VOTO Nº 1229-F-06 VOTO Nº 1229-F-06 AGRARIAN COURT OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at eleven o’clock on catorce de diciembre del dos mil seis.

Ordinary Agrarian Proceeding brought by [Nombre1], of legal age, married, businessman, resident of San José, identification number CED1- -; against [Nombre2], of legal age, single, merchant, resident of San José, identification number CED2- -, heard before the Agrarian Court of Corredores. The State was joined as a party to the proceeding, represented by Víctor Bulgarelli Céspedes, of legal age, married, Attorney, resident of Heredia, identification number CED3- -, in his capacity as Agrarian State Attorney. Attorney Marcela Rodríguez Chaves, of legal age, single, attorney, identification number CED4- -, acts as Special Judicial Counsel for the plaintiff, and Attorney Merly González Mayorga, of legal age, divorced, Attorney, resident of Puntarenas, identification number CED5- -, acts for the defendant.

BACKGROUND:

  1. 1The plaintiff brings an ordinary proceeding valued at diez millones de colones, seeking a judgment declaring: “1- That the undersigned be declared the sole possessor of the land described in cadastral plan number P- 111049-93, possession of which I acquired from [Nombre3], who in turn acquired it from [Nombre4], who acquired it from [Nombre5]. 2- That it be declared that the undersigned and the previous transferors have exercised possession as owners, peacefully, publicly, and under claim of ownership, for more than forty years over all of the land. 3- That the defendant has never exercised possession over the undersigned’s unregistered land. 4- That, by virtue of the possession exercised by the undersigned personally and that derived from my transferors, registration of the land claimed herein in my name in the Public Registry be ordered. 5- That the possession exercised by the undersigned is in good faith and, furthermore, has been made manifest through acts involving productive use of the land. 6- That the defendant has not exercised any act of possession or production over the land belonging to me. 7- That the defendant’s purported possession is in bad faith. 8- That the defendant be ordered to pay the procedural costs and attorney’s fees of this action,” (folios 5 to 8).
  2. 2The defendant answered the action brought against him in the terms appearing at folios 31 to 35 and raised the defenses of lack of a right of action and lack of standing, as well as the general defense of sine actione agit.
  3. 3Attorney Wilberth Álvarez Lí, the trial judge, in a decision issued at eleven o’clock on veintinueve de abril del dos mil cinco, ruled: “THEREFORE: In accordance with the foregoing, the cited case law and legal provisions, the defense of lack of a right of action is sustained; as for the defenses of lack of standing and the general defense of sine actione, no ruling is made on them because it is unnecessary. Consequently, the ordinary agrarian complaint filed by [Nombre1] against [Nombre2] is dismissed in its entirety. The plaintiff is ordered to pay both categories of costs incurred in this action,” (folios 300 to 312).
  4. 4The plaintiff filed an appeal expressly setting forth the reasons for challenging the trial court’s position, folios 313 to 318.
  5. 5In the conduct of the proceeding, the statutory requirements have been observed, and no errors or omissions capable of rendering the judgment null and void have been found.

Judge Darcia Carranza drafts the opinion; and,

CONSIDERING:

I.The Court adopts the facts found to have been proven, as they faithfully reflect what occurred in the record. The following shall be deemed to be of that nature: 4.- By means of a public deed executed before notary public [Nombre6] at eight o’clock on veintiuno de noviembre de mil novecientos noventa y seis, Mr. [Nombre5] sold an unregistered property measuring cien hectáreas cuatro mil seiscientos cincuenta y seis metros con cincuenta y cuatro decímetros cuadrados, identified by cadastral plan Nº P-111049-93, located in Puerto Jiménez, Golfito, Province of Puntarenas, bounded to the north by [Nombre7], [Nombre8], Chimpol S.A.; to the south by [Nombre1], [Nombre9], [Dirección1] fronting thereon; to the east by [Nombre10]; and to the west by [Nombre1], transferring to Mr. [Nombre4] possession dating back more than sixty years (see folio 107 of the plaintiff’s evidence file). 5) By means of a public deed executed before notary public Olman Castro Madrigal at nine o’clock on veintinueve de noviembre de mil novecientos noventa y nueve, [Nombre4] transferred to [Nombre9] the unregistered property identified in cadastral plan Nº P- 111049-93, which he had acquired from [Nombre5] (see folio 109 of the plaintiff’s evidence file). 6) Ms. [Nombre9] commenced possessory information proceedings in expediente EXPN1 on 21 de noviembre de 2000 (see folios 105 to 130 of the plaintiff’s evidence file). 7.

By means of deed ciento treinta y siete, executed in volume cuarto of the protocol of notary public Marcela Rodríguez Chaves, folio 100, Ms. [Nombre9] assigned the rights arising from the possessory information proceeding to Mr. [Nombre1], which assignment was accepted by the Agrarian Court of origin in a decision issued at nine thirty on 3 de diciembre de 2002 (see folios 243 and 246 of the main record). 8. The deed by which Mr. [Nombre5] sold to [Nombre2] (now [Nombre2]) the land described in cadastral plan P-111049- 93, which is the subject of the dispute, was executed on 24 de abril de 1997 and was therefore subsequent to the deed by which he had transferred the same property to Mr. [Nombre4] (see folio 107 of the plaintiff’s evidence file and folio 25 of the main record). 9).- The land at issue is located within the Golfo Dulce Forest Reserve, created by executive decree Nº 8494-A of 28 de abril de 1978 (folio 74).

II.The facts found not to have been proven are not accepted, because the court below is deemed to have confused the action brought.

III.The special judicial attorney-in-fact (apoderada especial judicial) for the plaintiff, attorney Marcela Rodríguez Chaves, filed an appeal (recurso de apelación) against the judgment issued by the court of origin on the following grounds.

  • 1)The appellant states that the judgment failed to analyze the entirety of the factual circumstances and evidence contained in the record, and therefore resulted from a partial analysis that led to an erroneous conclusion in the ruling.
  • 2)She states that proven fact one asserts that the defendant has been working and possessing the property (fundo); however, that assertion lacks any supporting legal and logical analysis and also lacks an evidentiary analysis of the factual history of possession. When this proceeding was initiated, two case files from the same court were offered as evidence: EXPN1 and EXPN2. This evidence was never analyzed, weighed, or mentioned by the court below (a quo). That evidence establishes that her client acquired the right asserted herein through an assignment of disputed rights (cesión de derechos litigiosos) in a possessory information proceeding (información posesoria), and also demonstrates that this is unregistered land. Consequently, substantive finding four, in which the court below analyzes standing to sue (legitimación activa) and explains its reasons for finding that her client lacks standing because he has never held the status of registered owner, makes no sense whatsoever. She contends that the court below did not even read the complaint, the first factual allegation of which clearly states that her client’s standing arises from an assignment of disputed rights made in case file EXPN1.
  • 3)Regarding the fact deemed unproven, the court below states that it was not shown that her client performed any type of possessory act (acto posesorio), and further states that he likewise failed to prove that he was the owner of the property. Both facts would have been deemed proven had all the evidence presented been considered, because the testimony of the assignor of the rights was not analyzed as a whole, as required by law. She clearly stated that she had been threatened by the plaintiff to prevent her from entering an appearance at the disputed property. Moreover, her client could not prove ownership of unregistered real property except through the documents contained in the record, since he could not be expected to produce a land-registry entry, as the ruling appears to suggest.
  • 4)The evidence was not analyzed as a whole, as required by the principles of procedure, because the trial judge merely copied isolated statements from the witnesses, thereby failing to analyze each statement in its entirety and relate it to the remaining evidence, namely the documentary evidence and the judicial inspection record (acta de reconocimiento judicial).
  • 5)She argues that the court failed to consider that her client’s transferor acquired the property through public deed (escritura pública) number 119, appearing at folio 75 of the first volume of the notarial protocol of notary public Olman Castro Madrigal, executed at 9 horas del 29 de noviembre de 1999, by purchase from [Nombre4], who had acquired it from the prior possessor, [Nombre5], through deed number 19 of volume 13 of notary Jeremías Vargas Chavarría, executed at 8 horas del 21 de noviembre de 1996. She asserts that the testimonial evidence established that [Nombre5] was not only the person who directly exercised possession of the disputed property, but also that he always intended for such possession to be transferred to her client’s transferor, [Nombre9].
  • 6)As the basis for this proceeding, the defendant submitted a deed executed before notary public Adolfo Rojas Breedy, dated 24 de abril de 1997, through which [Nombre5] transferred the possessory rights (derechos posesorios) to him. By that date, however, he was no longer the owner of the property, because he had previously transferred the possessory rights to [Nombre4], and therefore could not transfer something that no longer belonged to him. That deed has not been rescinded to substantiate the title presented by the defendant, a circumstance that the court below did not even analyze.
  • 7)The court below states that agricultural use (explotación agraria) is protected by law as a basis for protecting a possessor against the owner, and that such possession must satisfy a series of requirements, including that it be peaceful and in good faith. She further states that it must be clearly understood that, while [Nombre5] was alive, any acts of possession performed by the defendant were merely tolerated by him because of the defendant’s family relationship with the direct possessor, since the latter was the person who exercised true possession. Notwithstanding his notarial acts, [Nombre5] retained possession until his death, and only thereafter did the defendant herein prevent [Nombre9] from exercising the right of possession now claimed. None of this was assessed by the judge.
  • 8)She states that there is an element of fundamental importance in this proceeding: [Nombre9], who was [Nombre5]’s wife, directly and jointly exercised possession of the land claimed herein for years. Thus, in addition to legal title, she held actual title, consisting of the conduct of productive activities on the disputed property.
  • 9)She states that the testimony obtained is fundamental in establishing, first, that the agricultural use of the property occurred in the same area in which [Nombre5] had conducted it and, second, that the defendant himself clearly and precisely testified that he had not had problems with other possessors because they had not gone to the farm. A contrario sensu, it may be inferred that if they went there, he would have problems with them, precisely as stated by [Nombre9], who has been intimidated by the defendant.
  • 10)The testimonial evidence provides relevant grounds for judgment, because the witnesses consistently stated that the defendant worked on the farm when [Nombre5] was the owner (testimony of [Nombre11]) and stated even more clearly: “I must clarify that when I saw [Nombre5]’s children going to work on the farm, I considered [Nombre5] to be its owner, and I never knew when [Nombre5] ceased to be the owner of that farm.” The appellant states that the consensual nature of the defendant’s possession, rather than possession as owner, is even clearer from the statement of [Nombre12], a witness offered by the defendant, to the effect that the person who had possessed the farm was [Nombre5] and that the person who subsequently worked it was [Nombre13]. This shows that the defendant and his siblings worked the property by performing possessory acts that were neither their own nor performed under a claim of ownership, but were instead the logical consequence of their family relationship, and that they perpetuated such acts over time by intimidating the property’s true owners. She further contends that, had the testimony of [Nombre12] been analyzed in its entirety, the judge would have realized that it was contradictory, because the witness also stated that he did not know who worked the farm when it belonged to [Nombre5] and did not know whether his children worked with him at that time. Yet, at the end of his testimony, in response to a follow-up question, he stated that he learned of a bill of sale (carta-venta) through which [Nombre2] acquired the property on the day of the previous hearing, referring to the inspection conducted in mayo del año pasado (2004). This leads to the conclusion that the witness had no information predating mayo del 2004 that would enable him to establish when [Nombre5] ceased exercising possession, which he ultimately transferred to the assignee from whom the plaintiff herein derives his rights. 8) In his testimony, the plaintiff clearly stated that he did not go to the farm because people he knew in the town had told him that [Nombre5]’s children were going to attack him with machetes or shoot him. This is also consistent with the other testimony indicating that, although the defendant is only one of [Nombre5]’s children, it has been established that another brother spends more time on the land. 9) The ruling also fails to analyze the judicial inspection (reconocimiento judicial) dated 1 de abril del 2004, which clearly and precisely establishes that the farm consists primarily of primary and secondary forest, with a small wooden cabin that was built many years ago, and that the few trees surrounding it were likewise planted years ago. This irrefutably establishes that there is no real and current operation of an agricultural enterprise (empresa agraria), which means that possession was transferred to him by its true successors and that no areas have been used other than those originally used by them. She states that it must be taken into account that the property measures one million four thousand six hundred fifty-six square meters and four square decimeters and that, as shown by the judicial inspection, the plantings are neither large-scale nor recent. This negates the principal basis for standing in agricultural matters, namely the use of the land, which has been disproved by the objective evidence admitted into the proceeding and not analyzed by the court below. She states that two matters are decisive in resolving this case: first, the legitimacy of the defendant’s possession, and second, the actual conduct of agricultural production. The trial judge entirely failed to address both matters when issuing the ruling (folios 313 a 324).

IV.The defendant challenges the ruling primarily on the ground that it failed to assess the essential documentary evidence concerning the deeds by which the prior possessor transferred the property before transferring it to the defendant herein. That evidence was neither weighed nor analyzed, even though this involved a double sale (doble venta) made when [Nombre5] was no longer the owner of the real property. He also criticizes the failure to weigh and analyze other evidence contained in the record, including the judicial inspection and the testimonial evidence. He further argues that he was deemed not to have proven that he was the owner of the property, even though registered ownership could not be at issue because the property is unregistered.

V.Regarding the appellant’s arguments that the court a quo failed to assess the documentary evidence (prueba documental) in the record concerning the prior sale made by [Nombre5] to [Nombre4], the appellant is correct, as the trial judge’s failure to analyze that evidence is evident. This Court considers it important to provide a connected account of what occurred in this case. By means of a public instrument (escritura pública) executed before Notary Public Jeremías Vargas Chavarría at eight o’clock on the twenty-first of November, nineteen ninety-six, [Nombre5] sold to [Nombre4] his unregistered property (finca sin inscribir), measuring one hundred hectares, four thousand six hundred fifty-six square meters and fifty-four square decimeters, identified by cadastral plan (plano catastrado) Nº P-111049-93, located in Puerto Jiménez de Golfito, Province of Puntarenas, bounded to the north by [Nombre7], [Nombre8], and Chimpol S.A.; to the south by [Nombre1], [Nombre9], and [Dirección1], which it faces; to the east by [Nombre10]; and to the west by [Nombre1], transferring to him possession (posesión) extending back more than sixty years (see folio 107 of the plaintiff’s evidentiary file).

By means of a public instrument executed before Notary Public Olman Castro Madrigal at nine o’clock on the twenty-ninth of November, nineteen ninety-nine, [Nombre4] transferred to [Nombre9] the unregistered property identified in cadastral plan Nº P- 111049-93, which he had acquired from [Nombre5] (see folio 109 of the plaintiff’s evidentiary file). On 21 de noviembre de 2000, [Nombre9] commenced possessory information proceedings (diligencias de información posesoria) under expediente EXPN1 (see folios 105 to 130 of the plaintiff’s evidentiary file). By means of instrument one hundred thirty-seven, executed at folio 100 of volume four of the protocol of Notary Public Marcela Rodríguez Chaves, [Nombre9] assigned the rights arising from the possessory information proceedings to [Nombre1], which assignment was accepted by the Juzgado Agrario of origin in a ruling issued at nine thirty on 3 de diciembre de 2002 (see folios 243 and 246 of the main record).

The instrument by which [Nombre5] sold the land described in cadastral plan P-111049-93 to [Nombre2] (now [Nombre2]), which is the subject of this dispute, was executed on 24 de abril de 1997 and was therefore subsequent to the instrument by which he had transferred the same property to [Nombre4] (see folio 107 of the plaintiff’s evidentiary file and folio 25 of the main record). On that basis, it is clear that when [Nombre5] sold the property to the defendant herein, that tract no longer belonged to him because he had transferred it almost one year earlier; that is, he lacked the capacity to sell because he was not the owner of the land at that time, and it was therefore the property of another (cosa ajena). In light of the foregoing, it is clear that public instrument number one hundred nineteen, appearing at folio 75 of volume one of the protocol of Notary Public Olman Castro Madrigal, by which [Nombre5] sold the tract at issue in these proceedings to [Nombre4] at nine o’clock on the twenty-first of November, nineteen ninety-six, predates the other transfer; accordingly, any subsequent transfer was not made in the capacity of owner.

In this regard, section 1061 of the Código Civil provides: “The sale of property belonging to another is absolutely null and void; however, a buyer who is unaware of the defect in the contract is entitled to damages, even against a seller acting in good faith”; and, with reference thereto, article 1063 of the same body of law provides: “The nullity of the sale of property belonging to another is cured if the true owner ratifies the disposition, or if the seller subsequently becomes the owner of the property sold.” Accordingly, the sale made by [Nombre5] to [Nombre2] would be affected by nullity (nulidad) unless the seller had reacquired ownership or the owner had ratified that sale. Neither circumstance is present in this case. First, [Nombre5] did not again become the owner of the property; and second, there is sufficient evidence in the proceedings to conclude that [Nombre1] has never ratified the aforementioned disposition (enajenación).

On the contrary, the record shows that after [Nombre5] sold the property to [Nombre4], the latter transferred the disputed property to [Nombre9] by means of a public instrument executed before Notary Public Olman Castro Madrigal at nine o’clock on the twenty-ninth of November, nineteen ninety-nine (see folio 109 of the plaintiff’s evidentiary file), and that on 21 de noviembre de 2000 she commenced possessory information proceedings under expediente EXPN1 (see folios 105 to 130 of the plaintiff’s evidentiary file); and by means of instrument one hundred thirty-seven, executed at folio 100 of volume four of the protocol of Notary Public Marcela Rodríguez Chaves, [Nombre9] assigned the rights arising from the possessory information proceedings to [Nombre1], which assignment was accepted by the Juzgado Agrario of origin in a ruling issued at nine thirty on 3 de diciembre de 2002 (see folios 243 and 246 of the main record).

All these instruments possess the corresponding validity because the property was acquired through the chain of prior owners, extending back to [Nombre5] as the former owner. Based on the foregoing, the circumstances set forth in the transcribed section 1063 are not present, and the sale through which [Nombre2] acquired the property remains affected by defects rendering it null and void. Irrespective of the foregoing analysis concerning a double sale (doble venta), this does not mean that the property belongs to the plaintiff herein, because it is important to conduct a legal analysis of the disputed lands, as they lie within a protected wildlife area (área silvestre protegida) created in June nineteen seventy-eight and, as will be seen below, the first possessor’s initial possession of those lands began in nineteen eighty-two, according to the evidence in the record. Consideration must be given to the statement by the Procuraduría General de la República that the property at issue is located within the Reserva Forestal Golfo Dulce, created by decreto Ejecutivo Nº 8494-A de 28 de abril de 1978 (folio 74), and therefore cannot be subject to private appropriation unless ten years of possession predating its creation are demonstrated, as stipulated in section 7 of the Ley de Informaciones Posesorias, because it forms part of the public domain (dominio público) as property belonging to the Patrimonio Natural del Estado.

According to the plans identifying the disputed property, it is located within the Reserva Forestal Golfo Dulce, as also indicated by the certification issued by the Ministerio del Ambiente y Energía (see folios 4 and 5 of the plaintiff’s evidentiary file and folio 92 of the main record). The documentary and testimonial evidence (prueba testimonial) in the case file establishes possession dating approximately from nineteen seventy-eight, since [Nombre11] stated that he had known the property for approximately twenty-two years, as he had possessed it himself. He clearly stated the following: “I have known the property at issue for twenty-two years; in fact, that property belonged to me when it was unappropriated land (tierras baldías). After me, [Nombre14] was the owner, and he then sold it to [Nombre5]...” (see folio 66, front). Because his testimony was given on 14 de setiembre de 2004, this places the commencement of possession in 1982, by which time the Reserva Forestal had already been declared, since its declaration dates from 28 de abril de 1978.

The other witnesses became acquainted with the disputed property after the date indicated by the aforementioned witness: [Nombre12] stated that he had known it for fifteen years, and [Nombre9] since nineteen ninety-two (see folios 65 and 66). Their testimony is therefore of no probative value for purposes of establishing ten years of possession predating 28 de abril de 1978. This Court considers it important to review the history of the various laws establishing the public-domain status (demanialidad) of lands situated within protected wildlife areas.

VI.In our country, the titling of land (titulación de terrenos) located within protected wilderness areas (áreas silvestres protegidas) has been permitted on the basis of Article 7 of the Ley de Informaciones Posesorias, which has been amended several times over the years. During the first thirty-three years in which the law was in force, the text of the provision bore no relation to the subject matter it currently governs, namely, possession for purposes of acquisitive prescription (posesión ad usucapionem) of real property located within protected wilderness areas. In this regard, through Ley No.5257 de 31 de julio de 1973, Article 7 of the Ley de Informaciones Posesorias was amended, and its text read: “Article 7.- When the property to which the possessory information proceedings (información posesoria) relate contains a forested area covering one-half or more of its total area, lawful acquisition must be proven by means of a public instrument executed more than ten years earlier.

In every case, the possessory information proceedings under this article must include a certification from the Dirección General Forestal stating that the land does not form part of any national reserves or parks.” The foregoing text was amended by Ley Forestal No.7032 de 2 de mayo de 1986, and the challenged provision was worded as follows: “Article 7.- When the property to which the possessory information proceedings relate is located within an area declared to be a national park, biological reserve, forest reserve, or protected zone, the person seeking title (titulante) must prove that ten-year possession (posesión decenal) was exercised beginning at least ten years before the effective date of the respective law or decree creating the relevant protected wilderness area. Properties located outside those areas and containing forests may be titled only if the petitioner proves that they have been possessed for ten years or more and that the natural resource has been protected, provided that the property must be properly demarcated by fences or cleared boundary paths.

Without exception, cadastral plans (planos catastrados) submitted in possessory information proceedings must be certified by the Dirección General Forestal and the Servicio de Parques Nacionales del Ministerio de Agricultura y Ganadería, which agencies shall attest whether the property for which title is sought is located inside or outside those protected areas.” The text of the provision quoted above was retained in the amendment introduced by Ley Forestal No.7174 del 28 de junio de 1990 to the Ley de Informaciones Posesorias; the only change concerned the Ministry to which the Servicio de Parques Nacionales was attached, as it became part of the Ministerio de Recursos Naturales, Energía y Minas. The text of that provision read: “Article 7.- When the property to which the possessory information proceedings relate is located within an area declared to be a national park, biological reserve, forest reserve, or protected zone, the person seeking title must prove that ten-year possession was exercised beginning at least ten years before the effective date of the respective law or decree creating the relevant protected wilderness area.

Properties located outside those areas and containing forests may be titled only if the petitioner proves that they have been possessed for ten years or more and that the natural resource has been protected, provided that the property must be properly demarcated by fences or cleared boundary paths. Without exception, cadastral plans submitted in possessory information proceedings must be certified by the Dirección General Forestal and the Servicio de Parques Nacionales del Ministerio de Recursos Naturales, Energía y Minas, which agencies shall attest whether the property for which title is sought is located inside or outside those protected areas.” Currently, following the amendment made by Ley Forestal No.7575 de 13 de febrero de 1996, the operative text of the Ley de Informaciones Posesorias reads: “Article 7.-When the property to which the possessory information proceedings relate is located within a protected wilderness area, regardless of its management category, the person seeking title must prove that he or she holds the legal rights arising from ten-year possession, exercised beginning at least ten years before the effective date of the law or decree creating that protected wilderness area.

Properties located outside those areas and containing forests may be titled only if the petitioner proves that he or she holds the legal rights arising from ten-year possession, exercised for at least ten years, and that the natural resource has been protected, provided that the property must be properly demarcated and enclosed by fences or cleared boundary paths. Without exception, cadastral plans submitted in possessory information proceedings must be certified by the Ministerio del Ambiente y Energía through the competent entity, which shall attest whether the property for which title is sought is located inside or outside those protected wilderness areas.” Based on the foregoing, where land is located within a protected wilderness area, a more stringent requirement concerning the exercise and duration of possession must be satisfied. The Tribunal Agrario has ruled accordingly: “…Pursuant to Article 7 of the Ley de Informaciones Posesorias, which applies to this case because the property to be titled is located within the Zona Protectora …, to register that property in the Registro Público, the applicant must prove that he or she possessed the property for at least ten years before the decree creating the aforementioned Reserva entered into force and that the forest resource was protected” (voto Nº170-03 de las 16:24 horas del 31 de marzo del 2003.

See also voto Nº755- 03 cited in this regard). The foregoing is required to protect the State’s forest heritage and biodiversity, without thereby impairing rights that private parties had actually perfected through the passage of time (see voto Nº497 de las 15:20 horas del 30 de julio del 2003 del Tribunal in this regard). Along these lines, in Voto N° 4587 de las 15:45 horas del 5 de agosto de 1997, in which it examined the constitutionality of the cited Article 7, the Sala Constitucional held that, to obtain title to land located in the protected zones specified therein, the interested party was required to prove possession beginning ten years before the respective decree entered into force. In essence, the Sala stated on that occasion: “…given the nature of the property for which title is sought (public property), the period of possession sufficient for acquisitive prescription (usucapión) must elapse before the property is dedicated to the public domain (afectación del bien al dominio público).

In other words, the declaration of a protected wilderness area prevents possession after that dedication from being counted and precludes satisfaction of the requirements for acquisitive prescription if the right had not been acquired by that time—that is, if the ten years of possession sufficient for acquisitive prescription under the conditions established by law had not elapsed… it is important to summarize the basic principles applied in legal scholarship and case law regarding these matters, which require the judge—in connection with the challenged provision—to determine in each case the specific type of possessory act (acto posesorio) exercised over the tract—which becomes part of the protected wilderness area—for which title is sought. This is intended to provide the judge with a broader basis—not limited to the effective date of the law or executive decree defining the boundaries of a particular protected wilderness area—for determining more precisely when such property became inalienable and not subject to prescription (imprescriptible), in order to establish whether possession for purposes of acquisitive prescription was exercised over it for ten years before it acquired that status.

This broader perspective promotes the protection of the Nation’s environmental heritage and ensures that, when title is sought through possessory information proceedings for land located within a protected wilderness area, the inquiry is not reduced to merely calculating how long the person has occupied the property in relation to the date on which it was declared a protected wilderness area, since—on the one hand—in order to establish possession for purposes of acquisitive prescription during the period prescribed by Article 7 of the Ley de Informaciones Posesorias, the elements required for each specific type of possession must be considered and—on the other hand—the possible existence of longstanding provisions that declared such land inalienable even before its specific dedication to the public domain must also be considered….” A series of important conclusions may be drawn from the Sala Constitucional’s ruling because, in addition to proving ten-year possession before the protected wilderness area was created, the applicant must prove that the resource existing on the land for which title is sought was protected.

Furthermore, that decision states that judges must exercise care when approving land-titling proceedings under Article 7 of the Ley de Informaciones Posesorias and must therefore determine in each specific case whether the land had already been dedicated to the public domain under a law predating the creation of the protected zone. In this particular case, it is clear that possession was initially exercised by Mr. [Nombre11], as he himself stated when testifying that the property had belonged to him when it consisted of unappropriated public lands (tierras baldías). Given that his statement was made on 14 de setiembre del 2004, counting back 22 years from the date of his statement places us in the year 1982. Thus, the dispute concerns land that had been part of the public domain since before that date because it was located within the Reserva Forestal Golfo Dulce, created by decreto Ejecutivo Nº 8494-A de 28 de abril de 1978.

Public-domain property (bienes demaniales) cannot be privately appropriated because it is outside private commerce. Before discussing the public-domain regime (régimen de dominio público), it is necessary to define the public domain. It is the set of publicly owned assets belonging to the State, lato sensu, dedicated to the direct or indirect public use of the inhabitants and subject to a special public-law regime that therefore departs from private law. The public domain comprises four elements: subjective, objective, normative, and teleological. The subjective element refers to the holder of the right—the State—; the objective element refers to or consists of the property or assets subject to the public domain—in this case, the real property at issue—; the normative element determines when an asset meets the statutory requirements for classification as public-domain property and consists of the body of rules governing it—the body of rules set out below—; and the teleological element concerns the purpose pursued by including a particular asset within the public domain, that is, the public purpose assigned to it—in this case, the protection of natural resources—.

Public-domain property is subject to a special legal regime and to the State’s regulatory authority (poder de policía), and it is characterized primarily by its inalienability and immunity from prescription (imprescriptibilidad). By its nature, it is intended to satisfy public needs, which precludes private individuals or entities from holding or possessing it; it lies outside private commerce and private law.

Our Political Constitution, in Article 121, subsection 14), refers to public-domain status (demanialidad), indicating which assets may be subject to that public-ownership regime. That article even establishes different degrees of dedication to public use (afectación pública), ranging from an intense and absolute degree of public dedication (publicatio) to less intense degrees, while harmonizing the rights of private parties with the powers of the Administration. Our current Civil Code, which dates from April of 1886, governs the most important principles concerning public-domain property (bienes de dominio público), specifically in Articles 261 through 263. Article 262 of the aforementioned Civil Code refers to two important characteristics of public-domain property: a- public things are outside commerce; and b- withdrawal from public use (desafectación) is established by stating that such property may not enter private commerce unless legally authorized to do so.

As may be observed, dedication to the public-domain regime does not depend on the nature of the property, but rather on the will of the legislature. In decision number 447-91, issued at fifteen hours thirty minutes on 21 de febrero de 1991, the Constitutional Chamber states that the declaration that property belongs to the public domain is established by law; this declaration does not constitute a restriction on property under Article 45 of the Constitution, because that article refers to private property, and public-domain property is not subject to private ownership. In this regard, the Constitutional Chamber has stated concerning this type of property: “The public domain consists of property that, by the express will of the legislature, has a special purpose of serving the Community and the public interest. These are known as government-owned property (bienes dominicales), public-domain property (bienes demaniales), public property or things (bienes o cosas públicas), or public assets (bienes públicos), which do not individually belong to private persons, are intended for public use, and are subject to a special regime outside human commerce; that is, dedicated by their very nature and purpose.

Consequently, such property belongs to the State in the broadest sense of the term, is dedicated to the service it provides, and that service is invariably essential by virtue of an express rule. Characteristic features of such property are that it is inalienable, may not be mortgaged or encumbered under Civil Law, and administrative action replaces possessory injunctions (interdictos) for purposes of recovering possession.” (Voto N° 2306, issued at catorce horas cuarenta y cinco minutos on seis de noviembre de mil novecientos noventa y uno by the Constitutional Chamber). Based on its analysis of all the evidence, this Court finds that the disputed lands are public-domain property not subject to private appropriation; therefore, from this perspective, the subject matter of this litigation concerning sales and double sales of the same property is unlawful because the property is dedicated to the public domain.

It is also important to bear in mind that, according to the judicial inspection (reconocimiento judicial) conducted, most of the property at issue consists of mountain land or forest (see folio 49), which means that it is property intended for conservation within Reserva Forestal Golfo Dulce, the objective for which it was declared a protected wildlife area (área silvestre protegida) in the year mil novecientos setenta y ocho. In connection with a case similar to the one under consideration, in which the parties disputed a superior right of possession (mejor derecho de posesión) over land located within Reserva Forestal Golfo Dulce, the First Chamber of the Supreme Court of Justice stated in decision Nº 56, issued at 14 horas on 5 de febrero de 1999: “WHEREAS: I.- In this ordinary agrarian proceeding (proceso ordinario agrario), the dispute concerns the existence of a superior right of possession over unregistered lands located in Reserva Forestal de Golfo Dulce.

Osa Ganadera S. A., the defendant and counterclaimant in this proceeding, dissatisfied with the dismissal of its counterclaim, files this appeal. It bases the appeal on the following three assertions: a) That its possession, when added to that of the persons who transferred the property, dates back to 1969, representing 28 years of tenure of the property that should have been protected by the judges; b) That it has performed several acts constituting the exercise of possession, entailing a major financial investment; and c) That the land at issue is not subject to the forestry regime (régimen forestal), because this is not possible since it is not recorded in the Registry, which also precludes the existence of a management or exploitation plan approved by the Dirección General Forestal. In view of the foregoing, it concludes that ecological possession (posesión ecológica) cannot properly be required under the terms proposed by the Court and, therefore, its possessory acts are valid and effective and must be protected.

II.- With respect to an appeal on points of law (recurso de casación) in agrarian matters, this Chamber has repeatedly emphasized the appellant’s obligation to challenge, systematically and technically, both the judge’s legal arguments and the factual assessments relied upon in reaching the decision. The challenge must explain, with clear and precise reasons, the grounds for disagreement and conclude by identifying the alleged lack of legal validity of the challenged judgment, if possible specifying the alleged errors committed by the Superior Court. Accordingly, general observations or assertions lacking evidentiary support cannot constitute a proper challenge before this Chamber. III.- Indeed, in the appeal, the challenging party makes no effort to refute the Superior Court’s reasoning. It merely makes general observations regarding the subject matter of the proceeding that bear little or no relation to the grounds of the judgment.

Those grounds may be summarized as follows: a) That the property in dispute has formed part of the State Forest Estate (Patrimonio Forestal del Estado) since 1978, and therefore the claimed area is public property and, consequently, is not subject to acquisitive prescription and is inalienable; b) That the exercise of ecological possession, at least since April 1968, was not established; c) That the logging in forested areas (approximately 100 hectares) is inconsistent with the possession required by law for this type of land. On this basis, the judges maintain that the activities conducted on the lands at issue are not legally sufficient and therefore could not give rise to any right in favor of the counterclaimant company. Accordingly, the appeal under consideration does not satisfy the basic technical requirements for a valid challenge in agrarian matters, because it contests the judgment of the court below (Ad quem) using arguments that do not actually address the grounds underlying the challenged decision.

Nor does it properly challenge the legal reasoning cited by the judge in deciding the case. Consequently, the appeal is highly informal, which alone would justify its dismissal. IV.- Nevertheless, it should be emphasized that the appellant on points of law insists upon judicial recognition of ordinary possessory acts over property belonging to the State Forest Estate. It overlooks the fact that the judges clearly asserted that the claimed lands were not subject to acquisitive prescription and were inalienable, based on the legal status conferred upon them upon the entry into force of Executive Decrees Nos. 8494-A of 28 de abril de 1978, 9388-A of 30 de noviembre of that same year, and 10142 of 12 de junio de 1979. As a consequence of these administrative acts, the Court reasoned, those properties became part of Reserva Forestal de Golfo Dulce. This Chamber agrees with that assertion, subject to the following clarification: the status of the aforementioned properties as public property did not arise in the year 1978.

Rather, it derives from the Fiscal Code of 1865. That legislation did, in fact, govern national vacant lands (baldíos nacionales) containing forests and mountains, thereby giving them the status of public property from that time onward. Those provisions were subsequently repealed by Ley General sobre Terrenos Baldíos Nº 13 of 6 de enero de 1939; however, the succeeding legislation likewise maintained the status of those lands as public property. Thereafter, upon the enactment of Ley Nº 2825 of 14 de octubre de 1961, the following lands became national reserves of the State: ‘a) ... those located within the borders of the Republic that are not registered as the private property of individuals, Municipalities, or Autonomous Institutions; b) Those not protected by ten-year possession (posesión decenal); c) Those that have not been allocated by special laws to the establishment of agricultural colonies; and d) In general, all lands that, while not privately owned, are not occupied for public services.’ (Article 11; underlining not in the original).

This means that those lands continued to form part of the public property of the Costa Rican State. Subsequently, Ley Forestal Nº 4465 of 25 de noviembre de 1969 introduced into our legal system the concept known as Patrimonio Forestal del Estado, which, pursuant to Article 18 of that legislation, consisted of: Reservas Nacionales, Reservas Forestales, Parques Nacionales, Viveros Forestales del Estado, Zonas Protectoras, and Reservas Biológicas, thereby giving that area a forestry-related public interest. Finally, the areas at issue were declared forest reserves through the decrees cited supra, while retaining their status as property not subject to acquisitive prescription and as inalienable property because they constituted public lands of the State (Regarding the development of State protection of historical heritage, this Chamber expanded its analysis in decision Nº 51, issued at 15:15 horas on 26 de mayo de 1995).

Consequently, the conditions of being exempt from acquisitive prescription and inalienable, as well as forestry protection, predate the decrees cited by the Superior Court. Nevertheless, what is stated here does not alter the decision but instead reaffirms it. V.- It should also be added that, even under the assumption that the public nature of the properties arose in April 1978—with their incorporation into Reserva Forestal de Golfo Dulce—the appellant would still have been required to prove ten-year possession of the properties as of that date, relying not only on its own tenure of them but also adding the possession exercised by the prior transferors. The Court so required. The appeal alleges—without justification, since it was established that tenure began in 1971—possession dating from 1969. Irrespective of the evidentiary issue, which may be questioned, that claim is ineffective in modifying the challenged judgment because the ten-year requirement for possessory activity would likewise not have been satisfied, even assuming the appellant’s arguments to be true.

VI.- Lastly, the counterclaimant argues that the forestry regime does not apply to the disputed lands and therefore that possession need not be ecological in nature. In support of its argument, it refers imprecisely to the forest-use mechanism (aprovechamiento forestal) prescribed by Sections 63 et seq. of Ley Forestal 1969. However, those provisions applied only to private forests whose owner sought to exploit them, because in the case of ownerless land, the forestry regime applied immediately by operation of law. The argument is therefore untenable and must be dismissed outright. VII.- Based on the foregoing reasons, the appeal must be dismissed and the challenged judgment affirmed. POR TANTO The appealed judgment is affirmed ….” For all the foregoing reasons, the ruling must be affirmed, but on the grounds stated at this level of review.

POR TANTO

For the reasons stated at this stage of the proceedings, the judgment rendered is affirmed.

VOTO Nº 1229-F-06 VOTO Nº 1229-F-06 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las once horas del catorce de diciembre del dos mil seis.

Proceso Ordinario Agrario, planteado por [Nombre1] , mayor, casado, empresario, vecino de San José, cédula número CED1- - ; contra [Nombre2] , mayor, soltero, comerciante, vecino de San José, cédula número CED2- - , tramitado ante el Juzgado Agrario de Corredores. En el proceso se tuvo como parte al Estado representado por Víctor Bulgarelli Céspedes, mayor, casado, Abogado, vecino de Heredia, cédula número CED3- - , en su condición de Procurador Agrario. Actúa como Apoderada Especial Judicial de la parte actora la Licenciada Marcela Rodríguez Chaves, mayor, soltera, abogada, cédula número CED4- - y de la parte demandada la licenciada Merly González Mayorga, mayor, divorciada, Abogada, vecina de Puntarenas, cédula número CED5- - .

RESULTANDO:

  1. 1La parte actora plantea proceso ordinario estimado en la suma de diez millones de colones, para que en sentencia se declare: "1- Se declare al suscrito único poseedor de los terrenos descritos en el plano catastrado número P- 111049-93 cuya posesión adquirí de [Nombre3] quien a su vez la adquirió de [Nombre4] quien adquirió de [Nombre5] . 2- Que se declare que el suscrito y los anteriores transmitentes hemos ejercido como propietarios, de forma quieta pública y a título de dueños la posesión durante mas de cuarenta años sobre la totalidad de los terrenos. 3- Que el demandado nunca ha ejercido la posesión sobre los terrenos sin inscribir del suscrito. 4- Que en virtud de la posesión ejercida por el suscrito, en forma personal y por la derivada de mis transmitentes se ordene la inscripción en el Registro Público, de los terrenos aquí reclamados, a mi nombre. 5- Que la posesión ejercida por el suscrito es de buena fe y además de ello ha sido materializada mediante actos de producción de la tierra. 6- Que el demandado no ha ejercido ningún acto de posesión o producción sobre los terrenos que me pertenecen. 7- Que la pretendida posesión del demandado es de mala fe. 8- Se condene al demandado al pago de las costas procesales y personales de esta acción", (folios 5 al 8).
  2. 2La parte demandada contestó la acción incoada en su contra en los términos que corren de folios 31 al 35, e interpuso las excepciones de falta de: derecho, legitimación, así como la excepción genérica sine actione agit.
  3. 3El licenciado Wilberth Álvarez Lí, juez de primera instancia en resolución de las once horas del veintinueve de abril del dos mil cinco, resolvió: "POR TANTO: De conformidad con lo expuesto, jurisprudencia y normativa citada, se acoge la excepción de falta de derecho, y en cuanto a la falta de legitimación y la genérica de sine actione, por innecesario se omite pronunciamiento sobre ellas. En consecuencia se declara sin lugar en todos sus extremos la demanda ordinaria agraria establecida por [Nombre1] contra [Nombre2] . Se condena a la parte actora al pago de ambas costas de esta acción", (folios 300 al 312).
  4. 4La parte actora formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, folios 313 al 318.
  5. 5En la substanciación del proceso se han observado las prescripciones legales, sin notarse la existencia de errores u omisiones capaces de producir la nulidad del fallo.

Redacta el juez Darcia Carranza; y,

CONSIDERANDO:

I.El Tribunal prohija los hechos tenidos por probados al ser fiel reflejo de lo acaecido en autos. De dicha naturaleza téngase el siguiente: 4.- Mediante escritura pública otorgada ante el notario público [Nombre6] a las ocho horas del veintiuno de noviembre de mil novecientos noventa y seis, el señor [Nombre5] le vende una finca sin inscribir con una medida de cien hectáreas cuatro mil seiscientos cincuenta y seis metros con cincuenta y cuatro decímetros cuadrados, identificada con el plano catastrado Nº P-111049-93, ubicada en Puerto jiménez, de Golfito de la Provincia de Puntarenas, lindante al norte con [Nombre7] , [Nombre8] , Chimpol S.A.; al sur con [Nombre1] , [Nombre9] , [Dirección1] frente a ésta; al este con [Nombre10] y al oeste con [Nombre1] trasladándole, al señor [Nombre4] una posesión de más de sesenta años (ver folio 107 del legajo de prueba del actor). 5) Por escritura pública otorgada ante el notario público Olman Castro Madrigal a las nueve horas del veintinueve de noviembre de mil novecientos noventa y nueve, [Nombre4] traspasa a [Nombre9] la finca sin inscribir identificada en el plano catastrado Nº P- 111049-93, que él había adquirido de [Nombre5] (ver folio 109 del legajo de prueba del actor). 6) La señora [Nombre9] inició trámites de diligencias de información posesoria seguida en el expediente EXPN1, en fecha 21 de noviembre de 2000 (ver folio 105 a 130 del legajo de pruebas del actor). 7.

Mediante escritura ciento treinta y siete otorgada en el tomo cuarto del protocolo de la notario público Marcela Rodríguez Chaves, folio 100, la señora [Nombre9] cedió los derechos de la información posesoria al señor [Nombre1] , la cual fue aceptada por el Juzgado Agrario de origen por resolución de las nueve horas treinta minutos del 3 de diciembre de 2002 (ver folios 243 y 246 del principal). 8. La escritura mediante la cual el señor [Nombre5] vende el terreno descrito en el plano catastrado P-111049- 93, a [Nombre2] (hoy [Nombre2] ), el cual es objeto de discusión fue suscrita en fecha 24 de abril de 1997, por lo que fue posterior a la escritura mediante la cual le había transmitido el mismo bien al señor [Nombre4] (ver folios 107, del legajo de prueba del actor y 25 del principal). 9).- El terreno objeto de litigio se encuentra dentro de la Reserva Forestal Golfo Dulce creada mediante decreto ejecutivo Nº 8494-A de 28 de abril de 1978 (folio 74).

II. No se comparten los hechos tenidos por no probados al considerarse el a quo confunde la acción planteada

III.La apoderada especial judicial de la parte actora, licenciada Marcela Rodríguez Chaves interpuso recurso de apelación contra la sentencia dictada por el Juzgado de origen con fundamento en lo siguiente.

  • 1)Indica el recurrente, la sentencia omitió analizar la totalidad de la situación fáctica y probatoria constante en autos, por lo que la misma es el resultado de un análisis parcial lo que conlleva a una conclusión errada en el fallo.
  • 2)Dice, en el hecho probado uno se afirma que es el demandado quien ha estado trabajando y poseyendo el fundo, sin embargo ello carece de un análisis lógico jurídico, que lo fundamente y también adolece de un análisis probatorio de los antecedentes fácticos de la posesión. Al iniciarse este proceso se ofreció como prueba dos expedientes que constaban en el mismo despacho, el número EXPN1 y el EXPN2, prueba que nunca fue analizada, valorada, ni mencionada por el a quo. Mediante dicha prueba se logra establecer que su representado adquirió, el derecho aquí alegado mediante una cesión de derechos litigiosos en un trámite de información posesoria, y se demuestra también se trata de un terreno sin inscribir, de ahí que el hecho cuarto sobre el fondo del asunto, en el cual el a quo analiza la legitimación activa y justifica las razones para determinar, que su representado adolece de legitimación activa, al decir que en ningún momento ostenta la calidad de propietario registral, carece de todo sentido. Aduce que el a quo ni siquiera leyó el libelo de demanda en cuyo hecho primero se indica claramente que la legitimación de su representado deviene de una cesión de derechos litigiosos dada en el expediente EXPN1.
  • 3)En cuanto al hecho tenido por no demostrado el a quo indica no se demostró que su representado ejerciera algún tipo de acto posesorio y por otra parte se dice tampoco demostró ser el propietario del fundo. Ambos hechos, si se hubiere tenido la totalidad de la prueba evacuada se tendrían por demostrados, pues la declaración de la cedente de los derechos no fue analizada en un todo, como en derecho corresponde y ésta fue clara en señalar que ha sufrido amenazas del actor para que no se apersone al fundo en litigio y por otra parte, no podría su representado demostrar la propiedad de un inmueble sin inscribir, más que con los documentos que constan en autos, pues no podría pretender una inscripción registral como parece indicarlo el fallo.
  • 4)la prueba no fue analizada en su conjunto como lo ordenan los principios procesales, pues el juzgador de instancia lo único que hace es copiar expresiones aisladas de los testigos, omitiendo con ello analizar la totalidad de cada declaración e interrelacionarla con el resto de prueba; a saber, la documental y el acta de reconocimiento judicial.
  • 5)Alega, no fue tomado en cuenta que la transmitente de su representado adquirió mediante escritura pública número 119 visible a folio 75 del tomo primero del protocolo del notario público Olman Castro Madrigal, otorgada a las 9 horas del 29 de noviembre de 1999, por compra hecha al señor [Nombre4] , quien había adquirido del poseedor anterior [Nombre5] , mediante escritura número 19 del tomo 13 del notario Jeremías Vargas Chavarría otorgada a las 8 horas del 21 de noviembre de 1996. Alude, que con la prueba testimonial se acreditó que el señor [Nombre5] , no solo, era la persona que ejercía de manera directa la posesión sobre el fundo en disputa, sino, también, que su voluntad siempre fue que dicha posesión le fuera entregada a su transmitente, [Nombre9] .
  • 6)La parte demandada presenta como base de este proceso una escritura otorgada ante el notario público Adolfo Rojas Breedy, de fecha 24 de abril de 1997, mediante la cual [Nombre5] le transmite los derechos posesorios, sin embargo ya para esa fecha el no era el dueño del fundo al haberle traspasado con anterioridad los derechos posesorios a [Nombre4] , por lo que éste no podía traspasar algo que ya no le pertenecía. Tal escritura no ha sido rescindida para justificar el título que exhibe el demandado, situación que ni siquiera fue objeto de análisis por parte del a quo.
  • 7)El a quo indica que la explotación agraria está amparada por la legislación como fundamento para proteger al poseedor del propietario, tal posesión debe cumplir con una serie de requisitos entre ellos el de ser pacífica y de buena fe. También dice, debe tenerse claro que mientras don [Nombre5] vivía, los actos de posesión que pudo ejercer el demandado eran por mera tolerancia de éste, en virtud de su relación de parentesco con el poseedor directo, pues éste era quien ejercía la verdadera posesión, pues a pesar de sus actos notariales Don [Nombre5] hasta su fallecimiento mantuvo la posesión y fue a partir de dicho momento que el aquí demandado le impidió a doña [Nombre9] el ejercicio del derecho de posesión que hoy se reclama, todo lo cual no ha sido objeto de valoración por el juez.
  • 8)Indica, hay un elemento que resulta fundamental en este proceso y es el hecho que doña [Nombre9] , quien era la esposa de Don [Nombre5] ejerció de manera directa y conjunta, por años la posesión sobre los terrenos aquí reclamados, por lo que además de título legal, ella había tenido el título real, cual es el ejercicio de actividades productivas en el fundo en litigio.
  • 9)Dice, resultan fundamentales los testimonios recabados en el sentido de que la explotación agrícola del bien se ha hecho en la misma área en la que lo hizo don [Nombre5] y en segundo lugar la declaración rendida por el mismo demandado quien indicó de manera clara y precisa que no había tenido problemas con otros poseedores por que no habían ido a la finca, a contrario sensu se puede deducir que si llegaran tendría problemas tal y como lo indicó la señora [Nombre9] quien ha sido amedrentada por el demandado.
  • 10)La prueba testimonial otorga elementos de juicio que resultan interesantes, pues los testigos son contestes en indicar que el demandado, laboraba en la finca cuando don [Nombre5] era dueño (declaración de [Nombre11] ) y aún más claro al señalar "debo aclarar que cuando yo veía a los hijos de don [Nombre5] que iban a trabajar a la finca yo consideraba que don [Nombre5] era el dueño de ella y yo nunca supe cuando don [Nombre5] dejo de ser el dueño de esa finca". Indica el apelante. queda aún más claro en cuanto a la posesión consentida del demandado y no como dueño lo dicho por [Nombre12] , deponente ofrecido por el demandado en cuanto a que quien ha poseído la finca lo ha sido don [Nombre5] y posteriormente que quien la ha trabajado a sido [Nombre13] , por lo que se denota que el demandado y sus hermanos han trabajado el fundo ejerciendo actos posesorios que no eran propios ni a título de dueños, sino como consecuencia lógica de la relación de parentesco y que han prorrogado a través del tiempo mediante la intimidación a los verdaderos dueños del fundo. Aduce incluso que si el testimonio de [Nombre12] hubiese sido analizado íntegramente se habría dado cuenta el juez de que el mismo resulta contradictorio pues también indicó: que el no sabía quien trabajaba la finca cuando era de don [Nombre5], que no sabía si sus hijos trabajaban en ese entonces con él, pero al final de su deposición ante una repregunta dijo: Que el conoció una carta - venta, mediante la cual [Nombre2] adquirió el fundo, el día del juicio pasado refiriéndose a la inspección realizada en mayo del año pasado (2004), lo cual hace concluir que dicho deponente en ningún momento tiene referencia anterior a mayo del 2004, como para establecer en que momento el señor [Nombre5] dejó de ejercer la posesión, quien a la postre se la transmitió a la cesionaria del aquí actor. 8) El actor en su deposición fue claro al indicar que no iba a la finca, por que gente conocida del pueblo le ha dicho que los hijos de don [Nombre5] lo van a machetear o a tirar, lo cual coincide también con los demás testimonios en cuanto a si bien es cierto el demandado es solo uno de los hijos de don [Nombre5], está acreditado que quien pasa más tiempo en los terrenos es otro hermano. 9) El fallo tampoco analiza el reconocimiento judicial de fecha 1 de abril del 2004, en el cual se determina de manera clara y precisa que la finca es básicamente de bosque primario y secundario con una pequeña cabaña de madera la cual tiene muchos años de construida, y los pocos árboles que se encuentran a su alrededor tienen también años de sembrados, lo que acredita de manera irrefutable que no existe un ejercicio real y actual de una empresa agraria, lo cual implica la posesión le fue trasmitida por sus verdaderos sucesores y no ha existido más explotación de áreas que las que ellos hicieron originalmente. Dice hay que tener en consideración el fundo mide un millón cuatro mil seiscientos cincuenta y seis metros con cuatro decímetros cuadrados y tal y como se desprende del reconocimientos judicial los siembros ni son a gran escala ni son recientes, lo que viene a eliminar el elemento principal de legitimación en materia agraria cual es el uso de la tierra, el cual ha sido desvirtuado por la prueba objetiva incorporada al proceso y no analizada por el a quo. Dice, hay dos aspectos que resultan trascendentales para resolver este caso, el primero referido a la legitimidad de la posesión que ejerce el demandado y el segundo, respecto al efectivo ejercicio de la producción agrícola, aspectos en los cuales el juzgador de instancia fue absolutamente omiso, al dictar el fallo (folios 313 a 324).

IV.El demandado ataca el fallo básicamente en cuanto a la falta de valoración de la prueba documental primordial referida a las escrituras de traspaso del bien por el anterior poseedor antes de traspasárselo al aquí demandado, prueba no valorada ni analizada, pues se trataba de una doble venta cuando ya el señor [Nombre5] ya no era dueño del inmueble, también critica la falta de valoración y análisis de otras pruebas constantes en autos como lo son el reconocimiento judicial y la testimonial. Alega también se tiene por no demostrado que fuera el propietario del fundo cuando no se podría hablar de propiedad registral al ser un fundo sin inscribir.

V.En cuanto a los alegatos que hace el recurrente respecto a la que el a quo no valoró la prueba documental constante en autos referente a la venta anterior que había hecho el señor [Nombre5] al señor [Nombre4] , lleva razón la recurrente, pues se nota la carencia de análisis de tal prueba por parte del juzgador de instancia. Considera importante este Tribunal hacer una relación concatenada de lo sucedido en este caso. Mediante escritura pública otorgada ante el notario público Jeremías Vargas Chavarría a las ocho horas del veintiuno de noviembre de mil novecientos noventa y seis, el señor [Nombre5] le vende su finca sin inscribir con una medida de cien hectáreas cuatro mil seiscientos cincuenta y seis metros con cincuenta y cuatro decímetros cuadrados, identificada con el plano catastrado Nº P-111049-93, ubicada en Puerto Jiménez de Golfito de la Provincia de Puntarenas, lindante al norte con [Nombre7] , [Nombre8] , Chimpol S.A.; al sur con [Nombre1] , [Nombre9] , [Dirección1] frente a ésta; al este con [Nombre10] y al oeste con [Nombre1] , al señor [Nombre4] , trasladándole una posesión de más de sesenta años (ver folio 107 del legajo de prueba del actor).

Por escritura pública otorgada ante el notario público Olman Castro Madrigal a las nueve horas del veintinueve de noviembre de mil novecientos noventa y nueve, [Nombre4] traspasa a [Nombre9] la finca sin inscribir identificada en el plano catastrado Nº P- 111049-93, que él había adquirido de [Nombre5] (ver folio 109 del legajo de prueba del actor). La señora [Nombre9] inició trámites de diligencias de información posesoria seguida en el expediente EXPN1, en fecha 21 de noviembre de 2000 (ver folio 105 a 130 del legajo de pruebas del actor). Mediante escritura ciento treinta y siete otorgada en el tomo cuarto del protocolo de la notario público Marcela Rodríguez Chaves, folio 100, la señora [Nombre9] cedió los derechos de la información posesoria al señor [Nombre1] , la cual fue aceptada por el Juzgado Agrario de origen por resolución de las nueve horas treinta minutos del 3 de diciembre de 2002 (ver folios 243 y 246 del principal).

La escritura mediante la cual el señor [Nombre5] vende el terreno descrito en el plano catastrado P-111049-93, a [Nombre2] (hoy [Nombre2] ), el cual es objeto de discusión fue suscrita en fecha 24 de abril de 1997, por lo que fue posterior a la escritura mediante la cual le había transmitido el mismo bien al señor [Nombre4] (ver folios 107, del legajo de prueba del actor y 25 del principal). Partiendo de ello es claro que cuando el señor [Nombre5] le vende al aquí demandado, ya dicho fundo no le pertenecía al haberlo transmitido prácticamente un año antes, es decir no estaba en capacidad de vender al no ser el dueño del terreno en dicho momento pues se trata de cosa ajena. Partiendo de lo anteriormente expuesto resulta claro que la escritura pública número ciento diecinueve visible al folio 75 del tomo primero del protocolo del notario público Olman Castro Madrigal mediante la cual [Nombre5] le vende el fundo objeto de este proceso en fecha de las nueve horas del veintiuno de noviembre de mil novecientos noventa y seis al señor [Nombre4] es anterior por lo que cualquier otro traspaso no fue en el carácter de dueño.

Al respecto, dispone el numeral 1061 del Código Civil: “La venta de cosa ajena es absolutamente nula; pero el comprador que ignora el vicio del contrato, tiene derecho a los daños y perjuicios aun contra el vendedor de buena fe”; y refiriéndose a ello, el artículo 1063 del mismo cuerpo normativo establece: “La nulidad de la venta de cosa ajena, queda salvada si el verdadero propietario ratifica la enajenación, o si el vendedor llega a ser ulteriormente propietario de la cosa vendida”. De acuerdo a lo anterior, la venta hecha por [Nombre5] a [Nombre2] estaría viciada de nulidad a menos que el vendedor hubiera adquirido nuevamente la condición de propietario o que el propietario ratificara dicha venta. Ninguno de esos supuestos se dan en este caso. En primer término, [Nombre5] no volvió a ser dueño del inmueble; y en segundo lugar, existen pruebas suficientes en el proceso como para concluir, [Nombre1] no ha ratificado en ningún momento la aludida enajenación.

Al contrario, consta en autos, luego de que [Nombre5] le vendió a [Nombre4] éste le traspasa el inmueble en disputa a la señora [Nombre9] por escritura pública otorgada ante el notario público Olman Castro Madrigal a las nueve horas del veintinueve de noviembre de mil novecientos noventa y nueve (ver folio 109 de legajo de prueba del actor) y esta inició trámites de diligencias de información posesoria seguida en el expediente EXPN1, en fecha 21 de noviembre de 2000 (ver folio 105 a 130 del legajo de pruebas del actor), y mediante escritura ciento treinta y siete otorgada en el tomo cuarto del protocolo de la notario público Marcela Rodríguez Chaves, folio 100, la señora [Nombre9] cedió los derechos de la información posesoria al señor [Nombre1] , la cual fue aceptada por el Juzgado Agrario de origen por resolución de las nueve horas treinta minutos del 3 de diciembre de 2002 (ver folios 243 y 246 del principal).

Todas estas escritura tienen la validez correspondiente al haber adquirido de la sucesión de dueños anteriores, hasta llegar al señor [Nombre5] como dueño anterior. De acuerdo a lo expuesto, no se está en presencia de los supuestos señalados por el numeral 1063 transcrito, manteniendo la venta mediante la cual adquirió el señor [Nombre2] vicios de nulidad.Independientemente al análisis anterior respecto a una doble venta ello no quiere decir el bien le pertenezca a la parte aquí actora, pues es importante hacer un análisis jurídico de los terrenos en disputa pues se encuentran dentro de un área silvestre protegida creada desde junio de mil novecientos setenta y ocho y como se verá más adelante la posesión inicial sobre esos terrenos por parte del primer poseedor lo fue desde el año mil novecientos ochenta y dos según la prueba contante en autos. Hay que tener presente lo dicho por la Procuraduría General de la República en cuanto a que el bien objeto de litigio se encuentra ubicado en la Reserva Forestal Golfo Dulce creada por decreto Ejecutivo Nº 8494-A de 28 de abril de 1978 (folio 74), por lo que no puede ser susceptible de apropiación particular sino se demuestra una posesión decenal diez años antes de su creación según lo estipula el ordinal 7 de la Ley de Informaciones Posesorias, al ser parte del dominio público al pertenecer al Patrimonio Natural del Estado..

Según los planos que identifican el inmueble en disputa el mismo se localiza dentro de la Reserva Forestal Golfo Dulce y así lo indica la certificación del Ministerio del Ambiente y Energía (ver folios 4 y folio 5 del legajo de prueba del actor y folio 92 del principal). De la prueba documental y testimonial existente en el expediente se logra determinar una posesión aproximada desde el año mil novecientos setenta y ocho, pues el señor [Nombre11] indicó el conoce la finca desde hace unos veintidós años, pues el fue poseedor de la misma. Este señor es claro en indicar lo siguiente: " Tengo de conocer la finca en litis hace veintidós años, incluso esa finca fue mía, cuando eran tierras baldías, después de mi el señor [Nombre14] fue el dueño, luego se la vendió a don [Nombre5]..." (ver folio 66 frente) y siendo que su declaración lo fue el 14 de setiembre de 2004, ello retrotrae a una posesión desde el año 1982, cuando ya se había hecho la declaratoria de la Reserva Forestal, pues la misma data desde 28 de abril de 1978.

Los demás testigos conocen el inmueble en disputa en fechas posteriores a la indicada por el deponente citado, al indicar [Nombre12] que lo conoce desde hace quince años, [Nombre9] desde el año mil novecientos noventa y dos (ver folios 65, 66), por lo que para efectos de demostrar una posesión decenal anterior al 28 de abril de 1978, carecen de validez. Considera este Tribunal importante hacer un recuento histórico de las diferentes leyes que indican la demanialidad de los terrenos inmersos dentro de las áreas silvestres protegidas.

VI.En nuestro país la titulación de terrenos que se encuentran ubicados en áreas silvestres protegidas se ha venido permitiendo teniendo como fundamento el artículo 7 de la Ley de Informaciones Posesorias, el cual ha sido reformado a lo largo del tiempo en varias oportunidades. En los primeros treinta y tres años de vigencia de la ley, el texto de la norma no guardaba relación con la materia que actualmente regula, a saber, la posesión ad usucapionem de bienes inmuebles que quedan comprendidos en áreas silvestres protegidas. Al respecto, se tiene que por Ley No.5257 de 31 de julio de 1973, el artículo 7 de la Ley de Informaciones Posesorias sufrió una reforma, y su texto decía: “Artículo 7.- Cuando el inmueble a que se refiere la información contenga un área de bosque de la mitad o más de su extensión, habrá necesidad de probar la debida adquisición, con documento público con más de diez años de otorgado.

A la información posesoria, de acuerdo con este artículo, deberá aportarse, en todo caso, constancia de la Dirección General Forestal, de que el terreno no forma parte de las reservas o parques nacionales.” El texto anterior fue reformado por la Ley Forestal No.7032 de 2 de mayo de 1986, y la disposición impugnada quedó de la siguiente manera: “Artículo 7.- Cuando el inmueble a que se refiere la información esté comprendido dentro de una zona declarada parque nacional, reserva biológica, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre. Las fincas que estén fuera de esas áreas y que tengan bosques, solo podrán ser tituladas si el promovente demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles limpios.

Los planos catastrados que se aporten en diligencias de información posesoria, sin excepción alguna, deberán ser certificados por la Dirección General Forestal y el Servicio de Parques Nacionales del Ministerio de Agricultura y Ganadería, dependencias que darán fe de si el inmueble que se pretende titular se encuentra dentro o fuera de esas áreas protegidas.” El texto de la norma antes citado se mantuvo con la reforma que introdujo la Ley Forestal No.7174 del 28 de junio de 1990, a la Ley de Informaciones Posesorias, variándose únicamente el Ministerio al que estaba adscrito el Servicio de Parques Nacionales, que pasó a pertenecer al Ministerio de Recursos Naturales, Energía y Minas. El texto de dicha norma decía: “Artículo 7.- Cuando el inmueble a que se refiere la información esté comprendido dentro de una zona declarada parque nacional, reserva biológica, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre.

Las fincas que estén fuera de esas áreas y que tengan bosques, solo podrán ser tituladas si el promovente demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles limpios. Los planos catastrados que se aporten en diligencias de información posesoria, sin excepción alguna, deberán ser certificados por la Dirección General Forestal y el Servicio de Parques Nacionales del Ministerio de Recursos Naturales, Energía y Minas, dependencias que darán fe de si el inmueble que se pretende titular se encuentra dentro o fuera de esas áreas protegidas." Actualmente, por la reforma efectuada por la Ley Forestal No.7575 de 13 de febrero de 1996, el texto vigente de la Ley de Informaciones Posesorias dice: “Artículo 7.-Cuando el inmueble al que se refiere la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre.

Las fincas ubicadas fuera de esas áreas y que tengan bosques, sólo podrán ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios. Sin excepción alguna, los planos catastrados que se aporten en diligencias de información posesoria, deberán ser certificados por el Ministerio del Ambiente y Energía, por medio del ente encargado, el cual dará fe de si el inmueble que se pretende titular se encuentra dentro o fuera de esas áreas silvestres protegidas.” Partiendo de lo anterior en los casos en los cuales el terreno esté comprendido dentro de un área silvestre protegida, debe cumplirse con un requisito más calificado en cuanto al ejercicio y tiempo de la posesión. En dicho sentido se ha pronunciado el Tribunal Agrario: “…De acuerdo con lo dispuesto en el artículo 7 de la Ley de Informaciones Posesorias, de aplicación al caso por encontrarse el inmueble a titular dentro de la Zona Protectora …, para poder inscribir dicho bien en el Registro Público, es preciso el gestionante demuestre haber estado en posesión del inmueble por lo menos diez años antes de la vigencia del Decreto que creó la citada Reserva, así como haber protegido el recurso forestal”(voto Nº170-03 de las 16:24 horas del 31 de marzo del 2003.

Ver también al respecto el voto Nº755- 03 citado). Lo anterior se exige en protección del patrimonio forestal del Estado y la biodiversidad, sin afectarse por ello los derechos que efectivamente los sujetos privados hubiesen consolidado por el transcurso del tiempo (ver al respecto el voto Nº497 de las 15:20 horas del 30 de julio del 2003 del Tribunal). En ese sentido, la Sala Constitucional en Voto N° 4587 de las 15:45 horas del 5 de agosto de 1997, en el cual analizó la constitucionalidad del artículo 7 citado, dispuso para poder titular los terrenos ubicados en las zonas protegidas que ahí se señalan, debía el interesado demostrar la posesión diez años antes de la vigencia del Decreto respectivo. Básicamente dijo la Sala en esa oportunidad: "… dada la naturaleza del bien que se pretende titular (cosa pública), el plazo de posesión apta para la usucapión debe transcurrir antes de que se produzca la afectación del bien al dominio público.

Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley… resulta importante sintetizar los elementos básicos que a nivel de doctrina y jurisprudencia se manejan con estos temas, y que obligan al juez – en relación con la norma impugnada- a determinar en cada caso el tipo específico de acto posesorio que se ha ejercido en el fundo – que entra a formar parte del área silvestre protegida- que se pretende titular. Lo anterior con el objeto de que el juez tenga un criterio más amplio – que no se limite a la fecha de entrada en vigencia de la ley o el decreto ejecutivo que defina los límites de un área silvestre determinada- para establecer con mayor precisión el momento en que dichos bienes se convirtieron en inalienables e imprescriptibles, a los efectos de determinar si sobre ellos se ejerció la posesión ad usucapionem durante diez años anteriores a que adquirieron esa condición.

Esta perspectiva de mayor amplitud favorece la protección del patrimonio ambiental de la Nación, determina que cuando se pretenda titular – mediante el procedimiento de informaciones posesorias- un terreno ubicado dentro de un área silvestre protegida, la discusión no se reduzca al simple cálculo del tiempo que tiene de haber ingresado a un inmueble en relación con la fecha en que se haya producido la declaratoria de área silvestre protegida, ya que -por un lado deberá contemplarse a los efectos de acreditar la posesión ad usucapionem durante el plazo establecido en el artículo 7 de la Ley de Informaciones Posesorias, los elementos que cada tipo específico de posesión contempla, y –por otro lado- la posible existencia de normas que de antaño declaraban inalienables esos terrenos, aún antes de su afectación específica al dominio público… ". De lo dicho por la Sala Constitucional se se logra extraer una serie de conclusiones importantes, ya que además de la posesión decenal antes de la creación del área silvestre protegida, debe demostrar haber protegido el recurso existente en los terrenos objeto de titulación.

Además, en dicho voto se indica el juzgador ha de ser cuidadoso en la aprobación de las diligencias de titulación de terrenos al amparo del artículo 7 de la Ley de Informaciones posesorias, por lo que deberá revisar en cada caso concreto si los terrenos no han sido afectos al dominio público por alguna ley anterior a la creación de la zona protegida. En este caso particular es claro la posesión fue primeramente ejercida por el señor [Nombre11] , según el mismo lo indicó al declarar la finca fue de él cuando eran tierras baldías, y tomando en cuenta su declaración fue rendida el 14 de setiembre del 2004, retrotrayéndose en el tiempo 22 años atrás de su declaración, nos ubica temporalmente en el año 1982, por lo que se estaría discutiendo sobre terrenos que fueron afectos al demanio público desde antes de esa fecha al estar comprendidos dentro de la Reserva Forestal Golfo Dulce creada por decreto Ejecutivo Nº 8494-A de 28 de abril de 1978.

Respecto a los bienes demaniales, ellos no pueden ser susceptibles de apropiación particular al estar fuera del comercio de los hombres. Sobre el régimen de dominio público se hace necesario previamente, definir lo que es el dominio público. Es el conjunto de bienes propiedad pública del Estado, lato sensu, afectados al uso público directo o indirecto, de los habitantes, y sometido a un régimen especial de derecho público y, por tanto, exorbitante del derecho privado. El dominio público se encuentra conformado por cuatro elementos: subjetivo, objetivo, normativo y teleológico. El elemento subjetivo se refiere al titular del derecho -El Estado-; el elemento objetivo se refiere o se constituye por el bien o los bienes sobre los cuales recae el dominio público -para este caso el inmueble objeto de litigio- ; el elemento normativo determina cuando un bien reúne los requisitos señalados por ley para considerarlo demanial, es el conjunto de normas que lo rigen -elenco de normas que en adelante se dirán-; y el elemento teleológico que se refiere a la finalidad que se persigue al incluir determinado bien dentro del dominio público, qué finalidad pública es asignada al bien -en este caso la protección de los recursos naturales-.

Los bienes de dominio público están sometidos a un régimen jurídico especial, se encuentran sujetos a un poder de policía, y se caracterizan esencialmente por su inalienabilidad e imprescriptibilidad. Por su naturaleza están dirigidos a satisfacer necesidades públicas, este hecho impide que sobre ellos exista tenencia o posesión por parte de particulares o personas privadas, están fuera del comercio, del derecho privado. Nuestra Constitución Política en su artículo 121 inciso 14) hace referencia a la Demanialidad indicando qué bienes son susceptibles de ese régimen de propiedad pública, incluso estableciéndose en ese artículo diferentes grados de afectación pública dándose un grado de publicatio intenso y absoluto hasta otros grados menos intenso y se armonizan los derechos de los administrados con las potestades de la Administración. Nuestro Código Civil vigente que data desde el mes de abril de mil ochocientos ochenta y seis, regula las bases más importantes en materia de bienes de dominio público, concretamente en sus artículos 261 al 263.

El artículo 262 del citado Código Civil, hace referencia a dos características importantes de los bienes de dominio público: a- las cosas públicas están fuera del comercio, y b- se establece la desafectación al decir que esos bienes no pueden entrar en el comercio privado, mientras legalmente no se disponga así. Como puede observarse la afectación al régimen de dominio público no depende de la naturaleza del bien, sino de la voluntad del legislador. Mediante voto número 447-91 de las quince horas treinta minutos del 21 de febrero de 1991 la Sala Constitucional manifiesta que la declaración de dominio público del bien se establece por ley, esta declaración no constituye una limitación a la propiedad, de acuerdo con el artículo 45 de la Carta Magna, pues éste artículo se refiere a propiedad privada, y los bienes de dominio público no están sujetos a propiedad privada. En este sentido la Sala Constitucional ha dicho, respecto a este tipo de bienes “ El dominio público se encuentra integrado por bienes que manifiestan, por voluntad expresa del legislador, un destino especial de servir a la Comunidad, al interés público.

Son los llamados bienes dominicales, bienes demaniales, bienes o cosas públicas o bienes públicos, que no pertenecen individualmente a los particulares y que están destinados a un uso público y sometidos a un régimen especial, fuera del comercio de los hombres, es decir, afectados por su propia naturaleza y vocación. En consecuencia, esos bienes pertenecen al Estado en el sentido más amplio del concepto, están afectados al servicio que prestan y que invariablemente es esencial en virtud de norma expresa. Notas características de estos bienes, es que son inalienables, no pueden hipotecarse ni ser susceptibles de gravamen en los términos del Derecho Civil y la acción administrativa sustituye a los interdictos para recuperar el dominio.” (Voto N° 2306 de las catorce horas cuarenta y cinco minutos del seis de noviembre de mil novecientos noventa y uno de la Sala Constitucional). Con fundamento en el análisis realizado de todo el elemento probatorio considera este Tribunal los terrenos en disputa son bienes de dominio público no sujetos de apropiación particular, por lo que el objeto de este litigio respecto a ventas y dobles ventas del mismo resulta ilícito desde esta perspectiva, por ser un bien afecto a la demanialidad.

Es importante tener presente también conforme al reconocimiento judicial practicado, el fundo en litigio está compuesto en su mayoría por montaña o bosque(ver folio 49), lo que implica se trata de un bien destinado a la conservación dentro de la Reserva Forestal Golfo Dulce, el cual fue el objetivo de la declaratoria como área silvestre protegida en el año de mil novecientos setenta y ocho. En relación a un caso similar al de estudio donde se discutía sobre un mejor derecho de posesión en terrenos comprendidos dentro de la Reserva Forestal Golfo Dulce, la Sala Primera de la Corte Suprema de Justicia mediante voto Nº 56 de las 14 horas del 5 de febrero de 1999 señaló: " CONSIDERANDO: I.- En el presente proceso ordinario agrario, se discute la existencia de un mejor derecho de posesión sobre terrenos sin inscribir ubicados en la Reserva Forestal de Golfo Dulce. La sociedad Osa Ganadera S. A., demandada y reconventora en este juicio, inconforme con la desestimación de su contrademanda, formula el presente recurso.

Lo sustenta en estas tres afirmaciones: a) Que su posesión, adicionada a la de los transmitentes del inmueble, se remonta al año 1969, lo que implica 28 años de tenencia del bien que debieron ser tutelados por los juzgadores; b) Que ha realizado varios actos, de ejercicio de la posesión, implicando una gran inversión económica y; c) Que el terreno en litigio no se encuentra sometido al régimen forestal debido a que esto no es posible por no estar inscrito en el Registro, lo que también impide la existencia de un plan de manejo o explotación aprobado por la Dirección General Forestal. Concluye, en consideración a lo anterior que no procede exigir una posesión ecológica en los términos que lo propone el Tribunal, y por ende, sus actos posesorios son válidos eficaces y deben ser tutelados. II.- Frente al recurso de casación en materia agraria, esta Sala ha sido reiterativa en punto a la obligación a cargo del recurrente de combatir, en forma sistemáticamente y técnica los argumentos jurídicos del juzgador, cuanto las apreciaciones de hecho aducidas para inclinar la decisión.

La censura debe hacerse explicando, con razones claras y precisas el disenso para concluir señalando en qué consiste la presunta falta de juridicidad de la sentencia objetada, de ser posible, puntualizando los supuestos errores cometidos por el Tribunal Superior. De allí que las apreciaciones de orden general o carente de soporte probatorio no pueden constituir una censura idónea en esta sede. III.- Precisamente, en el recurso, la censurante no se preocupa por desvirtuar las consideraciones del Tribunal Superior. Se limita a realizar apreciaciones de carácter general sobre el tema del proceso que poco o nada se relacionan con los fundamentos del fallo. Esto valga decirlo, bien puede resumirse así: a) Que el inmueble en conflicto es parte del Patrimonio Forestal del Estado desde 1978, por lo que el área reclamada es propiedad pública, y por ende, imprescriptible e inalienable; b) Que no se demostró el ejercicio de una posesión ecológica al menos desde abril de 1968; c) Que la tala en áreas boscosas (aproximadamente 100 hectáreas) no se corresponde con la posesión exigida por ley sobre este tipo de terrenos se trata.

A partir de lo anterior, sostienen los juzgadores, que la actividad desplegada sobre los terrenos objeto de litigio no es idónea y por lo mismo no podría ésta hacer nacer ningún derecho a favor de la sociedad contraventora. El recurso en estudio no es por lo mismo consecuente con los requerimientos técnicos elementales exigidos para estimar una censura en materia agraria, pues en él se refuta la sentencia del Ad quem utilizando argumentos con los que en realidad no se combaten los motivos que dieron cimento a la decisión recurrida. Tampoco se censura debidamente los juramentos jurídicos que aduce el juzgador para dirimir el caso. Por consiguiente, el recurso resulta bastante informal y esto sólo justificaría su rechazo. IV.- No obstante, conviene destacar que la casacionista insiste en el reconocimiento judicial de actos posesorios ordinarios sobre un bien que pertenece al patrimonio forestal del Estado.

Pasa por alto, que los juzgadores fueron claros en aseverar la imprescriptibilidad e inalienabilidad de los terrenos pretendidos, a partir del fuero otorgado a ellos con la vigencia de los Decretos Ejecutivos Nos. 8494-A de 28 de abril de 1978, 9388-A de 30 de noviembre de ese mismo año y, 10142 de 12 de junio de 1979. Como consecuencia de estos actos administrativos argumentó el Tribunal, esas propiedades pasaron a integrar la Reserva Forestal de Golfo Dulce. Esta Sala comparte ese aserto. Si bien con esta acotación: La cualidad de propiedad pública esos referidos bienes no surgió en el año 1978. Esta, proviene del Código Fiscal de 1865. Esta regulación, en efecto regía sobre los baldíos nacionales con bosques y montañas, y de allí su condición de bienes públicos desde aquella época. Posteriormente, esas disposiciones fueron derogadas por la Ley General sobre Terrenos Baldíos Nº 13 de 6 de enero de 1939; pero la normativa emergente mantuvo también la condición de propiedad pública para esos terrenos.

Luego, con la promulgación de la Ley Nº 2825 de 14 de octubre de 1961, pasaron a ser reservas nacionales del Estado los terrenos " a) ... comprendidos entre los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autónomas; b) Los que no estén amparados por la posesión decenal; c) Los que, por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas; y d) En general todos los que, no siendo de propiedad particular, no estén ocupados en servicios públicos." (artículo 11, el subrayado no pertenece al original). Esto dice que esas tierras continuaron integrando la propiedad pública del Estado costarricense. Más tarde, la Ley Forestal Nº 4465 de 25 de noviembre de 1969 introdujo en nuestro ordenamiento jurídico la figura denominada Patrimonio Forestal del Estado, que de conformidad con el artículo 18 de aquella normativa, estaba constituido por: Reservas Nacionales, Reservas Forestales, Parques Nacionales, Viveros Forestales del Estado, Zonas Protectoras y Reservas Biológicas, con lo cual esa zona asumió un interés forestal.

Finalmente, las zonas en litigio fueron declarados reservas forestales, a través de los decretos citados supra, manteniendo la condición de bienes imprescriptibles e inalienables por constituir terrenos públicos del Estado (Sobre el desarrollo de la protección estatal al patrimonio histórico, esta Sala profundizó su análisis en el voto Nº 51 de 15:15 horas del 26 de mayo de 1995). En consecuencia, las condiciones de imprescriptibilidad e inalienabilidad, así como la protección forestal son anteriores a los decretos citados por el Tribunal Superior. Pese a esto, lo que aquí se expone no cambia lo decidido sino que más bien lo reafirma. V.- No está de más agregar, que incluso en la hipótesis de la naturaleza pública de los fundos hubiese surgido en abril de 1978 -con la incorporación en la reserva forestal de Golfo Dulce-, la casacionista debió siempre demostrar la posesión decenal de los inmuebles a esa fecha, utilizando para ello no sólo su tenencia sobre ellos, sino también adicionando la ejercida por los anteriores transmitentes.

Así lo exigió el Tribunal. En el recurso se alega -sin justificación, pues quedó demostrado que la tenencia se realiza a partir de 1971-, una posesión desde 1969. Tal reclamo, independientemente del aspecto probatorio, que puede ser objeto de cuestionamiento, resulta ineficaz para modificar el fallo impugnado; esto por cuanto el requisito decenal de la actividad posesoria tampoco habría sido satisfecho, asumiendo como ciertos los argumentos de la recurrente. VI.- Por último, reclama la contrademandate que a los terrenos litigiosos no se les aplica el régimen forestal y por ende, no es necesario que la posesión sea de carácter ecológico. Para sustentar su alegato refiérese, de manera imprecisa, al mecanismo de aprovechamiento forestal que estipulaban los numerales 63 y siguientes de la Ley Forestal 1969. Sin embargo, esas normas sólo eran aplicables a los bosques privados cuyo propietario pretendiera explotarlos, porque tratándose de terreno sin dueño, el régimen forestal se imponía en forma inmediata por imperativo legal.

El argumento es así deleznable y deben sin más desestimarse. VII.- Con base en las razones expuestas, es de rigor desestimar el recurso interpuesto y confirmar la sentencia impugnada. POR TANTO Se confirma el fallo recurrido …". Por todo lo anteriormente expuesto se hace necesario confirmar lo resuelto pero por los motivos dados en esta instancia.

POR TANTO

Por los motivos dados en esta instancia se confirma la sentencia dictada.
