RES: 000397-F-01 FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE.- San José, at fifteen hours twenty-five minutes on June sixth, two thousand one.

Ordinary proceeding (proceso ordinario) brought before the Juzgado de lo Contencioso Administrativo y Civil de Hacienda by Nombre59846, businessman, resident of Ciudad Quesada, against THE STATE, represented by Licenciado Cristóbal Chavarría Matamoros, Deputy Attorney General, whose other particulars are not stated. Xiomara Rodríguez Aguilar, a resident of San José, also appears as special judicial attorney-in-fact (apoderada especial judicial) for the plaintiff. All natural persons are of legal age and, subject to the qualifications stated, married and attorneys.

RESULTS:

1°.- Based on the facts and legal provisions he cited, the plaintiff filed an ordinary complaint, the amount in controversy being set at nine million seven hundred eighty-six thousand seven hundred sixty colones without céntimos, seeking a judgment declaring: “1.) That all proceedings conducted in the case file by Messrs. Alfáro and Nombre201772 concerning the denial of the timber-harvesting permit be declared null and void; 2.) That the State be ordered to pay the value of the seized timber, the appraisal of which appears in the record, plus the interest that such sums would have accrued under the legal system in force. I further request that the State be ordered to pay the costs of these proceedings. 3.- I request that the officials responsible for the manifestly unlawful conduct occurring in the resolution of the case file at issue be identified, for the purpose of bringing against them the corresponding administrative, civil, and criminal actions afforded by the legal system, thereby obtaining compensation for the multimillion-colón loss suffered by my principal.

The foregoing is based on the Ley General de la Administración Pública, which expressly provides: Article 199.- 1. A public servant who, in the performance of or in connection with his duties, has acted with intent or gross negligence shall be personally liable to third parties, even if he merely used the means and opportunities afforded by his office. 2. Such cases shall include an official who issued manifestly unlawful acts and an official who obeyed them in accordance with this law… 4. The characterization of the servant’s conduct for purposes of this article shall be made without prejudice to joint and several liability with the Administration toward the injured party. Article 200.- Whenever administrative acts are declared invalid, the authority making that determination shall expressly rule on whether or not the illegality was manifest, under the terms of Article 199. 2. If so, it shall institute ex officio the corresponding proceeding to determine the resulting liabilities”… 4..- I request that the State be ordered to pay subjective non-pecuniary damages (daño moral subjetivo) …”.

2°.- The representative of the State answered the action, opposing the plaintiff’s claims, and raised the defenses of active standing (legitimatio ad causam activa), lack of legal entitlement (falta de derecho), the preliminary defenses of acquiescence to the act (acto consentido), and lack of procedural standing (falta de legitimación ad procesum), which were resolved by interlocutory decision.

3°.- Judge Vernor Perera León, in judgment N° 22-2000 at 10:00 hours on January 17, 2000, ruled: “The action is dismissed. Both sets of costs shall be borne by the plaintiff.” 4°.- The plaintiff appealed, and the Tribunal Contencioso Administrativo, Sección Segunda, composed of Judges Sonia Ferrero Aymerich, Miriam Anchia Paniagua, and Joaquín Villalobos Soto, in judgment N° 254-2000 issued at 15:00 hours on August 30, 2000, ordered: “The judgment under appeal is affirmed.” 5°.- Licenciada Rodríguez Aguilar, acting in the stated capacity, filed an appeal on points of law (recurso de casación por el fondo) before this Chamber. She alleges violation of Articles 10 and 34 of the Ley Reguladora de la Jurisdicción Contencioso Administrativa; Articles 131, 133 subsection 1), 136, 173, 214, 330, and 331 of the Ley General de la Administración Pública; and improper application of Articles 60 and 61 of the repealed Ley Forestal N° 7174; Article 80 of the repealed Reglamento a la Ley Forestal, Decreto Ejecutivo N° 19886-MIRENEM, dated August 27, 1990; as well as failure to apply Articles 60 and 61 of the repealed Ley Forestal N° 7174 dated June 28, 1990, and Article 80 of the repealed Reglamento a la Ley Forestal, Decreto Ejecutivo N° 19886-MIRENEM dated August 27, 1990; and also Article 34 of the Constitución Política.

6°.- The statutory requirements have been observed throughout the proceedings.

Drafted by Magistrate Zeledón Zeledón; and,

CONSIDERING:

I.By deed N° 6 dated May 3, 1993, executed before Notary Xiomara Rodríguez Aguilar, Nombre201773 sold Nombre59846 the right to harvest timber from his property, which was undergoing registration. In December 1993, all duties and taxes required by law were paid, and the application was approved in full, authorizing the extraction of 115 trees, comprising a volume of 402.49 cubic meters of timber, but it was not removed during 1994. On March 2, 1995, Nombre201773 requested renewal of the timber-extraction permit, for which he was directed to submit a certificate of ownership of the property. On March 21 of that year, Nombre201774, an official of the Dirección General Forestal, inspected the property and recommended revalidating the permit for the same number of trees and volume authorized the previous year. At 10 hours on April 6, 1995, resolution N° 634-95 CRFZN was drafted, under which the forestry permit requested by Nombre201773 would be approved; nevertheless, that resolution was not signed by Licenciado Fausto Alfaro Morales, and the notation “null and void” was stamped on the folios.

By official letter N° 101-95 OFCCH, dated April 24, 1995, Fausto Alfaro Morales informed the Agente Fiscal de San Carlos that there was no permit to fell trees on Nombre201773’s property, and Nombre201772 filed a complaint for unlawful timber harvesting before the Agencia Fiscal de San Carlos. In June 1995, Nombre59846 filed a motion for nullity (incidente de nulidad) before the Head of the Oficina Regional Forestal de la Región Huetar Norte to inform the Administration of the irregularities that had occurred in the processing of his case. The Director General Forestal denied that application on the ground that Nombre59846 lacked standing, through resolution N° 081-95 DGF. Mr. Nombre59846 filed a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) against that resolution, which was declared inadmissible as untimely.

II.The plaintiff requested that all proceedings conducted by Messrs. Alfaro and Nombre201772, officials of the Dirección General Forestal and the Fiscalía de San Carlos, respectively, concerning the denial of the timber-harvesting permit be declared null and void. He also requested that the State be ordered to pay the value of the seized timber, plus interest, the costs of the proceedings, and non-pecuniary damages consisting of the personal suffering endured by him and his family because of the uncertainty caused by the loss of the income that provided their daily sustenance. He valued those non-pecuniary damages at ¢500.000. He requested identification of those responsible for the actions taken in the case file at issue so that the administrative, civil, and criminal actions afforded by the legal system could be brought and the resulting economic loss redressed.

III.The Juzgado dismissed the complaint and ordered the plaintiff to pay the costs of the proceedings. The Tribunal affirmed the judgment.

IV.The plaintiff brings this appeal. He raises three challenges on points of law based on direct violation of law. In the first, relying on Article 595 subsection 1) of the Código Procesal Civil, he alleges violation of Articles 10 and 34 of the Ley Reguladora de la Jurisdicción Contencioso Administrativa; Articles 131, 133 subsection 1), 136, 173, and 214 of the Ley General de la Administración Pública; and improper application of Articles 60 and 61 of the repealed Ley Forestal N°7174 and Article 80 of the repealed Reglamento a la Ley Forestal, Decreto Ejecutivo N°19886-MIRENEM, dated August 27, 1990. He does so because the Administration should have followed the procedures established in our legal system for annulling the act granting renewal of the timber-harvesting permit, instead of merely placing the notation “NULL AND VOID” on the document. In the second ground, he alleges violation of the administrative doctrine prohibiting a party from contradicting its own prior acts (doctrina de los actos propios de la administración); consequently, he alleges that the appellate court failed to apply Articles 60 and 61 of the repealed Ley Forestal N°7174 dated June 28, 1990, and Article 80 of the repealed Reglamento a la Ley Forestal, Decreto Ejecutivo N°19886-MIRENEM dated August 27, 1990, because, in his case, the Administration did not follow the corresponding administrative procedure for extinguishing his individual right (derecho subjetivo).

In the third ground, he alleges violation of Article 34 of the Constitución Política, Articles 10 and 34 of the Ley Reguladora de la Jurisdicción Contencioso Administrativa, and Articles 330 and 331 of the Ley General de la Administración Pública because they govern deemed approval through administrative silence (silencio positivo), which arises when the Administration fails to decide a claim submitted by an interested party within one month after an application satisfying all the requirements for an authorization, license, or permit has been filed, after which it may not issue an act denying the right that arose from the Administration’s own inaction. The Tribunal found the procedure followed by the Administration to be proper and did not require the use of nullity proceedings or the existence of a valid ground for rendering ineffective the renewal of the permit requested by the plaintiff.

In his case, when renewal of the permit was requested, March 2, 1995, the applicable law allowed deemed approval through administrative silence, because it was not until February 13, 1996, through Ley Forestal N°7575, that application of that doctrine to natural-resource matters was prohibited. He considers the Tribunal’s actions contrary to the Constitución Política because it retroactively applied the effects of Ley Forestal N°7575 to one year before it entered into force. He also argues that judgment N°2954-94 of the Sala Constitucional does not apply to this specific case. That judgment explains that deemed approval through administrative silence does not apply to the harvesting of natural forests, whereas the plaintiff’s extraction occurred on pastureland and private properties, not in natural forests. Moreover, both the repealed Ley Forestal and the current one distinguish between forest resources on lands belonging to the State and other bodies of the Public Administration and forest resources on privately owned lands.

He therefore considers the judgment of the Sala Constitucional applicable to the former situation but not to the latter. Furthermore, he also considers the Tribunal’s reliance on judgments N° 2233-93 and N° 6836-93 of the Sala Constitucional as grounds for dismissing the complaint to be misplaced because the harvesting carried out by the plaintiff was neither indiscriminate nor irrational. Finally, ruling N° 6332-94 issued by the Sala Constitucional eliminated deemed approval through administrative silence for the collection of scarlet macaws, which, the appellant considers, is clearly irrelevant because the plaintiff never sought to undertake such collection.

V.It is appropriate to address the third claim first, since it has consequences for the other grounds of grievance. At this point, it must be determined whether or not positive administrative silence (silencio positivo) occurred in this case, applying the rules in force at the time of the event. Accordingly, it is appropriate to recall the case law (jurisprudencia) of the Constitutional Chamber (Sala Constitucional) established in judgment N° 2954, issued at 9 hours and 9 minutes on 17 de junio de 1994, which stated in this regard: “I°.- Contrary to the appellants’ assertions, there is indeed an overriding public interest that precludes the effectiveness of the positive administrative silence invoked in their favor, because the requested approval, as is apparent from the application itself, concerns the exploitation of ‘Natural Forests,’ which are protected by our legislation in view of their importance to the community.

Indeed, the irrational exploitation of such natural resources entails irreparable harm not only to local residents but also to the entire citizenry, because of the negative environmental impact that their uncontrolled exploitation may cause. Consequently, it cannot be claimed that the requested approval was granted by operation of positive administrative silence, even if the appellants believe that the proposed plan satisfied the applicable legal requirements. In any event, compliance with those requirements is not a matter to be determined in these proceedings, since holding otherwise would entail reviewing the technical criteria used by the respondent Ministry to assess such compliance, a procedure which, as stated, falls outside this jurisdiction.” Moreover, in another similar case, reaffirming this line of case law, the Constitutional Chamber ruled in judgment N° 2233, at 9 hours 36 minutes on 28 de mayo de 1993: “I.

This amparo proceeding (amparo) seeks protection of the legally protected interest (bien jurídico) consisting of forest resources, which ultimately means protecting and preserving the integrity of the natural environment existing at the site where the road giving rise to the dispute was laid out. When asked whether that legally protected interest, in its full scope, significance, and relationships, constitutes a constitutional value or fundamental right, the answer is unquestionably affirmative. Much is said today about humanity’s vital need—as a species—and its consequent obligation to provide such protection and preservation. This constitutes a worldwide position from which our country is not exempt, as demonstrated by Costa Rica’s evident interest in participating in international forums where ecological issues are discussed. But the conduct of our people is not manifested only in that manner, because domestically—and this is of paramount importance—we have also acted by enacting laws intended to provide such protection.”

VI.In previous decisions, this Chamber had upheld the position that positive administrative silence does not exist in forestry matters because these concern a legally protected interest safeguarded by the Political Constitution. Therefore, in deference to the Constitutional Chamber’s case law, which is binding erga omnes pursuant to Article 13 of its enabling law, positive administrative silence does not apply in forestry matters. This does not entail the erroneous retroactive application of a law, but rather the protection and safeguarding of that legally protected interest. This case law has the same normative hierarchy as the provision being interpreted, namely, the Constitution. Accordingly, this does not involve the retroactive application of the new Ley Forestal, which establishes the inapplicability of positive administrative silence in such matters, but rather the application of a higher-ranking source of law.

VII.In this case, positive administrative silence clearly did not occur because, as has been indicated, the matter was of great importance to humanity. Furthermore, the Administration did not grant subjective rights (derechos subjetivos) to the appellant because resolution N° 634-95 CRFZN of 10 hours on 6 de abril de 1995, which would have approved the request, was not signed by the competent official; consequently, no act creating rights in favor of the administered party (administrado) came into legal existence. This claim must therefore be rejected.

VIII.Regarding the appellant’s first and second grounds for cassation (motivos de casación), in which he alleges a failure to apply the procedural mechanisms necessary to invalidate the purported renewal of the timber-harvesting permit through positive administrative silence, as well as a failure to observe the doctrine of one’s own acts (doctrina de los actos propios), it should first be noted that Articles 135 and 173 of the Ley General de la Administración Pública exist, as does this Chamber’s definition of the so-called contentious-administrative proceeding for a declaration of injury to the public interest (proceso contencioso de lesividad): “…through the so-called contentious-administrative proceeding for a declaration of injury to the public interest, the Administration may challenge its own final act creating a subjective right when that act is deemed harmful to the public interest, pursuant to a reasoned decision by the highest-ranking body of the administration that issued it.” (Judgment Nº 17 of 16 hours on 13 de febrero de 1998).

That procedure is inapplicable here because there was no administrative act (acto administrativo). The Administration could not request the annulment of any act issued by itself and deemed harmful to the public interest because, instead, owing to its silence and failure to issue a decision—that is, because it had neither tacitly nor expressly granted the claimant a right—the plaintiff presumed that he had acquired certain rights. Given the absence of such an administrative act, neither the mechanism for a declaration of injury to the public interest nor that for absolute, evident, and manifest nullity (nulidad absoluta, evidente y manifiesta), as applicable, may be used. Therefore, the claims asserted before this Court are likewise not established.

IX. In view of all the foregoing, the appeal must be dismissed, and its costs imposed on the party who filed it

Therefore:

The appeal is dismissed. Its costs shall be borne by the party who filed it.

Proceso ordinario establecido en el Juzgado de lo Contencioso Administrativo y Civil de Hacienda, por Nombre59846 , empresario, vecino de Ciudad Quesada, contra EL ESTADO, representado por el Licenciado, Cristóbal Chavarría Matamoros, Procurador Adjunto, demás calidades no indicadas. Figura además como apoderada especial judicial, de la parte actora, Xiomara Rodríguez Aguilar, vecina de San José. Todas las personas físicas son mayores de edad, y con las salvedades hechas casados y abogada.

RESULTANDO:

1°.- Con base en los hechos y disposiciones legales que citó, el actor estableció demanda ordinaria cuya cuantía se fijó en la suma de nueve millones setecientos ochenta y seis mil setecientos sesenta colones sin céntimos, a fin de que en sentencia se declare: ”1.) Que se declare la nulidad de todo lo actuado en el expediente por los señores Alfáro y Nombre201772 en cuanto a la denegación del permiso de explotación de la madera; 2.) Que se condene al Estado al pago del valor de la madera decomisada, cuya estimación consta en autos, más los intereses que dichas sumas hubieran devengado, conforme con el ordenamiento jurídico vigente. Además, solicito se condene al Estado al pago de las costas de este proceso. 3.- Solicito se establezca quienes fueron los funcionarios responsables de la manifiestamente ilegal actuación que se dado en la resolución del expediente de marras, con el propósito de establecer contra los mismos las acciones correspondientes en fase administrativa, civil y penal que el ordenamiento jurídico otorga, para poder así resarcir el millonario perjuicio que mi poderdante ha sufrido.

Lo anterior sustentada en la Ley General de la Administración Pública, que dispone expresamente: Articulo 199.- 1. Será responsable personalmente ante terceros el servidor público que haya actuado con dolo o culpa grave en el desempeño de sus deberes o con ocasión del mismo, aunque sólo haya utilizado los medios y oportunidades que le ofrece el cargo. 2. Estará comprendido en tales casos el funcionario que emitiere actos manifiestamente ilegales, y el que los obedeciere de conformidad con esta ley… 4. La calificación de la conducta del servidor para los efectos de este artículo se hará sin perjuicios de la solidaridad de responsabilidades con la Administración frente al ofendido. Artículo 200.- Siempre que se declare la invalidez de los actos administrativos, la autoridad que la resuelva deberá pronunciarse expresamente sobre si la ilegalidad era manifiesta o no, en lo términos del artículo 199. 2.

En caso afirmativo, deberá iniciar de oficio el procedimiento que corresponda para reducir las responsabilidades consiguientes”… 4..- Solicito se condene al Estado al pago del daño moral subjetivo …”.

2°.- El representante del Estado, contestó la acción oponiéndose a las pretensiones de la parte demandante e interpuso las excepciones de legitimatio ad- causan activa, falta de derecho, las previas de acto consentido y la de falta de legitimación ad- procesum, mismas que fueron resuelta interlocutoriamente.

3°.- El Juez, Vernor Perera León, en sentencia N° 22-2000 de las 10:00 horas del 17 de enero del 2000, resolvió: “Se declara sin lugar la acción. Son ambas costas a cargo de la parte actora.”.

4°.- La parte actora apeló y El Tribunal Contencioso Administrativo, Sección Segunda, integrado por los Jueces, Sonia Ferrero Aymerich, Miriam Anchia Paniagua y Joaquín Villalobos Soto, en sentencia N° 254-2000 dictada a las 15:00 horas del 30 de agosto de 2000, dispuso: “Se confirma la sentencia apelada.”.

5°.- La Licenciada, Rodríguez Aguilar, en su expresado carácter, formuló recurso de casación ante esta Sala por el fondo. Alega violación de los artículos 10 y 34 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa; 131, 133 inciso 1), 136, 173, 214, 330 y 331 de la Ley General de la Administración Pública e indebida aplicación de los artículos 60 y 61 de la derogada Ley Forestal N° 7174; el numeral 80 del derogado Reglamento a la Ley Forestal, Decreto Ejecutivo N° 19886-MIRENEM, del 27 de agosto de 1990; además de la desaplicación de los artículos 60 y 61 de la derogada Ley Forestal N° 7174 de 28 de junio de 1990 y 80 del derogado Reglamento a la Ley Forestal, Decreto Ejecutivo N° 19886-MIRENEM del 27 de agosto de 1990; también de los artículos 34 de la Constitución Política.

6°.- En los procedimientos se han observado las prescripciones legales.

Redacta el Magistrado Zeledón Zeledón; y,

CONSIDERANDO:

I.Mediante escritura N° 6 del 3 de mayo de 1993, otorgada ante la Notaria Xiomara Rodríguez Aguilar, Nombre201773 le vendió a Nombre59846 , el derecho de explotación de la madera de su finca, la cual se encontraba en trámite de inscripción. En diciembre de 1993 se pagaron todos los derechos e impuestos exigidos por ley y la solicitud fue aprobada en todos sus extremos, autorizando la extracción de 115 árboles, para un volumen de 402.49 metros cúbicos de madera, pero durante 1994 no la sacaron. El 2 de marzo de 1995, Nombre201773 solicitó la renovación del permiso de extracción de madera, para lo cual se le previno aportar un certificado de propiedad de la finca. El 21 de marzo de ese año, Nombre201774 , funcionario de la Dirección General Forestal, inspeccionó la finca y recomendó revalidarlo por el mismo número de árboles y volumen autorizado el año anterior. A las 10 horas del 6 de abril de 1995 fue redactada la resolución N° 634-95 CRFZN, donde se aprobaría el permiso forestal solicitado por Nombre201773 , no obstante, dicha resolución no fue firmada por el Licenciado Fausto Alfaro Morales y se estampó sobre los folios la leyenda “nulo”.

Por oficio N° 101-95 OFCCH, del 24 de abril de 1995, Fausto Alfaro Morales le indicó al Agente Fiscal de San Carlos la falta de permiso para la tala de árboles en la finca de Nombre201773 , interponiéndose denuncia por tala ilegal de madera ante la Agencia Fiscal de San Carlos, por parte de Nombre201772 . En junio de 1995, Nombre59846 interpuso incidente de nulidad ante el Jefe de la Oficina Regional Forestal de la Región Huetar Norte, con el fin de alegar a la Administración, cuales habían sido las irregularidades en la tramitación de su caso. Dicha solicitud fue rechazada por el Director General Forestal, fundamentándose en la falta de legitimidad de Nombre59846 mediante resolución N° 081-95 DGF. Contra esa resolución el señor Nombre59846 interpuso recurso de revocatoria con apelación en subsidio, el cual fue declarado inadmisible por extemporáneo.

II.La parte actora solicitó declarar la nulidad de todo lo actuado por parte de los señores Alfaro y Nombre201772, funcionarios de la Dirección General Forestal y de la Fiscalía de San Carlos respectivamente, relativo a la denegatoria del permiso de explotación maderera. Solicitó también condenar al Estado a pagar el valor de la madera decomisada más los intereses, las costas del proceso y el daño moral consistente en el sufrimiento personal y de su familia por la incertidumbre de dejar de recibir la suma de su sustento diario. El daño moral subjetivo lo valoró en ¢500.000. Pidió establecer quienes fueron los responsables de la actuación dada en el expediente de marras con el fin de entablar las acciones en sede administrativa, civil y penal otorgadas por el ordenamiento jurídico y, con ello, resarcir el perjuicio económico sufrido.

III.El Juzgado declaró sin lugar la demanda y condenó a la parte actora al pago de las costas del proceso. El Tribunal la confirmó.

IV.El recurso lo plantea la parte actora. Interpone tres reproches por el fondo por violación directa de ley. En el primero, basándose en el artículo 595 inciso 1) del Código Procesal Civil alega violación de los artículos 10 y 34 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa, 131, 133 inciso 1), 136, 173 y 214 de la Ley General de la Administración Pública e indebida aplicación de los artículos 60 y 61 de la derogada Ley Forestal N°7174 y el numeral 80 del derogado Reglamento a la Ley Forestal, Decreto Ejecutivo N°19886-MIRENEM, del 27 de agosto de 1990. Lo anterior porque la Administración debió seguir los procedimientos señalados en nuestro ordenamiento para anular el acto de otorgamiento de la renovación del permiso de explotación maderera, y no simplemente poner la leyenda “NULO” en el documento. En el segundo motivo alega violación de la doctrina de los actos propios de la administración, consecuentemente alega desaplicación por parte del Tribunal de alzada de los artículos 60 y 61 de la derogada Ley Forestal N°7174 de 28 de junio de 1990 y el artículo 80 del derogado Reglamento a la Ley Forestal, Decreto Ejecutivo N°19886-MIRENEM del 27 de agosto de 1990, pues en su caso, la Administración no siguió el procedimiento administrativo correspondiente para dejar sin efecto su derecho subjetivo.

En el tercer motivo alega violación del artículo 34 de la Constitución Política, de los artículos 10 y 34 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa y de los numerales 330 y 331 de la Ley General de la Administración Pública porque regulan el silencio positivo, el cual emerge cuando la Administración no resuelve la pretensión del administrado en el plazo de un mes luego de presentada la solicitud con todos los requisitos de una autorización, licencia o permiso, no pudiéndose luego dictar acto denegatorio del derecho acaecido por la inercia misma de la Administración. El Tribunal, consideró acertado el procedimiento de la Administración, no exigió la utilización del procedimiento de nulidad ni haber tenido un motivo válido para dejar sin efecto la renovación del permiso solicitado por el actor. En su caso, cuando se solicitó la renovación del permiso, 2 de marzo de 1995, la normativa vigente permitía la aplicación del silencio positivo, pues no fue sino hasta el 13 de febrero de 1996, mediante la Ley Forestal N°7575, cuando se prohibió la aplicación del instituto del silencio positivo en materia de recursos naturales.

Considera, la actuación del Tribunal, contraria a la Constitución Política, por cuanto retrotrayó los alcances de la Ley Forestal N°7575 a un año antes de haber entrado en vigencia. Argumenta también la inaplicación al caso concreto de la sentencia N°2954-94 de la Sala Constitucional, donde se explica, en materia de explotación de bosques naturales no opera el silencio positivo, pues la extracción del actor se llevó a cabo en potreros y fincas privadas y no en bosques naturales. Además, en la derogada Ley Forestal y en la actual, se diferencia entre el recurso forestal en terrenos del Estado y demás organismos de la Administración Pública y del recurso forestal en terrenos de propiedad privada. Por ello considera, la sentencia de la Sala Constitucional, de aplicación para el primer supuesto y no para el segundo. Por otra parte, tampoco considera atinada la utilización por parte del Tribunal de las sentencias N° 2233-93 y N° 6836-93 de la Sala Constitucional como fundamento para declarar sin lugar la demanda, porque la explotación realizada por el actor no fue ni indiscriminada ni irracional.

Finalmente, el voto N° 6332-94 dictado por la Sala Constitucional, suprimió el silencio positivo en la recolecta de lapas rojas, el cual, considera el recurrente, es claro no viene al caso, porque el actor nunca pretendió tal recolecta.

V.Conviene resolver en primer lugar el tercer reproche, pues de él se derivan consecuencias para los demás agravios. Es menester aclarar en este punto si en la especie existió o no silencio positivo, aplicando la normativa vigente al momento del hecho. En razón de ello conviene recordar la jurisprudencia de la Sala Constitucional consagrada en la sentencia N° 2954 dictada a las 9 horas con 9 minutos del 17 de junio de 1994, en este aspecto: “I°.- Contrario a lo que afirman los recurrentes, sí media un interés público calificado que imposibilita la eficacia del silencio positivo que se alega a su favor, pues la aprobación solicitada, según se desprende del propio libelo de interposición, lo es para la explotación de "Bosques Naturales" los que se encuentran protegidos por nuestra legislación, habida cuenta de la importancia que ellos tienen para la colectividad. En efecto, la explotación irracional de tales recursos naturales implica un perjuicio irreparable no sólo para los vecinos del lugar sino que también para toda la ciudadanía, en razón del impacto ambiental negativo que una explotación no controlada de ellos puede ocasionar, de manera que, no es posible alegar que la aprobación pretendida haya operado positivamente, aún cuando los recurrentes estimen que el plan propuesto cumplía con los requisitos legales exigidos, cumplimiento que, en todo caso, no corresponde ser constatado en esta vía, pues afirmar lo contrario implica la revisión de los criterios técnicos empleados por el Ministerio recurrido para el bastanteo de tal cumplimiento, procedimiento que, como se dijo, resulta ajeno a esta jurisdicción.”.

Por otra parte, en otro caso similar, reiterando la línea jurisprudencial, mediante sentencia N° 2233 la Sala Constitucional, a las 9 horas 36 minutos del 28 de mayo de 1993, resolvió: “I. El presente amparo pretende la tutela del bien jurídico recurso forestal, lo que en último término significa la protección y preservación de la integridad del medio ambiente natural, que existe en el sitio donde se ha trazado el camino que es causa del problema. Ante la interrogante de si es ese bien jurídico, en todo su dimensión, significación y relación, un valor constitucional o derecho fundamental, la respuesta es indudablememente, positiva. Mucho se habla hoy en día de la necesidad vital para el hombre -como género- y de la obligación consecuente, de esa protección y preservación, y esto constituye una actitud de carácter mundial, de la cual nuestro país no está exento, lo que se demuestra por el interés evidente de Costa Rica de participar en los foros internacionales donde se discute el tema ecológico. Pero tal conducta de nuestro pueblo no sólo se manifiesta de esa manera, porque internamente, lo que es primordial, también hemos actuado promulgando leyes cuyo fin tiende a esa protección.”.

VI.Esta Sala, en fallos anteriores había sostenido la tesis de la inexistencia del silencio positivo en materia forestal. Porque se trata de un bien jurídico tutelado por la Constitución Política. Luego siendo respetuosos de la jurisprudencia vinculante erga omnes de la Sala Constitucional, según el artículo 13 de su Ley constitutiva, no se aplica el silencio positivo en materia forestal. Con ello no se cae en el error de aplicar retroactivamente una ley, sino más bien en proteger y tutelar ese bien jurídico. Esta jurisprudencia tiene una jerarquía normativa propia de la norma interpretada, sea la Constitución. En razón de ello no se está en presencia de una aplicación retroactiva de la nueva Ley Forestal, la cual instituye la inaplicabilidad del silencio positivo en esa materia, sino de la aplicación de una fuente normativa superior.

VII.En este caso evidentemente no operó el silencio positivo pues, como se viene indicando, se trataba de una materia de gran trascendencia para la humanidad. Pero además, la Administración tampoco otorgó derechos subjetivos a favor del recurrente, porque al no haber sido firmada la resolución de las 10 horas del 6 de abril de 1995, N° 634-95 CRFZN, en la cual se hubiere aprobado lo solicitado, por el funcionario competente no surgió a la vida jurídica ningún acto generador de derechos a favor del administrado. En consecuencia, este reproche debe ser rechazado.

VIII.En cuanto al primer y segundo motivos de casación del recurrente, donde alega falta de aplicación de los mecanismos procesales para dejar sin efecto el pretendido otorgamiento de la renovación del permiso de explotación maderera a través del silencio positivo e irrespeto a la doctrina de los actos propios, cabe indicar, en primer término la existencia de los numerales 135 y 173 de la Ley General de la Administración Pública, así como la definición de esta Sala del llamado proceso contencioso de lesividad, “…, por medio del llamado proceso contencioso de lesividad, la Administración puede impugnar un acto propio, firme y creador de algún derecho subjetivo, cuando se considere lesivo a los intereses públicos, según resolución fundada del órgano superior jerárquico de la administración que lo dictó.” ( Sentencia Nº 17 de las 16 horas del 13 de febrero de 1998). En este caso ello no procede pues no medio ningún acto administrativo, pues la administración no podía solicitar la anulación de acto alguno dictado por ella misma, considerado lesivo a los intereses públicos, pues más bien por su silencio y falta de resolución, o sea, por no haber otorgado ni tácita ni expresamente un derecho a favor del accionante, el actor supuso haber derivado ciertos derechos.

Debido a la inexistencia de ese acto administrativo, no cabe la aplicación del mecanismo de la lesividad o de la nulidad absoluta, evidente y manifiesta, según sea la situación, razón por la cual tampoco se configuran los reproches alegados en esta instancia.

IX. En virtud de todo lo expuesto procede declarar sin lugar el recurso e imponer sus costas a cargo de quien lo interpuso

Por tanto:

Se declara sin lugar el recurso. Son sus costas a cargo de quien lo interpuso.
