Goicoechea, at fourteen hours and twenty minutes on December twenty-second, two thousand ten.- POSSESSORY TITLE PROCEEDING (INFORMACIÓN POSESORIA), filed by [Nombre1], of legal age, married, farmer, resident of Cartago, identity card number CED1 - - . Participating in the proceeding are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose personal particulars do not appear in the record, in her capacity as Deputy Attorney General, and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - - , represented by Gerardo Vargas Rojas, of legal age, married, attorney, resident of Alajuela, identity card number CED3 - - , in his capacity as attorney-in-fact with the fullest powers and without limitation as to amount.   1. 1The petitioner brings a possessory title proceeding so that the following property may be registered in his name in the Registro Público de la Propiedad: “Land consisting of scrubland (charral) and crops of mango, orange, sweet lemon, and grapefruit, located at [Dirección1] in [Dirección2], Santa Cruz, Province of Guanacaste, which, according to the attached registered cadastral survey plan (plano catastrado) No G-1105488-2006, has an area of four thousand two hundred thirty-eight square meters and zero six square decimeters, with the following boundaries: North: [Nombre2], South: [Nombre3], East: [Dirección3], with frontage thereon measuring fifty-one linear meters and forty-seven centimeters,” (folios 8 to 12).-
  2. 2The Procuraduría General de la República and the Instituto de Desarrollo Agrario appeared in the proceeding under the terms set forth at folios 29 to 32, 55 to 58, 75 to 76, 99 to 103, 120 to 121 and 27, respectively, neither of them expressing opposition to these proceedings.-
  3. 3Attorney José Joaquín Piñar Ballestero, judge of the Juzgado Agrario de Santa Cruz, by judgment issued at fourteen hours and three minutes on October twentieth, two thousand ten, ruled: “THEREFORE (POR TANTO): The possessory title proceeding is approved. Subject to the encumbrances referred to in artículo 17 de la Ley de informaciones Posesorias and without prejudice to third parties having superior rights, the Registrar of the Registro de la Propiedad is ordered to register, for the first time, in the name of [Nombre1], of legal age, married once, farmer, resident of Cartago, identity card number CED5, the property described in the plan registered with the Catastro Nacional under No G-1105488-2006, described as follows: Land consisting of scrubland and crops of mango, orange, sweet lemon, and grapefruit, located at [Dirección4] in the Province of Guanacaste. Area: four thousand two hundred thirty-eight square meters and zero six square decimeters.Bounded on the North by: [Nombre2]; South: [Nombre3]; East: Río Grande; and West: [Dirección5], with frontage thereon measuring fifty-one linear meters and forty-seven centimeters. The property that is the subject of this proceeding is valued at one million five hundred thousand colones. The right-of-way (derecho de vía) of the public roads adjoining the property at [Dirección6] is fourteen meters (artículo 4 de la Ley General de Caminos Públicos y 19, inciso a, de la Ley de Informaciones Posesorias).- The area adjacent to Río Grande, which adjoins the property on the east, is a protected area (área de protección) pursuant to artículo 33, inciso b), de la Ley Forestal Nº 7575, and the cutting or removal of trees is prohibited; this restriction must be stated in the judgment for purposes of registration in the Registry (artículo 34 ibídem).- Likewise, the channel and waters of that watercourse are in the public domain (dominio público) (Ley de Aguas, artículo 1, inciso IV, y 3, inciso III).- A certified copy of this judgment shall serve to register the aforementioned property in the Registro de la Propiedad,” (folios 130 to 131).-
  4. 4Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney General, filed an appeal, expressly stating the reasons for challenging the trial court’s position, (folios 136 to 138).-

5. In the conduct of the proceeding, the statutory requirements have been observed, and the judgment contains no apparent errors or omissions capable of rendering it null and void.

Judge Castro García drafts the opinion; and,

CONSIDERING:

I- The findings of fact are adopted because they are well supported by the record.

II- The appeal was filed by Attorney Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General (folio 136). She disagrees with the judgment issued at 14 horas 03 minutos del 20 de octubre del 2010, which approved the possessory title proceedings (folio 136 to 137). She states the following grounds of appeal:

  • 1)Land-use certificate (certificado de uso de suelos) 3334 establishes that 100% of the property to be titled consists of secondary forest (bosque secundario), a land condition inconsistent with that described in the survey plan underlying these proceedings, the witnesses’ statements, and the judicial inspection (reconocimiento judicial). She adds that, in a filing submitted by certifying engineer Shiriam Yassir Guzmán clarifying the nature of the property, he stated that the land-use certificate was prepared using plan G-1105488-2006 and indicated that the land use was secondary forest, based on an inspection conducted in noviembre del 2006. That land use was secondary forest, rather than mango cultivation as indicated by one witness and by the judicial inspection. The certifier stated that the land use did not coincide with what was observed during the judicial inspection because of the time elapsed between the certifier’s visit and the judicial inspection, during which the land use could have been changed. The appellant considers that, in light of the engineer’s clarification, these proceedings should have been denied because the forest resource was not protected in accordance with artículo 7 de la ley de Informaciones Posesorias, and that ruling otherwise would permit title to be granted over land on which the forest resource has been left unprotected.
  • 2)She requests that certified copies of the relevant records be forwarded to the Ministerio Público to determine whether grounds exist to bring a criminal prosecution for the offense of land-use change (cambio de uso de suelo) (Ley Forestal articulo 19 y 61 inciso c).
  • 3)She argues on appeal that the survey plan underlying these proceedings depicts lines for future road widening, encompassing the location of the 14-meter right-of-way. The title applicant was therefore required to move the fences to a distance of seven meters from the road’s centerline and submit a new plan removing the notation “future road widening” and reducing the property’s stated area by the percentage corresponding to the width of the strip released by moving the fences, so as to prevent harm to state interests. The title applicant must not be permitted to register a reduced right-of-way area, because doing so would be equivalent to allowing the missing strip to be incorporated into the property; moreover, under the principle of parallelism of powers (principio de paralelismo de las competencias), property designated by law as part of the public domain may be released from that designation only by the legislature, not by the courts, much less through irregular acts by the parties.

III—Regarding the secondary forest (bosque secundario) and mango cultivation existing on the property, and the certification of portions of the record (testimonio de piezas) for submission to the Ministerio Público. These proceedings are brought for the purpose of registering in the Registro Público de la Propiedad the property located at [Dirección7], Santa Cruz canton, province of Guanacaste, measuring 4238,06 square meters, according to plan G-1105488-2006, folio (folio 47). Said property is not part of a protected wilderness area (área silvestre protegida), as stated in the certification issued by the Sistema Nacional de Áreas de Conservación and submitted as evidence (folio 48). The soil study (estudio de suelos) contained in the record (folio 49) indicates that the land has been used in accordance with its soil suitability for the activity conducted there, pursuant to the approved methodology.

The observations indicated that the land contains secondary forest, with tree species such as guácimo, madero negro, chaperno, and pochote, as well as patches of natural pasture, evidencing that it was used for livestock farming in the past. The recommendations stated that natural forest regeneration should be encouraged and that no trees should be cut without the consent of the Administración Forestal del Estado. That study is dated 11 de noviembre del 2006. A record of the judicial inspection (reconocimiento judicial) was drawn up on 2 de octubre del 2008 (folio 86), documenting that the land was demarcated by fences, its boundaries, and that one of those boundaries adjoins the Río Grande, where forest cover (cobertura forestal) exists and is duly protected by espavel, guayabo de monte, roble, guanacaste, and palma real. Mango crops and other fruit trees were also observed. The witnesses gave their statements on 7 de junio del 2010, as follows: [Nombre4] (folio 92) testified that he had known the property for 50 years, when it belonged to [Nombre5], then to Mr. [Nombre6], son of [Nombre1], and, for the previous 7 or 8 years, to the petitioner, who acquired it from [Nombre6].

He stated that it was fenced and contained mango crops and forest cover along the riverbanks. Witness [Nombre7] (folio 92 vuelto) stated that he had known the property for 40 years, when it belonged to [Nombre1], then to [Nombre6], and subsequently to the petitioner; it contained mango crops and was fenced. Witness [Nombre8] (folio 93) concurred with the chain of possession (cadena posesoria) described by the preceding witnesses, the presence of fences, and the existence of mango cultivation. At the request of the trial judge, the soil-use certifier supplemented and clarified (folio 11) the information recorded in the certificate he had issued, because the Procuraduría noted that the judicial inspection and the witnesses reported the existence of mango crops, whereas the study recorded the presence of secondary forest. In this regard, he asserted that a period of time had elapsed between his visit to the property and the judge’s visit, during which a change in land use (cambio en el uso del terreno) might have occurred.

He further stated that his certification had noted the existence of patches of natural jaragua pasture and different types of trees, identifying some but not all of those present. He clarified that he had included the phrase “among others,” meaning that other types of vegetation existed, although with a limited presence of shrubs such as cornizuelos or other types of trees forming part of secondary forest or regenerating scrubland (tacotal), because the owner had been cutting those shrubs, which possessors often regard as weeds. As can be seen from the technical soil study and its subsequent clarification, the land was covered by the various forest resources cited and was therefore not land consisting of virgin or primary forest, but rather a property with forest cover that contained secondary forest, that is, forest undergoing regeneration. Regarding this type of forest, the Comisión Nacional de Certificación Forestal de Costa Rica defines secondary forest as “... land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities or natural phenomena; with a minimum area of 0,5 ha and a density of no fewer than 500 trees per ha of all species.” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

The term Tacotal means “dense scrubland.” Based on these definitions and the INTA technical study, which clarified in its observations that the land had been used for livestock farming in the past, the original forest cover had been removed and the vegetation was being allowed to grow again. To declare that this type of secondary forest, which possessors regard as weeds or scrubland, as stated by the soil-use certifier, cannot be combined with agricultural plantations—and thereby eliminate the existence of agroforestry systems (sistemas agroforestales)—would mean prohibiting the sustainable use of soil resources and failing to apply the principle of sustainable development (principio de desarrollo sostenible). This Court finds that agricultural activities combined with the regeneration of secondary forests and scrubland are necessary activities that contribute to atmospheric carbon sequestration and constitute human activities that mitigate global warming.

They benefit the environment, and it would therefore be inconsistent to penalize possessors who combine those activities. Furthermore, the property at issue is not located within protected wilderness areas subject to management categories and specific objectives with which owners and possessors must comply. In this case, the property consists of land designated for forestry use, on which regeneration must be encouraged, without this preventing its possessor from establishing an agroforestry system; the possessor must nevertheless exercise diligence and conserve the areas of regenerating forest. Furthermore, the appellant’s request to certify portions of the record for submission to the Ministerio Público for a criminal investigation is denied because the Court finds that there is no offense requiring investigation, without prejudice to the appellant’s right to pursue directly any avenues she deems appropriate and request any investigations she considers necessary.

IV—Regarding the width of the public road and the phrase included in the registered cadastral plan (plano catastrado). The appellant argues that the base plan for these proceedings depicts future road widening and that the applicant for title must therefore move the fences to a distance of seven meters from the street centerline and submit a new plan eliminating the notation “future road widening,” thereby reducing the area of the property that included portions of the public road, such area being in the public domain (dominio público). The appellant’s claim is unfounded because a review of the record shows that a registered cadastral plan had been submitted and appears at folio one, depicting [Dirección5] at [Dirección8] as having a width of 8.43 linear meters and showing the area of the property for which title was sought as 4.368.23 linear meters. That plan was subsequently canceled, and new plan number G-1105488-2006 was submitted, showing an original road width of 8.43 meters and road-widening strips of 2.79 meters on each side, which together produce a public-road area 14.01 linear meters wide.

Those widening areas are not included within the area of the property for which title is sought. In addition, the land area was reduced to 4.238.06 square meters, reflecting that the area corresponding to the public road is not being treated as part of the unregistered land. Accordingly, there is no encroachment upon the public domain as alleged by the appellant. Her claim and her request for the submission of another registered cadastral plan on that ground are denied.

V—From the foregoing, this Court concludes that, because compliance with all requirements of the Ley Informaciones Posesorias has been established, the appeal must be denied and the appealed ruling affirmed as to the matters challenged.

POR TANTO:

RESULTANDO:

  1. 1El promovente plantea proceso de información posesoria con el fin de que se inscriba a su nombre en el Registro Público de la Propiedad la finca que describe así: “ Terreno de Charral y cultivo de mango,naranjo, limón dulce y raifrut ,ubicado en [Dirección1] del [Dirección2] Santa Cruz de la Provincia de Guanacaste, que según el plano catastrado adjunto No G-1105488-2006, posee una extensión de cuatro mil doscientos treinta y ocho metros con cero seis decímetros cuadrados, cuyos linderos son: Norte: [Nombre2] , Sur:[Nombre3] , Este: [Dirección3] con un frente a ella de cincuenta y un metros cuarenta y siete centímetros lineales", (folios 8 a 12).-
  2. 2La Procuraduría General de la República y e l Instituto de Desarrollo Agrario, se apersonaron al proceso en los términos visibles de folios 29 a 32, 55 a 58, 75 a 76, 99 a 103, 120 a 121 y 27 ; respectivamente, sin manifestar ambos su oposición a las presentes diligencias.-
  3. 3El licenciado José Joaquín Piñar Ballestero , juez del Juzgado Agrario de Santa Cruz , mediante sentencia de las catorce horas tres minutos del veinte de octubre de dos mil diez , resolvió: “ POR TANTO: Se aprueba la información posesoria. Con las afectaciones a que se refiere el artículo 17 de la Ley de informaciones Posesorias y sin perjuicio de terceros de mejor derecho, se ordena al Señor Registrador del Registro de la Propiedad inscribir, por primera vez, a nombre de [Nombre1] , quien es mayor, casado una vez, agricultor, vecino de Cartago con cédula número CED5 , la finca descrita en el plano inscrito en el Catastro Nacional bajo el número No G-1105488-2006, que se describe así: Terreno de Charral y cultivo de mango, naranjo, limón dulce y raifrut,ubicado en [Dirección4] de la Provincia de Guanacaste, Mide: cuatro mil doscientos treinta y ocho metros con cero seis decímetros cuadrados.Linda al Norte:[Nombre2] Sur: [Nombre3] Este: Río Grande y Oeste: [Dirección5] con un frente a ella de cincuenta y un metros cuarenta y siete centímetros lineales. El inmueble objeto de este proceso se estima en la suma de un millón quinientos mil de colones. Que el derecho de vía de las Calles Públicas que colinda por el [Dirección6] es de catorce metros (artículo 4 de la Ley General de Caminos Públicos y 19, inciso a, de la Ley de Informaciones Posesorias ).-Que el área contiguo al Río Grande que colinda por el rumbo este es área de protección, según el artículo 33, inciso b), de la Ley Forestal Nº 7575, y queda prohibido la corta o eliminación de árboles, debiéndose consignar en sentencia para efectos de inscripción en el Registro ( artículo 34 ibídem).- Asimismo, que el cause y las aguas de esa corriente son de dominio público ( Ley de Aguas, artículo 1, inciso IV, y 3, inciso III).- Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada", (folios 130 a 131).-
  4. 4La licenciada Lydiana Rodríguez Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, (folios 136 a 138 ).-

5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta la jueza Castro García; y,

CONSIDERANDO:

I- Se comparte el elenco de hechos probados por tener buen sustento en los autos.

II- La apelación es interpuesta por la licenciada Lydiana Rodríguez Paniagua en su carácter de Procuradora Adjunta (folio 136). Se muestra disconforme con la sentencia de las 14 horas 03 minutos del 20 de octubre del 2010, donde se aprobaron las diligencias de información posesoria (folio 136 a 137). Expone como agravios los siguientes:

  • 1)Consta en el certificado de uso de suelos 3334 que el 100% del inmueble a titular es bosque secundario, naturaleza contraria a la descrita en el plano base de estas diligencias, manifestaciones hechas por los testigos y lo consignado en el reconocimiento judicial. Agrega, que en escrito aportado por el ingeniero certificador Shiriam Yassir Guzmán, en donde aclara sobre la naturaleza del inmueble, manifestó que el certificado de uso de suelos se elaboró con el plano G-1105488-2006 y se consignó que el uso era de bosque secundario, según visita efectuada en noviembre del 2006. Dicho uso era de bosque secundario y no como lo indicó un testigo y el reconocimiento judicial que era de cultivo de mango. Indicando el certificador que el uso de suelo no coincidía con lo observado en el reconocimiento judicial, debido al lapso transcurrido entre la visita del certificador y la de la inspección judicial, en donde pudo haberse cambiado el uso. Estima la apelante, que con la aclaración del ingeniero estas diligencias debieron ser rechazadas por no haberse protegido el recurso forestal de conformidad con el artículo 7 de la ley de Informaciones Posesorias, y resolver lo contrario significa permitir la titulación de terrenos en lo que se ha desprotegido el recurso forestal.
  • 2)Pide testimoniar piezas ante el Ministerio Público para determinar si existe mérito para ejercer la acción penal del delito de cambio de uso de suelo (Ley Forestal articulo 19 y 61 inciso c).
  • 3)Apela, el plano base de estas diligencias describe líneas de futura ampliación vial, abarcando en el sitio del derecho de vía de 14 metros. Por lo que el titulante debía haber corrido las cercas a una distancia de siete metros de la linea del centro de la calle y aportar nuevo plano donde se eliminara la leyenda "futura ampliación vial" y en el que se redujera la cabida del inmueble en el porcentaje correspondiente al ancho de la franja que se libera al correr las cercas a fin de no ver afectados los intereses estatales. Y no debe permitirse al titulante inscribir con una área menor en el derecho vía, por cuanto equivale a permitir incorporar al terreno la franja faltante y por el principio de paralelismo de las competencias un bien afecto por ley a dominio público, solo el legislador puede desafectarlo y no los tribunales y menos por actos irregulares de las partes.

III-Sobre el bosque secundario y cultivo de mango existente en el fundo y testimonio de piezas ante Ministerio Público. Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad el inmueble ubicado en [Dirección7] , cantón Santa Cruz de la provincia de Guanacaste, mide 4238,06 metros cuadrados, según plano G-1105488-2006, folio ( folio 47). Dicho bien, no es parte de área silvestre protegida, conforme se indica en la certificación emitida por el Sistema Nacional de Áreas de Conservación aportada como prueba (folio 48). En el estudio de suelos que consta en autos (folio 49) se indica, se ha ejercido el uso conforme al suelo para la actividad que realiza de acuerdo con la metodología aprobada. En las observaciones fue indicado que el terreno tiene bosque secundario, con especies de arboles como guácimo, madero negro, chaperno y pochote, manchas de pasturas naturales, lo cual evidencia que fue dedicado a la ganadería en el pasado.

Como recomendaciones se indicó que debe propiciarse la regeneración forestal natural y no cortar árboles sin el consentimiento de la Administración Forestal del Estado. Tal estudio tiene fecha del 11 de noviembre del 2006. Del reconocimiento judicial celebrado se levanto acta del 2 de octubre del 2008 (folio 86) en donde se dejó constancia de la delimitación con cercas del terreno, sus colindancias, una de las cuales es con el Río Grande en donde existe cobertura forestal y se encuentra debidamente protegido con espavel, guayabo de monte, roble, guanacaste y palma real. Ademas de haber observado cultivos de mango y otros frutales. Los testigos rindieron sus declaraciones el día 7 de junio del 2010, en el siguiente sentido: [Nombre4] ( folio 92) depuso que conoce la propiedad hacia 50 años cuando le pertenecía a [Nombre5] , luego a don [Nombre6] , hijo de [Nombre1] y desde hacia 7 u 8 años al promovente, quien adquirió de [Nombre6].

Indica que esta cercada, y tienen cultivos de mango y cobertura forestal en las márgenes del río. El testigo [Nombre7] (folio 92 vuelto) manifestó que conocía la propiedad desde hacía 40 años, cuando le pertenecía a [Nombre1], luego a [Nombre6], y posteriormente el promovente, tiene cultivos de mango, esta cercada. El testigo [Nombre8] (folio 93), es conteste con la cadena posesoria descrita por los testigos anteriores, la presencia de cercas y la existencia de cultivo de mango. El certificador de uso de suelos, a solicitud del juzgador de instancia adiciona y aclara (folio 11) la información consignada en el certificado que había emitido, pues la Procuraduría indica que en el reconocimiento judicial y los testigos manifestaron la existencia de cultivos de mango y el estudio consignó la presencia de bosque secundario. Al respecto aduce que entre su visita al fundo y la del juzgador había transcurrido un período de tiempo en el cual podría haberse dado un cambio en el uso del terreno.

Además señala que en su certificación señalò la existencia de manchas de pasturas naturales de jaragua y diferentes tipos de arboles , en donde señalo algunos y no todos los existentes. Aclaró que consignó la frase " entre otros", lo cual quiere decir que existe otro tipo de vegetación, pero con una presencia leve de arbustos como cornizuelos u otro tipo de árboles que forman parte de bosque secundario o tacotal que se encuentra en regeneración, debido al tratamiento de corta que le hacía el propietario a dichos arbustos, que en muchas ocasiones a criterio del poseedor es tomado como malezas. Como es observado, del estudio técnico de suelos y su posterior aclaración, el terreno estaba cubierto por diversos recursos forestales que se citaron, y no se trataba entonces de un terreno constituido por bosque virgen o primario, sino que era un fundo con cobertura boscosa que contenía bosque secundario, es decir en regeneración.

Sobre este tipo de bosques la Comisión Nacional de Certificación Forestal de Costa Rica define el bosque secundario como “... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies." (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999. Estándares y procedimientos para el manejo sostenible y la certificación forestal en Costa Rica. San José,. Costa Rica. 54 p.) El concepto de Tacotal es "matorral espeso". Partiendo de estas definiciones y del estudio técnico del INTA, en el que aclara en las observaciones que el terreno había sido dedicado a la ganadería en el pasado, la cobertura forestal original había sido eliminada y se estaba dejando a la vegetación crecer nuevamente.

Declarar que ese tipo de bosque secundario que es visto como malezas o tacotales, por los poseedores, tal y como lo consigna el certificador de usos de suelo, no puede ser combinado con plantaciones agronómicas; y eliminar de esta forma la existencia de sistemas agroforestales, significa que se prohíbe el uso sostenible del recurso suelo y la inaplicación del principio de desarrollo sostenible. Estima esta sede que las actividades agrícolas combinadas con las de regeneración de bosques secundarios y tacotales, son actividades necesarias que repercuten en la captación de carbono en la atmósfera, y son actividades humanas que mitigan el calentamiento global. Beneficiosas para el medio ambiente, por lo que sería incoherente castigar a los poseedores que combinan dichas actividades. Por otra parte, no nos encontramos en presencia de un fundo que se encuentre dentro de áreas silvestres protegidas con categorías de manejo y objetivos específicos a las que deben someterse los propietarios y poseedores.

En el caso en estudio, es un fundo con un terreno al que se le ha dado la vocación de forestal y en el cual debe propiciar la regeneración, sin que esto implique que sus poseedor se encuentren impedidos de establecer un sistema agroforestal y que deba tener una actitud diligente y de conservación con las zonas en regeneración de bosques. Por otra parte, se deniega la solicitud de la apelante de testimoniar piezas ante el Ministerio Público para la investigación en sede penal, por estimar que no se esta en presencia de un delito que deba ser investigado, sin que esto inhiba a la apelante de acudir directamente a las vías que estime pertinentes y solicitar las investigaciones que considere necesarias.

IV- Sobre el ancho del camino público y frase incluida en plano catastrado. La apelante, aduce que plano base de estas diligencias describe futuras ampliaciones viales, por lo que el titulante debe mover sus cercas a una distancia de siete metros de la linea del centro de la calle y aportar nuevo plano donde se eliminara la leyenda "futura ampliación vial", reduciendo el área del fundo que incluía las áreas del camino público y que tal zona es de dominio público. No lleva razón la apelante en su agravio, pues de la lectura de los autos, se observa que se había aportado un plano catastrado visible a folio uno, en donde se graficaba la [Dirección5] en la [Dirección8] que tenía un ancho de 8.43 metros lineales de ancho y un área del fundo a titular de 4.368.23 metros lineales. Posteriormente dicho plano fue anulado, y se aportó el nuevo plano número G-1105488-2006 que refleja un camino original de 8.43 metros y unas franjas de ampliación vial de 2.79 a cada lado y que sumadas nos dan una zona de camino público de 14.01 metros lineales.

Zonas de ampliación que no están incluidas dentro del área del fundo que se pretende titular. Aunado a ello, el área del terreno fue disminuida a 4.238.06 metros cuadrados, lo cual refleja que la zona correspondiente a camino público no esta siendo considerada como parte del terreno sin inscribir. Por ello, no existe la afectación al dominio público alegada por la apelante. Se rechaza su agravio y la solicitud de que se vuelva a presentar nuevo plano catastrado, por ese motivo.

V- De lo citado, concluye este Tribunal, que en virtud de haberse corroborado el cumplimiento de todos los requisitos de la Ley Informaciones Posesorias, debe rechazarse la apelación y confirmarse la resolución recurrida en lo apelado.

POR TANTO:

Se confirma la sentencia en lo que ha sido objeto de apelación.- [Nombre9] CARLOS PICADO VARGAS ANDREA [Nombre10] PROCESO: INFORMACIÓN POSESORIA PROMOVENTE: [Nombre1] CPE
