The Agrarian Tribunal affirmed approval of the possessory-information proceeding because continuous possession dating from before 1974 was established, no land-use change was proven, and the remaining objections were insufficient to deny titling.

SummaryResumen

The Agrarian Tribunal affirmed the judgment approving María Adelia Fuentes Romero’s possessory-information proceeding for a 1,976 m² property located entirely within the Zona Protectora Río Navarro-Río Sombrero. Under Article 7 of the Ley de Informaciones Posesorias, she had to establish ten years of possession exercised at least ten years before the protected wildlife area was created in 1984, meaning possession dating back to 1974. The Tribunal found that three witnesses demonstrated continuous, public, and notorious possession for more than fifty years. It rejected objections concerning suggestive questions, testimonial imprecision, identity discrepancies, and the competency of a former possessor as a witness. It also held that the difference between the deed’s 2,548 m² and the 1,976 m² claimed for registration was insufficient to deny titling because no additional land was being claimed. The Tribunal concluded that the property had historically been pasture and cut grassland, with no proof of a land-use change, and left possible construction-permit violations to the competent administrative authority.

Key excerptExtracto clave

In this regard, Article 7 of the Ley de Informaciones Posesorias provides for the possibility of obtaining title to property located within a protected wildlife area, regardless of its management category, if the claimant proves that they hold the legal rights to ten years of possession exercised at least ten years before the law or decree creating that protected wildlife area took effect. The provision requires proof that possession was exercised during that period; therefore, because the Zona Protectora Río Navarro-Río Sombrero became part of the public domain in 1984, possession dating back at least to 1974 had to be established. Consequently, because the witnesses testified in 2024, they had to attest to fifty years of possession. Moreover, all three witnesses stated that the property had always been pastureland and had been used for cut grass since long before the protected zone was declared. There was therefore no evidence that its land use had been changed; rather, that was already the property’s condition when it became subject to the protected-zone designation. Consequently, the judgment must be affirmed.

The Registro Inmobiliario shall proceed to register for the first time, in the name of MARÍA ADELIA FUENTES ROMERO, of legal age, married once, homemaker, identity card three-zero three hundred ninety-five zero one hundred eleven, resident of La Estrella, El Guarco de Cartago, the unregistered property described as follows: Land with an area of grass, fruit trees, and ornamental plants, with two structures, one used for storage and the other for recreation, located in the Province of Cartago, district two San Isidro, canton eight El Guarco, bounded on the NORTH by Adrián Gerardo Ramírez Alfaro; on the SOUTH by Juan Rafael Fuentes Romero; on the EAST by a public road, with 38.74 linear meters of frontage; and on the WEST by Instituto de Desarrollo Rural.

The foregoing shall be observed by both the applicant for title and third parties (principle of notice through the public registry” (see the electronic case file, first-instance judgment in the associated-documents tray, dated 05/08/2025 15:25:42).

II.The Court endorses the statement of proven facts contained in the challenged judgment because it is the result of the evidence in the record. However, item 7) is reformulated as follows: The initiating party acquired the property for which title is sought by purchasing it from the company 3-101-770460 S.A., represented by Mr. Wilfredo Emilio Fuentes Romero, on 01 August 2022, through public instrument number 185-13, executed in the city of Cartago before Notary Laura Daniela Fernández Mora and appearing on the front of folio 81 of volume 13 of that Notary’s protocol, whereby that company stated that it transferred to her both its own possession and that of the prior possessors: EFE BE Fuentes Brenes S.A., Alberto Rafael González Cordero, Colmenares Chapultepec S.A., and José Luis Fallas Navarro (see instrument in images 131-132). The following is also added at this stage: 8) Actual and effective possession has been exercised over the property for which title is sought for more than 60 years, consisting primarily of maintaining pastureland and cut-and-carry grass, such that the initiating party currently uses it for natural pasture, recreation, some crops, and fruit trees.

It was first possessed as owner by the grandfather, Salvador Fallas Barboza; then by his son Antonio Fallas Romero, who died and left it to his wife; then by their son José Luis Fallas Navarro; subsequently by Colmenares Chapultepec S.A., Alberto Rafael González Cordero, EFE BE Fuentes Brenes S.A., the company 3-101-770460 S.A.; and currently by the initiating party (testimony of Elí Ezequiel Rivera Rivera, Aurelio Edgar Fallas Navarro, and José Luis Fallas Navarro, and judicial inspection recorded in a multimedia audio file; public instrument in images 131 and 132).

III.The Court agrees with the judgment’s statement that it is unnecessary to mention any unproven facts relevant to the decision.

IV.

The Procuraduría General de la República filed an appeal expressly stating the grounds on which it challenges the position adopted by the first-instance court. The grounds of appeal are as follows:

  • 1)The notarial instrument submitted in the proceeding states that the property has an area of 2548 m², whereas the property for which registration of title is sought has an area of 1976 m², revealing a significant difference of 572 m² that was not clarified during the proceeding. Furthermore, that instrument proves only the transfer of ownership from the company 3-101-770460 S.A. to the initiating party on the stated date, but it does not constitute suitable or sufficient evidence of continuous and public possession during the ten years preceding the designation of the protected wilderness area, as required by law. It should be recalled that private instruments contain only the parties’ statements, which the notary merely records and which are not made under oath (Articles 1, 6, and 36 of the Código Notarial), thereby limiting their evidentiary value.
  • 2)Regarding testimonial evidence, Article 41.4 of the Código Procesal Civil provides that questions asked during witness testimony must not be leading or misleading or suggest the substance of the answer, so as to prevent a witness from being induced to testify in a particular manner. In the testimony of Aurelio Fallas Navarro, the judge can be seen to ask questions containing affirmative and leading language, contrary to the procedural rules requiring questions to be clear, precise, and neutral. For example, in the statement, “In other words, yes, we are talking about more than 60 years,” the judge does not ask a question but instead establishes a conclusion, conditioning the witness’s answer and limiting his freedom to express himself in his own words. This type of question improperly influences the testimony. Regarding the length of time during which declarant Fallas Navarro’s grandfather allegedly held the land, the witness stated: “When my grandfather divided that up, I was very little, and by the time I became aware of it, it belonged to my father.” Besides lacking temporal precision, this answer reflects indirect, nonpersonal, and belated knowledge of ownership, which limits its evidentiary value for establishing possession. The expression “I was very little” shows that the witness has neither a direct recollection nor exact knowledge of the events occurring at that crucial time.
  • 3)Furthermore, it should be noted that witness Fallas Navarro states that his father’s name was Otoniel Fallas Romero; however, he appears in the Registro Civil as Antonio Fallas Romero, and no record is found under the name Otoniel.
  • 4)José Luis Fallas Navarro was called as a witness and stated in his testimony that he had been the owner of the land for which title is sought (see also fact 4). This circumstance renders him unsuitable as a witness because his testimony concerns his own acts and not those of third parties, contrary to Article 43 of the Código Procesal Civil, which requires a witness to testify only about the acts of others. (Tribunal Agrario. Voto N° 0926-f-07 14:10 on 15 November 2007. Article 7 of the Ley de Informaciones Posesorias provides that, within a protected wilderness area, regardless of its management category, the applicant for title must establish that he or she holds the legal rights arising from ten-year possession exercised at least ten years before the effective date of the law or decree creating that wilderness area. Consistently with that provision, Article 6 of the same statute requires possession to be substantiated through the testimony of three witnesses, a requirement that was not met in this proceeding. Furthermore, the questioning of witness Aurelio Fallas Navarro lacks depth regarding specific dates or years and concrete acts that could clearly establish the period and nature of the possession attributed to the grandfather and the other titleholders. Answers such as “a whole lot of years,” “all that time,” “several whole lots of years,” “I can’t remember those people’s name,” and “Let’s say I had it, let’s say—I don’t remember very well—but let’s say maybe five or six years” are imprecise and do not allow the continuity of possession to be determined or proven, even though that continuity is an essential element in a possessory-title proceeding, particularly when the land is located in a protected wilderness area. The questioning is deficient in the precision and clarity of the information concerning possession of the land. This is especially serious where a protected wilderness area is involved, in which proof of possession must be rigorous and duly substantiated as required by Article 7 of Ley No. 139. It bears noting that the special judicial attorney-in-fact was given an opportunity to ask questions during the examination but did not do so. It is the legal professional’s responsibility to ask appropriate questions because the initiating party is obligated to submit adequate evidence under Article 41.1 of the Código Procesal Civil.
  • 5)Moreover, the judicial inspection found that the land is at a higher elevation than the road, a circumstance attributed to soil alteration, as indicated by the land-use certificate, which states: “The methodology for determining official land-use capability is inapplicable because leveling and removal of surface soil layers prevent the use of the soil auger.” The foregoing contravenes the requirement to exercise acts of possession aimed at protecting natural resources, as must be done within protected wilderness areas (Voto N° 931-F-15 at 16: 47 on 16 September 2015). The initiating party maintains that the nature of the land is for construction and declares that no construction exists (see fact two). The judicial inspection, however, found a building that lacks the corresponding municipal permit and is the subject of a complaint, as stated in official communication N° 20-GAJ-2024 from the Municipalidad del Guarco. Note the lack of truthfulness in the sworn statement made in her initial submission: “There is no construction whatsoever on the property that I possess….” To be valid, possession must be exercised lawfully and not in violation of the legal system.
  • 6)The three witnesses testified that no forest exists on the property for which title is sought and that the land has been used for cut-and-carry grass and livestock grazing, activities that are incompatible with the rules applicable to protected wilderness areas. Nor is the applicant’s description of the property as intended for construction compatible with those rules, demonstrating an intention contrary to the property’s designated and true nature. Mr. Eli Ezequiel Rivera Rivera stated in his testimony that the property borders forest at the rear, from which it may be inferred that the land for which title is sought may, with a high degree of probability, have been stripped of the forest protection applicable to it as a result of the initiating party’s “acts of possession.”
  • 7)To register in her name the real property located within the Zona Protectora Río Navarro–Río Sombrero, created by Decreto Ejecutivo N° 15436-MAG of 5 June 1984, the applicant for title was required to prove that she had exercised possession for at least ten years before that Decree took effect and had protected the natural resource. Such possession must be proven through the testimony of three witnesses, a requirement not met in this proceeding. In view of the foregoing, and considering that the Zona Protectora in which 100% of the property is located is an important watershed for the Sombrero and Navarro rivers, ensuring an influx of water to meet the needs of present and future populations, principally in the province of Cartago (Decreto Ejecutivo N° 15436 of 30 March 1984), I request that this appeal be granted because it is duly grounded in law and that, consequently, the possessory-title application submitted by Ms. María Adelia Fuentes Romero be denied (appeal submission in images 152 through 160).

V.It has been established in the record that the land to be registered under cadastral plan number 3-7188-2023, located in La Estrella, district two San Isidro, canton eight El Guarco, province of Cartago, lies within the ZONA PROTECTORA RÍO NAVARRO-RIO SOMBRERO, created by Decreto Ejecutivo # 15436-MAG of 5 June 1984 (SINAC certification in image 119 and plan in image 12). In this regard, Article 7 of the Ley de Informaciones Posesorias provides for the possibility of obtaining title to real property located within a protected wilderness area, regardless of its management category, upon proof that the applicant holds the legal rights arising from ten-year possession exercised at least ten years before the effective date of the law or decree creating that wilderness area. What this provision requires is proof that such possession was exercised during that period. Therefore, because the Zona Protectora Río Navarro-Río Sombrero was incorporated into the public domain in 1984, possession exercised since at least 1974 had to be established.

Consequently, because the witnesses testified in 2024, they were required to attest to 50 years of possession. According to the judicial inspection conducted, the property consists of land with a truck cargo box used as a storage structure and another structure made of “plank-type” wood and industrial zinc sheets for recreational use, grassy areas, and some blackberry, plantain, banana, guayabita, mesino lemon, mandarin, and orange plants and trees, as well as a tree of unknown species that is very tall and has vigorous foliage, with water and electricity services (audio recording of the judicial inspection incorporated into the oral-hearings file of the electronic case file). The Court has examined the testimonial evidence under Article 54 of the Ley de Jurisdicción Agraria, which establishes the principle of free assessment of evidence. It is therefore appropriate to address grounds of appeal 2), 3), 4), 6), and 7) first and jointly, because they concern objections to the assessment of that evidence.

Accordingly, the State’s representative is incorrect in alleging that the judge who conducted the hearing asked witness Aurelio Fallas Navarro leading questions, specifically regarding the total period during which he had known the property. After listening to the audio, it can be inferred that the witness explained on his own initiative that he had known the land since he was “very little” and that he was 70 years old. The Judge’s question, “In other words, yes, we are talking about more than 60 years?” was therefore a direct consequence of what the witness had stated and was intended to confirm that period. Nor is the appellant correct in asserting that this testimony shows alleged temporal imprecision or indirect or belated knowledge. Although witness Aurelio stated that he “was very little” when the land belonged to his grandfather and then to his father, that expression does not denote vagueness.

On the contrary, it is a natural and spontaneous way, consistent with the witness’s plain manner of expression, of illustrating how long he had known about the property. His account conveys the personal context in which he retained that fact in his memory. Similarly, expressions such as “a whole lot of years,” “all that time,” or “several whole lots of years” do not reflect ignorance but are colloquial ways of conveying very longstanding knowledge. In any event, he stated that he was 71 years old; therefore, under the rules of logic and experience, he is plainly a witness with direct knowledge of continuous and notorious possession for more than 50 years. The challenge to the witness’s credibility based on his identification of his father as “Otoniel Fallas Romero,” even though the Registro Civil lists him as “Antonio Fallas Romero,” must likewise be rejected. That discrepancy is not conclusive evidence of falsity because it is unknown whether the father was known socially or within the family by that name.

It would be disproportionate and illogical to diminish the evidentiary value of testimony on the assumption that the witness does not know his own father’s identity. Along the same lines, the objection to the suitability of witness José Luis Fallas Navarro must be rejected. The appellant challenges him because he had been a possessor of the property, arguing that his testimony concerns his own acts and not those of third parties (Article 43 of the Código Procesal Civil). Admittedly, testimonial evidence in this type of proceeding is intended to have third parties attest to another person’s possession (Article 6 of the Ley de Informaciones Posesorias), which would generally exclude persons who transferred the right. Nevertheless, because this case falls within Article 7 of that statute, the decisive element to be proven is the qualified ten-year possession established before the protected wilderness area was designated.

In that context, the witness—who was 77 years old—testified that he had known the property since childhood, explaining that it had belonged to his grandfather, then to his father, and subsequently to his mother, who allocated a portion to him for cattle approximately 30 years ago. His account indicates that the witness began exercising acts of possession around 1995, by which time the prior ten-year possession had already been established well before the Zona Protectora Río Navarro-Río Sombrero was created. Consequently, his testimony is suitable to attest to the possession exercised during the historically relevant period; matters concerning subsequent or current possession are outside the scope of this objection.

VI.Furthermore, the first ground of appeal, concerning the discrepancy in area, cannot be upheld. Although the notarial instrument states an area of 2,548 m² and the title sought covers only 1,976 m²—a difference of 572 m²—this ground is insufficient to deny title. It is unreasonable to object that the applicant for title seeks to register an area smaller than the area acquired or that the actual physical area is smaller. What matters is that she is not attempting to obtain title to more land than she is entitled to, especially when the location and nature of the property coincide. The State’s argument that the instrument proves only the transfer of ownership from the company 3-101-770460 S.A. to the initiating party on the stated date, and not ten-year possession before the designation of the protected zone, must meet the same fate because the ten-year possession has been established through the testimony of three witnesses.

Lastly, the objection concerning soil alteration and the alleged failure to conserve natural resources within the protected zone is rejected. The appellant maintains that the difference in elevation between the land and the road—observed during the judicial inspection—is attributable to leveling work and removal of surface layers, as purportedly stated in the land-use certificate. In this regard, the judicial inspection established that the property is located two kilometers from the community of La Estrella, is elevated above the public road, is fenced (except along certain sections of embankment), has water and electricity services, and contains a variety of crops (blackberry, mesino lemon, mandarin, orange, plantain, itabos, banana, tree tomato, and guayabita). These characteristics show that the property is neither forested land nor situated within forest, but instead borders the public road and is located near the community.

Moreover, all three witnesses stated that the property had always been pastureland and had been used for cut-and-carry grass since very long ago, before the protected zone was designated. There is therefore no evidence that the land use was changed; rather, that was already its nature when the property became subject to the designation. Witness Rivera Rivera, who is 78 years old and stated that he had known the property for approximately 55 years, explained in this regard that the land had always been used to cut grass and that cattle were sometimes placed there. Similarly, Aurelio Fallas Navarro explained that, since the time it belonged to grandfather Fallas, it had been maintained with “imperial” variety cut-and-carry grass and that cattle had been kept there when it belonged to his father, many years ago. José Luis Fallas Navarro likewise agreed that, since it belonged to his father, it had been used as pastureland and for cutting grass and that cattle had been kept there at one time, but no longer.

In any event, the soil study concludes that the land has been used in 100% conformity and that the soil is regenerating with natural grass (images 25 through 27). Furthermore, it should be noted that the judicial inspection found a truck cargo box used for storage, as well as a two-story wooden building with an enameled industrial zinc roof, used for recreational purposes. The existence or absence of municipal permits for those structures is an issue for adjudication by the competent administrative authority. Accordingly, that circumstance is neither a decisive nor a sufficient factor for denying title to a property over which continuous possession for more than sixty years has been established.

VII.Consequently, the judgment must be affirmed.

THEREFORE

The judgment is affirmed.
