-2004 532-2004 ADMINISTRATIVE LITIGATION COURT, SECOND SECTION. II Judicial Circuit. San José, at fifteen hours and ten minutes on veintiuno de octubre de dos mil cuatro.- Motion to stay the effects of the administrative act (incidente de suspensión de los efectos del acto administrativo), filed by Nombre60357 within the ordinary proceeding brought by him against the State before the Administrative Litigation and Civil Treasury Court (Juzgado de lo Contencioso Administrativo y Civil de Hacienda).- RESULTS:

1º.- The subject matter of this case is the stay of the administrative act (suspensión del acto administrativo), consisting of Environmental Tribunal decisions numbers 971-03-TAA, issued at catorce horas veintiocho minutos del dieciséis de setiembre de dos mil tres, and 1030-03-TAA, issued at nueve horas cincuenta minutos del treinta de setiembre de dos mil tres.- 2º.- After the required notice was served, the State’s representative opposed the measure.- 3º.- Attorney Rosibel Jara Velásquez, Acting Judge of the Court with jurisdiction over the matter, ordered as follows in decision number 495-2004, issued at trece horas treinta minutos del cuatro de mayo último: “THEREFORE: The present motion to stay the administrative act is denied.”- 4º.- Dissatisfied with the ruling, the plaintiff appealed; the appeal was admitted, and this Court therefore hears the matter on appeal.- 5º.- The statutory procedures have been observed in these proceedings, and no grounds for nullity capable of invalidating the proceedings are apparent. This judgment is issued within the statutory period.- Judge Ferrero Aymerich writes the opinion; and

CONSIDERING:

I.The facts listed as proven are adopted because they are supported by the evidence cited in their support. Nevertheless, the Court adds the following as proven facts: 4.- that the Engineering Department of the Municipalidad de Aserrí granted permit number 141 in mayo de dos mil dos to Mr. Nombre60358, “(…) To carry out earthworks (movimiento de tierras) (Widening and clearing of an existing road with an area of 300 m (…)” (copies at folios 13 and 14); 5.- that the witness Nombre60359 stated that, on behalf of Mr. Nombre60358, he requested permission from the movant, “(…) to clear the road; the idea was to carry out a properly executed project, and the work was performed on Mr. Nombre60358’s portion. The work performed on Don Nombre60357’s portion was carried out by Don Nombre60358 with Don Nombre60357’s permission (…) No terraces were made; the soil left over from widening the road was placed in the pasture.

(…) Don Nombre60358 wanted to widen the access routes, and we were granted permission. The Municipality granted the permit requested by Don Nombre60358 (…)” (his statement given in the administrative proceedings, folios 39 to 42); 6.- that the witness Nombre60360 states that “(…) Don Nombre60358’s property belonged to me; he bought the property from me, and the road had already been built. He then asked Don Nombre60357 for permission to widen the road, and the work was later stopped because of these problems. The road was cleared and widened a little, by about 5 or 6 metros, and it had previously been 3 metros wide; they deposited the soil on Don Nombre60357’s property (…)” (same item of evidence); 7.- that, during a visit to the land owned by the movant, the members of the Environmental Tribunal noted the following: “(…) Specifically, on the property adjoining that of Mr. Nombre60358, there are 3 medium-sized terraces (approximately 300 m2) and trees of unknown species, with diameters greater than 15 cm, have been cut down.

This property shows a serious alteration of the land caused by the earthworks and terracing work (labores de terraceo) performed, which, because of the extremely steep slope, could cause a major landslide that might ultimately endanger the physical safety of the persons living in the lower portion of the affected property. In another part of the road, extensive gullies can be seen, caused by water runoff, evidencing a high degree of erosion due to the exposure of soil without forest cover (cobertura forestal) (…)” (proceeding of veinticuatro de enero de dos mil tres, at folio 94 of the principal case file); 8.- that the “visual inspection record” (acta de inspección ocular), prepared by members of the Environmental Tribunal on dieciséis de setiembre de dos mil tres, notes that the construction of a road and the formation of terraces and earthworks can be observed on the land owned by the movant.

Water erosion (erosión hídrica) is also observed, “(…) resulting from the complete lack of runoff-water management. The formation of gullies along the road and soil erosion caused by runoff transport are apparent (…)” (folio 31 of the motion record).-

II.The following matters are listed as unproven: a.- there is no evidence of Mr. Nombre60357’s profession or occupation or of his income; b.- the cost of the soil studies ordered by the Environmental Tribunal; c.- irreparable or difficult-to-repair damages and losses (daños y perjuicios de imposible o difícil reparación). No evidence was submitted in this regard.-

III.The petitioner alleges that the decision issued in the administrative proceedings left him without a defense by finding him responsible for environmental damage to the soil and water, when the fact is that it was established that he never performed infrastructure work or earthworks on his property. He continues by stating that he is a farmer who depends on a weekly wage with which he supports his parents and that, for this reason, he cannot afford the preparation of soil and slope-stability studies, including construction designs, completion schedules, identification of the responsible professional, and appropriate systems for removal of the road, nor can he afford to pay a fine of cien mil colones. He states that the erosion is natural and caused by rain, and therefore that he has nothing to do with natural events that cause a rock face gradually to break away. “(…) If I were attempting to build something and had caused such damage while performing earthworks, then of course I would be responsible for what I myself had caused.

The easement (servidumbre) that gave rise to this litigation is not even used by me (…)”. He says that it cannot be claimed that the harm to him is not difficult or impossible to repair, when the fact is that he lacks the financial resources to comply with the order, because “(…) Who is going to grant me a loan based on the money I earn? What banking institution will deem me eligible for an infrastructure project that will not produce a single cent with which to repay the money? That rock outcrop does not even have fruit trees. How could I comply with what has been requested, when this is the only asset I own? How could it not impair my estate when mortgaging it to anyone would mean exactly the loss of the land in exchange for the money they give me?(…)”. He states that the administrative decision did not hear the witnesses, who were clear and precise in establishing his innocence, and that it also rules that, in the event of noncompliance, he will go to jail. In light of the foregoing, he requests that the decision be reversed and that his motion be granted.-

IV.The purpose of the precautionary measure (medida cautelar) is to protect the subject matter of the litigation and ensure effective compliance with any judgment that may ultimately uphold the claim, as a safeguard and counterbalance to the enforceability of administrative acts—articles 146 to 151 of the Ley General de la Administración Pública—which are therefore vested with binding and executory force. Accordingly, the measure is appropriate when it can be established that enforcement would cause irreparable or difficult-to-repair damages or losses, under the terms of section 91 of the Ley Reguladora de la Jurisdicción Contencioso Administrativa. Relevant considerations include the imminence of the harm, but, even more importantly, its relationship to the public interest, which in some cases must prevail over the private party’s interest. As an initial matter, the Court observes that the petitioner did not establish any irreparable or difficult-to-repair damages or losses, limiting himself to alleging defects in the challenged decisions. It was only at this stage that he claimed to have no money, but he submitted no evidence whatsoever concerning his profession or occupation or showing that he lacks the financial means to pay the imposed fine. Nor did he establish the cost of the ordered soil studies. These circumstances alone require denial of the motion.

V.Nevertheless, the assessment made on this occasion is also based on other considerations. Specifically, it is based on the public interest in safeguarding the environment as a common good of the citizenry, which merits complete protection against the private party involved, taking into account all corrective measures ordered for its protection and, above all, the primacy of Environmental Law (Derecho Ambiental) and its derivative, the pro natura principle (principio pro natura). The evidence in the record established that water erosion was caused by the earthworks and construction of terraces on the petitioner’s property, all of which unquestionably constitutes damage deserving protection. On this subject, there is precedent from the First Section of this Court, which held as follows in judgment number 30-2001, issued at 10 horas 45 minutos del 2 de febrero de 2001:

“(…) IV).- Although all the cited texts regulate specific matters, there is not a single one that fails to recognize the incontrovertible fact that protecting nature, which is part of the world’s heritage, means safeguarding not only people’s lives and health but also the life of humanity on Earth.- It is for this reason that today we speak of ‘sustainable development’ (desarrollo sostenible), which, in its most basic conception, incorporates the environmental variable into the economic and social aspects that have traditionally formed part of every development plan, with the aim of protecting our present and safeguarding the heritage of future generations.- Our constitutional case law has addressed this issue extensively and has staunchly defended the environment in relation to the various development plans and policies that have been proposed for implementation in our country. Thus, in judgment number 2641-96, it stated:

‘The environment... must be understood as a development resource to be used appropriately, requiring integrated action in its natural, sociocultural, technological, and political relationships, because otherwise its productivity for the future and the present will be degraded and the heritage of future generations could be placed at risk... The primary objective of the use and protection of the environment is to achieve development and evolution favorable to human beings. Environmental quality is a fundamental parameter of that quality of life; other no less important parameters are health, food, work, housing, education, etc. More important, however, is understanding that although human beings have the right to use the environment for their own development, they also have the duty to protect and preserve it for the use of present and future generations. This is not particularly novel, because it is merely the application to this field of the principle of “injury” (principio de la lesión), already firmly established in Private Law (Derecho Común), under which the legitimate exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational and beneficial exercise of the right itself.’ Along the same lines, and more specifically regarding sustainable law, that Court has stated:

“…it is the State’s obligation to provide for its protection [that of the environment], whether through general policies aimed at achieving that end or through specific actions by the Administration. Sustainable development is one such general policy established by the State to expand the opportunities for all persons to fulfill their aspirations for a better life, by increasing productive capacity or by broadening the possibilities of attaining equitable progress between population growth and natural systems. Sustainable development is the process of transformation in the use of resources, the direction of investments, the channeling of technological development, institutional changes, and everything that contributes to meeting present and future human needs.” (Judgment number 1763-94) This new conception of how the development of our society should be pursued requires all of us—private individuals and public officials alike—to strive to find solutions that reconcile all the interests at stake, seeking, insofar as possible, to minimize harm to the environment.

Thus, the aim is not to impede countries’ technological development or the satisfaction of the population’s basic needs, but rather to ensure that those objectives are achieved in harmony with the environment, that is, by balancing all the factors that affect decision-making. This specialized jurisdiction is not exempt from that obligation, particularly when ruling on whether precautionary measures (medidas cautelares) for the protection of the environment are warranted (…).”-

VI.The proven facts establish that, on the property owned by Mr. Nombre60357, terraces were constructed and earthworks (movimientos de tierra) and tree-felling were carried out, causing “water erosion,” which unquestionably causes environmental harm and poses an imminent danger to the neighbors. In any event, even if it were accepted that Mr. Nombre60357 did not perform the work, the fact remains that he consented to it without taking the appropriate preventive measures; and, in the absence of scientific and technical studies demonstrating otherwise, the most appropriate course is to uphold the decision adopted by the Environmental Tribunal and, as a corollary, to affirm the challenged ruling.

THEREFORE:

-2004 532-2004 TRIBUNAL CONTENCIOSO ADMINISTRATIVO, SECCION SEGUNDA. II Circuito Judicial. San José, a las quince horas diez minutos del veintiuno de octubre de dos mil cuatro.- Incidente de suspensión de los efectos del acto administrativo, establecido por Nombre60357 dentro del proceso ordinario tramitado en el Juzgado de lo Contencioso Administrativo y Civil de Hacienda, de él contra el Estado.-

RESULTANDO:

1º.- El objeto de este asunto, es la suspensión del acto administrativo, resoluciones del Tribunal Ambiental números 971-03-TAA de catorce horas veintiocho minutos del dieciséis de setiembre de dos mil tres, y 1030-03-TAA de nueve horas cincuenta minutos del treinta de setiembre de dos mil tres.- 2º.- Corrido el traslado de rigor, la representación estatal se opuso a la medida.- 3º.- La licenciada Rosibel Jara Velásquez, Juez a. i. del Juzgado de la materia, en resolución número 495-2004, de trece horas treinta minutos del cuatro de mayo último, dispuso: “POR TANTO: Se rechaza el presente incidente de suspensión del acto administrativo”.- 4º.- Inconforme con lo resuelto el actor apeló, recurso admitido y en virtud de lo cual conoce este Tribunal en alzada.- 5º.- En los procedimientos se han observado los trámites legales sin que se noten causales de nulidad capaces de invalidar lo actuado. Esta sentencia se dicta dentro del término de ley.- Redacta la Juez Ferrero Aymerich; y

CONSIDERANDO:

I.Se suscriben los hechos que como demostrados se enlistan, al tener respaldo en los elementos de prueba que se citan en su apoyo. No obstante, el Tribunal se permite agregar como tales, los siguientes: 4.- que la Municipalidad de Aserrí, Departamento de Ingeniería, otorgó el permiso número 141 en mayo de dos mil dos, al señor Nombre60358 , “(…) Para que lleve a cabo movimiento de tierras (Ampliación y limpieza de camino existente con área de 300 m (…)” (copias a folios 13 y 14); 5.- que el testigo, Nombre60359 expresó, que él, a nombre del señor Nombre60358 , solicitó permiso al incidentista, “(…) para limpiar el camino, la idea era hacer un proyecto bien hecho, en la parte de don Nombre60358 si se realizaron los trabajos. Los trabajos realizados en la parte de Don Nombre60357 se hicieron por parte de Don Nombre60358 con el permiso de Don Nombre60357 (…) No se hicieron terrazas, la tierra que sobro (sic) de la ampliación del camino la colocaron en el potrero.

(…) Don Nombre60358 lo que quería era ampliar los accesos, nos dieron permiso. La Municipalidad dio permiso pedido por Don Nombre60358 (…)” (declaración suya, rendida en sede administrativa, folios 39 a 42); 6.- que el testigo, Nombre60360 , manifiesta, que “(…) la finca de Don Nombre60358 era mía, el señor me compro (sic) la finca y el camino estaba hecho, luego le pidió permiso a don Nombre60357 para ampliar el camino y luego se pararon los trabajos por estos problemas. Se limpio (sic) y se amplio (sic) un poquito como 5 o 6 metros el camino y antes tenía 3 metros, la tierra la hecharon (sic) donde don Nombre60357 (…)” (mismo elemento probatorio); 7.- que en visita al terreno propiedad del incidentista, los integrantes del Tribunal Ambiental, destacan lo siguiente: “(…) Propiamente en el fundo que se encuentra contiguo al del señor Nombre60358 , se aprecian 3 terrazas de tamaño regular (aproximadamente 300 m2) y la corta de árboles de especies desconocidas, con diámetro superior a 15 cm.

En esta propiedad se denota una grave alteración del terreno producido por el movimiento de tierras y las labores de terraceo ejecutadas, las cuales, por la pendiente tan pronunciada, podría llegar a provocar un deslizamiento de tierra importante que eventualmente podría llegar a poner en peligro la integridad de las personas que habitan en la parte inferior del fundo afectado. En otro parte del camino se aprecian cárcavas extensas, producidas por la escorrentía de aguas, lo que evidencia un acto grado de erosión por la exposición de la tierra sin cobertura forestal (…)” (diligencia de veinticuatro de enero de dos mil tres, a folio 94 del expediente principal); 8.- que en “acta de inspección ocular”, llevada a cabo por integrantes del Tribunal Ambiental, el dieciséis de setiembre de dos mil tres, se destaca, que el terreno propiedad del articulante, se observa la construcción de un camino y la conformación de terrazas y movimientos de tierra.

Se observa también, erosión hídrica “(…) producto de que no hay ningún manejo del agua de escorrentía. Por el camino se denota la conformación de cárcavas y la erosión del suelo por arrastre de la escorrentía (…)” (folio 31 del incidente).-

II.Como indemostrados, se enlistan los siguientes extremos: a.- no consta la profesión u oficio del señor Nombre60357 ni los ingresos con que cuenta; b.- el costo de los estudios de suelos ordenados por el Tribunal Ambiental; c.- los daños y perjuicios de imposible o difícil reparación. No se procuró prueba al respecto.-

III.Alega el petente que lo decidido en sede administrativa le provocó indefensión al encontrarlo responsable de un daño ambiental al suelo y al agua, cuando lo cierto es que quedó acreditado, que él nunca realizó obras de infraestructura ni de movimientos de tierra en el terreno de su propiedad. Es, sigue, un agricultor que depende de un salario semanal con el que mantiene a sus padres y por ello, no puede hacer frente a la elaboración de estudios de suelo y estabilidad de taludes, comprensivos de diseños de obras, tiempo de ejecución, profesional responsable, sistemas adecuados de removido del camino, así como hacer frente al pago de una multa de cien mil colones. Los hechos de erosión, señala, son naturales, causados por la lluvia, por lo que él no tiene nada que ver con los hechos de la naturaleza, que hacen que una peña, poco a poco se desprenda. “(…) Si fuera que mi persona estuviera tratando de construir y hubiera ocasionado a la hora de hacer movimientos de tierra tales daños.

Por supuesto que soy responsable de lo que yo mismo hubiere provocado. La servidumbre que ha dado lugar a esta litis no es siquiera utilizada por mí (…)”. No puede afirmarse, dice, que el daño para él no es de difícil o imposible reparación, cuando no lo cierto es que no cuenta con recursos económicos para hacer lo que se le ordenó, ya que “(…) Quién me va a dar a mi un préstamo con el dinero que devengo. ¿Cuál institución bancaria me va a reconocer como elegible para una obra de infraestructura que no a producir un cinco que posibilite el retorno del dinero?. Dicho peñón no tiene ni árboles frutales. Como podría yo hacerle frente a lo solicitado, siendo este el único patrimonio que tengo ¿Cómo no va a ser un menoscabo a mi patrimonio que sometiéndolo a hipoteca ante cualquiera, significa exactamente la perdida (sic) del terreno por el dinero que se me de?(…)”. La resolución administrativa, refiere, no escuchó a los testigos que fueron claros y precisos en demostrar mi inocencia, la que también decide, que en caso de no cumplimiento, irá a la cárcel. En virtud de lo expuesto, solicita la revocatoria de lo decidido y se acoja su incidente.-

IV.La medida cautelar tiene como finalidad la protección del objeto litigioso y el cumplimiento efectivo de la sentencia eventualmente estimatoria, como garantía y contrapreso frente a la ejecutividad de los actos administrativos - artículos 146 a 151 de la Ley General de la Administración Pública -, y por ende, revestidos de fuerza obligatoria y ejecutiva. Es procedente entonces, cuando se logre comprobar que con su ejecución, se hubieren de producir, daños o perjuicios de reparación imposible o difícil, según los términos del ordinal 91 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa, dentro de los que destacan, la inminencia de la producción del daño, pero aún más, de su relación con el interés público, que, en algunos casos, debe prevalecer sobre el del particular. Como primera providencia observa el Despacho, que el petente no comprobó los daños y perjuicios de reparación imposible o difícil, limitándose a enunciar vicios en las resoluciones combatidas. No es sino hasta en esta instancia, que manifiesta no tener dinero, mas no aportó elemento probatorio alguno respecto de su profesión u oficio o bien, que carezca de medios económicos para hacer frente a la multa impuesta. Tampoco acreditó el costo de los estudios de suelos ordenados, estas circunstancias por sí solas, provocan la denegatoria de la articulación.

V.No obstante, lo ponderado en esta oportunidad, obedece también a criterios diferentes. En específico, al interés público en el resguardo del medio ambiente como bien común de los ciudadanos, el cual merece una total defensa frente al particular involucrado tomando en consideración, todas las medidas correctivas que se acuerden para su protección, y sobre todo, la prevalencia del Derecho Ambiental y su derivado, el principio pro natura. De los atestados que constan en autos se comprobó, la erosión hídrica ocasionada con los movimientos de tierras y la construcción de terrazas en el terreno propiedad del gestionante, todo lo cual, constituye, a no dudarlo, un daño que merece ser protegido. En relación al tema, existe un antecedente de la Sección Primera de este Tribunal, la que, en su sentencia número 30-2001 de 10 horas 45 minutos del 2 de febrero de 2001, dispuso:

“(…) IV).- Ahora, si bien es cierto todos los textos enunciados regulan temas concretos, no hay uno sólo de ellos en los que no se reconozca el hecho incontrovertible de que proteger la naturaleza, que es patrimonio mundial, es salvaguardar no sólo la vida de las personas y su salud, sino también la de la humanidad sobre la tierra.- Y es por esa razón que en la actualidad, se habla de "desarrollo sostenible", que en su concepción más básica incorpora a los aspectos económicos y sociales, tradicionalmente integrantes de todo plan de desarrollo, la variable ambiental, en la idea de proteger nuestro presente, así como de salvaguardar el patrimonio de las generaciones venideras.- Nuestra jurisprudencia constitucional ha sido abundante en este aspecto, y ha hecho una férrea defensa del ambiente, en relación con los diversos planes y políticas de desarrollo que se han pretendido implementar en nuestro medio. Así, en la sentencia número 2641-96, señaló:

"El ambiente... debe ser entendido como un potencial de desarrollo para utilizarlo adecuadamente, debiendo actuarse de modo integrado en sus relaciones naturales, socioculturales, tecnológicas y de orden político, ya que, en caso contrario, se degrada su productividad para el futuro y el presente y podría ponerse en riesgo el patrimonio de las generaciones venideras... El objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano. La calidad ambiental es un parámetro fundamental de esa calidad de vida; otros parámetros no menos importantes son salud, alimentación, trabajo, vivienda, educación, etc., pero más importante que ello es entender que si bien el hombre tiene derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción de esta materia, del principio de la "lesión", ya consolidado en el Derecho Común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales: por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y útil del derecho mismo" En esa misma línea, y más concretamente sobre el derecho sostenible, ha expresado ese Tribunal:

"...es obligación del Estado proveer a su protección [la del ambiente], ya sea a través de políticas generales para procurar ese fin o bien, a través de actos concretos por parte de la Administración. El desarrollo sostenible es una de esas políticas generales que el Estado dicta para ampliar las posibilidades de que todos puedan colmar sus aspiraciones a una vida mejor, incrementando la capacidad de producción o bien, ampliando las posibilidades de llegar a un progreso equitativo entre un crecimiento demográfico o entre éste y los sistemas naturales. Es el desarrollo sostenible, el proceso de transformación en la utilización de los recursos, orientación de las inversiones, canalización del desarrollo tecnológico, cambios institucionales y todo aquello que coadyuve para atender las necesidades humanas del presente y del futuro." (Sentencia número 1763-94) Esta nueva concepción, acerca de cómo debe buscarse el desarrollo de nuestra sociedad, obliga a que todos -particulares o funcionarios públicos- nos esmeremos en la búsqueda de soluciones para conciliar todos los intereses en juego, tratando de evitar, en la medida de lo posible, el menor daño al ambiente; de manera que no se trata de impedir el desarrollo tecnológico de los países, ni la satisfacción de las necesidades básicas de la población, sino de buscar que el cumplimiento de tales fines se haga en armonía con el medio, valga decir, en el equilibrio de todos los factores que inciden en la toma de las decisiones. De dicha obligación no escapa esta jurisdicción especializada, y menos aún, cuando se trata de resolver acerca de la procedencia o no, de medidas cautelares en defensa del ambiente (…)”.-

VI.De los hechos probados se obtiene, que en el terreno propiedad del señor Nombre60357, se destaca la construcción de terrazas y los movimientos de tierra y volteo de árboles, provocándose “erosión hídrica”, lo que sin lugar a dudas provoca un daño al ambiente y un peligro inminente para los vecinos. En todo caso, aún y cuando se aceptara que don Nombre60357 no fue el que realizó los trabajos, lo cierto del caso es que consintió en ellos, sin tomar las pedidas preventivas del caso, y ante la ausencia de estudios científicos y técnicos que demuestren lo contrario, lo más conveniente, es mantener la decisión adoptada por el Tribunal Ambiental, y como corolario de ello, avalar la resolución combatida.

POR TANTO:
