APPEAL ON POINTS OF LAW (RECURSO DE CASACIÓN) filed in the present proceedings brought against [Nombre1]., Nicaraguan, [Identificacion1], AND [Nombre2]., Costa Rican, CED1, son of [Nombre3]. and [Nombre4]., for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges [Nombre5], Jorge Arturo Tabash Forbes, and Víctor Alfonso Dobles Ovares participated in deciding the appeal. Counsel [Nombre6], public defender for the accused persons (imputados) [Nombre1]. and [Nombre2]., and Counsel [Nombre7], representative of the Ministerio Público, appeared in the cassation proceedings.

BACKGROUND (RESULTANDO):

  1. 1By Judgment No. 289-2009, issued at seven hours thirty minutes on primero de octubre de dos mil nueve, the Trial Court of Alajuela ruled: “THEREFORE (POR TANTO): In accordance with the foregoing, the laws cited, Articles 39 and 41 of the Political Constitution; Articles 360, 361, 363, 364, and 367 of the Code of Criminal Procedure; and Article 61 subsection (a), in relation to Article 3 subsection (a), of Ley Forestal 7575, this Court hereby rules: The accused [Nombre1]. AND [Nombre2]. are found criminally responsible as perpetrators of the offense of VIOLATION OF THE LEY FORESTAL, pursuant to Article 61 subsection (a), in relation to Article 3 subsection (a), of Ley 7575, committed to the detriment of NATURAL RESOURCES, and, in that capacity, each is sentenced to ONE MONTH OF IMPRISONMENT, to be served in the appropriate correctional facility, with credit for any pretrial detention (preventiva) served.Because the defendants (encartados) [Nombre1]. AND [Nombre2]. meet the statutory requirements, they are granted the benefit of conditional suspension of sentence (ejecución condicional de la pena) for a period of three years, with the warning that if, during that period, they commit (sic) a new intentional offense punishable by more than six months’ imprisonment, that benefit shall be revoked. The definitive forfeiture (comiso definitivo) of the timber felled, as recorded in the seizure report (acta de decomiso) on page 14, is ordered in favor of the State. Once this judgment becomes final, it shall be entered in the Judicial Registry, and certified copies of the judgment (testimonios de sentencia) shall be forwarded to the appropriate authorities. No specific award of costs is entered. The costs of the proceedings shall be borne by the State. The parties are informed that the taking of evidence and this judgment have been recorded on an audio and video disc; therefore, only the operative portion (parte dispositiva) shall appear in the case file. Should they require a copy thereof, they must provide the appropriate device for that purpose. The parties are hereby notified. [Nombre8], Judge.”
  2. 2Counsel [Nombre6], public defender for the accused [Nombre1]. and [Nombre2]., filed an appeal on points of law against the foregoing ruling.
  3. 3After the corresponding deliberation was conducted in accordance with Article 464 bis of the Code of Criminal Procedure, the Court proceeded to consider the appeal.
  4. 4The relevant statutory requirements have been observed throughout the proceedings.

Drafted by Cassation Judge [Nombre9]; and, CONSIDERING (CONSIDERANDO):

I.Attorney [Nombre10], in his capacity as Public Defender for the accused [Nombre1]. and [Nombre2]., files an appeal in cassation (recurso de casación) against the oral judgment issued by the Court of the Second Judicial Circuit of Alajuela, a decision rendered at seven thirty hours on primero de octubre de dos mil nueve. The first ground asserted concerns the lack of reasoned assessment of the evidence (fundamentación probatoria intelectiva), and is based on Articles 37, 39, and 41 of the Political Constitution and Articles 142, 143, 184, 363 subsection c), and 369 subsection d) of the CPP. The appellant contends that the judgment contains the aforementioned defect “[...] because it fails to analyze evidence important to disprove that my clients were the perpetrators of a violation of Article 61 subsection a) of Ley Forestal No. 5775, and because it fails to analyze the constituent elements of the aforementioned offense” (sic, folio 77).

Counsel proceeds to reproduce the first proven fact (hecho probado) in the judgment, objecting that the a quo merely accepted that aspect of the accusation as true while disregarding other matters. In this regard, he states that witness [Nombre11]. asserted that the defendants were using chainsaws, but no authority seized them; the appellant finds that this reveals an enormous contradiction between his statement and what occurred, particularly because he is the only eyewitness to the events. He emphasizes that the testimony of [Nombre11]. cannot be consistent, as the a quo claims, with that of [Nombre12]., because this person, an official of MINAET, was not at the site when the events occurred, but arrived later, and therefore observed only the stumps and not the timber. He also challenges the decision to credit the testimony of Ms. [Nombre13]., who stated that she had asked the defendants to do her the favor of splitting the timber for her, which was reaffirmed by witness [Nombre13].; accordingly, it was that witness, rather than the defendants, who would make use of the timber, and defense counsel asserts that the injured party (ofendido), [Nombre14], was also aware of this situation.

He therefore maintains that there is no evidence that his clients made use of the timber in any way, because it was established that Ms. [Nombre13]. would use it to repair her house. He adds that it was not established that the accused felled the trees, since they had been cut before the events, yet it was nevertheless accepted as true that his clients felled them. He then adds: “The court had (sic) reasonable doubt in its account of the judgment as to whether or not the trees were used by my clients, but despite this it convicts them of violating section 61 subsection a) of Ley Forestal 7575, which concerns the utilization of forest resources (aprovechamiento de los recursos forestales) and not the felling of the trees as charged and requested by the representative of the Public Prosecutor’s Office in her closing arguments, such that the A-quo (sic) is contradictory as between the first fact found proven and the sanction ultimately imposed, because it has not been established how the cited trees were felled” (folio 79 fte. y vlto.).

The Public Defender proceeds to recount, citing the testimonial evidence as his source, that the trees had been given to Ms. [Nombre13].’s father by [Nombre14]., and that the woman asked his clients to do her the favor of splitting the timber so that she could use it in her house; he therefore considers it proven that Ms. [Nombre13]. was the person who would use the timber and that she caused the accused to act under a mistake (error). He cites Article 3 of Ley Forestal 7575 to support the contention that the conduct undertaken by the defendants cannot be classified as timber utilization (aprovechamiento de madera), without the judgment stating how they benefited from that property. He once again transcribes the first proven fact and once again asserts that the event was not established, because they were hired by [Nombre13]., who caused them to act under a mistake. He asserts that the a quo accepts the foregoing as true and nevertheless fails to analyze those elements.

Finally, he sets out a series of theoretical considerations regarding the importance of a reasoned judgment (fundamentación). The ground is granted. The claim is presented in a somewhat unsystematic manner and, as may be gathered from viewing the video, appears to correspond to the closing arguments made by defense counsel at the conclusion of the trial (debate). Many of the matters asserted are unsupported subjective assessments, such as the irreconcilable contradiction he perceives in the testimony of witness [Nombre11]. arising from the failure to seize the chainsaws, or other similar issues, such as the argument that it was not established that his clients cut the trees (which is also stated in the judgment). However, defense counsel also observes that the judgment fails to provide adequate reasoning concerning an essential element of the statutory definition of the offense (tipo penal), namely, the utilization of the timber.

On that point, he is correct. The oral judgment explains the foregoing aspect as follows: “Article 3 provides a definition of what must be understood as utilization and specifically states, Article 3: for the purposes of this law, timber utilization means the act of cutting or removing standing timber trees, or using fallen trees, carried out on private land. Thus, although the accusation did not charge them with the offense of felling, what is established, what is found proven, is that when Mr. [Nombre15]. arrived, he and the remaining evidence found the defendants herein working on the two bitter cedar logs, and if Mrs. Te. says that she was given timber that had fallen, and if this (sic) is the description provided in section 61 subsection a) in relation to section 3, which is timber utilization, regardless of whether it had fallen or not, because it defines utilization as the act of cutting or the act or use of fallen trees, as could be or is the case here, this falls within the statutory description that must be deemed proven; this is the prohibited conduct that (sic) is attributed as having been undertaken by the defendants herein.

Evidently, if the defendants herein are found with chainsaws working on two logs of bitter cedar timber, it cannot be concluded that they had an intention different from the conduct they were undertaking, which was converting a fallen bitter cedar trunk into logs, into squared timber” (video 8:11:54 a 8:14:41). Thus, the judge accepts as true that the defendants were converting a fallen bitter cedar tree into logs and infers from this that the offense of timber utilization was established (Ley Forestal art. 61.a). He bases this conclusion on Article 3 of the cited law, because the concept of utilization is defined in the first subsection of that provision. However, the a quo considers only that the conduct undertaken by the defendants consisted of the “use of fallen trees carried out on private land,” but does not address the requirement that such conduct “[...] generate or be capable of generating some profit, benefit, advantage, usefulness, or gain for the person undertaking it or for the person whom that individual represents.” This issue was important in the present case because the judgment accepted as true that the defendants acted at the request of Ms. [Nombre13]., who asked them to saw the trunk so that she could use it to repair her house (cfr. video 7:57:58 ss.).

Although the benefit need not be personal, since the provision refers to acting on behalf of another person, neither is an actual benefit required, its potential being sufficient. Notwithstanding the foregoing, the judgment fails to provide reasoning concerning these matters. This omission is not remedied by the judgment’s subsequent reference to the absence of due obedience (obediencia debida) (video 8:18:25 ss.). This is so not only because the approach attempted by the a quo bears no relation whatsoever to the issue that arose at trial, since no order from a competent authority was involved (art. 36 CP). Moreover, the possible mistake cannot be ruled out on the basis that Ms. [Nombre13]. was not paying them and by assuming, without stating any reasons, that the defendants knew their conduct was unlawful. It could only be presumed that the a quo omitted the identified issue because addressing it would have required analyzing elements arising from unlawfully obtained evidence (prueba ilícita).

Indeed, the information that the defendants acted at the request of Ms. [Nombre13]. arises primarily from that woman’s own testimony; after being sworn as a witness, she acknowledged at trial that she had in fact asked them to saw the timber and that she did not know a permit was required for that purpose (cfr. video 9:32:20). The secondary source of that information is no less controversial, because it was introduced by witness [Nombre11]., who went to the site following the report of the events and, upon questioning the accused, was told by them that Ms. [Nombre13]. had entrusted them with the work. In any event, regardless of the reason for omitting the issue, the a quo merely states in the judgment that the defendants were sawing a fallen bitter cedar trunk; it does not explain what the benefit was (actual or potential), who benefited, what relationship existed between that person and the defendants, or why it considered that the latter knew their conduct was unlawful.

All the foregoing matters necessarily required consideration in the present case and are not adequately addressed in the oral judgment. The appellant must therefore be found correct on this point, and for that reason the judgment is vacated and a new adjudication of the case is ordered; because it is unnecessary, no ruling is made on the other claims contained in this ground or on the second ground of this appeal.

POR TANTO:

The first ground of the appeal in cassation filed by the defendants’ Public Defender is granted. The oral judgment and the trial from which it arose are vacated, and a new adjudication of the case in accordance with law is ordered. Because it is unnecessary, no ruling is made on the remaining claims. NOTICE SHALL BE GIVEN.

RECURSO DE CASACIÓN interpuesto en la presente causa seguida contra [Nombre1]., nicaragüense, [Identificacion1] , Y [Nombre2]. costarricense, CED1 , hijo de [Nombre3]. y [Nombre4]., por el delito de INFRACCIÓN A LA LEY FORESTAL, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces [Nombre5] , Jorge Arturo Tabash Forbes y Víctor Alfonso Dobles Ovares. Se apersonaron en casación, el licenciado [Nombre6] , defensor público de los imputados [Nombre1]. y [Nombre2]., y la licenciada [Nombre7] , representante del Ministerio Público .

RESULTANDO:

  1. 1Que mediante sentencia número 289-2009, de las siete horas treinta minutos del primero de octubre de dos mil nueve, el Tribunal de Juicio de Alajuela, resolvió: "POR TANTO: De conformidad con lo expuesto, leyes citadas y artículos 39 y 41 de la Constitución Política; 360, 361, 363, 364, 367, del Código Procesal Penal, 61 inciso a), en relación con el artículo 3 incis a) de la Ley Forestal 7575, este Tribunal resuelve: Declara a los imputados [Nombre1]. Y [Nombre2]. autores responsables del delito de INFRACCIÓN A LA LEY FORESTAL, según el artículo 61 inciso a), en relación con el artículo 3 inciso a) de la Ley 7575, cometido en perjuicio de LOS RECURSOS NATURALES, y en tal carácter se les impone una pena de UN MES DE PRISIÓN a cada uno, que deberán descontar en el establecimiento carcelario respectivo previo abono de la preventiva que hubiere sufrido. En razón de que los encartados [Nombre1].Y [Nombre2]. reúnen los requisitos de ley, se les concede el beneficio de ejecución condicional de la jpena, por un plazo de tres años, bajo la advertencia que si en ese lapso comenten (sic) nuevo delito doloso sancionado con pena superior a los seis meses les será revocado tal beneficio. Se ordena el comiso definitivo de la madera talada según acta de decomiso de folio 14, a favor del Estado. Firme este fallo, inscríbase en el Registro Judicial y remítanse los testimonios de sentencia a las autoridades respectivas. Se resuelve sin especial condenatoria en costas. Quedan los gastos del proceso a cargo del Estado. Se informa que la recepción de la prueba y la presente sentencia, quedan grabados en un disco de audio y video, por lo que en el expediente únicamente constará la parte dispositiva, en caso que requieran una copia del la misma, deben aportar el dispositivo correspondiete para tal efecto. Quedan las partes notificadas. [Nombre8] , Juez".
  2. 2Que contra el anterior pronunciamiento, el licenciado [Nombre6] , defensor público de los imputados [Nombre1]. y [Nombre2]., interpuso recurso de casación.
  3. 3Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 464 bis del Código Procesal Penal, el Tribunal procedió a conocer el recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez de Casación [Nombre9] ; y,

CONSIDERANDO:

I.El licenciado [Nombre10] , en su condición de Defensor Público de los acusados [Nombre1]. y [Nombre2]., formula recurso de casación en contra de la sentencia oral dictada por el Tribunal del Segundo Circuito Judicial de Alajuela, decisión de las siete horas con treinta minutos del primero de octubre de dos mil nueve. El primer motivo esgrimido se refiere a la falta de fundamentación probatoria intelectiva, mismo que se fundamenta en los artículos 37, 39 y 41 de la Constitución Política y 142, 143, 184, 363 inciso c) y 369 inciso d) del CPP. Estima el quejoso que la sentencia presenta el vicio aludido "[...] por no analizar prueba importante para desacreditar a mis defendidos como el autores de infringir el artículo 61 inciso a) de la Ley Forestal No. 5775, como por no analizar los elementos constitutivos del delito aludido" (sic, folio 77). El letrado procede a reproducir el hecho probado primero del fallo, reprochando que el a quo se haya limitado a tener por cierto tal aspecto de la acusación, dejando de lado otros aspectos.

En el anterior sentido señala que el testigo [Nombre11]. afirmó que los encartados utilizaban motosierras, pero ninguna autoridad decomisó las mismas, encontrando el impugnante que ello señala una enorme contradicción entre su dicho y lo ocurrido, máxime que es el único testigo presencial de los hechos. Resalta que la declaración de [Nombre11]. no puede ser coincidente, como afirma el a quo, con la de [Nombre12]., pues esta persona, funcionario del MINAET, no estuvo en el sitio cuando se dieron los hechos, sino posteriormente y de allí que únicamente observara los tocones y no la madera. También cuestiona que se haya creído en la declaración de la señora [Nombre13]., quien relató que ella solicitó a los encartados que le hicieran el favor de rajarle la madera, lo que fue reafirmado por el testigo [Nombre13]., de allí que quien aprovecharía la madera era dicha testigo y no los encartados, afirmando el defensor de tal situación también era conciente el ofendido [Nombre14].

De allí que afirma que no existe prueba de que sus representados aprovecharan de alguna manera la madera, pues quedó acreditado que sería la señora [Nombre13]. que la utilizaría para reparar su casa. Agrega que no se acreditó que los acusados talaran los árboles, pues los mismos habían sido cortados antes de los hechos, pese a ello se tuvo por cierto que sus patrocinados los talaron. A continuación agrega: "El juzgado tubo (sic) en su relato de sentencia duda razonable de si los árboles fueron aprovechados o no por mis representados, pero pese a ello los condena por infringir el numeral 61 inciso a) de la Ley Forestal 7575, que corresponde al aprovechamiento de los recursos forestales y no de la tala de los árboles como lo acusó y solicito la representante del Ministerio Público en sus conclusiones, siendo que el A-quo (sic) es contradictorio entre el hecho primero tenido por demostrado y la sanción que al final impone, pues no está acreditado como aconteció la tala de los árboles citados" (folio 79 fte. y vlto.).

El defensor público procede a relatar, mencionando como fuente la prueba testimonial, que los árboles habían sido regalados al padre de la señora [Nombre13]. por [Nombre14]., que dicha señora les pidió a sus representados que le hicieran el favor de rajarle la madera para aprovecharla en su casa, por ello estima que está demostrado que la señora [Nombre13]. sería quien aprovecharía la madera y que ella hizo incurrir en error los acusados. Cita el artículo 3 de la Ley Forestal 7575, para sustentar que la acción desplegada por los justiciables no puede catalogarse de aprovechamiento de madera, sin que la sentencia diga de qué manera ellos aprovecharon dicho bien. Nuevamente vuelve a transcribir el primer hecho probado y nuevamente vuelve a afirmar que tal evento no quedó acreditado, pues fueron contratados por [Nombre13]., quien los hizo incurrir en error. Afirma que el a quo tiene por cierto lo anterior y a pesar de ello no analiza tales elementos.

Finalmente procede a señalar una serie de aspectos teóricos sobre la importancia de la fundamentación. Con lugar el motivo. El planteamiento del reclamo es poco sistemático y tal parece que corresponde, conforme se desprende de la observación del video, a las conclusiones vertidas por el defensor al finalizar el debate. Muchos de los temas esgrimidos corresponden a apreciaciones subjetivas sin amparo alguno, tal como la insalvable contradicción que observa en la declaración del testigo [Nombre11]. derivada del no decomiso de las motosierras u otras cuestiones similares, como el argumento de que no se acreditó que sus representados cortaran los árboles (lo que también se afirma en sentencia). Pero también repara el defensor en que la sentencia no fundamenta debidamente un aspecto esencial del tipo penal, a saber el aprovechamiento de la madera. En ello lleva razón. La sentencia oral fundamenta el anterior aspecto de la siguiente manera: "El artículo 3 da una definición de lo que debe tener como aprovechamiento y concretamente se dice, artículo 3: para los efectos de esta ley se considera aprovechamiento maderable, acción de corta, eliminación de árboles maderables o en pie o la utilización de árboles caídos, realizada en terrenos privados.

De tal manera que si la acusación no le atribuyó el delito de tala, de tal manera que lo que logra, lo que se tiene como probado es que don [Nombre15]. al llegar encuentra y el resto de prueba, encuentra a los aquí encartados trabajando las dos trozas de cedro amargo y si doña Te. dice que a ella le regalaron una madera que estaba caída y si este (sic) es la descripción que hace el numeral 61 en su inciso a) en relación con el 3, que es el aprovechamiento de madera, independientemente de que la misma este caída o no, porque define aprovechamiento como la acción de corta o la acción o la utilización de árboles caídos, como podría o es el presente asunto, esta en la descripción típica que debe tenerse como probada, esta es la acción típica a la cual (sic) se le esta atribuyendo como desplegada por los aquí encartados. Evidentemente a los aquí encartados si se les encuentra con motosierras trabajando en dos trozas de madera amargo de cedro amargo, no puede concluirse que tenían una intención distinta a esa que estaban desplegando que eran convirtiendo en trozas, en escuadras, lo que era un tronco de cedro amargo caído" (video 8:11:54 a 8:14:41).

De tal manera que el señor juez tiene por cierto que los encartados se encontraban convirtiendo en trozas un árbol de cedro amargo que estaba caído y de allí desprende que se configura el delito de aprovechamiento de madera (Ley Forestal art. 61.a). Tal aspecto lo fundamenta en el artículo 3 de la citada ley, pues el concepto de aprovechamiento es definido en el inciso primero de tal norma. Sin embargo, el a quo únicamente repara en que la acción desplegada por los justiciables consiste en la «utilización de árboles caídos realizada en terrenos privados», pero no se pronuncia respecto a la exigencia de que dicha conducta «[...] genere o pueda generar algún provecho, beneficio,ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa». Tal cuestión resultaba importante en la presente causa, pues en sentencia se tuvo por cierto que los encartados actuaron por encargo de la señora [Nombre13]., quien les pidió que aserraran dicho tronco para utilizarlo en reparación de su casa (cfr. video 7:57:58 ss.).

Si bien el provecho no tiene que ser personal, pues se alude a la actuación en nombre de otra persona, así como tampoco se requiere un beneficio efectivo, aceptándose la potencialidad del mismo. A pesar de lo anterior, lo cierto es que la sentencia pasa por alto la fundamentación de tales aspectos. No se solventa la anterior omisión con la alusión que posteriormente se hace en el fallo la inexistencia de la obediencia debida (video 8:18:25 ss.). No solamente por no corresponder en absoluto el abordaje intentado por el a quo con tema surgido en debate, pues no se estaba en presencia de una orden de autoridad competente (art. 36 CP). Además el posible error no cabe descartarlo partiendo de que la señora [Nombre13]. no les pagaba y dando por supuesto, sin indicar las razones, de que los encartados sabían que su conducta era ilegal. Únicamente cabría presumir que el tema señalado es omitido por el a quo en razón de que el abordaje del mismo habría exigido analizar elementos surgidos de prueba ilícita.

En efecto, el dato respecto a que los encartados actuaron bajo encargo de la señora [Nombre13]., surge principalmente de la propia declaración de esta señora, quien luego de ser juramentada como testigo reconoce en juicio que efectivamente ella les pidió que aserraran la madera y que ignora que se ocupaba un permiso para ello (cfr. video 9:32:20). No menos controversial es la fuente secundaria de dicha información, pues es introducida por el testigo [Nombre11]., quien a raíz de la denuncia de los hechos se presentó al lugar y al inquirir a los imputados estos le manifestaron que la labor se la había encargado la señora [Nombre13]. En todo caso, sea cual fuera la razón por la cual se omite el tema, el a quo en sentencia se limita a decir que los encartados se encontraban aserrando un tronco de cedro amargo que se encontraba caído, no explica cuál era el provecho (efectivo o potencial), a quién aprovechaba, cuál era la relación existente entre dicha persona y los encartados y por qué razón estimaba que estos últimos conocían de la ilicitud de su proceder.

Todos los anteriores aspectos surgían como de necesario abordaje en el presente asunto y no son debidamente tratados en el fallo oral. En lo anterior debe concedérsele razón al impugnante y por tal razón se anula el fallo disponiéndose la nueva sustanciación de la causa, por innecesario se omite pronunciamiento sobre otros reclamos contenidos en el presente motivo y también sobre el segundo motivo del presente recurso.

POR TANTO:

Se acoge el primer motivo del recurso de casación presentado por el defensor público de los encartados. Se anula la sentencia oral, así como el debate que le dio origen, se dispone la nueva sustanciación de la causa conforme a Derecho. Por innecesario se omite pronunciamiento sobre los restantes reclamos. NOTIFÍQUESE.
