Res. 00874-2026 Tribunal Agrario · Tribunal Agrario · 28/08/2026
OutcomeResultado
The Tribunal affirmed the challenged portions of the order requiring the corporate owner to perform and pay for the complete removal of the dangerous tree while complying with the prescribed technical, safety, and environmental measures.
SummaryResumen
The Agrarian Tribunal affirmed the judgment granting the summary proceeding for removal and ordering Inversiones M&O S.A. to cut down, within the prescribed period, a gallinazo tree located on its property that, according to SINAC technical evidence, posed an imminent risk to a school, its students, and people passing nearby. It rejected the argument that there had been an “allanamiento bajo condición” (conditional acceptance of the claim), because Article 111 of the Agrarian Procedural Code requires an unconditional acceptance and does not permit a party unilaterally to determine who must perform or pay for the removal. Under Article 276, the owner of the dangerous tree must undertake and pay for the safety measures regardless of having accepted the claim; the possibility that the claimant may advance the costs “in default thereof” is reserved for proceedings against unknown persons. The remains belong to the owner, who may use, decline to use, or donate them. The Tribunal also observed that the precedents cited by the appellant concerned unrelated matters and suggested possible negligent or imprecise use of artificial-intelligence tools.
Key excerptExtracto clave
VI.- The appellant is incorrect because the concept of an “allanamiento bajo condición” (conditional acceptance of the claim) does not exist in the Agrarian Procedural Code. Under Article 111, an allanamiento—whether total or partial—entails unconditional acceptance of the claims and does not permit unilateral demands to be imposed on the opposing party. Because technical evidence established that the gallinazo tree threatened the safety of the neighboring property and because it was proven to stand on the defendant entity’s property, registration 1-132221-000—matters that were not challenged—Article 276 of that Code fully applies and assigns the costs of the safety measures to the owner of the dangerous tree. The exception allowing the claimant to advance those costs “in default thereof” is reserved for proceedings against unknown persons, which is not the situation here; consequently, the defendant cannot evade its legal obligation or unilaterally condition its acceptance without an express agreement or prior conciliation with the claimant.VI.- No lleva razón la parte apelante, por cuanto la figura de un “allanamiento bajo condición” no existe en el Código Procesal Agrario.

JOSE CESPEDES MATA DEFENDANT:
INVERSIONES M&O SOCIEDAD ANÓNIMA DECISION N° N° 2026000874 AGRARIAN COURT. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At 9:50 a.m. on 28 August 2026.- SUMMARY TREE-FELLING PROCEEDING brought by JOSÉ PABLO CÉSPEDES MATA, of legal age, educator, resident of Pérez Zeledón, identity card number one - one thousand two hundred twenty-four - six hundred ninety-two; against INVERSIONES M&O SOCIEDAD ANÓNIMA, legal-entity identification number three - one hundred one - forty-one thousand four hundred twenty-one, represented by Olman Vargas Cubero, of legal age, identity card number five - one hundred forty-one - three hundred ninety-three. The PROCURADURÍA GENERAL DE LA REPÚBLICA participates in the proceeding, represented by Deputy Procuradora Rosa Natalia Aguilar Porras, of legal age, single, attorney, resident of Heredia, identity card number one - one thousand one hundred eighteen - seven hundred fifty-nine. Attorney Miguel Ángel Fernández Ureña acts as agrarian public defender for the plaintiff; and attorney Adrián Ceciliano Altamirano, bar membership number five thousand six hundred forty-four, acts as counsel for the defendant. The matter was heard before the Agrarian Court of the First Judicial Circuit of the Southern Zone.
Judge Fisher González drafts the decision; and, REASONS:
I.The plaintiff filed a summary tree-felling proceeding, seeking a judgment declaring: “First: I am a resident of Las Mesas de Pejibaye and president of the local school’s Board of Education. One hundred twenty-five children attend this school and enter it every day with the persons accompanying them. Second: Next to the Las Mesas School, specifically beside its busiest entrance and on property 1-132221-000 belonging to Inversiones M&O, there is a large gallinazo tree. This situation poses a risk, considering its proximity to the school and the large number of children who attend it. (sic) 2- RELIEF SOUGHT: Based on the foregoing, the facts stated, the legal grounds, and the evidence submitted, the following relief is sought: ‘I request that the judgment declare as follows: a- That the defendant be ordered to fell the aforementioned tree’” (see case file downloaded in PDF format, images 1 to 2).
II.The Procuraduría General de la República was admitted as an interested party and entered an appearance in the proceeding (see case file downloaded in PDF format, images 25 to 28).
III.The defendant, INVERSIONES M&O SOCIEDAD ANÓNIMA, answered the complaint by expressing “conditional acquiescence,” insofar as it agreed that the tree could be cut down, but the plaintiff would have to perform that act and bear its entire cost (see case file downloaded in PDF format, images 31 to 34).
IV.Judge Jorge Bolaños González of the Agrarian Court of Pérez Zeledón, by judgment number 2026000044 issued at 4:37 p.m. on 18 February 2026, ruled: “THEREFORE: The defendant is deemed to have ACQUIESCED and, accordingly, this SUMMARY TREE-FELLING ACTION brought by JOSÉ PABLO CESPEDES MATA against the commercial company INVERSIONES M&O SOCIEDAD ANÓNIMA is GRANTED. To prevent an imminent risk, the complete felling of the tree identified and tagged as #1 GALLINAZO is authorized; pruning is not feasible, and Complete Felling is therefore recommended, which is advisable and foreseeable as a means of preventing further misfortunes and danger to human life. From a technical standpoint, the complete felling of the tree described is recommended. The foregoing is based on its total height in relation to its distance from the school and the road described, which creates an imminent risk.” The decision to fell the tree rests with the judicial authority after assessing the risk and SINAC’s recommendation that the tree be felled completely.
That condition represents a serious risk to persons traveling through the area, particularly considering that the tree is located very close to the described property, where people are constantly entering the premises and must also be protected. The complete felling of the tree described, identified during the judicial inspection as number #1 in red paint, is therefore authorized. Because the tree is located on property belonging to the defendant commercial company, INVERSIONES M&O SOCIEDAD ANÓNIMA is ordered, through its legal representative, to completely fell the tree described within the next EIGHT DAYS after notice of this ruling. The foregoing is pursuant to Article 278 of the Código Procesal Agrario. The costs incurred in carrying out the felling shall be borne by the owner of the hazardous property. Should the defendant fail to comply with this ruling, criminal proceedings may be brought against it for the offense of disobedience of authority; failing that, the plaintiff shall advance the expenses and shall be entitled to the corresponding reimbursement if the defendant is ordered to pay costs in the final judgment.
The defendant is advised that it must take all precautions necessary to prevent the felling from causing damage to the plaintiff or third parties and must hire a person qualified to perform the complete felling of the aforementioned tree. - As stated in Articles 33, 34, and 28 of the Ley Forestal, Articles 148 and 145 of the Ley de Aguas, and by the state agency itself. For the recommended felling, the recommendations generally issued by officials of the Sistema Nacional de Áreas de Conservación, known by its acronym SINAC, must be considered as follows: 1. When the trees are felled, the responsible party must monitor their fall and take all safety measures into consideration so as not to endanger the lives of persons, students, and passersby, or infrastructure, power lines, and vehicles that use access points on the property each day; 2. The defendant must take every precaution to prevent an accident or any impact on the surrounding area or other neighboring properties. 3.
When the tree at issue is felled, the forest product must be relocated to places outside the public roadway to prevent any type of accident. 4. The defendant must adhere to established specifications, procedures, and protocols and comply with current environmental legislation. 5. The work of felling and pruning the trees must be performed by personnel duly trained and qualified for that purpose, who have the safety and climbing equipment required for this type of work, as well as the necessary occupational-risk insurance. The chainsaw operator must possess expertise because the School is near the site where the tree is located. The foregoing is required because of the height of the tree to be felled; the interested party is advised that the authorization empowers it only to perform the indicated felling at its own expense and that it assumes responsibility for ensuring that, when the tree is felled, no property belonging to third parties or surrounding vegetation is affected, except to the extent strictly necessary.
It must notify the neighbors so that they may take the relevant safety measures. Regarding the use of the proceeds from the felling ordered herein, the defendant is authorized to use the resulting timber. Accordingly, if the forest product is usable, the felling expenses shall be borne by the defendant applicant itself, which shall assume responsibility for ensuring that, when the tree is cut, no property belonging to third parties or surrounding vegetation is affected, except to the extent strictly necessary. It is also ordered that, if any part of the tree falls onto a public roadway, the defendant must clear it to prevent obstructions that impede the free passage of persons and vehicles. Because the trees are located on the defendant’s property, the appropriate course is to order that the owner of the property on which the trees stand may use their products, pursuant to Articles 505 and 506 of the Código Civil.
Accordingly, if the forest product is usable, the defendant shall dispose of the resulting timber; however, to transport the timber, if it wishes to do so and the timber is usable, it must obtain the corresponding permit (tags and transport documents) from the Ministerio de Ambiente y Energía, pursuant to Article 56 of the Ley Forestal. The costs of milling and transportation, as well as any required procedures and permits, must be borne by the defendant. The parties are required to notify this authority immediately when the felling takes place, stating the condition of the timber. SINAC is authorized to verify that everything ordered in this ruling, particularly the clearing work, is properly performed. Otherwise, the appropriate actions may be brought to secure effective compliance with the order. Once this ruling becomes final, the corresponding writ shall be transmitted electronically to SINAC for the matters within its purview and shall be made available to the plaintiff for service and execution.
A complete copy of the documents comprising this judgment shall be attached. Given the manner in which the proceeding concludes and the defendant’s evident good faith, no special award of costs is made. (Article 73.2 of the Código Procesal Civil)” (see case file downloaded in PDF format, images 90 to 101).
Attorney Adrián Ceciliano Altamirano, counsel for the defendant, filed an appeal based on the following grounds: 1) The defendant company answered the complaint through acquiescence subject to specific conditions, which define the limits of this party’s willingness to conclude the proceeding early. The judgment under appeal errs by disregarding the third condition (the plaintiff’s assumption of expenses) and the fourth condition (disposition of the timber resource in favor of the Board of Education). Because there was no opposition, the court cannot impose obligations additional to or different from those conditionally accepted, particularly when the SINAC technical report (Proven Fact 3) confirmed that pruning is not feasible because of the specimen’s height and recommended complete felling. Requiring the defendant entity to prune the tree or undertake forestry procedures that it expressly rejected constitutes an improper procedural and material burden. The Agrarian Court has accordingly held: “Conditional acquiescence requires the court to rule within the bounds of what was accepted. If the conditions are lawful, the judgment must incorporate them so as not to violate the principle of congruence and due process” (Tribunal Agrario, Voto N° 0045-F-S1-2019).
VI.The appellant is incorrect because the concept of “conditional acquiescence” does not exist in the Código Procesal Agrario. Under Article 111 thereof, acquiescence—whether total or partial—entails unconditional acceptance of the relief sought and does not permit unilateral demands to be imposed on the opposing party. Given the technical evidence that the gallinazo tree threatened the safety of the neighboring property and the proof that it stands on the defendant entity’s land, registered as 1-132221-000—matters that were not challenged on appeal—Article 276 of that body of law is fully applicable and places the expenses for the safety measures on the owner of the hazardous tree. The owner of the tree whose felling is recommended by the technical study is responsible for cutting it down because the owner is responsible for property that may cause damage and poses a danger. This responsibility is imposed solely by virtue of ownership of the hazardous property, regardless of whether the owner acquiesced to the complaint. The exception provided by the statute, under which the plaintiff advances those costs “failing that,” is reserved for proceedings against unknown persons, which is not the situation here. The defendant therefore cannot evade its legal obligation or unilaterally condition its acquiescence without an express agreement or prior conciliation with the plaintiff.
VII.Furthermore, it is striking that the judicial decisions attributed to this Court in support of the appellant’s position have absolutely no connection with tree felling or acquiescence. This inconsistency suggests that the plaintiff or appellant may have negligently or imprecisely used artificial-intelligence tools to generate citations that are nonexistent or irrelevant to the case. Finally, the remains of the tree belong to the owner of the property on which the specimen stands. The second paragraph of Article 277 provides that the person legally entitled to do so may use the product, but it is for that party to decide whether to use it, refrain from doing so, or donate it, according to its interests.
VIII.In view of the foregoing, the judgment is affirmed as to the matters appealed.
THEREFORE
The judgment is affirmed as to the matters appealed.
