Res: [Telf1] CRIMINAL CASSATION TRIBUNAL. Second Judicial Circuit of San José. Goicoechea, at ten o'clock on the twelfth of May, two thousand and five.
APPEAL ON CASSATION (recurso de casación) filed in the present case brought against [Nombre1][Nombre2], an adult, divorced, driver for MOPT, Costa Rican, born in Nicoya on December 10, 1969, son of [Nombre3] and [Nombre4], residing in Pochote de Quebrada Honda de Nicoya, national identity card CED1, for the offense of VIOLATION OF THE Ley Forestal[Nombre2], to the detriment of THE STATE[Nombre2]. The Judges deciding the appeal are Jorge Luis Arce Víquez, Rafael Ángel Sanabria Rojas, and [Nombre5]. Deputy Prosecutor [Nombre6], Esq., appeared in the cassation proceedings.
WHEREAS:
I.By judgment number 81-04, handed down at four-thirty in the afternoon on the twentieth of December, two thousand and four, the Trial Court (Tribunal de Juicio) of Guanacaste ruled: "THEREFORE: For the foregoing reasons, Articles 39 and 41 of the Constitution, 1, 2, 6, 9, 142, 265, 360, 364, 365, 366 of the Code of Criminal Procedure, 1, 45 of the Criminal Code, 61 subsections a) and e) of the Ley Forestal 7575, [Nombre1] IS ACQUITTED OF ALL PUNISHMENT AND LIABILITY for the offense of VIOLATION OF THE Ley Forestal to the detriment of THE STATE. The costs of the criminal proceedings are borne by the State. The private criminal complaint (querella) and the civil damages action (acción civil resarcitoria) brought by the Attorney General's Office (Procuraduría General de la República) are deemed withdrawn, and both are resolved with no special award of costs. Once the judgment becomes final, the case file is ordered closed. Notice to be given by public reading.- ESQ. [Nombre7]. JUDGE."
III.Upon completion of the required deliberation in accordance with Article 450 of the Code of Criminal Procedure, the Tribunal considered the issues raised in the appeal on cassation.
The opinion is authored by Judge [Nombre8]; and,
CONSIDERING:
I.Majority opinion.[Nombre2] The Deputy Prosecutor of Guanacaste, Esq. [Nombre9], has filed an appeal on cassation on the merits against the judgment that acquitted the accused [Nombre10] of all liability for the offense of violation of the Ley Forestal. The claim is not well-founded.[Nombre2] This is so in light of the essentially accusatorial character of the proceedings governed by the new Code of Criminal Procedure of 1996 (hereinafter CPP). On the matter at hand, it has been established that "[Nombre2]the Public Ministry (Ministerio Público) may only challenge judicial decisions that cause it harm, provided it has not contributed to bringing about that harm (cf. art. 424 CPP) or to ratifying it (cf. art. 177 CPP). This means, for example, that if the trial court characterizes the act in the same way the prosecutor proposed at the oral trial proceedings (debate), the prosecutor may not then invoke cassation—on a sudden change of position—to seek a different legal characterization that would be more adverse to the accused; or, under the same characterization,[Nombre2] request the imposition of a sentence higher than the one sought at the oral trial proceedings (cf. art. 357 CPP), because in those situations, if there is error, the prosecutor contributed to causing it" ([Nombre8][Nombre2] [Nombre11]: La persistencia de la Inquisición: ¿cuál es el objeto de la Casación Penal?[Nombre2] in A.A.V.V.
"Una oportunidad para reflexionar: XXV aniversario del Ministerio Público", Departamento de Publicaciones e Impresos del Poder Judicial, San José, 2000, p. 232). In the present case, the trial record and the judgment both show that the representative of the Public Ministry (Esq. [Nombre12]) concluded by requesting that [Nombre10] be acquitted of all punishment and liability for the offenses charged, and that even the Attorney General (Esq. [Nombre13]) reached the same conclusion as the Prosecutor's Office (cf. folios 178 and 191). For this reason, Prosecutor [Nombre9] cannot now allege, by way of an appeal on cassation, that harm has been caused to her, since the law clearly provides that:
"The parties may only challenge judicial decisions that cause them harm, provided they have not contributed to bringing about that harm.[Nombre2] The appeal must be grounded in the defects alleged to cause the prejudice.
The accused may challenge a judicial decision even if he or she contributed to causing the defect, in cases where constitutional or statutory provisions concerning his or her participation, assistance, or representation have been violated." (underlining not in the original; Article 424 CPP).
If the Public Ministry expressly requested that the accused be acquitted of all punishment and liability, and the trial court granted that request in its judgment, no harm has been caused to the Prosecutor's Office that would justify the new claim now raised in the appeal by the hierarchical superior, who disagrees with the position taken by the trial prosecutor and with the judgment rendered. Esq. [Nombre14] justifies her challenge by alleging that: "[Nombre2]The Ministry files this appeal pursuant to Art. 18 of the Ley Orgánica del Ministerio Público, given that the Prosecutor who handled the trial requested acquittal, and also because it is considered that irreparable harm has been caused to the prosecuting body, since the incorrect interpretation of the rule made the accused's acquittal possible[Nombre2]" (appeal, folio 197). It is evident that the appellant wishes to give the cited article a scope it does not actually have—one that is moreover prohibited by the interpretive rule contained in Article 2 CPP—since Article 18 LOMP reads as follows:
"Article 18. Amendment. The hierarchical superior may amend, by means of a reasoned opinion identifying the error or errors committed, the rulings or requests of the subordinate, provided that the corresponding decision has not yet been issued.
Similarly, once these decisions or any others have been issued, said superior may order another representative of the Public Ministry to file such appeals as the law allows, or to take over the continuation of the proceedings.[Nombre2]" (Ley Orgánica del Ministerio Público).
The Public Ministry is organized according to the principle of unity of action (art. 1 LOMP) and the principle of hierarchy (art. 14 LOMP), in light of which Article 18 must be interpreted. Thus, the first paragraph of Article 18 establishes that the hierarchical superior prosecutor may amend the rulings or requests of the subordinate, provided that the corresponding decision has not yet been issued (and in this case, the decision was issued without the hierarchical superior having corrected the trial prosecutor's request). The second paragraph of Article 18 indicates that if the hierarchical superior does not amend the subordinate's request and the decision is accordingly rendered, what the superior may do—if deemed necessary—is to replace the prosecutor with another representative of the Public Ministry, and may even order the new prosecutor to file such appeals as the law permits or to take over the continuation of the proceedings, with the new prosecutor being required to comply with the general orientations and instructions that the hierarchical superior issues regarding their duties.
It is clear, however, that Article 18 does not authorize excusing the Public Ministry, as a party to the proceedings, from the concrete consequences of the position taken by its prosecutors in the exercise of the criminal action. Art. 2 CPP prevents interpreting Article 18 as a privilege of the Public Ministry as a party to evade the legal consequences of the actions or omissions of its prosecutors during the proceedings. Certainly, the law authorizes Prosecutor [Nombre14] to replace Prosecutor [Nombre15] and to file the appeal on cassation; however, the law does not authorize granting her claim on its merits, because the party she represents contributed to bringing about the alleged harm that the decision causes it—but now, in view of the fact that "the party" has changed its position following the rendering of the judgment. For the reasons stated, the appeal on cassation filed must be declared without merit (sin lugar).
II.Dissenting opinion (voto salvado) of Judge [Nombre16].- The undersigned dissents from the majority of the court and issues this opinion as follows. First, it should be noted that although the representative of the Ministerio Público expressly requested an acquittal of the defendant at the closing arguments of the trial (folio 178), the truth is that Article 18 of the Ley Orgánica del Ministerio Público, which is a later and special law, authorizes a superior officer to file the appropriate appeals through the hierarchical amendment (enmienda jerárquica). This implies the possibility for the prosecuting body to correct the errors of its subordinates. This is not a mere intellectual exercise, admitting the appeal at the outset only to reject it for lack of interest. Such an interpretation would reduce the process to mere formalism serving no purpose, beyond the waste of resources that are already scarce in public administration.
From our perspective, the legislature intended that the senior prosecutor be able to oversee and correct deviations by prosecutors and deputy prosecutors, in order to uphold the principles of unity and hierarchy that are inherent to the Ministerio Público. Certainly, in a purely adversarial system (sistema acusatorio), the amendment procedure would not be admissible; indeed, in such a scenario the prosecuting body has no right to appeal. However, that argument is not applicable here because we do not have an adversarial system, but rather a mixed system (sistema mixto) with some adversarial features. Evidence of this is the continued existence of a series of institutions characteristic of the inquisitorial system (sistema inquisitivo), such as evidence for better deciding (prueba para mejor resolver), the disagreement procedure (procedimiento de disconformidad), ex officio evidence (prueba de oficio), judicial questioning of witnesses during the trial phase, etc. (Cf. [Nombre17].

No: 22, Year 16, September 2004 [Nombre2] Thus, the possibility of rectifying the errors of a subordinate prosecutor is merely another characteristic of our system. Finally, we also do not consider that this legal mechanism results in unequal treatment favoring one of the parties. In this regard, it should be noted that if Article 18 of the Ley Orgánica del Ministerio Público is considered contrary to the principle of equality, the appropriate course of action would be to file a constitutional referral (consulta de constitucionalidad). In any case, it is not entirely accurate that having contributed to creating a procedural defect (vicio) necessarily precludes the possibility of subsequently filing an appeal in all cases. Evidence of this is that the accused may accept the abbreviated procedure (procedimiento abreviado) and agree to a sentence.
Nevertheless, the accused may subsequently appeal through cassation (casación) and even through review (revisión), without the existence of the legal grievance (agravio) being questioned. Having established the foregoing, I proceed to resolve the appeal filed. In the present case, the challenge is grounded in that provision, and is therefore admissible. In order to resolve the claim and place in context the factual framework from which the resolution of this matter must proceed, it is appropriate to note that the Tribunal de Juicio de Guanacaste, sitting at Nicoya, established the following in the challenged judgment: "It was determined at trial that the defendant proceeded to cut a certain number of forest species in three different sectors, as indicated in the study conducted by MINAE contained in the case file, some of which are not timber species. The significant element in this matter is that one of those trees was felled in a mangrove (manglar) area and the remainder in cultivated zones, which furthermore, given their extent, cannot be considered a forest" (sic).
(Cf. Folios 190 and 191 of the main file.) Based on the foregoing facts, the defendant was acquitted on the grounds of failure to constitute a criminal offense (atipicidad), given that the court understood a requirement of the criminal offense provision (tipo penal) to be that the cutting or felling take place in a forest.
The Ley Forestal 7575 of April 16, 1996, published in Supplement (Alcance) No. 21 of Tuesday, April 16, 1996, clearly establishes in numeral 58, paragraph b), punishable by a sentence of three months to three years of imprisonment, that the following shall be penalized: [Nombre2] a)—… b) Exploits forest resources on lands of the State's natural heritage (patrimonio natural del Estado) and in the protection areas (áreas de protección) for purposes other than those established by this law." c)—…". Likewise, numeral 3), paragraph a) of the aforementioned Ley 7575 defines exploitation (aprovechamiento) as the [Nombre2] "act of cutting, removing timber trees, or using fallen trees, carried out on private lands not included under Article 1 of this Law, that generates or may generate any profit, benefit, advantage, utility, or gain for the person who performs it or for whomever that person represents." Moreover, numeral 1 of the aforementioned Ley Forestal N° 7575 is entirely clear in its second paragraph, stating that in light of a prevailing public interest, "…the cutting or exploitation of forests in national parks, biological reserves (reservas biológicas), mangroves, protective zones (zonas protectoras), wildlife refuges, and State-owned forest reserves is prohibited." From the reading of those articles together, it follows that the felling or cutting of trees in protected zones, such as a mangrove, even when the land is privately owned, remains a punishable act and has therefore not been decriminalized as argued.
In the present matter, the juez a quo himself finds it established that at least one of the trees was located within the protected zone of the mangrove. This is also evident from the testimony given at trial by forestry engineer [Nombre18], who stated: [Nombre2] "an oak tree was found in a protection area of the mangrove; one stump (tocón) was identified, measurements of the diameter of seventy centimeters were recorded, the situation of its proximity to the mangrove area was assessed, and the existence of other damaged trees was noted…" (folio 189). From the foregoing it follows that at least one of the felled trees was located within a protected zone, and therefore the condition of being a forest was not required. It should be clarified that although there are some rulings of this Court that adopt the theory of failure to constitute a criminal offense for conduct in areas that do not correspond to the concept of forest [Nombre2]—as defined by numeral 3, paragraph d) of the cited Ley Forestal N° 7575 [Nombre2]—and aside from the fact that this theory is not uniformly held in that regard [Nombre2], those rulings are not applicable to the factual situation adjudicated here, since, as stated, in at least one instance the felling took place in a protection zone of a mangrove.
That is, these are circumstances different from those resolved in Voto 929-2001 of 9:45 a.m. on November 16, 2001. For the reasons set forth above, I grant the appeal filed, with the corresponding legal consequences.
POR TANTO:
By majority, the cassation appeal filed is dismissed. Judge [Nombre16] dissents and grants the appeal.

RECURSO DE CASACIÓN interpuesto en la presente causa seguida contra [Nombre1][Nombre2] mayor, divorciado, chofer del MOPT, costarricense, nativo de Nicoya el 10 de diciembre de 1969, hijo de [Nombre3] y de [Nombre4], vecino de Pochote de Quebrada Honda de Nicoya, cédula de identidad CED1, por el delito de INFRACCIÓN A LA LEY FORESTAL[Nombre2] en perjuicio de EL ESTADO[Nombre2] Intervienen en la decisión del recurso, los Jueces Jorge Luis Arce Víquez, Rafael Ángel Sanabria Rojas y [Nombre5]. Se apersonó en casación la Licenciada [Nombre6], fiscal adjunta.
RESULTANDO:
I.Que mediante sentencia número 81-04 de las dieciséis horas con treinta minutos del veinte de diciembre del año dos mil cuatro, el Tribunal de Juicio de Guanacaste, resolvió: “POR TANTO: Por lo expuesto, artículos 39 y 41 Constitucional, 1, 2, 6, 9, 142, 265, 360, 364, 365, 366 del Código Procesal Penal, 1, 45, del Código Penal, 61 inciso a) y e) de la Ley Forestal 7575, SE ABSUELVE DE PENA Y RESPONSABILIDAD A [Nombre1] por el delito de INFRACCIÓN A LA LEY FORESTAL en perjuicio del ESTADO. Son las costas del proceso penal a cargo del Estado. Se tiene por desistida la querella y la acción civil resarcitoria promovidas por la Procuraduría General de la República y se resuelve ambas sin especial condenatoria en costas. Firme la sentencia se ordena el archivo del expediente. Notifíquese mediante lectura.- LIC. [Nombre7]. JUEZ”.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de casación.-
Redacta el Juez [Nombre8] ; y,
CONSIDERANDO:
I.Voto de mayoría.[Nombre2] La Fiscal adjunta de Guanacaste, Licda. [Nombre9], ha interpuesto recurso de casación por el fondo contra la sentencia que absolvió de toda y responsabilidad al imputado [Nombre10] por el delito de infracción a la ley forestal. El reclamo no es atendible[Nombre2] Esto así en atención al carácter esencialmente acusatorio del proceso regulado en el nuevo Código Procesal Penal de 1996 (en adelante CPP). Sobre la cuestión que aquí interesa se ha indicado que [Nombre2]el Ministerio Público sólo podrá impugnar las decisiones judiciales que le causen agravio, siempre que no haya contribuido a provocarlo (cfr. art. 424 CPP) o a convalidarlo (cfr. art. 177 CPP). Quiere decir, por ejemplo, que si el tribunal de juicio califica el hecho tal como lo propuso el acusador en el debate, éste no podrá reclamar en casación, por un repentino cambio de criterio, una diversa calificación jurídica que resulte más gravosa para el imputado; o pedir bajo una misma calificación[Nombre2] la imposición de una pena superior a la que solicitó en el debate (cfr. art. 357 CPP), pues en estos casos, de haber error, el acusador contribuyó a provocarlo" ([Nombre8][Nombre2] [Nombre11]: La persistencia de la Inquisición: ¿cuál es el objeto de la Casación Penal?[Nombre2] en A.A.V.V.
"Una oportunidad para reflexionar: XXV aniversario del Ministerio Público", Departamento de Publicaciones e Impresos del Poder Judicial, San José, 2000, pág. 232). En el presente asunto consta en el acta de debate y en la sentencia que el representante del Ministerio Público (Lic. [Nombre12]) concluyó solicitando que se absolviera de toda pena y responsabilidad a [Nombre10] por los delitos acusados, y que incluso el Procurador de la República (Lic. [Nombre13]) concluyó en igual sentido que la Fiscalía (cfr. folios 178 y 191). Por lo anterior la Fiscal [Nombre9] no puede alegar ahora, por la vía del recurso de casación, que se le ha causado un agravio, pues la ley dispone claramente que:
"Las partes sólo podrán impugnar las decisiones judiciales que les causen agravio, siempre que no hayan contribuido a provocarlo[Nombre2] El recurso deberá sustentarse en el reproche de los defectos que causan la afectación.
El imputado podrá impugnar una decisión judicial aunqye haya contribuido a provocar el vicio, en los casos en que se lesionen disposiciones constitucionales o legales sobre su intervención, asistencia y representación." (el subrayado no es del original, artículo 424 CPP).
Si el Ministerio Público expresamente solicitó que se absolviera de toda pena y responsabilidad al imputado y el Tribunal de mérito acogió su pretensión en la sentencia, no se le ha causado un agravio a la Fiscalía que justifique la nueva pretensión que plantea en el recurso el superior jerárquico que discrepa del criterio que tuvo el fiscal de juicio y de lo resuelto. La Licda. [Nombre14] justifica su impugnación alegando que: [Nombre2]El Ministerio presenta este recurso de conformidad con el Art. 18 de la Ley Orgánica del Ministerio Público dado que el Fiscal que atendió el debate solicitó la absolutoria, así mismo por cuanto se considera que se ha causado un gravamen irreparable al ente acusador, pues al interpretarse de modo incorrecto la norma, se ha posibilitado la absolutoria del imputado[Nombre2] (recurso, folio 197). Se nota que la recurrente quiere darle al artículo indicado un alcance que en realidad no tiene y que más bien prohibe la regla de interpretación contenida en el artículo 2 CPP, pues el artículo 18 LOMP dice lo siguiente:
"Artículo 18. Enmienda. El superior jerárquico podrá enmendar, mediante dictamen fundado y con indicación del error o errores cometidos, los pronunciamientos o solicitudes del inferior, mientras no se haya dictado la resolución correspondiente.
Igualmente, una vez dictadas estas resoluciones o cualesquiera otras, dicho superior podrá ordenar a otro representante del Ministerio Público la interposición de los recursos que la ley autoriza, o que se haga cargo de la continuación del procedimiento.[Nombre2] (Ley Orgánica del Ministerio Público).
El Ministerio Público tiene una organización que se rige por el principio de unidad de actuaciones (art. 1 LOMP) y por el principio de jerarquía (art. 14 LOMP), conforme a los cuales debe interpretarse el artículo 18. Así, pues, el párrafo primero del artículo 18 se refiere que el fiscal superior jerárquico puede enmendar los pronunciamientos o solicitudes del inferior, mientras no se haya dictado la resolución correspondiente (y en este asunto se dictó la resolución sin que el superior jerárquico corrigiera la solicitud del fiscal de juicio). El párrafo segundo del artículo 18 indica que si el superior jerárquico no enmienda la solicitud del fiscal y así se dicta la resolución, lo que puede hacer el superior, si lo considera necesario, es sustituir al fiscal por otro representante del Ministerio Público, pudiéndole incluso ordenar al nuevo fiscal que interponga los recursos que la ley autoriza o que se haga cargo de la continuación del procedimiento, debiendo el nuevo fiscal acatar las orientaciones generales e instrucciones que el superior jerárquico imparta sobre sus funciones.
Pero queda claro que este artículo 18 no autoriza excusar al Ministerio Público, en cuanto parte del proceso, por las consecuencias concretas del criterio con que han actuado sus fiscales en el ejercicio de la acción penal. El art. 2 CPP impide interpretar el artículo 18 como un privilegio del Ministerio Público como parte para evadir las consecuencias jurídicas de las actuaciones u omisiones de sus fiscales durante el proceso. Ciertamente la ley autoriza a la Fiscal [Nombre14] para sustituir al Fiscal [Nombre15] e interponer el recurso de casación, mas la ley no autoriza concederle la razón por su reclamo porque la parte a quien representan contribuyó a provocar el supuesto agravio que la decisión le causa, pero en vista de que "la parte" ha cambiado de criterio tras el dictado de la sentencia. Por las razones indicadas se debe declarar sin lugar el recurso de casación interpuesto.
II.Voto salvado del juez [Nombre16].- El suscrito, disiento de la mayoría del tribunal y emito el voto de la siguiente forma. En primer lugar debe advertirse que si bien la representación del Ministerio Público en las conclusiones del debate solicitó expresamente la absolutoria del encartado (folio 178), es lo cierto que el artículo 18 de ley Orgánica del Ministerio Público, que es ley posterior y especial, faculta al superior para que mediante la enmienda jerárquica interponga los recursos pertinentes. Lo anterior implica la posibilidad del órgano requirente de corregir los yerros de sus inferiores. No se trata de un mero ejercicio intelectual, autorizando el recurso en su entrada, pero rechazándolo por falta de interés. Tal interpretación nos conduciría a un mero formalismo sin que cumpla ninguna finalidad, más allá de la pérdida de recursos, de por sí escasos en la administración pública.
Desde nuestra perspectiva, el legislador pretendió que el fiscal superior pueda controlar y corregir las deviaciones de sus fiscales y fiscales auxiliares, para dar cumplimiento a los principios de unidad y jerarquía que son consustanciales al Ministerio Público. Ciertamente, en un sistema acusatorio puro no sería admisible el procedimiento de enmienda, es más, en tal hipótesis el órgano acusador no tiene derecho a recurrir. Sin embargo ello no es un argumento aplicable porque nosotros no tenemos un sistema acusatorio, sino más bien un sistema mixto con algunos rasgos acusatorios. Prueba de ello es la vigencia de una serie de instituciones propias del sistema inquisitivo, tales como la prueba para mejor resolver, el procedimiento de disconformidad, prueba de oficio, interrogatorio de los jueces en la etapa del debate, etc. (Cfr. No: 22, Año 16, setiembre 2004 [Nombre2] De manera que la posibilidad de rectificar los errores del fiscal inferior, no es más que otra particularidad de nuestro sistema. Finalmente, tampoco estimamos que con este instituto se esté dando un trato desigual, favoreciendo a una de las partes. Al respecto debe acotarse que si se considera que el artículo 18 de la Ley Orgánica del Ministerio Público es contrario al principio de igualdad, lo procedente sería plantear la respectiva consulta de constitucionalidad. En todo caso, no es tan cierto que el hecho de coadyuvar en la producción del vicio impida en todos los casos, la posibilidad de recurrir posteriormente. Prueba de ello es que el imputado puede aceptar el procedimiento abreviado y pactar una pena. Sin embargo, posteriormente puede recurrir en casación y hasta en revisión, sin que se cuestione la existencia del agravio.
Establecido lo anterior, procedo a resolver el recurso planteado. En el presente caso, la impugnación se formula con fundamento en dicha norma, por lo que resulta admisible. A los fines de resolver el reclamo y contextualizar el marco fáctico sobre el que debe partir la resolución de este asunto, conviene indicar que el Tribunal de Juicio de Guanacaste, sede de Nicoya, en la sentencia cuestionada, estableció lo siguiente: “Se determino en juicio que el encartado procedió a cortar en tres sectores diferentes un número determinado de especies forestales, indicados en el estudio realizado por el Minae constante en el expediente algunas de las cuales no son especies maderables. Lo trascendente en este asunto es que uno de esos árboles se talo en un área de manglar y los restantes en zonas de cultivos, que además, por su extensión ninguno de los sectores puede considerarse un bosque”(sic). (Cfr.
Folios 190 y 191 del principal). Conforme a los anteriores hechos al justiciable se le absolvió por estimar la atipicidad de los mismos, toda vez que el juzgado entiende que un requisito del tipo penal es que la corta o tala se realice en un bosque. La Ley Forestal 7575 del 16 de abril de 1996, publicada en el Alcance número 21 del martes 16 de abril de 1996, claramente establece en el numeral 58 inciso b- y sancionable con una pena de tres meses a tres años de prisión, quien: [Nombre2] a)-…b)- Aproveche los recursos forestales en terrenos del patrimonio natural del Estado y en las áreas de protección para fines diferentes a los establecidos en esta ley”. c)-…”. Igualmente el numeral 3) inciso a) de la citada Ley 7575 define aprovechamiento como la [Nombre2]acción de corta, eliminación de árboles maderables o la utilización de arboles caídos, realizada en terrenos privados, no incluidos en el artículo 1 de esta Ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa”.
Inclusive, el numeral 1 de la supra referida Ley Forestal N- 7575, es clarísima en el párrafo segundo, al indicar que por mediar un interés público, “…se prohibe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológicas, manglares, zonas protectoras, refugios de vida silvestre, y reservas forestales propiedad del Estado”. De esa relación de artículos se concluye que la tala o corta de árboles en zona protegidas, como lo es un manglar, aún cuando se trate de propiedad privada, es una acción que sigue siendo punible y por ende no ha sido despenalizada como se argumenta. En el presente asunto, el propio juez a quo tiene por cierto que por lo menos uno de los árboles se encontraba dentro de la zona protegida del manglar. Situación que también se advierte del testimonio rendido en el debate por el ingeniero forestal [Nombre18], quien señaló: [Nombre2]se encontró un árbol de roble en un área de protección del manglar, se determinó uno tocón se tomaron los datos de diámetro de setenta centímetros, se valoró la situación de que estaba cerca del área del manglar y la existencia de otros árboles dañados…”(folio 189).
De lo anterior se colige que al menos uno de los árboles talados se encontraba dentro de una zona protegida y por ende no le era exigible la condición de bosque. Debe aclararse que si bien es cierto existen algunos votos de este Tribunal que recogen la tesis de la atipicidad de la conducta en zonas que no corresponden al concepto de bosque [Nombre2] definido por el numeral 3 inciso d)- de la Ley Forestal N° 7575 citada [Nombre2] aparte de que se trata de una tesis que no es uniforme en ese sentido [Nombre2] no son aplicables a la especie fáctica juzgada, pues como se dijo, en al menos un caso, la tala se dio en una zona de protección de un manglar. Es decir, que se trata de supuestos diversos al resuelto en el Voto 929- 2001 de 9:45 horas del 16 de noviembre del 2001. Por las razones expuestas declaro con lugar el recurso interpuesto con las respectivas consecuencias legales.
POR TANTO:
Por mayoría se declara sin lugar el recurso de casación interpuesto. El juez [Nombre16] salva el voto y declara con lugar el recurso.
