SummaryResumen
The Administrative-Litigation and Civil Treasury Court dismissed in full the action brought by Carlos Alfredo Umaña Balser and Forestales Alegría S.A. against the State concerning the failure to execute an administrative eviction from land subject to a forestry project. It held the compensation claims time-barred because the 2022 action was filed after the four-year period measured from the favorable 2015 decision, with no proven claim interrupting that period. The Court also found no unlawful conduct by the Ministerio de Seguridad Pública or Ministerio de la Presidencia: the administrative challenges, interinstitutional coordination, and social-vulnerability assessment were authorized by Costa Rican law. It refused to order the eviction because a 2019 administrative decision, which had not been challenged, continued to suspend execution, and because Article 176 of the Código Procesal Contencioso-Administrativo (CPCA) provided a special enforcement procedure. It also denied the request for disciplinary proceedings, rejected the supplemental documentary evidence, and ordered the applicants to pay costs and statutory interest.

In conclusion, pursuant to Article 198 of the Ley General de la Administración Pública and Article 40 of the Código Procesal Contencioso Administrativo, the State’s limitation defense is upheld with respect to the compensation claims asserted against it. Accordingly, the request that this Court order the immediate execution of the administrative eviction in these proceedings must be denied, both because relief must in principle be sought through the special procedure under Article 176 of the Código Procesal Contencioso-Administrativo for enforcing final administrative acts favorable to the affected person, and because execution cannot legally be ordered while disregarding a subsequent administrative act that continues to suspend the measure and whose annulment was neither requested nor placed at issue in these proceedings.

Proceedings on the Merits PLAINTIFF:
CARLOS ALFREDO UMAÑA BALSER DEFENDANT:
THE STATE No. 2026006244 ADMINISTRATIVE-LITIGATION AND CIVIL COURT OF THE TREASURY (TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA), SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at nine forty-five a.m. on 7 September 2026.- Proceedings on the merits instituted by CARLOS ALFREDO UMAÑA BALSER, identity card number 1-0555-0247, acting personally and as representative of FORESTALES ALEGRÍA S.A., legal entity identification number 3-101-077633, with the powers of a generalísimo power of attorney without limitation as to amount, against THE STATE, represented by State attorney Adriana Fallas Martínez, bar number 16465. Roberto Enrique Umaña Balser, bar number 7417, and Jorge Antonio Cortés Salinas, bar number 7471, appear as special judicial attorneys for the plaintiff (power of attorney visible in image 511 of the electronic court file, PDF version in ascending order, hereinafter “court file”).
REASONS
Before the oral trial, the plaintiff submitted evidence for a more informed decision (prueba para mejor resolver) in a filing dated 17 October 2024 (see images 1367 to 1388 of the court file). This consists of the documents in images 1389 and 1390 (a note dated 10 September 2024, addressed to the plaintiff company by the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Barbilla de Matina, in which its representatives are reproached for a lack of diligence regarding the persons occupying its property, whose activities the Association considers harmful to the water resource supplying the community), and images 1391 to 1395 (a report addressed by the Environmental Manager of the Municipalidad de Matina to the Mayor of Matina, dated 7 November 2023, concerning an inspection of the property owned by the plaintiff company to which the claims in these proceedings refer; the report states that tree cutting was observed along the banks of springs (nacientes), as well as informal activity that included land-use change (cambio de uso del suelo) from forest to plantation, posing a risk to the water supply; it should be noted that the document contains photographs that lack clarity in the copy submitted).
The State was given an opportunity to address this evidence by decision issued at 9:38 a.m. on 8 November 2024, and its representative reserved her submissions for the trial hearing. Having reviewed the record and the arguments made by the parties in their filings and at the trial hearing, this Court considers that the documents offered are not material, since the plaintiff asserts no claims against the State concerning an alleged environmental disaster being perpetrated on its property. Furthermore, neither the ASADA that made the complaint or accused the plaintiff company of negligence, nor the Municipalidad de Matina or the private individuals allegedly responsible for possible environmentally harmful actions, are parties to these proceedings, and they cannot or should not benefit or suffer prejudice from the outcome. Neither document relates to State conduct or harm included among the claims in these proceedings.
It is therefore concluded that they lack relevance, connection, and materiality for deciding this case, and this Court rejects their admission as evidence for a more informed decision. It should be recalled that evidence for a more informed decision (also called prueba para mejor proveer) is an exceptional power allowing a judge to order evidence to be taken on the court’s own motion when, after the hearing, the judge remains uncertain about the facts and needs to ascertain the substantive truth before rendering judgment. On this subject, the First Chamber of the Supreme Court of Justice has repeatedly stated for many years: “…it must be recalled that evidence for a more informed decision is, by its nature, a power of the judge, who decides whether it is appropriate and necessary and, accordingly, is not required to admit such evidence when offered by the parties. It is a power that allows the judge to add, during the concluding phase, relevant evidentiary elements for the proper resolution of the dispute.
From this perspective, although it is permissible to introduce—as evidence for a more informed decision—entirely new evidence, as well as evidence declared incapable of being taken, void, rejected as untimely or inadmissible, or related to facts deemed established because of the defendant’s default—sections 331 and 575 of the Código Procesal Civil—the decision to obtain it is certainly a matter for the judge’s discretion, and the judge may dispense with it without the need for an express decision” (Resolución N° 408-A- S1-2012 of 2:30 p.m. on 03 de abril de 2013). In administrative-litigation matters, the Código Procesal Contencioso Administrativo provides as follows in sections 82.1, 93.3, 110.1, and 148.1: “Article 82.- 1) The judge shall order and conduct all evidentiary measures necessary to determine the substantive truth of the facts relevant to the proceedings”; “Article 93.- (…) 3) If indispensable or manifestly useful for ascertaining the substantive truth of the disputed facts, the case-management judge may, on the court’s own motion, order the taking of any evidence not offered by the parties”; “Article 110.- 1) If, during deliberations, the Court considers it absolutely necessary to receive new evidence or expand upon the evidence introduced, it may order the hearing reopened.
The discussion shall be limited to examination of the new elements for consideration.” In the case under examination, as already stated, after assessing the plaintiff’s arguments when offering the evidence and the submissions of the State’s representative, this Court considers that the documentary evidence offered as evidence for a more informed decision is unnecessary for ruling on the merits because it lacks a direct connection to the subject matter of these proceedings. Consequently, because this Court considers it immaterial to resolving the merits of this matter on the terms stated, the documentary evidence for a more informed decision offered by the plaintiff is rejected.
The course of the proceedings is recounted below:
7- There are no defects or omissions rendering the proceedings in this matter procedurally void.
The principal claim asserted by the plaintiff in these administrative-litigation proceedings seeks a declaration that the alleged omission and negligence of State authorities—the Ministerio de Seguridad Pública and Ministerio de la Presidencia—in processing an administrative eviction proceeding concerning property owned by the plaintiff constitute a basis for administrative liability. In conjunction with this, the plaintiff requests a judicial order for execution of the administrative eviction and asks this Court to compel the Executive Branch authorities to institute an administrative proceeding to establish the responsibility of officials who allegedly acted improperly in processing the eviction. As ancillary relief, it seeks damages and losses under the categories of principal objective damage, subsidiary material damage, subjective (non-pecuniary) damage, future damage, and losses (interest), as well as an order requiring the defendant to pay both procedural costs and attorney fees; if the plaintiff is unsuccessful, however, it requests exemption from their payment.
The State’s representative opposes the claims, alleging that the actions of the ministries involved complied with the legal system, that the alleged harm lacks a causal relationship with administrative conduct and would instead result from the victim’s own fault and acts of third parties, and that no compensable harm chargeable to the State therefore exists. She considers it improper to order execution of the administrative eviction because its legal basis has disappeared, and likewise improper for a court to order the institution of proceedings regarding allegedly erroneous procedures. The State raised the defenses of lack of legal entitlement and lack of active and passive standing ad causam, and later also asserted the statute-of-limitations defense regarding the damages for which compensation is sought. Finally, the defendant requests that the plaintiff be ordered to pay costs and interest thereon.
(a) The plaintiff’s arguments: In both the complaint and its closing arguments, the plaintiff states that the Ministerio de Seguridad Pública took from the initial invasion of the plaintiff company’s property until 24 February 2015—a little more than thirteen years—to deliver administrative justice, when it issued a final act ordering the requested eviction (it would later correct its statement to say that the invasions dated from 2013 rather than 2003). It alleges misuse of administrative powers, accompanied by neglect, negligence, improper patronage, and administrative indifference, resulting in the plaintiff company’s commercial failure and the documented loss of many millions of dollars. It asserts that not only was possession of the property lost, but also all improvements; all planted timber trees were cut down until none remained; seventy-two reforested hectares disappeared; all buildings were destroyed; and undisturbed primary forest was totally destroyed.
It states that all of this occurred during the years in which the plaintiff awaited ministerial action. Under section 197 of the Ley General de la Administración Pública (LGAP), it attributes to the Ministerio de Seguridad Pública, together with the “invading trespassers,” liability for harm to the plaintiff’s rights, which it characterizes as exceptional, actual, effective, assessable, and readily ascertainable on an individual basis. It states that the current occupants are not the additional invaders who allegedly destroyed the project developed on the property, and alleges a lack of solidarity, empathy, and concern on the part of ministerial authorities. It states that it is incredible that an eviction that had been final since 2015 could remain unexecuted through the filing date of the complaint (2022), and that it has still not been carried out. It maintains that, instead of helping the persons characterized as invaders, the Administration’s delay causes them greater harm because they rely on a false sense of normality and a belief in the legality of their ten-year possession of the plaintiff company’s land.
It alleges that the administrative authorities approached by the plaintiff failed to take the measures necessary to prevent the harmful and unlawful act from continuing to perpetuate its injurious effects over time. It refers to the alleged trespassers, who would lose their homes and possibly the work and investments of many years, and adds that the improvements introduced do not benefit a reforestation company in any way because they consist of houses and crops, not forests technically replanted under a program. After referring to the allegedly improper conduct of the Ministerio de Seguridad Pública, it addresses the intervention of authorities from the Ministerio de la Presidencia, particularly the Comisión de Atención Integral de Desalojos (CAID), and asserts that they exceeded their authority for a purpose other than that established by law, thereby increasing the damages and losses caused to the claimants, both through the company’s failure and through the frustration and despair caused to the natural persons.
It maintains that, at the time the complaint was filed, the Ministerio de Seguridad Pública remained obligated to execute the eviction because it was a final and valid act entailing the need to administratively evict all persons described as precaristas—informal occupants without title—from the plaintiff company’s property. It states that it was a mistake to trust the actions of the authorities of the Ministerio de Seguridad Pública and the Ministerio de la Presidencia, which countenanced unlawful conduct without resolving the social housing problems that are the State’s responsibility. It criticizes public entities for providing public services to those it characterizes as trespassers. It alleges that the Executive Branch lacks interest in enabling the plaintiff company to recover its land and, in the plaintiff’s view, patronizes those who dispossessed the company of its land and whom it characterizes as criminal invaders.
It emphasizes that the executive authorities cannot place the burden of solving the housing needs of allegedly vulnerable sectors on the plaintiff entity, and that they have acted to the undeniable detriment of the claimants’ guarantees, rights, and assets; had they acted diligently, the harm would have been reduced to its lowest possible extent. The damages and losses for which compensation is sought are then substantiated in compliance with section 58, first paragraph, subsection (e), of the CPCA. The closing argument reiterates the allegations summarized above and contests those of the State. In particular, it disputes that extinctive prescription has occurred, arguing that it is incorrect to link prescription to the period beginning on 24 February 2015 and to place the expiration of the claimants’ rights in 2019, because doing so would disregard conduct by the Ministerio de Seguridad Pública that was omissive, repeated, systematic, continuous, and consolidated over the years (once again, and in this instance within the closing argument, for which image 1433 of the court file may be consulted, the plaintiff refers to an eleven-year period, thereby again placing the origin of the effects on its property in 2003).
It alleges a suspension by memorandum, without reasons or notice. It states that the State’s representative commits the fallacy of treating the matter as involving a single event giving rise to liability, because the State’s inaction and acts prevented execution of the administrative eviction, referring to matters such as unmet logistical coordination. It further argues that the conduct complained of is an omission whose effects continue and that, accordingly, the claim is not time-barred under the law (Article 40 of the CPCA), and that the State created a state of paralysis from which it now seeks to benefit. It also states that prescription was interrupted by the filing of an amparo application, which resulted in referral to the administrative-litigation jurisdiction. By way of conclusion, it emphasizes that the State’s omission is continuing and current and that the State cannot benefit from its own intentional misconduct. The closing arguments list a series of issues:
(b) Arguments of the State’s representatives: In their answer to the complaint and conclusions, the State’s representatives oppose the claims asserted. They allege lack of legal entitlement and lack of passive standing on the merits (legitimación ad causam pasiva), insofar as there is no conduct attributable to the State that could serve as a basis for holding it liable for the millions in damages claimed. They add that the purpose of the complaint is to obtain a declaration that the party they represent is liable for the alleged millions in damages and losses caused to the plaintiffs by third parties. According to the State’s representatives, this is incontrovertible because the plaintiffs expressly admit in their complaint that they exercised possession and ownership over the invaded property, which means that it is inadmissible, contrary to logic, and contrary to the legal system to accuse the State of acts committed by third parties and, moreover, to seek compensation that is entirely unrelated and disproportionate, the efficient cause of which does not arise from the State, to which liability is sought to be attributed even though two grounds exempting it from liability are clearly and manifestly present: namely, fault of the victim and acts of third parties.
They argue that, in April 2013, when the Administrative Evictions Department processed an eviction request submitted by the plaintiff, Article 455 of the Code of Civil Procedure (Ley N° 7130, of 16 August 1989, repealed by Ley N° 9342, of 03 February 2016, Article 183.1) was in force, and that provision established that administrative eviction was available in the circumstances set forth in Article 7(f) of the General Urban Leasing Law (N°7527 of 17 August 1995). They emphasize that, at that time, by resolution N° 818-13 at 08:05 on 14 August 2013, the Department denied the application filed by the plaintiff; dissatisfied with that decision, Mr. Umaña Balser, in his capacity as President of Forestales Alegría S. A., filed an appeal against that resolution; and, by official letter 1321-14-AJ-D dated 31 January 2014, the Legal Advisory Office of the Ministry of Public Security requested a report from the Batán Police in order to decide the appeal in question.
They recount that subsequently, by resolution N°996-15-DM at 10:45 on 24 February 2015, the Office of the Minister of Public Security granted the appeal, approved the application filed by the plaintiff, and authorized the local police to carry out the eviction; however, before the resolution was enforced, the occupants were given five days to vacate the property voluntarily, and by official letter N°2933-15 AJD, dated 16 March 2015, from the Legal Advisory Office of the Ministry of Public Security, the Commander of the Limón Matina Batán Police was ordered to proceed as provided in resolution N°996-15-DM. Nevertheless, in submissions dated 08 April 2015 and 15 April 2015, the families occupying the property to be vacated filed an application for review (recurso de revisión) against resolution N°996-15-DM, and on 04 June 2016 the plaintiff also filed a submission alleging “absolute nullity.” By resolution 596-16-DM at 08:45 on 22 March 2016, the Office of the Minister of Security granted the application for review only as to codefendants María Mercedes Ortiz Gómez and Felicita López Salinas; as to the remaining defendants, it granted them three days to leave the property voluntarily, failing which the eviction would be enforced; it also denied the motion for nullity filed by the plaintiff.
It is further stated that, in a submission dated 06 June 2016, the occupants filed another “extraordinary application for review and annulment of an administrative act,” and that subsequently, by an official letter filed on 27 June 2016, the Legal Advisory Office of the Ministry of Public Security asked the then Vice Minister of the Presidency to assess whether the administrative eviction should be enforced or whether the potential-vulnerability procedure of the Comprehensive Eviction Assistance Commission should be applied. By resolution N°2019-2551-DM at 10:00 on 22 May 2019, the Office of the Minister of Public Security denied the application for review and the request for annulment of the administrative act filed by the occupants of the property at issue. In addition, on 19 June 2019, the occupants of the property filed a submission in which they requested, among other things, suspension of the eviction until the requested social-vulnerability assessment had been decided.
It is stated that subsequently, by resolution N° 2019-1590-DM (sic), at 11:00 on 16 August 2019, the Minister of Security ordered the suspension of the administrative eviction, and the plaintiff did not file any challenge to that decision, thereby demonstrating, according to the State’s representatives, its agreement with the ruling. Regarding the proceedings before the Ministry of the Presidency, it is noted that, by official letter VPDC-269-2018 dated 28 August 2018, signed by the Vice Minister of Political Affairs and Citizen Dialogue, the plaintiff was informed that, in compliance with Decreto Ejecutivo N°39277, the matter was to be referred to the Comprehensive Eviction Assistance Commission for analysis; and on 14 May 2019, a meeting was held between the Office of the Vice Minister of Political Affairs and Citizen Dialogue and the plaintiff for the purpose of addressing the matter concerning the property in question.
Based on the foregoing, the State’s representatives conclude that, contrary to the plaintiff’s view, the administrative actions taken by both Ministries do not constitute the efficient cause of the damage sought to be attributed to the party they represent, and they maintain that the plaintiff’s objections are unfounded. As to the first objection, concerning the Administration’s decision on the applications for review filed by the property’s occupants, they state that it is evident that this objection does not qualify as “injury to the interests of the plaintiff company,” because, under the principle of informality established in Article 358 of the General Public Administration Law (N°6227 of 02 May 1978), which governs administrative proceedings and procedures, the title or name given to a remedy does not determine its denial; it is sufficient that the reasons for requesting review of the decision can be inferred from its contents.
The applications for review filed by the interested parties identify with absolute clarity their disagreement with the decision adopted seven years earlier (in resolution N° 996-2015). Although the second application for review was addressed in resolution N° 2019- 2551-DM, the fact remains that, by that date, the Administration had already sent the matter to the then Vice Minister of the Presidency for the corresponding assessment. The issuance of that administrative act certainly caused no injury to the plaintiff, contrary to its erroneous assertion, because the matter was no longer in the hands of the Ministry of Public Security. For that reason, by resolution N°2019-1590-DM, the Office of the Minister of Public Security determined that the proceeding depended on the Comprehensive Eviction Assistance Commission’s decision concerning vulnerability. No challenge was filed against that administrative act; the party that is now the plaintiff did not challenge the decision.
The State’s representatives also assert that there is no evidence of an allegedly urgent situation on the plaintiff’s property, much less that it was experiencing damage as a consequence of the State’s conduct. They question the account given of the extent of the injuries that the plaintiff alleges it sustained, which, in the opinion of the State’s legal representative, would demonstrate the plaintiff’s minimal or nonexistent vigilance and active care of its property, a matter confined to the plaintiff’s private sphere. Yet the plaintiff now seeks compensation for events dating back many years before the State was even aware of the case. They conclude that the administrative actions taken at the time by the Evictions Department of the Ministry of Public Security and by the Ministry of the Presidency were lawful and consistent with the legal system. Based on Article 190 of the LGAP, they contend that, under the factual account presented by the plaintiffs, the act of a third party is clearly and manifestly established in this case as a ground exempting the State from liability, a circumstance that breaks the causal link between the liability claimed and the alleged damage.
They refer to precedents of this Tribunal, whose judgments have held that alleging that the Administration engaged in an omission is not sufficient to establish the damage claimed; rather, it must be shown that the damage was in fact the direct consequence of the defendant Administration’s omission. Regarding the specified damage, the State’s representatives maintain, in essence, that it is indisputable that the plaintiff has clearly identified those who caused the damage it now seeks to recover from the State. Nevertheless, its claim is tantamount to asking the State and the public to award it an exorbitant sum in dollars based on mere probabilities and expectations frustrated by events unrelated to the State; consequently, any claim asserted is attributable to those third parties. They state that the property lacked the necessary protection and care by its owner to prevent the situations that had been occurring for decades, and they question the evidence concerning the existence of security and professional forestry oversight (regencia forestal) on the property.
They further argue that, with respect to the claims for compensation, the plaintiff failed to meet its burden of proof (Article 41.1.1 of the Code of Civil Procedure, applicable on a supplementary basis pursuant to Article 220 of the Administrative Litigation Code of Procedure); therefore, in this matter, the party bearing that burden failed to establish either the alleged pecuniary damage or its causal relationship with the State. They add that not every instance of damage gives rise to an obligation to provide compensation; rather, damage must satisfy a series of requirements for a claim to be granted, which are set forth in Article 196 of the General Public Administration Law, providing that “the alleged damage must be actual, quantifiable, and capable of individual determination in relation to a person or group.” They conclude by stating that the State has taken no action intended to misappropriate the plaintiff’s property, is not occupying the property, and has not hindered the development of any project there, and that the property is registered in the name of the plaintiff company.
Specifically regarding subjective nonpecuniary damage (daño moral subjetivo), they point out that the shareholders are not plaintiffs, which entails a lack of active standing, and they also deny the alleged favoritism claimed to constitute that injury, which they consider to arise from the plaintiff’s dispossession by third parties unrelated to the State. They question the plaintiff’s reasoning that the mere fact of having filed an administrative application in 2013 entitles it to seek recovery from the State for expectations, errors, unrealized projects, acts of third parties, and so forth, while disregarding the fact that the State is not responsible for what occurred during the more than thirty years in which the property was held and administered. These successes or failures have nothing to do with the State. Accordingly, in the view of the State’s representatives, any injury to the plaintiff’s nonpecuniary rights would be attributable exclusively to the third parties who committed those acts and, to the same extent, to the owner.
It would not be attributable to the State; thus, the grounds exempting it from liability consisting of fault of the victim and the act of a third party are established with respect to this damage and the remaining damage, which they consider to have been claimed without basis. As to other strictly economic items, the plaintiff states that it sustained various forms of damage that it describes as “actual loss” (daño emergente), “lost profits” (lucro cesante), “future lost profits” (lucro cesante futuro), and “future damage” (daños futuros). For the last of these, it claims $254,317.00 (two hundred fifty-four thousand three hundred seventeen dollars) per year, for a total since February 2015 of $1,525,902.00 (one million five hundred twenty-five thousand nine hundred two dollars), and $434,906,57.75 (four hundred thirty-four thousand nine hundred six dollars and fifty-seven cents) for losses.
In this regard, the State’s representatives maintain that there is no basic reasoning from which the differences among each of the forms of damage listed can be discerned; rather, the supporting argument essentially concerns the income allegedly not received as a consequence of the evasive conduct and omissions attributed to the State agencies. On behalf of the defendant, they respond that the plaintiff’s conduct is again surprising, because it is attempting—now under different labels for the damage—to obtain compensation on the basis of the same arguments already refuted above. To avoid repeating what has already been stated, it is sufficient to note that if the property has faced various problems over the course of decades, those problems were not caused by the State. Under the fourth claim in the complaint, the plaintiff requests enforcement of the eviction order issued by the Ministry of Public Security years before the filing of the complaint that gave rise to these proceedings.
On this point, it must be noted that, pursuant to the authority conferred by Article 455 of the Code of Civil Procedure, which was in force at the time of the events, the Administration processed the application filed by the plaintiff. However, when the new Code of Civil Procedure entered into force on 08 October 2018, Article 455 was repealed, and from that time onward Article 104 of the Code of Civil Procedure (Ley N° 9342 of 03 February 2016) became applicable. Accordingly, the State’s representatives conclude that, from that date, the procedural remedy afforded by the legal system for evicting occupants from real property has been the summary judicial eviction proceeding provided for in Article 104 of that Code, which the plaintiff may pursue directly. Finally, regarding the claim seeking the establishment of a directing body for proceedings (órgano director de procedimiento) against the officials who may have failed to ensure the proper processing of the eviction sought by the plaintiff, they state that the Administrative Litigation Tribunal cannot and must not supplant the active Administration and determine whether disciplinary administrative proceedings should be instituted against the officials who participated in the process initiated in 2013.
Both in their oral arguments during the trial hearing and in their written conclusions, the State’s representatives raised the statute-of-limitations defense. In this regard, they state that, as may be gathered from the plaintiff’s allegations, the liability it seeks to impose and the injuries it asserts were caused by the State’s failure to enforce the administrative eviction; according to the plaintiff, enforcement should have occurred once the eviction became final upon the issuance of resolution N°996-15-DM at 10:45 on 24 February 2015. Therefore, from that time, pursuant to Article 198 of the LGAP, the plaintiff had four years to claim the alleged damage caused to its property. This did not occur in the administrative forum—there were no acts interrupting the limitations period—and the complaint was duly served on the State on 27 May 2022, well after the period in question had elapsed.
It is therefore evident that the plaintiff’s ability or right to bring its claim is time-barred. They add that, should the Tribunal find that this complaint was filed within the statutory period, it should be noted that, although this may appear obvious or of little relevance, the subject matter of this case concerns the real property registered under real-property folio number 10576-000, with survey plan L-0606016-1985, which is owned by the plaintiff company. It is not a Forest Reserve or public-domain property merely because it was placed under a self-sustaining reforestation program. It must be borne in mind, first, that this is privately owned real property that the plaintiff voluntarily decided to place under the forestry regime by signing a contract whose purpose was forestry development to be carried out over several years. That agreement entails the owner’s receipt of financial incentives in exchange for protecting, maintaining, or reforesting forests; such agreements form part of the Pago de Servicios Ambientales Program, as provided by the Ley Forestal.
The following facts, which are relevant to these proceedings, are deemed duly established:
The following facts, which are significant to the resolution of this complaint, are deemed unproven because no supporting evidence appears in the case file:
The logical order of the analysis requires first addressing the statute-of-limitations defense raised at the trial hearing by the State’s representative, the applicability of which is opposed by the claimant. The arguments of both parties were summarized in the corresponding sections. It should be emphasized that, in its arguments, the State’s representative invokes Article 198, first paragraph, of the General Law of Public Administration (Ley General de la Administración Pública, LGAP), which, in its current version, already in force when the action was filed, provides: “The right to claim compensation from the Administration shall be time-barred after four years, counted from the event giving rise to liability.” That provision is found among the rules governing administrative liability. It must be borne in mind that the limitations period would therefore concern the possibility of compensating the party for the damages and losses at issue, if such compensation were warranted because the essential prerequisites for the corresponding obligation had been met (unlawful conduct attributable to the Public Administration, compensable damages and losses, and a causal relationship between the first of those elements and the injury claimed).
In determining whether this defense applies, it is essential to consider that the event alleged to give rise to administrative liability is the failure to execute Resolution 996-15-DM, issued at 10:45 a.m. on 24 February 2015 and served by fax on 20 March 2015 by the Office of the Minister of Public Security, which ruled: “To grant the appeal and approve the administrative eviction application filed by Carlos Alfredo Umaña Balser, representative of Forestales Alegría S.A., against occupants...”; it additionally granted five days for voluntary eviction and advised of the opportunity to file a motion for review (see proven fact number 15 of this judgment). In contrast with the date on which that declaration was issued, the claimant went to court seeking compensation for events that it links to State inaction and obstacles to the execution of that decision, which it considers final and favorable, almost seven years later, on 9 February 2022 (see Reason III, paragraph 1, and image 2 of the judicial case file).
After the corresponding requirements were verified, the complaint was served on the State’s representative on 27 May 2022, by which time more than seven years had elapsed since the starting point alleged by the claimant for the damages for which compensation is sought (see Reason III, paragraph 2, and image 515 of the judicial case file). The limitations period applicable to the claims for compensation asserted in these proceedings, which the State’s representative contests as extinguished because they were filed after the four-year period, had therefore plainly and amply expired. Three additional elements are particularly important because they reinforce the applicability of the defense under analysis and rule out the opposition raised. (i) The claimant does not show that, before resorting to the courts, it had filed an administrative claim concerning the damages that could be deemed to have interrupted the limitations period.
It should be noted that this does not impose a requirement of prior exhaustion of administrative remedies, which does not govern a matter such as the one under review. Rather, it shows that the claimant allowed the compensation obligation to lapse without going to court within the statutory four-year period or even filing a claim that might validly have been deemed a possible ground for interrupting the limitations period applicable to the right asserted. (ii) It is inconsistent to argue that the damages arose from the failure to execute a decision issued in 2015 while also asserting that, because the damages accumulated over time, they became exempt from any limitations period under the continuing-effects theory and Article 40 of the CPCA. Under that theory, the right to compensation would continue indefinitely, without any proportionate and reasonable limit. The applicable statutory period is considered lengthy; although shorter than ten years, it far exceeds the shorter periods in force in other fields and cannot justify a party’s choice to allow seven years, or even longer periods, to pass before bringing an action against conduct it considers unlawful and productive of damages and losses.
(iii) Nor may the judgment referred to in proven fact number 28 of this judgment—Resolution 2019-5190-DM, issued at 11:00 a.m. on 16 August 2019 by the Office of the Minister of Public Security—be treated as interrupting the limitations period. It ruled: “To maintain the suspension of the administrative eviction requested by Carlos Alfredo Umaña Balser, representative of Forestales Alegría S.A., against Benito Chévez Chévez, David Ismael Gutiérrez, Mario Garbanzo Obregón, and others, until completion of the referenced social-vulnerability process....” To begin with, this judgment was issued more than four years after service of Resolution 996-15-DM, issued at 10:45 a.m. on 24 February 2015. Moreover, as stated in the list of facts not proven in this judgment, the evidence submitted shows that this decision became final because no administrative challenge was filed and, additionally, because no application for annulment was filed against it within the limitation period for bringing the action (Article 39 of the CPCA), or even in these proceedings, although it constitutes formal conduct by the Administration.
Consequently, the circumstances described above, and fundamentally the claimant’s inaction, preclude it from arguing that the four-year limitations period applicable to the claims for compensation asserted in 2022 was interrupted without contradicting its own failure to timely pursue the appropriate avenues. In conclusion, pursuant to Article 198 of the General Law of Public Administration and Article 40 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo), the statute-of-limitations defense raised by the State regarding the claims for compensation asserted against it is granted.
ANALYSIS OF THE CONDUCT ATTRIBUTED TO STATE BODIES AS THE BASIS FOR THE CLAIMS ASSERTED. Notwithstanding the ruling on the statute-of-limitations defense, it is appropriate to provide additional considerations regarding why various aspects of the claims are unfounded. Upon reviewing the record, this Chamber finds that the complaint filed is unfounded and must be dismissed in its entirety because the claimant has failed to establish a basis for its claims. As a starting point, those claims would require proof of conduct by the State that was contrary to the legal order and could be regarded as an event giving rise to compensable damages and losses and other obligations of the defendant entity. Notwithstanding the ruling regarding the limitations period, it is appropriate to set out general clarifications concerning the liability regime operating within the national legal system. The strict-liability regime governing the Costa Rican Public Administration is generally established in Articles 190 et seq. of the General Law of Public Administration, from which follows the duty to compensate for all damages and losses caused by the conduct and omissions of the Public Administration.
That is, the Administration is liable for all damages caused by its lawful or unlawful, normal or abnormal operation, except in cases of force majeure, fault of the victim, or the act of a third party. From this perspective, based on the Administration’s duty to provide compensation regardless of subjective assessments—intent or fault—concerning the actions of its public servants or agents, the country operates under a liability regime that is essentially objective. Accordingly, the State must compensate for any harm that the person subject to the Administration or the litigant is not legally required to bear, whether within the person’s economic or non-economic sphere, regardless of the person’s individual legal status. Thus, the Public Administration is liable for its lawful and normal conduct when it issues an administrative act substantially consistent with the legal order or when it undertakes permitted material conduct, whether through action or omission.
The State is, of course, also liable for damages arising from unlawful, abnormal, and formal administrative conduct when the administrative act is illegal, and from nonformal conduct when the matter involves impermissible or abnormal material conduct. It follows from the foregoing that three fundamental requirements must be met for the State’s predominantly strict-liability regime to apply. The first is the existence of administrative conduct, whether by action or omission, formal or material, lawful or unlawful, and involving normal or abnormal operation. The second requirement is the occurrence of unlawful, actual, assessable, and individually identifiable harm that the victim is not legally required to bear, whether in the victim’s economic or non-economic sphere. The third and highly significant requirement is the existence of a causal connection between the two preceding requirements; that is, a direct cause-and-effect relationship between the alleged event and the resulting harm that gives rise to the loss, with no ground excluding causation, such as force majeure, fault of the victim, or the act of a third party.
(For further discussion, reference is made to the following judgments of the First Chamber of the Supreme Court of Justice: number 025-F-99, issued at 2:15 p.m. on 22 January 1999; number 589-F-99, issued at 2:20 p.m. on 1 October 1999; and number 252-F-01, issued at 4:15 p.m. on 28 March 2001.) The conduct attributed to the State, which according to the claimant entity’s theory would give rise to State liability, is analyzed below, although such liability was previously ruled out because of an extinguishing limitations period. It should be noted that, in this particular case, the claimant sought to attribute liability to the State for unlawful conduct or abnormal operation. That liability is objective insofar as its applicability requires proof of the unlawfulness of the conduct and the injury (objective elements), but does not require proof of intent or fault by the State officials involved (subjective elements) for the compensation obligation to arise.
It is also important to consider that the alleged administrative unlawful acts would form the basis of the other claims asserted, principally the execution of the administrative eviction and the commencement of “administrative proceeding director-body proceedings” (órganos directores de procedimiento).
The claimant seeks an order from this Court directing the immediate execution of the administrative eviction authorized by Resolution number 996-15-DM, issued at 10:45 a.m. on 24 February 2015. This claim cannot be granted, but the reasons must be explained by reference to the nature of the claim asserted, the legal regime governing execution of final administrative acts favorable to persons subject to the Administration, and particularly the subsequent actions established in these proceedings. First, it has been proven that, through Resolution number 996-15-DM, the Ministerio de Seguridad Pública granted the appeal filed by the claimant company and approved its administrative eviction application, giving the occupants a period within which to vacate voluntarily and directing that the decision be executed if they failed to do so (proven fact number 15). It has also been established, however, that this decision did not remain unchanged in its original terms.
The occupants filed remedies against it and, subsequently, through Resolution number 596-16-DM of 22 March 2016, the Administration itself partially granted the motion for review, excluded specified persons from the eviction, maintained the order with respect to the remaining persons, and also denied the application filed by the claimant company for absolute nullity of that modification to the original decision (proven facts numbers 16, 18, and 19). This sequence shows that the legal situation whose execution is now sought cannot be assessed exclusively on the basis of the 2015 resolution in isolation from the subsequent administrative actions. The documentary evidence demonstrates the existence of a series of remedies and decisions that partially modified the personal scope of the eviction order and affected the conditions governing its potential execution. It has likewise been proven that, on 5 August 2016, the claimant company itself asked the Deputy Minister of the Presidency to confirm the eviction and coordinate its execution, while the response issued on 19 September of that year expressly established that neither the Deputy Ministry of the Presidency nor the Comisión de Atención Integral de Desalojos had legal authority to confirm an eviction order issued by the Ministerio de Seguridad Pública, although they did participate in matters relating to the comprehensive handling of evictions in situations of social vulnerability (proven fact number 22).
This evidence is relevant because it rules out, as an independent event giving rise to liability attributable to the Ministerio de la Presidencia, that either that ministry or CAID formally suspended the eviction order. Indeed, it was not found proven that any authority of that ministry or CAID issued a judgment suspending execution of the decisions adopted by the Ministerio de Seguridad Pública (fact not proven number 9). Moreover, it was established that in 2018 the claimant company again applied to the Ministerio de la Presidencia for a resolution of the matter and that its application was referred to the Comisión de Atención Integral de Desalojos, after which a meeting was held with representatives of that body on 14 May 2019. The record also shows that, on that same date, the claimant filed a complaint with the Contraloría de Servicios regarding the alleged delay in addressing its case (proven facts numbers 23 through 26).
The administrative action that is decisive to the situation now invoked, however, is Resolution number 2019-5190-DM of 16 August 2019. In that resolution, the Minister of Public Security expressly directed that the administrative eviction remain suspended until completion of the social-vulnerability process, while also stating that the claimant company was the registered owner of the property, that it had full standing to act, and that the prior judgments had been issued in accordance with the law (proven fact number 28). The relevance of this act is decisive. It is not merely material conduct, an informal communication, or an administrative omission lacking legal expression. There is an express administrative act by which the Administration determined that execution of the eviction would remain suspended for a specific reason: the existence of a social-vulnerability assessment process. Consequently, while that act remains legally effective, this Court cannot simply disregard it and order immediate execution of the earlier decision as if the subsequent action had never occurred.
The claimant knew of that situation but did not establish that it challenged Resolution number 2019-5190-DM through the corresponding administrative mechanisms or subsequently through the extraordinary remedies established by the legal order. This follows from fact not proven number 8. This matter cannot be regarded as merely formal. If the claimant company considered the resolution maintaining the suspension of the eviction to be unlawful, inadequately reasoned, issued through a misuse of powers, or improperly disregardful of a prior administrative act favorable to its interests, it was required to assert the corresponding challenge seeking relief against that act. It is not legally possible, within proceedings whose subject matter includes a claim of administrative liability and a request for execution, to ask the Court to disregard the legal effect of a subsequent act whose nullity was not sought, whether within the applicable time or in the proper manner.
This is required by the party-presentation and congruence principles governing administrative-litigation proceedings and by the parties’ right of defense. The subject matter of the proceedings defines the scope within which the judicial function may be exercised. The defendant must know which administrative acts are challenged, which events are attributed to it, and which legal consequences are requested so that it may adequately exercise its right to contest them. If the Court were to declare in this judgment that the 2019 resolution is invalid, ineffective, or inapplicable without a claim having been asserted to obtain its annulment, it would be ruling on a matter that was not submitted for debate in those terms and would alter the limits within which the dispute was joined. It is therefore impermissible to construct a form of incidental ineffectiveness of the subsequent administrative act in order to execute the earlier act.
The Costa Rican legal order does not permit the Court to disregard the existence and effect of an administrative act simply because, in the Court’s view, it obstructs the execution of another, earlier act. If the legality of the subsequent act constituted the true obstacle to the claimant’s claim, the claimant was required to challenge it in a timely manner and request, as applicable, the legal consequences arising from its potential nullity. This conclusion assumes still greater significance given that these proceedings were not brought as special proceedings for execution of a final and favorable act. Article 176 of the Administrative Litigation Procedure Code expressly provides a specific procedural avenue for cases in which the Administration fails to comply with its final acts favorable to a person subject to the Administration (“When the Public Administration fails to comply with its final acts favorable to the person subject to the Administration, that person may have them executed in accordance with this chapter.”).
The existence of this avenue confirms that execution of an administrative act is a claim with its own subject matter and rules, distinct from a declaratory action for economic liability based on administrative inaction. In the present case, moreover, the evidence demonstrates that the act whose execution is sought was the subject of subsequent administrative actions that partially modified its scope and culminated in 2019 with an express decision to maintain the suspension of its execution. Therefore, within this action, this Court may not replace the administrative procedure or the special execution procedure established by Article 176 of the CPCA, nor may it declare the subsequent administrative act null on its own initiative. In short, a joint assessment of the evidence establishes that there was an administrative decision favorable to the claimant company in 2015; that this decision was subsequently the subject of remedies and partial modification; that the involvement of the Ministerio de la Presidencia and CAID consisted of coordination and vulnerability assessment, without proof that those bodies formally ordered the suspension; and that, finally, the Ministerio de Seguridad Pública itself issued an express act in 2019 maintaining the suspension of execution of the eviction.
In light of these proven circumstances, the claimant could not expect the Court to disregard the subsequent administrative decision without having challenged it. Any disagreement with the legality of that act should have been asserted through the corresponding claim, thereby safeguarding adversarial proceedings and the defendant’s right of defense. Consequently, the claim seeking an order in these proceedings for immediate execution of the administrative eviction must be denied, both because satisfaction of that claim corresponds, in principle, to the special procedure for executing final and favorable acts established in Article 176 of the Administrative Litigation Procedure Code and because it is not legally possible to order such execution while disregarding a subsequent administrative act that maintains the suspension of the measure and whose nullity was neither sought nor made the subject of these proceedings. In conclusion, the claim must be denied and the no-right-to-relief defense raised by the defendant must instead be granted.
This claim is unfounded for two fundamental reasons. First, the existence of administrative actions that violated the legal order to the detriment of the claimant legal subjects was not established, and granting this claim would necessarily have depended on such a finding. Second, from a technical perspective, the request under review is unfounded because ordering the establishment of an administrative proceeding director-body (órgano director de procedimiento administrativo) would require a prior identification of the alleged responsible persons and the specific objectionable actions so that proper notice of the charges could be provided. That did not occur. Accordingly, the potentially appropriate measure—and the one customarily ordered—would have been the commencement of a preliminary investigation to determine possible liability for specific events. Consequently, the claim must be denied and the no-right-to-relief defense raised by the State’s representative must instead be granted.
For the reasons stated in Reason VII of this judgment, the statute-of-limitations defense is granted as to the claims for compensation asserted by the claimant. The defenses of lack of active and passive standing on the merits (legitimación ad causam activa y pasiva) are denied because, in light of the theory of the case, the holders of the rights and obligations under the pleadings would be those appearing as claimants and defendant in this matter. For the reasons stated in each of the specific sections (Reasons IX and X of this judgment), the no-right-to-relief defense raised by the State regarding the requested execution of the administrative eviction and commencement of disciplinary proceedings is granted. Consequently, the complaint is denied in its entirety.
Pursuant to Article 193 of the Administrative Litigation Procedure Code, attorneys’ fees and procedural costs are imposed on the unsuccessful party by reason of that party’s lack of success, and exemption is warranted only when, in the Court’s opinion, there was sufficient reason to litigate or when the judgment is issued on the basis of evidence whose existence was unknown to the opposing party. In the case under review, this panel finds no reason to apply the exceptions established by the governing law and depart from the principle that costs are imposed on the unsuccessful party. Accordingly, both categories of costs are imposed on the claimant in favor of the State, together with the respective statutory interest (Civil Code, Article 1163) accruing from the date the resolution fixing those amounts becomes final until payment in full. These amounts shall be calculated during the judgment-enforcement phase once this judgment becomes final.
THEREFORE
I.The documentary evidence offered by the claimant to assist the Court in reaching its decision is excluded.
II.The defenses of lack of active and passive standing on the merits are denied, and the statute-of-limitations and no-right-to-relief defenses raised by the State’s representative are granted under the terms stated in the corresponding Reasons. Consequently, the claims for compensation asserted by the claimant are declared time-barred, and the remaining claims asserted against the Administration concerning execution of the administrative eviction and commencement of disciplinary proceedings are denied for the factual and legal reasons developed in this judgment. The complaint filed by CARLOS ALFREDO UMAÑA BALSER, identity card number 1-0555-0247, in his personal capacity and as representative of FORESTALES ALEGRÍA S.A., legal-entity identification number 3-101-077633, with the powers of a generalísimo attorney-in-fact without limitation as to amount, against the STATE is DENIED in its entirety.
III.The claimant legal subjects are ordered to pay the costs incurred by the STATE in these proceedings, together with the respective statutory interest (Article 1163 of the Civil Code) accruing from the date the resolution fixing their amount becomes final until payment in full. Those amounts shall be calculated during the judgment-enforcement phase once this judgment becomes final.-
