SummaryResumen
The Administrative-Litigation and Civil Treasury Court of Appeals rejected outright the appeal against an order denying a medida cautelar provisionalísima, an exceptionally urgent interim measure decided without first hearing the opposing party, requested by Nereyda Avilés Taylor against the State. She sought to prevent MINAE and SINAC from disturbing or dispossessing her, preserve the possessory status quo, and suspend a criminal proceeding while the proceedings on the merits remained pending. The first-instance court found that the defendants had to be heard before deciding the underlying interim-measure request because the alleged events dated from 1980 and, at the latest, 2023, and therefore did not demonstrate extreme urgency. The appellate court held that Articles 28 and 30 of the Código Procesal Contencioso Administrativo authorize appeals only from an order deciding an interim measure on its merits or setting a bond or counterbond, not from a ruling granting or denying a provisionalísima measure. It also rejected the renewed provisionalísima request for lack of instrumentality.
Key excerptExtracto clave
III.- Upon reviewing the matter, the attempted challenge is found to be plainly improper. As this Court has repeatedly held, in matters involving interim measures, the Código Procesal Contencioso Administrativo permits an appeal only from an order deciding them on the merits and from an order setting a bond or counterbond in connection with them (Articles 28 and 30 of that Code), but not from an order granting or denying a provisionalísima measure, which is the order challenged here. Because the legislature did not provide for an appeal from a ruling deciding a medida cautelar provisionalísima, this Court is legally required to reject the appeal outright under Article 132(2), final paragraph, of the same Code. For lack of instrumentality, the provisionalísima measure sought by the claimant together with the filing of the appeal is rejected. The appeal filed against the provisionalísima measure is rejected outright. The provisionalísima measure sought by the claimant together with the appeal is also rejected for lack of instrumentality.III.- Revisado el asunto, se advierte, la impugnación intentada, es abiertamente improcedente.

Case No. 26-003382-1027-CA. Urgent Ex Parte Interim Measure (Medida Cautelar Provisionalísima). Plaintiff Nereyda Avilés Taylor v. State No. 333-2026-I ADMINISTRATIVE-LITIGATION AND CIVIL TREASURY COURT OF APPEALS. FIRST SECTION. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. ANNEX A. Goicoechea, at 2:30 p.m. on 21 September 2026. - Appeal against the decision issued at 7:19 a.m. on 24 June 2026, filed within the interim-measure proceedings brought in case No. 26-003382-1027-CA, pending before the Tribunal de lo Contencioso Administrativo y Civil de Hacienda, by Plaintiff Nereyda Avilés Taylor against the State.
Opinion drafted by Judge Laura García Carballo.
REASONS:
I.The plaintiff requested an interim measure based on the following relief sought:
“In light of the foregoing, I respectfully request that the Court:
3. Maintain the status quo regarding possession until a final judgment is entered.
II.Regarding the urgent ex parte interim measure, the judge ruled:
“In this case, it is considered that THE URGENT EX PARTE INTERIM MEASURE, AS REQUESTED, MUST BE DENIED. Having reviewed that application, as well as the evidence submitted, the undersigned judge considers it necessary to hear the opposing party before adopting a decision. It must not be overlooked that urgent ex parte interim measures, without a hearing for the opposing party, are appropriate when failure to adopt them would make it impossible to ensure the effectiveness of the interim measure that may ultimately be ordered; that is not the situation presented by this application. Furthermore, it cannot be disregarded that, in the facts alleged in its application for interim relief, the plaintiff does not refer to any event that has just occurred or is about to occur; on the contrary, the alleged events date back to 1980, with the most recent dating from 2023. Accordingly, there is no extreme urgency in this case requiring protection through an urgent ex parte interim measure.
The proper course is therefore to deny it and grant the defendants a hearing before deciding the application for interim relief on the merits. III.- HEARING FOR THE DEFENDANTS TO RESPOND TO THE APPLICATION FOR AN INTERIM MEASURE. The STATE and the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN are granted a period of THREE DAYS to respond in writing to the plaintiff’s application for an interim measure (Article 24.1 of the Código Procesal Contencioso Administrativo) …” (images 4–6 of the appellate record)
III.Upon review of the matter, it is apparent that the attempted challenge is manifestly inadmissible. As this Court has repeatedly held, in matters involving interim measures, the Código Procesal Contencioso Administrativo permits an appeal only from an order deciding such measures on the merits and from an order setting security or counter-security in connection with them (Articles 28 and 30 of that Code), but not from an order granting or denying an urgent ex parte interim measure, which is the ruling challenged here. Because the legislature did not provide for an appeal from a decision resolving an urgent ex parte interim measure, this Court is legally required to summarily reject the appeal pursuant to Article 132, subsection 2), final paragraph, of the same Code. The urgent ex parte interim measure sought by the plaintiff together with the filing of the appeal is denied for lack of instrumentality.
THEREFORE:
The appeal filed against the urgent ex parte interim measure is summarily rejected. The urgent ex parte interim measure sought by the plaintiff together with the appeal is also denied for lack of instrumentality. Judge. Laura García Carballo.

Exp:26-003382-1027-CA. Medida Cautelar Provisionalísima. Actora Nereyda Avilés Taylor contra Estado Nº333-2026-I TRIBUNAL DE APELACIONES DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA.
Jueza. Laura García Carballo.
