VOTO Nº 0224-F-07 VOTO Nº 0224-F-07 AGRICULTURAL TRIBUNAL OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at sixteen hours thirty minutes on the fourteenth of March of two thousand seven.
Ordinary proceedings (proceso ordinario) filed by [Nombre1], of legal age, married, farmer, resident of La Tigra de San Carlos, national identity card (cédula de identidad) number CED1 — against INVERSIONES LA MANGUERA SOCIEDAD ANÓNIMA, corporate registration number (cédula jurídica) CED2 —; represented by [Nombre2], of legal age, married, Business Administrator, resident of Curridabat, national identity card number CED3 —; in his capacity as President with powers of General Attorney-in-Fact (Apoderado Generalísimo) without limit of amount. Processed before the Agricultural Court (Juzgado Agrario) of the Second Judicial Circuit of Alajuela. Acting as Special Judicial Attorney for the plaintiff is Licenciado Ricaute Jiménez Araya, of legal age, single, Attorney-at-Law, resident of San Ramón de Alajuela, national identity card number CED4 —; and for the defendant company, Licenciado Gino Capella Molina, of legal age, married, Attorney-at-Law, resident of Moravia, national identity card number CED5 —.
BACKGROUND:
The opinion is authored by Judge Vargas Vásquez; and, ANALYSIS:
I.The plaintiff offered in this instance, as evidence for better adjudication, an expert report (informe pericial) and requested that a judicial site inspection (reconocimiento judicial) be conducted at the location where the conflict arose. Said evidence was admitted for better adjudication, with the expert examination and its supplement appearing at folios 556 and 579, and the judicial site inspection record at folio 548.
II.The Tribunal concurs with the findings of fact numbered one through twelve, fourteen through seventeen, and twenty-two, as they are consistent with the evidentiary record (probanzas) contained in the case file (autos); it does not concur with findings of fact thirteen and eighteen through twenty-one, as they are not supported by the evidentiary record in the case file. The following is accordingly added: 23.) That on the property registered in the name of the plaintiff in the Public Property Registry, Alajuela Partition, under folio real four hundred two thousand two hundred fifty-four-zero zero zero, sediments were deposited originating from the canal in which the pressure pipeline of the hydroelectric project was constructed and where [Dirección1] existing on said property were located (expert report at folio 556 and supplement thereto at folio 579, judicial site inspection records at folios 308 and 548, and testimonial statements of [Nombre3], [Nombre4], [Nombre5], [Nombre6], [Nombre7], and [Nombre8] at folios 287 to 296 and 327 to 331).
III.The findings of fact deemed unproven numbered two, four, and eight are not adopted, as there is evidence in the proceedings to the contrary; likewise the first unproven finding, insofar as it refers to the existence on the plaintiff's landholding (fundo) of ornamental plants and green areas prior to the construction phase of the La Esperanza Hydroelectric Project. The Tribunal concurs with the latter finding in all other respects, as well as with the remaining findings, there being no evidence to support them. The following is accordingly added: 9.) The plaintiff did not demonstrate an increase in ambient noise on the landholding following the construction of the hydroelectric project. 10.) The plaintiff did not demonstrate the area where the ornamental plants and pastures had been planted, nor the species of the former and the latter, nor their condition at the time the sediment deposits materialized.
IV.Ms. María Isabel Campos Jiménez filed an appeal (recurso de apelación) against the judgment in a brief (libelo) submitted to the court on August 9, 2006 (folio 507). In substance, she raised the following objections:
a.- Regarding the first, she states that it is the road, not the property (inmueble), that has the grade change, since the latter has a natural slope from south to north; the slope is only noticeable along the fence facing the road because the parcel borders the road. She argues that evidence of this is the direction in which the río La Esperanza flows—located along the eastern boundary (lindero) of the property—which runs from south to north, as does part of the stream (riachuelo) at issue in this claim. She states that the stream used to run through her property parallel to the river, up to the point where it was diverted—that is, obstructed by the mound of earth placed across it during the construction of the powerhouse (casa de máquinas)—and by the trench that the defendant dug on her land without her authorization in order to channel the waters and drain part of the southern side of the defendant company's property, where it built an access point to the river for heavy machinery.
Additionally, she states, the judge had yet to gather evidence, such as the notable brown discoloration covering the grass and other vegetation in one of the ponds—a color resulting from dirty water mixed with soil—whereby, as the water level drops, part of the sediment impregnates the vegetation that was submerged when the level rose. She states that the water level rose due to the large volume of water collected across the full width and length of the channel or gorge where the pressure pipeline (tubería de presión) is located, with its tall retaining walls (paredones). She cites in support of this the judicial inspection record drawn up by the court, the addendum thereto, and the recommendation of the representative of the Defensoría de Los Habitantes. She considers it would have been appropriate for the judge to inquire into the cause of the gullies (cárcavas) and the soil or sediment mentioned, as well as the similar coloration of the vegetation in the pond compared to the soil of the retaining wall.
She states that the answer is obvious given the evidence and traces of sediment transport observed in the ponds during the inspection—the sole discharge point for all runoff flowing through the channel—which led the Municipalidad to request that the defendant relocate the water disposal described, specifically a short stretch of drainage ditch (cuneta) said to be municipal but which was in fact built by the Constructora del Proyecto Hidroeléctrico to carry water from the pressure pipeline channel to the old water-cutoff culverts (alcantarillas) that crossed the road, whose waters, she states, discharge onto her property. She adds that the old culverts previously only collected a small amount of water from the edge of the road, which was clean because it was a paved road. She cites in support of this the testimony of [Nombre5], who stated: "... water has always flowed through the culvert and when the project began it was already mud" (folio 305).
She states that initially this water was of low volume, so managing it within her property was simple. On this point, she questions why the company, instead of discharging these sediment-laden waters onto her property, does not discharge them onto its own, answering this question with the categorical assertion that it does so because otherwise the powerhouse located at the lower end—where the channel and the pressure pipeline terminate—would be affected. On this point, she cites the testimony of the defendant's witnesses, including that of [Nombre7], who said: "The gabion (gavión) was built to hold back the earth ... because they carved them out ..." (folio 338); which, she states, was evident because at the point where the pressure pipeline passes under the road it formed a blockage in the channel, and everything coming through the channel discharged onto the road. For that reason, the appellant concludes, they placed gabions to form a retaining wall by adding soil at the blockage point, draining the muddy water that accumulated inside the channel through a culvert that empties into the drainage ditch they constructed, which ends on her property, where everything coming from the pressure pipeline channel is discharged.
She cites on this point the testimony of [Nombre7], who stated: "... The mud in that pond comes from above where they excavated, as it is collected up there and thrown into the drainage ditch and then reaches the plaintiff's pasture land ... it passes under the road where culverts exist ..." (folio 338), clarifying that when the witness refers to "above" it is in reference to the pressure pipeline channel, which descends with a steep grade.
In light of the foregoing, the appellant states that the judgment failed to treat the following facts as proven, despite their having been demonstrated in her view: The improper relocation of the powerhouse, forebay, and pressure pipeline without authorization from the Municipalidad de San Carlos; that the relocations affected her property by changing the discharge point, causing the river flow between the intake site and the discharge point to diminish—a stretch in which her property is located; the obstruction of the free flow of the springs on her property; the channeling of rainwater with sediment that discharges onto the property in dispute; the risk of flooding of the disputed property in the event of a rupture of the reservoir (embase), since the waters could descend through the pressure pipeline channel, which she states is directed toward the property in dispute; and, that in connection with the construction of the Proyecto Hidroeléctrico La Esperanza, materials were dumped into the river, affecting its natural channel.
"Due to the construction of the aforementioned powerhouse (casa de máquinas), the topography of the property (finca) on which it now stands was altered — specifically, a fill (relleno) was placed that obstructs the natural watercourse (cauce) and free flow of a tributary stream (riachuelo) ..." (folio 64). Furthermore, the appellant notes that during the judicial site inspection (reconocimiento judicial) it was recorded that "... At first glance, one can see that the powerhouse is situated practically at river level, from which it is separated only by a ridge ..."; and that this ridge is precisely the retaining wall (paredón) referred to, which was installed facing the river and the appellant's property in order to prevent the powerhouse from flooding. The appellant also disagrees with the assertion made in the ruling (fallo) to the effect that witness [Nombre3] did not refer to the obstruction of the stream by the retaining wall, since [Nombre3] stated: "... that water used to flow freely before, and when the powerhouse was built they constructed a fill between the powerhouse and our property, so the water no longer has an outlet; and until a few months ago the water would move from our property toward the powerhouse property for a few meters, and from there to the river ..." (folio 288).
The appellant also cites the testimony of [Nombre5], who stated: "...When I first knew that property there were two springs and the water flowed down through the property where the powerhouse now stands." (folio 305). The appellant likewise disagrees with the statement in the judgment (sentencia) to the effect that [Nombre7] limited his testimony on this subject, arguing that [Nombre7] declared: "... The pasture I am referring to had a guava grove (guayabal) that extended to where the powerhouse stands today. In that guava grove there was a spring (naciente) that passed through where the powerhouse stands today; that spring was altered because a canal was built and the spring was diverted when the canal was built, and now it empties into the river. The spring no longer follows its original course, since when the canal was built it was diverted. The lower part of the land used to be flat and today it is not the same; I do not know whether soil was dumped there, but I do know it is no longer the same.
With the project in place, they surely filled it in and the water was diverted." (folio 338). The appellant contends that this evidence demonstrates the environmental damage caused by the defendant, and that it is insufficient for the defendant to have subsequently obtained authorization from SETENA, since that body lacks the authority to exempt parties from liability — particularly where no Municipal permit was obtained to change the location of the powerhouse and the pressure pipeline (tubería de presión). Likewise, regarding the alleged authorization to obstruct the course of the stream, advanced under the argument that Article 95 of the Ley de Aguas applies, the appellant submits that the judgment errs because that authorization relates to embankments (malecones) or walls that do not block the watercourse and serve only to regulate it, which is not the situation under examination, since the obstruction is total; moreover, the construction of the powerhouse violates Article 33 of the Ley Forestal by encroaching upon the protection zone (zona de protección) of the watercourse.
The appellant also notes that the survey map indicates that the land had pasture areas (repastos), and that the appellant subsequently decided to develop it with two tilapia ponds, ornamental plantings, clearing (chapia) of green areas, and further improvements aimed at developing a tourism project that was never realized due to the damages described. The appellant states that [Nombre5] was asked to clear the parcel in order to prepare it for ornamental plant cultivation, as [Nombre5] himself testified; and that [Nombre7] made reference to a guava grove, sugarcane (caña), pasture, and subsequently to ornamental plants that resembled a garden. The appellant adds that the intention was not to open a bar or restaurant, but rather to create a destination for enjoying ornamental plants, tilapia fishing, and river swimming. On this point, the appellant disputes the testimony of [Nombre4], noting that [Nombre4] worked for the defendant and stated that he did not recall seeing springs, despite the springs having been duly established in evidence.
The appellant states that those materials, together with some trees, were deposited in the protection zone and watercourse of the river — all in plain sight of SETENA officials, who were unable to prevent it and also failed to report it to the Ministerio Público, to the point that an environmental compliance officer (regente ambiental) resigned; the appellant therefore considers that body to deserve little credibility. The appellant further states that the judgment failed to analyze key evidence, namely the gullies (cárcavas) and soil deposits found on top of the canal in which the pressure pipeline is laid — noting that gullies are formed by the action of water running downhill, so that, given that the appellant's property lies at a lower elevation, it is impossible to suppose that the soil originating from those gullies did not reach that property, particularly given that the damages in question occurred over the last seven years, during the heavy rainy seasons (inviernos) characteristic of the northern zone, with a short dry season (verano) of four months.
The appellant states that SETENA, in Resolution 41-99 of 11:30 a.m. on October 4, 1999, and Resolution 454-2000 of 9:20 a.m. on May 30, 2000, ordered the lifting of the work-suspension order issued against the said project on the grounds that it was not causing significant environmental damage, despite the fact that the environmental damage to the river and the ecosystem has been demonstrated. The appellant objects to the application of Article 94 of the Ley de Aguas, arguing that that provision presupposes the absence of human intervention, a circumstance not present in this case; the appellant also objects to the assessment made of the testimony of [Nombre5], arguing that [Nombre5] cleared and cleaned mud from the property when the project commenced because what had previously fallen was water — given that even during river flood surges (llenas), rather than leaving mud behind, the river ends up forcing its way through and leaves the flooded area stripped of vegetation, or leaves large mounds of timber, especially where there are ponds — a situation that was not observed during the judicial site inspection.
On this point, the appellant refers to Article 109 of the Ley de Biodiversidad, which places on the defendant the burden of demonstrating the absence of environmental damage. The appellant asks the Court to bear in mind that, because there is an intake (toma) upstream, the flow rate has decreased and the drag of materials occurs primarily during flood events (crecidas) — and this would occur from the intake downstream, since materials upstream do not pass through due to the presence of the intake, which forms a large reservoir that captures all material arriving at it. In this regard, the appellant states that witness [Nombre5] is correct in asserting that the material came down during the major flood surge last year, since without major flood surges the material would not be dragged, inasmuch as the intake itself is a deposit of materials and, at the same time, diverts 90% of the average annual flow to the reservoirs.
Regarding the seven meters lost from the plaintiff's property, the appellant questions how these could not have been lost, and immediately responds that it is obvious: as a result of the material dumped into the river, the riverbed (lecho) gradually fills in downstream over time through drag, causing the river's watercourse, rather than deepening, to spread outward toward its banks. Similarly, regarding the claim concerning the flow rate, the appellant states this is not a matter of less than the 10% that must remain after the intake being left, but rather that when the water concession (concesión de agua) was authorized — that is, for the remaining 90% — that water was to be returned to the natural channel through the powerhouse discharge, so that the flow returns to the river beyond the authorized stretch.
V.The claimant party (parte accionante), in the appeal brief (libelo de apelación), broadly sets forth the grounds on which it considers the judgment (sentencia) to be incorrect. In essence, it alleges that sufficient evidence exists in the proceedings to demonstrate the causal link (nexo de causalidad) between the damages it claims were caused to its property and the works carried out in connection with the construction of the Proyecto Hidroeléctrico developed by the defendant. With respect to the latter, it alleges that a series of irregularities occurred, some of which came to light when SETENA ordered the suspension of the project; although that suspension was later lifted on the grounds that no significant environmental damages would result, such damages did in fact occur on the claimant's farm. It is for these damages, including consequential losses, that the claimant seeks compensation.
In support of the claimant's allegations, there is a substantial body of evidence in the proceedings, which will be comprehensively analyzed in accordance with the guidelines established by Article 54 of the Ley de Jurisdicción Agraria, pursuant to which the agrarian judge shall weigh the evidence in good conscience without strict adherence to the rules of common law, always citing the principles of law and equity on which its decision is based. Nevertheless, it must be noted that, in these proceedings, the evidence offered by the appellant (recurrente) was admitted as evidence to better inform the court's resolution, consisting of an expert report (experticia) and a judicial site inspection (reconocimiento judicial) conducted by the Tribunal at the disputed location. The first piece of evidence referenced is complemented by the results of the second, insofar as the causal link between the condition of the plaintiff's property (fundo) following the construction of the Proyecto Hidroeléctrico La Esperanza has been verified.
Expert evidence (prueba pericial) is fundamental in this case as it constitutes technical evidence, being of special relevance in determining the environmental damage caused, in this instance, to the claimant's farm. Engineer Gerardo Hidalgo Vega was able to verify, through a site visit conducted in the company of some members of this Tribunal, a series of facts that led him to the following technical conclusions: "... The land to which this ordinary proceeding refers does, in fact, exhibit sedimentation (sedimentación) caused by the erosion and transport of said land by the drainage (desague) of the channel (canal) through which the pressure pipeline (tubería de presión) that carries water to feed the hydroelectric plant La Esperanza was constructed ..." (folio 556). This statement is supported by the record of the judicial site inspection drawn up by this Tribunal upon its visit to the site (folio 548), the photographs submitted as evidence by the plaintiff visible at folios 5 to 10 and 16 to 20, as well as the record of the judicial site inspection prepared by the trial court (Juzgado de origen) after receiving evidence at the site, since, even though for the a quo no causal link exists, said record does reveal the presence of such sediments.
To further corroborate the foregoing, the expert added: "... said drainage carries water and sediments to a drainage ditch (cuneta) 0.5 meters deep, located along the western edge of the public road, which then crosses the road (approximately 12 meters) through culverts (alcantarillas) 12 inches in diameter, discharging directly onto the plaintiff's property along the western boundary with a drop of 12 meters ..." (folio 556). Regarding the foregoing, it must be noted what was stated in the record of the judicial site inspection drawn up at this Court, namely that the water and sediments cross the street and flow directly onto the plaintiff's farm, rather than continuing with the possibility of falling directly onto the defendant's property. Likewise, in support of the foregoing, the expert stated: "... it is important to mention that it was clearly possible to observe that the sediments accumulated on the plaintiff's property coincide with those transported by the drainage, as it was possible to observe the difference in accumulated layers on the property, as well as the small landslides (deslizamientos) and erosion processes (procesos erosivos) visible along the channel carrying the pressure pipeline." (folio 557).
Having thus established the picture regarding the causal link between the damages caused to the plaintiff's property and the work carried out by the defendant company in connection with the construction of the hydroelectric project, it is necessary to determine whether the damages and losses (daños y perjuicios) specifically claimed by Ms. Campos Jiménez were in fact produced. In the complaint, under the heading of damages and losses, she stated: "...They consist of the deterioration of the property and the risk of flooding with its consequent damages due to the eventual flood surge (avalancha) from the reservoirs (embalses), rendering it unusable for the establishment thereon of an intended tourism project or any other construction, with the consequent loss of economic value. With respect to the deterioration of the property and the risk of flooding indicated, as well as its consequent loss of economic value, I conservatively estimate it at twenty million colones." (folios 72 and 73).
First, with regard to "... the deterioration of the property ...", it must be noted that the expert stated in his report: "... Within the property, three excavations are affected, with the following dimensions: the first 33 x 50 meters, the second 15.2 x 32 meters, and the last 23 x 29.7 meters, all of them affected by the accumulation of sediment originating from the channel where the pressure pipeline of the hydroelectric project was constructed, and located at [Dirección1] ..." (folios 556 and 557). This confirms that, as the appellant indicates, there were indeed three excavations on the property, which according to her were intended for the development of a tilapia farming operation. The expert analyzed the condition of each of those excavations in order to reach specific conclusions regarding the cost of restoring them to their original state, as follows: "...Excavation 1: Dimensions: 33 x 50 x 2.5 meters.
Accumulated volume of sediments: 4125 cubic meters. Excavation 2: Dimensions: 15:20 x 32 x 1.5 meters. Accumulated volume of sediments: 729.6 cubic meters. Excavation 3: Dimensions: 23 x 29 x 2.5 meters. Accumulated volume of sediments: 1667.5 cubic meters. Total accumulated material: 6522.1 cubic meters ..." (folio 558). In this manner, the quantity of sediments deposited on the plaintiff's property, essentially in the excavations referred to above, is considered proven, such that if what is claimed as damage is the deterioration of the property, the way to restore the situation for the plaintiff so that her property returns to its original state is by paying her the value thereof. The latter was estimated by the expert at the sum of 22.509.462,84 colones, at a rate of 3451,26 colones per square meter, setting forth in the document the method used to conclude that this is the value corresponding to that item, which is considered to be reasonable.
Another aspect to consider under the damage category of "... deterioration of the property ..." is the restoration of the property's original condition with respect to the ornamental plants existing thereon. Such plants, as well as the existence of pastures (repastos), were proven by the submission of photographs and even by the results of the first judicial site inspection on record; however, the Tribunal considers that, since the plaintiff, who bore the burden of proof on this point, failed to submit evidence regarding the planted area of such plants or their quantity — such as purchase receipts from a local nursery, among other things — this item must be rejected. Indeed, the expert states in his report: "... With respect to the replacement of plants, a provision of 400,000.00 (four hundred thousand colones with 00/100) is estimated, based on a survey of landscaping companies in the area and the metropolitan region ..." (folio 558); however, the expert report omits any reference to the area where the plants may have been planted, the species thereof for the purpose of determining their value — given that not all plants are priced equally — the potential for recovery of those still existing on the property, among other things, all of which are essential considerations for granting recognition of this item to the claimant, who, it is reiterated, likewise offered no evidence allowing these aspects to be determined.
Second, in accordance with the claims set forth in the complaint, Ms. [Nombre1] sought recognition of: "... the risk of flooding with its consequent damages due to the eventual flood surge from the reservoirs, rendering it unusable for the establishment thereon of an intended tourism project or any other construction, with the consequent loss of economic value." (folio 68). Such risk was analyzed by the expert, who stated: "... to divert the stream (caño) toward the channel of the Río La Esperanza (this being the most appropriate option given the terrain conditions and the structures present on the public road and on the properties involved), it is necessary to continue the construction of the drainage ditch, which, according to the Manuel [sic] de Valores Unitarios por Topología Constructiva of the Organo de Normalización Técnica of the Ministerio de Hacienda, establishes a value of 4000.00 per square meter, and an approximate length of 200 meters is calculated for this work, such that the cost thereof would be 800,000.00 (eight hundred thousand colones with 00/100)..." (folios 558 and 559).
The Tribunal considers that, given the existence of the hydroelectric project and its operation for many more years to come, the most accessible means of eliminating the risk that a possible flooding due to an eventual flood surge from the reservoirs could cause to the plaintiff's property, regardless of the use to which she wishes to put her property, is through the diversion of the stream toward the Río La Esperanza. For this reason, the expert's proposal and the estimate he provided for the work to be carried out are considered appropriate, given that he cited the method used for the respective valuation. Accordingly, the Tribunal considers that compensation to the claimant for damages in the amount of 22.509.462,84 colones plus 800,000.00 colones, for a total of 23.309.462,84 colones, must be approved, an amount that exceeds the expectations the claimant set forth for damages and losses in the complaint.
Nevertheless, it is important to revisit the claimant's demands, since, in addition to the damages and losses cited, she requested that it be declared: "... 2. That the defendant be ordered to restore the property to its previous state (estada [sic]), that is, to its condition prior to the construction of the channel where the pressure pipeline and the aforementioned powerhouse (casa de máquinas) are currently located.
extracting the sediment (sedimento) accumulated on my property, without increasing the harm already caused to it by the works carried out by the defendant; correcting the inflow of water and sediment flowing through the penstock (tubería de presión) channel that reaches the property at issue in this claim; likewise restoring the free flow of the tributary (riachuelo) previously referred to; eliminating the constant noise coming from the said powerhouse (casa de máquinas) as heard from my [sic] property; eliminating the danger posed by the existence of the high-pressure penstock located above the property at issue in this claim; as well as the risk of water flow in the event of a sudden rupture of the reservoirs (embalses), as indicated by the defendant itself in documents submitted as evidence by me...." These claims are encompassed within the headings cited above through which compensation is sought for the plaintiff; however, there are some upon which a ruling must be issued, as they fall outside the scope of what was cited above.
First, the defendant is requested to be ordered to "... restore the free flow of the tributary (riachuelo) ..."; however, there is no technical evidence that would allow the Court to conclude that the construction works of the hydroelectric project caused that tributary to be affected by a reduction in water flow (caudal), and furthermore, even if that point had been established, there is no report indicating the percentage of reduction, a figure that the appellant has cited without supporting evidence. On the contrary, the document titled "Reporte de Ajuste dentro del marco del Sistema de Gestión Ambiental" stated: "... Two aspects must be highlighted within this process. First, as can be observed at the discharge point, the Río La Esperanza carries a significant flow prior to the water distribution point of the Project. The reason for this lies in the fact that, in addition to the minimum required flow or ecological flow (caudal ecológico), along the course of the river after the PHE intake, it is fed by a series of streams (quebradas) and minor watercourses that prevent its total flow from being appreciably affected ..." (folio 209). It is therefore considered that the defendant party succeeded in establishing in these proceedings that the water flows have not been appreciably affected.
Likewise, regarding the request that the defendant be required to "... eliminate the constant noise coming from the said powerhouse [sic] as heard from my [sic] property ...," there is no technical evidence whatsoever to support this Court in concluding that noise pollution (contaminación sónica) is present in excess of the permitted limits. On the contrary, the technical studies contained in the case file regarding the environmental effects of the hydroelectric project's construction indicate that noise pollution is not significant. Likewise, the expert appointed by this Court to assess that matter stated: "... it is not possible for this expert to measure the impact of the noise from the hydroelectric project's powerhouse on the plaintiff's property ..." (folio 559). In this regard, it is important to clarify to the appellant that in order for a given noise to be considered noise pollution of a degree that would entail, among other remedies, compensation, it must involve significant noise levels and not merely a "... nuisance that did not previously exist, as bothersome as the faint buzzing of a mosquito." (folio 531), as stated in the appeal. For that reason, that claim must be rejected.
Regarding the foregoing, and more generally, with respect to the arguments raised by the appellant concerning how the burden of proof (carga de la prueba) must be allocated in this case given its nature, it must be noted that Article 109 of the Ley de Biodiversidad provides: "The burden of proving the absence of contamination, degradation, or non-permitted impacts shall fall upon whoever requests approval, a permit, or access to biodiversity, or upon whoever is accused of having caused environmental harm." Likewise, Article 98 of the Ley Orgánica del Ambiente provides: "Environmental harm or contamination may result from acts of commission or omission and is attributable to all natural or legal persons who engage in such conduct." In this case, there is evidence of the harm and losses (perjuicios) produced, in the terms described; however, with respect to noise pollution, the case file contains the "Reporte de Ajuste dentro del marco del Sistema de Gestión Ambiental," in which "Noise and Vibrations (RYV)" was identified as an environmental aspect produced and directly related to the process as a consequence of the potential contamination that might occur; the "Effects of noise and vibrations from energy generation [sic]" was rated as a negative [sic] impact of "Low" category, while the "Production of noise and vibrations at the dam," "Production of noise and vibrations at the Tubería de Presión," "Production of noise and vibrations from Energy Transmission," and "Production of noise and vibrations from maintenance works" were all rated as "Very Low" (folio 220), with no mention of the application of "corrective measures," and noting that the impact is of little significance.
In light of the foregoing, the Court considers that the defendant company did indeed address the need to establish that the noise pollution in this case is not significant, further reinforced by the fact that the expert report (pericial) submitted at this instance does not contribute new elements that would warrant changing that assessment.
Finally, with respect to the testimony of Otto Méndez Vargas, Rafael Angel Montero Campos, Juan Francisco Ocampo Ocampo, Mauricio López Cedeño, Gerardo Alvarado Ledezma, and Fernando Alonso Castro Esquivel, the Court concludes that said testimony, without exception, serves — together with the remainder of the evidentiary record — to support the conclusion that a causal link (nexo de causalidad) exists between the harm claimed by the plaintiff, as recognized by this Court, and the construction and commissioning of the works by the defendant. The sworn statement (confesional) of Ms. Campos Jiménez yields no relevant information to be used against her. As for the remaining documentary evidence, it is worth noting that the case file contains reports establishing that the plaintiff made no applications to the competent authorities to develop a tourism project (folios 261, 275 and 311). Nevertheless, the Court considers that regardless of the productive use the plaintiff intended to make of the land, it is clear that she has been unable to make proper use of it due to the sedimentation problems resulting from the hydroelectric project and the risks this entails.
Therefore, it is considered that she must be recognized as entitled to payment for the losses claimed in the complaint in that regard, which were assessed in the expert assessment (experticia) at three million one hundred sixty-three thousand fifty colones, an amount considered reasonable given the expert's explanation of the methodology used to determine it, stating: "... the technicians of the Ministerio de Agricultura at the Agencia de San Ramón were contacted and interviews were conducted with persons from the area; it is estimated that the average annual cost to rent one hectare of land in the area where the plaintiff's property is located is 300,000.00 (three hundred thousand colones). From the case file it can be inferred that the hydroelectric project has been in existence for ten years and the area of the land in question is 11,715.78 meters or 1.1715 hectares; therefore the annual loss for this property is 351,450.00; this amount multiplied [sic] by nine years of the project's existence yields the economic loss caused to the defendant's [sic] property, that is, 3,163,050.00 (three million one hundred sixty-three thousand fifty colones and 00/1000) ..." (folio 559).
VI.Regarding the actions taken by the plaintiff's (accionante's) husband before various administrative and criminal authorities to seek redress for damages caused on the rural property (fundo) at issue in this case — which belongs to her — these are initiatives extraneous to the matters under review here; they serve only as a frame of reference for establishing how the various events unfolded with respect to the construction permits, the suspension of the works, and the subsequent lifting of that suspension. Furthermore, it must be clarified that whether or not the Municipality of San Carlos authorized the defendant company to modify certain original conditions of the project — such as the location of the powerhouse (casa de máquinas), among others — as well as any deficiencies or lack thereof on the part of SETENA in overseeing compliance with the environmental commitments undertaken by the defendant company and in monitoring the corresponding environmental compliance officer (regente ambiental), are administrative matters extraneous to these proceedings, since no liability has been claimed against those agencies and no claims directly related to such matters have been included.
Likewise, arguments regarding whether or not negotiations took place between the plaintiff and her husband on one side and the defendant company on the other for the purchase of the rural property at issue are of no legal relevance here — a property that, it should be noted, is indeed registered in the name of Ms. [Nombre1], as evidenced by the property registry certification she submitted. For this reason, the exception of lack of standing (excepción de falta de legitimación activa) raised by the defendant company must be denied, as must the exception of lack of legal right (excepción de falta de derecho), to the extent that the causal link (nexo de causalidad), the claimed damage, and the liability of the company arising from the construction of the works have all been established.
VII.For the foregoing reasons, and on the basis of Article 1045 of the Civil Code and the other provisions cited, the judgment must be reversed insofar as it upholds the exception of lack of legal right, fails to rule on the exception of lack of standing, denies recovery of the items set out below, and orders the plaintiff to pay court costs (costas). In its place, the exceptions of lack of standing and lack of legal right are rejected; the defendant is ordered to pay the plaintiff for the damage consisting of the deterioration of her real property registered in the Registro Público de la Propiedad (Public Property Registry), Partido de Alajuela, at property registration folio (folio real) four hundred two thousand two hundred fifty-four-zero zero zero, caused by the levels of sedimentation deposited thereon, originating from the channel in which the pressure pipeline (tubería de presión) of the hydroelectric project developed by the defendant company was constructed, located at [Dirección1] of said property; the estimated cost of restoring the property to its original condition is twenty-two million five hundred nine thousand four hundred sixty-two colones and eighty-four céntimos; as well as the loss consisting of the plaintiff's inability to make adequate use of the land, in the amount of three million one hundred sixty-three thousand fifty colones.
The defendant is ordered to redirect the drainage channel (caño) toward the riverbed of Río La Esperanza, continuing the construction of the drainage ditch (cuneta) for an approximate length of two hundred meters, as indicated in the expert report (informe pericial), and is granted a period of one month from the date this ruling becomes final to do so; with the warning that if it fails to comply in the manner and within the time period specified, the plaintiff will be authorized to carry out the work at the defendant's expense; and if the work is carried out in a manner other than that specified in this judgment, the work performed will be ordered demolished and what has been ordered will be enforced, in which case all expenses and damages and losses resulting from the improper execution shall be borne by the defendant. Court costs are imposed on the defendant company. In all other respects, the judgment is affirmed.
VIII.With respect to court costs, given the manner in which this matter is resolved at this level, the losing party — the defendant — shall be required to pay them, pursuant to Article 55 of the Ley de Jurisdicción Agraria, read in conjunction with Article 221 of the Code of Civil Procedure, applied supplementarily.
Por tanto:
The judgment is reversed solely insofar as it upholds the exception of lack of legal right, fails to rule on the exception of lack of standing, denies recovery of the items set out below, and orders the plaintiff to pay court costs. In its place, the exceptions of lack of standing and lack of legal right are rejected; the defendant is ordered to pay the plaintiff for the damage consisting of the deterioration of her real property registered in the Registro Público de la Propiedad, Partido de Alajuela, at property registration folio four hundred two thousand two hundred fifty-four-zero zero zero, caused by the levels of sedimentation deposited thereon, originating from the channel in which the pressure pipeline of the hydroelectric project developed by the defendant company was constructed, located at [Dirección1] of said property; the estimated cost of restoring the property to its original condition is twenty-two million five hundred nine thousand four hundred sixty-two colones and eighty-four céntimos; as well as the loss consisting of the plaintiff's inability to make adequate use of the land, in the amount of three million one hundred sixty-three thousand fifty colones.
The defendant is ordered to redirect the drainage channel toward the riverbed of [Dirección2], continuing the construction of the drainage ditch for an approximate length of two hundred meters, as indicated in the expert report, and is granted a period of one month from the date this ruling becomes final to do so; with the warning that if it fails to comply in the manner and within the time period specified, the plaintiff will be authorized to carry out the work at the defendant's expense; and if the work is carried out in a manner other than that specified in this judgment, the work performed will be ordered demolished and what has been ordered will be enforced, in which case all expenses and damages and losses resulting from the improper execution shall be borne by the defendant. VOTO Nº 0224-F-07 VOTO Nº 0224-F-07 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las dieciséis horas treinta minutos del catorce de Marzo de dos mil siete.- Proceso Ordinario planteado por [Nombre1] , mayor, casada, agricultora, vecina de la Tigra de San Caros, cédula de identidad número CED1 - - contra INVERSIONES LA MANGUERA SOCIEDAD ANÓNIMA, cédula jurídica número CED2 - - ; representada por [Nombre2] , mayor, casado, Administrador de Empresas, vecino de Curridabat, cédula de identidad número CED3 - - ; en su condición de Presidente con facultades de Apoderado Generalísimo sin límite de suma. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela. Actúa como Apoderado especial Judicial de la parte actora, el licenciado Ricaute Jiménez Araya, mayor, soltero, Abogado, Vecino de San Ramón de Alajuela, cédula de identidad número CED4 - - ; y de la sociedad demandada, el licenciado Gino Capella Molina, mayor, casado, Abogado, vecino de Moravia, cédula de identidad número CED5 - - .-
RESULTANDO:
Redacta la jueza Vargas Vásquez; y,
CONSIDERANDO:
I.La parte actora ofreció en esta instancia como prueba para mejor resolver un informe pericial y pidió se realizara un reconocimiento judicial del sitio donde se generó el conflicto. Dicha prueba fue admitida para mejor resolver, constando la experticia y su ampliación a folios 556 y 579, y el acta de reconocimiento judicial a folio 548.-
II.El Tribunal comparte los hechos tenidos por probados primero a doce, catorce a diecisiete y veintidós, al ser acordes con las probanzas constantes en autos; no así los hechos trece y dieciocho a veintiuno, al no responder a las probanzas constantes en autos. De tal naturaleza se adiciona: 23.) Que en la finca inscrita a nombre de la actora en el Registro Público de la Propiedad, Partido de Alajuela, al folio real cuatrocientos dos mil doscientos cincuenta y cuatro-cero cero cero, se depositaron sedimentos provenientes del canal en donde fue construida la tubería de presión del proyecto hidroeléctrico y ubicadas de [Dirección1] existente en el dicha propiedad (informe pericial de folio 556 y ampliación de éste de folio 579, actas de reconocimiento judicial de folios 308 y 548, y declaraciones testimoniales de [Nombre3] , [Nombre4] , [Nombre5] , [Nombre6] , [Nombre7] y [Nombre8] de folios 287 a 296 y 327 a 331).-
III.No se prohijan los hechos tenidos por indemostrados segundo, cuarto y octavo al existir prueba en el proceso de lo contrario, lo mismo que el hecho improbado primero en cuanto se refiere a la existencia en el fundo de la actora de plantas ornamentales y zonas verdes antes del proceso constructivo del Proyecto Hidroeléctrico La Esperanza. Se comparte este último en lo demás, así como los restantes al no existir prueba que les den fundamento. De tal naturaleza se adiciona: 9.) No demostró la accionante el incremento en el sonido ambiental existente en el fundo luego de la construcción del proyecto hidroeléctrico. 10.) No demostró la actora el área donde tenía sembradas las plantas ornamentales y los pastisales, así como las especies de las primeras y los segundos y el estado de los mismos al momento en que se materializaron los sedimentos.-
IV.La señora María Isabel Campos Jiménez interpuso recurso de apelación contra la sentencia en libelo presentado a estrados el 9 de agosto del 2006 (folio 507). En lo medular, se mostró inconforme por lo siguiente: 1.) Considera que algunos de los hechos que se tienen por probados en el fallo son incorrectos por lo siguiente: a.- En cuanto al primero señala, quien tiene el desnivel es la carretera y no el inmueble, pues éste último tiene un desnivel natural de sur a norte, solo que junto a la cerca frente al camino se recorre con ese desnivel por ser lindante con la carretera. Alega que una prueba de ello es la dirección en que discurre el río La Esperanza, ubicado en el lindero este del inmueble, el cual discurre de sur a norte, e igual dirección tiene parte del riachuelo objeto de este reclamo. Dice, este último discurría por su propiedad en forma paralela al río, hasta el punto de su desvío, sea hasta su obstrucción con el montículo de tierra atravesado sobre éste al construir la casa de máquinas y la zanja que la demandada confeccionó sobre su finca sin su autorización para encausar las aguas con el fin de drenar parte del costado sur de la propiedad de dicha empresa, donde construyó un acceso al río para maquinaria pesada. b.) En relación con el hecho probado doce señala, debió agregarse como prueba la documental de folio 52, 54 y 67, lo cual señala es de gran importancia para la correcta fundamentación del mismo. c.) Sobre el hecho trece indica es incorrecto, pues sólo se fundamenta en lo visto durante el reconocimiento judicial, sin tomar observaciones adicionales, así como otros elementos probatorios.
Alega que cuando el juez indica en el acta que desconoce el origen del sedimento existente en las dos excavaciones y los alrededores de una de las nacientes, lo hace porque está iniciando el recorrido y hasta ese momento para él era desconocido su origen dado que no llovía de manera tal que no existía escorrentía que le permitiera visualizar el ingreso del sedimento. Aduce que si el juzgador hubiera indicado cual era el origen de ese sedimento, ello constituiría una falta de objetividad y un adelanto de criterio sobre ese hecho, el cual en todo caso debía ser demostrado por la demandada dado que al constituir un daño ambiental, la carga de la prueba se invierte conforme lo establece el artículo 109 de la Ley de Biodiversidad. Sumado a ello, indica, al juez le faltaba prueba que recabar, como lo era la importante coloración café que cubría el pasto y demás maleza existente en una de las lagunas, color éste producto del agua sucia mezclada con tierra, que al bajar el nivel, parte del sedimento se impregna en la vegetación por haber sido cubierta cuando aumentó el nivel.
Dice, hubo un aumento de nivel a causa de la gran cantidad de agua que recoge el ancho y largo del canal o cañón al llover, en que se ubica la tubería de presión, con sus altos paredones. Cita como fundamento de esto último el acta de reconocimiento judicial levantada por el Juzgado, la adición de ésta, así como la recomendación del representante de la Defensoría de Los Habitantes. Considera que hubiera sido oportuno se preguntara el juzgador el porqué de las cárcavas y tierra o sedimentos aludidos, así como la similar coloración de la vegetación existente en el lago respecto a la de tierra del paredón. Alude, la respuesta es obvia dadas las evidencias y restos del arrastre de sedimentos que durante el reconocimiento se observó en los lagos, sitio único donde descarga toda la escorrentía que discurre por el canal, a raíz de lo cual la Municipalidad solicitó a la demandada la reubicación del depósito de las aguas en referencia, sea que el pequeño tramo de cuneta que se dice es municipal, pero que realmente es una cuneta que construyó la Constructora del Proyecto Hidroeléctrico para llevar el agua del canal de la tubería de presión hasta las viejas alcantarillas de corte de agua que existían atravesando la carretera cuyas aguas dice, descargan en su finca.
Agrega que las viejas alcantarillas antes solo recogían una pequeña cantidad de agua de la orilla de la carretera, la cual era limpia por tratarse de una carretera asfaltada. Cita como fundamento de esto último la declaración de [Nombre5] , quien indicó que "... por la alcantarilla siempre ha caído agua y cuando se inició el proyecto ya era barro" (folio 305). Esa agua, señala, en un inicio era de poco volumen por lo que el manejo dentro de su finca era sencillo. Sobre esto último se cuestiona el porqué la empresa en lugar de descargas esas aguas sedimentadas en su propiedad no lo hace en la de dicha sociedad, respondiendo tal cuestionamiento con la afirmación categórica de que es así porque de lo contrario se vería afectada la casa de máquinas ubicada en la parte inferior, sea hasta donde llega el canal y la tubería de presión. Sobre esto último cita la declaración de testigos de la demandada, entre ellos la de [Nombre7] quien dijo: "El gavión lo hicieron para atajar la tierra ... porque los tallaron ..." (folio 338); lo cual dice era evidente debido a que al pasar por ese punto la tubería de presión, por debajo de la carretera, ésta formaba un tapón al canal y todo cuanto viniera por el mismo descargaba sobre la calle.
Por esa razón, concluye el recurrente, colocaron gaviones para formar un paredón agregando tierra en el tapón, desaguando el agua con lodo que se acumulaba dentro del canal por medio de una alcantarilla que desemboca en la cuneta construida por ellos y que termina en su finca, donde descarga todo cuanto venga del referido canal de la tubería de presión. Cita sobre esto la declaración de [Nombre7] cuando señala: "... El lodo que tiene ese lago viene de arriba por donde excavaron, ya que se recoge arriba y se tira a la cuneta y luego llega al potrero del terreno de la actora ... pasa por debajo de la carretera donde existen alcantarillas ..." (folio 338), aclarando que cuando el testigo se refiere a "arriba" lo es respecto del canal de la tubería de presión, mismo que baja con gran desnivel. d.) En relación con el hecho probado dieciséis, en el cual se indica que las obras de antecámara, tubería de presión y casa de máquinas del proyecto sufrieron una modificación para aumentar la seguridad y reducir significativamente el impacto ambiental de las obras, está basado solo en el documento de Reporte de Ajuste dentro del marco del Sistema de Gestión Ambiental, el cual considera es ambiguo y no se ajusta a la verdad.
Esto último debido a que la distancia existente entre el río y la casa de máquinas no sobrepasa los 25 metros -mientras que en el docuemento se dice son 100 metros- y no está a una elevación aproximada de 5 metros sino a nivel del río como se señala en el acta de reconocimiento judicial. Así mismo indica, en el Reporte de Ajuste dentro del marco del Sistema de Gestión Ambiental se indica "Potencionalización de amenazas naturales en la Casa de Máquinas por efectos de una inundación ... inundación anómala producida por una crecida del Río la (sic) Esperanza." (folio 229); sobre lo que se cuestiona del porqué ese temor si el cause del río según su dicho está a 100 metros y a una altura de 5 metros, respondiéndose que ello es obvio, debido a que en realidad la casa de máquinas no está a más de 20 metros y a un mismo nivel del río. e.) Cuestiona el recurrente lo indicado en el hecho probado dieciocho, pues dice no es del todo cierto en la medida de que en la ejecución material de la obra no se cumplieron las especificaciones normativas vigentes, siendo prueba de ello la solicitud de suspensión del proyecto por lanzar materiales al río, y la renuncia del regente ambiental. f.) En cuanto al hecho probado diecinueve agrega, el mismo es incorrecto al estar basado solo en un documento probatorio que de por si, como ha venido señalando, es ambiguo.
Señala, de descender por la tubería de presión el agua, cómo podría ésta alcanzar el río sin antes inundar su finca dado que ésta se localiza junto a la casa de máquinas, además de que antes de ella existen el paredón y los gaviones, así como la carretera que obstruyen su libre discurrir. Por lo expuesto, el recurrente señala que en la sentencia se omitió tener por probados los siguientes hechos, pese a haber sido en su criterio demostrados: La indebida reubicación de la casa de máquinas, antecámara y tubería de presión al no haber sido autorizados por la Municipalidad de San Carlos; que con las reubicaciones se afectó su finca al cambiarse el lugar de desfogue generando que el caudal del río existente entre el sitio de la toma y el punto de desfogue disminuyera, tramo en el cual se encuentra su propiedad, la obstrucción del libre discurrir de las nacientes existentes en ésta, la canalización de aguas pluviales con sedimento que descargan en el inmueble en litis, el peligro de inundación sobre el inmueble en litis ante una eventual ruptura del embase pues las aguas podrían descender por el canal de tubería de presión, mismo que dice está en dirección al inmueble en litigio; y, que con motivo de la construcción del Proyecto Hidroeléctrico La Esperanza se lanzaron materiales al río afectando su cauce natural. 2.) En cuanto a los hechos tenidos por indemostrados indica, éstos sí fueron probados, a saber: a.) Sobre el primero dice se demostró lo contrario con las fotografías de folios 5 y 8, con las que se prueba que el fundo tenía "...actitud (sic) turística." (folio 517); b.) El segundo dice es incorrecto porque existen a los lados del canal paredones altos desprovistos de vegetación, los cuales son arrastrados por el agua pluvial hasta la alcantarilla que corta el agua y la pasa por debajo de la vía pública para descargarla en el inmueble en litigio, sin existir recolector de sedimentos entre el sitio donde están las cárcavas, las pequeñas acumulaciones de tierra suelta, sedimentos visibles sobre las terrazas de concreto y la salida de alcantarilla que da su finca e inmediatamente descarga en uno de los lagos y nacientes; c.) El cuarto hecho tenido por indemostrado, dice el recurrente es incorrecto, debido a que fue probado que el alto volumen o cantidad de agua pluvial adicional que recibe su finca llega del sistema de drenaje municipal, dice no existe ningún otro acceso adicional a los pequeños nacientes que no fuese ese drenaje, citando como prueba fotografías de folios 7, 8 y 10, así como folios 54, 67, 288, 307, 319 y 338; d.) En cuanto al quinto, existe prueba a folio 9 que le da fundamento, aparte de eso, conforme al artículo 109 de la Ley de Biodiversidad, la carga de la prueba la tenía la demandada; e.) Sobre el sexto señala, existe prueba consistente en la fotografía inferior de folio 5, e igualmente a folio 245 se indica que posterior a la toma tan solo queda un 10% del caudal promedio anual del río La Esperanza, siendo que de haberse construido la casa de máquinas donde originalmente estaba autorizada, junto a su finca el río discurriría en un 100%; f.) En relación con el octavo indica, lleva razón el juzgador al señalar que su propiedad no recibe aguas provenientes de la tubería de presión o del embalse, pues de ser así, sería probablemente borrado dada la cantidad de metros cúbicos existentes en los mismos, de ahí su fundado temor de que se produzca una ruptura en éstos. 3.- En cuanto a la constitución de los daños, pide se tome en consideración que se obstruyó el cauce natural que mantenía un riachuelo del río La Esperanza.
Objeta la sentencia al señalar "... la actora ... su argumento estriba en señalar que por causa de esas obras, así en Casa de Máquinas, el barrerse la topografía de ese otro terreno construyeron un relleno para asentar esa otra estructura ...", pues según dice, lo indicado es que se varió la topografía pero nunca que se barriera lo cual es muy diferente. Además agrega, no dijo que la casa de máquinas se asentara sobre el relleno, sino que ".... Por causa de la construcción de la referida casa de máquinas, se varió la topografía del inmueble donde actualmente se ubica la misma, sea se levantó un relleno que provoca la obstrucción del cause natural y libre discurrir de un tributario (riachuelo) ..." (folio 64). Aunado a ello, indica, en el reconocimiento judicial se anotó que "... A simple vista, se aprecia que la casa de máquinas esta ubicada prácticamente a nivel del río, del cual lo separa únicamente una loma ...", siendo precisamente esa loma el paredón al que se refiere que fue instalado de cara al río y a su finca para evitar la inundación de la casa de máquinas.
No está conforme tampoco con la afirmación hecha en el fallo en el sentido de que el testigo [Nombre3] no se refirió a la obstrucción del riachuelo por parte del referido paredón, pues éste indicó: "... esa agua antes discurrió libremente y a la hora de construir casa de máquinas ellos construyeron un relleno entre casa de máquinas y nuestra propiedad, entonces el agua ya no tiene salida y hasta hace unos meses el agua pasaba de nuestra propiedad hacia la propiedad de casa de máquinas unos cuantos metros y de ahí al río ..." (folio288). Cita también la declaración de [Nombre5] cuando indica que "...Cuando yo conocí esa propiedad habían dos nacientes y el agua bajaba por la propiedad donde está casa de máquinas." (folio 305). Tampoco está conforme con la manifestación hecha en el fallo en el sentido de que [Nombre7] limitó su declaración sobre este tema, pues indica, dicho testigo declaró: "...
Al potrero que yo me refiero tenía un guayabal que pasaba hasta donde hoy día esta (sic) la casa de máquinas. En ese guayabal había una naciente que pasaba por donde hoy día está la casa de máquinas, esa naciente se vario (sic) hoy día porque hicieron un canal y la naciente se desvió cuando hicieron el canal y ahora se tira al río. La naciente ya no lleva el cauce original, ya que al hacer el canal se desvió. La parte de abajo del terreno ante era llano y hoy día no es igual, no se si fue que la tierra la tiraron ahí, pero si se que ya no es igual. Al existir el proyecto seguramente aterraron y el agua se desvió." (folio 338). Dice que con ello queda demostrado el daño ambiental que causó la demandada, sin que sea suficiente contara luego con autorización de la Secretaría Técnica Nacional Ambiental -en adelante SETENA- pues ese ente no tiene competencia para eximir de responsabilidad, máxime si no se contó con el permiso Municipal para variar la ubicación de la casa de máquinas y la tubería de presión.
Así mismo, respecto a la aludida autorización de obstruir el cauce del riachuelo, bajo el argumento de la aplicación del artículo 95 de la Ley de Aguas, considera que la sentencia comete un error por cuanto dicha autorización refiere malecones o paredes que no impidan su curso y que tan solo sirvan para regularizar, no siendo el caso en estudio, puesto que la obstrucción es total y con la construcción de la casa de máquinas se esta infringiendo el numeral 33 de la Ley Forestal al ocupar la zona de protección de la misma.
V.La parte accionante en el libelo de apelación, de manera amplia expone los aspectos por los cuales considera la sentencia es incorrecta. En lo medular, alega que existen suficientes pruebas en el proceso que evidencia el nexo de causalidad entre los daños que dice se generaron en su propiedad y las obras realizadas con ocasión de la construcción del Proyecto Hidroeléctrico desarrollado por la demandada. Sobre este último, dice, se dieron una serie de irregularidades, algunas de las cuales quedaron en evidencia al disponerse la suspensión del proyecto por parte de la SETENA, la cual aunque luego se levantó bajo el argumento de que no ocasionarían significativos daños ambientales, en el caso de su finca sí se generaron. Es sobre estos últimos que pide ser resarcida, incluyendo los perjuicios. Sobre los alegatos de la parte accionante existen muchas pruebas en el proceso que le sirven de fundamento, las cuales serán objeto de análisis en este proceso de manera integral, conforme a los lineamientos establecidos por el artículo 54 de la Ley de Jurisdicción Agraria, según la cual, el juez agrario deberá apreciar la prueba a conciencia sin sujeción estricta a lineamientos de derecho común, citando siempre los principios de derecho y de equidad en que base su decisión.
No obstante, debe resaltarse el hecho de que en este proceso se admitió como prueba para mejor resolver la ofrecida por la recurrente, consistente en una experticia y un reconocimiento judicial realizado por el Tribunal en el lugar en conflicto. La primera prueba citada se complementa con los resultados de la segunda al haberse verificado el nexo de causalidad existente entre la situación que presenta el fundo de la actora luego de la construcción del Proyecto Hidroeléctrico La Esperanza. La prueba pericial en este caso es fundamental al ser prueba técnica, siendo de especial relevancia en la determinación del daño ambiental causado, en este caso, en la finca de la accionante. El Ingeniero Gerardo Hidalgo Vega logró constatar mediante visita realizada al sitio en compañía de algunos de este Tribunal, una serie de hechos que le permitieron arribar a las siguientes conclusiones técnicas: "...
Los terrenos a los cuales se refiere este proceso ordinario presenta (sic), efectivamente sedimentación causada por el arrastre de los mismos por parte del desague del canal por el que fue construida la tubería de presión que conduce el agua que alimenta la planta hidroeléctrica La Esperanza ..." (folio 556). Esta afirmación tiene como respaldo el acta de reconocimiento judicial que levantara este Tribunal al apersonarse al sitio (folio 548), las fotografías aportadas como prueba por la actora visibles a folios 5 a 10 y 16 a 20, así como el acta de reconocimiento judicial redactada por el Juzgado de origen luego de la recepción de prueba en el sitio, puesto que aunque para el a quo no existe nexo de causalidad, sí deja en evidencia la existencia de tales sedimentos. Para mayor certeza de lo anterior, el experto agregó: "... dicho desague conduce el agua y sedimentos hasta un (sic) cuneta de 0.5 metros de profundidad, que se encuentra ubicado borde oeste de la vía pública y luego atraviesa la carretera, (12 metros aproximadamente), a través de alcantarillas de 12 pulgadas de diámetro descargando directamente en el predio de la actora por el lindero oeste con una caída de 12 metros ..." (folio 556).
Sobre esto último debe rescatarse lo expuesto en el acta de reconocimiento judicial levantada en esta Sede en el sentido de que el agua y los sedimentos atraviesan la calle y van directo a la finca de la actora, en lugar de continuar pudiendo existir la posibilidad de que caiga directamente en propiedad de la demandada. Así mismo, como respaldo de lo anterior, el perito indicó: "... es importante mencionar que se pudo apreciar claramente que los sedimentos acumulados en la propiedad de la actora coinciden con los traslados (sic) por el desague ya que se pudo apreciar la diferencia de capas acumuladas en la propiedad, así como los pequeños deslizamientos y procesos erosivos ivsibles a lo largo del canal que transporta la tubería de presión." (folio 557). En tal orden de ideas, teniendo claro el panorama en torno al nexo de causalidad existente entre los daños causados al fundo de la actora y las labores realizadas por la empresa demandada con ocasión de la construcción del proyecto hidroeléctrico, precisa determinar si en efecto se produjeron los daños y perjuicios que en concreto reclama la señora Campos Jiménez.
En el escrito de demanda, ésta bajo el título de daños y perjuicios, señaló: "...Consisten en el deterioro del inmueble y riesgo de inundación con sus consiguientes daños a causa de la eventual avalancha proveniente de los embalses, inutilizándolo para la ubicación en el mismo de un pretendido proyecto turístico o cualquier otra construcción, con su consiguiente perdida (sic) de valor económico. Respecto al deterioro del inmueble y riesgo de inundación indicado, así como su consiguiente perdida (sic) de valor económico, lo estimo conservadoramente en veinte millones de colones." (folios 72 y 73). En primer término, en relación con "... el deterioro del inmueble ..." debe señalarse que el perito en su informe señaló: "... Dentro de la propiedad se ven afectados tres excavaciones que tienen las siguientes dimensiones, la primera 33 x 50 metros, la segunda 15.2 x 32 metros y la ultima (sic) 23 x 29.7 metros, todas ellas afectadas por la acumulación de sedimento proveniente del canal en donde fue construida la tubería de presión del proyecto hidroeléctrico y ubicadas de [Dirección1] ..." (folios 556 y 557).
Lo anterior significa que en efecto, tal y como lo señala la recurrente, en el inmueble existían tres excavaciones, que según ésta tenía como fin el desarrollo de un cultivo de tilapias. El experto analizó la situación de cada una de esas excavaciones para arribar a conclusiones concretas en cuanto al costo de volver estas a su estado original, de la siguiente manera: "...Excavación 1: Dimensiones: 33 x 50 x 2.5 metros. Volumen acumulado de sedimentos: 4125 metros cúbicos. Excabación 2: Dimensiones: 15:20 x 32 x 1.5 metros. Volumen acumulado de sedimentos: 729.6 metros cúbicos. Excavasión 3: Dimensiones: 23 x 29 x 2.5 metros. Volumen acumulado de sedimentos: 1667.5 metros cúbicos. Material total acumulado: 6522.1 metros cúbicos ..." (folio 558). De esta manera se tiene por acreditada la cantidad de sedimentos que fueron depositados en el fundo de la actora, básicamente en las excavaciones a las que se ha venido haciendo alusión, de forma tal que si lo reclamado como daño es el deterioro del inmueble, la posibilidad de revertir esta situación a la demandante para que su fundo vuelva al estado original, es pagándole el valor de ello.
Este último fue estimado por el perito en la suma de 22.509.462,84 colones, a razón de 3451,26 colones el metro cuadrado, estableciendo en el documento el método que utilizó para concluir ese es el valor que corresponde por ese rubro, mismo que se considera es razonable. Otro aspecto a considerar en el daño denominado "... deterioro del inmueble ..." es el restablecimiento de la situación original del fundo en cuanto a la existencia en éste de plantas ornamentales. Tales plantas, lo mismo que la existencia de repastos, fueron acreditadas con la presentación de fotografías e inclusive como los resultados del primer reconocimiento judicial constante en autos; sin embargo, considera el Tribunal que al no haberse aportado prueba por parte de la actora, quien sobre ese extremo tenía la carga de la misma, acerca del área sembrada de plantas de tal naturaleza o la cantidad de éstas, como podrían ser las facturas de compra a algún vivero de la zona, entre otras, ese rubro debe rechazarse.
Ciertamente, el perito en su informe señala: "... En lo que respecta a reposición de plantas se estima una provisión de 400,000.00 (cuatrocientos mil colones con 00/100) basado en un sondeo con empresas de jardinería de la zona y del área metropolitana ..." (folio 558); empero, omite en su experticia referencia alguna al área donde las plantas pudieron estar sembradas, las especies de éstas para determinar su valor dado que no todas las plantas son estimadas al mismo precio, las eventuales posibilidades de recuperación de las existentes en el fundo, entre otros, aspectos éstos esenciales para poder admitir el reconocimiento de ese rubro a la accionante, la cual se reitera, tampoco ofreció prueba alguna que permitiera determinar los aspectos citados. En segundo término, de acuerdo a las pretensiones expuestas en la demanda, la señora [Nombre1] se le reconociera el: "... riesgo de inundación con sus consiguientes daños a causa de la eventual avalancha proveniente de los embalses, inutilizándolo para la ubicación en el mismo de un pretendido proyecto turístico o cualquier otra construcción, con su consiguiente perdida (sic) de valor económico." (folio 68).
Tal riesgo fue objeto de análisis por parte del experto, al afirmar: "... para desviar el caño hacia el cause del Río La Esperanza, (es la opción mas acertada según las condiciones del terreno y las pobras presentes en la vía pública, y en la (sic) propiedades involucradas), se necesita continuar la construcción de la cuneta que según el Manuel (sic) de Valores Unitarios por Topología Constructiva según el Organo de Normalización Técnica del Ministerio de Hacienda, que determina un valor de 4000.00 por metro cuadrado y se calcula una extensión aproximada de 200 metros para realizar esta obra por lo que el costo de esta seria (sic) de 800,000.00 (ochocientos mil colones con 00/100)..." (folios 558 y 559). Considera el Tribunal que partiendo de la existencia del proyecto hidroeléctrico y de su explotación por muchos años más, la forma más accesible de eliminar el riesgo que una posible inundación ante una eventual avalancha proveniente de los embalses podría causar al fundo de la actora, independientemente el destino que ésta quiera darle a su propiedad, es mediante el desvìo del caño hacia el río La Esperanza.
Por esta razón se considera acertada la propuesta del perito y la estimación dada por éste a la obra que debe realizarse al citar el método que utilizó para la valoración respectiva. De esta forma, considera el Tribunal deberá aprobarse el resarcimiento a la accionante por daños en la suma de 22.509.462,84 colones más 800,000.00 colones, para un total de 23.309.462,84 colones, monto éste que sobrepasa las expectativas que por daños y perjuicios expuso la accionante en la demanda. No obstante, es importante retomar las pretensiones de éstas dado que aparte de los daños y perjuicios citados, ésta pidió se declarara: "... 2. Que se le ordene a la demandada restituir el inmueble a su estada (sic) anterior, sea a su estado antes de la construcción del canal donde actualmente se ubica la tubería de presión y la indicada casa de máquinas. Extrayendo el sedimento acumulado en mi propiedad, sin aumentar los daños a la misma, a causa de las obras ejecutadas por la demandada; corregir el ingreso de agua y sedimentos que discurren por el canal de la tubería de presión y que llegan hasta la propiedad objeto de la presente demanda y igualmente que se restituya el libre discurrir del tributario (riachuelo) antes indicado; eliminar el constante ruido proveniente de la referida casa de maquinas (sic) escuchado desde mí (sic) inmueble; eliminación de peligro con motivo de la existencia de la tubería de alta presión, ubicada arriba del inmueble objeto de la presente demanda; así como el riesgo del discurrir del agua en caso de una ruptura súbita de los embalses, conforme lo indica la misma demandada en documentos que al efecto aporto como prueba...." Tales extremos están comprendidos en los rubros citados anteriormente mediante los cuales se pretende resarcir a la accionante; sin embargo, existen algunos sobre los cuales debe emitirse pronunciamiento al quedar fuera de lo citado líneas atrás.
En primer término, se pide se ordene a la demandada "... restituya el libre discurrir del tributario (riachuelo) ..."; sin embargo, no existe prueba técnica que permita concluir al Tribunal que con las obras de construcción del proyecto hidroeléctrico, ese riachuelo haya resultado afectado mediante una disminución en el discurrir del agua, e inclusive, aunque se hubiera podido acreditar ese extremo, no hay informe alguno que indique el porcentaje de disminución, mismo que ha manejado la recurrente sin prueba que le respalde. Al contrario, en el documento denominado "Reporte de Ajuste dentro del marco del Sistema de Gestión Ambiental" se indicó: "... Dos aspectos deben destacarse dentro de este proceso. Primero que como se puede notar en el sitio del desfogue, el Río La Esperanza, lleva consigo un importante caudal de previo al sitio de distribución de las aguas desde el Proyecto. La razón de esto, se encuentra en el hecho de que, sumado al caudal mínimo requerido o caudal ecológico, en el trayecto que sigue el río, después de la toma del PHE, este es alimentado por una serie de quebradas y causes menores que hacen que su caudal total no se vea senciblemente afectado ..." (folio 209).
De ahí se considere que la parte demandada logró acreditar en este proceso que no se han visto afectados senciblemente los caudales. De la misma forma, en relación con la petición para que se exija a la accionada "... eliminar el constante ruido proveniente de la referida casa de maquinas (sic) escuchado desde mí (sic) inmueble ..." no existe prueba técnica alguna que sirva de respaldo a este Tribunal para poder concluir se está en presencia de una contaminación sónica que exceda los límites permitidos. Al contrario, en los estudios técnicos constantes en autos vinculados con los efectos que en el ambiente tendría la construcción del proyecto hidroeléctrico, se cita que la contaminación sónica no es relevante. De la misma forma, el experto que designó este Tribunal para determinara ese rubro, señaló: "... no es posible para este perito medir el impacto del ruido de la casa de máquinas del proyecto hidroeléctrico sobre el predio de la actora ..." (folio 559).
Al respecto es importante aclarar al recurrente que para poder considerar determinado ruido como una contaminación sónica tal que implique entre otras medidas el resarcimiento, debe tratarse de niveles importantes de ruido y no de una simple "... molestia que antes no existía, como molesto es el pequeño ruido de un zancudo." (folio 531), tal y como se indica en el recurso de apelación. Por tal razón ese extremo deberá ser rechazado. Sobre esto último y en general, en relación con los alegatos hechos por la recurrente sobre la forma en que debe asumirse la carga de la prueba en este caso dada su naturaleza, debe señalarse que el numeral 109 de la Ley de Biodiversidad establece que: "La carga de la prueba, de la ausencia de contaminación, degradación o afectación no permitidas, corresponderá a quien solicite la aprobación, el permiso o acceso a la biodiversidad o a quien se le acuse de haber ocasionado daño ambiental." Así mismo, el numeral 98 de la Ley Orgánica del Ambiente dispone: "El daño o contaminación al ambiente puede producirse por conductas de acción y omisión y les son imputables a todas las personas físicas o jurídicas que las realicen." En este caso, existe prueba de los daños y los perjuicios producidos, en los términos señalados; sin embargo, en relación con la contaminación sónica consta en autos el "Reporte de Ajuste dentro del marco del Sistema de Gestión Ambiental" en el cual se indicó como aspectos ambientales producidos y directamente relacionados con el proceso como consecuencia de la potencial contaminación que podría producirse, el "Ruido y Vibraciones (RYV)", calificándose como un impacto negaativo de categoría "Baja" los "Efectos de ruido y vibraciones por la genetación de energía" y de "Muy Baja" las "Producción de ruido y vibraciones en la represa", "Producción de ruido y vibraciones en la Tubería de Presión", la "Producción de ruido y Vibraciones por la Transmisión de Energía" y la "Producción de ruido y vibraciones por las labores de mantenimiento" (folio 220), sin que se cite la aplicación de "medidas correctivas" citándose que el efecto es poco significativo.
De acuerdo a lo anterior, considera el Tribunal que sí se ocupó la empresa demandada de acreditar que la contaminación sónica en este caso no es significativa, aunado al hecho de que la pericial traída al proceso en esta instancia no aporta elementos nuevos que permitan cambiar tal criterio. Finalmente, en relación con la prueba testimonial de los señores Otto Méndez Vargas, Rafael Angel Montero Campos, Juan Francisco Ocampo Ocampo, Mauricio López Cedeño, Gerardo Alvarado Ledezma y Fernando Alonso Castro Esquivel, concluye el Tribunal que la misma, sin excepción alguna sirve de respaldo para concluir de manera integral con el resto del elenco probatorio, que existe un nexo de causalidad entre los daños reclamados por la accionante reconocidos en esta sede y la construcción y puesta en operación de la obra por parte de la demanda. De la confesional de la señora Campos Jiménez no se extrae información relevante a ser usada en su contra.
En cuanto al resto de la documental cabe resaltar el hecho de que existen informes en autos mediante los cuales se acredita que no existen gestiones de la actora para desarrollar un proyecto turístico ante las instancias competentes (folios 261, 275 y 311). No obstante, considera el Tribunal que independientemente del destino productivo que la accionante quisiera dar al terreno, es lo cierto que se ha visto imposibilitada para disponer del mismo de manera adecuada debido a los problemas de sedimentación producto del proyecto hidroeléctrico y al riesgo que esto implica, por lo que se considera deberá reconocerse a ésta el pago de los perjuicios reclamados en la demanda en tal sentido, mismos que fueron valorados en la experticia en la suma de tres millones ciento sesenta y tres mil cincuenta colones, monto que se considera es razonable dada la exposición del perito acerca del procedimiento utilizado para su fijación, al señalar: "... se contactó a los Técnicos del Ministerio de Agricultura de la Agencia de San Ramón y entrevista a algunas personas de la zona, se estima que el costo anual promedio para alquiler de una hectárea de terreno en la zona donde se localiza la propiedad de la actora es de 300,000.00 (trescientos mil colones).
Se deduce del expediente de este caso que el proyecto hidroeléctrico tiene una existencia de diez años y la extensión del terreno en cuestión es de 11,715.78 metros ó 1.1715 hectáreas; por lo que el costo por perjuicios anual para este predio es de 351,450.00, este monto multiplicada (sic) por nueve años de existencia del proyecto da como resultado el perjuicio económico causado al terreno de la demandada, esto es 3,163,050.00 (tres millones ciento sesenta y tres mil cincuenta colones con 00/1000. ..." (folio 559).
VI.En cuanto a las gestiones realizadas por el esposo de la accionante reclamando ante diversas instancias administrativas y penales daños ocasionados en el fundo en litis, propiedad de ésta, se trata de iniciativas que son ajenas a las aquí en estudio, mismas que sirven como marco de referencia para determinar como se han dado los distintos sucesos que implicaron los permisos de construcción, la suspensión de la obra y posterior levantamiento de ésta. Además, debe aclararse que la existencia o no de permiso de la Municipalidad de San Carlos para que la demandada haya hecho modificaciones a algunas de las condiciones originales del proyecto, como es la ubicación de la casa de máquinas, entre otros, así como las deficiencias o no de la SETENA en el manejo del cumplimiento de los compromisos adquiridos por la empresa accionada, y el seguimiento del regente ambiental respectivo, son aspectos de índole administrativo ajenos a este proceso al no reclamarse a tales instancias responsabilidad alguna y no incluirse pretensiones relacionadas directamente con ello.
De la misma forma, carecen de interés los alegatos acerca de si mediaron o no negociaciones entre la accionante y su esposo para con la empresa demandada para la compra por parte de ésta del fundo en litis, mismo que valga decir, efectivamente esta inscrito a nombre de la señora [Nombre1] , según certificación registral por ella aportada. Por esta razón se considera deberá denegarse la excepción de falta de legitimación activa opuesta por la empresa accionada, así como la de falta de derecho en la medida de que quedó demostrado el nexo de causalidad, el daño reclamado y la responsabilidad de la empresa ante la construcción de la obra.
VII.Por lo expuesto, con fundamento en el artículo 1045 del Código Civil y demás normas citadas, deberá revocarse la sentencia en cuanto acoge la excepción de falta de derecho, omite pronunciamiento sobre la de falta de legitimación activa, rechaza el cobro de los extremos que de seguido se dirá, e impone a la parte actora el pago de las costas. En su lugar, se rechazan las excepciones de falta de legitimación activa y falta de derecho, se ordena a la demandada pagar a la actora el daño que consiste en el deterioro de su inmueble inscrito en el Registro Público de la Propiedad, Partido de Alajuela, al folio real cuatrocientos dos mil doscientos cincuenta y cuatro- cero cero cero, a causa de los niveles de sedimentación depositados en éste, proveniente del canal en donde fue construida la tubería de presión del proyecto hidroeléctrico desarrollado por la empresa demandada, ubicadas de [Dirección1] de dicha propiedad, estimándose el valor de volver el inmueble a su estado original en la suma de veintidós millones quinientos nueve mil cuatrocientos sesenta y dos colones con ochenta y cuatro céntimos; así como el perjuicio consistente en la imposibilidad que ha tenido la accionante de usar el terreno adecuadamente, en la suma de tres millones ciento sesenta y tres mil cincuenta colones.
Se impone a la demandada la obligación de desviar el caño hacia el cause del Río La Esperanza, continuando la construcción de la cuneta en una extensión aproximada de doscientos metros, tal y como se señala en el informe pericial, para lo cual se le concede el plazo de un mes a partir de la firmeza de esta resolución, bajo apercibimiento de que en caso de no hacerlo en la forma dicha y en el plazo otorgado, se autorizará a la actora para que lo haga por cuenta de la demandada, y si lo hiciere de modo distinto al señalado en esta sentencia, se dispondrá la destrucción de lo hecho y se cumplirá lo ordenado, en cuyo caso estarán a cargo de la demandada todos los gastos y los daños y perjuicios ocasionados por la mala ejecución. Se impone el pago de las costas a la empresa demandada. En lo demás, se confirma la sentencia.-
VIII.En relación con las costas, dada la forma en que se resuelve en esta instancia, deberá imponerse el pago de éstas a la parte demandada al ser la perdidosa, de conformidad con el artículo 55 de la Ley de Jurisdicción Agraria en relación con el 221 del Código Procesal Civil aplicado supletoriamente.-
POR TANTO:
Se revoca la sentencia únicamente en cuanto acoge la excepción de falta de derecho, omite pronunciamiento sobre la de falta de legitimación activa, rechaza el cobro de los extremos que de seguido se dirá, e impone a la parte actora el pago de las costas. En su lugar, se rechazan las excepciones de falta de legitimación activa y falta de derecho, se ordena a la demandada pagar a la actora el daño que consiste en el deterioro de su inmueble inscrito en el Registro Público de la Propiedad, Partido de Alajuela, al folio real cuatrocientos dos mil doscientos cincuenta y cuatro-cero cero cero, a causa de los niveles de sedimentación depositados en éste, proveniente del canal en donde fue construida la tubería de presión del proyecto hidroeléctrico desarrollado por la empresa demandada, ubicadas de [Dirección1] de dicha propiedad, estimándose el valor de volver el inmueble a su estado original en la suma de veintidós millones quinientos nueve mil cuatrocientos sesenta y dos colones con ochenta y cuatro céntimos; así como el perjuicio consistente en la imposibilidad que ha tenido la accionante de usar el terreno adecuadamente, en la suma de tres millones ciento sesenta y tres mil cincuenta colones.
Se impone a la demandada la obligación de desviar el caño hacia el cauce del [Dirección2] , continuando la construcción de la cuneta en una extensión aproximada de doscientos metros, tal y como se señala en el informe pericial, para lo cual se le concede el plazo de un mes a partir de la firmeza de esta resolución, bajo apercibimiento de que en caso de no hacerlo en la forma dicha y en el plazo otorgado, se autorizará a la actora para que lo haga por cuenta de la demandada, y si lo hiciere de modo distinto al señalado en esta sentencia, se dispondrá la destrucción de lo hecho y se cumplirá lo ordenado, en cuyo caso estarán a cargo de la demandada todos los gastos y los daños y perjuicios ocasionados por la mala ejecución.
