SummaryResumen
The Agrarian Tribunal granted María Teresa Salas Murillo’s appeal against the portion of the judgment that authorized the felling of a guayabón tree, a roble de sabana tree, and an espavel tree because they posed a danger, but denied the use of the resulting timber. It held that Article 27 of the Forestry Law governs administrative authorization to fell trees on agricultural land without forest cover but did not preclude the requested use of timber in these summary tree-felling proceedings. MINAE had already technically authorized and recommended the felling, and the trial court had ordered it subject to the specified safety measures. According to the Tribunal, use of the timber is a logical consequence of the ordered felling under Articles 506 and 509 of the Civil Code and requires no additional administrative authorization. The interested party must nevertheless obtain the appropriate transport documents if the timber is transported and secure the applicable permit for the tree located within a protection zone.
Key excerptExtracto clave
V.- The applicant’s sole ground of appeal is well founded. The a quo court based its denial of the use of the timber on Article 27 of the Forestry Law, which provides: “Authorization to fell. A maximum of only three trees per hectare per year may be cut on agricultural land without forest cover, after authorization has been obtained from the Regional Environmental Council. If the cutting exceeds ten trees on the property, authorization from the State Forestry Administration shall be required.” As may be observed, the provision concerns authorization to fell. In these interdictal proceedings, the object is the felling itself because of the existing danger; therefore, MINAE, in its technical report, has already authorized and recommended the cutting, and the Court is ordering the felling. Use of the timber is a logical consequence thereof (Articles 506 and 509 of the Civil Code), so no further administrative authorization is required for the cutting and use, except for the tree located within the protection zone. Consequently, the appealed decision must be reversed and use of the timber authorized, without prejudice to the interested party requesting the appropriate transport documents if transportation is required and the permit for the tree located within the protection zone. OPERATIVE ORDER: As to the matter appealed, the appealed judgment is reversed and use of the timber is authorized, without prejudice to the interested party requesting the appropriate transport documents if transportation is required and the permit for the tree located within the protection zone.V.- Lleva razón el recurrente en su único agravio.

SUMMARY PLAINTIFF:

VOTE N° N° 2026000795 AGRARIAN COURT. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At sixteen hours and five minutes on 12 August 2026.- SUMMARY TREE-FELLING PROCEEDING filed by MARÍA TERESA SALAS MURILLO, of legal age, widowed, resident of Nicoya, Caimital, identity card number one - seven hundred ninety-seven - eight hundred five; against UNKNOWN. The PROCURADURÍA GENERAL DE LA REPÚBLICA participates as an interested party, represented by its deputy procurator, attorney Daniela Vargas Delgado, of legal age, married once, attorney, resident of Grecia de Alajuela, identity card number two - six hundred eight - four hundred seventeen, bar registration number nineteen thousand two hundred ninety-six. Attorney Ana Jeimmy Rodríguez Morales, bar registration number twenty-nine thousand six hundred seventy-five, acts as agrarian public defender for the plaintiff. Proceeding heard before the Agrarian Court of the Second Judicial Circuit of Guanacaste, Santa Cruz.
Judge Ulate Chacón delivers the opinion; and, REASONS:
The plaintiff files the complaint, values this proceeding at one hundred thousand colones, and requests the following declarations: 1.- “That this summary Tree-Felling Proceeding be granted. 2.- That the felling of the guayabón and oak trees located on the property in my possession be authorized. 3.- I request authorization for the utilization of any usable timber (aprovechamiento de la madera) resulting from this proceeding, so that I may cover the expenses required to hire a person with the equipment necessary to carry out the ruling, since the timber is also located on my land. 4.- That the petitioner be exempted from any award of costs arising from this proceeding.” (See the electronic case file, submissions tray, dated 03/09/2024:13:26:21).
The Procuraduría General de la República entered an appearance and raised no objection. (See the electronic case file, submissions tray, dated 20/11/2024:12:13:46).
III.Judge Ana Isabel Rojas Alvarado of the Agrarian Court of the Second Judicial Circuit of Guanacaste, Santa Cruz, ruled as follows in judgment N°2025000098, issued at fourteen hours and fifty-four minutes on 23 April 2025: THEREFORE: “Pursuant to the cited facts and law, Articles 54 and 55 of the Ley de Jurisdicción Agraria, 311 of the Código Civil, 108.1 and 108.3 of the Código Procesal Civil, and Article 27 of the Ley Forestal: 1. This summary Tree-Felling Proceeding is GRANTED. 2. Ms. MARÍA TERESA SALAS MURILLO IS AUTHORIZED to fell the following trees located on her property and along its boundary: 01 Guayabón, 01 Roble de Sabana, and 01 Espavel, which are the subject of this summary Tree-Felling Proceeding and have been judicially identified and described in the MINAE Report. The felling of the three trees must also be performed in accordance with the safety recommendations made by the MINAE Engineer and cited in this judgment. 3.
The petitioner is exempted from any award of costs arising from this proceeding, since her good faith and legitimate interest in the complaint filed have been demonstrated. The plaintiff’s request for authorization to utilize any usable timber resulting from this proceeding, so that she may cover the expenses required to hire a person with the equipment necessary to carry out the ruling, since the timber is also located on her land, IS DENIED, because, in accordance with Article 27 of the Ley Forestal, she must submit the corresponding application to the MINAE offices, as MINAE is the authority competent to decide the matter, not this judicial authority. Furthermore, in keeping with the request and recommendation of the Procuraduría General de la República, the plaintiff, Ms. María Teresa, is advised that, after felling these three trees as ordered and pursuant to Article 50 of the Constitución Política and Articles 145 and 148 of the Ley de Aguas, she must replace the three trees with native, low-growing species that provide food and shelter for wildlife and contribute to the anchoring and conservation of the soil and associated ecosystems.
(Votes of the Agrarian Court: numbers 720-F-2021, 1161-F+2021, 158-F-2022, 2023000410.” Notice shall be given. (See the electronic case file, associated-documents tray, first-instance judgment, dated 23/04/2025 14:54:36).
IV.Through her public defender, attorney Ana Jeimmy Rodríguez Morales, the plaintiff filed an appeal, expressly stating the grounds on which she relied to challenge the trial court’s position. (See the electronic case file, submissions tray, dated 24/07/2025:17:33:38). In essence, she argues that Article 27 of the Ley Forestal does not apply in this case because the land is not used for agricultural or livestock purposes. She states that the guayabón tree is located within the protected area, while the remaining trees are on the plaintiff’s property, and that it is necessary to safeguard human life; they need to utilize the timber to perform the work. She cites case law from the Agrarian Court (including Vote 996-2020), which permits such utilization pursuant to Sections 505 and 506 of the Código Civil and Section 56 of the Ley Forestal. She requests that the judgment be partially reversed and that the plaintiff be authorized to utilize the timber located on her property.-
V.The amparo applicant is correct as to her sole ground of appeal. The trial court’s basis for denying utilization is Article 27 of the Ley Forestal, which provides as follows: “Authorization to fell trees. No more than three trees per hectare may be felled annually on land used for agricultural or livestock purposes and containing no forest, after obtaining authorization from the Consejo Regional Ambiental. If more than ten trees are to be felled on the property, authorization from the Administración Forestal del Estado shall be required.” As may be seen, the provision concerns authorization to fell trees. The subject of this interdict proceeding (proceso interdictal) is the felling of the trees due to the existing danger; accordingly, MINAE has already granted authorization and recommended the felling in its technical report, and the Court is ordering the trees to be felled. Utilization is a logical consequence thereof (Articles 506 and 509 of the Código Civil), and therefore no additional administrative authorization is required for the felling and utilization, except with respect to the tree located within the protected area.
Consequently, the appealed decision must be reversed and utilization authorized, without prejudice to the interested party applying for the corresponding transport documents if transportation is required and for the permit concerning the tree located within the protected area.
THEREFORE:
With respect to the matter under appeal, the appealed judgment is reversed, and utilization is authorized, without prejudice to the interested party applying for the corresponding transport documents if transportation is required and for the permit concerning the tree located within the protected area.
