JUDGMENT No. 0075-F-08 JUDGMENT No. 0075-F-08 AGRARIAN COURT OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at dieciséis horas cinco minutos on treinta de enero de dos mil ocho.

ORDINARY PROCEEDING (PROCESO ORDINARIO) brought by REFORESTACIÓN INDUSTRIAL LOS NACIENTES SOCIEDAD ANÓNIMA, legal entity identification number CED1 - - , represented by [Nombre1], of legal age, married, forestry entrepreneur, identification number CED2 - - , resident of el Roble de Alajuela, against [Nombre2], of legal age, married, farmer, identification number CED3 - - , resident of Paraíso de Dos Ríos de Upala de Alajuela. Heard before the Juzgado Agrario de Liberia. Attorney Juan Carlos Morera Fernández serves as counsel for the plaintiff, and attorney Mauricio Rodríguez Méndez serves as agrarian public defender for the defendant; both are of legal age and professionals, and their other particulars appearing in the record are unknown.

BACKGROUND:

1. The plaintiff brings this ordinary proceeding, valued at diez millones quinientos mil colones, seeking a judgment declaring the following: “1.- That this complaint be granted in all respects. 2.- That the timber located on the defendant’s property, registered in Provincia de Alajuela under real property folio registration number [Placa1], is the sole and exclusive property of Reforestación Industrial los Nacientes S.A. 3.- That Reforestación Industrial Los Nacientes S.A. may cut, remove, and transport said timber during the next dry season following the date on which the judgment so determining becomes final. 4.- That the defendant must refrain from performing acts of any kind that obstruct, restrict, or prevent the cutting and removal of the existing timber. 5.- That until this occurs, the defendant herein shall continue to receive the corresponding amount of the lease payment that he has been receiving, which amount shall be paid in a single installment when the last timber tree is removed. 6) That, in the event of opposition, the defendant be ordered to pay all legal costs (costas) of this action for acting in evident bad faith,” (folios 12 to 16).

2. The defendant was duly served with notice of this proceeding under the terms appearing at folios 74 to 81, and raised the defenses of the general sine actione agit, lack of a legal right, lack of active and passive standing (legitimatio ad causam), and lack of cause.

3. Attorney Luis Jorge Gutiérrez Peña, the trial judge, ruled in a judgment issued at quince horas cinco minutos on veinticuatro de abril del dos mi siete: “THEREFORE. In accordance with the foregoing and the cited legal provisions, the defenses of lack of a legal right, lack of active and passive standing, and the general defense of sine actione agit raised by the defendant are denied. THE COMPLAINT brought by Sociedad Reforestación Industrial los Nacientes S.A. against [Nombre2] IS GRANTED. Consequently, it is ordered that Sociedad Reforestación Industrial los Nacientes S.A. may cut, remove, and transport said timber, because said Gmelina arborea plantation is its property. Once this ruling becomes final, it is granted a period not exceeding SEIS MESES to cut, remove, and transport the timber, and must pay the defendant the corresponding lease payment that he has been receiving, under the same agreed conditions. The defendant, [Nombre2], is ordered to refrain from obstructing or restricting access to the property that is the subject of the forestry lease agreement (contrato de arrendamiento forestal), or in any manner preventing the plaintiff Company (sic), meaning the company’s workers, from cutting and removing the existing timber. The unsuccessful party is ordered to pay all costs of this proceeding. NOTICE SHALL BE GIVEN.” (folios 115 to 120).

4. The plaintiff filed an appeal (recurso de apelación), expressly stating the grounds relied upon to challenge the trial court’s position, (folios 145 to 148).

5. The statutory requirements were observed in the conduct of the proceeding, and no errors or omissions capable of rendering the judgment void are apparent.

Judge Picado Vargas authors the opinion; and,

WHEREAS:

I.The statement of proven facts is adopted because it is consistent with the weight of the evidence admitted during the proceeding.

II. The statement of facts not deemed proven is adopted

III.The defendant’s agrarian public defender, attorney Mauricio Rodríguez Méndez, files an appeal seeking concomitant nullification (nulidad concomitante) of the judgment issued at quince horas cinco minutos on veinticuatro de abril del dos mil siete, based on the following: Ground for Nullification: Defect of incongruity and lack of reasoning: He argues that the relief sought in the complaint does not show that the plaintiff requested a declaration that a contract existed, the type of any such contract, a declaration that it had been breached, or specific performance or rescission of a contract. Therefore, the court below cannot order the defendant, where such relief was not requested, to perform a contract whose existence or breach was not even sought to be declared.- Substantive Ground of Appeal: Although the court below deemed it proven in its second proven fact that the lease agreement had a term of trece años and expired on 20 de octubre del 2005, it contradicts itself by allowing the plaintiff to continue removing timber for seis meses after the contract had expired, as the plaintiff did in diciembre del 2005; the judgment therefore cannot order that the plaintiff be allowed to remove additional timber, since this restricts the defendant’s ownership rights under a contract that has already expired (folios 146 to 148).-

IV.As to the sole ground for nullification, the appellant is incorrect. In its complaint, the plaintiff seeks a declaration that the timber located on the defendant’s property belongs to it because it planted the timber pursuant to a lease agreement between the two parties. The existence of the lease agreement is not a disputed fact, as may be inferred from facts one and two of the complaint and answer appearing at folios 14 and 74, in accordance with Article 316 of the Código Procesal Civil, applied on a supplementary basis. To determine whether the action is proper, it is necessary to examine the existence of that agreement; because it is not a disputed fact, in accordance with Article 316 of the Código Procesal Civil, applied on a supplementary basis, the challenged judgment is not incongruous because of an award beyond the relief requested (vicio extrapetita), as the appellant alleges, nor does it render him defenseless. Consequently, the request for concomitant nullification is denied.-

V.As to his sole substantive ground of appeal, the appellant is likewise incorrect. First, the lease agreement entered into by the parties, as a product of the contracting parties’ freedom of contract (autonomía de la voluntad), clearly establishes in its eighth clause that the plaintiff is the owner of the plantation (see contract at folio 8).- The fact that the lease agreement between the parties has expired does not preclude granting the plaintiff a reasonable period—in this case seis meses—to cut and collect its remaining timber. In the matter before us, the parties entered into a lease agreement concerning property suitable for forestry, with a term of trece años, which expired in octubre del año dos mil cinco. Following that expiration, the plaintiff company sued the lessor, seeking a declaration that the timber remaining on the property belonged to the plaintiff and permission to remove that timber, cultivated over the últimos quince años, by the following dry season; in the meantime, the defendant would continue receiving rent, which the plaintiff requests permission to pay in a single installment (Cf.

Relief sought at folio 15).- The existence of the timber, the lease agreement, and the expiration date are not disputed facts, and because the contract itself establishes that the plantation belongs to the plaintiff, allowing the tenant to leave without collecting the remaining timber would result in unjust enrichment (enriquecimiento ilícito) in favor of the lessor, which cannot validly be endorsed, because the lessor would appropriate timber that, from the moment the parties reached their agreement, they stipulated would belong to the plaintiff. Accordingly, this ground of appeal cannot be sustained. However, this Court considers the period granted by the court below excessive; therefore, an extension of cuatro meses, rather than seis, is reasonable for removing the remaining timber and does not restrict the defendant’s ownership rights, since he will receive rent for that period. Consequently, as to the matters appealed, the decision under review must be affirmed.-

THEREFORE:

The request for concomitant nullification is denied. As to the matters appealed, the decision under review is affirmed, with the period granted for removing the remaining timber modified to cuatro meses.- CARLOS PICADO VARGAS ANTONIO DARCIA CARRANZA MAGDA DÍAZ BOLAÑOS Note by Judge Díaz Bolaños The undersigned judge agrees with the decision of the other judges; however, I consider it important to clarify the following:

Sole Point: This is an ordinary proceeding in which the lease agreement executed by the parties is not in dispute, as established by the relief sought appearing on the reverse of folio 15. It must be borne in mind that the central issue in dispute is ownership of the timber, as is clear from the second request for relief: “2.- That the timber located on the defendant’s property, registered in Provincia de Alajuela under real property folio registration number CED4, is the sole and exclusive property of Reforestación Industrial Los Nacientes S.A.” The judgment determined, by virtue of the principle of freedom of contract, that the agreement in which the parties stipulated that the plaintiff entity owned the timber was valid. The legal basis for that decision derives from Article 632 of the Código Civil, since contracts have been established as sources of obligations. In this matter, it is evident that, in addition to leasing the property—which is not an issue in dispute—the defendant undertook an obligation toward the plaintiff company to define ownership from the outset of the negotiations.

It is in this sense that the defendant’s substantive argument must be rejected, because the lease agreement itself is not the matter in dispute. The document appearing at folios 7 to 13 is an additional item of documentary evidence (prueba documental) that is weighed without implying that this Court is in any manner extending the cited lease agreement or ruling on the expiration of the agreement.

VOTO N° 0075-F-08 VOTO N° 0075-F-08 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las dieciséis horas cinco minutos del treinta de enero de dos mil ocho.

PROCESO ORDINARIO establecido, por REFORESTACIÓN INDUSTRIAL LOS NACIENTES SOCIEDAD ANÓNIMA, cédula jurídica número CED1 - - , representada por [Nombre1] , mayor, casado, empresario forestal, cédula CED2 - - , vecino de el Roble de Alajuela, contra [Nombre2] , mayor, casado, agricultor, cédula de identidad número CED3 - - , vecino de Paraíso de Dos Ríos de Upala de Alajuela. Tramitado ante el Juzgado Agrario de Liberia. Actúa como abogado director de la parte actora el licenciado Juan Carlos Morera Fernández, y como defensor público agrario del demandado el licenciado Mauricio Rodríguez Méndez, ambos mayores, profesionales y demás calidades en autos ignorados.

RESULTANDO:

1. La parte actora interpone el presente proceso ordinario, estimado en la suma de diez millones quinientos mil colones, para que en sentencia se declare lo siguiente:" 1.- Con lugar en todos sus extremos la presente demanda. 2.- Que la madera existente en la finca del demandado inscrita en Provincia de Alajuela, folio real matrícula número [Placa1], es propiedad única y exclusiva de Reforestación Industrial los Nacientes S.A. 3.- Que Reforestación Industrial Los Nacientes S.A., podrá cortar, extraer y trasladar dicha madera en el verano próximo siguiente a la firmeza de la sentencia que así lo determine. 4.- Que el demandado deberá de inhibirse de realizar actos de cualquier índole que obstaculicen, limiten o impidan la corta y extracción de la madera existente. 5.- Que hasta ese tanto no se dé, el aquí demandado seguirá percibiendo el monto correspondiente al pago que por concepto de arrendamiento ha venido recibiendo, suma la cual será cancelada en solo tracto al momento de darse la extracción de la última mata de madera. 6) Debiéndose condenar en caso de oposición al demandado al pago de ambas costas de esta acción por actuar con evidente mala fe", (folios 12 a 16).

2. El demandados fue debidamente notificado del presente proceso en los términos que corren a folios 74 a 81, e interpuso las excepciones de genérica sine actione agit, falta de derecho, legitimatio ad - causa y pasiva y la falta de causa.

3. El licenciado Luis Jorge Gutiérrez Peña, juez de primera instancia, en sentencia de las quince horas cinco minutos del veinticuatro de abril del dos mi siete, resolvió: " POR TANTO. De conformidad con lo antes expuesto, y citas de ley, se rechazan las excepciones de falta de derecho, falta de legitimación activa y pasiva, y la genérica de sine actione agit interpuestas por el demandado. SE DECLARA CON LUGAR LA DEMANDA establecida por Sociedad Reforestación Industrial los Nacientes S.A. contra [Nombre2] . En consecuencia se ordena que la Sociedad Reforestación Industrial los Nacientes S.A. podrá cortar, extraer y trasladar dicha madera, por ser dicha plantación de la especie Gmelina arborea de su propiedad, una vez firme esa resolución, se le concede un plazo no mayor a los SEIS MESES, para que procede a cortar, extraer y trasladar la madera, debiendo cubrir o cancelar al demandado el monto correspondiente al pago que por concepto de arrendamiento que ha venido recibiendo, en las mismas condiciones pactadas.

Se le previene al demandado [Nombre2] abstenerse de obstaculizar y limitar el ingreso a la finca objeto del contrato de arrendamiento forestal o impedir de alguna forma la corta y extracción de la madera existente a la Sociedad (sic) actora, entendiéndose esto trabajadores de la empresa. Se condena a la parte vencida al pago de ambas costas de este proceso. NOTIFÍQUESE." (folios 115 a 120).

4. La parte actora interpuso recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia, (folios 145 a 148).

5. En la substanciación del proceso se han observado las prescripciones legales, sin que se observen la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta el juez Picado Vargas, y;

CONSIDERANDO:

I. Se comparte el elenco de hechos probados por corresponder al mérito de las probanzas evacuadas durante el proceso

II. Se prohíja el elenco de hechos no tenidos por demostrados

III.El defensor público agrario del demandado, licenciado Mauricio Rodríguez Méndez, interpone recurso de apelación con nulidad concomitante contra la sentencia dictada a las quince horas cinco minutos del veinticuatro de abril del dos mil siete, con base en lo siguiente: Motivo de Nulidad: Vicio de incongruencia y falta de fundamentación: Alega que de la petitoria de la demanda no se desprende que el actor haya solicitado la declaratoria de la existencia de un contrato, ni de qué tipo, ni tampoco que se declare un incumplimiento del mismo o se solicite la ejecución forzosa o la resolución de un contrato. Por lo que el ad quo no puede condenar al demandado, por no haber sido pedido, a cumplir un contrato que ni siquiera se solicitó se declarara su existencia ni su incumplimiento.- Agravio de fondo: Que si bien el ad quo tuvo por demostrado en su segundo hecho probado que el contrato de arrendamiento tenía un plazo de trece años y se venció el 20 de octubre del 2005, incurre en contradicción pues permite que el actor siga extrayendo madera por seis meses más estando vencido el contrato, tal y como lo hizo en diciembre del 2005 por lo que no se puede ordenar en sentencia que se permita al actor extraer más madera, lo cual viene a limitarle su derecho de propiedad, por un contrato que ya está vencido (folios 146 a 148).-

IV.En cuanto al único motivo de nulidad, no lleva razón el recurrente. El actor en su demanda pretende se declare que la madera existente en la finca de la demandada le pertenece, en virtud de haberla sembrado merced a un contrato de arrendamiento entre ambas. La existencia del contrato de arrendamiento, no es un hecho controvertido, según se desprende de los hechos primero y segundo en los libelos de demanda y contestación a folios 14 y 74, de conformidad con el artículo 316 del Código Procesal Civil, aplicado supletoriamente. Para determinar la procedencia o no de la acción, resulta preciso examinar la existencia de dicha convención, y al no ser un hecho controvertido, de conformidad con el numeral 316 del Código Procesal Civil, aplicado supletoriamente, no deviene el fallo impugnado en incongruente por vicio extrapetita como lo alega el recurrente ni se le causa estado de indefensión. En consecuencia, se rechaza la nulidad concomitante.-

V.En cuanto a su único agravio de fondo, tampoco lleva razón el apelante. En primer lugar, el contrato de arrendamiento suscrito entre las partes, producto de la autonomía de la voluntad de los sujetos contratantes, en su cláusula octava, establece claramente que la dueña de la plantación lo es la parte actora (ver contrato a folio 8).- El hecho de que el contrato de arrendamiento entre las partes haya vencido no imposibilita al actor a que se le otorgue un plazo prudencial –en este caso seis meses- para cortar y recoger la madera de su propiedad pendiente. En el caso que nos ocupa, se ha dado entre las partes un contrato de arrendamiento de un inmueble de aptitud forestal, con un plazo de trece años, el cual expiró en octubre del año dos mil cinco. Ante tal vencimiento, la sociedad actora demanda a la arrendante a fin de que se declare que la madera subsistente en la finca es de su propiedad y se le permita extraer dicha madera, cultivada a lo largo de los últimos quince años, hasta el próximo verano y por mientras tanto, que la demandada siga percibiendo la renta, la cual pide se permita cancelar en un solo tracto (Cfr.

Petitoria a folio 15).- La existencia de la madera, así como del contrato de arrendamiento y la fecha de vencimiento no son hechos controvertidos y siendo el mismo contrato quien establece que la plantación pertenece a la actora, si se permitiese la salida del arrendatario sin recoger la madera subsistente, se daría un enriquecimiento ilícito a favor del arrendante que no sería válido avalar, ya que se apoderaría de una madera que desde el momento en que se dio el acuerdo de voluntades, se pactó sería del actor. Por ello, no es de recibo el agravio expuesto. Sin embargo, considera este Tribunal que el plazo dado por el ad quo es excesivo, por lo que una prórroga de cuatro meses, en lugar de seis, resulta razonable para sacar la madera pendiente y no limita el derecho de propiedad del demandado toda vez que va a recibir una renta por ese lapso de tiempo. En consecuencia, en lo apelado, procede confirmar la resolución venida en alzada.-

POR TANTO:

Se rechaza la nulidad concomitante. En lo apelado, se confirma la resolución venida en alzada, modificándose el plazo concedido para la extracción de la madera pendiente a cuatro meses.- CARLOS PICADO VARGAS ANTONIO DARCIA CARRANZA MAGDA DÍAZ BOLAÑOS Nota de la jueza Díaz Bolaños La suscrita jueza comparte la decisión de los compañeros jueces, sin embargo estimo importante aclarar que los siguientes aspectos:

Único: Este es un proceso ordinario donde no se discute el contrato de arrendamiento verificado por las partes, ello al tenor de la petitoria visible a fgolio 15 vuelto. Debe tenerse presente que objeto central de debate es la propiedad de la madera según se desprende con claridad de la petitoria segunda: "2.- Que la madera existente en la finca del demandado inscrita en Provincia de Alajuela, folio real matrícula número CED4 es propiedad única y exclusiva de Reforestación Industrial Los Nacientes S.A". En el voto se estimó, en virtud del principio de autonomía de voluntad darle validez al convenio donde las partes acordaron que la propiedad de la madera es de la entidad actora. El fundamento jurídico de tal decisión procede de los ordinales 632 del Código Civil por cuanto se ha establecido que los contratos son fuentes de obligaciones. En este asunto es evidente que el demandado se obligó con la empresa actora, además del arrendamiento del inmueble, que no es tema de litis, a definir desde el principio de la negociación.

En este sentido es que se debe rechazar el alegato de fondo del demandado porque lo debatido no es el contrato de arrendamiento como tal. El documento visible a folio 7 a 13 es una prueba documental más que se pondera, sin que implique que este Tribunal este de manera alguna prorrogando el contrato de arrendamiento citado ni pronunciándose sobre la expiración del convenio.
