JUDGMENT Nº 0 83 7-F-10 AGRARIAN COURT OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at ten forty-eight a.m. on the thirty-first of August, two thousand ten.- POSSESSORY TITLE PROCEEDING (INFORMACIÓN POSESORIA), brought by [Nombre1], of legal age, farmer, married, resident of San Lorenzo, Tarrazu, identity card number CED1 - - . Participating in the proceeding are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose personal details are not stated in the record, in her capacity as Deputy State Attorney, and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - - , represented by [Nombre2], of legal age, married once, agricultural engineer, resident of Siquirres, Limón, identity card number CED3 - - . Heard before the Agrarian Court of the Second Judicial Circuit of San José. FINDINGS:

  1. 1The applicant institutes a possessory title proceeding for the purpose of having the property described as follows registered in his name in the Public Property Registry: “Mountain land, located at [Dirección1] SAN LORENZO, in the fifth canton of TARRAZÚ, Province of SAN JOSÉ, currently bounded as follows: to the north by [Nombre3], to the south by [Nombre4] AND [Dirección2], to the east by [Nombre4], WITH A STREAM BETWEEN THEM, and to the west by [Dirección3]. Said boundaries are current and true. It measures THIRTEEN HECTARES TWO HUNDRED SQUARE METERS AND SEVENTY-SIX SQUARE DECIMETERS, according to cadastral plan number SJ - SIX HUNDRED THIRTY-FOUR THOUSAND FOUR HUNDRED THIRTEEN - TWO THOUSAND”, (folio 6).-
  2. 2The Procuraduría General de la República and the Instituto de Desarrollo Agrario entered appearances in the proceeding under the terms appearing at folios 35 to 38, 81 to 87, 124, 125 and 49, respectively, neither expressing opposition to these proceedings.-
  3. 3Judge Vanessa Fisher González of the Agrarian Court of the Second Judicial Circuit of San José, by judgment issued at nine twenty-six a.m. on the twenty-fifth of May, two thousand ten, ruled: “POR TANTO: Pursuant to the Ley de Informaciones Posesorias Nº 139 of 14 de julio de 1941 and its amendments, these possessory title proceedings, in which the Procuraduría General de la República and the Instituto de Desarrollo Agrario have participated as parties, are approved. The land to be titled shall remain subject to the reservations established by the Ley General de Caminos Públicos, insofar as the minimum width of highways is twenty meters and that of local roads is fourteen meters (Articles 19 of the Ley de Informaciones Posesorias and 4 of the Ley General de Caminos Públicos). The Public Property Registry shall register the property free of encumbrances, co-owners, and real-property charges, without prejudice to third parties with superior rights, in the name of [Nombre1], of legal age, married, farmer, identity card CED4, resident of Quebrada Arroyo de San Lorenzo de Tarrazú: land classified as mountain land, located in Quebrada [Dirección4], Province of San José, measuring thirteen hectares two hundred two square meters and seventy-six square decimeters, bounded to the north by [Nombre3], to the south by [Nombre4] and [Dirección5], with frontage measuring one hundred twenty-four linear meters and twenty-eight centimeters, to the west by [Dirección5], with frontage measuring four hundred eleven linear meters and ninety-three centimeters, and to the east by [Nombre4], with a stream between them, as described in cadastral plan SJ-1291003-2008.The property to be titled was acquired through a purchase and sale from [Nombre5], identity card CED5, of legal age, married once, farmer, resident of [Dirección6]. [Nombre6], identity card CED6, and [Nombre4], known as [Nombre4], identity card CED7, testified as witnesses. The property was valued at one hundred thousand colones, and these proceedings were assessed at the same amount. The notice concerning these proceedings was published in Boletín Judicial number 236 dated 8 de diciembre del 2006. The property lies outside any protected wildlife area (área silvestre protegida), and the possessory acts (actos posesorios) have been exercised in compliance with the conforming use of the land.” (folios 138 and 139).-
  4. 4Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy State Attorney, filed an appeal expressly stating the reasons for challenging the trial court’s position, (folios 145 and 146).-

5. The statutory requirements have been observed in the conduct of the proceeding, and the judgment contains no errors or omissions capable of rendering it null and void.

Drafted by Judge Castro García; and,

WHEREAS:

I.The list of proven facts is adopted because it is supported by the record. The following fact of the same nature is added: The property at issue in this proceeding borders [Dirección9] at [Dirección7] and [Dirección8] (technical report of the Instituto Costarricense de Acueductos y Alcantarillados, folio 57; cadastral plan 1-2365048, folio 97).

II.The appeal was filed by Attorney Lydiana Rodríguez Paniagua in her capacity as Deputy State Attorney (folio 145). She disagrees with the judgment issued at 09 hours 26 minutes on 25 de mayo del 2010, which approved the possessory title proceedings (folio 125). She states the following grounds of appeal:

  • 1)The judgment did NOT state that the area adjoining the watercourses constitutes a protection zone (área de protección) under section 33(a) and (b) of Ley Forestal 7575, which prohibits the cutting or removal of trees pursuant to article 34 of the same statute. She further argues that the bed and waters of that watercourse are in the public domain (dominio público), citing articles 1(IV) and 3(III) of the Ley de Aguas as authority.
  • 2)She challenges the fact that the judicial inspection (reconocimiento judicial), the testimonial evidence received, the land-use certificate, and the applicant’s own statements establish that the land to be titled is forested in nature (mountain), and argues that forestland located in national reserves has been subject to the public-domain regime as State Natural Heritage (Patrimonio Natural del Estado) since Ley Forestal 4465 de 1969, article 33, as amended by Ley Forestal 7174 de 1990 (articles 32 and 33), and that it retains its public-domain character under Ley 7575, (articles 13 and 14). She argues that the law permits properties outside protected wildlife areas to be titled if the applicant proves lawful rights arising from ten years of possession, that the applicant has protected the resource, and that the property has been duly demarcated. She cites judgment of the Sala Constitucional voto 4587-97 and reiterates that forests may be titled only if adverse possession (usucapión) was completed before they became part of Patrimonio Natural del Estado by operation of law, and that the requisite adverse-possession period must have elapsed before the designation occurred; she further contends that forestland is immediately designated by law as public domain.
  • 3)She objects that the witnesses’ testimony does not prove the ten years of possession required to acquire title by adverse possession on behalf of its owner, and requests reversal and denial of these proceedings.

III.The appellant is incorrect in her argument, on behalf of the State, concerning the existence of an area with forest cover (cobertura boscosa) that is ineligible for acquisition by adverse possession because it forms part of Patrimonio Natural del Estado. These proceedings were brought for the purpose of registering in the Public Property Registry the property located at [Dirección10] in the Province of San José, measuring 13 hectares 0202 square meters and 76 square decimeters, according to plan 1- 1291003-2008, (folio 97). Said property does not form part of a protected wildlife area, as stated in the certification issued by the Sistema Nacional de Áreas de Conservación and submitted into the record (folio 103). The soil study contained in the record states that the land has been used in conformity with its designated use (folio 21). The Court conducted a judicial inspection of the property, for which a record was prepared stating that the land to be titled is “virgin mountain” and is well protected; no clearings among the trees indicative of timber extraction were observed; the boundary lines were clear; there were no crops of any kind, livestock, or structures; no springs (nacientes) or streams were observed within the property; and its terrain is rugged.

(folio 75). Testimony was also received from witnesses [Nombre6], [Nombre7], and [Nombre4] (folios 76 to 78). Witness [Nombre6] stated that he had known the property for more than twenty-four years, witness [Nombre4] for 38 years, and witness [Nombre7] for 37 years. All agree that Mr. [Nombre8] sold the property to [Nombre5], who in turn sold it to the applicant 24 years ago; that the land has maintained primary- and secondary-forest cover for many years; and that they recognize the applicant’s commitment to protecting its natural resources, since he preserves the existing forest and prohibits hunting there. In this case, an assessment of the cited testimony and the soil study contained in the record supports the conclusion that the land is forested and has been duly protected by the applicant. Article seven of the Ley de Informaciones Posesorias provides that properties located outside protected wildlife areas and containing forests may be titled if the applicant proves that he holds lawful rights arising from ten years of possession and has protected the resource, without distinguishing between secondary and primary forests.

Based on these definitions and the INTA technical study appearing at folio 21, which states that the land is entirely covered by forests, and given that the resource has been protected as required by law, the Court does not agree with the State representative’s assertion that, because the land is devoted to forest, it forms part of Patrimonio Natural del Estado, since under article 856 of the Código Civil the property is eligible for acquisition by adverse possession. Accordingly, pursuant to article 7 of the Ley de Informaciones Posesorias, the Court finds that the evidence submitted did establish the exercise of the legally required possession over the property for ten years preceding the date on which this proceeding was instituted, and that the land at issue in these proceedings is eligible for acquisition by adverse possession because it lies outside any protected wildlife area, regardless of its management category, and because possessory acts involving the conservation of natural resources have been exercised. (In this regard, voto N°51 issued at 15 hours 15 minutes on 26 de mayo de 1995 by the Sala Primera de la Corte Suprema de Justicia may be consulted).

IV.The appellant is likewise incorrect in her argument that the witnesses’ testimony does not prove ten years of possession. Although she does not specifically state why she considers that testimony insufficient to establish ten years of possession, a review of each witness’s testimony shows that all three consistently describe a chain of possession (cadena posesoria) proving that the applicant and his predecessors in interest have exercised possession continuously, that they have known the land for several decades, and that they are unaware of any possessory disputes arising from the possession exercised over the land. This ground of appeal is therefore rejected.

V.With respect to the request for a declaration of the protection area (área de protección) of the watercourses (corrientes de agua) existing on the property, it is noted that, it having been established that the northeastern boundary of the property partly adjoins quebrada Arroyo and that the southern boundary adjoins [Dirección11], the judgment under appeal must be supplemented, pursuant to Article 33(a) of the Ley Forestal and Article 19 of the Ley de Informaciones Posesorias, to state that the property is subject to the restrictions of the Ley Forestal because protection areas exist along the banks of the specified watercourses, with the consequent prohibition against removing vegetation cover (cobertura vegetal) in those areas, as well as a declaration that its flow (caudal), and that of all existing watercourses, is in the public domain (dominio público). The appellant is correct as to this ground of appeal (agravio).

VI.In light of the foregoing, the ruling must be affirmed insofar as appealed and the judgment under appeal must be supplemented to state that, because quebrada Arroyo lies along the northeastern boundary of the property and quebrada Blanco lies to the south, pursuant to Article 33(a) of the Ley Forestal and Article 19 of the Ley de Informaciones Posesorias, the property is subject to the restrictions of the Ley Forestal because protection areas exist along the banks of the specified watercourses, with the consequent prohibition against removing vegetation cover in those areas, as well as a declaration that its flow, and that of all existing watercourses, is in the public domain. These additions must be included in the certified judgment (ejecutoria) that the court of origin sends to the Registro Público for purposes of recording the property in the registry (inscripción registral).

POR TANTO:

The judgment under appeal is affirmed. The ruling is supplemented to state that, because quebrada Arroyo lies along the [Dirección12] of the [Dirección13] and quebrada Blanco lies to the [Dirección8], pursuant to Article 33(a) of the Ley Forestal and Article 19 of the Ley de Informaciones Posesorias, the property is subject to the restrictions of the Ley Forestal because a protection area exists along the banks of the specified watercourses. The removal of vegetation cover in those areas is prohibited, and the flow of quebrada Arroyo and quebrada Blanco, and that of all existing watercourses, is declared to be in the public domain. These additions must be included in the certified judgment that the court of origin sends to the Registro Público for purposes of recording the property in the registry.

RESULTANDO:

  1. 1El promovente plantea proceso de información posesoria con el fin de que se inscriba a su nombre en el Registro Público de la Propiedad la finca que describe así: “ Terreno de montaña, sito en [Dirección1] SAN LORENZO, del cantón quinto TARRAZÚ, de la Provincia de SAN JOSÉ, linda actualmente: norte [Nombre3] , sur [Nombre4] Y [Dirección2] , este [Nombre4] QUEBRADA EN MEDIO y al oeste con [Dirección3] . Que dichos linderos son actuales y verdaderos. Mide TRECE HECTÁREAS DOSCIENTOS METROS CON SETENTA Y SEIS DECÍMETROS CUADRADOS, según plano catastrado número SJ - SEISCIENTOS TREINTA Y CUATRO MIL CUATROCIENTOS TRECE - DOS MIL ” , (folio 6 ).-
  2. 2La Procuraduría General de la República y e l Instituto de Desarrollo Agrario, se apersonaron al proceso en los términos visibles de folios 35 a 38, 81 a 87, 124, 125 y 49 ; respectivamente, sin manifestar ambos su oposición a las presentes diligencias.-
  3. 3La licenciad a Vanessa Fisher González , juez a del Juzgado Agrario del Segundo Circuito Judicial de San José , mediante sentencia de las nueve horas con veintiséis minutos del veinticinco de mayo del dos mil diez , resolvió: “ POR TANTO: De conformidad con la Ley de Informaciones Posesorias Nº 139 del 14 de julio de 1941 y sus reformas, se aprueban estas diligencias de Información Posesoria, en la cual han intervenido como partes la Procuraduría General de la República y el Instituto de Desarrollo Agrario. El terreno a titular quedará afectado por las reservas que indica la Ley General de Caminos Públicos, en cuanto a que el ancho mínimo de las carreteras es de veinte metros y de los caminos vecinales de catorce metros (Artículos 19 de la Ley de Informaciones Posesorias y 4 de la Ley General de Caminos Públicos). Proceda el Registro Público de la Propiedad a inscribir libre de gravámenes, condueños y cargas relaes, y sin perjuicio de terceros de mejor derecho, a nombre de [Nombre1] , mayor, casado, agricultor, cédula de identidad CED4, vecino de Quebrada Arroyo de San Lorenzo de Tarrazú, el terreno de naturaleza de montaña, situado en Quebrada [Dirección4], , de la Provincia de San José, con una medida de trece hectáreas doscientos dos metros con setenta y seis decímetros cuadrados, linda al norte con [Nombre3] , al sur con [Nombre4] y [Dirección5] con un frente de ciento veinticuatro metros con veintiocho centímetros lineales, al oeste con [Dirección5] con un frente de cuatrocientos once metros con noventa y tres centímetros lineales y al este con [Nombre4] uebrada en medio, descrito en el plano catastrado SJ-1291003-2008.El inmueble a titular lo adquirió por compraventa que le hiciera [Nombre5] , cédula CED5, mayor, casado una vez, agricultor, vecino de [Dirección6] . Declararon como testigos [Nombre6] cédula de identidad CED6 y [Nombre4] conocido como [Nombre4] cédula de identidad CED7. El inmueble fue estimado en la suma de cien mil colones y en la misma suma las presentes diligencias. El edicto relativo a estas diligencias salió publicado en el Boletín Judicial número 236 de fecha 8 de diciembre del 2006. El inmueble está fuera de cualquier área silvestre protegida y se han ejercido los actos posesorios cumpliendo con el uso conforme del suelo. ” (folios 138 y 139 ).-
  4. 4La licenciada Lydiana Rodríguez Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, (folios 145 y 146 ).-

5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta la jueza Castro García; y,

CONSIDERANDO:

I.Se comparte el elenco de hechos probados por tener sustento en los autos. De igual naturaleza, se agrega: La finca objeto de este proceso colinda al [Dirección7] y al [Dirección8] con [Dirección9] (informe técnico del Instituto Costarricense de Acueductos y Alcantarillados folio 57, plano calastrado 1-2365048 folio 97).

II.La apelación es interpuesta por la licenciada Lydiana Rodríguez Paniagua en su carácter de Procuradora Adjunta ( folio 145). Se muestra disconforme con la sentencia de las 09 horas 26 minutos del 25 de mayo del 2010, donde se aprobaron las diligencias de Información Posesoria (folio 125). Expone corno agravios los siguientes: 1) NO fue indicado en la sentencia que el área contigua a las corrientes, es área de protección según en el numeral 33 inciso a) y b) de la Ley Forestal 7575, en donde se preceptúa que queda prohibida la corta o eliminación de arboles, según artículo 34 de la misma norma citada. Asimismo, que el cauce y las aguas de esa corriente son de dominio público, citando como fundamento la Ley de Aguas artículos 1 inciso IV y 3 inciso III. 2) Combate que consta en el reconocimiento judicial y prueba testimonial recibida, certificado de uso de suelos y manifestaciones del mismo promovente, que la naturaleza del terreno a titular es boscosa (montaña) y que los terrenos de bosques ubicados en reservas nacionales están afectados a régimen de dominio público, Patrimonio Natural del Estado, desde la Ley Forestal 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y de carácter demanial que mantiene la Ley 7575, (artículos 13 y 14).

Argumenta, la Ley permite titular inmuebles fuera de las áreas silvestres protegidas si el promovente demuestra sus legítimos derechos de posesión decenal, haber protegido el recurso y tener el inmueble debidamente deslindado. Cita voto de la Sala Constitucional voto 4587-97 y reafirma los bosques solo podrán titularse si la usucapión se consolidó antes de ingresar por Ley a Patrimonio Natural de Estado y el plazo de la usucapión apta debe haber transcurrido antes de antes haberse producido la afectación, además esgrime los terrenos de bosques tienen una afectación inmediata por Ley a dominio público. 3) Agravia, la declaración de los testigos no demuestra la posesión decenal apta para usucapir en cabeza de su dueño y solicita la revocatoria para decretar la improbación de estas diligencias.

III.Sobre el agravio de la representación estatal referido a la existencia de una zona con cobertura boscosa que no es apta para usucapir, por ser parte del Patrimonio Natural del Estado, no lleva razón la apelante. Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad el inmueble ubicado en [Dirección10] de la provincia de San José, mide 13 hectáreas 0202 metros cuadrados con 76 decímetros cuadrados, según plano 1- 1291003-2008, (folio 97). Dicho bien no es parte de área silvestre protegida, conforme se indica en la certificación emitida por el Sistema Nacional de Áreas de Conservación aportada a los autos (folio 103). En el estudio de suelos que consta en autos se indica, se ha ejercido el uso conforme al suelo (folio 21). El Juzgado practicó un reconocimiento judicial del inmueble, del que se levantó un acta que consignó que el terreno a titular es de "montaña virgen" y la misma esta bien protegida, no se observaron claros entre los árboles que denote extracción de madera, los carriles estaban limpios y no habían sembradíos de ninguna especie ganado o construcción, no se observaron nacientes o quebradas dentro del inmueble y es de topografía quebrada.

( folio 75). También se recibió la declaración de los testigos [Nombre6] , [Nombre7] y [Nombre4] (folios 76 a 78). testigo [Nombre6] adujo conocer la propiedad desde hacía más de veinticuatro años, el testigo [Nombre4] hacía 38 años y el testigo [Nombre7] desde 37 años atrás. Todos son coincidentes en manifestar que el señor [Nombre8] le vendió el inmueble a [Nombre5] y éste útimo al promovente hacía 24 años, que el terreno mantiene una cobertura boscosa de bosque primario y secundario desde hace muchos años y reconocen la actitud de protección de los recursos naturales que tiene el titulante, pues se conserva el bosque existente y prohibe la cacería en el mismo. En este caso de la valoración de los testimonios citados, y el estudio de suelos que consta en autos, es posible deducir que en el terreno bosque, el cual ha sido debidamente protegido por el titulante. Por su parte, la Ley de Informaciones Posesorias en su artículo sétimo indica que las fincas ubicadas fuera de áreas silvestres protegidas y con bosques, podrían ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal y haber protegido el recurso, sin hacer diferencias si son bosques secundarios o primarios.

Partiendo de estas definiciones y del estudio técnico del INTA visible a folios 21, en el que se hace referencia a que el terrreno esta cubierto de bosques en su totalidad y habiendose protegido el recurso en los terminos exigidos por ley, no se comparte lo señalado por la representante estatal, que el terreno al estar destinado a bosque forma parte del patrimonio natural del Estado, porque de conformidad con el artículo 856 del Código Civil, el fundo es apto para adquirir por usucapión. Por ende, conforme al artículo 7 de la Ley de Informaciones Posesorias, estima el Tribunal que efectivamente fue acreditado con la prueba aportada, el ejercicio de la posesión legal exigida sobre el fundo, con diez años de antelación a la fecha en la que se promovieron este proceso , y el terreno objeto de las presentes diligencias es apto para usucapir al encontrarse fuera de cualquier área silvestre protegida, sea cual fuere su categoría de manejo y haber ejercido actos posesorios de conservación de los recursos naturales. (Al respecto puede ser consultado el voto N°51 de las 15 horas 15 minutos dei 26 de mayo de 1995 de la Sala Primera de la Corte Suprema de Justicia).

IV.Sobre el agravio referente a que la declaración de los testigos no demuestra la posesión decenal, tampoco lleva razón la apelante. Aún y cuando no indica en forma específica el motivo por el cual considera que los mismos no son aptos para acreditar la posesión decenal, del estudio de lo que cada uno depuso se concluye que los tres son contestes en describir una cadena posesoria que comprueba, se ha ejercido la posesión en forma ininterrumpida por parte del promovente y sus transmitentes, y que conocen el terreno desde hace varias décadas, así como no conocer de conflictos posesorios originados en la posesión ejercida sobre el terreno, por lo que se rechaza tal agravio.

V.Con respecto a la solicitud de la declaratoria del área de protección de las corrientes de agua que existen en el inmueble, se indica que al haberse acreditado que en el lindero noreste del fundo se colinda en parte con quebrada Arroyo y al sur con [Dirección11] , debe agregarse a la sentencia apelada, en aplicación del artículo 33 inciso a) de la Ley Forestal y 19 de la Ley de Informaciones Posesorias, que el inmueble queda afecto a las limitaciones de la Ley Forestal, por existir áreas de protección en las riberas de las corrientes de agua indicadas y la consecuente prohibición de eliminación de cobertura vegetal en dichas zonas, además de la declaratoria de dominio público del caudal de la misma y de todos los cursos de agua que existan. En dicho agravio, lleva la razón la apelante.

VI.En razón de lo anterior, en lo apelado, deberá confirmarse lo resuelto y adicionarse a la sentencia apelada que por existir en la colindacia noreste del fundo la quebrada Arroyo y al sur la quebrada Blanco, sea deberá agregar a la sentencia apelada, que en aplicación del artículo 33 inciso a) de la Ley Forestal y 19 de la Ley de Informaciones Posesorias, que el inmueble queda afecto a las limitaciones de la Ley Forestal por la existencia de áreas de protección en las riberas de las corrientes de agua indicadas, y la consecuente prohibición de eliminación de cobertura vegetal en dichas zonas, además de la declaratoria de dominio público del caudal de la misma y de todos los cursos de agua que existan. Tales adiciones deberán ser incluidas en el ejecutoria que el despacho de origen dirija al Registro Público para efectos de la inscripción registral del inmueble

POR TANTO:

Se confirmar la sentencia apelada. Agréguese a lo resuelto, que por existir en la [Dirección12] del [Dirección13] la quebrada Arroyo y al [Dirección8] la quebrada Blanco, en aplicación del artículo 33 inciso a) de la Ley Forestal y 19 de la Ley de Informaciones Posesorias, que el inmueble queda afecto a las limitaciones de la Ley Forestal por la existencia de área de protección en las riberas de las corrientes de agua indicadas. Se prohíbe la eliminación de cobertura vegetal en dichas zonas, y se declara de dominio público el caudal de la quebrada Arroyo y quebrada Blanco y de todos los cursos de agua que existan. Tales adiciones deberán ser incluidas en el ejecutoria que el despacho de origen dirija al Registro Público para efectos de la inscripción registral del inmueble.
