Document Review *019002800472PE* Res: 2009-00628 THIRD CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at seventeen hours and seventeen minutes on the twenty-ninth of April of two thousand and nine.
Cassation appeal (recurso de casación) filed in the present case brought against Nombre01, of legal age, resident of Siquirres, national identity card number CED02; for the crimes of fraud (estafa) and use of a forged document (uso de documento falso), to the detriment of the Instituto de Desarrollo Agrario and public faith (Fe Pública). The following Justices participated in deciding the appeal: Carlos Chinchilla Sandí, Ana Eugenia Sáenz Fernández, Lilliana García Vargas, Carlos Estrada Navas, and María Elena Gómez Cortés, the latter four serving as Substitute Justices (Magistrados Suplentes). Also participating is attorney Carlos Luis Redondo Gutiérrez, as private defense counsel (defensor particular) for the defendant (encartado). The representative of the Ministerio Público also appeared.

Considering:
I.Appeal by attorney Carlos Luis Redondo Gutiérrez, private defense counsel for the accused (imputado) Nombre01. In his first ground based on procedural defects (vicios de forma), he alleges a violation of the principle of continuity and concentration. In this regard, he argues that in accordance with article 364 of the Código Procesal Penal, the full reading of the judgment is authorized after the deliberation period has ended, but that this provision does not permit the Court to draft the judgment in an interrupted and discontinuous manner, because continuity and concentration must be maintained without variation, even after the close of deliberation and until notification to the defendant and the other parties. He argues that the law requires members of collegiate courts to "actively participate in the deliberation and decision" (article 8 of the Código Procesal Penal). The claim is not upheld.
Our criminal procedural rules distinguish between the deliberation phase and the judgment-drafting phase (articles 360, 361, and 364 of the same code), and in light of this, this Chamber has noted that it is during the first phase that the collegiate body — in plenary session — must discuss and decide on each of the matters brought before it, and that the drafting phase consists of putting into writing the result of the prior deliberative process (see, in this regard, resolutions No. 555, of 9:30 hours, of June 8, 2001, and No. 1127, of 9:20 hours, of September 30, 2000). The aforementioned article 360 sets out the requirements that the deliberation phase must satisfy in the case of collegiate courts, namely:
II.As a second ground, the appellant alleges that the judgment is based on an omitted and contradictory statement of reasons. The appellant argues that in Considerando III (proven facts), the Court stated that it had not been proven that the IDA suffered a financial loss (perjuicio patrimonial), and that on the basis of that argument the defendant was acquitted of the crime of fraud; nonetheless, in Considerando Nombre02 of the judgment, it is stated that the purposes and objectives of that institution — to provide land to peasant farming families (campesinos) — were harmed, since a parcel was titled in favor of persons who did not demonstrate that they were a peasant farming family. Nor was the harm to potential beneficiaries specified. Furthermore, the appellant argues that his client's conviction rests on the harm to the institution's interests in ensuring that land ownership fulfills the social function demanded by the Constitución Política and the law, and that the Court failed to assess the fact that adjudicatees Nombre02 and Nombre03 possessed the parcel and devoted it to agricultural purposes.
Finally, he submits that the Court does not explain how, by assigning the parcels to the persons cited, the gradual increase of productivity was left unpromoted, since the Court failed to take into account Ley 2825 (Ley de Tierras y Colonización), which assigns that function to the IDA. The claim cannot succeed. There is no contradictory reasoning of the kind the appellant seeks to demonstrate, nor is any prejudice to the interests of his client shown. The Court effectively acquitted the defendant of the crime of fraud due to the absence of one of the objective elements of the offense — namely, the absence of a financial loss — ; however, it found him responsible for the crime of ideological falsity, to the extent that it was established that he introduced false data into the technical forms (fichas técnicas) that served as the basis on which the Board of Directors of the IDA adopted the agreement to assign the parcels, as well as for the drafting of the deeds.
For the offense in question to be constituted, it is not a required element of the offense that an actual financial loss exist; it suffices that the conduct "may cause harm," and such harm may be financial or of another nature. The argument offered by the Court relates precisely to this possible harm to other persons who did possess the status of peasant farmers — a status that co-defendants Nombre02 and Nombre03 did not possess, since one is a physician while the other is an attorney — thereby preventing compliance with the provisions of Ley 2825 (Ley de Tierras y Colonización), which establishes in its first article: "1.- To determine that land ownership shall be promoted for the gradual increase of its productivity and for a fair distribution of its product, elevating the social condition of the peasant farmer and making him a conscious participant in the economic and social development of the Nation [...]"; consequently, it is irrelevant whether Nombre02 and Nombre03 devoted the parcel in part to activities that could be characterized as agricultural, insofar as that land was not assigned to peasant farmers, which are the persons to whom, pursuant to law, the land in question must be assigned. For the foregoing reasons, the claim is rejected.
III.As the third ground of appeal, the appellant alleges contradictory intellectual reasoning (fundamentación intelectiva contradictoria) in the judgment. In this regard, the appellant contends that the intellectual line of reasoning (discurso intelectivo) offered by the judges in the judgment is contradictory, because, insofar as the defendant is acquitted of the offenses of fraud (estafa) and use of a false document (uso de documento falso), he is simultaneously convicted of documentary forgery (falsedad documental). The appellant argues that the prosecution's indictment (acusación fiscal) and the criminal complaint (querella) held that the offenses of forgery and use of a false document were committed in connection with fraud, but the Tribunal sided with the theory of a single offense — ideological forgery (falsedad ideológica) — finding no harm caused in the fraud, and acquitting the defendant of the offense of use of a false document on the grounds that it was not proven that he had presented the documents before the IDA.
Furthermore, the appellant contends that in Considerando II.1 of the judgment, the judges indicate that the IDA was dispossessed of its assets when land belonging to that institution was granted to persons who did not meet the legal requirements; yet in Considerando V, the judges state that it was not established that the IDA suffered a patrimonial loss, which the appellant views as a manifest inconsistency. The appellant further argues that the defendant's ultimate purpose was land titling (titulación) and, therefore, in the preparation of the false document and its use before the IDA, there existed a means-to-an-end relationship, making it untenable to posit the existence of the end offense while attributing only the means offense, since the very reason for the forgery was to defraud the institution in order to benefit a third party. The claim is rejected. With respect to the argument regarding the alleged patrimonial loss, the appellant must abide by the preceding considerando.
Now, in order to determine the existence of a unity of action (unidad de acción), the following must be verified: a) the existence of the phenomenological connection (temporal and spatial) described by the rule; and b) the existence of a single specific intent underlying that harmful external act (Sala Tercera, resolución 101-F, of nine o'clock on March 3, 1995). Subsequently, in order to refine the foregoing concepts, this Chamber stated: "if one proceeds from the premise that an action is a bodily movement guided by a purpose — that is, the externalization of that purpose — both aspects must be verified in order to determine whether one or more actions exist. If the functional and phenomenological proximity (temporal and spatial) of the act evidences a single purpose, it constitutes a single action" (Sala Tercera, resolución 719-F, of nine forty-five in the morning on November 22, 1996).
Determining whether a unity of action or a plurality of actions exists are two exercises in judicial interpretation of primary importance before establishing the existence of a concurrence of offenses (concurso de delitos), particularly a real concurrence (concurso material), which, according to the description in article 22 of our Código Penal, refers to the scenario of a single perpetrator who commits several offenses separately or jointly, and which entails a serious sanction (article 76 of the Código Penal). According to the proven facts (hechos probados) of the judgment, it was not possible to attribute to the defendant the offenses of fraud or use of a false document; the possibility of an ideal concurrence (concurso ideal) of those offenses in that hypothesis is therefore excluded. The only thing that was unequivocally established is that the defendant, on two separate occasions, proceeded to enter false data concerning co-defendants A. and Nombre02 in the titling records (fichas de titulación), neither of whom met the legal requirements for land titling, by means of which they obtained the registration of real property (proven facts 1 through 9, visible at folios 627 through 629).
That being so, it remains to be analyzed whether these facts concur materially. A simple reading of the proven facts suffices to conclude that each of the acts attributed to the defendant is perfectly distinguishable, since there is no spatiotemporal unity between them: the first titling record was prepared on August 21, 1998, while the second was prepared on November 4 of that same year, which leads to the conclusion that the rules governing the real concurrence of offenses apply. The existence of a unity of action, as the appellant contends, is therefore completely ruled out, since continuity was broken. Accordingly, the claims lack merit and must be rejected.
IV.As the fourth ground of appeal, the appellant alleges insufficient reasoning in the finding that the acts attributed to the defendant concur in real concurrence. The appellant argues that the judgment convicts his client of two counts of ideological forgery in real concurrence, yet fails to explain clearly and exhaustively whether this constitutes a single criminal act, or a single action giving rise to multiple legal injuries, or whether the acts are truly separate and mutually exclusive, given that the Tribunal concludes that real concurrence exists solely because the acts are distinct. The complaint is dismissed. In its intellectual analysis, the Tribunal stated: "Regarding the concurrence of offenses, two offenses of Ideological Forgery (Falsedad Ideológica) are constituted by the insertion of false information into the Technical Records (Fichas Técnicas) — information that those documents were required to verify — the first record dated August 21, 1998 and the second dated November 4, 1998; there is therefore a real concurrence of offenses, since two distinct acts are involved." The judgment must be understood as a logical-legal whole; accordingly, from a reading of the proven facts, it is clear that two perfectly distinguishable acts are involved, for which the defendant was sentenced, as resolved in the preceding considerando.
Legal doctrine holds that: "The existence of a real concurrence presupposes, first and foremost, the existence of a plurality of actions. The verification of this plurality takes place in negative form: there will be a plurality of actions if the unity of action is ruled out." (BACIGALUPO, Enrique. Manual de Derecho Penal, Editorial Temis, Santa Fe de Bogotá, Colombia, 1996, p. 250.) This is a homogeneous real concurrence, since independent actions are present that injured the same legally protected interest (bien jurídico tutelado); however, the continuing offense (delito continuado) cannot be applied, inasmuch as the legally protected interests at stake are not of a patrimonial nature, as established by article 77 of the Código Penal. In conclusion, it is not established that the Tribunal's reasoning was insufficient or unlawful with respect to the existence of a real or material concurrence of offenses, as alleged by the appellant; the claim is therefore rejected.
V.As the fifth ground of appeal, the appellant alleges illegitimate reasoning regarding the facts attributed to the defendant due to deficient evidentiary assessment, on the grounds that the Tribunal did not analyze report PE 902-2000 of August 16, 2000, which would have allowed it to infer that the defendant's conduct was not willful (dolosa) but rather a deficiency of an administrative nature. The appellant also contends that no account was taken of co-defendant Nombre02's possession of the parcel for more than 10 years, in addition to the fact that the Tribunal likewise fails to explain the basis for its conclusion that Ley 2825 or the special procedure (the "Ley del Burro") could not apply to professionals by virtue of the transfer of rights from parents or grandparents who had occupied land for a long time. The Tribunal cites no evidence to support the position that the IDA distributes only parcels of 5 or 6 hectares.
Finally, in the appellant's view, the conviction for ideological forgery is premised on the finding that the special exceptional procedure was not applicable to co-defendants Nombre02 and Nombre03, on the grounds that they were professionals and no socioeconomic study was conducted on them. The claim is dismissed. Contrary to what the appellant contends, the report was assessed by the Tribunal. Thus, at folio 644, the admission into evidence of the "Administrative Proceeding (Proceso Administrativo) 1-99 brought by the IDA against Mr. Nombre01, comprising folios 1 through 205," is recorded — a file in which the report whose absence is alleged is contained; however, upon verification of the report's conclusions, findings different from those put forward by the appellant are established. The report expressly states: "It is therefore clear that the procedure carried out by Mr. Nombre01 with respect to the first resolution was the result of personal action and not of the ordinary management of the offices involved, which caused a resolution of adjudication, partition (segregación), and transfer of title to be adopted without the sufficient and necessary elements to ensure that it was grounded in reality and in the law.
Furthermore, that first resolution, as handled by Mr. Nombre04, lifted the encumbrances on the parcel without there being any procedure in place to verify the existence of the administrative default (morosidad administrativa) referenced by the said official in the titling record." (folio 37 of the case file). Regarding the second act attributed to the defendant, the following is added: "This Office, like the Directing Body (Órgano Director), considers that the second record that was filled out — which gave rise to a second resolution to adjudicate, partition, and title the parcel in question in the name of the indicated parties — had as its sole and exclusive purpose to circumvent the Institute's normal procedures, the suspension resolution, and, of course, to mislead the Board of Directors (Junta Directiva), which was induced to adopt a resolution to title a parcel whose execution it had itself previously suspended." (folio 39).
From the foregoing excerpts, one cannot conclude, as the appellant contends, that a mere administrative infraction was involved, since it was the Board of Directors of the Instituto de Desarrollo Agrario itself that, through office PE-108-2001 of January 18, 2001, visible at folio 2 of the case file, transmitted the notitia criminis to the Ministerio Público, on the grounds that the defendant's actions constituted a criminal offense. As for the remaining arguments regarding the alleged possession of more than 10 years by co-defendant Nombre02 and the applicability of the so-called "Ley del Burro," as well as the size of the parcels distributed by the IDA, these are irrelevant and do not negate the typicality (tipicidad), unlawfulness (antijuricidad), and culpability (culpabilidad) of the defendant with respect to the acts that were found to be proven — namely, the insertion of false information into public documents on two separate occasions. Accordingly, the claim is dismissed.
VI.As the sixth ground of appeal, the appellant challenges the judgment for insufficient reasoning, insofar as the judgment established that the falsity of the document was due to the fact that the titling forms (fichas de titulación) recorded that the parent parcel (finca madre) had exhausted its registered area. He contends that this error is evident in light of the registry certification submitted during the trial proceedings to better inform the court, which the judges failed to analyze. The Tribunal errs in stating that the accused could not sign the titling forms in three capacities — as agrarian technician (agrarista), regional deputy chief (subjefe regional), and regional director — since the basis for that inference is not apparent from the record. Finally, the judges also err in finding it established that the accused knew that the Board of Directors of IDA had suspended the first proceeding, which prompted the initiation of the second proceeding, since he never personally received notification of the suspension of the resolution — from which the appellant concludes that there was no criminal intent (dolo) on the part of the accused.
The appellant's argument is without merit. The judgment, in its intellectual analysis, was sufficiently clear in establishing what the false statements inserted in each of the documents consisted of, as explained below: "[…] the first form, prepared on August 21, 1998, lists parcel number 94 according to cadastral plan (plano catastrado) L-468950-98, with an area of 37 hectares 1047.63 meters; on the reverse side of the form there is a section where Mr. Nombre01. signs stating that Mr. Nombre02. and Ms. Nombre03, as the possessor and allottee (adjudicatario) of the above-referenced parcel, having met the corresponding requirements, is recommended for the delivery of the respective title deed. This statement inserted in the technical form is false, since, as witnesses Nombre05, mbre06. and mbre01 testified, these individuals did not meet the requirements to be allottees, and in any event no socioeconomic study (estudio socioeconómico) had been conducted for them.
Another false statement found in this technical form appears in the observations section, which reads: authorization is requested for the transfer without establishing the limitations of ley 2825, due to: 1) the parent parcel has exhausted its registered area, and 2) administrative delinquency owing to the lengthy period of occupation of the said land. Another section indicated that the mode of acquisition was by purchase in the year 1987. This was likewise false, since the parcel was purchased in the year 1997, when the company Ansa S.A. bought it — and it was not even purchased by Ms. (sic) mbre03. and Mr. mbre02. Moreover, because their occupation of the parcel was recent, there could be no administrative delinquency. All of these false statements inserted in the technical form were known to Mr. mbre01, since he had many years of service at the Institution and because it was established that he had a friendship with Ms. mbre03. and with Mr. mbre02" (folio 650).
As can be seen, it was not only the matter of the parcel's area that the Tribunal concluded was false, but also the status of the alleged beneficiaries (co-accused mbre03. and mbre02.), the absence of a socioeconomic study, and the length of possession of the property. Thus, challenging only one aspect of the false information introduced (exhaustion of the registered area) in the document at issue is of no consequence, insofar as other equally false data were proven, and that challenge therefore cannot eliminate the elements of the offense (tipicidad) charged. Regarding the second document, the judgment states: "In the second technical form dated November 4, 1998, the parcel is identified as number 86, according to cadastral plan 468950-98, and the purchase date is given as October 7, 1997, which was correct; no observations were entered; however, it was recorded that Engineer mbre06. expressly stated that Mr. mbre03. and Mr. mbre02, as the possessor and allottee of the above-referenced parcel, having met the corresponding requirements, is recommended as such for delivery of the title deed.
Below the foregoing statement appears the signature (sic) of mbre07., national identity document CED01. This statement was false because neither Ms. mbre03. nor Mr. mbre02. were allottees of IDA, nor had a socioeconomic study been conducted for them, and moreover, Engineer mbre06. and agrarian technician mbre04. both consistently stated that they had not signed the technical form, since Mr. mbre04. indicated that the beneficiaries had not followed the allotment process, and Mr. mbre06. had not even seen the form. In this case, as with the previous form, the accused mbre01., in order to benefit his friends Ms. mbre03. and Mr. mbre02., proceeded to sign the technical form in all three spaces — that of the agrarian technician, that of the Regional Deputy Director, and in his capacity as Regional Director — thereby violating the internal procedure, which provided that signing in all three spaces was not permissible since the procedure required oversight by the field technician, the regional deputy director, and finally the Regional Director; so much so that in the case of the second form, the agrarian technician, after conducting the inspection, decided not to sign the form, since the procedures had not been followed and it had not been determined whether the beneficiaries qualified; nevertheless, despite this situation, Mr. mbre01., taking advantage of the position he held at the time, bypassed all oversight mechanisms, signed in all three spaces, and sent the form to the titling office, where the Board of Directors of IDA ultimately issued the Title Deed." (folio 651; emphasis added) The Tribunal derives its conclusion that the accused could not sign in three functional capacities — logically, by reason of the oversight principle that must govern every administrative proceeding — from documentary evidence, specifically from the administrative proceeding file brought against the accused herein, which culminated in his dismissal, together with the testimony of witnesses Nombre05, re06., and re07., who consistently affirm that such conduct was improper.
Finally, regarding the accused re04's knowledge of the suspension of the first allotment resolution — raised for the purpose of negating criminal intent in his conduct — this is likewise explained by the accused's objective conduct in completing the second information form. Logically, there had to be a reason for it, since it would make no sense, under the rules of logic and common experience, to initiate a new proceeding if the first one had run its normal course. It is obvious that the accused was aware of this situation, since it was likewise proven that "All of these false statements inserted in the technical form were known to Mr. re01, since he had many years of service at the Institution and because it was established that he had a friendship with Ms. re03. and with Mr. re02." (folio 651; emphasis added). For the foregoing reasons, the claim is dismissed.
VII.As the seventh ground of appeal, on procedural grounds, the appellant claims insufficient reasoning in the Tribunal's characterization of the titling forms as public documents. The appellant contends that the Tribunal does not explain the public character of the titling forms, since these are merely working instruments, and that while the accused was indeed a public official, he did not exercise public faith (fe pública) in his acts. Under the same arguments, but in his second substantive claim, the appellant alleges beyond-intent (preterintención) under Article 360 of the Criminal Code (regarding the public character of the document), since in the defense counsel's view the forms do not possess the essential characteristic of being public documents. The grounds of appeal are denied. Contrary to the appellant's position, the Tribunal does provide reasoning for its conclusion that the titling forms are public documents.
In this regard, the judgment states: "[…] we must indicate that the technical form is not merely a working instrument, as argued by the defense; it is a public document in which data concerning the parcels to be titled and the beneficiaries are recorded. This document is submitted to the Board of Directors of IDA, which, on the basis of it, orders or declines to order the titling of a parcel, and it is with that same document that notaries prepare the deeds to be submitted to the Public Registry. These documents record the data from the agrarian inspection, and also include data concerning the beneficiaries and the approval of the Regional Deputy Director and the Regional Director, all of whom are public officials holding public faith (sic), so that the Board of Directors, relying on the public faith that such documents carry, orders the titling of the parcels." (folio 654). Furthermore, regarding the concurrence of the objective elements of the offense (tipicidad objetiva) of ideological falsification (falsedad ideológica), this Chamber has stated that: "One of the objective elements of this criminal offense is precisely that the document must be public or authentic.
This requirement is a normative element of the offense, which requires interpretation by the legal practitioner in order to define the content of what is considered a public document. In this regard, Article 369 of the Code of Civil Procedure provides that: 'Public documents are all those that have been drafted or issued by public officials, in the required form and within the scope of their authority.' Moreover, for the offense of ideological falsification to be established, pursuant to Article 360 of the Criminal Code, it is required not only that the document be public, but also that the act consist of inserting or causing to be inserted false declarations therein, concerning a fact that the document is intended to prove […]" (Sala Tercera, resolución 1294-2004, nine thirty-five a.m., November 12, 2004). Having established that accused Nombre04 prepared both titling forms in the exercise of his duties, inserting false data, this gives rise to the commission of two offenses of ideological falsification in real concurrence (concurso material). For the reasons set forth above, the claims are rejected.
VIII.As the first ground on the merits, the appellant argues a violation of Articles 22 and 76 of the Penal Code through erroneous application, and of Articles 21 and 75 of the same code through non-observance. The appellant contends that Articles 22 and 76 of the Penal Code were violated because the accused did not carry out independent, mutually exclusive acts, given that the conduct was directed toward land titling (titulación). On the first occasion, it was thwarted by the recommendation of notary Gen Palma, and therefore no administrative or legal effect was produced. The accused then prepared a new proceeding, which was effectively completed. The property was registered in the names of Nombre02. and Nombre03. in a single deed and not in two; consequently, there is only one act and not two, constituting at most an ideal concurrence (concurso ideal), for which reason the appellant requests that the conduct be reclassified and that his client be granted the benefit of a suspended sentence (ejecución condicional).
The appellant is incorrect. Regarding the existence of two perfectly distinguishable acts that give rise to the application of the rules of real concurrence (concurso material), the appellant is referred to what was resolved in considerando Nombre02 of this ruling. It must be taken into account, contrary to what defense counsel asserts, that the preparation by the accused of the first application file (ficha) did in fact produce administrative and legal effects, namely the suspension of the titling agreement with co-accused Nombre02. and Nombre03., upon the detection of irregularities in the proceedings followed. For the foregoing reasons, the application of the rules of ideal concurrence and the requested reclassification are both impossible, and accordingly the claim must be rejected.
IX.As the third ground on the merits, a violation of Article 360 of the Penal Code is raised (absence of harm). The appellant's argument is based on the fact that the Tribunal found that no financial harm existed for the IDA, but did find harm for the potential beneficiaries of the parcels, on the ground that the offense is a material and concrete-danger offense and not one of abstract danger. The defect is not sustained. The appellant proceeds from the mistaken notion that financial harm must exist in this case in order for the objective elements of the offense (tipicidad objetiva) to be established. It must be recalled that there are countless situations in which harm is of a different nature. In the harm and its potential lies the justification for criminal law to sanction this type of criminal conduct, in keeping with the harmfulness principle (lesividad) as applied to legal interests essential to society as a whole.
We are speaking here of a requirement that goes beyond the mere injury presumed to be intrinsic to every criminal offense that respects the demands of the Rule of Law. However, this requires clarification, because it does not mean that, in addition to the injury to public faith (fe pública), an injury to another distinct legal interest must also be established in order to satisfy the objective elements of the offense — which appears to be the appellant's understanding. In the case of public or authentic documents, these are presumed, by their very nature, to be true erga omnes. Therefore, if one of these instruments is forged and subsequently used in an appropriate manner, there is the possibility that it will generate an erroneous judgment about what it purports to represent. It is here that the requirement of a possibility of harm is located. This possibility must be distinguished from the impairment of the protected legal interest which, as noted, is included in every offense.
It involves something more — either when it is expressly required by the offense definition, or when it is considered an indispensable element — as in the offense of using a forged document — even if it is not stated in the provision. Thus, it is affirmed that "The character of the document, the suitability of the forgery, and the possibility of harm form a unity around the criminal-law concept of public faith, at least in the chapter on documentary forgeries" (CREUS, Carlos. Falsificación de documentos en general, 2a. edición actualizada, Buenos Aires, Argentina, Editorial Astrea, p.6.). That possibility of harm is linked to the injury to public faith that the forgery represents, and a reciprocal relationship arises, so to speak: injury to public faith implies the possibility of harm to other legal interests or interests worthy of protection, precisely because of the value public faith confers upon those documents.
In order to injure public faith efficiently — that is, in order for the conduct to be found to satisfy the elements of the offense — there must be a possibility that it will cause harm. The author cited above states in this regard: "normally the very forgery — above all when it falls upon public documents — can already be identified as an impairment of public faith insofar as the document that carries it has been distorted; but that effect is not typically sufficient; the law requires that to that eventual 'abstract' injury there be added the concrete one of the possibility of harm to other legal interests (distinct from public faith), which may be of varied nature: financial, moral, political, and must belong to a third party, that is, they must be owned by someone other than the agent of the forgery. That effect must come directly from the forgery, from what it represents for the extinction or creation of rights, powers, and obligations." (ibid, p. 69) What has been said is quite clear when dealing with public documents, which by themselves and according to law must be deemed true and have an undeniable significance in the field of legal certainty (seguridad jurídica), so that their forgery could already in itself be said to constitute the possibility of harm, which moreover "[…] may fall upon any interest; it is not restricted to those of a strictly economic character, nor even to those of a material nature, nor to those of a private nature: it extends to intangible ones, to public ones; even honor and political interests and those that the State may have in the performance of certain activities or in the regulation for the granting of certain authorizations are mentioned as included" (ibid, p.75).
In the specific case, the lower court (a quo) found the existence of potential harm for those persons who do meet the legally established requirements to qualify as subjects eligible for land allocation (adjudicación de tierras) through titling. It states: "[…] yes, the aims and objectives of the IDA as an institution were harmed — providing land to peasant families who work the land and are dependent on subsistence agriculture — the harm lies in the fact that ultimately the IDA titled a thirty-seven-hectare parcel in favor of Nombre03. and Nombre02., who did not follow the procedures established by the Institution to carry out a titling and who were not shown to be a peasant family dependent on a subsistence economy, since each of them had a profession that generated income […]" (folio 654). For the foregoing reasons, the claim must be rejected.

The cassation appeal (recurso de casación) filed by Licenciado Carlos Luis Redondo Gutiérrez, private defense counsel for the accused J., is hereby declared without merit.

Revisión del Documento *019002800472PE* Res: 2009-00628 SALA TERCERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diecisiete horas con diecisiete minutos del veintinueve de abril de dos mil nueve.
Recurso de casación interpuesto en la presente causa seguida contra Nombre01 , mayor de edad, vecino de Siquirres, cédula de identidad número CED02 ; por el delito de estafa y uso de documento falso, en perjuicio de Instituto de Desarrollo Agrario y la Fe Pública. Intervienen en la decisión del recurso los Magistrados Carlos Chinchilla Sandí, Ana Eugenia Sáenz Fernández, Lilliana García Vargas, Carlos Estrada Navas y María Elena Gómez Cortés, los cuatro últimos como Magistrados Suplentes. Intervienen además el licenciado Carlos Luis Redondo Gutiérrez, como defensor particular del encartado. Se apersonó el representante del Ministerio Público.
Resultando:
Considerando:
I.Recurso del licenciado Carlos Luis Redondo Gutiérrez, defensor particular del imputado Nombre01 . En su primer motivo por vicios de forma, alega violación al principio de continuidad y concentración. En ese sentido, plantea que de conformidad con el artículo 364 del Código Procesal Penal, se autoriza la lectura integral del fallo con posterioridad al término de la deliberación, pero no le permite al Tribunal la elaboración de la sentencia de manera interferida e interrumpida, porque la concentración y continuidad debe mantenerse invariable, aun después del cierre de la deliberación y hasta la notificación al imputado y demás partes. Que la ley exige a los integrantes de los Tribunales colegiados “intervenir activamente en la deliberación y decisión (artículo 8 del Código Procesal Penal). No se acoge el reclamo. Nuestra normativa procesal penal, diferencia las fases de deliberación y de redacción de la sentencia (numerales 360, 361 y 364 ejúsdem) y, al tenor de ello, esta Sala ha hecho ver que es en el primer momento, que el cuerpo colegiado –en pleno– debe discutir y decidir acerca de cada una de las cuestiones que se someten a su conocimiento y, que en la fase de redacción, de lo que se trata es de poner por escrito el resultado del anterior proceso deliberativo (al respecto, resoluciones Nº 555, de 9:30 horas, del 8 de junio de 2001, y N° 1127, de 9:20 horas, del 30 de septiembre de 2000). En el citado artículo 360, se establecen los requisitos que debe cumplir la fase de deliberación tratándose de tribunales colegiados, a saber:
II.Como segundo motivo, se alega fundamentación omisa y contradictoria del fallo. Argumenta el recurrente que en el considerando III (hechos probados), el Tribunal dice que no se probó que el IDA hubiera sufrido un perjuicio patrimonial, y que con ese argumento se absuelve al imputado por el delito de estafa, no obstante en el considerando Nombre02 de la sentencia, se afirma que se lesionaron los fines y objetivos de dicha institución, de dotar de tierras a familias campesinas, pues se tituló una parcela a personas que no demostraron ser familia campesina. Tampoco se precisó el daño respecto de los posibles destinatarios. Además, que la condena de su representado estriba en la lesión a los intereses institucionales de darle a la propiedad de la tierra, la función social que la Constitución Política y la ley le exigen y que el Tribunal no valoró que los adjudicatarios Nombre02. y Nombre03, poseían la parcela y la dedicaban a fines agrícolas.
Por último, considera que el Tribunal no explica cómo, con la asignación de la parcelas a las personas cita das, se dejó de promover el aumento gradual de la productividad, pues no tomó en cuenta la Ley 2825 (Ley de Tierras y Colonización), que le asigna dicha función al IDA. El reclamo no puede prosperar. No existe el razonamiento contradictorio que intenta evidenciar el recurrente, ni tampoco se demuestra el perjuicio que se le causa a los intereses de su defendido. El Tribunal efectivamente absuelve al imputado por el delito de estafa, ante la carencia de uno de los elementos objetivos del tipo (ausencia de perjuicio patrimonial), sin embargo, lo encuentra responsable por el delito de falsedad ideológica, en el tanto quedó demostrado, que éste introdujo datos falsos en las fichas técnicas que servían de base, para que se tomara el acuerdo de asignar las parcelas por parte de la Junta Directiva del IDA, así como también para la confección de las escrituras.
Para que se configure el delito de comentario, no es requisito del tipo que exista un perjuicio patrimonial efectivo, sino que basta con que la conducta “pueda causar perjuicio”, siendo que éste puede ser patrimonial o bien de otra naturaleza. El argumento que brinda el Tribunal, justamente tiene que ver con este posible perjuicio a otras personas que sí poseían la condición de campesinos, condición que no poseían los coencartados Nombre02. y Nombre03 , pues uno es médico mientras que la otra es abogada, con lo que se impedía cumplir con lo establecido en la Ley 2825 (Ley de Tierras y Colonización), que establece en su artículo primero: “1.- Determinar que la propiedad de la tierra se debe promover para el aumento gradual de su productividad y para una justa distribución de su producto, elevando la condición social del campesino y haciéndolo partícipe consciente del desarrollo económico-social de la Nación […]”; de ahí que carezca de relevancia si los señores Nombre02. y Nombre03 , dedicaban la parcela en parte a actividades que podían ser calificadas como agrícolas, en el tanto, dicha tierra no le fue asignada a campesinos, personas a las cuales debe, de acuerdo con la ley, ser asignada la tierra objeto de discusión. Por lo expuesto, se rechaza el reclamo.
III.Como tercer motivo, se alega fundamentación intelectiva contradictoria de la sentencia. En este sentido, menciona el recurrente que es contradictorio el discurso intelectivo ofrecido por los Jueces en la sentencia, pues, en el tanto absuelven al imputado por el delito de estafa y uso de documento falso, se le condena por la falsedad documental. Que la acusación fiscal y la querella consideran que se dieron los delitos de falsedad y uso de documento falso con ocasión de estafa, pero el Tribunal se inclina por la tesis de un solo ilícito, falsedad ideológica, al no existir perjuicio en la estafa y por no probarse que el imputado presentara los documentos ante el IDA, se le absolvió del delito de uso de documento falso. Además, que en el considerando II.1 de la sentencia, se hace ver que el IDA fue despojado de su patrimonio, al concedérsele tierras pertenecientes a esa institución, a personas que no reunían los requisitos de ley, pero en el considerando V, hacen ver los Jueces que no se acreditó que el IDA sufriera un perjuicio patrimonial, lo cual constituye en su criterio, una incongruencia manifiesta.
Que el propósito último del imputado, era la titulación y por tanto, en la confección del documento falso y su utilización ante el IDA, había una relación de medio a fin, por lo que resulta insostenible la tesis de la existencia del delito fin y la atribución del delito medio, pues la razón de ser de la falsedad, era el fraude a la institución por querer favorecer a un tercero. Se rechaza el reclamo. En cuanto al argumento sobre el supuesto perjuicio patrimonial, debe el recurrente atenerse al considerando anterior. Ahora bien, para determinar la existencia de una unidad de acción ha de verificarse: a) la existencia de la vinculación fenoménica (temporal y espacial) que describe la norma; y, b) la existencia de una misma intencionalidad específica subyacente a ese movimiento exterior lesivo (Sala Tercera, resolución 101-F, de las nueve horas del 3 de marzo de 1995). Con posterioridad, a fin de precisar los anteriores conceptos, esta Cámara indicó: "si se parte de que la acción es un movimiento corporal presidido por una finalidad, es decir la exteriorización de esa finalidad, debe estarse a la constatación de ambos aspectos para determinar la existencia de una o más acciones.
Si la proximidad funcional y fenoménica (temporal y espacial) del hecho evidencian una sola finalidad, se tratará de una sola acción" (Sala Tercera, resolución 719-F, de las nueve horas cuarenta y cinco minutos del 22 de noviembre de 1996). La determinación de si existe una unidad de acción o una pluralidad de éstas, resultan ser dos actividades de interpretación judicial de primordial importancia antes de establecer la existencia de un concurso de delitos, muy especialmente del concurso material, el cual, según la descripción del artículo 22 de nuestro Código Penal, se refiere a la hipótesis de un mismo autor que comete separada o conjuntamente varios delitos, y que implica un supuesto sancionatorio grave (artículo 76 del Código Penal). Según los hechos probados de la sentencia, no fue posible atribuirle al imputado los delitos de estafa ni uso de documento falso, es decir, queda excluida la posibilidad de un concurso ideal de dichos delitos en tal hipótesis.
Únicamente se logró demostrar de manera inequívoca, que el imputado, en dos ocasiones distintas, procedió a consignar datos falsos de los coencartados A. y Nombre02 , en las fichas de titulación, siendo que ninguno de los dos cumplía con los requisitos exigidos por ley para la titulación de tierras, con lo cual logran la inscripción de inmuebles (hechos probados 1 al 9 visibles a folios 627 al 629). Así las cosas, queda por analizar si estos hechos concurren materialmente. Basta una simple lectura a los hechos tenidos por probados, a fin de concluir que cada una de las conductas atribuidas al imputado, son perfectamente diferenciables pues no existe una unidad espacio temporal entre ellas, pues la primer ficha es confeccionada el 21 de agosto de 1998, mientras que la segunda el 4 de noviembre de ese mismo año, lo cual nos hace concluir que son de aplicación las reglas relativas al concurso material de delitos.
Lógicamente se descarta por completo, la existencia de una unidad de acción, tal y como lo pretende el recurrente, puesto que se perdió la continuidad. Así las cosas, los reclamos carecen de sustento y se impone su rechazo.
IV.Como cuarto motivo, se señala falta de fundamentación al acreditarse los hechos en concurso real. Indica el impugnante que la sentencia condena a su defendido por dos delitos de falsedad ideológica en concurso material, sin embargo, no explica clara y exhaustivamente si correspondió a un solo hecho delictivo o a una sola acción con diversidad de lesiones jurídicas, o bien, se trata de realmente de acciones separadas y excluyentes entre sí, ya que el Tribunal concluye que se trata de un concurso material únicamente porque se trata de acciones distintas. Se declara sin lugar el reproche. El Tribunal en su análisis intelectivo, indicó: “En cuanto al concurso de delitos en primer término se configuran dos delitos de Falsedad Ideológica al insertar en las Fichas Técnicas información falsa que tales documentos debían probar la primera ficha en fecha 21 de agosto de 1998 y la segunda el 04 de noviembre de 1998, tenemos entonces un concurso material de delitos por tratarse de dos acciones distintas.” La sentencia debe entenderse como una unidad lógico jurídica, de ahí que de la lectura de los hechos probados, se infiere que se trata de dos hechos perfectamente diferenciables, por los que se sentenció al imputado, tal y como se resolvió en el considerando anterior.
En doctrina se afirma que: “La existencia de un concurso real presupone, en primer lugar, la existencia de una pluralidad de acciones. La comprobación de esta pluralidad tiene lugar en forma negativa: habrá pluralidad de acciones si se descarta la unidad de acción.” (BACIGALUPO, Enrique. Manual de Derecho Penal, Editorial Temis, Santa Fe de Bogotá, Colombia, 1996, p. 250.) Se trata de un concurso real homogéneo, pues se está en presencia de acciones independientes que lesionaron el mismo bien jurídico tutelado, sin embargo no es posible la aplicación del delito continuado, en el tanto no estamos en presencia de bienes jurídicos de carácter patrimonial, según lo establece el artículo 77 del Código Penal. En conclusión, no se comprueba que la fundamentación del Tribunal, haya sido insuficiente o ilegal, en torno a la existencia de un concurso real o material de delitos, tal y como se alegó por el recurrente, por lo que se rechaza el reclamo.
V.Como quinto motivo, el impugnante indica fundamentación ilegítima de los hechos atribuidos al imputado por deficiente valoración probatoria, pues el Tribunal no analizó el informe PE 902-2000 del 16 de agosto del 2000, el cual le hubiera permitido inferir que la actuación del imputado no fue dolosa, sino una deficiencia de carácter administrativo. Además que no se tomó en cuenta la posesión de la parcela por parte de Nombre02. por más de 10 años, aunado al hecho de que el Tribunal tampoco explica de dónde deduce que la Ley 2825 o el procedimiento especial (“Ley del Burro”), no podía tutelar a profesionales por transmisión de derechos de padres o abuelos, que habían ocupado terrenos por mucho tiempo. El Tribunal no cita ninguna probanza para apoyar la tesis de que el IDA sólo entrega parcelas de 5 ó 6 hectáreas. Por último, en criterio del recurrente, la condena por falsedad ideológica parte de la base de que a los coimputados Nombre02. y Nombre03 , no les era aplicable el trámite excepcional anotado, pues eran profesionales y no se les realizó un estudio socioeconómico.
Sin lugar el reclamo. Contrario a lo que indica el recurrente, el informe fue valorado por el Tribunal. Así se consigna a folio 644, la incorporación del “Proceso Administrativo 1-99 seguido por el IDA contra el señor Nombre01. conformado por fl. 1 a 205 folios”, legajo en el que se encuentra el informe que se echa de menos; sin embargo, verificadas las conclusiones del mismo, se establecen soluciones diferentes a las apuntadas por el recurrente. Expresamente el informe menciona: “Es claro entonces, que el trámite realizado por el señor Nombre01. en lo que respecta al primer acuerdo, obedeció a una acción personal y no a la gestión propia de las oficinas involucradas, lo que provocó que se tomara un acuerdo de adjudicación, segregación y traspaso en propiedad, sin que se contara con los elementos suficientes y necesarios para ello, de tal manera que fuera ajustado a la realidad y al Derecho.
Además, ese primer acuerdo, según lo gestionado por el señor Nombre04, levantaba las limitaciones sobre la parcela sin que existiera un procedimiento para verificar la existencia de la morosidad administrativa a la que hace referencia el citado funcionario en la ficha de titulación.” (folio 37 del expediente). En cuanto al segundo hecho atribuido al justiciable, se agrega: “Esta Presidencia al igual que el Órgano Director considera que la segunda ficha que se llenó y que dio lugar a un segundo acuerdo para adjudicar, segregar y titular la parcela de marras a los administrados indicados, tenía como único y exclusivo fin burlar los procedimientos normales del Instituto, el acuerdo de suspensión y por supuesto burlar a la Junta Directiva, la que fue inducida a tomar un acuerdo para titular una parcela que de previo ella misma había suspendido en su ejecución.” (folio 39). De lo anteriormente trascrito, no se puede concluir, tal y como lo pretende quien recurre, que se estuviera en presencia de una simple falta administrativa, ya que es la propia Junta Directiva del Instituto de Desarrollo Agrario, mediante oficio PE-108-2001 de 18 de enero de 2001, visible a folio 2 del expediente, quien traslada la notitia criminis al Ministerio Público, por considerar que las acciones del imputado constituían delito.
En cuanto a los restantes argumentos sobre la supuesta posesión por más de 10 años de parte del coimputado Nombre02. y la aplicación o no de la llamada “Ley del Burro”, así como la medida de las parcelas entregadas por el IDA, son irrelevantes y no eliminan la tipicidad, antijuricidad y culpabilidad del imputado en los hechos que se tuvieron por demostrados, al haber insertado hechos falsos en documentos públicos, en dos ocasiones distintas. Así las cosas, procede desestimar el reclamo.
VI.Como sexto motivo, el recurrente reprocha fundamentación insuficiente de la sentencia, por cuanto la sentencia estableció, que la falsedad del documento se debe a que se consignó en las fichas de titulación que la finca madre tenía agotada el área en el registro. Que ese error es evidente frente a la certificación registral aportada en el debate para mejor proveer y que los Jueces no analizaron. El Tribunal se equivoca al indicar que el imputado no podía suscribir las fichas de titulación bajo las tres condiciones de agrarista, subjefe regional y director regional, pues no se extrae de donde infiere tal argumento. Por último, yerran también los Jueces al tener por cierto que el imputado tenía conocimiento de que la Junta Directiva del IDA había suspendido el primer trámite, por lo cual ordena realizar el segundo trámite, ya que nunca recibió una notificación personal acerca de la suspensión del acuerdo, con lo cual –concluye- no existió dolo del imputado.
No lleva razón el recurrente. La sentencia, en su análisis intelectivo fue suficientemente clara en establecer en qué consistieron las falsedades insertas en cada uno de los documentos, así se explica: “ […] la primera ficha confeccionada en fecha 21 de agosto de 1998, indica parcela número 94 según plano catastrado L-468950-98 con un área de 37 hectáreas 1047,63 metros, en el reverso de la ficha se observa un apartado en donde el señor Nombre01. firma diciendo que el señor Nombre02. y la señora Nombre03 , quien es poseedor y adjudicatario de la parcela arriba indicada, por haber cumplido con los requisitos correspondientes se recomienda para la entrega del título de propiedad respectivo. Tenemos que esta afirmación insertada en la ficha técnica es falsa, pues según lo informan los testigos Nombre05, mbre06. . y mbre01 , , estas personas no cumplían con los requisitos para ser adjudicatarios y en todo caso no se les había realizado el estudio socioeconómico.
Otra falsedad encontrada en esta ficha técnica se observa en el apartado de observaciones cuando se indica: se solicita autorizar el traspaso sin establecer limitaciones de la ley 2825 debido a: 1) La finca madre tiene agotada el área en el registro y 2) debido a morosidad administrativa por al largo tiempo de ocupar dichos terrenos. En otro de los apartados se indicó que la forma de adquisición fue por compra en el año 1987. Esta situación también era falsa, por cuanto la compra de la finca fue en el año 1997, cuando la compañía Ansa S.A compró la parcela, ni siquiera fueron los señora (sic) mbre03. . y mbre02 . . Además debido a que tenían una reciente ocupación de la parcela no podía haber mora administrativa. Todas estas falsedades insertas en la ficha técnica eran de conocimiento del señor mbre01 , , pues él tenía muchos años de servicio en la Institución y porque quedó acreditado que lo unía una relación de amistad con la señora mbre03. . y con el señor mbre02 ” ” (folio 650).
Como se comprueba, no es sólo lo referente al área de la finca que el Tribunal concluyó que era un dato falso, sino también lo referente a la condición de los supuestos beneficiarios (los coimputados mbre03. . y mbre02. . ), la carencia de estudio socioeconómico y el tiempo de posesión del inmueble. Así, pierde relevancia que se cuestione sólo uno de los aspectos de la falsedad introducida (agotamiento de la cabida), en el documento de comentario por parte del justiciable, en el tanto se demostraron otros datos igualmente falsos y que por tanto, no tiene dicha discusión la virtud de eliminar la tipicidad del delito atribuido. En cuanto al segundo documento, se dice: “En la segunda ficha técnica de fecha 04 de noviembre de 1998, se indica que la parcela es la número 86, según plano catastrado 468950-98 y se refiere que la fecha de compra es 07 de octubre de 1997, lo cual era correcto, no se ponen observaciones; sin embargo, se consignó que el Ing. mbre06. . expresamente manifestaba que los señores mbre03. . y mbre02 , , quien es poseedor y adjudicatario de la parcela arriba indicada, por haber cumplido con los requisitos correspondientes y se recomienda como tal para la entrega del título de propiedad.
Se tiene que al pie de la anterior manifestación aparece la fima (sic) mbre07. . cédula CED01. Esta afirmación era falsa por cuanto ni la señora mbre03. . ni el señor mbre02. . eran adjudicatarios del IDA, ni se les había llevado a cabo un estudio socioeconómico, aunado a ello el Ing mbre06. . y el técnico agrario mbre04 . . fueron contestes al indicar que ellos no habían firmado la ficha técnica ya que el señor mbre04. . indicó que los beneficiarios no habían seguido el proceso de adjudicación y el señor mbre06. . ni siquiera había visto la ficha. En este caso como en la ficha anterior, el imputado mbre01. . con el fin de favorecer a sus amigos la señora mbre03. . y el señor mbre02 , , procedió a firmar la ficha técnica en los tres espacios, el del técnico agrarista, en el espacio del Sub Director Regional y en calidad de Director Regional, ello violentando el procedimiento interno que indicaba que no era posible rubricar en los tres espacios pues el procedimiento tenía que tener un control, tanto del técnico de campo, del sub director regional y finalmente del Director Regional, tan es así que en el caso de la segunda ficha, el técnico agrario luego de llevar a cabo la inspección decide no firmar la ficha, pues no se habían seguido los procedimientos y no se había determinado si los beneficiarios calificaban; no obstante, pese a esta situación, el señor mbre01. . aprovechando el puesto que en ese momento ocupaba, se brinca todos los controles, firma en los tres espacios y envía la ficha a titulación, donde finalmente la Junta Directiva del IDA entrega el Título de Propiedad.” (folio 651; el destacado no es del original) El Tribunal deriva que el imputado no podía firmar en las tres calidades funcionales, (lógicamente por un principio de control que se debe llevar en todo procedimiento administrativo), de la prueba documental, específicamente del expediente del procedimiento administrativo, que se llevó en contra del aquí encartado, que culminó con su despido, aunado a las declaraciones de los testigos Nombre05, re06. y. y re07 , q , quienes son contestes en afirmar que tal proceder era incorrecto.
Por último, y en cuanto al conocimiento de la suspensión del primer acuerdo de adjudicación por parte del imputado re04 , a , a efecto de eliminar el dolo en la conducta, igualmente se explica en la conducta objetivizada del imputado, al llenar la segunda ficha de información. Lógicamente tenía una razón de ser, pues no tendría sentido, de acuerdo con las reglas de la lógica y la experiencia común, que se iniciara un nuevo trámite, si el primero había discurrido normalmente. Es obvio que el imputado conocía tal situación, pues igualmente se demostró que “Todas estas falsedades insertas en la ficha técnica eran de conocimiento del señor re01 , p , pues él tenía muchos años de servicio en la Institución y porque quedó acreditado que lo unía una relación de amistad con la señora re03. y. y con el señor re02 .” .” (folio 651; el destacado no es del original). Por las razones anteriores, no se acoge el reclamo.
VII.Como sétimo motivo por razones de forma, se reclama insuficiente fundamentación al apreciar las fichas de titulación como documentos públicos. Menciona el recurrente que el Tribunal no explica la naturaleza pública de las fichas de titulación, ya que éstas constituyen simples instrumentos de trabajo y que si bien es cierto, el imputado era funcionario público, no tenía fe pública en sus actuaciones. Bajo los mismos argumentos, pero en su segundo reclamo por el fondo, se alega preterintención del artículo 360 del Código Penal (naturaleza pública del documento), pues en criterio del abogado defensor, las fichas no poseen la característica esencial de ser documentos públicos. Se declaran sin lugar los motivos. Contrario al criterio del recurrente, el Tribunal sí fundamenta por qué considera que las fichas de titulación, son documentos públicos. Al respecto se menciona: “ […] debemos indicar que la ficha técnica, no es sólo un instrumento de trabajo, como lo alegó la defensa, es un documento público en donde se consignan datos referentes a las parcelas a titular y los beneficiarios, este documento va a la Junta Directiva del IDA, que con base en el mismo ordena la titulación o no de una parcela y con ese mismo documento los notarios llevan a cabo las escrituras que se presentarán al Registro Público; en estos documentos se consignan los datos de la inspección agraria, también se insertan datos referentes a los beneficiarios y el visto bueno del Sub Director Regional y del Director Regional, todos ellos funcionarios públicos, con fé (sic) pública, por lo que la Junta Directiva, partiendo de la Fe Pública que ostentan tales documentos ordena la titulación de las parcelas.” (folio 654).
A mayor abundamiento y sobre la concurrencia de los elementos de tipicidad objetiva del delito de falsedad ideológica, esta Sala ha indicado que: “Uno de los elementos objetivos de esta figura penal, es precisamente que se trate de un documento público o auténtico. Este requisito es un elemento normativo del tipo, que requiere de interpretación por parte del operador del derecho, a fin de darle contenido a lo que se considera es un documento público. En ese sentido, el artículo 369 del Código Procesal Civil señala, que: “Son documentos públicos todos aquellos que hayan sido redactados o extendidos por funcionarios públicos, según las formas requeridas y dentro del límite de sus atribuciones”. Por otro lado, para que el delito de falsedad ideológica se configure, de acuerdo con el artículo 360 del Código Penal, se requiere no sólo que el documento sea público, sino también que la acción sea insertar o hacer insertar declaraciones falsas en el mismo, concernientes a un hecho que el documento deba probar […] ” (Sala Tercera, resolución 1294-2004, de las nueve horas treinta y cinco minutos, del 12 de noviembre de 2004).
Habiéndose comprobado que el imputado Nombre04 , confeccionó sendas fichas de titulación, en ejercicio de sus funciones, insertando datos falsos, de ahí la configuración de dos delitos de falsedad ideológica en concurso material. Por lo expuesto anteriormente, se rechazan los reclamos.
VIII.Como primer motivo por el fondo, se argumenta violación a los artículos 22 y 76 del Código Penal por errónea aplicación, y 21 y 75 del mismo cuerpo legal por inobservancia. Menciona el recurrente que se violentan los artículos 22 y 76 del Código Penal ya que el imputado no realizó acciones independientes, excluyentes entre sí, pues la acción estaba orientada hacia la titulación. En la primera ocasión se frustró por la recomendación del notario Gen Palma, por lo que no se produjo ningún efecto administrativo ni jurídico. Luego, el imputado prepara un nuevo trámite, lo cual ocurrió de manera efectiva. La finca fue inscrita a Nombre02. y Nombre03. en una sola escritura y no en dos, consecuentemente estamos en presencia de una sola acción y no de dos, constituyendo a lo sumo un concurso ideal, con lo cual solicita se recalifique la conducta y se le conceda el beneficio de ejecución condicional a su representado.
No lleva razón el recurrente. En torno a la existencia de dos acciones perfectamente diferenciables, que dan origen a la aplicación de las reglas del concurso material, estése el recurrente a lo resuelto en el considerando Nombre02 de la presente resolución. Debe tomarse en cuenta, contrario a lo expuesto por el defensor, que la elaboración por parte del encartado, de la primer ficha, sí produjo efectos administrativos y jurídicos, cuales fueron la suspensión del acuerdo de titulación a los coimputados Nombre02. y Nombre03. , al haberse detectado anomalías en los trámites seguidos. Por lo anterior, resulta imposible la aplicación de las reglas del concurso ideal y la recalificación pretendida y en consecuencia se impone rechazar el reclamo.
IX.Como tercer motivo por razones de fondo, se plantea violación al artículo 360 del Código Penal (ausencia de perjuicio). Se fundamenta el recurrente en que el Tribunal consideró que patrimonialmente no existía perjuicio para el IDA, pero si estimó un perjuicio para los posibles beneficiados con las parcelas, siendo que el delito es material y de peligro concreto y no abstracto. No se acoge el vicio. El recurrente parte de la errónea concepción, de que debe existir un perjuicio patrimonial en el presente caso, a efectos de que exista la tipicidad objetiva. Debe recordarse que existen un sinnúmero de situaciones, en las que el perjuicio tiene otra naturaleza. En el perjuicio y su potencialidad está la legitimación para que el derecho penal pueda sancionar este tipo de conductas delictivas, atendiendo al principio de lesividad a bienes jurídicos esenciales para el conglomerado social. Hablamos aquí de una exigencia que va más allá de la mera lesión que se supone intrínseca en todo tipo penal respetuoso de las exigencias del Estado de Derecho.
Sin embargo, esto merece ser precisado pues no significa que a la lesión de la fe pública deba agregársele a su vez la lesión a otro bien jurídico distinto, para acreditar la tipicidad de la conducta, que es lo que parece entender el recurrente. En el caso de los documentos públicos o auténticos, se presumen, por su propia naturaleza, verdaderos erga omnes. Por ello, si se falsifica uno de estos instrumentos y luego se utiliza, en forma idónea, existe la posibilidad de que genere un juicio errado sobre lo que se supone representa. Aquí es donde se ubica la exigencia de la posibilidad de perjuicio. Esta posibilidad debe distinguirse del menoscabo al bien jurídico tutelado que, según se dijo, está incluido en todo delito. Se trata de algo más, bien cuando está expresamente exigido en el tipo, bien cuando se considere que es elemento indispensable -como sucede en el delito de uso de documento falso- aunque no se enuncie en la norma.
Así, se afirma que “El carácter del documento, la idoneidad de la falsificación y la posibilidad de perjuicio, forman unidad en torno al concepto jurídico penal de la fe pública, al menos en el capítulo de las falsedades documentales” (CREUS, Carlos. Falsificación de documentos en general, 2a. edición actualizada, Buenos Aires, Argentina, Editorial Astrea, p.6.). Esa posibilidad de perjuicio va unida a la lesión a la fe pública que la falsedad representa y surge, por así decirlo, una relación biunívoca: la lesión a la fe pública implica la posibilidad de perjuicio para otros bienes jurídicos o intereses merecedores de tutela, precisamente por el valor que ella otorga a esos documentos. Para lesionar la fe pública en forma eficiente es decir, para estimar típica la conducta, debe estarse en posibilidad de que ésta cause perjuicio. El autor antes citado al respecto señala: “normalmente la misma falsedad ‑sobre todo cuando recae sobre documentos públicos- puede señalarse ya como un menoscabo de la fe pública en cuanto se ha deformado el documento que la lleva; pero ese efecto no es típicamente suficiente; la ley exige que a esa eventual lesión “abstracta” se sume la concreta de la posibilidad de perjuicio de otros bienes jurídicos (distintos de la fe pública), que pueden ser de variada naturaleza: patrimonial, moral, política, y deben pertenecer a un tercero, es decir, tienen que ser de titularidad de alguien que no sea el agente de la falsificación.
Ese efecto tiene que provenir directamente de la falsificación, de lo que ella represente para la extinción o creación de derechos, facultades y cargas.” (ibid, p. 69) Lo dicho es bastante claro cuando se trata de documentos públicos, que por sí mismos y según la ley, deben reputarse verdaderos y tienen una innegable trascendencia en el campo de la seguridad jurídica, de modo que su falsedad podría decirse que ya en sí misma configura la posibilidad del perjuicio, que además “[…] puede recaer sobre cualquier bien; no se restringen a los de carácter propiamente económico, ni siquiera a los de índole material, ni a los de naturaleza privada: se extienden a los inmateriales, a los públicos; hasta se mencionan como comprendidos la honra y los intereses políticos y los que puede tener el Estado en el cumplimiento de determinadas actividades o en la reglamentación para la concesión de ciertas habilitaciones” (ibid, p.75).
En el caso concreto, el a-quo consideró la existencia de un perjuicio potencial para las personas que sí reúnen los requisitos establecidos en la ley, para ser sujetos de adjudicación de tierras mediante titulación. Así menciona: “ […] sí se lesionaron los fines y objetivos del IDA como Institución, el dotar de tierras a familias campesinas, trabajadoras de la tierra, dependientes de una agricultura de subsistencia, el perjuicio radica en el hecho de que finalmente el IDA tituló una parcela de treinta y siete hectáreas a favor de los señores Nombre03. y Nombre02 , quienes no siguieron los procedimientos establecidos por la Institución para llevar a cabo una titulación y quienes no se demostró fueran una familia campesina, dependiente de una economía de subsistencia, pues cada uno tenía una profesión que le generaba ingresos […] ” (folio 654). Por las razones expuestas, debe rechazarse el reclamo.
Por Tanto:
Se declara sin lugar el recurso de casación formulado por el Licenciado Carlos Luis Redondo Gutiérrez, defensor particular del imputado J .
