JUDICIAL BRANCH CRIMINAL CASSATION COURT Decision: [Telf1] Case File: 07-001076-0597-PE(3) CRIMINAL CASSATION COURT. Second Judicial Circuit of San José. Goicoechea, at sixteen hours forty-five minutes, on veintiocho de abril de dos mil once.- APPEAL ON POINTS OF LAW (RECURSO DE CASACIÓN) filed in the present proceedings brought against [Nombre1],, of legal age, married, Costa Rican, CED1, a tour guide by occupation, born in Limón on 9 de noviembre de 1979, child of CED2, resident of CED2, for the offenses of VIOLATION OF THE LEY SOBRE LA ZONA MARÍTIMO TERRESTRE AND DISOBEDIENCE, to the detriment of THE LEY SOBRE LA ZONA MARÍTIMO TERRESTRE AND THE AUTHORITY. Judge [Nombre2] and associate judges Omar Vargas Rojas and Ronald Salazar Murillo participated in deciding the appeal. Attorney [Nombre3] appeared before this Court in his capacity as Public Defender for the accused.
PROCEDURAL BACKGROUND:
I.By judgment number 306-2010, issued at twelve hours forty minutes on quince de noviembre de dos mil diez, the Criminal Court of the First Judicial Circuit of the Atlantic Zone, Bribrí, ruled: “THEREFORE (POR TANTO): In accordance with the foregoing; Articles 39 and 41 of the Constitution; 1, 22, 30, 45, 59 through 63, 71, 76, and 307 of the Criminal Code; 12, 13, and 61 of the Ley Sobre la Zona Marítimo Terrestre; and 1, 140, 360, 361, 363, 364, 365, 366, and 367 of the Code of Criminal Procedure, O IS ACQUITTED OF ALL PENALTY AND LIABILITY for the offense of UNLAWFUL OCCUPATION OF PUBLIC-DOMAIN PROPERTY with which he had been charged to the detriment of the State. No special award of costs is entered. Furthermore, O, is found to be the Responsible Perpetrator of the offenses of VIOLATION OF THE LEY SOBRE LA ZONA MARÍTIMO TERRESTRE and DISOBEDIENCE with which he had been charged to the detriment of the Ley sobre la Zona Marítimo Terrestre and the Authority, respectively, and in that capacity he is sentenced to ONE MONTH OF IMPRISONMENT for the first offense and SIX MONTHS OF IMPRISONMENT for the second offense, which sentences, when served consecutively for separate offenses (Concurso Material), amount to SEVEN MONTHS OF IMPRISONMENT.
The sentence imposed shall be served, with credit for time spent in pretrial detention, in the manner and under the terms established by the Prison Regulations. For a term of three years, beginning when this judgment becomes final, the defendant is granted the Benefit of a Conditionally Suspended Sentence (Beneficio de Condena de Ejecución Condicional); accordingly, he is not required to serve the sentence imposed in prison, provided that during said term he does not commit a new intentional offense punishable by imprisonment for more than six months, in which event the benefit granted shall be revoked. He is ordered to pay the costs of the proceedings. The demolition of the structure erected by the defendant without the permits required by law is ordered. The costs of this demolition shall be borne by the convicted person. Once the judgment is final, it shall be entered in the Judicial Registry.- (sic).”
II.Attorney [Nombre3], in his capacity as Public Defender for the accused, filed an appeal on points of law against the foregoing ruling.
III.Following the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal on points of law.
Drafted by Cassation Judge [Nombre4]; and,
CONSIDERING:
I.The appeal on points of law meets the admissibility requirements established by Articles 437, 438, 439, 458, 459, and 460 of the Code of Criminal Procedure, and the issues raised shall therefore be decided.
II.In the first ground of appeal on points of law, the appellant alleges an erroneous application of substantive law (ley sustantiva). He argues that the offense of disobedience requires that the person ordered to comply be expressly and personally informed that failure to comply will result in criminal proceedings for disobedience being instituted against him. He states that, in this case, the issuance of such a warning was not established as a finding of fact (hecho acreditado), either in the relevant considering section or elsewhere in the judgment, and that the conduct established in the judgment therefore does not constitute an offense (es atípico). Position of the Procuraduría General de la República: At the oral hearing, criminal prosecutor Attorney [Nombre5] disputes the existence of the alleged defect. The appellant reads the judgment’s findings of fact (hechos probados) in isolation.
The administrative inspection record on folio 4 states that if construction was not halted, proceedings would be brought against him for the offense of disobedience, and the accused acknowledged his signature on the document, acknowledged that he had been warned, and disregarded the warning. Position of the Public Prosecution Service (Ministerio Público): At the oral hearing, the representative of the Ministerio Público, Attorney [Nombre6], opposes the appeal and states that defense counsel proceeds from the mistaken premise that the element allegedly missing from the findings of fact is an objective element of the statutory definition of the offense (tipo penal) of disobedience. The judge adequately found that the objective elements had been satisfied. An incidental element was omitted from the statement of facts, but the formal warning (apercibimiento) appears on folio 4. The mere fact that those elements are not stated in the findings of fact does not impair or prejudice the right of defense, because they were never challenged or disputed.
The ground is denied. For the offense of Disobedience of Authority to be established, the objective elements of the offense (elementos del tipo objetivo) must exist, namely: an order issued by a public official in the performance of official duties; an order that is clear, precise, directed to a specific person, and requires that person to act, refrain from acting, or deliver something; personal communication of the warning regarding the criminal-law consequences of noncompliance; and failure to comply with the order. The subjective element of the offense (elemento subjetivo del tipo penal) must also exist, namely, knowledge of the order and the intent not to comply with it. (Cf. judgments of this Chamber, 2006-9 of 20 de enero de 2006, [Telf2], of 10 de diciembre de 2004). In this case, the judgment analyzes and finds it established that on 08 de setiembre de 2007, [Nombre7] and [Nombre8], officials of the Ministerio del Ambiente, Energía y Telecomunicaciones, accompanied by [Nombre9], an officer of the Policía de Fronteras, served the accused with an order to halt the work he had been carrying out on the property in question so that, within a specified period, he could submit the legal documentation authorizing the construction; however, he disregarded that order (folios 185 verso and 186).
Folio 4 contains the warning issued to the accused, O, by a public authority acting in the performance of its duties, ordering him to halt all activities that had prompted the inspection by officials of the Sistema Nacional de Áreas de Conservación until he obtained the required permits. He was also warned there that, if he failed to comply with the order, he could be reported for the offense of disobedience of authority, punishable by imprisonment for up to one year pursuant to Article 305 of the Criminal Code. His signature appears at the bottom of the document, and the accused acknowledged it at trial (folio 136). The accused was therefore fully aware of the obligations imposed upon him and disregarded them, thereby satisfying the objective and subjective elements of the offense of disobedience of authority. A review of the Considering section concerning the findings of fact, subsection c), confirms that the accused was expressly, personally, and in writing warned that failure to comply with the order to halt the work would result in criminal proceedings being instituted against him for the offense of disobedience of authority.
Moreover, the intellectual reasoning (razonamiento intelectivo) set forth in the judgment demonstrates that the finding that the accused committed the criminal act was reached through a clear, complete, reasoned, and comprehensive assessment of the evidence, consistent with rational sound judgment (sana crítica racional). Thus, the essential objective and subjective elements of the aforementioned offense are described in the body of established facts, which correspond to those alleged in the charges, thereby safeguarding in the judgment the guarantee of proper notice of the charge (garantía de la imputación), which is fundamental to assessing compliance with the right of defense and, consequently, due process. Accordingly, this ground of the appeal is denied.
III.In the second ground, he alleges an erroneous application of substantive law in finding his client criminally responsible for the offense of Violation of the Law on the Maritime-Terrestrial Zone, even though the legally protected interest (bien jurídico tutelado) under that legislation was not affected, since the trial court itself acknowledges that, even before the creation of the Refugio de Vida Silvestre Gandoca-Manzanillo, the accused exercised possession (posesión) over the land, where he resided and paid municipal taxes. He argues that any failure in that regard is merely administrative in nature and concerns the requirements necessary for construction. He further argues that the law does not establish how the accused’s conduct could have infringed upon the area’s natural environment. He requests that the appeal be granted and that his client be released from all punishment and liability.
Position of the Procuraduría General de la República: The illegal construction is located in the maritime-terrestrial zone (zona marítimo terrestre), and therefore it is irrelevant whether it was within the wildlife refuge or whether possession of the property was exercised. Position of the Ministerio Público: It opposes the ground and states that the omission of construction permits is not what endangers the legally protected interest, but rather the violation of the maritime-terrestrial zone. The ground is denied. The Court acquitted the accused of the offense of usurpation of public-domain property (usurpación de bienes de dominio público), after concluding, in view of the particular characteristics of the Refugio de […], that at the time of the alleged acts the accused held possession of the land located within that Refugio, which was owned by the State, and therefore could not be deemed the perpetrator of the offense of usurpation of public-domain property.
This circumstance does not preclude a finding that, by erecting a building in the maritime-terrestrial zone located within that Refugio, at coordinates 398-399 and 610-611, he committed the offense of Violation of the Law on the Maritime-Terrestrial Zone, Article 62, because these are distinct, clearly differentiated acts that also infringe legally protected interests of a different nature. On the one hand, in the offense of usurpation of property, under any of the forms provided for in Article 225 of the Criminal Code, the conduct is directed toward interfering with another person’s right of possession (derecho de posesión), which did not occur in this case because the accused had already been exercising possession over the land and could not dispossess the State if he already held possession, whether partially or entirely. A different form of conduct is the unlawful act of erecting a building within the maritime-terrestrial zone, which is not negated merely because the accused exercised possession, since possessory rights (derecho posesorio) do not grant the inhabitants of this country any permission to build or undertake any type of development in the maritime-terrestrial zone contrary to the provisions of the law.
Pursuant to Article 1 of the Law on the Maritime-Terrestrial Zone, the maritime-terrestrial zone is public-domain property (bien de dominio público), title to which belongs to the State. It comprises the 200-meter-wide strip extending along the entire Atlantic and Pacific coastlines of the Republic, measured horizontally from the ordinary high-tide line (línea de la pleamar ordinaria); as well as the land and rocks exposed by the sea at low tide, islands, islets, and maritime rocks, and any land or natural formation rising above sea level within the territorial waters of the Republic, except for those islands whose ownership and administration are determined by the law itself and by other special laws, among them. As the trial judge correctly stated in the judgment: “…the Environment, which is the legally protected interest under Article 62 of the Law on the Maritime-Terrestrial Zone, because it protects the integrity of an area of special ecological importance, which was left completely unprotected and endangered because the accused had not conducted the environmental feasibility studies (estudios de viabilidad ambiental) necessary to determine that the construction would not harm its biodiversity, that the land use (uso del suelo) was permitted, or that the construction complied with the requirements imposed by law for its safety and that of its inhabitants…” (folio 192).
What is at issue is not the accused’s right of possession over the land on which he built the cabins, located within the maritime-terrestrial zone and also within the Refugio […], and for which he even paid municipal taxes, but rather the fact that he built in an area where construction is prohibited without the proper legal authorization. Contrary to the appellant’s assertion, the cited law establishes criminal penalties for the accused’s conduct, consisting of imprisonment for one month to three years; this is independent of any administrative liability that may apply, is neither contingent upon such liability nor mutually exclusive with it. Finally, regarding the defense’s argument that the law does not establish how the accused’s conduct could have infringed upon the area’s natural environment, it is not for this Chamber to opine on what the legislature should have included in the provision regulating the prohibition against building in the maritime-terrestrial zone; the judicial function (función jurisdiccional) is to apply the law.
In any event, the appellant’s argument is subjective and unfounded, since a simple reading of the provision is sufficient to conclude that the prohibition against building in the maritime-terrestrial zone does not require, as an element of the offense (configuración típica), any result or harm to the environment or natural surroundings. In view of the foregoing considerations, the ground is denied.
POR TANTO:
The appeal on points of law (recurso de casación) filed is denied. PODER JUDICIAL TRIBUNAL DE CASACIÓN PENAL Resolución: [Telf1] TRIBUNAL DE CASACIÓN PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las dieciséis horas cuarenta y cinco minutos, del veintiocho de abril de dos mil once.- RECURSO DE CASACIÓN interpuesto en la presente causa seguida contra [Nombre1],, mayor, casado, costarricense, CED1 de oficio Guía de turismo, nacido en Limón el 9 de noviembre de 1979, hijo de CED2 vecino de CED2 por el delito de INFRACCIÓN A LA LEY SOBRE LA ZONA MARÍTIMO TERRESTRE Y DESOBEDIENCIA, en perjuicio de LA LEY SOBRE LA ZONA MARÍTIMO TERRESTRE Y LA AUTORIDAD. Intervienen en la decisión del recurso, la jueza [Nombre2] , y los co-jueces Omar Vargas Rojas y Ronald Salazar Murillo. Se apersonó en esta sede el Licenciado [Nombre3] , en calidad de Defensor Público del encartado.
RESULTANDO:
I.Que mediante sentencia número 306-2010, de las doce horas cuarenta minutos, del quince de noviembre de dos mil diez, el Tribunal Penal del Primer Circuito Judicial de la Zona Atlántica, Bribrí, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política; 1, 22, 30, 45, 59 a 63, 71, 76 y 307 del Código Penal; 12, 13 y 61 de la Ley Sobre la Zona Marítimo Terrestre; 1, 140, 360, 361, 363, 364, 365, 366 y 367 del Código Procesal Penal, se ABSUELVE DE PENA Y RESPONSABILIDAD a O, del delito de USURPACIÓN DE BIENES DE DOMINIO PÚBLICO que en perjuicio del Estado se le venía atribuyendo. Se falla sin especial condenatoria en costas. Asimismo, se declara a O,, Autor Responsable de los delitos de INFRACCIÓN A LA LEY SOBRE LA ZONA MARÍTIMO TERRESTRE y DESOBEDIENCIA que en perjuicio de la Ley sobre la Zona Marítimo Terrestre y la Autoridad, respectivamente, se le venían atribuyendo y en tal carácter se le impone el tanto de UN MES DE PRISIÓN por el primer delito y SEIS MESES DE PRISIÓN por el segundo delito, penas que en Concurso Material, alcanzan el tanto de SIETE MESES DE PRISIÓN.
La pena impuesta la deberá cumplir, previo abono de la preventiva sufrida, en la forma y términos que determinen los Reglamentos Penitenciarios. Por término de tres años, que corre a partir de la firmeza de este fallo, se concede al justiciable el Beneficio de Condena de Ejecución Condicional, por lo que no está obligado a descontar en prisión la pena impuesta, siempre que en el plazo dicho no cometa nuevo delito doloso sancionado con pena de prisión mayor de seis meses, caso en el cual se revocará el beneficio concedido. Se le condena al pago de las costas del juicio. Se ordena la demolición de la construcción levantada por el justiciable sin los permisos de Ley. Los costos de esta demolición correrán a cuenta del sentenciado. Firme la sentencia inscríbase en el Registro Judicial.- (sic)".
II.Que contra el anterior pronunciamiento interpuso recurso de casación el Licenciado [Nombre3] , en calidad de Defensor Público del encartado.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de casación.
Redacta la Jueza de Casación [Nombre4] ; y,
CONSIDERANDO:
I.El recurso de casación reúne los requisitos de admisibilidad establecidos por los artículos 437, 438, 439, 458, 459 y 460 del Código Procesal Penal, entrándose a resolver los aspectos planteados.
II.En el primer motivo de casación, el recurrente reclama errónea aplicación de la ley sustantiva. Alega que el delito de desobediencia requiere que al conminado se le indique, expresa y personalmente, que su incumplimiento llevará a la instauración de un proceso penal por desobediencia en contra suyo. Dice que en este caso, la realización de dicha advertencia no fue un hecho acreditado ni en el considerando respectivo, ni en cualquier parte del fallo, por lo que lo probado en sentencia es atípico. Posición de la Procuraduría General de la República: El procurador penal, Licenciado [Nombre5] , en la audiencia oral se opone a la existencia del vicio alegado. El recurrente hace una lectura aislada de los hechos probados de la sentencia. En el acta de revisión administrativa de folio 4 se indica que de no paralizarse la construcción, se le seguiría causa por el delito de desobediencia y el encartado reconoció su firma en el documento, que se le previno e hizo caso omiso.
Posición del Ministerio Público: En la audiencia oral, el representante del Ministerio Público, Licenciado [Nombre6] , se opone y manifiesta que el defensor parte de la premisa errada, de que el elemento que se echa de menos en los hechos probados es un elemento objetivo del tipo penal de la desobediencia. Los elementos objetivos fueron adecuadamente relacionados por el juez como cumplidos. Hay un elemento accidental que se omitió en la relación de hechos, pero a folio 4 se obtiene el apercibimiento. No porque tales elementos no se digan en los hechos probados, hay afectación o se perjudica el derecho de defensa, porque nunca fueron cuestionados ni discutidos. Sin lugar el motivo. El delito de Desobediencia a la Autoridad para su configuración requiere de la existencia de los elementos del tipo objetivo, a saber, la existencia de una orden emanada de un funcionario público en el ejercicio de sus funciones, que sea clara, precisa y dirigida a un sujeto específico, imponiendo un hacer o no, o dar, debiendo ser comunicada en forma personal, la conminación sobre las consecuencias jurídico penales del incumplimiento, así como la omisión del cumplimiento de ésta.
También se requiere la existencia del elemento subjetivo del tipo penal, cual es el conocimiento de la orden y la voluntad de no cumplirla. (Cfr. sentencias de esta Cámara, 2006-9 de 20 de enero de 2006, [Telf2], de 10 de diciembre de 2004). En este caso, la sentencia analiza y tiene como hecho demostrado que el día 08 de setiembre de 2007, los señores [Nombre7] y [Nombre8] , funcionarios del Ministerio del Ambiente, Energía y Telecomunicaciones, en compañía de [Nombre9] , oficial de la Policía de Fronteras, procedieron a notificarle al imputado la orden de paralización de las labores que venía realizando en la propiedad en cuestión, a fin de que en un plazo definido presentara la documentación legal que permitiera efectuar la construcción, pero hizo caso omiso de dicha orden (folios 185 vto.y 186). A folio 4 se observa la prevención emanada de una autoridad pública en el ejercicio de sus funciones, al imputado O, de paralizar todos los actos que originaron la inspección de parte de los funcionarios del Sistema Nacional de Áreas de Conservación, hasta tanto cumpliera con los permisos requeridos.
Ahí también se le advirtió que si no respetaba la orden, podía ser denunciado por el delito de desobediencia a la autoridad, penado con prisión de hasta un año, conforme al artículo 305 del Código Penal. Al pie del documento está su firma, la que reconoció el acriminado en el debate (folio 136). De esta forma el imputado tenía pleno conocimiento de las obligaciones impuestas y las desatendió, concurriendo los elementos objetivos y subjetivos del delito de desobediencia a la autoridad. Un repaso del Considerando de hechos probados, acápite c), permite verificar la existencia de la advertencia expresa, escrita y personal al imputado, que el incumplimiento a la orden de paralización llevaría a la instauración de un proceso penal en su contra por el delito de desobediencia a la autoridad. Además, el razonamiento intelectivo expuesto en el fallo, muestra que la realización del hecho típico de parte del imputado, se obtiene a través de una valoración clara, completa, razonada e integral de la prueba, respetuosa de la sana crítica racional.
De modo que los elementos esenciales de la figura delictiva citada, tanto objetivos como subjetivos se encuentran descritos en el elenco de hechos acreditados, que guardan correlación con los que fueron acusados, resguardándose así en la sentencia la garantía de la imputación, que es fundamental para valorar el respeto al derecho de defensa y, consecuentemente, al debido proceso. Así las cosas, se rechaza este extremo del recurso.
III.En el segundo motivo, aduce errónea aplicación de la ley sustantiva al declararse a su defendido autor responsable del delito de Infracción a la Ley sobre la Zona Marítimo Terrestre, ello a pesar de que no se afectó el bien jurídico tutelado por dicha normativa, ya que el propio Tribunal sentenciador reconoce que, incluso antes de la creación del Refugio de Vida Silvestre Gandoca-Manzanillo, el encartado ejercía la posesión sobre el terreno, en el que habitaba y pagaba los impuestos municipales. Apunta que cualquier falla en ese sentido, no es más que de carácter administrativo, relacionada con los requisitos necesarios para la construcción. Además, que no establece la ley de qué forma la conducta del encartado pudo transgredir el entorno natural del área. Solicita se declare con lugar el recurso y se libere de toda pena y responsabilidad a su defendido. Posición de la Procuraduría General de la República: La construcción ilegal se da en la zona marítimo terrestre por lo que es irrelevante si estaba dentro del refugio o no, tampoco si se ejercía la posesión del inmueble.
Posición del Ministerio Público: Se opone al motivo y dice que la omisión de los permisos de construcción no es lo que pone en peligro el bien jurídico, sino la infracción a la zona marítimo terrestre. El motivo se declara sin lugar. El Tribunal absolvió al imputado por el delito de usurpación de bienes de dominio público, luego de concluir, en consideración a las particularidades del Refugio de […], que el encartado al momento de los hechos acusados ostentaba la posesión del terreno ubicado dentro del citado Refugio, propiedad del Estado, de tal suerte que no podía ser considerado autor del delito de usurpación de bienes de dominio público. Esta situación no excluye que levantando una edificación en la zona marítimo terrestre, ubicado dentro del citado Refugio, en las coordenadas 398-399 y 610-611, incurra en el delito de Infracción a la Ley sobre la Zona Marítimo Terrestre, artículo 62, porque se trata de acciones distintas, claramente diferenciadas, que además vulneran bienes jurídicos de diversa naturaleza.
Por una parte, en el delito de usurpación de bienes, en cualquiera de las modalidades previstas en el artículo 225 del Código Penal, la acción va dirigida a perturbar el derecho de posesión de otro, lo que no se da en este caso porque el encartado venía ejerciendo la posesión sobre el terreno y no puede despojarse de la posesión al Estado, si ésta ya se tiene, parcial o totalmente. Otra conducta es, la acción ilegítima de levantar una construcción dentro de la zona marítimo terrestre, que no hay razón alguna para que desaparezca por ejercer el imputado la posesión, porque el derecho posesorio no concede ningún permiso a los habitantes de este país para construir o realizar cualquier tipo de desarrollo en la zona marítimo terrestre contra lo dispuesto en las leyes. De conformidad con el numeral primero de la Ley sobre la Zona Marítimo Terrestre, la zona marítimo terrestre es un bien de dominio público, cuya titularidad corresponde al Estado.
Comprende la franja de 200 metros de ancho a todo lo largo de los litorales Atlántico y Pacífico de la República, medidos horizontalmente a partir de la línea de la pleamar ordinaria; así como los terrenos y rocas que deje el mar en descubierto en la marea baja, las islas, islotes y peñascos marítimos, así como toda tierra o formación natural que sobresalga del nivel del océano dentro del mar territorial de la República, con excepción de aquellas islas cuyo dominio y administración se determinen en la propia ley y en otras leyes especiales, entre ellas. Tal y como acertadamente señala la juzgadora en el fallo: “…el Ambiente, que es el bien jurídico tutelado por el numeral 62 de la Ley sobre la Zona Marítimo Terrestre, pues se tutela la integridad de una zona de especial importancia ecológica, que se vio totalmente desprotegida y amenazada por no haber, el imputado, efectuado los estudios de viabilidad ambiental que determinaran que esa construcción no iba a dañar su biodiversidad, ni que el uso del suelo estuviera dentro de lo permitido, tampoco que la construcción cumplía con los requisitos que exige la ley para su seguridad y la de sus habitantes…” (folio 192).
No está en discusión el derecho de posesión del imputado sobre el terreno en que construyó las cabinas, situado dentro de la zona marítimo terrestre, a la vez dentro del Refugio […] y por el que incluso pagaba impuestos municipales; sino el hecho de construir en un área donde es prohibido hacerlo sin la debida autorización legal. Contrario a lo apuntado por el recurrente, la citada ley señala sanciones penales para la conducta de imputado, con prisión de un mes a tres años; lo que es independiente de cualquier responsabilidad administrativa que pudiera caber, ni está sujeta a aquella ni es excluyente. Finalmente, respecto del alegato de la defensa, que la ley no establece de qué forma la conducta del encartado pudo transgredir el entorno natural del área, no compete a esta Cámara opinar sobre lo que el legislador debió incorporar dentro de la norma que regula la prohibición de construir en la zona marítimo terrestre, correspondiendo a la función juridiccional la aplicación de las leyes.
En todo caso, el argumento del impugnante es subjetivo e infundado, bastando con una simple lectura de la norma para concluir que la prohibición de construir en la zona marítimo terrestre no requiere para su configuración típica, de un resultado o daño al medio ambiente o al entorno natural. En virtud de las consideraciones anteriores, el motivo se declara sin lugar.
POR TANTO:
