Judgment enforcement proceeding (proceso de ejecución de sentencia) handled before the Administrative and Treasury Civil Court (Juzgado de lo Contencioso Administrativo y Civil de Hacienda), brought by JULIE ROOS AYUB, holder of national identity card (cédula de identidad) number 1-600-955, resident of Ciruelas, in her personal capacity and as President of the ASOCIACIÓN CONSERVACIONISTA DE LOS RÍOS Y EL AMBIENTE DE CIRUELAS DE ALAJUELA (ACORACI), corporate registration number (cédula jurídica) 3-002-298374, and JOSÉ LUIS MADRIGAL MOYA, retiree, identity card 1-233-345, resident of Turrúcares de Alajuela, in his personal capacity and as President of the ASOCIACIÓN DE AMIGOS DEL MEDIO AMBIENTE DEL RÍO SIQUIARES Y SUS NACIENTES DE TURRÚCARES (ASAMARS), against the COOPERATIVA DE PRODUCTORES DE LECHE R.L. (DOS PINOS), represented by Jorge Pattoni Saenz, mechanical engineer, identity card 1-398-416, resident of San José, and against the STATE, represented by Administrative Procurator (Procurador Administrativo) Iván Vincenti Rojas, attorney, identity card 1-695-983, resident of Curridabat, all parties being of legal age and married.

RECITALS:

  1. 1The judgment of the Constitutional Chamber (Sala Constitucional), number 2001-01882, issued at nine hours and twenty-four minutes on March ninth, two thousand and one, is being enforced. That judgment ordered: "The appeal is granted. The Cooperativa de Productores de Leche R.L. and the State are condemned, jointly and severally (solidariamente), to pay costs and damages (costas, daños y perjuicios) arising from the facts underlying this ruling, which shall be liquidated in judgment enforcement proceedings before the administrative litigation court."
  2. 2In enforcement of that ruling, the following relief is sought: "1) That this judgment enforcement proceeding be granted in its entirety, on the basis of the ruling of the Constitutional Chamber of the Supreme Court of Justice, issued at 9:24 a.m. on March 9, two thousand and one, number 2001-01882, which granted said writ of amparo (Recurso de Amparo) and condemned the Cooperativa de Productores de Leche R.L. Dos Pinos and the State, jointly and severally, to pay both costs and damages.2) That judgment declare that both the Cooperativa de Productores de Leche R.L. Dos Pinos and the State are obligated to pay us, as damages, the sum of FOUR HUNDRED TEN THOUSAND DOLLARS or its equivalent in national currency at the official exchange rate. That the amounts to which the defendants are condemned be inflation-indexed (indexadas), so that the sums they pay are equivalent to the value of the Costa Rican currency at the time judgment is rendered.3) Additionally, that the sum of 90.00000 (NINETY THOUSAND COLONES) be paid as costs incurred in the writ of amparo.4) That both the Cooperativa de Productores de Leche R.L. Dos Pinos and the State be condemned to pay both costs of this enforcement proceeding.5) That both the Cooperativa de Productores de Leche R.L. Dos Pinos and the State be condemned to pay amounts for community management activities (gestión comunal), being the expenses incurred by residents of the affected communities in accessing administrative and judicial bodies in defense of the health of community residents and of the environment, due to the contamination of the Río Siquiares.6) That the amounts to which both Dos Pinos and the State are condemned be applied to environmental projects benefiting the affected communities. To that end, I hereby present and detail the various projects to which we request these funds be applied, and we ask the Court to order that these amounts be managed in a special account, duly monitored by the Court itself, with administration of said funds granted to the environmentalist associations we represent under the supervision of the Court or such other body or environmental organization as the Court may designate, in order to prevent said funds from going to other non-environmentalist organizations or to the Caja Única del Estado, which is itself jointly responsible for the environmental and health damage caused to the communities of Siquiares, Ciruelas, and Turrúcares, among others, and thereby ensure that the funds recovered under these headings are applied to projects aimed at improving the health and environment of the affected communities: COMPENSATION TO THE COMMUNITIES OF CIRUELAS AND TURRUCARES BY THE COOPERATIVA DE PRODUCTORES DE LECHE DOS PINOS AND THE STATE FOR THE EVIDENT CONTAMINATION OF THE RÍO SIQUIARES, FOR THE ECOLOGICAL DISASTER CAUSED TO THE AREA, AND FOR THE PHYSICAL, SOCIAL, AND MATERIAL HARM CAUSED TO THE POPULATION. In view of the similarity between the expert assessment presented by IPS and that commissioned by the community, with respect to the different types of harm caused by the contamination of the Río Siquiares in Ciruelas and Turrúcares, the following compensation plan for said communities, to be carried out by Dos Pinos and the State, is submitted for the Court's consideration. 1. COMPENSATION FOR CONTAMINATION A.- Dos Pinos shall comply permanently with all requirements necessary to stabilize and bring to optimal operation its treatment plant (planta de tratamiento), as it has always been its obligation toward the environment and the surrounding communities since it began production, so that its discharge water (aguas de vertido), rather than contaminating, contributes to the natural purification of the Río Siquiares, as demonstrated by the biological tests described in the expert assessment commissioned by the community. B. So that the conservationist associations of Ciruelas and Turrúcares may be assured of the company's compliance with its environmental obligations, the company shall allocate a monthly sum for five years to enable each of these associations to carry out their monitoring and reporting functions. C. Dos Pinos shall pay the costs of the community management activities, costs that the community should never have been required to incur. 1. COMPENSATION FOR BIOLOGICAL DAMAGE TO THE RIVER AND ITS SURROUNDINGS A. The cooperative shall sponsor a community reforestation campaign along the riverbanks (márgenes del río) from La Pista to Turrúcares, through the acquisition of trees native to the area, which, by way of motivation and promotion for the company, shall be planted by the residents and children of the community themselves, who shall also be responsible for overseeing their growth. B. The company shall sponsor, for five years, once a year, a thorough cleanup campaign to remove non-traditional waste along the entire length of the river from La Pista to Turrúcares (including personnel and vehicles). C. Stocking of native fish from the area. D. Conducting the study to find the best method for capturing the water from the spring (naciente) of the Río Siquiares, carrying out such capture, and channeling the river through pipes to the industrial zone, in order to prevent contamination of the river with fecal matter originating from the residential developments built in surrounding areas, and thereby achieving full control of any contamination that the industrial zone might cause to the Río Siquiares, and contributing to the health of the inhabitants throughout the entire area. 2. COMPENSATION FOR SOCIAL, PHYSICAL (HEALTH), MATERIAL, AND MORAL HARM TO THE POPULATION OF CIRUELAS A. Dos Pinos shall pay, on a one-time basis, a private company chosen by the Conservationist Association to conduct a study of the sewage (aguas negras) flowing into the river in order to identify strategic points and solutions. B. Dos Pinos shall provide all materials and labor necessary for the construction of a minimum of four community septic tanks (tanques sépticos comunales) to collect sewage and domestic wastewater in locations where social conditions make their capture difficult and they are directed into the river. The Conservationist Association of Ciruelas shall be responsible for obtaining permits from the property owners of the sites where these tanks would be constructed. 3. COMPENSATION FOR SOCIAL, PHYSICAL, MATERIAL, AND MORAL HARM TO THE POPULATION OF TURRÚCARES A. Dos Pinos shall cooperate, as it had agreed with the Municipality in 1998, with the protection of the first two springs, those located at river level (Siquiares and Turrúcares centro). It shall assume the costs of a thorough study by a hydrologist to determine the most appropriate construction method, and shall provide all materials and labor necessary for construction. B. Dos Pinos shall provide all materials for a new water intake at La Pradera, which is located far from the Río Siquiares, to prevent the old springs from flooding due to a possible increase in river flow resulting from the company's discharge of wastewater (aguas residuales), or alternatively shall drill a well in Turrúcares Centro to supply potable water to the community during the dry season. 3. OTHER FORMS OF COMPENSATION A. The compensation approved by the courts shall be published in La Nación, La República, and El Extra, so that the justice served may serve as an example to all companies that might subsequently attempt to damage our natural resources, disturbing the peace of the communities and endangering community health, thereby setting a precedent. B. In order to ensure compliance and the proper execution of the works for the well-being of all, we propose that the NGO Asociación Justicia para la Naturaleza take charge of monitoring in the area, visiting the works as often as necessary and agreeing directly with the company on its fees for this function. Members of the Conservationist Associations of Ciruelas and Turrúcares shall regularly attend these inspections, and members of MINAE, the Municipality, and the Ministry of Health shall be called upon to attend if necessary. FOR THE STATE THROUGH THE MINISTRY OF HEALTH: A. That it expedite all procedures and permits necessary for the proper development of all projects we propose that are approved by the Courts. B. That the Ministry of Health protect the spring of the Río Siquiares from all contamination; this spring is currently being contaminated—also owing to negligence by this Ministry, through failure to enforce and exercise oversight—by residential developments that do not have treatment plants. C. That the Ministry of Health submit to the conservationist associations of Ciruelas and Turrúcares, every two months, a report on the operation of Dos Pinos." @
  3. 3The legal representative of the Cooperativa de Productores de Leche, R.L. (Dos Pinos) answers the claim by raising the defenses of lack of legal capacity (falta de capacidad) of the petitioning associations, payment (pago), what it termed lack of formal requirements (falta de formalidad) and lack of legal right (falta de derecho), statute of limitations (prescripción) on the principal amount and interest, res judicata (cosa juzgada), the general defense of sine actione agit, and lack of jurisdiction (falta de competencia), requesting that the enforcement proceeding be dismissed in its entirety and that the plaintiff be condemned to pay both court costs and attorney's fees (costas procesales y personales) for vexatious conduct (actitud temeraria). For its part, the State's representative also opposes the enforcement proceeding, raising the defenses of lack of active and passive standing (falta de legitimación ad causam activa y pasiva), lack of legal right, and lack of current legal interest (falta de interés actual), requesting that the liquidations submitted be dismissed, that the State be absolved from payment of enforcement costs, and that the movant be condemned to pay both costs.

Attorney Luis Guillermo Ruiz Bravo, Judge of the aforementioned Court, in judgment number 807-04 issued at ten o'clock on the sixth of July two thousand and four, ordered: "FOR THESE REASONS: For all of the foregoing and the statutory provisions cited, the defenses of statute of limitations (prescripción) as to principal and interest, the defense of lack of right and current interest, and the general defense of sine actione agit, the defense of payment, and the defense of res judicata (cosa juzgada) are rejected. The defenses denominated lack of formality and right in payment to the environment, and lack of jurisdiction regarding the relief sought by the enforcing parties, are sustained. The defense of lack of standing and capacity of the Conservationist Associations of the Rivers and Environment of Ciruelas de Alajuela (ACORACE) and Friends of the Environment of the Siquiares River and its Springs of Turrucares (ASAMARS) is declared well-founded.

The present enforcement of judgment (ejecución de sentencia) is declared partially well-founded; accordingly, the State and the Cooperativa de Productores de Leche R.L. are condemned jointly and severally to pay, in favor of the enforcing party Julie Roos Ayub, the sum of one hundred seventy-eight thousand six hundred thirty-four colones and twenty cents as procedural and attorney's costs (costas procesales y personales) of the constitutional amparo writ (recurso de amparo), plus the interest that such item generates from the date this resolution becomes final until its effective payment. The procedural and attorney's costs of this enforcement proceeding are charged to the defendants." 5.

Being dissatisfied with the ruling, the plaintiffs appealed; their appeal was admitted, by virtue of which this Tribunal is now hearing the matter on appeal.

The required procedural formalities have been observed throughout these proceedings, and no grounds for nullity are noted that would invalidate the acts performed or require correction. This judgment is issued after the required deliberations, and Drafted by Judge Fernández Brenes, and,

CONSIDERING:

I. ESTABLISHED FACTS

For the sake of greater clarity, this Tribunal takes the liberty of reformulating the list of established facts as follows:

  • 1)That within the environmental impact assessment (evaluación de impacto ambiental) process, the Plenary Commission (Comisión Plenaria) of SETENA, in session number 053-99 held on December 21, 1999, Article 4, established a bond amount for the El Coyol–Dos Pinos Raw Milk Processing Plant project of one hundred twenty-eight thousand four hundred thirty United States dollars ($128,430.00), or its equivalent in national currency, to be deposited in the environmental guarantee custody account number 297-MINAE-FONDO NACIONAL AMBIENTAL (SETENA) at the Banco Nacional de Costa Rica, which was deposited by the company on May 19, 2000 (folios 594 to 598);
  • 2)That the El Coyol–Dos Pinos Raw Milk Processing Plant began operations in October 2000 (Constitutional Chamber (Sala Constitucional) judgment 2001-1882, which is being enforced, folio 1010);
  • 3)That on November 29, 2000, Julie Roos Ayub, Carlos Luis Quesada Altamirano, Abel Víquez Fuentes, and José Luis Madrigal Moya filed a constitutional amparo writ before the Sala Constitucional against the Ministry of Health (Ministerio de Salud) and the company Cooperativa de Productores de Leche, R.L. (Dos Pinos), on account of the contamination of the waters of the Siquiares River affecting the communities of Turrúcares, Cebadilla, San Miguel, and Siquiares, which was processed under case file (expediente) number 00-010098-0007-CO (folios 17 to 20);
  • 3)That by judgment number 2001-01882, issued at 09:24 hours on March 9, 2001, the Sala Constitucional resolved that writ, ordering: "The writ is declared well-founded. The Cooperativa de Productores de Leche R.L. and the State are condemned, jointly and severally, to pay the costs, damages, and losses caused by the acts upon which this declaration is based, which shall be assessed in enforcement of judgment before the administrative contentious jurisdiction" (enforcement order at folios 996 to 1025, as well as certified copy of the complete case file from folio 17 to 452);
  • 4)That in December 2001, Julie Roos Ayub filed an administrative complaint for environmental damage (daño ambiental) before the Environmental Administrative Tribunal (Tribunal Ambiental Administrativo), which was processed under case file number 171-00-TAA (folio 682 and 1141);
  • 5)That in March 2001, SETENA, in collaboration with IPS, conducted an economic valuation of the environmental damage caused by the Cooperativa de Productores de Leche Dos Pinos project at El Coyol de Alajuela, which was supplemented by a report issued in April of that same year, in which, under the treatment-costs methodology, the following assessment of environmental damages was made: treatment costs: $92,189; social cost: $92,189; biotic cost of the damage: $27,653.70; and management cost: $6,307; for a grand total of $218,341.70 (folios 453 to 504 and 1041 to 1088);
  • 6)That the complaint processed under case file 171-00-TAA was resolved by the Tribunal Ambiental Administrativo in resolution 369-01-TAA, issued at 8:00 hours on June 4, 2001, in which it declared the Cooperativa de Productores de Leche Dos Pinos R.L. and Mr. Jorge Julio Pattoni Saenz jointly and severally liable for environmental damage for the contamination of the Siquiares River, and accordingly ordered, among other damage mitigation measures, the payment of ninety-two thousand one hundred eighty-nine dollars, which at the selling exchange rate amounts to thirty million one hundred twenty-three thousand six hundred sixty-seven colones as compensation, in accordance with the economic valuation of the damage carried out by SETENA and IPS, and imposed the following environmental mitigation measures on them: to submit to SETENA and the Ministry of Health, for their approval, a program to suction the sediments and larvae accumulated as a result of the contamination in the bed of the contaminated river, and an environmental management plan providing for the comprehensive management of solid and liquid waste (folios 1141 to 1154 and certification from folio 1219 to 1238);
  • 7)That on October 2, 2001, the Cooperativa de Productores de Leche Dos Pinos R.L. deposited in favor of MINAE, by check number 99273-4 dated October 1, 2001, the compensatory sum established by resolution 369-01-TAA, with government remittance number 392084 D being issued in the amount of thirty million one hundred twenty-three thousand six hundred seventy-seven exact colones (certification from folio 1163 to 1166 and from 1236 to 1238);
  • 8)That the contamination of the Siquiares River caused by the operation of the El Coyol–Dos Pinos Raw Milk Processing Plant caused damage and nuisances to the communities of Turrúcares, Siquiares, San Miguel, and Cebadillas, consisting of foul odors emanating from the river, loss of potential uses, harm to economic and recreational activities, and an increase in pests (mosquitoes and flies) (report estimating costs for socioeconomic and environmental damages, visible at folios 453 to 504);
  • 9)That the enforcing parties submitted one hundred eleven original documents, including invoices, receipts, payment stubs, and vouchers, as part of the expenses incurred in this litigation and its antecedents (folios 526 to 569);
  • 10)That at the time the constitutional amparo writ was filed and adjudicated, the enforcing associations had not yet been formed (the record).

II. THE APPELLANTS' GRIEVANCES

The plaintiffs appeal judgment number 807-04 issued at ten o'clock on the sixth of July two thousand and four, as they do not share the position of the lower court (a-quo) with respect to the sustaining of the lack of active standing (legitimación ad causam activa) asserted, which renders the greater part of the items claimed inadmissible, given that the constitutional amparo writ was filed in order to seek protection of the environmental right granted by Article 50 of the Constitución Política, deemed to have been violated by the conduct of the defendants (contamination of the Siquiares River) to the detriment of the communities of Ciruelas, Turrúcares, San Miguel, and Cebadillas; such that at no point, despite the writ having been signed by four individuals, did the parties act in a personal capacity, but rather on behalf of the said communities, and they were always supported by de facto groups that shared their position—hence also that when formulating the petition, reference was made to community projects and not to the personal benefit of the plaintiffs.

It should be noted that the Sala Constitucional itself established: "…In the Court's view, the described situation confirms that during the indicated period the reported contamination occurred, which constituted an infringement of the fundamental rights to health and to a healthy and ecologically balanced environment of the residents of the affected communities, which requires the writ to be granted…"; so that the judgment was favorable for the entire community, not only for Julie Roos and the other complainants. In light of the foregoing, the appellants submit that since they filed the constitutional amparo writ, it logically follows that they have standing to bring the enforcement proceedings. They argue that the spirit of Article 50 of the Constitución Política goes beyond simple procedural concepts and permits or broadens the possibility that enforcement proceedings for environmental damages caused may be settled in the name of the community, given the nature of the diffuse interests (intereses difusos) that govern the subject matter.

Limiting standing runs counter to what is enshrined in that constitutional provision, which is why they request that the appealed resolution be reversed and that the denied items be recognized, including the moral damages (daño moral) claimed.

III. THE STATE'S POSITION

The State's representative requests that the appealed judgment be upheld, adopts its reasoning as his own, and states that in the current state of legal development, what is requested cannot be granted without breaking not only the value of res judicata but also the very foundations upon which the active standing required in any jurisdictional proceeding rests; furthermore, the relief sought has no normative basis, making the partial dismissal of the claim mandatory, in the terms and scope in which it was resolved by the lower court.

IV.PRIOR ASSESSMENTS FOR THE ENFORCEMENT OF THE JUDGMENT UNDER CONSIDERATION.- It should be noted that in this type of proceeding, the conduct of the Administration — specifically the Ministry of Health — and of the co-defendant company — Cooperativa de Productores de Leche, R.L. (Dos Pinos) — may not be challenged or re-evaluated, since it was through the Constitutional Chamber's own review of that conduct that it was determined to be contrary to constitutional law, directly infringing the right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado), as set forth in Article 50 of the Constitution: on the part of the Ministry of Health, through an omission in failing to exercise the supervisory and oversight functions that the legal framework imposes on it for the effective protection of the environment; and on the part of the company, through an active act of pollution by discharging waste directly into the river without complying with the environmental parameters established in the legal framework (Reglamento de Vertido y Reuso de Aguas Residuales, Decreto Ejecutivo número 26.042-S-MINAE).

Accordingly, in this proceeding, the only matters to be determined are: the existence of the environmental damage caused by that conduct (as assessed by the Constitutional Chamber), the monetary quantification of that damage, and the party with standing (legitimación) to bring this action and to receive the corresponding payment.

It should further be noted that, although the facts assessed by the Constitutional Chamber arose from the operations of the Dos Pinos milk-processing plant at Coyol de Alajuela beginning in October 2000, and it was in February 2001 that the Chamber issued its judgment upholding the constitutional writ of amparo (recurso de amparo) filed before it, it is not possible to hold that the damages — whose existence and calculation are sought to be determined in this enforcement proceeding (ejecución de sentencia) — must be confined to that four-month period, as the State's representative argues. This is because there was, in fact, a polluting act with continuing effects on the environment that, as indicated by the technical studies included in the case file, requires appropriate technical measures and an extended period of time to reverse the contamination caused to the Río Siquiares — that is, to restore it to the condition it was in prior to the harm suffered.

V.THE STANDING OF THE PETITIONERS TO PROMOTE THIS ENFORCEMENT OF JUDGMENT.- It is indeed the case that with the amendment of Article 50 of the Constitution by ley número 7412, of June 3, 1994, not only was the content of the right to a healthy and ecologically balanced environment expressly recognized for all persons, but, with respect to the proper protection of this right, an extremely broad standing — direct or diffuse — was also established, enabling any individual to bring the corresponding actions before administrative or judicial bodies to claim protection of this right. This broad standing reflects the special nature of the interest at stake — the environment — which transcends the private sphere of the interested parties and merges with the collective interest of the nation, given that its ownership rests in the very holders of sovereignty, that is, in each and every inhabitant of the Republic. For this reason, constitutional jurisprudence has held that this constitutes a true interest belonging to the national community (in this regard, see judgments number 2002-9703, 2003-3656, and 2003-6323).

It was precisely in exercise of that standing that Julie Roos Ayub, Luis Quesada Altamirano, Abel Víquez Fuentes, and José Luis Madrigal Moya filed a recurso de amparo before the Constitutional Chamber — a fact that is not in dispute. What is disputed is the standing of the plaintiff associations to promote this enforcement of judgment, as well as to receive payment of the alleged compensation for environmental damage (daño ambiental).

On the first point, this Tribunal finds that the lower court (a quo) was wrong to have upheld the defense of lack of standing (falta de legitimación ad causam) against the plaintiff associations, on the grounds that the claim in this proceeding is limited to the purely personal harm suffered by the associations' representatives, who had been the ones to file the recurso de amparo. The trial judge did not take into account that, although that recurso de amparo was filed by four individuals in their personal capacity, they did so in representation of the interests of the communities of Siquiares, Cebadilla, Turrúcares, and San Miguel, invoking the harmful effects caused to the environment by the operation of the Cooperativa Dos Pinos milk-processing plant (inability to use the water for irrigation and for watering livestock, for recreational purposes, foul odors, and alteration of the natural conditions of the river water).

This was indeed understood by the High Constitutional Court, which found an infringement of the fundamental right to a healthy and ecologically balanced environment as regards "all residents of the affected communities." Accordingly, the plaintiff parties must be deemed to have proper standing to promote this enforcement of judgment, acting as they do in representation of the interests of the communities affected by the contamination in question — precisely by virtue of the right declared in their favor in Constitutional Chamber judgment number 2001-1882.

Likewise, and for the same reasons stated above, the objections raised with respect to the participation in this proceeding of two non-profit associations, formed and represented by precisely two of the petitioners in that amparo action, are also without merit — notwithstanding that these associations were created after that constitutional ruling. Indeed, it must be held that, since the same actors and the same interests are at stake, the representation that the amparo petitioners had been exercising may be deemed to have been subsumed into these two associations, created precisely for the purpose of protecting the environment of the communities of Ciruelas, Siquiares, and Turrúcares.

VI.THE STANDING OF THE PETITIONERS TO RECEIVE THE CLAIMED COMPENSATION.- On this point, it should be noted that, even though standing to claim compensation for environmental damage is truly broad — in the terms established by the aforementioned Article 50 of the Constitution — it is not the case that entitlement to receive the corresponding indemnification arising from a claim for environmental damage may be extended indiscriminately, particularly given the special nature of the interest at stake. Since the environment operates as a collective good, a private individual or private-law entity cannot, in principle, claim compensation or reparation for harm of which it is not the owner. For this reason, the co-defendant company's representative raised as a defense in this proceeding the lack of authority of the plaintiffs to receive payment, arguing that only the Tribunal Ambiental Administrativo has authority to collect for environmental damage, and the Ministry of Health for damage to public health.

This Tribunal does not share that view. In environmental matters, two distinct types of damage arise: direct damages (daños directos), which are not in dispute, since they are capable of being individualized — consisting of direct harm to the victim, translating into bodily, property, or moral damages, in the terms expressly provided in Article 41 of the Constitution, such that it is the owner of the injured estate, or the person who has suffered harm in their personal sphere or in their legally protected interests, who may seek the corresponding compensation; and indirect damages (daños indirectos), which international legal scholarship and national constitutional jurisprudence have classified as collective — that is, affecting the community as a whole.

It is this latter type of damage that motivates this enforcement proceeding — not, as the Office of the Attorney General (Procuraduría) contends, the first type of environmental damage, as indicated in the preceding Considerando. With respect to collective environmental damage, legal scholars (DE MIGUEL PERALES, Carlos, La responsabilidad civil por daños al medio ambiente. Editorial Civitas, S.A. Primera reimpresión. Madrid. España. 1994. pp. 285 a 332, and MORENO TRUJILLO, Eulalia. La protección jurídico-privada del medio ambiente y la responsabilidad por su deterioro. J.M. Bosch Editor, S.A. Barcelona. España. 1991. pp. 286 y 287), drawing on U.S. law, have developed a new concept that allows standing to pursue such claims to be recognized: "class actions" (which may be translated as "the action of the class or group"), which arises as a procedural mechanism defined as an action brought by a plaintiff aimed not merely at protecting their own interest, but equally that of others who are in the same situation, thereby allowing a plaintiff to act in representation of other individual claims similar to their own — without this being confused either with a public interest action (acción popular) or with joinder of parties (litis consorcio).

Accordingly, it is not even necessary for there to be a legally organized body — an association or corporate entity — dedicated to environmental protection; it suffices that there be a mere factual category, an individualized or individualizable class based on any distinguishing criterion — in our case, environmental damage — which is precisely the situation here, where a group of residents arrogate to themselves the representation of the community's interests: first, in establishing the unlawful nature of an act causing environmental damage, and now, in seeking proper compensation for it.

For these reasons, it is held that the plaintiff associations — Asociación Conservacionista de los Ríos y el Ambiente Ciruelas de Alajuela (ACORACI) and Asociación de Amigos del Medio Ambiente del Río Siquiares y sus Nacientes de Turrúcares (ASAMARS) — have proper standing to receive the compensation claimed for the environmental damage determined by the Constitutional Chamber in judgment number 2001-1882.

VII.PROOF OF DAMAGES FROM ENVIRONMENTAL CONTAMINATION (CONTAMINACIÓN AMBIENTAL).- Having established the standing (legitimación) held by the executing associations (asociaciones ejecutantes) to seek compensation for environmental damage (daño ambiental) caused by the commissioning of the milk-processing plant operated by Cooperativa de Productores de Leche, R.L. Dos Pinos in Coyol de Alajuela, it must be noted that, given the technical nature of this subject matter, this Tribunal will rely on the studies submitted by the plaintiffs, inasmuch as those studies were prepared by the Administration's technical body competent in this field—the National Technical Environmental Secretariat (Secretaría Técnica Nacional Ambiental, SETENA)—in accordance with the provisions of Articles 83 and 84 of the Ley Orgánica del Ambiente—and by qualified professionals in the field, none of which were challenged or rebutted by the defendants.

This satisfies the constitutional environmental principle of the objectification of environmental protection (tutela ambiental), which requires that decisions in this area be duly grounded in science and technical expertise (as derived from administrative discretion (discrecionalidad administrativa) under Articles 16 and 160 of the Ley General de la Administración Pública). Accordingly, based on the economic environmental valuation (valoración ambiental económica) of environmental damage appearing at folios 1041 to 1087, supplemented by the study appearing at folios 453 to 504, using the treatment cost methodology (metodología de costos de tratamiento), which encompasses the following variables of damage to the environment: a) the treatment cost, which does not—strictly speaking—assess the environmental damage produced by the contamination, but rather establishes an approximation of the value of the damage based on the cost of having applied the appropriate measures to prevent the source of harm from arising, and therefore represents a minimum applicable value (technical study on the economic valuation of the environmental damage caused, folios 1041 to 1053), which was set at ninety-two thousand one hundred and eighty-nine United States dollars ($92.189.00); b) the biotic cost (costo biótico) of the damage, which addresses the living component and all its sub-components, that is,

"the quality of the environment, the capacity of the environment to meet the needs for the organisms that inhabit it to develop in a healthy manner, and the balance that must naturally exist between physical and chemical aspects within normal ranges, for each particular situation. In cases of environmental contamination, all of these sub-components are altered, giving rise to degradation of the abiotic phase (fase abiótica) of ecosystems (ecosistemas), and disrupting the natural balance: this is the case with the discharge of effluent from the Dos Pinos treatment plant, which has caused a rupture in the equilibrium of the río Siquiares" (Supplemental Final Report, folio 454).

In the case of the río Siquiares, based on the biochemical tests submitted to the case file and reflected in the technical studies, it was determined that at the monitoring station located at the outlet of the effluent (efluente) from the Dos Pinos milk-processing plant, approximately fifty meters downstream, in addition to the contamination already carried by the water from the upstream stations, the discharges (vertidos) from this industry accumulate, with the following characteristics—according to a field visit conducted on April tenth, two thousand and one—:

"It has been affected by an increase in total solids, total suspended solids, dissolved solids, and settleable solids, organic matter in general, and to a lesser extent by the load of fats and oils discharged from the treatment plant, which has caused an increase in the BOD₅ (biochemical oxygen demand, DBO5) and COD (chemical oxygen demand, DQO) rates and, consequently, also in the deoxygenation (desoxigenación) of the water. The presence of fats in the water creates problems due to their surfactant (tensoactivo) effect, which prevents the uptake of oxygen, or generates a film coating around biological flocs (flóculos biológicos) that blocks their respiration and causes them to become buoyant, so that they float to the surface." The foregoing results in the loss of oxygen from the water—that is, the respiratory processes of aquatic organisms are impeded—since the gills (branquias) of fish, insects, and other organisms become saturated, causing their death by asphyxiation; this precludes any form of life in the riverbed (lecho del río) and in those waters.

This damage (to the biotic component) was assessed at twenty-seven thousand six hundred and fifty-six dollars ($ 27.656.00); c) the social cost (costo social) of the damage caused, which refers to the harm suffered by the community as a result of the contamination under examination—arising from the foul odors (malos olores) from the river due to the transport and sedimentation of organic material, which generates organic sludge (lodos orgánicos) undergoing anaerobic decomposition (descomposición anaeróbica)—the loss of the river's potential uses (for agricultural, livestock, recreational, and leisure purposes), and the growth of certain pest populations (particularly mosquitoes and flies), assessed at ninety-two thousand one hundred and eighty-nine United States dollars ($92.189.00); and d) the management cost (costo de gestión), which encompasses all expenses incurred by the plaintiffs, both in filing the writ of amparo (recurso de amparo) and in prosecuting this enforcement proceeding (proceso de ejecución), which, as noted by the defendants, include litigation costs (costas del proceso), both personal and procedural, assessed at six thousand three hundred and seven United States dollars ($ 6.307.00).

This satisfies the requirement set forth in Article 693 of the Código Procesal Civil, which provides that in enforcement proceedings, where an abstract judgment to pay damages has been entered, the burden of proof (carga de la prueba) of demonstrating those damages rests with the prevailing party, as does the obligation to provide the corresponding specific and detailed liquidation thereof. Accordingly, the defense (excepción) raised by the defendant Cooperative—to the effect that there is a lack of formality and a lack of legal basis because the plaintiffs failed to demonstrate the damages caused by the operation of its milk-processing plant—cannot be upheld; since, as has been emphasized, those damages are supported by the respective technical studies, which were not discredited by the defendants.

VIII. CONSTITUTIONAL PRINCIPLES GOVERNING COMPENSATION FOR ENVIRONMENTAL DAMAGE

Prior to assessing the amounts sought as compensation for environmental damage suffered by residents of the affected communities, it is necessary to recall that the entire framework of patrimonial liability (responsabilidad patrimonial) is oriented toward the redress (resarcimiento) of damages suffered, within the terms provided in Article 41 of the Constitution, which establishes the general mechanism for redress, precisely to remedy any harm "... received to one's person, property, or moral interests." This reparation takes on special relevance in environmental matters, given the nature of the asset at stake—being one of evident collective interest—and given the significant consequences that may arise across the various ecological systems, such that priority must be given to restoring the environment to the condition in which it existed prior to the damage caused, in order to reverse those negative effects on the various environmental components.

This encompasses what is known as in-kind compensation (indemnización in natura), consisting of compensatory or preventive measures that temper the essentially restorative character of the compensation; and, additionally, where appropriate, monetary (pecuniary) compensation—neither of which excludes the other, nor is one subsidiary to the other. In any event, it is important to note that monies recognized as compensation for environmental damage must be earmarked exclusively to mitigate the harm that gave rise to the claim, which is grounded in the recognition of the right to a healthy and ecologically balanced environment; this objective will not be achieved if the plaintiffs are free to dispose of those funds as they see fit, without applying them directly to the mitigation of the environmental harm adjudged, since allowing their allocation to other causes or purposes would undermine the very nature of the compensation. (To the same effect, see ruling No. 392-2006, of fourteen hours forty minutes of August thirty-first, two thousand and six, of the Sección Segunda of this Tribunal.)

IX.DAMAGES AWARDED.- Now, with respect to the first component of the compensation under consideration (the one relating to the treatment cost for the damage), it is indeed the case that this amount was paid through administrative channels (vía administrativa) by the polluting company—Cooperativa de Productores de Leche, R.L. (Dos Pinos)—on October second, two thousand and one, in connection with the complaint filed through those channels before the Tribunal Ambiental Administrativo by Julie Roos Ayub, regarding the same facts at issue here; Resolution No. 369-01-TAA, of eight hours on June fourth, two thousand and one, ordered payment of the amount established in the economic valuation carried out by SETENA and IPS for that item—namely, ninety-two thousand one hundred and eighty-nine United States dollars ($92.189.00)—at the then-prevailing exchange rate, which totaled THIRTY MILLION ONE HUNDRED AND TWENTY-THREE THOUSAND SIX HUNDRED AND SEVENTY-SEVEN COLONES (¢ 30.123.677.00).

Regarding this payment, two observations must be made: first, as noted in the technical study that performed the economic valuation for this environmental damage, this component is "a minimum," which the active polluting agent (agente activo contaminador) is required to pay, given that its calculation is based on the costs that the industry should have incurred to bring its operations into compliance with environmental parameters and standards—that is, the cost of treating the wastewater (aguas residuales)—whereby the basis of calculation was determined by the level of contamination entering the system and the level of contamination discharged into the river. However, as the reference technical studies pointed out, this is not the only component for quantifying this compensation, which means that the plea of payment (excepción de pago) raised by the co-defendant company must be upheld only in part, given that it did not pay the full amount of the damage caused.

It is therefore of interest to note that on that occasion—through the administrative channel—no account was taken of the recommendation to recognize an item for environmental damage on account of the biotic cost; therefore, having been established in the corresponding technical-scientific study, as estimated in the preceding section, it is appropriate to recognize it in these proceedings in the fixed sum—that is, in the amount of TWENTY-SEVEN THOUSAND SIX HUNDRED AND FIFTY-SIX DOLLARS ($ 27.656.00)—to be paid jointly and severally by the defendants, as imposed by the judgment being enforced. This amount is justified in the cited report on the following basis:

"It is our opinion that the cost estimate must include the biotic component, which, however, cannot be charged on the basis of a natural community, given that upstream from the effluent outlet of the Dos Pinos treatment plant the ecosystem already shows signs of contamination. For this reason, the estimated cost must be multiplied by a factor between 1 (natural water) and 0 (totally contaminated water); in this case, the factor is estimated to be 0.3. Therefore, to the formula used by IPS, Treatment Cost +a Social Cost + Management Cost a fourth component is added, B * Treatment Cost, corresponding to the deterioration in the biotic phase; accordingly, the total estimate would be Total Charge = $92.189 + 1*$92.189 + 0,3 * $92.189 +6.307" (folio 455).

X.Special consideration must be given to the social cost of the environmental damage (daño ambiental) claimed, since this Tribunal cannot accept the sum set forth in that report, as it was established without any methodological basis for its calculation, which prevents its recognition in the assessed amount, precisely due to the lack of expert assessment. Nevertheless, it is indeed the case that the harm and disturbances caused to the communities surrounding the río Siquiares — specifically Ciruelas, San Miguel, Cebadillas, and Turrúcares — were duly established in the proceedings, as detailed in the respective technical report: "the degradation of water quality, as a result of which this liquid cannot be used for a lengthy period and along an extended stretch of its course for other purposes such as irrigation, livestock watering, recreation, and least of all as a source for human consumption" (folio 486), and whose restoration will take a moderately long period (three to five years).

This collegiate body considers that this item must be treated in a manner analogous to moral damages (daño moral), which allows the judge to determine the amount based on an assessment of the circumstances surrounding the case — that is, in re ipsa — but without confusing or equating it with moral damages in the broad or strict sense, since it is indeed the case that this type of damage (to the environment) causes disturbances and harm to those affected; in light of which, having established the existence of such harm to the residents of the aforementioned communities, their proper compensation cannot go unrecognized, precisely in application of the principles of equity and justice, which, in the absence of a technical criterion, must be set at the prudential sum of FIVE MILLION COLONES (¢5.000.000.00), payable jointly and severally by the defendants. As for the final component of the environmental damage, namely the management cost, the defendants are correct in arguing that these must be treated as court costs (costas), including attorney's fees (personales) and procedural costs (procesales); such costs were determined in the appealed judgment at the amount of ONE HUNDRED SEVENTY-EIGHT THOUSAND SIX HUNDRED THIRTY-FOUR COLONES AND TWENTY CÉNTIMOS; this item was not appealed in the present judgment, and therefore its assessment is not appropriate on this occasion.

XI.In accordance with the reasoning set forth in Considerando VIII.- of this judgment, the plaintiff associations (Asociación Conservacionista de los Ríos y el Ambiente de Ciruelas de Alajuela —ACORACI— and Asociación de Amigos del Medio Ambiente del Río Siquiares y sus Nacientes de Turrúcares —ASAMARS—) are hereby advised that the sums recognized in this ruling must be used SOLELY AND EXCLUSIVELY for restoration projects for the río Siquiares; for which purpose, they will be required to align those projects with technical criteria and standards endorsed by the Secretaría Técnica Nacional Ambiental, SETENA, the technical body of the Administration in environmental matters; work that is likewise subject to the oversight falling within the competence of the administrative authorities, such as the Ministerio de Salud, the Ministerio de Ambiente y Energía, the Procuraduría General de la República, and the Defensoría de los Habitantes, which by legal mandate have jurisdiction in this matter.

In any event, the parties are warned that diverting the funds recognized in this ruling, under criminal law, could constitute a criminal offense (disobedience of authority, unjust enrichment, misappropriation of funds, etc.). In accordance with the provisions of Article 79 of the Ley Reguladora de la Jurisdicción Contencioso Administrativa, interest on the sums awarded shall run from the date this judgment becomes final until actual payment, at the legal rate set forth in Article 1163 of the Código Civil.

XII.ON THE INADMISSIBILITY OF RECOGNIZING HEALTH DAMAGES TO RESIDENTS OF THE AFFECTED COMMUNITIES.- The other damages that the plaintiff associations request be recognized do not fare equally well. Indeed, with regard to health damages — sought to be treated as moral damages on account of the ailments that this contamination has caused to the population — this claim cannot be so treated, since the ailments in question are entirely indeterminate and generic physical conditions, which at most could give rise to the corresponding claim, but properly brought by the affected individuals themselves. Likewise, as the petitioners themselves acknowledge, there is no technical-objective study that conclusively and with absolute certainty establishes a health problem or epidemic that broke out in these communities in connection with the commencement of operations at the Dos Pinos milk-processing plant; and although approximately thirteen thousand five hundred clinical records from the Equipo Básico de Atención Integral (EBAIS) health posts at Ciruelas and the Clínica de San Rafael Sur were reviewed, it was not possible to conclusively determine that the sole cause of the allergies, viral respiratory infections, mild asthma attacks, intestinal parasitosis, migraines, and severe episodes of diarrhea that intensified during the months of January through June of two thousand and one was the contamination of the río Siquiares.

What was obtained was a list of illnesses "that could be related to adverse environmental factors, such as the water quality of the río Siquiares," but which could also be caused by "a series of anthropogenic activities such as urban development and, principally, industrialization of the surrounding area," as the petitioners themselves stated.

XIII.ON THE COMPENSATORY MEASURES REQUESTED.- Finally, the plaintiffs request a series of compensatory measures for the environmental damage caused by the defendants' conduct; however, the majority of these are plainly inadmissible, as they exceed the scope recognized in the favorable judgment of the Sala Constitucional being executed. In this regard, it must be noted that, even though the contamination caused by the operation of the Dos Pinos milk-processing plant was duly substantiated and established, it cannot be expected that this company should pay for and restore all the environmental damage and contamination that various agents have caused to the río Siquiares — first, it is reiterated, because such damage does not arise from the judgment being executed, and second, because the application of the constitutional environmental principle known as "the polluter pays" means that those other polluting agents are responsible for their own remediation.

In light of the foregoing, it is not possible to recognize, as part of this enforcement proceeding, items for the funding of the plaintiff associations, the imposition of the construction of works for the capture and piping of springs (nacientes) and septic tanks — since these are motivated by the contamination caused to the river by the urban developments located upstream of the Dos Pinos plant — actions and funds for the protection of the river's springs, collection at La Pradera to avoid supply shortages during the dry season, the sponsorship of a campaign to reforest the riverbanks, and the stocking of fish in the river. It is noted that the request to publish this judgment in a nationally circulated newspaper constitutes an additional sanction, which, in view of the principle of specificity (tipicidad) governing sanctions — Article 39 of the Constitution — must be duly established in advance by a formal and substantive law, a circumstance that does not obtain in the present case.

Notwithstanding the foregoing, in application of the constitutional environmental principle governing compensation for environmental damage — which requires that, in this type of damage, restoration in natura must be sought above all else, as the ultimate purpose of compensation in such cases — and given that it is duly supported by the respective technical study, Cooperativa Productora de Leche Dos Pinos, R.L. must be ordered to bring its operations into compliance with the environmental parameters established by the legal framework and to carry out an artificial cleaning of the riverbeds of the river in the vicinity of the outlet of that company's treatment plant and extending up to one kilometer downstream, once a year for three consecutive years. Likewise, it is appropriate to remind the Ministerio de Salud of its obligation to exercise oversight of the industrial activity carried out by the co-defendant, such that it must — at a minimum — conduct four water quality monitoring inspections per year (one during the rainy season, one during the dry season, and one during each transition period).

XIV.ON THE EXCEPTIONS RAISED.- As has been indicated throughout this ruling, and in light of the considerations set forth, the appealed judgment must be reversed with respect to the exceptions that bear upon the appeal filed; accordingly, the exceptions of lack of active standing (legitimación ad causam activa) and lack of capacity of the plaintiffs to receive payment, raised by the defendants, must be dismissed, and the exceptions of payment and lack of legal right (also referred to as lack of formality) must be partially upheld, inasmuch as not all of the plaintiffs' claims were recognized.

XV.ON COURT COSTS.- Although no appeal was filed with respect to the order for court costs made in the judgment at first instance, Article 224 of the Código Procesal Civil permits their assessment, even sua sponte, at the appellate stage, in connection with the appeal filed, in accordance with the ruling issued. This Tribunal finds no reason to reverse or modify that judgment with respect to this point — which ordered the defendants to pay full court costs (State and Cooperativa de Productores de Leche, R.L. Dos Pinos) — given that this is an enforcement proceeding arising from a favorable constitutional judgment, in which a violation of a fundamental right was recognized, and given that the standing of the plaintiff associations to act and to receive the corresponding compensation for environmental damage was admitted, and the damages caused by the contamination of the río Siquiares and their economic quantification were established, confirmation is therefore appropriate.

It is worth noting that, had the co-defendant company brought its operations into compliance with the environmental parameters and had the Administration fulfilled its obligations under the environmental legal framework by reprimanding and overseeing the operation of the Cooperativa Dos Pinos milk-processing plant in a timely manner, the environmental damage that gave rise to these proceedings in pursuit of effective environmental protection, as mandated by Article 50 of the Constitution, would have been avoided.

POR TANTO:

On the matter appealed, the judgment under appeal is reversed, and in its place the defenses (excepciones) of lack of standing to sue (falta de legitimación activa) and lack of capacity of the plaintiffs to receive payment are rejected. The defenses of payment and lack of entitlement (falta de derecho) — also referred to as lack of formality (falta de formalidad) — are partially sustained, with the claim being understood as denied in all matters not specified herein. In light of the foregoing, the State and Cooperativa Productora de Leche, R.L. Dos Pinos are jointly and severally ordered to pay the following amounts in favor of the Asociación Conservacionista de los Ríos y el Ambiente de Ciruelas de Alajuela (ACORACI) and the Asociación de Amigos del Medio Ambiente del Río Siquiares y sus Nacientes de Turrúcares (ASAMARS): TWENTY-SEVEN THOUSAND SIX HUNDRED SIXTY-FIVE AMERICAN DOLLARS ($27.665.00) for environmental damage (daño al ambiente), and FIVE MILLION COLONES EXACTLY (¢ 5.000.000.00) for the social cost (costo social) of the environmental damage caused, said amount to be allocated solely and exclusively to restoration projects for the Siquiares river; interest shall accrue on both amounts from the date this judgment becomes final and binding until actual payment, at the statutory rate set forth in artículo 1163 del Código Civil.

Likewise, Cooperativa Productora de Leche Dos Pinos, R.L. is ordered to bring its operations into compliance with the environmental standards established in the applicable legal framework and to carry out an artificial cleaning (limpieza artificial) of the river channels (cauces del río) in the vicinity of the outlet of that company's treatment plant (planta de tratamiento) and extending up to one kilometer downstream, once per year for three consecutive years. The Ministerio de Salud is reminded of its obligation to exercise oversight of the industrial activity carried out by the co-defendant, and is therefore required to carry out at least four water-quality monitoring exercises per year (one during the rainy season, one during the dry season, and one during each transitional period). Once this judgment becomes final and binding, it shall be communicated to the Defensoría de los Habitantes and to the Secretaría Técnica Nacional Ambiental for action within their respective jurisdictions.

No No. 379-2006 TRIBUNAL CONTENCIOSO ADMINISTRATIVO SECCIÓN TERCERA. Segundo Circuito Judicial de San José, Goicoechea a las once horas cuarenta minutos del veintidós de setiembre del dos mil seis.

Proceso de ejecución de sentencia tramitado en el Juzgado de lo Contencioso Administrativo y Civil de Hacienda, establecido por JULIE ROOS AYUB, con cédula de identidad número 1-600-955, vecina de Ciruelas, en su condición personal y como Presidenta de la ASOCIACIÓN CONSERVACIONISTA DE LOS RÍOS Y EL AMBIENTE DE CIRUELAS DE ALAJUELA (ACORACI), cédula jurídica 3-002-298374, y JOSÉ LUIS MADRIGAL MOYA, pensionado, cédula 1-233-345, vecino de Turrúcares de Alajuela, en su carácter personal y como Presidente de la ASOCIACIÓN DE AMIGOS DEL MEDIO AMBIENTE DEL RÍO SIQUIARES Y SUS NACIENTES DE TURRÚCARES (ASAMARS), contra la COOPERATIVA DE PRODUCTORES DE LECHE R.L.(DOS PINOS), representada por Jorge Pattoni Saenz, ingeniero mecánico, cédula 1-398-416, vecino de San José, y contra el ESTADO, representado por el Procurador Administrativo Iván Vincenti Rojas, abogado, cédula 1-695-983 vecino de Curridabat, todos mayores y casados.

RESULTANDO:

  1. 1Se ejecuta la sentencia de la Sala Constitucional número 2001-01882, de las nueve horas con veinticuatro minutos del nueve de marzo de dos mil uno, la cual dispuso: "Se declara con lugar el recurso. Se condena a la Cooperativa de Productores de Leche R.L. y al Estado, solidariamente, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo."
  2. 2En ejecución de ese fallo se pretende: "1) Que se acoja la presente ejecución de sentencia en todos sus extremos, con fundamento en la resolución de la Sala Constitucional de la Corte Suprema de Justicia, de las 9:24 horas del 9 de marzo del año dos mil uno, número 2001-01882, la cual declaró con lugar dicho Recurso y condenó a la Cooperativa de Productores de Leche R.L Dos Pinos y al Estado, en forma solidaria, al pago de ambas costas, y al pago de los daños y perjuicios causados.2) Que se declare en sentencia que tanto la Cooperativa de Productores de Leche R.L. Dos Pinos y el Estado están obligada a pagarnos, por concepto de daños y perjuicios, la suma de CUATROCIENTOS DIEZ MIL DOLARES o su equivalente en moneda nacional al tipo de cambio oficial. Que se ordene que dichas sumas de dinero a que sean condenados los accionados sean indexadas, de tal forma que la sumas que ellos reconozcan sean equivalentes al valor de la moneda de Costa Rica, en el momento que se dicte la sentencia.3) Además, que por concepto de costas derivadas del Recurso de Amparo debe cancelarse la suma de 90.00000 (NOVENTA MIL COLONES).4) Que se condene tanto a la Cooperativa de Productores de Leche R.L. Dos Pinos y el Estado al pago de ambas costas de esta ejecución de sentencia.5) Que se condene tanto a la Cooperativa de Productores de Leche R.L. Dos Pinos y al Estado, al pago de los montos por concepto de gestión comunal, que son gastos en que incurrieron los habitantes de las comunidades afectadas para acceder a las instancias administrativas y judiciales en defensa de la salud de los habitantes de las comunidades y del ambiente, por la contaminación de que fue objeto el Río Siquiares.6) Que los montos a que sean condenados tanto la Dos Pinos como el Estado, solicitamos se empleen en proyectos ambientales que favorezcan a las comunidades afectadas. A tales efectos me permito presentar y detallar los distintos proyectos en que solicitamos se empleen estos dineros, así como solicitamos al Despacho que se ordene que estos montos sean manejados en una cuenta especial, debidamente monitoreada por el mismo Despacho, otorgando la administración de dichos dineros a las asociaciones ambientalistas que representamos bajo la supervisión del Juzgado u otro órgano u organización ambientalista que el Despacho designe, para evitar que dichos dineros vayan a parar a otras organizaciones no ambientalistas o a la Caja Única del Estado, que es precisamente copartícipe en el daño ambiental y a la salud que se le provocó a las comunidades de Siquiares, Ciruelas y Turrúcares, entre otras, y con ello garantizar que los dineros que se recuperen por estos conceptos se empleen en proyectos que tienden a mejorar la salud y el ambiente de las comunidades afectadas: COMPENSACIÓN A LAS COMUNIDADES DE CIRUELAS Y TURRUCARES POR PARTE DE LA COOPERATIVA DE PRODUCTORES DE LECHE DOS PINOS Y EL ESTADO ANTE LA EVIDENTE CONTAMINACIÓN DEL RIO SIQUIARES, POR EL DESASTRE ECOLÓGICO CAUSADO A LA ZONA Y POR EL DAÑO FÍSICO, SOCIAL Y MATERIAL OCASIONADO A LA POBLACIÓN. En razón de la similitud entre el peritaje presentado por IPS y el contratado por la comunidad, con respecto a los diferentes tipos de afectación provocada por la contaminación del Río Siquiares en Ciruelas y Turrucares, se somete a consideración del juzgado el siguiente plan de compensación hacia dichas comunidades por parte de la empresa Dos Pinos y el Estado. 1. COMPENSACIÓN POR LA CONTAMINACIÓN A.- La empresa Dos Pinos cumplirá de por vida con todos los requerimientos necesarios para estabilizar y poner a funcionar óptimamente su planta de tratamiento, como es y ha sido su obligación para con el ambiente y comunidades que le rodean/ desde que empezó a producir, de manera que sus aguas de vertido en vez de contaminar, ayuden a la purificación natural de que es objeto el Río Siquiares tal y como lo demuestran las pruebas biológicas descritas en el peritaje contratado por la comunidad. B. Para que las Asociaciones conservacionistas de Ciruelas y Turrúcares puedan estar seguras del cumplimiento de la empresa para con el ambiente, la empresa destinará un rubro mensualmente por cinco años para que cada una de estas asociaciones pueda desempeñar su función fiscalizadora y denunciante. C. La empresa Dos Pinos pagará los gastos de la Gestión Comunal, gastos que la comunidad nunca debió haber tenido que realizar. 1. COMPENSACIÓN POR EL DAÑO BIOLÓGICO AL RIO Y SUS ALREDEDORES A. La cooperativa patrocinará una campaña comunal de reforestación de las márgenes del río desde (a pista hasta Turrúcares, mediante la adquisición de árboles autóctonos de la zona, los cuales a manera de motivación y promoción para la empresa, serán sembrados por los mismos vecinos y niños de la comunidad, quienes a su vez deberán velar por su desarrollo. B. La empresa patrocinará por cinco años, una vez a! año, una campaña de limpieza profunda de basura no tradicional a lo largo de todo el río, desde la pista hasta Turrúcares. (incluye personal y vehículos). C. Siembra de peces autóctonos de esta zona. D. Hacer el estudio para encontrar la mejor formo para captar la naciente del Río Siquiares. realizar dicho captación y entubar el río hasta la zona industrial, para evitar la contaminación del río con materia fecal proveniente de Las urbanizaciones construidas en los alrededores del río, y con esto obtener un perfecto control de la contaminación que la zona industrial pudiera ocasionar al Río Siquiares, y contribuir con ello a la salud de los habitantes de toda esta zona. 2. COMPENSACIÓN POR EL DAÑO SOCIAL, FÍSICO (a la salud), MATERIAL Y MORAL DE LA POBLACIÓN DE CIRUELAS A. La Dos Pinos pagará por una sola vez a una empresa privada, escogida por la Asociación Conservacionista, un estudio de las aguas negras que van al río para determinar puntos y soluciones estratégicas. B. La Dos Pinos proporcionará todos los materiales y mano de obra necesarios para la construcción de mínimo cuatro tanques sépticos comunales para captar las aguas negras y domésticas en lugares en donde por las condiciones sociales se dificulta su captación y son dirigidas al río. La Asociación conservacionista de Ciruelas será la responsable de buscar permisos con los propietarios de fas propiedades en donde se harían estos tanques. 3. COMPENSACIÓN POR EL DAÑO SOCIAL, FÍSICO, MATERIAL Y MORAL DE LA POBLACIÓN DE TURRÚCARES A. La empresa Dos Pinos colaborará, tal y como lo había acordado con la Municipalidad en 1998, con la protección de las dos primeras nacientes, que son las que se encuentran a nivel del río (Siquiares y Turrúcares centro). Asumirá los costos de un buen estudio por parte de un hidrólogo que determine el método más conveniente de hacerlo, y proporcionará todos los materiales y mano de obra necesarios para la construcción. B. La Dos Pinos proporcionará todos los materiales para una nueva captación de agua en la Pradera la cual se encuentra lejos del Río Siquiares previniendo que las antiguas nacientes se inunden por el posible aumento del caudal del río, producto de la recepción de las aguas residuales de la empresa ó bien hará un pozo en Turrúcares Centro que abastezca de agua potable a la comunidad durante la época de sequía. 3. OTRAS FORMAS DE COMPENSACIÓN A. La compensación aprobada por los tribunales deberá ser publicado en La Nación, La República y el Extra/ para de esta manera, la justicia aplicada sirva de ejemplo a todas las empresas que en lo sucesivo intenten dañar nuestros recursos, perturbando la tranquilidad de las poblaciones/ y poniendo en peligro la salud de las comunidades y así sentar un precedente. B. Con el fin de asegurar el cumplimiento y el buen desarrollo de las obras, en pro del bienestar de todos, proponemos que la ONG Asociación Justicia para la Naturaleza se haga cargo del monitoreo en la zona. visitando las obras las veces que sea necesario y arreglando personalmente con la empresa sus honorarios por esta función. A esta inspección deberán asistir regularmente miembros de las Asociaciones Conservacionistas de Ciruelas y Turrúcares, y se convocará, de ser necesario, a miembros del MINAE. Municipalidad y Ministerio de Salud, para que asistan a la inspección. PARA EL ESTADO A TRAVÉS DEL MINISTERIO DE SALUD: A. Que agilice todos los procedimientos y permisos necesarios para el buen desarrollo de todos los proyectos que proponemos y que se aprueben en los Tribunales. B. Que el Ministerio de Salud proteja de toda contaminación la naciente del río Siquiares, que actualmente, y también por negligencia de este Ministerio por falta de exigencia y control, está siendo contaminada por urbanizaciones que no tienen plantas de tratamiento. C. Que el Ministerio de Salud presente a las asociaciones conservacionistas de Ciruelas y Turrúcares, cada dos meses un informe sobre el funcionamiento de la empresa Dos Pinos. " @
  3. 3La representación de la Cooperativa de Productores de Leche, R.L (Dos Pinos) contesta la demanda oponiendo las excepciones de falta de capacidad de las asociaciones ejecutantes, de pago, la que denominó falta de formalidad y de derecho, de prescripción del principal e intereses, cosa juzgada, la genérica de sine actione agit y la falta de competencia, para que se rechace en todos sus extremos la ejecución y se condene a la parte actora al pago de las costas procesales y personales por actitud temeraria. Por su parte la representación Estatal también se opone a la ejecución alegando las excepciones de falta de legitimación ad causam activa y pasiva, falta de derecho y falta de interés actual, para que se rechacen las liquidaciones presentadas, se absuelva al Estado del pago de costas de la ejecución y se condene al promovente al pago de ambas costas.
  4. 4El licenciado Luis Guillermo Ruiz Bravo, Juez del indicado Juzgado, en sentencia número 807-04 de las diez horas del seis de julio del dos mil cuatro dispuso: "POR TANTO: Por todo lo expuesto y citas de ley indicadas, se rechazan las excepciones de prescripción de principal e intereses, la excepción de falta de derecho e interés actual y la genérica de sine actione agit, la de pago y cosa juzgada. Se acogen las excepciones denominadas, falta de formalidad y de derecho en el pago al ambiente y falta de competencia atinente a las pretensiones de los ejecutantes. Se declara con lugar la excepción de falta de legitimación y capacidad de las Asociaciones Conservacionista de los Ríos y el Ambiente de Ciruelas de Alajuela (ACORACE) y Amigos del medio ambiente del río Siquiares y sus Nacientes de Turrucares (ASAMARS). Se declara parcialmente con lugar la presente ejecución de sentencia, en consecuencia se condena en forma solidaria al Estado y la Cooperativa de Productores de Leche R.L., al pago en favor de la ejecutante Julie Roos Ayub, de la suma de ciento setenta y ocho mil seiscientos treinta y cuatro colones con veinte céntimos por concepto de costas procesales y personales del recurso de amparo, mas los intereses que tal rubro genere desde la firmeza de esta resolución y hasta su efectivo pago. Son las costas procesales y personales de esta ejecución a cargo de los demandados."
  5. 5Que inconforme con lo resuelto, los actores apelaron, recurso que le fue admitido, y en virtud de lo cual conoce este Tribunal en alzada.
  6. 6Que en los procedimientos se han observado las prescripciones de rigor y no se notan causales de nulidad que invaliden lo actuado o deban ser corregidas. Esta sentencia se dicta previas las deliberaciones de rigor y,

Redacta la Juez Fernández Brenes, y,

CONSIDERANDO:

I.DE LOS HECHOS PROBADOS.- Para una mayor claridad, este Tribunal se permite reformular el elenco de hechos probados, para tenerlos de la siguiente manera: 1).- Que dentro del proceso de evaluación de estudio de impacto ambiental, la Comisión Plenaria de la Secretaría Técnica Ambiental en sesión número 053-99, celebrada el 21 de diciembre de 1999, artículo 4, fijó un monto de garantía al proyecto la Planta Procesadora de Leche Cruda El Coyol-Dos Pinos, de ciento veintiocho mil cuatrocientos treinta dólares americanos ( $ 128.430.00) o su equivalente al cambio de la moneda nacional, a ser depositado en la cuenta de custodia de garantías ambientales número 297-MINAE-FONDO NACIONAL AMBIENTAL (SETENA), en el Banco Nacional de Costa Rica, el cual fue depositado por la empresa el 19 de mayo del 2000 (folios 594 a 598); 2).- Que la planta Procesadora de Leche Cruda El Coyol-Dos Pinos comenzó a funcionar en el mes de octubre del 2000 (sentencia 2001-1882 de la Sala Constitucional, que se ejecuta, folio 1010); 3).- Que el 29 de noviembre del 2000, Julie Roos Ayub, Carlos Luis Quesada Altamirano, Abel Víquez Fuentes y José Luis Madrigal Moya presentaron recurso de amparo contra el Ministerio de Salud y la empresa Cooperativa de Productores de Leche, R.L.

(Dos Pinos) ante la Sala Constitucional, por la contaminación de las aguas del río Siquiares en afección de las comunidades de Turrúcares, Cebadilla, San Miguel y Siquiares, el cual fue tramitado en expediente número 00-010098-0007-CO (folios 17 a 20); 3).- Que mediante sentencia número 2001-01882, de las 09:24 horas del 9 de marzo del 2001, la Sala Constitucional resolvió ese recurso, disponiendo "Se declara con lugar el recurso. Se condena a la Cooperativa de Productores de Leche R.L. y al Estado, solidariamente, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo" (ejecutoria de folio 996 al 1025, así como copia certificada del expediente competo del folio 17 al 452); 4).- Que en diciembre del 2001 Julie Roos Ayub formuló denuncia administrativa por daño ambiental ante el Tribunal Ambiental Administrativo, la cual se tramitó en 2001, la Secretaría Técnica Nacional Ambiental (SETENA) en colaboración con el IPS realizó una valoración económica del daño ambiental ocasionada por el proyecto de la Cooperativa de Productores de Leche Dos Pinos, en el Coyol de Alajuela, el cual fue adicionado por informe de abril de ese mismo año, en el que, sobre la metodología costos de tratamiento, se hace la siguiente tasación de los daños ambientales: costos de tratamiento: $ 92.189, costo social: $ 92.189, costo biótico del daño: $ 27.653,7 y costo de gestión: $ 6.307, para un gran total de $ 218.341,7 (folios 453 a 504 y 1041 a 1088); 6).- Que la denuncia tramitada en expediente 171-00-TAA fue resuelta por el Tribunal Ambiental Administrativo en resolución 369-01-TAA, de las 8:00 horas del 4 de junio del 2001, en que declaró responsable por daño ambiental por la contaminación del río Siquiares a la Cooperativa de Productores de Leche Dos Pinos R.L y al señor Jorge Julio Pattoni Saenz solidariamente, por lo que dispuso entre otras medidas de mitigación del daño, la cancelación de noventa y dos mil ciento ochenta y nueve dólares, que al tipo de cambio para la venta es la suma de treinta millones ciento veintitrés mil seiscientos sesenta y siete colones de indemnización, según la valoración económica del daño realizada por la SETENA y el IPS, y le impuso las siguientes medidas de mitigación al ambiente: presentar ante la SETENA y el Ministerio de Salud para su aprobación, un programa para succionar los sedimentos y larvas acumulados derivados de la contaminación en el cauce del río contaminado y un plan de gestión ambiental que contemple el manejo integral de los desechos sólidos y líquidos (folios 1141 al 1154 y certificación de folio 1219 al 1238); 7).- Que el 2 de octubre del 2001, la Cooperativa de Productores de Leche Dos Pinos R.L depositó en favor del MINAE, mediante el cheque 99273-4 del primero de octubre del 2001, la suma indemnizatoria fijada por resolución 369-01-TAA, emitiéndose el entero a favor del gobierno numero 392084 D por la suma de treinta millones ciento veintitrés mil seiscientos setenta y siete colones exactos (certificación de folio 1163 al 1166 y del 1236 al 1238); 8).- Que la contaminación del río Siquiares causada por el funcionamiento de la Procesadora de Leche Cruda El Coyol-Dos Pinos provocó daños y molestias en las comunidades de Turrúcares, Siquiares, San Miguel y Cebadillas, consistentes en los malos olores que emanaban del río, pérdida de usos potenciales, perjuicios en actividades económicas y recreativas, aumento de plagas (zancudos y moscas) (informe de estimación de costos por los daños socio-económicos ambientales, visible a folios 453 a 504); 9.) Que los ejecutantes aportan ciento once documentos originales entre facturas, recibos, colillas y comprobantes, como parte de los gatos realizados en esta litis y sus antecedentes (folio 526 al 569); 10).- Que al momento de promoverse y fallarse el recurso de amparo no estaban conformadas las asociaciones ejecutantes (los autos).

II.DE LOS AGRAVIOS DE LOS RECURRENTES.- Los actores apelan la sentencia número 807-04 de las diez horas del seis de julio del dos mil cuatro, por no compartir la posición del a-quo respecto del acogimiento de la falta de legitimación ad causam activa aducida, lo cual torna improcedente la mayor parte de los rubros reclamados, por cuanto el recurso de amparo se interpuso para pretender la tutela del derecho ambiental que otorga el artículo 50 de la Constitución Política estimado infringido por la actuación de las demandadas (contaminación del río Siquiares) en perjuicio de las comunidades de Ciruelas, Turrúcares, San Miguel y Cebadillas; de manera que en ningún momento, pese a que ese recurso fue suscrito por cuatro personas, no se actuó a título personal, sino en nombre de las indicadas comunidades, y siempre fueron apoyados por grupos de hecho que compartían su posición, de ahí también, que al formular la petitoria se refiriera para proyectos comunales no para beneficio personal de los actores.

Nótese, que la propia Sala Constitucional estableció: "... A juicio de la Sala, de la situación descrita se constata que durante el periodo señalado ocurrió la contaminación acusada, lo que constituyó una infracción a los derechos fundamentales a la salud y a un medio ambiente sano y ecológicamente equilibrado de los vecinos de las comunidades afectadas, lo que obliga a estimar el amparo..."; por lo que la sentencia fue favorable para toda la comunidad, no solo para Julie Roos y demás denunciantes. En virtud de lo anterior, estiman que si ellos interpusieron el recurso de amparo, lógicamente son ellos los que tienen capacidad para interponer las diligencias de ejecución. Alegan que el espíritu del artículo 50 de la Constitución, va más allá de simples conceptos procesales y permiten o amplían la posibilidad de que la ejecución por los daños ambientales causados puedan ser liquidados a nombre de la colectividad, por la naturaleza de los intereses difusos que rigen la materia.

Limitar la legitimación se contrapone con lo consagrado en esa norma constitucional, motivos por lo que solicitan revocar la resolución apelada y reconocer los aspectos denegados incluyendo el daño moral reclamado.

III.POSICIÓN DE LA REPRESENTACIÓN DEL ESTADO.- El representante estatal pide confirmar la sentencia recurrida, cuyos razonamientos hace suyos e indica que en el estado actual de la evolución jurídica, lo pedido no puede ser otorgado so pena de quebrantar no solo el valor de la cosa juzgada, sino los mismos fundamentos en que descansa la legitimación activa que se exige en cualquier proceso jurisdiccional; además de que lo pretendido no encuentra asidero normativo, deviniendo en obligatoria la desestimación parcial de la demanda, en los términos y alcances con que fuera resuelto por el a-quo.

IV.VALORACIONES PREVIAS PARA LA EJECUCIÓN DE SENTENCIA QUE SE CONOCE.- Se advierte que en este tipo de procesos no se puede cuestionar ni valorar la actuación de la Administración –concretamente del Ministerio de Salud– ni de la empresa codemandada –Cooperativa de Productores de Leche, R.L. (Dos Pinos), por cuanto ha sido en virtud del conocimiento que de ella hizo nuestro Tribunal Constitucional, que se determinó que era contraria al Derecho de la Constitución, al quebrantar de manera directa el derecho a un ambiente sano y ecológicamente equilibrado, en los términos previstos en el artículo 50 constitucional, por una conducta omisiva, respecto de la primera, al haber omitido la labor de control y fiscalización que el ordenamiento le impone en aras de hacer efectiva esa tutela al ambiente, y por una conducta activa contaminante de la segunda, por verter los desechos directamente al río, sin adecuarse a los parámetros ambientales definidos en el ordenamiento (Reglamento de Vertido y Reuso de Aguas Residuales, Decreto Ejecutivo número 26.042-S-MINAE).

De manera que en este proceso, sólo se determinará la existencia de los daños ocasionados al ambiente por aquella conducta (evaluada por la Sala Constitucional), la cuantificación económica de esos daños, y el sujeto legitimado para accionar en esta vía y para percibir ese pago. Ahora bien, se advierte que, aún cuando los hechos que fueron valorados por la Sala Constitucional se dieron a partir del funcionamiento de la planta procesadora de la Dos Pinos en el Coyol de Alajuela en octubre del dos mil, y es en febrero del dos mil uno que ese Tribunal dicta su sentencia estimatoria del recurso de amparo que le fuera planteado, no es posible estimar que los daños –cuya existencia y liquidación se intentan determinar en este proceso de ejecución– deban de circunscribirse a ese lapso de cuatro meses, como lo alega la representación del Estado, por cuanto es lo cierto que hubo una acción contaminante de efectos continuados en el ambiente, que como lo indican los estudios técnicos aportados al expediente, requiere, de acciones técnicas adecuadas y de un plazo prolongado para revertir la contaminación causada al río Siquiares, esto es, para restituirle a la situación anterior de la afectación sufrida.

V.DE LA LEGITIMACIÓN DE LOS RECURRENTES PARA PROMOVER ESTA EJECUCIÓN DE SENTENCIA.- Es lo cierto que con la reforma del artículo 50 de la Constitución, mediante ley número 7412, de tres de junio de mil novecientos noventa y cuatro, no solo se reconoció en forma expresa el contenido del derecho a un ambiente sano y ecológicamente equilibrado a todas las personas, sino también que, respecto de la debida tutela de este derecho, se estableció una amplísima legitimación (directa o difusa) que permite a todo individuo a interponer las correspondientes acciones ante las instancias administrativas o jurisdiccionales para reclamar la protección de este derecho, en atención a la especial naturaleza del bien de que se trata –ambiente–, que trasciende la esfera particular de los interesados y se confunde con el de la colectividad de la nación, en tanto su titularidad reposa en los mismos detentadores de la soberanía, es decir en todos y cada uno de los habitantes de la República, motivo por el cual, la jurisprudencia constitucional ha señalado que se trata de un verdadero interés que atañe a la colectividad nacional (en tal sentido pueden consultarse las sentencias número 2002-9703, 2003-3656 y 2003-6323).

Fue precisamente en ejercicio de esa legitimación que Julie Roos Ayub; Luis Quesada Altamirano, Abel Víquez Fuentes y José Luis Madrigal Moya presentaron recurso de amparo ante la Sala Constitucional, tema en el que no hay discusión; como sí lo hay en relación con la legitimación de las asociaciones actoras para promover esta ejecución de sentencia, así como para percibir el pago de la supuesta indemnización por daño ambiental. En cuanto al primer punto, estima este Tribunal que no lleva razón el a-quo al haber admitido la excepción de falta de legitimación ad causam respecto de las asociaciones actoras, en virtud de lo cual, el reclamo que se hace en esta ocasión esté limitado a un daño eminentemente personal de sus representantes, que sí habían presentado ese recurso de amparo. No tomó en consideración el juzgador de instancia que aún cuando ese recurso de amparo fue interpuesto por cuatro personas en su condición personal, es lo cierto que lo hicieron en representación de los intereses de las comunidades de Siquiares, Cebadilla, Turrúcares y San Miguel, para lo cual alegaron los efectos dañinos que provocó en el ambiente el funcionamiento de la planta procesadora de leche de la Cooperativa Dos Pinos (imposibilidad de aprovechar el agua para riego y toma de agua del ganado, para destino recreativo, malos olores, alteración de las condiciones naturales del agua del río); situación que sí entendió el Alto Tribunal Constitucional, toda vez que estimó la infracción del derecho fundamental a un ambiente sano y ecológicamente equilibrado respecto de "todos los vecinos de las comunidades afectadas".

En virtud de lo cual, es que deben tenerse como debidamente legitimadas a los actores para promover esta ejecución de sentencia, en tanto actúan en representación de los intereses de las comunidades afectadas por la contaminación en cuestión, precisamente por el derecho que les fue declarado a su favor en la sentencia 2001-1882 de la Sala Constitucional. De igual manera, y por los mismos motivos indicados, es que las objeciones que se hacen respecto de la actuación en este proceso de dos asociaciones sin fines de lucro, conformadas y representadas precisamente por dos de los propios recurrentes de ese amparo, tampoco son de recibo, no obstante que fueron creadas con posterioridad a ese fallo constitucional. En efecto, debe estimarse que, al ser los mismos actores y los mismos intereses en juego, puede estimarse que hubo una subsunción de la representación que estaban ejerciendo los gestores del amparo en estas dos asociaciones creadas, precisamente para dedicarse a la tutela del ambiente de las comunidades de Ciruelas, Siquiares y Turrúcares.

VI.DE LA LEGITIMACIÓN DE LOS RECURRENTES PARA PERCIBIR LA LEGITIMACIÓN RECLAMADA.- Sobre este punto debe de advertirse que, aún cuando la legitimación para reclamar por el daño al ambiente sea realmente amplia –en los términos establecidos en el citado numeral 50 de la Carta Fundamental–, es lo cierto que en forma indiscriminada no cabe una extensión de la titularidad para recibir el pago de la correspondiente indemnización con ocasión a la demanda por el daño ambiental, sobre todo si se atiende a la especial naturaleza del bien de que se trata, toda vez que el ambiente se comporta como un bien colectivo, de donde, en principio no es posible que un particular o entidad de derecho privado pretender una indemnización o reparación de un daño del cual no es su titular. Por este motivo es que la representación de la empresa codemandada alegó como excepción de este proceso la falta de competencia de los actores para percibir el pago, en tanto sólo le atañe al Tribunal Ambiental Administrativo el cobro del daño al ambiente, y al Ministerio de Salud el del daño a la salud.

No comparte este Tribunal esta tesis, toda vez que en materia ambiental se producen dos tipos de daños diferenciados, los directos, sobre los que no hay discusión, por cuanto son susceptibles de ser individualizados, por constituirse en daños directos en la víctima, al traducirse en daños corporales, patrimoniales o intereses morales, en los términos expresamente previstos en el artículo 41 de la Constitución Política; de manera que será el titular del patrimonio lesionado, o aquel que hubiera sufrido el daño en su esfera personal o en sus intereses jurídicamente protegidos, el que pueden instar la correspondiente indemnización; y los indirectos, que la doctrina internacional y la jurisprudencia constitucional nacional ha catalogado como colectivos, esto es, que atañen a la colectividad en su conjunto. Es sobre este último tipo de daño que se motiva esta ejecución, y no como pretende la Procuraduría, que lo califica y circunscribe al primer tipo de daño ambiental, como se indicó en el Considerando anterior; sobre el que la doctrina (DE MIGUEL PERALES, Carlos, La responsabilidad civil por daños al medio ambiente.

Editorial Civitas, S.A. Primera reimpresión. Madrid. España. 1994. pp. 285 a 332, y MORENO TRUJILLO, Eulalia. La protección jurídico-privada del medio ambiente y la responsabilidad por su deterioro. J.M. Bosch Editor, S.A. Barcelona. España. 1991. pp. 286 y 287) como consecuencia del ordenamiento norteamericano, ha elaborado un nuevo concepto que permite reconocer la legitimación para realizar este cobro: las "class actions" (que puede ser traducida como la "acción de la clase o del grupo"), que surge como un mecanismo procesal definido como la acción ejercida por el demandante no encaminada a garantizar únicamente su propio interés, sino igualmente el de los que se encuentren en la misma situación que él, de manera que se permite a un actor actuar en representación de otras reclamaciones individuales similares a la suya; sin que pueda ser confundida ni con la acción popular ni con la litis consorcio.

Así, no resulta siquiera necesario la existencia de una organización jurídicamente organizada –asociación o ente corporativo– para la tutela ambiental, sino que basta la mera categoría de hecho, de una clase individualizada o individualizable sobre la base de cualquier criterio de distinción que, en nuestro caso, es el daño al ambiente, situación que precisamente se da en este caso, en que, unos vecinos se arrogan la representación de los intereses de la comunidad en lo relativo, primero a la determinación de una actuación antijurídica por daño ambiental, y ahora, para lograr su debida indemnización. En virtud de lo cual, es que se estima que las asociaciones actoras (Asociación Conservacionista de los Ríos y el Ambiente Ciruelas de Alajuela (ACORACI), y Asociación de Amigos del Medio Ambiente del Río Siquiares y sus Nacientes de Turrúcares (ASAMARS) están debidamente legitimadas para percibir la indemnización reclamada por el daño ambiental que determinó la Sala Constitucional en sentencia número 2001-1882.

VII.DE LA ACREDITACIÓN DE LOS DAÑOS POR CONTAMINACIÓN AMBIENTAL.- Determinada la legitimación que ostentan las asociaciones ejecutantes para pretender la indemnización por daño ambiental que ocasionó la puesta en funcionamiento de la planta procesadora de leche de la Cooperativa de Productores de Leche, R.L. Dos Pinos en el Coyol de Alajuela, es necesario advertir que, tratándose de una materia técnica, este Tribunal se sustentará en los estudios que han sido aportados por las actoras, en tanto han sido elaborados por el órgano técnico de la Administración en la materia (Secretaría Técnica Nacional Ambiental) –de conformidad con lo dispuesto en los artículos 83 y 84 de la Ley Orgánica del Ambiente– y por profesionales competentes en la materia, los cuales no fueron objetados ni desvirtuados por las demandadas, con lo cual, se da cumplimiento al principio constitucional ambiental de la objetivación de la tutela ambiental, que exige que las decisiones en esta materia estén debidamente sustentadas en la ciencia y la técnica (como derivado de la discrecionalidad administrativa, artículos 16 y 160 de la Ley General de la Administración Pública).

Es así como, de conformidad con valoración ambiental económica del daño ambiental visible a folios 1041 a 1087, ampliado por el estudio visible a folios 453 a 504), mediante la metodología de costos de tratamiento, que comprende las siguientes variables del daño al ambiente: a) el costo del tratamiento, que no valora –en rigor– el daño ambiental que la contaminación ha producido, sino más bien establece una aproximación del valor del daño con el costo de haber aplicado las medidas pertinentes para que la fuente de daño no se produjera, por lo que es un el valor mínimo aplicable (estudio técnico de la valoración económica del daño ambiental ocasionado, folios 1041 a 1053), que fue fijado en noventa y dos mil ciento ochenta y nueve dólares americanos ($92.189.00); b) el costo biótico del daño, que atiende al componente de vida y todos los sub-componentes, esto es, a

"la calidad del ambiente, las posibilidades de que el ambiente satisfaga las necesidades para que los organismos que lo habitan se desarrollen de manera saludable, y el equilibrio que debe existir de manera natural entre los aspectos físicos y químicos dentro de los rangos normales, para cada situación particular. En el caso de procesos de contaminación ambiental, todos esos sub-componentes se alteran, dando paso a la degradación de la fase abiótica de los ecosistemas, dando paso a la degradación de la fase abiótica de los ecosistemas y alterando el equilibrio natural: es el caso del derrame de vertidos desde la planta de tratamiento de la Dos Pinos el cual ha provocado una ruptura en el equilibrio del río Siquiares" (Ampliación de Informe Final, folio 454).

En el caso del río Siquiares, con sustento en las pruebas bioquímicas aportadas al expediente y reflejadas en los estudios técnicos, se logró determinar que en la estación que se encuentra en la salida del efluente de la planta de procesamiento de leche de la Dos Pinos, aproximadamente cincuenta metros aguas abajo, demás de la contaminación arrastrada por el agua de las estaciones anteriores, se suman los vertidos de esta industria, que presenta las siguientes características –según visita de campo realizada el diez de abril del dos mil uno–:

"Ha sido afectada por el incremento de sólidos totales, sólidos suspendidos totales, sólidos disueltos y sólidos sedimentables, materia orgánica en general y ligeramente por la carga de grasas y aceites que se vierten desde la planta de tratamiento, lo que ha provocado un incremento en la tasa de DBO5 y de DQO y, por lo tanto también de la desoxigenación del agua. La existencia de grasas en las aguas genera problemas en su poder tensoactivo que impiden la captación de oxígeno o genera una película envolvente de los flóculos biológicos impidiendo su respiración y aligerándolos por lo que entran en flotación." Lo anterior se traduce en la pérdida del oxígeno del agua, esto es, se impiden los procesos respiratorios de los organismos acuáticos, debido a que saturan las branquias de los peces, insectos y otros, provocando la muerte de los mismos por asfixia; lo que impide cualquier tipo de vida en el lecho del río y en esas aguas.

Este daño (al componente biótico) fue valorado en veintisiete mil seiscientos cincuenta y seis dólares ($ 27.656.00); c) el costo social del daño causado, que son los daños sufridos por la comunidad con ocasión de la contaminación en estudio producto de los malos olores del río –debido al arrastre del material orgánico y su sedimentación, por lo que se generan lodos orgánicos en proceso de descomposición anaeróbica–, la pérdida de los usos potenciales del río (para uso agrícola, ganadero, recreativo y de esparcimiento), y el crecimiento de algunas plagas (especialmente zancudos y moscas), valorado en noventa y dos mil ciento ochenta y nueve dólares americanos ($92.189.00); y d) el costo de gestión, que comprende todos los gastos en que los actores incurrieron, tanto para la presentación del recurso de amparo como también de esta ejecución, que como lo señalan las demandadas, comprenden las costas del proceso (personales y procesales), tasadas en seis mil trescientos siete dólares americanos ($ 6.307.00).

Con lo cual, se da cumplimiento a la exigencia dispuesta en el artículo 693 del Código Procesal Civil que exige que, en los procesos de ejecución, cuando se ha condenado en abstracto a pagar daños y perjuicios, al victorioso le asiste la carga de la prueba de la demostración de esos daños y perjuicios que han sido ocasionados con la actuación antijurídica del vencido, así como la correspondiente liquidación concreta y detallada. En virtud de lo cual, no resulta atendible la excepción opuesta por la Cooperativa demandada, en el sentido de estimar una falta de formalidad y de derecho por no haber demostrado las actoras los daños causados con ocasión del funcionamiento de su planta procesadora de leche; por cuanto se insiste, los mismos están sustentados en los respectivos estudios técnicos, sin que hubiesen sido desacreditados por los demandados.

VIII. DE LOS PRINCIPIOS CONSTITUCIONALES QUE RIGEN LA INDEMNIZACIÓN POR DAÑO AMBIENTAL

Previo a la valoración de las sumas solicitadas en concepto de indemnización por daño ambiental en perjuicio de los vecinos de las comunidades afectadas, es necesario recordar que, todo el esquema de la responsabilidad patrimonial tiende a la reparación de los daños sufridos, en los términos previstos en el artículo 41 constitucional, que prevé el mecanismo general del resarcimiento, precisamente para subsanar todo daño "... recibido en su persona, propiedad o intereses morales." Esta reparación en materia ambiental cobra especial relevancia, por cuanto, en atención al tipo de bien de que se trata, por ser un bien de evidente interés de la colectividad, y por las significativas consecuencias que pueden provocar en los diversos sistemas ecológicos, es que, en forma prioritaria debe de procurarse la restauración del ambiente a la situación en que se encontraba con anterioridad al daño causado, para revertir esos efectos negativos sobre los diversos componentes ambientales, que comprende la denominada indemnización in natura, consistente en medidas compensatorias o preventivas, que tienen maticen ese carácter esencialmente reparador de la indemnización; y en forma adicional, cuando así proceda, la indemnización patrimonial (dineraria), sin que sean excluyentes una de la otra, ni tampoco subsidiarias.

En todo caso, es importante anotar que, los dineros que se reconozcan en concepto de indemnización por daño ambiental deben de ser destinados en forma exclusiva a paliar la lesión que la motiva, que tiene como sustento el reconocimiento del derecho a un ambiente sano y ecológicamente equilibrado, lo que no va a acontecer, si las actoras pueden disponer de esos fondos de la manera que les plazca, sin aplicarlos de una vez a la mitigación de la lesión ambiental juzgada; por cuanto el permitir su destino a otras causas o fines implicaría desnaturalizar la figura de la indemnización (En igual sentido, puede consultarse la sentencia número 392-2006, de las catorce horas cuarenta minutos del treinta y uno de agosto del dos mil seis, de la Sección Segunda de este Tribunal).

IX.DE LOS DAÑOS QUE SE CONCEDEN.- Ahora bien, en cuanto al primer componente de la indemnización que se conoce (el relativo al costo del tratamiento por el daño), es lo cierto que el mismo fue pagado en la vía administrativa por la empresa contaminante – la Cooperativa de Productores de Leche, R.L. (Dos Pinos)– el dos de octubre del dos mil uno, con ocasión de la denuncia interpuesta en esa vía ante el Tribunal Ambiental Administrativo por Julie Roos Ayub, por los mismos hechos aquí conocidos, que en resolución número 369-01-TAA, de las ocho horas del cuatro de junio del dos mil uno, le impuso el pago de la suma fijada en la valoración económica realizada por la SETENA y el IPS por ese concepto, sea, por noventa y dos mil ciento ochenta y nueve dólares americanos ($92.189.00) al tipo de cambio de ese momento, que sumó la cantidad de TREINTA MILLONES CIENTO VEINTITRÉS MIL SEISCIENTOS SETENTA Y SIETE COLONES (¢ 30.123.677.00).

Sobre este pago deben hacerse dos advertencias: en primer lugar, que tal y como se indicó en el estudio técnico que realizó la valoración económica por este daño ambiental, este componente es "un mínimo", que se impone pagarlo al agente activo contaminador, en atención a que su cálculo se realiza sobre la base de los costos que esa industria debió de haber realizado para adecuar su funcionamiento a los parámetros y estándares ambientales, esto es, el costo del tratamiento de las aguas residuales, de donde la base de cálculo lo determinó el nivel de contaminación que entra al sistema y el nivel de contaminación que es vertido al río. Sin embargo, tal y como lo señalaron los estudios técnicos de referencia, ese no es el único componente para cuantificar esta indemnización, lo que hace que deba acogerse de manera parcial la excepción de pago, aducida por la empresa co-demanda, en razón de que no pagó la totalidad del daño causado.

Es así como resulta de interés denotar que en aquella ocasión –vía administrativa– no se atendió a la recomendación de reconocer un rubro por concepto del daño al ambiente por el costo biótico; en virtud de lo cual, habiéndose sido acreditado en el respectivo estudio técnico-científico, cómo se estimó en el Considerando anterior, corresponde ser reconocido en esta vía, en la suma fijada, esto es, por el monto de VEINTISIETE MIL SEISCIENTOS CINCUENTA Y SEIS DÓLARES ($ 27.656.00), para ser pagado en forma solidaria por las demandas, como lo impuso la sentencia ejecutada. Este monto está justificado en el citado informe sobre la siguiente base:

"Es nuestra opinión que en el estimado del costo se debe incluir el componente biótico, el cual, sin embargo no puede ser cobrado en función de una comunidad natural, debido a que aguas arriba de la salida del efluente a planta de tratamiento de la empresa Dos Pinos el ecosistema ya muestra señales de contaminación. Por esa razón el costo estimado debe ser multiplicado por un factor entre 1 (agua natural) y 0 (agua totalmente contaminada), en este caso se estima que el factor se sitúa en 0.3. Por lo tanto, a la fórmula utilizada por IPS, Costo de Tratamiento+a Costro Social+Costo de Gestión se le incluye un cuarto componente B *Costo de Tratamiento, correspondiente al deterioro en la fase biótica, por lo tanto el estimado sería Cobro Total=$92.189 + 1*$92.189 + 0,3 * $92.189 +6.307" (folio 455).

X.Especial consideración debe hacerse respecto del costo social por el daño ambiental reclamado, por cuanto este Tribunal no puede admitir la suma dispuesta en ese informe, por cuanto se fija sin ninguna acreditación metodológica para su cuantificación, lo cual impide su reconocimiento en la suma tasada, precisamente por la falta de pericia. Sin embargo, es lo cierto que en los autos quedaron debidamente sustentados los perjuicios y molestias causadas a las comunidades circundantes del río Siquiares –concretamente Ciruelas, San Miguel, Cebadillas y Turrúcares–, como se detallan en el respectivo informe técnico: "la degradación de la calidad del agua, razón por la cual este líquido no puede ser utilizado durante un largo período y a través de un tramo prolongado de su cauce para otros propósitos tales como riego, abrevadero para ganado, recreación y mucho menos utilizar el agua como fuente para consumo humano" (folio 486), el cual, para su restablecimiento tardará un período medianamente largo (de tres a cinco años).

Estima este órgano colegiado que este rubro debe ser tratado de manera semejante que el daño moral, que permite al juzgador su determinación conforme a la valoración de las circunstancias que rodean el caso, esto es in re ipsa, pero sin que se confunda o identifique con el daño moral en sentido lato o estricto, por cuanto es lo cierto que este tipo de daños (al ambiente) provoca molestias y perjuicios a los afectados; en virtud de lo cual habiéndose acreditado la existencia de esos perjuicios a los vecinos de las comunidades indicadas, no puede dejarse de reconocer su debida indemnización, precisamente en aplicación de los principios de equidad y justicia, la cual, a falta de criterio técnico debe ser fijado en la suma prudencial de CINCO MILLONES DE COLONES (¢5.000.000.00), que corresponde pagar en forma solidaria a las demandadas. En cuanto al último componente del daño ambiental, el relativo al costo de gestión, llevan razón las demandadas en el sentido de que deben ser tratados como costas (personales y procesales); los que en la sentencia recurrida fueron determinados en la suma de CIENTO SETENTA Y OCHO MIL SEISCIENTOS TREINTA Y CUATRO COLONES CON VEINTE CÉNTIMOS; rubro que no fue apelado en esta sentencia, motivo por el cual no procede su valoración en esta ocasión.

XI.Conforme a las razones dadas en el Considerando VIII.- de esta sentencia, se advierte que a las asociaciones actoras (Asociación Conservacionista de los Ríos y el Ambiente de Ciruelas de Alajuela –ACORACI– y Asociación de Amigos del Medio Ambiente del Río Siquiares y sus Nacientes de Turrúcares –ASAMARS–) que las sumas reconocidas en este pronunciamiento deben de ser destinadas ÚNICA Y EXCLUSIVAMENTE a proyectos de restauración del río Siquiares; para lo cual, requerirán la adecuación de los mismos a criterios y estándares técnicos, avalados por la Secretaría Técnica Nacional Ambiental, órgano técnico de la Administración en la materia ambiental; labor que asimismo está sujeta a los controles que competen a las autoridades administrativas, tales como el propio Ministerio de Salud, el Ministerio de Ambiente y Energía, la Procuraduría General de la República, y la Defensoría de los Habitantes, que por mandato legal tienen competencia en esta materia.

En todo caso, se advierte que, el cambio de destino de los dineros reconocidos en este fallo conforme al ordenamiento penal, podría conformar un delito (desobediencia a la autoridad, enriquecimiento sin causa, malversación de fondos, etc.). De conformidad con lo dispuesto en el artículo 79 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa, sobre las sumas concedidas se reconocen intereses a partir de la firmeza de este fallo y hasta su efectivo pago, conforme al tipo legal del artículo 1163 del Código Civil.

XII.DE LA IMPROCEDENCIA DEL RECONOCIMIENTO DEL DAÑO A LA SALUD DE LOS VECINOS DE LAS COMUNIDADES AFECTADAS.- No corren igual suerte los otros daños que se solicitan sean reconocidos por las asociaciones actoras. En efecto, respecto del daño a la salud, que piden se trate como un daño moral, por las afecciones que esta contaminación ha producido en la población no puede ser tratado como tal, en tanto se trata de afecciones corporales absolutamente indeterminadas y genéricas, que a lo sumo podrían motivar el correspondiente reclamo, pero propiamente de los afectados. Asimismo, tal y como lo señalan las propias gestionantes, no existe un estudio técnico-objetivo que acredite a ciencia cierta y con absoluta certeza un problema de salud o epidemia que se haya desencadenado en estas comunidades con ocasión de la puesta en funcionamiento de la planta procesadora de leche Dos Pinos; siendo que no obstante haberse revisado aproximadamente trece mil quinientos expedientes clínicos de los puestos de Salud de Equipo Básico de Atención Integral (EBAIS) de Ciruelas y la Clínica de San Rafael Sur, es lo cierto no se logró determinar en forma fehaciente que la causa de las alergias, infecciones virales respiratorias, crisis de asma leve, parasitosis intestinales, migrañas y cuadros fuertes de diarreas que se intensificaron en los meses de enero a junio del dos mil uno, encuentren su origen único en la contaminación del río Siquiares.

Lo que se obtuvo fue una lista de enfermedades "que podrían estar relacionadas con factores ambientales adversos, como es el caso de la calidad del agua del río Siquiares", pero que también pueden motivarse en "una serie de actividades antropogénicas tales como el urbanismo y principalmente industrialización de la zona aledaña", tal y como lo señalaron los propios gestores.

XIII.DE LAS MEDIDAS COMPENSATORIAS SOLICITADAS.- Por último, las actoras solicitan una serie de medidas compensatorias del daño ambiental causado con la conducta de las demandadas; sin embargo, en su mayoría resultan a todas luces improcedentes, por exceder el contenido reconocido en la sentencia estimatoria de la Sala Constitucional que se ejecuta. En este sentido debe advertirse que aún cuando quedó debidamente motivada y sustentada la contaminación que causó el funcionamiento de la planta procesadora de leche de la Dos Pinos, no puede pretenderse que esta empresa deba pagar y restaurar todo el daño y contaminación ambiental que diversos agentes han causado al río Siquiares, primero, se insiste, por cuanto no se derivan de la sentencia que se ejecuta, y segundo por cuanto en aplicación del principio constitucional ambiental que se enuncia como "el que contamina paga", corresponde a esos otros agentes contaminantes su reparación.

En virtud de lo anterior, no es posible reconocer como parte de esta ejecución rubros para el financiamiento de las asociaciones actoras, que se imponga la construcción de obras de captación y entubamiento de nacientes y tanques sépticos, en tanto se motivan en la contaminación que sobre el río causan las urbanizaciones ubicadas río arriba de la planta Dos Pinos, acciones y dinero para la protección de las nacientes del río, la captación en la Pradera para evitar desabastecimiento en la época de sequía, el patrocinio de una campaña para reforestar los linderos del río y la siembra de peces en el río. Se advierte que la solicitud de publicar esta sentencia en un diario de circulación nacional se constituye en una sanción más, la cual, en atención al principio de tipicidad que rige las sanciones –artículo 39 constitucional–, debe estar debidamente establecida con anterioridad en una ley formal y material, situación que no se da en la especie.

No obstante lo anterior, en aplicación del principio constitucional ambiental que rige la indemnización por daño ambiental, que exige que en este tipo de daño debe de procurarse, primero que nada la restauración in natura –finalidad última de la indemnización en este tipo de daños–, es que, por estar debidamente motivada en el respectivo estudio técnico, debe de imponerse a la Cooperativa Productora de Leche Dos Pinos, R.L adecuar su funcionamiento conforme a los parámetros ambientales establecidos en el ordenamiento y a realizar una limpieza artificial de los cauces del río en las cercanías de la salida de la planta de tratamiento de esa empresa y hasta un kilómetro aguas abajo una vez por tres años consecutivos. Igualmente, resulta pertinente recordarle al Ministerio de Salud su obligación de ejercer el control de la actividad industrial realizada por la codemandada, de manera que debe –al menos– realizar cuatro monitoreos de la calidad del agua al año (uno en la época lluviosa, uno en la época seca, uno en cada período de transición).

XIV.DE LAS EXCEPCIONES OPUESTAS.- Como se ha ido indicando en este pronunciamiento, y al tenor de las consideraciones dadas, es que debe de revocarse la sentencia apelada en relación con las excepciones que inciden sobre la apelación formulada; motivo por el que deben de rechazarse las excepciones de falta de legitimación ad causam activa y falta de competencia de los actores para recibir el pago opuestas por las demandas, y acoger parcialmente las excepciones de pago y de falta de derecho (también denominada como de falta de formalidad), por cuanto no se reconocieron la totalidad de las pretensiones de las actoras.

XV.DE LAS COSTAS.- No obstante que no fue apelado lo relativo a la condenatoria en costas que hiciera la sentencia de instancia, el artículo 224 del Código Procesal Civil permite su valoración, aún de oficio, en la segunda instancia, con ocasión de la apelación formulada, conforme al pronunciamiento que se haga. No estima este Tribunal motivo por el cual deba de ser revocada o modificado ese fallo respecto de este punto –que condenó a las demandadas al pago íntegro a las demandadas (Estado y Cooperativa de Productores de Leche, R.L. Dos Pinos)–, en atención a que se trata de un proceso de ejecución de una sentencia constitucional estimatoria, en la que, se hizo el reconocimiento de una vulneración a un derecho fundamental, y habiéndose admitido la legitimación de actuación de las asociaciones actoras y para percibir el pago correspondiente por la indemnización por daño ambiental, así como haberse acreditado los daños causados por la contaminación del río Siquiares y su cuantificación económica, es que procede su confirmación.

Nótese al efecto que si la empresa codemandada hubiese adecuado su funcionamiento a los parámetros ambientales y la Administración hubiese cumplido con las obligaciones contenidas en el ordenamiento ambiental, reprendiendo y fiscalizando a tiempo el funcionamiento de la planta procesadora de leche de la Cooperativa Dos Pinos, se hubiese evitado el daño ambiental que causó estos procesos en procura de la efectiva tutela al ambiente, como lo ordena el artículo 50 constitucional.

POR TANTO:

En lo apelado, se revoca la sentencia venida en alzada, para en su lugar rechazar las excepciones de falta de legitimación activa y falta de competencia de los actores para recibir el pago. Se acogen parcialmente las excepciones de pago y de falta de derecho (también denominada como de falta de formalidad), entendiéndose denegada la demanda en lo no indicado. En virtud de lo anterior, se condena al Estado y a la Cooperativa Productora de Leche, R.L. Dos Pinos al pago solidario de las siguientes sumas a favor de la Asociación Conservacionista de los Ríos y el Ambiente de Ciruelas de Alajuela (ACORACI) y a la Asociación de Amigos del Medio Ambiente del Río Siquiares y sus Nacientes de Turrúcares (ASAMARS): VEINTISIETE MIL SEISCIENTOS SESENTA Y CINCO DÓLARES AMERICANOS ($27.665.00) en concepto de daño al ambiente y CINCO MILLONES DE COLONES EXACTOS (¢ 5.000.000.00) en concepto de costo social por el daño ambiental producido, para destinarlo única y exclusivamente a proyectos de restauración del río Siquiares, montos sobre los que se reconocen intereses a partir de la firmeza de este fallo y hasta su efectivo pago, conforme al tipo legal del artículo 1163 del Código Civil.

Asimismo, se impone a la Cooperativa Productora de Leche Dos Pinos, R.L a adecuar su funcionamiento conforme a los parámetros ambientales establecidos en el ordenamiento y a realizar una limpieza artificial de los cauces del río en las cercanías de la salida de la planta de tratamiento de esa empresa y hasta un kilómetro aguas abajo una vez por tres años consecutivos. Al Ministerio de Salud se le recuerda su obligación de ejercer el control de la actividad industrial realizada por la codemandada, de manera que debe –al menos– realizar cuatro monitoreos de la calidad del agua al año (uno en la época lluviosa, uno en la época seca, uno en cada período de transición). Comuníquese a la Defensoría de los Habitantes y a la Secretaría Técnica Nacional Ambiental para lo de su cargo, una vez firme esta sentencia.
