JUDICIAL BRANCH TRIBUNAL DE CASACIÓN PENAL Res. [Telf1] TRIBUNAL DE CASACIÓN PENAL. Second Judicial Circuit of San José. Goicoechea, at sixteen hours and ten minutes on the fifth of November of two thousand and four.
CASSATION APPEAL (Recurso de Casación) filed in the present case brought against [Nombre1], of legal age, single, national identity card CED1, for the offense of LAND-USE CHANGE (cambio de uso de suelo), to the detriment of NATURAL RESOURCES. Judges Jorge Luis Morales García, Ulises Zúñiga Morales, and [Nombre2] participate in deciding the appeal. Attorneys [Nombre3], private defense counsel, and [Nombre4], Attorney General (Procurador de la República), appeared before the court in cassation proceedings.
FINDINGS:
1. That by means of a judgment handed down at fourteen hours on the twentieth of May of two thousand and two, the Trial Court (Tribunal de Juicio) of Cartago ruled: "THEREFORE: In accordance with the foregoing and with Articles 39 and 41 of the Political Constitution, 1, 30, 31, 45, 59 and following of the Penal Code, 61 a) and c) and 62 of the Ley Forestal 7575, 1 through 15, 180 through 184, 265 through 267, 324, 346 and 371 of the Code of Criminal Procedure, [Nombre5] is declared the responsible perpetrator of the offense of LAND-USE CHANGE, to the detriment of NATURAL RESOURCES, and as such is sentenced to ONE YEAR OF IMPRISONMENT. The benefit of conditional execution of the sentence (beneficio de ejecución condicional de la pena) is granted for a probationary period of THREE YEARS, during which time the defendant may not commit a new intentional offense punishable by a prison term of six months or more, as the said benefit will be revoked. [Nombre5] is acquitted of all punishment and liability for the offense of illegal road construction to the detriment of Natural Resources.
Court costs are charged to the convicted person. The defendant is hereby obligated to restore the woodland and shall therefore remove the coffee plants and reseed native species in their place, or allow them to regenerate naturally. The foregoing is subject to the penalty of also revoking the conditional execution benefit granted. The parties are hereby notified upon the reading of this judgment. — Lic. [Nombre6], Trial Judge." 2. That against the foregoing ruling, Attorney [Nombre3] filed a cassation appeal.
3. That after the respective deliberation was conducted in accordance with the provisions of Article 450 of the Code of Criminal Procedure, the Tribunal considered the issues raised in the appeal.
4. That the relevant legal requirements have been observed in the proceedings.
DRAFTED by Judge [Nombre7]; and,
CONSIDERING:
I.The defense counsel of the convicted person in the present proceedings formally files a cassation appeal against the ruling issued by the Trial Court of Cartago at fifteen hours on the twenty-sixth of September of two thousand and three, which ruling, on remand (reenvío), integrates judgment number 142-02 handed down at fourteen hours on the twentieth of May of two thousand and two. Said appeal meets the admissibility requirements established by Articles 422, 423, 424, 443, 444, and 445 of the Code of Criminal Procedure, and the issues raised are hereby decided.
II.In the first ground of the cassation appeal on procedural grounds, the following articles are alleged to have been violated: Articles 23, 24, 25, 29, 30, 38, and 40 of the Ley Forestal Número 7575 of April 16, 1996; Articles 50, 59, and 60 of the Penal Code; Articles 39 and 40 of the Political Constitution; Articles 37 and 369, subparagraphs h) and i), procedural defects (vicios de procedimiento) sanctioned as defective procedural acts (actividad procesal defectuosa) under Articles 175, 178, and 433 of the Code of Criminal Procedure. It is first alleged that, in the present case, no civil damages claim (acción civil resarcitoria) was filed, a circumstance which, in the appellant's view, renders improper the tribunal's ex officio ruling with respect to the conditions imposed to restore the woodland, remove the coffee plants, and reseed native species or allow them to regenerate naturally.
The appellant states that this amounts to an alternative penalty (pena alternativa) that the defendant has no possibility of fulfilling, so that his only option will be to go to prison, given that the conditions set are impossible to meet, as the tree species ordered by the judgment are unavailable and the area to be reforested is not specified. The appellant also notes that the defendant did not deforest the land, and therefore the condition that he must proceed to reforest it is contrary to the principle of proportionality of punishment which, as the Constitutional Chamber has held in vote number 1953-96 of 12:03 hours on April 26, 1996, forms part of due process. The claim is partially well-founded for reasons other than those alleged. In order to properly resolve this ground of objection in the present case, reference must be made clearly to the background of the ruling at issue here.
Indeed, it must first be noted that the judgment initially handed down, number 142-02 at fourteen hours on the twentieth of May of two thousand and two, with respect to the point that was subsequently the subject of the cassation appeal and whose remand was ordered, provided:
"ON RESTORATION: As requested by the representative of the public prosecutor's office, and because it is neither fair nor equitable for the defendant to profit from the typical and unlawful act for which he was convicted, the defendant is hereby obligated to restore the woodland and shall therefore remove the coffee plants and reseed native species in their place, or allow them to regenerate naturally. The foregoing is subject to the penalty of also revoking the conditional execution benefit granted. The basis for issuing this measure is found in the scientific opinion prepared by Mr. [Nombre8], in which he was advised by specialists versed in forestry matters (folios 67 to 75)." (cf. folio 331 of the case file; bold type does not appear in the original).
That same circumstance was reflected in the operative clause (dispositivo), which agreed: "The defendant is hereby obligated to restore the woodland and shall therefore remove the coffee plants and reseed native species in their place, or allow them to regenerate naturally. The foregoing is subject to the penalty of also revoking the conditional execution benefit granted." (folio 332 of the main file; emphasis added). Now, against that ruling, only Attorney [Nombre3], acting as defense counsel for Mr. [Nombre1] and in the latter's favor, filed an appeal in due course. As may be confirmed at folio 353, all the Public Prosecutor's Office did was to respond to the hearing in opposition to the arguments advanced by the appellant, without at any point filing an independent challenge by the prosecuting body, whether autonomous or of an adhesive nature. The TRIBUNAL DE CASACIÓN PENAL, by virtue of ruling number [Telf2] of eleven hours and fifty-four minutes on the fifth of May of two thousand and three, ordered: "The appealed judgment is partially annulled, solely with respect to the time frames, stages, and monitoring mechanisms for compliance with the condition upon which the conditional execution benefit is granted.
Remand is ordered for these aspects to be resolved. The judgment on the merits is final in all other respects." (Folio 370). It is clear that, since this concerns the resolution of an appeal filed by the defense and, by virtue of the prohibition of non reformatio in peius, the defendant's initial situation could not be made worse on remand; however, this prohibition was not respected by the court below (a quo), as is clearly evident from a mere transcription of the operative clause as agreed upon, since the ruling now under challenge here provided:
"In accordance with the foregoing and Articles 59 and following of the Penal Code, the ruling with respect to the conditional execution benefit granted to the defendant is maintained, which shall be revoked if the defendant does not uproot the coffee plants and regenerate the area with native species such as: 2 types of Aguacatillos, Sirrí, cacho de venado, papallillo [sic], dantisco, roble encino, magnolia, dama, tirrá. To this end, the defendant shall carry out the UPROOTING before the end of December of the year 2003. The defendant shall then carry out NATURAL REGENERATION and planting under the stated conditions, before the end of the month of JUNE 2004. From that date onward, five semi-annual checks shall be conducted with periodic site visits and reports by MINAE. All costs and expenses shall be borne by the defendant. A formal notice shall be issued to the owner of the property so that the defendant may carry out the uprooting of the coffee plants and the regeneration within the stated time frames and under the stated conditions." It is clear from the foregoing that what was originally ordered gave the convicted person, as an option, the possibility of choosing natural regeneration of native species — that is, without any active intervention on his part in the planting.
Certainly, the availability of the options to choose from in that judgment was somewhat illogical — between the possibility of reseeding native species or allowing them to regenerate naturally — since obviously the first was burdensome for the defendant, while the second implied nothing more than a non-action and allowing the natural course of events to unfold. However, since the Public Prosecutor's Office did not challenge this second possibility, it acquiesced in the terms of that ruling, and said possibility cannot now be arbitrarily excluded in a manner contrary to the defendant's interests, in violation of fundamental rights and due process in the trial of the convicted person. In the present case, we are faced with a defect of such gravity that it must be corrected ex officio by this Tribunal in favor of the defendant, since, although it was not expressly alleged, it certainly seriously affects his interests and bears upon elements of the judgment that were expressly challenged, such as the impossibility of complying with the order as handed down, due to the unavailability of the species cited in the judgment.
Accordingly, this tribunal corrects the error identified, in the sense that what the convicted person must comply with is the uprooting of the coffee plants, which shall be carried out, as originally ordered, updating the deadline to December of the present year, without prejudice to opting for natural regeneration of the land. In this regard, the argument raised in the appeal under consideration — that said possibility was not viable because no civil damages claim had been filed — is not well-taken, insofar as, as this same chamber had already ruled in the aforementioned prior ruling number [Telf2]:
"While what the judge ordered in the present matter does not correspond to the existence of a civil damages claim, it is nonetheless true that it does not exceed the will of the law, which requires the reparation of damages when an offense is committed, regardless of intent or negligence. In the present case the act was committed intentionally, which makes what was ordered by the Trial Court of Cartago all the more fully justified." It should be noted that, in that ruling, the only matter that was annulled and remanded for a new decision was the question of the time frames, stages, and monitoring mechanisms for compliance with the condition to which the benefit was made subject, so that not even that benefit, nor the condition imposed, was called into question, and for that reason, in this respect as well, the claim is inadmissible, since the judgment is final in that regard.
III.In the second procedural ground for cassation (casación), articles 37, 369 subsections h) and i), 175, and 178 of the Code of Criminal Procedure; article 45 of the Political Constitution; article 2 of the Ley Forestal Número 7575 of April 16, 1996; and article 30 of the Criminal Code are cited as the legal basis for the claim. The appeal argues that the indication in the judgment that an official notice be issued to the property owner requiring the convicted person to proceed with the uprooting (desarraigo) of the coffee plants amounts to ordering a criminal act that is contrary to and violates the right to private property of the landowner, who was not a party to the present proceedings, thereby violating the constitutional guarantee of article 45 of the Constitution. It is noted that the owner of the property (finca) was never summoned or notified, despite knowledge that the land did not belong to the defendant; accordingly, acting in that manner is deemed improper, and nullity (nulidad) of the decision is requested.
The claim does not succeed. As was clearly set out in the preceding considerando, the very condition of uprooting the coffee plants had already been ordered in the original judgment and was not questioned by the ruling of this Tribunal that ordered the remand (reenvío); therefore, that aspect of the decision has become final. Additionally, it must be noted that, as this same tribunal stated in the frequently cited resolution number [Telf2], said order is the result of the prevalence of public interests over individual interests in matters as sensitive and of such social importance as the conservation of a healthy and ecologically balanced environment. Furthermore, as was established by the judgment handed down by the Tribunal de Cartago, the defendant was found to be the responsible perpetrator of having planted the coffee, thereby effecting a land-use change (cambio de uso del suelo); it therefore follows that no particular harm would be caused to the legitimate interests of the owner if he removes what he himself planted.
THEREFORE:
The first ground for cassation raised by the defendant's counsel is partially upheld; the judgment is quashed insofar as it contravenes the prohibition of non reformatio in peius; in its place, it is ordered that the convicted person, as a condition for maintaining the benefit of a suspended sentence (ejecución condicional de la pena), must uproot the coffee planted by him on the property in question, having until December of the current year to do so and being permitted to opt for natural regeneration (regeneración natural) of the land; failure to comply with this condition will result in revocation of the benefit granted. The remaining grounds raised are declared without merit.

TRIBUNAL DE CASACIÓN PENAL Res. [Telf1] TRIBUNAL DE CASACIÓN PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las dieciséis horas con diez minutos del cinco de noviembre de dos mil cuatro.
RECURSO DE CASACIÓN interpuesto en la presente causa seguida contra [Nombre1], mayor, soltero, cédula de identidad CED1, por el delito de CAMBIO DE USO DE SUELO, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso los jueces Jorge Luis Morales García, Ulises Zúñiga Morales y [Nombre2]. Se apersonaron en Casación los Licenciados [Nombre3], defensor particular y [Nombre4], Procurador de la República.
RESULTANDO:
1. Que mediante sentencia dictada a las dictada a las catorce horas del veinte de mayo de dos mil dos, el Tribunal de Juicio de Cartago resolvió: “POR TANTO: De conformidad con lo expuesto y artículos 39 y 41 de la Constitución Política, 1, 30, 31, 45, 59 y siguientes del Código Penal, 61 a) y c)y 62 de la Ley Forestal 7575, 1 al 15, 180 a 184, 265 a 267, n324, 346 y 371 del Código Procesal Penal, se declara a [Nombre5] autor responsable del delito de CAMBIO DE USO DE SUELO, en perjuicio de LOS RECURSOS NATURALES, y como tal se le impone la pena de UN AÑO DE PRISION. Se le concede el beneficio de ejecución de la pena por un período de prueba de TRES AÑOS, tiempo durante el cual no podrá cometer nuevo delito doloso sancionado con pena de seis meses de prisión porque se le revocará dicho beneficio. Se absuelve de toda pena y responsabilidad a [Nombre5] por el delito de construcción ilegal de camino en perjuicio de los Recursos Naturales.
Son las costas a cargo del sentenciado. Queda el imputado obligado a restaurar la montaña y en tal sentido deberá eliminar el café y en su lugar resembrar especies locales o permitir que ellas renazcan naturalmente. Lo anterior bajo pena de revocarle también el beneficio de ejecución que se le ha concedido. Con la lectura quedan notificadas las partes.- Lic. [Nombre6] Juez de Juicio. ” 2. Que contra el anterior pronunciamiento el Licenciado [Nombre3] interpuso Recurso de Casación.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso.
4. Que en los procedimientos se han observado las prescripciones legales pertinentes.
REDACTA el Juez [Nombre7]; y,
CONSIDERANDO:
I.El defensor del condenado en el presente proceso interpone formal recurso de casación en contra de la resolución tomada por el Tribunal de Juicio de Cartago a las quince horas del veintiséis de setiembre de dos mil tres, misma que integra, en juicio de reenvío, la sentencia número 142-02 de las catorce horas del veinte de mayo de dos mil dos, dicho recurso reúne los requisitos de admisibilidad establecidos por los artículos 422, 423, 424, 443, 444, 445 del Código Procesal Penal, entrándose a resolver los aspectos planteados.-
II.En el primer motivo de casación por la forma, se indican como violentados los artículos 23, 24, 25, 29, 30, 38 y 40 de la Ley Forestal Número 7575 del 16 de abril de 1996, los numerales 50, 59 y 60 del Código Penal, 39 y 40 de la Constitución Política, 37, 369, incisos h) e i), vicios de procedimiento sancionados como actividad procesal defectuosa por los artículos 175, 178 y 433 del Código Procesal Penal. Se alega, en primer término que, en el presente proceso no se dedujo ninguna acción civil resarcitoria, situación que, a su entender hace improcedente la resolución oficiosa del tribunal en relación con las condiciones impuestas de restaurar la montaña, eliminar el café y sembrar especies locales o permitir que ellas renazcan naturalmente; indica que esto viene a ser una pena alternativa, que no tiene posibilidad de cumplir, por lo que su única opción será ir a la cárcel, dado que las condiciones fijadas resultan imposibles de cumplir, por no haber disponibilidad de las especies arbóreas que ordena el fallo, ni precisarse la zona que se debe reforestar.
También señala que él no deforestó, por lo que la condición de que debe proceder a reforestar, contraría el principio de proporcionalidad de la pena, que, ha señalado la Sala Constitucional, en voto número 1953-96, de las 12:03 horas del 26 de abril de 1996, integra el debido proceso. El reclamo resulta parcialmente procedente por razones distintas a las alegadas. Para resolver adecuadamente el motivo de disconformidad en el presente caso, hay que referirse con claridad a los antecedentes de la resolución que en este asunto nos ocupa. En efecto, en primer lugar es necesario indicar que la sentencia inicialmente dictada, número 142-02 de las catorce horas del veinte de mayo de dos mil dos, respecto al punto que fue posteriormente objeto del recurso de casación y dispuesto su reenvío estableció:
“SOBRE LA RESTAURACION: Tal y como lo solicitó el representante el ministerio público (sic), y debido a que no resulta justo ni equilibrado que el imputado saque provecho de la acción típica y antijurídica por la cual se le condenó, queda el imputado obligado a restaurar la montaña y en tal sentido deberá eliminar el café y en su lugar resembrar especies locales o permitir que ellas renazcan naturalmente. Lo anterior bajo pena de revocarle también el beneficio de ejecución que se le ha concedido. El fundamento para dictar esta medida está en el dictamen científico elaborado por don [Nombre8], en el que se hizo asesorar por especialistas versados en el tema forestal (folios 67 a 75).” (confrontar folio 331 del expediente, la negrita no pertenece al original).
Esa misma circunstancia fue recogida en el dispositivo, al acordarse: “Queda el imputado obligado a restaurar la montaña y en tal sentido deberá eliminar el café en su lugar resembrar especies locales o permitir que ellas renazcan naturalmente. Lo anterior bajo pena de revocarle también el beneficio de ejecución que se le ha concedido.” (folio 332 del principal, resaltado agregado). Ahora bien, de ese fallo, en su oportunidad recurrió únicamente el Licenciado [Nombre3], como abogado defensor del señor [Nombre1] y a favor de éste. Como puede corroborarse, a folio 353, lo único que realizó el Ministerio Público fue contestar la audiencia, en oposición a los argumentos esgrimidos por el impugnante, sin que en ningún momento se dedujera una impugnación independiente del ente acusador, ya fuera autónoma o de carácter adhesivo. El Tribunal de Casación, en virtud de resolución número [Telf2] de las once horas cincuenta y cuatro minutos del cinco de mayo de dos mil tres, dispuso: “Se anula parcialmente la sentencia venida en alzada, solamente en cuanto a los plazos, etapas y formas de control para el cumplimiento de la condición por la que se otorga el beneficio de ejecución condicional de la pena.
Se ordena el reenvío para que se resuelvan estos aspectos. En lo que no se menciona queda firme el fallo de mérito.” (Folio 370). Resulta claro, que tratándose de la resolución de un recurso interpuesto por la defensa y, en virtud de la prohibición de la non reformatio in peius, la situación inicial del imputado no podría verse agravada en el juicio de reenvío, sin embargo, esta prohibición no fue respetada por el juez a quo, lo que se nota claramente de una mera transcripción del dispositivo en lo acordado, pues en la resolución que aquí es objeto de impugnación se dispuso:
“De conformidad con lo expuesto y artículos 59 y siguientes del Código Penal, se mantiene lo resuelto en cuanto al beneficio de ejecución condicional de la pena concedido al imputado, el cual se le revocará, si no desarraiga el café y regenera la zona con especies nativas como: 2 tipos de Aguacatillos, Sirrí, cacho de venado, papallillo (sic), dantisco, roble encino, magnolia, dama, tirrá. Para ello, realizará el DESARRAIGO antes de que finalice diciembre del año 2003. Luego hará la REGENERACION NATURAL y la siembra en las condiciones dichas, hasta antes de finalizado el mes de JUNIO del 2004. A partir de esa fecha se hará cinco controles semestrales con visitas periódicas e informe a cargo del MINAE. Todos los costos o gastos son a cargo del imputado. Líbrese atento oficio a la propietaria del inmueble para que el imputado realice en forma dicha el desarraigo del café y la regeneración dentro de los plazos y en las condiciones dichas.” Queda claro, de lo anteriormente expuesto, que lo originalmente dispuesto daba como una opción al condenado, la posibilidad de optar por la regeneración natural de las especies nativas, es decir, sin ninguna intervención activa de su parte en la siembra.
Ciertamente, era un tanto ilógica la procedencia de las opciones a escoger en dicha sentencia, entre la posibilidad de resembrar especies locales o permitir que ellas renazcan naturalmente, pues obviamente, la primera resultaba gravosa para el imputado, mientras la segunda no implicaba más que un no hacer y permitir el decurso natural de los acontecimientos, sin embargo, la representación del Ministerio Público, al no impugnar esta segunda posibilidad, se conformó con lo dispuesto en esa resolución y dicha posibilidad, no puede venir a ser excluida, en forma arbitraria y contraria a los intereses del imputado en esta oportunidad, contraviniendo los derechos fundamentales y el debido proceso en el juzgamiento del condenado. En este caso, estamos ante un vicio de tal gravedad que, debe ser subsanado de oficio por este Tribunal, a favor del justiciable, pues, pese a que expresamente no se alegó, ciertamente afecta gravemente sus intereses e incide sobre elementos del fallo que si fueron expresamente criticados, como la imposibilidad de cumplir con el mandato, según lo resuelto, por carecer de la disponibilidad de especies que se citaron en la sentencia.
Así las cosas, este tribunal enmienda el yerro apuntado, en el sentido de que el condenado lo que deberá cumplir es con el desarraigo del café, lo cual deberá llevarse a cabo, tal y como originalmente se dispuso, actualizando el plazo a diciembre del presente año, sin perjuicio de optar por la regeneración del terreno. En tal sentido, no es de recibo el argumento expuesto en el recurso que conocemos, que indica que dicha posibilidad no era viable por no haberse deducido la acción civil resarcitoria, toda vez que, como lo había resuelto esta misma cámara, desde la resolución anterior ya citada número [Telf2]:
“Si bien en el presente asunto lo resuelto por el juzgador no corresponde a la existencia de una acción civil resarcitoria, es lo cierto que no sobrepasa la voluntad de la ley, que exige la reparación de los daños cuando se cometa delito, con independencia del dolo o la culpa. En este caso se actuó dolosamente, por lo que con mayor razón tiene total aceptación lo dispuesto por el Tribunal de Juicio de Cartago.” Cabe puntualizar, que en dicha resolución lo único que se anuló y se reenvió para ser nuevamente resuelto fue lo referente a los plazos, etapas y formas de control para el cumplimiento de la condición a la que se sujetó el beneficio, por lo que, ni siquiera ese beneficio, ni la condición impuesta, fue cuestionada, de ahí que, en este sentido, también el reclamo es impertinente, porque en cuanto a ello el fallo está firme.
III.En el segundo motivo de casación por la forma, se reseñan como sustento jurídico del reclamo los artículos 37, 369 incisos h) e i), 175 y 178 del Código Procesal Penal, 45 de la Constitución Política, 2 de la Ley Forestal Número 7575 del 16 de abril de 1996 1 y 30 del Código Penal. Se argumenta en el recurso que la indicación en el fallo de que se libre un oficio para la propietaria del inmueble a fin de que el condenado proceda al desarraigo del café implica el ordenar un hecho delictuoso, contrario o atentatorio del derecho a la propiedad privada del dueño del terreno, el que no fue parte en el presente proceso, violentando así la garantía constitucional del artículo 45 de la Carta Magna. Señala que nunca se citó o notificó a la persona dueña de la finca, pese a que se tenía conocimiento de que el terreno no era del imputado, por ello, se considera improcedente el actuar en ese sentido y se pide la nulidad de lo resuelto.
El reclamo no procede. Como claramente se expuso en el considerando anterior, la condición misma del desarraigo del café, ya había sido dispuesta desde la sentencia original y no fue cuestionada por la resolución de este Tribunal que ordenó el reenvío; por lo que, ese aspecto de lo resuelto se encuentra firme; adicionalmente, debe de decirse que, dicha disposición, tal y como se expuso por este mismo tribunal, en la tantas veces citada resolución número [Telf2], es producto de la prevalencia de los intereses públicos sobre los individuales, en materias tan álgidas y de importancia social como es la conservación de un ambiente sano y ecológicamente equilibrado; por otra parte, tal y como quedó demostrado con la sentencia dictada por el Tribunal de Cartago, el imputado fue encontrado autor responsable de haber sembrado el café, cambiando así el destino del suelo, de ahí que, se deduce que ninguna afectación particular estaría efectuando a los intereses legítimos del propietario si remueve lo que él mismo plantó.-
POR TANTO:
Se acoge parcialmente el primer motivo de casación deducido por el defensor del imputado, se casa la sentencia en cuanto contraviene la prohibición de la non reformatio in peius, en su lugar se dispone que el condenado, como condición para que se mantenga el beneficio de ejecución condicional de la pena, deberá desarraigar el café sembrado por él en el terreno en cuestión, contando para ello con plazo hasta diciembre del presente año pudiendo optar por la regeneración natural del terreno, y en caso de incumplir con dicha condición, se le revocará el beneficio otorgado. Se declara sin lugar los restantes motivos esgrimidos.
