Res: [Telf1] CRIMINAL CASSATION TRIBUNAL. Second Judicial Circuit of San José. Goicoechea, at ten hours nine minutes on the seventeenth of July two thousand and three.
CASSATION APPEAL (recurso de casación) filed in this case against [Nombre1], of legal age, single, national identity card number CED1, son of [Nombre2] and [Nombre3], for the offense of VIOLATION OF THE Ley Forestal, to the detriment of NATURAL RESOURCES. The following judges participated in deciding the appeal: Rafael Ángel Sanabria Rojas, Jorge Luis Arce Víquez, and Ulises Zúñiga Morales. Attorney [Nombre4], public defender (defensora pública) of the accused, and Attorney [Nombre5], representing the Public Prosecutor's Office (Ministerio Público), appeared before the cassation tribunal.
PROCEDURAL BACKGROUND:
I.By judgment number 103-2003, issued at fifteen hours on the twenty-fifth of February two thousand and three, the Criminal Trial Tribunal of Heredia ruled as follows: Por tanto: In accordance with the foregoing, the cited rules and laws, and Articles 39 and 41 of the Political Constitution; Article 8, paragraph 1) of the American Convention on Human Rights; Article 9, paragraph 2) of the International Covenant on Civil and Political Rights; Articles 1, 111 through 124, 265 through 267, 269, 341, 343, 349, 351, 355, 356, 358, 360, 361, 363, 364, 365, 367, and 368 of the Code of Criminal Procedure; Articles 1, 30, 45, 71, 59 through 63, and 110 of the Criminal Code; Articles 122, 124, and 126 of the 1941 Criminal Code; and Articles 1, 61(a), and 65 of Ley Forestal number 7575: [Nombre6] is declared criminally responsible as perpetrator of the offense of harvesting of forest products (aprovechamiento de productos forestales) without authorization from the State Forestry Administration, to the detriment of THE CONSERVATION, PROTECTION AND ADMINISTRATION OF NATURAL FORESTS AND THE STATE'S FOREST RESOURCES.
The sentence imposed is ONE MONTH OF IMPRISONMENT, to be served in the manner and place indicated by the applicable prison regulations, with credit for preventive detention already served. The defendant is further ordered to pay all court costs and, once the judgment becomes final, to have it registered in the Judicial Registry. The ruling shall be communicated to the Instituto Nacional de Criminología and to the Sentence Execution Court (Juzgado de Ejecución de la Pena). For a probationary period of three years, the defendant is granted the benefit of a suspended sentence (Beneficio de Ejecución condicional de la Pena), with the warning that if during that period he commits an intentional offense resulting in a sentence of more than six months of imprisonment, this benefit shall be revoked and he shall be required to serve the sentence imposed herein. The forfeiture (comiso) of the seized timber is ordered in favor of the State.
The civil damages claim (acción civil resarcitoria) is granted; the civil defendant, [Nombre7], is ordered to pay the damages and losses caused to the State by his action, which are accepted in the abstract so that the specific amounts may be determined in civil proceedings. The civil defendant is likewise ordered to pay all costs of the civil action in favor of the State. NOTIFY.- (Exp. 01-000399-573-PE against [Nombre6]. OFFENSE: Harvesting of forest products without authorization from the State Forestry Administration).- Atty. [Nombre8]. JUDGE
III.The deliberation having been conducted in accordance with Article 450 of the Code of Criminal Procedure, the Tribunal considered the issues raised in the appeal.
This opinion is authored by Cassation Judge [Nombre9]; and, GROUNDS:
I.The cassation appeal meets the admissibility requirements set forth in Articles 443, 444, and 445 of the Code of Criminal Procedure; accordingly, the court proceeds to rule on the grounds raised.
II.In the first ground of the cassation appeal, the public defender of the accused alleges a lack of adequate reasoning (falta de fundamentación). She cites as violated Articles 39 and 41 of the Political Constitution, and Articles 361(c) and (e), 363, and 369 of the Code of Criminal Procedure. She contends that the judgment contains a contradiction, since on one hand the trial judge found it proven that four trees were felled on the accused's property, that the accused had full knowledge thereof and complete control over the action, while in analyzing the elements of the offense (tipicidad) and the applicable sanction, the judge stated that [Nombre10] proceeded to cut down—or to authorize a third party to cut down—a fact that could not be established with certainty—the four trees in question. From this, the appellant infers that an irreconcilable contradiction exists, as these represent two entirely opposing situations.
The ground is not well taken. The judgment must be read as a unified legal-logical whole. A reading of the ruling reveals with precision that the lack of certainty concerns only whether the felling of the trees was carried out directly by the accused or by another person hired by him for that purpose; the trial judge, however, had no doubt whatsoever that the action was carried out because [Nombre11] ordered it. To reach this conclusion, the trial court (A quo) weighed the prosecution's evidence, as well as the statements of the accused and of the witnesses he presented, finding the latter to lack credibility, all in accordance with the rules of reasoned judgment (sana crítica). There is therefore no irreconcilable contradiction in the judgment, as the appellant would have it, since the ruling is directed at determining that the criminal act was committed by the accused, and the doubt noted does not exclude his liability—all of which was analyzed by the trial judge (record pages (folios) 122 to 125).
III.The second ground alleges a lack of descriptive reasoning, citing as violated Articles 38 and 41 of the Political Constitution, and Articles 1, 142, and 363(b) of the Code of Criminal Procedure. The appellant argues that the trial judge failed to include in the testimony summaries of the MINAE officers certain information that is essential for ruling out the accused's liability. The complaint relates to witnesses [Nombre12] and [Nombre13], MINAE officers who conducted the investigation, who, according to the defense, stated that they were unable to determine who cut down the trees on [Nombre7]'s property and then transported them to the location where they were impounded. She adds that this evidence is essential inasmuch as it excludes [Nombre11]'s criminal liability. The complaint is not well founded. Although it is true that the trial court did not record the statements that the public defender claims are missing, those statements are not essential, nor do they affect the outcome of the ruling.
The Tribunal was able to infer the existence of the offense and the accused's participation from valid evidence, as well as from clear, precise, and consistent circumstantial evidence (indicios), through an assessment that conforms to the rules of reasoned judgment. Thus, from the testimony of the cited officers, the court concluded that the trees had been cut down no more than twenty-two days earlier, based on the destruction of the undergrowth (maleza), the sawdust (aserrín) found at the stumps, and the drag marks left by the transportation of the timber—thereby refuting the accused's defense claim that the trees had been felled more than a year prior. The court also considered that the accused had no MINAE permits for the harvesting of said trees and that they were felled approximately one hundred and fifty meters from [Nombre14]'s house, using a chainsaw (motosierra). The proximity of the trees to the accused's home and the noise produced by the machine used to fell and mill them allowed the judge to rule out the possibility that [Nombre14] was unaware of such action—that is, that other persons carried it out without his consent.
The court likewise analyzed that the trees were of considerable size, a circumstance that required substantial time to fell, mill, and transport the timber, which could not have been accomplished without the authorization of the accused, who lived on the property (pages 122 to 124). The statements not included in the summaries of the testimony of [Nombre15] and [Nombre16] are insufficient to undermine the trial judge's analysis of the existence of the offense and the accused's participation. It is noteworthy that the trial court acknowledged what the appellant claims, namely that it was not established with certainty who cut down the trees—that is, whether the accused did so directly or whether others did so on his orders—yet criminal liability remains unchanged, since, as the judgment correctly states, the accused had dominion over the act (dominio del hecho) and the circumstance in question is legally irrelevant.
IV.The third ground alleges a violation of due process through the introduction of unlawful evidence. It invokes a breach of Articles 142, 181, 363, and 369 of the Code of Criminal Procedure, and Articles 38 and 41 of the Political Constitution. The complaint is that the trial tribunal relied as evidence on an alleged spontaneous statement made by the accused in the presence of MINAE inspectors, in which he asked [Nombre17] to take responsibility for the problem in order not to implicate other people, a request that [Nombre17] refused. The appellant argues that this statement by the accused cannot be treated as a spontaneous declaration because the authorities were required to advise him of his right to remain silent while the inspection was being conducted, as provided under Article 82 of the Code of Criminal Procedure. The ground is rejected. The public defender is correct that the authorities are obliged to advise a person of their right to refrain from making statements from the very moment that person is regarded as a suspect in the commission of an unlawful act, and equally of the right to the assistance of a legal professional to provide technical defense.
This obligation exists to guarantee the right of defense enshrined in Article 39 of the Political Constitution, Article 8 of the American Convention on Human Rights, and Articles 12, 13, and 82 of the Code of Criminal Procedure. The testimonies given by the officers at the oral and public hearing do not indicate that they advised the accused [Nombre11] of that right, which precludes the use as evidence of the statements made by the accused while the MINAE inspectors were conducting their inspection and gathering evidentiary elements for the precise purpose of determining who was responsible for the offense. However, hypothetically excluding said evidence, the judgment stands unaffected, since [Nombre1]'s participation is derived from other valid evidentiary elements already cited; the statement excluded here had been used as one additional element to support the ruling, but not as essential evidence. The request to declare the ruling null and void therefore cannot be granted.

Goicoechea, a las diez horas nueve minutos del diecisiete de julio del dos mil tres.- RECURSO DE CASACIÓN interpuesto en la presente causa seguida contra [Nombre1], mayor, soltero, cédula de identidad número CED1, hijo de [Nombre2] y [Nombre3], por el delito de INFRACCION A LA LEY FORESTAL, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los Jueces Rafael Ángel Sanabria Rojas, Jorge Luis Arce Víquez y Ulises Zúñiga Morales. Se apersonaron en casación la Licenciada [Nombre4], defensora pública del imputado y en representación del Ministerio Público el Licenciado [Nombre5].-
RESULTANDO:
I.Que mediante sentencia número 103-2003, de las quince horas del veinticinco de febrero del dos mil tres, el Tribunal Penal de Juicio de Heredia, resolvió: POR TANTO: De conformidad con lo expuesto, normas y leyes citadas y artículos 39 y 41 de la Constitución Política, 8, inciso 1) de la Convención Americana de Derechos Humanos, 9, inciso 2) del Pacto Internacional de Derechos Civiles y Políticos; 1, 111 a 124, 265 a 267, 269, 341, 343, 349, 351, 355, 356, 358, 360, 361, 363, 364, 365, 367 y 368, del Código Procesal Penal; 1, 30, 45, 71 59 a 63 y 110 del Código Penal; 122, 124 y 126 del Código Penal de 1941 y 1, 61 inciso a) y 65 de la Ley Forestal número 7575, se declara a [Nombre6] autor responsable del delito de Aprovechamiento de productos forestales sin el permiso de la Administración Forestal del Estado en perjuicio de LA CONSERVACIÓN, PROTECCIÓN Y ADMINISTRACIÓN DE LOS BOSQUES NATURALES Y LOS RECURSOS FORESTALES DEL ESTADO, imponiéndosele como sanción el tanto de UN MES DE PRISIÓN que deberá descontar en el lugar y forma que indiquen los respectivos reglamentos penitenciarios, previo abono de la preventiva cumplida.
Se le condena además al pago de ambas costas del proceso y a que se inscriba el fallo una vez firme en el Registro Judicial. Comuníquese lo resuelto al Instituto Nacional de Criminología y al Juzgado de Ejecución de la Pena.- Por un período de prueba de tres años se otorga al imputado el Beneficio de Ejecución condicional de la Pena, bajo la advertencia de que si durante ese periodo llega a cometer algún delito doloso y se le imponga más de seis meses de prisión el beneficio que aquí se le otorga le será revocado debiendo, en tal caso, cumplir la pena que se le ha impuesto. Se ordena a favor del Estado el comiso de la madera secuestrada.- Se declara con lugar la acción civil resarcitoria condenándose al demandado civil, [Nombre7], al pago de los daños y perjuicios causados con su acción al Estado, lo cuales se acogen en abstracto para que dichos montos sean establecidos con certeza en la vía civil.
De la misma forma se condena al demandado civil al pago de ambas costas de la acción civil a favor del Estado. NOTIFÍQUESE.- (Exp. 01-000399-573-PE C/ [Nombre6]. DELITO: Aprovechamiento de productos forestales sin el permiso de la Administración Forestal del Estado).- Lic. [Nombre8]. JUEZ
II.Que contra el anterior pronunciamiento interpuso Recurso de Casación la Licenciada [Nombre4], defensora pública del imputado.-
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso.-
Redacta el Juez de Casación [Nombre9]; y,
CONSIDERANDO:
I.El recurso de casación reúne los requisitos de admisibilidad establecidos por los artículos 443, 444 y 445 del Código Procesal Penal, razón por la cual se entra a resolver los motivos planteados.
II.En el primer motivo de casación la defensora pública del imputado alega falta de fundamentación. Cita como violados los artículos 39 y 41 de la Constitución Política, 361 inciso c y e, 363, 369 del Código Procesal Penal. Estima que existe contradicción en el fallo pues por un lado el juzgador tiene por demostrado que se talaron cuatro árboles en la finca del imputado, quien tuvo pleno conocimiento y dominio total de la acción, mientras que al analizar la tipicidad y sanción expresa que don [Nombre10] procedió a cortar por sí mismo o autorizar a un tercero, lo que no se pudo llegar a establecer con certeza, los citados cuatro árboles. De lo anterior infiere la impugnante que existe una contradicción insalvable pues estamos antes dos situaciones totalmente adversas. El motivo no es atendible. La sentencia debe apreciarse como una unidad lógico jurídica. De la lectura del fallo se extrae, con exactitud, que la falta de certeza se centra en si la tala de los árboles la realizó directamente el imputado u otra persona que él contrató al efecto, pero para el juzgador no queda la menor duda que la acción se ejecutó porque así lo dispuso [Nombre11].
Para concluir en tal sentido el A quo valora la prueba de cargo, así como la declaración del imputado y de los testigos que aportó, restando credibilidad a los últimos, respetando en tal menester las reglas de la sana crítica. De tal forma que no existe una contradicción insalvable en la sentencia, como pretende hacerlo ver la recurrente, ya que la decisión se orienta a determinar que el hecho delictivo se cometió por el imputado y la duda apuntada no excluye su responsabilidad, todo lo cual es objeto de análisis por el juzgador (folios 122 a 125).
III.En el segundo motivo se reprocha falta de fundamentación descriptiva, citándose como violados los artículos 38, 41 de la Constitución Política, 1, 142 y 363 inciso b) del Código Procesal Penal. Sostiene la recurrente que el juzgador omitió incluir en los testimonios de los oficiales del MINAE algunos datos que resultan esenciales para descartar la responsabilidad del imputado. El reproche se relaciona con los testigos [Nombre12] y [Nombre13], funcionarios del MINAE que realizaron la investigación, quienes, según la defensa, indicaron que no lograron determinar quién cortó los árboles en la propiedad de [Nombre7] y luego los trasladó al sitio donde se decomisaron. Agrega que esa prueba resulta esencial en el tanto que excluye la responsabilidad de [Nombre11]. El reclamo no es de recibo. Si bien es cierto el A quo no consigna las manifestaciones que echa de menos la defensora, también lo es que estas no resultan esenciales, ni afectan lo resuelto.
El Tribunal logra derivar la existencia del hecho y la participación del imputado de elementos de prueba válidos, así como de indicios claros, precisos y concordantes, mediante una valoración que se ajusta a las reglas de la sana crítica. Así de lo expuesto por los citados oficiales extrae que los árboles habían sido cortados en un lapso no mayor de veintidós días, por la destrucción de la maleza, el aserrín localizado en los troncos y las huellas de arrastre que dejó el traslado de la madera, descartando de esta forma lo indicado por el imputado quien en su defensa alegó que los árboles habían sido talados hacía más de un año. Se valoró igualmente que el acusado no tenía permisos del MINAE para el aprovechamiento de dichos árboles y que estos fueron talados a escasos ciento cincuenta metros de la casa de [Nombre14], utilizando para ello una motosierra. La cercanía de los árboles a la vivienda del acusado y el ruido que producían la máquina usada para talarlos y aserrarlos permite al juez descartar que [Nombre14] no estuviera enterado de dicha acción, es decir, que la realizaran otras personas sin su consentimiento.
De igual forma se analiza que los árboles tenían un tamaño considerable, circunstancia que exigía bastante tiempo para talarlos, aserrarlos y trasladar la madera, lo que no podía hacerse sin la autorización del imputado que vivía en el sitio (folios 122 a 124). Las manifestaciones que no se incluyeron en el relato de los testimonios de [Nombre15] y [Nombre16] no logran desvirtuar el análisis sobre la existencia del hecho y la participación del imputado que realizó el juzgador. Nótese que el A quo admite lo que reclama la recurrente, en cuanto a que no se determinó con certeza quién cortó los árboles, es decir, si lo hizo el imputado directamente u otras personas por orden suya, pero la responsabilidad penal no varía, pues como bien se afirma en el fallo el imputado tenía dominio del hecho y la circunstancia apuntada carece de relevancia.
IV.En el tercer motivo se alega violación al debido proceso por introducción de prueba ilícita. Se invoca quebranto de los artículos 142, 181, 363 y 369 del Código Procesal Penal, 38 y 41 de la Constitución Política. Se reprocha que el Tribunal de mérito utilizó como prueba una supuesta manifestación espontánea que hizo el imputado, en presencia de los inspectores del MINAE, donde le pedía a don [Nombre17] que se hiciera cargo del problema para no involucrar a otras personas, a lo que se negó el último. Que esa expresión del imputado no puede tomarse como una manifestación espontánea porque las autoridades debieron advertirle de su derecho de mantenerse callado, mientras se realizaba la inspección, conforme lo regula el artículo 82 del Código Procesal Penal. Se rechaza el motivo. Lleva razón la defensora en el sentido de que es obligación de las autoridades advertir a una persona de su derecho de abstenerse de declarar, desde el mismo momento en que se le tenga como sospechoso de la comisión de un hecho ilícito e igualmente del derecho a la asistencia de un profesional en derecho que ejerza su defensa técnica.
Lo anterior para garantizar el derecho de defensa consagrado en los artículos 39 de la Constitución Política, 8 de la Convención Americana de Derechos Humanos, 12, 13 y 82 del Código Procesal Penal. No se desprende de las declaraciones dadas por los oficiales en la audiencia oral y pública que hubiesen advertido de ese derecho al imputado [Nombre11], lo cual impide utilizar como prueba las expresiones que realizó el imputado cuando los inspectores del MINAE realizaban la inspección y recogían elementos probatorios precisamente para determinar quién había sido el autor del hecho. Sin embargo, excluyendo hipotéticamente la citada prueba, el fallo se mantiene incólume, pues la participación de [Nombre1] deriva de otros elementos probatorios válidos ya citados, en el tanto que la manifestación que aquí se excluye había sido utilizada como un elemento más para justificar el fallo, pero no como prueba esencial. De ahí que no resulte atendible la solicitud de declarar la nulidad del fallo.
POR TANTO:
Se declara sin lugar el recurso de casación.
