V-F-96 Decision No.: 2004-00567 THIRD CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at eleven twenty-one a.m. on the twenty-first day of May, two thousand four.

Appeal in cassation filed in the present proceedings brought against Nombre01, a Costa Rican citizen, of legal age, married, resident of Alajuela, identity card number CED01, for the offense of fraudulent conveyance to the detriment of Nombre02. Participating in the decision on the appeal are Justices Daniel González Álvarez, Presiding Justice; Jesús Alberto Ramírez Quirós, Alfonso Chaves Ramírez, Ronald Salazar Murillo, and Jorge Arce Víquez, the latter two sitting as Alternate Justices. Attorney Pablo Rodríguez Solano also participates as counsel for the accused. The representative of the Public Prosecutor’s Office entered an appearance.

Findings:

  1. 1By judgment N° 387-02 at sixteen hours on the twenty-eighth day of August, two thousand two, the Trial Court of the First Judicial Circuit of Alajuela ruled: “THEREFORE: In accordance with the foregoing and Articles 39 and 41 of the Political Constitution; 1, 30, 31, 45, 59 to 62, 71 to 74, and 217, subsection two, in relation to 216, subsection two, of the Criminal Code; 1 to 15, 184, 265, 360 to 372, and 468 of the Code of Criminal Procedure; 122 of the 1941 Criminal Code; and 1045 of the Civil Code, this Court, by unanimous vote, finds Nombre01 CRIMINALLY LIABLE AS THE PERPETRATOR OF THE OFFENSE OF FRAUDULENT CONVEYANCE committed to the detriment of Nombre02 and sentences her to TWO YEARS OF IMPRISONMENT, to be served at the place and in the manner determined by prison regulations, with credit for any time served in pretrial detention. The costs of the criminal proceedings shall be borne by the State.Once the judgment becomes final, it shall be entered in the Judicial Registry. The accused is granted the benefit of a conditionally suspended sentence for a probationary period of FOUR YEARS, with the warning that if she commits a new intentional offense punishable by more than six months’ imprisonment, this benefit shall be revoked and her arrest shall be ordered so that she may serve the sentence. The CIVIL ACTION FOR DAMAGES brought by civil plaintiff Nombre02 against civil defendant Nombre01 is partially granted, and public deed number 47 executed before Notary Guido Arturo Peñaranda Segreda at nine a.m. on the first day of September, nineteen ninety-two, is declared null and void. The accused is ordered to vacate said property, which order shall take effect one month after the judgment becomes final, with the warning that she shall be prosecuted for Disobedience to Authority if she fails to comply with said order.All other claims are denied. The civil defendant is also ordered to pay all costs and attorney’s fees of the civil action for damages, which shall be assessed during enforcement of the judgment. Once the judgment becomes final, the case file shall be closed and this matter removed from the docket. Notice shall be given by reading.” (sic).   2. 2The accused filed an appeal in cassation against the foregoing ruling. The appellant alleges expiration of the statute of limitations for the criminal prosecution and erroneous application of substantive law. She requests that the judgment be vacated and that the present case be remanded to the court of origin for new proceedings.-
  3. 3After the corresponding deliberation was held, the Chamber proceeded to consider the appeal.
  4. 4The pertinent legal requirements have been observed in the proceedings.

Justice Chaves R. reporting; and,

Considerations:

I.In the second ground of her appeal, the accused asserts that the statute of limitations for the criminal prosecution has expired. She argues that the charged acts date from 1 September 1992 and that, consequently, by the date of trial, namely 27 and 28 August 2002, the criminal prosecution was time-barred. She states that the current procedural code applies and that, pursuant to Article 216 of the 1973 Criminal Code, as amended by Law 7107, the penalty is two months to three years if the amount defrauded does not exceed 5 thousand colones, and six months to ten years’ imprisonment if it exceeds that amount. She adds that this article must be read in conjunction with Sections 82, 83, and 84 of the Criminal Code, in view of which the criminal prosecution is time-barred. The claim is denied. Because this is an objection that, if sustained, would terminate the proceedings, it shall be decided before considering the first ground of appeal.

Since the case against the accused commenced in 1999, it was conducted in accordance with the current Code of Criminal Procedure. Consequently, Articles 31 and 33 apply to the statute of limitations. The offense under investigation is fraudulent conveyance (Article 217 of the Criminal Code), punishable, in view of the amount defrauded, by six months to ten years’ imprisonment (in 1993 the base salary was 37.400 colones), and according to proven fact 6), the financial loss sustained was 600000 colones (folio 515). Once the proceedings had commenced, the first formal accusation of the act against the accused occurred when she gave her statement on 29 June 1999 (folio 53), an act as of which the ten-year limitations period was reduced by half and began to run anew. At the time of the judgment, the next interrupting act (the order first setting the preliminary hearing did not interrupt the period because it predated the amendment), issued on 28 August 2002 (folio 509), five years had not elapsed, and the case is therefore not time-barred. Accordingly, the claim is denied.

II.In the first ground of her appeal, the defendant (encartada) alleges the erroneous application of substantive law (ley sustantiva). She argues that INVU awarded her son, Nombre03, lot # 561 in the Nombre04 housing complex, subject to certain conditions, including that he could not transfer, sell, encumber, or otherwise dispose of the property without the institution’s prior express consent. She states that on 1 de setiembre, Nombre03 and his wife assigned to the accused (imputada), Nombre01, the rights to that property by deed number 47 executed before the notary public, attorney Guido Peñaranda; this was an ineffective transaction and therefore could not be regarded as conduct constituting the offense of fraudulent conveyance (estelionato), since the act was insufficient to produce legal effects. This was because no transaction involving that property could be conducted without INVU’s prior consent, which had not been obtained when the transfer was made.

She contends that the accused’s conduct in signing the deed therefore did not constitute an offense (atípica). The claim is granted. The accused was convicted of rendering the injured party’s right to lot # 561 in Urbanización Gregorio José Ramírez uncertain and subject to litigation, while enjoying the use and benefits of the property for 10 years for her own benefit and to the detriment of Nombre02, who had purchased the improvements and the right of possession (derecho de posesión) over the land (folio 530). The alleged conduct was that, despite knowing that the lot in question had been sold to the victim, the awardees transferred it to the defendant by deed while also requesting that INVU remove them from the family unit associated with that lot and include Nombre01 and her husband, Nombre05, thereby rendering Nombre02’s right over the property uncertain and subject to litigation (folio 515).

The judgment states that the Instituto Nacional de Vivienda y Urbanismo did not process the transfer of the property from Nombre03 to Nombre02 because, a few days later, the latter transferred it to his mother (folio 530). However, an examination of the contract entered into between Nombre03 and INVU, as well as the regulations governing the award of social-interest housing (viviendas de interés social), shows that the transaction between Nombre03 and Nombre02 conferred no vested right (derecho cierto) upon the latter. Under the Ley Orgánica del INVU, Article 4 identifies as one of its purposes the provision of adequate housing, preferably to families with the fewest resources. Rather than facilitating the acquisition of real property, the institution seeks to provide shelter and protection to those who lack them; therefore, until the awardee obtains title to the property (derecho al dominio de la propiedad), the relationship consists merely of making the serviced lot available so that the awardee may construct what is necessary for shelter.

This situation will continue if, for any reason, the respective municipality does not authorize the subdivision (segregación) of the lot, even if the award price has been paid in full (Article 8 of INVU’s regulations governing the award of serviced lots (adjudicación de lotes con servicios)). To ensure that this purpose of resolving a housing problem is fulfilled, and to prevent attempts to profit from the properties in view of the low price of the housing, certain requirements must be met to qualify as an awardee, particularly a lack of sufficient resources (Article 41 of the Ley Orgánica del INVU), and being a low-income head of household, which shall be verified through the appropriate studies (Articles 2 and 4 of the Reglamento para la adjudicación de vivienda). Trade in such housing is also regulated in furtherance of that purpose. Thus, Article 9 of INVU’s Reglamento para la adjudicación de vivienda, in force at the time of the events, provides that the awardee must sign a contract containing a declaration accepting, among other matters, the conditions of sale, restrictive clauses, and grounds for eviction (causales de desalojo), including the prohibition against selling or transferring the property in any manner without the prior authorization of INVU’s Board of Directors; nor may the awardee rent it out in whole or in part or lend it to another person, and these restrictions shall remain in effect for the specified period (Articles 12 and 13 of the aforementioned Regulations, Article 42 of the Ley Orgánica del INVU, and Article 7 of the Reglamento para la adjudicación de lotes con servicios).

Also for the purpose of safeguarding the institution’s objective of providing housing to persons who could not otherwise obtain it, the awardee must personally occupy the assigned lot together with his or her family within two months of the award, under penalty of having the award declared void (insubsistente); personal occupancy (ocupación en lo personal) means actual possession of the property by the awardee and his or her family for the purpose of establishing their family home there (Article 4 of the Reglamento para la adjudicación del lote con servicios). Moreover, improvements made by the awardee to the property shall create no right in the awardee’s favor and, when the award relationship ends for any reason, the awardee must remove them (Article 5 of the Reglamento para la adjudicación de lotes con servicio). Reference to these regulations is important in determining whether Nombre03 could sell the property to the injured party and whether the latter held a vested right over that property that the defendant’s conduct could have rendered uncertain or subject to litigation.

Under these provisions, Nombre03 was not permitted to dispose of the lot, nor could he be said to have a right of possession over it because, given the social-interest nature of the awarded properties, the institution did not regulate ownership of the lot while the awardee paid off the debt, but rather possession of the lot, which could not be transferred without the institution’s permission, was precarious, and even the structures erected on the land created no rights in the awardee’s favor. This was because title to the property and the resulting deed would be granted to the awardee only after full compliance with all applicable provisions; until then, the relationship consisted merely of making the serviced lot available so that the awardee would have somewhere to take shelter. Because the awardee was required to meet certain eligibility requirements, the awardee could not assign or otherwise transact in the housing granted without the institution’s permission, since the new purchaser must also meet the profile for which the award system is designed.

Accordingly, the “right” acquired by the injured party through the purchase of the property was not transferable on the terms under which the transaction was conducted, and the subsequent transfer of that property from Nombre03 to his mother did not alter in any way the injured party’s position with respect to the land, which had always been uncertain and contrary to the regulations. What prevented the land from being transferred into the victim’s name was not the transaction between mother and son, but the very sale of property that could not be transacted in any manner without INVU’s prior permission. Furthermore, as stated during the trial for unlawful occupation (usurpación) by the witness Nombre06, head of INVU’s social studies department (the case file having been admitted into evidence by reading, folio 351), when Nombre03 and the injured party consulted her about the sale of the lot, she told them that doing so was improper and that the awardee’s right could be revoked because the institution had not authorized the transaction; when they returned with the letter documenting the sale, permission was denied because the requirements had not been met.

She stated that Nombre03 later submitted the transfer made to his mother, which constituted another irregularity; in view of this, they requested an opinion from the legal department, which recommended revoking the award and granting the lot to a family that met the requirements. The witness added that the institution had no contractual relationship with either Nombre02 or Nombre01, but only with Nombre03, and that the revocation of the award applied to him. Furthermore, she stated that the purchaser was aware of the restrictions governing the award because, in a leadership capacity, he had handled certain matters relating to the project and had dealt with the Social Work department responsible for the Nombre04 project. This Chamber finds that, because the property could not be transacted in without INVU’s prior permission, the injured party could not acquire it and Nombre03 could not transfer it; consequently, the former had no right whatsoever over the property, and the transaction was entirely uncertain.

The Civil Chamber held that when a transfer is made subject to the condition that INVU approve it, the transaction is not void but is instead subject to a condition precedent (condición suspensiva): “V.- From the foregoing, the Chamber concludes that the parties did not enter into a promise of sale (promesa de venta), but rather a contract of sale (compraventa), albeit subject to a condition precedent: the seller’s performance of everything necessary to permit the lawful and effective transfer of the property, a situation permitted by Articles 1092 and 1093 of the Código Civil. Under contracts subject to such a condition, title is not transferred until the condition is satisfied. In this case, the fundamental triggering event was authorization by the Instituto Nacional de Vivienda y Urbanismo, without which the seller lacked full capacity to dispose of the property, even though it had already been awarded to her.

That authorization and registration in the property registry occurred several months later than contemplated in the transaction. Given the foregoing, the Court erred in characterizing the transaction as a promise of sale solely because, at that time, the seller lacked the power to dispose of the property, and compounded its error by inconsistently finding that the promise was perfected on 16 de julio de 1995, because that was the date on which the sum of four hundred ninety-five thousand colones was paid; in fact, perfection occurred when the seller became able to transfer ownership. It should be noted that, although the transaction initially concerned property belonging to another (cosa ajena), it could not be deemed void, first, obviously, because neither party sought that result, and second, because the sale of another’s property (venta de cosa ajena) is validated if, as occurred here, the seller subsequently becomes the owner of the property, in which case the transaction is treated as a conditional sale.

(Articles 1062 and 1063 of the same Code)” (Sala Primera Civil, voto 608-F-2002 de 16:20 horas del 7-08-02). In the present case, no condition was attached to the sale, and even if there had been, the right acquired in that manner would have been uncertain, since there was no assurance that the institution would approve the transfer; it was required to conduct a study of the purchaser, who had to meet the requirements for qualification as a potential awardee of social-interest housing. As stated above, it was not the defendant’s conduct that rendered a right of the injured party uncertain; rather, he never had any right over the property, and the transfer was uncertain from the outset, which means that the accused’s conduct did not constitute an offense. If the injured party acted in good faith (buena fe) when acquiring the housing, any criminal or civil claim would have to be brought against the seller.

For the foregoing reasons, Nombre01 is acquitted of all punishment and liability for the offense of fraudulent conveyance with which she has been charged. The order to evict her from the property is vacated, and the Instituto Nacional de Vivienda y Urbanismo shall determine the disposition of the lot in accordance with the contract entered into and the applicable regulations. Since the accused’s conduct did not cause the injured party’s loss, the civil action (acción civil) brought against her is dismissed.

The civil claimant (actor civil) is exempted from payment of costs (costas), given that there were plausible grounds for litigation. The expenses of the proceedings shall be borne by the State.

The order to evict the property is vacated, and the Housing and Urban Development Institute shall determine the disposition of the lot in accordance with the executed contract and the applicable regulations. Recurso de casación interpuesto en la presente causa seguida contra Nombre01, costarricense, mayor de edad, casada, vecina de Alajuela, cédula de identidad número CED01; por el delito de Estelionato en perjuicio de Nombre02. Intervienen en la decisión del recurso los Magistrados Daniel González Álvarez, Presidente; Jesús Alberto Ramírez Quirós, Alfonso Chaves Ramírez, Ronald Salazar Murillo y Jorge Arce Víquez, estos dos últimos como Magistrados Suplentes. Interviene además el licenciado Pablo Rodríguez Solano, como defensor de la encartada. Se apersonó el representante del Ministerio Público.

Resultando:

  1. 1Que mediante sentencia N° 387-02 de las dieciséis horas del veintiocho de agosto del dos mil dos, el Tribunal de Juicio del Primer Circuito Judicial de Alajuela, resolvió: “POR TANTO: De conformidad con lo expuesto y artículos 39 y 41 de la Constitución Política, 1, 30, 31, 45, 59 a 62, 71 a 74, 217 inciso segundo en relación con el 216 inciso segundo del Código Penal, 1 a 15, 184, 265, 360 a 372, 468 del Código Procesal Penal, 122 del Código Penal de 1941, 1045 del Código Civil este Tribunal por unanimidad de sus votos declara a Nombre01, AUTORA RESPONSABLE DEL DELITO DE ESTELIONATO, cometido en perjuicio de Nombre02, imponiéndosele una pena de DOS AÑOS DE PRISON, la que deberá descontar en el lugar y forma que determinen los reglamentos penitenciarios, previo abono de la preventiva cubierta si la hubiere. Son los gastos de lo penal a cargo del Estado. Firme la sentencia inscríbase en el Registro Judicial.Se le concede a la acusada el beneficio de la Condena de ejecución condicional de la pena por un período de prueba, CUATRO AÑOS advertida de que si cometiere nuevo delito doloso con una pena superior a los seis meses de prisión, se le revocará este beneficio y se ordenara captura para el cumplimiento de la pena. Firme el fallo archívese el expediente y sáquese este asunto del libro de entradas. Mediante lectura, notifíquese.”(sic). Fs. OLGA VIALES ROSALES ROSARIO ALVARADO CHACON HANNY SBRAVATTI MAROTO.
  2. 2Que contra el anterior pronunciamiento la encartada, interpuso recurso de casación. Alega la recurrente prescripción de la acción penal, errónea aplicación de la ley sustantiva. Solicita se case la sentencia y se ordene el reenvío de la presente causa al Tribunal de origen para su nueva sustanciación.-
  3. 3Que verificada la deliberación respectiva, la Sala entró a conocer del recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Informa el Magistrado Chaves R; y,

Considerando:

I.En el segundo motivo de su recurso la encartada reprocha prescripción de la acción penal. Aduce que los hechos imputados datan del 1 de setiembre de 1992, por lo que para la fecha de juicio, sea los días 27 y 28 de agosto del 2002 la acción penal estaba prescrita. Indica que es de aplicación el actual código procesal, y que de conformidad con el artículo 216 del Código Penal de 1973, reformado por ley 7107, la sanción será de 2 meses a 3 años, si el monto de lo defraudado no excediere de la suma de 5 mil colones, y con prisión de 6 meses a 10 años si pasara de esa suma. Agrega que ese artículo debe ser relacionado con los numerales 82, 83 y 84 del Código Penal, en vista de lo cual la acción penal se encuentra prescrita. No se acoge el reclamo. Por tratarse de una excepción que de prosperar pondría fin al proceso, se resolverá de previo a conocer el primer motivo del recurso. En vista de que la causa en contra de la acusada dio inicio en el año 99, se tramitó de conformidad con el actual Código Procesal Penal.

En consecuencia, sobre prescripción serán de aplicación los artículos 31 y 33. Se investiga el delito de estelionato (artículo 217 del Código Penal), sancionado, en vista del monto de lo defraudado, con prisión de 6 meses a 10 años (para el año 93 el salario base era de 37.400 colones), y de acuerdo al hecho acreditado 6) el perjuicio económico sufrido fue de 600000 colones (folio 515). Iniciado el proceso, la primera imputación formal del hecho a la encartada fue al momento de rendir su declaración, el 29 de junio de 1999 (folio 53), acto a partir del cual el plazo de diez años para la prescripción se redujo a la mitad y empezó a correr de nuevo. Para el momento de la sentencia, siguiente acto interruptor (la resolución que convoca por primera vez a la audiencia preliminar no interrumpe el plazo pues es anterior a la reforma), dictada el 28 de agosto de 2002 (folio 509) no habían transcurrido cinco años, por lo que la causa no se encuentra prescrita. Por lo indicado, sin lugar el reclamo.

II.En el primer motivo de su recurso la encartada reprocha errónea aplicación de la ley sustantiva. Argumenta que el INVU le adjudicó a su hijo Nombre03 el lote # 561 del conjunto Nombre04, con algunas condiciones, como que no podría traspasar, vender, gravar ni disponer de otra forma del inmueble sin el consentimiento previo y expreso de la institución. Que en fecha 1 de setiembre Nombre03 y su esposa cedieron a la imputada Nombre01 los derechos sobre ese inmueble, en escritura número 47 otorgada ante la notaría del licenciado Guido Peñaranda, negocio ineficaz y que por tanto no podría ser considerado como una conducta constitutiva del delito de estelionato, pues el acto fue insuficiente para producir efectos. Esto por cuanto sobre esa propiedad no se podía realizar ninguna transacción sin el consentimiento previo del INVU, asentimiento con el cual no se contó al hacer el traspaso. Considera que la conducta desplegada por la imputada al haber firmado la escritura es por tanto atípica.

Se acoge el reclamo. A la imputada se la condenó por tornar incierto y litigioso el derecho del ofendido sobre el lote # 561 de la Urbanización Gregorio José Ramírez, usufructuando el bien durante 10 años, en su beneficio y en perjuicio de Nombre02, quien había adquirido mediante compra las mejoras y el derecho de posesión sobre el terreno (folio 530). La conducta atribuida es que, conociendo que el lote en cuestión había sido vendido a la víctima, los adjudicatarios se lo traspasan a la encartada mediante escritura, a la vez que solicitan al INVU que se les excluya del núcleo familiar del citado lote y se incluya a Nombre01 y su esposo Nombre05, tornando de esa forma la acusada incierto y litigioso el derecho que mantenía Nombre02 sobre el inmueble (folio 515). Se afirma en el fallo que el Instituto Nacional de Vivienda y Urbanismo no tramitó el traspaso del inmueble que había efectuado Nombre03 a Nombre02 en razón de que éste pocos días después lo traspasó a su madre (folio 530).

Sin embargo, si se examina el contrato suscrito entre Nombre03 y el INVU, así como la normativa que regula la adjudicación de viviendas de interés social, se observa que el negocio efectuado entre Nombre03 y Nombre02 no confiere a éste último ningún derecho cierto. De conformidad con la Ley Orgánica del INVU, se contempla en el artículo 4 como una de sus finalidades, proporcionar alojamiento adecuado a las familias de más bajos recursos, preferentemente. Más que facilitar la adquisición de un inmueble, lo que la institución procura es brindar techo y abrigo a quienes no lo tengan, por lo cual antes de que el adjudicatario obtenga el derecho al dominio de la propiedad, la relación será de simple facilitación del lote con sus servicios para que el adjudicatario levante lo necesario para guarecerse, situación que se mantendrá en el evento de que la respectiva municipalidad no autorice la segregación del lote por cualquier causa, aunque el precio de la adjudicación esté satisfecho en su totalidad (artículo 8 del reglamento para la adjudicación de lotes con servicios, del INVU).

Para asegurar este fin de solucionar un problema de vivienda, y evitar que, en vista del bajo precio de la vivienda, se trate de lucrar con las propiedades, es que se debe de cumplir con ciertos requisitos para ser adjudicatario, especialmente carecer de recursos suficientes (artículo 41 de la Ley Orgánica del INVU), ser cabeza de familia, de bajos ingresos, para constatar lo cual se harán los estudios pertinentes (artículos 2 y 4 del Reglamento para la adjudicación de vivienda). También en procura de esa finalidad, el comercio de esas viviendas se encuentra regulado. Es así como el Reglamento para la adjudicación de vivienda, del INVU, vigente para la fecha de los hechos, señala en su artículo 9 que el adjudicatario deberá firmar un contrato que contendrá su declaración aceptando, entre otras cosas, las condiciones de venta, cláusulas restrictivas y causales de desalojo, entre las cuales se indica que no podrán vender o traspasar en forma alguna la propiedad, sin la previa autorización de la Junta Directiva del INVU; tampoco podrá alquilarla total o parcialmente, ni prestarla, restricciones que se mantendrán por el plazo que se indique (artículos 12 y 13 del Reglamento mencionado, 42 de la Ley Orgánica del INVU y 7 del Reglamento para la adjudicación de lotes con servicios).

También con el propósito de reguardar el objetivo de la institución, de otorgar vivienda a quien de otra forma no podría procurársela, es que se requiere que el adjudicatario ocupe el lote asignado en lo personal, junto con su familia dentro del plazo de dos meses a partir de la adjudicación, bajo pena de declarar insubsistente la adjudicación, entendiéndose como ocupación en lo personal la efectiva posesión del inmueble por parte del adjudicatario y su familia con fines de establecer allí su habitación familiar (artículo 4 del Reglamento para la adjudicación del lote con servicios). Por otro lado, las mejoras realizadas por el adjudicatario en el inmueble no producirán ningún derecho a su favor y cuando por cualquier razón finalice el vínculo de adjudicación, deberá retirarlas (artículo 5 del Reglamento para la adjudicación de lotes con servicio). La referencia a esta normativa resulta de importancia para determinar si Nombre03 podía vender el inmueble al ofendido, y si éste detentaba un derecho cierto sobre ese bien, que la conducta de la encartada hubiera tornado incierto o litigioso.

Según lo dispuesto, para Nombre03 no era permitido disponer del lote, y no podría hablarse de un derecho de posesión sobre él, porque, en vista de la naturaleza de los inmuebles adjudicados, de interés social, no era la propiedad sobre el lote lo que la institución regulaba mientras el adjudicatario cancelaba la deuda, sino la posesión sobre el lote, que no podía ser traspasada sin permiso del ente, y que era precaria y ni aún las obras levantadas en el terreno producían derechos a su favor, puesto que el derecho al dominio de la propiedad y la consecuente escritura procedería a favor del adjudicatario hasta que hubiere cumplido a cabalidad todas las disposiciones pertinentes; mientras esto no ocurra la relación será de mera facilitación del lote con sus servicios para que el adjudicatario tenga donde guarecerse. Como el adjudicatario debió reunir ciertos requisitos para ser tal, no podrá ceder ni negociar la vivienda que se le otorgó, sin el permiso de la institución, puesto que el nuevo adquirente debe también cumplir con el perfil para el que está diseñado el sistema de adjudicaciones.

Es así como el “derecho” que el ofendido adquirió, al comprar la propiedad, no era negociable en los términos en que se hizo, y el traspaso posterior de ese inmueble, de Nombre03 a su madre, en nada hizo variar la posición del perjudicado con respecto al terreno, que siempre fue incierta y al margen de la normativa. Lo que impidió que el terreno se traspasara a nombre de la víctima no fue la negociación entre madre e hijo, sino la venta misma de una propiedad que no podía ser negociada en forma alguna sin el permiso previo del INVU. A mayor abundamiento, según declaró en el juicio por usurpación la testigo Nombre06, jefa del departamento de estudios sociales del INVU (expediente que fue incorporado por lectura como prueba, folio 351), cuando Nombre03 y el perjudicado fueron a consultarle sobre la venta del lote, ella les indicó que era una irregularidad hacer eso y que se podía revocar el derecho del adjudicatario, pues no hubo permiso de la institución para la negociación; cuando volvieron con la carta donde habían hecho la venta, no les dieron el permiso porque no se habían cumplido los requisitos.

Indica que luego llevó Nombre03 el traspaso hecho a la madre, lo que constituye una nueva irregularidad, en vista de lo cual solicitaron el criterio del departamento legal, el que recomendó que se revocara la adjudicación y se diera el lote a una familia que cumpliera los requisitos. Agrega la testigo que la institución no tiene relación contractual ni con Nombre02 ni con Nombre01 sino únicamente con Nombre03, y es a él a quien se aplica la revocatoria de adjudicación. Aún más, afirma que el comprador conocía las limitaciones que tiene la adjudicación porque a nivel de liderazgo ha manejado algunas situaciones del proyecto y ha tenido relación con el departamento de Trabajo Social que tiene a su cargo el proyecto Nombre04. Considera esta Sala que al ser el inmueble no negociable sin el permiso previo del INVU, el ofendido no podía adquirirlo ni Nombre03 traspasarlo, por lo que el primero no tendría derecho alguno sobre el bien y el negocio realizado deviene completamente incierto.

La Sala Civil consideró que cuando el traspaso se hace bajo la condición de que el INVU lo aprueba, el negocio no será nulo, sino sujeto a una condición suspensiva: “ V.- De lo anteriormente expuesto, la Sala colige que las partes no suscribieron una promesa de venta, sino una compraventa, aunque sujeta a una condición suspensiva: la realización por la vendedora de todo lo necesario para permitir el traspaso legal y efectivo del inmueble; situación permitida por los artículos 1092 y 1093 del Código Civil. En los contratos así condicionados el dominio no se trasmite sino en el momento de cumplirse la condición. En este caso el hecho condicionante fundamental era la autorización del Instituto Nacional de Vivienda y Urbanismo, sin la cual la vendedora no tenía la capacidad plena de disposición del inmueble, que sin embargo le había sido ya adjudicado. Ese permiso y la inscripción registral sobrevinieron meses después de lo previsto en la negociación.

Supuesto lo anterior el Tribunal se equivocó al calificar la negociación de promesa de venta, sólo porque la vendedora no tenía a ese momento la disposición del bien, y agravó su error al estimar, contradictoriamente, que esa promesa se perfeccionó el 16 de julio de 1995, por corresponder al día en que se abonó la suma de cuatrocientos noventa y cinco mil colones; en realidad, dicho perfeccionamiento se produce cuando la vendedora estuvo en condiciones de trasmitir la propiedad. Vale advertir que aunque la negociación tenía en principio por objeto una cosa ajena, no cabría pensar en su nulidad, en primer término, obviamente, por que tal efecto no fue pretendido por ninguna de las partes, y en segundo lugar porque la venta de cosa ajena se convalida si, como aquí sucedió, el vendedor llega posteriormente a ser propietario del bien, en cuyo caso el negocio se tiene como una venta realizada bajo condición.

(Artículos 1062 y 1063 del mismo Código)” ( Sala Primera Civil, voto 608-F-2002 de 16:20 horas del 7-08-02). En el presente caso, ninguna condición se puso a la venta, y aunque así hubiera sido, el derecho de esta forma adquirido sería incierto, puesto que no habrá seguridad que la institución avale el traspaso, pues debe hacer estudio del comprador, el cual ha de reunir los requisitos exigidos para que califique como posible adjudicatario de vivienda de interés social. Como se ha indicado, la conducta de la encartada no fue la que tornó incierto un derecho del ofendido, sino que éste nunca tuvo derecho sobre el bien, y el traspaso realizado fue incierto desde el inicio, lo que convierte en atípica la conducta de la imputada. Si el ofendido actuó de buena fe en la adquisición de la vivienda, sería contra el vendedor contra quien tendría que realizar el reclamo, penal o civil. Por lo indicado, se absuelve a Nombre01 de toda pena y responsabilidad por el delito de estelionato que se le ha venido atribuyendo.

Se deja sin efecto la orden de desalojo del inmueble y será el Instituto Nacional de Vivienda y Urbanismo quien disponga sobre el lote, de acuerdo al contrato suscrito y a la normativa pertinente. En vista de que la conducta de la acusada no fue la causante del daño al perjudicado, se declara sin lugar la acción civil incoada en su contra. Se exime al actor civil del pago de las costas, en vista de que existió razón plausible para litigar. Son los gastos del proceso a cargo del Estado.

Por Tanto:

Se declara con lugar el recurso de casación incoado por la encartada. Se absuelve a Nombre01 del delito de estelionato que se le ha venido atribuyendo en perjuicio de Nombre02. Se declara sin lugar la acción civil resarcitoria. Se exime al actor civil del pago de las costas. Son los gastos del proceso a cargo del Estado. Se deja sin efecto la orden de desalojo del inmueble y será el Instituto de Vivienda y Urbanismo quien disponga sobre el lote, de acuerdo al contrato suscrito y a la normativa pertinente. Notifíquese.
