Ordinary proceeding (proceso ordinario) brought before the Civil Court of Heredia by Nombre210238 against Nombre210239. Both are of legal age, married, homemakers, and residents of Heredia.
RESULTS 1°.- Based on the facts she set forth and the legal provisions she cited, the plaintiff filed an ordinary complaint, the amount in controversy being set at cinco millones de colones, seeking a judgment declaring: “1- That the defendant has large trees planted on her property AT A DISTANCE OF LESS THAN 5 METERS from the boundary line with the plaintiff’s property. 2- That, pursuant to Article 403 of the CIVIL CODE, the defendant be ordered, within tres meses after the judgment becomes final, to remove all trees located less than 5 meters from the boundary line with my property. She must fell them and extract their roots. 3- That the felling of said trees and extraction of their roots must be carried out within the stated period without causing damage to neighboring properties. 4- That, if the defendant fails to comply with the order within the tres meses period, the plaintiff be authorized to fell said trees and extract their roots AT THE DEFENDANT’S EXPENSE.
For this purpose, the plaintiff shall be authorized to hire labor and specialized machinery, and the defendant must endure any inconvenience this may cause her, including possible damage such as the demolition of the wall or entrance enclosure through which the machinery must enter. The defendant must likewise tolerate all rubble, branches, roots, and trunks that may remain on her property as a result of the felling of the trees. 5- That the defendant be ordered to pay both categories of costs (ambas costas) of this action.” 2°.- The defendant denied the complaint and raised the defenses (excepciones) of failure to state a legal right, lack of standing on the part of both plaintiff and defendant, and lack of a current interest, as well as the defense of acquisitive prescription (prescripción positiva).
3°.- Judge Ricardo Chacón Cuadra, in judgment no. 173-R-2005 issued at 15 horas 50 minutos on 14 de junio del 2005, ruled: “Pursuant to Articles 1, 3, 5, 9, 99, 121, 155, 221 and 287 of the Code of Civil Procedure, as well as Articles 403 and 1045 of the Civil Code, the Court rules as follows: The defenses of Failure to State a Legal Right, Lack of Standing on the Part of Both Plaintiff and Defendant, and Lack of a Current Interest, as well as the defense of acquisitive prescription, are dismissed as unfounded. This ordinary complaint brought by Nombre210238 against Nombre210239 is granted. It is declared: 1. That the defendant has large trees planted on her property AT A DISTANCE OF LESS THAN 5 METERS from the boundary line with the plaintiff’s property. 2. That, pursuant to Article 403 of the CIVIL CODE, the defendant is ordered, within tres meses after the judgment becomes final, to remove all trees located less than 5 meters from the boundary line with the plaintiff’s property.
She must fell them and extract their roots. 3. That the felling of said trees and extraction of their roots must be carried out within the stated period without causing damage to neighboring properties. 4. If the defendant fails to comply with the order within the tres meses period, the plaintiff is authorized to fell said trees and extract their roots at the defendant’s expense [sic]. In that event, the plaintiff must take every possible precaution and measure to avoid causing such damage. Attorney’s fees and court costs (costas personales y procesales) are imposed on the defendant.” 4°.- The defendant appealed, and the Superior Civil Court of Heredia, composed of Judges Roberto J. Tánchez Bustamante, Carmen María Blanco Meléndez, and Henry Madrigal Cordero, in judgment no. 171-02-2005 issued at 8 horas 30 minutos on 27 de julio del 2005, held: “In accordance with the foregoing considerations, the defense of extinctive prescription (prescripción negativa) raised at this stage is denied, and the trial court’s judgment is AFFIRMED in all respects.” 5°.- The defendant files an appeal on points of law (recurso de casación por el fondo). She alleges violations of Articles (290), 264, 265, 290, 403, 404, 851, 865, 866, 867, 868, all of the Civil Code; 45 of the Political Constitution; and 19, 20, 21, 28, 29 and 31 of the Ley Forestal.
6°.- The statutory requirements have been observed throughout the proceedings. Substitute Justices Nombre5180 and Margoth Rojas Pérez participate in the decision of this matter.
Justice León Feoli delivers the opinion
CONSIDERING
I.Nombre210238, the plaintiff in this proceeding, owns the property registered in the Heredia Registry District under record Placa39826, which adjoins on the west the property recorded under real-property folio n° 116228-000. The latter belonged to her sister, Nombre210239, who, in 1987, planted a group of 37 Australian pine trees between 40 and 50 centímetros from the boundary line separating the two properties. At present, those trees have an average height of 17.05 metros and a diameter at breast height of 34 centímetros, are spaced 1.5 metros apart, and have shallow roots extending into the plaintiff’s lot. The same is true of their branches, which extend as much as tres metros beyond the property line. The trees have the potential to develop greater height, diameter, and root systems. Cracks and ruptures can be seen at approximately cinco locations on Nombre210238’s property, running along a concrete base.
There is also a vehicle-entry concrete slab over which pine branches extend for a distance ranging from 1.50 to 4 metros, at an approximate height of 8 to 15 metros. In that area there is a wall approximately 25 or 30 metros long, consisting of a metal-frame structure set in concrete bases and clad with enameled zinc sheets that had to be modified during construction because the tree roots prevented their placement in the intended locations. The front gutter of doña Nombre210238’s home, located where the Australian pine trees overhang, becomes clogged and, when water flows through it, overflows into the living room. For this reason, it has had to be replaced and fitted with mesh, but it continues to retain moisture and debris from the branches. In this litigation, she essentially seeks a declaration that doña Nombre210239 must cut down the trees because they do not maintain the distance required by law and cause damage to her property.
The defendant opposed the claim and raised the defenses of failure to state a legal right, lack of standing on the part of both plaintiff and defendant, and lack of a current interest. She subsequently invoked acquisitive prescription. At the trial level, all defenses were denied. Señora Nombre210239 was ordered, within tres meses after the judgment became final, to remove all trees located less than cinco metros from the boundary line by felling them and extracting their roots, without causing damage to the neighboring parcels (fundos). If she failed to do so, the plaintiff was authorized to perform the work at the defendant’s expense, and the defendant would also be required to endure any resulting damage and inconvenience. Dissatisfied with the ruling, doña Nombre210239 appealed and invoked extinctive prescription. The Court affirmed the ruling and rejected the defense raised at that stage.
II.The defendant appeals to this Chamber. She brings an appeal in cassation (casación) on substantive grounds, based on four arguments. First. She alleges infringement of Articles 851, 865, 866, 867, and 868 of the Civil Code. She states that the planted trees are more than 17 years old and that, therefore, the plaintiff is not entitled to request their removal. Accordingly, she contends that there is neither active nor passive standing (legitimación activa y pasiva), that no current interest exists, and that the claim is time-barred (prescrito). She argues that the judgment must be vacated because the judges at both levels failed to analyze the defenses raised. She states that the established facts show that the trees were planted more than 17 years ago and that, therefore, the ten-year period for filing the claim had expired. She asserts that the failure to so declare violates Article 868 of the Civil Code.
She states that, because of the family relationship between the adjoining landowners (colindantes), there was always consent and tolerance, evidencing a tacit waiver of prescription (renuncia tácita a la prescripción) under Article 851 thereof. She maintains that, had those rules been applied, the defenses of lack of active and passive standing and lack of a current right and interest would have been well-founded, because the plaintiff’s right had already expired through the passage of time and she lacked grounds to support her claims. She adds that the Tribunal’s judgment, before which she raised and explained the defense of extinctive prescription (prescripción negativa), disregards the fact that the relief sought concerns trees planted more than 17 years ago. Second. She asserts that Article 403 of the Civil Code was violated, which, she states, restricts an owner from planting trees within a certain distance of the boundary line (línea divisoria).
However, if the adjoining landowner does not assert that right and instead acquiesces in the situation for years, the provision does not require the forcible removal of trees planted by the owner’s own hand. She argues that this also violates the principles of private property embodied in Article 45 of the Political Constitution, Articles “264 (290) and 265” of the Civil Code, and constitutional and civil case law. She maintains that the first provision was applied incorrectly because the private-property system was interpreted restrictively and contrary to national circumstances, since nearly all owners have planted trees near a shared boundary (colindancia). She states that the judgment could become a “scandalous” precedent, generating a needless series of disputes among owners of adjoining parcels over an issue on which there is no case-law ruling as radical and severe as the one challenged here.
She reiterates that, although the cited Article 403 prohibits planting within a certain distance of the property boundary (lindero), thereby constituting a restriction on the right of ownership under the Civil Code—or a limitation, according to one school of legal scholarship—it does not provide for the removal ordered in the judgment. That order constitutes a requirement not contemplated by the legal system (Ordenamiento) and, moreover, interprets private property restrictively to the detriment of the owner and expansively in favor of the adjoining landowner. She objects that the removal order has a “twofold coercive effect”: it grants her a period of 3 months to carry it out, failing which entry onto her property is authorized so that the trees may be removed at her expense. Instead, she argues, Article 404 thereof should have been applied, as it provides for the pruning (poda) of branches and roots, a rule consistent with the “entire property-ownership system, with reality, with causing less harm to the owner, and with the principle that limitations must be construed restrictively.” She states that those provisions date back to Roman and Napoleonic law and are found in “all codes,” except that the national code established a greater distance than that prescribed in other countries.
Accordingly, she adds, her argument is not novel. She notes that, under Article 45 of the Constitution, limitations on private property may be imposed only by a qualified majority of two-thirds of the Legislative Assembly, pursuant to Article 195 of that text. In that regard, she asserts that because Article 403 of the Civil Code predates the Constitution, it must be interpreted consistently with the property-ownership regime and not in contravention of it. She adds that the case law of the competent Chamber holds that limitations on private property may not override the owner’s right, because doing so would render that right ineffective and nonexistent. She continues that the challenged judgment violated Articles 264, 265, and 290 of the aforementioned body of law because it restricts her right, protecting the adjoining landowner to the detriment of the owner, even though the trees were planted more than 17 years ago, and improperly interprets the cited Article 403, which is also contrary to the “property-ownership system.” Third.
She states that Article 404 of the Civil Code was not applied, even though it authorizes the owner of an adjoining parcel (fundo contiguo) to demand that the branches and roots of trees planted near the boundary line be cut, under a “more peaceable provision consistent with Constitutional Article 45 and Articles 264 and 265 of the Civil Code.” She alleges that, by failing to apply it, the judges at both levels erred by basing their decisions on Article 403 thereof, which was improperly applied. She maintains that once the trees have been planted and more than enough time has elapsed for that limitation on property to prescribe “ab initio,” it is transformed into an obligation incumbent upon the owner of the trees to cut any branches and roots extending onto another’s parcel. She asserts that this is consistent with the “property-ownership system,” because the position adopted by the judges at both levels leaves the owner unprotected.
She reiterates several arguments presented in the preceding objection. She insists that, once the trees have been planted, their removal is not warranted because, in her opinion, it is a violent alternative that conflicts with other principles of the same legal system, unless it has been proven, under the principle of causation (principio de causalidad) set forth in Article 704 of the Civil Code, that there is a high risk to persons or property, in accordance with the case law governing summary proceedings for removal of a dangerous structure or object (interdicto de derribo) under Article 474 of the Code of Civil Procedure. Fourth. She alleges infringement of Articles 19, 20, 21, 28, 29, and 31 of the Ley Forestal and the principles developed from them in case law, because the destruction of all trees located along the shared boundary was ordered, constituting an unlawful act that is impossible to perform, since that legislation establishes an administrative procedure for felling them and requires a prior proceeding before the competent department of the Ministry of the Environment; furthermore, under those rules, she continues, the land use (uso del suelo) may not be changed.
She adds that those plant species could be utilized only if a management plan (plan de manejo) containing an environmental impact study (estudio de impacto ambiental) is submitted, and that felling (corta) is authorized under the supervision of a forestry supervisor (regente forestal), whose involvement was not contemplated in the challenged judgment. She further states that the trees at issue in the dispute are not exempt from the felling permit (permiso de corta) requirement and that the judgment disregards the administrative procedure that must be followed in order to proceed in that manner.
III.The first three grounds of appeal (agravios) are interrelated, since they assert, in order, the lapse of the plaintiff’s right due to the passage of time without exercising it, the absence of any provision authorizing the felling of Australian pine species, and that the rule applicable to the dispute is the one governing the pruning of roots and branches. On this point, it is essential to determine the particular features of the alleged violation and its connection to the expiration of the right to seek relief, through allowing the period required for the limitation period (prescripción) to elapse. Article 403 of the Civil Code establishes, as a limitation on ownership (limitación a la propiedad), that large tree species may not be planted within five meters of the boundary line of another property, or within two meters in the case of shrubs. The provision demonstrates the three-dimensional nature of real property, which encompasses not only the surface but also what lies below and above it.
Its purpose is to prevent inconvenience to the owners of adjoining properties in any of those dimensions, or damage to their property. For that reason, an injury or risk of impairment need not exist for judicial relief (tutela jurisdiccional) to be appropriate because, as the judges at both levels held, it would be sufficient for the tree to have been planted at a distance shorter than permitted for the right to request its removal to arise. Moreover, the effects resulting from the violation of this provision are not exhausted by the act of planting. What is planted does not retain its diameter, height, and length; rather, all of those measurements change over time, and the likelihood that it will encroach upon adjoining properties increases proportionally. Thus, in the present case, the consequences of what the provision seeks to prevent occur continuously, thereby renewing the affected party’s right to request corrective action in order to prevent harm or danger to persons or their property; in any event, as was established in the record and is not challenged at this stage, such harm has already occurred due to the consequences that the branches and roots of the pine trees have caused to the plaintiff’s property.
The foregoing is supported by the statement of Mr. Nombre36174, transcribed in the trial court judgment. Contrary to the appellant’s contention, it is through this interpretation that protection of the property right enshrined in the Political Constitution is achieved, by allowing the adjoining owner to freely enjoy what belongs to her, without unnecessary inconvenience or risks arising from circumstances beyond her control. As explained, that right is continuously renewed for as long as the tree remains planted at a distance shorter than permitted; therefore, the right to seek judicial protection is not subject to a limitation period. This does not pose a risk or danger to the “property system,” but instead seeks effective compliance with obligations between neighboring landowners (obligaciones de vecindad) in circumstances such as those described, so as to preserve intact the powers exercised by the owner over the affected parcel in light of the planting of the trees at a distance shorter than permitted.
For this reason, Article 404 of the Civil Code must be interpreted together with the preceding article; that is, the pruning of branches and roots applies to large specimens that, despite being planted more than five meters from the boundary, extend beneath or above the adjoining property. The appellant’s proposition that the plaintiff’s sole authority is limited to requesting the cutting of those extensions is inadmissible, because it would lead to a legal violation of obligations between neighboring landowners that would place the appellant above the rights of the owner of the adjoining parcel. Ownership of the trees cannot be allowed to become vested when they were planted in contravention of the statutory provision, conduct that continues to have repercussions in this case. Accordingly, no limitation on private property is being created through case law; rather, an existing limitation contained in the legal system is being enforced.
The felling of the trees is merely the logical and direct consequence of the right being protected. If that course were not followed, the result would be an abstract declaration without any real and effective consequence through which its enforcement could be accomplished. This principle, moreover, is contemplated in Article 696 of the Code of Civil Procedure, since the judgment entails an affirmative obligation (obligación de hacer), for which a reasonable period was granted, on the understanding that if the order is not complied with, the plaintiff is authorized to carry it out at the obligated party’s expense. Only in this manner can matters be restored to the condition in which they stood before the injury. Failure to comply with a statutory prohibition that confers a subjective right (derecho subjetivo) to bring a claim, under Article 41 of the Magna Carta, requires restoring matters to their prior condition, that is, to the condition existing before the planting. Consequently, the alleged statutory violations did not occur, and the claims raised must therefore be rejected.
IV.The appellant’s objections based on the Ley Forestal and her concern regarding the consequences of failing to follow the procedure established for cutting trees lack any factual basis. It must be borne in mind that, in this case, a judicial order founded on the violation of a rule of equal rank must be complied with. Moreover, the alleged conflict of laws does not exist, since the procedure she mentions applies only to trees on forest-covered land (Articles 19 and 3(d) of the Ley Forestal), which, according to Article 3(d) thereof, consists of a “native or indigenous ecosystem, whether disturbed or not, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares,” whereas the present dispute concerns the destruction of 37 pine trees. Article 28 of that statute establishes that specimens planted individually do not require the aforementioned permit. Therefore, the violation she alleges is not present in the judgment under appeal, which merely orders compliance with the law. Consequently, for the reasons stated, the appeal must be denied. Costs shall be borne by the party who filed it. (Article 611 of the Code of Civil Procedure).

The appeal is denied, with costs to be borne by the moving party.

Proceso ordinario establecido en el Juzgado Civil de Heredia por Nombre210238 contra Nombre210239 . Ambas mayores de edad, casadas, amas de casa y vecinas de Heredia.
RESULTANDO
1°.- Con base en los hechos que expuso y disposiciones legales que citó, la actora estableció demanda ordinaria, cuya cuantía se fijó en la suma de cinco millones de colones, a fin de que en sentencia se declare: "1- Que la demandada tiene plantados arboles (sic) grandes en su propiedad CON UNA DISTANCIA INFERIOR A 5 METROS de la línea limítrofe con la propiedad de la actora. 2- Que en razón a lo dispuesto en el artículo 403 del CODIGO CIVIL se ordene a la demandada, que en el plazo de tres meses a partir de la firmeza de la sentencia, deberá eliminar todos los árboles que estén a menos de 5 metros de la línea limítrofe con mi propiedad. Deberá derribar los mismos, y extraer sus raíces. 3- Que el derribo de dichos árboles y la extracción de sus raíces, deberá hacerlo en el plazo indicado, sin ocasionar daños a las propiedades vecinas. 4- Que en caso de que la demandada no cumpliere con lo ordenado dentro del plazo de tres meses, se autoriza a la actora para que haga el derribo de dichos árboles y extraiga sus raíces, BAJO COSTO DE LA DEMANDADA.
Para lo cual queda la actora autorizada para que contrate la mano de obra y maquinaria especializada, debiendo la demandada soportar las molestias que ello le provoque, y hasta posibles daños como derribo del muro o tapia de entrada, por donde deberá ingresar la maquinaria. Asimismo deberá soportar la demandada todos los escombros, ramas, raíces y troncos, que puedan quedar dentro de su propiedad a raíz del derribo de los árboles. 5- Que se condene a la demandada al pago de ambas costas de esta acción." 2°.- La demandada contestó negativamente y opuso las excepciones de falta de derecho, falta de legitimación activa y pasiva, y falta de interés actual, así como la excepción de prescripción positiva.
3°.- El Juez Ricardo Chacón Cuadra, en sentencia no. 173-R-2005 de las 15 horas 50 minutos del 14 de junio del 2005, resolvió: “De conformidad con lo dispuesto por el artículo 1, 3, 5, 9, 99, 121, 155, 221 y 287 del Código Procesal Civil, así como los artículos 403 y 1045 del Código Civil, se resuelve: Se rechazan por improcedentes las excepciones de Falta de Derecho, Falta de Legitimación Activa y Pasiva, y Falta de Interés Actual, así como la excepción de prescripción positiva. Se declara con lugar esta demanda ordinaria establecida por Nombre210238 contra Nombre210239 . Se declara: 1. Que la demandada tiene plantados árboles grandes en su propiedad CON UNA DISTANCIA INFERIOR A 5 METROS de la línea limítrofe con la propiedad de la actora. 2. Que en razón a lo dispuesto en el artículo 403 del CODIGO CIVIL se ordena a la demandada, que en el plazo de tres meses a partir de la firmeza de la sentencia, deberá eliminar todos los árboles que estén a menos de 5 metros de la línea limítrofe con la propiedad de la actora.
Deberá derribar los mismos, y extraer sus raíces. 3. Que el derribo de dichos árboles y la extracción de sus raíces, deberá hacerlo en el plazo indicado, sin ocasionar daños a las propiedades vecinas. 4. En caso de que la demandada no cumpliere con lo ordenado dentro del plazo de tres meses, se autoriza a la actora para que haga el derribo de dichos árboles y extraiga sus raíces, bajo costo de la demandado (sic). Para lo cual queda la actora autorizada para que contrate la mano de obra y maquinaria especializada, debiendo la demandada soportar las molestias que ello le provoque. Asimismo deberá soportar la demandada todos los escombros, ramas, raíces y troncos, que puedan quedar dentro de su propiedad a raíz del derribo de los árboles. En cuanto a que la demandada soporte los posibles daños como derribo del muro o tapia de entrada, por donde deberá ingresar la maquinaria se rechaza por improcedente a la luz de lo resuelto.
En tal caso deberá tomar la actora todas las precauciones y medidas posibles para evitar producirlos. Se imponen las costas personales y procesales a cargo de la parte demandada.” 4°.- La demandada apeló y el Tribunal Superior Civil de Heredia integrado por los Jueces Roberto J. Tánchez Bustamante, Carmen María Blanco Meléndez y Henry Madrigal Cordero, en sentencia no. 171-02-2005 de las 8 horas 30 minutos del 27 de julio del 2005, dispuso: “De conformidad con lo considerado, se declara sin lugar la excepción de prescripción negativa interpuesta en esta instancia; y se CONFIRMA en todos sus extremos la sentencia de primera instancia.” 5°.- La demandada formula recurso de casación por el fondo. Alega violación de los artículos (290), 264, 265, 290, 403, 404, 851, 865, 866, 867, 868 todos del Código Civil; 45 de la Constitución Política; 19, 20, 21, 28, 29 y 31 de la Ley Forestal.
6°.- En los procedimientos se han observado las prescripciones legales. Intervienen en la decisión de este asunto las Magistradas Suplentes Nombre5180 y Margoth Rojas Pérez.

CONSIDERANDO
I.Nombre210238 , actora en este proceso, es propietaria del inmueble del Partido de Heredia, matrícula Placa39826, que colinda por el rumbo oeste con el inscrito al folio real n° 116228-000, el cual perteneció a su hermana, Nombre210239 , quien en 1987, sembró un conjunto de 37 árboles de pino australiano que distan entre 40 y 50 centímetros de la línea divisoria de ambas propiedades. En la actualidad, esas especies tienen un promedio de 17.05 metros de alto y 34 centímetros de diámetro a la altura del pecho, con una distancia de 1.5 metros y con raíces superficiales que sobrepasan hacia el lote de la demandante. Lo mismo ocurre con sus ramas, que superan el lindero hasta por tres metros. Los árboles tienen potencial de desarrollar mayor altura, diámetro y sistema radicular. En el inmueble de la señora Nombre210238 se observan grietas y reventaduras en alrededor de cinco sitios que corren a lo largo de una base de cemento.
También, existe un planché de entrada de vehículos sobre el que se extienden ramas de pino en una distancia que oscila entre 1.50 y 4 metros, a una altura aproximada de 8 y 15 metros. En esa zona se encuentra una tapia de unos 25 o 30 metros de longitud, con estructura de perling fundada en bases de concreto, forradas con láminas de zinc esmaltado que debieron modificarse durante su construcción, pues las raíces de los árboles impedían colocarlas en los lugares en que habían sido dispuestos. La canoa frontal de la vivienda de doña Nombre210238, ubicada en el sitio en que se sobrepasan los ejemplares de pino australiano, se bloquea y con el flujo de agua se rebalsa y penetra hacia la sala, motivo por el cual ha debido cambiarse y colocarle cedazo, pero soporta humedad y basura de las ramas. En el presente litigio solicita, en lo esencial, se declare que doña Nombre210239 debe cortar los árboles, porque no guardan la distancia establecida por ley y causan daños a su propiedad.
La demandada se opuso y formuló las excepciones de falta de derecho, falta de legitimación activa y pasiva, y falta de interés actual. Posteriormente, invocó la de prescripción positiva. En primera instancia todas las defensas fueron denegadas. Se ordenó a la señora Nombre210239 que en el plazo de tres meses a partir de la firmeza de la sentencia, eliminara todos los árboles ubicados a menos de cinco metros de la línea limítrofe, derribándolos y extrayendo sus raíces, sin ocasionar daños a los fundos vecinos. En caso de no hacerlo, se autorizó a la actora a ejecutarlo con los gastos a cargo de la demandada, quien deberá además, soportar los posibles daños e inconvenientes que se ocasionen. Disconforme con lo decidido, doña Nombre210239 apeló e invocó la prescripción negativa. El Tribunal confirmó lo resuelto y rechazó la defensa argüida en esa sede.
II.La demandada recurre ante esta Sala. Formula casación por razones de fondo que fundamenta en cuatro motivos. Primero. Recrimina conculcados los ordinales 851, 865, 866, 867 y 868 del Código Civil. Los árboles sembrados, expone, tienen más de 17 años, por lo que la actora no tiene derecho para pedir su derribo. Por ello, estima, tampoco existe legitimación activa y pasiva, no hay interés actual y el reclamo está prescrito. La sentencia, alega, debe anularse, pues los jueces de ambas instancias no analizaron las excepciones interpuestas. En los hechos probados, manifiesta, se constata que los árboles se plantaron hace más de 17 años, por lo que expiró el plazo decenal para que se formulara la demanda. Al no declararse de ese modo, asegura, se violenta el artículo 868 del Código Civil. Por existir vínculo familiar entre las colindantes, refiere, siempre hubo consentimiento y tolerancia, de ahí que se evidencia una renuncia tácita a la prescripción, derivada del numeral 851 ibídem.
De haberse aplicado esas reglas, sostiene, resultaban procedentes las excepciones de falta de legitimación activa y pasiva, de derecho e interés actual, porque el derecho de la actora ya había expirado por el transcurso del tiempo y carecía de fundamento para sustentar sus reclamos. La sentencia del Tribunal, agrega, ante quien interpuso y explicó la prescripción negativa, ignora que lo peticionado, versa sobre unos árboles que se sembraron hace más de 17 años. Segundo. Se transgredió el artículo 403 del Código Civil que, afirma, limita al propietario a sembrar árboles a cierta distancia de la línea divisoria. Pero, si ese derecho no se reclama por el colindante, consintiendo por años la situación, no impone el derribo coactivo de lo sembrado por propia mano del titular. Con ello, aduce, también se violan los principios de la propiedad privada, contenidos en el ordinal 45 de la Constitución Política, y los artículos “264 (290) y 265” del Código Civil y la jurisprudencia constitucional y civil.
La primera norma, sostiene, fue aplicada erróneamente al interpretarse el sistema de propiedad privada de manera restringida y en contravención con la realidad nacional, porque casi todos los dueños han plantado árboles cerca de la colindancia. La sentencia, manifiesta, podría ser un precedente “escandalizante”, que generaría una serie innecesaria de luchas entre titulares de fundos contiguos, sobre un punto en el cual no existe pronunciamiento jurisprudencial tan radical y severo como el que se combate. Si bien, reitera, el artículo 403 citado impide sembrar a cierta distancia del lindero, lo cual constituye un límite al derecho de propiedad según el Código Civil, o una limitación siguiendo a un sector de la doctrina, no regula el derribo que fue ordenado en sentencia. Ello constituye una imposición no prevista por el Ordenamiento, que además interpreta de modo restrictivo la propiedad privada, en perjuicio del titular y en forma ampliativa para el colindante.
El derribo, censura, tiene una “doble modalidad de imperio”: le otorga un plazo de 3 meses para hacerlo por que de lo contrario, autoriza el ingreso a su propiedad para eliminarlos a su costa. En su lugar, estima, debió aplicarse el numeral 404 ibídem que contempla la poda de las ramas y raíces, regla que resulta armónica con el “entero sistema propietario, con la realidad, con el daño menor al propietario y porque las limitaciones deben ser analizadas en forma restrictiva”. Esas disposiciones, refiere, datan del derecho romano y napoleónico y se encuentran en “todos los códigos”, con la salvedad de que en el nacional, se estableció una distancia mayor a la de otros países. Por eso, añade, su planteamiento no es original. De conformidad con el artículo 45 constitucional, advierte, sólo pueden imponerse limitaciones a la propiedad privada si existe mayoría calificada de las dos terceras partes de la Asamblea Legislativa, al tenor de lo dispuesto en el canon 195 de ese texto.
En ese sentido, asegura, como el ordinal 403 del Código Civil es anterior a la Constitución, ha de interpretarse de conformidad con el régimen de propiedad y no contrariándolo. La jurisprudencia de la Sala competente, añade, sostiene que las limitaciones a la propiedad privada no pueden sobrepasar el derecho del titular porque lo harían nugatorio e inexistente. El fallo recurrido, continúa, violentó los numerales 264, 265 y 290 del cuerpo normativo mencionado, por cuanto restringe su derecho, protegiendo al colindante en perjuicio del propietario, aún cuando los árboles fueron sembrados hace más de 17 años, e interpreta en forma indebida el precepto 403 citado, lo cual, además, es contrario al “sistema propietario”. Tercera. Resultó inaplicado, dice, el artículo 404 del Código Civil, que autoriza al titular del fundo contiguo a exigir que se corten las ramas y raíces de los árboles sembrados cerca de la línea divisoria, en una “normativa más pacífica, acorde con el 45 Constitucional, 264 y 265 del Código Civil.”.
Al no actuarlo, los jueces de ambas instancias, acusa, han incurrido en error fundamentando lo decidido en el canon 403 ibídem que se aplicó de manera indebida. Una vez plantados los árboles, sostiene, y transcurrido de sobra el plazo necesario para que prescriba esa limitación a la propiedad “ab initio” , se transforma en una obligación por cuenta del dueño de los árboles, de cortar las ramas y raíces que se pasan al fundo ajeno. Esto último, asevera, resulta acorde con el “sistema propietario”, pues la tesis prohijada por los juzgadores de ambas instancias desprotege al titular. Reitera varios argumentos expuestos en la censura anterior. Luego de sembrados, insiste, no procede el derribo, que es, en su opinión, una alternativa violenta y antagónica con otros principios del mismo Ordenamiento, salvo que se hubiere probado, por el principio de causalidad previsto en el canon 704 del Código Civil, que hay un alto riesgo para las personas o las cosas, siguiendo la jurisprudencia del interdicto de derribo derivada del artículo 474 del Código Procesal Civil.
Cuarta. Fueron conculcados, recrimina, los ordinales 19, 20, 21, 28, 29 y 31 de la Ley Forestal y sus principios desarrollados jurisprudencialmente, porque se ordena la destrucción de todos los árboles ubicados en la colindancia, en un acto ilícito e imposible de realizar, en tanto esa normativa prevé un procedimiento administrativo para cortarlos, exigiendo un trámite previo ante el departamento competente del Ministerio del Ambiente, y de conformidad con esas reglas, continúa, no se puede mudar el uso del suelo. Esas especies vegetales, agrega, sólo podrían utilizarse si se presenta un plan de manejo que contenga un estudio de impacto ambiental, y la corta se autoriza bajo el control de un regente forestal cuyo concurso no fue previsto en el fallo combatido. Los árboles objeto de la controversia, añade, no están exentos del permiso de corta y la sentencia obvia el procedimiento administrativo que debe cumplirse para proceder de esa manera.
III.Los tres primeros agravios se relacionan entre sí, pues se invoca, por su orden, el decaimiento del derecho de la actora por el transcurso del tiempo sin ejercitarlo, la ausencia de norma que faculte el derribo de las especies de pino australiano y que la regla aplicable a la controversia es la que regula la poda de raíces y ramas. En este punto, es indispensable determinar las particularidades de la infracción reclamada y el ligamen que tiene con el fenecimiento del derecho a solicitar tutela, por dejar pasar el tiempo indispensable para que prescriba. El artículo 403 del Código Civil establece como limitación a la propiedad, la imposibilidad de sembrar árboles de especies grandes a menos de cinco metros de la línea divisoria de la heredad ajena, o de dos metros tratándose de arbustos. La norma evidencia el carácter tridimensional de la propiedad inmobiliaria, que abarca, además de la superficie, lo que se encuentra por debajo y por encima de ella.
Su fin es evitar que se produzcan incomodidades a los titulares de los inmuebles colindantes en cualquiera de esas dimensiones o daños a sus bienes. Por tal motivo, no es indispensable que la lesión o el peligro de menoscabo exista para que la tutela jurisdiccional sea procedente, pues como fue señalado por los juzgadores de ambas instancias, bastaría con que el árbol fuere plantado a una distancia inferior a la permitida, para que surja el derecho a solicitar su retiro. Por otra parte, los efectos que produce la infracción de esta norma no se agotan en el acto de sembrar. Lo plantado no mantiene su diámetro, altitud y longitud, sino que todas esas medidas varían con el paso del tiempo y las posibilidades de que invadan las heredades contiguas se acrecientan proporcionalmente. De este modo, en el presente caso, las consecuencias de lo que se procura evitar se verifican de manera constante, por lo que se renueva el derecho del afectado a peticionar su corrección, en aras de evitar un daño o peligro en las personas o sus bienes, lo que en todo caso, conforme se acreditó en autos y en esta instancia no se combate, ya ocurrió, debido a las consecuencias que en la propiedad de la actora han ocasionado las ramas y raíces de los pinos.
Sirva de apoyo a lo expuesto, lo dicho por don Nombre36174 y transcrito en el fallo de primera instancia. Contrario a lo que afirma la recurrente, es con esta interpretación que se alcanza la tutela del derecho de propiedad consagrado en la Constitución Política, al permitir a la colindante, el libre disfrute de lo que le pertenece, sin inconvenientes y riesgos innecesarios originados en situaciones ajenas a su voluntad. Ese derecho, según fue expuesto, se renueva en forma permanente en tanto el árbol siga plantado a una distancia inferior a la permitida, por lo que no es susceptible de prescribir el derecho a pedir el amparo jurisdiccional. Esto no supone un riesgo o peligro para el “sistema propietario”, sino que busca la efectiva observancia de las obligaciones de vecindad en supuestos como el descrito, con el fin de dejar incólumes las facultades que sobre el fundo afectado ejerce su titular por la siembra de los árboles a menor distancia de la permitida.
Es por esta razón que el artículo 404 del Código Civil debe interpretarse en conjunto con el anterior, es decir, la poda de ramas y raíces aplica para los ejemplares de gran tamaño, los cuales, no obstante estar plantados a más de cinco metros de la divisoria, se prolongan bajo o sobre la propiedad contigua. Es inadmisible la propuesta de la recurrente en el sentido de que la única facultad de la actora se constriñe a solicitar la corta de sus extensiones, pues ello conduciría a una infracción legal de las obligaciones de vecindad, que la colocaría por encima de los derechos de la propietaria del fundo colindante. No puede pretenderse que se consolide el dominio sobre los árboles, si fueron plantados al margen de la previsión legal, conducta que en este caso, continúa teniendo repercusiones. De ahí, que no se esté creando una limitación a la propiedad privada a nivel jurisprudencial, sino que se efectiviza una ya contenida en el Ordenamiento.
El derribo de los árboles no es sino consecuencia lógica y directa del derecho que se ampara. De no procederse de esa manera, se estaría ante una declaratoria en abstracto, sin ningún efecto real y efectivo que concretice su ejecución. Este principio, por demás, está contemplando en el artículo 696 del Código Procesal Civil, dado que la condena, se traduce en una obligación de hacer, para la cual se otorgó un plazo razonable, en el entendido de que si no se procede de conformidad con los ordenado, se autoriza a la actora para que lo haga a costa de la obligada. Solo así, se pueden restituir las cosas al estado en que se encontraban antes de la lesión. La inobservancia de una prohibición legal que otorgue el derecho subjetivo de reclamar, bajo el influjo del artículo 41 de la Carta Magna, supone restaurar las cosas a la condición anterior, esto es, antes de la siembra. Consecuentemente, no se han dado las violaciones legales invocadas, por lo que procede desestimar los cargos planteados.
IV.Los reparos que formula la recurrente basándose en la Ley Forestal y el temor ante las consecuencias de la inobservancia del procedimiento establecido para la corta de árboles, carecen de sustento real. No debe perderse de vista que en este caso, ha de cumplirse con una orden jurisdiccional que se funda en la infracción a una regla de igual rango. Amén de lo anterior, el conflicto normativo, en tanto el trámite que menciona, aplica sólo para árboles en terrenos cubiertos de bosque (artículos 19 y 3 inciso d) de la Ley Forestal), que consiste, según el inciso d) del artículo 3) ibídem, en un “Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas” y aquí se debate la destrucción de 37 árboles de pino. El ordinal 28 de ese cuerpo normativo establece que los ejemplares sembrados individualmente no requieren del referido permiso. Por ello, el quebranto que acusa no se constata en el fallo venido en alzada, que no hace sino disponer que se cumpla con lo que señala la ley. En consecuencia, por los motivos señalados, el recurso debe desestimarse. Las costas correrán a cargo de quien lo interpuso. (artículo 611 del Código Procesal Civil).
POR TANTO
Se declara sin lugar el recurso, con las costas a cargo de la promovente.
