaleza Jurídica de dicho acceso." (al respecto puede ser consultado voto 443-F-10 de este Tribunal). La posición vertida en el voto citado ha sido reiterada en este Tribunal. Con respecto a la modificación del lindero norte solicitado por la apelante, lleva razón la apelante, y se estima procede tal modificación al no existir la constitución de la servidumbre indicada, por lo que deberá revocarse la resolución únicamente con respecto esa colindancia, que debe indicarse de la siguiente manera: Norte: [Nombre2] , [Nombre3] y [Nombre4] y no con servidumbre agrícola. En lo demás objeto de apelación, se confirma la resolución recurrida.
VI I - Por los motivos esgrimidos y con fundamento en los artículos 7 y 11, entre otros, de la Ley de Informaciones Posesorias y 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria, deberá revocarse parcialmente la resolución con respecto al lindero norte, para que en su lugar sea consignado que colinda con [Nombre2] , [Nombre3] y [Nombre4] , y confirmarse la resolución en lo apelado.
POR TANTO:
Se revoca parcialmente la resolución, únicamente con respecto al lindero norte del inmueble. En su lugar, se consigna que el lindero norte es [Nombre2] , [Nombre3] y [Nombre4] . En lo demás objeto de apelación, se confirma la resolución recurrida.
[Nombre14] [Nombre15] [Nombre16] NOTA EXPUESTA POR LA JUEZA [Nombre16] Esta nota se expone en en el sentido de indicar el caso bajo examen no es de naturaleza demanial como lo afirma la apelante por el solo hecho de que el inmueble cuenta con una parte de montaña. Nótese, el imueble tiene una medida de diez hectáreas mil ciento cuatro metros con veinticuatro decímetros cuadrados, es terreno de charrales en más del cincuenta por ciento de su cabida, también tienen cultivos agrícolas como maíz en una hectárea aproximadamente según reconocimiento judicial de folio 66, y la montaña que se indica existe no corresponde a un bosque primario o que esté dentro de alguna zona protegida. La mayor parte del mismo es de naturaleza agrícola, y de repastos, solo un porcentaje menor es área boscosa, de allí implica no es se trata de un bosque primario de importancia de recarga acuífera para abastecer a alguna población de allí no tenga esa relevante característica para que sea considerado un bien demanial.
Si no que se trata de un inmueble del cual se ha demostrado el ejercicio de actos posesorios por parte del titulante. La naturaleza del inmueble es predominantemente agrícola, de allí no se considere sea un bien demanial, por lo que no se comparte los argumentos de la apelante, y tampoco los expuestos en el voto de mayoría con relación a tomar como referencia el artículo 7 de la Ley de Información Posesoria para hacer el conteo del plazo decenal este tema, pues la naturaleza del inmueble es predominantemente agrícola con bosque secundario, por lo que el conteo de la posesión decenal lo es bajo la tesitura de la posesión agraria simple, sin ser necesario entrar a valorar normativa que regula terrenos boscosos, cuya posesión y conteo decenal sería diferente al aplicar al caso bajo examen.- [Nombre16] INFORMACIÓN POSESORIA PROMOVENTE: [Nombre5] [Nombre17] /
