SIMPLE EXECUTORY PROCEEDING (proceso ejecutivo simple), brought before the Sixth Civil Court of Larger Claims (Juzgado Sexto Civil de Mayor Cuantía) of San José, under case file number EXPN1. Filed by [Nombre1], who assigned his rights to INMOBILIARIA VINKONK SOCIEDAD ANONIMA, represented by its special attorney-in-fact (apoderada especial) [Nombre2], who granted a special judicial power of attorney to attorney Alvaro Emilio Castro Garnier, against VIAJES ROCA S.A., INVERSIONES SIEVERT Y [Nombre3] S.A., COSMOS TOURS S.A., ASESORES CENTROAMERICANOS DE TURISMO S.A., SICATICO S.A., and SERVICIOS TURISTICOS DE PRIMERA CLASE S.A., all represented by their general attorney-in-fact (apoderado generalísimo) ROBERTO [Nombre3] SIEVERT, and against the latter in his personal capacity, who granted a special judicial power of attorney in his dual capacity to attorney Jorge Gerardo Cerdas Pérez. By virtue of an appeal (recurso de apelación) filed by the defendant party, this Court takes up the order (auto) of fifteen hours thirty minutes on the thirteenth of March, two thousand and seven, which rejects the procedural fraud motion (incidente de fraude procesal) filed by the defendant party. It likewise rejects the absolute nullity motion (incidente de nulidad absoluta).

The opinion is drafted by Judge Víquez Herrera; and

WHEREAS:

I.The special judicial attorney (mandatario especial judicial) for defendant Viajes Roca, S.A. bases his challenge to the indicated ruling on the argument that procedural fraud can be established not only during the cognition phase of a proceeding but also during the enforcement phase; furthermore, that the criminal sentence on which the motion is grounded became final and binding only at an advanced stage of the civil proceeding. He also argues that the procedural fraud has persisted over time and that a declaration thereof does not become time-barred; therefore, no procedural technicality or formalism may be imposed upon such a declaration.

II.The challenged ruling, among other things, summarily rejects a procedural fraud motion, stating therein that this is not the appropriate avenue for what is sought, given the existence of a final judgment in which the plaintiff's claims were granted.

III.In view of that ruling and the challenge thereto, this Court finds itself before a case file that has required lengthy study, given the numerous motions the parties have filed and the evidentiary submissions they have introduced. Upon completion of its review, the proceedings are in the enforcement phase and have not yet been concluded. Against this backdrop, it becomes necessary to highlight the content of Article 100 of the Code of Civil Procedure (Código Procesal Civil). This provision, which forms part of the general section of that Code as well as of the Chapter concerning the powers and duties of the judge, states that "at any moment when, given the circumstances of the specific case, the judge is convinced that the plaintiff or the defendant used the proceeding to carry out a simulated act or to achieve a purpose prohibited by law, the judge shall issue a judgment preventing the parties from attaining their objectives…." This provision, which applies to all types of proceedings, does not at any point establish that such a ruling must be issued before the judgment is handed down, since not every proceeding includes that type of resolution.

Nor does the provision indicate that the ruling must be made in the judgment contemplated for the proceeding in which a possible procedural fraud has been denounced; note that, since this provision imposes a duty upon the judge, the judge could even declare the fraud on his or her own motion. Furthermore, although Article 100 does not specify the procedural vehicle by which the parties must seek a declaration of procedural fraud, since this constitutes an exceptional circumstance within a proceeding, the incidental proceeding (proceso incidental) is the ideal vehicle, as it is a special, ancillary, and cognition-based proceeding that allows the parties to exercise their right of defense adequately and to provide the adjudicator with the elements necessary to determine whether fraud is or is not established with certainty. In this regard, Article 483 of the Code of Civil Procedure does not limit the use of the incidental proceeding; on the contrary, in general terms its first paragraph states: "the incidental motion shall be admitted when it bears an immediate relation to the principal claim, or to the validity of the procedure. …." That being so, by majority and with respect to the matters appealed, the challenged order is annulled. The Court shall proceed to process and resolve the Procedural Fraud Motion.

THEREFORE:

By majority and with respect to the matters appealed, the challenged order is annulled. The Court shall proceed to process and resolve the Procedural Fraud Motion.

WHEREAS:

I.Reasons of a procedural nature are the vector that separates us from the view expressed by the distinguished fellow judges. The dissenting vote adopted is reasoned below.

II.When examining a prior request by attorney Jorge Gerardo Cerdas Pérez, defender of the defendants herein, seeking suspension of the trial, the Chamber — with a different composition and by majority — ruled: "…Summary cognition phase concluded. An estimatory judgment order (auto sentencia) followed (folio 34) and is the subject of enforcement. Article 445 of the Code of Procedure. The Tribunal de Juicio I Circuito Judicial de San José finds [Nombre1] criminally responsible as author of the offense of fraud (estafa) against the defendants. In accordance with the dispositive portion of the judgment, it declares 'the unenforceability of bill of exchange (letra de cambio) number 0001 of July 21, 1997' (sic) appearing to be subscribed (folio 2, front and reverse) before [Nombre1]. Folios 909 to 990. This is a severe ruling that does not authorize deferring the course of the proceeding filed, since, for better or worse, it has already been decided to grant the claim.

Moving for that has lost its timeliness. The hypothesis contemplated by Article 202, subsection 2), ibidem, is absent. The only avenue remaining for the appellants — res judicata (cosa juzgada material) not yet existing — is the ordinary proceeding (vía ordinaria), where it is feasible to enforce what has been decided by our criminal courts when they strip the underlying instrument of its executory force…" Voto N° 707-P of 7:50 hours, July 21, 2006. III.This proceeding now presents a characteristic, a nuance sufficient for the law to appear in a new and unforeseen light. The cassation appeal (recurso de casación) by [Nombre1] against the criminal verdict that convicted him (folios 998 to 1079) was denied by the Sala Tercera, which — as is of significance here — ruled: "…In this regard, it must be borne in mind that the trial judges, after finding it established (folios 1030 to 1035 of the judgment) that [Nombre4] contracted the services of [Nombre1] to administer a group of companies that were experiencing financial difficulties (proven fact 'one'), the latter, already acting as attorney-in-fact and administrator, arranged a loan with Banco ELCA S.A. (fact 'two'). In this way a debt of one hundred twenty-two thousand three hundred seventy-three dollars and seventy-four cents ($ 122,370.74) was incurred, secured by real property and several of [Nombre3]'s companies, as well as by the personal surety (fianza personal) of the latter and of [Nombre1] himself (proven fact 'three').

The Court further established that, in view of the personal surety he was assuming, the accused proposed to [Nombre4] that the latter issue him a bill of exchange for the same amount as the bank loan, to protect himself in the event that the loan could not be honored and [Nombre1] were required to personally answer for the amount owed. 'For this reason, [Nombre4], on the understanding that said guarantee would operate only in the event that the loan installments were not met, in his personal name and in the name of the companies… (proceeded) to issue him bill of exchange No. 0001 dated July 21, 1997, payable on demand, for the same amount as the loan that was being applied for…' (proven fact 'four'). On March 31, 1999, the ELCA S.A. loan was duly paid off, as a result of which [Nombre4] attempted to recover the bill of exchange from the hands of the accused. In November 1999, at least two notarial demands and notifications were made and the public was alerted through a mass media outlet about the aforementioned bill of exchange, but all efforts were fruitless: [Nombre1] did not return the said negotiable instrument (título valor) (proven fact 'five').

Next, in accordance with the Court of judgment: '…Three days after the aforementioned announcement, on November 25, 1999, the accused [Nombre1], knowing that the document in question, as he had agreed with the victim [Nombre4], was intended to secure a potential payment of that loan transaction and that said transaction had been paid off, with the purpose of appropriating the 120 thousand dollars represented by that document and any interest that could be collected up to that date, taking advantage of the civil judicial organs, since they were unaware (sic) of the origin and purpose of that negotiable instrument, and that it did not secure any debt whatsoever, filed a simple executory claim against the companies…, represented by [Nombre4] and against the latter personally, falsely asserting and claiming that the aforementioned companies and [Nombre4] were his debtors and that they owed him the bill of exchange…

He moved for enforcement to be levied against checking accounts, savings accounts, safe-deposit boxes, master accounts, and certificates of deposit…. Also against assets owned by the defendants…' (proven fact 'six'). Finally, once the claim was filed at the Juzgado Sexto Civil de San José, case No. 99-001710-185 Cl was pursued, in which the competent judges, misled by their lack of knowledge of the origin and purpose of the negotiable instrument, ordered enforcement for the sum of two hundred thirty-five thousand seven hundred twenty-one dollars and ninety-one cents, the said executory claim was granted, and they ordered the proceeding to continue until the companies and the responsible person paid [Nombre1] the indicated sum as principal, interest, and costs of the proceeding. Finally, attachments (embargos) were decreed and enforced against assets of the defendant companies and properties of the victim [Nombre4] (proven fact 'seven').

On the basis of these facts, the judges of the Tribunal de Juicio del Primer Circuito Judicial de San José reasoned (see folios 1036 to 1048) that it was the prosecutorial theory that was confirmed, namely, that the bill of exchange was issued as a counter-guarantee, at the demand of the accused, to back his personal surety in the loan transaction that had been arranged to address the financial needs of the victim's companies and that, once that loan was paid off, its presentment for collection — as carried out by the accused [Nombre1] — was not legitimate, constituting what is doctrinally known as triangular fraud (estafa triangular) or judicial fraud (estafa procesal), since the deception fell upon one person (in this instance, the civil judge or judges) and the financial harm upon others (the victim's estate and his companies). The lower court's conclusion is correct in the sense that, from the outset, the accused knew the origin and nature of that bill of exchange.

When the Banco ELCA S.A. loan was paid off, he repeatedly refused to hand over the document that [Nombre4] had requested of him and, with the deliberate purpose of deceiving the civil judges and causing financial harm to the victim, he presented the document for collection." Folios 1168 to 1170.

IV.Licenciado Jorge Cerdas Pérez — appearing on behalf of his principals (poderdantes) — submits a notarial certification relating to ordinary civil action (ordinario) number CED1, filed before the 6th Civil Court of San José by [Nombre3], personally and as legal representative (personero) of Inversiones Sievert y [Nombre3] Sociedad Anónima; Viajes Roca Sociedad Anónima; Cosmo Tours Sociedad Anónima; Servicios Turísticos Primera Clase Sociedad Anónima; and Siatico Sociedad Anónima, versus [Nombre1] and Inmobiliaria Vinkonk Sociedad Anónima, seeking a declaration that: "...2) That the underlying cause that gave rise to bill of exchange (letra de cambio) No. 0001 in his favor, for the sum of U.S. $120,000.00, did not correspond to any debt whatsoever, much less to professional fees owed to the former, but rather had the purpose of securing the obligation that [Nombre1] was going to assume by signing as guarantor (fiador) of a loan in favor of a company of the plaintiff [Nombre3] (for an amount of U.S. $120,000.00), in the event that said obligation was not fulfilled, given that under such circumstances the defendant would be required to assume part of the obligation, since he had provided surety (fianza) in his personal capacity.

(sic) 3) That as a consequence of the foregoing, and upon the extinguishment of the underlying cause that gave rise to the bill of exchange in question, said instrument became unenforceable, invalid, and ineffective. 4) That consequently, the Simple Executory Proceeding (Proceso Ejecutivo Simple), being processed at the Sixth Civil Court of San José for Major Claims, under case file No. EXPN1, is absolutely null and void, and consequently ineffective..." Folios 1237 to 1274.

V.Through the case under examination (juicio subexamine), a claim is brought against [Nombre3] and others for reimbursement of $120,000.00 — principal — secured by exchange draft (libranza cambiaria) No. 0001, issued on July 21, 1997. Photostatic copy (calco fotostático) at folio 2. Inmobiliaria Vinkonk Sociedad Anónima — assignee of [Nombre1]'s rights, folios 784 and 788 — enforcing that instrument, bid on the seized property (finca apremiada) registration number (matrícula) CED2, San José Land Registry. See auction (subasta) at 8:30 hours on March 29, 2005. Folio 854. The award (adjudicación) has not yet been ratified. Therefore, the matter must be adjudicated. The validity of the bill of exchange (cambiale tratta) that forms the framework of this litigation is being disputed in declaratory proceedings (vía declarativa) (folios 1237 to 1274), with some noteworthy support from what was decided in criminal jurisdiction (sede criminal) against [Nombre1] (folios 1136 to 1151).

There thus emerges a sui generis preliminary question (prejudicialidad) that prevents ruling on the appeal filed upon challenging the threshold rejection of the so-called "procedural fraud incident (incidente de fraude procesal)." Because taking the contrary course could lead to a contradictory ruling — an analysis of the general validity of the bill of exchange — as against what may ultimately be definitively decided in the ordinary action. The interlocutory order (auto) of ten o'clock on May 15, 2007 is annulled, so that a ruling may be issued on the admissibility of the appeal (alzada) filed once the pending full proceeding (proceso pleno) or claim (petitorium) has been concluded.

POR TANTO:

The order of ten o'clock on the fifteenth of May of two thousand seven is ANNULLED.

Redacta el Juez Víquez Herrera, y;

CONSIDERANDO:

I.El mandatario especial judicial de la demandada Viajes Roca, S. A., basa su reproche contra la resolución indicada, bajo la tesis de que un fraude procesal no solo se puede configurar en la etapa de conocimiento de un proceso, sino también en la etapa de ejecución; además, que el dictado y firmeza de la sentencia penal en que sustenta la incidencia, se llegó a dar ya avanzado el proceso civil. Aduce también, que el fraude procesal se ha mantenido en el tiempo y su declaratoria no precluye, por tanto, no podríase imponer un tecnisismo o formalismo procesal, a su decreto.

II.La resolución recurrida, entre otras cosas, rechaza en puertas un incidente de fraude procesal, indicándose en ella que esa no es la vía idónea para lo que se pretende dada la existencia de una sentencia en firme, donde se acogieron las pretensiones del actor.

III.En vista de tal pronunciamiento, como su impugnación, este Tribunal se encuentra con un expediente de lento estudio ante las múltiples gestiones que las partes han presentado, como de piezas probatorias que han introducido. Culminada su revisión, en que los procemientos están en fase de ejecución y aun no dan por concluida la misma. Ante este panorama, necesario se vuelve destacar el contenido del artículo 100 del Código Procesal Civil. Esta norma, que forma parte de la parte general del Código citado, como también del Capítulo referente a los poderes y deberes del juez, nos dice que "en cualquier momento en que, por las circunstancias del caso concreto, el juez estuviere convencido de que el actor o el demandado se sirvieron del proceso para practicar un acto simulado o conseguir un móvil prohibido por la ley, dictará sentencia que impida a las partes obtener sus objetivos...". Esta disposición, que es de aplicación a todo tipo de procesos, en ningún momento establece que el pronunciamiento deba de emitirse antes del dictado de la sentencia, pues no todo proceso goza de ese tipo de resolución.

Tampoco la norma refiere que el pronunciamiento deba de vertirse en la sentencia prevista para el proceso en donde se denuncie un posible fraude procesal, véase que hasta por implicar un deber al juez, el mismo podría decretar el fraude hasta de oficio. En otro orden de ideas, si bien, ese numeral 100 no prevé la forma en que las partes deban de buscar la declaratoria de fraude procesal, por tratarse de una circunstancia excepcional a un proceso, el proceso incidental constituye el ideal, pues se trata de un proceso especial, accesorio y de conocimiento, que permite a las partes ejercer adecuadamente un derecho de defensa y proporcionar al juzgador los elementos necesarios para decidir si se está o no ante una certeza de fraude. En este particular, el artículo 483 del Código Procesal Civil no limita el ejercicio del incidente y por el contrario, de manera general expone en su primer párrafo: "se admitirá el incidente cuando tenga relación inmediata con la pretensión principal, o con la validez del procedimiento. ...". Así las cosas, por mayoría y, en lo apelado, se anula el auto recurrido. Proceda el Juzgado a tramitar y resolver el Incidente de Fraude Procesal.

POR TANTO:

Por mayoría y, en lo apelado, se anula el auto recurrido. Proceda el Juzgado a tramitar y resolver el Incidente de Fraude Procesal.

Gerardo Parajeles Vindas Celso Gamboa Asch Javier Víquez Herrera Voto Salvado por el Juez Gamboa Asch, y

CONSIDERANDO:

I.Motivos de orden adjetivo son el vector a separarnos del criterio que externan los distinguidos compañeros cojueces. De seguido se razona voto disidente adoptado.

II.Al analizar antaño solicitud del jurista Jorge Gerardo Cerdas Pérez, defensor de los aquí demandados, tendente a suspender el juicio la Cámara con distinta integración y por mayoría dispuso: "...Faceta de conocimiento sumario conclusa. Sobrevino auto sentencia estimatorio ( folio 34 ) objeto de ejecución. Artículo 445 del Código de Rito. El Tribunal de Juicio I Circuito Judicial de San José conceptúa a [Nombre1] autor responsable del injusto de estafa versus accionados. Conforme elemento dispositivo del fallo declara " la inejecutividad de la letra número 0001 de 21 de julio de 1997 " (sic) que aparecen suscribiendo ( folio 2 frente y vuelto ) ante [Nombre1] . Folio 909 a 990. Es dictámen severo que no autoriza diferir marcha del proceso planteado, pues, bien o mal dispuesto ya fue decidido declarar con lugar la demanda. Gestionarlo ha perdido oportunidad. Luce ausente hipótesis que prevé canon 202, inciso 2), ibidem. Unicamente queda a los recurrentes - inexistente ahora cosa juzgada material - via ordinaria donde resulta factible hacer valer lo resuelto por nuestra justicia criminal cuando priva de alcurnia ejecutiva al título base..." Voto N° 707-P de 7:50 horas 21 de julio 2006. Folio 1087. Enfasis suplido.

III.Este proceso presenta - ahora - una característica, un matiz suficientes para que la ley aparezca bajo aspecto nuevo e imprevisto. Recurso de casación de [Nombre1] contra veredicto penal que lo condena (folios 998 a 1079 ) declarado sin lugar por la Sala Tercera quien - como aquí de trascendencia - sentenció: "...En este sentido, debe tenerse presente que los juzgadores, después de tener por cierto (folios 1030 a 1035 del fallo) que [Nombre4] contrató los servicios de [Nombre1] para que le administrara un grupo de empresas que pasaban por dificultades económicas (hecho demostrado “uno”), éste último, ya como apoderado y administrador, gestionó un préstamo con el Banco ELCA S.A. (hecho “dos”). Fue así cómo se concretó una deuda de ciento veintidós mil trescientos setenta y tres dólares con setenta y cuatro centavos ($ 122.370,74), garantizados con una propiedad inmueble y varias de las empresas de [Nombre3], así como la fianza personal de éste y del propio [Nombre1] (hecho demostrado “tres”).

Continúa el Tribunal estableciendo que en vista de esa garantía personal que estaba asumiendo el aquí acusado, propuso a [Nombre4] que le librara una letra de cambio por el mismo monto del giro bancario, para protegerse en el eventual caso de que el préstamo no pudiera honrarse y tuviera [Nombre1] que responder personalmente por lo adeudado. “Razón por la cual, [Nombre4] y bajo el entendido de que dicha garantía operaría únicamente en caso de que no se cumpliera con el pago de la operación crediticia, en nombre personal y de las empresas… (procedió) a librarle la letra de cambio No. 0001 de fecha 21 de julio de 1997, pagadera a la vista, por el mismo monto del crédito que estaba solicitándose…” (hecho probado “cuatro”). El 31 de marzo de 1999 el préstamo de ELCA S.A. fue debidamente cancelado, motivo por el cual [Nombre4] intentó recuperar la letra de cambio de manos del aquí imputado. En noviembre de 1999 se hicieron al menos dos requerimientos y notificaciones notariales y se alertó al público por un medio de comunicación colectiva acerca de la citada letra de cambio, pero todos los esfuerzos fueron infructuosos: [Nombre1] no devolvió el citado título valor (hecho probado “cinco”).

Enseguida, de conformidad con el Tribunal de sentencia: “…Tres días después del mencionado anuncio, el 25 de noviembre de 1999, el acusado [Nombre1] , con conocimiento que el documento en cuestión y como lo había acordado con el ofendido [Nombre4] , era para garantizar un eventual pago de aquella operación crediticia y que la misma había sido cancelada, con el propósito de apropiarse de los 120 mil dólares que aquel documento representaba y los eventuales intereses que pudiera cobrar hasta esa fecha, aprovechándose de los órganos jurisdiccionales civiles, toda vez que estos desconocía (sic) el origen y finalidad de ese título valor, y que ella no garantizaba deuda alguna, suscribió una demanda ejecutiva simple contra las empresas…, representadas por [Nombre4] y contra éste en lo personal, aseverando y demandando falsamente que las empresas mencionadas y [Nombre4] eran sus deudores y que le debían la letra de cambio…

Gestionó que se despachara ejecución sobre las cuentas corrientes, cuentas de ahorros, cajitas de seguridad, cuentas maestras y certificados de depósitos…. Asimismo sobre los bienes propiedad de las demandadas…” (Hecho probado “seis”). Por último, interpuesta la demanda en el Juzgado Sexto Civil de San José, se siguió la causa No. 99-001710-185 Cl, en la cual, los juzgadores competentes inducidos en error por no conocer el origen y finalidad del título valor, despacharon ejecución por la suma de doscientos treinta y cinco mil setecientos veintiún dólares con noventa y un centavos, se declaró con lugar la demanda ejecutiva dicha y ordenaron continuar con la demanda hasta que las empresas y persona responsables cancelaran a [Nombre1] la suma indicada por concepto de capital, intereses y costas del proceso. Finalmente se decretaron y ejecutaron embargos sobre bienes de las empresas demandadas y propiedades del aquí ofendido [Nombre4] (hecho probado “siete”).

Con esta base fáctica, los juzgadores del Tribunal de Juicio del Primer Circuito Judicial de San José, razonaron (ver folios 1036 a 1048) que fue la hipótesis acusatoria la que quedó confirmada, a saber, que la letra de cambio fue librada como una contra-garantía, por exigencia del aquí acusado, para respaldar su fianza personal en la operación de préstamo que había sido tramitada para hacer frente a las necesidades de las empresas del ofendido y que, una vez cancelado aquél préstamo, no era legítima su puesta al cobro, tal y como lo hizo el imputado [Nombre1] , configurando lo que doctrinariamente se conoce como estafa triangular o estafa procesal, por recaer el engaño en una persona (en esta oportunidad el juez o jueces civiles) y el daño patrimonial en otras (el patrimonio del ofendido y sus empresas). Es correcta la conclusión del a quo en el sentido de que desde un principio, el imputado sabía el origen y naturaleza de aquella letra de cambio.

Cuando el préstamo del Banco ELCA S.A. se canceló, se negó reiteradamente a entregar el documento que le fuera solicitado por [Nombre4] y, con el deliberado propósito de engañar a los jueces civiles y perjudicar patrimonialmente a la víctima, presentó el documento a cobro." Folios 1168 a 1170.

IV.El licenciado Jorge Cerdas Pérez - recurriendo en nombre de sus poderdantes - aporta certificación notarial relativa a ordinario número CED1 que ante Juzgado 6° Civil de San José promueve [Nombre3] personalmente y como personero de Inversiones Sievert y [Nombre3] Sociedad Anónima; Viajes Roca Sociedad Anónima; Cosmo Tours Sociedad Anónima; Servicios Turísticos Primera Clase Sociedad Anónima y Siatico Sociedad Anónima versus [Nombre1] e Inmobiliaria Vinkonk Sociedad Anónima solicitando se declare: "...2) Que la causa que le dio origen a la letra de cambio No.0001 a su favor, por la suma de U.S. $120.000.00, no obedecía a deuda alguna ni mucho menos por honorarios profesionales a favor del primero, sino que tenía como finalidad garantizar la obligación que [Nombre1] , iba a asumir al firmar como fiador un crédito a favor de una empresa del actor [Nombre3] ( por un monto de U.S. $120.000.00), en caso de que no se cubriera dicha obligación, dado que ante este presupuesto, el demandado debería asumir parte de la obligación, puesto que había rendido fianza en su carácter persona.(sic) 3) Que como consecuencia de lo anterior, y al extinguirse la causa que le dio origen a la letra de cambio en mención, la misma se tornó en inejecutable, inválida e ineficaz. 4) Que en consecuencia el proceso Ejecutivo Simple, que se tramita en el Juzgado Sexto Civil de San José de Mayor Cuantía, bajo el expediente No. EXPN1, es nulo absolutamente, y en consecuencia ineficaz..." Folios 1237 a 1274.

V.A través de juicio subexamine se reclama a [Nombre3] y otras reembolso de $ 120 000,oo - principal - que garantiza libranza cambiaria No. 0001 emitida 21 de julio de 1997. Calco fotostático de folio 2. Inmobiliaria Vinkonk Sociedad Anónima - cesionaria de los derechos de [Nombre1] folios 784 y 788 - ejecutando aquel título licitó por finca apremiada matrícula CED2 Partido de San José. Ver subasta de 8:30 horas 29 de marzo 2005. Folio 854. Sin homologar todavía la adjudicación. Debe, entonces, arbitrarse. Discútese en vía declarativa ( folios 1237 a 1274), con algún interesante respaldo de lo resuelto en sede criminal contra [Nombre1] ( folios 1136 a 1151), validez de cambiale tratta andamiaje de este litigio. Revena, pues, una sui géneris prejudicialidad que obstaculiza conocer recurso planteado al impugnarse rechazo ad portas del nominado " incidente de fraude procesal." Porque tomar vertiente contraria podría conducir a resolución contradictoria - análisis de eficacia genérica de la letra - con lo que llegue a dictaminarse - definitivamente - en el ordinario. Anúlase auto de 10 horas del 15 de mayo del 2007 para que se dictamine acerca de admisión alzada interpuesta cuando quede finalizado petitorium o proceso pleno pendiente de trámite.

POR TANTO:

Se ANULA el auto de diez horas del quince de mayo del dos mil siete.
