Res: 2011-021 Res: 2011-021 Criminal Cassation Court of Cartago. At fifteen hundred hours on treinta y uno de enero de dos mil once.

Appeal in cassation (recurso de casación) filed in the present proceedings brought against [Nombre1]., of legal age, married, born on […], for the offenses of Encroachment upon Protection Areas, Illegal Logging, and Land-Use Change (Cambio de uso de Suelo), to the detriment of Natural Resources. Judges [Nombre2], Guillermo Sojo Picado, and [Nombre3] participated in deciding the appeal. Licenciada [Nombre4], acting as public defender for the accused, and Licenciado [Nombre5], representative of the Ministerio Público, entered appearances in the cassation proceedings.

Findings:

1. By judgment No. 123-2010, issued at nine hundred hours on treinta y uno de mayo de dos mil diez, the Trial Court of the Southern Zone, Pérez Zeledón seat, ruled: “POR TANTO: In accordance with the foregoing, the cited provisions, and Articles 39 and 41 of the Political Constitution; 1, 11, 30, 45, 50, 59 to 63, 71, and 103 of the Criminal Code; Articles 1, 5, 6, 16, 37, 38, 40, 111, 116, 140, 265 to 267, 341 to 365, 367, and 368 of the Code of Criminal Procedure; and Articles 33, 58 subsection a), and 61 subsections a) and c) of the current Ley Forestal, [Nombre1]. is hereby found to be the RESPONSIBLE PRINCIPAL OFFENDER of one offense of Encroachment upon a Protection Area, one offense of Illegal Logging, and one offense of Land-Use Change, and is sentenced to SIX MONTHS’ IMPRISONMENT for the first offense, TWO MONTHS’ IMPRISONMENT for the second offense, and SIX MONTHS’ IMPRISONMENT for the third offense, for a total sentence of ONE YEAR AND TWO MONTHS’ IMPRISONMENT, against which time spent in pretrial detention shall be credited. Because the accused meets the applicable requirements, he is granted the BENEFIT OF SUSPENDED EXECUTION OF SENTENCE, with a probationary period of FIVE YEARS, during which he shall comply with the following conditions: a) he shall not commit a new intentional offense punishable by more than six months’ imprisonment; b) he shall allow the affected area—both the protection areas of the streams and the zone in which the land-use change occurred—to regenerate naturally. Verification of compliance with the latter condition shall be entrusted to MINAE personnel. The accused is hereby advised that, should he fail to comply with the imposed conditions, the benefit now granted to him shall be revoked and he shall serve the imposed sentence. The civil action for damages (acción civil resarcitoria) brought by the State against [Nombre1]. is hereby GRANTED; consequently, the latter is ordered to pay the State, as compensation for the environmental damage caused, the sum of ONE MILLION NINE HUNDRED SEVENTY THOUSAND THREE HUNDRED FIFTY-EIGHT COLONES. The request for an order requiring the destruction of the house built on the accused’s property is denied. The costs of the criminal action shall be borne by the State, and both sets of costs arising from the civil action for damages shall be borne by the civil defendant. Once this judgment becomes final, it shall be entered in the Judicial Registry and the corresponding certified copies of the judgment shall be issued. (s) Francisco Sánchez Fallas. JUDGE.” (sic)

2. Licenciada [Nombre4] filed an appeal in cassation against the foregoing ruling.

3. Following the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.

4. The relevant legal requirements have been observed in the proceedings.

Judge [Nombre6] drafts the opinion; and,

Considerations:

I.The appeal in cassation meets the requirements established by sections 437, 458, 459, and 460 of the Code of Criminal Procedure; accordingly, its grounds shall be considered.

II- In her first ground, the public defender of the accused, [Nombre1]., Licenciada [Nombre4], alleges the absence of a precise and detailed account of the punishable act (hecho punible) found proven in the judgment and a violation of the right of defense. After transcribing the alleged facts, she states that the charge places the events in time before diez de octubre de 2005, specifically the clearing (socola) of low-growing and understory vegetation affecting the streams’ protection areas. It then places the land-use change and the cutting and harvesting of trees within a period identified solely by the word “subsequently,” a term which, in her view, is overly broad and does not result in a clear and precise charge. She states that she disagrees with the trial judge’s determination that the charge is neither imprecise nor prejudicial to the right of defense. She requests that the judgment be vacated and the case remanded.

The claim is denied. According to the appealed judgment, the alleged facts were as follows: “1. The defendant, [Nombre1]., owns a property located in […]. 2.- In the year dos mil cinco, before diez de octure de dos mil cinco, at an unspecified time, the defendant, [Nombre1]., without authorization from the Forestry Administration, proceeded to remove completely, by brush-cutting (chapea) or clearing, the low-growing or understory vegetation of smaller diameters surrounding larger trees. By carrying out this clearing, the defendant encroached upon the protection areas of four streams; from three of them, he removed the vegetation on both banks of the stream for a distance of trescientos metros, leaving them entirely unprotected, and from the fourth stream, he removed the understory vegetation from one bank for a distance of trescientos metros. The defendant also removed the existing smaller vegetation from three springs (nacientes). 3.- Subsequently, the defendant, [Nombre1]., planted grass known as Gamalote in the cleared area.

In addition, the defendant felled one tree of the cedro dulce species and one tree of the Ira species, from which seis metros were harvested, given that three logs measuring 3,5 metros in length by 46 centímetros in diameter were cut, another log measuring 3,5 metros in length by 46 centímetros in diameter, another log measuring 3,5 metros in length by cuarenta centímetros in diameter, and another measuring 3,5 metros in length by cuarenta centímetros in diameter; these events occurred on the property owned by the defendant and located in […].” (folios 221-222). In essence, these same facts are alleged in the private criminal complaint (querella) filed by the Procuraduría General de la República. This Chamber does not find the statement of facts imprecise or unclear as to when the events occurred. Note that it states that the removal of low-growing or understory vegetation from the protection areas of four streams occurred in 2005 before diez de octubre.

Logically, the charge then states that the planting of the grass known as Gamalote—specifically in the cleared area—and the cutting of the trees occurred “subsequently.” The act of clearing must necessarily precede the planting of Gamalote and the land-use change. Moreover, it must be stated that merely alleging defects in the charge is insufficient for such defects to be declared; rather, the defense must demonstrate how its defense strategy or its opportunity to offer evidence was affected by the failure to specify an exact date in the charge, which, in any event, will generally be nearly impossible in cases involving facts such as those at issue here. Accordingly, this ground must be rejected.

III- In its second ground, the defense alleges the erroneous application of substantive law. Violation of the harm principle (principio de lesividad) insofar as the protected legal interest (bien jurídico) was not affected in connection with the offense of land-use change (cambio de uso del suelo). It argues that the testimony of the witnesses [Nombre7]. and the expert witness [Nombre8]. made it clear that, for thirty years, underbrush had been cleared (socolaba) and the pastures had been cut back on that property. According to the expert witness, since 1970 that property had already been disturbed primary forest, meaning that timber was extracted, but it was not pastureland. He stated that the expert report established that timber had been extracted since 1970 and that this had been the normal use of the property, and he therefore found it striking that land-use change was being discussed.

The defense considers that the protected legal interest was not affected because the management of the property is no different from its historical management. It contends that the action is not materially unlawful (antijurídica materialmente). It adds that the trial judge did not state the grounds for his judgment on that issue. The claim is denied. The judgment adequately explains the reasons why, notwithstanding the statements of witness [Nombre7]. and expert witness [Nombre8]., it was determined that the vegetation adjacent to the streams had indeed been cleared and that a land-use change had occurred through the planting of the grass known as gamalote. In that regard, the judgment states: “Furthermore, although it is true that the defense witness, [Nombre7]., was heard at trial and stated that he had worked since the 1980s on the property that now belongs to the accused, and that since then he had carried out work involving gamalote grass because the previous owners had established some pastures, that circumstance in no way rules out the possibility that, in the specific area observed by MINAE officials during their inspections, the accused had also ordered the clearing of the understory (sotobosque) and the change in the designated use of those areas by also planting grass of the same gamalote species: witness [Nombre7]. does not specify precisely which areas of the property were planted with grass thirty years ago; consequently, the information he provided in no way rules out the clearing and grass-planting work observed by MINAE officials.

It is important to note that MINAE officials were clear that the grass being planted in octubre del 2005 could not be the same grass planted on that property so many years earlier by witness [Nombre7]., because those officials described the removal of vegetation characteristic not of grasslands but of understory, such as the vines, heliconias, and palm plants described in the inspection report on folio 6. Furthermore, the information provided by the defense expert witness, biologist [Nombre8]., does not in any way refute what MINAE officials observed, as the expert himself acknowledges; rather, he merely concludes that any impact that may have occurred at the site was not significant because, in his view, the area was well preserved by 2010 and the streams located on the property had not been affected. The basis on which this expert states that the streams were not affected is unknown, because he has no data regarding the flow of the streams in 2005 that could be compared with the flow observed in 2010.

Offenses affecting the environment, such as those provided for in the Ley Forestal, are endangerment offenses (delitos de peligro), which do not necessarily require a measurable environmental impact to be established for the offenses to be made out, because alterations to the ecosystem in their various forms will, in many cases over the long term, cause irreversible environmental damage, which is more evident today than ever, when the alterations caused by pollution are continually discussed and written about” (folios 236-237). This Chamber fully concurs with the conclusions of the court below (a quo). Indeed, the fact that the previous owners of the property had for many years carried out underbrush-clearing and grass-planting activities in protection areas (áreas de protección) cannot in any way negate either the statutory elements (tipicidad) or the unlawfulness (antijuridicidad) of the conduct.

Both the prior acts that were not reported at the time and those committed by the accused constitute the offenses of Encroachment upon a Protection Zone (Invasión de Zona Protectora) and Land-Use Change (Cambio de Uso del Suelo). Furthermore, as the judgment states, the offenses established in the Ley Forestal protect the environment, which is altered by any change to the ecosystem—cutting down a tree, removing vegetation from a protection area, or killing a wild animal—and all the more so in this case, in which four streams connected to the operation of the water-supply system serving the community of San Antonio de Mollejones were affected (folio 238). The conduct is therefore materially unlawful because it causes environmental harm, which cannot be regarded as insignificant, as the appellant contends.

IV- In its third ground, the defense alleges a failure to state grounds concerning the offense of affecting the protection areas of four streams. It contends that the Trial Court did not give due weight to expert witness [Nombre8].’s statement that any impact that may have occurred at the site was not significant because, by 2010, the area was well preserved. It argues that the Trial Court reached a biased conclusion by stating that the expert could not express an opinion because he lacked data concerning the flow of the streams at the time of the offense. The claim is denied. As stated in addressing the preceding ground, the Trial Court did provide the reasons why environmental harm occurred, particularly with respect to the streams along whose banks the accused cut the vegetation. As may be inferred from the judgment, expert witness [Nombre8]. stated: “I cannot say that nothing happened there or contradict the MINAE officials, but if something did happen, it was harmless because the area is homogeneous; if there was damage, it does not persist today, and even the bodies of water have been preserved and remain in place.” Although the expert sought to minimize the environmental damage, the fact remains that he himself stated that he could not know whether that damage occurred in 2005, since his observation was conducted in 2010.

Furthermore, as the Trial Court explained, these environmental offenses are abstract-endangerment offenses (delitos de peligro abstracto), so proof of specific environmental damage—and, in this case, damage to the streams—is not required. In any event, according to the environmental-damage expert report submitted by MINAE and assessed by the Trial Court in determining the amount of damages to be paid by the accused (folios 18 to 27), damage did occur. The report states that an impact on this type of forest fragments the habitat of wild species; reduces its biogenetic capacity and its regulation of the local and global microclimate; and reduces carbon-dioxide capture and the retention of surface water. Accordingly, this ground must be rejected.

V- In its fourth ground, the defense alleges a violation of the rules of reasoned judgment (sana crítica), logic, and the principle of derivation (principio de derivación) with respect to the sole conclusion that the accused changed the land use in the affected area. It contends that the conclusion reached by the trial judge is not the only one that can logically be derived from the evidence received and set forth in the judgment. It argues that the Judge himself stated that witness [Nombre7].’s testimony did not rule out the possibility that the accused had changed the land use, despite the witness’s assertion that, since the 1980s, the land had been worked by other owners through the planting of gamalote grass. According to the defense, that assertion could have supported the conclusion that the land use in the sector identified by MINAE officials had already been changed. The claim is denied.

The judgment clearly explains that, although witness [Nombre7]. stated in his testimony that gamalote grass had been planted on that property since the 1980s, MINAE officials were clear that the grass being planted in octubre de 2005 was not the same grass that witness [Nombre7]. had planted so many years earlier, because the officials described the removal of vegetation characteristic not of grasslands but of understory, such as the vines, heliconias, and palm plants described in the inspection report on folio 6 (folio 236). Furthermore, it is clear from the testimony of officials M. and O., transcribed in the judgment, that both observed the accused’s workers planting gamalote grass, and that the accused himself subsequently arrived (folios 225-226). They also observed that the planted grass was recent because its roots had not taken hold in the soil. Accordingly, the conclusion reached by the Trial Court can be derived from the evidence received and does not violate the rules of reasoned judgment.

VI- In its fifth ground, the defense alleges insufficient grounds for the sentence imposed. It states that the Trial Court imposed a sentence of one year and two months’ imprisonment. It argues that the reasons given by the trial judge for not imposing the minimum sentence for each offense are inherent elements of the offense itself. It further argues that the Trial Court did not consider factors such as the accused’s lack of prior convictions, the fact that the environmental damage was almost imperceptible, and the occurrence of adequate forest regeneration. The claim is denied. Regarding the imposition of the sentence, the judgment states: “The offense of Encroachment upon a Protection Area (Invasión de Área de Protección) is punishable under section 58(a) of the Ley Forestal by three months to three years’ imprisonment. Taking into account that, according to MINAE personnel, the protection areas of four streams were affected over a substantial area, specifically approximately 300 meters along the streams, a sentence of SIX MONTHS’ IMPRISONMENT is imposed.

The offense of Illegal Logging (Tala Ilegal) is punishable under section 61(a) of the same law by one month to three years’ imprisonment. A sentence of TWO MONTHS’ IMPRISONMENT is imposed for that offense, taking into account that the two felled trees were located in an aquifer recharge area (área de recarga acuífera) supplying a water system for human use. The offense of Land-Use Change is punishable under subsection (c) of the same section 61 by one month to three years’ imprisonment. A sentence of SIX MONTHS’ IMPRISONMENT is imposed for that offense, taking into account that the area affected by that action is extensive, consisting of approximately eight hectares” (folios 238-239). As may be inferred from the foregoing, the judgment considered the severity of the damage caused when determining the sentence. In this case, the relevant factors were the impact on four streams, the size of the disturbed area—eight hectares—and the fact that those streams feed an aquifer that supports a water-supply system for human use.

In this Chamber’s judgment, there was no double assessment of the elements of the offense, because it is the seriousness of the act—the number of streams affected, the size of the area cleared, and the function of those streams—that warrants a sentence above the minimum, which is also proportionate given that the accused has no prior record. Section 71 of the Criminal Code does not require each and every circumstance listed therein to be assessed, but only those circumstances that are essential to justify a proportionate sentence. For the foregoing reasons, this ground is rejected.

Therefore:

The appeal on points of law (recurso de casación) filed by the public defense counsel for the accused, [Nombre1]., is denied. NOTICE SHALL BE GIVEN.

Resultando:

1. Que mediante sentencia No. 123-2010 de las nueve horas del treinta y uno de mayo de dos mil diez, el Tribunal de Juicio de la zona sur sede Pérez Zeledón, resolvió: "POR TANTO: De conformidad con lo expuesto, normativa citada y artículos 39 y 41 de la Constitución Política; 1, 11, 30, 45, 50, 59 a 63, 71 y 103 del Código Penal; artículos 1, 5, 6, 16, 37, 38, 40, 111, 116, 140, 265 a 267, 341 a 365, 367 y 368 del Código Procesal Penal, y artículos 33, 58 inciso a) y 61 incisos a) y c) de la Ley Forestal vigente, se declara [Nombre1]. como AUTOR RESPONSABLE de un delito de Invasión de Área de Protección, un delito de Tala Ilegal y un delito de Cambio de Uso del Suelo, y se le impone por el primer delito el tanto de SEIS MESES DE PRISIÓN, por el segundo delito el tanto de DOS MESES DE PRISIÓN y por el tercer delito el tanto de SEIS MESES DE PRISIÓN, para una pena total de UN AÑO Y DOS MESES DE PRISIÓN, que deberá descontar previo abono de la preventiva sufrida. Por reunir los requisitos para ello, se concede al acusado el BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA, fijándose el período de prueba en CINCO AÑOS, lapso durante el cual deberá el acusado cumplir con las siguientes condiciones: a) no cometer nuevo delito doloso sancionado con pena superior a los seis de prisión; b) deberá dejar que el área afectada, tanto las áreas de protección de las quebradas, como la zona en la cual se hizo el cambio de uso de suelo, se regeneren de forma natural. La verificación del cumplimiento de la última condición quedará a cargo de los personeros del MINAE. Se le hace saber al acusado que en caso de incumplir con las condiciones impuestas, se le revocará el beneficio que ahora se le concede, y deberá cumplir la pena impuesta. Se declara CON LUGAR la acción civil resarcitoria establecida por El Estado contra [Nombre1]., y en consecuencia se condena a este último a pagar al Estado, por concepto de daño ambiental causado la suma de UN MILLON NOVECIENTOS SETENTA MIL TRESCIENTOS CINCUENTA Y OCHO COLONES. No ha lugar a ordenar la destrucción de la casa construída en la propiedad del acusado. Son las costas de la acción penal a cargo del Estado, y ambas costas de la acción civil resarcitoria a cargo del demandado civil. Una vez firme inscríbase en el Registro Judicial y expídanse los respectivos testimonios de sentencia.(f) Francisco Sánchez Fallas. JUEZ." (sic)

2. Que contra el anterior pronunciamiento, la licenciada [Nombre4] interpuso el recurso de casación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez [Nombre6] , y;

Considerando:

I.El recurso de casación reúne los requisitos establecidos por los numerales 437, 458, 459, 460 del Código Procesal Penal por lo que se entra a conocer de sus motivos.

II- En su primer motivo la defensora pública del imputado [Nombre1]., Licenciada [Nombre4] , aduce falta de relación precisa y circunstanciada del hecho punible tenido por demostrado en la sentencia y violación al derecho de defensa. Luego de transcribir los hechos acusados, indica que la imputación ubica los hechos temporalmente con anterioridad al diez de octubre de 2005, específicamente la socola de la vegetación baja y de sotobosque afectando el área de protección de las quebradas. Luego ubica el cambio de uso de suelo, la corta y aprovechamiento de árboles, en un espacio temporal donde se enuncia únicamente la palabra "posteriormente", término que a su juicio es demasiado amplio y no produce una imputación clara y precisa. Aduce que no comparte la decisión del juzgador en el sentido de que tal acusación no es imprecisa ni afecta el derecho de defensa. Solicita la nulidad del fallo y el reenvío correspondiente.

Sin lugar el reclamo. Según consta en el fallo recurrido los hechos acusados fueron los siguientes: "1.El encartado [Nombre1]., es propietario de una finca ubicada en la […]. 2.- En el año dos mil cinco anterioridad al diez de octure de dos mil cinco sin precisar la hora exacta el encartado [Nombre1]., sin contar con el permiso de la Administración Forestal procedió a eliminar totalmente mediante chapea o socola la vegetación baja o sotobosque de diámetros menores que se encontraban rodando árboles de mayor grosor, con la realización de esta socola el encartado invadió el área de protección de cuatro quebradas, de tres de ellas les eliminó su vegetación en ambas márgenes de la quebrada a lo largo de trescientos metros, dejándolos desprotegidas por completo y a la cuarta quebrada le eliminó el sotobosque en uno de sus márgenes a lo largo de trescientos metros, siendo que también el encartado eliminó la vegetación menor existente de tres nacientes. 3.- Posteriormente el encartado [Nombre1]. sembró pasto conocido como Gamalote en el área socolada, siendo que además el encartado taló un árbol de la especie cedro dulce y un árbol de la especie Ira, del mismo se aprovecharon seis metros, toda vez que se realizaron tres trozas de 3,5 metros de largo por 46 centímetros de diámetro, otra troza de 3,5 metros de largo por 46 centímetros de diámetro, otra troza de 3,5 metros de largo por cuarenta centímetros de diámetro y otra de 3,5 metros de largo por cuarenta centímetros de diámetros, hechos ocurrido en la finca propiedad del encartado ubicada en la […]." (folios 221-222).

Estos mismos hechos en esencia son los querellados por la Procuraduría General de la República. No encuentra ésta Cámara que la relación de hechos sea imprecisa o poco clara en cuanto al tiempo en que ocurren los hechos. Nótese que se indica que en el año 2005 antes del diez de octubre es que ocurre la eliminación de la vegetación baja o sotobosque de las áreas de protección de cuatro quebradas. Luego como es lógico, la acusación indica que "posteriormente", es que se produce la siembra del pasto conocido como Gamalote, precisamente en la zona en el área socolada, y la corta de los árboles. La acción de socola necesariamente debe preceder a la acción de siembra del gamalote y el cambio de uso del suelo. Por otro lado debe decirse que no basta con alegar defectos en la imputación para que éstos sean declarados, sino que debe la defensa demostrar en qué sentido se le afectó su estrategia de defensa, su oportunidad de ofrecer pruebas, por el hecho de que no se le indique una fecha exacta en la acusación, lo que en todo caso, generalmente va a resultar casi imposible en hechos como el presente. Por ende, el motivo debe rechazarse.

III- En su segundo motivo, la defensa alega errónea aplicación de la ley sustantiva. Violación al principio de lesividad en cuanto a la no afectación del bien jurídico en relación al delito de cambio de uso del suelo. Arguye que con la declaración de los testigos [Nombre7]. y el perito [Nombre8]., quedó claro que en esa finca desde hace treinta años se socolaba, se chapeaban los potreros. Que según el perito, desde 1970 esa finca ya era bosque primario intervenido, es decir se sacaba madera pero no es potrero. Indicó que el peritaje estableció que desde 1970 se saca madera, ha sido el uso normal de la finca, por lo que le llama la atención que se hable de cambio de uso del suelo. Estima la defensa que no hay afectación al bien jurídico tutelado, ya que el manejo de la finca no es distinto al que históricamente ha tenido. Aduce que la acción no es antijurídica materialmente. Agrega que el juzgador no fundamentó su sentencia en ese aspecto.

Sin lugar el reclamo. La sentencia expone adecuadamente las razones por las cuales, pese a lo dicho por el testigo [Nombre7]. y el Perito [Nombre8]., se estimó que sí existió la socola de la vegetación aledaña a las quebradas y el cambio de uso de suelo al sembrar el pasto conocido como gamalote. En ese sentido se dice en el fallo: " Por otra parte, si bien es cierto se escuchó en debate al testigo de la defensa, [Nombre7]., quien indicó que desde los años ochenta él había laborado en la finca que ahora es del acusado, y que desde entonces había realizado trabajos de pastos de la especie gamalote, porque los anteriores propietarios habían establecido algunos potreros, esa circunstancia no descarta en lo absoluto que en el área específica observada por los funcionarios del MINAE en las inspecciones realizadas, el encartado hubiere dispuesto también la socola del sotobosque y el cambio de destino de esas áreas sembrando también pasto de la misma especie gamalote: el testigo [Nombre7]. no establece con precisión en cuales áreas de la finca se sembró pasto hace treinta años, por lo que la información por él aportada no descarta en lo absoluto las labores de socola y siembra de pasto que los funcionarios del MINAE observaron: es importante señalar que los funcionarios del MINAE fueron claros en que el pasto que se estaba sembrando en octubre del 2005 no puede ser el mismo pasto que hace tantos años sembró el testigo [Nombre7]. en esa finca, ya que los funcionarios dichos describen una eliminación de vegetación que no es propia de pastizales sino de sotobosque, tal como los bejucos, heliconias y palmitos que se describen en el acta de inspección de folio 6.

Por otra parte, la información aportada por el perito de la defensa, el biólogo [Nombre8]., no desvirtúa en forma alguna lo observado por los funcionarios del MINAE, como el mismo perito reconoce, sino que se limita a hacer una conclusión en el sentido de que la afectación que se pudo dar en el sitio no fue relevante, porque en su criterio para el año 2010 la zona está bien conservada y no se han afectado las quebradas existentes en el inmueble; no se sabe con base en que es que este perito señala que las quebradas no se han visto afectadas, puesto que no tiene datos referentes al caudal de las quebradas en el año 2005 que puedan ser comparados con el caudal observado en el año 2010. Los delitos que afectan el medio ambiente, como lo son los previstos en la Ley Forestal, son delitos de peligro, que no requieren necesariamente de determinar una afectación mensurable al ambiente para su configuración, puesto que las alteraciones al ecosistema en sus distintas formas van a producir, en muchos casos a largo plazo, un daño ambiental irreversible, lo cual es patente en estos días mas que nunca, cuando continuamente se habla y se escribe sobre las alteraciones provocadas por la contaminación" (folios 236-237).

Las conclusiones del a quo son plenamente compartidas por ésta Cámara. En efecto, el hecho de que desde hace muchos años viniera realizándose por los anteriores propietarios de la finca, actividades de socolaje y sembrado de pasto en áreas de protección, no puede en modo alguno eliminar ni la tipicidad ni la antijuridicidad de la conducta. Tanto las acciones anteriores que en su oportunidad no fueron denunciadas, como las que realizó el acusado constituyen los delitos de Invasión de Zona Protectora y Cambio de Uso del Suelo. Por otra parte, tal y como lo señala la sentencia, los delitos establecidos en la Ley Forestal, protegen el ambiente, el cual se ve alterado con cualquier variación del ecosistema (cortar un árbol, eliminar vegetación de un área de protección, matar un animal silvestre) y mucho más en este caso, en donde se afectaron cuatro quebradas, que se relacionan con el funcionamiento del acueducto que surte a la comunidad de San Antonio de Mollejones (folio 238). Por ende, la conducta es antijurídica materialmente, por generar un daño al ambiente, el cual no puede reputarse insignificante como lo pretende la recurrente.

IV- En su tercer motivo, se alega falta de fundamentación en cuanto al delito de afectación del área de protección de cuatro quebradas. Estima que el Tribunal no le dio importancia al dicho del perito [Nombre8]. en cuanto a que la afectación que pudo darse en el sitio no fue relevante porque para el 2010 el área está bien conservada. Que el Tribunal hizo una conclusión sesgada al decir que no podía el perito emitir criterio por no tener un dato respecto al caudal de las quebradas al momento de la infracción. Sin lugar el reclamo. Tal y como se indicó al resolver el motivo anterior, el Tribunal sí da las razones por las que existió un daño al ambiente, y en especial en el caso de las quebradas a cuyos márgenes el encartado cortó la vegetación. Como se colige de la sentencia el perito [Nombre8]. dijo: " yo no puedo decir que ahí no pasó nada, ni desmentir a los señores del Minae (sic), pero sí pasó algo fue inocuo porque el área es homogénea, si hubo un daño no se mantiene hoy, incluso los cuerpos de agua se han conservado, se mantienen".

Si bien el perito ha tratado de minimizar el daño ambiental, lo cierto del caso es que él mismo dice que no puede saber si en el año 2005 ese daño se dio, pues la observación que realizó lo fue en el 2010. Por otra parte, como lo expone el Tribunal, estos delitos contra el ambiente, son delitos de peligro abstracto, de manera que no se requiere la demostración de un daño en concreto al medio ambiente, y en este caso a las quebradas. En todo caso, conforme al peritaje de daño ambiental presentado por el Minaet y valorado por el Tribunal al fijar el monto del daño a resarcir por parte del acusado ( folios 18 a 27) se indica que sí existió un daño, citando que al impactarse este tipo de bosque, se produce fragmentación de habitat para las especies silvestres, además se ve reducida su capacidad biogenética, así como la regulación del micro clima local y global, además la captura de dióxido de carbono se reduce, así como la retención de aguas superficiales. Por ello, el motivo debe rechazarse.

V- En su cuarto motivo, se alega violación de las reglas de la sana crítica, lógica, principio de derivación en cuanto a la conclusión única de que el imputado cambió el uso del suelo en el área afectada. Estima que la conclusión a la que llegó el juzgador no es la única lógicamente derivable de la prueba recibida y plasmada en la sentencia. Arguye que el propio Juez dice que de la declaración del testigo [Nombre7]. no se puede descartar que el imputado haya cambiado el uso del suelo, pese a la afirmación del testigo, que señaló que desde los años ochenta, había sido trabajado con la siembra del pasto gamalote por otros propietarios. De manera que conforme a la defensa, de esta aseveración se podría haber concluído que en el sector indicado por los funcionarios del Minaet ya se le había cambiado el uso al suelo. Sin lugar el reclamo. La sentencia expone con claridad que si bien el testigo [Nombre7]. mencionó en su declaración que desde los años ochenta en esa finca se sembraban pastos de la especie gamalote, los funcionarios del Minaet fueron claros en que el pasto que se estaba sembrando en octubre de 2005, no era el mismo pasto que hace tantos años sembró el testigo [Nombre7]., ya que los funcionarios describieron una eliminación de vegetación que no es propia de pastizales, sino de sotobosque, tal como bejucos, heliconias y palmitos que se describen en el acta de inspección de folio 6.

(folio 236). Por otra parte, de la declaración de los funcionarios del M. y O., transcrita en la sentencia se desprende en forma clara que ambos observaron a los peones del imputado, incluso luego llegó éste, sembrando pasto gamalote ( folios 225-226). Además observaron que el pasto sembrado era reciente, pues no tenía la raíz afianzada en la tierra, de allí que la conclusión a la que arribó el Tribunal es derivable de la prueba recibida y no violenta las reglas de la sana crítica.

VI- En su quinto motivo, la defensa alega fundamentación insuficiente en cuanto a la pena impuesta. Indica que el Tribunal le impone la pena de un año y dos meses de prisión. Arguye que las razones que da el juzgador para no imponer la pena mínima en cada delito, son propias del tipo penal. Que no se valoraron elementos tales como la carencia de juzgamientos del imputado, que el daño ambiental es casi imperceptible, que ha habido una regeneración idónea del bosque. Sin lugar el reclamo. La sentencia en cuanto a la imposición de la pena indica: "El delito de Invasión de Área de Protección está sancionado en el numeral 58 inciso a) de la Ley Forestal, con pena de ters meses a tres años de prisión: tomando en cuenta que según lo señalado por los personeros del MINAE, se afectó el área de protección de cuatro quebradas, en una extensión importante, en un tanto de unos 300 metros a lo largo de las quebradas, se le impone el tanto de SEIS MESES DE PRISION.

El delito de Tala Ilegal se sanciona en el numeral 61 inciso a) de la misma ley, con pena de un mes a tres años de prisión: por ese delito se le impone el tanto de DOS MESES DE PRISION, tomando en cuenta que los dos árboles talados se encuentran en un área de recarga acuífera que surte un acueducto de uso humano. El delito de Cambio de Uso de Suelo se sanciona en el inciso c) del mismo numeral 61, con pena de un mes a tres años de prisión: por ese delito se le impone la pena de SEIS MESES DE PRISIÓN, tomando en cuenta que el área afectada por esa acción es extensa, pues se trata de un área aproximada a las ocho hectáreas" ( folios 238-239). Como se colige de lo transcrito la sentencia toma en cuenta la gravedad del daño producido para fijar la sanción. En este caso, la afectación de cuatro quebradas, la extensión del área violentada, ocho hectáreas y el hecho de que esas quebradas alimentan un manto acuífero que sirve de sustento a un acueducto para uso humano.

A juicio de ésta Cámara no se ha incurrido en una doble valoración de los elementos del tipo penal, pues es la gravedad del hecho (número de quebradas afectadas, extensión del área socolada, función de esas quebradas), lo que determina una pena mayor al mínimo, que es proporcional también al hecho de que el encartado es una persona de limpios antecedentes. No resulta exigido por el numeral 71 del Código Penal, que todas y cada una de las circunstancias allí enumeradas sean valoradas, sino solo algunas de ellas, que resulten esenciales para justificar una pena proporcional. Por lo anterior, se rechaza el motivo.

Por tanto:

Se declara sin lugar el recurso de casación interpuesto por la defensa pública del imputado [Nombre1]. NOTIFÍQUESE.
