Cassation appeal filed in the present case brought against Nombre01, Costa Rican national, national identity card number CED01, son of Nombre02 and Nombre03, for the offenses of ideological forgery (falsedad ideológica) and others, to the detriment of public faith (fe pública) and others. The Justices participating in the decision on the appeal are José Manuel Arroyo Gutiérrez, Presiding Justice, Jesús Alberto Ramírez Quirós, Alfonso Chaves Ramírez, Rodrigo Castro Monge, and Magda Pereira Castro. Licenciado Roy Harold Elizondo Durán also participates in these proceedings as private defense counsel for the defendant. A representative of the Public Prosecutor's Office appeared.

  1. 1That by judgment No. 133-2005 issued at sixteen hours thirty minutes on the twenty-seventh of May, two thousand and five, the Tribunal de la Zona Sur, Dirección01, San Isidro de El General ruled: "POR TANTO: In accordance with the reasoning set forth and Articles 39 and 41 of the Constitución Política, 1, 30, 31, 45, 50, 59, 60, 71, 73, 74, 103, 110, and 365, all of the Código Penal, 58, 61, and 62 of the Ley Forestal No 7575 and its amendments, 1, 30 inciso e), 46, 117, 265, 266, 267, 308, 341 to 372 of the Código Procesal Penal, that Tribunal unanimously ruled: TO ACQUIT OF ALL CRIMINAL PENALTY AND LIABILITY Nombre04 for the offenses of IDEOLOGICAL FORGERY AND VIOLATION OF THE Ley Forestal IN THE FORM OF ILLEGAL LOGGING (tala ilegal de madera) IN FOREST AND IN PROTECTED ZONE (zona protectora), LAND-USE CHANGE OF FOREST-SUITABLE LAND (cambio de uso de aptitud forestal), INVASION OF PROTECTED ZONE, AND ILLEGAL CONSTRUCTION OF TRAILS (trochas), as committed to the detriment of PUBLIC FAITH AND NATURAL RESOURCES.Court costs shall be borne by the State.   2. 2That against the foregoing judgment, licenciado Roy Harold Elizondo Durán, acting as private defense counsel for defendant Nombre01, filed a cassation appeal. He alleges failure to state reasons in violation of Articles 142, 369 inciso i) and 363 inciso c) of the Código Procesal Penal. He argues that the conduct attributed to the defendant does not fall within the legal provision regarding the use of a forged document, since the suitability of the document presented was not established. He therefore requests that the judgment be entirely annulled and that the defendant be acquitted of all liability.
  3. 3That upon completion of the corresponding deliberations, the Chamber proceeded to examine the appeal.
  4. 4That the relevant legal requirements have been observed in the proceedings.

Justice Ramírez Quirós reports; and,

Considering:

I.Defense counsel Elizondo Durán filed a cassation appeal against judgment No. 133, issued by the Tribunal Penal de la Zona Sur at 16:30 hours on May 27 of this year, by which defendant Nombre01 was convicted of use of a forged document and sentenced to one year of imprisonment. The appellant claims that "the suitability of the document presented was not established," and thus there is a failure to state reasons in both the judgment and the sentence. He argues that it was not clearly established that the defendant knew of the harm that the use of the document in question could cause, since no false information was inserted therein but rather certain facts were simply omitted. The claim is not well-founded: The Tribunal took care to explain in the judgment that the defendant's conduct showed that he had full knowledge that the data recorded in the forestry report (informe forestal) were not accurate, since, being fully familiar with the land in question, he knew that trees 306 and 307 were located in a forest zone (zona de bosque) and not in agricultural-use land (folio 951).

From this it follows that it is not true that no false data or information was inserted in the document — it was (moreover, falsity may also consist of deliberately omitting matters of relevance); but it also demonstrates that the accused was aware that said information was false, and yet Nombre01 used those documents to apply for the corresponding logging permit at the MINAE offices in Pérez Zeledón (folios 953-955 and 957). This being the case, the defendant's intentional participation in the criminal act of use of a forged document is fully established. The other issue is whether the use of that document was capable of causing harm, which, although properly belonging to a substantive argument, is addressed below. The answer is affirmative: The harmful nature of said action is twofold. First, it violated the general trust that documents certifying a particular circumstance for public faith must command, thereby undermining the credibility that such records or declarations may enjoy, which are essential in everyday social dealings.

Second, a concrete injury was caused to the environment, since the trees protected by virtue of being in a forest zone (zona boscosa) were felled by means of the permit obtained through the aforementioned fraud (folio 936). Consequently, actual harm was indeed caused in both respects, making it clear that the use of said document was not merely capable of causing harm but actually did so. Finally, regarding the fixing of the sentence, the relevant reasons were indeed set out. Indeed, the defendant's personal circumstances and the characteristics of the act were taken into account (folio 965), and it cannot be overlooked that the punishment imposed was the minimum provided for by Article 365 of the Código Penal (one year of imprisonment); therefore, there is no procedural interest in annulling the judgment on that ground either.

II.In the second ground of appeal, it is argued that the punishable act was imprecisely determined, "since the documentation failed to record the existence of the two permanent springs (nacientes) and the intermittent stream (quebrada intermitente)… how can the defendant be convicted of use of a forged document if there is insufficient certainty and conviction to establish as false the documentation submitted by him to the State Forest Administration." The appellant is likewise wrong: The fact that the omission of the existence of those springs from the forestry report could not be established as a falsehood was no obstacle to proving that the report was false with respect to the trees in question. This is explained at folio 952-953, which sets out that there is a doubtful inference as to whether those springs actually existed at the time the said report was prepared, and thus it could not be concluded with certainty that the omitted information constituted a falsehood. However, there is no doubt whatsoever regarding the trees felled in the protected zone that had been deliberately placed in agricultural-use land, which the accused exploited to knowingly use the aforementioned document containing the falsehood and thereby cause the two injuries described.

Recurso de casación interpuesto en la presente causa seguida contra Nombre01, costarricense, cédula número CED01, hijo de Nombre02 y de Nombre03, por el delito de falsedad ideológica y otros, en perjuicio de la fe pública y otros. Intervienen en la decisión del recurso los Magistrados José Manuel Arroyo Gutiérrez, Presidente, Jesús Alberto Ramírez Quirós, Alfonso Chaves Ramírez, Rodrigo Castro Monge y Magda Pereira Castro. También interviene en esta instancia el licenciado Roy Harold Elizondo Durán como defensor particular del imputado. Se apersonó el representante del Ministerio Público.

Resultando:

 1.- Que mediante sentencia Nº 133-2005 dictada a las dieciséis horas treinta minutos del veintisiete de mayo de dos mil cinco, el Tribunal de la Zona Sur, Dirección01, San Isidro de El General resolvió: “POR TANTO: De conformidad con los razonamientos expuestos y artículos 39 y 41 de la Constitución Política, 1, 30, 31, 45, 50, 59, 60, 71, 73, 74, 103, 110 y 365,todos del Código Penal, 58, 61 y 62 de la Ley Forestal No 7575 y sus reformas, 1, 30 inciso e), 46, 117, 265, 266, 267, 308, 341 a 372 del Código Procesal Penal, ese Tribunal resolvió por unanimidad: ABSOLVER DE TODA PENA Y RESPONSABILIDAD a Nombre04 por los delitos de FALSEDAD IDEOLÓGICA E INFRACCION A LA LEY FORESTAL EN LA MODALIDAD DE TALA ILEGAL DE MADERA EN BOSQUE Y EN ZONA PROTECTORA, CAMBIO DE USO DE APTITUD FORESTAL, INVASIÓN DE ZONA PROTECTORA Y CONSTRUCCIÓN ILEGAL DE TROCHAS, como cometidos en perjuicio de LA FE .PUBLICA Y LOS RECURSOS NATURALES. Son las costas a cargo del Estado. Este Tribunal por unanimidad resuelve declarar autor único y responsable al encartado Nombre01 por el delito de USO DE DOCUMENTO FALSO, cometidos en perjuicio LA FE PUBLICA, por lo que se le impone la pena de UN AÑO DE PRISION. Son las costas a cargo del condenado. Por un plazo de TRES AÑOS se le concede el BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA, se le advierte que en caso de cometer un nuevo delito doloso con pena mayor a seis meses de prisión se le estará revocando dicha gracia Una vez firme la sentencia inscríbase en el Registro Judicial, remítanse los testimonios de estilo ante el Juzgado de Ejecución de la Pena y el Instituto Nacional de Criminología. El Tribunal resuelve: ABSOLVER DE TODA PENA Y RESPONSABILIDAD A Nombre01 por el delito de INFRACCION A LA LEY FORESTAL EN LA MODALIDAD DE TALA ILEGAL DE MADERA EN BOSQUE Y EN ZONA PROTECTORA, CAMBIO DE USO DE APTITUD FORESTAL, INVASIÓN DE ZONA PROTECTORA Y CONSTRUCCIÓN ILEGAL DE TROCHAS, como cometidos en perjuicio de LOS RECURSOS NATURALES, en cuanto a este delito son las costas a cargo del Estado.- Se declara sin lugar la ACCIÓN CIVIL RESARCITORIA por desistimiento tácito, y en cuanto a la misma se resuelve sin especial condenatoria en costas. Se ordena el comiso de la madera talada o aprovechada en la Infracción a la Ley Forestal, quedando la misma a la orden de la Administración Forestal del Estado.   1. 2Que contra el anterior pronunciamiento el licenciado Roy Harold Elizondo Durán en su condición de defensor particular del imputado Nombre01, interpuso recurso de casación. Alega falta de fundamentación en observancia de los artículos 142, 369 inciso i) y 363 inciso c) del Código Procesal Penal. La conducta atribuida al imputado no encuadra dentro de la norma respecto al uso de documento falso, ya que no se demostró la idoneidad del documento presentado. Por lo anterior, solicita se anule el fallo de forma total y se absuelva al imputado de toda responsabilidad.
  2. 3Que verificada la deliberación respectiva, la Sala entró a conocer del recurso.
  3. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Informa el Magistrado Ramírez Quirós; y,

Considerando:

I- El defensor Elizondo Durán interpuso casación contra la sentencia # 133, dictada por el Tribunal Penal de la Zona Sur, a las 16:30 horas del 27 de mayo de este año, mediante la cual se condenó al imputado Nombre01 a un año de prisión por el delito de uso de documento falso. Reclama el recurrente, que: “no se demostró la idoneidad del documento presentado”, por lo que hay falta de fundamentación del fallo y de la pena. Comenta que no se definió de forma certera que el endilgado tuviera conocimiento del perjuicio que podía generar el uso del documento en cuestión, pues no se incorporaron datos falsos en el mismo, sino que sólo se dejó de consignar algunos. No es de recibo el reclamo: El Tribunal se esmeró por explicar en el fallo que la conducta del justiciable evidenciaba que tenía pleno conocimiento de que los datos consignados en el informe forestal no eran exactos, pues estando familiarizado plenamente con el terreno en cuestión, sabía que los árboles 306 y 307 se hallaban en zona de bosque, y no de uso agropecuario (folio 951).

De ello se obtiene que no es cierto que no se insertara datos o información falsa en el documento, cosa que sí aconteció (aun así, la falsedad también puede consistir en omitir adrede aspectos de interés); pero, además, demuestra que el acusado tenía conciencia de que esa información era falsa, pese a lo cual Nombre01 empleó esos documentos para gestionar el permiso respectivo de corta ante las oficinas del Ministerio de Ambiente y Energía (MINAE) en Pérez Zeledón (folios 953-955 y 957). Así las cosas, la intervención dolosa de ese sujeto en la acción típica de uso de documento falso, está completamente probada. El otro tópico es, el de si el empleo de ese documento era idóneo para generar un perjuicio, lo cual, aunque es propio de un alegato de fondo, se aborda de seguido. La respuesta es afirmativa: La ofensividad de dicha acción es doble. En un primer plano, violentó la confianza general que deben dispensar los documentos que dan fe pública de una circunstancia determinada, lo cual mina o socava la credibilidad que puedan tener ese tipo de constancias o declaraciones, que son esenciales en el tráfico social cotidiano.

En segundo lugar, se produjo una lesión concreta al medio ambiente, puesto que los árboles protegidos por estar en zona boscosa, fueron cortados valiéndose del permiso concedido mediante el fraude antes referido (folio 936). Por consiguiente, sí se ocasionó un daño efectivo en ambos ámbitos, lo cual hace visible que el uso de dicho documento no sólo era susceptible de ocasionar un perjuicio, sino que efectivamente lo generó. Para concluir, al fijarse la pena sí se extendieron las razones respectivas. En efecto, se tomó en cuenta las circunstancias personales del endilgado y las características del hecho (folio 965), no pudiendo eludirse que el castigo impuesto fue el mínimo previsto por el artículo 365 del Código Penal (un año de prisión), por lo que, tampoco en ese sentido, habría interés procesal alguno en anular el fallo por ese tema.

II- En el segundo alegato, se arguye la determinación imprecisa del hecho sancionado, “al no consignarse en esa documentación la existencia de las dos nacientes permanentes y de la quebrada intermitente… cómo es que se condena al encartado por uso de documento falso si no se tienen la certeza y la convicción suficiente y necesaria para acreditar como falsa la documentación presentada por este ante la Administración Forestal del Estado”. Tampoco lleva razón el recurrente: El hecho de que no se pudiera acreditar como una falsedad la falta de consignación en el informe forestal sobre la existencia de esas nacientes, no fue óbice para que sí se pudiera demostrar era falsa en lo que concernía a los árboles referidos. Así se explica a folio 952-953, en los que se expone que hay una inferencia dubitativa de si existían realmente esas nacientes al ser elaborado el susodicho informe, por lo que no se podía concluir con seguridad que la información omitida configurara una falsedad. Sin embargo, no hay duda alguna en cuanto a los árboles talados en zona protegida y que habían sido aviesamente ubicados en terreno de uso agropecuario, de lo cual se valió el acusado para, a sabiendas, hacer uso del mencionado documento que contenía la falsedad y generar los dos perjuicios descritos.

Por Tanto:

Se declara sin lugar la casación interpuesta.
