Goicoechea, at fourteen hours twenty-five minutes on February third, two thousand eleven.- POSSESSORY INFORMATION PROCEEDINGS (INFORMACIÓN POSESORIA), filed by [Nombre1], of legal age, married once, holder of a bachelor’s degree in Environmental Management, resident of San Carlos, Alajuela, identity card CED1 - - . Participating in the proceedings are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, in her capacity as Deputy State Attorney, whose particulars are not recorded in the case file, and the INSTITUTO DE DESARROLLO AGRARIO, corporate identification number CED2 - - - , represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Guachipelín, Escazú, identity card CED3 - - , in her capacity as general attorney-in-fact for judicial proceedings. 5. In the processing of the case, the statutory requirements have been observed, and no errors or omissions capable of rendering the judgment null and void are apparent.
Drafted by Judge CHACON ACUÑA; and,
CONSIDERING:
I.The statement of proven facts contained in the appealed judgment is adopted because it reflects the evidence in the case file.-
II.The Deputy State Attorney appealed. As her sole ground for appeal, she contends that the ruling on the merits was premature because no judicial inspection (reconocimiento judicial) was conducted to verify the matters set forth in Article 7 of the Possessory Information Law (Ley de Informaciones Posesorias), even though the soil study indicated that part of the property consists of secondary forest (bosque secundario); the judgment should therefore duly establish protection of the forest in accordance with the second paragraph of the cited article.
III.The appellant is incorrect. Regarding the need to conduct a judicial inspection, although, as the State representative notes, the land-use study (estudio de uso de suelo) indicates that there is secondary forest at [Dirección5], it is no less true that the protection of that resource has been duly established in the case file. First, pursuant to Article 54 of the Agrarian Jurisdiction Law, concerning the free assessment of evidence (libre valoración de la prueba), the court below assesses as a whole the evidence submitted in the proceedings, particularly the Soil Study (Estudio de Suelos) (folio 9) and the testimony of [Nombre3] (folio 45), [Nombre4] (folio 46), and [Nombre5] (folio 56), all of which agree that the property currently consists of grazing land and has fruit trees such as guava, apple, and mango trees, and that along the boundary with [Dirección6] there is vegetation containing naturally occurring trees.
The Court therefore concludes, as did the court below, that a judicial inspection was unnecessary in this case, not only because of the size of the land but also because the property has continued to be used as grazing land, including the planting of fruit trees, together with the sustainable protection of the forest-cover areas (áreas de cobertura boscosa) adjoining the river that borders the property. Second, concerning the nature of the property, all the evidence in the case file must be considered and analyzed objectively to determine the property’s actual use. Contrary to what the State Attorney appears to assume, the term “secondary forest” should not be confused with either “mountain” or simply “forest,” since those concepts are not exactly synonymous. Regarding the definition of secondary forest, the Comisión Nacional de Certificación Forestal de Costa Rica defines the term as “... land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities or natural phenomena, having a minimum area of 0.5 ha and a density of no fewer than 500 trees per ha of all species.” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

Furthermore, Ley Forestal N. 7575, in Article 3, subsection d), defines forest as follows: “A native or indigenous ecosystem, whether disturbed or undisturbed, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than 70% of that area and containing more than sixty trees per hectare with a diameter of fifteen or more centimeters measured at breast height (DBH).” (Underlining and boldface not in the original). In the case at bar, it should be noted that the Cadastral Plan at issue in these proceedings indicates that the land is grazing land and has an area that does not even reach one hectare (10.000 m2) (folio 1); it is also located outside any protected wildlife area (área silvestre protegida) (MINAE certification at folio 4).
Furthermore, the report of the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (folio 9) indicates that the property is partly scrubland (charral) and partly secondary forest. Although the report notes that the property is bordered on the north by a river and lacks sufficient forest cover along that boundary, all the witnesses subsequently stated unanimously that “...the boundary with the Los Negritos River has vegetation containing naturally occurring trees...” and “the land is fenced along all its boundaries.” It may therefore be concluded that the title claimant has been promoting the recovery of forest cover in the river’s protective zone (zona protectora), which would constitute an area of secondary forest produced through natural regeneration (regeneración natural). Accordingly, in this Court’s view, possession has been exercised in accordance with the land use applicable to the activities conducted.
It follows from the foregoing that sustainable agro-environmental possession (posesión agroambiental sostenible), consistent with the requirements of Article 7 of the Possessory Information Law, has been exercised over the property to be titled, which is currently used as grazing land and includes an area of forest along the boundary with the [Dirección7] River. Thus, this is not merely land covered by scrubland and natural grass, but land also devoted to other sustainable productive activities, such as planting fruit trees and conserving the forest resource in the area designated for that purpose, thereby satisfying the requirements for its corresponding titling.-
POR TANTO:
As to the matters appealed, the judgment is affirmed. The judgment is supplemented to provide that the property remains subject to the reservations concerning rights-of-way (derechos de vía) for public roads established by Article 4 of the General Public Roads Law (Ley General de Caminos Públicos) and Article 19(a) of the Possessory Information Law.- [Nombre6] [Nombre7] LUIS ALONSO MADRIGAL PACHECO CASE FILE:EXPN1 POSSESSORY INFORMATION PROCEEDINGS PETITIONER: [Nombre1] D+G+V

RESULTANDO:
5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.
Redacta el juez CHACON ACUÑA, y ;
CONSIDERANDO:
I.Se prohija la relación de hechos probados contenidos en el fallo recurrido al ser reflejo de las probanzas constantes en autos.-
II.La Procuradora Adjunta apeló. Aduce, como único agravio, el dictado de la resolución de fondo es prematuro pues no se realizó un reconocimiento judicial para constatar los extremos del artículo 7 de la Ley de Informaciones Posesorias, a pesar de que el estudio de suelos indicó que parte de la naturaleza del inmueble es bosque secundario, debiendo quedar debidamente acreditado en sentencia la protección del bosque, en los términos del párrafo segundo del citado artículo.
III.No lleva razón la recurrente. En cuanto a la necesidad de practicar el reconocimiento judicial, si bien como apunta la representante estatal, en el estudio de uso de suelo se indica que el [Dirección5] hay bosque secundario, no menos cierto es que la protección de ese recurso ha quedado debidamente acreditada en autos. En primer término, de conformidad con el numeral artículo 54 de la Ley de Jurisdicción Agraria, referente a la libre valoración de la prueba, el a-quo aprecia en su conjunto los elementos traídos al proceso, y especialmente, el Estudio de Suelos (de folio 9), y la prueba testimonial de [Nombre3] (folio 45), [Nombre4] (a folio 46) y [Nombre5] (folio 56), las cuales coinciden en el sentido de que el fundo es actualmente de repastos y tiene árboles frutales tales como guayaba, manzana y mango, siendo que en la colindancia con el [Dirección6] existe vegetación con árboles naturales.
De ahí que el Tribunal concluya, al igual que lo hizo el a-quo, en este caso no era necesario practicar un reconocimiento judicial, no sólo atendiendo a razones de cabida del terreno sino también porque el destino dado al inmueble ha venido manteniéndose en su modalidad de repastos e incluso con siembra de árboles frutales aunado a una protección sostenible de las áreas de cobertura boscosa anexas al río colindante con el fundo. En segundo lugar, en lo tocante a la naturaleza del inmueble, deben tomarse en consideración todos los elementos constantes en autos, y analizarse de una manera objetiva, para determinar cuál es la verdadera dedicación del fundo. No se debe confundir, como parece asumirlo la procuradora, el término "bosque secundario" sea con "montaña" o bien sencillamente con "bosque", pues ambos conceptos no resultan precisamente sinónimos. Sobre la definición de bosque secundario, la Comisión Nacional de Certificación Forestal de Costa Rica precisa el término como “... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies." (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

Por otra parte, la Ley Forestal N. 7575, en su numeral 3, acápite d) define bosque de la siguiente forma: "Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del 70% de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho (DAP)". (Subrayado y negrilla no son del original). En el subjúdice, nótese en el Plano Catastrado objeto de estas diligencias, se indica el terreno es de repastos y presenta una cabida que no llega ni siquiera a una hectárea (10.000 m2) (folio 1), a su vez se encuentra fuera de cualquier área silvestre protegida (certificación del MINAE a folio 4).
Por otra parte del informe del Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (folio 9), se extrae que el fundo es parte charral y parte bosque secundario, si bien en el informe se indica como observación el fundo colinda al norte con un río y en esa colindancia no tiene suficiente cobertura boscosa, posteriormente todos los testigos fueron unánimes en sus declaraciones al indicar "...la colindancia con el río Los Negritos tiene vegetación con árboles naturales...", y "el terreno está cercado en todas sus colindancias" de manera que es dable concluir el titulante ha venido promoviendo la recuperación de la cobertura boscosa en la zona protectora del río, siendo que se trataría de un sector de bosque secundario mediante regeneración natural, por lo cual en criterio de este Tribunal la posesión se ha ejercicio conforme con el uso del suelo para las actividades desarrolladas.
De lo anterior se infiere, en el fundo a titular, siendo destinado actualmente a repastos y con una parte de bosque en la colindancia con el río [Dirección7] , se ha dado una posesión agroambiental sostenible, acorde con las exigencias del artículo 7 de la Ley de Informaciones Posesorias. Ergo, no se trata sólo de un terreno cubierto de charral y pasto natural, sino también dedicado a otras actividades productivas sostenibles tales como la siembra de árboles frutales y conservación del recurso forestal en el área destinada para ello, con lo cual se cumplen los requisitos necesarios para su respectiva titulación.-
POR TANTO:
En lo apelado se confirma la sentencia. Se adiciona el fallo en cuanto a que el inmueble queda afecto a las reservas en cuanto a derechos de vía de las calles públicas que dispone el artículo 4 de la Ley General de Caminos Públicos y 19 inciso a de la Ley de Informaciones Posesorias.- [Nombre6] [Nombre7] LUIS ALONSO MADRIGAL PACHECO INFORMACIÓN POSESORIA PROMOVENTE: [Nombre1] D+G+V
