Nº 100 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA.- San José, at fourteen hours and thirty minutes on diez de junio de mil novecientos noventa y cuatro.
In the ordinary proceeding for partition in kind (división material) brought by Nombre96543 and another against Nombre187735, the Juzgado Primero Civil de Heredia denied the objection based on lack of subject-matter jurisdiction (excepción de incompetencia por razón de la materia) filed by the defendant, who, disagreeing with that decision, appealed, whereupon the matter was referred to this Chamber for review.
WHEREAS:
I.In agrarian matters (materia agraria), it is the use to which the property (fundo) is devoted that determines jurisdiction. This Chamber has repeatedly held that “... the act of devoting the property to production constitutes the transition from the static property right characteristic of Civil Law, which focuses entirely on use and enjoyment, to the dynamic property right characteristic of Agrarian Law, under which it constitutes an instrument of production; therefore, Article 4 of the Ley de Jurisdicción Agraria, analyzed from this perspective—that is, by linking it to the very purpose of production, which is what defines the subject matter—makes it possible to determine whether or not the property is agrarian in nature and, consequently, whether or not the agrarian jurisdiction has authority to hear a particular matter...” (See, among others: Resolution No. 60 of 13:55 hours on 20 de abril de 1994).
II.In the Sub Judice matter, the parcel (predio) is located in San Antonio de Belén and has an approximate area of 10.402,87 square meters. The record shows that there are eight residential houses on the property, while the remainder is occupied by a “pigsty,” an “old” coffee plantation, bamboo, several itabo plants, and corn. This supports the conclusion that no type of commercial agrarian activity (actividad agraria empresarial), as defined by the Ley de Jurisdicción Agraria, is being carried out there.

En el proceso ordinario de división material establecido por Nombre96543 y otro contra Nombre187735 , el Juzgado Primero Civil de Heredia denegó la excepción de incompetencia por razón de la materia interpuesta por el demandado, quien inconforme apeló, en virtud de lo cual fue elevado en consulta a esta Sala.
CONSIDERANDO:
I.En materia agraria es el destino del fundo el que permite definir la jurisdicción. Esta Sala ha reiterado su criterio en cuanto a que "... el acto de destinación del bien a la producción constituye el paso del derecho de propiedad estático propio del Derecho Civil, que se concentra todo en goce y disfrute, al derecho de propiedad dinámico, propio del Derecho Agrario, donde éste constituye un instrumento de producción, por lo que el artículo 4º de la Ley de Jurisdicción Agraria, analizado bajo esta óptica, sea vinculándolo con el fin mismo de la producción que es lo que identifica a la materia permite determinar la naturaleza agraria o no del bien y en consecuencia si la jurisdicción agraria es o no competente para conocer de un determinado asunto...
