DRAFT JUDGMENT NO. 502.
SUPERIOR AGRARIAN COURT, Goicoechea. San José, at nine forty in the morning on veinticuatro de julio del dos mil uno.- Ordinary proceeding (Proceso Ordinario) brought by [Nombre1] against [Nombre2], whose particulars appear in the record. This Court considers the declination of jurisdiction (inhibitoria) based on subject matter, ordered by the Civil Agrarian Court of Limón.- Opinion drafted by Judge DARCIA CARRANZA; and,
WHEREAS:
I.By an order issued at eight in the morning on trece de febrero del dos mil uno, the Agrarian Court of Limón declined jurisdiction over this proceeding based on subject matter. (folio 5).- .
II.Agrarian jurisdiction (competencia agraria), based on subject matter, is generally established by Articles 1 and 2(h) of the Agrarian Jurisdiction Law (Ley de Jurisdicción Agraria). The fundamental criterion is the productive agricultural activity, whether animal husbandry or crop cultivation (commercial or subsistence activities), or related activities, as well as sustainable agro-environmental activities. Complementary criteria include the nature or suitability of the productive property, as well as its area, and the parties participating in the agrarian proceeding as plaintiffs or defendants. The nature or suitability of the property is closely linked to agricultural holdings (fundos agrarios) (incorrectly referred to in legislation as rural properties (predios rústicos)), which are devoted or capable of being devoted to productive agricultural activities or to forest conservation and the sustainable management of agro-environmental activities. Likewise, the parties acquire the designation of “agrarian parties” (sujetos agrarios) by virtue of their engagement in productive agricultural activities. The fundamental criterion is always the functional one—that is, the activity—to which both the objective and subjective criteria are tied.-
III.This proceeding concerns a timber purchase and sale agreement entered into by the parties, as shown by the certified copies appearing at folios one and two of the case file. The fifth clause of that agreement provides: “The buyer shall pay all expenses for the survey plan, titling, management plan (plan de manejo), and any other expense entailed in obtaining the forestry permit, which amount shall be deducted from the price payable for the timber.”; the sixth clause states: “The administrative and timber-harvesting expenses shall be borne by the buyer.” From the foregoing, it can be determined that this is an agreement for forestry exploitation (explotación forestal) through a management plan, and thus involves a forestry activity capable of initiating the biological cycle of the forest; accordingly, it does fall within the jurisdiction of this specialized court.-
IV.The Agrarian Courts have jurisdiction over all acts and contracts arising from the performance of essentially productive agricultural activities (animal husbandry or crop cultivation), or related activities involving the processing, industrialization, or marketing of agricultural products when carried out by the same agricultural entrepreneur (empresario agrario). This means that every commercial agricultural activity requires the involvement of farmers or agricultural entrepreneurs in the biological cycle of plants or animals. Specifically, the commercial practice of silviculture requires human direction throughout the entire process of cultivation, weeding, thinning, fertilizing, plantation care, firebreak maintenance, and so forth. A purely extractive timber activity (which merely requires an extraction permit from the Ministry of the Environment) must therefore not be confused with commercial agricultural activity, in which humans intervene in the biological cycle.-
V.The First Chamber of Cassation has held as follows: “III.- In the case at bar, part of the agreement consists of the plaintiff’s acceptance of the rules specific to forestry legislation, whose requirements mandate the preparation of a series of technical studies intended to ensure the continuity of the exploitation through the successive planting of timber trees, the ultimate purpose of which would be to establish a silvicultural enterprise. Although the overall project involves timber extraction in certain previously authorized areas—at different times and as other obligations to the forestry administration are fulfilled—the ultimate purpose is to transform a virgin forest into a continuous process that subsequently permits agricultural activity in which, through permanent human intervention in the biological cycle, certain species are replaced by others and duly authorized extraction occurs, thereby enriching the holding rather than destroying the forest.
This is the purpose of the management plan. The situation would be different if it involved only the sale of timber resulting from extraction not intended to establish a silvicultural enterprise. IV.- Mere extraction supports recognition of the existence of forest property, but not of commercial forest property. It would constitute commercial forest property if the entrepreneur’s activity involved participation in the biological cycle, from planting and cultivating trees to replacing certain species with others and, in general, caring for the forest for purposes of silvicultural production; or, at a minimum, if there were an intention to submit to a legal framework imposing an obligation to promote a commercial undertaking aimed at maintaining real property characterized by the production of timber trees for placement on the market. This is so because the latter two situations entail submission to forestry regulations.
V.- Only when humans intervene in the biological life cycle of plants and make forestry exploitation more productive is there an activity falling within the jurisdiction of the agrarian courts. The mere extraction of timber from a property where there has been no human intervention—or where such intervention is instead intended to terminate that biological cycle, without preserving timber species or giving the forest a productive purpose—is a non-agrarian activity and therefore falls within the civil jurisdiction rather than the specialized jurisdiction. This is all the more so because silvicultural activity identifies an agricultural entrepreneur, whereas mere extraction identifies an owner holding title to property that also contains timber—through civil accession (accesión civil)—whose activity is not agricultural. (First Chamber of Cassation, No. 68, at 10:10 on 8 de mayo de 1991).-
VI.Ley Forestal number 7575 defines a Forest Management Plan (Plan de Manejo Forestal) as a “Set of technical standards governing the actions to be carried out in a forest or forest plantation, on a property or part thereof, for the purpose of utilizing, conserving, and developing existing tree vegetation or vegetation intended to be established, in accordance with the principle of rational use of renewable natural resources that guarantees the sustainability of the system.” In the case at bar, this is a forestry agreement for utilization through a forest management plan intended to develop a silvicultural activity for the advancement of a productive activity and the recovery of the forest. In view of the foregoing, because this is an agreement that is fundamentally forestry-related and concerns utilization through a forest management plan, it falls within the jurisdiction of this specialized court; consequently, the present matter must be heard by the Agrarian Court of Limón. The present matter is ordered remanded to the court of origin so that it may continue hearing it and conclude it as provided by law.-
THEREFORE:
The declination of jurisdiction ordered by the Agrarian Court of Limón in its ruling issued at eight in the morning on trece de febrero del dos mil uno is DISAPPROVED. TRIBUNAL SUPERIOR AGRARIO, Goicoechea. San José, a las nueve horas cuarenta minutos del veinticuatro de julio del dos mil uno.- Proceso Ordinario establecido por [Nombre1] contra [Nombre2] , de calidades que constan en autos. Conoce este Tribunal de la inhibitoria, por razón de la materia, decretada por el Juzgado Civil Agrario de Limón.- Redacta el juez DARCIA CARRANZA; y,
CONSIDERANDO:
I.El Juzgado Agrario de Limón, por auto dictado a las ocho horas del trece de febrero del dos mil uno, declara su inhibitoria por razón de la materia, para conocer de este proceso. (folio 5).- .
II.La competencia agraria, por razón de la materia, está determinada en forma genérica por los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria. El criterio fundamental es el de la actividad agraria de producción, sea de cría de animales o cultivo de vegetales (actividades empresariales o de subsistencia), o cuando se trate de actividades conexas, así como actividades agroambientales sostenibles. Como criterios complementarios, se han establecido, la naturaleza o aptitud del bien productivo, así como su extensión, y los sujetos que participan dentro del proceso agrario como actores o demandados. La naturaleza o aptitud del bien está estrechamente vinculada a los fundos agrarios (denominados incorrectamente por la legislación como predios rústicos), dedicados o que sean susceptibles de destinarse al ejercicio de actividades agrarias productivas, o a la conservación de bosques y manejo sostenible de actividades agroambientales. Los sujetos, igualmente, adquieren su calificativo de “sujetos agrarios”, por su dedicación al ejercicio de actividades agrarias productivas. El criterio fundamental es siempre el funcional, es decir, la actividad, al cual son reconducidos los criterios tanto objetivos como subjetivos.-
III-. Este proceso versa sobre un contrato celebrado entre las partes de compra - venta de madera, según se desprende de copias certificadas que corren a folios uno y dos del expediente. En dicho contrato se establece en la cláusula quinta: “ El comprador pagará todos los gastos de plano, titulación, plan de manejo, y cualquier otro gasto que conlleva la obtención del permiso forestal, suma que será deducida del precio a cancelar por pago de madera.” ; la cláusula sexta reza, “Los gastos administrativos y de extracción forestal corresponderán al comprador.”. De lo expuesto se logra determinar, se trata de un contrato para la explotación forestal a través de un plan de manejo, de ahí estaríamos ante una actividad forestal que permitiría activar el ciclo biológico de bosque, por ende, si sería de conocimiento de esta sede especializada.-
IV.Los Tribunales agrarios son competentes para conocer de todos los actos y contratos originados en el ejercicio de actividades esencialmente agrarias de producción (cría de animales o cultivo de vegetales) o bien conexas de transformación, industrialización o comercialización de productos agrarios cuando sean realizadas por el mismo empresario agrario. Lo anterior significa, en toda actividad agraria empresarial se requiere la intervención de los agricultores o empresarios agrarios en el ciclo biológico de las plantas o de los animales. Particularmente, en el ejercicio de una actividad silvicultura de carácter empresarial, se requiere la dirección del hombre en todo el proceso de cultivo, deshierba, raleos, abonos, cuido de la plantación, rondas, etcétera. Por ello no se debe confundir la actividad puramente extractiva de madera (donde simplemente se requiere un permiso de extracción del Ministerio del Ambiente), con la actividad agraria empresarial, donde el hombre interviene en el ciclo biológico.-
V.La Sala Primera de Casación ha indicado lo siguiente: "III.- En el subjudice parte del contrato consiste en la aceptación del actor de las normas propias de la legislación forestal, cuyas exigencias obligan a formular una serie de estudios técnicos orientados a darle continuidad a la explotación a través de la sucesiva siembra de árboles maderables, cuyo fin último sería la de estructurar una empresa silvícola, pues si bien el proyecto general implica la extracción de madera en algunas áreas previamente autorizadas -en diferentes momentos y en la medida que se vayan cumpliendo otras obligaciones con la administración forestal- el fin último es convertir una montaña virgen en un proceso continuo que permita luego una actividad agrícola donde -con la intervención permanente del hombre en el ciclo biológico- se vayan sustituyendo unas especies por otras, extrayéndolas debidamente autorizadas generando un enriquecimiento del fundo, y no la destrucción del bosque.
A esto conduce el plan de manejo. Diferente sería la situación si solamente se tratara de la venta de madera, como consecuencia de una extracción no conducente a la configuración de una empresa silvícola. IV.- La mera extracción permite aceptar la existencia de una propiedad forestal, pero no empresarial. Sería una propiedad forestal empresarial si la actividad del empresario implica la participación suya en el ciclo biológico, desde la siembra, cultivo de árboles, sustitución de unas especies por otras, y en general cuido del bosque con el fin de la producción silvícola, o cuando menos la voluntad de someterse a un régimen jurídico cuya obligación consiste en impulsar una labor empresarial orientada a tener un inmueble caracterizado por producir árboles maderables para ser colocados en el mercado; ésto es así porque en los dos últimos casos implica un sometimiento a la normativa forestal.
V.- Solo cuando el hombre interviene en el ciclo biológico de la vida de las plantas, y hace más productiva la explotación forestal, se estaría en presencia de una actividad cuyo conocimiento compete a la jurisdicción agraria. La mera extracción de la madera de una finca, donde no ha habido intervención del hombre, o si la hay ella se orienta por el contrario a darle fin a ese ciclo biológico, sin preservar las especies maderables, ni darle al bosque un sentido productivo, se trata de una actividad no agraria, y por ende no susceptible de ser conocida por la jurisdicción especializada, sino la civil. Esto es así, a mayor abundamiento, porque con la actividad silvícola se identifica a un empresario agrario, con la mera extracción se identifica a un propietario, titular de una finca conformada también por madera -con accesión civil-, cuya actividad no es agraria.(Sala Primera de Casación, No. 68 de las 10:10 del 8 de mayo de 1991).-
VI.La Ley Forestal número 7575, define el Plan de Manejo Forestal como “Conjunto de normas técnicas que regularán las acciones por ejecutar en un bosque o plantación forestal, en un predio o parte de este con el fin de aprovechar, conservar y desarrollar la vegetación arbórea que exista o se pretenda establecer, de acuerdo al principio de uso racional de los recursos naturales renovables que garantizan la sostenibilidad del sistema”. En el caso de marras estamos ante un contrato forestal para el aprovechamiento a través de un plan de manejo forestal tendiente a desarrollar una actividad silvicultural para el desarrollo de una actividad productiva y a la recuperación del bosque. POR TANTO:
Se IMPRUEBA la inhibitoria declarada por el Juzgado Agrario de Limón en resolución de las ocho horas del trece de febrero del dos mil uno.
