VOTO N° 0958-F-07 VOTO N° 0958-F-07 AGRARIAN TRIBUNAL OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at fifteen hours forty minutes on the twenty-second of November of two thousand seven.

ORDINARY PROCEEDING (proceso ordinario), filed by [Nombre1], of legal age, married once, agricultural businessman, national ID CED1 - -, resident of San Ramón; [Nombre2], of legal age, married once, agricultural businessman, national ID CED2 - - -, resident of Cañas Guanacaste; and [Nombre3], of legal age, divorced, agricultural businessman, national ID CED3 - -, resident of Bagaces Guanacaste, against AGROSUPERIOR SOCIEDAD ANÓNIMA, corporate ID CED4 - -; represented by [Nombre4], of legal age, married once, civil engineer, national ID CED5 - -, resident of San José, in the capacity of general attorney-in-fact without limit of sum (apoderado generalísimo sin límite de suma), heard before the Agrarian Court of Liberia. Attorneys Mario Alberto Rosales Vargas, national ID CED6 - - -; Rogelio Navas Rodríguez, national ID CED7 - -; and Carlos Alejandro Baéz Astúa, national ID CED8 - -, all of legal age, professionals, and residents of San José, appear as special judicial attorneys-in-fact for the plaintiffs and defendants respectively.

WHEREAS:

1. The plaintiffs file an ordinary civil action, valued at thirty million colones, requesting that judgment declare: "1. Prior to serving the complaint on the defendants, we request that it be annotated in the margin of the vehicle registrations of the defendant companies, specifically the license-plated vehicles listed in the attached Public Registry certifications. 2. We likewise request that this proceeding be annotated in the margin of the real property registry folio (folio real) for the property in the San José registry district, property registration number [Placa1]. 3. That the complaint filed against the defendants be served upon them. 4. That the evidence offered in this brief be received. 5. That this complaint be granted in its entirety. 6. That the defendants be ordered to pay the damages and losses (daños y perjuicios) caused to our clients. 7. That the defendants be ordered to pay the legal interest accruing on the compensation amounts until they are effectively paid. 8. That the defendants be ordered to pay all court costs (costas) of this proceeding" (folio 143).

2. The defendant companies were duly served with notice of the action filed against them and did not oppose it (folios 201 to 204).

3. Attorney Ruth Alpízar Rodríguez, first-instance judge, in a judgment rendered at eight o'clock on the sixteenth of January of two thousand six, ruled: "POR TANTO: The present ordinary action for damages and losses filed by [Nombre1], [Nombre2], and [Nombre3] against AGROSUPERIOR SOCIEDAD ANÓNIMA is partially granted. The defendant companies are ordered to pay the following amounts, with any items not expressly indicated being deemed denied: 1) For lost profits, the earnings that the plaintiffs failed to receive on an area of ninety hectares of rice harvested in the first cycle of the year two thousand two, an amount to be determined at the judgment enforcement stage (etapa de ejecución de sentencia). 2) For actual damages, the amount expended on the purchase of 360 liters of Harness 90 EC, fixed at ONE MILLION SIXTY-SIX THOUSAND SEVENTEEN COLONES AND SIXTY-NINE CÉNTIMOS. 3) The defendant company is ordered to pay all court costs of this proceeding" (folios 543 to 571).

4. Attorneys Rogelio Navas Rodríguez and Ricardo Fournier Vargas, attorneys-in-fact for the plaintiffs and the defendant company respectively, filed appeals before this Tribunal, expressly stating the grounds on which they relied to challenge the lower court's position (folios 574 to 630).

5. The legal requirements governing the conduct of the proceeding have been observed, and no errors or omissions capable of rendering the judgment void have been identified. This decision is issued within the time period prescribed by law.

The opinion is authored by Judge Picado Vargas; and,

CONSIDERING:

I.In accordance with Article 52 of the Ley de Jurisdicción Agraria, the documentary evidence offered by the plaintiff party is admitted as evidence for better resolution (prueba para mejor resolver), as follows: 1.- Curriculum vitae of Mr. [Nombre5] (folios 583 to 587). 2.- Certified copies of the three most recent publications of appointments of official expert witnesses (peritos oficiales) of the Court, in which said individual appears (folios 588 to 591). The remaining evidence offered is rejected as unnecessary, given that sufficient evidentiary elements exist in the record.

II.The set of facts deemed proven (hechos tenidos por demostrados) is adopted, as it corresponds to the merit of the evidence that has been offered, admitted, and received during the proceeding.

III. Likewise, the set of facts deemed unproven (hechos tenidos por indemostrados) is adopted

IV.Mr. Ricardo Fournier Vargas, as representative of the defendant company, appeals the aforementioned judgment based on the following grounds: 1.- He considers it contradictory that the lower court (ad quo) found extra-contractual liability (responsabilidad extracontractual) while at the same time treating as a proven fact that this dispute arose from a sales contract for an agricultural input (insumo agrícola), and he cites jurisprudence of the Sala Primera de la Corte Suprema de Justicia that in fact excludes such liability when a prior contractual relationship existed. 2.- The judgment errs in applying a system of strict liability (responsabilidad objetiva), since the plaintiffs cannot be considered consumers within the scope of Article 2 of the Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, as they are not the final recipients in the production chain of goods or services, in accordance with the consistent jurisprudence of the Sala Constitucional de la Corte Suprema de Justicia. 3.- Nor is that liability regime applicable to this case based on phytosanitary regulations, since those regulations are exclusively limited to the administrative sphere under the oversight of the Department of Control of Agricultural Inputs or any other activity, and therefore the sanctions imposed by the lower court on the basis of those regulations violate the principle of legality. 4.- He argues that the applicable liability regime in this case is subjective contractual civil liability (responsabilidad civil contractual de carácter subjetivo), within which two facts exempt the defendant from liability: namely, that the land had pre-existing problems with the red rice infestation (plaga del arroz rojo) prior to the events in question, and that the plaintiffs applied Harness 90 EC knowing that no technical information existed for its use in this country; consequently, victim's fault (culpa de la víctima) is established as a ground exempting the defendant from liability (folios 574 to 580).

V.Attorney Rogelio Navas Rodríguez, special judicial attorney-in-fact for the plaintiffs, filed an appeal based on the following grounds: 1).- He argues that the lower court erroneously interpreted the fourth unproven fact — the loss of the harvest on 55 hectares of rice — and that there is a contradiction between proven facts 12 and 13 with respect to proven facts numbers 8, 9, and 11 of the appealed judgment, specifically regarding the dates and locations of planting and harvesting of those 55 hectares of rice. He contends that in reality, although the defendant provided, as a gesture of settlement, agricultural inputs for the replanting (resembrar) of 55 of the 90 hectares damaged by Harness, the result was the same notwithstanding those inputs, and therefore the total damage covers all 90 hectares on which the product was applied. That is, there was a first planting of 90 hectares that were damaged by the product, and subsequently 55 of those 90 hectares were replanted — thanks to the inputs received from the defendant — with the same result; accordingly, the lower court erred in finding that the damage to this second harvest of 55 hectares had been remedied by the defendant. 2).- They maintain that, among the compensable damages, the appealed judgment improperly denies them compensation for all of the investment made in the preparation and planting for the first harvest cycle of 2002 (labor, fertilizers, pesticides, irrigation, seed) caused by Harness 90 EC, which amounts to 14 million colones.

The plaintiffs estimated they would recover that investment through the rice harvest in the amount of seven million colones. Accordingly, the damage was not effectively remedied by the defendant, since the inputs it provided were lost because this second harvest on the 55 hectares was also lost due to Herness. Therefore, according to the calculations of expert witness [Nombre5], the total final amount comes to 14,367,929 colones. The expert report is valid because it was prepared by a well-known mathematical expert witness who is part of the Poder Judicial's panel of expert witnesses, and it cannot be disregarded — as the lower court did — on the ground that the expert opinion was not authenticated; nor can the opinion rendered by engineer Adolfo Soto be disregarded on that same basis, given that both pieces of evidence were admitted in a timely fashion. He challenges the fact that the lower court discredited these expert reports yet accepted the one submitted by engineer [Nombre6], offered by the defendant, even though no one witnessed him visiting the land or questioned the failure to prove his authentication and professional credentials, particularly given that the report was issued on SENARA letterhead while the engineer actually works for MAG — and therefore the partial compensation recognized by the lower court with respect to the second planting on the 55 hectares lacks any evidentiary foundation (folios 594 to 630).

VI. ON THE APPEAL FILED BY THE DEFENDANT

Regarding the first ground of error raised by the defendant, the appellant's argument is without merit. Although a sales contract for a pesticide (plaguicida) was entered into between the parties, what the plaintiff seeks is compensation for damages and losses (daños y perjuicios) caused by the said agrochemical (agroquímico) to its rice crops, which gives rise to a form of strict liability (responsabilidad objetiva). In this regard, the case law of the Sala Primera de la Corte Suprema de Justicia, addressing objective non-contractual liability (responsabilidad extracontractual objetiva), has ruled as follows, in the relevant part, further reinforcing the position of this Tribunal:

"...IX.- Article 1045 of the Código Civil establishes the foundation of subjective non-contractual liability: 'Any person who, through deceit, fault, negligence, or recklessness, causes harm to another, is obligated to repair it together with the resulting losses.' The duty to make reparations (resarcimiento), in this case, arises from the culpable breach of the general principle of 'not causing harm to others.' For liability to exist, it is required that the harm have been caused by the agent's fault (negligence, recklessness, or lack of skill) or willful misconduct. The burden of proof therefore falls on the creditor, that is, on the victim seeking reparations. The scenario set forth in Article 1048, paragraph 3 of the same code is different: 'Anyone who entrusts another person with the performance of one or several acts is obligated to select a person capable of carrying them out and to supervise the execution within the bounds of the diligence of a prudent head of household (buen padre de familia); and if such duties are neglected, that person shall be jointly and severally liable for the losses that the agent causes to a third party through an act that violates the rights of others, committed with ill intent or through negligence in the performance of the agent's duties, unless that act could not have been prevented even with the exercise of all due diligence in supervision.' This is indirect civil liability (responsabilidad civil indirecta) or liability for the acts of another, in its two forms: in eligendo and in vigilando.

The law obligates the party who entrusts another with the performance of a given task to select a capable person and to supervise the execution of the assignment. If the agent, in carrying out the assignment and within the scope of authority granted by the principal (comitente), causes harm to third parties, those third parties are empowered to bring a direct action against the party who made the assignment. Indirect liability, in the case of an agent who causes harm to a third party, is assumed by the principal (mandante) upon the occurrence of one event: that the harm arises from an intentional or culpable act. Given this, indirect liability follows, since fault in selection or in supervision is presumed on the part of the principal. The presumption is directed, therefore, not at the agent's conduct, but at the principal's conduct, who could only be excused from liability by proving that, even with the utmost care in supervision, the event would have occurred regardless. The culpable act of the direct wrongdoer is not presumed in matters of non-contractual liability; what is presumed is the fault in the acts of supervision or selection, on the part of the principal."

Based on the foregoing ruling, the regime of strict liability transcends the contractual or non-contractual sphere in which the legal relationship between the parties originated. Legal doctrine has interpreted that Article 704 of the Código Civil excludes from compensation those damages that are not necessarily the product of the breach, or that are a remote consequence of the act. This provision is understood to apply to both contractual and non-contractual civil liability (see RIVERO SÁNCHEZ (Juan Marcos), Responsabilidad Civil, Tomo II, San José, Editorial Areté, 2001, p. 141). The appellant's ground of error is not well-taken, since the strict liability at issue here may arise regardless of whether a contract existed between the parties. Article 704 is a general provision that complements Article 1045 of the same code. Therefore, in matters of the sale, distribution, and handling of pesticides, the applicable form of liability is strict liability under the created risk theory (teoría del riesgo creado) in hazardous activities.

This theory establishes that whoever profits from a hazardous activity (such as the sale of chemical substances, namely pesticides) must be liable for the damages they generate, and this principle is grounded in the Ley de Protección Fitosanitaria and its implementing regulations, as well as in the Reglamento sobre Registro, Uso y Control de Plaguicidas Agrícolas y Coadyuvantes, the Decreto Ejecutivo establishing the Operating Permit for the Sale or Dispensing of Chemical, Biological, and Related Substances, and the Ley General de Salud itself.

The created risk theory, according to the most recent Italian legal doctrine on torts: "... allows strict liability criteria to be applied even in those cases where, in the absence of a business activity, the association 'risk-benefit-liability' could not otherwise be established. Accidents that occur outside of strictly profit-making activities are thus absorbed by the premise that anyone who employs sources of risk must bear the negative consequences of their actions." ALPA (Guido). Nuevo Tratado de la Responsabilidad Civil, Milán, Giuffré Editori, 1999, p.p.383-384.

The author Pacchioni states: "when a person organizes their own economic activity for profit, they must certainly bear the disadvantages of their conduct and compensate third parties for the damages caused, even if they were not at fault," (PACCHIONI ([Nombre7].) Diritto Civile Italiano, Parte II, Vol. IV, Papua, 1940, p.11).- Therefore, this theory is grounded in the general principle, articulated at the end of the nineteenth century by the jurist Vittorio Emanuele Orlando, that "anyone who, in the course of operating a business or carrying out any activity, causes harm to the rights of others in a way that appears as a direct or indirect consequence of that activity, must compensate for the harm, regardless of whether the agent acted with negligence or recklessness in the harmful event, nor can the event itself, considered in isolation, appear to have resulted from an act of God (caso fortuito) or force majeure." The author Carnelutti, in his seminal work "Jurisdicción y procedimiento," reaches the conclusion, in 1934, having analyzed this theory, that "the risk principle, rather than establishing new duties incumbent on the entrepreneur, makes possible the distribution of industrial risks." CARNELUTTI (Francesco). Giurisdizione e Procedura, Milano, Giuffré, 1987, p.213.

In the present case, the issue is the liability attributed to the defendant company, a distributor and seller of agrochemicals, for the damages caused to ninety hectares of the plaintiffs' rice crops. Although a sales contract for an agrochemical existed between them, the causal nexus (relación de causalidad), in light of this theory, transcends what was agreed upon in that transfer-of-title contract (contrato traslativo de dominio) and falls instead within the realm of strict liability, given that the defendant's commercial activity is based on a profit derived from the risk inherent in the commercialization of chemical substances. Accordingly, the first ground of error is rejected.-

VII.Regarding the second and third grounds of appeal, the defendant is likewise incorrect. Strict liability (responsabilidad objetiva) arises both from treating the plaintiffs as consumers (consumidores) under the Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, N° 7472, and from the legislation governing agrochemicals (agroquímicos). This Tribunal has stated the following with respect to the application of the strict liability regime in matters of harm caused by agrochemicals: "VII.- (...) However, given what occurred in this case, the legal analysis of the grounds of appeal cannot be confined solely to matters relating to the purchase and sale of a product, as the plaintiff seeks to argue, because there is a subsequent phase—that of aerial application. Moreover, when dealing with harm caused by products, modern doctrine in the field of consumer law has developed novel criteria that are not limited to the contractual sphere, given the inherent implications of the production, processing, marketing, and use of such products.

In this regard, Ley 7472 de Promoción de la Competencia y Defensa Efectiva del Consumidor, in its articles 32 and 34, regulates consumer rights and the obligations of merchants and manufacturers. One of the most important of these is precisely the right to information. Section 35 of that Law further establishes a strict liability regime by imposing on the producer, supplier, or merchant the duty to respond regardless of fault if the consumer is harmed by reason of the good or service, by inadequate or insufficient information about them or about their use and risks. Only those who prove they were unconnected to the harm are relieved of liability. It also provides that legal representatives or those in charge of businesses are liable for acts or deeds carried out by their employees or auxiliaries. In this case, however, given the matters in dispute, no failure of the duty of information is at issue, since what the plaintiff alleges is the erroneous delivery of a product; nor can this be considered a case of product-defect liability, nor does what is alleged give grounds for applying—had the fact been proven—the warranty of operation (garantía de funcionamiento) regulated in section 43 of the cited Law and section 452 of the Código de Comercio.

VIII.- On the other hand, in matters of civil liability—whether contractual or extracontractual, strict or fault-based, and regardless of whether the subject matter is agrarian, civil, or commercial—for a claim to be admitted there must exist harm or injury (daño o perjuicio) that is attributable to or originates with the party being sued. Harm is understood as 'every impairment, loss, or detriment to the patrimonial or extra-patrimonial legal sphere of a person (the injured party (damnificado)), which deprives that person of a legal interest whose preservation, objectively speaking, was to be expected had the harmful event not occurred. Under this view, there is no civil liability without harm, just as there is no harm without an injured party. Furthermore, only harm that is proven—in its reality or existence—is compensable, this being a question of fact reserved to the sound discretion of the judge…' (Sala Primera de la Corte Suprema de Justicia, Voto Nº 114 de las 16:00 horas del 2 de noviembre de 1979).

In addition to being real, certain, effective, and deserving of legal protection, the harm must be caused by a third party and must persist at the time the claim is filed. There must also be a causal relationship (relación de causalidad) between the unlawful act and the harm that occurred." Tribunal Agrario, Voto N° 814-F-03 de las 14:45 horas del 16 de diciembre del 2003.- Strict liability is not limited solely to a consumer-law perspective; it also derives from agrochemicals legislation, and the defendant is therefore wrong to contend that it does not apply to the present case, as the Sala Primera has held: "V. (...) The laws that govern this matter are the Ley de Protección Fitosanitaria número 7664 and the Ley de Aviación Civil número 5050 del 11 de diciembre de 1972. The first provides: 'Those who import, manufacture, formulate, re-containerize, repackage, distribute, store, transport, sell, or apply chemical, biological, or related substances for agricultural use shall be obligated to compensate for the damage and injury that, through their actions or omissions, they cause to agriculture, livestock, human health, and the environment' (article 32).

The second establishes: 'Any natural or legal person who uses aircraft intended for agricultural aviation shall be liable for the damage caused to persons or the property of third parties on the ground' (article 107). Both provisions clearly establish strict liability; neither requires the victim to prove any subjective element of imputation. It therefore suffices to prove the harm and the causal link (nexo causal) in order to attribute civil liability to those who are objectively required to respond under the cited rules. The Sala, in a case similar to this one, recognized strict liability—today more than ever obligatory in the face of problems of an ecological nature (Sala Primera de la Corte Suprema de Justicia, Voto N° 607-F-02 de las 16:15 horas del 7 de agosto del 2002.).- The marketing and distribution of agrochemicals is an activity that entails a risk—to consumers, to the environment, and to agricultural producers—which gives rise to strict liability for those who assume that risk by engaging in such activity.

The Sala Primera has stated on another occasion: "VII. (...) The rationale for this position is very simple. It is not a matter of fault-based liability (responsabilidad subjetiva) as provided in section 1045 of the Código Civil, because under that framework the injured party must prove the causal link between the action of the injuring party and the harm suffered. Under strict liability, the mere existence of the harm presumes the liability of the injuring party to have been the cause of that harm, and it is therefore that party who must indemnify for the damage and injury caused by its conduct. This does not derive from an arbitrary act but from pure logic: anyone who, even through lawful conduct, assumes a risk involving danger must answer for all the harm that such danger may cause. There are many examples of this. If a person handles gunpowder, or any type of flammable material, whether in a factory, a commercial activity, or for their own entertainment, and an incident occurs with effects on any neighbor, it is not for the injured party to prove the causal link between the conduct engaged in and the harm caused; rather, the legal order presumes the fault of whoever assumed the risk and the danger, and only to be relieved of liability may that party prove not to be directly responsible for the harm caused, such that the burden of proof is reversed, and the grounds for exemption (eximentes)—which by analogy could be applied in the environmental sphere—would be those provided in the Ley General de la Administración Pública, which also establishes the strict liability of the State, namely 'force majeure,' 'fault of the victim,' or 'act of a third party' (article 190).- (Voto de la Sala Primera N° 398-F-01 de las 16:00 horas del 6 de junio del 2001).- The appellant's argument that phytosanitary regulations are confined exclusively to the administrative sphere is inadmissible, since the legal order, by virtue of the principle of hermeneutic completeness (plenitud hermenéutica), is a single whole.

Even in the absence of a written rule, the judge must apply the material sources of law—such as jurisprudence and the general principles of law—by virtue of article five of the Ley Orgánica del Poder Judicial. To sustain the appellant's argument would be to confine phytosanitary protection exclusively to the administrative jurisdiction (sede administrativa), which is unacceptable under any interpretation, given that the same regulatory framework derives from article 50 of the Constitución Política, which establishes as a duty of the State—the Judicial Branch included—to guarantee the protection of the human right to a healthy and ecologically balanced environment, by regulating risky activities such as those involving agrochemicals. Article one of the Ley de Protección Fitosanitaria establishes that the phytosanitary protection measures set forth in that law and its regulations are of public interest and of mandatory application, without distinguishing whether this applies exclusively to the administrative jurisdiction. Accordingly, the second and third grounds of appeal are rejected.-

VIII.As the final ground of appeal, the defendant contends that the applicable liability regime is that of subjective contractual civil liability (responsabilidad civil contractual de carácter subjetivo), under which two facts operate to exempt the defendant from liability: first, that the land had pre-existing problems with the red-rice (arroz rojo) pest prior to the events at issue, and second, that the plaintiffs applied Harness 90 EC knowing that no technical information existed for its use in this country. The defendant therefore argues that victim's fault (culpa de la víctima) is established as a ground exempting it from liability. The appellant is likewise wrong on this point. As was explained at length above, the applicable liability regime is one of strict liability (responsabilidad objetiva). Nevertheless, the grounds invoked by the appellant can also operate as exemptions under this type of liability.

According to the appellant's argument, the fact that the land had pre-existing problems with the red-rice pest would constitute, under its theory, "force majeure (fuerza mayor)." This Tribunal does not find such a theory acceptable, because within the causal nexus (nexo de causalidad), that pest is not the act generating the damage that occurred—that is, the disease affecting the crops was not what caused the rice to be burned. Its effect would have been something different, not the destruction of the rice in the manner in which it occurred. The presence of that pest was what motivated the application of Herness 90 EC—a fact that is undisputed by the parties, as can be inferred from the complaint and the answer thereto, as well as from the entire discussion that developed throughout the litigation. The testimony of [Nombre8], who is an agronomist, also confirms that the act generating the damage was the application of that agrochemical (agroquímico), as he declared at folio 368 verso: "I know that approximately three years ago a product was applied on a farm belonging to the [Nombre3] brothers, which has irrigation, and that harvest cycle was lost.

We were paying close attention to it because it was something novel in the area for what was being treated, but it did not work because nothing could be harvested on the plot. I also know of another farmer named [Nombre9] who applied the same product and was likewise unable to harvest anything. The product was not selective for rice cultivation; it did not solve the problem—it actually created more problems. The product was Harness. (…) The aim was to control red rice, which is a segregant of good rice. Red rice is bad, and since both are rice, the product applied should have been selective so as not to affect the good rice, but what was applied killed both." (Emphasis not in the original). As can be gathered from the foregoing testimony, the cause of the burning and destruction of the plaintiffs' crops was the application of Herness, sold and recommended by the defendant. The red-rice pest would, on its own, have had segregant effects—not a burning effect such as that which occurred in the plaintiffs' rice fields.

The remedy (Herness) turned out to be worse than the disease (red rice), since that product was not authorized in this country for use on rice cultivation (in contravention of the provisions of Articles 23 and 24 of the Ley de Protección Fitosanitaria and Articles 92, 93, 95, and 101 of its Reglamento). Accordingly, the "experiment" suggested and recommended by the defendant had disastrous results for the Araya family's rice fields, as witness [Nombre8] recounted at folio 369: "The product was applied with the knowledge of Agrosuperior employees, because they were present and attentive throughout the application and the subsequent development of the crop." The foregoing witness's account deserves credence from this Tribunal, not only because he is an agronomist and a resident of the area, but also because of the attention he devoted to the product's application given the novelty of its use.

The second exempting ground invoked by the defendant is likewise not acceptable in this case: victim's fault. Both the account given by witness [Nombre8] and the testimony of [Nombre10] establish this. The latter stated that Herness was applied by [Nombre11]. He even states that he saw Agrosuperior vehicles at the farms at the time of the application (folio 373). Mr. [Nombre11] also ratifies this in his declaration at folio 376 verso and states that the application and the mixing were carried out at the dosage indicated by the defendant company, and that [Nombre12], an employee of the defendant, even came to supervise. These witnesses deserve credence from this Tribunal, both because of their knowledge of rice cultivation and because they were eyewitnesses. The opposite holds true for the testimony of [Nombre12], an agricultural engineer and the defendant's sales representative, who sold Herness to the plaintiffs.

Disregarding his legal obligations, he openly denies having even asked the plaintiffs what they intended to use Herness for, claiming that "in sales I had no obligation to ask what the product was going to be used on, and I still don't even now" (folio 371). Such a statement from a witness is astonishing. Logic and experience tell us that, for example, when a patient visits a doctor, the patient must explain the ailment affecting him so that the professional can make a diagnosis and provide a "prescription." The same applies to agrochemicals: the farmer describes the problem, and the salesperson—who is presumed to have experience and full knowledge of the entire range of available products—advises the use of a particular product. Herein lies the strict liability so vigorously denied by the defendant, which has incurred liability by having an employee like this witness selling highly dangerous products such as pesticides (plaguicidas) without any professional judgment and without providing adequate guidance and information to customers.

One might well ask: what would happen if what was being sold were not pesticides but gunpowder?... Decreto 27034-MAG of January 5, 1998 imposes obligations on companies such as the defendant to verify that their sales personnel—such as the aforementioned witness—have received the training required of dispensers and sales staff. This requirement is entirely logical, given the delicate nature of handling and applying these products. In every company, personnel are trained on the products being sold. Even encyclopedia salespeople receive training so that they can properly advise on and sell the product. Witness [Nombre12] deserves no credence whatsoever, for, being an agricultural engineer, his testimony leads to one of two conclusions: 1.- That he genuinely received no training whatsoever (and for that reason believes he had no obligation even to ask what Herness was to be used for); or, 2.- That he is not telling the truth in order to conceal his negligence at the time of the sale.

From the standpoint of strict liability—and even subjective liability—the defendant company is responsible for the sale and application of that product in violation of the legislation governing this type of activity. Accordingly, no victim's fault occurred, as the plaintiffs acted in accordance with the instructions and assessment provided by the defendant. Since the act generating the damage was the application of a product not authorized for rice in this country, and since the party generating the damage was the defendant company through Mr. [Nombre12], it follows that in this case—as the lower court (ad quo) found to be established—the defendant is liable for the damages and losses (daños y perjuicios) caused to the plaintiffs' rice crops. In light of the foregoing, it must therefore be taken as established that the damage to the rice plantings was caused by the application of the Herness product on the farm, carried out by agreement between the plaintiffs and AgroSuperior itself, under whose instructions the pesticide was applied.

All of the foregoing leads to the conclusion that the cause—as the act generating the damage in these proceedings—was the application of Herness on ninety hectares of rice by the plaintiffs, acting under the defendants' instructions on their farm, which resulted in damage to the rice crop belonging to the co-plaintiffs. And that damage was not attributable to force majeure or to victim's fault, neither of which was demonstrated in any way, but rather to the defendant's own conduct in connection with the production of the harm caused. The causal nexus is established, and accordingly liability is attributable to the defendant as has been found to be proven. The fourth and final ground of appeal raised by the defendant is dismissed.-

IX. ON THE APPEAL FILED BY THE PLAINTIFF

The grounds of appeal (agravios) of the plaintiff essentially center on the non-recognition of the loss of the investment made in 55 hectares of rice for the second planting of the year 2002. First, the curriculum vitae of [Nombre5] and the last three publications in the Official Gazette La Gaceta concerning the appointments of the panel of expert witnesses (peritos) for the Judicial Branch, in which the aforementioned expert appears, have been admitted as evidence for a better resolution of the matter. However, the reasons that led the lower court judge (ad quo) to decline to credit the private expert report (peritaje) rendered by said expert are shared by this Tribunal. No one disputes the professional competence of said individual; his credentials speak for themselves. The same applies to the expert report rendered by engineer [Nombre13]. Nevertheless, both expert opinions are based on premises provided by the plaintiffs and, being private expert reports, they carry no evidentiary weight, since that evidence was produced—by its private nature—without the guarantees of the adversarial process (contradictorio) and the right of defense that are embedded in the procedural framework for expert evidence, set forth in Articles 401 through 408 of the Code of Civil Procedure.

Proceduralist doctrine has developed the expert-evidence procedure in light of constitutional guarantees, in the sense that "expert evidence must be conducted with absolute respect for the legal and constitutional guarantees that govern it in order to be considered above reproach and capable of rebutting the presumption of innocence. If those guarantees are not observed, the expert evidence may lack validity and may not be taken into account when the adjudicating body forms its conviction. This does not mean, however, that any infraction of the legal procedural rules established for its proper conduct automatically and directly results in the invalidity of the expert evidence for the purpose of overcoming the presumption of innocence." CAJAL ALONSO (Javier). Análisis Jurisprudencial de la Prueba Pericial, en: Prueba Documental y Pericial, Bogotá, Editorial Jurídica Bolivariana, Primera Edición, 2002, p. 524.- This Tribunal has repeatedly reduced the evidentiary weight of private expert reports for lacking a procedure of submission, admission, production, and examination in light of the constitutional guarantee of the bilateral hearing (bilateralidad de la audiencia): "Now, with regard to the document whose analysis was omitted in the judgment despite constituting a cadastral report from which an overlap of survey plans is apparent, it is evident from the document itself that it is a study prepared in connection with a private consultancy in which the adversarial process was clearly not followed; furthermore, while it does locate the area corresponding to the defendant's survey plan, it is not sufficiently explicit to affirm that the parent plan—which includes several topographic surveys—corresponds to the one cited by the plaintiff in the complaint." Tribunal Agrario Voto N° 151 de las 8:00 horas del 28 de febrero del 2002, Voto 168 de las 14:40 horas del 13 de marzo del 2002.- Therefore, it cannot be considered established that the second harvest carried out on the 55 hectares with the inputs supplied by the defendant was lost, particularly given that the expert report of [Nombre5] is a mathematical expert report that does not certify the existence of said damage, as the ad quo determined.

What was in fact established is that the defendant made a kind of partial arrangement by supplying the plaintiffs with the inputs necessary to replant those 55 hectares, so that the damage alleged by the plaintiffs has been duly remedied; accordingly, it cannot be held that the total loss occurred across all ninety hectares, given that 55 of them were remediated. As to what was invested in the second planting of the 55 hectares, there is no evidence—as the trial judge found—that it was lost, because the loss of that second planting was not proven. In any event, the investment in it was contributed by the defendant, which is an uncontested fact and therefore exempt from proof, in accordance with Article 316 of the Code of Civil Procedure. That is to say, the investment lost in the first harvest was compensated by the defendant through the input investment of the second harvest. For this reason, the rejection of the claimed indemnification item for the loss of everything invested in the preparation and planting for the first harvest cycle of 2002 (labor, fertilizers, pesticides, irrigation, seed) is justified, as that item was spontaneously remedied by the defendant.

Because the private expert reports of [Nombre5] and [Nombre13] carry no evidentiary weight, the plaintiffs' estimate of the investment in the first planting in the amount of 14 million colones remains an unproven fact. Since that damage has not been established, the claim for lost profits—the supposed earnings from the rice harvest sown, in the amount of seven million colones—is likewise inadmissible. Finally, the plaintiff challenges the fact that the ad quo declined to credit these expert reports while crediting the one rendered by engineer [Nombre6], submitted by the defendant, when no one witnessed him visiting the property, nor was the failure to prove the authenticity and professional standing of his report ever challenged—particularly given that the report was issued on SENARA letterhead when said engineer works for the MAG, so that the evidentiary basis relied upon by the ad quo for the partial indemnification for the second planting on the 55 hectares lacks foundation (folios 594 to 630).- The appellant is likewise incorrect on this point.

Note that at folios 388 to 389 there is the report rendered by engineer [Nombre14], Director of the Chorotega Regional Directorate of the MAG, in which, in response to the ad quo's own inquiries, he certifies that engineer [Nombre6] was assigned to the Agricultural Services Agency of Bagaces as an active employee of the MAG. He also explains that the use of prescription forms or technical-visit vouchers such as the one admitted into the record at folio 234—carried out by said professional on June 21, 2002—is common practice among officials of the MAG, SENARA, the CNP, the IDA, and the PIMA, so that the grounds of appeal raised by the plaintiff are repetitive, as their objections were addressed in said report, which was obtained by the ad quo, who diligently took care to verify the authenticity of those forms. Consequently, with respect to the matters appealed, the decision under review must be affirmed.

Por tanto:

The documentary evidence offered by the plaintiff is admitted as evidence for a better resolution of the matter, including both the curriculum vitae of [Nombre5] and the certified copies of the last three publications of the official court expert witness appointments. The remainder of the evidence offered is rejected. With respect to the matters appealed, the decision under review is affirmed.

VOTO N° 0958-F-07 VOTO N° 0958-F-07 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las quince horas cuarenta minutos del veintidós de noviembre de dos mil siete.

PROCESO ORDINARIO, planteado por [Nombre1] , mayor, casado una vez, empresario agrícola, cédula CED1 - - vecino de San Ramón; [Nombre2] , mayor, casado una vez, empresario agrícola, cédula CED2 - - - , vecino de Cañas Guanacaste; y [Nombre3] , mayor, divorciado, empresario agrícola, cédula CED3 - - , vecino de Bagaces Guanacaste, contra AGROSUPERIOR SOCIEDAD ANÓNIMA, cédula jurídica CED4 - - ; representada por [Nombre4] , mayor, casado una vez, ingeniero civil, cédula CED5 - - , vecino de San José, en la condición de apoderado generalísimo sin límite de suma, tramitado en el Juzgado Agrario de Liberia. Intervienen como apoderados especiales judiciales de los actores y demandados los licenciados Mario Alberto Rosales Vargas; cédula CED6 - - - ; Rogelio Navas Rodríguez, cédula CED7 - - ; y Carlos Alejandro Baéz Astúa, cédula CED8 - - , todos mayores, profesionales y vecinos de San José.

RESULTANDO:

1. Los actores presentan demanda ordinaria, estimada en la suma de treinta millones colones, para que en sentencia se declare: "1. De previo a otorgar traslado a la presente demanda, solicitamos su anotación al márgen de los vehículos de las empresas demandadas, a saber los vehículos placas que constan en las certificaciones del Registro Pública adjuntas. 2. Igualmente solicitamos anotar la presente causa al márgen de la finca del partido de San José, matrícula de folio real número [Placa1] 3. Otograr traslado a las demandadas acerca de la presente demanda incoada en su contra. 4. Evacuar la prueba ofrecida en el presente memorial. 5. Declarar con lugar en todos sus extremos la presente demanda. 6. Condenar a los accionadas al pago de los daños y perjuicios ocasionados a nuestros representados. 7. Condenar a las demandadas al pago de los intereses legales que las indemnizaciones devenguen hasta el efectivo pago de las mismas. 8. Condenar a las demandadas al pago de ambas costas del presente proceso" (folio 143).

2. Las empresas demandadas, fueron debidamente notificadas de la acción en su contra, y no se opusieron a la misma, (folios 201 a 204).

3. La licenciada Ruth Alpízar Rodríguez, jueza de primera instancia en sentencia dictada a las ocho horas del dieciséis de enero del dos mil seis, resolvió: " POR TANTO: Se declara parcialmente con lugar la presente demanda ordinaria de daños y perjuicios establecida por [Nombre1], [Nombre2] y [Nombre3] en contra de AGROSUPERIOR SOCIEDAD ANONIMA. Se condena a las sociedades demandadas al pago de los siguientes extremos, entendiéndose por denegados los que expresamente no se indiquen: 1) Por perjuicios, las utilidades dejadas de percibir por los actores en un área de noventa hectáreas de cosecha de arroz del primer ciclo del año dos mil dos, suma que se fijará en etapa de ejecución de sentencia. 2) Por daños, el monto erogado por la compra de 360 litros de Harness 90 EC, el cual se fija en UN MILLON SESENTA Y SEIS MIL DIECISIETE COLONES CON SESENTA Y NUEVE CENTIMOS 3) Se condena a la sociedad demandada al pago de ambas costas de este proceso (folios 543 a 571 ).

4. Los licenciados Rogelio Navas Rodríguez y Ricardo Fournier Vargas apoderados de los actores y de la sociedad demandada formularon recurso de apelación ante este Tribunal con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia, (folios 574 a 630).

5. En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones capaces de producir la nulidad del fallo. La presente resolución se dicta dentro del término de ley.

Redacta el juez Picado Vargas; y,

CONSIDERANDO:

I.De conformidad con el numeral 52 de la Ley de Jurisdicción Agraria, se admite como prueba para mejor resolver la prueba documental ofrecida por la parte actora, en lo que se dirá: 1.- Currículum vital del señor [Nombre5] (folios 583 a 587). 2.- Copias certificadas de las tres últimas publicaciones de los nombramientos de peritos oficiales de la Corte, en los que aparece dicho señor (folios 588 a 591). El resto de prueba ofrecida se rechaza por resultar innecesario, por existir suficientes elementos de prueba en los autos.-

II.Se prohíja el elenco de hechos tenidos por demostrados, por corresponder al mérito de las probanzas que han sido ofrecidas, admitidas y evacuadas durante el proceso.-

III. Del mismo modo, se comparte el conjunto de hechos tenidos por indemostrados.-

IV.El señor Ricardo Fournier Vargas, en representación de la sociedad demandada, presenta recurso de apelación contra la citada resolución, conforme a los siguientes agravios: 1.- Considera contradictorio que la ad quo estime que ha mediado responsabilidad extracontractual al tiempo de que tiene como hecho demostrado que este conflicto ha surgido a causa de un contrato de compraventa de un insumo agrícola y cita jurisprudencia de la Sala Primera de la Corte Suprema de Justicia que más bien excluye dicho tipo de responsabilidad cuando ha mediado una relación contractual previa. 2.- Yerra la sentencia en aplicar un sistema de responsabilidad objetiva ya que los actores no pueden ser considerados como consumidores al ámbito del artículo 2 de la Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, pues no son destinatarios finales de la cadena de producción de bienes o servicios, de conformidad con la reiterada jurisprudencia de la Sala Constitucional de la Corte Suprema de Justicia. 3.- Dicho régimen de responsabilidad tampoco es aplicable al caso con base en la normativa fitosanitaria ya que ésta se circunscribe en forma exclusiva al ámbito administrativo bajo el soporte del Departamento de Control de Insumos Agrícolas o de cualquier otra actividad, por lo que las sanciones establecidas por la ad quo con base en dicha normativa atentan contra el principio de legalidad. 4.- Estima que el régimen de responsabilidad aplicable al caso lo es el de responsabilidad civil contractual de carácter subjetivo, dentro del cual existen dos hechos que eximen de responsabilidad a la demandada, como lo es que el terreno tuviera problemas preexistente a los hechos con la plaga del arroz rojo, y que los actores aplicaron el Harness 90 EC con conocimiento de que no existía información técnica del mismo para nuestro país; por lo que se configura culpa de la víctima como causal eximente de responsabilidad (folios 574 a 580).

V.El licenciado Rogelio Navas Rodríguez, apoderado especial judicial de los actores, interpuso recurso de apelación con base en los siguientes agravios: 1).- Aduce una errónea interpretación de la ad quo al tener como hecho cuarto no probado la pérdida de la cosecha de 55 hectáreas de arroz y una contradicción con los hechos probados 12 y 13 con respecto a los hechos demostrados números 8, 9 y 11 de la sentencia recurrida, específicamente en lo concerniente a las fechas, lugares de siembra y cosecha de esas 55 hectáreas de arroz. Considera que en realidad a pesar de que la demandada dio en señal de arreglo insumos para la siembra de 55 de las 90 hectáreas dañadas con el Harness, a pesar de dichos insumos el resultado fue el mismo, por lo que el daño total es sobre las 90 hectáreas en que se aplicó el producto. Es decir, que se dio una primera siembra de 90 hectáreas, que resultaron dañadas por el producto.

Y luego de esas 90, se resembraron 55 (merced a los insumos recibidos de la demandada) con igual resultado, por lo que se equivoca la ad quo al considerar que el daño sobre esta segunda cosecha de 55 hectáreas fue reparado por la demandada. 2).- Sostienen que dentro de los daños resarcibles, la sentencia recurrida les niega la indemnización de la pérdida todo lo invertido en la preparación y siembra para el primer ciclo de cosecha del 2002 (mano de obra, abonos, plaguicidas, riego, semilla) a causa del Harness 90 EC, lo cual asciende a la suma de 14 millones de colones. Dicha inversión, estiman los actores, pretendían recuperarla con la cosecha de arroz sembrado en una suma de siete millones de colones. Por ello, el daño no fue reparado por la demandada en forma efectiva por cuanto los insumos dados por ésta se perdieron porque esta segunda cosecha en las 55 hectáreas se perdió a causa del Herness.

Por ello, según los cálculos del perito [Nombre5] asciende a la suma de definitiva de 14.367.929 colones. Dicho peritaje es válido por tratarse de un conocido perito matemático, parte del grupo de peritos del Poder Judicial y no puede ser desechado como lo hace la ad quo por venir la experticia sin autenticar, lo mismo que el vertido por el ingeniero Adolfo Soto, pruebas que fueron admitidas en su oportunidad. Cuestiona el hecho de que la ad quo no le diera valor a estos peritajes y sí lo hiciera con el vertido por el ingeniero [Nombre6] , ofrecido por la demandada, cuando nadie lo vio apersonarse al terreno, ni habérsele cuestionado la indemostración de su autenticidad y profesionalidad, máxime que el informe está emitido con papel del SENARA cuando dicho ingeniero trabaja para el MAG, por lo que la acreditación hecha por la ad quo a la indemnización parcial sobre la segunda siembra en las 55 hectáreas no tiene fundamento probatorio (folios 594 a 630).-

VI. SOBRE EL RECURSO DE APELACIÓN INTERPUESTO POR LA DEMANDADA

En cuanto al primer agravio formulado por la demandada, no lleva razón el recurrente. Si bien entre las partes medió un contrato de compraventa de un plaguicida lo que pretende la parte actora es una indemnización por daños y perjuicios ocasionados por dicho agroquímico en sus cultivos de arroz, lo cual constituye una responsabilidad de tipo objetivo. Al respecto ha señalado la jurisprudencia de la Sala Primera de la Corte Suprema de Justicia, en relación con la responsabilidad extracontractual objetiva, y a efecto de consolidar aún más la tesis de este Tribunal ha resuelto en lo conducente: "...IX.-El artículo 1045 del Código Civil establece el fundamento de la responsabilidad extracontractual subjetiva: "Todo aquél que por dolo, falta, negligencia o imprudencia, causa a otro un daño, está obligado a repararlo junto con los perjuicios." El deber de resarcimiento, en este caso, deriva del incumplimiento culposo del principio general de "no causar daño a los demás".

Para que haya responsabilidad, se requiere que el daño haya sido ocasionado con culpa (negligencia, imprudencia o impericia), o dolo del agente. La carga de la prueba corresponde entonces al acreedor, es decir, a la víctima que solicita el resarcimiento. La hipótesis contenida en el artículo 1048 párrafo 3 ibídem es distinta: "El que encarga a una persona el cumplimiento de uno o muchos actos, está obligado a escoger una persona apta para ejecutarlos y a vigilar la ejecución en los límites de la diligencia de un buen padre de familia; y si descuidare esos deberes, será responsable solidariamente de los perjuicios que su encargado causare a un tercero con una acción violatoria del derecho ajeno, cometida con mal intención o por negligencia en el desempeño de sus funciones, a no ser que esa acción no se hubiere podido evitar con todo y la debida diligencia en vigilar". Esta es la responsabilidad civil indirecta o por hecho ajeno, en sus dos formas "in eligendo " e "in vigilando".

La ley obliga a quien encarga a otro la realización de determinado trabajo, a elegir a alguien apto y a vigilar la ejecución del encargo. Si el encargado, en ejecución del encargo y dentro del ámbito de confianza otorgado por el comitente, causa daños a terceros éstos se ven facultados para accionar directamente contra la persona que hizo el encargo. La responsabilidad indirecta, en el caso del encargado que causa daño a un tercero, la asume el mandante a partir de un suceso: que el daño emerja por una acción dolosa o culposa. Supuesto esto, viene esa responsabilidad indirecta, ya que se presume la culpa en elegir o en vigilar del comitente. La presunción se dirige pues, no a la acción del encargado, sino a la acción del mandante, quien solo podría excusarse de ella si prueba que, aún poniendo toda la previsión en vigilar, el suceso siempre habría ocurrido. La acción culpable del autor directo no se presume en materia de responsabilidad extracontractual; lo que se presume es la culpa en la acción de vigilancia o de elección, a cargo del mandante.

"(Sala Primera de la Corte, N° 34 de las 14 horas 25 minutos del 22 de marzo de 1991. Lo enfatizado no responde al original). Con base en lo dispuesto en la anterior sentencia, el régimen de responsabilidad objetiva trasciende el ámbito contractual o extracontractual en que se haya originado la relación jurídica entre las partes. La doctrina ha interpretado que el artículo 704 del Código Civil excluye de la indemnización los daños que no sean necesariamente producto del incumplimiento, o que sean una consecuencia lejana de la acción. Este numeral se entiende aplicable a la responsabilidad civil contractual como a la extracontractual, (en ese sentido RIVERO SÁNCHEZ (Juan Marcos) Responsabilidad Civil. Tomo II. San José, Editorial Areté, 2001, p. 141). El agravio del recurrente no es de recibo, ya que la responsabilidad objetiva que aquí se discute se puede dar sin importar que haya mediado o no contrato entre las partes.

El artículo 704 es una norma de carácter general que complementa el artículo 1045 del mismo código. Por ello, en materia de venta, distribución y manejo de plaguicidas, el tipo de responsabilidad es objetiva por la teoría del riesgo creado en actividades peligrosas. Dicha teoría establece que quien lucra de una actividad riesgosa (como el vender sustancias químicas como lo son los plaguicidas) debe ser responsable de los daños que éstos generan y ello se encuentra en la Ley de Protección Fitosanitaria, su Reglamento, así como en el Reglamento sobre Registro, Uso y Control de Plaguicidas Agrícolas y Coadyuvantes, y el Decreto Ejecutivo que crea Permiso de Operación para la Venta o Expendio de Sustancias Químicas, Biológicas o Afines y la misma Ley General de Salud. La Teoría del Riesgo Creado, según la doctrina italiana más reciente en material de daños: “... permite aplicar criterios de responsabilidad objetiva incluso en aquellos casos en que, al no existir un ejercicio de actividades empresariales, no se podría realizar la asociación “riesgo-beneficio- responsabilidad”.

Los accidentes que se producen fuera de las actividades lucrativas propiamente dichas terminan siendo absorbidas, entonces, por la premisa según la cual todo aquel que emplea fuentes de riesgo debe soportar las consecuencias negativas de su acción.” ALPA (Guido). Nuevo Tratado de la Responsabilidad Civil, Milán, Giuffré Editori, 1999, p.p.383-384. El autor Pacchioni, indica que: “cuando un sujeto organiza una actividad económica propia, con fin de lucro, debe, ciertamente, padecer las desventajas de su obrar, y resarcir los daños ocasionados a terceros, aun cuando él no fuera culpable”, (PACCHIONI ([Nombre7].) Diritto Civile Italiano, Parte II, Vol. IV, Papua, 1940, p.11).- Por ello, esta teoría parte del principio general, enunciado desde finales del siglo XIX por el jurista Vittorio Emanuele Orlando, que “todo aquel que en el ejercicio de una empresa o de una actividad cualquiera causa al derecho ajeno un daño que se presenta como consecuencia directa o indirecta de tal actividad, debe resarcir el daño, sin que tenga importancia el hecho de que en el evento dañoso el agente no haya pecado de negligente o imprudente, ni en el evento mismo, aisladamente considerado, puede aparecer dependiente del caso fortuito o de una fuerza mayor”.

ORLANDO (Vittorio Emanuele). Saggio di una teoria sul fondamento guiridico della responsabilitá civile, Roma, 1893, Archivio di diritto pubblico, p.242. El autor Carnelutti, en su obra cumbre “Jurisdicción y procedimiento”, llega a la conclusión, en 1934, analizando esta teoría, que “el principio del riesgo más que establecer nuevos deberes a cargo del empresario, viabiliza la distribución de los riesgos de la industria”. CARNELUTTI (Francesco). Giurisdizione e Procedura, Milano, Giuffré, 1987, p.213. En el presente caso, se discute la responsabilidad que se le reprocha a la sociedad demandada, distribuidora y vendedora de agroquímicos, por los daños ocasionados a noventa hectáreas de arroz de los actores. Si bien existió entre ellos un contrato de compraventa de agroquímico, mas la relación de causalidad, a la luz de esta teoría, trasciende a lo pactado en dicho contrato traslativo de dominio para invadir más bien al ámbito de la responsabilidad objetiva, en razón de que la actividad comercial de la demandada se basa en un beneficio fundado en el riesgo que reviste el comercializar sustancias químicas. Por ende, se rechaza el primer agravio.-

VII.En cuanto a su segundo y tercer agravio, tampoco lleva razón la demandada. La responsabilidad objetiva deviene tanto en considerar a los actores como consumidores al amparo de la Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, N° 7472, como de la misma legislación en materia de agroquímicos. Ha señalado este Tribunal sobre la aplicación del régimen de responsabilidad objetiva en materia de daños ocasionados por agroquímicos: "VII.- (...) Sin embargo, dado lo acontecido en este asunto, no puede limitarse el análisis jurídico de los agravios de la apelación únicamente a lo relacionado con la compraventa de un producto, como lo pretende la actora, por cuanto existe una fase posterior, la de su aplicación vía aérea. Aún más, tratándose de daños producidos por productos, la doctrina moderna en materia de derecho del consumidor, ha desarrollado criterios novedosos, que no se limitan a la esfera contractual, por las implicaciones propias de la producción, elaboración, comercialización y uso de tales.

En ese sentido, la Ley 7472 de Promoción de la Competencia y Defensa Efectiva del Consumidor, en sus artículos 32 y 34, regula los derechos de los consumidores y las obligaciones de comerciantes y fabricantes. Uno de los más importantes es precisamente el derecho de información. El numeral 35 de dicha Ley establece además un régimen de responsabilidad objetiva, al imponer al productor, proveedor o comerciante, el deber de responder independientemente de la existencia de culpa, si el consumidor resulta perjudicado por razón del bien o el servicio, de informaciones inadecuadas o insuficientes sobre ellos o de su utilización y riesgos. Solo se libera quien demuestra ha sido ajeno al daño. Además, indica los representantes legales o encargados de los negocios son responsables por los actos o hechos producidos por los dependientes o auxiliares. En este caso, sin embargo, dado lo debatido, no se discute se haya faltado al deber de información, pues lo que se alega por el actor es una entrega errónea de un producto, ni puede considerarse por ello se esté en presencia de responsabilidad por defecto del producto, así como tampoco lo alegado da pie para aplicar, de haberse comprobado el hecho, la garantía de funcionamiento regulado en los numerales 43 de la Ley citada y 452 del Código de Comercio.

VIII.- Por otro lado, en materia de responsabilidad civil, contractual o extracontractual, objetiva u subjetiva, independientemente de tratarse de materia agraria, civil o comercial, para ser admitido el reclamo debe existir un daño o perjuicio, el cual debe ser imputable u originado por quien se demanda. Por daño se entiende “ todo menoscabo, pérdida o detrimento de la esfera jurídica patrimonial o extrapatrimonial de la persona (damnificado), el cual provoca la privación de un bien jurídico, respecto del cual era objetivamente esperable su conservación de no haber acaecido el hecho dañoso. Bajo esta tesitura, no hay responsabilidad civil si no media daño, así como no existe daño si no hay damnificado. Por otra parte, solo es daño indemnizable el que se llega a probar (realidad o existencia), siendo ello una cuestión de hecho reservada al prudente arbitrio del juzgador…”(Sala Primera de la Corte Suprema de Justicia, voto Nº 114 de las 16:00 horas del 2 de noviembre de 1979).

Aparte de tener que ser real, cierto, efectivo y merecedor de amparo jurídico, se requiere el daño sea causado por un tercero y esté subsiste a la hora de plantearse la demanda. Debe mediar además una relación de causalidad entre el hecho ilícito y el daño acontecido." Tribunal Agrario, Voto N° 814-F-03 de las 14:45 horas del 16 de diciembre del 2003.- La responsabilidad objetiva no sólo se limita desde la óptica del consumidor, sino también se deriva de la legislación sobre agroquímicos, por lo que no lleva razón la demandada en estimar que no es aplicable la misma al presente asunto, tal y como lo ha estimado la Sala Primera: "V. (...) Son las Leyes de Protección Fitosanitaria número 7664, y la de Aviación Civil número 5050 del 11 de diciembre de 1972, las que la regulan. La primera dispone: “Quienes importen, fabriquen, formulen, reenvasen, reempaquen, distribuyan, almacenen, transporten, vendan y apliquen sustancias químicas, biológicas o afines para uso agrícola, estarán obligados a resarcir los daños y perjuicios que, con sus acciones u omisiones, ocasionen a la agricultura, la ganadería, la salud humana y el ambiente” (artículo 32).

La segunda establece: “Toda persona física o jurídica que utilice aeronaves destinadas a la aviación agrícola responderá por los daños que cause a las personas o bienes de terceros en la superficie” (artículo 107). Ambas determinan claramente una responsabilidad objetiva, ninguna obliga a la víctima a demostrar algún elemento subjetivo de imputación. Por ello basta con que se pruebe el daño y la relación de causalidad para imputar la responsabilidad civil a los sujetos que objetivamente deben responder, según las normas citadas. La Sala en un caso similar al presente, admitió la responsabilidad objetiva, hoy más que nunca obligada frente a problemas de orden ecológico (Sala Primera de la Corte Suprema de Justicia, Voto N° 607-F-02 de las 16:15 horas del 7 de agosto del 2002.).- El comercializar, distribuir agroquímicos es una actividad que implica un riesgo, tanto al consumidor como al medio ambiente, como al productor agrario, lo cual genera responsabilidad de tipo objetivo para quien asuma dicho riesgo al dedicarse a dicha actividad.

Ha dicho la Sala Primera referida en otra oportunidad: "VII. (...) El fundamento de esta tesis es muy simple. No se trata de la responsabilidad subjetiva prevista en el numeral 1045 del Código Civil, porque en tal hipótesis el damnificado debe probar el nexo causal entre la acción del agente dañino y los perjuicios sufridos. En la objetiva la simple existencia del daño reputa la responsabilidad en el agente dañino de haber sido el causante de ese daño, y por tal quien deberá indemnizar los daños y perjuicios causados con su conducta. Esto no deriva de un acto arbitrario sino de pura lógica, pues quien, incluso en una conducta lícita, asume un riesgo donde exista peligrosidad, debe responder por todo cuanto daño pueda causar esa peligrosidad. Existen muchos ejemplos al respecto. Si una persona manipula pólvora, o cualquier tipo de material inflamable, sea en una fábrica, en una actividad comercial, o por su propia diversión, en caso de ocurrir un siniestro con efectos en cualquier vecino, no ha de ser el damnificado el llamado a probar el nexo de causalidad entre la conducta ejercida y el daño causado, más bien el ordenamiento jurídico parte de la culpabilidad de quien asumió el riesgo y la peligrosidad, y solo para eximirlo de la responsabilidad podría probar no ser el responsable directo del daño causado, así la carga de la prueba se invierte, y los eximentes, como por analogía podría aplicarse para el ámbito ambiental, serían los previstos en la Ley General de la Administración Pública donde también se prevé la responsabilidad objetiva del Estado, siendo ellos “fuerza mayor”, “culpa de la víctima” o “hecho de un tercero” (artículo 190).- (Voto de la Sala Primera N° 398-F-01 de las 16:00 horas del 6 de junio del 2001).- La tesis del recurrente en cuanto a que la normativa fitosanitaria solo se circunscribe al ámbito administrativo es inadmisible, ya que el ordenamiento jurídico, en virtud del principio de plenitud hermenéutica, es uno solo.

Incluso a falta de norma escrita, el juzgador debe aplicar las fuentes materiales del derecho, como lo son la jurisprudencia y los principios generales del derecho, por disposición del artículo quinto de la Ley Orgánica del Poder Judicial. Sostener la tesis del recurrente equivaldría a mantener la protección fitosanitaria únicamente en sede administrativa en forma exclusiva, lo cual no es de recibo bajo ninguna óptica, ya que la misma normativa se deriva del artículo 50 de la Constitución Política que establece como un deber del Estado -Poder Judicial incluido- el garantizar la tutela del derecho humano al ambiente sano y ecológicamente equilibrado, regulando actividades riesgosas como lo es lo relativo a los agroquímicos. El artículo primero de la Ley de Protección Fitosanitaria establece que es de interés público y aplicación obligatoria las medidas de protección fitosanitaria establecida en esta ley y sus reglamentos, sin discriminar si lo es exclusivamente para sede administrativa. En consecuencia, se rechazan el segundo y tercer agravios.-

VIII.Como último agravio, la demandada estima que el régimen de responsabilidad aplicable al caso lo es el de responsabilidad civil contractual de carácter subjetivo, dentro del cual existen dos hechos que eximen de responsabilidad a la demandada, como lo es que el terreno tuviera problemas preexistente a los hechos con la plaga del arroz rojo, y que los actores aplicaron el Harness 90 EC con conocimiento de que no existía información técnica del mismo para nuestro país; por lo que se configura culpa de la víctima como causal eximente de responsabilidad. Tampoco lleva razón la recurrente. Como se explicó ampliamente, el régimen de responsabilidad aplicable es el de tipo objetivo. Sin embargo, las causales expuestas por el apelante son eximentes también en este tipo de responsabilidad. De acuerdo a lo expuesto por el recurrente, el hecho de que el terreno presentara problemas previos con la plaga del arroz rojo entraría, según su tesis, como “fuerza mayor”.

No considera este Tribunal, aceptable tal tesis, ya que dentro del nexo de causalidad, dicha plaga no es el hecho generador del daño ocurrido, es decir, la enfermedad que presentaban los cultivos no fue la que ocasionó que el arroz se quemara. Su efecto sería otro, no la destrucción del arroz en la forma en que se presentó. La presencia de dicha plaga fue la que motivó el aplicar el Herness 90 EC, hecho que no es controvertido por las partes, según se desprende de la demanda y su contestación, así como de toda la discusión que se ha desarrollado a lo largo de la litis. También se comprueba con el testimonio de [Nombre8] , quien es agrónomo, que el hecho generador del daño lo fue la aplicación de dicho agroquímico, tal y como a folio 368 vuelto declaró: “Sé que hace tres años aproximadamente se aplicó un producto en una finca de los hermanos [Nombre3] que tiene riego, y ese ciclo de cosecha se perdió.

Se estuvo pendiente de ello porque era algo novedoso en la zona para lo que se estaba tratando, pero no funcionó porque no se pudo cosechar en el lote. Sé también de otro agricultor de nombre [Nombre9] que aplicó el mismo producto y tampoco pudo cosechar nada. El producto no fue selectivo para el cultivo de arroz, no solucionó el problema más bien les dio problemas. El producto era Harness. (…) Se estaba tratando de controlar arroz rojo, que es un segregante del arroz bueno. El arroz rojo es malo, y como los dos son arroces el producto que se aplique debería ser selectivo para no afectar el bueno, pero lo aplicado mató a los dos.” (El énfasis no corresponde al original). Tal y como se desprende del anterior testimonio, la causa de la quema y destrucción de los cultivos de los actores, fue la aplicación del Herness, aplicación realizada por la venta y asesoría de la demandada. La plaga de arroz rojo tendría, por sí solo, efectos segregantes, no de quema como la presentada en los arrozales de los actores.

El remedio (Herness) salió peor que la enfermedad (arroz rojo); ya que dicho producto no se encontraba autorizado en nuestro país para el cultivo de arroz (contraviniendo lo estipulado en los artículos 23 y 24 de la Ley de Protección Fitosanitaria y numerales 92, 93, 95 y 101 de su Reglamento), por lo que el “experimento” sugerido y aconsejado por la demandada tuvo nefastos resultados para el arrozal de los Araya, tal y como lo relató el testigo [Nombre8] a folio 369: “El producto se aplicó con conocimiento de empleados de Agrosuperior, porque ellos estuvieron pendientes de la aplicación y evolución del cultivo.” Lo dicho por el anterior testigo merece la credibilidad de parte de este Tribunal, no sólo por ser agrónomo y vecino de la zona, sino también por la atención que le dio a la aplicación del producto por lo novedoso de su aplicación. La segunda causal eximiente de responsabilidad invocada por la demandada tampoco es de recibo en este caso: la culpa de la víctima.

Tanto lo relatado por el testigo [Nombre8] , como del testimonio de [Nombre10] así lo establecen. Este último relató que el Herness fue aplicado por [Nombre11] . Incluso dice que vio vehículos de Agrosuperior en las fincas al momento de la aplicación (folio 373). El señor [Nombre11] también lo ratifica en su declaración a folio 376 vuelto e indica que la aplicación y la mezcla se realizó con la dosis indicada por la sociedad demandada y que incluso llegó [Nombre12] , empleado de la demandada a supervisar. Estos testigos merecen credibilidad a este Tribunal, por conocer del cultivo de arroz y ser testigos presenciales. Todo lo contrario ocurre con el testimonio de [Nombre12] , ingeniero agrícola, encargado de ventas de la demandada y quien le vendió el Herness a los actores, quien, desconociendo de las obligaciones que tiene por orden legal niega abiertamente haberles siquiera preguntado a los actores para qué querían el Herness aduciendo que “yo en ventas no tenía la obligación de preguntar en qué se va a aplicar el producto ni tampoco la tengo incluso ahora” (folio 371).- Resulta inaudito tal afirmación de parte del testigo.

La lógica y experiencia nos dice que, verbigracia, si uno acude a un médico, el paciente debe explicarle el mal que le aflige a fin de que el profesional le haga un diagnóstico y le brinde una “receta”. Igual sucede con los agroquímicos: el agricultor le expone el problema y el vendedor, que se supone tiene experiencia y conocimiento pleno de todo el “staff” de productos disponibles, le aconseja utilizar determinado producto. Aquí es donde radica la responsabilidad objetiva tan negada por la parte demandada, quien ha incurrido en responsabilidad por tener a un empleado como el testigo vendiendo sin ningún criterio y sin dar un adecuado asesoramiento e información a los clientes, productos altamente peligrosos como lo son plaguicidas. Cabe preguntarse: ¿qué pasaría si lo que se vende no son pesticidas sino pólvora?... El decreto 27034- MAG del 5 de enero de 1998 impone obligaciones a empresas como la demandada de comprobar que el personal de ventas -como el mencionado testigo- haya recibido capacitación para expendedores y personal de ventas.

Esta norma tiene toda lógica, por lo delicado que es el manejo y aplicación de estos productos. En toda empresa, se capacita el personal acerca de los productos que se venden. Hasta para vender enciclopedias los vendedores se capacitan para asesorar y vender adecuadamente el producto. El testigo [Nombre12] no merece ninguna credibilidad, pues siendo ingeniero agrícola, de su dicho puede concluirse: 1.- Que efectivamente no recibió ninguna capacitación (y por ello considera que no era su obligación siquiera preguntar para qué era el Herness) ó, 2.- Que está faltando a la verdad para disimular su desidia a la hora de vender el producto. Desde el punto de vista de la responsabilidad objetiva e incluso la subjetiva la empresa demandada es responsable de la venta y aplicación de dicho producto sin observancia de la legislación que regula este tipo de actividad. Por ello, no ocurrió culpa de la víctima, ya que los actores se sometieron a las instrucciones y diagnóstico de la demandada, por lo que, siendo el hecho generador del daño la aplicación de dicho producto, no autorizado para arroz en nuestro país, y siendo el agente generador del daño la compañía demandada a través del señor [Nombre12], es que se configura en este caso, tal y como lo tuvo acreditado el ad quo, que la demandada es responsable de los daños y perjuicios ocasionados a los cultivos de arroz de los actores.

De acuerdo a lo anterior, debe tenerse entonces como cierto que los daños ocasionados a la siembra del arroz se debieron a la aplicación del producto Herness efectuada en el fundo por acuerdo de la parte actora con la misma compañía AgroSuperior, quien bajo sus instrucciones, fue que se aplicó el plaguicida. Todo lo anterior para concluir que la causa como hecho generador del daño en este proceso es la aplicación del Herness en noventa hectáreas de arroz realizada por los actores bajo instrucciones de los demandados en su fundo, la cual conllevó una daño en la siembra de arroz de los coactores. Y no por fuerza mayor o culpa de la víctima, lo cual de forma alguna se demostró, sino por la existencia del comportamiento de la demandada sobre la producción del daño causado. Se da el nexo causal por lo que existe culpabilidad imputable al demandado según se ha tenido por demostrado. Se rechaza el cuarto y último agravio de la demandada.-

IX. SOBRE EL RECURSO DE APELACIÓN INTERPUESTO POR LA ACTORA

Los agravios de la parte actora se centran básicamente en el no reconocimiento de la pérdida de lo invertido en 55 hectáreas de arroz por la segunda siembra del año 2002. En primer lugar, se ha admitido como prueba para mejor resolver el currículum vitae de [Nombre5] y las últimas tres publicaciones del Diario Oficial La Gaceta sobre las designaciones del grupo de peritos para el Poder Judicial, donde figura el mencionado perito. Sin embargo, las razones que tuvo la ad quo para no darle crédito al peritaje privado rendido por dicho experto son compartidas por este Tribunal. Nadie pone en duda la capacidad profesional de dicho señor, sus atestados hablan por sí solos. Igual sucede con el peritaje vertido por el ingeniero [Nombre13] . No obstante, ambas experticias parten de premisas brindadas por los actores y siendo un peritaje privado, no tiene ningún valor probatorio ya que dicha prueba se desarrolló, al ser de carácter privado, sin las garantías del contradictorio y del derecho de defensa que se encuentran insertadas en el procedimiento probatorio de la pericial, contenido en los artículos 401 al 408 del Código Procesal Civil.

La doctrina procesalista ha desarrollado el procedimiento pericial a la luz de las garantías constitucionales, en el sentido de que "la prueba pericial ha de ser practicada con absoluto respeto de las garantías legales y constitucionales que la disciplinan para poder ser considerada sin tacha alguna susceptible de enervar la presunción de inocencia. Si dichas garantías no son respetadas, la prueba pericial podrá carecer de validez y no podrá ser tenida en cuenta a la hora de que el órgano jurisdiccional de que se trate forme su convicción. Ello no quiere decir más, que cualquier infracción de las normas legales de procedimiento establecidas para su práctica correcta presuponga como efecto directo la invalidez de la prueba pericial a los efectos de destruir la presunción de inocencia." CAJAL ALONSO (Javier). Análisis Jurisprudencial de la Prueba Pericial, en: Prueba Documental y Pericial, Bogotá, Editorial Jurídica Bolivariana, Primera Edición, 2002, p. 524.- Este Tribunal en forma reiterada ha restado valor probatorio al peritaje privado, por carecer de un procedimiento de ofrecimiento, admisión, producción y evacuación a la luz de la garantía constitucional de la bilateralidad de la audiencia: "Ahora bien, en relación con el documento, cuyo análisis fue omitido en sentencia pese a constituir un informe catastral donde se desprende el traslape de planos, se evidencia del mismo, tratarse de un estudio elaborado con ocasión de una consultoría privada en la que evidentemente no se dio el contradictorio, aunado a ello, si bien ubica el área correspondiente al plano del demandado, no es lo suficientemente explícito para afirmar, el plano madre donde se incluyen varios levantamientos topográficos, corresponda al citado por el actor en la demanda." Tribunal Agrario Voto N° 151 de las 8:00 horas del 28 de febrero del 2002, Voto 168 de las 14:40 horas del 13 de marzo del 2002.- Por ello, no se puede tener por demostrado que la segunda cosecha realizada en las 55 hectáreas con los insumos aportados por la demandada se haya perdido, máxime que el peritaje del señor [Nombre5] es un peritaje matemático, que no acredita la existencia de dicho daño, tal y como lo estimó la ad quo.

Lo que si quedó demostrado es que la demandada hizo una especie de arreglo parcial aportando a los actores los insumos necesarios para resembrar esas 55 hectáreas, por lo que el daño alegado por los actores se encuentra reparado en forma debida, por lo que no se puede estimar que el daño total se haya dado sobre la totalidad de las noventa hectáreas, dado que fueron reparadas 55 de ellas. Lo invertido en la segunda siembra de las 55 hectáreas no hay prueba, tal y como lo estimó la juzgadora de instancia, que se haya perdido, por no acreditarse la pérdida de esa segunda siembra. En todo caso, lo invertido en ella fue aportado por la demandada, lo cual resulta ser un hecho no controvertido y por ende, exento de prueba, de conformidad con el numeral 316 del Código Procesal Civil. Es decir que la inversión perdida en la primera cosecha fue indemnizada por la demandada con la inversión de insumos de la segunda cosecha.

Por ello, el rechazo del rubro pretendido de indemnización de la pérdida todo lo invertido en la preparación y siembra para el primer ciclo de cosecha del 2002 (mano de obra, abonos, plaguicidas, riego, semilla) se encuentra justificado, ya que dicho rubro fue reparado en forma espontánea por la demandada. Por no tener valor probatorio los peritajes privados de los señores [Nombre5] y [Nombre13], se mantiene como hecho indemostrado la estimación realizada por los actores de la inversión de la primera siembra en la suma de 14 millones de colones. Al no ser demostrado dicho daño, tampoco es de recibo el reclamo del perjuicio, que es la supuesta ganancia de la cosecha de arroz sembrado en una suma de siete millones de colones. Por último, cuestiona el hecho de que la ad quo no le diera valor a estos peritajes y sí lo hiciera con el vertido por el ingeniero [Nombre6] , ofrecido por la demandada, cuando nadie lo vio apersonarse al terreno, ni habérsele cuestionado la indemostración de su autenticidad y profesionalidad, máxime que el informe está emitido con papel del SENARA cuando dicho ingeniero trabaja para el MAG, por lo que la acreditación hecha por la ad quo a la indemnización parcial sobre la segunda siembra en las 55 hectáreas no tiene fundamento probatorio (folios 594 a 630).- Tampoco lleva razón la recurrente en este aspecto.

Nótese que a folios 388 a 389 se encuentra el informe vertido por el ingeniero [Nombre14] , Director de la Dirección Regional Chorotega del MAG en la cual, ante consultas de la propia ad quo, da fe que el ingeniero [Nombre6] se encontraba destacado en la Agencia de Servicios Agropecuarios de Bagaces como funcionario activo del MAG. También explica que la utilización de recetarios o boletas de visitas técnicas como la admitida en autos a folio 234, realizada por dicho profesional el día 21 de junio del 2002, son uso común tanto para funcionarios del MAG, como del SENARA, el CNP, el IDA o el PIMA, por lo que los agravios vertidos por la actora resultan reiterados, ya que sus cuestionamientos tuvieron respuesta de en dicho informe, gestionado por la ad quo, quien, en forma diligente, se preocupó por verificar la veracidad de dichos recetarios. En consecuencia, en lo apelado, se ha de confirmar la resolución venida en alzada.

POR TANTO:

Se admite como prueba para mejor resolver la prueba documental ofrecida por la parte actora, tanto el currículum vitae del señor [Nombre5] , como las copias certificadas de las tres últimas publicaciones de los nombramientos de peritos oficiales de la Corte. El resto de prueba ofrecida se rechaza. En lo apelado, se confirma la resolución venida en alzada.
