Legal Document No. 28076 LBJ 456-F-98 CRIMINAL CASSATION TRIBUNAL. Second Judicial Circuit of San José, Goicoechea. At fourteen hours on the thirtieth of June, nineteen ninety-eight.
CASSATION APPEAL (recurso de Casación) filed in the present case brought against [Nombre1], of legal age, Costa Rican, married, businessman, national ID number (cédula número) CED1, for the offense of VIOLATION OF THE Ley Forestal, to the detriment of NATURAL RESOURCES. Participating in the decision on the appeal are Judges Fernando Cruz Castro, Jorge Alberto Chacón Laurito, and [Nombre1]. Appearing in cassation are the defendant's private defense counsel, Lic. [Nombre2], and the representative of the Ministerio Público, Lic. [Nombre3].
WHEREAS:
1) That by means of a judgment (fallo) rendered at ten hours and thirty minutes on Tuesday, the twenty-sixth of August, nineteen ninety-seven, the Juzgado Penal de San Carlos resolved: "POR TANTO: In accordance with the foregoing and with articles 1, 11, 19, 20, 30, 31, 71 of the Penal Code, 61 subsection A. of the Ley Forestal N. 7575, 39, 40 and 41 of the Political Constitution, and 392 to 396 and 542 to 546 of the Code of Criminal Procedure, [Nombre1] is hereby declared criminally responsible for having committed the offense of VIOLATION OF THE Ley Forestal IN ITS MODALITY OF ILLEGAL TIMBER HARVESTING to the detriment of THE FOREST HERITAGE (PATRIMONIO FORESTAL), and as such is sentenced to SIX MONTHS OF IMPRISONMENT, to be served in the appropriate correctional facility, with credit for any pretrial detention served. The defendant (encartado) meeting the requirements established by law, the benefit of a suspended sentence (Ejecución Condicional de la Pena) is granted for a probationary period of THREE YEARS, a benefit that shall be revoked if, during this period, the defendant commits a new intentional offense punishable by a sentence exceeding six months. Once final, this judgment shall be recorded in the Judicial Criminal Registry (Registro Judicial de Delincuentes), and the corresponding certified copy of the judgment shall be remitted. The costs and expenses of the proceedings are charged to the defendant. FORFEITURE (Comiso) is ordered of one log (troza) of Bitter Cedar (Cedro Amargo), six logs of Caobilla (Caobilla), and two logs of Black Oak (Roble Negro) in various diameters and lengths, seized in the course of this proceeding. Lic. [Nombre4]. Criminal Judge of San Carlos, [Nombre5]. Court Clerk." (sic).
The opinion is drafted by Cassation Judge [Nombre6]; and,
CONSIDERING:
The Criminal Judge of San Carlos, Lic. [Nombre4], convicted [Nombre1] for the offense of Violation of the Ley Forestal, imposing a sentence of six months of imprisonment. Against this judgment, the defendant's defense counsel filed a cassation appeal on grounds of procedural errors (yerros de forma), requesting the annulment of the judgment and the trial (debate). The Tribunal analyzed the appellant's claims and resolved them as set forth below:
I.In his first and only claim based on procedural errors, the appellant (impugnante) alleges non-observance of articles 393, second and third paragraphs, 387, 400, subsection four, all of the Code of Criminal Procedure. As stated by defense counsel, the trial judge's reasoning does not conform to the logical rules governing judicial reasoning, particularly the principle of sufficient reason (principio de razón suficiente), since the judgment is based on the testimony of [Nombre7] and [Nombre8], who at no point were able to identify any person carrying out the criminal act. The cited testimonies do not satisfy the principle of sufficient reason, as the evidence is insufficient to establish as proven the act described in the indictment. The evidence is insufficient, and the judge furthermore failed to fulfill his fundamental duties by summoning [Nombre2] as a witness. This witness could have provided important information and therefore should have appeared at trial.
Other witnesses, such as [Nombre3] and a certain [Nombre9], should have testified, as they are mentioned by the O.I.J. investigator. The Ministerio Público should also have charged [Nombre10]. In reality, no one was able to observe the defendant as the perpetrator of the act described in the indictment, which is why the representative of the Ministerio Público requested an acquittal (absolutoria) of the accused. The evidence supporting the judgment is insufficient; accordingly, the logical principle of sufficient reason was disregarded. The grievance raised is without merit. The appellant fails to recognize that, pursuant to the principle of freedom of evidentiary means (libertad en los medios de prueba), a conviction may be based exclusively on the testimony of one or two persons. The principle of sufficient reason cannot be said to have been violated merely because the judgment rests on the statements of one or two witnesses; what matters is that the trial judge's reasoning be consistent and well-grounded — defects that the appellant does not in fact allege.
Nor does the appellant demonstrate the specific reasons why he believes that certain witnesses should have been summoned to better resolve the matter. The appellant fails to demonstrate, based on the evidentiary record, the circumstances that would have made a particular witness's testimony necessary for a better resolution. It is not enough to assert that certain witnesses could have provided decisive information; it must be shown, through specific data, why those testimonies would have been important in the context of the evidence supporting the challenged decision. Nor does defense counsel specify the grounds upon which he considers the evidence supporting the conviction to be insufficient. The fact that charges should have been brought against another person does not constitute a defect in the reasoning (fundamentación) that would disqualify the challenged judgment. It is a possible omission that does not in any way alter the decision being contested.
The testimony of [Nombre11] provides decisive information for the resolution of the case, when he states that the defendant authorized the cutting of timber as a means of payment for the construction of a road and that at all times he undertook to obtain the permit from the competent forestry authorities. The information provided by investigator [Nombre12] corroborates the account of [Nombre11], as can be seen at folio 43 verso and folio forty-four recto. The trial judge analyzes, with proper grounds, the cited testimonies, rejecting the defendant's version, as can be seen at folio forty-four verso. With respect to this reasoning, defense counsel does not allege any essential logical defect or error in the grounds. The appellant's arguments are not persuasive; the claim is rejected.
POR TANTO:
The cassation appeal filed by Defense counsel is declared without merit. Notice to be served.

RECURSO DE CASACION interpuesto en la presente causa seguida contra [Nombre1], mayor, costarricense, casado, empresario, con cédula número CED1, por el delito de INFRACCION A LA LEY FORESTAL, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los Jueces Fernando Cruz Castro, Jorge Alberto Chacón Laurito y [Nombre1]. Se apersonó en casación el abogado defensor particular del imputado, Lic. [Nombre2] y el representante del Ministerio Público, el Lic. [Nombre3].
RESULTANDO:
Firme inscríbase en el Registro Judicial de Delincuentes, y remítase el testimonio de sentencia respectivo. Son los gastos y las costas del proceso a cargo del encartado. Se ordena EL COMISO de una troza de madera de la especie Cedro Amargo, seis trozas de madera de la especie Caobilla y dos trozas de madera de la especie Roble Negro en diversos diámetros y largos, decomisadas dentro de esta causa. Lic. [Nombre4]. Juez Penal de San Carlos, [Nombre5]. Secretario." (sic).- 2) Que contra el anterior pronunciamiento el Lic. [Nombre2] interpuso Recurso de Casación.
Redacta el Juez de Casación [Nombre6]; y,
CONSIDERANDO:
El Juez Penal de San Carlos, Lic. [Nombre4], condenó a [Nombre1] por el delito de Infracción a la Ley Forestal, imponiéndole una pena de seis meses de prisión. Contra esta sentencia, el defensor del acusado, interpuso recurso de Casación por yerros de forma, solicitando la nulidad del fallo y del debate. El Tribunal analizó las pretensiones del recurrente, resolviendo sus pretensiones, conforme se expondrá:
I- En su primer y único reclamo por yerros de forma, el impugnante acusa la inobservancia de los artículos 393, párrafo segundo y tercero, 387, 400, inciso cuarto, todos del Código de Procedimientos Penales. Según lo expone el abogado defensor, el razonamiento del juzgador no se ajusta a las reglas lógicas que rigen el razonamiento judicial, especialmente el principio de razón suficiente, pues el fallo se funda en el testimonio de [Nombre7] y [Nombre8], quienes, en ningún momento pudieron identificar a ninguna persona ejecutando el hecho delictivo. Los testimonios citados, no cumplen con el principio de razón suficiente, pues se trata de una prueba insuficiente para tener por demostrado el hecho descrito en la acusación. La prueba es insuficiente e incluso el juez incumplió sus deberes fundamentales, al citar, como testigo, al señor [Nombre2]. Este testigo pudo aportar datos importantes, por esta razón debió comparecer al debate.
Otros testigos, como [Nombre3] y un señor [Nombre9], debieron declarar, pues los menciona el investigador del O.I.J. El Ministerio Público también debió acusar a [Nombre10]. En realidad nadie pudo apreciar que el imputado fuese el autor del hecho descrito en la acusación, por esta razón el representante del Ministerio Público solicitó la absolutoria del encausado. La prueba que sustenta el fallo es insuficiente, por esta razón se inobservó el principio lógico de razón suficiente. El agravio reclamado, es inatendible. Desconoce el impugnante, que conforme al principio de libertad en los medios de prueba, un fallo condenatorio puede fundarse, exclusivamente, en el testimonio de una o dos personas. No puede contravenirse el principio de razón suficiente, si el fallo se funda en la declaración de uno o dos testigos, lo importante es que el razonamiento del juzgador sea consistente y motivado, vicios que realmente no acusa el impugnante.
Tampoco demuestra el recurrente los motivos específicos por los que estima que debieron citarse, para mejor resolver, algunos testigos. No demuestra el recurrente, conforme al contexto de la prueba, las circunstancias por las que considera que se debió contar con un testigo para mejor resolver. No basta afirmar que unos testigos pudieron aportar datos decisivos, debe demostrarse, conforme a datos específicos, las razones que demuestran la importancia de tales testimonios en el contexto de la prueba que sustenta la decisión que se impugna. Tampoco señala el abogado defensor los motivos específicos por los que considera que la prueba que sustenta el fallo condenatorio, es insuficiente. La acusación que debió plantearse a otra persona, no constituye un vicio de fundamentación que descalifique la sentencia recurrida. Es una posible omisión que no modifica, de ninguna manera, la decisión que se objeta.
El testimonio de [Nombre11] aporta datos decisivos para la resolución de la causa, cuando afirma que el imputado autorizó la corta de la madera como medio para pagar la construcción de un camino y que en todo momento se comprometió a conseguir el permiso ante las autoridades forestales competentes. Los datos que brinda el investigador [Nombre12], corroboran del dicho de [Nombre11], según se aprecia a folio 43 vuelto y cuarenta y cuatro frente. El juzgador analiza, fundadamente, los testimonios citados, rechazando la versión del acusado, según se aprecia a folio cuarenta y cuatro vuelto. Respecto a este razonamiento, el abogado defensor no acusa ningún vicio lógico esencial o alguna yerro de motivación. Los argumentos del impugnante no son convincentes, rechazándose el reclamo planteado.
POR TANTO:
Se declara sin lugar el recurso de Casación planteado por el representante de la Defensa. Notifíquese.
