POSSESSORY INFORMATION PROCEEDING (proceso de información posesoria) filed by [Nombre1], of legal age, married once, farmer, national ID CED1 - -, resident of San Andrés de León Cortés. Processed before the Agrarian Court (Juzgado Agrario) of the Second Judicial Circuit of San José. The State and the Instituto de Desarrollo Agrario were parties to the proceeding; appearing on behalf of the former was attorney Víctor Bulgarelli Céspedes, of legal age, married, attorney, ID CED2 - -, resident of Heredia, in his capacity as Agrarian Attorney (Procurador Agrario), and on behalf of the latter, attorney Gerardo Vargas Rojas, of legal age, married once, attorney, ID CED3 - -, resident of Atenas, in his capacity as Executive President with the powers of general attorney-in-fact without limit of authority (apoderado generalísimo sin límite de suma). Acting as special judicial attorney-in-fact (apoderado especial judicial) for the petitioner is attorney Alvaro Eduardo Mata Bustamante, of legal age, attorney, ID CED4 - -, resident of San Andrés de León Cortés.

WHEREAS:

I.The titling applicant (titulante) files a possessory information proceeding, valued at five hundred thousand colones, for the purpose of registering in the Public Registry of Property an unregistered parcel described as follows: agricultural land planted with coffee, with an area of 3519-07 square meters, located in the place known as Higuerón, [Dirección1] San Andrés, Canton of León Cortés, Province of San José, which according to the attached cadastral survey plan (plano catastrado) No. SJ-594793-85 has an area of three thousand five hundred nineteen meters and seven square decimeters, whose boundaries are: to the north, a public road with a frontage of one hundred twenty-one meters and sixty-one linear centimeters; to the south, [Nombre2]; to the east, [Nombre3]; and to the west, [Nombre2], (folios 8 to 10).

2. The Procuraduría General de la República and the Instituto de Desarrollo Agrario appeared in the proceeding and opposed it, (folios 64 to 65 and 230).

3. Attorney Juan Carlos Castillo López, first-instance judge, in a judgment issued at fifteen hours thirty-eight minutes on the seventeenth of May two thousand and six, ruled: THEREFORE: In accordance with the foregoing and the applicable legal provisions, THE possessory information proceeding filed by [Nombre1] IS REJECTED. This file shall be archived. The petitioner is advised that this judgment is subject to an appeal, which must be filed before this Court within five days. Within that same period and before this Jurisdictional Body, the factual and legal grounds on which the appealing party bases its objection must be set forth verbally or in writing, under warning that failure to do so will result in the appeal being declared inadmissible, pursuant to Articles 500 and 501, subsections c) and d) of the Código de Trabajo, Votes number 5798 of 16:21 hours of August 11, nineteen ninety-eight and 1306 of 16:27 hours of February 23, 1999, both of the Constitutional Chamber, and Vote number 386 of 14:20 hours of December 10, 1999. NOTIFY THE PARTIES, (folio 235).

4. This Tribunal takes up the appeal filed by the petitioner in a brief submitted to the court on May 31, 2006, (folio 243).

5. In the conduct of the proceeding, the legal requirements have been observed, and no errors or omissions capable of producing the nullity of the judgment are noted. This decision is issued within the legal time limit.

Drafted by Judge Vargas Vásquez; and,

CONSIDERING:

I.The first and third facts deemed proven are accepted, as they are consistent with the evidence on record; the remaining facts are not accepted, as they are not relevant given the manner in which this matter will be resolved at this level.

II.Attorney Alvaro Eduardo Mata Bustamante, special judicial attorney-in-fact for the petitioner [Nombre1], filed an appeal with concomitant nullity against the judgment in a brief submitted to the court on May 31, 2006 (folio 243). No grounds for nullity of the judgment or of the proceedings were stated, and the Tribunal finds no grounds to declare nullity ex officio. As grounds for appeal, the appellant argued: He alleges that the Instituto de Desarrollo Agrario does not own the property sought to be registered; it is merely the regulatory body for lands forming part of the Zona de Titulación Puriscal-Parrita, which has no connection whatsoever to the property to be registered through this proceeding, which is depicted in Cadastral Survey Plan No. SJ-594793-85, located in San Andrés de Higuerón de León Cortés, Province of San José. That property was acquired, he states, through a judicial foreclosure auction (remate judicial), as evidenced by Case No. 572-92 processed before the Third Civil Court of Greater Jurisdiction of San José, by [Nombre4], who later sold it to [Nombre1], such that if the property had in fact belonged to the Instituto de Desarrollo Agrario, it could not have been subjected to a foreclosure auction.

III.The Constitutional Chamber of the Supreme Court of Justice, in Vote No. 8560-01 of 15 hours 37 minutes of August 28, 2001, declared unconstitutional and thereby annulled the Ley de Titulación de Tierras ubicadas en Reservas Nacionales, which regulated the land-titling programs through which large tracts of land — most of them unregistered — were transferred to the Instituto de Desarrollo Agrario and, through the procedure established therein, the occupants of properties located within those areas could appear before the Agrarian Court or before that administrative body to apply for their respective title, with the corresponding parcel subdivision (segregación) being carried out. In this way, the existence of two title deeds over the same property was avoided. Upon annulment of that law, it ceased to have effect; however, the Constitutional Chamber redimensioned the effects of that nullity by stating: "…Finally, the Chamber does not find it appropriate to grant the Procuraduría General de la República's request to declare unconstitutional by connection decrees Nos. 27726-MINAE-MAG of December 22, 1999, No. 27861-MINAE-MAG of March 12, 1999, 28743-MAG-MINAE of June 12, 2000, 28744-MINAE-MAG of June 12, 2000, No. 28745-MINAE-MAG of June 12, 2000, and No. 28746-MINAE-MAG of June 12, 2000, given that what is sought, in substance, is an order that the lands transferred to IDA by virtue of the Ley de Titulación de Tierras en Reservas Nacionales may be acquired by third parties under the terms of the Ley de Tierras y Colonización, which the Chamber considers unnecessary to order, since the aforementioned decrees were also grounded in the Ley de Tierras y Colonización and therefore remain in force for the application of those rules.

Justice Piza dissents and declares that the consulted provisions do not violate constitutional law, as they fall within the constitutional powers of the Legislative Assembly. Therefore: The query is resolved by declaring that Law No. 7599 of April 29, 1996, entitled 'Ley de Titulación de Tierras ubicadas en Reservas Nacionales,' in its entirety and its amendments, is unconstitutional. This judgment has declaratory and retroactive effect to the date of entry into force of the annulled provisions, without prejudice to rights acquired in good faith. However, in accordance with Articles 107, 108, and 91 of the Ley de la Jurisdicción Constitucional, the effects are redimensioned in the sense that the declared unconstitutionality does not affect persons who have titled their lands under the law now declared unconstitutional, provided that the three-year period for challenging the effects of that declaration has elapsed.

This ruling shall be communicated to the Legislative Branch. This ruling shall be summarized in the Diario Oficial La Gaceta and published in full in the Boletín Judicial. Notify the parties." In light of the foregoing, the Constitutional Chamber upheld the validity of the titling actions carried out by the Instituto de Desarrollo Agrario in those areas, including — among others — the one relevant to this proceeding, namely the Zona de Titulación Puriscal-Parrita, such that if the property sought to be registered through this possessory information proceeding falls within that Zone, its registration could not be authorized, as doing so would generate a double title over the same geographic area, regardless of whether the property was acquired through a judicial auction (subasta judicial). In light of this situation, it must first be determined whether the property sought to be registered is in fact located in that area, in accordance with the appellant's arguments.

IV.In the case at hand, titling is sought for a property depicted in cadastral survey plan SJ-594793-85, located in Higuerón de San Andrés de León Cortés, Province of San José, with an area of 3519.07 square meters (folio 4). The representative of the Instituto de Desarrollo Agrario appeared in the proceeding, contending that the property forms part of the Zona de Titulación Puriscal-Parrita, registered in the Public Registry of Property, Partido de San José, at folio real 219039-000, in the name of that entity. As evidence thereof, he submitted the study prepared by the Topography Division (Area de Topografía) of that office, which indicated that the referenced property is cartographically located within that Zone. From the case file, it is not apparent that this last document was brought to the parties' attention as required by Article 476 of the Código de Trabajo, applied supplementarily pursuant to Articles 6, 26, and 79 of the Ley de Jurisdicción Agraria; however, the appellant did not object to this situation on the basis that it caused him a prejudice sufficient to generate the nullity of the judgment, in which that document was used as grounds for rejecting the application.

The appellant did indeed request that the nullity of the judgment be declared; however, he stated no grounds for nullity whatsoever — only grounds for appeal — which do not relate to what occurred regarding the failure to notify the parties of the document, of which the appellant is deemed aware given that he challenges the finding that the property is located within that Zone. Under these circumstances, the Tribunal considers that declaring a nullity ex officio on that basis would only generate unnecessary delays and thus a violation of Article 41 of the Constitución Política, which requires that justice be prompt and complete. In that vein, based on the referenced document — which carries full evidentiary value as it was issued by a public authority — it is possible to conclude that the property sought to be registered does in fact fall within that titling area, and therefore the appellant's contention that it lies outside that Zone is not accepted.

It should be noted that there is no evidence in the case file to support the petitioner's claim that the property is outside that Zone. Likewise, the fact that the property was acquired by the petitioner or his predecessor through a judicial foreclosure auction does not alter these circumstances, and this Tribunal cannot, in this proceeding, issue a ruling as to whether the foreclosure auction in question could have been conducted without the Instituto de Desarrollo Agrario having been made a party to the respective proceeding, as this is a matter that cannot be resolved in a proceeding of non-contentious jurisdiction (jurisdicción no contenciosa).

V. For the foregoing reasons, the challenged ruling must be upheld on appeal

THEREFORE:

The request for nullity of the judgment is rejected. On appeal, that ruling is affirmed.

VOTO N° 0698-F-06 VOTO N° 0698-F-06 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSE, SECCION PRIMERA. Goicoechea, a las diez horas veintidós minutos del once de julio de dos mil seis.

PROCESO DE INFORMACION POSESORIA planteada por [Nombre1] , mayor, casado una vez, agricultor, portador de la cédula CED1 - - , vecino de San Andrés de León Cortés. Tramitada en el Juzgado Agrario del Segundo Circuito Judicial de San José. En el proceso se tuvo como parte al Estado y al Instituto de Desarrollo Agrario, apersonándose en representación del primero el licenciado Víctor Bulgarelli Céspedes, mayor, casado, abogado, cédula CED2 - - , vecino de Heredia, en el carácter de Procurador Agrario, y del segundo el licenciado Gerardo Vargas Rojas, mayor, casado una vez, abogado, cédula CED3 - - , vecino de Atenas, en su condición de Presidente Ejecutivo con facultades de apoderado eneralísimo sin límite de suma. Actúa como apoderado especial judicial del promovente el licenciado Alvaro Euardo Mata Bustamante, mayor, abogado, cédula CED4 - - , vecino de San Andrés de León Cortés.

RESULTANDO:

I.El titulante plantea diligencias de información posesoria, estimadas en la suma de quinientos mil colones con el fin de inscribir en el Registro Público de la Propiedad una finca sin inscribir que se descibe así: terreno para la agricultura, sembrado de café, con una superficie de 3519-07 metros cuadrados, se encuentra ubicada en el lugar conocido como Higuerón, [Dirección1] San Andrés del Cantón de León Cortés de la Provincia de San José, que según el plano catastrado adjunto N° SJ- 594793-85 posee una extensión de tres mil quinientos diecinueve metros con siete decímetros cuadrados, cuyos linderos son al norte con calle pública con frente a la misma de ciento veintiun metros con sesenta y un centímetros lineales al Sur con [Nombre2] , al Este con [Nombre3] y al Oeste colinda con [Nombre2] , (folios 8 a 10).

2. Por su parte la Procuraduría General de la República y el Instituto de Desarrollo Agrario se apersonaron al proceso, oponiéndose al mismo, (folios 64 a 65 y 230).

3. El licenciado Juan Carlos Castillo López, juez de primera instancia, en sentencia de las quince horas treinta y ocho minutos del diecisiete de mayo del dos mil seis, resolvió: POR TANTO: De conformidad con lo expuesto y citas de ley SE RECHAZA el proceso de Información Posesoria promovido por [Nombre1] . Archívese este expediente. Se le advierte al promovente que esta sentencia admite recurso de apelación, el cual deberá interponerse ante este Juzgado en el término de cinco días. En ese mismo plazo y ante éste Organo Jurisdiccional se deberán exponer en forma verbal o escrita los motivos de hechos de hecho o de derecho en que la parte recurrente apoya su inconformidad, bajo el apercibimiento de declarar inadmisible el recurso, según los artículos 500 y 501 inciso c) y d) del Código de Trabajo, Votos número 5798 de las 16-21 horas del 11 de agosto de mil novecientos noventa y ocho y 1306 de la 16:27 horas del 23 de Febrero de 1999, ambos de la Sala Constitucional y Voto número 386 de las 14:20 horas del 10 de diciembre de 1999. NOTIFIQUESE, (folio 235).

4. Conoce este Tribunal del recurso de apelación formulado por el promovente en memorial presentado a estrados el 31 de mayo del 2006, (folio 243).- 5. En la substanciación del proceso se han observado las prescripciones legales, sin que se note la existencia de errores u omisiones capaces de producir la nulidad del fallo. La presente resolución se dicta dentro del plazo legal.

Redacta la jueza Vargas Vásquez; y,

CONSIDERANDO:

I.Se comparten los hechos tenidos por probados primero y tercero al ser acordes con las probanzas constantes en autos; no así los restantes al carecer de interés dada la forma en que se resolverá en esta instancia.-

II.El licenciado Alvaro Eduardo Mata Bustamante, apoderado especial judicial del promovente, [Nombre1] , interpuso recurso de apelación con nulidad concomitante contra la sentencia en libelo presentado a estrados el 31 de mayo del 2006 (folio 243). No expuso ningún motivo de nulidad del fallo ni del trámite, y el Tribunal no encuentra causal alguna por la cual declararla de oficio. Como agravios, el recurrente indicó: Alega, el Instituto de Desarrollo Agrario no es dueño del inmueble que se pretende titular, es solo el ente regulador de las tierras que forman parte de la Zona de Titulación Puriscal-Parrita, la cual no tiene relación alguna con bien a inscribir mediante este proceso, el cual se grafica en el Plano Catastrado Nº SJ-594793-85, ubicado en San Andrés de Higuerón de León Cortés, de la provincia de San José. Ese inmueble fue adquirido, según dice, en remate judicial, según se desprende del Expediente Nº 572-92 tramitado en el Juzgado Tercero Civil de Mayor Cuantía de San José, por parte de [Nombre4] , quien luego le vendió a [Nombre1] , de manera tal que si el inmueble en efecto hubiera sido del Instituto de Desarrollo Agrario, no se hubiera podido rematar.-

III.La Sala Constitucional de la Corte Suprema de Justicia, en Voto Nº 8560-01 de las 15 horas 37 minutos del 28 de agosto del 2001, declaró inconstitucional, por ende anuló la Ley de Titulación de Tierras ubicadas en Reservas Nacionales, la que regulaba los programas de titulación de inmuebles mediante el cual grandes extensiones de tierra en su mayoría no inscritas, eran traspasadas al Instituto de Desarrollo Agrario y mediante el procedimiento ahí establecido, los poseedores de los inmuebles ubicados en ellas, podían acudir al Juzgado Agrario o bien, al citado ente administrativo a gestionar su respectivo título, haciéndose la segregación respectiva. De esta manera, se evitaba la existencia de dos títulos de propiedad sobre un mismo bien. Al anularse la citada ley, la misma quedó sin efecto; no obstante, la Sala redimencionó los efectos de la citada nulidad, al señalar: "…Finalmente, la Sala no estima procedente la pretensión de la Procuraduría General de la República en cuanto a declarar por conexidad inconstitucionales los decretos Nos. 27726-MINAE-MAG de 22 de diciembre de 1999, No. 27861-MINAE-MAG de 12 de marzo de 1999, 28743-MAG-MINAE de 12 de junio del 2000, 28744-MINAE-MAG de 12 de junio del 2000, No. 28745-MINAE-MAG de 12 de junio del 2000 y No. 28746-MINAE-MAG de 12 de junio del 2000, toda vez que en el fondo lo pretendido, es que se ordene que los terrenos traspasados al IDA en virtud de la Ley de Titulación de Tierras en Reservas Nacionales, puedan ser adquiridos por terceros en los términos de la Ley de Tierras y Colonización, lo cual considera la Sala innecesario ordenar, pues los decretos de cita se fundamentaron también en la Ley de Tierras y Colonización, quedando por ende vigentes para la aplicación de esta normativa.

El Magistrado Piza salva el voto y declara que las normas consultadas no son violatorias del Derecho de la Constitución por caer dentro de las potestades constitucionales de la Asamblea Legislativa. Por tanto: Se evacua la consulta formulada en el sentido de que la Ley No. 7599 de 29 de abril de 1996 denominada “Ley de Titulación de Tierras ubicadas en Reservas Nacionales” en su totalidad y sus reformas, es inconstitucional. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de las normas anuladas, sin perjuicio de derechos adquiridos de buena fe. Sin embargo, de conformidad con lo dispuesto por los artículos 107, 108 y 91 de la Ley de la Jurisdicción Constitucional, se dimensionan los efectos en el sentido de que la inconstitucionalidad declarada no afecta a las personas que hayan titulado sus tierras al amparo de la Ley que se declara ahora inconstitucional siempre y cuando haya transcurrido el término de tres años para impugnar los efectos de esa declaratoria.

Comuníquese este pronunciamiento al Poder Legislativo. Reséñese este pronunciamiento en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese." Al tenor de lo expuesto, la Sala Constitucional mantuvo la vigencia de las titulaciones que hiciera el Instituto de Desarrollo Agrario de esas áreas, entre otras la de interés para este proceso, sea la Zona de Titulación Puriscal-Parrita, de manera tal que si el bien que se pretende inscribir mediante este proceso de información posesoria está comprendido dentro de dicha Zona, no podría autorizarse su inscripción pues eso implicaría generar un doble título sobre la misma área geográfica, independientemente haya sido adquirido el inmueble mediante subasta judicial. Ante tal panorama, debe definirse en primer orden, si en efecto el inmueble que se pretende inscribir está ubicado en ese sector, conforme a los agravios del recurrente.-

IV.En el subjúdice, se pretende la titulación de un inmueble graficado en el plano castatrado SJ-594793-85, el cual se localiza en Higuerón de San Andrés de León Cortés, de la provincia de San José, el cual tiene una medida de 3519.07 metros cuadrados (folio 4). El representante del Instituto de Desarrollo Agrario se apersonó al proceso aduciendo que dicho bien forma parte de la Zona de Titulación Puriscal-Parrita, inscrita en el Registro Público de la Propiedad, Partido de San José, al folio real 219039-000, a nombre de dicho ente. Como prueba de lo anterior, aportó el estudio elaborado por el Area de Topografía de ese distrito, donde se indicó, el inmueble en referencia está ubicado cartográficamente dentro de dicha Zona. Del expediente no se desprende, este último documento haya sido puesto en conocimiento de las partes como lo exige el artículo 476 del Código de Trabajo aplicado supletoriamente conforme a los artículo 6, 26 y 79 de la Ley de Jurisdicción Agraria; sin embargo, el apelante no objetó esta situación en el sentido de que le hubiera causado un perjuicio tal que generara la nulidad del fallo, en el que se utilizó dicho documento para el rechazo del trámite.

Ciertamente, el recurrente solicitó se declarara la nulidad del fallo; sin embargo, no expuso causal alguna de nulidad, sólo agravios, los cuales no están referidos a lo acontecido con la no puesta en conocimiento del documento, del cual se da por sabido al cuestionar el bien esté ubicado dentro de esa Zona. Ante esa circunstancias, considera el Tribunal declarar de oficio una nulidad por esa circunstancia lo único que generaría serían atrasos innecesarios y por ende, violación del artículo 41 de la Constitución Política que exige la justicia sea pronta y cumplida. En tal orden de ideas, conforme al documento en referencia que tiene plena validez al haber sido emitido por una autoridad pública, es posible concluir que en efecto, el inmueble que se pretende titular está comprendido dentro de dicha área de titulación, por lo que no se comparte lo expuesto por el recurrente en el sentido de que el mismo es ajeno a ese sector.

Nótese, no existe en el proceso prueba alguna que respalde el dicho de la parte actora, en el cuanto a que está fuera de esa Zona. Así mismo, el hecho de que el bien fuera adquirido por el promovente o su transmitente por remate judicial no hace varíen tales circunstancias, sin que pueda este Tribunal en este proceso emitir pronunciamiento acerca de si la subasta en referencia pudo haberse realizado sin haber sido tenido como parte al Instituto de Desarrollo Agrario en el proceso respectivo, pues se trata de un tema que no puede resolverse en un proceso de jurisdicción no contenciosa.-

V. Por lo expuesto, en lo apelado deberá confirmarse la resolución recurrida.-

POR TANTO:

Se rechaza la solicitud de nulidad de la sentencia. En lo apelado, se confirma dicha resolución.- DAMARIS VARGAS VASQUEZ MAGDA DIAZ BOLAÑOS CARLOS BOLAÑOS CESPEDES INFORMACION POSESORIA TIT: [Nombre1] [Nombre5].
